[0:00] some of the joining communities have [0:02] more restricted access to their [0:05] facilities some charge fees uh the city [0:09] has not done it and uh some of us were [0:12] approaching IT staffing level more of an [0:15] open mind uh it's a new facility it [0:18] really looks very impressive uh the [0:21] weather is also going to be slightly [0:22] warmer than we probably like so I assume [0:25] the utilization in the first days is [0:28] going to [0:30] uh T some of the limits to handle it and [0:34] then we'll just see how it goes uh from [0:38] that uh in terms of the actual hours and [0:42] Staffing but some of the fees other [0:45] access issues there still the prodct of [0:47] the city council and uh not like for the [0:51] Central Park pool but the uh rest of the [0:55] pools in the city or some of the other [0:57] uh facilities that we offer [1:03] who's [1:04] next yeah I was going to say yes it does [1:07] look beautiful and I think that um [1:09] really proud of this project I I would [1:11] say um sustainability of of the project [1:16] is going to be really key so I guess you [1:19] know what would be ideal for me and I'm [1:21] saying this without you know really any [1:23] um information to support at this time [1:25] to the m point we're going to there is [1:26] going to be a [1:28] level kind of seeing how things are [1:30] going and then being responsive to what [1:31] we see but um I you know my initial [1:35] thought would be not to charge residents [1:37] of the city but people who don't live [1:39] here who are coming here to you know to [1:43] will be there be some small fee there [1:45] that's probably not and I know that [1:46] happens in other municipalities um the [1:49] only thought thing would be I know it [1:51] cost the city uh something to enforce [1:54] those fees and like all like so I'll [1:55] just you know look at that cost benefit [1:57] piece there but that's what I would [2:01] be comfortable [2:03] with okay mfield so um do [2:08] we has the parks department come up with [2:10] anything that they' even considering um [2:12] what those fees might be and who would [2:14] be charged um is one of my questions and [2:17] the other part is there signage that you [2:19] know rules of the pool essentially is [2:22] that all in place for this weekend I [2:26] hope so you don't know hav been up to [2:30] look at they tell me the signages up [2:35] uh and uh currently we don't charge [2:39] anything Mr Farley's Point uh there is a [2:43] cost in terms of collecting that and [2:46] some of our neighboring communities are [2:48] far more restrictive in terms of access [2:51] to their [2:53] facilities and so we we'll consider [2:56] what's what's reasonable for us to do [2:57] but I have to agree that um to charge [3:00] residents I don't yeah people you know [3:04] um because people are really looking [3:05] forward to it and they're not looking [3:06] forward to like being sto at the gate [3:08] for a dollar whatever it's going to be [3:10] yeah I was I actually also would support [3:12] not charging residents I just wasn't [3:14] sure if we were going to have a [3:15] non-resident a non-resident fee but I [3:18] like the idea of you know opening and [3:20] see how things go um in terms of [3:22] Staffing are we all set with the [3:24] lifeguards and all that we will be by [3:27] the time we open okay and then oh Mr Toro yes [3:34] um so residents absolutely children free [3:39] um no charge um how do they prove [3:42] they're a resident folks don't have a [3:44] license and maybe they don't have a um [3:46] an ID where we looking for the for the [3:49] Youth to provide a student ID um to get [3:53] in because they might have one from [3:55] school so what happens um Saturday the [3:59] gates open [4:02] well it's up to the C yeah we have [4:05] generally used student IDs from the [4:09] school district in past summers for [4:11] access to Central Park Pool and the [4:15] other facilities assume that that's [4:17] going to continue okay City the past has [4:20] had a [4:22] recreation ID that was uh used for the [4:27] tennis courts the golf course and other [4:30] facilities that had uh shifted so that [4:35] even though there's fee structures on [4:36] the books for the ten courts those are [4:39] not collected uh the golf course set up [4:43] is where there is a fee structure that [4:44] is uh 100% enforced that becomes a self- [4:48] sustaining entity MH we used to get a a [4:51] photo at the place in Central Park where [4:54] the AL um we used to be able to get a [4:57] resident photo there for for the golf [4:59] course and other things that we were [5:00] participating in city um so say um you [5:03] know a young child shows up with their [5:05] mom and their mom doesn't have anything [5:07] this weekend can they bring the niag Mok [5:09] Bill I just thinking I sometimes you [5:11] bring that to um to the golf course to [5:15] prove you're a resident you know a bill [5:17] so I just you know want to make sure [5:19] everyone that's entitled to get in there [5:21] to swim this weekend and get in to swim [5:24] so well but this weekend we're not [5:26] asking anybody for anything right is [5:28] that correct okay [5:32] the having said that the Boys and Girls [5:34] Club is going to use the same procedures [5:36] that they used last year in Central Park [5:39] where they still have [5:41] to uh validate the number of people who [5:45] are actually in the pool area because [5:48] that dictates how many lifeguards we [5:50] have to have on duty and so they have [5:53] collected the student ID or some [5:57] counting procedure as people come into [5:59] the the facility and that will still be [6:02] used just as it was uh in Prior years [6:06] but we're not looking to restrict [6:08] anybody in terms of their access other [6:11] than there may be a quantity issue where [6:14] uh we would limit people because the [6:16] capacity has been exceeded to match with [6:18] lifeguards that makes [6:21] sense Mr Williams but I'd also like to [6:23] comment so to miss uh D Toro's Point [6:26] like of how do you manage that fee [6:27] structure and the collection of it I [6:29] don't know if I agree well I don't agree [6:35] but doesn't agree either I love that [6:41] quote my train thought with [7:46] we're looking more of early [7:48] morning no those are the public hours [7:52] there's some swim lessons that they have [7:56] scheduled before the opens the General [7:58] Public and in terms of security um we're [8:02] talking about um cameras and en personal [8:05] security is that will be available [8:11] yes okay um Mr Williams are you yep okay [8:17] so say I wanted to also just have a [8:19] reminder and correct me if I'm wrong Mr [8:21] Mayor uh the emphasis with using a [8:24] considerable amount of the or dollars to [8:28] create a new resource was to help with [8:30] the exploding maintenance fees to where [8:33] it currently was in [8:37] effect say that again where the tal Park [8:39] Pool currently was it was just a [8:42] difficult uh resource to manage just due [8:44] to the the the Aging filtration system [8:48] uh and among other issues with it being [8:50] closely uh near the some of the animals [8:53] that live around there so wanting to re [8:56] uh move it should help with [9:00] controlling some of those maintenance [9:01] and and preventative maintenance costs [9:03] in theory to some degree we basically [9:07] had no filtration system on the original [9:11] pool it was refilled every day it's our [9:14] ability to [9:15] generate uh very large quantities of [9:18] high quality water at a very low [9:21] price uh [9:23] so some of that uh will be reduced but [9:28] this pool [9:29] by its nature where you're recirculating [9:32] the water you do have filtration systems [9:34] better controls there will be uh more of [9:37] a maintenance issue in terms of people [9:40] monitoring uh the systems [9:44] and uh again there will be some upkeep [9:47] on those systems to maintain the high [9:49] quality of water and uh the overall [9:52] character of the [9:55] facility I think um one thing I just [9:58] want to add just from going up there a [10:00] few times this past week um remember [10:03] that part of the project also had to do [10:05] with the lighting and the roadway and [10:08] parking access um it looks like there's [10:11] about 36 additional parking spots I I [10:14] was trying to count them as I was [10:15] walking so I didn't get an exact number [10:17] but um the lighting is going to really I [10:21] just feel very significantly um increase [10:24] some safety um at night time in that [10:26] part of the that I mean this is just me [10:29] and anecdotally saying but I mean it [10:31] looks really great so I encourage folks [10:33] to go up there uh and check that out but [10:36] I just it's it's world class and mean [10:39] there's no doubt when you see it and so [10:41] I just really am hoping that whatever we [10:44] can do security wise um we'll you know [10:48] help keep the the buildings the bath [10:50] house is just fabulous looking um I [10:53] won't be here tomorrow I mean everyone [10:55] knows that there is a it's tomorrow [10:57] morning I believe is the uh ribbon f [11:00] um so I hope that folks can get up there [11:02] uh for that as well so Mr Williams so [11:06] I'd say two points one Mr Mayor if you [11:08] wouldn't mind speaking I've heard myself [11:10] I imagine it's the same for other [11:11] council members people have walked up [11:13] definitely uh laed at the new facility [11:16] it's going to be there and like that's [11:17] only parking there so I know this is the [11:20] first phase of the reconfiguration of [11:22] the park but then uh second I wanted to [11:25] just point out I know there have been [11:27] ongoing conversations now about security [11:29] I think part of it is also challenging [11:32] the community there are often times [11:34] comments of this is why we can't have [11:35] nice things and I want to ensure that [11:37] there's also an equal responsibility [11:39] placed on our community residents of we [11:41] can continue to make these Investments [11:43] not only in our Renovations of [11:45] properties throughout the building but [11:47] also making sure that the city is and [11:49] remains economically viable but if we [11:51] are are chasing ourselves with having [11:54] additional costs such as vandalism uh [11:58] that makes it difficult to continue [11:59] these types of efforts so I know that [12:01] there are preventive ways you go about [12:03] that IE surveillance cameras and also [12:05] with maybe increased police uh um uh [12:09] patrols throughout the area but but I [12:11] want to ensure to Mr um Farley's Point [12:15] let's let's see how it is and then [12:17] respond rather than putting in place [12:19] some safeguards that might not [12:20] necessarily be [12:22] needed yeah I think I think that's what [12:24] the mayor was um indicating in his [12:26] opening remarks that that would be what [12:28] we could trying to do so I appreciate Mr [12:31] Carly and Mr Williams following up on [12:33] that Mr Toro um and I'd like to up to [12:37] you of course your committee bring it [12:39] back in two weeks and think about how [12:40] we're you know my biggest concern is is Mom or Dad can't bring [12:46] me I'm Grandma's from out of town and [12:49] now she you know she so it's up to the [12:52] council you know to work on to decide on [12:56] how we're going to move forward with a [12:58] fee structure and and things like that [13:01] actually the fee structure part of it [13:02] should really come out of the its [13:03] administrative function so they it's [13:06] like with the golf course they we don't [13:07] create the fees they come to us they [13:09] create the fees and then we say you know [13:12] yes or no so really it would be the [13:14] parks department we don't really have [13:16] the capacity to do that it would really [13:19] need to be the folks who work here on on [13:21] a you know daily basis and you know [13:23] obviously we can provide suggestions but [13:25] creating the fees and all of that is [13:27] something that with this Administration [13:29] way to [13:30] function and how it's done with all the [13:32] other parts with the life cards with all [13:34] of that great other question well the [13:38] end result is solely the proga of the [13:39] city council so you know one example for [13:43] this swimming pool is it is now designed [13:46] for competitive swimming events [13:50] yeah those type of things may increase [13:54] our staffing costs or monitoring it so [13:57] do you want to have those free for City [14:01] students uh would there be a fee for any [14:05] group that's coming in doing a [14:06] competitive swimming event uh do we only [14:11] charge people outside of the city so [14:15] there [14:16] are things there again in terms of the [14:19] policy decision it's only the [14:21] prerogative of the council the policy [14:23] yes but like the fees I don't know how [14:24] we would you know or even how to how to [14:27] like do like with the boys and girls [14:28] club they came up with the process of [14:30] how people um show ID and and how to do [14:34] um and get in so because we hired them [14:36] to uh to do that [14:38] so I would think I don't know there's um [14:41] I know there's not a Parks director [14:42] right now but I'm assuming there's other [14:44] staff that would still be able to um you [14:47] know provide us with some gu guidance on [14:52] where we start with this I I think [14:54] that's a good suggestion um especially [14:56] when we start talking about tournaments [14:58] um and what will happen because again [15:00] it's restoration of the historic wall [17:29] at simons's Park um the project was [17:32] scoped uniquely where the city will be [17:34] purchasing and providing materials and [17:36] the contract is essentially for labor [17:39] only um so the idea is this uh the [17:42] company Jaan construction out of New [17:44] York um City they will be coming up and [17:47] Performing essentially masonry only work [17:49] to repoint um modify the wall repair the [17:52] wall and install pre-cast concrete caps [17:55] the city will purchase the preast [17:58] concrete caps and then the needed mortar [18:01] and uh grout for the for the project we [18:04] did meet with them on site uh we did [18:06] call five references because we weren't [18:08] familiar with them and um they seemed [18:12] like they they had their act together [18:13] they have worked for other state [18:15] agencies um they are working in almany [18:17] right now um it's a small family-owned [18:20] company uh they are an MBE company and [18:23] they're looking forward to doing work in [18:24] the city uh we actually took them into a [18:27] couple areas to look at other project in [18:29] the city because to have uh Masons is [18:32] something that is a skill that we we're [18:34] looking for for this kind of stuff so [18:36] we're comfortable awarding it uh the [18:38] price was competitive [18:40] and we'll see and this money is already [18:43] in the ARA line for this [18:47] project Mr can you just tell us a little [18:49] bit about the timeline for this work [18:51] well the timeline they are ready to go [18:53] because they're labor only so what we're [18:55] doing right now is I'm working with [18:56] Sarah and purchasing on the cat [18:59] what we were concerned about was the [19:01] costs we didn't want to order 420 caps [19:05] and then this number come in out of [19:07] budget and then we have caps and no [19:09] labor so uh we wanted to try to get it [19:12] so we have this number we already had [19:14] the quotes from a local company that [19:16] specializes in pre-cast and we don't [19:18] need 420 caps tomorrow we just need them [19:21] to start making the Caps so Sarah's [19:23] already contacted their person uh [19:26] earlier last later last week about [19:29] getting into the caps and then the other [19:31] materials are common shell materials so [19:33] right now we're just waiting on the [19:35] Caps well I I don't have a schedule [19:37] we're hoping fall I don't think this is [19:38] a project you want to do in the dead of [19:40] the summer because you know you're [19:42] exposed you're out and uh I don't I [19:44] don't think you know you want to do [19:45] something more 100 but if we can get [19:47] some of the caps on we're going to store [19:48] the Caps uh right next to C and's yard [19:51] there uh in stams and then just start [19:53] picking away at and working forward they [19:56] anticipate once they start it's going to [19:58] for the [20:15] northberry street Plum station exterior [20:18] so this is another uh harpa funed [20:20] project so as you're aware we have a new [20:22] northberry pump station uh that has put [20:25] the existing or the previous North fairy [20:27] Pump Station uh as a a abandoned city [20:30] facility the building is historically [20:32] significant and there was money approved [20:33] to make sure that it does not get into a [20:35] state of disrepair um the building is [20:39] okay presently but it's not great so [20:41] what the funding for this building is [20:43] essentially seal the envelope we're [20:44] going to be doing the windows similar [20:46] that we did at City Hall removing the [20:48] windows restoring the windows replacing [20:50] any Rock uh reglazing the glass putting [20:52] the back we're going to be replacing the [20:54] roof um the reason for the roof is that [20:56] the roof right now has over a dozen [20:58] penetrations for various Vents and [21:02] systems to come through because it was a [21:03] pump house we have the vent we're going [21:05] to remove all of those vents fill in [21:08] where we can with concrete steel and [21:10] masonry and then do one flat roof with [21:13] no penetrations so that will really seal [21:15] the roof off a lot better to go to the [21:17] parit we're going to remove all of the [21:19] stucko from the building cuz if you look [21:21] at the building the building is a series [21:22] of Patchwork cuz stuckle was put on in [21:25] various years so we're going to remove [21:27] all of the stuckle down to the masonry [21:29] block and then redo the stucco paint the [21:32] building so it'll look from the outside [21:34] like a preserved building the inside is [21:37] a different story but from the outside [21:38] it'll be weather tight and preserved and [21:41] I know that the Stockade Association is [21:42] working on lining up funding to try to [21:45] address the interior of building but [21:47] this money is for the exterior of the [21:49] building have we already done some work [21:51] on this and started this process any [21:53] work at all in the ex area no not not to [21:56] mind out as Paul might have years ago [21:58] but to mind know it's just it's there [22:00] it's just a building and once again is [22:02] one of the tricky situations that we're [22:04] trying to work with Stockade is the [22:06] reason that we built a new building or [22:08] one of the many reasons was is that that [22:10] building was determined to not be um [22:13] cost effective to flood proof because it [22:15] is in the flood plane so we built a new [22:18] building that is flood resilient um so [22:21] this is fine and I know that we haven't [22:23] had any issues there but making [22:24] significant investments into the [22:26] building will be a complex subject going [22:28] forward because that is why we abandoned [22:30] the [22:31] building okay any any questions all are [23:16] aware of this project I'm sure you're [23:18] all aware of in some part of me but it [23:19] is a rather older project um that was [23:22] done preco and it is something that we [23:26] have been pushing along slow and [23:27] steadily sense then due to all the [23:30] development really at Mohawk Harbor so [23:32] um just to go through I I'll be quicker [23:35] than this but we're going to I'm [23:37] presenting it here I'm hoping to catch [23:38] some publicity from possibly the the [23:40] paper just to get it out there what [23:42] we're doing we're going to have a public [23:43] meeting next week at the Landing which [23:45] is an official public meeting uh and [23:48] then hopefully from there you know we'll [23:50] get some input and then we're just going [23:51] to move forward with the process of the [23:54] project so the overview is um the city [23:57] receiv CFA br in 2019 for the creation [24:00] of a dot gameway in Plaza with path so [24:04] it says um the idea was to create an [24:06] access point to the river I don't know [24:08] if many people realize it but even [24:10] though we are a river front Community we [24:12] do not have any docks or points of [24:14] access to the river other than the parks [24:16] so it's kind of unique when you go to [24:18] other uh Riverside communities they [24:20] usually have docks and we do not um [24:22] there was a talk um several years ago um [24:25] about putting a dock in Riverside Park [24:27] but uh we ended up being controversial [24:30] people didn't want the idea of a dock [24:32] down there so this is a dock with an [24:34] Upland Plaza and I will get into the [24:35] location a little bit right here you'll [24:37] see the location is we have uh an arena [24:41] we have the future hotel which improved [24:43] um parking lot would be here parking lot [24:45] Arena and then that is our Plaza and [24:47] those are our docks and that is the RPI [24:49] research facility so as I'll get into in [24:52] a little bit there's a reason for all [24:53] the delay um the project 2016 we put in [24:57] some access [24:59] 2020 we got the grants with this concy [25:02] match of [25:03] 15% um that's typical on these kind of [25:06] projects you know [25:07] 855s uh City released to design an RFP [25:10] in 2021 after Co working with MJ and [25:13] what's called waterfront Solutions so MJ [25:16] is essentially handling all the Civil [25:17] work and then Waterfront Solutions is [25:19] handling the dot work they're a DOT [25:21] company they also did the harbor for G [25:25] um did a bath metric survey that is a [25:27] survey of the river read uh in 2022 the [25:30] project was paused and that was we we [25:33] rushed we got to a point and then it was [25:35] Aquatic Center I was like okay where's [25:37] the Aquatic Center going to go and it [25:38] was never mind not an aquatic center [25:40] arena it's like okay where's the arena [25:42] going to go so we actually had a spot uh [25:46] picked out and in South there I can show [25:48] you where we actually were going to put [25:50] the the docks here mhm um and we had a [25:54] plan laid out and then the arena came [25:56] forward and it was weight and so we [25:58] didn't want to move it anymore so we [26:00] waited until planning approval and [26:02] everything was set with the arena and [26:05] then we found out nice little spot in [26:07] the middle the Nic thing about this [26:09] location is that we are by a turnaround [26:12] we're by parking the glassi group is [26:14] said that that would be public parking [26:16] they will allow people during the day to [26:18] park there uh you know not event [26:20] notwithstanding but you know there [26:21] probably won't be event 24/7 and we are [26:24] directly adjacent to the Alo Heritage [26:26] Trail so this will both be a Overlook on [26:29] the trail and the landing and we'll have [26:31] parking and a drop off um you know be [26:34] honest this has to be publicly [26:36] accessible and probably get into that [26:38] but people who know the area I do not [26:40] see this going to be a full access dock [26:44] for recreational purposes the reason [26:46] being is of the gang way the gang way is [26:48] going to be quite long to get down from [26:50] the shore to the water and across the [26:53] street by the lighthouse if you're [26:54] familiar with the area it's the easiest [26:56] launch in the area there's nothing [26:59] easier than that you park you launch [27:01] it's 10 ft you don't go down the gameway [27:03] so I think that for people wanting to [27:05] see the river and be involved and be by [27:06] the water and fishing and all that but I [27:08] really don't think that people will [27:10] kayak and Hike their kayaks down and [27:12] things like that unless it's for the [27:14] novelty of it because it is it is a [27:16] slope um so the project the one stage [27:19] like we said is the plaza which we're [27:21] calling the plaza The Landing it's small [27:23] 5,000 ft it will have lights it will [27:25] have signs benches we are looking at [27:28] very attractive welcom is concy because [27:30] you have to understand that this is [27:32] going to be now a new entrance way for [27:35] the city this is going to be a Gateway [27:37] we are looking at you know people who [27:39] are called Loopers who come from all [27:40] around the country this is going to be [27:42] allowing them to stop and go to [27:44] connected so we really want to make sure [27:45] that we have a nice anchored site here [27:48] that shows you where they are also we [27:50] are talking with a Riverfront Cruise [27:52] company that does small Riverfront [27:54] cruises of 40 people on boats you know [27:56] we're limited by the locks so they would [27:58] come in so this this is something that's [28:00] important we're trying to make sure that [28:02] we're working and we're also [28:03] incorporating this into our dri wayf [28:05] finding because that also is going to [28:07] connect to downtown so there's a lot of [28:09] irons in the fire with this this will [28:10] have water this will have sanitary we [28:12] are not getting into fuel fueling is a [28:15] whole other animal we're going to allow [28:16] the yacht club in places like that to [28:18] handle fueling uh parking look say we be [28:20] at the um there's a better idea you see [28:23] the passenger drop off the trail and [28:26] then the U the area itself we are going [28:28] to have electricity you're going to need [28:30] a large Transformer we'll try to [28:32] landscape that make it as pretty as [28:34] possible these are some of the things [28:35] that we were looking at you know just to [28:37] say ventes that we are actually moving [28:39] away from the arch but they took a [28:41] picture of it we are moving away from [28:42] the arch style um one of the things to [28:44] point out is uh this one right here uh [28:48] I've been to marinas before uh my family [28:52] and that is something that we are going [28:54] to have to talk about and discuss going [28:56] forward is what is Public Access what is [28:59] not Public Access I'm proposing that the [29:02] docks are publicly available from a time [29:05] to a time and that it is posted and that [29:09] after a certain time it could be sundown [29:12] most likely uh the gate is locked and if [29:15] you have a boat there you're have a code [29:18] because one of the things that you're [29:19] going to see is if you actually look at [29:21] the river sometimes you will see million [29:24] doll boats multi-million dollar boats [29:26] and we want to make it safe environment [29:28] that somebody feels and the voting [29:30] Community is a very tight Community [29:32] especially with internet social media [29:34] forums uh we really are looking for it's [29:37] open it's signed it's a public amenity [29:39] and the sunlight come on down and then [29:41] at night time you know what we're going [29:43] to close it off we don't want people you [29:45] know down on the docks it is a little [29:47] tough to see we are going to have [29:48] cameras in security we are working at [29:50] getting a dock management company but I [29:52] just don't want you to think that is [29:54] something that we're looking at is uh uh [29:56] and it's very common at commercial [29:58] marinas with this type of public um so [30:02] the project just it's two projects it's [30:04] two contracts that's what we're saying [30:05] to Dock and it's a plaza so they're [30:08] awarded differently they'll have to be [30:09] progressed differently so we've already [30:12] talked with the permitting we've got a [30:14] lot of the permitting done this is the [30:16] secret portion we're now going to reach [30:17] out to all the involved agencies and [30:19] talk to them about making sure that [30:20] they're okay with it we have uh stamp [30:23] plans uh right now we're just going [30:25] through all of the finals on it for the [30:27] doc company [30:28] um and then we'll be done with seeker [30:31] and then hopefully we issue a [30:32] declaration later this year and then [30:34] we're out to bid like it says in August [30:37] we look in August we're going to have a [30:38] lot of manufacturing time because these [30:40] are custle very large docs uh and then [30:43] as it shows doc delivery and do [30:44] construction of next year we are one of [30:48] the things just to also point out that [30:50] we are struggling right now with [30:52] schedule and when docks go in and when [30:54] they wouldn't go in we are looking at if [30:56] we can get docks in in this June July [31:00] time frame it might make it worth it to [31:02] put them in next year the arena will be [31:04] substantially complete you're going to [31:06] be working inside but we do not want to [31:08] put docks in towards the end of the [31:10] season because it's a lot of work to put [31:12] them in you're using them for 3 weeks [31:15] then we close so the timing of it is [31:17] fluid of when we're really going to get [31:18] it in uh the plaza similarly Plaza a lot [31:22] of this is going to be uh driven by the [31:24] arena which is adjacent CU we don't want [31:26] to build a plaza and have a construction [31:28] site around it we like to do and the [31:29] hotel hasn't even started yet so we have [31:33] bi-weekly coordination meetings with [31:35] gesi and the hotel and these are the [31:37] things that we're tracking so right now [31:39] say it's a similar path but this doesn't [31:41] have as long as the lead time is [31:42] constructing of a dock uh and I guess in [31:46] conclusion I guess is just want to get [31:48] out there that we're going to have a [31:49] public meeting Wednesday the 26 4:30 at [31:52] the Landing Hotel we chose the Landing [31:54] Hotel because we were looking for a [31:55] place on site somewhere we're trying to [31:58] get people involved the problem with a [32:00] project like this is It's essentially [32:01] for transient people um you know the [32:04] people that will be using the facility [32:05] the most are not residents uh residents [32:08] will use it for fishing and things like [32:10] that but we do want to hear from people [32:12] so we're looking at having a public [32:13] meeting uh 4:30 uh at the landing and [32:17] then um like I said I think it's a great [32:20] project it's has a lot of fingers in [32:22] everything else um and I'm looking [32:24] forward to getting people's comments on [32:27] uh I the other thing that is it is [32:30] expandable um 360 ft is what we can [32:33] afford today if we find that the amenity [32:37] is used and utilized we'll have to look [32:40] at expanding uh the do you can expand it [32:43] uh to the north of the [32:45] river so [32:51] questions I think it's a terrific [32:52] project I mean I think it's something [32:54] that we've been waiting for you know in [32:56] terms of the initial design of the [32:58] entire Mohawk Harbor and um I'm excited [33:01] I'm very excited about it so looking [33:03] forward to seeing its completion and [33:04] there might be people in the apartments [33:07] down there that might want some of the [33:08] do space that are residents in other [33:11] words yep and so we were going to have [33:13] the meeting in the harbor house but we [33:15] thought if we had it there it would be [33:16] too convenient and we would overwhelm [33:17] their community room so um our our [33:20] partner our friends at gie and Metroplex [33:23] we arranging the the uh the hotel which [33:25] has a larger space for us to be able to [33:27] use and this is really going to be a [33:29] partnership project unique to what we've [33:31] ever done because the the city will be [33:33] the owner of the Docks but we already [33:36] have a memorandum of understanding with [33:38] the with the gesi group to help you know [33:40] operate the docks we're going to have to [33:42] store the docks these docks canot be out [33:44] in the winter time they'll be floated [33:45] and stored uh within the harbor we're [33:48] believing um you know we have uh the Dr [33:51] that we're working on like I said [33:52] Danielle's here for you know show the [33:54] support of Metroplex uh with these [33:57] projects and and uh I we really think [33:59] that it could be a great way to just [34:01] promote the city to the Waterfront [34:03] Community because we're just very [34:05] uniquely we're uniquely positioned on [34:07] both the river and the bike path and [34:09] this is the river and the bike path [34:11] together so that's [34:14] great s are you anticipating any [34:17] concerns from the public um I'm not I I [34:21] really don't [34:22] have because the way everything came [34:24] together uh the original plan like I [34:26] showed you when we were little more the [34:28] parking was a little farther away the [34:30] path was a little longer things were a [34:32] little bit but with the the new spot [34:34] where we are with the drop off and the [34:36] parking and the way it kind of [34:37] integrates into the site I I I really [34:40] think it's a it's a wi I really like it [34:43] um I don't see what people would I [34:45] haven't figured out what people would [34:46] push back on yet other than they don't [34:48] want big boats but you know they're not too noisy and they're in the [34:52] river so I and this is a commercial area got a [35:54] revised uh uh uh ordinance um the [36:00] comments came back Pur sooning to the uh [36:02] General Municipal law from the county uh [36:05] Planning Commission with their comments [36:08] and uh there were uh uh which are [36:13] highlighted in in the package I gave you [36:15] in red um and that [36:20] uh they just had a couple of questions [36:23] really minor minor revisions to the [36:26] overall text of the uh of the proposed [36:30] ordinance [36:35] um the uh minor edits and comments of [36:38] the pros ordinance were attached the [36:41] Reds the Reds uh were the items that [36:43] were deleted the yellow items are the [36:46] ones that were the suggested language um [36:48] they had a couple of questions in the [36:50] definition section um what was added [36:53] what was included in there is some uh [36:55] medical marijuana and another Mar want a [36:58] uh a definition they said it's not not [37:02] in the rest of the the code the reason [37:04] those were put in there in case you ever [37:07] want to build off of this particular [37:09] section of the code regarding cannabis [37:13] operations so those definitions are [37:15] already in there and that's how come [37:16] it's not referenced in there but in case [37:18] you ever want to build off of it [37:20] definitions are already included and [37:22] then in the last part of this the last [37:25] page uh dealing with the uh ammonization [37:28] um uh oversight on my part that language [37:32] came from our City Zoning code dealing [37:34] with adult establishments um that that [37:38] reference wasn't deleted it should have [37:40] been was deleted um regarding the issue [37:43] of amortization I know there was some [37:45] discussion on this on this the last time [37:48] and what it means is that if you adopt [37:51] this ordinance you the the vape shops [37:55] that are in those areas that you've [37:56] declared them not to be legal um would [38:00] have one year to wrap up their business [38:03] now if they wish to extend past that one [38:07] year then they would have to go to the [38:09] zoning board of appeals to prevent uh [38:12] financial information as to why this [38:14] would be a hardship and they they can't [38:17] abide by that onee uh deadline so [38:20] there's an appeal process through the [38:22] zoning board of appeals that language is from as I indicated from our zoning [38:27] code dealing with adult businesses so [38:29] that same type of appeal process is [38:33] already in our code and it's just placed [38:34] into this uh section regarding Vapes [38:37] shops smoke shops Etc in the alternative [38:40] if you just wanted to not get into that [38:45] and and just have these establishments [38:47] stay past that one year then they' [38:49] become a legal non-conforming use what [38:51] does that mean they can stay as long as [38:53] they're continuing an operation as a [38:56] vape shop but if if they vacated it then [38:59] whoever came in would not it's not zoned [39:02] for that particular [39:05] use so if you want you know it can be [39:08] the language there can be changed in [39:10] which it will become a legal [39:11] non-conforming use for after one year um [39:16] or on the alternative you know keep that [39:18] language [39:19] regarding mization in there uh for for [39:24] uh for it so it's really up you but it's your option I know there was [39:29] concern discussion last time so I just [39:31] want to flex that a little a little [39:35] bit so I I I do have a concern about you [39:39] know after a year saying you have to [39:41] prove that you're financially that you [39:43] need to stay here so um I essentially [39:45] think that's that's that's an [39:47] opportunity for us to put people on the [39:48] business where they currently are if [39:50] they're there legally so um I I have [39:53] concern about that and I think that I'm [39:55] just to have them stay with the um then allowing them to be there and [40:00] not have to come before the zoning board [40:03] every year is is the way that I would [40:05] prer that we approach this particular um [40:09] uh situation with these establishments [40:11] but obviously input from the other [40:13] council [40:17] members I mean the language we could use [40:20] I mean if we wanted if you wanted to go [40:22] down that route and delete that [40:23] particular portion it would be that all [40:25] such facilities or establishment [40:28] lawfully actually operating open to the [40:30] public on the date of the adoption of [40:32] this particular order shall be permitted [40:34] to continue as a legal non-conforming [40:36] use and all others will be declared [40:38] unlawful prohibited so and our Zone law [40:42] deals with nonperforming uses and what [40:44] if they're discontinued [40:47] it it would if there's a discontinuance [40:50] if it's not continuous operating then it [40:52] would revert to it would be a [40:54] non-conforming use the new outfit [40:58] Mr Williams So to that point is the [41:00] non-conforming use extended to the [41:02] business or to the business owner youan [41:04] if the business no it's the business a [41:06] jobs or meant to to like a singular [41:09] business it's the type of business [41:11] that's gone in [41:12] there it's it's the type of business and and in the definition the definition [41:19] section covers all that so I I know it's [41:25] it would be the type of business okay [41:28] thank [41:31] you so suggestion is to keep the current [41:34] language that we have we're not putting [41:36] them out to business it's just they will [41:37] have to move up the year into so approve [41:40] the approved area that is zoned for this [41:43] so I think there is opportunity for them [41:44] to kind of like work until they are [41:47] ready to move into the approv area [41:50] and that is own for for V and smoke [41:55] shops so I I think what comes into play [41:58] here is how many vape shops are there [42:01] how much room is there in these um in [42:04] these approved areas because we have a [42:07] there's a distance right they they have [42:09] to stay apart so if we're limiting the [42:12] area and within that area we're limiting [42:15] the proximity that could impact [42:17] businesses if there's enough businesses [42:19] like and then we run out of space what [42:21] happens to those individuals so those [42:24] you know are are also part of my [42:25] concerns because if we do that and [42:27] essentially somebody would have may have [42:29] to go at business [42:31] so well they're allow to for a year [42:36] extension they would have to they would [42:39] be allowed to operate from one year from [42:41] the from the when you adopt this [42:43] ordinance say July 15th or whatever one [42:48] year they can continue after that one [42:50] year if they wish to remain in business [42:54] um a form would need to be developed for [42:56] the go before the zoning board of [42:58] appeals for them to demonstrate [43:00] financial hardship as as to why they [43:03] should be allowed to operate for a [43:05] period of time after the end of the [43:08] after the after that uh oneyear period [43:11] in their current position in their [43:13] current [43:18] position well last count there were 39 [43:21] smoke shops um in the city plus we know [43:25] that more have developed and popped up [43:28] and um don't have proper um you know AR [43:32] aren't properly documented on the books [43:35] to even operate so I noticed one the [43:37] other day with with the windows were all [43:39] sealed up and it's got a big sign in in [43:41] the window 8m but it's the dragons or [43:44] it's a smoke shop but anyway um so I I'm [43:48] in in in agreeance with to leaving it [43:50] that you know they'd have to come before [43:52] the board of appeals to uh keep their [43:55] position uh if they can prove it's [43:57] hardship but other than that as far as [43:59] um we we don't need six in one block um [44:02] so I I do like you know how things are [44:04] going to be um stated in the moratorium [44:07] I'm I'm sorry I'm off for small business [44:09] I'm a small business but um you know we [44:12] have we have a lot of Youth out there um [44:14] that are walking by these smoke shops [44:16] and and I'm just not in favor of them um [44:19] there's more than enough places that [44:20] they'll be able to establish their [44:23] business I don't know if there's nor [44:25] than enough places I don't know have if [44:26] we've done what the what if we moved all [44:28] 39 to this to what's to what's would be [44:32] available um to what we're zoning it for [44:34] I don't know that there's enough place [44:36] so I I do have that concern about [44:38] someone not being able to I [44:40] don't not being able to um to continue [44:43] with their business whether it's a [44:45] business that I approve her or not [44:46] that's not really why I'm here it's it's [44:48] if it's a legal business and they're you [44:50] know it's something that they can even we agreed on the fact that [46:24] you know whatever they want to put in [46:26] their shop or or you know the 40% was [46:29] you know we didn't have an issue with them you know keeping that at 40% [46:35] um you know they have a shop they can [46:38] sell everything legally in there [46:39] whatever they want and whoever's going [46:41] into the shop is going in there for a [46:43] specific reason anyway um for products [46:46] and so I don't think there was an issue [46:49] with the percentage of of the space [46:51] inside the building what they could [46:55] sell yes [46:57] so they were suggesting the members from [47:01] the zoning [47:02] board Planning Commission [47:05] 25% is that no they never gave a number [47:09] the other localities have gone down to [47:12] 20 20 25% that was just as a as a [47:15] reference point but I don't think we did [47:18] not get a hard number from the uh City [47:21] Planning Commission Co So currently it's [47:23] 40 it's 40% in the essentially have businesses [48:40] continuing on without making any [48:43] adjustments I don't understand the [48:45] question well we're highlighting wanting [48:48] to adjust the behavior so I applied for [48:51] a [48:53] non-conformance to not have to like [48:56] alter we business yeah you would what no [48:59] what you're saying to the Zone board of [49:01] appeals I'm at this [49:03] street the the deadline has come down I [49:06] have in I I've invested x amount of [49:10] dollars into this therefore I feel that [49:13] it I should expend more I should the [49:16] deadline should business [50:41] there prior to when you accept it's had [50:45] the moratorium put in place back in [50:47] March the legal businesses right [50:59] so that seems to be the only sticking [51:00] [52:50] not they're not uh operating in [52:53] compliance with what the you know City's [52:55] rules expectations are and and this [52:59] moratorium was to kind of stop the from [53:02] popping up all over the place where we [53:03] can manage what was in front of us right [53:05] like so that okay right um and and with [53:09] that so mayor in terms of the [53:11] enforcement and for those that are legal [53:14] versus illegal do we have any type of [53:16] update on the on of the 39 is what M Tor [53:19] says but I kind of think your number's [53:22] [Music] [53:24] low uh seen an abide by those rules [59:08] so I just wanted to add that [59:10] statement um so that there's some level [59:13] of enforcement if that's the term you [59:15] want to use so they're right there [59:16] before you as they currently stand but [59:18] just adding number 17 that says by [59:20] signing up to speak that you agree to [59:23] adhere to the the Corum of the council [59:28] meetings so maybe add that to the sign [59:31] up um sheets well the sign up sheets [59:33] already have all of these on here but [59:36] that statement yes and just adding that [59:38] to what's already there State [1:03:03] consequences um and I think yeah I I [1:03:06] agree and I think that it's important [1:03:08] that we you know um let people know what the expectation is but um I am with [1:03:15] as Mr barley I'm kind of like want to be [1:03:17] careful of the over [1:03:21] policing yes Mr Farley some I mean [1:03:24] because some of the language I mean even [1:03:26] though I think that we might have a [1:03:28] pretty clear well at least a we might be [1:03:31] able to build consensus around what we [1:03:33] think is vulgar or inflammatory you know [1:03:35] I think that something that you do [1:03:38] really well is if if people seem to be [1:03:40] Crossing that line you remind them and I [1:03:42] think that what usually happens from [1:03:44] what I have my experience when someone [1:03:47] says something um that might be closely [1:03:50] getting ready across that line you [1:03:51] address them and then they uh are more [1:03:55] mindful in their words and I think that [1:03:57] that's important because I think they [1:03:59] want put something on paper saying if [1:04:01] you do this then this is the consequence [1:04:04] or maybe to some people some of the [1:04:07] things that they might be saying might [1:04:09] not be inflammatory and or threat right [1:04:12] we might perceive them differently so I [1:04:13] like that at least [1:04:15] that kind of uh guardrail of you just [1:04:19] saying hey that's you're you know you're [1:04:22] getting close to this thing so I just [1:04:23] think that that's important too and I [1:04:25] think that that might have to be in some [1:04:26] language as well because that is really [1:04:29] that might just be something that you do [1:04:31] as you know as a matter of practice and [1:04:32] not necessarily a matter of policy so I [1:04:34] know we're talking about policy [1:04:38] here well again I think that it looks [1:04:41] like five of us agreed to this um not [1:04:43] saying that we wouldn't ever change our [1:04:45] minds but um we we did vote for this and [1:04:50] you know it's it's pretty clear in terms [1:04:52] of the language that's that's that's [1:04:54] here and I agree that I think the [1:04:57] council president um as you did last [1:05:00] week for example you opened the meeting [1:05:02] really kind of reminding people about um [1:05:06] the public comment period um and then [1:05:10] did you know kind of uh what's the word [1:05:13] I'm looking for Marshall uh the [1:05:16] discussion um so I think that that's I [1:05:19] think what you're saying as well that um [1:05:21] you know we do have that ability for the [1:05:23] council president um to [1:05:26] make an announcement and then you know [1:05:29] has the timer and has the ability to I [1:05:32] think you've you know many times have [1:05:33] said director comments here you have you [1:05:36] have different statements or the council [1:05:38] president has different statements that does sort of keep the [1:05:42] conversation going within you know [1:05:45] appropriateness appropriate [1:05:47] guidelines so I'm I'm fine with just [1:05:50] sing that one if um once we um make sure [1:05:53] that it's legally um okay okay did [1:05:57] you yes Mr yeah Madam president just a [1:06:01] question when you know they would be [1:06:03] free to sign it or not sign it in other [1:06:06]
