recognition [7:26] for us to pause and just acknowledge the [7:28] accomplishments of some of our youth [7:29] within the city um so as you can read in [7:32] our packet uh they they took the the [7:35] pleasure of placing second in a recent [7:37] competition Down Louisiana and then in [7:39] addition to having their drill team come [7:41] and do a mini drill for us the next [7:44] Monday at all things uh work with their [7:46] planning uh again I think it's nice to [7:48] just U to just acknowledge and just [7:51] appreciate the uh the achievements of [7:53] our our younger individuals in the [7:55] community excellent so um we [8:00] we need a motion to to do so that's for [8:07] motion okay dor second you me and all in [8:12] favor I okay sorry about [8:15] that okay the next item is a discussion [8:18] a continued discussion of Central Park [8:20] swimming pool fees hours and security um [8:23] I put some materials in your packets um [8:27] it was a lot to send out so I decided to [8:29] just bring uh this evening and I would [8:32] ask that people review it um what I did [8:34] was look at our um missa Guilderland and [8:38] Colony uh to look at what their fees are [8:41] as well as their uh pool rules um [8:44] there's some there's some things that [8:46] are consistent and others that aren't um [8:50] so I wanted to have a little bit of a [8:51] discussion about this [8:54] um Miss Yuna has uh three separate [8:57] Seasons to their pool um and they also [9:00] have um on their uh site they talk about [9:03] rules for if swim meets are were going [9:06] to happen um they have season [9:09] passes um as does [9:16] um as does the uh the Guilderland Town [9:20] pool um and actually all three have [9:24] season rates um and they're different [9:26] between uh the rates very depending on [9:30] whether how old a child is whether [9:33] somebody's a senior whether it's an [9:34] adult um so this is a lot of information [9:37] I think we may have to um take a look at [9:39] it and come back again um I'm hoping to [9:42] have a meeting of the health and [9:43] Recreation committee as well um before [9:45] our next meeting um to review this uh [9:48] this information again this is not the [9:50] end all be all but it is the um [9:52] municipalities that are around us [9:53] there's no public pool um that I could [9:57] find in Scotia or Glenville so jump in [10:00] if I'm wrong there anybody from Scotia [10:02] or lenville [10:03] but but I think it's really important I [10:05] think um what I've heard so far um from [10:08] some some folks I've heard concerns that [10:10] there's been children in the pool with [10:13] diapers um I've heard concerns that [10:15] there's been glass um containers in use [10:20] um these are things that I don't think [10:21] should be happening um so I think we [10:24] definitely have to have some rules and [10:26] have some posted rules the other side of [10:28] that is the enforcement of those rules [10:30] so again we have um youth employees uh [10:35] that come to us through the Boys and [10:36] Girls Club so all of this is are things [10:39] that we need to take into consideration [10:41] and I'd like to bring up at a health and [10:43] Recreation uh meeting um and anyone [10:46] would be welcome to attend as well but [10:48] um we have to post that uh Etc so I will [10:52] get around to doing that as well but [10:54] does anybody have any comments or has [10:56] anybody else been hearing any concerns [11:00] um [11:01] Mr so I actually have a question and [11:03] probably it would probably be more for [11:05] the mayor iny because you mentioned it [11:06] Miss Patrick in terms of signage so um [11:09] the signage would be separate apart from [11:11] the fee thing so are we I know that we [11:13] talked about a couple minuts ago about [11:15] the signage so will there be signage uh [11:18] we don't have to wait till we get [11:19] through this process for the signage for [11:20] the pool in terms of the rule there was [11:22] signage that was put up initially then [11:24] some of was modified in the last couple [11:27] days that by understanding been put up I [11:30] I've been up there to actually see if [11:32] it's been up not as of today about 2 o' [11:35] I didn't see any there [11:37] um and and my other question was [11:40] somebody will have a rough War tomorrow [11:43] well I hope [11:44] not um the other question was in terms [11:47] of if we're going to be charging fees we [11:49] have to talk about considering how that [11:51] Staffing works right now there's a a [11:53] person there from the Boys and Girls [11:54] Club who is just taking names and ages [11:57] we we would have to consider that um the [11:59] town of Colones Park they actually have [12:01] fobs key fobs for residents um so [12:05] residents have to go to town hall to get [12:07] the fob [12:10] um also it's this idea of residents and [12:15] in in all all of these cases a resident [12:18] can bring a non-resident guest but it's [12:21] not that a non-resident is getting into [12:22] the pool without a resident hosting them [12:26] um there's also um again you'll see that [12:28] uh there could be a limit on the number [12:30] of non-residents that a resident can [12:33] bring to the pool um so these are all [12:36] things that um we have to make decisions [12:38] about um okay moving forward so I guess [12:43] um I'll try to have a meeting of the [12:44] health and Recreation committee I have [12:46] to get with the other folks and um we'll [12:48] have to come up with recommendations so [12:49] I would ask that you review this Mr Rini [12:52] did you have a comment I I I would I one [12:55] of current rules the Boys and Girls Club [12:57] have regards the [13:00] and and then possibly you know they [13:03] probably have um mechanisms to where a [13:07] given membership they they serve many [13:10] many youth in their clubs so they may [13:12] have existing methods where they maybe [13:15] take youth photos or and issue [13:17] memberships we can inquire into what [13:19] they're currently doing and see if any [13:21] of those practices would work and if not [13:24] look to some [13:26] Alternatives and the Nisa is that for [13:28] resident [13:30] you know it's for [13:32] um this is for residents okay yeah I [13:36] thought it was kind of um neat that they [13:38] also give their volunteer firefighters [13:40] free season passes to the um again they [13:43] don't get any compensation but I thought [13:45] that was kind of cool as well in [13:50] this Sorry Miss guro that's right I'm um [13:53] I'm hoping that you can call this [13:54] Committee of health and Recreation [13:56] committee together as soon as possible I [13:57] think it's imperative that we get some [13:59] things in order over there um I heard a [14:02] lot of things a lot of great things a [14:03] lot of things that need addressing um [14:06] it's it's definitely a welcomed resource [14:10] in our community especially with the [14:11] weather we've been having um says a lot [14:14] about the fact that people are waiting [14:15] to get in there but um there's just a [14:18] lot of things that that you know have [14:20] been um individuals have approached me [14:24] with that that I think need to be [14:25] addressed um the second thing is I would [14:27] like to see if we can add a senior uh [14:32] mornings um a senior special time to [14:35] senior swim um I had quite a few emails [14:38] and phone calls regarding that so the [14:40] pool opens at noon every day from 11: to [14:43] 12: um you know especially with the [14:45] resistance pool there um and a lot of [14:47] seniors like to get into the water so um [14:50] I'd like to see that uh definitely [14:52] moving forward and then you know have a [14:54] discussion with the health and [14:55] Recreation as far as the other things [14:57] that are happening there at the pool [14:59] okay well um again our committee is U [15:02] myself um M Doro and Mr Farley so I'll [15:05] be reaching out to you guys tomorrow um [15:07] to try to get that in as soon as [15:09] possible so that when we come back [15:11] together on July 15th for a committee [15:14] meeting um we our committee will make a [15:16] recommendation to the the larger Council [15:19] does that sound [15:20] good okay anybody have any other [15:23] thoughts or comments just follow Mr [15:25] manini's [15:27] comment kind of the standard that the [15:29] boys and girls club used in the past is [15:31] using this year is the city school [15:35] district ID [15:37] for uh kids going in so that they use [15:41] that accting and as a uh reference for [15:46] validating where they live and just who [15:49] they [15:53] are so I was just thinking that as we [15:56] look at this I feel like being that this [15:57] with new beautiful thing that we have [16:00] happened in City work is again to Mr T [16:02] welcome by the [16:04] community I still want to get into a [16:06] place where we start I still want to [16:08] leave some room for us to be responsive [16:10] to like what the needs of the community [16:12] are so in other words like I think that [16:14] there are some rules that are probably [16:17] pre-existed the pool when you're in [16:18] another location and sometimes it's not [16:21] necessary about like implementing new [16:23] rules but making sure the ones that are [16:24] existing are followed with some level of [16:26] fidelity so I would just um as we're [16:28] thinking about what we could do at this [16:30] schol we want to give ourselves some [16:31] some autonomy here to say hey this is [16:34] working well for the community and this [16:36] isn't and I think that maybe it'd be [16:38] wise for us to just know that as we [16:40] enter this conversation that this might [16:41] be something that comes up again and we [16:43] should be expecting to maybe make some [16:46] adjustments as it relas to as what we [16:48] see come up I'll when I actually I'll [16:51] call the boys and girls SP and see what [16:53] the current rules um have been because I [16:55] haven't done that yet so um I'll do that [16:58] before I reached out to them okay yes so [17:02] um again you have the rules they have [17:06] they're in their [17:08] Transit okay great yes I spoke to them [17:11] as well and they are going to be sending [17:12] that but my understanding there is [17:14] already uh something underway for rules [17:16] to be developed based on what the mayor [17:19] said okay [17:22] yes so I'm trying to confirm that the [17:26] sign which has been printed should [17:29] install I thought was going to [17:30] happen last [17:35] week I I just I just want to say that [17:38] today when I was up at Central Park uh [17:40] just walking into the park there was a [17:42] young man coming towards me with a towel [17:44] around his neck and I said Hey how do [17:46] you like that pool and he said oh the [17:48] pool's closed and I [17:51] said no I don't think the pool's closed [17:53] and it turned out he went to the old I [17:56] said we have this like incredible new [17:57] pool you need to turn around right now [17:59] and go back to the pool but uh he he [18:01] said it's getting a little late now I [18:03] have to go [18:04] home so obviously we need to get more [18:06] promotion out there about the new pool [18:08] as well um so I just want to say I mean [18:12] I know that we have these other things [18:13] that we need to do but overall to have [18:15] the pool there I've been get a lot of [18:17] really wonderful feedback there were [18:19] lines and not necessarily one people [18:21] waiting in the line but there there [18:22] people were just excited about it so uh [18:24] we'll iron up those details absolutely [18:26] no to it's a fantastic thing I'm [18:29] thrilled that we have it so Mr Williams [18:32] uh just a point of clarification outside [18:33] of the lifeguards are there any other [18:35] guardians or just oversight figures [18:37] there I think the only worry that I have [18:38] is who's going to be responsible for [18:41] implementing or like reinforcing some of [18:42] these rules I think the expectation [18:44] shouldn't be for like teenagers or [18:46] college students to be calling out [18:47] adults for not adhering to the to the [18:50] expectations in the pool honey I'll [18:52] defer to the mayor but my guess is that [18:54] it's the boys and girls club uh [18:56] lifeguards that are the people that are [18:58] there and I I think we also are going to [18:59] have to I mean obviously uh depending on [19:02] the age of the child at least when you [19:04] when you go through this an adult needs [19:06] to be present with children um so one [19:09] would hope that you know we would also [19:12] um have our parents uh [19:16] the following rules as well but [19:18] currently the Boys and Girls Club you [19:20] have to be um with the rules that [19:21] they're using you have to be um if [19:23] you're 13 and under or 12 and under so [19:26] 13 and up you can be on your own but 12 [19:27] and under you have to be accompanied by [19:29] a parent or Guardian that's a little [19:31] older than some Mr Williams point the [19:34] front line is the staff and boys and [19:37] girls park supplemented with [19:41] staff par department and the police [19:50] department Gazette we are currently in our [20:43] 30-day public comment period so today [20:45] I'm here asking city council to please [20:48] call for a public hearing on July 27th [20:50] to discuss those government [21:47] operations we have two items on the [21:50] agenda today uh first being uh the [21:53] renaming City street uh be Village Lane [21:56] to Lane Mr Mr wall [22:03] hello hello everyone so just a refresher [22:07] uh I have the ordinance in front of me [22:08] in July of 2021 the city accepted the [22:12] ownership of a uh a roadway essentially [22:15] an alley behind the liven concy project [22:17] on Barrett Street uh and the name that [22:20] came with the development was Barrett [22:22] Village Lane um you know at the time [22:25] there was not much into the name we just [22:27] accepted it as is uh in the road with [22:29] built to City standards and we move [22:31] forward since that time uh I've been [22:33] reached out to uh by the family uh who [22:36] was around and who will probably speak [22:37] in a moment and they have requested that [22:40] the city look to uh change the name to [22:43] Luigi Lane in uh commemoration of their [22:46] grandfather father Uncle friend who [22:49] operated uh the Luigi restaurant uh [22:51] beginning in 1950 on the former site of [22:53] where living connect is um just before I [22:57] introduce uh Mike T one of the grand STS [22:59] I just wanted to let you know that I did [23:01] reach out and speak with the uh property [23:04] owners of the uh conglomerate that was [23:06] liven connect which is essentially um [23:09] you know Dave buo and John roal of [23:11] hybrid as this was a uh and uh they did [23:14] not have any objections and in fact uh [23:17] John Roth uh supported it as he said [23:20] that his parents were a good friends of [23:21] the legi and Abell and they always had a [23:24] uh nice things to say about them and so [23:26] I thought that that was nice just also [23:28] to let you know um there are no uh [23:30] residences on this street typically what [23:33] you'll see uh in the city is that we do [23:35] ceremonial resolutions uh for s name [23:38] change and the reason for that is um to [23:41] change the name of a street that has [23:42] been in existence for 75 years would [23:44] have a very large repercussion on the [23:46] residents of that street as there are no [23:49] residents on this street as it [23:50] essentially is an alley um the naming of [23:53] it uh would be actually changed so no [23:56] two signs it would be one green sign [23:58] sign uh so without that anymore I'd like [24:01] to introduce Mike tyno and whoever else [24:03] just to talk about and this is a call [24:04] for public hearing I understand that [24:06] they can come and talk at the public [24:08] hearing but I did not want you to have [24:10] no information going forward for your um [24:13] uh support of this I'm sorry good [24:16] evening I just wanted to uh take this [24:18] moment to talk about my grandfather and [24:20] why this is a viable name change not [24:22] just for us but for the city um my [24:26] family here and um my grandfather was [24:29] the fifth of 11 children born to Luigi [24:31] bagil senior and Angelo lazeri he was [24:34] born in Pennsylvania while his parents [24:35] lived and worked at a logging camp at 2 [24:38] years old they returned to Italy there [24:40] he was only educated until the age of [24:41] eight before he had to begin working to [24:43] help support his family in 1938 at age [24:46] 19 upset with fist Italy and the threat [24:48] of a war looming he made a difficult [24:50] decision to return to the United States [24:52] this left this meant leaving behind his [24:54] siblings and family that weren't US [24:56] citizens he worked as a B in Manhattan [24:59] for 4 years before being drafted into [25:00] World War II in 1942 where he would [25:03] serve in the Pacific after the war he [25:05] reunited with many of the siblings and [25:07] family who had then relocated his family [25:10] he worked at the prestigious van carair [25:12] hotel now known as connecting community [25:14] colleges eston [25:16] Hall he took his wages from the war and [25:19] everything he had saved in searched for [25:20] a restaurant of his own he looked into [25:22] purchasing a restaurant called the [25:23] Victoria on North J Street and it was [25:25] there that he met my grandmother at Del [25:27] Moret the restaurant was owned by my [25:30] great-grandfather he used to joke that [25:32] he went looking for a restaurant and [25:33] ended up finding a wife my grandmother [25:36] and her three brothers were born and [25:37] raised on North J Street the gateway to [25:39] skc's Little Italy in 1950 he purchased [25:42] Stella's restaurant around the corner on [25:44] Bar Street and renamed it Luigi's after [25:46] himself with no formal education but a [25:49] work ethic that began as a child he [25:51] operated a successful restaurant during [25:53] an exuberant period of sc's History [25:56] Luigi's was a popular location for not [25:58] just the residents and families of the [25:59] city but also GE and Alco Executives [26:01] Union professors and City officials [26:04] through determination dedication and [26:06] hard work he made his American dream a [26:08] reality he had successful business with [26:10] fathers six children 12 grandchildren [26:12] had countless friends and was happily [26:14] married for 48 years in 1981 he wly sold [26:17] the restaurant and retired after doctors [26:19] told him that he was literally working [26:20] himself to death I'd like to briefly [26:23] read a citation from his retirement [26:25] ceremony that reiterates and reinforces [26:27] some of the information I just [26:30] share whereas Luigi bag Jr has recently [26:34] retired from the restaurant business and [26:35] has many friends have seen it fitting [26:37] and proper to honor him at a testimonial [26:39] dinner on this 27th day of October 1981 [26:42] in appreciation of his services to disc [26:44] connected community and visions and [26:46] whereas Luigi born in wels be [26:48] Pennsylvania spent his boyhood in the [26:50] hammer of cilia Italy where he learned [26:52] his culinary art which he offered to his [26:54] native country upon his return from [26:56] Italy just before the entry of the [26:57] United States in World War II and [26:59] whereas although having a language [27:01] barrier at the time Luigi attained the [27:03] rank of Master Sergeant in the South [27:05] Pacific where all the commissioned [27:06] officers were killed Luigi was next in [27:08] the chain of command and successfully [27:11] led the remnants of a battalion of [27:12] troops whereas Luigi's success would [27:15] made possible because of Luigi's [27:17] astuteness and picking Adele as his wife [27:19] now be it resolve that I Frank J DUI May [27:23] mayor of the city of skak New York site [27:25] Luigi bag Jr for his contributions to [27:28] his country and the City of skincity and [27:30] wish him and Adele many years of [27:31] peaceful and happy matrimonial Bliss be [27:34] it further resolved that this citation [27:36] be presented to Luigi bagioli by my UST [27:39] illustrious predecessor former mayor [27:42] Malcolm e Ellis who is one of Luigi's [27:44] closest [27:47] friends uh the name change will be a [27:49] positive upgrade from the current street [27:50] name and a way to memorialize a small [27:53] piece of Sky history was also a fitting [27:55] name to the Little Italy Sky [27:56] neighborhood I hope I have your support [27:58] and this renaming and thank the council [27:59] for your time i' especially like to [28:01] thank councilwoman Dar Doro and the [28:03] mayor for supporting this proposal we [28:05] pick on tonight's agenda and the city [28:07] engineer Chris Wallen who has given me [28:08] his time support and guidance thank you [28:13] I think it's always important that [28:14] anytime we get a chance to kind of [28:16] highlight the legacy of people um our [28:18] citizens we should do so especially this [28:20] sounds like you know an amazing person [28:22] qu who left quite a a large footprint in [28:25] the community so I you know any other [28:27] questions or com prise around [28:29] this so I will Mr well I'd say I'd be [28:33] remiss if I didn't say even just taking [28:35] aside his military service your [28:36] grandfather truly is the representation [28:39] of just uh stepping forward and [28:41] answering the call I think on top of [28:43] that truly he represents the uh the good [28:45] nature of the members of our community [28:47] and skans and that they are hardworking [28:49] tenacious uh very very looking for [28:51] handouts willing to do the work and this [28:52] truly is a reflection of all that so [28:55] excited to see this this really is a is you Mr Mayor Mr uh uh Mr [30:32] chairman this is um as you know that the [30:35] uh there's no Provisions in our current [30:38] Charter regarding what happens after [30:40] November 1st looking at the charters of [30:43] our surrounding cities the city of [30:45] Albany the city detoy the city of [30:47] Amsterdam they have procedures for for [30:50] if something is not adopted and what you [30:54] see before you is is the procedure from [30:58] the city of Albany but also a tweet from [31:00] the city of Amsterdam on how the process [31:03] goes forward if the budget is not uh [31:06] adopted by the uh the date of November [31:09] 1st and you see as it goes back it goes [31:11] through the entire legislative process [31:14] if the budget isn't adopted then the [31:17] mayor's proposed budget is is is uh is [31:22] adopted if the council [31:24] adds amendments if those amendments [31:27] aren't [31:28] uh done under taken acted upon by [31:31] November [31:33] 10th [31:35] um the the honoral force November 10th [31:40] and uh if not mayor may v one or more of [31:43] the proposed amendments the mayor fails [31:46] to act on those proposed amendments then [31:49] the budget as amended by the city [31:51] council comes the budget and if the if [31:54] the budget is if mayor does veto it [31:58] honor before November 20th the city [32:00] council May override mayor's V all one [32:03] more of its proposed amendments the [32:05] council overrides the mayor's be in the [32:08] city operating budget with any item so [32:10] overridden together with any change not [32:12] Beed by mayor mayor shall be deemed [32:15] adopted and failure by the city council [32:18] to act on the mayor's veto by November [32:20] 20th shall result in the adoption of the [32:22] operating budget along with any [32:24] amendments not previously veto by the [32:26] mayor so there's a process back and [32:28] forth was with the councel and the mayor [32:31] both going back and forth given the time [32:33] to act upon the budget so by November [32:37] 20th which is around Thanksgiving give [32:39] or t the budget process is [32:42] complete tax bills can be prepared [32:45] Equalization rates Etc all those other [32:48] things that have to be done is taken [32:51] care of by the end of by the end of you [32:53] know November so it goes back and forth [32:56] now because we're dealing with changing [33:00] the roles and procedures between the [33:02] mayor and and the uh and the council [33:05] this has to go to a mandatory [33:08] referendum amending the city Charter and [33:11] it's affecting the roles between the [33:14] council and the mayor um and therefore [33:17] it's subject to a mandatory [33:20] referendum um as the mayor indicated [33:23] that in order to get this there has to [33:25] be public hearings and and then [33:28] eventually adoption by the city council [33:31] signed into law by the mayor subject to [33:34] referendum this has to go over to the uh [33:37] Court of election 60 days before the [33:39] general election which [33:40] is so just giving you a overview of of [33:45] the process um it's really through the [33:48] summer um going through the process and [33:52] having the public hearings looking at [33:54] this final adoption for the we going [33:59] going over to the board of elections in [34:01] September [34:02] 3 and that will not affect this year's [34:05] budget process but will affect [34:09] 2025 budget year subse [34:13] Years thank you questions comments on [34:16] this so tonight you just so tonight [34:19] you're just providing this for us to [34:20] take a look at it to provide [34:24] feedback right and I know you said so [34:26] essentially the timeline is would have [34:28] to have it to the Board [34:39] have the public hearing public hearing [34:40] will be on the [34:41] 22nd according to the uh Municipal home [34:44] rule law because the city was connected [34:47] has a strong executive mayor with veto [34:49] power the mayor has it's mandated to [34:52] hold a public hearing uh himself on on [34:55] the on the proposal so the council made [34:58] to do so and the uh the mayor is [35:00] required to do so according to the [35:03] municipal home [35:05] R um so I'd like to like spend a little [35:10] bit more time like looking at it and [35:13] um because well I'm just at at first [35:16] blush you know when I'm first looking at [35:19] it I just need more time to look at it [35:21] how to say that and I just wanted to [35:24] also just to be clear so I know like [35:26] there's three ways to um amend the [35:28] charter so we have this one because of [35:29] what it is has to be referendum [35:31] absolutely okay has to be referendum [35:34] because you're dealing with powers the [35:36] two [35:42] branches and so if we had a call for a [35:45] public hearing would the public hearing [35:46] would be based on what you're providing [35:47] to us tonight is that correct [35:51] okay I'm comfortable calling for a [35:53] public hearing I mean I I would have to [35:55] say that [35:57] I don't know about the rest of you but I [35:59] had some sleepless nights last year um [36:01] in terms of really worried about what [36:03] was going to happen if we hadn't passed [36:05] the budget by the end of um 2023 and [36:09] going into January I was worried about [36:11] both [36:12] our the functioning of the city our [36:15] employees uh security Etc so I think [36:19] this is a uh a good idea I think that it [36:22] will um Force us as a group to be more [36:25] accountable as well um so in terms of [36:29] opinion um my opinion would be that this [36:32] this is a a good thing for us to be to [36:34] be doing so um I don't have a problem [36:37] you know it's um calling for the public [36:40] hearing but um if we have to wait get [36:44] that too that's my two sents yeah Mr [36:48] thank you so you know when we received [36:50] this last week so I did have a chance to [36:52] look it over read it over and made a few [36:53] notes I'm very comfortable as well uh [36:56] because of the situation that we into [36:58] last year even with our tax bills [36:59] getting out late um you know residents [37:01] were concerned um people were calling [37:03] constantly am I going to get a charge so [37:06] anyway I I I think it's something that [37:07] we really need to [37:09] do moving forward as soon as possible [37:12] sure president I agree that we [37:14] definitely have to put something in [37:15] place um I don't necessarily agree that [37:18] this as it is written uh because [37:21] essentially if we didn't pass the budget [37:23] then it would automatically go back to [37:25] the mayor's budget I don't um you know [37:28] we as a council part of our [37:29] responsibility is to pass the budget so [37:32] if we have concerns or we want to make [37:33] changes if if the if it automatically [37:36] goes back to the mayor's budget that any [37:38] amendments that we would have had would [37:40] necessarily kind of disappear so I'm not [37:43] I'm not 100% comfortable that it [37:44] automatically goes back to the mayor's [37:46] budget I would entertain it going back [37:47] to the prior Year's budget which means [37:50] that we all have a say and how what the [37:53] budget was until we can um work through [37:55] any amendments but I wouldn't I wouldn't [37:58] automatically um um just defer back to [38:00] the to the utive budget VAR by the mayor [38:03] so I want to take a little bit more time [38:04] to look through that talk um talk to our [38:06] Corporation Council about all the things [38:08] that are in here just need to be able to [38:10] make sure um as we move forward Mr Mayor [38:15] again I have to submit it by October 1st [38:18] the council has the month of October to [38:20] act on not adopted by November [38:24] 1st last over half century council is [38:28] always able to come to some agreement [38:29] with the mayor and the council last year [38:31] we didn't so I don't [38:33] know again this is just codifying [38:38] process that eliminates any ambiguity [38:41] and puts everybody under a little bit of [38:44] pressure I understand [38:46] you're ping this to look at it [38:49] and there are some changes hopefully get [38:53] them out in a day or two to the council [38:56] so we can make those changes move ahead [38:58] with the public area so it seems like [39:00] good thing is that you know throughout [39:02] that process which I think we all [39:04] learned learned some things and I think [39:06] that um you know as somebody who was was [39:09] working extremely hard to make sure that [39:11] we could kind of meet each other where [39:12] we were at and and get a budget pass [39:14] which we ultimately did um I think that [39:17] the need for this is is is clear and [39:19] there's a some consensus among the group [39:21] that there's a that that there's a need [39:23] here um to president Porter fil's Point [39:26] um and kind into what been indicated by [39:28] uh Corporation Council that this is [39:31] something that really impacts the checks [39:33] and balances of how we operate so I [39:36] think that um uh careful consideration [39:38] is not only a good idea but it's [39:40] definitely warranted in this case so I [39:42] think that you know we we do that and to [39:44] the mayor's point we just do that um uh [39:48] as as fast as we can um where we're not [39:51] uh impacting the Integrity of of the [39:53] process itself so any other thoughts on [39:56] that Mr Miss i i would support moving it [39:59] to a public hearing I think these [40:01] additions put in the necessary [40:03] guardrails to avoid what happened last [40:05] year so I would be in support of moving [40:07] this forward um this clearly is giving [40:09] us kind of a timeline that we need to [40:12] adhere to so I'm in support of it I [40:15] would also kind of rais the point that [40:17] to I agree that um about the necessary [40:20] guard rails um I think that what this [40:23] would do at the level of the text um [40:25] will definitely put in place those guard [40:26] rails I think that we can uh end up in a [40:29] place where we have the same guard rails [40:30] and still hold ourselves to that level [40:32] of accountability but if there's any [40:33] concerns or questions or maybe um some [40:37] scenarios that we haven't had [40:39] opportunity to play out I think uh in [40:41] consultation with uh Corporation Council [40:43] um and a research that's going to be [40:44] done by as members I think would be a [40:46] good thing to do for for something this [40:48] nature but good thing that we all agree [40:50] that something doesn't happen Mr [40:52] Williams and for the sake of commenting [40:54] I think you put it accurately he said [40:55] careful consideration I think when ever [40:57] we can um meet other council members [41:00] where they stand with having further [41:01] questions or wanting to digest [41:03] information I think as long as it [41:05] doesn't come at the expense of the [41:06] timeline and I think already and I [41:08] applaud the mayor for ensuring that this [41:11] topic was on our discussion prior to us [41:12] entering this upcoming budget season [41:15] Corporation Council correct me if I'm [41:16] wrong we have time I don't foresee this [41:20] exhausting all the time up until [41:22] September 5th but I think allowing 2 [41:24] weeks or or or I think that is more than [41:27] appropriate and I do not think that [41:28] comes at the expense of us passing this [41:31] collectively um but yet again I I think [41:33] meeting counsel is where they are regard [41:34] regardless the topic again as long as it [41:36] doesn't come at the expense of us [41:39] passing a set item I don't think that's [41:42] an [41:43] issue any other comments questions [41:46] around [41:47] this okay so i' I'd like to to have that [41:51] time to take and and bring it back in [41:53] two weeks and make the decisions and I'm [41:54] just I'm not ready to move it to a [41:56] public hearing the way it is based right [41:58] here what on the agenda discuss sure I [42:01] just was wondering what your concern is [42:03] my concern as I stated is that when if [42:05] we don't pass the budget that [42:07] automatically goes back to the mayor's [42:08] budget and then I feel like then we've [42:11] kind of given up our shed our [42:12] responsibility in terms of putting forth [42:14] the budget because no wa to I'm just [42:17] saying because then any concerns or any [42:20] changes that we want to make would not [42:21] take place if it didn't happen like [42:24] that and it's a scenario where if if we [42:29] went through it last year it kept [42:30] getting pushed back to us and kept [42:32] pushed back and that if that timeline [42:34] plays out then it automatically goes [42:36] back to the mayor's budget and I think [42:38] that a budget that involves all of us [42:40] having say in it is the type of budget [42:42] that we want and this in this scenario [42:46] it does not work out like that so I want [42:48] to look at it and see how we could [42:50] change some of this so that the council [42:52] does what it is been members are elected [42:55] to do which is to help pass up [42:57] and we have to have some we have to have [42:59] some say on what that budget looks like [43:01] if we're going to not just pass [43:03] it those are my [43:07] concerns so we will have a say in what [43:11] gets passed because of the timeline um I [43:15] also want to not to bring up arguments [43:17] from last year but again I think we need [43:20] to understand that our department heads [43:23] work very closely with their expertise [43:26] and their their experience on the [43:28] budgets that they then present to the [43:30] mayor uh and then they kind of go back [43:32] and forth so um I think we will have [43:36] input we would have input into the [43:38] budget it just holds our feet to the [43:41] fire um in a way that I think is [43:43] appropriate given what happened last [43:45] year so um I'm not on this subcommittee [43:48] I would encourage the committee to you [43:50] know move forward with the public [43:52] hearing because I think we have all the [43:54] information right here and I think that [43:56] um Corporation Council indicated that [43:58] Aly and Troy and Amsterdam have similar [44:02] language in their um in their um yes [44:07] they're all similar Lang where they have [44:08] this process where they when's adopted [44:11] goes to the council override Etc it's [44:14] all this process okay so um hearing what [44:19] everyone's point of view is I think that [44:22] right now we're in a pretty good place [44:23] where we can um allow members of the [44:27] council who might have you know cuz [44:29] right now we're basing on what's in [44:30] front of us right here correct maybe [44:32] there's some other um uh suggestions or [44:35] input that that can kind of uh bring us [44:38] together in in a point of agreement so I [44:40] would really uh being with the timeline [44:43] what it is I think that you know we [44:45] really should give that opportunity to [44:47] any council members who um want to look [44:49] at this a little more closely or maybe [44:51] introduce some different ideas and again [44:53] it won't impact our timeline it's the [44:55] good thing is that we all are an [44:57] agreement that something needs to happen [44:59] um and I think that the conversation um [45:02] will be a more productive and beneficial [45:05] one if we're saying you know what this [45:07] is something that maybe I think that we [45:08] can consider so I just you know being [45:10] that you know we don't lose anything by [45:13] uh the due diligence of the council [45:15] members to kind of look at this and and [45:17] maybe look at other uh options that can [45:20] get us to the same place so with that uh [45:22] I will just um you know I W call for the [45:26] public hearing right now I don't think [45:27] we need to do that what we'll do is uh [45:30] you know and not that I would ever [45:32] firste Us in uh set situation that that [45:34] we've been in before but I think it is [45:36] our responsibility as a council to again [45:38] have some guard rails in place and I [45:39] think that this will do that and and we [45:41] need to give our our teammates the [45:43] opportunity to um cuz this is a really [45:46] significant substantial decision and I [45:49] think it definitely requires again some [45:51] careful consideration and as long as [45:53] it's not impacting the timeline what do [45:54] we lose by giving our colleagues the [45:56] opportunity to Del deeper maybe come up [45:58] with some something that that that might [46:00] even fit better for us than it does for [46:02] some of our uh surrounding [46:06] municipalities any other thoughts or [46:08] questions on that President P I would [46:09] just ask that Mr um O'Brien if you could [46:12] just um provide for us the other um [46:16] municipalities information where this [46:17] was derived from yes that was to be part [46:20] of the consideration right that wouldn't [46:22] be a problem all right thank you but um [46:25] just to be mindful of you know the [46:28] timelines a veto and overriding the time [46:30] if you're over going to override The [46:32] veto of the mayor whatever you come to [46:34] and goes to the mayor and it's veto you [46:37] have 30 days in which to override The [46:39] veto and I think at that point you have [46:41] to be mindful of the time absolutely I [46:44] think y I think that we understand that [46:46] you know any you know if president P [46:49] fail if mrini is saying that hey we want [46:51] to look at this I think that I would [46:53] encourage all our council members to do [46:54] so you know as quickly as POS possible [46:57] as long as you're you know again not [46:59] compromising the Integrity of the [47:00] decision that you arrive at because this [47:01] is a pretty consequential piece of [47:03] legislation so um [47:06] yeah [47:08] so with that I will and and uh we'll [47:12] bring this back in 2 weeks [47:15] well sure we can BR back in two weeks if [47:18] that's if that's well we have to well [47:20] know what I would say is that if we um [47:23] the mayor was saying you know in a [47:25] couple days uh hopefully we could you [47:27] have something to to him to you know for [47:30] his consideration or for a larger [47:32] consideration with the group I was going [47:33] to say when we say we'll bring it back [47:35] in two weeks that doesn't mean that we [47:36] won't do our due diligence within that [47:38] timeline no we'll definitely do our due [47:40] diligence and we want to make sure like [47:42] this is a change to our Charter it's [47:44] significant um and U we want to make [47:46] sure that all council members actually I [47:48] know that Mr is absent today and [47:50] sometimes that happens but this would [47:51] also give him time to um to be able to [47:54] provide any input and um can I also just [47:57] say that as this was brought up I took [47:59] the opportunity to look at the CH [48:01] Charter in its entirety and it might [48:03] just be time for an overall uh revision [48:06] of the chart because some of the even [48:07] some of the language in there like a [48:09] constable we haven't had conable I can't [48:11] tell you when so this might be a time [48:12] where us you know it came up and I'm [48:14] said well let me look at this and uh so [48:16] maybe we may want to look at the entire [48:18] Charter and make sure that everything is [48:20] as it should be not this time though I [48:22] mean just P [48:24] moment but there is a process with a [48:26] revision and I think that we should [48:28] really consider doing that to make sure [48:30] that our Charter um meets what today's [48:32] standards are actually need in today's carry [49:42] Street Park along the basketball court [49:45] and the playground um we received three [49:47] bids the low bid was byal construction [49:51] um we did call five references including [49:53] a reference in the city of Albany for a [49:56] here that we work with all the [49:57] references came back fine um we are [50:00] looking to award all of the alternates [50:02] as it was in budget and the budget will [50:04] be split between arpa funding that was [50:06] set aside for Lo League improvements and [50:09] Facilities funding as the park is not [50:12] part of [50:15] the so um in terms of the organ Avenue [50:18] and I know that's where the arpa money [50:19] is so this is the fencing but is there [50:21] other are there other things that are [50:23] also going to be happening in addition [50:25] to that I know it's part of this correct [50:28] yes so now that we have our budget [50:30] number we wanted to see what the budget [50:32] number was so when we received this uh [50:35] since it was under the budget that we [50:36] had we then issued a PO for a new [50:39] scoreboard so the scoreboard is actually [50:41] ordered it was underneath the the value [50:44] we needed to bid so the scoreboard is [50:46] ordered uh City forces have been there [50:48] we've repaired some of their uh septic [50:50] issues they have had volunteers uh [50:53] donate time to often times requires them to maintain uh [1:00:36] the viability of our community I did [1:00:38] have a few questions you mentioned that [1:00:40] it was going to be $10 for 20 minutes I [1:00:42] see in the pricing structure [1:00:45] hopefully all right cool U so I didn't [1:00:47] know if there was a guess 20 minutes and [1:00:49] 30 minutes but so we can discuss that [1:00:51] later also in your contract it said that [1:00:53] You' pay a fee of $250 you [1:00:57] mind even if she presented [1:01:00] that negotiating contract well mean not [1:01:03] negotiating getting a definition of [1:01:04] where she came from I think you know we [1:01:06] can bring that back if the council wish [1:01:08] should negotiate with that we can put [1:01:11] that right prop vendor [1:01:15] concern so the question is with their [1:01:19] for the general question what's what's [1:01:21] the proposal on [1:01:24] now say how much you how much you you [1:01:27] want to pay the [1:01:28] city OWN [1:01:56] say once [1:01:57] again if we have any concerns about [1:01:59] proposal perhaps we can do that [1:02:02] executive session and we can reach out [1:02:04] to the proposed vendor with their [1:02:06] concerns and I guess a final question in [1:02:09] um timeline should we approve it uh how [1:02:12] fast will you be able to implement that [1:02:13] are you thinking about this season and [1:02:15] do you already have the [1:02:17] equipment I was like way I said the [1:02:19] paper I was try to open this as soon as [1:02:22] possible like I put it in writing was [1:02:24] supposed to be June 3D but as you see [1:02:28] June so i' been waiting so I was happy [1:02:30] to receive a phone call from Mr PA when [1:02:32] he called me like oh you forget me so so [1:02:37] now we are in July as soon as possible [1:02:40] cuz at this point we only have like what [1:02:43] July August it be like two months cuz [1:02:46] the city asked that the uh bo have to be [1:02:50] out the water before uh September 3rd or [1:02:54] after September 3rd [1:02:57] so we only have like two months but you [1:03:01] do have equipment already though yes we [1:03:02] have the equipment already everything is [1:03:05] set up oh okay that okay thank you so um [1:03:09] I think there are some questions though [1:03:11] that the council has that we would have [1:03:13] to address those in the executive [1:03:17] session so um there's Council has other [1:03:20] questions and we're going to have to [1:03:21] talk more about that in executive [1:03:22] session because it it has to do with the [1:03:25] contract and we can't [1:03:26] that publicly okay okay so is the city [1:03:29] going to send me the contract or what I [1:03:32] well depends on the decision comes out [1:03:34] that you also [1:04:14] one there [1:04:15] was there was one piece of legislation [1:04:18] of the legislation that um there were we [1:04:22] received [1:04:23] emails and email and also someone came [1:04:26] to speak at the public hearing and they [1:04:28] followed that up with the email as well [1:04:30] and it had to do with the um number of [1:04:33] people on the [1:04:34] [Music] [1:04:35] commission as far as I know that was the [1:04:37] only area of concern that was brought up [1:04:39] at the public hearing um what I did take [1:04:43] a look at is uh all of our other boards [1:04:47] that we have and essentially most boards [1:04:49] with the exception of the um the board [1:04:52] of assessment review which meets just a [1:04:54] few weeks to um to for assessments and [1:04:57] then the ethics board which meet seems [1:05:00] like every uh every decade um they have [1:05:03] five but everything else has between [1:05:04] seven and nine and um if you would just [1:05:08] in your packet you have the input from [1:05:10] the individuals [1:05:14] who unan part of the grp that [1:05:16] unanimously um voted to try to keep it [1:05:19] at 7 and um just want to have some [1:05:22] discussion around that in terms of that [1:05:25] and and you know how we how we move [1:05:28] forward I did um I did have a discussion [1:05:30] with Miss caror to explain um you know [1:05:33] how I I saw this but I'd like to open [1:05:36] this up to the council for discussion [1:05:38] because uh at the public hearing that [1:05:40] was the only concern that was brought up [1:05:43] as part of this [1:05:46] um as part of this amendment to the [1:05:50] ordinance [1:05:51] so yes Mr to um I I would go on the [1:05:55] advice of of the historic commission um [1:05:57] they've been doing this job a long time [1:05:59] for many years having a business and a [1:06:02] home both in historic uh districts here [1:06:04] in the city I appreciate everything they [1:06:06] do keeping things [1:06:09] um keeping things uh true to to their [1:06:13] their past um my feeling is if they [1:06:16] think seven uh would would always uh [1:06:19] constitute uh getting a better Quorum um [1:06:23] and I'm going to go with their advice I [1:06:25] think it should stay at 7 and instead of [1:06:28] down to 5: again that's if I mean it's a [1:06:31] it's a it's a huge undertaking this this [1:06:34] commission itself um there's a lot to [1:06:37] consider a lot of meetings there's a lot [1:06:38] of areas in the city that they have to [1:06:40] consider but um again if if these [1:06:44] individuals um who have reached out to [1:06:46] us have uh Richard and Gloria have been [1:06:48] on this commission for a long time and [1:06:50] and I think if they think seven is [1:06:52] worthy then I I would suggest we stay [1:06:55] with seven [1:06:57] anybody else Miss Patrick well I do have [1:07:00] concerns um I I appreciate what Miss [1:07:02] Toro um and the commission is saying um [1:07:05] at the same time I appreciate what the [1:07:07] staff is saying [1:07:09] having I mean if we look on page 46 of [1:07:12] our packet we did get I think that you [1:07:14] asked for that these statistics um [1:07:18] and you know they really haven't had uh [1:07:21] great attendance at the um according to [1:07:24] this um we can see that I think we can [1:07:29] understand why our staff person was [1:07:30] recommending the change um but yes I can [1:07:35] see also that the commission is asking [1:07:37] for us to stay at 7 but I guess I would [1:07:39] have to say that we really would need to [1:07:44] make sure that they were going to be [1:07:45] able to have you know more than four [1:07:48] people there right well I'm sorry go [1:07:51] ahead Mr no I was going to kind I agree [1:07:53] with what uh m b is saying I think that [1:07:56] you know we're in a cuz all things that [1:07:59] we're talking about here kind of you [1:08:00] know have Merit it makes sense to you [1:08:01] know kind of defer to the people who are [1:08:03] in the position right now who understand [1:08:05] how things have been going um or or [1:08:08] what's necessary but then looking at you [1:08:10] know kind of the information that [1:08:11] receive based on outcomes it does seem [1:08:13] to be a struggle so I guess the question [1:08:16] is you know if we were to defer to um [1:08:20] people assign a commission how would [1:08:21] they demonstrate their ability to not be [1:08:23] in the position that they're currently [1:08:25] in [1:08:26] so I I think in terms of demonstrating [1:08:28] the um um that they would not be in this [1:08:32] position part of that is our [1:08:33] responsibility it belongs to the city [1:08:36] that because we [1:08:38] really we've kind of went through this [1:08:40] process similarly with the um the cprb [1:08:43] true so it's about um making sure the [1:08:47] applications are submitted my [1:08:48] understanding from one of the emails is [1:08:49] there are current applications that are [1:08:51] we have here that have not gone through [1:08:53] the process and therefore you know one [1:08:55] they have to come to us before we can [1:08:57] make a decision on them so um I I don't [1:09:00] I looked for it in the code I looked and [1:09:02] I didn't see where there's any clear [1:09:04] process we know that we know you know [1:09:07] because of how we've been doing it that [1:09:08] it goes to the mayor and then mayor [1:09:09] brings to the council but I don't see [1:09:11] where there's any any written process [1:09:14] and um so with the cprb the way we found [1:09:17] out about it is that the um the chair of [1:09:19] the cprb came to us and said oh we need [1:09:21] people and and I kept pushing that [1:09:22] forward when it happened with the [1:09:23] Planning Commission the chair of the [1:09:25] planning commission came forward when it [1:09:27] happened with the Bureau of assessment [1:09:29] the board of assessment review our staff [1:09:31] member who works with that particular um [1:09:34] board told us so we've got varying ways [1:09:38] so I think part of it is the process and [1:09:40] we have to make sure that we have the [1:09:42] process and then once we have [1:09:43] applications that we um that they're um [1:09:47] acting on in in an expedited manner so [1:09:50] that there is not this um from November [1:09:52] till May like we had with the cprb so [1:09:55] part of that is making sure that we have [1:09:57] all the information and all people that [1:09:59] need to have the information are aware [1:10:01] and the applications move through the [1:10:02] process in an expedited manner so that [1:10:05] people can get the quum so it's not [1:10:07] entirely I mean I would say that the [1:10:09] board has responsibility to say hey [1:10:12] we're missing but what is the process [1:10:14] who does it go to and how do once [1:10:16] applications get here we make sure that [1:10:17] applications move through the process [1:10:21] so so um and the I um my my [1:10:25] recommendation is that we allow the the [1:10:28] applications that are there be moved [1:10:30] forward and looked at and moved forward [1:10:32] so that um they could be able to get a [1:10:34] form and to me it's easier to if like [1:10:38] for instance that you look at the [1:10:39] information that um that was provided by [1:10:41] Miss haror in terms of them not getting [1:10:44] um not having only four people but if [1:10:46] you only have five to choose from and [1:10:49] four come you have the majority but if [1:10:51] you if you have seven then you have two [1:10:53] more people you can ask that you can't [1:10:56] that that would be available so I would [1:10:59] recommend that and if if we could um get [1:11:01] those applications moved forward and [1:11:04] give it at least till the end of the [1:11:05] year and see that if they're getting the [1:11:07] quum and and move forward like that but [1:11:10] I I uh with I would have to agree with [1:11:12] Mr Toro that the folks who do this who [1:11:14] volunteer their time um it's not [1:11:17] compensated uh that they have the [1:11:19] opportunity as long and they're willing [1:11:21] to work with um the department head and [1:11:23] and again I think that we need to talk [1:11:25] about not just for this board but for [1:11:27] all the boards we need to talk about [1:11:28] what the process looks like getting [1:11:30] people getting applications and get them [1:11:32] moved through the so they don't we have [1:11:34] vacancies for a long period of time that [1:11:36] causes people not to have a [1:11:38] quum Mr Williams Oh So what I first [1:11:41] would like to identify is in no ways [1:11:43] there a slate at the planning and [1:11:44] development um department for putting [1:11:46] together these amendments I think it was [1:11:48] definitely their best interpretation of [1:11:49] how to respond uh to address the quum [1:11:51] issues but I truly believe in responsive [1:11:53] government and as we had we've heard [1:11:56] from individuals that are uh serving in [1:11:58] these capacities saying hey can you [1:11:59] pause and and [1:12:02] reidentifying with that if there are [1:12:04] applications that haven't been processed [1:12:07] or if there is hesitancy on on um the [1:12:09] approving agency's part I think can we [1:12:12] discuss having a criteria uh where what [1:12:15] are the Baseline considerations expected [1:12:17] for a candidate and I think in similar [1:12:19] fashion to how uh Chief Marino and the [1:12:22] police dep and the fire department [1:12:23] excuse me have uh identified a base [1:12:26] level exportation and they'll train you [1:12:27] the rest of the way can we have a [1:12:29] baseline exportation that evaluates time [1:12:31] served to help bridge some of those uh [1:12:34] uh gaps if you say and having like a [1:12:36] true candidate um but definitely we had [1:12:39] some of these similar concerns with the [1:12:41] cprb and I think today it's been the [1:12:43] most uh staff so far so I I agree uh if [1:12:47] there have been historic vacancies uh I [1:12:51] think it is not uh um uncustomary of us [1:12:54] to pause and see if there's ways we can [1:12:56] just re-evaluate ways to just boost um [1:12:59] participation but also in the right way [1:13:01] where we're not uh taking expenses at [1:13:04] just quality candid coming [1:13:08] for put your hand up are you no okay yes [1:13:12] Miss Patrick well I think Mr Farley has [1:13:14] okay Mr far certainly so I would just I [1:13:17] guess something I think we [1:13:18] should probably don't talk about enough [1:13:20] which I think that we have to uh [1:13:22] demonstrate the curage to address when [1:13:24] anytime we talk about it board positions [1:13:25] I think that you [1:13:27] know maintaining [1:13:30] um a larger board I think gives more [1:13:33] people opportunity and gives us a better [1:13:35] opportunity to have a more diverse and [1:13:38] inclusive uh board voice and I think [1:13:40] that so that's something that we have [1:13:42] council members no matter what we're [1:13:43] doing any decision we're making we [1:13:45] should be looking through an equitable [1:13:47] lens and you know I would love to invite [1:13:50] my colleagues to kind [1:13:53] of be raise that point a little more [1:13:56] often um because it's something I think [1:13:58] that is something that's the expectation [1:14:00] of the people of our community that um [1:14:02] we represent that we uh make sure that [1:14:04] we're being as inclusive and and all of [1:14:06] these um volunteer pay whatever the [1:14:09] situation of the board is that we set it [1:14:11] up in a way that gives us the greatest [1:14:12] chance to uh be more inclusive and to be [1:14:15] equable M Patrick I was just wondering [1:14:17] if there were other I mean there's a lot [1:14:19] of changes in here that's just one uh [1:14:22] that's being recommended so I just [1:14:23] wanted to see if there were other I mean [1:14:25] this is there's a lot in here so I [1:14:27] didn't know if we wanted to summary um I [1:14:30] know that particular staff person isn't [1:14:33] here tonight but [1:14:36] um we gave a summary already of all the [1:14:38] changes we pres the city C so so they [1:14:42] gave the summary and the only and then [1:14:45] there was the public hearing so the only [1:14:47] thing that came out of the public [1:14:48] hearing and that was reviewed by [1:14:50] everyone you know who had interest in it [1:14:52] and that was the only um concern and and [1:14:55] change that was that was requested [1:15:00] okay yes do we know anything about in [1:15:02] regard to the bylaws if if there are [1:15:05] members that are passing consistently [1:15:08] where they can maybe be discharged and [1:15:11] bring out a new member um and maybe [1:15:13] keeping a number a little bit smaller [1:15:15] but we move people quicker for not [1:15:18] showing up you know my the only concern [1:15:21] I have is is that there's not a quum so [1:15:23] there's a lot of time time being wasted [1:15:26] so I'm wondering if they have um I think [1:15:29] um we looked at that before in another [1:15:31] board that if somebody isn't showing [1:15:34] that we can move move them and then [1:15:36] bring on another candidate I don't know [1:15:40] if the bylaws address it or not I'm not [1:15:42] sure I can get back to [1:15:43] you what you see is is what what you [1:15:47] that's that's the the operating [1:15:49] structure you made some changes to the [1:15:52] board of assessment review earlier this [1:15:54] yearing attendance issues was the to to [1:15:58] amend the attendance and they were being [1:16:01] paid uh so there is there are no bylaws [1:16:05] um regarding that and based on the [1:16:08] information we received it said that [1:16:10] they uh had to vote unanimously it [1:16:12] didn't say that nothing passed that so [1:16:15] so what ended up happening the four [1:16:16] people were there and the four people [1:16:19] unanimous bu on it so it was if if there [1:16:22] had been three people that said yes and [1:16:24] one person said no that would have been [1:16:25] a problem but so far that hasn't been [1:16:28] the [1:16:29] problem so which to me again speaks to [1:16:32] the fact that you should have more [1:16:33] opportunity a bigger pool to choose from [1:16:35] to lessen the um possibility of having a [1:16:40] not having a [1:16:43] COR so the the uh it's on page 63 and [1:16:47] item uh number one article [1:16:51] 10 uh membership [1:16:55] so the way it's being proposed is that [1:16:57] it should it go down to five and then [1:17:00] one alternate member to serve in the [1:17:02] absence of a [1:17:07] member and Mr O'Brien the one alternate [1:17:11] member was an addition when when you [1:17:13] change when it was the requested was to [1:17:15] change it from 5 to 7 7 to five you [1:17:17] would just want to keep the seven [1:17:19] everything else uh leave the [1:17:22] same yes that's that's what [1:17:25] consensus of the council just change the [1:17:27] board you know keep keep it in other [1:17:29] words the draft is amended but the [1:17:34] actual code is not because the code is [1:17:36] not the code is decreased the amendment [1:17:39] is asking for a decrease but you don't [1:17:41] want want to do that so just the uh [1:17:44] proposed uh legislation just has to be [1:17:48] amended to reflect seven instead of five [1:17:50] yes membership is that the is that the [1:17:54] any other change regarding that that's [1:17:57] that you're all good with that okay yes [1:18:00] so we just change the draft for it to be [1:18:02] said sure I don't know that that this is [1:18:04] something that need to be addressed in [1:18:06] this but I think it should just be noted [1:18:07] that cuz I I heard you say at least to [1:18:10] the end of the year to see and then make [1:18:12] could revisit something like that I [1:18:14] think that that's a good I don't know [1:18:16] that that needs to be in the amendment [1:18:18] right but just it's [1:18:19] just always say corre at any time you [1:18:24] can just saying for clarity expectation [1:18:27] transparency purposes I think it should [1:18:28] be [1:18:29] so would you pass [1:18:32] think [1:22:50] we need to be able to move forward on [1:22:52] some of this um we've heard from various [1:22:56] residents um about the concern about [1:22:59] speeding and other types of uh traffic [1:23:01] infractions that have been happening uh [1:23:04] the concerns that I brought up last time [1:23:06] uh had to do with um how we would go [1:23:09] about uh educating how we would go about [1:23:12] with uh making sure that we were [1:23:14] enforcing um again I think we need staff [1:23:17] to be able to um talk with us about um [1:23:21] which streets would be uh 2 M an hour um [1:23:26] I because there are some streets that we [1:23:28] know we wouldn't want to put down to 25 [1:23:30] M hour but as we've said over and over [1:23:34] again for the last few years in bringing [1:23:36] this forward um even Bringing Down the [1:23:38] speed limit from 30 to 25 there's [1:23:40] research that shows um that that has an [1:23:43] impact on pedestrian safety for sure um [1:23:46] I think we've heard from um I think you [1:23:50] know Chief Clifford's not here but I've [1:23:53] heard from um a couple of U members of [1:23:55] our Police Department that if we were to [1:23:57] lower the speed limit then we could at [1:23:59] least know that people might go 30 uh [1:24:02] instead of 25 um it gives them a little [1:24:04] bit more flexibility in terms of being [1:24:06] able to um issue tickets um so I just I [1:24:12] I you know I don't know the next step um [1:24:14] I think um obviously there'd be some [1:24:17] budgetary issues in terms of changing [1:24:19] the um the signage um again the signage [1:24:23] is primarily um at entranceways to the [1:24:26] city [1:24:27] um so I leave it open for folks to chime [1:24:31] in here but see what other people feel [1:24:34] um well the last time we talked about [1:24:36] this um we uh we asked that Chief [1:24:39] Clifford Mr Canon and [1:24:41] uh Chris Wallen is now gone to talk [1:24:44] about this so I I agree that we need to [1:24:48] do that um the there was an accident [1:24:51] that happened last August I think all of [1:24:54] you may have know about that at this [1:24:56] point in time where a woman was [1:24:57] seriously [1:24:58] injured and um I mean a traumatic brain [1:25:02] injury and [1:25:04] so there's definitely a problem with [1:25:06] speeding I think we've all seen it we [1:25:07] didn't have to wait for an accident to [1:25:09] see it we've all seen it I also [1:25:11] understand that there's only certain [1:25:12] there's certain street that that we [1:25:14] can't apply this to but we would [1:25:16] definitely need to hear um again from Mr [1:25:18] Wallen and from Mr Canon Mr yeah Mr [1:25:23] Canon who I guess the fine person U he [1:25:25] replaced John kucho and uh Chief [1:25:28] Clifford but I don't know how we um can [1:25:32] get that [1:25:34] accommodated to have them here so we can [1:25:36] you know hear what needs to be done and [1:25:38] then move [1:25:39] forward get it scheduled and get them [1:25:41] here with an appropriate presentation [1:25:43] okay so for the next committee meeting [1:25:46] quite possible their calendar July's a [1:25:50] little bit harder with some vacation I [1:25:52] tentatively say yes cancel [1:25:55] vacations the city council controls the [1:25:59] terms and conditions of employment so if [1:26:01] you want to do a resolution canceling [1:26:03] vacation I don't think they'll be very [1:26:05] popular resolution I I just wanted to [1:26:08] point out that um we do have a resident [1:26:09] here this evening who did give us um [1:26:11] some additional information about lower [1:26:13] speed limit so I appreciate that um it's [1:26:16] information that uh came to my attention [1:26:19] a couple of years ago um I support the [1:26:22] the information that that's in there um [1:26:24] so I hope that everybody will take a [1:26:25] chance take a moment to to to look at [1:26:27] that and we have other residents here [1:26:29] this evening as well who have come [1:26:31] continuously to our Council asking us to [1:26:34] move forward um with trying to you know [1:26:37] Implement some change so um I think [1:26:42] especially as we when we move into the [1:26:43] budget season it's clear that we will [1:26:46] have some budget implications of this um [1:26:49] in terms of do we need additional stop [1:26:51] signs do we [1:26:52] want to to think about you know what [1:26:55] happens with cameras on stop lights and [1:26:57] whether tickets get automatically um [1:27:00] issued if someone goes through a redl [1:27:02] for example I mean that was something [1:27:03] that Mr PA manyy brought up when he was [1:27:05] on Council so some of this has [1:27:07] implications budget wise and we would [1:27:10] have to care for staff um regarding [1:27:13] those kinds of things yes and also I'm [1:27:16] going to say 5 years ago I think I [1:27:18] presented something to for us to get [1:27:20] speed hunts which took 3 years and then [1:27:22] we only had it as a demonstration [1:27:24] project on one street so we definitely [1:27:26] need to look at traffic calming measures [1:27:29] um to to make sure that um that we [1:27:32] address this problem so um if if and I [1:27:35] don't even know where those speed humps [1:27:37] are now because they didn't come back [1:27:38] out again this summer I have no idea so [1:27:41] we definitely have to do that and but in [1:27:43] addition to all of the things that we [1:27:45] passed we have like implementation and [1:27:47] enforcement is going to be a huge part [1:27:49] of this whole process yes yes M and I do [1:27:52] want to say um was expressing this to a [1:27:55] resident that called today but um I've [1:27:57] really racked my brains um I know this [1:27:59] is going to sound really wacky but I [1:28:01] mean one of the ideas that I have is [1:28:03] whether we could approach um something [1:28:06] like AAA to see if you know they would [1:28:09] offer um a free defensive driving course [1:28:13] to Residents who um you know I I don't [1:28:16] know I mean all of this would have to be [1:28:18] worked out in terms of a program but I [1:28:20] know I myself did that during Co when we [1:28:23] were stuck in home home you know before [1:28:25] vaccination time I took that defensive [1:28:27] driving again for the second time in my [1:28:29] life and um I know that it has [1:28:32] influenced my behavior um as I drive [1:28:35] around the city and um you know I would [1:28:37] hope that that might have an impact as [1:28:39] well so we have to try to come up with [1:28:41] some other creative uh ways to the the [1:28:45] behavior issue I feel is just so [1:28:47] fundamental uh I encourage all of you to [1:28:50] when you leave tonight go drive home 25 [1:28:53] M hour on the streets that you think [1:28:55] this might happen and you'll see that it [1:28:56] is difficult to do so um but again I [1:29:00] mean it's a safety factor that I I I [1:29:03] really can't discount enough and you'll [1:29:05] see that um again this is this this [1:29:08] handout is definitely some of the things [1:29:10] that I I saw when I was first [1:29:12] researching this so please uh pay [1:29:16] attention to this and let's try to um [1:29:18] you know get the staff here and try to [1:29:20] come to some [1:29:22] decisions um about this [1:29:25] uh Mr Wings so I I [1:29:31] um I know there are a number of [1:29:32] residents who are looking at this [1:29:33] conversation and saying that again this [1:29:35] is an item that's been talked about and [1:29:37] talked about and talked about and no [1:29:39] action has been conducted and to them I [1:29:41] would just like to ask for their [1:29:43] contined patience um I think I always [1:29:46] appreciate a light light Baner [1:29:48] especially kind of referencing the the [1:29:50] budget season um but with all sincerity [1:29:53] this is [1:29:54] a a a a dire issue that we need to [1:29:57] address um I need to miss um Patrick's [1:30:01] Point I don't think we're short of ideas [1:30:03] it's just selecting one um I'm glad that [1:30:06] we've expanded from the singular focus [1:30:09] of uh this item with addressing just in [1:30:11] governements in general and I think we [1:30:12] truly need to have a comprehensive [1:30:15] approach for the entire city uh even in [1:30:18] separate facets but for my entire [1:30:19] Council um career that highlighted just [1:30:23] neighbor hoods throughout the city that [1:30:24] are experiencing this to varying degrees [1:30:27] um but but collectively as a city we [1:30:29] need to respond and again if that is [1:30:32] waiting for the conversation to have the [1:30:33] proper uh agents and agencies to speak [1:30:36] to this I I I uh I yield to that um but [1:30:39] very much I correct me if I'm wrong [1:30:41] anyone at the table I think we do not [1:30:44] need to experience a fatality to [1:30:46] understand the severity of this and uh I [1:30:49] I appreciate the individuals throughout [1:30:51] the city who are taking the time to [1:30:52] adhere proactively to being uh slower in [1:30:56] their vehicles um but we are addressing [1:30:59] individuals that are taking a less of [1:31:00] regard for it um so again it is our [1:31:03] responsibility to hold individuals uh [1:31:06] accountable for helping us identify the [1:31:08] proper solution we have had measures in [1:31:10] place referencing the speed humps that [1:31:12] have been indicated that they had a had [1:31:14] a a positive impact um but again we just [1:31:17] need to respond and then hold that [1:31:20] response year in and year out um in [1:31:23] order [1:31:25] this yes Mr Mr far we has his hand up [1:31:29] yeah so I'll try to be brief as I can I [1:31:31] think this is has there's been some [1:31:33] learning for me in this cuz initially I [1:31:34] was just like okay yeah we keep talking [1:31:36] this why AR we just doing something but [1:31:37] I think that now recognizing you know [1:31:40] what steps have to be in place and for [1:31:41] us to make an informed decision I will [1:31:44] second what Mr Williams kind of thrs [1:31:45] around like it we need to make sure that [1:31:47] we're doing this in a way that's smart [1:31:49] that has an impact on why I guess then [1:31:52] my other question you know we're kind of [1:31:54] wering if you will is what can we do in [1:31:57] the meantime because I feel like you [1:31:59] know I know we talked about uh you said [1:32:02] some speed humps that were out that we [1:32:04] might have in possession of the city are [1:32:06] there things that where we can as we are [1:32:09] going through the process are there you [1:32:12] know as we go through the kind of the [1:32:13] graduated interventions are there things [1:32:15] that we can do along the way um as far [1:32:18] as uh you know maybe bringing out [1:32:20] whatever speed humps that we have um and [1:32:22] putting those in um um the areas that [1:32:24] have been identified to be you know kind [1:32:26] of those more high-risk areas um is [1:32:29] there um signage that we have that we [1:32:31] can kind of post up so I'm just welc [1:32:33] like like what are some of those [1:32:36] more measured responses as we wait to [1:32:39] get to kind of that larger response um [1:32:42] and if there are those I would just [1:32:44] encourage us to at least do those things [1:32:45] like I don't know exactly what all of [1:32:47] those are yes well for example we have [1:32:50] um we have like the digital uh you know [1:32:54] sign like the one you at high school you [1:32:56] know if you're coming up um is it Mullen [1:32:59] um you know that kind of thing where I [1:33:01] mean again I would think that when [1:33:03] people see what their speed is and what [1:33:06] the speed is supposed to be hopefully [1:33:08] that would make them so we have you know [1:33:10] that that's one type of traffic calming [1:33:12] measure that that also could could [1:33:14] happen um we did I just wanted to point [1:33:16] out publicly that we did get the home [1:33:19] rule legislation passed in August of [1:33:22] 2022 so that we move forward with doing [1:33:25] this um changing the speed limit so that [1:33:28] piece is in place [1:33:30] um and then otherwise I think we need to [1:33:33] hear from staff on some of these other [1:33:35] items I would agree we definitely have [1:33:37] to hear from staff but I um because I [1:33:41] would I would um say to council members [1:33:43] forward your questions to the clerk's [1:33:46] office so that anything that you want [1:33:47] staff to consider or talk about in the [1:33:49] presentation uh that that they would [1:33:52] have the information prepared ready to [1:33:54] talk about it at that time and and to Mr [1:33:57] Char point I think this the staff is [1:33:58] going to have to be the one who decides [1:34:01] you know what measures can be taken in [1:34:02] what steps because you know they do that [1:34:04] more and also we did do when there was a [1:34:08] situation on King's Road they did [1:34:09] Implement some things in addition to [1:34:12] that some of the stop signs where it has [1:34:15] the light that uh like light has extra [1:34:18] lights on it so there have been some [1:34:20] things that have been implemented but [1:34:21] clearly we need to do more so we yes Mr [1:34:25] Toro um I did know it stop signs all on [1:34:27] Eastern Avenue as well there now there's [1:34:29] red reflection tape on the bottom of the [1:34:31] stop saw that too so kind of brings them [1:34:35] right out I mean maybe not everyone can [1:34:37] have every sign can have the [1:34:39] uh right but um yeah so there are [1:34:43] different meth you know different [1:34:44] methods to catch our attention yes [1:34:47] you're right but again once everyone [1:34:50] gets here and um we can come up with a [1:34:52] plan and I it's a good idea that we do [1:34:54] send our questions to to the clerk so [1:34:57] that at least when they get here they'll [1:34:59] know what what you know a lot of our our [1:35:01] concerns are probably all the same [1:35:03] because we hear the same thing from [1:35:04] everyone throughout so and I think the [1:35:08] for that maybe um like what kind of data [1:35:11] would we have like time of day accidents [1:35:14] tickets issued the most complaints so [1:35:17] like like you talked about yeah The Hot [1:35:20] Zone yeah we have all that we've had [1:35:23] that presentation actually even also so [1:35:26] we could probably ask for that's one of [1:35:28] the questions we can make sure the data [1:35:29] is up to date from when of the last time [1:35:31] we had prev so at this point in time we [1:35:34] bring this back in two weeks and again [1:35:37] submit any of your questions concerns to [1:35:38] the clerk's office so they can be [1:35:40] forwarded to the appropriate staff so [1:35:42] when Council meetings at [1:35:57] the last committee meeting I asked that [1:36:00] we add one thing to um the current rules [1:36:03] of the Forum that being that if the [1:36:05] individual um s the would state that by [1:36:09] signing this I agree to adhere to her [1:36:12] abide by um the rules of the Quorum and [1:36:15] so miss uh Miss barage said that she [1:36:18] wanted to look at whether or not that [1:36:19] was something that we could legally um [1:36:22] do and so so um I'll just let her she [1:36:27] present some case law which all of you [1:36:29] should have a copy of and I'll just let [1:36:32] her present um what her opinion on that [1:36:37] is thank you madam president um as the [1:36:41] chair uh you have you are the one who [1:36:44] can run the meeting so you can enforce [1:36:47] uh the rules that you would like to [1:36:50] enforce [1:36:54] um I provided you with case law for our [1:36:57] discussion and if you have further [1:36:59] questions you can present them so based [1:37:02] on the case law um the case law really [1:37:05] talked a lot about um violating people's [1:37:08] Fifth Amendment rights and I don't see [1:37:11] um asking people to say that I'll hear [1:37:13] by the rules is violating their Fifth [1:37:15] Amendment rights in any way so um for me [1:37:18] it's I say that we you know I want to I [1:37:21] would like to move forward so that it's [1:37:22] there that a person signs it and says I [1:37:25] I'm willing to go by these rules I don't [1:37:27] see where there's a violation of the [1:37:29] person's First Amendment [1:37:32] um right so unless you I just don't see [1:37:35] it in there Mr far oh no that's so I was [1:37:39] asking Corporation Council do you feel [1:37:41] that that we can get into that uh space [1:37:44] of violing someone's rights by acing [1:37:46] them to sign that or just trying to see [1:37:48] what your opinion is on that um I've not [1:37:51] I've never provided an opinion that [1:37:54] uh it's a violation of the rights V [1:37:56] rights um it's up to a judge If This [1:37:59] Were if someone were to accuse the city [1:38:03] of that uh it's not up to me so it's [1:38:07] possible but there's the potential that [1:38:10] someone [1:38:12] would uh try to make that clean I'm not [1:38:16] providing an opinion on whether they [1:38:18] would win or [1:38:20] not because it's up to a judge or a jury [1:38:23] at the end of the day not to [1:38:27] me did you have did you have a [1:38:31] hand anyone else so our question [1:38:35] is when they sign in there's the rules [1:38:40] of um the cor the Corum that they're [1:38:43] going to follow that is what we're [1:38:45] asking him and if it's your [1:38:47] interpretation as the if they violate [1:38:50] that and you can that's currently [1:38:52] already like that yeah yeah that's [1:38:54] that's already there if someone starts [1:38:55] to swear you've seen it and like you [1:38:57] know then they get stopped this is [1:38:59] simply saying that I'm willing to do [1:39:01] that that's I think it's already implied [1:39:04] but I'd like to see it just added to [1:39:09] that yes Miss Patrick and again I think [1:39:11] what we talked about at the last meeting [1:39:13] was that it could be at the top of the [1:39:15] there could be a statement at the top of [1:39:16] the signning [1:39:18] sheet that indicates this is what you're [1:39:20] signing you [1:39:21] know I don't know the language that we [1:39:24] used but I'm just saying once they sign [1:39:25] their name onto that signin sheet it [1:39:27] would mean that they were agreeing to [1:39:29] whatever was at the top of the [1:39:31] sheet and so and that's what I'd like to [1:39:34] and then I do think um that again [1:39:37] council president maintains that order [1:39:40] um by virtue of I mean announcing what [1:39:43] the rules are um and then keeping [1:39:47] people to task um as they speak which [1:39:50] you know you do do [1:39:54] so I just would like to add that to the [1:39:56] to the rules of the form just [1:39:59] so it's there and people are [1:40:03] clear Mr Williams um so I would say I [1:40:06] definitely don't see an issue with that [1:40:08] I'm not an attorney or practicing law [1:40:10] nor what I want to um but definitely [1:40:13] it's identified as privilege of the so [1:40:16] to me that sounds like there is a a [1:40:18] shared understanding of what it is you [1:40:20] need to fulfill to have this ability to [1:40:22] speak [1:40:23] um I think just uh lining up or or [1:40:27] having the written justification I think [1:40:29] looks beyond the individual that's [1:40:31] currently in the seat but provides that [1:40:32] justification because in instances there [1:40:35] have been individuals that challenge [1:40:37] what is not written and it should not [1:40:39] have to be up to interpretation it [1:40:40] should be something that is again [1:40:42] written so we can reference um for all [1:40:46] Clarity within [1:40:48] reason I'm sorry within [1:40:51] reason may I haven't had a chance to [1:40:53] read these documents [1:40:55] then okay yes so we can wait until the [1:40:59] next cycle um but I again to me that um [1:41:02] these documents don't address what my [1:41:04] question was and was my question was [1:41:06] simply a statement of saying if I if I [1:41:10] sign this by signing this I will adhere [1:41:12] to these rules and these documents speak [1:41:15] a lot to um people's strength amend [1:41:17] being [1:41:18] violated I think just again I'm just [1:41:22] briefly looking at the case some in this [1:41:23] one and the last sentence there does say [1:41:25] the First Amendment did not protect [1:41:27] defendant's right to discuss irrelevant [1:41:29] topics at the meeting so yeah and which [1:41:32] is already in there we we kind of say [1:41:34] that in in terms of the public [1:41:36] hearing yeah I would just say I think [1:41:40] um the reality is no matter what it says [1:41:44] on on paper our expectations and our [1:41:46] rules I my my very very very very [1:41:50] limited scope of understanding um to [1:41:52] this [1:41:53] how I understand it would be that [1:41:55] someone's uh uh first their First [1:41:59] Amendment right will supersede any real [1:42:01] expectation that we um have for them [1:42:04] anyway I believe that that would be the [1:42:06] kind of the final say on that but again [1:42:09] so I'm completely okay with I think what [1:42:12] you're uh kind of bringing forward is [1:42:14] saying that there's a clear [1:42:16] understanding and not just an implied [1:42:18] understanding of what people sign which [1:42:19] I think is really good um again though I [1:42:22] would just be really defer to [1:42:24] Corporation counsel if they have any [1:42:25] reservations around that I would welcome [1:42:28] that and we should probably you know I [1:42:29] that would be something that I would [1:42:30] want to take into a strong [1:42:32] consideration I think since the uh chair [1:42:37] already um can call someone out of order [1:42:40] and [1:43:04] to this [1:43:05] is unnecessary I think it's quite [1:43:08] necessary quite frankly based on some of [1:43:11] the [1:43:13] uh meetings we've had and going forward [1:43:16] so that people understand that the [1:43:17] reason that we even had the rules of the [1:43:18] form to begin with a couple years ago [1:43:21] was because it was just getting a little [1:43:23] a little dicey so that's why we came up [1:43:25] with a B so I'd like to see that on [1:43:27] there and I'd like to um be able to work [1:43:29] with Corporation counsel for us to have [1:43:31] appropriate language that just spells it [1:43:34] out like that and being able to bring [1:43:35] that back into it Mr oh is your hand [1:43:39] up I think well I'll make a comment I'll [1:43:43] prer to the councilman it's councilman [1:43:45] well no I think we just have to [1:43:47] recognize that there will be risks there [1:43:50] will be risks of you know um getting [1:43:53] suit it sounds like or getting having to [1:43:56] you know be brought to Fort um so we [1:43:58] have to understand those risks if we [1:44:01] decide to move forward with that I might [1:44:04] I know you're not making an opinion that [1:44:05] it would be up to a judge but that's [1:44:07] what I'm hearing in other words of [1:44:08] course anybody could bring us to court [1:44:11] if they wanted to everything a risk yeah [1:44:14] so I just wanted to say that publicly [1:44:16] that a risk 100% And there's a risk with [1:44:19] almost anything that we have to do yes [1:44:22] Mr fary yeah and just for clarity my [1:44:24] question would you know wouldn't [1:44:25] necessarily be about whether it's [1:44:27] necessary or not I think that that's [1:44:28] well within the um real house of the [1:44:31] council and and to experience the [1:44:33] meetings whether you think it's [1:44:34] necessary or not my question is is more [1:44:36] along the lines of because it makes [1:44:38] reasonable sense to me I would support [1:44:40] it but I want to make sure that we're [1:44:42] deferring to Corporation counsel to make [1:44:43] sure that we are in you know legal [1:44:45] parameters and minimizing the likelihood [1:44:48] of Us ending up in a situation that we [1:44:50] don't need to be so that was really M [1:44:52] May [1:44:53] yeah what's your end goal you put the [1:44:57] rules down which people already know or [1:45:00] should know somebody violates it what [1:45:02] are you looking to [1:45:04] do my own goal is to well already when [1:45:07] people violate it I tell them my my goal [1:45:08] is just to state for people in the very [1:45:10] beginning that we our expectation of you [1:45:14] is that you will go cool by the slides [1:45:16] that's it so and I don't and again I [1:45:19] don't I don't find you don't need the [1:45:20] corporation counsel or any other staff [1:45:22] to do it prerogative have the clerk put [1:45:25] it on the list put it there and we're [1:45:27] done with it know it's the end becomes [1:45:31] what do you do do you rule somebody out [1:45:33] of order do you recess the meeting [1:45:35] sergeant-at-arms you bring the police in [1:45:38] we can remove somebody if they're really [1:45:40] uh totally out of line that seem to be [1:45:44] overly complicating something solely [1:45:46] within the barog of the organizational [1:45:48] structure of the BS Office of the [1:45:49] council president well that's what I [1:45:51] thought the last meeting how Corporation [1:45:53] Council said that we need to have a [1:45:56] legal um opinion on it do you seem going [1:46:00] clear I was very clear I don't mean [1:46:04] in [1:46:07] okay I think there would have to be some [1:46:10] consequence though I think that's what [1:46:11] the mayor is asking so I mean when I [1:46:13] look at um again I've only briefly [1:46:15] looked at this but it looks like we [1:46:17] would be saying okay someone will be [1:46:18] removing this person from our Chambers [1:46:21] and Roberts rules the borders cover a [1:46:23] lot which the way the council um 28 of [1:46:27] the code explains that uh Robert's rules [1:46:30] are what we abide by unless it's [1:46:33] otherwise so Robert's Rules covers [1:46:34] covers those things yes yes Mr fary and [1:46:38] I I would just say that this might not [1:46:39] be um I I don't see this necessarily as [1:46:42] a reactive thing this can kind of be a [1:46:44] proactive thing that reduces the [1:46:46] likelihood of us getting to that place [1:46:48] right so where people understand that [1:46:50] when you sign up you know you're not [1:46:52] just signing your name to speak on this [1:46:53] list you're signing your name to speak [1:46:55] on this list and there is a shared [1:46:57] understanding of how wom will conduct [1:46:58] themselves by speaking in this way and [1:47:00] this and if that's clearest among them [1:47:01] they're less likely to to make his point [1:47:04] to get way out of line and I think so [1:47:06] that there are things that have in [1:47:07] placed to address the people do that [1:47:09] behavior I think that this is a pretty [1:47:11] lowrisk way as long as it's [1:47:13] constitutionally sound a lowrisk way to [1:47:15] um uh minimize the rest of that [1:47:19] happen so B with the mar say we can just [1:47:22] um do that through the council so [1:47:27] willing to I still would want I would um [1:47:29] pass the language just to make sure if [1:47:32] Corporation Council is over with me to [1:47:33] make sure but I don't I don't think the [1:47:36] language that I am actually submitted [1:47:38] did not but just basically said you'll [1:47:40] abide by the source [1:47:41] so we will have that ready for the next [1:47:44] council [1:47:46] meeting any other questions or further [1:47:48] discussion on this [1:47:51] topic okay the last two items are for [1:47:55] executive session and um and then we
