[0:00] [Music] [0:54] he [0:56] [Music] [2:38] I'd like to call the or concy city [2:39] council committee meeting for Monday May [2:41] 20th 2024 and the first committee is [2:44] Public Safety Mr Williams thank you so [2:46] I'd like to call the order Public Safety [2:48] we have one item on the agenda tonight [2:50] that is the lead of Women Voters super [2:52] recommendation [2:54] May thank you Mr chairman the submitted [2:58] uh names the recommendation from uh Leal [3:02] woman voters ask for the favorable [3:04] consideration councel you any questions [3:07] or [3:09] comments move second all in favor I are [3:13] there any other items to call public sa [3:15] the committee any have motion toour so [3:18] move second all in [3:21] favor I would like to call the finance [3:23] committee to order and the first item is [3:25] the annual fee waiver for exterior [3:28] building repair [3:31] [Music] [3:34] from everyone should have received an [3:37] email from the last week with regards to [3:39] the the 2023 [3:42] reports um this [3:45] year I'm looking to continue this [3:48] exterior perit waiver for the period of [3:50] June 1st to August [3:53] 31st and there is [3:57] a there is a dve um [4:00] letter and package to kind of identify [4:02] the same thing from the previous years [4:05] we just continue with the changing the [4:07] dates and and continue to carry this [4:09] program forward last year um we were [4:12] able to give back to our neighborhood [4:14] almost [4:16] $24,000 as incentive for encouraging [4:18] home owners to um pull permits which is [4:21] very important make sure they pull the [4:23] permit get it inspected by the our court [4:26] enforcement offic so make sure they are [4:27] doing the correct thing and applying the [4:29] code evenly across so I'm looking um to [4:33] continue this program and to continue [4:35] our give back to our neighborhood as [4:38] they continue to revitalize the neighood [4:40] across the [4:41] [Music] [4:42] city open for [4:45] questions go ahead please uh so thank [4:48] you definitely sounds like a wonderful [4:50] opportunity to offer our our homeowners [4:52] or individuals wanting to like do this [4:54] type of work in their homes um based on [4:57] the conversation we're able to have and [4:59] definitely I like to see a [5:00] substantiating documentation on the back [5:02] end to speak to some of the added [5:04] benefits to our community uh as we seek [5:07] to have more budgetary conversations [5:09] throughout the year leading up to this [5:11] upcoming budget season I just want to [5:12] make sure at least I am being consistent [5:15] and evaluating all um opportunities [5:17] where we are trying to make a [5:20] concessions with our community just so [5:22] we can speak to those in in further [5:23] detail when the question is ultimately [5:25] asked how do we pass a uh successful [5:27] budget that the mayor will approve [5:32] am questions go ahead please chairman [5:35] the wording [5:38] uh highlight have for the maximum permit [5:41] value of [5:44] $35,000 that for the construction value [5:47] of 35,000 not the value [5:50] of permit fees no no no that's a [5:53] construction value so and this applies [5:57] to residential construction that is [6:00] that's correct yes on one to four unit [6:03] residential property one to four [6:05] units for bullet on the [6:08] bottom go ahead please I just um wanted [6:11] to have you highlight I think that you [6:13] had told us how much it was that we [6:16] saved the residents last year it was [6:17] around yes I did mention that but I can [6:19] pull that last year on the the regular [6:23] permit that's the application fee wave [6:25] was [6:27] $4,280 for a total of [6:32] 200 255 permits that was pulled within [6:36] that period of time that was weigh [6:41] $56 this back here and then the fencing [6:44] was U 24 permits Val [6:47] $1200 and Roofing $85 permits $8,500 [6:51] totally [6:52] $23,988 [6:54] uh this is the largest um incentive give [6:58] back to our community is the highest [7:00] year last [7:02] year and um know there homeowners are [7:05] looking forward for this um some of us [7:08] might say it's U we're losing Revenue [7:10] but at the same time we're giving back [7:11] to our community we're buying in to them [7:13] re having the houses and at the same [7:16] time this is our incentive towards them [7:18] continue to pull the permit rather than [7:20] them working without permits on weekends [7:23] and evening and not pulling a permit by [7:25] allowing them to pull the permit W up [7:27] the fees and get the work done [7:31] that's for [7:37] required go ahead please sorry okay so [7:40] um Mr M usually four um it's usually one [7:42] to three there res four units don't they [7:44] become commercial a four unit [7:47] residence I I would not be able to [7:50] answer but this is the same uh [7:51] information that we had from the [7:53] beginning so we just carrying power here [7:54] to years so there's been a lot of [7:56] discussion lately about commercial [7:58] versus residential so I mean it's I [8:01] don't have a problem changing it to one [8:03] to three I mean this is something that [8:04] we've been carrying year to year so as [8:06] we revisit it we can make changes as we [8:08] go along so if there is [8:12] a an agreement to to change to one to [8:15] three [8:16] I that um so president pfield is right [8:21] so there's been a lot about you know [8:22] four units become like a commercial [8:24] trash versus residential trash but you [8:27] probably just check what with code and Zoning just to make [8:33] sure and then change it to three if need [8:35] be [8:39] or I mean we can I'm up to I mean [8:43] changing it the want to me that's um the [8:47] council's direction I'm okay with [8:49] changing it 1 to three 1 to three okay [8:58] yeah so Mr M with this um it it it [9:02] increases the value of the home does [9:03] that also [9:05] increase assessment assessment on their [9:08] property well at some stage if an [9:12] extension is done or A change is done on [9:15] the property while they're doing [9:16] construction yeah that will take an [9:18] assessment [9:20] increase that's what Mr MO is saying [9:23] generally if it is a maintenance issue [9:26] it does not increase the value of the [9:28] property if it's an expansion [9:32] or increase in the functionality of the [9:34] property then the assessment would go [9:38] up go ahead please and then from our [9:40] conversation I don't know if I was [9:42] explicit in in this setting but I would [9:44] like to see um an account of how many uh [9:49] expansion efforts and then what was that [9:51] additional value added to our city just [9:53] so we can properly identify the full [9:55] impact of this program and then since it [9:57] has been year to year to here or it's [10:00] been here since I've been on the council [10:02] I think an appropriate conversation [10:03] would then be um how do we evaluate [10:05] maybe streamline this into into the [10:07] budget if that's an opportunity but uh I [10:10] think looking at the permanency of this [10:12] and then are there other facets of uh [10:14] coding that we can evaluate for these [10:16] types of gains as well if that's what [10:19] the data [10:21] reads go Mr M would this have already [10:25] then however been a part of our budget [10:27] planning for 202 [10:29] for talk so that's something we can [10:32] consider to add this into the line as [10:34] a revenue reduction can I say give back [10:38] so we can account this in and out of the [10:40] budget on code's [10:43] Department I [10:45] am we will have to engage the assessor [10:48] office to look at the the 255 plus 2485 [10:54] cor to see which one triggers an [10:56] expansion or a [10:57] change that uh would ultimately U adjust [11:01] the assessment [11:05] value that is something I can reach out [11:07] to and and see if we can get that done [11:10] thank [11:11] you go ahead so timing wise though we'll [11:14] put this back um because we'd have to [11:16] come back to our next committee meeting [11:18] is that what you wanting us to do we are you because we're looking to have [11:22] this start on June 1st is that some [11:26] information you wanted to to kind of get [11:28] on hand and then look at it over into [11:30] next year so I would say since it would [11:32] appear that many residents in the city [11:34] have functioned with this understanding [11:35] already in mind I think delaying that [11:37] especially you speak so confidently [11:38] about the program I'm not challenging [11:40] that I think for me I would like to ask [11:42] to kind of continue and then should we [11:44] identify any uh variations I I would [11:47] like to have the opportunity to kind of [11:48] readdress this at the council yes [11:50] absolutely we u i I do have notes and [11:53] that we'll follow up and get those [11:55] reports to all of us so will we have the [11:57] reports by um Friday are you saying [12:00] before we get to um not okay I been able to answer that [12:05] control with staff availability I will [12:09] send out request to the May sh and ask [12:12] the staff [12:13] to to get that report for us [12:17] okay I'm guessing it shouldn't be long [12:19] because the reports that reports appear [12:22] but it's just that they have to look at [12:23] the type of formats that was [12:25] pulled the type of work that was done [12:31] any other [12:33] comments no but next week is May 28th I [12:35] mean our our meeting is May 28 yes so [12:38] that's what we move forward with this [12:40] and we'll follow up with those reports [12:42] and make sure you have them in hand so [12:44] in the future I would ask for that going [12:47] forward along with the permit report I [12:50] would ask for also the expansion or [12:52] anything of maor impact thank you I just [12:56] do have one other comment about putting [12:58] in the budget um I'm not so sure that we could do that and make it work [13:02] because in the budget we give a uh [13:05] definite number like let's say 25,000 [13:07] but if there are more people that take [13:08] advantage when we get to that $25,000 [13:10] what happens then so we we want to keep [13:13] in mind if we give a definitive number [13:15] then when we get there what happens to [13:17] the people that may go over I know that [13:18] it's not something we need to discuss [13:20] today because we're not in budget season [13:21] yet but coming close um then you know we [13:24] can talk about then so I just want to [13:26] make sure that we consider that you know [13:29] we've made this work the normal [13:30] budgetary process would be is you have [13:33] to find some way to offset this [13:35] right [13:38] so I shouldn't say Rost [13:42] cost all right any other comments so but [13:44] I understood Mr M to say that there's [13:47] been return on investment based has [13:49] there any has there been a return on [13:50] investment with this program what what [13:53] the coun what the city has waved has [13:55] there been an increase in um well that's [13:58] the report we going to look at we never [14:00] looked at it nobody never has where [14:02] we're looking it as the incentive of [14:04] getting back 20 almost $24,000 so work [14:08] was performed 255 permit regular permit [14:11] was pulled within that that given time [14:14] period last year plus the 24 plus the 85 [14:18] permits within that 3 months [14:21] time so a lot of work was done during [14:23] that that period of [14:27] time and then uh sorry [14:30] go ahead please and if I just lastly add [14:32] definitely looking forward to planning [14:33] my uh um shadowing of the Cod Department [14:36] in the near future really excited about [14:38] that um but I would love to hear from [14:41] this department um there after this [14:43] season uh just to understand to get a [14:45] better indication of if there are any [14:48] unforeseen hurdles or issues that they [14:50] notice when they're in but I always love [14:52] your information and sharing it with the [14:55] table and and I just would like to add [14:57] one other Mr M and since we have um new [15:00] uh person heading up the cod's [15:01] department I think it's make make sure [15:02] we get this information CU they're not [15:04] going to be familiar with it they [15:05] weren't here last year no I did have the [15:08] chief B request a meeting with him I met [15:11] with him a couple weeks ago okay because [15:14] when I asked for the report he asked so [15:15] he did submit a report and asked to have [15:17] a brief meeting so I high like the [15:19] program okay with him all right yes and [15:22] I walking through the detail of the [15:23] program so you get a better [15:24] understanding of this program that we [15:26] are running for the last several years [15:28] thank you [15:31] all right so the only change we're going [15:33] to have in this document here is that [15:34] the first bullet on the bottom section [15:37] is that residential property one to [15:39] three [15:42] units all right S have a motion to move [15:45] I'll make the motion so move second all in favor I I thank you the [15:53] next [15:56] item is a swimming pool operat agreement [15:59] with boys and [16:03] Club you going do that me [16:07] to I don't Council has any question that [16:10] this is just a basic renewal of our [16:13] operating agreement with the poison [16:15] Girls Club to run the swimming [16:17] pools uh they have submitted a uh [16:21] proposal just under [16:24] $200,000 uh it's [16:27] uh a little flexibility with Central [16:30] Park opening so playing around with what [16:33] those hours would be where might extend [16:37] them somewhat based on demand or [16:40] weather uh it's a good partnership and [16:44] relationship where they do the Staffing [16:46] for the lifeguards and related activity [16:48] and uh again we're looking forward to [16:51] having Central Park pool open up and [16:55] running question go ahead please so um [16:58] you said a little bit of FX ility would [16:59] made a change in the cost but maybe the [17:01] hours is the only thing the actual cost [17:03] I think went up a little bit in this [17:06] I'll give you the numbers from last year [17:08] this this is up a few th000 from what we [17:11] paid last year but it reflects the [17:15] hourly rate for the [17:18] lifeguards okay M how many years have [17:21] the boys and girls been doing this go [17:23] ahead please goe sorry how many years [17:27] have Bo [17:35] been any other [17:37] comments second second all in favor any [17:41] other business for [17:42] finance we have a motion to [17:45] adour move second all in [17:50] favor [17:52] governments I would like to call to [17:53] order government operation and for on to [17:57] request the authorization dep part [17:59] hydrochloric acid 2024 for the water [18:06] department I'll cover this uh so like it [18:09] say every year the water department [18:10] solists bid for hydrop forc acid for our [18:15] water wells um chemical is used in the [18:17] treatment of our Municipal Water um we [18:19] put it out the bid a low bid was [18:21] received from Univar Solutions and [18:22] $51,100 uh are Au recommending to [18:27] purchase the product from Universal [18:28] solutions for our Mr [18:31] water [18:33] questions seeing none I have a motion to [18:38] move so Mo second all in favor I I thank [18:44] you any other business for government [18:46] operation motions for second all in [18:49] favor I I thank you thank you I'd like [18:52] to call the order City development and [18:54] planning uh we have 17 items on the [18:56] agenda the first item is the discussion [18:58] a possible agreement regarding pad bolts [19:00] in Central Park I don't see Mr lefon [19:03] present is there anyone that's supposed [19:05] to be taking this over for him if not no [19:09] I'll address it this is a proposal that [19:11] has come in to operate paddle boats in [19:15] the [19:17] uh cities connect to zise [19:20] plake uh really I'm recommending that we [19:24] entertain this I don't have a [19:29] be structured [19:31] or uh look to charge people could be as [19:36] cheap as a few hundred might be [19:41] $1,000 the city council president gets a [19:46] discount uh to uh it's going back like [19:51] 20 years ago we had paddle boats there [19:54] they went her to decline uh so this [19:57] would be a vendor coming in we would see [19:59] how it goes uh looking to get a little [20:02] revenue for the city but they would pick [20:04] up all the risk and assessment uh for [20:07] Staffing providing the equipment and uh [20:10] just managing the operation and so we'd [20:13] see how it is this year and then be able [20:15] to have a more formal uh relationship [20:18] next [20:21] year I do they because we have we just [20:24] have the lrs are they anticipating a [20:26] start time and we you know we'd like to [20:27] see the background information done the [20:30] company that they we look to get it [20:32] started as soon as possible sometime in [20:35] June running it through Labor Day uh and [20:39] again the question comes what's the [20:42] council think it's worth is it uh few [20:46] hundred $1,000 I don't think they're [20:49] going to participate if we set the [20:51] number too high and some of that [20:54] discussion could actually go into [20:56] executive session the council wants to [20:58] get [21:00] into the Min of [21:03] contract um what I'd like to see is [21:05] actually what they're offering you know [21:07] and all that without necessarily getting [21:09] to the price because that's going to [21:10] help us determine what the cost is going [21:12] to be so um I I have the woman's name [21:15] but not the name of the organization or [21:16] anything so I think if in two weeks we [21:18] could at least hear more about what [21:21] they're offering the uh organization and [21:24] you know have they done this before and those kind of things okay [21:29] other questions if they had a package [21:32] together and as soon be the number of [21:34] votes the type of votes [21:36] this business plan would the council [21:40] consider it for unanimous consent on [21:42] Monday M Patrick I I would I think it's [21:45] a great idea I you know heard many many [21:48] stories of um folks using the paddle [21:50] poats I think it would add yet another [21:53] you know feature to our beautiful [21:55] Central Park so um I definitely would be [21:58] in favor of but I'm hoping we'll bring [21:59] in $24,000 in Revenue um that was a Mr [22:04] mud that was [22:07] sorry I know you were coming but in any [22:09] case I I I think it would be a great a [22:12] great I'm not sure we can get it [22:13] together if we [22:16] could um get your hands up click in your [22:19] pen um I I really can't commit to you [22:22] set till I see the background I just [22:25] they want to make a promise and read [22:26] something and I like H so oh I did have [22:29] one more question Patrick so the other [22:31] thing I though uh question that I had [22:33] was um whether they would be also [22:35] responsible for taking reservations for [22:37] how that would handle be handled in [22:39] terms of you know not putting something [22:43] they're assum they're assuming the whole [22:44] responsibility for it [22:47] so yes Mr um so uh I know it was Tuesday [22:51] or Wednesday at the golf course I saw [22:53] arpad of bolts in the they're back there [22:56] by the by the sheds and I got thinking [22:58] of how much fun they were um when my [23:00] girls were little we'd always take the [23:02] paddle boats out Tuesday in the park the [23:04] fireworks so and there there were there [23:06] were constantly people on on the pond on [23:09] aoy Lake yeah with paddle boats I think [23:11] it's a good thing and without any [23:13] obligation or cost to us so I do in [23:15] favor of whatever you could put for and [23:18] if not to cast any aspersions over it [23:20] but if the council did consider it by an [23:22] animous consent Monday night they would [23:25] probably extend that discount for the [23:27] rides that's granted the council [23:28] president all the [23:30] council this is getting better not [23:33] taking any discounts I'll be in the [23:41] paper yeah I don't have a problem I mean [23:43] getting all the documents some this to [23:45] un consent part let me see if we can get [23:48] a package together it's or now it's [23:51] conceptual it sounds good [23:53] but we all know the devils in the [23:55] details and we have another council [23:57] member who's not here so that would mean [23:59] that everybody be up to be on board so [24:01] the sooner the better I know Mr um lefon [24:04] said he just kind of like there wasn't a [24:06] real they just approached them there was [24:08] nothing really hammered out yet so it [24:10] wouldn't matter to [24:13] me and we can consider for youit content [24:16] if we get all the [24:18] documentation [24:23] great okay uh the next item oh excuse me [24:26] item yeah item two to the award been in [24:28] contact with this connected police [24:30] locker and toilet room Renovations Mr [24:33] Wallen uh last session I came to you [24:36] with the award of three contracts for [24:38] the renovations sity police toilet and [24:40] locker room uh they were the mechanical [24:42] the electrical and the um General we did [24:46] not have a plumbing at the time as we [24:47] did not have anyone um put in actually [24:50] we had a plumbing not a mechanical so we [24:52] had to rebid the mechanical portion of [24:54] it fourth uh we did reach out to some [24:56] firms we did get uh a bid on it from eer [25:00] mechanical uh e mechanical um they seem [25:03] to be aggressively pursuing working in [25:05] the city they were also N Low on our [25:07] fire station and hbac maintenance [25:10] contracts so uh they have an idea of the [25:13] buildings and um we're comfortable [25:16] moving forward with it and this would be [25:17] our fourth contractor so that we can [25:19] move forward with the project as a whole [25:22] questions or comments entertain a motion [25:25] so second all those in favor thank you [25:28] item number three is being closed at the [25:30] request of Mr Wallen item number four to [25:32] authorize the issuance of vote permit [25:35] number 683 to MTX group yep uh we've [25:38] seen this one before um but working with [25:40] the law Department we discovered some [25:42] discrepancies but we want to make sure [25:43] is going forward that the applicant's [25:45] information is on the permanent not the [25:48] um installer of the sign so we went back [25:51] and we clarified that and we had them [25:53] add it we also had them uh add an email [25:57] that the certificate owner for the [25:59] insurance is going to be the property [26:00] owner which is uh scoa Holdings so now [26:03] that we have that documented we'd like [26:05] to um officially um issue the [26:09] revocable this is we didn't issue the [26:12] revocable correct Maxi before so this is [26:14] now the official issuance of it we'll [26:16] just act like we [26:18] never for 683 683 wasn't issue before [26:22] correct so we're going to move forward [26:24] now this is the insurance okay questions [26:27] or comments and a motion second all in [26:32] favor all right uh item number five the [26:35] issue authorization of issuance of a [26:37] vocable commit 684 to Maverick Quantum [26:39] Inc so uh same building simar shine same [26:45] Insurance holder different um company in [26:47] the building and same thing we had them [26:50] uh reapply for the correct applicant [26:52] information and signature of the [26:54] applicant not signature of the sign [26:55] company and that would be the standard [26:57] going forward when we do with vocables [26:59] to make sure that um usually it's like [27:02] an AJ sign they're very familiar we work [27:04] with them and they'll fill it out on [27:05] behalf but we would like to now see the [27:08] applicate signature and the applicant's [27:10] information and not do it as on behalf [27:12] of Mak sense questions or comments out a [27:16] motion so second all those in [27:19] favor thank you very [27:21] much uh item number six is discussion [27:25] seeker and Planning Commission [27:27] recommendation regarding the addition of [27:28] Section [27:30] 26411 3 of connected city code regarding [27:33] the regulation and location of smoke [27:35] shops vape shops hook and VAP [27:37] consumption businesses there was a [27:39] public hearing that was held on April [27:40] 22nd 2024 Mr [27:45] barage um yeah I'll take [27:47] this President um I think Jack Conelly [27:51] from the planning department is here as [27:54] well um as you know this was the public [27:57] hearing was held about a month ago um [27:59] it's part of the legislative process [28:01] we've been staff has been looking at the [28:03] proposed uh ordinance and uh has some [28:07] changes that need to be you know need [28:10] recommending to the proposed ordinance [28:12] and also giving you a way ahead here as [28:15] far as the [28:16] process um if as U Mr cin would go [28:20] through it in just a moment regarding [28:22] the the changes to the proposed [28:24] ordinance but since we're amending the zoning code this this needs to be [28:28] referred up to the County Planning [28:30] Department so if the changes as uh [28:36] discussed if there's changes to it then [28:38] the final draft you can transmit up to [28:41] the county on Monday via a resolution [28:45] saying that the proposed Vape ordinance [28:47] is attached for County's review and [28:51] pursuing to the state of law they have [28:52] 30 days in which to do the [28:55] review because as you all know the the [28:57] more a atorium is coming up and expiring [29:00] in June pursuing to that then we need to [29:02] do a public hearing um prior to the [29:06] extension of that for another uh 3 [29:09] months so um I would recommend that the [29:14] council pass a uh resolution calling for [29:17] a public hearing on for next week for [29:20] the 10th if it's necessary to extend [29:24] that [29:25] moratorium obviously it depends on what [29:28] you all do here tonight as far as [29:30] changing you know the the draft and then [29:33] subject to the County Planning [29:35] Department's review and [29:38] recommendations so that's the process [29:42] the big picture and Mr con will go [29:44] through some of the uh Provisions that [29:47] uh staff has been going through so the [29:50] first provision is pretty brief um in [29:51] section B location uh the only thing [29:54] that need to Chang is are to is not [29:56] included as one of the Z districts that [29:58] these will be prohibited in all the [30:00] other residential districts as long as [30:01] C1 2 3 and the I districts were included [30:04] C1 area R2 was just an oversight that [30:06] was not included um obviously I'm sure [30:09] we can all agree we'd like to see that [30:10] in there um the second ones the rest of [30:14] them are a little bit bigger we want to [30:16] change some of the radiuses um and I can [30:18] go through why we want to do that as [30:19] well um so in the next section c [30:22] restriction on location of H vate BR [30:24] smoke Andor vape shops um we decided to [30:29] take out paragraph 1 um in regards to [30:32] the radius regarding um residential uses [30:36] uh originally there was a th000 ft [30:38] radius in any residental in any [30:40] industrial Zone that was near uh within [30:42] 1,000 ft of a residential district the [30:44] reason we decided to get rid of that is [30:46] because the majority of our uh [30:48] industrial districts are very small to [30:50] begin with um and pretty much all of [30:52] them have hes that are within 1,000 ft [30:55] of residential districts so I I pulled [30:58] the data [30:59] earlier uh M1 and M2 districts which is [31:02] which are our industrial manufacturing [31:04] districts are only about 11% of the of [31:07] the area of the city um to begin with [31:09] and the vast majority of those Parcels [31:11] that lie within those districts are [31:14] within the you know within the radius of [31:16] the residential so we'd effectively be [31:18] banning them from nearly all of the [31:20] industrial districts regard uh If This [31:22] Were to be enacted um given the fact [31:25] that the industrial is obviously very [31:27] clear and separate from the residential [31:29] um we didn't see that as necessary the [31:32] other reasons why we didn't see it as [31:33] necessary go with the next two items um [31:37] first of all there's going to be we [31:39] wanted to keep up the 1000 ft radius [31:42] with similar uses meaning if there's a [31:45] one smoke shop in that region that you [31:47] can't have another one within 1,000 ft [31:49] therefore if you have one in an M1 [31:51] District unless things are very [31:53] perfectly situated which you're not [31:56] going to have a second in that [31:57] Industrial distri [31:58] um meaning there's only going to be one [32:01] per District close to Res relatively [32:04] close to residential I should say it's [32:05] not even going to be near residential um [32:08] but because of that we're going to [32:09] severely decrease the amount the density [32:12] of the smoke shops um there the last [32:14] thing in number [32:17] three um we wanted to switch it from [32:20] 2,000 ft to 750 ft away from schools the [32:24] reason for that is again similar to what [32:28] I was saying before these are already [32:30] being [32:31] severely limited um 2,000 ft from as [32:34] it's currently listed right now would [32:37] effectively REM limit it completely um [32:41] and and it would effectively make it so [32:43] you cannot open one of these shops which [32:45] I understand is part of the purpose of [32:47] the moratorium however you know we need [32:49] to allow for some uses of it we can't [32:51] outright ban it completely um so the [32:53] goal was to get a 750 ft away from [32:56] schools um most of which are already [32:58] located in residential districts that [33:00] wouldn't [33:01] have any any use for this anyway there [33:04] are a few schools that I have listed [33:06] that that would be affected and that [33:07] would take that would uh eliminate some [33:09] of those business and Industrial [33:11] districts from uh consideration but for [33:14] the most part it would stay relatively [33:16] similar to how it is um again the [33:20] purposes written as it is um with the changes that I just detailed we [33:24] would still be severely limiting the the [33:27] smoke shops um but it would make it a [33:30] bit more accessible for them with that [33:31] was still making it completely uh [33:33] restricted for for our [33:35] purposes and just to follow on on Mr K's [33:39] comments uh regarding section two [33:42] currently section two there would [33:45] be a minor tweak there where would say [33:48] uh legal hookah lounge uh smoke shot and [33:51] vape lounge that's just added just to [33:54] make it [33:55] consistent and excuse me were you adding [33:58] that language it would be under two it [34:01] would be such legal Hooks and and vape [34:05] bounds in the original draft the smoke [34:09] shop was was deleted but was was not was [34:12] omitted and should have been in there so [34:14] that's just a corrective action okay and [34:16] then uh Madam president as you know the [34:20] council also got a a memo from the uh [34:23] from the Planning Commission regarding [34:25] uh this um while they didn't indicates [34:29] a a uh a uh specific percentage of the [34:34] floor area of a smoke shop Vape Shop [34:37] hooker Lounge um they did indicate that [34:41] it would be something some less than 40% [34:47] which the current draft has and just uh some localities have gone down as far [34:53] as [34:54] 25% so I'm just giving you a range 25 to [34:59] propos was was take ordinance that [35:02] language was taken from the Town of [35:04] Babylon so other localities have G to [35:08] 25 so just giving the council a range of [35:11] uh [35:13] numbers um so you were there with a [35:15] planning meeting do you want to talk [35:17] about that please uh effectively what [35:19] they said is they wanted to they thought [35:20] 40% was too large of an area um because [35:24] you can their their main concern is you [35:26] could have 30 8% of the floor area be [35:29] dedicated to smoking materials and then [35:30] the rest just be filled with they call [35:32] it fluff items um so technically it's [35:35] not 40% of the floor area that's that's [35:37] we smoking um and they can be legally [35:39] operating but it would effectively be [35:40] operating as a smoke shop so that's why [35:42] they wanted that threshold uh lowered as Mr BR said they don't have a specific [35:46] number they wanted it something closer [35:48] to how a sparts operates um with you [35:51] know smoking products in the back and [35:54] speaking with uh Christine perano [35:55] upstairs we thought I mean clearly [35:58] stewards is not a smoke shop um so we [36:00] wanted it a bit more than that 25% in [36:03] our estimation seemed like a fair number [36:05] um as Mr BR said we got that was similar [36:08] to other municipalities in the [36:14] area so um my my only concern with that [36:18] is that smoke shops that's all they have [36:20] is so um it's not like STS where they [36:23] have ice cream and cigarettes smoke [36:25] shops that's that's all they have so [36:28] um I'm not sure if we I'm not saying [36:30] that we shouldn't lower it I just don't [36:32] want to make it so restrictive that [36:35] there we're essentially trying to tell [36:36] them they just can't have their products [36:38] um advertised not I don't both CHS but I [36:42] think we need to be fair and how we U [36:44] put this legislation together I think [36:45] that's fair yeah they uh the reason they [36:47] brought it up is there was a uh was a [36:50] convenience store opening up and when [36:51] they found out that it could be up to [36:53] 40% they found that it would they were [36:55] effectively going to operate as a smoke [36:56] shop based on the conversation that was [36:58] had in the Planning Commission meeting [36:59] with with that applicant um so that [37:02] that's what spurred their [37:07] recommendation yes Mr Tor I did notice [37:09] one um convenience store that that did [37:12] um advertise as a smoke shop on half of [37:15] the store that smoke shop sign came down [37:18] so um I know there's been some um [37:20] enforcement out there as well so and it wasn't on our list of even legal [37:25] smoke shops so yeah off officers put a [37:28] lot of effort into restricting the [37:32] sence Mr WS so I had one question [37:35] and just not really sitting that well [37:39] with me in the section c uh [37:42] reducing the uh the the property around [37:44] schools from [37:47] 2750 as you as you mentioned just [37:49] referencing just the intent with which [37:51] this was presented to the to the council [37:53] in 2008 says this ordinance this [37:56] ordinance is an athet regul land use and [37:58] to protect health and safety and the [37:59] welfare of our community pursuant can [38:01] you just speak to the reasoning behind a [38:05] identifying 2,000 as an appropriate [38:06] measure and I understood what you [38:08] speaking towards of reducing that to 750 [38:11] so you're saying why was 2,000 [38:12] originally considered 2000 was that was [38:14] the model that we used that was out of [38:16] the Town of Babylon that's where the [38:18] figure 2000 came from so upon further [38:21] review that's where we're we're looking [38:23] at now taking that those feet and [38:26] looking at the zoning map and where [38:28] these location where these these shops [38:30] are going to go and then regarding the [38:34] 750 you Al that that would really just [38:38] affect the the commercial districts in [38:40] C4 and C5 is that pretty much there so I [38:44] went through all the schools in the city [38:46] um there are a couple that come within [38:49] 750 ft of this as I said most schools [38:51] wouldn't be affected by this anyway [38:53] because they're in primarily residential [38:54] districts there would be a few schools [38:56] that earn that 7 50 foot buffer um [39:00] effectively what it would be looking [39:01] like is this a majority of our [39:03] industrial districts which I said after [39:05] these things are about 10% of our our [39:08] city would be able to have smoke shops [39:10] as as a freight if they have one there [39:12] can't be another within 1,000 ft M it [39:14] would be severely limiting there C4 and [39:16] C5 which is downtown in our business [39:18] districts it would be special use permit [39:20] again with the same rules applying with [39:21] 1,000 ft um what that allows the [39:25] Planning Commission to do is have a lot [39:26] more leeway over what's allowed so even [39:29] though you might come into issues where [39:31] you know it's near residential areas [39:34] that are technically C4 um the Planning [39:37] Commission has the authority to view [39:39] that as a whole and take that into [39:40] consideration when passing approvals and [39:43] just okay would you be able to provide [39:45] us a listing of those schools that might [39:46] potentially be affected absolutely thank [39:48] you and just following on Mr K's remark [39:51] regarding the special use permit um the [39:54] uh section 2649 [39:57] 9 subb of of the code says the proposed [40:00] building that would be the Vape chop or [40:03] use will not have a substantial undo [40:05] adverse effecta on adjacent property the [40:08] character of the neighborhood traffic [40:10] conditions parking uh utility facilities [40:13] and other matters affecting public [40:15] health safety and general welfare so [40:18] those even though you're decreasing that [40:20] as far as the special use permit the [40:22] Planning Commission has to factor those [40:25] uh uh items into their decision and just [40:29] as a sort of a a standpoint right now I did the analysis for this obviously [40:33] this building would never be a smoke [40:34] shop let's hope um but a 500t radius [40:37] from here would take you down to [40:39] Broadway to Union Street and State [40:41] Street so in 1,000ft radius would you [40:43] know be twice that size so so having one [40:46] smoke shop there is going to severely [40:48] impact the rest of that neighborhood and [40:49] make it clear if any [40:53] others did you have hand up um that was [40:56] good clarified point I I mean I was [40:58] questioning the 750 as well and how we [41:00] got to that lower number from 2000 so [41:04] and also wasn't sure why you know we [41:06] just didn't say a thousand since we were [41:08] you know using a thousand as the marker [41:11] in the other in in the other bullet um [41:15] but cuz I mean my concern is having them [41:18] close to schools we don't want them [41:20] close to schools um [41:22] so you know but sounds like that's a [41:26] good enough distance [41:28] we felt as if it was we spent a lot of [41:29] time talking about it um 750 we thought [41:32] was a was a fair number um and like I [41:34] said I looked at all the schools the the [41:37] ones that would be affected are still [41:38] going to be you know a decent amount [41:40] away from the industrial districts and [41:41] again that's only also if things are [41:45] perfectly placed to be as close as [41:46] possible if there's one on the farther [41:48] end of the industrial district that's [41:50] closer to a th000 or more feet away from [41:52] the school that's going to make it so [41:53] there's nothing else that can get even [41:54] remotely close [41:59] so these are for the um like people that [42:01] are goinging to be applying so for the [42:04] existing VAP the existing legal vape and [42:07] smoke shops um these those will be taken [42:10] into account when you when somebody else [42:12] is trying to locate so those would take [42:14] into account let me pull up or something [42:17] it's [42:18] on section one [42:21] um those businesses according to this [42:24] legislation would be would cease to [42:26] exist after 1 year um of the city [42:29] council adopting the legislation now if [42:31] they are in an industrial district [42:33] already they can apply for site plan [42:36] approval again if they are in a c4 C5 [42:39] District they can apply for a special [42:40] use permit um if they are in another [42:43] District as I I know one of the main [42:45] problem areas is Upper Union Street [42:46] which is C2 they could apply for a use [42:49] variant um which at the last page [42:51] details that it could be granted if they [42:53] showed that they have not received [42:55] Financial [42:57] you know the proper financial [43:00] repercussions for opening the business [43:02] in the first place and the use variants [43:04] would only be good until they get their [43:06] finances in order once they you know get [43:09] a return on their investment then the [43:11] business would cease to exist again and [43:13] could not reopen again unless there was [43:15] a used variance granted which would be [43:16] unlikely [43:21] mhm I I don't know telling people [43:24] they're going to do their business in [43:25] the year I'm not sure that [43:27] [Music] [43:28] I'm not 100% but they they would have [43:30] the ability to go before the zoning [43:32] board of appeals and make their case as [43:34] to why they should stay you know [43:36] additional because of huiz of their costs so the idea is to [43:44] um to allow the business [43:48] to recoup their Investments past that [43:52] onee deadline and this wasn't anything [43:54] that changed from the last time it was [43:56] here either that something the in the in [43:59] the original [44:05] draft [44:06] Yeah do do we know how many existing [44:11] shops that will impact I don't have a [44:14] number for [44:15] you that would be [44:23] important would you be able to provide [44:25] us with that information I could provide [44:26] you with rough with a rough number at I [44:28] you know getting an exact one would be [44:30] near possible we could look [44:34] [Music] [44:37] it Adam president just for you know as [44:40] followup from my earlier comments just [44:42] for you know the way [44:43] ahead if um based on Mr Conley's [44:47] comments and the other comments uh if [44:50] you want to move forward with this you [44:54] could amend it as we've just discussed [44:57] mhm um and we'll put it on the agenda [45:00] for Monday and that will have a cover [45:05] resolution for transmitt up to the [45:08] County Planning Department for their [45:09] comment and review and then subject to [45:13] their comments then uh it would it would [45:16] come back before the council for for for [45:20] final action or any any other amendments [45:23] based on the there there be an [45:25] opportunity to amend after we find [45:27] oh yeah oh yeah oh yeah and uh so if but [45:32] I would I think what we're looking to do [45:34] is move move this forward so the county [45:37] has something to look at from us a final [45:39] draft if you will and then and then uh [45:43] have that process move forward and as I [45:46] indicated earlier also have a resolution [45:49] calling for a public hearing extending M [45:52] moratorium has that June 10th today so [45:54] we're keeping everything along okay so [45:58] that so I just have one other I have one [46:00] other question under item c number uh [46:04] number four where the about the window [46:06] coverage of the 20% and all those so are [46:09] these are these numbers according to the [46:11] um I know there's some sep head gu [46:13] guidelines these These are actually out [46:15] of the the signage wage you see there is [46:18] out of the city of [46:20] Buffalo's uh ordinance dealing with Vape [46:24] Shops and and and the uh so that's where [46:26] that leg that's where those numbers can [46:28] and 20% is in our city code for all [46:30] businesses it is for bus for all [46:32] businesses so that's it's restating [46:34] what's already was already okay I'm that [46:36] is part of the [46:38] subra just want to make sure we're kind [46:40] of be [46:42] consistent okay mad president sir mayor [46:46] just I referen Monday and Mr O'Brien [46:49] reference Monday it's actually [46:53] Tuesday not that we don't all look [46:54] forward to getting together on Monday [46:56] and Tuesday [46:57] on [46:58] Tuesday absolutely so m p um I mean I [47:03] would like to move this forward so that [47:04] it can go to the county however um I [47:07] think the uh 25% piece needs to be [47:10] discussed um the recommendation of the [47:13] planing commission for [47:16] Section section [47:21] two [47:23] a 22 a yeah yeah under the uh definition [47:29] section of uh the substantial or [47:32] significant portion that goes through [47:35] it's a b c and d uh the 40% came from [47:40] the kind of babylon's code um other as [47:44] Mr Colin said in in my Research [47:47] indicates other locations have gone down [47:49] to [47:50] 25% so that gives you a range that gives [47:52] the council a range to to work from MH [47:57] you can keep it at 40 or you can go down [47:58] to 25 or anything in between I mean it's [48:01] really up to you you feel comfortable [48:04] with it's just there's other as you in [48:07] that portion there other factors you [48:09] know how they [48:10] Define or described the operation of the [48:13] business so this is just [48:17] really narrowing and further so the um [48:21] Planning Commission recommends we lower [48:23] it just hasn't hasn't given a [48:25] recommendation as to what we lower too [48:27] they didn't give a specific number they [48:29] didn't have specific numbers on hand and [48:30] didn't want to throw stuff around [48:32] willy-nilly without you [48:37] knower [48:39] um discussion [48:42] [Music] [48:45] Council and again we're you know this we [48:47] can send this to the county and if then [48:49] we want to have more discussion or amend [48:51] it um maybe have some conversations with [48:54] the Planning Commission in terms of what [48:56] they're thinking because the memo that [48:57] they said doesn't really give a lot of [48:59] detail right okay so um have that [49:02] discussion and we could possibly change [49:05] it then or leave it as [49:08] is I mean if it's council's wish they you can put it up you can move it [49:13] forward with 40% then change it again [49:16] change it if you wish at you know when [49:19] you read get the comments from the from [49:21] the county were were amended in the [49:24] final Amendment form lower [49:27] mayor and the reality in these type of [49:30] things are you're going to get people [49:31] whatever number you pick and they're [49:33] going to be compliant there's also going [49:35] to be other people who will [49:38] be uh crafty clever [49:42] uh interesting in their design of their [49:45] floor space you know what's common area [49:48] what's a walkway what's [49:50] actual retail and so the wording there [49:55] howy have something has some kind of [49:56] sense that's enforceable and that we [50:00] want to be able to just manage it going [50:02] [Music] [50:10] forward anyone else okay um I mean I I I [50:15] think reducing it is the way to go just [50:18] based on everything we've been hearing [50:19] from for example the [50:21] um New York State toac Council [50:27] if the council chose a low [50:31] number is there a process where somebody [50:34] go to the zoning board of appeals or do [50:36] something where they had some unique set [50:39] of circumstances where they would then [50:40] have to [50:42] justify having additional space no no [50:47] it's it's it's it's it's from an [50:48] enforcement point of view as far as [50:51] what's your floor space what you got in [50:53] there as your inventory and product for [50:55] sale and it's way for the the zoning [50:58] inspector or the code enforcement person [51:00] to take a look make a make an assessment [51:03] on the floor space inventory what's this [51:05] business all [51:06] about [51:09] and um [51:12] 40% substantial or significant it's 25% [51:15] you know 25% is [51:18] that significant or [51:21] substantial um like I said some [51:24] localities have gone down to 25% so [51:29] um [51:31] it's there's other factors that they [51:33] consider revenues dered advertising Etc [51:37] that that an inspector can can use but [51:40] it's just further defining the the the [51:44] uh the uh enforcement mechanism of [51:48] what's what's in that particular [51:51] store Mr Toro um having visited several [51:54] of them I mean it's the same they have [51:58] the same product store after store after [52:00] store I would say more than 40% of their [52:03] floor is dedicated to vape and smoka and [52:06] paraphernalia and things like that so um [52:09] 40 and I mean 40 would I think a lot of [52:13] the stores I've been in would reduce [52:15] their inventory as it is now uh 25% [52:19] would even reduce it further um so again [52:24] I'd like to hear what um you know what [52:26] the Planning Commission recommends I can [52:28] see lowering it a little bit but the I [52:31] think the 25% would really limit what [52:33] they have in their shop and if we're [52:35] allowing their shops to be there then [52:38] they should at least be able to kind of [52:40] sell what they have I guess I 40% was a [52:43] number originally that was agreed upon [52:45] between the department of development [52:46] and the law office so that that was a [52:48] number that we took from a couple [52:49] different spots and and looked at um the [52:53] Planning Commission just agreed [52:57] so um I think we can move this forward [52:59] but we'd have to I still would like to [53:00] hear from the Planning Commission what [53:02] their um rationale was for that and we [53:04] could get that before um before it's [53:07] time to actually um within 30 days that [53:10] the council that the county would have [53:12] to send it back um I have to agree with [53:14] mror I think that we don't want to limit [53:16] it really too much so we're just [53:18] basically not giving people an [53:19] opportunity to run their business Mr you [53:23] suggested moving forward in [53:25] 40% but that and amend it when we [53:28] receive the recommendation from the [53:29] county [53:31] exactly I'm good with that and okay also [53:34] Mr umbrian you want us to also move [53:37] ahead with the to call for a public [53:39] hearing for the extension of the more [53:42] 20 so first should we U Move This [53:45] forward to the count do we have to move [53:47] this in a resolution to the county with [53:50] but and then do a second resolution um Madam president just so [53:56] I'm I'm tracking the changes here so [53:58] we're all on the same page so for [54:01] location we're adding uh R2 that's corrective action residential [54:06] area [54:07] R2 we're deleting in the section calling [54:12] for restrictions on location of hookah [54:14] lounges Vape lounges Etc we're deleting [54:18] one SE paragraph two would then become [54:22] paragraph one and paragraph three would [54:25] become paragraph two with the location [54:28] change to [54:29] 750 750 [54:31] ft and that you would remain at this [54:34] point 40% regarding the definition [54:38] portions that substantial or significant [54:40] portion is that is that [54:42] correct you would leave that at 40% at [54:45] this point but this is so I'll amend as [54:51] discussed and then um and then prepare [54:54] the resolution as the cover [54:56] resolution for the draft to go up to the [55:00] county yes [55:03] okay yeah we need to move yes we need to [55:06] move that so move as this disc okay [55:10] second all those in favor I okay now we [55:13] need a motion to um call for a public [55:16] hearing to discuss if needed the [55:18] extension on the [55:19] moratorium so second all those in [55:24] favor one final matter on this whole [55:27] packet Madam president there was a [55:29] Seeker I think that a Seeker resolution [55:32] declaring this as a non type two action [55:35] I think we should just wait on that [55:37] until we get the final product of the uh [55:42] ordinance ready to go and use that as a [55:43] companion piece of legislation once for [55:46] the final [55:49] okay anything else Mr thank you okay [55:53] thank you all right um [55:57] item number [55:58] seven threeyear home Consortium [56:01] agreement R the city of troit in town [56:03] Miss [56:04] Carver good evening our sced Detroit [56:08] Colony Consortium agreement is up for [56:10] Renewal we renew it every 3 years [56:13] roughly each year we get a million [56:15] dollar in Home Federal funding that's [56:17] allocated with connect being a leite [56:20] entity part of this renewal process is [56:22] that we need to do a resolution stating [56:25] just that we're the lead entity and we're [56:29] approving the renewal of the home [56:30] Consortium agreement for another three [56:32] years my recommendation today which I [56:34] did Supply um for your review the last [56:37] resolution that we did is that we passed [56:40] another threeyear Ral for the home [56:41] consor agreement any questions or [56:44] comments move it second all those in [56:47] favor I thank you um the next one is our [56:51] Pro housing communities pledge [56:53] resolution Miss par yes to governor 2023 [56:57] executive order um has some designated [57:00] funds that some discretionary funds that [57:02] we would have access to if we get the [57:05] pro housing community designation part [57:08] of that process to get that is to pass [57:11] the community housing Pro housing [57:13] community pledge resolution I do need to [57:15] supply the exact wording to you for [57:17] review which I do have to make sure that [57:19] we're aign um by passing this resolution [57:21] we are agreeing to things that we [57:23] already do one streamlining and [57:25] permitting from multif family housing [57:27] affordable housing units accessibility [57:29] and Supportive Housing that we're going [57:31] to adopt policies that affirmatively [57:33] further fair housing incorporate [57:35] Regional Housing needs into our planning [57:37] decisions and increase development [57:39] capacity for residential uses so today [57:42] um the A is for city council to do a um [57:46] resolution adopting the pro housing [57:48] communities [57:50] pledge so um Mrs Carver will provide us [57:52] with that information but if uh everyone [57:54] is comfortable p that information we can [57:56] move it now and if there's any question [57:58] of course we can um remove it if [58:00] necessary but I'll entertain a motion to [58:02] do so second all those in favor I thank [58:06] you very [58:07] much okay so quickly uh item number nine [58:11] is um I'm asking for a ceremonial [58:13] resolution recognizing spal Zulus and [58:15] Steve Harris for their years of service [58:18] at woodlon Park um they spent 133 years [58:21] revitalizing that Park SPO is now moving [58:24] away and Steve just felt like he [58:25] couldn't carried on on his own so just [58:28] want to the council to recognize the [58:29] work that they put into the city [58:31] park second all those in [58:34] favor uh the next item is a ceremony [58:37] resolution recognizing National [58:38] Caribbean American Heritage Month Mr M [58:41] Baron thank you June is recognized as [58:44] National Caribbean heritage month and I [58:46] once again asking for resolution to [58:48] recognize the Caribbean [58:50] American contribution to our city andal [58:54] reg I'll move it [58:56] second all those in favor [58:59] hi okay item number 11 is a proposed [59:04] changing um proposed zoning change for [59:06] this SKC 40 project um I'll turn that [59:10] over to the [59:11] mayor thank you uh mam [59:14] president we've been fortunate done a [59:17] number of major announcements recently [59:19] on projects in the city uh this item [59:23] coming before you tonight I want to [59:25] thank [59:27] uh the landbank team ecni Community [59:31] Builders developers [59:33] Metroplex it will [59:36] have as big an impact or more than some [59:40] of the other things that have we've [59:42] announced and are getting bigger [59:45] headlines but it's going to clean up a [59:47] lot of blight within the area it's going [59:49] to create housing opportunities and [59:51] hopefully just continue the level of [59:53] excitement that we have on community on [59:55] this Community where people are making [59:57] Investments here and that they'll be [59:59] able to take advantage of your [1:00:01] moratorium on the price structure Mr [1:00:03] here but with that I turn it over to Mr [1:00:06] Gillan from uh Metroplex to go through [1:00:09] the uh proposal and the request we thank [1:00:13] the council it should be we thank the [1:00:17] council president for uh having us [1:00:19] tonight and for all of you for being [1:00:21] here I want to introduce Steve strikman [1:00:23] from our land bank love having backing [1:00:26] on our team s bua from Five Corners [1:00:29] development very involved in this [1:00:31] project Andy brick our legal [1:00:34] counsel Courtney Davis from LaBella [1:00:38] Associates and yon Thompson from [1:00:40] Community Builders who's already done so [1:00:42] much good work on the Aly Street [1:00:44] Corridor as the mayor said we're very [1:00:46] pleased to bring this forward this me [1:00:49] this is really we're riding on the [1:00:51] coattails of the great work done by the [1:00:54] legal team and the codes team here in [1:00:56] the city and the mayor and everyone in [1:00:58] this room to uh it kind of reminds me of [1:01:02] the wedgeway building we went after our [1:01:04] bad owner there we're able to collect a [1:01:08] huge fine get the building transferred [1:01:10] to a new owner we have a $20 million [1:01:12] project under way there with the help of [1:01:14] the restore theor program we want to do [1:01:16] the same here so first and foremost [1:01:18] though the cod's team the Leal Team Max [1:01:20] has been spectacular on this and she [1:01:22] joined the city team uh won a judgment [1:01:25] against the owner of this connected 40 [1:01:27] properties of $760,000 that's the [1:01:30] biggest fine in the history of the city [1:01:32] as I understand it again I have nothing [1:01:34] to do with it I wish I could take credit [1:01:36] for it this it's so spectacular but I [1:01:38] can't and um with this so you not only [1:01:42] are you going to get $760,000 to put in [1:01:44] your budget but we're going to get these [1:01:46] blighted properties cleaned up which is [1:01:48] just so exciting and you see a couple [1:01:50] pictures there just go back to me if you [1:01:52] can the one building I've talked to the [1:01:54] council president on this upper left [1:01:56] many many times it's it's burned out [1:01:58] it's a disaster um you know you look at [1:02:01] the interior conditions of some of these [1:02:03] buildings along the Albany Street [1:02:04] quarter so it's it's really exciting [1:02:07] that uh this this judgment was levied uh [1:02:10] and now we're moving forward the plan to [1:02:12] clean up the pl [1:02:14] sites in addition this all of those [1:02:17] buildings are along the Aly Street [1:02:19] quarter adjacent to that Al Street [1:02:21] quarter of course is the Mohawk Honda [1:02:23] site which our partners at the county [1:02:25] agreed to buy and have closed on [1:02:27] purchased it for $980,000 and the county [1:02:31] has dedicated as you all know $3 million [1:02:33] to develop that site of arpa funding to [1:02:35] develop a grocery store at that site so [1:02:37] we've got all of this potential uh good [1:02:40] things happening on Aly Street and of [1:02:42] course the um Monda site is right next [1:02:46] to one of the great things about this [1:02:48] site it fronts both on Aly Street and on [1:02:50] State [1:02:51] Street next [1:02:54] slide when we looked at [1:02:57] developing uh the Monda site for um [1:03:02] retail and for new development it [1:03:05] quickly became apparent that you [1:03:06] couldn't do one project without the [1:03:08] other you had to run these projects in [1:03:10] tandem I didn't think of this I wasn't [1:03:12] smart enough but our team is is very [1:03:14] smart so they said You' got to run these [1:03:16] in tandem when we started showing the [1:03:18] Mohawk Honda site to to developers and [1:03:20] to uh interested retailers they said [1:03:23] what about all this BL on ay street [1:03:25] right next to s so you have to do them [1:03:26] in Tandem and that's why we're here to [1:03:28] talk about tonight we're moving them [1:03:30] forward at the same time we've put [1:03:32] together a great team commity Builders [1:03:34] Five Corners development Better [1:03:36] Community neighborhoods uh the [1:03:37] consultant team is very strong from our [1:03:40] environmental experts to CT mail laella [1:03:43] Andy brick Law Firm Jackson Demolition [1:03:46] and of course Metroplex of the [1:03:49] land this team has been very busy uh [1:03:53] over the last uh 6 to8 months surveys [1:03:56] have been completed phase one [1:03:57] environmental reviews completed Phase 2 [1:04:00] is basically completed ongoing Geotech [1:04:03] so we're testing the soil ongoing [1:04:05] asbestos testing demolition budgets put [1:04:08] together asbestos abatement is underway [1:04:10] on these properties so we're getting [1:04:12] ready to develop the site this is the [1:04:14] same thing we did at the ALCO site this [1:04:16] is the same thing we've done time and [1:04:17] time again in this [1:04:20] community again not only did the county [1:04:22] buy Monda and get site control but we [1:04:26] went after and again the city uh was [1:04:28] super Cooperative on this uh we were [1:04:31] awarded a $2.75 million Grant from the [1:04:34] Restore New York program to demolish and [1:04:36] clean up this site and prep it for [1:04:38] development so we have that in hand so [1:04:40] again it's a development momentum we [1:04:41] have these properties on Aly street that [1:04:43] are coming under control we have the M [1:04:45] Honda side under control and now we have [1:04:47] this grant to help prep the M Honda site [1:04:50] for um development we're here tonight [1:04:53] because you need to play a key role in [1:04:55] moving this project before we want to [1:04:57] rezone and this is critical for this [1:04:59] project to go forward it's in a minor [1:05:01] change there's four Parcels on sken [1:05:04] street that are that need to be reson uh [1:05:08] and there are three Parcels on Albany [1:05:11] Street the four on all on sken street [1:05:14] two are owned by Sora and they're in the [1:05:16] process we're in the process of asking [1:05:18] those to be turned over to the land bank [1:05:21] the other two are part of this connected [1:05:22] 40 the infamous connected 40 assemblage [1:05:26] all of the properties on Albany Street [1:05:27] are part of the uh uh the sk40 [1:05:31] assemblage so you see uh on the first [1:05:34] Slide the current zoning see the red box [1:05:37] um on SKC Street see the small red box [1:05:40] on Aly street again four Parcels on [1:05:42] skincity three on on Albany we move [1:05:46] those into the green uh and um you can [1:05:50] see that all the adjacent areas are [1:05:52] already zoned uh you know as C4 so we're [1:05:56] making a very minor change with three [1:05:58] Parcels on ALB street that are part of [1:06:00] the sked 40 assemblage four on connected [1:06:04] Street what that allows us to do is move [1:06:07] forward with the project uh site a is [1:06:10] the Monda site to to demolish that [1:06:13] building almost an 18,000 ft building [1:06:16] clean it up remediate it site B there [1:06:19] are 10 Parcels there very blighted those [1:06:22] come down the buildings are unsafe Again [1:06:24] part of theu 40 assemblage site C [1:06:28] similar activity the parcels are cleaned [1:06:31] up they're heavily damaged that's the [1:06:33] fire damage parcel that you see in Aly [1:06:35] street now it has to come down it's very blighted and and dilapidated site [1:06:41] so we're able to clean up a lot of this [1:06:43] bried Corridor on ALB Street and here's [1:06:46] the good part uh what we are planning to [1:06:49] do with this great development team [1:06:51] we've put together is to build the new [1:06:54] grocery store of 16 000 ft um in site [1:06:59] a and build [1:07:02] 125 housing units as well in site a in [1:07:07] site B on the lower left uh 80 units [1:07:11] site C 20 units so 225 units of new [1:07:16] affordable high quality [1:07:19] housing uh Fitness Center business [1:07:21] center community indoor outdoor space [1:07:24] you see all the green space on on the [1:07:25] map there's a lot of green space in this [1:07:27] project one of the things we talked to [1:07:29] the council president about many times [1:07:31] is having a very nice pathway from the [1:07:35] grocery store back to Albany Street [1:07:37] that's in the plan uh we have big buffer [1:07:40] areas around underground parking uh uh [1:07:44] you know first level parking of the [1:07:46] apartment buildings being uh first floor [1:07:48] parking so it's really a a very good [1:07:51] site plan and uh we're excited to move [1:07:54] it forward but we need to do this [1:07:56] uh zoning change this minor zoning [1:07:58] change in order to do this what does [1:07:59] this get us more more quality housing [1:08:02] removal of blighted and hazardous [1:08:05] buildings uh continue the the uh [1:08:07] development that we want to see in this [1:08:10] quarter provide access to Transit [1:08:12] provide walkable development and um a [1:08:16] tree line sidewalks we talked to the to many of you about you're concerned [1:08:20] that this be a walkable development have [1:08:22] good sidewalks have good landscaping and [1:08:25] really be a nice addition to our [1:08:28] community of course one of the reasons [1:08:30] we're doing this one of the drivers is [1:08:32] to improve access to fresh food enhance [1:08:36] food security improve quality of life [1:08:38] and and the store will create 25 to 30 [1:08:40] new jobs as well so it's really a a very [1:08:43] creative development taking those [1:08:45] blighted buildings down that you won [1:08:47] this big judgment against this notorious [1:08:49] landlord who was um Breaking All the [1:08:52] Rules uh getting us 760,00 ,000 getting [1:08:57] those sites developed for quality [1:08:58] affordable housing taking the site that [1:09:00] the county purchased cleaning that up [1:09:02] knocking the building down and [1:09:04] developing it for [1:09:06] grocery to move this forward that's what [1:09:08] we're asking you to do declare your [1:09:10] intent that you often do to be lead [1:09:12] agency under Seeker which is required [1:09:14] for any project like this make a [1:09:17] referral to the Planning Commission uh [1:09:19] the evening on the zoning change and [1:09:22] they'll go through their usual process [1:09:24] and call for a public hearing as [1:09:27] well you see a couple of the skanky 40 [1:09:30] properties there um they're really [1:09:32] blighted and um again they all get [1:09:35] cleaned up uh with this project and we [1:09:38] happy to answer any [1:09:43] questions um so you talked about the [1:09:45] grocery storees do you have has you [1:09:47] identified who that grocery store we're [1:09:49] under a non-disclosure right now but we [1:09:51] have a letter int of intent uh in place [1:09:54] we're working very diligently to [1:09:56] complete that transaction okay could you [1:09:59] give us a little bit information what [1:10:01] the timeline might would look like would [1:10:02] look like on this project the the [1:10:04] timeline is is we move this ahead take [1:10:08] the zone change to the Planning [1:10:10] Commission uh it's critical to allow um [1:10:15] uh this development to to move forward [1:10:18] uh and again it builds on the momentum [1:10:19] we've already seen on allby stre the [1:10:21] community Builder Hillside Crossings [1:10:23] project uh the Joe Allen [1:10:25] apartments and um uh some of the other [1:10:28] developments Hillside Crossing 2 um we [1:10:32] then move into the uh development stage [1:10:35] and bring the the project the building [1:10:37] designs and and other uh features of the [1:10:40] project back to the Planning Commission [1:10:41] for final review and move the project [1:10:45] forward overall do you know about and [1:10:48] the time onine I'm not trying to like [1:10:50] pin it down to the day we have been [1:10:51] meeting weekly for longer than I want to [1:10:54] tell you [1:10:56] we have a call every Friday with this [1:10:59] development team and we take notes and [1:11:01] uh it is moving forward um I would say [1:11:05] what would you think to me yeah Q2 Q3 [1:11:08] 2027 we would expect delivery so we [1:11:11] we're hoping to have all HCR approvals [1:11:14] by Q2 Q3 of this coming year and then [1:11:17] it's about a roughly a two-year build oh [1:11:20] okay the the key is getting the the [1:11:23] sites prepped and cleaned up uh getting [1:11:26] Monda cleaned up getting the building [1:11:28] down we have the restore Grant in hand [1:11:30] the developer the development team we [1:11:33] put together has the financing to [1:11:35] purchase these buildings from the [1:11:37] receiver that's has been appointed by [1:11:38] the courts to sell these properties so [1:11:40] you get your $960,000 this [1:11:47] year9 76 you got me all right and then [1:11:52] uh so that happens the demolition of [1:11:55] cond would happen this year the [1:11:57] demolition of the sky 40 properties [1:11:59] would happen this year hopefully this [1:12:01] year yep and then we'll have cleaned up [1:12:05] sites environmentally remediated like we [1:12:07] did look at the you know the the corner [1:12:09] of KRA all where we built that beautiful [1:12:11] new housing and cleaned up you know a [1:12:14] dry cleaner site that was very very [1:12:16] dirty you know so all of those things [1:12:18] take a little time but then we head into [1:12:21] the development phase and the [1:12:23] construction phase and it's a it's a very large exciting [1:12:28] project as a mayor said this Rivals some [1:12:30] of the larger developments that we've [1:12:32] seen happen in this community uh as a [1:12:34] result of our great partnership between [1:12:36] the county and the city and our unified [1:12:38] economic development team is it [1:12:41] conceivable that the the store the [1:12:43] grocery store will be open before all [1:12:44] the apartments are completed or there [1:12:47] like everything going if you want to if you wanted to add something to this [1:12:50] you could join Mr Gillan up here because [1:12:51] then you'd be on the cameras um is it [1:12:54] conceivable that the grocery store would [1:12:56] be open prior to that is it are you [1:12:58] planning just everything kind of launch [1:12:59] it at one time it's probably going to [1:13:01] happen all at the same time just CU part [1:13:03] of the funding from from the HCR is [1:13:05] going to include funding for helping to [1:13:07] support the grocery store okay so [1:13:08] realistically speaking it would all be [1:13:10] delivered around the same time I mean uh [1:13:13] the Monda site is obviously going to be [1:13:14] the first we're not necessarily phasing [1:13:16] it but it's going to be the first to be [1:13:17] built and then we're going to move on to [1:13:19] the other sites it's going to sites [1:13:21] after but it wouldn't be open until [1:13:23] everything else is finished even if yeah [1:13:25] okay thank [1:13:27] you Mr Wes uh so it's more of a comment [1:13:31] definitely scany winning and respect to [1:13:33] economic revitalization and [1:13:35] Redevelopment is definitely something [1:13:37] that I've come to just appreciate [1:13:39] whenever you come to our Council and [1:13:40] definitely is respective of the team and [1:13:42] its Collective work so to definitely [1:13:44] thank you for continuing to provide [1:13:46] these types of results um in that same [1:13:48] context I also want to say U taking a [1:13:50] Step Beyond that where it's apparent the [1:13:53] end users benefit from these types of [1:13:55] efforts where the grocery store and the [1:13:57] additional housing and some of the other [1:13:59] areas that you highlighted but also I [1:14:01] want to make sure there's considerable [1:14:02] Investments kind of speaking in in [1:14:04] spirit to what councilman Farley always [1:14:06] brings up um making sure that our small [1:14:08] business owners and our small business [1:14:10] contractors can see those wins as well [1:14:12] not to speak as though they do not um [1:14:14] but saying that we need to continue [1:14:16] making sure that there are also tangible [1:14:19] wins for those types of individuals [1:14:21] where having uh these developers come in [1:14:23] and help clean up definitely very [1:14:25] welcomed but I know we have some upand [1:14:27] cominging businesses within the [1:14:28] community who are truly prideful scant [1:14:31] dians that would love to be a part of [1:14:32] these efforts as well you know that's a [1:14:33] great point I'm glad you rais it we just [1:14:35] had an Outreach event up at the Mosaic [1:14:37] development on Crane Street inviting you [1:14:39] know the neighborhood in inviting the [1:14:41] local businesses in we'll do the same [1:14:42] thing here over and over inviting the [1:14:45] team in and I'm just comment on earlier [1:14:47] thrilled that you passed the pro housing [1:14:50] uh move that forward tonight thank you [1:14:51] because that's going to help us in so [1:14:52] many ways that is really be becoming [1:14:55] something that they they'll look at when [1:14:56] they're scoring these Grant applications [1:14:58] to the state so as your development [1:15:00] director said very well this evening [1:15:02] that's a very important that'll be [1:15:04] helpful to our grant applications that [1:15:05] we're applying [1:15:07] for Miss Patrick I just um wanted to [1:15:10] comment about the grocery store because [1:15:12] of course there's also the Electric City [1:15:14] grocery store going in at the other end [1:15:17] um and I'm just wondering if there was [1:15:19] ever consideration [1:15:21] of using this site for the Electric City [1:15:24] grocery store so that now in we'll have [1:15:27] two Grocery Stores um instead of one [1:15:31] both are still under development it's a [1:15:32] good question we have spoke spoken to [1:15:35] both groups they're both still under [1:15:38] development um um that's a question you [1:15:42] have to ask to call [1:15:45] up okay and I think this is fabulous I'm [1:15:48] very excited especially that the [1:15:50] demolition will happen within this year [1:15:52] is what I think I heard you say um so [1:15:55] the fence will be going up um the next [1:15:56] couple weeks around M Honda and um [1:16:00] you'll see the site remediated and the [1:16:02] other and the house and the demolition [1:16:03] as well we're just wait waiting on [1:16:05] closing the contract once that with the [1:16:07] housing once we close on that we'll demo [1:16:09] those Monda will come down sooner uh but [1:16:12] realistically speaking within the next [1:16:14] two or three months would be our V I [1:16:16] really want to thank the team the mayor [1:16:18] mat we've taken up a lot of your time [1:16:21] her time on preparing legal briefs and [1:16:24] other things for the development team [1:16:26] council president has been uh advising [1:16:29] us on this and working with us for [1:16:30] months now on this development you know [1:16:32] going back made some very good points [1:16:35] about when we should bring this forward [1:16:37] uh given the U the legal issues that [1:16:40] were surrounding this we're very [1:16:42] confident now this is the time and place [1:16:43] to move this project forward and and [1:16:45] clean up this this blight on Al Street [1:16:48] and and clean up the mwanda site as well [1:16:51] and again we should say Manda has been [1:16:53] nothing but Cooperative on this [1:16:54] abolutely great citizens of the [1:16:56] community held the option with the [1:16:59] county for 3 years so that all the [1:17:01] proper due diligence could be done with [1:17:03] the cleanup and Etc [1:17:06] so Mr M on the apartments are there [1:17:10] considerations for set aside low income [1:17:13] apartments yeah so the uh the entire uh [1:17:17] all of the buildings all four of the [1:17:18] buildings will be affordable affordable [1:17:20] in income regulated so so you have to [1:17:23] show [1:17:25] your your rent is based on your [1:17:27] income [1:17:29] okay there these are high quality units [1:17:32] Business Center Fitness Center [1:17:35] Parking uh Green Space uh these are [1:17:38] units every one of us would be proud to [1:17:40] live in they're made affordable by state [1:17:43] housing tax credits that are issued so [1:17:46] that um we don't price these out of the [1:17:49] range of hardworking connect idiot [1:17:52] basically and and that's a big part of [1:17:54] our our agenda as well you wouldn't know [1:17:56] the difference if this was a marker rate [1:17:58] or affordable housing it just happens to [1:17:59] be for affordable people who qualif yeah [1:18:03] thank you in terms of infrastructure um [1:18:06] you know we had this we had a similar [1:18:08] conversation when um the other Hills [1:18:10] side view went in terms of the sidewalks [1:18:12] essentially you know what the sidewalk [1:18:14] BLS look like and obviously walked it so [1:18:16] that is all built into this so that [1:18:18] we're it's going to become really [1:18:20] walkable yes absolutely it's all part of [1:18:22] our plan okay y a lot of green space [1:18:25] cleaning up light cleaning up [1:18:27] environmentally uh dirty sites and and [1:18:29] building quality units and uh making a a [1:18:32] walkable development okay we've spent a [1:18:35] lot of time we're viewing through the [1:18:36] complete streets program so we're very [1:18:39] familiar with what city wants and what [1:18:41] we need to deliver thank [1:18:44] you anyone else Chris Wen said to me be [1:18:48] short tonight be [1:18:50] quicket I have a tendency to go on but [1:18:53] we wanted to fully on this development [1:18:56] and we appreciate our whole team coming [1:18:57] out and U being here tonight we [1:19:00] appreciate you bearing with us this [1:19:03] exciting is there anything else you want [1:19:04] to add council members any other [1:19:07] questions statements okay so at this [1:19:10] time um the council would need to thank [1:19:12] you very much would to um need to [1:19:15] declare our intent act lead agency to [1:19:17] refer this to the Planning Commission [1:19:20] and who and we need to call the public [1:19:22] hearing yes public hearing call public [1:19:24] hearing but I would recommend until you [1:19:25] hear back from the Planning Commission [1:19:27] you want to wait yeah because what would [1:19:30] right so we need a time frame is okay so [1:19:33] um tonight we would need to [1:19:37] De I would like to request [1:19:40] right land just like to request that uh [1:19:43] the Planning Commission meets late this [1:19:45] month or in June because of juneth so [1:19:48] the meeting the last so they're meeting [1:19:50] the last one day of the month so I don't [1:19:52] think there's any requirement that you [1:19:54] have the public hearing before that but [1:19:56] I was hoping that the public hearing [1:19:57] could be either on June [1:20:00] 14th dates June 10th or June 24th I mean [1:20:03] there will be public there people will [1:20:06] have the opportunity to speak publicly [1:20:08] the Planning Commission meeting they'll [1:20:09] have opportunity to speak at every one [1:20:12] of the council meetings as this gets [1:20:13] adopted down the road Madam president I [1:20:15] would recommend that the 24th because by [1:20:17] that time the Planning Commission would [1:20:19] have had their meeting and then there [1:20:22] you would have it on the 24th [1:20:25] and it would be draft legislation [1:20:27] perhaps for comment by that time based [1:20:30] on the actions of the Planning [1:20:32] Commission so you I'm saying putting it [1:20:34] out further um our public hearing our [1:20:38] public hearing on the 24th would be [1:20:40] based on that schedule would be by that [1:20:43] time there would be input from the [1:20:45] Planning Commission to we can work off [1:20:47] of that to draft an ordinance for the [1:20:49] public hearing for your review okay so [1:20:52] you can call for the public hearing hear [1:20:54] in now if you want but it will not be in [1:20:56] our regular cycle but it'll be put out a [1:20:59] little bit later okay thank you thank [1:21:02] you have do anything [1:21:04] please all right thank you so uh Mr o'ri [1:21:07] do we need to do these as three separate [1:21:09] resolutions um yes you do three separate [1:21:11] referral okay the seeker and the public [1:21:14] hearing all right first of all I would [1:21:16] uh entertain a motion to have the city [1:21:18] council declar as a leite agency second [1:21:21] all in favor I um I'd like to to uh have [1:21:25] the city council refer this to the [1:21:26] zoning um the zoning change to the [1:21:29] Planning Commission so second all those [1:21:31] in favor I I and third I'd like to ask [1:21:35] um city council to call for a public [1:21:37] hearing on June 24th so second all those [1:21:41] in favor I thank you very [1:21:46] much the remainder of our items are in [1:21:50] executive session so all members of the [1:21:52] public will have to leave [1:21:55] so like motion to go executive session [1:21:58] so second all in favor thank you [1:22:12] [Music] [1:22:24] oh
