and first I can [3:36] introduce the mother of the team was uh [3:39] Jamie flowers who earned her diploma in [3:41] Pharmacy technology Jamie initially [3:43] started the pharmacy technology program [3:45] in [3:47] 2003 but PA their education is to take [3:49] care of a young kids and help them grow [3:52] up but persistance pays off and here she [3:55] is today in 2024 finishing that program [3:58] she hopes to secure a position I in an [4:00] inpatient facility where she can fulfill [4:02] her passion for assisting pharmacist and [4:04] providing patient care in addition have [4:07] a daughter here as well Candace Brewer [4:11] earned her uh diploma in Aesthetics [4:15] graduated from pen High 6 months early [4:18] looks his accomplishment and was drawn [4:20] to cfcc a studies program due to her [4:22] deep interest in the connection between [4:23] exterior appearance and mental health [4:26] well-being upon passing her state [4:28] certification she hopes to work working [4:30] at a salon where she can immerse herself [4:32] in learning about the field her ultimate [4:34] goal is to sort her own business but in [4:37] addition to that cace also received the [4:40] uh presence award which meant she had an [4:42] overall GPA of 4.0 so it's impressive [4:46] both were born and raised here in uh in [4:48] pen County and currently reside in [4:50] ainson and both chose cake fury because [4:53] of the proximity to home affordability [4:55] and overall reputation but what they [4:58] don't re realize is that when we have [5:00] commencement we typically give out uh [5:02] basically a letter in a portfolio a [5:05] folder and later because we have some [5:07] many students we mail them but I have [5:09] the originals here tonight for you so [5:11] you don't have to wait for them in the [5:12] mail okay so if you would you could come [5:17] up that's to Jamie [5:20] [Applause] [5:24] first and then also for Kansas we have [5:27] your diploma but also certific [6:53] up 18 and a half per. this shows that we [6:55] really are pushing hard in Pender County [6:57] to increase the attendance and if you [7:00] recall you know a couple years ago we [7:01] bought two buildings over here in Bal [7:04] and now we've received $4 million that [7:06] go toward the expansion of Surf City [7:09] pretty much duplicate the space we have [7:11] there to add another [7:44] and um here's our presentation here is [7:47] this the clicker okay so um before I [7:51] begin we have officially changed the [7:53] name to uh from Henderson Field Airport [7:56] to Wallace Pender Airport [8:00] and [8:01] um it's a very exciting partnership [8:03] we've got going we love we appreciate [8:05] all your support throughout the year and [8:07] from the years past we also need is even [8:10] the radio calls are now the proper radio [8:13] call is Wallace Pender airport so Pilots [8:15] here that Pender County uh across the [8:18] radio and of course uh Mr Fred McCoy is [8:20] one of our advisory council members so [8:24] it's good to see you a lot of people [8:25] don't realize that's in P the county [8:27] wall yes yes yes [8:32] sir so here's a little overview of the [8:34] airport our identifier is Alpha Charlie [8:38] Zulu right now the runway is [8:41] 4,150 Ft uh we have 100 low Leed Avgas [8:45] and we have jet a um we have a crew car [8:48] for Pilots to use and we've had several [8:50] Pilots that'll fly in across the state [8:52] other states they'll use the crew car to [8:54] go to burgal they use the crew car to go [8:56] to in town Wallace to do other various [8:58] business [9:00] activities we have tie down and ramp [9:02] Space storage places for planes to park [9:05] for transient planes and also stationary [9:08] planes right now uh we have 14 hangers [9:11] there and we have an onfield uh [9:13] maintenance facility that's privately [9:14] run there as well that's aircraft [9:18] maintenance um our clientele will get [9:21] business jets that come from all the way [9:22] from Austin Texas to look at new [9:24] business [9:25] opportunities and then we also of course [9:28] they'll will have house raford come in [9:30] to fly in their their check on their [9:31] farms and we also have a lot of [9:35] small two seater four-seater airplanes [9:37] and these are families traveling across [9:39] the country or they're for used for [9:41] recreational or flight training [9:46] purposes and uh here's our meet the crew [9:49] U that's me on my name is Ben Jones [9:51] there on the right I've got David pal he [9:53] he's in the middle he's a part-time [9:55] employee and I've got Anthony Roso on [9:57] the left he's also a part-time employee [10:02] and as you can see as the year's Trend [10:03] we're getting busier and [10:05] busier [10:07] um 2023 physical year we were just right [10:11] at the 6,000 [10:14] operations uh mark this year we broke [10:17] the 7,000 operation Mark and I have [10:19] print outs if you would like to see them [10:20] later after my [10:24] presentation so the biggest reason we're [10:27] here today not only just for the yearly [10:29] up update all these projects that we've [10:31] been talking about is is finally coming [10:33] together it's finally happened the grant [10:35] money has been awarded and the bids are [10:38] in and the road relocation project will [10:41] be starting between November and [10:44] December and as you can see Old bille [10:48] Road and Wallace Airport Road will be [10:50] rerouted and the old road will be [10:53] reclaimed and the the runway will be [10:55] extended to 5,500 ft and this is so [10:59] important because more private jets and [11:02] also more flow and of customers will be [11:06] coming to the area spending money in [11:09] Pender County and also the land around [11:11] it can be developed for Aviation [11:14] purposes bringing in a lot more jobs to [11:16] the to the [11:19] community and here's a closer look at [11:22] the map as you can see and this has been [11:24] on the wall of the of the FBO terminal [11:26] for several years now and it's it's been [11:29] at least a five-year project getting the [11:31] do to approve and the grant money so [11:34] look for changes around the rock fish [11:36] area of of Pender County right there [11:39] around the [11:42] airport the second project we have which [11:44] is happening even sooner it's going to [11:47] be the runway rehab and lighting program [11:49] we're going to be rehabing the existing [11:51] Runway that we have now getting it ready [11:54] to extend in possibly two years from now [11:57] and it's all do Department of Aviation [11:59] Grant funded through the dot and is [12:02] going to me out the old existing Runway [12:05] and we're getting new LED lights which [12:08] are better for the pilots to see at [12:09] night they also use less electricity and [12:12] they also have a much longer life on [12:15] those individual lights and of course [12:18] the project will also be prepping for [12:20] the runway extension and that'll be [12:22] early September 2024 so now I'm thinking [12:26] that's going to be more at end of later [12:28] September 24 and this grant money has [12:30] been already awarded and um Fred Smith [12:34] Company got the bid for this individual [12:36] project uh Barnhill got the bid for the [12:40] re Road relocation [12:45] project so now as we're expanding [12:48] looking to the Future here is the map [12:50] that shows [12:51] you the F the total phase one [12:55] project uh the the new phase one project [12:57] will will have a parallel t tax way now [13:00] Pilots have to land and Back Taxi to get [13:03] to the ramp we'll have an actual [13:05] parallel taxi way the new improvements [13:07] are there are in the [13:09] purple we'll also have a new FBO [13:11] terminal building a 10 acre ramp which [13:14] is in [13:15] Orange um and the plan is to build [13:17] corporate and general aviation tea [13:20] hangers and as this airport grows the [13:22] economic impacts for pendrick County I [13:25] would say would was going to explode for [13:27] this community because we're going to [13:28] have so much more offered for larger [13:31] companies to move to Pender County [13:33] because they look how close their [13:35] company or their Farm is based to a [13:38] large general aviation [13:42] airport H I didn't [13:46] want and here's a larger map of the [13:50] project of this is phase one phase uh [13:52] the end of phase one this is after the [13:54] road has been realigned the earliest for [13:57] this the road has to be done first and [13:59] that's a 365 Day project just for the [14:02] road so next year that should be [14:04] finished the phase one project is two to [14:07] three years out in the time window for [14:09] the runway extension and the parallel [14:14] Runway and just a quick conclusion we we [14:18] love serving our community uh we have [14:20] the Young Eagles Boy Scouts they fly [14:23] children from the age of 7 to 17 three [14:26] times a year at the airport and and uh [14:29] it's a free airplane ride for children [14:31] in the and they can get their Aviation [14:33] badge the bo Scouts and it's not just [14:35] boys it's boys and girls in that age and [14:37] it's a free airplane ride all they have [14:39] to do is sign up in advance through our [14:41] uh the the Young Eagles program and they [14:43] can find that by calling the airport or [14:45] also the EAA chapter here in bural at [14:48] stag a park they also partnership with [14:50] us there as [14:52] well the mlad leadership academy also [14:55] hosts a a ground School for Children uh [14:57] interested in learning aviation jobs and [15:00] they come three times a year and we host [15:03] a class with the kids about different [15:05] job opportunities in the world of [15:07] Aviation and we're also connecting [15:10] Pender County to the Future we're [15:12] growing and seeing what other benefits [15:15] and other opportunities we can bring to [15:17] this area and I invite each and every [15:20] one of you if you have [17:21] to give some updates for late summer [17:23] early fall things that are happening in [17:25] our office um in our community for [17:27] veterans [17:28] so we do have the 911 coffee and [17:31] breakfast for veterans that's going to [17:33] be held at 9:00 at the Hamstead Library [17:35] completely free uh we do ask because [17:37] there's limited availability to just [17:39] contact myself to [17:41] RSVP there's also the monthly burgo [17:44] veteran social that we're going to be [17:45] doing at the old Carolina eery this [17:48] month it is this Saturday from 10: to 12 [17:51] also free for veterans in their families [17:53] to come join and come out and see [17:55] us we will be hosting assist training [17:58] which is is applied suicide intervention [18:00] skills training on November 6th and 7th [18:03] um that's going to be at the Hamstead [18:05] Library again completely free um not [18:08] just for veterans can be for law [18:09] enforcement um anyone who's they have surpassed 2 million [19:19] claims processed so far this fiscal year [19:22] 2024 and the average Grant rate was [19:25] 64.6% with which the average disability [19:27] rating being around [20:59] Moran I'm the long range planner for the [21:01] county and we're very excited to be [21:04] moving forward uh with the Imagine [21:07] Pender comprehensive land use plan it's [21:09] a new comprehensive land use plan for [21:11] the county which is has a lot of impacts [21:14] on the county over the next few decades [21:17] um so it's a we need everyone kind of [21:20] giving their feedback and that's one of [21:22] the things I wanted to uh share with you [21:23] all today um as well as a very brief [21:27] update we had our second steering [21:29] committee uh meeting back on July [21:32] 29th uh working with our Consultants [21:35] Clarion Associates and um you kind of [21:38] started talking about the the survey [21:40] questions online survey that will be [21:42] coming out which will um tentatively be [21:46] available on uh September 17th through [21:50] October 22nd so that's not 100% but that [21:55] I think that's what we're we're going [21:56] for and that's the tentative date for [21:57] the online [21:59] survey um a couple of documents are [22:01] being you know kind of solidified by our Consultants a community policy [22:06] profile uh which kind of just looks at [22:09] all the different plans and ordinances [22:11] and everything that kind of guides the [22:12] county and policies and [22:14] ordinances as well as a community [22:16] Factbook which is a lot of you know [22:18] great background information that will [22:20] be kind of an appendix to the the [22:23] finished plan there is I want to tell [22:26] everyone as well there is a website [22:28] specifically Al for this please um go [22:31] check out the new County website in [22:33] general that we got this summer but also [22:36] U Pender count nc.gov [22:38] imagin uh to go find out all the the [22:40] different updates and and things that [22:42] are happening uh with the plan as well [22:45] as uh an email address specifically for [22:48] the plan it's imagine at little bit and do one event uh per day [23:35] over the course of three weeks uh not [23:37] every single day U but you see the dates [23:40] there on the board and I wanted to let [23:42] everyone know uh here there's these [23:44] little pieces of paper I'm sorry if it's [23:46] very small I can print you bigger ones [23:48] they're out on the table out there [23:50] please take them or talk to me and I can [23:52] get you a bigger printed copy um these [23:55] are uh events that we're going to have [23:59] where everyone would be able to come to [24:01] these different locations and learn [24:03] about the comprehensive plan why it's [24:05] important and uh also offer your [24:07] feedback on growth development uh all [24:10] the different things that that everyone [24:13] um from Scottdale and it's causing um [30:06] flooding in my yard and then in several [30:09] other properties as well um there's [30:12] Drone footage as well on that and then [30:14] we have um actually some of the field [30:17] and the flooding in the field the [30:20] concerns here are um damaged drains that [30:23] have not been fixed and um we understand [30:26] we have to work through the NC do our [30:29] concern there is that we've contacted [30:31] ncdot and we don't get any response so [30:34] we'd really like to engage with the uh [30:36] County and make sure that we get a [30:38] response so that we can address those [30:40] drains and then the development which um [30:43] the Drone V footage would show [30:47] um we they're they're going to have [30:51] three Retention Ponds but um what we [30:54] would also like to suggest is that they [30:56] pump water and have filter system so [30:58] that they can you know dump off into the [31:01] futch creek into issues in Oak [32:58] Veil and the other Scots Hill [33:00] neighborhoods we've all experienced [33:02] floodings in recent years we first [33:04] flooded in hurricane Floyd [33:07] 1999 where the data suggests there was [33:09] 18 to 24 Ines Floyd was considered a [33:12] 100-year flood however since then my [33:15] garage has flooded five times um we [33:18] flooded in September 2016 April of [33:22] 2017 July of 2018 Florence um Florence [33:26] and September of 2018 we had 24 inches [33:29] of water in the garage um with hurricane [33:32] Debbie the backside of it two weeks ago [33:36] um we ended up with 12 Ines of water in [33:38] the garage we had water that filled [33:40] ditches and was rushing down the [33:42] driveway and over our BMS I'm not sure [33:45] which retention Pond they came from but [33:47] I had minnows not tadpoles Minnows [33:50] swimming in my garage closed garage [33:53] clearly there's something not not [33:55] operating correctly with the storm water [33:57] management system [33:58] this last rain after Debbie left [34:01] multiple neighborhoods flooded and [34:02] residents without access to the [34:04] driveways they were either cars were [34:06] stuck in the driveways or stuck on the [34:08] road um this is inconvenient for them [34:11] but is also a safety concern as fire and [34:13] rescue workers would be unable to reach [34:16] these homes if there were a fire or [34:17] medical [34:19] emergency so it's our understanding that [34:21] you that the natural flow of water from [34:23] Oakvale is through Foy Fields where [34:26] Kim's video just showed the Sweet Water [34:28] development is planned to futch Creek um [34:32] where will that water go when the [34:33] topology changes futch Creek um is set [34:37] up to drain according to the research [34:39] that I've seen [34:41] 3,813 acre Watershed with [34:45] 12.3% of impervious [34:48] coverage please help us with the issues [34:51] that Scott Hill residents are only our [35:37] backyard we didn't have water in our [35:39] garage but our backyard also backs to [35:42] the new sweet grass development so I can [35:45] only imagine what will happen [35:49] once the topology changes and we have [35:52] water coming from sweet grass into our [35:56] backyard it's not just our backyard it's [36:00] the whole [36:01] Community um streets were flooded um I [36:05] think there was a called the saac that [36:06] was flooded for days after Debbie um [36:10] let's [36:11] see we recently also we just dug a hole [36:15] in our backyard and it's it's clay soil [36:19] so there was water with 2 and 1/2 ft [36:23] there was already water there so I don't [36:26] know what they're going to to do with [36:28] the development but I think something [36:30] a hurricane [37:13] and on Monday Debbie made lamf fall at [37:16] 5:00 a.m. near big Benin Florida with [37:18] Winds of 80 M hours of cat one storm on [37:22] into Tuesday we continue to prepare for [37:23] the storm and on Wednesday the USC was [37:25] activated after a state of emergency was [37:27] signed to 5:00 p.m. the day before two [37:29] shelters were open at topso and cap for [37:31] elementary with no one coming in in the [37:33] 24-hour period they were open during [37:35] Wednesday evening the county received [37:37] two tornadoes one in Maple Hill around [37:39] Highway 50 and 53 and also one on 421 at [37:43] the Samson County Line no injuries or [37:45] major damage to any [37:46] structures and it continued to rain [37:48] Wednesday into Thursday morning Thursday [37:51] evening rainfall mountains and Holly [37:53] Shelter were 3.29 in in areas of Long [37:56] Creek and Curry Community received 11 in [37:58] the EOC received 6.58 in of rain and the [38:01] Hamstead Annex received 6.8 in of rain [38:04] the weather service has been calling for [38:06] 10 to 15 they had pushed it to 15 to 20 [38:09] and we were spared with the dry air on [38:10] the back side of [38:12] Debbie which in the next coming days as [38:15] you all know we saw rain um Saturday we [38:18] knew both the Northeast Kate River and [38:20] the Black River would go to Major flood [38:22] stage NC do closed Highway 53 between [38:25] Maple Hill and bergall around 2: p.m. on [38:28] Saturday the OC knew this was going to [38:30] be a potential threat to the county so [38:32] we went to a minimum activation on [38:34] Saturday afternoon and through Saturday [38:35] night Sunday morning the e was in fully [38:38] operational status at 8:00 a.m. and went [38:40] to 24 operations until Friday at 5:00 [38:42] p.m. also on Sunday a swift water rescue [38:45] team from bunkham County Task Force 2 [38:48] arrived here in the county to assist [38:50] us and um on Monday that team was demoed [38:54] in task force 9 out of fat will arriv to [38:57] Back Field that team Tuesday the [39:00] Northeast Kate fa River crested at NC [39:02] Highway 53 at 16 feet. 51 ft 16.5 1 ft [39:07] that's just over major flood stage at 16 [39:09] ft the Black River crested on Wednesday [39:13] at 11.7 fet around 8:40 a.m. due to the [39:18] continuous flash flooding we had [39:19] Wednesday Thursday in Scot hill we went [39:22] into Scott Hill on Friday morning [39:24] evaluated some out took pictures and [39:26] then the continued flash flooding [39:28] Friday and Saturday and then the Sunday [39:30] and adkinson Burg on Maple Hill added to [39:32] the rainfall mounts and after a six- day [39:34] total rainfall mounts in pend County [39:36] averaged 9 to 20 in which was back to [39:39] the original forecast of the National [39:41] Weather Service just some little food [39:43] for thought water rescue crews contacted [39:45] 120 homes in the flooded areas where [39:48] people were Sheltering place in the [39:49] flood waters also 10 people were [39:51] evacuated by Swift water rescue teams to [39:53] Higher Ground and 18 water rescue calls [39:57] for people stranded in their vehicles [39:59] and every one of them was a case where [40:01] they drove around a [40:02] barricade what where were where were the [40:04] 10 residential rescues they was [40:07] scattered out some on the Black River [40:09] some on the northeast cap feir River and [40:11] I do not know the exact location of all [40:13] 10 so they were trying to drive through [40:15] that border we had 13 people removed [40:18] from vehicles that attempted to drive [40:20] through flooded roads that dot had [40:22] closed during the six day period the 911 [40:25] Center received 80 calls for weather related events in the emergency [40:29] management app did 44 push notifications [40:32] either by our office or by automatic [40:34] weather [40:35] notifications just a little rundown [40:37] supporting agencies the Pender County [40:39] elected officials each one of y'all had [40:41] reached out some of you stopped by and [40:42] that was appreciated all the County [40:44] Employees the Sheriff's Office the [40:46] Pender County 911 Center all the local [40:49] PDS all the fire departments across the [40:51] county Pender fire and EMS Pender County [40:53] Schools Steve path and the National [40:55] Weather Service Team in Wilmington [40:57] bunkham County Task Force 2 swiftwater [40:59] rescue team fat task force swiftwater [41:03] rescue team the North Carolina Forest [41:04] Service Brunswick County Emergency [41:06] Management dupan County Emergency [41:07] Management North Car emergency [41:09] management Leland fire Stanley County [41:12] 911 Hamlet search and rescue rundown on the storm and we closed the [41:25] state of emergency this afternoon we res [41:27] sended that order at 4:00 and we're back [41:29] and no more [41:31] operations I have a [41:35] question by what Authority Under what [41:38] Authority do you put up those signs [41:42] saying high water don't go through for [41:46] the 13 individuals that you had to [41:48] rescue out of their car what was the [41:52] signage that they went went past they [41:55] were all road closed signs that is all [41:57] handled by North Carina do and then they [41:59] handle it because it's their Road they [42:01] close them and even though a barricade [42:03] may be moved out of the way NC do has to [42:06] go out and do a full Road inspection [42:09] shoulder inspection if it crosses a [42:10] bridge they've had to go out and do [42:12] bridge inspections prior to them having [42:14] to open it up [42:15] and but that's a highway patrol manner [42:18] to enforce yes and is that being [42:21] enforced Highway Patrol did their best [42:24] attempts to keep po out there but I [42:25] don't think they had adequate staff in [42:27] has maned all the control points [42:29] 247 would you consider that that signage [42:32] is related to safety it [42:37] is I don't know uh Mr County attorney [42:40] but correct me if I'm wrong violation of [42:42] a safety statute is negligence per se I [42:46] would definitely say so yes Comm and [42:49] today we only had one injury throughout [42:51] the entire storm and no deaths here in [42:53] this County did you receive any calls [42:56] from any of the folks that saw fit to [42:58] drive past the road closed sides the [43:01] many of them call 911 for assistance and [43:03] we for the rescueing teams no no no [43:04] before they went around the side we did [43:09] not and if I may expand briefly um the [43:14] county does not have authority to close [43:16] the roads it would be either through the [43:18] sheriff or do in conjunction with the [43:21] highway patrol on doing that so I mean [43:24] the the chairman enacted a state of [43:26] emergency but but the statute was [43:28] changed the county as the county does [43:30] not have authority to close roads uh [43:33] what what my point is while I sympathize [43:36] with people having to get home having to [43:39] cook supper having to get home from work [43:41] having to do you know when we're in a [43:44] state of [43:45] emergency um we know in this County [43:49] pretty much if like at my house I know [43:53] that there's a place on shalow road [43:56] that's going to flood I know it so I [43:58] just have to go another route um but I [44:03] think that it would behoove people to [44:05] make accommodations for for these types [44:09] of things when they know we're going to [44:11] be in a flooding situation rather than [44:14] putting their lives at [44:17] risk and thank you for having the staff [44:21] to go out and the Personnel to go out [45:25] the board again [45:27] um so I have the pleasure to be able to [45:31] um request a uh consideration of a [45:36] couple of resolutions that uh the [45:39] planning department is is asking for [45:40] we're seeking grant funding from two [45:43] different grants for the same uh project [45:46] and that project is a multi-use path uh [45:50] that would run from the intersection of [45:53] Country Club Drive and Sloop Point Loop [45:55] Road uh also intersecting with the [45:59] existing uh multiuse path between hsed [46:01] kuas Park and North topsil Elementary it [46:04] would run all the way up Country Club [46:07] Drive to um [46:09] us7 cross over us7 and continue up [46:14] Jenkins and uh North St John's Church [46:17] Road to the the combined school campuses [46:20] there at topsil High School uh also [46:23] there would be a connector along a Zia [46:25] drive to the the existing path that that [46:28] connects in um not quite at the [46:31] intersection of Country Club Drive there [46:33] so that is the the uh project that we're [46:36] seeking to move forward with uh with [46:38] y'all's blessing and um this it project [46:43] came from a feasibility study it's the [46:45] East Coast Greenway the nc210 East Coast [46:48] Greenway feasibility study which was [46:49] completed last year and adopted by uh [46:53] the board earlier this year um we're [46:57] seeking um adoption or approval of of [47:00] two resolutions for those two grants and [47:04] the two grants one is through the [47:06] Wilmington Metropolitan planning [47:08] organization uh it's using Federal [47:10] monies for that it's an 820 match so 80% [47:15] with those Federal monies 20% uh with a local match now the exciting part is [47:21] that we're also uh applying for uh a [47:25] second Grant through the state Parks and [47:27] Recreation division uh for it's a It's [47:30] called The Great Trail State program and [47:33] uh that would potentially you know if we [47:35] got both those grants that would cover [47:36] the [47:37] 20% that would remain from that 80% [47:40] match um so ask yall support and and see [47:45] if you had any questions about those [47:50] resolutions there any questions [47:52] comments and if we didn't get the um [47:58] second grant that you were speaking of [48:00] the 20% matching portion to the county [48:04] would be [48:06] $168,000 yes ma'am when would [48:08] construction of this pathway take place [48:12] yes ma'am uh so that would be after [48:15] sorry this is the for the design phase [48:18] and is projected that the design phase [48:20] would last two years and so there would [48:23] uh the county would need to seek more [48:25] grant funding or or find funding for the [48:27] construction so at least 2 years from now is uh when construction would [48:33] start so we don't know how much this is [48:37] going to cost this is just the design [48:40] phase uh yes ma'am this is the design [48:43] phase the projected cost um from the [48:46] feasibility study as um for these [48:49] sections is uh $1 million I [48:53] believe yes [48:59] and we don't know when construction [49:00] would be if the construction would be [49:04] after completion of the [49:06] bypass uh it would be at least two years [49:10] out uh the federal money requires that [49:12] it be completed uh before 10 [49:15] years so there's a little bit of a [49:17] window there yes [49:23] ma'am so these paths are crossing all [49:25] over New County now and a lot of those [49:28] the do have has come back and help fund [49:31] or funded part of so hopefully that is [49:34] the intent here that we'll get some of [49:36] that the the multi-use path along SL [49:39] Point Loop [49:40] from um Country Club to North topsel was [49:45] a state funded [49:48] um pathway I think the only thing the [49:50] county has had to do was take ownership [49:52] of it as far as maintenance cut cutting [49:54] the grass [49:56] yes sir the area they're talking about [49:58] putting this is a well-traveled area [50:02] it's very busy with people trying to [50:03] ride bikes back and forth to the park [50:06] and walking through the park and and [50:09] trying to get to the golf courses and it [50:11] would take some of the traffic off and [50:13] there's also a planned subdivision of [50:15] 1100 homes that would that attaches to [50:18] this walking trail so hopefully you know [50:21] we can um leverage some of that with the [50:25] approval of that you know that's [50:27] where they they get a portion of the of [50:29] their 300 and some Acres there they can [50:31] front with some help us pay for part of [50:34] it and their [50:36] construction is there any other [50:38] questions or [50:40] comments if not is there a [50:44] motion I I I just want to make a comment [50:48] um this is this is uh something that we [50:53] had looked at uh with the bypass uh [50:56] several years ago when this opportunity [50:59] came up for funding uh for a sidewalk [51:03] along that area through that area um I'm just concerned about on its face [51:11] it's not very transparent or clear to me [51:14] the total cost of this project and with [51:17] the other [51:19] construction projects that we've got [51:21] going on in this County and the [51:23] uncertainty of when the bypass is going [51:26] to be completed I I'm I'm I'm just [51:30] concerned about it um given that the [51:33] design phase if if we have a second [51:36] Grant to cover the [51:38] 168,000 then it's going to be a [51:40] considerably lot more money for the [51:44] actual construction and again it needs [51:48] to happen I understand that it needs to [51:50] happen but my concern with this is lack [51:53] of transparency with regards to full [51:56] cost of the project and things change [51:59] with regards State funding um so that's [52:03] those are my comments that's what [52:05] happened on the sidewalk I think didn't [52:06] they change their funding so the the [52:09] sidewalk the multi- use pass on the [52:12] sidewalk that that project has been [52:15] funded from Washington Acres Drive not [52:17] just the sidewalk part of that but the median project which encompasses a [52:23] multi-use trail on each side of Highway [52:25] 17 [52:27] has been funded prioritized as the [52:29] number one priority and funded with no [52:31] matching with no matching with no [52:33] matching right from the do starting in [52:35] 2031 which is supposed to be immediately [52:38] after the bypass opens in [52:41] 2030 um so again would it be prudent for [52:44] us to wait and hope that do could then [52:49] also fund this other section that will [52:52] connect those I don't know that without [52:55] the uncertainty of the financing and the [52:57] matching grants and the 11 million price [53:01] tag that you had just referenced do do [53:05] you see what I'm saying I do but I don't [53:06] know that waiting is going to offer that [53:11] as we've seen with the DHS h building [53:14] and the the law enforcement center and [53:16] the school uh bond issue the longer you [53:20] wait the more it cost so yes we can wait [53:25] and and [53:27] two years and it's $44 million instead [53:30] of 11 I mean that's just the way things [53:31] have has has progressed here lately and [53:34] I don't see any relief in in sight for escalating construction costs [53:42] um that is going to have to be I'm [53:45] assuming there's going to have to be [53:46] right aways purchased the property [53:48] values in that area that this would [53:50] propose for they're not coming down [53:54] they're they're constantly inreasing at [53:56] a rapid rapid pace so I don't see that [53:59] we would benefit by waiting but that's [54:01] just I can't make a motion or so that's [54:04] just my opinion on the project but this [54:07] tonight is not the $1 million for [54:10] construction no no this is for the [54:12] design phase which could at [54:16] $168,000 I'm sorry sir right that's 20% [54:20] cost count GRS right if we don't get the [54:23] second Grant to cover m our 20% on the [54:27] first grad gotcha okay my concern is how [54:31] much of a bill we going to be left [54:35] with I know it's really needed the do [54:38] would they buy the rway the do would [54:41] actually buy the rway I I'm not sure of [54:43] how RightWay acquis acquisition um you [54:46] know goes down legally or or that sort [54:48] of thing maybe Mr Thurman chime in on [54:51] RightWay acquisition I'm not an expert [54:54] on that I'm sorry we got a lot on the [54:57] back burer I think all these [54:59] construction jobs [55:00] con I w't be here in a few months and [55:03] neither well I so maybe bring it back no [55:07] I don't agree with bringing it back I [55:09] mean the reason Wards and some of the [55:11] shap is in now because everything got [55:13] put off to the new board got here and [55:15] now the new board that's here is having [55:17] to pick up where the old board left off [55:19] and I don't think it's fair for a new [55:21] board to have to come in if this is [55:23] something that needs to be done now need [55:24] to be done now doesn't need to be kicked [55:25] down the road and then later if it needs [55:27] to be voted down now it needs to be [55:28] voted down and I agree with you 100% on [55:31] that um and this is not a heel that I'm [55:34] ready to down uh because it is something [55:37] that would be beneficial to the [55:39] community and helpful uh for uh traffic [55:43] congestion but again the only thing I'm [55:46] saying is my concern is the lack of [55:49] transparency of the total cost of the [55:52] priority goals to submit [56:44] to the North Carolina Association of [56:45] County Commissioners they are as follows [56:48] seek legislation funding and other [56:50] efforts to expand digital infrastructure [56:53] Broadband capability to the unserved and [56:55] under served areas and residents in the [56:57] state the second goal is seek additional [57:00] excuse me Mr maner can we wait just a [57:02] second till these people get out of here [57:05] it's a little [57:08] distracting sorry thank [57:11] you I'll start with first goal [57:14] again seek legislation funding and other [57:17] efforts to expand digital infrastructure [57:20] Broadband capability to the unserved and [57:22] underserved areas and residents of the [57:24] state the second goal is seek additional [57:27] Revenue sources including a Statewide [57:30] wide Bond referendum and expanded [57:33] Lottery proceeds and changes to the [57:35] needs-based public school Capital fund [57:38] to equitably address Statewide Public [57:40] School and Community College Capital [57:42] challenges the third item is support [57:45] legislation to allow counties to include [57:48] specific language on the ballot [57:49] referendum designating how the proposed [57:52] quar Cent local sales tax levy will be [57:54] spent the fourth goal is increased State [57:57] funding and support legislation for [57:59] Behavioral Health Services and [58:01] Facilities including dedicated resources [58:04] for Community param medicine projects [58:08] inpatient crisis beds substance use [58:11] disorders specialty courts individuals [58:13] mental health issues in county jails and [58:16] single stream funding for area [58:17] authorities and the last goal that is [58:20] being proposed is oppos efforts to [58:22] divert to the state fees or taxes [58:25] currently all to the counties or to erod [58:28] existing County revenue streams with [58:30] unfunded [58:32] mandates um M Mr chairman I'd like to [58:36] make a comment um under item two uh the [58:42] paragraph appears to address uh [58:46] Statewide Revenue sources including Bond [58:48] referendums and Lottery proceeds that [58:52] would benefit um the education system [58:55] community based colleges and [58:57] somewhat and under the subsections under [59:01] that the second one reducing or [59:04] eliminating local match requirement for [59:07] tier one and tier 2 counties [59:11] um I think it would be [59:14] important for us to address issues [59:19] pertaining to tier one and how tier one [59:22] and tier 2 counties are determined [59:26] because whether you're a tier one or a [59:29] tier 2 County uh is is uh very much a [59:33] deciding factor as to what assistance [59:37] our um citizens are able to get and our [59:42] local governments are able to acquire I [59:45] think that tier one tier 2 uh [59:50] designation uh should be a a standalone [59:55] issue as it has been since I've been on [59:57] the board for 2016 for the lobbyist at [1:00:01] the North Carolina ass County [1:00:03] Commissioners to continue pushing for a [1:00:06] more Equitable and fair assessment of [1:00:09] what constitutes a tier one and tier 2 [1:00:11] County for the purposes of of uh funding [1:00:15] uh grant funding and things of that [1:00:16] nature we can certainly break that out [1:00:19] as a separate goal I agree I think they [1:00:21] that committee started back this was [1:00:23] approved to start back reviewing that [1:00:26] and I think it's very important that we [1:00:28] join our our fellow counties in [1:00:30] emphasizing that as a [1:00:37] concern does the board have any [1:00:39] additional feedback on these [1:00:42] priorities I think otherwise they look [1:00:44] good the Department of Health [1:02:03] and Human Services [1:02:07] facility is there any [1:02:09] questions I'm assuming that's why Mr [1:02:11] Jess has joined us again tonight yes he [1:02:13] wants we'll increase it to include the um GMP [1:03:03] and increase the purchase order and make [1:03:06] the necessary budget transfers which is [1:03:08] what the attached documentation [1:03:11] does is October [1:05:46] um [1:05:47] October's uh when their next meeting [1:05:49] would be a reset for them uh Miss Denise [1:05:52] hton is currently serving as District [1:05:53] 1's representative she's applied for [1:05:56] reappointment and is recommended by the [1:05:58] chair of the hospital board to uh be [1:06:01] reappointed she has a long-standing [1:06:03] history in the health field she's [1:06:04] experienced working in the regional [1:06:06] health education consult for NC [1:06:08] Department of Health and Human Services [1:06:10] the health promotions director for new [1:06:11] County's Health Department and the [1:06:12] executive director of the American [1:06:14] Cancer [1:06:15] Society uh Miss Myra McDuffy is also [1:06:18] currently serving as the District 5 [1:06:21] member uh she's applied fore appointment [1:06:23] and is also recommended by their chair [1:06:26] uh she is the respiratory therapist at [1:06:28] downstate Medical Center she's been the [1:06:30] assistant director of the business sorry [1:06:33] excuse me um previously she was the [1:06:36] respiratory therapist at downstate [1:06:38] Medical Center the assistant director of [1:06:40] respiratory at Vanderbilt Skilled [1:06:41] Nursing Facility and she's now the owner [1:06:43] of our local business [1:06:45] mimos um Chicken and Rib she served on [1:06:48] numerous boards as well such as the [1:06:50] burga tourism Development Authority and [1:06:52] the burga Chamber of Commerce um for [1:06:54] both of these applicants their terms [1:06:56] would uh begin January 1st 2025 and [1:07:00] expire December 31st [1:07:03] 2028 I uh currently serve on this board [1:07:07] um and uh miss hton and miss McDuffy [1:07:10] both have been a asset uh and and in [1:07:14] fact our Pender Count's [1:07:17] designes uh and I would recommend them [1:07:20] uh for [1:07:21] reappointment uh [1:07:24] unequivocally um and I have a question [1:07:26] for our [1:07:28] manager [1:07:30] did the chair of this board indicate to [1:07:35] you that they had um Novant designes [1:07:41] that they wish to run by uh this board [1:07:46] for reappointment as well which is a Community [1:08:46] Development block grant uh for the [1:08:48] installation of water lines in the 421 [1:08:51] corridors around the Columbia Union [1:08:54] district um so my deputy director Mr [1:08:57] James bror and myself will be holding a [1:08:59] public meeting at the Pender Le School [1:09:01] auditorium to assist the citizens of [1:09:04] Columbia Union around the Highway 421 [1:09:06] Corridor uh to fill out an income survey [1:09:09] form which is a requirement uh for the [1:09:12] Community Development blood Grant uh [1:09:14] this is the application that is due on [1:09:16] September the 30th so we're moving [1:09:18] forward quite fast uh part of the [1:09:21] requirement was the public hearings [1:09:22] which we already uh perform now we're [1:09:25] doing [1:09:25] uh the um income survey and uh on our [1:09:29] next board meeting I will have some [1:09:30] forms for the chairman of the board to [1:09:32] sign uh and we'll have all this put [1:09:35] together on a package we'll send it out [1:09:38] and uh we'll at that moment we'll wait [1:09:40] to see uh what the state will uh allow [1:09:44] us to to receive the cap is $3 million [1:09:47] and we're looking forward to get that [1:09:49] money um so this meeting uh will be held [1:09:53] uh this upcoming Monday [1:09:56] we will be at the Pender Lee is that the [1:09:58] 26th that is Monday the 26th yes ma'am [1:10:01] August Monday the 26th uh Mr James bror [1:10:04] and myself we're going to be at the [1:10:05] Pender Pender Le School uh Auditorium [1:10:09] from 12:00 [1:11:27] minutes uh filling out this form uh it's a one single form and pretty much [1:11:32] it's asking for name address contact [1:11:35] information and income and income that's [1:11:38] it is [1:15:02] Associates in Automotive Systems [1:15:04] Technology he has 18 years of experience [1:15:07] in local government related to [1:15:09] facilities and ground maintenance Fleet [1:15:12] Management and Parks and Recreation as [1:15:14] well um he comes to us most recently [1:15:17] from the town of uh Leland and he was [1:15:21] there for about six years and um also [1:15:24] he's worked with the city of Durham and [1:15:26] Sarasota County Florida so we're really [1:15:29] happy to have him on board with us and [1:15:31] uh expect great things from you sir no pressure appreciate that just kidding [1:15:37] we are glad to have you and I'm glad to [1:15:39] be here uh I wanted to thank you all for [1:15:41] uh letting me join the team um excited [1:15:43] to add value to the organization and [1:15:45] ready to get work on uh both our Fleet [1:15:48] department and uh some of our County [1:15:50] facilities as we have some aged and some [1:15:52] new ones um they're going [1:17:25] to do extensive work on [1:17:28] 117 from Porter's Lane to um Walker [1:17:32] Street and that's pretty exciting to get [1:17:35] that project started and um a couple of [1:17:39] little things here from a citizen they [1:17:42] feel like the [1:17:43] $40 um [1:17:46] dumping um sticker is way too high and I [1:17:50] also feel like 40 is kind of high I'd [1:17:53] like to see that took down to 20 if they [1:17:56] need an extra sticker uh if we could [1:17:59] look at that anyway and um I had several [1:18:03] opportunities to stop by the EOC I want [1:18:06] to thank Tommy for his hard work that he [1:18:09] did during the storm it it was stressful [1:18:13] for a lot of people and um and to add to [1:18:17] that it Zing um emergency vehicles I [1:18:22] feel like if we're in a state of [1:18:26] emergency we should [1:18:28] limit River [1:18:31] activity because these boats are causing [1:18:34] more harm than the regular [1:18:37] storm they're tearing up the [1:18:39] banks and of course y'all know I live on [1:18:42] the river and I had a chance to look at [1:18:45] some of it today as the water was low [1:18:48] enough to look and um I I feel like Mr [1:18:53] manager you [1:18:55] kind of open that door and see if we [1:18:57] could do something to recreational [1:19:01] vehicles during state of emergency [1:19:05] during a [1:19:06] flood [1:19:10] um and that's about all I have yes [1:19:14] sir Mr Burton uh yeah real quick just a [1:19:18] couple of things um I just want to [1:19:19] reiterate and thank the citizens that [1:19:22] have contacted and called me that live [1:19:24] in the low l areas especially around [1:19:26] Scotts Hill around my neighborhood um my [1:19:29] wife and I have been there for 25 years [1:19:31] my wife since 1979 so we're very aware [1:19:34] of of those areas and my heart goes out [1:19:37] to uh to those citizens and hopefully as [1:19:39] we work forward uh the developers will [1:19:43] come under new storm water regulations [1:19:46] that will hopefully help mitigate some [1:19:48] of that moving forward uh and I'm glad [1:19:50] the new plan is is coming out with a lot [1:19:52] of public input um um secondly uh I had [1:19:57] a chance to uh be welcomed to the [1:19:58] tourism board last week for their [1:20:00] meeting my first time there and uh great team great group of folks had some [1:20:05] good discussions uh we're happy to get [1:20:08] the additional 3% what occupancy tax and [1:20:11] that's coming and uh look forward to uh [1:20:14] to helping on behalf of the board and [1:20:16] the citizens to uh to forward that and [1:20:20] uh thank you mayor that's it thank you [1:20:23] sir so I just have a few things uh I do [1:20:27] want to thank um emergency management [1:20:29] office and and the staff all the staff [1:20:31] that was there not just Emergency [1:20:32] Management there was the times I went in [1:20:35] there was everybody from Fire EMS [1:20:38] Sheriff Department Fire Marshal's Office [1:20:40] Department of Social Services Wes was in [1:20:43] there on Sunday afternoon hanging out [1:20:45] when he didn't need have to be his shift [1:20:47] had even started yet so it takes a lot [1:20:49] of different people and a lot of [1:20:50] different skills to toand that Center [1:20:52] and I appreciate every one of you um you [1:20:55] all made a difference in [1:20:57] somebody's part during this this event [1:21:00] luckily for us you know it was it wasn't [1:21:02] as bad as they predicted thank God and [1:21:04] um let's hope that we're done for the [1:21:06] year so we close that out um out on the [1:21:09] table also out where the public signment [1:21:12] comment signups are there is a uh paper [1:21:15] with a QR code for the transportation [1:21:18] plan where they're seeking input for [1:21:20] your want your input [1:21:22] on how to route the trans transportation [1:21:25] system in Pender County um a lot of [1:21:27] these projects are scored by public [1:21:29] input and we don't always score very [1:21:33] well because our our residents don't don't like to get on there and and [1:21:37] voice their opinions or concerns but [1:21:39] those do make a difference for the whole [1:21:41] County of Pender for the wmpo we have [1:21:44] two only had two projects approved last [1:21:46] year and the new H County had the [1:21:49] remaining 19 or 20 so it's important for [1:21:52] us to to you know have have a say um in [1:21:57] our own transportation [1:21:59] system also out there are the little [1:22:01] Flyers that um Adam Mr Mor discussed the [1:22:05] with it's also got a QR code to the [1:22:08] comprehensive um plan meetings I hope [1:22:12] there's big turnout for that it's a it's [1:22:14] a constant thing I hear every day about [1:22:17] how outdated our our comprehensive land [1:22:20] use plan and our ordinances are um and [1:22:23] this is a chance for the community the [1:22:24] citizens that that that feel that pain [1:22:26] to have have some say so I encourage [1:22:29] everybody that has opportunity to attend [1:22:31] one of those meetings to attend I am [1:22:33] concerned about like I said earlier [1:22:35] about the early meetings I want [1:22:36] everybody to have the same opportunity [1:22:38] so maybe we can work something out with [1:22:40] the consultant that we can move those to [1:22:42] a time that's more convenient to people [1:22:45] um and there may no you know we've done [1:22:47] this several times we make these [1:22:49] opportunities available and nobody shows [1:22:52] up but at least we've made the opportun [1:22:55] available um I'm going to harp on [1:22:58] something that I've harped on several [1:22:59] time and that's and and it was pretty [1:23:03] obvious in parts of Eastern Pender [1:23:04] County um this time where the where a [1:23:08] lot of the flooding was at is our [1:23:11] um there's our will to let the developer [1:23:14] come in and clearcut everything even the [1:23:16] dog finnels out off the field and not [1:23:18] leave a tree um there's places on 17 [1:23:21] that had never flooded and now that [1:23:23] they've um clear cut right there by [1:23:26] Blakes Farm on 17 there's High still [1:23:28] high water sign there there's no water [1:23:30] there but it's never flooded before but [1:23:33] we let them come in they take all the [1:23:34] trees off and then maybe four or five [1:23:36] years later they'll come in and put [1:23:38] their storm water system in so where [1:23:40] does that water go in the meantime it [1:23:43] goes in the road it goes in the people's [1:23:45] yards um I rode down through Scott Hill [1:23:49] I rode through those neighborhoods I [1:23:51] seen what was coming off of of where [1:23:53] that development behind popular Grove is [1:23:55] clearcut everything there those 300 year [1:23:58] oak trees that used to be there that [1:23:59] soaked up a th000 gallons an hour are no [1:24:02] longer there all that water is one of [1:24:03] these people's garages ride down through [1:24:06] Washington [1:24:07] Acres um where that 60 Acres plus was [1:24:10] clearcut for to plant 30 apartment [1:24:14] buildings where does all that water [1:24:16] going that storm water system has not up [1:24:18] and functional um but they're allowed to [1:24:21] continue you know building and then put [1:24:23] that in later so I I really like for us [1:24:26] to see us go back and revisit our tree [1:24:28] Ordinance do away with the with the [1:24:31] addition to the ordinance where we [1:24:33] allowed them to clear before permits [1:24:36] were [1:24:37] obtained and maybe that will at least [1:24:39] slow it down for a little while and i' [1:24:40] I've encouraged that a couple of times [1:24:41] now I'll encourage it again and once I [1:24:44] not chair again I'll make that motion to [1:24:46] have that done um we got it [3:04:50] 20246 kg Plaza LLC the applicant owner [3:04:53] is requesting to modify an existing [3:04:56] conditional zoning District to allow for [3:04:57] the residents of the sanctuary at Forest [3:04:59] sound to store recreational vehicles uh [3:05:02] within a private facility in the [3:05:04] development the private private storage [3:05:06] facility will be approximately 4.51 [3:05:09] Acres with 106 storage units the [3:05:11] existing conditional District was [3:05:13] approved in 2015 and allowed for the [3:05:15] development of 106 single family homes uh we have a vicinity map here the [3:05:21] uh red highlighted and hatched area is [3:05:23] the subject property it's right off of [3:05:25] US Highway 17 uh right next to the [3:05:27] intersection of 17 and4 sound Road um [3:05:31] very close proximity to the Hamstead [3:05:34] andx we can see from the aerial map uh [3:05:37] the outlined subject property uh it's a [3:05:39] heavily vegetated [3:05:41] area um mostly trees there along the [3:05:45] roads and uh right behind it to the West [3:05:48] is uh the sanctuary at Forest Sound [3:05:52] Community it is zoned RM cd1 it's a [3:05:56] residential mixed conditional zoning [3:05:57] District uh it's surrounded by [3:05:59] residential performance and general [3:06:03] business this is the applicant's [3:06:05] original site plan consisting of 154 [3:06:08] storage units um after feedback from the [3:06:12] public input meeting in the community [3:06:13] they have uh decided to reduce the [3:06:16] number of stor units to 106 uh to be [3:06:19] consistent with the number of homes here [3:06:22] is what it looks like now um a lot more [3:06:24] open space toward the back less units [3:06:26] and an overall reduction of about 31% in [3:06:29] total [3:06:32] footprint uh here we have traffic counts [3:06:34] provided by the wmpo and [3:06:37] ncdot uh we see that US Highway 17 is [3:06:39] over capacity which we all probably knew [3:06:43] uh but this is a reserved use for the [3:06:45] residents of sanctuary Forest sound [3:06:47] therefore the uh in there's not an [3:06:50] anticipated increase in traffic as [3:06:51] they're already going to be traveling [3:06:53] that [3:06:56] road there are no residential uses being [3:06:59] proposed for this uh conditional zoning [3:07:00] district and Commercial uses would be n [3:07:03] code [3:07:05] 53113 and then miss the miscellaneous [3:07:07] use storage of boats and watercraft [3:07:09] Outdoors on or on dry stack structures [3:07:13] uh we have our set setback table um [3:07:16] it'll be 30 foot setback act all around [3:07:18] with a maximum height of 40 ft for [3:07:21] structures we have our landscaping and [3:07:23] buffer table um there will be an A4 [3:07:26] buffer along the road on for sound uh [3:07:29] and the rest will be buffered by [3:07:30] existing [3:07:33] vegetation the A4 buffer consists of a [3:07:36] 30 foot wide strip with one canopy tree [3:07:38] two understory trees and a grass or [3:07:41] other vegetative ground [3:07:44] cover Excuse me yes ma'am for [3:07:48] yes ma'am when you say the subject [3:07:51] property um on one of your slides back [3:07:54] there and I have it in front of [3:07:56] me one [3:07:59] more is that where they're proposing the [3:08:02] storage yes ma'am it'll the storage [3:08:05] facility will be approximately where [3:08:07] this line is but I have a in this slide [3:08:09] is that the 120 [3:08:12] AC how large is that this is I believe [3:08:15] it's say I believe this is 60 Acres 60 [3:08:19] and A2 um behind it to West here kind of [3:08:24] Southwest that's the rest of sanctuary [3:08:26] Force sound where the 106 homes [3:08:28] are [3:08:31] okay but this this is where they're [3:08:34] under the street canopy is where they're [3:08:37] proposing the storage unit yes ma'am [3:08:44] okay here is the proposed entrance and [3:08:48] proposed storage area where they'll be [3:08:50] located on the [3:08:53] parcel um the future land use map CL [3:08:56] classifies this as low density [3:08:58] residential [3:09:01] and staff is recommending approval for [3:09:03] this project um amending the conditional [3:09:06] zoning District would be consistent with [3:09:07] the intent of the initial development by [3:09:09] providing an amenity to existing [3:09:11] residential [3:09:13] development proposal is supported by one [3:09:15] policy and one recommended action the [3:09:17] future land use plan policy 5.1. F [3:09:21] conditional zoning and recommended [3:09:23] action 5.1. K1 discourage the [3:09:27] construction of storage facilities along [3:09:28] the road Frontage and um I can go into [3:09:31] further detail on those policies if the [3:09:33] board would [3:09:37] like um staff is recommending the [3:09:39] following conditions approval to [3:09:41] consider and approving the conditional [3:09:42] Zoning for the site um this is between [3:09:46] staff and the plan board or the rather [3:09:48] the planning board recommended some of [3:09:50] these appr or conditions of approval uh [3:09:53] first the project shall comply with all [3:09:54] requirements of the Pender County [3:09:55] unified development ordinance the [3:09:58] applicant shall meet all other state [3:09:59] local uh and federal regulations the [3:10:02] storage facility shall remain private [3:10:04] and only for the use of the residents of [3:10:06] the sanctuary at Forest sound [3:10:08] development for the developer shall be [3:10:11] fully responsible Financial or otherwise [3:10:13] for the repair of any damage or [3:10:15] maintenance issues on the forest sound [3:10:17] Road until the boat storage facility has [3:10:19] received a certificate of occupancy once [3:10:22] the certificate of occupancy has been [3:10:24] issued maintenance cost for Forest sound [3:10:26] Road shall revert to the original [3:10:27] maintenance [3:10:29] agreement five the site of the storage [3:10:32] facility will be of a perious surface [3:10:35] there will be no dry stack structures [3:10:38] and the apron and entrance of the [3:10:40] storage facility will be pervious [3:10:42] concrete at a minimum of 161 ft [3:10:46] length I that will last from again uh [3:10:48] the apron and entrance of the storage [3:10:50] facility will be a perious concrete in a [3:10:53] minimum of 161 foot [3:10:59] length the planning board unanimously [3:11:02] approved uh a recommended approval for [3:11:04] this uh when it went before [3:11:07] them and is there any questions yes [3:11:10] ma'am can I direct you back to where the [3:11:13] conditions um one of the conditions says [3:11:16] that it remains private was there any [3:11:19] distinction made between Property Owners [3:11:22] or residents how was that [3:11:29] characterized I believe it's homeowners [3:11:32] I'm not sure if I understand the [3:11:33] question okay so all I'm saying is [3:11:37] someone could own houses rent houses and [3:11:40] then you got more than what was [3:11:43] anticipated that you got the homeowner I [3:11:46] mean you got got the property owner ma' [3:11:48] and then you've got the how private are [3:11:51] we making [3:11:53] this I believe it's all residents I'm [3:11:56] not sure if that distinction was made [3:11:58] okay thanks yes [3:12:07] ma'am yes ma'am um commissioner Newton [3:12:10] the uh store condition three says the [3:12:12] storage facility shall remain private [3:12:14] and only for the use of residents of the [3:12:15] sanctuary at Forest sound [3:12:24] um are there any questions from other [3:12:27] members of the [3:12:28] board or anything I could explain [3:12:32] further so do you know why they're not [3:12:35] opting to go with the the lead Drive can [3:12:38] you speak to why the lead Drive yes sir [3:12:40] it's my understanding that there's [3:12:41] Wetlands near lead drive and developing [3:12:43] that uh is not recommended [3:12:47] and that there is uh an agreement for [3:12:49] the applicant to be able to use Force [3:12:51] sound Road um I believe that applicants [3:12:53] can speak more to this but I believe the [3:12:55] agreement uh is from decades ago where [3:12:59] they have access to that [3:13:00] road how many access they have access to [3:13:03] the neighborhood that's one access how [3:13:05] many access did it [3:13:07] specify how many accesses they could [3:13:09] have to that road um what is the purpose [3:13:11] of the access is it just for just for [3:13:13] the storage yes sir [3:13:17] so [3:13:19] when the access [3:13:21] point the uh the driveway the apron area [3:13:25] was was ample research done and that [3:13:28] because you storage unit is going to be [3:13:30] boats stuff like that it's going to be [3:13:32] big boats yes sir there there's plenty [3:13:34] of room to navigate your way in that [3:13:36] entrance that's yes sir the applicant [3:13:37] can speak a little bit more to this but [3:13:39] I believe at the planning board they um [3:13:41] went over how they tested it and that [3:13:42] there was they found that there was [3:13:44] enough room okay yes sir [3:13:49] is there any other questions for staff [3:13:50] before we [3:13:51] get Mr Rose you good I'm good yes sir [3:13:56] thank you I believe uh the applicant has [3:13:57] a presentation [3:14:12] prepared good evening Mr chairman and [3:14:14] members of the board my name is Matt [3:14:16] Nicholls I'm an attorney in Wilmington [3:14:19] and I represent the applicant owner in [3:14:21] this request uh we appreciate the [3:14:23] opportunity to uh make a brief [3:14:25] presentation and have a series of slides [3:14:27] which I hope will help explain the [3:14:29] request and answer uh questions that the [3:14:32] board may have uh with me here this [3:14:34] evening are Brad Schuler who is a land [3:14:37] planner with Paramount engineering as [3:14:39] well as Jeremy Blair he is a civil [3:14:40] engineer with Paramount engineering and [3:14:43] then my client Representatives uh Robert [3:14:45] Jackson and Dean Dean hard AR are also [3:14:47] here um I'll start out by saying what [3:14:52] this is the project is not just to [3:14:54] clarify uh this is not open to the [3:14:57] public it is not a commercial uh boat or [3:15:01] recreational vehicle storage there'll be [3:15:03] no renting or selling of slips or [3:15:07] spaces um there's no change in the [3:15:10] residential [3:15:11] density um there's no dry stack storage [3:15:14] of boats or other RV type Vehicles [3:15:19] there's no many storage units there's [3:15:21] really no structures involved except my [3:15:25] understanding is there's proposed a gate [3:15:27] to gate the the uh entryway uh and but [3:15:32] other than that this is not a a like a a [3:15:35] many storage facility in any way um I [3:15:38] know that the board is uh very familiar [3:15:40] with the area and uh but this will [3:15:43] provide some context we circled the [3:15:44] Pender County Annex Building there in [3:15:46] blue [3:15:48] and I won't go through the the details [3:15:51] of the 2015 approval but in [3:15:55] 2015 um the board of County [3:15:57] Commissioners unanimously approved the [3:15:59] 106 unit single family subdivision the [3:16:03] entire property um commissioner Newton [3:16:04] to your question the entire property was [3:16:07] the 120 acres and then the part the part [3:16:09] that we're talking about is rough [3:16:11] roughly half that about 60.5 Acres um [3:16:15] where the Wetland or [3:16:17] yes ma'am correct yes [3:16:20] ma'am and you can see there that the [3:16:22] proposed RV boat storage area shown [3:16:26] dotted and blue there and there are from [3:16:28] what I understand some significant [3:16:30] wetlands in the around the area and [3:16:34] that's what's limiting the access or [3:16:37] would you would want the access on [3:16:39] Forest sound road but I I'm certainly [3:16:41] can defer to the engineers on on [3:16:43] specific questions about the [3:16:45] wetlands um so here is the area of the [3:16:48] proposed modification to the existing [3:16:50] conditional [3:16:51] zoning and just to provide again just [3:16:54] some context here um there's the Pender [3:16:56] County Annex Building uh it's as [3:16:59] everyone knows it's quite commercial [3:17:01] there on on Highway [3:17:02] 17 the there's the entrance to Forest [3:17:04] sound Road and then you can see the star [3:17:09] represents the approximate location of [3:17:11] the proposed RV and Boat Storage and [3:17:13] then you can see the approximate [3:17:15] location of the proposed entrance [3:17:17] so it's fairly close to 17 and um while [3:17:22] it is putting um you would say there's [3:17:25] sort of boat travel trailering traffic [3:17:28] on that area um it's not really taking [3:17:31] that through the the significant or the vast the the majority of the [3:17:36] neighborhood streets that are to the [3:17:38] east of there um you can see the [3:17:41] approved residential lots at the top of [3:17:43] the screen and then just in the um the [3:17:47] bottom of the screen you can see the [3:17:48] commercial and Civic uses so it it [3:17:50] really is um sort of within that sort of [3:17:53] buffer area between the commercial and [3:17:55] then the residential and um it um it [3:17:59] will be sort of out of sight for the [3:18:02] most part so you won't be having like [3:18:05] storage on the say on 17 I know there's [3:18:08] some things in your land use plan that [3:18:09] sort of discourage that type of use but [3:18:11] um for the most part um it will largely [3:18:14] be you won't really see it uh Mr [3:18:17] attorney Nicholls one of the questions [3:18:19] what I was trying to get to a while ago [3:18:22] was on the 60 Acres that includes the [3:18:25] wetlands it seems to be heavily wooded [3:18:29] how much of that 60 Acres is going to [3:18:32] need to be cut and what improvements [3:18:36] will be made for drainage once those [3:18:39] trees are cut on that 60 Acres around [3:18:43] the wetlands area that's my concern yes [3:18:45] ma'am so the area [3:18:47] that we're talking about is roughly 4 [3:18:49] and A2 Acres of that 60 and A2 [3:18:53] Acres I want to make sure I'm answering [3:18:55] the question accurately as to the [3:18:57] drainage and the impacts with that so if [3:18:59] I may defer to Jeremy Blair the engineer [3:19:02] on that question I don't mean to [3:19:03] interrupt your presentation if you need [3:19:05] to address it later on feel free if [3:19:08] that's okay with the board sure [3:19:09] absolutely thank you thank you um the [3:19:12] original site plan as mentioned had [3:19:15] significantly more [3:19:17] of spaces on there I think it was [3:19:20] 156 if I'm not mistaken but as a result [3:19:23] of the community meeting that proposed [3:19:26] site plan was reduced to the 106 so it [3:19:30] matches exactly the number of permitted [3:19:33] residential lots and as I said before it will just be [3:19:38] one space for residential lot and it's [3:19:41] purely a amenity for the neighborhood it [3:19:44] this is not it can't be rented it can't [3:19:47] be sort of sub leased out to a friend or [3:19:50] something like that that that's that's a [3:19:52] proposed condition for the board's [3:19:54] consideration so here's a slide showing [3:19:56] the overall reduction in the footprint [3:19:58] from the original plan to the revised [3:20:00] plan uh and again that was just to [3:20:04] minimi try to minimize the impact and [3:20:06] downsize the The Proposal based on the [3:20:08] community meeting and and frankly really [3:20:12] didn't need that many [3:20:13] spaces for the most part probably not [3:20:17] everybody in the neighborhood's going to [3:20:18] have a boat or an [3:20:19] RV uh so the idea of all the spaces at [3:20:23] 106 being used is probably not likely [3:20:27] although certainly wanted to have the [3:20:29] ability for each lock to have a place to [3:20:32] put their boat or their RV but for the [3:20:33] most part it's probably not likely that [3:20:35] it would be maxed out with 106 boats or [3:20:40] RVs the Gated access as I mentioned is [3:20:43] set off of for sound row by [3:20:47] 161 feet and that was to allow the [3:20:51] vehicles to sort of come in and it would [3:20:54] prevent sort of stacking onto Forest [3:20:56] sound Road there's ample space [3:21:00] there [3:21:01] and uh see Mr Cherry mentioned the the [3:21:05] land use plan I won't get into this in [3:21:07] detail I know they the staff did a very [3:21:08] good job going through that in the staff [3:21:11] packet um again this is consistent with [3:21:15] the residential nature of the approved [3:21:18] subdivision and it's again an amenity [3:21:20] for the residential [3:21:22] subdivision um I'm glad to go through [3:21:24] any of the policies or goals in the land [3:21:27] use plan if the board would would like [3:21:29] me to do that but again staff did a a [3:21:31] very good job of that in the staff [3:21:34] report um I would point out that this is [3:21:36] really a very minimal traffic impact [3:21:38] this is from the TRC notes but it's hard [3:21:43] to it's hard to really uh analyze what [3:21:45] the impact would be but uh the AM and PM [3:21:49] peak hour trips would be very minimal [3:21:51] this is not typically something that you [3:21:54] probably the higher use would be on the [3:21:55] weekends so it's not probably going to [3:21:58] coincide with what you would think of as [3:22:00] a weekday PM or am peak hour [3:22:04] trip and then in the staff report it [3:22:07] mentions here that the the the Trips [3:22:10] Again are going to be really really [3:22:12] pretty minimal when you're when I know [3:22:14] this board's used to looking at these [3:22:15] traffic tables and things and there's [3:22:18] significant numbers on there but with [3:22:19] two and three peak hour trips is really [3:22:22] pretty [3:22:22] minimal why does it say many [3:22:26] Warehouse I I don't know I think that [3:22:28] was that was going to be my question how [3:22:30] many were of those spaces were under [3:22:32] roof none no sir none none the the the [3:22:37] boat and RV spaces there there'll be no [3:22:40] uh sort of roofing structures or [3:22:41] anything like that commissioner n if I [3:22:44] may answer that question the wmpo uses [3:22:47] uh essentially a large book that [3:22:49] categorizes uses and then uh determines [3:22:52] a specific number of trips based on that [3:22:54] use and there's a note I believe on the [3:22:56] previous slide Mr Nichols uh it says [3:22:59] basically there's no comparable use to [3:23:01] what is being proposed so they chose [3:23:03] what they thought was most closely [3:23:06] aligned it's one of those uh technical [3:23:09] terms of art that I don't ever right so [3:23:12] um also that impervious surface what [3:23:15] will that be I know you have to have [3:23:17] something fairly solid to be pulling [3:23:19] boats in and out so and RVs so what will [3:23:23] that impervious surface SP I think the I [3:23:26] think the majority of it is perious yeah [3:23:28] all yeah Jeremy if you don't mind this [3:23:31] is uh Jeremy Blair with Paramount [3:23:34] engineering I'm sorry I misunderstood [3:23:36] that when I was hearing the conditions [3:23:39] all uh J Jeremy Blair civil engineer [3:23:42] with Paramount engineering so the the 61 ft stem apron is going to be a [3:23:50] pervious concrete which you know allows [3:23:52] for the the water to all soak through [3:23:54] and infiltrate and then the remainder is [3:23:56] a will be a a you know a structural [3:23:59] stone with a a geogrid which the EQ [3:24:03] recognizes as as perious as well okay [3:24:06] very good so while you're up there can [3:24:09] you answer my question about the clear [3:24:11] cutting of the trees yeah [3:24:15] so Mr said it's you know 4 and A2 Acres [3:24:18] out of 60 um and with it all being [3:24:22] perious all of the drainage is um [3:24:25] proposed to to soak into the ground not [3:24:28] run off so it'll be I'm G hold you to it [3:24:30] very similar to the to the current state [3:24:33] uh is certainly the uh [3:24:36] intent thank [3:24:38] you I think just a few more slides if I [3:24:41] may Mr chairman and then we'll U again [3:24:44] glad to answer any questions the [3:24:45] proposed conditions I know the staff [3:24:48] went through those um I'll just [3:24:50] highlight a few um we have to comply [3:24:53] with all the requirements in the [3:24:54] ordinance we have to meet all the local [3:24:57] state and federal [3:24:58] regulations um I mentioned the part [3:25:01] about it has it's purely private and for [3:25:04] the sanctuary for sound development [3:25:06] only um this part I I wanted to mention [3:25:09] um my client will be fully responsible [3:25:12] financially uh for the repair or damage [3:25:15] to any of the if anything happens to [3:25:18] Forest sound Road during the [3:25:19] construction of it he'll um repair that [3:25:22] at his cost um there is a road [3:25:25] maintenance agreement that's in place so [3:25:27] my client's already responsible for 50% [3:25:29] of of the cost of Maintenance of the [3:25:34] road Jeremy talked about the per the [3:25:37] pervious surface uh no dry stack [3:25:41] structures and then this was the wording [3:25:43] of the seventh condition in the staff [3:25:45] report [3:25:47] and the the one item we would ask the [3:25:49] board to consider [3:25:51] is after the planning board hearing we [3:25:54] discussed the possibility that the ncdeq [3:26:00] might have some different requirements [3:26:03] for the length of that or what surface [3:26:05] it would be so what we'd ask the board [3:26:07] to consider would be um adding that it [3:26:11] would be subject to modification of the [3:26:12] requirements of the permitting agencies [3:26:15] and condition number two and that would [3:26:17] really be only if when it gets to the [3:26:20] permitting at the state level if the [3:26:21] state for some reason doesn't want to [3:26:24] have 161 ft of perious concrete but want [3:26:27] say a lesser amount and some other [3:26:29] material there just so we're not out of [3:26:31] compliance with state [3:26:33] requirements um so we appreciate your [3:26:35] consideration of that change we just [3:26:38] don't know till we get to that part at [3:26:40] the state [3:26:41] level um planning board unanimously [3:26:43] recommended approval the planning staff [3:26:47] um I think did a great job with the [3:26:49] report and we're glad to answer any [3:26:50] questions that um that the board may [3:26:52] have and we appreciate appreciate your [3:26:56] time so what made the Lee Island connect [3:26:59] in 2015 when it was initially approved [3:27:02] it it stated that if there was any [3:27:03] modifications to this conditional zoning [3:27:06] adding structures or any other that that [3:27:09] would be reevaluated was it adequately [3:27:12] evaluated why the the First Street [3:27:14] connection off a lead Drive which would [3:27:16] make more sense for safety wise why was [3:27:20] that adequately evaluated and if so [3:27:23] what's the findings uh I'm going to [3:27:26] defer back to Jeremy or the land Planner [3:27:29] on that if they or my client Robert [3:27:36] Jackson can we get to the SL yeah to the [3:27:39] global slide [3:27:47] the area keep going designing there we [3:27:51] go right here right here okay is there a [3:27:56] pointer okay got I'm Robert Jackson uh [3:27:59] 640 Maritime way topso Beach the [3:28:01] applicant um at Sanctuary at Forest [3:28:04] sound and uh yes answer your question um [3:28:09] we've got actually that's not this real [3:28:11] slide there's Wetland let me get back to [3:28:14] this is Upland the the white area [3:28:18] anything in Gray I think that's a gray [3:28:20] hash mark is wetlands and so we've [3:28:24] already we at the limit for a general [3:28:28] permit for the US Army Corps of [3:28:29] Engineers with our project that was [3:28:32] entailed from the beginning we're at a [3:28:33] half acre of wetland impacts so the core [3:28:37] will not issue a wetland fill permit if [3:28:40] you've already exceeded or at or not [3:28:43] exceeded if you at the fill permit or if [3:28:46] you have an Upland access so if you have [3:28:49] a way to get to your property Upland [3:28:52] versus filling the Wetland they say well [3:28:54] nice trial you need to go to the Upland [3:28:55] side and uh Mr Hall Alec Hall who [3:28:59] developed the original Forest sound [3:29:01] negotiated with Mr Howard the seller at [3:29:05] that time for all this property or the [3:29:06] owner of all this property that there [3:29:09] could be Ingress and egress for the [3:29:11] remaining Parcels that Mr Hall did not [3:29:13] buy onto Forest sound road which [3:29:15] includes the subject property that we're [3:29:17] discussing here tonight so um and so [3:29:21] there is no way to get to this Upland [3:29:23] site without coming through uh Forest [3:29:26] sound Road legally or to be able to [3:29:29] permit it yeah so yes sir we did and a [3:29:33] couple people at the community mentioned [3:29:35] well hey if you could get access this [3:29:37] isn't a an improved road but there is a [3:29:39] RightWay here if you could get access to [3:29:42] this right away could you put boat [3:29:45] storage in here Behind these homes on I [3:29:48] think this is Lee Drive but uh behind [3:29:50] the homes on lead drive and there isn't [3:29:52] enough width one there's no legal [3:29:55] RightWay built but there's not enough [3:29:57] width or turnaround or I mean it would [3:30:00] maybe you could get 10 boats in there or [3:30:02] something I mean it'd be very limited [3:30:04] for 106 lot neighborhood as you can see [3:30:06] the width of of this Upland area so we [3:30:10] did we did Analyze That to answer your [3:30:12] question but it just wasn't feasible for [3:30:14] this size project and I will say when we [3:30:16] did uh Mr bieberstein who's probably [3:30:19] know past but he represented us when we [3:30:22] um did this uh project initially and at [3:30:25] that time we didn't know the amenity I [3:30:28] mean we didn't we were in the infant uh [3:30:31] planning stages of the project so we [3:30:32] didn't know if we were going to have a [3:30:33] pool a boat storage a playground or what [3:30:36] have you so he included and it's on page [3:30:39] 305 of the Udo because it was a [3:30:41] conditional use zoning case so it [3:30:44] included the proposed uses is within RM [3:30:46] cd1 residential mix this is under [3:30:49] rezoning proposal gry bll Inc that's us um the proposed uses are [3:30:55] residential mixed conditional zoning [3:30:57] District R telecommunications Tower [3:30:59] single family dwelling uh conventional [3:31:02] detached homes in other typical [3:31:05] neighborhood amenities which again we [3:31:08] we're here to say that we think in [3:31:10] pendra County a boat storage is a [3:31:12] typical neighborhood amenity um you know [3:31:14] if you have the land the accessibility [3:31:16] to have one it keeps people off the [3:31:18] highways you're in proximity of your [3:31:20] boat you can it's probably more secure [3:31:22] that way and you can get your family in [3:31:24] and out more quickly when the few times [3:31:26] you get to use [3:31:28] it so and I did have just for reference [3:31:32] legally um Mr bieberstein the seller's [3:31:36] attorney which was um U Mr uh Nunley I [3:31:40] believe and the hoa's attorney at the [3:31:43] time who I I don't know that remember [3:31:45] his name [3:31:46] reviewed the deed legal access from our [3:31:49] property to Forest sound Road prior to [3:31:52] even submitting and designing the site [3:31:55] and the title insurance company and all [3:31:56] three attorneys agreed that we had [3:31:59] unlimited access from Mr Howard's [3:32:01] original parcel which is now our parcel [3:32:04] to Forest sound Road in addition to that [3:32:06] in our community meeting we did ENT Enga [3:32:09] voluntarily in the in the community [3:32:11] meeting engage into a road maintenance [3:32:14] agreement with for sound Road [3:32:16] 50/50 from our entrance to the [3:32:19] neighborhood that we built here the [3:32:21] entrance here it's approximately I think [3:32:24] it's approximately a mile don't hold me [3:32:26] to that to 17 we share in 50% of that [3:32:30] maintenance in addition to that um as [3:32:33] part of our agreement our private HOA [3:32:35] agreement or whatnot um we agreed to [3:32:38] repave that and we did do that it was [3:32:41] $92,000 to repave that section from our [3:32:44] entrance to 17 and also um the the HOA [3:32:48] negotiated a gated entrance I'm going to [3:32:51] say 30 or 40 feet to the east of our [3:32:55] entrance for [3:32:57] security um and we had agreed to pay [3:32:59] that I think it was $441,000 [3:33:01] approximately um today they still [3:33:03] haven't gated it but they did put up two [3:33:05] brick columns so I think we in my view [3:33:09] we um we're a neighborly developer for [3:33:13] lack of a better way of describing it [3:33:16] are there any other [3:33:18] questions so as you know in the forest [3:33:22] sound road is going to become a Right [3:33:23] only turn in the next five or six [3:33:28] years I still think it would be better [3:33:30] to go down Dan 's drive across safety [3:33:35] wise and up Le drive and is going to be [3:33:36] trying to get in and out of far sound [3:33:38] Road Far sound road is a nightmare now [3:33:40] yeah no and pulling a boat out there I [3:33:42] could only imagine exact depiction of [3:34:03] it but it's close enough um this is [3:34:06] better um Second Street comes into here [3:34:09] and goes and cuts to for sound this is [3:34:11] our entrance this is a public DOT road [3:34:14] we were mandated by the County to make [3:34:16] that part of the I think it was The [3:34:17] Collector Street program or what's not [3:34:20] to make this a public DOT road and of [3:34:23] course and do will maintain it when we [3:34:25] um dedicate it to them so any Resident [3:34:29] which I would prefer also should in my [3:34:32] view with a boat and trailer should take [3:34:34] a right out of the facility come down [3:34:36] Second Street and head over to the light [3:34:39] and there's plenty a turning radius in [3:34:41] our new driveway entrance to take a [3:34:43] right or left understand it would be [3:34:44] shorter for them to [3:34:46] distance-wise to go up to 17 but if were [3:34:50] my if it were my family I'd say no let's [3:34:51] just go the long way and go to the [3:34:53] traffic signal but again that is going [3:34:55] to be up to the that's going to be the [3:34:57] prerogative of the [3:34:58] driver but um this this road is that we have [3:36:15] uh over [3:36:16] um kg Plaza using our road for a sound [3:36:20] road for the access to their [3:36:21] amenity um I think one of the the [3:36:24] biggest concerns that um we haven't been [3:36:26] able to understand is why the um [3:36:29] revaluation for Access off of lead Drive [3:36:32] Extension as you were mentioning um had [3:36:34] not been evaluated um I did talk to um [3:36:37] Mr Jackson when we had the public [3:36:39] meeting and asked him specifically if he [3:36:42] had looked into any other options and he [3:36:44] told me that he had not [3:36:46] and I asked him if he'd be willing to do [3:36:47] so and he said he would consider it so I [3:36:50] don't know what else what other [3:36:52] evaluation has transpired since I had [3:36:54] that conversation with him but my [3:36:56] understanding was that basically he said [3:36:57] it's wetlands and there's nothing we can [3:36:59] do [3:37:00] to you know look for access from another [3:37:03] Direction and Forest sound road is our [3:37:05] only option so this means that there's [3:37:08] going to be a Boatyard in our community [3:37:11] an entrance in our community for another [3:37:14] community which is highly [3:37:16] irregular I'm sure that some of you live [3:37:19] in a community maybe you know it's gated [3:37:22] maybe it's not and I don't know that you [3:37:25] would ever think that you could be [3:37:26] driving down a road in your own [3:37:28] community and see another community's [3:37:31] Boatyard and the one of the other [3:37:33] concerns excuse me that we have is that [3:37:37] you know it's unsightly a Boatyard is [3:37:40] unsightly a Boatyard has you know large [3:37:43] trucks and trailers coming in and out of [3:37:46] it that's going to be you know further [3:37:48] damage to the road further traffic up at [3:37:50] the um at the the entrance to Forest [3:37:55] sound um up at Highway 17 I mean it's [3:37:58] already very difficult getting in and [3:37:59] out of there during the busy times and [3:38:01] now we're going to have you know boats [3:38:02] and trailers going in and out I just [3:38:05] feel like there hasn't been an [3:38:07] adequate uh time spent to evaluate [3:38:09] another option or Mr Jackson possibly [3:38:12] should have planned his community in [3:38:14] another way if he knew knew he wasn't [3:38:16] going to have the ability to build an [3:38:18] amenity and have access to that amenity [3:38:20] inside his own Community you know when [3:38:23] he [3:38:24] originally you know was laying out the [3:38:26] neighborhood I don't understand why that [3:38:28] should now be a consequence of the [3:38:29] residents of fora sound um so there are [3:38:34] many many concerns that the neighborhood [3:38:36] has these are a few um one of the other [3:38:39] things is [3:38:41] that they say it's only for residents [3:38:44] and they say it's it's not going to be [3:38:46] rented but how can you [3:40:08] this would be that that our local [3:40:12] government would allow somebody to put [3:40:14] this type of of amenity into our [3:40:17] neighborhood I know it's their land but [3:40:18] the entrance all the activity everything [3:40:20] going on in there is happening from our [3:40:24] neighborhood the last thing that I want [3:40:26] to mention is that if this is actually [3:40:29] approved um I would I would think that [3:40:32] there should be of Greater consideration [3:40:34] for the buffer I think it's a 30 foot [3:40:36] buffer is what it states um we have I [3:40:39] think a 20 foot buffer today for the [3:40:41] community that they built there's no [3:40:43] buffer you see everything house you see [3:40:46] what everybody's doing in their backyard [3:40:48] um feet then the [3:52:00] width of it as you can see here the [3:52:03] width where we have the majority of our [3:52:06] boat storage from the Red Dot I don't [3:52:09] maybe Brad can tell me that exact width [3:52:11] we don't have that much geography feet [3:52:14] for the Ingress and egress of a boat the [3:52:17] trailer the 161 ft of storage and so on [3:52:21] so the the mechanics of the because of [3:54:29] the excuse me the sanctuary development [3:54:32] that there's additional water uh [3:54:35] flooding being experienced by other [3:54:38] homeowners around the sanctuary is there [3:54:42] anything or any convers ation or any [3:54:45] plans to do any drainage or directing [3:54:52] runoff wherever you clear for the boat [3:54:55] basins um beyond having it 100% [3:54:59] impervious there's not a project I've [3:55:02] ever done that's 100% impervious so when [3:55:05] we clear and when we install the Geotech [3:55:08] Fabric and the the the rock matter and [3:55:11] the impervious concrete it will all be [3:55:13] perious [3:55:14] so there is my answer would be I don't [3:55:17] know if there's anything else we could [3:55:19] do beyond that that would be in my view [3:55:22] the gold standard when you cut trees [3:55:25] will you agree with me that there would [3:55:27] be additional runoff yes ma'am no [3:55:30] there's no question I think that um part [3:55:32] of the problem I'm not just again I'm [3:55:35] rehashing the the area of the storm [3:55:37] water you're bringing up their Causeway [3:55:39] does flood when when Mr Hall did that [3:55:41] development he didn't do it under the [3:55:43] current storm water or really any storm [3:55:45] water regulations and at that time to my [3:55:47] knowledge the development ordinance [3:55:49] didn't require private roads to be built [3:55:51] to dat standards so I do agree they have [3:55:54] an issue there but that wasn't caused by [3:55:57] the sanctuary their issue was started in [3:55:59] the 80s or 90s when that development [3:56:01] Started Mr Hall was here you testify to [3:56:04] that but this particular development of [3:56:08] the boat storage is 100% impervious when [3:56:11] the trees come out the perious matter [3:56:13] goes in so we're going to [3:56:15] have again in my view the state of North [3:56:19] Carolina deer would tell you that a 100% [3:56:22] pervious parking lot is very hard to [3:56:25] come by I don't know of one in there [3:56:27] probably is one but I don't know of one [3:56:29] in east side of 17 and just as a [3:56:32] reference to the use I counted well [3:56:34] there's one in Salter's Haven not even [3:56:36] two or 3 hundred yards away there are 12 [3:56:39] residential which I sent to Mr Adams in [3:56:41] my initial conversations there're 12 [3:56:44] residential single family neighborhoods [3:56:46] with private boat storage facilities [3:56:47] today as we speak east of 17 in [3:56:51] Hampstead we're this isn't a unique [3:56:54] situation at all in my view matter of [3:56:56] fact it's a preferable one if you're a [3:56:58] boat owner in Pender County but most of [3:57:01] those are all designed inside of the [3:57:02] neighborhood sir yes sir they are and I [3:57:05] think there's some misnomer on the [3:57:08] Neighborhood Mr Howard Mr Hall did not [3:57:12] buy this track of land from Mr Howard he [3:57:14] only bought a portion of it so in [3:57:16] exchange for that he said you can bring [3:57:19] your private road through but I'm going [3:57:21] to have access to the road for for my [3:57:24] future seller or he could have developed [3:57:25] it a separate neighborhood so on any [3:57:28] public or private road if the owners of [3:57:32] forest sound or Mr Hall wanted to [3:57:35] protect the site they would have [3:57:36] purchased it and then they would have [3:57:38] been able to remove the access to Forest [3:57:40] sound road but as it stands at the time [3:57:43] Mr could have developed 20 lots that [3:57:46] front for sound Road or 50 or I don't [3:57:49] know how long it is but one every 100 [3:57:51] fet to use ra zoning as an example so [3:57:54] that he didn't want to limit the access [3:57:56] for land he didn't sell to the [3:57:58] neighborhood to the east of him you know [3:58:02] Forest sound so it we are not this is a [3:58:05] private piece of property it's not in [3:58:07] the forest sound it's called Sanctuary [3:58:08] at for sound but it's not in their [3:58:10] neighborhood it was never part of their [3:58:12] neighborhood it wasn't a plat of their [3:58:13] neighborhood it was a separate parcel [3:58:15] that Mr Hall did not buy because because [3:58:19] it's a 60 acre parcel that from what [3:58:24] I've [3:58:25] gathered is 50 acres wetlands and 10 [3:58:29] acres of Uplands in two different places [3:58:33] yeah well the whole parcel we bought was [3:58:35] 127 Acres so the balance of that was up [3:58:38] talking about the parcel in question [3:58:39] here yes ma' roughly 60 Acres yes ma'am [3:58:43] that's true that's primar Wetlands yes [3:58:45] ma'am that's true and what's going to [3:58:47] happen when you cut five acres or 3 and [3:58:51] A2 Acres of the [3:58:53] Uplands what's going to happen with the [3:58:56] remainder remainder of the wetlands is [3:58:59] that going to make it worse bring the [3:59:02] water table up no I wouldn't say so maam [3:59:05] we're well within the diner guidelines I [3:59:07] mean we're I think beyond that as far as [3:59:09] it relates to having a perious facility [3:59:12] so I think anywhere in Pender County [3:59:14] that you develop near Wetlands there's [3:59:17] trees that are taken out and they have [3:59:19] to deal with that in the diner code in [3:59:21] the storm water code and there's there's [3:59:24] you can have high density which our our [3:59:26] project's low density so you can have [3:59:29] high density with storm water ponds and [3:59:31] have you know more more Lots or you can [3:59:33] have low density and I think what we've [3:59:35] designed here I know it meets the state [3:59:37] code but I think in addition to that [3:59:40] being 100% impervious I don't know of a [3:59:42] different way we could do it more [3:59:44] environmentally sensitive that I know of [3:59:47] yes sir thank you thank you I have a [3:59:49] question for Mr Adams Mr Adams currently [3:59:52] under the current Zone and if if it was [3:59:56] to stay just like it is and no action to [3:59:58] be taken what would Mr Jackson be by [4:00:01] right legally able to build or put there [4:00:03] right now nothing what's currently Zone it's a [4:00:09] conditional zoning District so when that [4:00:13] zoning District was approved that was uh [4:00:16] not designated for any use so if he were [4:00:18] to say propose to build more homes he'd [4:00:21] have to come back before this board to [4:00:22] amend that approval so he's not allowed [4:00:26] to to build anything on that site [4:00:28] without getting approval from this [4:00:34] board any other questions I have any [4:00:37] other questions yeah is was [4:04:49] initially issued in 2009 and [4:04:51] subsequently revised in [4:04:54] 2014 that permitted an industrial park [4:04:57] uh that we all know as Pender Commerce [4:05:00] Park um so I'm going to just go through [4:05:02] a a little bit of brief background on [4:05:04] this property and Orient the board with [4:05:06] the site and then I'll turn it over uh [4:05:08] to miss Spinx if she has anything to add [4:05:10] although she's really more here just to [4:05:12] answer any questions [4:05:14] should the board have them so the map on [4:05:16] the site um you can see the Pender [4:05:19] Commerce Park is outlined or or shaded [4:05:23] in a light blue color the subject [4:05:25] property is in red and the subject [4:05:27] property is approximately 15 Acres on [4:05:30] the east side of US Highway 421 just [4:05:33] north of the Pender new han County [4:05:36] Line and some background on this [4:05:39] property uh or on the Commerce Park if [4:05:41] you will on February 16th of 2009 a [4:05:44] special use permit was issued for an [4:05:46] industrial park that covered [4:05:48] approximately 378 Acres that special use [4:05:51] permit was revised in 2014 to expand the [4:05:55] industrial [4:05:56] park and then on September 21st of 2021 [4:06:00] the county sold the approximately 15 [4:06:03] acres to Philips leasing Systems [4:06:06] LLC here's a map of the site uh just to [4:06:09] give you some reference this is a [4:06:11] recorded map [4:06:14] the subject property is primarily zoned [4:06:17] Industrial in the general industrial [4:06:19] category although the tail falls in the [4:06:21] rural agricultural zoning [4:06:24] District just a couple photos of the [4:06:27] site standing across 421 looking East [4:06:30] towards the site um you can see that [4:06:33] there appears to be a stub all 421 [4:06:35] that's barricaded and this is actually [4:06:37] standing on that stub looking Northeast [4:06:39] to the subject property [4:06:45] uh this slide is really just intended to [4:06:47] confirm to the board that removing this [4:06:50] property from the special you from the [4:06:52] special use permit that governs the [4:06:53] Commerce Park doesn't affect the [4:06:56] existing special use permit or have any [4:06:58] effect on the Commerce Park so you can [4:07:00] see that industrial parks are permitted [4:07:02] in the general industrial zoning [4:07:04] District via a special use permit and [4:07:06] they must have the following five items [4:07:09] that are listed on the board there by [4:07:11] removing these 15 Acres we're not uh [4:07:14] impairing the ability of the industrial [4:07:16] park to continue to operate or be [4:07:18] governed by the special use [4:07:22] permit uh the future land use map [4:07:24] designates this property as industrial [4:07:28] uh which is consistent with the [4:07:29] development pattern in this [4:07:31] area and on the screen are the findings [4:07:33] of fact uh that are in the Udo that the [4:07:36] board must make when uh issuing approval [4:07:39] of a special use permit or special use [4:07:41] permit revision this is this is the end [4:07:44] of staff's presentation again miss Spinx [4:07:46] is here representing the applicant um [4:07:48] she does not have a presentation [4:07:49] prepared and and really is just here to [4:07:51] answer question should the board have [4:07:55] them what's staff's recommendation we [4:07:58] generally don't make recommendations on [4:08:01] special use permits I I would say that [4:08:03] this is consistent with the future land [4:08:05] use plan the property is zoned [4:08:07] industrial so it's reasonable to expect [4:08:09] that Industrial Development will occur [4:08:11] on this site um on the new County side [4:08:14] south of you know south of the subject [4:08:16] site it's also zoned for heavy heavy [4:08:19] Industrial Development and the owner [4:08:21] owns the adjacent property on the new [4:08:24] han County side as [4:08:29] well is there any additional [4:08:32] questions or is there any questions for [4:08:34] the [4:08:39] applicant there are no questions is [4:08:41] there a special use permit for the longo [4:10:12] estate's home Owners Association um [4:10:15] there was a previous approval um last [4:10:17] year under Su case [4:10:21] 2023-24 um for a special use permit for [4:10:23] the expansion of an existing Community [4:10:26] boating facility in the longpoint [4:10:27] estate's community at the time the [4:10:30] request was to add an additional five [4:10:33] boat slips to the existing facility [4:10:36] along Hughes Road bringing the total [4:10:38] number of boat slips on site to 10 in [4:10:42] addition to the existing [4:10:43] um boat [4:10:46] ramp which [4:10:48] brought [4:10:50] each property owner in the neighborhood [4:10:52] to have their own boat slip right so [4:10:55] we're going to talk a little bit more [4:10:57] about the the the use of the boat ramp [4:10:59] in question as that is a focus of the [4:11:00] request this evening so the revision [4:11:04] tonight seeks to allow a limited number [4:11:06] of hammock watch and Greystone residents [4:11:08] which are two nearby neighborhoods to [4:11:10] utilize the longo estate's Community [4:11:12] boat range [4:11:15] and as you can see here the subject [4:11:16] property is highlighted in in a black [4:11:19] pattern um the total acreage is around [4:11:21] two acres this is off of Hughes Road [4:11:25] near the end of Washington Acres Road [4:11:27] and I've highlighted some of the the [4:11:29] neighborhoods nearby you can see [4:11:30] Washington acres is to the north of the [4:11:33] property in question you have hammock [4:11:35] watch to the southwest and then Longo [4:11:38] Estates consists of a lot of the a lot [4:11:41] of the nearby residences [4:11:44] the subject parcels and the surrounding [4:11:46] area zone RP residential [4:11:49] performance and here's an aial of the [4:11:51] site um this is a bit dated since this [4:11:54] photo was taken and per the approval [4:11:57] from the last special use permit they [4:11:58] did build five additional boat slips for [4:12:02] individual Property Owners at the [4:12:04] site and as you can see there's an [4:12:06] existing boat ramp to the north of those [4:12:09] slips those were the five that were [4:12:12] previously approved [4:12:13] bringing the total on site of 10 which [4:12:15] again gives every single owner in the [4:12:19] HOA Community um an individual boat slip [4:12:22] most of which have their own at their [4:12:24] own properties which are for the most [4:12:25] part on the water themselves but this [4:12:28] provides boat slips for those those [4:12:30] owners do that do not have direct water [4:12:33] access and so here's an an aerial image [4:12:36] with the site plan as you can see [4:12:37] there's a there's a finston area here a [4:12:41] green area here that's been ly used for [4:12:43] parking there's parking on the interior [4:12:47] you can see that existing concrete boat [4:12:49] ramp they have a a covered shelter on [4:12:52] site as well and then directly to the [4:12:53] north you can see the Washington Acres [4:12:55] boat [4:12:57] ramp there are some Wetlands on the [4:12:59] property um which is common for for a [4:13:01] coastal area like this and I also want [4:13:03] to point out that a community boating [4:13:05] facility as a use is allowed via special [4:13:07] use permit by by the Board of [4:13:11] Commissioners so briefly I want to talk [4:13:12] about about what a community boating [4:13:14] facility is um per the unified [4:13:16] development ordinance a private [4:13:19] nonprofit boating facility with [4:13:21] navigable water Frontage which includes [4:13:22] a dock Pier or launching ramp which is [4:13:25] intended to serve five or more [4:13:27] residential units it must be controlled [4:13:29] or owned or controlled by a homeowners [4:13:32] association or any type of Development [4:13:35] Association or Collective Owners Group [4:13:37] where more than one family has [4:13:39] privileges to use the facility [4:13:41] commercial activities of any kind in [4:13:43] including commercial letting of slips to [4:13:44] parties that are not residents of the [4:13:46] association or development shall be [4:13:52] prohibited so as I mentioned originally [4:13:55] this special use permit was issued for [4:13:57] the residents and property owners of [4:13:59] Long Point Estates since that time they [4:14:01] have entered into a memorandum of [4:14:03] understanding with hammock watch and [4:14:05] Greystone to essentially create a [4:14:07] collective Owners Group to share in the [4:14:09] use of that boat ramp as moving forward [4:14:13] without these neighborhoods involved [4:14:15] there would the boat ramp would be [4:14:17] underutilized because each owner has [4:14:18] their own slip so this would allow the [4:14:21] that to be used by the neighboring [4:14:23] communities select neighboring [4:14:25] communities and just to be clear this [4:14:26] will be accessible by limited number of [4:14:30] folks in these [4:14:31] neighborhoods but the the the facility [4:14:33] itself is not growing or changing so the [4:14:36] capacity will remain the [4:14:38] same so here's some trip counts from the [4:14:41] last special use permit just kind of is [4:14:43] you know illustrating [4:14:44] that the additional five boat slips at [4:14:47] the time equated to around an additional [4:14:50] 12 trips per day um which was an [4:14:53] additional one trip per peak hour in the [4:14:56] AM or PM um they actually did not have a trip count generation with the dot [4:15:02] that equaled an approximation for the [4:15:06] use of a boat ramp so the marina was the [4:15:08] closest thing for [4:15:09] that so here's some some photos of the [4:15:12] site um from last fall so you can see [4:15:15] there's a very very large grass area [4:15:18] along Hughes Road in between that you [4:15:20] see a marsh area that's grown up with [4:15:22] vegetation on the opposite side of this [4:15:24] would be those boat [4:15:26] slips and then if we Shuffle down the [4:15:28] street a bit we can see the gate that [4:15:30] takes you into the boat ramp um boat [4:15:33] ramp [4:15:35] area and so when we talk about special [4:15:38] use permits one of the requirements for [4:15:40] a special use permit is that is [4:15:42] consistent with the future land use plan [4:15:44] designation for that property which in [4:15:46] this case is Coastal residential which [4:15:48] is intended to preserve the County's [4:15:50] Coastal [4:15:51] character and it encourages unencumbered [4:15:53] access to public trust Coastal [4:15:56] Waters and appropriate land uses include [4:15:58] single family residences community [4:16:01] recreation open space uses and [4:16:03] water-based recreational uses so this [4:16:06] existing [4:16:07] facility is is in direct support of the [4:16:10] coastal residential intention um to [4:16:12] allow water access for those communities [4:16:14] and those [4:16:16] residents and so as you can see before [4:16:18] you these are these are the eight [4:16:19] requirements that have to be met for the [4:16:21] special use permit to be [4:16:25] issued and then these are the standard [4:16:27] conditions for for a special use permit [4:16:30] but again there's no proposed changes to [4:16:31] the site it's just a matter of letting [4:16:33] limited number of neighboring [4:16:35] communities use the underutilized boat [4:16:39] ramp moving [4:16:40] forward so that they may have direct [4:16:43] water [4:16:44] access are there any [4:16:47] questions any questions for staff this [4:16:49] may be a stupid question but back up to [4:16:53] the the one the last slide you were [4:16:56] talking about the [4:17:01] conditions the obligations imposed by [4:17:04] this permit will be the [4:17:06] responsibility of the property owner in [4:17:09] this case who is the property owner the [4:17:13] applicant HOA [4:17:16] or because we've got other residential [4:17:21] groups involved who who was responsible [4:17:25] for damage to this property if allowed [4:17:29] access the longo Estates HOA is the [4:17:33] property owner and to my knowledge [4:17:34] there's no intent to change that status [4:17:37] the agreement they've entered into is [4:17:38] not an ownership agreement it's merely [4:17:40] an agreement to utilize to use that [4:17:43] property unencumbered usage yes ma' new [4:17:47] members and they do and the applicant [4:17:49] can speak to this or the applicants [4:17:51] representative they do have some kind of [4:17:53] restrictions for those users that he'll [4:17:55] go over in his presentation sure thank this evening they are the [4:18:39] applicant and the the property owner and uh with me here this evening are is [4:18:45] um Ellen Wartman she's an attorney um [4:18:48] she's the regular HOA attorney and I [4:18:51] asked Ellen to be here and thankfully [4:18:53] she was available to answer any [4:18:55] questions that the board may have and [4:18:56] also to make sure I'm speaking correctly [4:18:59] as to the HOA Long Point Estate so um [4:19:03] the um and Terry Williams one of our [4:19:06] board members is here and there may be a couple other board [4:19:10] members but um we have a series of [4:19:13] slides Mr chairman and I think that will [4:19:15] help explain the request and um if you [4:19:19] have any questions along the way please [4:19:21] don't hesitate to uh to to stop uh stop [4:19:25] me um this is uh the general vicinity of [4:19:28] the longpoint Estates boat ramp [4:19:33] property and here's sort of a closeup of the boat ramp property I know the [4:19:38] board members will be familiar with this [4:19:40] because uh last year late last year year [4:19:43] the board allow my client uh to uh build [4:19:47] five additional wet slips on the [4:19:50] Waterway so the boat ramp that we're [4:19:53] talking about tonight is located there [4:19:56] uh as [4:19:57] shown and then just an overall sort of a [4:20:01] vantage point of everything um that's [4:20:04] approximation of the of the same [4:20:06] property and then um right the the [4:20:10] yellow star represents the slips that [4:20:12] were there previously and then the blue [4:20:14] star is where this board um allowed the [4:20:17] additional five slips approved and I [4:20:20] believe it was December of [4:20:22] 2023 and then to provide some further [4:20:24] context there's um the longpoint Estates [4:20:28] boat [4:20:29] ramp and then there's the neighboring [4:20:33] Washington Acres boat ramp which is not [4:20:36] part of this request at all it's a it's [4:20:38] a completely different facility and as [4:20:40] you'll see as you go through the these [4:20:41] slides they're they're different users [4:20:43] and it's it's just they happen to be [4:20:45] next to each [4:20:47] other so here's another view sort of a [4:20:50] street view of the longo Estates uh HOA [4:20:55] facility and then again here and then to [4:20:58] the left of the screen you can again see [4:21:00] the Washington Acres boat ramp and if [4:21:03] I'm not mistaken I I I don't know that [4:21:05] there's any access between the two I'll [4:21:07] maybe let um some of the other folks [4:21:10] speak to that but they're they're [4:21:12] separate parking areas separate separate [4:21:15] areas Al [4:21:17] together here's just another view [4:21:20] looking down Hughes Road and you can see [4:21:22] um the Gated area shown there in the [4:21:25] distance that's the Long Point of States [4:21:27] but also outside of the Gated area [4:21:29] there's quite a bit of parking [4:21:31] available um for uh vehicles and [4:21:35] trailers here's just another view of [4:21:40] that so um long point of States we [4:21:43] provided this just to show you kind of [4:21:45] where in proximity the two other [4:21:48] neighborhoods that were asking the board [4:21:50] to consider this evening are uh you can [4:21:52] see Longo Estates [4:21:54] here that's sort of a generalization of [4:21:57] where Longo Estates is and I'll I'll [4:21:58] come back to that with a little handout [4:22:00] I have but um there's Longo Estates and [4:22:02] then you can see Highway [4:22:04] 17 and Greystone is the first [4:22:07] neighborhood that we're asking for the [4:22:08] board to consider to allow using the the [4:22:12] longo Estates boat ramp as I mentioned [4:22:15] before when this board approved the um [4:22:18] we appreciate the board approving the [4:22:20] ability to build those five additional [4:22:22] wet slips my understanding is now [4:22:24] everybody within the Long Point estate's [4:22:27] HOA now has a a wet slip either at their [4:22:31] lot or at that Community slip so the [4:22:34] boat ramp really isn't [4:22:37] utilized uh if you will in the same way [4:22:39] that a community that simply has a boat [4:22:41] ramp it's certainly convenient to get [4:22:44] boats in and out of in an emergency and [4:22:46] or maintenance and that sort of thing [4:22:48] but my understanding is most people are [4:22:50] keeping their boats at their slip which makes [4:22:52] sense um the Greystone Community is [4:22:56] shown here with the green um the green [4:22:58] star and we've got the subdivision map [4:23:01] here this is map book 46 at page 40 of [4:23:04] the Pender County registry and I believe [4:23:06] there's um representatives of Greystone [4:23:09] here this evening um but Greystone [4:23:12] consists of 35 lots and conveniently [4:23:15] they're actually all sort of shown on [4:23:17] one map and and these are the lots here [4:23:19] and to provide sort of some context [4:23:21] here's the Pender County GIS of [4:23:24] Washington Acres shown in uh sort of the [4:23:28] pink color and you can see that um [4:23:31] Greystone is really not part of [4:23:34] Washington Acres my understanding um [4:23:37] it's in it and surrounded by it but the [4:23:39] Greystone neighborhood is not allowed to [4:23:41] use the the Washington Acres boat ramp [4:23:44] so they they don't have access to [4:23:47] that currently the my guess would be if [4:23:51] someone were U if this is not allowed [4:23:53] tonight then they would be using a [4:23:57] public boat ramp and that would involve [4:23:59] um you know getting on Highway 17 and [4:24:01] either traveling north or south so in [4:24:03] considering this we do think that there [4:24:05] is a benefit to um both the Greystone [4:24:09] and the hammock watch communities of um [4:24:12] having much more direct access to the [4:24:15] water with the boats and not getting out [4:24:16] and putting the boat travel trail [4:24:19] trailering traffic on uh [4:24:22] 17 so back to the map we've got [4:24:24] Greystone shown in green and then [4:24:26] hammock watch which is a smaller [4:24:28] Community but it's immediately adjacent [4:24:30] to Long Point [4:24:31] Estates [4:24:33] and again here's just the general [4:24:35] vicinity map of showing that and then [4:24:37] we've got [4:24:38] a here's a [4:24:41] map uh showing the 14 Lots um in Hammock [4:24:45] watch there's not one map of all of [4:24:48] hammock watch but this map happens to [4:24:49] show the 14 Lots shown here a couple [4:24:53] things I would point out with hammock [4:24:54] watch my understanding that there's a [4:24:57] community boating facility for hammock [4:24:59] watch so I believe it's nine of those [4:25:03] folks are have slips also at their own [4:25:06] facility and the reason I'm pointing [4:25:08] that out is because this really is I [4:25:11] don't think it's going to see like real [4:25:12] intense use from hammock watch it would [4:25:15] be to allow them to get their boats in [4:25:17] and out of in close proximity to their [4:25:19] neighborhood [4:25:20] also um but of course um we're asking [4:25:24] for their ability to to also use [4:25:29] it as uh Mr Brantley mentioned we are [4:25:32] proposing a number of boat ramp rules um [4:25:36] The Long Point estate's HOA would be who [4:25:38] would if if granted by the board would [4:25:40] be the recipient of the special use [4:25:43] permit and we would be responsible for [4:25:46] making sure all the rules are followed [4:25:48] there's any enforcement issues uh that [4:25:50] would be to the special use permit [4:25:52] applicant so it would be incumbent on us [4:25:54] to make sure that the rules are [4:25:56] followed but we have a number of rules [4:25:58] here in addition to any rules that this [4:26:01] board might request to be added as [4:26:03] conditions of [4:26:05] course the traffic impacts we think [4:26:08] would be pretty minimal with this like I [4:26:10] said the there's not a lot of traffic [4:26:13] with the boat ramp associated with [4:26:14] longpoint Estates um and um the other [4:26:19] neighborhoods we don't Envision a a [4:26:21] significant amount of traffic impact [4:26:23] from [4:26:26] this um I won't go can can I ask a [4:26:30] question um you say you don't expect a [4:26:34] significant traffic impact but looking [4:26:37] at this um roughly uh. n10 AC lot that's [4:26:46] gated [4:26:48] how has there been any calculations or [4:26:52] um I guess what I'm trying to get to is [4:26:57] You' got 40 on any given day you've got [4:27:01] 35 Lots in Greystone yeah yes and five [4:27:07] from hammock watch because nine have [4:27:10] their own boat slips that's my [4:27:12] understanding so we're looking at [4:27:14] 40 40 [4:27:17] units residents if they all one sunny [4:27:21] day came and use this boat slip is there [4:27:23] sufficient parking for their um vehicle [4:27:28] and their trailer either inside that [4:27:32] fenced area or along for the additional [4:27:35] parking outside the fence without having [4:27:38] to park along hu Road [4:27:42] no ma'am there is not sufficient parking [4:27:44] if everybody wants to use the facility [4:27:46] at the same time that's that's pretty [4:27:48] clear um it would be again it would be [4:27:51] uncomon on us to have rules and [4:27:52] regulations so [4:27:55] that I think in the I would say the rare [4:27:58] case when everybody is trying to use it [4:28:02] and working under the assumption that [4:28:04] everybody has a boat which I I don't [4:28:06] think is the Assumption which is [4:28:07] ludicrous I know but just bear with me [4:28:10] yes ma'am is there any other places for [4:28:13] overflow parking for this facility if [4:28:16] you open it up to 40 more [4:28:20] residents no no ma'am the parking is [4:28:22] what's shown so I we don't want to [4:28:25] misrepresent to the board in any way [4:28:27] that if if [4:28:29] everyone who has a pass if if approved [4:28:32] has a pass wants to use the facility at [4:28:35] the same time there's simply not enough [4:28:36] parking there um I I won't speak for [4:28:39] Greystone I understand there's a [4:28:41] representative here may want to speak [4:28:43] but from what I understand of Greystone [4:28:45] for example I've been told that there's [4:28:47] roughly 29 homes built out so there's [4:28:50] still still a few empty lots there and [4:28:52] roughly a third or so have boats or [4:28:55] kayaks so I think that's probably I'm [4:28:59] going to guess that's maybe fairly [4:29:01] representative of a of your typical [4:29:03] subdivision not everyone is going to [4:29:05] have a boat um but a significant number [4:29:08] will for sure um but um [4:29:12] what is the capacity boat and vehicle [4:29:15] and trailer in in this area both inside [4:29:19] the gate and outside the gate looking [4:29:22] back at my notes from the previous [4:29:25] hearing um my understanding is within [4:29:27] the [4:29:28] gate for vehicles is roughly 20 to 22 [4:29:34] vehicles within the gate vehicle meaning [4:29:37] the the motor vehicle and the trailer no [4:29:41] ma'am that just just the vehicle outside [4:29:43] of the gate my understanding is you [4:29:46] could have roughly 12 trucks with [4:29:50] trailers I don't know how that [4:29:51] translates I'm going to maybe defer to [4:29:53] my client and how they use this on an [4:29:55] everyday use but to give you an idea and [4:29:58] I'll go back to the aerial [4:30:01] um you can see a vehicle parked there [4:30:03] now I don't know if that I looks like [4:30:06] it's showing a trailer on the I'd have [4:30:08] to go closer to the screen to see but [4:30:11] just to provide an idea of how much [4:30:13] space is there now this I believe is [4:30:15] showing a vehicle U white color vehicle [4:30:19] on the spot now yeah Mr Pickles is I know Washington acres has been [4:30:25] there for years [4:30:27] but it looks significantly smaller and [4:30:29] there's a lot more residents in [4:30:31] Washington Acres how do they navigate [4:30:33] that busy weekend yes sir Wonder uh [4:30:36] again I my understanding is a lot more [4:30:38] people can use Washington Acres boat [4:30:40] ramp oh yeah that's my understanding so [4:30:43] um but we would be required to keep the [4:30:46] parking on site and if it was an an [4:30:48] issue then you referen 10 vehicles in [4:30:50] the gate because there's 10 boats going [4:30:52] to be in the slips and they're just [4:30:53] going to drive their vehicle down there [4:30:54] not going to bring a trailer I know that [4:30:57] yes or walk from their house yes sir yes [4:30:59] sir yeah so but um to be clear there's [4:31:02] not 40 parking spaces there's not enough [4:31:05] room for everybody to be using it at one [4:31:08] time uh but I I think the idea or the [4:31:11] assumption is is that um on the vast [4:31:14] majority of the days it's not going to [4:31:16] be an issue with parking Fourth of July [4:31:19] weekend that's probably going to be an [4:31:21] issue that they'll have to accommodate [4:31:22] and make rules and maybe not everyone [4:31:24] can use it at the same time so um or [4:31:28] busy summer weekend so that would [4:31:30] certainly be something that we we would [4:31:31] have to work through but I think other [4:31:34] um facilities of a similar nature [4:31:36] probably have to work through the same [4:31:37] issues [4:31:40] also so [4:31:44] um me go back to so right so I again I [4:31:49] don't know how many um lots are eligible [4:31:51] to use the Washington [4:31:53] Acres uh boat ramp but based upon my [4:31:55] limited research I think it's [4:31:57] significantly more than what we're [4:31:58] proposing [4:32:01] here [4:32:03] um the other thing I wanted I did want [4:32:06] to point this out just so we're clear [4:32:08] I've got a handout and and I apologize [4:32:10] that this did not make it into the [4:32:11] PowerPoint but if I may [4:32:14] um what we've got here and seeking just [4:32:18] wanted to get clarification from my [4:32:20] client what I what I've handed out is a [4:32:22] is really a two-page [4:32:25] handout and it's got yellow dots on it [4:32:27] and red dots on it and the yellow dots [4:32:32] represent the Lots within Long Point [4:32:36] Estates that are sort of part of the HOA [4:32:39] meaning they those 23 lots are are [4:32:41] currently allowed to use the longo [4:32:45] Estates boat [4:32:46] ramp the red lot the red dotted [4:32:50] lots and and this is where I may defer [4:32:52] to the HOA attorney on this because I'm I'm trying to understand it the um [4:32:56] the red dots are sort of you could say [4:32:58] are in longpoint Estates or their deed [4:33:00] may say they're in longpoint Estates but [4:33:01] they're not part of the HOA and they're [4:33:04] not they don't have the right to use the [4:33:06] boat ramp the red dots the red dots yes [4:33:09] ma'am so when you break down the number [4:33:12] of users within Longo Estates that who [4:33:14] I'm representing represented by the [4:33:16] yellow dots those are the folks now that [4:33:18] can use the boat ramp and my [4:33:22] understanding is all the folks [4:33:23] represented by a yellow dot they have a wet boat [4:33:27] slip so [4:33:29] um what we're asking the board to [4:33:32] consider is to allow 40 additional sort [4:33:36] of passes if you will from the two [4:33:39] neighborhoods 40 maximum [4:33:42] and it would allow that um the folks of [4:33:47] Greystone and of long of hammock watch [4:33:50] could utilize the boat ramp subject to [4:33:53] the rules and any conditions that the [4:33:55] board puts on that use and it would be [4:33:59] um I think a a significant convenience [4:34:02] to those neighborhoods it would help [4:34:04] alleviate [4:34:06] um traffic on 17 with folks going to the [4:34:09] public boat ramp or to another boat ramp [4:34:12] and again it's um something that [4:34:16] um I think would be a beneficial to an [4:34:19] under what is now a an underutilized [4:34:23] facility I [4:34:25] think I'm getting near the end of my [4:34:28] slides talked about traffic I I won't [4:34:32] talk too much about the comprehensive [4:34:33] plan it's in the staff report but I'm [4:34:35] glad to do [4:34:36] so um I do sort of outline the special [4:34:40] use permit criteria here but I know the [4:34:42] board knows knows those criteria well uh [4:34:45] special use permits for Community [4:34:46] boating facilities are allowed in this [4:34:48] District [4:34:50] um the we would contend that this is [4:34:53] consistent with the the area generally [4:34:57] you really need to only look next door [4:34:59] to Washington acres and you can see [4:35:01] there's a fairly similar proposed use [4:35:04] happening there now and what uh what we [4:35:07] would be asking for would be similar [4:35:09] with what you would see in coastal [4:35:10] Pender County and res Nal post tender [4:35:12] County with boat ramps and there's [4:35:14] really not a lot of boat ramps available [4:35:17] public or [4:35:20] private um no new structures are [4:35:23] proposed um subject to any the the rules [4:35:27] that were proposing in any conditions we [4:35:29] would have to comply with all applicable [4:35:30] CA rules and [4:35:32] regulations and that's that's goes [4:35:35] without saying and then um we would we [4:35:38] would ask the board to consider limiting [4:35:41] or allowing ing additional 40 Lots [4:35:43] within those two [4:35:45] subdivisions [4:35:47] and just to uh conclude the presentation [4:35:50] I'll go I'm glad to go through any of [4:35:52] the particular permits but again I'm I'm [4:35:54] sorry any of the particular criteria but [4:35:58] uh we would contend that the special use [4:36:00] permit criteria are met and this is uh [4:36:03] in some ways a modification to the [4:36:05] existing special use permit for the [4:36:06] community voting facility um to allow [4:36:09] the uh expanded use and the ordin does [4:36:12] allow under the Community voting [4:36:13] facility for there to be sort of a an [4:36:16] organization of I guess HOAs to um the [4:36:21] way the definition is would allow you to [4:36:23] consider this of course it's up to the [4:36:26] board and um we would contend that there [4:36:30] is sufficient parking for what we're [4:36:34] proposing um in the vast majority of [4:36:38] instances but like other uses I I do [4:36:40] want to say that as I said before you [4:36:42] could not Park everybody there at the [4:36:44] same time um and then that would be [4:36:46] something that we certainly would have [4:36:47] to work around because we would be [4:36:48] required to do that and not to be in [4:36:51] violation of the special use permit um [4:36:54] so that would be something we would have [4:36:55] to address with either times of use or [4:36:57] other rules and regulations to limit use [4:36:59] on um busy [4:37:03] days and um talked about the previous [4:37:06] special use [4:37:07] permit and then again it's uh we would [4:37:11] respect contend that for the propo the [4:37:14] scope of the proposed expansion that [4:37:16] there would be sufficient area there to [4:37:18] accommodate that um but of course we [4:37:23] appreciate the board's consideration of [4:37:25] that and we're certainly glad to [4:37:28] uh listen to any comments questions [4:37:31] concerns or additional conditions the [4:37:32] board may want to [4:37:35] consider uh I think I've said everything [4:37:37] Mr chairman that I had intended to say I [4:37:39] appreciate the board's time um I'm glad [4:37:42] to answer any questions and I think [4:37:43] there's some folks uh here to speak in [4:37:46] favor of it from from Long Point is [4:37:49] there any questions for the [4:37:52] applicant not this time so I have problems with with their keeping their [4:38:22] parking lot up with this much traffic [4:38:25] it's going to cause wear and tear than [4:38:27] what more than what they're used to now [4:38:30] um can we put conditions on on [4:38:33] maintaining that where it [4:38:35] doesn't pollute the [4:38:38] waterways I think so sir if the [4:38:40] applicants willing to agreed to that yes [4:38:45] sir yes sir uh that we don't want there [4:38:49] to be any issues with that so certainly [4:38:52] glad to agree a condition in that [4:38:56] regard any other questions for staff as [4:38:58] applicate for the [4:39:32] way that the vehicles are parked along [4:39:35] the roadway easement to ensure that [4:39:39] there's no um [4:39:42] intrusion or intrusion onto the roadway [4:39:45] itself that front of the boat [4:46:43] ramp there is nine children that live [4:46:45] there it's very limited it's a very nice [4:46:48] Community the extra traffic is going to [4:46:51] be a problem somebody's going to get [4:46:55] hurt I don't want to see [4:46:58] that on top [4:47:01] of all the traffic the nuisance that is [4:47:05] going to cause they've also built nine [4:47:07] ramps slips I'm sorry in in [4:50:00] 2010 uh the original developers of [4:50:02] Greystone longpoint and hammock's watch [4:50:06] um the Land Company of Pender um Jerry [4:50:08] Reeves JW Fussell and and um David Greer [4:50:13] had intended for the use of the boat [4:50:16] round to be extended to just those three [4:50:18] neighborhoods and it was all in place [4:50:20] legally but for the exception of some [4:50:23] paperwork that the attorney at the time [4:50:25] James Brandon did not file with the bank [4:50:28] um with which uh their developers had [4:50:31] their mortgage that bank subsequently [4:50:33] foreclosed and was assumed by another [4:50:36] bank and we worked diligently the HOA [4:50:38] myself and Mike Griffin at the time and [4:50:40] he was was the president I was the [4:50:41] secretary on the HOA board and uh [4:50:44] fortunately we were unable to uh to work [4:50:46] with the with with everything and the [4:50:48] ownership reverted to longpoint Estates [4:50:51] so what this current agreement is [4:50:53] proposing is really a revision to the or [4:50:57] version to the prior um intent of [4:51:00] extending access to Greystone and [4:51:02] hammock watch uh to the boat ramp during [4:51:06] that original transaction the property [4:51:08] was originally 3.21 Acres 21 Acres was [4:51:11] carved off and sold or deeded to [4:51:13] Washington Acres so their boat ramp [4:51:16] actually includes some of the original [4:51:17] property so their their um access has [4:51:20] been improved through um prior [4:51:23] transactions on this lot and that was [4:51:25] around about 210 time frame I believe so [4:51:29] that's that's just my point I think uh I [4:51:31] think we're all cognizant of what's [4:51:33] going on with traffic in the area but [4:51:35] honestly with 40 extra um boats compared [4:51:39] to or up to that many compared to how [4:51:41] many people use was and Acres um it is a [4:51:43] drop in the bucket compared to the [4:51:45] myself and all the other [4:53:03] users of of this boat ramp we currently [4:53:05] using the Lewis Road boat ramp facility [4:53:07] which I think we're all aware is next to [4:53:10] Sloop point and it's very very heavily [4:53:12] utilized so we're taking we're not [4:53:14] creating any additional trips we're just [4:53:16] taking them off of 17 and moving them [4:53:19] onto a local Road within our community [4:53:21] um the other thing is there's about a [4:53:23] hundred uh Parcels within the Washington [4:53:25] Acres neighborhood and as you can see [4:53:27] their facility is actually about [4:53:28] onethird the size of ours when you [4:53:30] consider the total acreage and so if [4:53:32] you've got a 100 homes using that that [4:53:34] that's much smaller of a parcel versus [4:53:37] only 40 on ours I I think think that U [4:53:41] we need to think about the parking and [4:53:43] you know whether or not maybe uh [4:53:45] Washington acres is creating some of [4:53:46] that traffic because again they have 100 [4:53:48] homes about 100 homes in their [4:53:49] neighborhood versus only 40 that were [4:53:51] asking to be on the uh longpoint Estates [4:53:53] boat ramp and of course the ultimate um [4:53:56] guide to parking is that you issue the [4:53:58] passes on a first come first Sur basis [4:54:00] so if we determine that you know the [4:54:02] capacity of the boat ramp and the [4:54:04] parking Etc is only you know let's say [4:54:06] 25 then the first 25 you know permit [4:54:08] hold or homeowners Within the group um [4:54:11] that applied and they would just get [4:54:12] first some first serve um permits and [4:54:15] then the rest would have to wait until [4:54:16] there is [4:54:17] vacancies um other than that again we [4:54:51] where you kind of get out into the water [4:54:53] and at Safe Harbor going down to Lewis [4:54:56] Road right beside slute point I tried it [4:54:58] recently and it's like getting on an [4:55:00] on-ramp an [4:55:01] I95 I got ran over and it was very scary [4:55:05] so I immediately turned the boat around [4:55:07] put it back on the trailer and headed [4:55:08] back home [4:55:10] this access will obviously provide a lot [4:55:12] of recreational value to myself and my [4:55:15] family and the community and that's why [4:55:17] we moved to Hamstead we came here to be [4:55:21] on the water fish clam oystering [4:55:24] following all the rules that are [4:55:26] provided by the state of North Carolina [4:55:28] and enjoying the water that is around [4:55:31] us the folks that are here that are [4:55:33] against this maybe being washed in acres [4:55:36] um we ride by that boat ramp daily [4:55:39] including Saturdays and Sundays [4:55:42] frequently see traffic on the road [4:55:45] because of the Washington Acres ramp Lao [4:55:48] Marina is I've only seen it filled up [4:55:51] one time so we're talking about 40 [4:55:54] permits that you know the own owners of [4:55:56] the boat ramp and all of us being there [4:55:57] at the same time I haven't seen it but [4:56:00] one time in a few years so just kind of [4:56:02] want to put that in context as well [4:56:40] eating at me [4:56:41] since literally since I got back from [4:56:43] the trip when I first moved in the real [4:56:46] estate agent promised me I'd have boat [4:56:49] access and I when I found out that it [4:56:52] wasn't deeded I went after that real [4:56:54] estate agency and a lot of our [4:56:56] homeowners have been promised that as [4:56:58] well these communities were built by a [4:57:01] group of Builders they were all built [4:57:03] together for our access and through the [4:57:06] time that I've been there since [4:57:07] 2017 I've been using that boat r [4:57:10] paying a nominal fee and everything [4:57:12] seemed to be working out fine I have [4:57:15] never and I have probably one of the [4:57:17] biggest boats and I probably use it more [4:57:19] than anybody here and I'm going to tell [4:57:21] you I have never seen parking ever be a [4:57:23] problem for us and anybody in Washington [4:57:26] Acres that has any complaint about [4:57:27] parking is complaining about [4:57:30] themselves our community doesn't use up [4:57:33] everything in Long Point we barely even [4:57:35] I have never had to park outside the [4:57:37] gate with my boat and trailer the [4:57:39] outside parking is given to us when we [4:57:43] had the rant passes for us to invite [4:57:45] friends to park their individual cars [4:57:47] there so they never even have a trailer [4:57:49] behind them and there's there's a a good [4:57:51] amount of distance between the main road [4:57:53] and where the fence is where they pull [4:57:55] up and and what I'm trying to say is [4:57:58] that taking away our access for for [4:58:00] boating rights does put us back on the [4:58:02] water where we have to go to the state [4:58:03] boat ramp I own a very big boat it costs [4:58:06] a lot of gas if you're talking about [4:58:08] environmental impact in General a lot of [4:58:11] us are so upset about this that we're [4:58:13] going to start looking for a different [4:58:14] way to get another boat ramp built which [4:58:16] means that's a big environmental impact [4:58:19] I've talked to Jason already about it [4:58:21] and he's told me about not messing with [4:58:22] the seagrass everybody's really upset [4:58:25] going down to the public boat ramp it's easily 12 to 14 miles Towing my [4:58:32] boat putting my boat in driving my boat [4:58:34] back down to the end of South topsil how [4:58:36] much gas does that [4:58:38] use when it when we talk about going to [4:58:41] the boat ramp and our access us using [4:58:44] our side of that ramp for all the years [4:58:46] that I've been doing this I I take my [4:58:49] boat down Washington Acres Road I don't [4:58:51] go weaving through Hughes or any of the [4:58:53] other roads to get there I have to [4:58:55] partially because of how high up it is [4:58:57] in the air but I have anyway just [4:58:59] because the traffic going around the [4:59:01] corners I am very concerned about [4:59:02] everybody else in the community and kids [4:59:04] playing but we have other things going [4:59:06] on and I want to say that that this [4:59:08] isn't something new every body here has [4:59:11] been dealing and we have not the picture [4:59:14] is showing all the cars parked outside [4:59:16] there we haven't been using the boat [4:59:18] ramp all this year so if those pictures [4:59:19] were neighborhoods are sister [5:00:16] neighborhoods originally developed by [5:00:18] the same developer and they who intended [5:00:20] for this access at that [5:00:23] location um as my neighbor chip just [5:00:25] mentioned those pictures that were shown [5:00:28] were during the time that we were paying [5:00:29] a nominal fee um I I believe this is all [5:00:32] to get in compliance with the Udo um [5:00:35] that was actually my truck in one of the [5:00:36] pictures so that's a average US day [5:00:39] Greystone it's 35 Lots 29 homes less [5:00:43] than a third of us are boat owners and [5:00:44] kayakers so you know a fraction of the [5:00:46] 40 we do [5:00:49] Traverse um you know talking about [5:00:51] traffic we all drive and Traverse Center [5:00:55] Drive Hugh Road Washington Acres Road [5:00:58] daily we walk ride bikes have children [5:01:03] um current water access is north on 17 [5:01:06] through the 210 and 17 [5:01:08] intersection um you know it's a 25 [5:01:11] minute drive without traffic couple [5:01:14] hours on the weekends if [5:01:16] so um so this permit will actually [5:01:19] reduce boat traffic on [5:01:21] 17 and the pressure on S Point Road [5:01:24] which we know is pressured from all over [5:01:26] the state I think we all have friends in [5:01:27] Raleigh that come here on the weekends [5:01:30] um so just yeah thank you for your time appealed [5:02:04] to us was the marina area and the way [5:02:08] that uh the boats were down there very [5:02:10] picturesque it looked like a New England [5:02:11] town almost it was so it was so Charming [5:02:14] but the the the point I guess that [5:02:18] someone made to me the other day and I'm a native North Carolinian and uh my [5:02:22] grandmother used to come down here spot [5:02:24] fishing so I mean you know it's kind of [5:02:25] in my in my blood to uh to appreciate [5:02:28] the the property down here and the land [5:02:30] down here [5:02:32] but that as as one person pointed out to [5:02:35] me that Marina and those ramps down [5:02:39] there people have been putting their [5:02:40] boats down there for a long time okay [5:02:43] they put some electronic Gates down [5:02:45] there you know if years back but you [5:02:48] know the precedents has been set and the [5:02:51] boating community and the fishing [5:02:52] Community they've been putting their [5:02:54] boats in there for a very long time and [5:02:56] this part of the tradition of Washington [5:02:58] acres and the inter Coastal [5:03:01] Waterway and I think when you start with [5:03:04] a [5:03:06] regulation and often times it's it's for [5:03:09] the betterment of the community but then [5:03:11] at the same time I think you need to [5:03:13] temper that with your [5:03:16] consideration of what your heritage of [5:03:18] your community is and what the people [5:03:20] are expecting you know as [5:03:23] Citizens thank [5:03:25] you Barry [5:03:32] barber Barry barber communities I [5:03:43] personally was a friend of Raymond [5:03:45] Hughes who was the original developer of [5:03:47] Washington acres and Longport Estates he [5:03:50] developed both those communities and [5:03:52] each one of them had a private boat ramp [5:03:55] it's written it's not a homeowners [5:03:56] association rule it's written into the [5:03:59] deed legally in the deed those ramps are [5:04:02] for the exclusive and sole use of [5:04:04] members of those two subdivisions so I'm [5:04:07] not even sure how this zoning question [5:04:10] it's not even legal the these [5:04:12] specifically States they cannot be used [5:04:14] by anyone else so that eliminates one of [5:04:18] the issues on your agenda the legality [5:04:21] secondly we've talked about the [5:04:23] commercial use these gentlemen are [5:04:25] proposing to sell a number of slips the [5:04:28] new communities do have no rights or [5:04:30] rules they're simply selling passes if [5:04:33] that's not a commercial application I'm [5:04:34] not sure what is they've created a [5:04:37] memorandum of understanding to kind of [5:04:40] skirt that issue but the bottom line is [5:04:42] longpoint Estates is simply selling [5:04:44] passes to other communities for monetary [5:04:47] value they're basically making a 100 [5:04:49] Grand a year or so from that so that's a [5:04:51] commercial Enterprise which is also [5:04:53] illegal in the community boat ramp [5:04:55] standards that you've put up here [5:04:57] tonight the the lady mentioned parking [5:04:59] there's approximately 15 spaces for [5:05:03] trucks and trailers that are in the long [5:05:05] por estate's property it's that's that [5:05:07] close maybe it's 16 maybe it's 14 but [5:05:10] approximately 15 in that range so now [5:05:12] you're proposing adding another 40 or so yes parking is going to be a problem [5:05:20] I've heard people in the Greystone [5:05:21] Community mention some unscrupulous [5:05:23] developers that promised them rights and [5:05:26] I know that's true I know that happened [5:05:28] and I do feel for them that's that's [5:05:30] wrong and it shouldn't have happened but [5:05:31] that should not infringe upon the rights [5:05:34] of the property rights of people who [5:05:36] bought in good faith into communities [5:05:38] expecting [5:05:40] the restrictions in our Deeds to be [5:05:41] honored the legal restrictions in the [5:05:44] Deeds that's that's all we're talking [5:05:46] about that should be the end of this [5:05:48] it's not legal what they're asking so I [5:05:51] do and I totally acknowledge voting [5:05:53] access is a problem in Hamp it's a [5:05:55] problem all up and down North Carolina [5:05:58] that's why people who bought in [5:05:59] Washington acres and bought in law en [5:06:01] por states did that they we realized [5:06:05] it's a exclusive Community with [5:06:07] exclusive use of the ramp for MERS MERS doesn't is because it was deed to them [5:07:38] and the bank couldn't take it from them [5:07:40] we had a handshake agreement with Longo [5:07:42] for years that allowed the original [5:07:46] owners of two other subdivisions that [5:07:49] lost their water rates to use that for a [5:07:51] nominal fee for me I for years it was [5:07:54] 350 bucks there has never been anybody [5:07:58] to the best of my knowledge when I par [5:08:00] there and I use it all the time parking [5:08:03] on the road out there because we don't [5:08:05] have to it's never full you go out there [5:08:08] July 4th Memorial Day Labor Day never a [5:08:11] problem so all we are asking from the [5:08:14] board your mercy on this to correct a [5:08:18] mistake the stroke of a pen that an [5:08:20] attorney did not do to give us the same [5:08:23] rights that we're entitled to that Long [5:08:25] Point has and the other two divisions [5:08:27] don't that's all we're asking for and [5:08:30] praying for here shows that roughly half of Long Point [5:10:56] acres does not have water access or at [5:11:00] least is not a member of the [5:11:03] HOA yes ma'am now some of course some of [5:11:06] those folks are on the water so they may [5:11:08] have a peer or they have the ability to [5:11:09] have a pier and in which case I don't [5:11:11] know that they really need the boat ramp [5:11:13] but yes ma'am I I didn't understand it [5:11:16] myself and like I said was figuring it [5:11:18] out today and didn't get a chance to put [5:11:20] that in the presentation but from what I [5:11:22] understand that's that accurate [5:11:24] 23 23 HOA lots have access to the boat [5:11:29] RAM and that's similar up the street Old [5:11:32] Point Old Point Property Owners that [5:11:34] have property adjacent to the water do [5:11:37] not have deed access to to the what is [5:11:40] Harbor Village jock club marina they [5:11:42] don't have DED access to because they're [5:11:43] on the water because they're on the [5:11:44] water there's only three of these Lots [5:11:46] looking at this map that that are on the [5:11:49] water that don't have access or don't [5:11:51] have rights to the boat why those three [5:11:53] I don't know yeah there's more than that [5:11:56] Mr chairman three four five six these [5:12:00] this is this is water here yeah that was [5:12:02] that water there that's not water yeah [5:12:05] the end of the creek is right there [5:12:06] that's his property oh [5:12:10] M Mr chairman may I add something it's [5:12:13] speak with my client and hearing the [5:12:14] comments we we would like to reduce the [5:12:17] request from 40 passes to 25 I was [5:12:20] fixing to ask that question because in [5:12:22] the original presentation wasn't it a [5:12:24] much less [5:12:26] number I remember reading 20 or 25 [5:12:29] somewhere in the past I I don't recall [5:12:32] Mr chairman on this particular item but [5:12:34] I would say that um from what I [5:12:37] understand [5:12:39] my from my client we likely wouldn't [5:12:41] even sell the 40 I say sell I mean [5:12:45] provide for the [5:12:47] um um provide for the other [5:12:51] neighborhoods a the 40 the 40 passes so [5:12:56] the 25 is is a more reasonable number it [5:13:00] also significantly lessens the uh impact [5:13:04] on [5:13:05] parking uh it's probably about a 35% [5:13:08] reduction 40 to to 25 would be about a [5:13:11] 35% [5:13:12] reduction um and um like I said the the [5:13:18] a number of the Lots in [5:13:21] um hammock watch they have the wet slips [5:13:25] and from what I understand from the [5:13:28] Greystone um folks not everyone has a has a boat anyway um and as far as [5:13:36] the issue of um this is not a we would [5:13:41] respectfully contend this is not a [5:13:42] commercial use in the sense of um it's [5:13:47] not open to the public it would be very [5:13:50] limited and of course there has to be a dues or a fee associated with that [5:13:57] there's costs associated with it there's [5:13:59] Insurance there's upkeep there's [5:14:02] maintenance there's you're expanding you [5:14:05] would be expanding the scope of it so [5:14:08] yes there would be [5:14:10] a monetary component to it but that's [5:14:13] true of any HOA with dues and that sort [5:14:17] of thing so [5:14:20] um but the idea is not to have a it's [5:14:24] not to have a commercial boat ramp there [5:14:26] it's to accommodate these two other [5:14:29] neighborhoods that otherwise are not [5:14:32] going to have access to a boat ramp and [5:14:34] we think it would benefit them it would [5:14:37] benefit us in the sense that we could [5:14:39] make better use of the ramp and also [5:14:42] plan for maintenance upkeep and just [5:14:46] allow better use of it and you heard [5:14:48] some of the testimony about um [5:14:51] historical or customary use but um in [5:14:55] any event we we understand and realize [5:14:57] that the the only use Allowed by that [5:14:59] ramp [5:15:00] today is by the Long Point Estates [5:15:04] owners the only board that can expand [5:15:07] that is this board and so that that's [5:15:09] why we're here asking for this board's [5:15:11] consideration can we C are we can we be [5:15:15] allowed or are we allowed to expand in a [5:15:18] limited capacity to allow these two [5:15:20] other neighborhoods to make limited use [5:15:22] of it um and we think there's there [5:15:24] would be a lot of benefit to that so we [5:15:27] appreciate the U the the time and [5:15:29] consideration of the request does the [5:15:32] 23 residents in Longo do they pay will [5:15:36] they pay the same fee [5:15:39] if you want to call it a fee or [5:15:42] registration as the ones from [5:17:42] the people who hammocks watch you don't [5:17:45] they have their own boat slips like we [5:17:47] do it's just 25 I don't know that we'd [5:17:50] sell 25 passes but we do sell them and [5:17:54] we say sell we do that because we have [5:17:58] couple hundred feet of Bulkhead we have [5:18:00] docks we have the ramp we have upkeep of those two acres approximately it's a very whatever we charge it will [5:18:11] be a fair number and it's not decided at [5:18:14] this point this is something that the [5:18:15] whole board has to [5:18:16] discuss as far as I get the question why [5:18:19] wouldn't you charge the same thing or a [5:18:23] pra amount for the upkeep of the [5:18:27] facilities to keep it from seeming as if [5:18:31] this is a um uh a a profit Enterprise [5:18:37] right well there is a res res erve [5:18:39] factor that comes in in the event of a [5:18:40] storm of course none of those facilities [5:18:42] are insured you know if hurricane comes [5:18:45] through we we hope to build up a reserve [5:18:47] to cover that [5:18:49] contingency um we do pay annual HOA dues [5:18:52] it's it's it's in in the event of [5:18:57] shortfalls we would be [5:18:59] assessed not a regularly [5:19:01] scheduled HOA due we would have a [5:19:04] special assessment to all of the owners [5:19:06] in longpoint Estates and only longpoint [5:19:08] Estates not just other communities the [5:19:10] HOA boat ramp [5:19:14] do it's it's not broken out we we [5:19:17] pay we pay one annual [5:19:21] HOA homeowners fee if what I'm saying is [5:19:25] if that doesn't cover the upkeep on [5:19:27] these facilities or damage to those [5:19:30] facilities because as Matt mentioned [5:19:32] earlier we're responsible for that that [5:19:34] would we would pay that out of pocket by [5:19:36] way of a special assessment [5:19:39] so would your current structure if you [5:19:41] charged $1,000 a year say for each [5:19:44] resident Lo how much of that thousand is [5:19:46] set [5:19:47] aside for the maintenance for the grass [5:19:50] keeping the upkeep of the fence upkeep [5:19:51] of the docks [5:19:53] currently right now it goes into a [5:19:55] general fund but that's something that [5:19:57] we could be more than willing to listen [5:20:01] to suggestions if that if you're what I [5:20:04] think you're getting at is you would used by members [5:22:53] other than longpoint Estates I told them [5:22:55] to stop doing that it's not allowed and [5:22:58] my understanding is they stopped doing [5:23:00] it which would have been it's I can't [5:23:04] hear really hey can we keep it down in [5:23:06] the audience please and and do and I've represented longpoint Estates [5:23:12] on a very limited basis really since the [5:23:15] I was before you all in 20123 for the [5:23:18] expansion um in the context of [5:23:21] representing them when I learned about [5:23:24] the others I guess historically using [5:23:27] the [5:23:27] ramp I said you can't do that under the [5:23:30] Pender County zoning ordinance you need [5:23:32] to stop doing that and my understanding [5:23:34] is they stopped doing it so correct me [5:23:36] if I'm wrong they haven't had anybody do [5:23:38] it [5:23:39] since I don't know I'm not sure when we [5:23:42] haven't probably haven't collected any [5:23:46] fees I I hate to say I may give you bad [5:23:49] information but I suspect it it was the [5:23:52] beginning [5:23:53] of [5:23:56] 2023 maybe and as soon as we were [5:24:00] informed that this is not it's not legal [5:24:04] U we stopped and we had informed [5:24:05] everybody that wouldn't be selling [5:24:07] passes until we had a opportunity to [5:24:10] come before you and hopefully get the [5:24:13] blessing to do that again um so soon as [5:24:17] we found out that we were not compliant [5:24:20] we stopped and I'd have to say we we we [5:24:24] get calls daily about when can we do it [5:24:28] again and we of them give them individual [5:29:42] assignments of boat slips but none of [5:29:45] them talk about the boat ramp so they give them membership in the HOA [5:29:53] itself and then the HOA itself owns that [5:29:57] real property to which that boat ramp is [5:30:00] attached or sits on and then some of [5:30:03] them were given deed boat slip access [5:30:07] which has been a separate topic of much [5:30:09] discussion amongst the community about [5:30:11] whether that's legal or not um but [5:30:13] whoever drafted up those deeds did give [5:30:15] them some specific boat slip assignments [5:30:19] and the exclusive use of certain boat [5:30:23] slips but I have not reviewed any Deeds [5:30:26] I've not reviewed all of them obviously [5:30:28] there are a lot of them but I've have [5:30:30] not reviewed any Deeds that specifically [5:30:32] give them exclusive use of the boat ramp [5:30:36] so just for example and uh I'm not going [5:30:38] to get too far further down in the weeds [5:30:42] but these property owners in Longo [5:30:45] Estates that have are on the water that [5:30:49] are the red dots they're red dots [5:30:52] because they have a boat slit on their [5:30:56] property I don't know why they are red [5:30:58] dots um there are my understanding is [5:31:02] four Waterfront lots that have boat [5:31:05] slips or docks on their own property [5:31:08] that are individual docs okay um but [5:31:11] what I've seen when I've gone back [5:31:13] through all their HOA documents is there [5:31:16] were plat Maps recorded there was an [5:31:18] original declaration recorded annexing a [5:31:21] the first few Lots into longpoint [5:31:23] Estates and then the annexation kind of [5:31:26] went two Lots at a time one lot at a [5:31:29] time and it was no longer the developer [5:31:32] annexing Lots into the HOA but rather [5:31:35] the individual property owners who had [5:31:37] purchased the Lots from the developer I [5:31:40] believe that coincided with the bank [5:31:42] foreclosure and other things that [5:31:45] happened and I just don't believe that [5:31:47] the HOA fully [5:31:50] developed um as the neighborhood was [5:31:53] developing so it it became a situation [5:31:56] where after a certain period of time [5:31:58] what you see is certain Lots voluntarily [5:32:01] joining the HOA and voluntarily becoming [5:32:04] annexed into the HOA but there was not a [5:32:07] m [5:32:08] PUD type scheme where the entire [5:32:11] neighborhood was put into an HOA like [5:32:14] you would see today if and you know [5:32:16] developer came and applied for that [5:32:18] right to do so so it's it is very [5:32:21] confusing but we've got 23 Lots within [5:32:24] the HOA again of those 19 have slips in [5:32:29] community boating facilities and four [5:32:32] have slips on attached to individual [5:32:35] peers that come off their waterfront [5:32:37] property [5:32:38] so when everything that you just said to [5:32:42] us you're referring to longpoint [5:32:46] Estates yes as distinguished and [5:32:50] distinct from Washington Acres property [5:32:54] owners who have deeded exclusive [5:32:58] rights yes and I believe the the [5:33:00] discussion about the exclusive rights [5:33:02] had to do with the common area itself [5:33:04] not the individual Lots owned by the [5:33:07] individuals within longpoint [5:33:12] Estates thank [5:33:18] you one more [5:33:21] question this [5:33:23] work uh I I trust your um legal [5:33:27] Acuity having had many cases with you in [5:33:31] the past do you [5:34:19] not Washington acres has an issue with [5:34:22] longpoint Estates head-to-head on some [5:34:25] other issues you know I don't know I [5:34:27] have not investigated the validity of
