commissioner for [0:37] Ferrari thank you council president uh [0:39] city council mayor uh we like to start [0:42] uh tonight with uh u a review of the [0:45] audit uh we have John Kowski from kuak [0:48] and Company Auditors of the who audited [0:51] the city's conected financials uh for [0:53] 20123 and uh uh we're going to have John [0:56] come up and explain the audit and what [0:58] he's done and uh how everything looks [1:01] and hopefully uh uh you guys can have [1:03] some questions as you go along okay I'm [1:06] going to turn it over to John [1:09] John uh I just wanted to start off by [1:12] saying thank you to um the mayor city [1:14] council and um everybody who help us out [1:16] during the audit um really appreciate [1:18] everything they did to help us complete [1:19] the audit um we have great staff here [1:21] very well qualified uh really good [1:23] people and really appreciate everything [1:25] that they did for us um so our ultimate [1:28] responsibility for the audit is to to be [1:30] able to issue an opinion in your [1:31] financial statements as to whether [1:33] they're materially stated and whether [1:34] they're in compliance with generally [1:35] accepted accounting principles otherwise [1:37] known as Gap so our audit takes place in [1:40] three main phases um the first is our [1:42] pre- audit phase which takes place in [1:44] December so during this time what we do [1:46] is we review your internal control [1:48] processes um we test those internal [1:50] control processes we perform variance [1:52] and budget analysis uh review council [1:55] meeting minutes and complete our [1:56] internal risk assessment [1:58] procedures um the next next is our audit [2:00] field workk phase this takes place in [2:02] mid March uh we use this information [2:04] gathered um to develop our audit [2:06] procedures our audit programs test [2:08] account balances um to U verify if they [2:11] appear materially stated the third is [2:14] our reporting phase where we review the [2:16] financial statements prepared by your [2:17] senior accountant and um report on the [2:20] final results so the financial [2:22] statements that you have in front of you [2:23] our 77 page document overall it's [2:26] comprised of several major parts the [2:28] first major part is going to be the [2:30] Management's discussion analysis on [2:31] pages 1 through 7 thises a required un [2:35] audited section of financial statements [2:37] so what this does is it summarizes the [2:39] operating results and other financial [2:41] highlights of the year if you're [2:43] unfamiliar with the financial statements [2:44] this is an excellent read uh Pages 8 [2:47] through 10 that's your independent 's [2:49] report where we issue an opinion on your [2:51] financial statements [2:53] um it is important to note that your [2:56] financial statements are on the fund [2:58] level only fund and account grp level [3:00] only exclusive of the non-current [3:02] governmental asset account group we are [3:05] pleased to say that we [3:06] have we have once again issued [3:09] unmodified opinion on your financial [3:10] statements the highest L insurance we [3:13] can give you it's considered a clean [3:14] report we have no report of issu with no [3:16] CL so Pages 11 through 13 these are your [3:19] governmental fund balance sheets and [3:21] statements of revenues expenditures and [3:23] changes in fund balance approximated [3:26] operating results for the year end of [3:27] December 31st 2023 general fund balance [3:31] was unchanged due to the ARA loss [3:32] Revenue water fund had a surplus of [3:36] 323,000 sewer fund had a surplus of [3:40] 136,000 recreation fund had a surplus of [3:43] 4,000 a special grants and revenue fund [3:45] surplus of [3:47] 13,000 and your capital projects had a [3:49] surplus of 26 million uh due to the [3:51] proceeds from seral Bond issuance and [3:53] band redemptions so highlights of the [3:56] 2023 general fund activity and these are [3:58] all approxim figures uh prior year tax [4:01] Le collected F below Expectations by 772 [4:04] th000 casino revenue exceeded [4:06] expectations by [4:08] 54,000 property sales fell below [4:10] Expectations by 1.7 million uh sales tax [4:14] revenue exceeded expectations by 2.3 [4:16] million insurance recoveries these [4:19] exceeded expectations by 753 th000 uh [4:22] don't use cannabis revenue for the year [4:24] was [4:25] $531,000 for new Revenue source for 2023 [4:28] Street opening permits these fell below [4:30] expectations [4:31] 78,000 and the federal arpa funds that [4:34] were utilized $8.9 million for the year [4:37] 6.5 million of which was used for the [4:39] loss Revenue [4:40] calculation um overall we feel that [4:42] management does a really good job with [4:43] your reserves uh general fund balance is [4:45] $18.9 million a year ended 6.5 million [4:49] of that is restricted funds and the [4:52] detail for these account balances is on [4:54] pages 52 and 53 the notes of financial [4:57] statements band borrowings increased by [4:59] 5.7 million to fund capital projects [5:02] your New York State EFC borrowings $28 [5:05] million converted to long-term [5:12] serons there was an increase of $48 [5:15] million in the city's net pension [5:17] liability this is for underfunded ERS [5:19] and pfrs balance of year end was a [5:21] liability of 9.9 million from ERS and a [5:24] liability of 42.9 million for pfrs total [5:28] opad liability other post employment [5:30] benefits this increased by $43 million [5:32] to $294 million these valuations are due [5:36] to gby savings 68 and 75 which require [5:39] the acral of pension assets and [5:41] liabilities and the other post [5:42] employment benefits on actual valuations [5:46] custodial fund is required by gas State [5:48] M 4 this includes the property taxes [5:50] which are collected for other [5:51] governments not yet remitted Pages 16 [5:54] through 58 of your financials these are [5:56] the foot notes of your financial [5:57] statements if you're not comfortable [5:58] with the face of the financial [5:59] statements or you wanted more detail as [6:01] a significant account balances or [6:03] material account balances on the face of [6:04] the financial statements the notes are a [6:06] very good read overall Pages 66 through [6:09] 77 this is your federal single audit [6:12] since the city expended more than [6:14] $750,000 of federal funding you are [6:16] required to have it's called a federal [6:17] single audit um Federal expenditures for [6:20] the year were $29 million overall so as [6:23] part of this Federal audit what we're [6:24] require to do is uh rotate your major [6:26] programs every 3 years major programs [6:29] for this year the Community Development [6:30] block grant uh the home Grant and also [6:33] the ARA funds as well um your ARA funds [6:35] are required to be obligated uh for [6:38] expenditure by December 31st 2024 and [6:41] must be expended by December 31st 2026 [6:44] there are currently $31 million um still [6:46] remaining of your AR funds to be spent [6:49] um from an overall accounting and [6:50] control standpoint we feel like your [6:52] staff does a really great job a really [6:54] great team here a lot of strong people [6:56] um they were very helpful during the [6:57] audit um if there was any questions at [7:00] this point you know on the audit process [7:01] that was just a brief overview of the [7:03] financial highlights and questions on [7:05] the audit process or the audit in [7:07] general financi statements i' be happy [7:09] to take at this point could you just go [7:11] over again about the liability that you [7:12] talked about 9.9 million liability [7:15] increase sure for the um underfunded ERS [7:17] and PFS so those evaluations are so ERS [7:22] and PFS are under gaser number 68 the [7:25] state has an actal evaluation done and [7:27] what they do is they have to report to [7:29] us whether whether we have if they're in [7:30] an asset situation or a liability [7:32] situation for over funding or [7:33] underfunding both of those um pension [7:36] systems are underfunded which [7:38] essentially means that they have a [7:39] liability that that is allocated on a [7:42] prated basis to each municipality that's [7:44] part of that system so in theory as of [7:47] 123123 should those systems fail in [7:50] theory the city would owe 9.9 million [7:52] for R and 42.9 million for place in fire [7:55] we know that would never happen there [7:57] safeguards in place but gby statement 68 [7:59] does require that that is placed on in [8:02] the long-term Deb fund as a [8:04] life and that's the same with gas St 75 [8:07] for the other post employment benefit [8:08] benefits that's a liability as well [8:11] that's going on an Actuarial basis so [8:13] the actuary provides a report that says [8:15] you know this is your projected [8:17] liability based on our our inputs and [8:20] outputs into into this calculation at [8:22] that given time so I know those numbers [8:24] seem really massive you know n it's kind [8:27] of scared up some but they the lack of [8:29] term can be considered paper liabilities [8:31] where they're not going to be funded [8:33] they cannot be funded but ultimately [8:35] those are valuations that have to be put [8:37] onto St thank you so question you said [8:41] uh that part of the federal audit [8:44] process that you have to rotate three [8:46] major programs what do you mean by that [8:48] so every so your major programs are any [8:50] programs that are over $750,000 or meet [8:53] certain risk criteria so if that AUD if [8:56] that program was audited in the previous [8:57] year it was over 7 50 we had findings we [9:00] then have to audit that program again so [9:03] every third year so essentially like um [9:05] like your Le Grant you spend more than [9:07] $750,000 a year that Grant this year but [9:10] I audited that program last year without [9:12] any material there was no findings no [9:14] significant efficiency so I did not have [9:16] to once again audit it this year as well [9:18] the arpa program is so large that we [9:21] consider a higher risk from our [9:22] standpoints our internal risk assessment [9:24] says this is a brand new program very [9:26] high dollar amount we're going to audit [9:28] it every year in regards of what we can [9:30] or cannot do so I that's kind of from [9:32] our our our side what we're doing our [9:34] risk assment that program [9:41] okay so I had a question and I imagine [9:44] your report gets more detailed uh just [9:46] wanted to confirm you said Pages 52 and [9:49] 53 give that assessment of the balances [9:51] uh and I imagine that gets into uh how [9:54] our rating as a city is [9:56] outlined I'm sorry your rating or I [9:59] think there's like a like a the bond [10:02] rating so the bond rating is discussed [10:04] in the Management's discussion and [10:06] Analysis the details of the actual fund [10:08] balance with all the different funds [10:10] that's going to be on pages 52 and 53 so [10:12] you can see how much is restricted what [10:14] it's restricted for if there's [10:15] incumbrances details of all those [10:18] different [10:22] balances um you mentioned um the arpa um [10:25] loss Revenue $8 million that was set [10:28] aside and we only use [10:29] $6 million does that mean that we have [10:32] $2 million available we're using it 24 [10:35] now yeah well I was going say there was [10:37] even more than that so it was I think [10:40] Tony I think it was $1 million in total [10:44] but we use six six a change this year [10:46] and then the rest of it is budget for [10:47] next [10:53] year anyone else [10:56] no we said the audit went very well [10:59] thank you all for having me here tonight [11:00] and if see a similar situation [11:29] is we did last we get to the budget we [11:31] kind of have an idea where we were [11:33] financially and how things are going so [11:35] M Ferrari is here [11:38] today just kind of go over it um where [11:41] we are with our [11:42] Revenue EXC are you going to vote to [11:46] adopt please for the audit to accept the [11:48] audit accept the audit yes but um but [11:51] let's just do that under government [11:53] office because I usually do it in a [11:54] committee so let's do it there [11:59] you want me to go ahead or you yeah [12:01] we'll do that in government Ops I'd like [12:03] to present D who's going to present our [12:06] first quarter uh [12:09] uh details for you [12:13] dere thank you so we're just going to [12:17] review the first quar report for the [12:18] fiscal year [12:19] 2024 uh I'd like to start with the [12:21] general fund um start off on a positive [12:24] note uh the city's connect uh did [12:27] increase its rating from an A to an A+ [12:29] after completion of the official [12:30] statement and interview with our S&P [12:33] experts um from operational standpoint [12:36] uh based on the original adopted budget [12:38] through March 2024 the city has attained [12:40] 40% of its projected general fund [12:42] revenue and expending 22% of projected [12:45] general fund expenditures uh during the [12:47] same period of 2023 the city had [12:49] attained 41% of projected revenue and [12:52] expended 23% of its projected [12:54] expenditures um some of the budget [12:56] concerns for the general fund are in [12:58] certies health insurance cost um there's [13:02] 11% increase from 2023 to 2024 this is [13:06] in the same period from January through [13:08] March uh vehicle repair budget um has [13:11] increased by [13:13] 68% uh compared to [13:15] 2023 um tipping fees increased by [13:19] 107% uh compared to 2023 the waste [13:22] recycling perm salary increased by [13:25] 28% um Public Safety overtime cost [13:29] um respectively the PD has increased by [13:32] 5% compared to 2023 and again this is [13:35] from January to March of 2024 the fire [13:38] department increased by 16% during the [13:41] same time period um there's only one [13:45] meeting contract which has not been [13:47] settled which is on tonight's agenda uh [13:50] the PBA uh for [13:52] 2024 um the golf fund uh from an [13:55] operational standpoint based on the [13:57] original adopted budget through March [13:58] 24th the city has obained 2% of [14:01] projected golf fund revenue and expended [14:02] 7% of its projected golf fund [14:05] expenditures through the same [14:07] period two and seven correct correct 2% [14:11] for Revenue 7% for the expenditures 2024 [14:14] uh compared to 2023 the city attained 2% [14:17] projected revenue and expended 20% of [14:20] its projected excuse me projected [14:24] expenditures uh the expenditures for [14:26] 2023 are due to higher typ type Capital [14:30] reserves expenditures compared to the [14:32] same period in 2024 the length of the [14:34] season will um definitely um influence [14:37] the financial outcome of the golf fund [14:39] um right as of now there are no budget [14:41] conserns in [14:44] 2024 the water fund uh from an [14:47] operational standpoint activities in the [14:49] water fund are closely tracking those of [14:51] 2023 raising no budget concerns at the [14:53] present time based on an original [14:56] adopted budget through March 2024 the [14:57] city has obtained 58% % of his projected [15:00] Revenue spended 28% of projected [15:02] expenditures through the same period of [15:04] 2023 the city has attained 67% of his [15:07] projected revenue and expending 19% of [15:10] his projected [15:11] expenditures the revenues are down in [15:13] 2024 due to the time of issuing uh NIS [15:16] Uno water [15:18] bill uh which is uh approximately [15:23] $648,000 the expenses are up in 2024 due [15:26] to early use of water repair line of [15:30] approximately 455,000 in [15:33] 2024 the sewer fund from an operational [15:36] standpoint based on an operational [15:38] adopted budget through March 2024 the [15:40] city has obtained 63% of the projected [15:43] sewer fund Revenue expended 16% of its [15:46] projected sewer fund expenditures [15:48] through the same time period of 2023 the [15:51] city has attained 62% of its projected [15:53] Revenue expended 18% of its projected [15:55] expenditures use of type Capital [15:57] reserves is much higher at this point in [15:59] 2024 then the same period in 2023 by [16:02] approximately [16:04] 66,000 so the finance department will [16:06] continue to monitor the numbers and [16:08] Report City Council on a quarterly basis [16:10] um are there any questions at this [16:15] point um thank you for the breakdown [16:19] looking for clarification you said the [16:20] vehicle repair increase uh are you able [16:23] to differentiate between like rou [16:25] maintenance and then just [16:27] acents uh the vehicle pairs parts and [16:30] bringing it to um uh broad shop to get [16:33] the repair um I think most of that is do [16:35] the inflation the parts supply and [16:38] demand um so we're definitely seeing [16:40] that [16:42] up so just your you're not you're [16:46] suggesting that's probably just because [16:47] the increase of Parts not necessarily [16:49] like more vehicles are breaking down or [16:51] there's an increase of things like that [16:53] could be potentially B of Aging Fleet [16:56] and um you know just Supply and and then [16:59] as we know inflation with the cost of [17:01] pair and you know getting those uh parks [17:04] that [17:06] from um you also said there was 11% [17:09] increase in for our healthcare costs [17:12] yeah yes um well that's compared to [17:15] 2023 um it's going up um we I think we [17:19] showed you guys in the past and the [17:21] council wanted to cut um I that's [17:24] approximately a million dollars at one [17:26] point but um it's just you know the way [17:28] the market is [17:29] point I think can speak more towards [17:35] that on the health side uh during the co [17:38] period from 2020 to 2023 actually uh [17:43] because of the co outbreak our our uh uh [17:47] fees for uh Health had steady and [17:51] actually gone down but as as uh 2023 [17:54] emerged especially at the last uh [17:56] quarter the last half you know people [17:58] started going back to the doctors we had [18:00] a lot more babies and starting to say we [18:03] have a lot more people getting sicker um [18:06] and than you know than we we we wish to [18:10] uh in 2024 we saw that uh last quarter [18:13] of 2023 move increasing as you can see [18:16] 11% more more people are going to the [18:18] doctors more people are getting [18:20] treatments and more people are getting [18:22] uh work done so uh uh the the price of [18:27] uh the price has G on up but you know I [18:30] I always like to say that uh because we [18:32] have such a great uh uh health benefit [18:34] here at this concy you know we're proud [18:36] that our workers are are covered so well [18:38] so it's it's it's give it costs more [18:41] money but you know we're giving a really [18:42] good product to our our [18:51] employees so you have a 2023 completed [18:55] year and now this year at this point in [18:57] time what areas or line um expenses that [19:01] we should be concerned of that we may I [19:04] think I mentioned a bunch of them I [19:05] think those are definitely you you a [19:07] look out for um we could do another that [19:11] sorry top three top three um health [19:14] insurance is definitely one of them um [19:18] you know with the overtime cost possibly [19:21] PB and uh PD and fire department um you [19:25] know the council did cut uh from this [19:27] past budget year [19:29] um you know this first quarter is really [19:31] hard to tell at this point we'll have a [19:32] better idea in the second and third [19:33] quarter where we're going to sit um so I [19:36] think about a month or so we'll have [19:38] another discussion uh for a second [19:40] quarter have more updated numbers [19:43] thanks um in terms of the vehicle [19:45] repairs um 68% increase do you think [19:48] that that might have been um lessened [19:51] had we been able to vote in our last [19:53] budget about going to the um going [19:57] internal with our vehicle repairs which [19:59] I think was what you guys had presented [20:01] to us in the budget but was rejected by [20:03] the council I I thought that we if I [20:07] recall correctly went through Oh I [20:09] thought we um went through yeah I think [20:13] think it took a while be work on in our [20:17] in our group now okay but we did keep [20:18] that guy on overnight okay Sor that's [20:22] also an increase but we're also thinking [20:23] one work [20:25] time cuz I thought you said something [20:27] about sending the vehicles out just just [20:29] now when you're talking to I was I no I [20:33] I was asking is is it due to the [20:35] increase of cost of price part we do [20:39] both we do both Miss Patrick [20:44] okay but to her point I thought that was [20:46] going to kind of uh that was supposed to [20:48] cut our our cost as opposed to as now [20:52] doesn't seem like it necessarily yeah I [20:54] think like I said it took a while to get [20:56] someone in that position oh I don't [20:58] think we're really seeing the fruits of [21:00] the labor yet so okay maybe in the [21:02] second third quarter we'll actually see [21:03] you know that decrease [21:07] okay thank you Mr waves uh I know kind [21:11] of referencing our last budget cycle I [21:13] know a point of contention or just an [21:14] area of a lot of discussion was around [21:16] the uh uh overtime budget related to the [21:19] police department and fire department um [21:21] I don't know if it's related but I do [21:23] see both uh Chief Clifford and chief [21:24] Marina here in in tonight I don't know [21:27] if either are available but I would love [21:29] to hear from their respect if there's [21:32] been any uh alteration in their [21:34] responses to Public Safety which was uh [21:36] a comment or series of comments I heard [21:38] frequently from the community I know as [21:40] you mentioned this is just the first [21:41] quarter but there's a question that I [21:43] will be asking throughout the year just [21:45] has there been any uh admin or altered [21:49] responses due to the uh or due to the [21:53] way we budgeted over time that makes [21:55] sense I'm not sure if the Chiefs are [21:57] ready to present there's time for that [21:59] and maybe they'll come in next commit [22:02] cycle to discuss that forther with [22:04] you did did you hear the question did [22:06] you hear the [22:11] comment I can speak in [22:14] general come [22:15] [Music] [22:22] on I know your fingers on the PST of [22:25] this all the time so I know your fingers [22:27] on the PST of this all the time [22:29] so you want to understand the [22:32] question U so just to repeat myself um [22:36] throughout my conversations I've heard [22:38] and also it was a comment that was [22:40] consistently repeated that any uh [22:42] adjustments that were made to the [22:43] recommended budgeted lines for overtime [22:46] would have a negative effect to your [22:48] ability to respond to events throughout [22:50] the [22:51] community so my question is have you had [22:54] to alter your response due to the um to [22:58] what money was allocated to over time no [23:01] not at this [23:02] point uh we have minimum Staffing of 20 [23:07] uh we put 20 on the street every day we [23:10] answer every call that comes in uh like [23:12] normal and the money is there now to pay [23:16] for all the overtime what happens in the [23:19] third and fourth quarter is yet to be [23:20] seen that's why I was so passionate and [23:23] adamant for that figure that we [23:26] presented um as a the first [23:30] quarter [23:31] the amounts that we were looking at we [23:35] were right on target for that amount [23:37] that we [23:38] requested uh now if we remain at that [23:42] we'll see we're definitely not going the [23:45] other [23:46] way [23:53] you similar response um I think it's [23:57] fair to say that the first qu for the [23:58] police department is always the least [24:00] expensive for us seems like uh weather [24:03] is usually Cooperative from the first of [24:04] the year until uh you know April May and [24:09] uh we we do a lot less proactively more [24:12] responsive so we really didn't you know [24:15] we we we we really didn't do much [24:17] different than we normally do um but we [24:20] do expect that with the summer months [24:21] upon us now we have more that will be [24:24] busier we'll be putting more assets out [24:26] there as the certain holidays come [24:28] around Fourth of July so we will expect [24:31] it to be probably a higher percentage [24:33] than the first quarter for our overtime [24:35] spending thank [24:39] you any other [24:42] questions okay thank you very much and U [24:45] we'll see you for the second quarter [24:47] absolutely I'm sorry no just mooving [24:49] your glasses around yeah oh mayor the [24:53] uh just [24:56] the the uh try light my word choice uh [25:01] last year's budget process was somewhat [25:03] of a debacle said trying to avoid that [25:05] this type of information has always been [25:08] provided to the council we had generally [25:11] made public comments at the adoption of [25:13] the budget we would go back and look to [25:16] change the code in the charter where [25:18] today it reads that the mayor submits it [25:21] by October 1st the council adopted by [25:23] November 1st uh there were some opinions [25:27] granted that there were [25:29] no impact or effect of not adopting a [25:34] budget uh I've made some staff [25:36] adjustments to uh reflect that prior [25:39] opinion but thought the council was in [25:42] the mindset to put something on the [25:44] ballot to clear that up so that if a [25:48] budget is not adopted by November 1st [25:51] you adopt either uh the mayor's proposed [25:55] budget last year's budget some [25:57] contingency budget but to take the [25:59] ambigu out of the whole process and that [26:03] uh you waited for that the action of the [26:06] council we are coming up to a point [26:09] where the timelines to put forward [26:12] resolutions that will go on the ballot [26:14] for this [26:15] November uh there's still time where we [26:17] can do that but I would assume the [26:19] council is going to act on that in some [26:21] fashion we can Pi up the discussion at [26:23] the next committee meeting thank [26:26] you oh I'm sorry Mr [26:28] yeah my my only response to that would [26:30] be I I would disagree in that I would [26:32] categorize that as a debacle I think it [26:34] offered a lot of areas of improvement [26:36] and a lot of learning opportunities for [26:38] the council I would agree with that if [26:40] we allowed it collectively to repeat [26:41] again in our 2024 or 2025 conversations [26:45] but I definitely agree um Mr Mayor I [26:47] think cleaning up some of those um [26:50] lesser cleared areas specifically with [26:51] regards to whether a budget is adopted I [26:54] I definitely can agree that having more [26:56] finer language to to alleviate our [27:00] interpretations only helps ensure that a [27:02] budget is passed in time and manner for [27:03] the [27:04] city and that's one of the reasons I was [27:07] hoping I was asking that we had do this [27:08] process so that we're once we get to the [27:11] um where we have to actually look at the [27:13] the overall budget we will have had [27:14] discussions throughout and have a better [27:16] idea of where we were so we will have [27:18] the back and forth and [27:22] um long elongated prolonged um budget [27:26] process that we had last year so we can [27:29] put that forward to have discussion at [27:31] the next committee meeting thank [27:34] you okay go ahead I like the call [27:37] government operations we have two items [27:39] on the agenda actually do the audit and [27:43] we put three items on the agenda right [27:45] so first I what we'll [27:49] do we to accept the [27:52] audit so second all those in favor I [27:59] our next agenda item is going to be ret [28:02] Dr Kelly tolin of other clinical [28:04] psychologist and that his chief [28:14] M um so working with the police [28:17] department the fire department has been [28:19] in the process of establishing our home [28:22] peer [28:23] support team as a matter of fact we're [28:26] joining the police department time with [28:29] their team they're doing a fantastic job [28:32] uh and we are modeling our team after [28:35] theirs and we'll be working closely with [28:37] them part of our pair support team is [28:40] bringing on a clinical psychologist and [28:43] we are uh asking to approve a contract [28:47] with Dr Kelly tolin who's the same [28:50] psychologist that the police work [28:52] with uh her contract calls for a [28:56] $1,400 uh retainer fee every [29:00] month uh we'll be modifying our original [29:03] proposal of a year contract to 6 months [29:06] and um there was some questions that the [29:11] uh uh council president had asked I have [29:16] answered to so the background of our the [29:20] reason why we want our prer support team [29:22] is because of the increase in mental [29:25] health challenges that First Responders [29:28] are facing and in the legislative [29:31] request I listed some of those they're [29:34] actually pretty troubling uh to the [29:36] point where we just dealt with two [29:39] issues uh about 10 days ago of people [29:42] that really needed some intervention so [29:46] due to the work our people do and the [29:49] stress that comes with that the amount [29:51] of time that our people are working um [29:54] we're seeing more and more challenges so [29:58] it is extremely important that we have a [30:00] team and with the team we need the [30:03] clinical psychologist so that's why I'm [30:05] here to ask for the approval of the [30:10] contract Chief um the compensation of [30:13] section three page um section three um [30:19] $1,400 with retainer and they not to [30:22] exceed [30:24] $1,000 for additional service so that's [30:26] like 4 hours is that enough [30:29] on top of the $1,400 so the 1,400 is uh [30:34] her retainer and all the services she'll [30:38] provide you see that on exhibited that [30:41] additional [30:43] $250 a uh an hour that would be in the [30:47] event of [30:48] some acute [30:50] event and I don't want to get specific [30:53] but if something happened and she was [30:55] called in because of the share [30:58] uh severity of it that would be what she [31:02] would be charging for that event it [31:04] wouldn't be for oneon-one for oneon-one [31:07] uh sessions she' be charging she'd be [31:11] invoicing the insurance so this would [31:15] be in the event of something [31:17] happen I [31:21] specific so I think what we're seeing um [31:24] in society right now is that there's a [31:27] renewal of the social contract for [31:28] institutions including school districts [31:31] um First Responders things like that [31:33] nature and I think that this is [31:35] definitely in line um with [31:38] that that's probably a contract that [31:40] wasn't necessarily negotiated we just [31:42] had to respond to because there's a [31:43] different level of need here so I think [31:45] that that's a important step to take a [31:47] proactive step to take it's something [31:48] that we can probably um [31:51] unfortunately uh will likely be utilize [31:54] one way or another so I I I appreciate [31:56] that F and full support of that [31:58] any other questions or comments on that [32:00] um just a comment do we have the same [32:02] PSA for the police department do we have [32:05] the same PS for the police department [32:07] I'm not sure it's exactly but [32:09] conceptually it's the same it's um the [32:12] police department it's 2,000 overall and [32:15] then 225 for [32:17] incidents um I just want to make sure [32:19] that we have uh up to- date signed [32:22] contract um that but that's that's the [32:25] difference there he so it was modeled as [32:27] the chief said off of the police [32:30] department my um I just wanted to ask [32:32] Chief so are we going to be um this [32:34] state in in that we have in our [32:35] information say June 1st so we're going [32:37] to be changing that to July 1st July 1st [32:39] yeah okay and I'll speak with court [32:41] Council tomorrow about uh making it a [32:44] six month as consideration what the contract States [34:21] here we're doing it basically on a [34:22] volunteer basis our people will not be [34:25] compensated there are people that are [34:28] drawn to this and they'll be vetted by [34:31] Dr toin and those members of the SK [34:35] Police Department team to make sure [34:37] there'd be a good thing so we we don't [34:40] have names to give you at this point reason I'm asking that [34:55] is because if for some reason she's on [34:57] vacation she's she's not feeling well or [34:59] whatever is there someone that that when [35:01] help is needed that there's still [35:03] someone that um is available to the uh [35:06] members she's a private practice but she [35:09] works closely with the police [35:10] department's peer support te so they're [35:14] involved uh they work as a group so if [35:17] she was not available there'd be people [35:19] from the police department's team and [35:21] and not everybody that has an issue goes [35:23] to Dr Tolman the whole concept of peer [35:26] support is to talk to a peer to work [35:29] with a peer okay and what we like about [35:32] it uh I'd like to say it was my idea was [35:34] it Chief Cliffords um that there could [35:38] be times where a member of the police [35:41] department would feel more comfortable [35:44] speaking to someone outside the police [35:45] department be a through some parts of the [38:53] city and video management software for [38:56] all the cameras that we have through [38:57] throughout the city so so so so that's [39:00] that's that's what we are awarded for [39:03] the next step after accepting the grant [39:05] will be to uh actually do the homework [39:07] on the site which uh which vendor we [39:09] will go with each for each uh each other issues that [41:25] folks had uh wanted to discuss regarding [41:27] the pool um so I just wanted to open [41:32] that discussion up I didn't know if we [41:34] had already a fee structure or have [41:36] started to consider that um the pool [41:39] looks fabulous I don't know if anyone [41:41] else has gone up to see it uh it's going [41:44] to open later this week um [41:47] obviously you know we want to make sure [41:49] that it stays as beautiful as it is uh [41:52] currently uh so to me that brings up [41:55] some security issues so I just wanted to [41:57] a little bit more about what might be [41:59] planned for um these items and whether [42:02] anybody else had some other items to [42:05] discuss are there fees fees collected at [42:09] this time and no no have we I'm sorry [42:14] considered the possibility of attaching [42:16] fees to [42:18] non-residents it's been informal [42:20] discussion you know some of the joining [42:23] communities have more restricted access [42:27] for their facilities some charge fees uh [42:30] the city has not done it and uh some of [42:34] us were approaching IT staffing level [42:36] more of an open mind uh to new facility [42:39] it really looks very impressive uh the [42:43] weather is also going to be slightly [42:44] warmer than we'd probably like so I [42:47] assume the utilization in the first days [42:50] is going to uh T some of the limits to [42:55] handle it and then we'll just see how it [42:58] goes uh from that uh in terms of the [43:02] actual hours and Staffing but some of [43:05] the fees other access issues are still [43:08] the PRI of the city council and uh not [43:12] like for the Central Park pool but the [43:15] uh rest of the pools in the city or some [43:18] of the other uh facilities that we [43:23] offer oh who's next I'm sorry Mr yeah I [43:27] was going to say yes it does look [43:29] beautiful and I think that um really [43:31] proud of this project I I would say um [43:36] sustainability of of the project is [43:38] going to be really key so I guess you [43:41] know what would be ideal for me and I'm [43:43] saying this without you know really any [43:45] um information to support at this time [43:47] to the m point we're going to there is [43:48] going to be a level of kind of seeing [43:51] how things are going and then being [43:52] responsive to what we see but um I you [43:55] know my initial ad would be not the [43:58] charged residents of the city but people [44:00] who don't live here who are coming here [44:02] to you know to be there' be some small [44:06] feed there that's probably not and I [44:08] know that happens in other [44:09] municipalities um the only thought thing [44:12] would be I know it cost the city uh [44:15] something to enforce those fees and like [44:17] all like so I'll just you know look at [44:18] that cost benefit piece there but that's [44:20] what I [44:22] would be comfortable [44:25] with okay Mr [44:27] so um do [44:30] we has the parks department come up with [44:32] anything that they've even considering [44:34] um what those fees might be who would be [44:36] charged um is one of my questions and [44:39] the other part is there signage that you [44:41] know rules of the pool essentially is [44:44] that all in place for this weekend I [44:48] hope so you don't know I haven't been up [44:52] to look at they tell me to signage just [44:54] up uh [44:57] and uh apparently we don't charge [45:01] anything Mr Farley's Point uh there is a [45:05] cost in terms of collecting it and some [45:08] of our neighboring communities are far [45:10] more restrictive in terms of access to [45:13] their [45:15] facilities and so we we'll consider [45:17] what's what's reasonable for us to do [45:19] but I have to agree that um to charge [45:22] residents I don't yeah people can you [45:25] know um cuz people are really looking [45:27] forward to it and that they're not [45:28] looking forward to like being stopped at [45:29] the gate for a dollar whatever it's [45:31] going to be yeah I was I actually also [45:34] would support not charging residents I [45:35] just wasn't sure if we were going to [45:36] have a non-resident a non-resident fee [45:39] but I like the idea of you know opening [45:41] and see how things go um in terms of [45:44] Staffing are we all set with the [45:46] lifeguards and all that we will be by [45:49] the time we open [45:51] okay okay and then Mr tutoral yes um [45:57] so residents absolutely children free um [46:01] no charge um how do they prove they're a [46:04] resident folks don't have a license and [46:06] maybe they don't have a um an ID but we [46:09] looking for the for the Youth to provide [46:12] a student ID um to get in because they [46:16] might have one from school so what [46:18] happens um Saturday the gates open [46:22] and well it's up to the C yeah we have [46:27] generally used student IDs from the [46:30] school district in past summers for [46:33] access to Central Park Pool and the [46:36] other facilities assume that that's [46:39] going to continue okay City the past has [46:42] had a [46:44] recreation ID that was uh used for the [46:49] tennis courts the golf course and other [46:52] facilities that had uh shifted so that [46:56] uh even though there's fee structures on [46:58] the books for the tennis courts those [47:01] are not collected uh the golf course set [47:04] up is where there is a fee structure [47:06] that is uh 100% enforced that becomes a [47:10] self- sustaining entity mhm we used to [47:13] get a a photo at the place in Central [47:15] Park where the AL um we used to be able [47:18] to get a resident photo there for for [47:20] the golf course and other things that we [47:21] were participating in city um so say um [47:25] you know a young child shows up with [47:27] their mom and their mom doesn't have [47:28] anything this weekend can they bring the [47:30] niok bill I just thinking I sometimes [47:33] you bring that to um to the golf course [47:36] to [47:36] prove you're a resident you know a bill [47:39] so I just you know want to make sure [47:41] everyone that's entitled to get in there [47:43] to swim this weekend and get in to swim [47:46] so well but this weekend we're not [47:48] asking anybody for anything right is [47:50] that correct [47:52] okay the having said that the Boys and [47:55] Girls Club is going to use the same [47:57] procedures that they used last year in [47:59] Central Park where they still have to uh [48:05] validate the number of people who are [48:07] actually in the pool area because that [48:10] dictates how many lifeguards we have to [48:12] have on duty so they have collected the [48:16] student ID or some counting procedure as [48:20] people come into the facility and that [48:22] will still be used just as it was uh in [48:27] Prior years but we're not looking to [48:29] restrict anybody in terms of their [48:31] access other than there may be a [48:33] quantity [48:35] issue we would limit people because the [48:38] capacity has been exceeded to match with [48:40] lifeguards that makes [48:42] sense Mr Williams but I'd also like to [48:45] comment so to miss uh D Toro's Point [48:48] like of how do you manage that fee [48:49] structure and the collection of it I [48:51] don't know if I agree well I don't agree [48:53] but have [48:58] he doesn't agree either I love that [49:02] quote my train of thought with the Fe [49:06] structures um uh excuse me so one with [50:10] morning no those are the public hours [50:14] there's some swim lessons that they give [50:17] scheduled before the op the general [50:20] public and in terms of security um we're [50:24] talking about um cameras and enfor [50:27] security is that will be available [50:32] yes okay um Mr Williams are you yep okay [50:39] so say I wanted to also just have a [50:41] reminder and correct me if I'm wrong Mr [50:43] Mayor uh the emphasis with using a [50:46] considerable amount of the or dollars to [50:50] create a new resource was to help with [50:52] the exploding maintenance fees to where [50:54] it currently was in effect [50:58] CR say that again where the Central Park [51:01] Pool currently was it was just uh [51:04] difficult a resource to manage just due [51:06] to the the the Aging filtration system [51:09] uh and among other issues whether it [51:11] being closely uh near the the some of [51:14] the animals that live around there so [51:16] wanting to re uh move it should help [51:21] with controlling some of those [51:22] maintenance and and preventive [51:24] maintenance costs in theory to some [51:26] degree we basically had no filtration [51:30] system on the original pool it was [51:34] refilled every day it's our ability to [51:36] generate uh very large quantities of [51:40] high quality water at a very low [51:43] price uh [51:45] so some of that uh will be reduced but [51:50] this pool by its nature where you're [51:53] recirculating the water you do have [51:54] filtration systems better controls there [51:57] will be uh more of a maintenance issue [52:00] in terms of people [52:02] monitoring uh the systems [52:06] and uh again there will be some upkeep [52:08] on those systems to maintain the high [52:11] quality of water and uh the overall [52:14] character of the [52:17] facility I think um one thing I just [52:20] want to add just from going up there a [52:21] few times this past week um remember [52:25] that part of the project also had to do [52:27] with the lighting and the roadway and [52:30] parking access um it looks like there's [52:33] about 36 additional parking spots I I [52:36] was trying to count them as I was [52:37] walking so I didn't get an exact number [52:39] but um the lighting is going to really I [52:42] just feel very significantly um increase [52:46] some safety um at night time in that [52:48] part of the that I mean this is just me [52:51] anecdotally saying but I mean it looks [52:53] really great so I encourage folks to go [52:55] up there uh and check that out but I [52:58] just it's it's world class and me [53:01] there's no doubt when you see it and so [53:03] I just really I'm hoping that whatever [53:06] we can do security wise um will you know [53:10] help keep the the buildings the bath [53:12] house is just fabulous looking um I [53:15] won't be here tomorrow I mean everyone [53:17] knows that there is a it's tomorrow [53:19] morning I believe is the uh ribbon [53:20] cutting um so I hope that folks can get [53:23] up there uh for that as well [53:27] Mr Williams so I'd say two points one Mr [53:29] Mayor if you wouldn't mind speaking I've [53:31] heard myself I imagine it's the same for [53:33] the council members people have walked [53:35] up definitely uh laed at the new [53:37] facility that's going to be there and [53:38] like that's only parking there so I know [53:41] this is the first phase of the [53:43] reconfiguration of the park but then [53:46] second I wanted to just point out I know [53:48] there have been ongoing conversations [53:50] now about security I think part of it is [53:52] also challenging the community there are [53:55] often times comments of this this is why [53:56] we can't have nice things and I want to [53:58] ensure that there's also an equal [54:00] responsibility placed on our community [54:02] residents of we can continue to make [54:04] these Investments not only in our [54:06] Renovations of properties throughout the [54:08] building but also making sure that the [54:09] city is and remains economically viable [54:12] but if we are are chasing ourselves with [54:16] having additional costs such as [54:18] vandalism uh that makes it difficult to [54:21] continue these types of efforts so I [54:23] know that there are preventive ways to [54:24] go about that I E surance camp [54:27] and also with maybe increased police uh [54:30] um patrols throughout the area but but I [54:33] want to ensure to Mr um Farley's Point [54:37] let's let's see how it is and then [54:39] respond rather than putting in place [54:41] some safeguards that might not [54:42] necessarily be [54:44] needed yeah I think I think that's what [54:46] the mayor was um indicating in his [54:48] opening remarks that that would be what [54:50] we would be trying to do so I appreciate [54:52] Mr Carly and Mr William's following up [54:55] on that Mr [54:56] um and I'd like to up to you of course [55:00] your committee bring it back in two [55:01] weeks and think about how we're you know [55:03] my biggest concern is is is Mom or Dad [55:06] can't bring [55:08] me I'm Grandma's from out of town and [55:11] now she you know she so it's up to the [55:14] council you know to work on to decide on [55:17] how we're going to move forward with a [55:19] fe structure and and things like that [55:22] actually the free structure part of it [55:24] should really come out of the its [55:25] administrative function so they it's [55:28] like with the golf course they we don't [55:29] create the fees they come to us they [55:31] create the fees and then we say you know [55:34] yes or no so really it would be the [55:36] parks department we don't really have [55:38] the capacity to do that it would really [55:41] need to be the folks who work here on a [55:43] you know daily basis and you know [55:45] obviously we can provide suggestions but [55:47] creating the feast and all of that is [55:49] something that would it's administrative [55:52] function and how it's done with all the [55:54] other parts with the lifeguards with all [55:56] that [55:57] great other question well the end result [56:00] is solely the proog of the city council [56:02] so you know one example for this [56:05] swimming pool is it is now designed for [56:08] competitive swimming events [56:12] yeah those type of things may increase [56:15] our staffing costs or monitoring it so [56:19] do you want to have those free for City [56:23] students uh would there be a fee for for [56:26] any group that's coming in doing a [56:28] competitive swimming event uh do we only [56:32] charge people outside of the city so [56:36] there [56:38] are things there again in terms of a [56:41] policy decision solely the PRI of the [56:43] counsil the policy yes but like the fees [56:46] I don't know how we would you know or [56:47] even how to how to like do like with the [56:49] boys and girls club they came up with [56:51] the process of how people um show ID and [56:54] and how to do um and get get in so [56:56] because we hired them to uh to do that [57:00] so I would think I don't know there's um [57:03] I know there's not a Parks director [57:04] right now but I'm assuming there's other [57:06] staff that would still be able to um you [57:09] know provide us with some guide guidance [57:13] on where we start with this I I think [57:16] that's a good suggestion um especially [57:18] when we start talking about tournaments [57:20] um and what will happen because again [57:22] it's [59:01] all these so the 685 social on state [59:05] that was a permit that was brought to [59:06] you previously about two sessions ago [59:08] however there were some discrepancies [59:10] between the applicant the insurance and [59:12] the property owner so we were working [59:14] with the property owner on making sure [59:16] that all what's that no I I'm wor about [59:20] this um and so now the applicant is the [59:23] owner and the names are the similar uh [59:25] as it's going to be on the insurance [59:27] which was the issue so we should be okay [59:29] with the issu of this per [59:47] that is uh an ARA funded project as well [59:50] as a Sam Grant funded project um it is [59:53] for the restoration of the historic wall [59:55] at Park um the project was scoped [59:58] uniquely where the city will be [1:00:00] purchasing and providing the materials [1:00:02] and the contract is essentially for [1:00:04] labor only um so the idea is this uh the [1:00:08] company Jaan construction out of New [1:00:10] York um City they will be coming up and [1:00:13] Performing essentially masonry only work [1:00:15] to repoint um modify the wall repair the [1:00:18] wall and install pre-cast concrete caps [1:00:21] the city will purchase the pre-cast [1:00:24] concrete caps and then the uh needed [1:00:26] mortar and uh grout for the for the [1:00:29] project we did meet with them on site uh [1:00:32] we did call five references because we [1:00:34] weren't familiar with them and um they [1:00:38] seemed like they they had their act [1:00:39] together they have worked for other [1:00:40] state agencies um they are working in [1:00:43] almany right now um it's a small [1:00:45] family-owned company uh they are an MB [1:00:48] company and they're looking forward to [1:00:50] doing work in the city uh we actually [1:00:52] took them into account a couple areas to [1:00:54] look at other projects in the city [1:00:55] because to have uh Masons is something [1:00:58] that is a skill that we we're looking [1:01:00] for for this kind of stuff so we're [1:01:03] comfortable awarding it the price was [1:01:05] competitive [1:01:06] and we'll see and this money is already [1:01:09] in the ARA line for this [1:01:13] project um Mr well can you just tell us [1:01:15] a little bit about the timeline for this [1:01:16] work well the timeline they are ready to [1:01:18] go because they're labor only so what [1:01:21] we're doing right now is I'm working [1:01:22] with Sarah and purchasing on the caps [1:01:25] but we were were concerned about was the [1:01:27] costs we didn't want to order 420 caps [1:01:31] and then this number come in out of [1:01:33] budget and then we have caps and no [1:01:36] labor so uh we wanted to try to get it [1:01:38] so we have this number we already had [1:01:40] the quotes from a local company that [1:01:42] specializes in pre-cast and we don't [1:01:44] need 420 caps tomorrow we just need them [1:01:47] to start making the Caps so Sarah's [1:01:49] already contacted their person uh [1:01:52] earlier last later last week about [1:01:55] getting in the caps and then the other [1:01:57] materials are common shell materials so [1:01:59] right now we're just waiting on the [1:02:01] caps but I I don't have a schedule we're [1:02:03] hoping fall I don't think this is a [1:02:05] project you want to do in the dead of [1:02:06] the summer because you know you're [1:02:08] exposed you're out and uh I don't I [1:02:10] don't think you know you want to do [1:02:11] something more 100 but if we can get [1:02:13] some of the caps on we're going to store [1:02:14] the Caps uh right next to C and's yard [1:02:17] there uh in stamus and then just start [1:02:20] picking away at the and working forward [1:02:22] they anticipate once they start it's [1:02:24] going to be around probably I think a 6 [1:02:25] week projects for okay so [1:02:29] thank any other [1:02:31] questions a motion so funed project so [1:02:47] as you're aware we have a new North [1:02:48] fairy Pump Station uh that is put the [1:02:51] existing or the previous North FY Pump [1:02:53] Station uh as essentially abandoned City [1:02:56] facility the building is historically [1:02:58] significant and there was money approved [1:02:59] to make sure that it does not get into a [1:03:02] state of disrepair um the building is [1:03:05] okay presently but it's not great so [1:03:07] what the funding for this building is [1:03:09] essentially seal the envelope we're [1:03:10] going to be doing the windows similar [1:03:12] that we did at City Hall removing the [1:03:14] windows restoring the windows replacing [1:03:16] any Rock uh reglazing the glass putting [1:03:18] them back we're going to be replacing [1:03:20] the roof um the reason for the roof is [1:03:22] that the roof right now has over a dozen [1:03:24] penetrations for [1:03:26] various Vents and systems to come [1:03:29] through because it was a pump house we [1:03:30] have the vent we're going to remove all [1:03:32] of those vents fill in where we can with [1:03:35] uh concrete and steel and masonry and [1:03:37] then do one flat roof with no [1:03:39] penetrations so that will really seal [1:03:41] the roof off a lot better to go to the [1:03:43] parit we're going to remove all of the [1:03:45] stucco from the building cuz if you look [1:03:47] at the building the building is a series [1:03:48] of Patchwork cuz stule was put on in [1:03:51] various years so we're going to remove [1:03:53] all of the stucco down to the block and [1:03:56] then redo the stucco paint the building [1:03:58] so it'll look from the outside like a [1:04:01] preserved building the inside is a [1:04:03] different story but from the outside [1:04:04] it'll be weather tight and preserved and [1:04:07] I know that the Stockade Association is [1:04:08] working on lining up funding to try to [1:04:11] address the interior of the building but [1:04:13] this money is for the exterior of the [1:04:15] building have we already done some work [1:04:17] on this and started this process anywh [1:04:19] all in the exterior no not not to M out [1:04:22] Paul might have years ago but to M out [1:04:24] no it's just [1:04:26] it's there it's just a building and once [1:04:28] again is one of the tricky situations [1:04:30] that we're trying to work with Stockade [1:04:31] is the reason that we built a new [1:04:34] building where one of the many reasons [1:04:36] was is that that building was determined [1:04:38] to not be um cost effective to flood [1:04:41] proof because it is in the flood plane [1:04:42] so we built a new building that is flood [1:04:45] resilient um so this is fine and I know [1:04:48] that we haven't had any issues there but [1:04:50] making significant investments into the [1:04:52] building will be a complex subject going [1:04:54] forward because that is why we abandoned [1:04:56] the [1:04:58] Agency for the mobile haror I have a [1:05:15] quick I'll try to make a brief this [1:05:17] presentation to just show you where we [1:05:18] are with this because it's part of the [1:05:19] process okay sure [1:05:39] okay so I don't know how many of you are [1:05:42] aware of this project I'm sure you're [1:05:44] all aware of in some part of you but it [1:05:45] is a rather older project um that was [1:05:48] done preo and it is something that we [1:05:52] have been pushing along slow and [1:05:54] steadily since then du of all the [1:05:56] development really at Mohawk Harbor so [1:05:59] um just to go through I I'll be quicker [1:06:01] than this but we're going to I'm [1:06:03] presenting it here I'm hoping to catch [1:06:04] some publicity from possibly the the [1:06:07] paper just to get it out there what [1:06:08] we're doing we're going to have a public [1:06:09] meeting next week at the Landing which [1:06:11] is an official public meeting uh and [1:06:14] then hopefully from there you know we'll [1:06:16] get some input and then we're just going [1:06:17] to move forward with the process um of [1:06:20] the project so the overview is um the [1:06:22] city received CFA Grant in 2019 [1:06:26] for the creation of a dot gameway in [1:06:28] Plaza with path so it says um the idea [1:06:31] was to create an access point to the [1:06:33] river I don't know if many people [1:06:35] realize it but even though we are a [1:06:36] river front Community we do not have any [1:06:38] docks or points of access to the river [1:06:41] other than the parks so it's kind of [1:06:43] unique when you go to other uh Riverside [1:06:45] communities they usually have docks and [1:06:47] we do not um there was a talk um several [1:06:50] years ago um about putting a dock in [1:06:52] Riverside Park but uh the ended up being [1:06:55] controversial people didn't want the [1:06:57] idea of a DOT down there so this is a [1:06:59] DOT with an Upland Plaza and I will'll [1:07:01] get into the location a little bit right [1:07:03] here you'll see the location is we have [1:07:06] uh an arena we have the future hotel [1:07:08] which is improved um parking lot would [1:07:10] be here parking lot Arena and then that [1:07:12] is our Plaza and those are our docks and [1:07:14] that is the RPI research facility so as [1:07:17] I'll get into in a little bit there's a [1:07:19] reason for all the delay um the project [1:07:22] 2016 we put in some access 20 20 we got [1:07:26] the grants with the skincity match of [1:07:29] 15% um that's typical on these kind of [1:07:32] projects you know 80 155s City released [1:07:35] to design an RFP in 2021 after Co [1:07:38] working with MJ and what's called [1:07:40] waterfront Solutions so MJ is [1:07:42] essentially handling all the Civil work [1:07:43] and then Waterfront Solutions is [1:07:45] handling the dot work they're a DOT [1:07:47] company they also did the harbor for G [1:07:51] um did a bath metric survey that is a [1:07:53] survey of the riverbed uh 2022 the [1:07:56] project was paused and that was we we [1:07:59] rushed we got to a point and then it was [1:08:01] Aquatic Center it was like okay where's [1:08:03] the Aquatic Center going to go and it [1:08:05] was never mind not an aquatic center [1:08:06] arena it's like okay where's the arena [1:08:08] going to go so we actually had a spot uh [1:08:12] picked out and and in South there I can [1:08:14] show you where we actually were going to [1:08:16] put the the docks here MH um and we had [1:08:20] a plan laid out and then the arena came [1:08:22] forward and it was weight and so we [1:08:24] didn't want to move it anymore so we [1:08:26] waited until planning approval and [1:08:28] everything was set with the arena and [1:08:31] then we found a nice little spot in the [1:08:33] middle the Nic thing about this location [1:08:36] is that we are by a turnaround we're by [1:08:38] parking the glassy group has said that [1:08:41] that would be public parking they will [1:08:42] allow people during the day to park [1:08:44] there uh you know not event [1:08:46] notwithstanding but you know there [1:08:47] probably won't be event 24/7 and we are [1:08:50] directly adjacent to the ALCO Heritage [1:08:52] Trail so this will both be a overlook on [1:08:55] the trail and the landing and we'll have [1:08:58] parking and a drop off um you know be [1:09:00] honest this has to be publicly [1:09:02] accessible and probably get into that [1:09:04] but people who know the area I do not [1:09:06] see this going to be a full access dock [1:09:10] for recreational purposes the reason [1:09:12] being is at the gang way the gang way is [1:09:14] going to be quite long to get down from [1:09:16] the shore to the water and across the [1:09:19] street by the lighthouse if you're [1:09:20] familiar with the area it's the easiest [1:09:23] launch in the area there's nothing [1:09:25] easier that you park you launch it's 10 [1:09:28] ft you don't go down the gameway so I [1:09:30] think that for people wanting to see the [1:09:31] river and be involved and be by the [1:09:33] water and fishing and all that but I [1:09:35] really don't think that people will [1:09:36] kayak and hip their kayaks down and [1:09:38] things like that unless it's for the [1:09:40] novelty of it because it is it is a [1:09:43] slope um so the project the one stage [1:09:45] like we said is the plaza which we're [1:09:47] calling the plaza or the landing it's [1:09:49] small 5,000 ft it will have lights it [1:09:51] will have signs benches we are looking [1:09:54] at very uh attractive welcome this [1:09:56] connec because you have to understand [1:09:57] that this is going to be now a new [1:10:00] entrance way for the city this is going [1:10:02] to be a Gateway we are looking at you [1:10:04] know people who are called the Loopers [1:10:06] who come from all around the country [1:10:07] this is going to be allowing them to [1:10:09] stop and go to SKC so we really want to [1:10:11] make sure that we have a nice anchored [1:10:14] site here that shows you where they are [1:10:16] also we are talking with a Riverfront [1:10:18] Cruise company that does small [1:10:19] Riverfront cruises of 40 people on boats [1:10:22] you know we limited by the locks so they [1:10:24] would come in so this this is something [1:10:26] that's important we're trying to make [1:10:27] sure that we're working and we're also [1:10:29] incorporating this into our drri WF [1:10:31] finding because that also is going to [1:10:33] connect to downtown so there's a lot of [1:10:35] irons in the fire with this this will [1:10:36] have water and this will have sanitary [1:10:38] we are not getting into fuel fueling is [1:10:41] a whole other animal we're going to [1:10:42] allow the yacht club in places like that [1:10:44] to handle fuel uh parking we say we'll [1:10:46] be at the um there's a better idea you [1:10:49] see the passenger drop off the trail and [1:10:52] then the um the area itself we are going [1:10:54] to have a Elric [1:10:55] going to a large Transformer we'll try [1:10:58] to landscape that make it as pretty as [1:11:00] possible these are some of the things [1:11:01] that we were looking at you know just to [1:11:03] say venges that we are actually moving [1:11:05] away from the arch but they took a [1:11:07] picture of it we are moving away from [1:11:08] the arch style um one of the things to [1:11:10] point out is uh this one right here uh [1:11:14] I've been to marinas before uh with my [1:11:18] family and that is something that we are [1:11:20] going to have to talk about and discuss [1:11:22] going forward is what is public access [1:11:25] what is not Public Access I'm proposing [1:11:28] that the docks are publicly available [1:11:31] from a time to a time and that it is [1:11:33] posted and that after a certain time it [1:11:37] could be sun down most likely uh the [1:11:40] gate is locked and if you have a boat [1:11:42] there you're have a code because one of [1:11:45] the things that you're going to see is [1:11:46] if you actually look at the river [1:11:48] sometimes you will see million dollar [1:11:50] boats multi-million dollar boats and we [1:11:53] want to make it a safe environment that [1:11:55] someone he feels and the voting [1:11:56] Community is a very tight Community [1:11:58] especially with internet social media [1:12:00] forums uh we really are looking for it's [1:12:03] open it's signed it's a public amenity [1:12:06] and the sunlight come on down and then [1:12:07] at night time you know what we're going [1:12:09] to close it off you don't want people [1:12:11] you know down on the docks it is a [1:12:13] little tough to see we are going to have [1:12:14] cameras and security we're are working [1:12:16] at getting a dock management company but [1:12:18] I just don't want you to think that is [1:12:20] something that we're looking at is U and [1:12:22] it's very common at commercial marine [1:12:25] with this type of b um so the project [1:12:28] just say it's two projects it's two [1:12:30] contracts that's what we're saying it's [1:12:31] a dock and it's a plaza so they're Ed [1:12:34] differently they'll have to be [1:12:35] progressed differently so we've already [1:12:38] talked with the permitting we've got a [1:12:40] lot of the permitting done this is the [1:12:42] sear portion we're now going to reach [1:12:43] out to all the involved agencies and [1:12:45] talk to them about making sure that [1:12:46] they're okay with it we have a stamp [1:12:49] plans uh right now we're just going [1:12:51] through all of the finals on it with the [1:12:53] doc company um and and then we'll be [1:12:56] done with seeker and then hopefully we [1:12:58] issue a declaration later this year and [1:13:00] then we're out to bid like it says in [1:13:02] August we look in August we're going to [1:13:04] have a lot of manufacturing time because [1:13:06] these are custom very large docks uh and [1:13:09] then as it shows doc delivery and Doc [1:13:10] construction of next year we are one of [1:13:14] the things just to also point out is we [1:13:16] are struggling right now with schedule [1:13:19] and when docs go in and when they [1:13:20] wouldn't go in we are looking at if we [1:13:22] can get docks in in this June July time [1:13:27] frame it might make it worth it to put [1:13:28] them in next year the arena will be [1:13:30] substantially complete we're going to be [1:13:32] working inside but we do not want to put [1:13:34] docks in towards the end of the season [1:13:37] because it's a lot of work to put them [1:13:39] in you're using them for 3 weeks then we [1:13:41] close so the timing of it is fluid of [1:13:43] when we're really going to get it in uh [1:13:45] the plaza similarly Plaza a lot of this [1:13:48] is going to be uh driven by the arena [1:13:50] which is adjacent CU we don't want to [1:13:52] build a plaza and have a construction [1:13:54] site around it like to do and the hotel [1:13:56] hasn't even started yet so we have [1:13:59] bi-weekly coordination meetings with [1:14:01] gesi and the hotel and these are the [1:14:03] things that we're tracking so right now [1:14:06] it's a similar path but this doesn't [1:14:07] have as long as the lead time is [1:14:09] constructing of a dock uh and then I [1:14:11] guess in conclusion I guess is just want [1:14:14] to get out there that we're going to [1:14:15] have a public meeting Wednesday the 26th [1:14:18] 4:30 at the Landing Hotel we chose the [1:14:20] Landing Hotel because we were looking [1:14:21] for a place on site somewhere we're [1:14:24] trying to get people inv well the [1:14:25] problem with a project like this is It's [1:14:27] essentially for transient people um you [1:14:29] know the people that will be using the [1:14:31] facility the most are not residents uh [1:14:33] residents will use it for fishing and [1:14:35] things like that but we do want to hear [1:14:37] from people so we're looking at having a [1:14:39] public meeting uh on 4:30 uh at the [1:14:42] landing and then um like I said I think [1:14:45] it's a great project it has a lot of [1:14:47] fingers into everything else um and I'm [1:14:50] looking forward to getting people's [1:14:51] comments [1:14:53] on I the other thing that is is [1:14:56] expandable um 360 ft is what we can [1:14:59] afford today if we find that the amenity [1:15:03] is used and utilized we'll have to look [1:15:06] at expanding uh the do you can't expand [1:15:09] it uh to the north of [1:15:11] the [1:15:13] so [1:15:17] questions I think it's a terrific [1:15:19] project I mean I think it's something [1:15:20] that we've been waiting for you know in [1:15:22] terms of the initial design of the [1:15:24] entire Mohawk Harbor and um I'm excited [1:15:27] I'm very excited about it so looking [1:15:29] forward to seeing its completion and [1:15:31] there might be people in the apartments [1:15:33] down there that might want some of the [1:15:34] dog space that are residents in other Y [1:15:38] and so we were going to have the meeting [1:15:39] in the harbor house but we thought if we [1:15:41] had it there it would be too convenient [1:15:43] and we would overwhelm their community [1:15:44] room so um our our partner our friends [1:15:47] at gassie and Metroplex we're arranging [1:15:50] the the uh the hotel which has a larger [1:15:52] space for us to be able to use and this [1:15:54] is really going to be a partnership [1:15:56] project unique to what we've ever done [1:15:57] because the the city will be the owner [1:16:00] of the Docks but we already have a [1:16:02] memorandum of understanding with the [1:16:04] with the gesi group to help you know [1:16:06] operate the docks we're going to have to [1:16:08] store the docks these docks cannot be [1:16:10] out in the winter time they'll be [1:16:11] floated and stored uh within the harbor [1:16:13] we're believing um you know we have uh [1:16:17] the Dr that we're working on I can said [1:16:19] Danielle's here for you know show the [1:16:20] support of Metroplex uh with these [1:16:23] projects and uh I we really think that [1:16:26] it could be a great way to just promote [1:16:28] the city to the Waterfront Community [1:16:30] because we're just very uniquely we're [1:16:32] uniquely positioned on both the river [1:16:34] and the bike path and this is the river [1:16:36] and the bike path together [1:16:39] so [1:16:40] great s are you anticipating any [1:16:43] concerns from the public um I not I I [1:16:47] really don't [1:16:48] have because of the way everything came [1:16:50] together uh the original plan like I [1:16:52] showed you when we were a little more [1:16:54] the parking was a little farther away [1:16:56] the path was a little longer things were [1:16:58] a little bit but with the the new spot [1:17:00] where we are with the drop off in the [1:17:02] parking and the way it kind of [1:17:04] integrates into the site I I I really [1:17:06] think it's a it's a win I really like it [1:17:09] um I don't see what people would I [1:17:11] haven't figured out what people would [1:17:12] push back on then other than they don't week you've got a [1:18:20] revised uh uh uh ordinance um the [1:18:26] comments came back orar to the uh [1:18:28] General Municipal law from the county uh [1:18:31] Planning Commission with their comments [1:18:34] and uh there were uh uh which are [1:18:39] highlighted in in the package I gave you [1:18:41] in red um and that [1:18:46] uh they just had a couple of questions [1:18:49] really minor minor revisions to the [1:18:52] overall text of the of the proposed [1:18:56] ordinance [1:19:01] um the uh minor edits and comments of [1:19:04] the proes ordinance were attached the [1:19:07] red the Reds uh were the items that were [1:19:09] deleted the yellow items are the ones [1:19:12] that were they suggested language um [1:19:14] they had a couple of questions in the [1:19:16] definition section um was added what was [1:19:19] included in there is some uh medical [1:19:21] marijuana and another marijuana uh [1:19:26] definition they said it's not not in the [1:19:29] rest of the the code the reason those [1:19:31] were put in there in case you ever want [1:19:33] to build off of this particular section [1:19:36] of the code regarding cannabis [1:19:39] operations so those definitions are [1:19:41] already in there and that's how come [1:19:43] it's not referenced in there but in case [1:19:44] you ever want to build off of it [1:19:46] definitions are already included and [1:19:48] then the last part of this the last page [1:19:51] uh dealing with the uh ammonization [1:19:55] um oversight on my part that language [1:19:58] came from our City Zoning code dealing [1:20:00] with adult establishments um that that [1:20:04] reference wasn't deleted it should have [1:20:06] been was deleted um regarding the issue [1:20:09] of amortization I know there was some [1:20:11] discussion on this on this the last time [1:20:14] and what it means is that if you adopt [1:20:17] this ordinance you the the vape shops [1:20:21] that are in those areas that you've [1:20:22] declared them not to be [1:20:25] legal um would have one year to wrap up [1:20:28] their business now if they wish to [1:20:31] extend past that one year then they [1:20:34] would have to go to the zoning board of [1:20:36] appeals to prevent uh financial [1:20:39] information as to why this would be a [1:20:41] hardship and they they can't abide by [1:20:44] that onee uh deadline so there's an [1:20:46] appeal process through the zoning board [1:20:49] of appeals that language is is from as I [1:20:52] indicated from our zoning code dealing [1:20:54] with both businesses so that same type [1:20:57] of appeal process is already in our code [1:21:00] and is just placed into this uh section [1:21:02] regarding Vapes shops smoke shops Etc in [1:21:05] the alternative if you just wanted to [1:21:09] not get into that and and just have [1:21:12] these establishments stay past that one [1:21:15] year then they'd become a legal [1:21:16] non-conforming use what does that mean [1:21:18] they can stay as long as they're [1:21:20] continuing an operation as a vape shop [1:21:23] but if they vacate it then whoever came [1:21:26] in would not it's not zoned for that [1:21:29] particular [1:21:31] use so if you want you know it can be [1:21:34] the language there can be changed in [1:21:36] which it will become a legal [1:21:37] non-conforming use for after one year um [1:21:42] or on the alternative you know keep that [1:21:44] language [1:21:45] regarding mization in there uh for for [1:21:50] uh for it so it's really up to you but [1:21:53] it's it's your option I know there was [1:21:55] concern discussion last time so I just [1:21:57] want to flex that a little a little [1:22:02] bit so I I I do have a concern about you [1:22:05] know after a year saying you have to [1:22:07] prove that you're financially you need [1:22:09] to stay here so um I essentially think [1:22:12] that's that's that's an opportunity for [1:22:13] us to put people out the business where [1:22:15] they currently are if they're there [1:22:17] legally so um I I have concern about [1:22:20] that and I think that I'm just to have [1:22:22] them stay with the um um [1:22:25] then allowing them to be there and not [1:22:27] have to come before the zoning board [1:22:29] every year is is the way that I would [1:22:31] prefer that we approach this particular [1:22:34] um uh situation with these [1:22:37] establishments but obviously input from [1:22:39] the other council [1:22:43] members I mean the language we could use [1:22:46] I mean if we want if you wanted to go [1:22:48] down that route and delete that [1:22:50] particular portion it would be that all [1:22:51] such facilities or establishments la [1:22:55] actually operating open to the public on [1:22:57] the date of the adoption of this [1:22:59] particular order shall be permitted to [1:23:01] continue as a legal non-conforming use [1:23:03] and all others will be declared unlawful [1:23:05] prohibited so and our zone of law deals [1:23:09] with non-performing uses and what if [1:23:10] they're discontinued [1:23:13] it it would if there's a discontinuance [1:23:16] if it's not continuous operating then it [1:23:18] would revert to it would be a [1:23:20] non-conforming use the new outfit [1:23:23] understood Mr Willams So to that point [1:23:26] is the non-conforming use extended to [1:23:28] the business or to the business owner [1:23:29] meaning if the business no it's the [1:23:31] business the B [1:23:32] jobs or I meant to to like a singular [1:23:35] business it's the type of business [1:23:37] that's gone in [1:23:39] there it's it's the type of business and [1:23:43] and and and the definition the [1:23:45] definition section covers all that so I [1:23:49] I know it's it would be the type of [1:23:52] business it's thank [1:23:57] you so suggestion is to keep the current [1:24:01] language that we have we're not putting [1:24:02] them out to business just they would [1:24:03] have to move after the year in approve [1:24:06] the approved area that is zoned for this [1:24:09] so I think there is opportunity for them [1:24:10] to kind of like work until they are [1:24:13] ready to move into the approv area [1:24:16] and that is z for for Fen smoke [1:24:21] shops so I think what that comes into to [1:24:24] play here is how many vape shops are [1:24:27] there how much room is there in these um [1:24:30] in these approved areas because we have [1:24:33] a there's a distance right they have to [1:24:35] stay apart so if we're limiting the area [1:24:39] and within that area we're limiting the [1:24:42] proximity that could impact businesses [1:24:44] if there's enough businesses like then [1:24:46] we run out of space what happens to [1:24:47] those individuals so those you know are [1:24:50] are also part of my concerns because if [1:24:52] we do that then essentially somebody [1:24:54] would have may have to go at business [1:24:57] so well they're allowed to for a year [1:25:02] extension they would have to they would [1:25:05] be allowed to operate from one year from [1:25:07] the from the when you adopt this [1:25:09] ordinance [1:25:10] say July 15th or whatever one year they [1:25:14] can continue after that one year if they [1:25:17] wish to remain in business um a form [1:25:21] would need to be developed for them to [1:25:23] go before the zon board of appeals for [1:25:25] them to demonstrate financial hardship [1:25:27] as as to why they should be allowed to [1:25:30] operate for a period of time after the [1:25:33] end of the after the after that uh [1:25:36] one-ear period in their current position [1:25:39] in their current [1:25:44] position well last count there were 39 [1:25:47] smoke shops um in the city plus we know [1:25:52] that more have developed and popped up [1:25:54] and um don't have proper um you know [1:25:58] aren aren't properly documented on the [1:26:01] books to even operate so I noticed one [1:26:03] the other day with with the windows were [1:26:05] all sealed up and it's got a big sign in [1:26:07] in the window 8m but it's the dragons or [1:26:11] it's a smoke shop but anyway um so I I'm [1:26:14] in in in agreeance with to leaving it [1:26:17] that you know they'd have to come before [1:26:18] the board of appeals to uh keep their [1:26:21] position uh if they can prove it's a [1:26:23] hardship but other than that as far as [1:26:26] um we we don't need six in one block um [1:26:28] so I I do like you know how things are [1:26:31] going to be um stated in the moratorium [1:26:34] I'm I'm sorry I'm off for small business [1:26:35] I'm a small business but um you know we [1:26:38] have we have a lot of Youth out there um [1:26:40] that are walking by these smoke shops [1:26:42] and and I'm just not in favor of them um [1:26:45] there's more than enough places that [1:26:46] they'll be able to establish their [1:26:49] business I don't know if there's nor [1:26:51] enough places I don't know if we've done [1:26:53] with the if we moved all 39 to this to [1:26:56] what's El to what's would be available [1:26:59] um to what we're zoning it for I don't [1:27:00] know that there's enough places so I I [1:27:02] do have that concern about someone not [1:27:05] being able to I [1:27:06] don't not being able to um to continue [1:27:09] with their business whether it's a [1:27:11] business that I approve or not that's [1:27:12] not really why I'm here it's it's if [1:27:14] it's a legal business and they're you [1:27:16] know it's something that they can [1:27:17] legally do then I don't uh I I don't [1:27:21] that we I think that we should just go [1:27:24] with leg and non-conforming that's [1:27:26] that's how I see [1:27:33] this Mr the last time of we discussed [1:27:36] this we were talking about the 40% um [1:27:39] allow [1:27:41] for [1:27:43] yeah yes there was no comment from the [1:27:45] the the County planning on that amount [1:27:48] and uh that 40% we the 40% is still in [1:27:53] right um [1:27:55] because they have not met yet they that [1:27:57] the city planning at City Planning they [1:28:31] they could bring it before you as a as [1:28:34] as a transmitt and saying that the their [1:28:37] number is whatever and then you would [1:28:39] have the opportunity to amend the [1:28:41] ordinance if you so desire at that [1:28:45] point yes I I think president P field [1:28:48] and I even we agreed on the fact that [1:28:50] you know whatever they want to put in [1:28:52] their shop or or you know the % was you [1:28:55] know we didn't have an issue with with [1:28:58] them you know keeping that at 40% um you [1:29:02] know they have a shop they can sell [1:29:04] everything legally in there whatever [1:29:06] they want and whoever's going into the [1:29:07] shop is going in there for a specific [1:29:09] reason anyway um for products and so I [1:29:14] don't think there was an issue with the [1:29:15] percentage of of the space inside the [1:29:18] building what they could [1:29:21] sell yes so [1:29:25] they were suggesting the members from [1:29:27] the zoning [1:29:28] board plan commission [1:29:32] 25% no they never gave a number the the [1:29:35] other localities had gone down to 20 20 [1:29:39] 25% that was just as a as a reference [1:29:42] point but I don't think we did not get a [1:29:45] hard number from the uh City Planet [1:29:48] commission correct So currently it's 40 [1:29:51] it's 40% in a draft other display area [1:30:07] yes Mr Williams so I think I'm just [1:30:09] being transparent with my thoughts as [1:30:11] everyone else has been uh I I I find [1:30:14] myself citing more with Miss Doro and I [1:30:16] understand to the nonconformity and that [1:30:57] that the the closing down would would [1:30:59] would have would have a financial impact [1:31:02] upon them so it's a continuation you [1:31:05] could essentially have businesses [1:31:06] continuing on without making any [1:31:09] adjustments I don't understand the [1:31:11] question well we're highlighting wanting [1:31:14] to adjust the behavior so I applied for [1:31:17] a [1:31:19] non-conformance to not have to like [1:31:22] alter like where my business is [1:31:24] yeah you would what no what you're [1:31:25] saying to the zon board of appeals I'm [1:31:28] at this [1:31:29] street the the deadline has come down I [1:31:32] have in I I've invested x amount of [1:31:36] dollars into this therefore I feel that [1:31:39] if I should going to ask add to that so [1:31:58] when you stay longer in ter is there a [1:32:00] time to recuit there it would be it [1:32:03] would be it would really depend on a [1:32:06] Case by case basis of how much they put [1:32:08] in how long they've been there dollars [1:32:10] and cents proof provided to the zonian [1:32:13] board of appeals so this point like they [1:32:16] can go on for another year it would all [1:32:18] depend all depends yeah it all depends [1:32:27] and it would be the prior to the [1:32:29] non-conformity the non-conformity is one [1:32:32] year in other words those individuals [1:32:34] that that put into their put the [1:32:37] business in [1:32:39] really um since we've had the uh The [1:32:44] Vape Shop moratorium since uh March it [1:32:48] would be you see that it would be a [1:32:50] longer period of time so a longer period [1:32:53] of time [1:32:54] it would be indicate that they would [1:32:56] have more return on their investment [1:32:57] because the non-conformity would occur [1:33:00] July [1:33:02] 15th but presumably they've been were in [1:33:06] had their business there prior to when [1:33:09] you except it's had the moratorium in [1:35:19] compliance with what the you know City's [1:35:21] rules and expectations are and and this [1:35:25] moratorium was to kind of stop the from [1:35:28] popping up all over the place where we [1:35:30] can manage what was in front of us right [1:35:31] so that okay right um and and with that [1:35:36] so mayor in terms of the enforcement and [1:35:39] for those that are legal versus [1:46:51] think that that might have to be in some [1:46:52] langage as well because that is really [1:46:55] that might just be something that you do [1:46:57] as you know as a matter of practice and [1:48:05] statements that that does sort of keep [1:48:07] the [1:48:08] conversation going within you know [1:48:11] appropriateness appropriate [1:48:13] guidelines so I'm I'm fine with just
