[0:00] e [0:26] [Music] [0:59] that okay [1:01] [Music] [1:08] [Applause] [1:09] [Music] [1:19] order we have one item on the agenda [1:20] today that is the discussion to amend [1:23] the city code chapter 182 uh in addition [1:26] to my colleagues here tonight I just [1:27] wanted to thank um mayor m [1:30] commissioner Divine and assistant chief [1:33] ovich and Mr bar for being pres as well [1:36] so starting with the why I think we've [1:39] all campaigned in in our perspective [1:41] areas on the issue of noise just how do [1:44] we address it uh as a as an entire city [1:47] so in recognizing that just the this has [1:49] been a chronic issue for as long as I've [1:52] been on the council to understand there [1:54] was ways where we can adjust C code and [1:57] also work collaboratively with the other [1:58] agencies this uh just have a better [2:02] impact and improve the quality of life [2:04] conditions for our residents uh so [2:06] before I turn it over to uh police and [2:09] the law department for their insight and [2:12] understanding of enforcement and the [2:14] legality of hearing to the U this city [2:19] code my recommendation would be just so [2:21] everyone has a transparent understanding [2:23] of my thoughts uh it's one adjusting the [2:27] time frame in which sound repr is deemed [2:30] unreasonable So currently it is listed [2:33] at 11:00 p.m. to 6: a.m. my [2:35] recommendation is adjusting it to 9.m 9: [2:44] a.m. [2:48] 11m so I'm reading [2:50] from section J and it is bullet number [2:54] two [2:56] okay and then again just for a [3:00] accountability it says between the hours [3:01] of 11:00 P.M to 6: [3:04] a. [3:06] the there occurrences of unreasonable [3:08] time unreasonable and unnecessary sound [3:10] production is like prohibited so my [3:12] recommendation is adjusting that to 9:00 [3:14] p.m. to 9:00 [3:16] a.m. secondly it is adjusting the [3:19] penalties so penalties for offenses [3:21] currently the initial request is the [3:25] fine should not be anything higher than [3:27] $250 my recommendation is is adjusting [3:30] first offenses to [3:31] $500 second violations to [3:34] $1,000 and then third violations [3:36] allowing the city court judge to [3:38] exercise their discretion um not to [3:41] exceed [3:42] $2,000 and then we can get more into [3:44] like the understanding of like my [3:46] reasoning for that and then finally [3:48] there is a [3:50] section in the city code that uh in the [3:54] same section J bullet one that last [3:57] paragraph it highlights to unreasonable [4:00] or unnecessary noise at any time except [4:02] for activities open to the public or to [4:05] the public benefit for which permission [4:07] has been granted by the city enity I [4:09] think that opens the door for us to have [4:12] a permanent style approach so we are not [4:14] just saying no to people having [4:16] unnecessary or excessive noise we are [4:19] saying within a certain confined [4:21] parameters and then that is something [4:23] that we can create collectively as a [4:25] council so after giving my [4:27] recommendations I would like to turn the [4:29] over to uh law enforcement department [4:32] and then following by the legal [4:33] department just to how noise complaints [4:36] are addressed currently and then if you [4:38] have any recommendations right now well [4:40] Mr chairman if I be allowed [4:44] to you the code [4:48] uh I have your thought process and some [4:52] of the things that you're putting [4:56] for we look for compliance servic not [4:59] like you want to go out and find people [5:01] you want to arrest people you want [5:03] people to be able to have a good time [5:05] enjoy their [5:07] property both the quiet perspective and [5:10] if you have music or something that's [5:14] going [5:16] on we follow up on every call that comes [5:20] in to dispatch people will say no nobody [5:25] responded unfortunately it's not [5:27] necessarily as quick as people would [5:29] like [5:30] it's a priority system that is used for [5:33] the calls coming in so they're evaluated [5:35] in terms of imediate danger to life or [5:39] property those who assigned Priority One [5:43] status and they take PR over anything [5:46] else priority two and noise complaints [5:49] are listed as priority three so it's [5:53] unfortunate [5:54] that uh the priority three calls are not [5:59] followed [6:00] up and in this timely manner as people [6:04] would like whether have we sitting here [6:06] in this tand staff or the neighbors but [6:11] at the Staffing [6:13] levels uh that's the reality of our [6:16] ability to do the respond St and I'm not [6:20] positioned to ask that we increase the [6:23] police staff or other staff [6:25] to deal with noise complaints at this [6:28] point [6:31] where get how do you get common sense [6:34] and people to act in an appropriate [6:37] manner that is sensitive to the concerns [6:41] and desires of their neighbors or the [6:44] neighborhood [6:47] and so we [6:49] do show up ask people to turn stuff down [6:52] I've been out calls [6:56] where you will have music blasting these [6:59] last turn it down they turn it down 15 [7:02] minutes later Call's coming back in the [7:05] same that people have turn the noise up [7:08] uh the sound up [7:11] and how do [7:13] you might have a key to this Mr Williams [7:16] if you can legislate Common Sense you'll [7:18] be a hero here uh but it's to get that [7:21] level of uh [7:23] compliance with it so with that I [7:26] appreciate the discussion the dialogue [7:28] and I know what you like to address you [7:31] add their perspective to it [7:35] AC uh [7:37] so when uh reading over the uh city [7:40] ordinance on the noise violation section [7:43] and we talked about the 11:00 p.m. to [7:45] 6:00 a.m. window um we also go by goet [7:49] point B where [7:53] um in such a manner as to create noise [7:56] that can be heard 50 feet from such [7:57] device and I know in this section [8:00] kind of refers to Motor Vehicles on a [8:02] public Highway and boat in public Waters [8:04] but also by a person on public or [8:06] private property so we utilize section B [8:11] to enforce this noise ordinance 24 hours [8:14] a day not only just in that uh window of [8:17] time that's described in in section a [8:21] um [8:23] regardless uh as the mayor stated a lot [8:25] of the times we get these calls and due [8:28] to our staffing level and and call [8:30] volume it may take us a lot longer to [8:34] arrive to deal with the situation to a [8:36] point where maybe the the source of the [8:38] noise is no longer there um we do have [8:42] the [8:43] ability If Video evidence or some other [8:48] type of [8:50] uh evidence that the noise was occurring [8:53] and that it was unreasonable to file for [8:56] a warrant um and deal with it that way [9:00] but generally the the noise has to be at [9:03] a an unreasonable level while the police [9:06] officers are there to observe it to [9:09] follow through with um you know the any [9:13] type of disciplinary action that would [9:14] come from this um how however in certain [9:19] circumstances we can file um charges for [9:24] evidence that we have that supports [9:25] those charges um that we didn't [9:28] personally Witness at the time of of the [9:30] event um there have been situations [9:34] where as the mayor stated where police [9:37] officer arrives gives a courtesy warning [9:41] for them to turn the music down and [9:43] oftentimes that suffices and people do [9:47] uh comply with those [9:49] orders there are a lot of times where [9:51] they comply in our presence and then [9:53] shortly after we leave they they turn [9:55] the music back up um we have gone [9:59] through and created I wouldn't say a [10:03] database but there are uh addresses that [10:06] have been Chic offenders of this [10:08] ordinance that it has [10:11] been a message given to to all platoon [10:15] that if you're responding to these [10:16] addresses for an issue along these lines [10:19] that they are not to be given you know [10:22] zero tolerance for those addresses [10:23] because they are chronic offenders of [10:26] this particular uh section um and that [10:30] currently any kind of um warnings or um [10:37] discretion that's been given to them in [10:39] the past has not been taken with respect [10:42] so um we're trying to to cut off issues [10:46] where one officer arrives gives a [10:50] courtesy uh warning to turn the music [10:52] down then then the issue happens again [10:55] and you have a different officer who [10:56] arrives and they didn't realize that the [10:58] first officer had just given that [10:59] warning and so now they're giving a [11:01] warning how many times can a different [11:03] officer arrive to the same place and [11:04] give a warning and what's the best way [11:06] of making sure that everybody is aware [11:09] uh that warning has been given um we do [11:12] have systems in place that should be [11:15] followed where you make notes in the [11:18] call and it kind of goes under the [11:19] premise history what we call it in our RMS system so we encourage officers [11:24] to check premise history before [11:27] responding to these calls so they can [11:28] see if warning has been given and when [11:30] was the last one um or if if the premise [11:35] is one of the ones that we spoke about [11:37] that's a chronic offender and that we [11:39] don't uh they have zero tolerance um [11:42] directive for for that [11:45] address beyond that if an officer [11:48] responds to these calls and sees that [11:51] the noise ordinance is being [11:55] violated at that point like you said [11:58] they there are uh different penalties [12:00] for each offense you know up to a third [12:03] offense where I think that was where it [12:05] maxes out um there is the ability of the [12:08] officer to remove the source of the [12:11] noise as well and I'm not sure that it's [12:14] exactly clear on if we could do that [12:16] right off the bat on the very first one [12:18] or if we have to wait until the third um [12:20] but there are situations where know you [12:24] have uh somebody was speaking to me [12:27] earlier today about a Dodge Ram pickup [12:30] truck that had [12:32] $60,000 worth [12:34] of subwoofers and speakers that took up [12:37] the entire back of the truck bed with a [12:40] hydraulic lift that makes it stand [12:43] straight up um you know in that [12:47] situation I were able to take the whole [12:49] vehicle and hold it until trial you know [12:52] create a hardship for that person but [12:54] it's also I don't know how you even play [12:57] speakers that large [12:59] in a reasonable manner I don't know if [13:01] it's possible um it's challenging um [13:07] because people have so many different [13:09] Avenues to reproduce this noise if you [13:12] take one set of speakers away and a new [13:15] set just pops up where the old one uh [13:18] was um I know that we have confiscated [13:21] systems in the past and you know there [13:23] is an Avenue for them to retrieve their [13:25] property after you know the case has [13:27] been adjudicated or um the processes [13:31] that they have to go through to to [13:34] re take possession of their [13:37] property um the other thing is when we [13:41] do make arrest on these it's an [13:42] appearance ticket it's not a custodial [13:44] arrest so generally Cooperative people [13:48] we will fill out and and this is a [13:51] appearance ticket that we've been [13:52] working on with um Mr Toro and John pal [13:57] was was a part of the effort where it's [13:59] a streamlined um appearance ticket [14:02] process that kind of everything's on one [14:05] form much like a it allows the officers [14:08] to handle the call more efficiently than [14:11] have to go back and be out of service [14:14] for an extended period time filling out [14:16] you know uh different informations and [14:18] reports and triplicate whereas uh this [14:21] one form can be submitted the only thing [14:24] is that that person never leaves their [14:26] home you know if they do if they're an [14:28] uncooperative person they need to be [14:29] exported to the police car to be given [14:31] their U appearance ticket at the [14:34] issuance of the appearance ticket [14:36] they're released back to their home or [14:38] to wherever they were taken [14:40] from and basically they're free to go [14:44] back right to doing what it was that got [14:46] them in trouble in the first place [14:48] should they choose to do that um so [14:51] there's only so much that we can [14:53] do uh at that point um so it it becomes [14:57] frustrating when you have repeat [14:59] offenders um I did [15:02] some kind of quick uh I got some quick [15:06] data from analysts and year to date [15:09] there's only about 20 arrests for uh [15:13] noise ordinance violations with you know [15:17] some repeat offenders on here um and [15:20] then there's a vast majority of the [15:22] calls that come in that the dispositions [15:26] for those are you know dark and quiet [15:28] gone on arrival [15:29] unfounded and so I think a lot of this [15:32] has to do with the periods of time where [15:35] these calls are most likely to come in [15:36] are also periods of time that are very [15:38] busy for the police department and on [15:40] days where the Staffing levels are not [15:42] the best you know Friday nights Saturday [15:44] nights that type of thing um and a lot [15:48] of situations like today a large portion [15:51] of our staffing is tied up on Odell [15:53] Street uh with you know the barric [15:56] subject that they have but still not [15:58] really resolved at this point so you [16:02] know much to what the mayor was stating [16:06] should a noise ordinance violation come [16:08] in to the call center you know during a [16:11] day like today the ability for us to [16:13] respond there in a time of manner is [16:16] prohibited by all of our resources being [16:18] utilized for things that have been [16:21] determined to be a higher [16:22] priority um [16:24] so this much I'm sure [16:29] every council member gets complaints [16:31] about this and you know between this and [16:33] traffic this is probably what I've get [16:35] the most complaints about to my office [16:37] so if you know if there's any way that [16:38] we can figure out as a group to better [16:42] deal with this issue or you know gain [16:44] compliance more effectively and I'd be [16:47] happy to do it but at this point this is [16:50] kind of what we do and and how it goes [16:52] and and the challenges that we're facing [16:56] and then if you wouldn't also mind just [16:57] speaking about the um joing as First [17:00] Responders that is definitely a [17:02] component of those discussions that [17:04] really catch my eye and kind of speaking [17:06] to the whole points about the cost of [17:09] having a law enforcement officer [17:10] responds to the incident and also just [17:12] speed at which they can respond so if we [17:14] have any information about that so it is [17:18] uh definitely something that we plan to [17:20] utilize once the program is up and [17:22] running we actually started this week [17:24] with uh reassigning a couple of our [17:27] officers temporarily to kind of get the [17:30] ball rolling on this and the U the [17:33] actual responder drones are expected to [17:36] arrive early in the beginning of [17:39] 25 uh or late 24 however we do have [17:43] drones currently that don't have the [17:45] capabilities of these drones but we're [17:47] going to be starting to apply some first [17:49] responder type missions within the next [17:52] few weeks and what [17:55] we will have the ability to do once this [17:58] program up and running provided that [18:00] meets all the legal [18:02] requirements um which I'm sure we'll [18:04] discuss with the law Department before [18:06] taking this action but as I stated if uh [18:10] evidentiary you know something of [18:11] evidentiary value that can kind of [18:15] um meet what we need to file charges [18:19] even if we can't be there in person we [18:21] might be able to get that evidence with [18:23] the drones and have an officer review [18:26] the footage or maybe the Drone pilot [18:27] review the footage then initiate a [18:30] warrant packet for the problem property [18:34] um I'm not sure what additional [18:37] challenges that might face at this point [18:39] as far as being able to determine who's [18:42] responsible for the music you know would [18:43] you be able to do that with the Drone if [18:46] it's [18:47] outside there's a possibility we can get [18:49] the footage of where the music is coming [18:51] from and you know maybe um for repeat [18:55] offenders or chronic offenders we would [18:57] know that this address [18:59] I see the person who's been responsible [19:01] for it before this is the same system [19:03] that's playing music this is the same [19:05] person who's out there uh playing the [19:07] music you know sometimes it'll be very [19:09] cut and dry who's responsible yeah you [19:12] know there may come a time where it [19:14] might be difficult just from the footage [19:16] alone and a little bit further uh [19:19] investigation may need to happen to um [19:22] determine exactly who's at fault and who [19:24] can be f for this and then you get to a [19:27] level of how much effort do we want want [19:28] to put into a [19:31] violation when we have you know the [19:35] priority uh situations that would [19:38] require more manpower I do believe [19:41] though that the Drone as a first [19:42] responder is a tool that we're going to [19:44] be able to utilize to assist with this [19:47] issue and I I think it will be effective [19:51] I just don't want [19:53] to I want to be cautiously optimistic [19:56] about it I I don't want to say that it's [19:57] going to be the Magic Bullet [20:00] that stops all of this um because there will still be challenges and it [20:05] will be you know something that can cure [20:08] it all but I I think it is going to be a [20:11] very effective tool once it's up and run [20:14] thank you any questions or comments [20:16] before turning over to Mr R Mr T so in [20:20] terms of the um arrests um that have [20:23] been made um I was wondering about the [20:26] um the financial penalties um um and to [20:29] what extent those get paid um you know [20:33] or whether you know folks just don't pay [20:36] them and then what happens you know that [20:38] type of thing [20:40] um I would not have much information on [20:46] the follow through with the people [20:49] paying the fines that they've been given [20:52] I can definitely get that I don't know [20:54] if maybe the law department has better [20:56] information on that um um but as as far [21:00] as you know my understanding of the way [21:03] things work is if somebody's given a [21:05] penalty by a judge and they don't follow [21:07] through with that then eventually there [21:09] will be bench warrants or um things that [21:14] would come into place that would make [21:17] them responsible for those things [21:19] because I I think just ignoring it and [21:21] not doing it once something is [21:24] adjudicated it's not yeah that they're [21:27] going to have to follow through one way [21:29] or the [21:29] other so uh we [21:33] typically we try to request a report [21:37] that the fine need paid at the time of [21:40] sentencing so that we don't have to [21:43] chase people for money um unfortunately [21:48] we don't have control uh the judge many [21:51] times give uh people time to pay so uh [21:56] i' have to [21:58] records to see how much we've collected [22:02] in fines um based on what was uh we were [22:06] sentenced to but a lot of people in a [22:10] lot of cases we do get the money the [22:13] same [22:14] day sometimes people are given to and [22:17] that's not as easy for us to [22:19] track thank you and I will say uh based [22:23] on and I'm sure everybody here's aware [22:25] but based on the ordinance uh [22:29] in those situations where we discuss you [22:31] know [22:32] giving even whether it's an arrest or a [22:35] warning and then the music goes on 15 [22:38] minutes later we show back up um if it's [22:42] a half an hour after we've given that [22:44] advisement or made that arrest it counts [22:46] as a new uh incident [22:49] so twice in the same night as long as [22:52] it's a half an hour apart counts as the [22:54] second violation so the fees for that [22:57] would go in line the second and third as [23:01] it as it [23:03] continues any other questions coms you [23:06] mentioned arrest so when the officer [23:08] shows up the resident is there [23:09] physically arrest people are you for to [23:12] pay ticket right so it's it's a it's not [23:15] a custodial arrest so it would be an [23:17] appearance ticket you know there have [23:19] been situations where somebody gets [23:21] escorted to the police car and fell the [23:23] paperwork but uh as far as you know [23:26] putting them in handcuffs and bringing [23:27] them down to the station [23:29] that doesn't Happ for [23:34] this is there a process where the [23:36] individual that files the complaint is [23:38] notified with the action the action [23:41] taken uh so the complaintant being made [23:44] aware so there are um one of the [23:48] questions that the dispatchers usually [23:50] ask is would you like the police to [23:52] contact you there there are times where [23:55] we will arrive unfortunately the music [23:58] or the the source of the loud noise is [23:59] no longer there but you know the person [24:01] who called it in does want to speak with [24:03] an officer so they'll get out of the car [24:05] they'll go in and and speak with the [24:06] complainant and then that person can you [24:09] know in their own words explain directly [24:11] to the officer what the the issue is um [24:14] and there are times where it's late at [24:17] night they're already having a hard time [24:19] sleeping so they don't want to be [24:21] bothered to get out of the bed any more [24:23] than they've already been bothered by [24:24] the noise so they prefer that the issue [24:27] just be dealt with and they don't want [24:28] to have anything more to do with it um [24:31] for those situations [24:34] there I don't we don't make a a call or [24:39] you know a notification that the the [24:41] problem's been solved Mr uh thank you [24:44] very much it sounds like you have a [24:45] handle on everything the department and [24:47] handling it with complete efficiency at [24:49] this point um trying to right um you [24:52] know when we make the phone call which I [24:54] make multiple times a year you know um [24:58] for for in my neighborhood again you [25:02] wait sometimes you know the police [25:03] happen to show up right away and sitting [25:05] on the front porch waiting or just a [25:06] little talk or something but um so at [25:09] least happy to to know that things are [25:11] being addressed as efficiently as they [25:13] are sometimes there's a time constraint [25:16] but thank you very much so thank [25:20] you so in terms of the number of calls [25:23] like say for instance there's a party so [25:25] you know maybe down street calls next [25:26] door Etc do you have um specific say we [25:30] receive this number of calls the same [25:33] regard the same incident in that case we [25:35] then take away their equipment or is or shut down the [25:42] party [25:43] so as far as shutting down parties [25:47] go [25:49] um people are allowed to have parties in [25:52] their private residences you know to an [25:55] extent obviously parties that your ad [25:58] iing and charging for a little bit [26:00] different um the after hours parties [26:03] that have been kind of plaguing our our [26:05] city for some time now um we've had a [26:09] lot of uh religious ceremonies that get [26:12] called in because sometimes they're [26:13] pretty loud especially with certain [26:14] cultures and and wedding [26:17] celebrations [26:19] um in those situations we try to [26:21] discreetly make advisements that we [26:24] understand this is a religious ceremony [26:26] but it is violating the noise ordinance [26:28] we don't want to disrupt what's going on [26:30] here but can you please turn it down and [26:31] more than often than not they they [26:33] comply with those um as far [26:38] as based [26:40] on when there are multiple calls for the [26:44] same problem coming from different [26:46] people it kind of indicates to us that [26:50] it kind of increases the legitimacy we [26:52] understand that you know this this must [26:54] really be bothering a lot of people when [26:57] we're getting multiple calls from [26:58] different people about the same problem [27:01] um but it doesn't necessarily affect the [27:04] way that we respond to it even one call [27:07] as long as we show up and it meets that [27:08] criteria we're going to handle the call [27:11] uh the way that it should hopefully [27:14] it'll be handled the way that it should [27:16] be handled by you know if you show up [27:18] and it's it's very a severe violation of [27:21] the ordinance then their reaction as [27:25] officers are probably going to be more [27:26] severe in that they're more to take away [27:30] the source of the noise on the First [27:33] Response if it's so [27:37] unreasonable that they don't deserve a [27:40] warrant now if if we show up and it's [27:44] somebody who it's borderline [27:47] unreasonable then we're probably not [27:49] going to take their uh the source of the noise away on the first um go around [27:56] so there isn't like uh if we get called [27:59] three times than this or four people [28:01] call than this it only takes one but [28:03] it's for the officers to determine when [28:05] they get there what's the level of [28:07] reasonableness of this you know how [28:09] unreasonable is it is how egregious is [28:12] the call and I think a lot of times if [28:14] it's and a lot of this I'm kind of [28:16] speaking from my own personal experience [28:18] where you know the time that I spent as [28:19] a patrol officer responding to calls [28:22] like [28:23] this personally if I got there and you [28:26] know um I I recall one instance it was [28:29] on Crane and [28:32] Orchard uh I remember I was Midnight's I [28:35] hadn't even received a call for it yet [28:37] but I was driving around the windows [28:38] were down and I could hear very very [28:41] loud music coming from a large apartment [28:42] building that was right across from um [28:45] original pizza and I saw an old elderly [28:48] woman on like the third floor kind of [28:51] looking out her window with her hands [28:52] like this and I could tell that the [28:54] music was coming from above so I was [28:56] like I don't need a call for this that's [28:59] enough for me so I went in there I found [29:01] the source of the [29:02] music gave them an advisement to turn it [29:05] down I got halfway down the stairs I [29:07] could hear the music already again so I [29:09] turned right around before I even left [29:10] the house and I took the power cord to [29:13] their stereo and issued a an appearance [29:17] ticket to the to the Violator so that [29:21] was the way I chose to deal with [29:22] removing the source of the music and it [29:24] seemed to work for that that night um [29:27] but but [29:29] again I feel like the removal of the [29:32] source of the music is based on the [29:35] ordinance it's discretionary and [29:37] sometimes it's difficult when you have [29:40] speakers that are as big as that window [29:42] or you know things that are not [29:44] necessarily you don't have the ability [29:45] to take them and put them in the police [29:47] car um so I don't know if I answered [29:51] your question [29:53] uh there's anything more that you want [29:55] me to elaborate that I didn't no that I just kind of trying to figure out [30:00] what is what the what you what are the [30:02] guidelines like I've called I've had [30:04] five calls from four different people [30:06] and what are we going to do about I mean [30:08] that's that's definitely taken into [30:09] consideration as well as how severely [30:12] they're violating the the and how do you [30:16] measure the sound like you heard that [30:17] you just talked about how you heard it [30:18] from the window isn't there you have [30:21] some actual instrument that measures [30:23] sound that that people can't argue with [30:24] like right you know what to me may not [30:27] be loud to you so it in the ordinance it [30:29] talks about being 50 ft away from where [30:33] the source of the music is so I mean [30:35] we're trained at estimating speed and [30:38] distance and that type of thing so it's pretty safe to say you know when [30:41] you're 50 feet away from something and [30:43] you can hear it but as far as a a [30:45] decibel measuring device we don't have [30:49] that um I know that they exist and same [30:53] you know similar to like a window 10 [30:54] measuring device um and I want to say [31:01] those I mean they they would be [31:03] applicable I just don't know how [31:05] necessary they are because it it's it's [31:07] probably an [31:08] expense that would just kind of confirm [31:11] how loud it is but the fact is as long [31:14] as you're 50 ft from it and you can hear [31:15] it and it's bothering someone you you're [31:18] checking all the boxes you need to check [31:20] right there I I don't even [31:35] know in terms of decb if that's even a [31:37] reasonable thing to say but um common [31:41] sense and and what a reasonable person [31:44] would would deem to be um too loud I [31:48] think it's it's will [31:51] be are there um like civil Avenues if a [31:56] neighbor [31:58] so you their neighbor has been ticketed [32:01] three four times and they've got F can [32:04] that complaint and take the neighbor to [32:07] Cil court on their own is that an option [32:09] I don't know you know kind of putting it [32:11] in their hands that they can do [32:13] something [32:15] themselves [32:16] I'll address [32:20] that some sometime ago Council me the [32:25] pressor pass section 183 [32:29] talking about [32:30] 182 the [32:33] new which U we had just started for the [32:37] first time ever to [32:41] force and uh we had our first hearing we [32:44] closed [32:45] down that [32:48] was all sorts of violation forget [32:51] through the hearing of mayor's [32:53] appointment as the heing officer and 12 [32:57] points in 12 months is considered a [33:00] nuisance this property had about 600 [33:03] points and but three points uh are since [33:09] we're focusing on noise uh violation of [33:13] section [33:14] 182 is three points under Section [33:18] 183 so that when you get in 12 points in [33:22] 12 months you had four violations in a [33:25] year then you would have uh there is a [33:29] civil procedure to take care of this [33:33] which we we're now starting to [33:35] enforce [33:37] [Music] [33:42] which but uh so we're starting to [33:45] enforce that it hadn't been enforced by [33:47] prior Corporation Council until vaccine [33:49] came in and U so kind of wearing two [33:54] hats [33:56] here we are now starting to uh enforce [33:59] that if you were looking for amendments [34:04] to certain parts of the city code maybe [34:08] you want to increase the point value [34:11] from 3 to four or something like that in [34:14] section 183 and then there be three you [34:17] know increase it there'll be three calls [34:19] in a year and then we can take the that [34:24] se so calls one yeah well [34:29] that's we sort of ties in with what the [34:32] chief was saying [34:35] that you know if you go away for a half [34:37] hour and you have to come back have to [34:39] back that's another incident you already [34:40] have six points yeah in one night and [34:44] that might uh have a chilling effect on [34:49] the people who turn it up when they [34:51] leave and if I can add one more one more [34:54] thing though I think is good for the [34:58] drones you know going back [35:02] to court there might be some due process [35:05] arguments about the drones and and [35:08] individual liability but certainly from the air you can tell whether the [35:13] property problem and that's what the new [35:16] it's about the property the property [35:18] continues to be a problem and so the [35:21] drones I think would also be a good tool [35:24] in terms of enforcing resour [35:28] um so if I can add I think the mayor was [35:31] like is there a magic ball or an answer [35:34] and I think trying to hedge our bets if [35:36] we look at this as a three-prong [35:37] approach I think you have the city code [35:41] and I speaking on the news I think I [35:43] misspoke and said it hasn't been [35:44] adjusted or amended in three decades is [35:47] not the case it's almost two decades but [35:49] still that's a long amount of time and [35:51] if we look at what has changed since 20 [35:55] 2006 a lot has think we evaluate how to [35:59] adjust our enforcement to incorporate [36:00] other Technologies and making sure the [36:02] legalities of how they're uh [36:05] adjudicating these types of cases I [36:07] think that improves the conditions for a [36:09] lot of our residents who in some [36:10] instances feel like they are uh helpless [36:14] where it is a beautiful day out my [36:16] windows are open and now I have to [36:18] inconvenience myself further to have a [36:21] slightly better day and and the [36:23] frustration is what do I do and I'm glad [36:26] Mr Terell highlighted that it is not at [36:29] the lack of consideration from the [36:30] police department it truly is not and on [36:32] my uh um right alongs I've seen the [36:36] calls come in and although you want to [36:38] respond to all them you physically [36:39] cannot uh so unfortunately I think it [36:42] has to be an understanding from the [36:43] community of you can only be in bu many [36:45] places at once but I think if the [36:47] perception from our residents is if I [36:49] call nothing happens because it keeps [36:51] happening day in and day out and if also [36:53] the perception is from these violators I [36:55] use that lightly because if some people [36:57] aren aware of the code and they just [36:58] think it's a free-for all I can put [37:00] $60,000 worth of equipment in my car I [37:03] think starting somewhere is important [37:07] um but I wanted to give Mr an [37:09] opportunity yes going back to the point [37:12] system I can recall that we did actually [37:15] amend that to kind of Target the [37:18] convenience stores in terms of the point [37:20] systems so you're mentioning point [37:22] system I think if I can recall a couple [37:25] years we had um Institute that that just [37:28] because of the the very problem we [37:31] having with these convenience stores and [37:32] how do we address it over a period of [37:34] time suggestion to us and basally [37:38] recommendation to ex the F system so I [37:42] not the F [37:43] system that was passed couple years ago [37:46] can carry over way into residential we [37:48] may want to amend that to include um yes [37:54] the right cross section of U the [37:56] violation who needed convenience stores [37:59] or any Del or sort of things like that we did at that point system [38:03] actually that is true it was never we [38:06] never get a chance to kind of enforce it [38:09] there were so many excuses oh didn't get [38:12] approved okay it was approved but never [38:15] got enforced right from the Law [38:17] Department commissioner is correct about [38:19] that [38:23] [Music] [38:28] the the [38:32] uh a private residence could [38:37] be when we would have we would have to [38:40] pull that resolution it was primarily [38:42] targeted towards the convenient delis to [38:46] kind of bring them in compliance so [38:47] whenever they come back apply for the [38:51] renewal the mayor Police Department [38:54] everybody will sit there and says okay [38:55] you had X violation [38:58] and if they if they was actually [38:59] enforcing it and if they met that [39:04] 12.65 automatically be closed within [39:07] that given year but unfortunately we [39:11] never have the [39:12] enforcement [39:14] glad [39:16] be we're doing [39:18] it and [39:20] if if it is limited to convenience [39:24] sources and sure you could change it to [39:28] noise coming from anywhere right so when [39:31] we that we did talk about the the point [39:34] syst but the commission is correct there [39:36] is in the nuisance part of the code [39:38] nuisance you can VI people with [39:41] individual residents can get violation [39:43] based on the nuisance um we um code but [39:47] we were targeting the convenience stores [39:49] and we trying to focus on that because [39:51] then we did have so many problems but [39:53] that part the um C is already there for [39:55] individual so maybe need to tighten up [39:58] to you know improve it um you know amend [40:01] whatever way necessary [40:04] yes I I do like that idea in in the next [40:08] 183 of bringing it from four to you know [40:11] different point levels for residents um [40:14] and somewhere in here and and of course [40:16] I forgot my glasses today so the [40:18] landlords are [40:23] responsible the it's somewhere in here [40:26] it's the landlords yeah so it it gives [40:28] the exception of [40:30] a somebody who's leasing the property [40:33] from the landlord so they the landlord [40:35] can't be held responsible [40:38] for really no they can be I think so I [40:42] thought identified that P it's p [40:48] P2 section three and it is category [40:52] section no [40:54] 1824 and it's within that initial [40:56] paragraph says for the purposes of this [40:58] chapter it shall be presumed that the [41:00] owner tenant person or persons in [41:02] possession or control and the occupant [41:05] of the particular premises or jointly or [41:08] severely sever a weird word so I think it it [41:14] identifies that whether you're directly [41:15] or indirectly you're responsible for [41:18] that reproduction of noise to some [41:20] extent and then my question was going to [41:22] be [41:23] follow was you mentioned earlier AC no [41:27] about people having video evidence that [41:30] they taking themselves and one [41:31] cautioning is people kind of going out [41:33] getting 4K cameras and getting their [41:35] ghilly suits like going to extreme but [41:39] also I want to make sure we're [41:40] documenting what is necessary to proceed [41:43] forward is that sufficient enough to [41:45] meet that threshold and you know there [41:49] can be issues where how do we prove that [41:54] this video is taken on this date at this [41:56] time at this location [41:58] um which I'm sure there are ways but [42:02] that maybe the Law Department might [42:06] want most most of these don't go to [42:10] trial most people [42:12] ple or a [42:15] hearing date following that so it's we [42:19] prepare Discovery um if we need to which [42:23] would [42:24] be pictures or videos If we have [42:28] um but most of the time like I said we [42:30] don't wind up getting to the point of [42:32] having to go trial to prove it people [42:34] generally take a lower fine to settle it [42:39] rather than risk going to a [42:41] trial and risking getting the mag and I [42:45] think that's where I want to kind of [42:47] focus on uh because I'd like for us to [42:50] have these fines strictly adhere to to [42:53] change the culture and narrative that [42:55] this is something that we are focusing in on it especially if uh by [43:00] the time we do address it it comes at [43:02] extreme cost in time and [43:06] responses so my question is around the [43:08] fine and as asash is saying that when [43:12] they go to court the judge has sort of [43:15] some leg in what they can do they can we [43:17] do so fine so is there a way that we [43:20] that that hard and fast or do they [43:22] always have the ability to um negotiate [43:26] what a person can pay because um what [43:29] happen sometimes people like I can [43:30] afford that and I'm willing to pay that [43:33] as opposed to I'll give you an example [43:35] that happened there was somebody putting [43:36] out their trash ear and so I roll down [43:39] like you know it's too early to put out [43:40] your trash like oh it's only $50 off [43:43] like I can afford that in no big deal [43:46] and so I was like really I was going up [43:48] to [43:49] 200 so um and I did hear that and so um [43:55] you know I think in matters how impacts [43:58] and financially off so once once it gets [44:01] in front of a judge we absolutely have [44:04] no control over it the judge then can [44:06] say you know this can go from 12 from a [44:09] th000 they can bring it down to [44:11] $100 I mean the judge certainly has full [44:14] control to do that but we generally go [44:16] in and make an offer the judges [44:19] typically follow what we agree to with [44:23] the defendant so we'll uh conference [44:28] with the defendant or we'll make the [44:30] offer in open court um but so the [44:33] maximum fine for the first defense is [44:37] $250 um so in order [44:42] to [44:44] uh increase the likelihood that someone [44:47] is going to settle typically we offer [44:50] $150 time sometimes a high as 200 if [44:54] there's something egregious about it if [44:57] we were [44:59] to uh go hard and fast with the maximum [45:02] buy then there's not necessarily a [45:04] reason for people to settle and so then [45:06] we have the added resources of the city [45:09] having to prosecute cases through [45:11] trial um not knowing whether the extra [45:15] $50 or $100 is really going to make a [45:17] difference in how it hits someone's [45:19] wallet so if if you want the fine for example the first violation to be [45:24] hard and fast at $250 [45:27] then my recommendation would be to raise [45:29] the fines generally so that we could [45:32] offer $250 as a way to settle it rather [45:37] than again there's a lot of resources [45:39] that go into trying a [45:41] case um and becomes is it worth it to [45:45] the city uh to do that of course in some [45:49] cases we have to but to do that on every [45:51] single one because we want the maximum f [45:54] um the only way to alleviate that raise [45:57] the fine you want to collect $250 or we [46:02] can offer $200 that's just $50 less but [46:05] again the further away you go from the [46:08] maximum fine the less likely someone's [46:11] going to be to leave and to just agree [46:14] to pay the fine rather than goes through [46:15] the trial process where they may be [46:17] found not [46:18] guilty Patrick well that's why I mean um [46:21] I I when you suggested the 500 the th000 [46:24] and the and the 2,000 I I I just felt [46:27] like in in looking at this I felt like [46:30] okay these were probably set so that [46:32] there'd be more affordability for people [46:34] to be able to pay the fine um so I here [46:39] you know obviously you know that's that [46:42] might be a stronger deterrent but I just [46:43] wonder if it would at those levels mean [46:47] that more and more people wouldn't pay [46:49] the fine um and then we have to go [46:51] through all the rest of the processes um [46:54] I I I you know but I I hear why you're [46:57] saying uh increase some I get that but [47:01] um I just was worried that it would [47:02] increase the workload on the other end [47:04] of trying to pursue someone that may not [47:07] be able to afford 500 or ,000 or $2,000 [47:11] but my response is why are we being [47:13] convenient to violators and my hope is [47:16] as you enforce this you do not live in a [47:19] big city or it is big in some respects [47:21] but it truly is not and I am under the [47:23] perception of once it is starting to [47:26] circulate through neighborhoods that the [47:28] city of skty is pursuing the maximum [47:31] penalties for these types of offenses I [47:34] have to believe that individuals who are [47:36] violating are going to take a second [47:39] pause um or understand the severity of [47:42] how we are evaluating these types of [47:44] complaints moving forward because my [47:46] caution is to what extent do we expect [47:48] our residents to continue to be [47:50] complicit and have we already lost [47:52] residents from our city as we continue [47:53] to revitalize our neighborhoods [47:56] Revitalize downtown if we don't have the [47:58] people here it's for not so I think that [48:01] is more of a worry for me who is turning [48:04] away from SCCY because of our inability [48:06] to correct this not because we don't [48:08] have the intent but just because we lack [48:10] the execution and implementing this so I [48:12] think we have to pick a [48:15] [Music] [48:17] path so for me when I look at the finds [48:20] I don't see it as a way so they have the [48:22] ability to pay to me I'm looking as a [48:24] deter it's like don't make the noise [48:29] and I wonder if when when leis offic go [48:32] out they even have that discussion with [48:34] people about that they even know Their [48:36] fines exist for them you know if you [48:39] continue to do this it's going to cost [48:40] you we could find the city could find [48:42] you finally $250 Etc are people aware [48:46] because sometimes awareness makes a [48:48] difference as well if they know [48:49] eventually if this continues it's going [48:52] to cost them money there are definitely [48:55] circumstances where those conversations [48:57] are had uh there are also circumstances [49:00] where the conversations don't ever occur [49:02] because the person's just looking at us [49:04] through a door that they refuse to open [49:06] um [49:09] so I [49:11] think um in a perfect world where we [49:13] would be able to take somebody and and [49:16] have a you know a conversation with them [49:18] and explain to them you know why we're [49:22] there the the problem with what's going [49:25] on how to resolve it and what the [49:27] penalties are and somebody being open [49:29] and receptive to that conversation I [49:32] think you know that would be great and I [49:35] think you probably have more success but [49:38] unfortunately all of our interactions [49:40] don't end up going that way um some [49:43] people are very combative and [49:45] confrontational or under the influence [49:47] of substances and not really in a [49:50] position to really comprehend what what [49:53] we're explaining to them but it it is is [49:57] uh something that I will bring to my the [50:02] patrol unit and explain that you know [50:06] try your best to be very transparent [50:10] about what [50:12] the um penalties are for being found [50:15] guilty of this especially for multiple [50:17] offenses or repeat offenses and um you [50:21] know I know that that is happening but [50:24] I'll try to put more emphasis on [50:27] um trying to do that as as much as [50:31] possible I mean it's conceivable that we [50:34] could just actually create just little [50:36] small documental warning Sy say like [50:39] here and for people when they no long [50:42] need can just read through it and uh [50:44] just so they have something that the [50:46] documents that we were here and this is [50:48] a concern and here's the um the possible [50:51] outcom Contin we have done that for [50:55] other things like informational handouts [50:57] for you know this is what happens if [50:59] you're the victim of a crime this is [51:01] what happens when you know a detective [51:03] is assigned to your case so you know [51:05] that might be beneficial to to give a [51:11] shot yeah I'm just going back to was [51:14] mentioned moments ago in terms of video [51:16] evidence it's a good thing but I don't [51:18] think um we should encourage it to get [51:20] people out there to go to video someone [51:22] because it might put people danger but [51:25] um can we do an affid statement and have [51:28] them sub that in terms of video evidence [51:32] and you just mentioned it can it can be [51:33] dangerous because a person is [51:34] intoxicated and you're going to video [51:36] them so that you can get evidence for [51:38] your case here you are on a premises and [51:42] you know XYZ can happen in those [51:45] situations that person would probably [51:47] have to testify or have their name on [51:51] the documentation so so I think that [51:54] something we should encourage that for [51:56] to give them an opportunity to say yes [51:58] if you are there and you are the witness [52:00] of it there's an opportunity for you to [52:01] submit an [52:02] affid to justify telling the police [52:07] department um just um looking at this [52:11] here and talking on the side of the [52:12] commissioner I think we need to look at [52:14] 182 and 183 chapter 183 because it's [52:17] very important to look at 183 also [52:19] because that's only the abatement is [52:21] because there are certain things that we [52:22] passed here a couple of years ago in [52:24] terms of points that is relevant over to [52:27] 183 that we need to address also because [52:30] past revising 182 it would make any [52:33] sense if we do not revise 183 so we need [52:36] to broaden our schol at this point in [52:39] time yeah I think actually um and we [52:41] kind of touched on this at our at a [52:43] previous meeting but even when we talk [52:45] about the vehicle piece which I hope we [52:48] will um that also will probably impact a [52:51] different different ordinance as well in [52:53] terms of traffic right I think sure um [52:57] so that that would be there as well and [53:00] there is I mean I guess I thought that [53:02] 1827 was the how a citizen um makes a [53:06] formal complaint Mr mudaron but I was [53:10] wondering a question that I had was just [53:13] um to the extent to which people might [53:17] fear uh putting their name to something [53:20] the retaliation I mean I know I have [53:21] felt that myself even when I've called [53:23] to make noise complaints and you know I [53:25] get what your name and it's kind of like [53:27] oh you know obviously I give them my [53:29] name and my my address and such but [53:31] there's always that you know I always [53:33] say is the person going to know uh who [53:36] it was and I I think that's why we take [53:38] every effort to be the witness of the [53:42] violation so that the initial caller is [53:46] not even part of the proceedings it's [53:50] the officer who personally observed the [53:53] violation and um [53:56] based it off of their [53:59] college um going back to the finds I [54:03] mean at this point I'm okay with with [54:05] what's in there um you know again you're [54:08] in your yard maybe having a a birthday [54:11] party and you got neighbors who don't [54:13] want to hear here it's tolerable to you [54:15] so you know all of a sudden please show [54:18] up at my door and be like you know turn [54:20] it down [54:25] there's [54:55] e e [56:29] about [56:30] 2 that's good to [56:32] know what we're identifying that what [56:35] we're identifying in here and I think [56:36] it's different if we have a community [56:39] that's hesitant to put their name on [56:41] these documents so you're not having [56:42] them attach their name which is a huge [56:45] component if the police department is [56:47] unable to respond to every instant which [56:49] we know they're not that's why I think [56:51] it is crucial for the incidences that [56:53] they do respond to for us to have a [56:55] stronger approach and I pushed back and [56:58] I out of fear of how think is going to [57:02] respond to us if we remain uh slow or [57:06] cautious to do anything different I just [57:08] had an email and in one regard the [57:11] resident says hey this is an issue I'm [57:13] glad you're talking about it then the [57:15] later half of the email he goes I don't [57:16] even think you guys are going to really [57:17] do anything and that is the expectation [57:19] that I hear day in and day out it's why [57:21] even bother I'm just going to suck this [57:23] up and get through it and I I again I I [57:27] don't think we're talking about the [57:30] cocktail parties where you're [57:31] celebrating a a birthday I think I'm [57:35] talking I I know I'm talking about the [57:37] Earth [57:38] shattering window pounding vibrations [57:42] and I think that is something that [57:43] people can tell the difference on and if [57:45] you're groping in those same arguments I wholeheartedly hope that the other [57:50] members in our committee Public Safety [57:52] Committee will at least will at least [57:55] allow the public weigh in during public [57:57] comment we choose to do something [57:59] differently but I I urge the community [58:01] to come out and give us your experiences [58:04] give us your stories because that's [58:05] what's going to be needed to ensure that [58:07] what we're doing is with the right [58:08] intent but I think staying the course [58:11] that sends a poor message to the [58:12] community and we have to do something [58:14] different and the reason why I'm uh [58:17] advocating for something as strong as [58:19] this because without that without the [58:21] drones without the law enforcement [58:24] officers there's a there's a hug huge [58:26] gap all Mr yes going back and as I had [58:31] it marked last time we met to modify the [58:33] section 1827 because there are many [58:36] people there who will let who doesn't [58:38] have a problem put their name on after [58:41] so I would like to see that we put that [58:43] in there and give them an opportunity [58:45] whoever so desire there's an opportunity [58:47] for you to make a statement and swore to [58:49] it that yes you Witnesses and if the [58:52] case was to go to trial they will show [58:54] off and testify on that [58:57] we can't just leave it blank and then [58:58] we're not giving them opportunity [59:00] because video evidence is one not a lot [59:02] of people will do that and I don't [59:03] encourage that safety reason but adding [59:07] that into this section will help and yes [59:09] you talk about um the shattering glasses [59:13] this is why we need to look at the [59:15] modified speaker because if we can [59:17] address the modified speaker with a [59:19] hydraulic lift putting this speak on top [59:21] of these SUVs on the car and what we're [59:24] doing here it just was time so that's [59:27] why I would like to refer to Law [59:31] Department how can we put something in [59:33] place to to Target these modified [59:36] speakers that they have these all [59:38] hydraulic system in they car do we need [59:41] to come up with something from the Law [59:44] Department to kind of revise the city [59:45] Charter to address that specifically [59:48] because we have seen over the several [59:51] months into the summer here a lot of [59:53] those activities where they call it them [59:55] car [59:58] meet and their loud explosion with music [1:00:01] and you know it's affecting the [1:00:03] neighborhood that's the thing we need to [1:00:05] address and at the same time this is [1:00:06] going to be addressing these are these [1:00:08] are residential but then we look at the [1:00:10] car and driving down the street and [1:00:12] shattering everybody's glass are shaking [1:00:15] how [1:00:16] be lot yeah I definitely I I really want [1:00:20] to talk about the vehicles and I have to [1:00:22] just say coincidentally I was on my walk [1:00:24] this morning headed back towards my [1:00:26] house and there was a vehicle and I you [1:00:29] know had just finished you know going [1:00:30] through all of this and there was a [1:00:32] vehicle parked on you know I think I was [1:00:34] on Keys uh on the side of the road [1:00:37] glaring music out the out the window um [1:00:41] just sitting in front of this house um [1:00:43] and they just kept pumping it up higher [1:00:45] and higher and higher um and I I [1:00:47] actually the the person I walked with [1:00:49] said don't like I because I literally [1:00:51] wanted to go over and say Hey you know [1:00:54] you you really and and you know my my [1:00:56] walking partner said don't don't you [1:00:57] dare go over there um uh in in case you [1:01:01] know something happened but I think the [1:01:03] car thing is really um important and [1:01:05] Miss Porterfield brought up at our last [1:01:07] meeting about the [1:01:09] Mufflers um and the fact that people are [1:01:11] um you know modifying Mufflers which is [1:01:14] um in 1824 section B um and I wanted to [1:01:19] bring up that you [1:01:21] know I think also we might consider a [1:01:24] penalty on you installers I mean I don't [1:01:27] know if people are just installing them [1:01:28] themselves or if there's actually places [1:01:30] that we could um you know think that are [1:01:33] this is this is happening at different [1:01:36] Service construction people start work at 6:00 [1:06:11] in the morning what they do so you know [1:06:14] how do we even address that because that [1:06:17] gets them from 6:00 to 3: [1:06:20] they [1:06:22] I I also circled that but I think think [1:06:26] that you know I mean people especially [1:06:29] like when you think about the summer [1:06:30] time um I think that folks are trying to [1:06:32] get their work done um in terms of the [1:06:35] early morning hours where it's less [1:06:37] humid that kind of thing so I [1:06:40] think I think that one's a tough one and [1:06:43] people might just have to deal with um [1:06:45] the construction noise but my response [1:06:48] would be if you're dealing with it as [1:06:49] you're driving to work if you're dealing [1:06:51] with it as you're trying to go to sleep [1:06:52] at night and if you're dealing with it [1:06:54] because the roads are getting PID [1:06:55] repaved again to to to what Avail so I [1:06:58] think it's just a lot um I I know we [1:07:01] weren't meant to kind of solve anything [1:07:03] is more have a pre-c [1:07:05] conversation community meeting which I I [1:07:07] very much want to just identify I [1:07:09] appreciate everyone coming out and being [1:07:11] present for this discussion I also want [1:07:13] to make sure we we capture the fact that [1:07:16] Miss BR I want to make sure I we heard [1:07:18] trial for every offense is not realistic [1:07:43] especially if the fine ultimately is [1:07:48] $250 yes I mean we it it doesn't really [1:07:52] make sense to take every to trial [1:07:57] um but if that's what the council wants [1:08:01] we can do that I mean if we're here to [1:08:04] do what you know we Implement what you [1:08:07] legislate so if if the council wants to [1:08:10] take everyone to trial we can but [1:08:12] unfortunately that's going to stress the [1:08:15] resources of the Law Department if we [1:08:17] had unlimited resources that might be [1:08:20] different but that's just not the [1:08:21] reality of it we're a small But Mighty [1:08:24] team um um but and and the thing is that [1:08:28] taking everything to trial [1:08:30] like if you if you take it to trial you [1:08:33] have to prove the case and we may not [1:08:37] always be able to because of certain [1:08:40] circumstances and then we can do all [1:08:42] that work and then we get zero so when [1:08:45] we take please it kind of works for both [1:08:49] sides because it's a deterrent to the [1:08:53] offender because they've had to pay pay [1:08:55] a fine and at the same time the Law [1:08:59] Department doesn't have to put in all of [1:09:02] the effort and resources to take it [1:09:04] other way to trial but again if if the [1:09:07] council were to decide that we would [1:09:09] certainly take everyone to trial um my [1:09:12] recommendation instead would be if you [1:09:14] want $250 to be the standard that we [1:09:17] request of the port or that we agreed to [1:09:21] as a plea then raise the maximum fine so [1:09:25] that we're [1:09:26] giving them a quotequote break in order [1:09:28] to plea barain and that's why people [1:09:30] plea because they're taking a lesser um [1:09:34] penalty in exchange for them also not [1:09:38] having the risk of going to court and [1:09:39] losing and having to pay the maximum [1:09:41] fine it's all a negotiation when you go [1:09:43] to court and before I opening up to [1:09:46] questions again I just want to make [1:09:47] clear my intent is not for the the Law [1:09:49] Department to take everyone to trial I [1:09:51] don't think we are truly going to have [1:09:53] everyone documenting or submitting these [1:09:55] complaints uh because in some regards [1:09:58] that is a luxury that others have than [1:10:00] not where I think if you're working two [1:10:02] jobs or if you're riding bus and you [1:10:03] don't have a computer I think you're [1:10:05] limited in how you can submit a [1:10:06] complaint um but what I will say is I [1:10:09] think if we are at least responding to [1:10:11] the egregious offenders I think yes we [1:10:13] need to have a strong expectation to to [1:10:17] see those through with no considerations [1:10:20] for fleas because again I think that [1:10:21] sets an undue presence where said it's a [1:10:24] Miss porterfield's point [1:10:26] what is [1:10:27] $50 and if you know you're having this [1:10:29] party and you want to enjoy yourself [1:10:30] what's $200 to have a good [1:10:33] time [1:10:34] Mr let let me go back to the m during [1:10:38] our and the speaker and there [1:10:49] is no legislation directly to kind of to [1:10:52] modify speaker but to exhaust is a state [1:10:55] La so what the police can only do is to [1:10:57] enforce it and by enforcing they will um [1:11:02] get a portion of that Revenue so I think [1:11:04] that's what they going to be touching on [1:11:05] Monday because we can as a local body [1:11:08] Institute that it's a state l so they [1:11:10] will try to see how they can put [1:11:12] resource to enforce that like how they [1:11:15] do the DWI check and you know all these [1:11:17] different um seat Bel stuff uh to get [1:11:21] that going so I don't know how we can [1:11:23] address that on the local level but more [1:11:26] PD enforcement and whenever they have [1:11:29] the resources to the in terms of the fee [1:11:32] I just want to to talk [1:11:35] and um the garbage violation on the [1:11:39] garbage garbage violation I mean yes we [1:11:41] have seen a lot of violation there but [1:11:44] then if you've go into the neighborhood [1:11:46] two months ago and you were to go back [1:11:48] today you will see drastic difference [1:11:51] the garbage can is not on the front [1:11:52] porch and garbage can is not on the [1:11:54] front site walk they're all the way at [1:11:56] the back of the house why because [1:11:58] somebody received a violation that you [1:12:00] were not putting your garbage was [1:12:02] improperly stored so it's more of an [1:12:04] enforcement to tell you that you are in [1:12:06] violation of your garbage take it to the [1:12:09] back of the house so I think for the [1:12:11] approach here I don't have an issue [1:12:13] either up or down with the fees but it's [1:12:15] more of a enforcement and a stronger [1:12:17] enforcement of the [1:12:20] no and agree with uh the Law Department [1:12:24] we have to also look at the result [1:12:25] Source we cannot tie up all the [1:12:27] department with a lot of um all these [1:12:29] evidence and all sort of things to [1:12:30] present the course so we give them an [1:12:32] opportunity to so okay let's ble a case [1:12:34] there is an opportunity for you to B [1:12:36] guilty and pay fine and move on and at [1:12:39] the same time also um we talked the last [1:12:41] time about Pro because there are a lot [1:12:44] of things that people are doing events [1:12:45] special events and things of that for [1:12:47] the you know the young kids we should [1:12:50] work on a Institute a permit and that [1:12:53] permit will carry a lot of information [1:12:56] about the host so the PD instead of [1:12:58] going down there they can from the pring [1:13:01] they can call the hes and ask them to [1:13:04] you know receive complaint you should [1:13:06] turn your music down and you know if [1:13:08] your perit expired you should take it [1:13:11] off so I think um that is something that [1:13:13] we should look at [1:13:15] into [1:13:17] and we talk about um Fireworks yes we we [1:13:23] need to look at that also it's not [1:13:24] because [1:13:25] that is that is a noise usess also how [1:13:28] do we do that this go back to the affid [1:13:31] if the person can sign that affid I say [1:13:33] yes my neighbor John light off you know [1:13:36] a whole bunch of fireworks you know so [1:13:39] be it show up the court and testify and [1:13:42] those we have to think actually the mayor started [1:15:20] our meeting by talking about the [1:15:21] priorities and and our chief um brought [1:15:25] it up as well because these are not [1:15:27] going to be their High priorities so we [1:15:29] either have to increase the Staffing um [1:15:31] so that they can you know be able to uh [1:15:34] allocate their their human resources in [1:15:37] a way to help us enforce these things um [1:15:40] because I think the enforcement is key [1:15:43] um whether it's speeding uh the red [1:15:45] lights I mean we had some when we first [1:15:47] started these discussions about the [1:15:48] traffic stuff um you know basically or [1:15:52] if we you know on my ride along I mean [1:15:54] you know they're like you know we can't [1:15:56] necessarily go [1:15:57] to after somebody that's going through a [1:15:59] red light if we're going to get a call [1:16:01] that you know something more serious is [1:16:03] happening so how do we hand you know I [1:16:06] think we have to I just want to bring [1:16:08] that up that when we start our budget [1:16:09] discussions I think this is going to be [1:16:11] something that's we need to think about [1:16:15] so um first of all I think we should [1:16:16] increase the fees based on especially [1:16:19] Bas on what our Corporation Council is [1:16:20] saying because that gives them room to [1:16:22] negotiate so raise it up a little bit [1:16:25] and they can come to what we would [1:16:27] really like to get so I think that's U [1:16:29] part of it in terms of enforcement I [1:16:31] agree however I'm not sure if we [1:16:33] increase our staff if it's still going [1:16:35] to get them to this place because still [1:16:38] because it's sometimes it's [1:16:40] da that you call [1:18:09] u Miss Porterfield Zero Tolerance I mean [1:18:12] it needs to get out there it won't be [1:18:13] tolerated even though we're not going to [1:18:15] be able to enforce it right now the way [1:18:50] you're out of there they sign it and [1:18:52] you're gone so that will allow them to [1:18:54] when they're driving down the street [1:18:55] there's a muffler in front of them and [1:18:57] they want to ticket it they don't want [1:18:58] to pull them over right now you know why [1:19:00] cuz they're on the way to another call [1:19:01] you don't know what's in qu waiting to [1:19:03] for them to to respond to so um all [1:19:07] those things but again Zero Tolerance we [1:19:09] can't we I I mean my neighborhood is [1:19:12] just [1:19:14] insane insane it's definitely [1:21:55] M we can say we can change after 13 182 [1:21:58] and 183 and said let it go there and we [1:22:01] expect the PD to enforce it we we're [1:22:04] being unfair to any Department if we [1:22:06] were to do that so we have to factor in [1:22:09] that because this what we're doing here [1:22:11] is good for our community but at the [1:22:12] same time we need to give the department [1:22:16] the resource to enforce it and let me [1:22:19] just go back a little bit and talk about [1:22:21] Nuance Department back in time it only [1:22:23] one m one person right we have four now [1:22:27] and it's the reason why we're seeing [1:22:30] that our neighborhood are being clean it [1:22:32] is because the resource at their [1:22:34] disposal they're fully staed and they're [1:22:36] going out there every single day and [1:22:38] they're enforcing the violation and it's [1:22:40] ticket and we're seeing our neighborhood [1:22:42] are cleaning day by day we're seeing [1:22:45] cleaning so the same thing going to be [1:22:46] happening here we're going to have to [1:22:48] make sure that we revise this to the [1:22:49] best we can to make sure that our [1:22:51] neighborhood are be addressed the [1:22:54] concern but at the same time address [1:22:57] resource resource to make sure that is put in place and they don't have to [1:23:02] wait 3 days we're going to have the [1:23:04] drones and we have somebody man the [1:23:05] Drone we have somebody right there to [1:23:07] take care of that to go over there res [1:23:09] You by appearance ticket a person show [1:23:11] up the court and then you know it takes [1:23:14] a course from there [1:23:16] on so just to piggyback on that I do [1:23:18] think that um I totally agree and I [1:23:21] think that there first of all we need to [1:23:24] having them at the table and I know he [1:23:26] you know he had to leave so but I mean [1:23:28] as we move forward obviously they'd [1:23:30] still be involved in these discussions [1:23:32] but because I've always thought maybe [1:23:34] there's a way to you know inist the help [1:23:36] of retirees from the I mean in other [1:23:38] words there might be Creative Solutions [1:23:41] uh to some of the staffing issues but [1:23:43] that's you know we need them to be uh [1:23:46] voicing their opinions on that I just [1:23:48] wanted to reiterate that I think whether [1:23:50] it's this issue whether it's the traffic [1:23:52] issue whether it's the trash issue the [1:23:55] education and the behavioral change is [1:23:57] key so I think we are going to have to [1:23:59] uh think about that and think about how [1:24:01] do we advertise it how do we Market it [1:24:03] you know what are the resources that [1:24:04] we're going to need to do to do that um [1:24:07] and then I also just want to say before [1:24:09] I mean two things before we before we [1:24:11] leave or just so when we continue our [1:24:13] discussion we do need to talk about [1:24:15] animals um and we do need to talk about [1:24:17] the parks um animals and what the noise [1:24:21] that there might be dogs that are left [1:24:23] outside you know eight hours or [1:24:25] something and they're barking like crazy [1:24:27] it's it's in here but I'm just saying [1:24:29] it's something that we didn't talk about [1:24:30] here and I do want us to do [1:24:51] again it's it's a resource thing but we [1:24:53] might want to have sign in our parks [1:24:55] where the um non-emergency number um is visible on on signage in terms of you [1:25:01] know [1:25:54] noise um adjusting the fines and then [1:25:56] focusing on the permits I think that [1:25:58] takes into account that our enforcement [1:26:00] is our enforcement so I don't foresee or forecast any significant changes to [1:26:06] the police department's Staffing levels [1:26:08] um I think enforcement is affected in a [1:26:11] positive way with the introduction of [1:26:12] drones which according to ACN no's [1:26:15] accounts are potentially end of this [1:26:17] year hopefully the beginning of next [1:26:20] year so again we're asking the community [1:26:22] to be patient which they've been doing [1:26:25] for a number of years so that is why [1:26:27] increasing the fines um I think gives M [1:26:30] rash's Department the ability to when we [1:26:33] respond to the few instances that we can [1:26:36] that it has more of a substantial impact [1:26:38] to the thing that everyone cares most [1:26:40] about which is your your wallet but also [1:26:43] it has a reverting impact on the [1:26:45] community that they are no longer [1:26:47] accepting fleas uh because the instances [1:26:49] that we do respond to are such a small [1:26:52] uh uh composite of all of the issues to [1:26:54] our city we need that to have a [1:26:56] magnified um impact so I think if we [1:26:59] were responding to a few instances those [1:27:02] instances that we're responding to need [1:27:04] to have weight and impact if that makes [1:27:06] sense so so I guess I think basically [1:27:09] what's mone's meeting that look like in [1:27:11] terms of you know what what we leave [1:27:14] from this you'll be bringing from this [1:27:16] meeting with the committee to the [1:27:18] meeting on Monday that's the question so [1:27:22] I would say listening with the [1:27:24] collective I know this is not a full [1:27:25] representation of our Collective Council [1:27:28] it seems as if we're saying we need to [1:27:30] increase um awareness which I agree on [1:27:33] um however we need to allow the uh [1:27:37] ticketing process as it currently exists [1:27:39] to continue on and I'm trying to be [1:27:42] positive but it it sounds like we need [1:27:45] to increase enforcement which we can but [1:27:48] we need to make sure the community is [1:27:49] aware that there's a ticketing um which [1:27:52] to some degree I don't think is going to [1:27:53] have impact on your ability to like [1:27:56] adhere to being a good Samaran or [1:27:58] not so well I thought we would [1:28:02] increasing the fin one discussion I [1:28:05] would say from the individuals in the [1:28:06] committee it seems as though they're [1:28:07] very they won't get out of [1:28:10] comme so no I'm just going to Monday's [1:28:13] meeting so what what is the purpose of [1:28:15] Monday's meeting because we still we're [1:28:17] still discussing here with gathering [1:28:19] information and then present so what are [1:28:21] we going to discuss Monday should we now [1:28:23] wait hold on another special meeting um [1:28:26] special public safety meeting try to get [1:28:29] some draft information in and present to [1:28:30] the entire Council Monday so what I [1:28:33] would ask is for everyone to as you had [1:28:35] your comments I took a vigorous amount [1:28:37] of notes and I hope think shitty clerk [1:28:39] was also taking notes also I would ask [1:28:41] in similar format if everyone could just [1:28:44] document your takeaways and either send [1:28:47] those in this m [1:28:48] gr or you can well I'd say that's [1:28:50] probably the best case uh and then we [1:28:52] compile them but in addition I think [1:28:55] there's a lot of credibility to [1:28:56] commissioner divine's comment of looking [1:28:58] at both chapter 182 and 183 collectively [1:29:01] in that point system um so I think [1:29:02] regardless of how we started this [1:29:04] meeting um I think we still have good [1:29:07] work or good outcomes to work towards [1:29:11] um [1:29:13] I um so okay so why don't you okay it's [1:29:18] on the agenda Monday so why don't you [1:29:20] give the entire Council an update or [1:29:23] what was the discussion or today and [1:29:25] then we continue and then come up with [1:29:27] our um recommendation to the entire [1:29:29] Council because we're going to discuss [1:29:32] the same thing Monday doesn't make any [1:29:33] sense no no I don't think that's what he [1:29:35] said I think I think he's saying that we [1:29:37] just give a um a report about the chair [1:29:41] can give you a report of what happened [1:29:42] like what Miss uh Patrick did and we [1:29:45] still continue to meet still continue to [1:29:47] put information together and come up [1:29:48] with a draft and then present to the F [1:29:50] Council agree so I don't um I don't know [1:29:54] how much of a discussion we're going to [1:29:55] have Monday because there's a lot of [1:29:57] discussion here and a lot of takeaways [1:29:59] for us to come up with a uh to start [1:30:01] work ons but I me one of the points was [1:30:04] uh looking at the system I think having [1:30:07] that as a kind of light hold moment of [1:30:10] that is an option we can have um as an [1:30:12] objective I think we have that continued [1:30:14] discussion as a council that might be [1:30:16] something we're willing to move on [1:30:17] forward in our committee so I would say [1:30:19] as if we capture all of the takeaways [1:30:22] and then we come to Monday and I do a [1:30:24] summarization but if you feel more [1:30:26] emboldened you want to take [1:30:28] a take a direction we can so I think [1:30:31] that's why leaving it is important um [1:30:33] but still continue like I have never [1:30:34] read 182 yet or 183 so I will and I then [1:30:38] may be more open to a different [1:30:41] direction exactly that's what I'm saying [1:30:43] uari so to kind of give summary next [1:30:46] Monday and then let's continue to work and make sure we [1:30:50] address every um section on the both [1:30:53] chapters and then bring it out to the [1:30:55] full Council once we can get that [1:30:57] agreement so move forward with I just [1:31:00] think that I do want to say that I think [1:31:02] that there might be things that um I I [1:31:04] absolutely think we need to you know [1:31:06] summarize our own questions and comments [1:31:09] and get that to miss Miku um I [1:31:11] definitely think we have to look at the [1:31:12] other uh ordinance as well and review [1:31:15] that but I hope that um there might be [1:31:19] some things where we might even on [1:31:20] Monday be able to make recommendations [1:31:22] for motions [1:31:24] um like increasing the fees like [1:31:27] increasing the fees or you know you'd [1:31:30] have to call for a public hear well we [1:31:32] do have a public hearing um when is the [1:31:34] public hearing there's no for public [1:31:36] hearing oh there isn't I thought there [1:31:37] was [1:31:38] already want to do that let's take our [1:31:40] time let's not jump on here we should do [1:31:43] all together I think what is the public [1:31:44] hearing that's coming up is it we have [1:31:46] some public hearings public okay what is [1:31:49] it okay and I just want to and I think [1:31:52] that's something we should do need to [1:31:54] talk to the law department and um the [1:31:56] police department and probably the Law [1:31:58] Department as well want to really just [1:32:00] caution Us in terms of the the use of [1:32:02] drones and people feeling about the the [1:32:04] whole big brother thing because that may [1:32:06] come into I think that's going to become [1:32:08] a conversation where people feel like [1:32:11] drones are over neighborhoods to pretty [1:32:13] much control their behavior so I'm not [1:32:16] sure that that if that's something we [1:32:19] can even do or how much how much we want [1:32:21] to do that so I think we should look [1:32:23] into the the theity of that well I think [1:32:26] I mean I think we've already moved [1:32:27] forward with purchasing these drones and [1:32:29] heard from our Police Department in [1:32:30] terms of some of the various uses for [1:32:32] the drones um I hear what you're saying [1:32:36] um but I think it's the same I mean I'm [1:32:39] still hoping that there's going to be [1:32:40] speed cameras on the red lights I mean [1:32:42] it's the same thing but we do have a [1:32:44] responsibility to be trying to look and [1:32:46] it's new techn I mean it's it is where [1:32:48] we're at I mean in terms of the world in [1:32:51] terms of being able to use the [1:32:53] technology that that now is at our um [1:32:56] available to us to be able to enforce [1:32:58] things um we may just have to take some [1:33:01] flap but I agree that when we have the [1:33:04] public hearing we we might hear um we're [1:33:07] going to hear I I mean I would have to [1:33:08] say that probably increasing the fines [1:33:10] we're going to hear from people that are [1:33:11] going to say this is going to be too [1:33:12] much of a hardship uh etc etc um in some [1:33:16] of our in some of our you know I'm just [1:33:19] saying I mean there's there's going to [1:33:20] be various opinions based on people's [1:33:22] income levels Etc where they're but I [1:33:26] get that we want to have zero tolerance [1:33:28] um so there's lot that's the term I'm [1:33:30] going to [1:33:31] use it's like out there and people [1:33:33] aren't really crazy about it yeah so I [1:33:35] mean we will hear all that in the H [1:33:37] hearing but but we're going to have to [1:33:39] still you know take all that information [1:33:41] in hand and still make our own decisions [1:33:43] based on as long as we're on good legal [1:33:45] standing that's that for me is a concern [1:33:48] oh yeah Abol make sure that we they [1:33:50] can't sue us or anything for that so as [1:33:52] long as we make sure that we have that [1:33:54] um because people are very petitious and [1:33:58] we get sued for a lot of things so can I [1:34:01] just ask what exactly do you are you [1:34:04] looking for from the law department for [1:34:06] Monday so i' say disregard no so I think [1:34:10] we're still in the uh information [1:34:12] gathering phase I think your perspective
