[0:27] local solicitation fisal year 202 for [0:40] chief good afternoon good evening uh the [0:44] city police department [0:46] is requesting acceptance of this uh [0:50] justice assistance grant ultimately we [0:54] were awarded uh the city and county was [0:56] awarded [0:58] $357 uh there's been agreed amount that [1:01] an agreed amount that the city will [1:02] accept [1:03] $55,000 and a remaining balance of $ [1:06] 3,711 will be used by the county [1:09] ultimately what this does this will [1:11] allow us to do rather is to use [1:13] consumables for um new evidence Tech [1:18] procedure equipment apparently there's [1:21] new technology out there and the city [1:23] possesses that we have uh use of uh like [1:27] a fighter extractor uh so anytime you [1:29] Mye pieces of fiber in either carpet or [1:32] clothing they can extract that but it [1:35] uses consumables so the $5,000 would be [1:39] used to purchase consumables as they're used up and there is no [1:44] [3:54] the lowest bidder and it is for [3:58] $4,130 per set [4:00] and that would be good for one [4:02] year so I'm asking the council to uh [4:05] consider that and pass that [4:08] forward [4:10] you Mr chairman this is a uh [4:26] the state program an exciting project [4:30] for the conversion and transition of the [4:32] old Ellis excuse me the St Claire's [4:34] hospital has been owned by Ellis [4:37] Hospital of GRE ills here uh in his role [4:40] as uh chair of Metroplex and heading up [4:43] to unified economic [4:45] development team accounted for uh [4:49] getting looking for the city's support [4:50] in turn to the application any specific [4:53] questions Mr Gill [4:56] available general questions I can answer [5:03] any question for the mayor or um Mr [5:09] Gillan other know what the mayor said [5:11] just is there anything else want to [5:13] we've been very successful in going [5:14] after restore New York grants I think [5:16] we've won seven this is the ninth round [5:19] they look for big buildings uh that have [5:22] a big impact on the community either [5:24] renovating or demolishing them everyone [5:26] knows about the central warehouse [5:28] project in Albany recently that's going [5:30] to be demolished so they're looking for [5:31] you know um large structures that create [5:35] either an opportunity or they're a drain [5:37] on a community and they need to come [5:39] down in this case we want to save the [5:41] vacant St cla's hospital it's 400,000 [5:45] foot building that's a big building we [5:48] have a proven developer in place uh [5:50] they're applying for historic tax [5:52] credits to help uh Finance the project [5:55] this would be an application to the [5:56] state for a restore New York money we've [5:58] laid out the calendar uh in your the [6:01] memo that was provided that shows that [6:03] we can follow all the steps that you all [6:05] like to follow and correct procedures [6:09] and get an endorsement hopefully from [6:10] the council by the end of November we [6:12] submit the application in December we'll [6:14] work very closely with the city staff at [6:17] FX and the developer to put together [6:19] hopefully a winning a winning [6:22] application any questions on this go [6:25] ahead please uh thank you for the the [6:27] overview are these the type of projects [6:29] white seat consideration for like Pilots [6:32] yeah this is a great point I'm glad you [6:34] raised that Council uh St cla's of [6:36] course since it was built in 1949 has [6:39] been off the tax rolls it's on an 18 [6:41] Acre Site uh this project would put it [6:44] on the tax rolls through a pilot that [6:46] would be uh still to be negotiated and [6:49] we'll consult with the City Finance team [6:51] and the mayor on that and all of you but [6:54] we are very excited about the [6:55] opportunity to put the buildings and the main hospital building on the tax [7:01] rolls the other Medical Arts buildings [7:04] at the campus uh which are staying open [7:07] are already on tax [7:10] rules any other question see now may [7:14] have a motion to move this item forward [7:17] second second all [7:39] fees for bulk items um and um the we'll [7:43] call the limit on the number of bags or [7:46] gallon cans per unit in front of [7:49] you it's been presented to you for [7:52] discussion I don't know if any of you [7:54] had time to go through it if you have [7:55] any comments but [7:57] again our was fees are going up [8:00] drastically every year um pit fees the [8:02] cost of truck and garbage this is also [8:05] to address what we call the excessive [8:08] waste on on a sneer and we know we go [8:10] byy these houses that have I mean it [8:13] looks like they empty three or four [8:15] houses I put it on the curb and we take [8:17] it right now and there's no additional [8:18] charges or cost for that cost there is a [8:21] cost for that but the city is absorbing [8:22] that so this is to really look at if [8:25] people are putting an excess amount of [8:26] trash out for pickup including bulk [8:29] which are taking up a lot of room in the [8:31] trucks and adding weight to um The [8:36] Collection well you just want to touch [8:38] on the fres bag in excess of seven can [8:41] you highlight that and how that was [8:43] arriv that we discussed this in several [8:45] meetings um two council members were [8:47] present we had a committee um it was [8:50] discussed a number of times on you know [8:53] what would be the limit on the bags for [8:54] the size bags um I believe we all came [8:57] to a conclusion at first it was five 6 [9:00] and then oh you know I got a lot of [9:01] garbage at 7 I mean I don't where you [9:03] want to end we can go to 9 but we've got [9:05] to have a point where it's reasonable [9:08] and um you know there are some studies [9:11] done by EPA and how much trash an [9:12] average person puts you know out in a [9:14] day um and we came to six and then we [9:18] grew it to seven being a little bit [9:20] generous I think um some of the U [9:22] meetings I went to on some of the [9:23] neighborhoods when they said seven bags [9:25] some people said that's an awful lot of [9:27] garbage it is seven bags and garbage [9:29] or 145g can so that means if there's a [9:33] two family unit it's 14 bags um or two 4 [9:37] gallon cans and for a three unit you got [9:39] 21 bags or three some people have asked [9:43] okay well what if put nine bags in my [9:45] can well if you don't fill a bag that [9:47] hard the can still holds nine bags it's [9:49] nine bags but it's the can or seven full [9:52] bags um so it was discussed in several [9:55] meetings and this is what we came out [9:58] with [10:02] um can you talk a little bit I I I see [10:04] the handout um that's in here but um [10:07] have you thought at all about how you're [10:08] going to promote this to residents of [10:10] what what some of the methods might be [10:12] Ben discussed just preliminary at some [10:14] of the neighborhood meetings would come [10:16] out as a soft start I we're just not [10:17] going to start you know writing [10:19] violations immediately um we'd have to [10:22] do a soft start we have to do a lot of [10:24] promotion you know there's a lot of work [10:26] to put this out um couple of things that [10:29] we discussed was um it's almost like the [10:32] permit fee um if you're going to build a [10:33] deck do some work in your house you come [10:35] to see Hall the sheet that you have it's [10:37] sort of an Excel simple Excel sheet you [10:40] get six items you fill it in it's going [10:43] to calculate the cost you come down the [10:45] room nine do the sheet just like you do [10:48] in codes you go upstairs for receips you [10:50] pay for it come downstairs we give the [10:52] appropriate stickers you put it on on we [10:56] schedule for the next pickup um the SPL [10:59] on there so would always go to the [11:00] property owner um unfortunately [11:03] tenants we we have no recourse to you [11:06] know to um you know get that bill paid [11:09] so we go to the homeowner um and if not [11:13] paid obviously if we be an MDB it would [11:15] be [11:18] ly go ahead please so in terms of um and [11:22] I wasn't there for the final decision [11:23] I'm sting so in terms of who's going to [11:26] keep track of the bags and how you're [11:28] going to you know how it gets reported [11:30] or let's say someone puts out eight bags [11:32] and seven is the number so how does that [11:35] get counted and then what happens with [11:36] that excess bag and how does it get [11:38] charged for I don't think we're going to [11:40] step on everybody's toes for one bag [11:42] once in a while okay all right five [11:44] extra [11:45] bags we have four new officers are out [11:48] on a daily basis plus two three [11:49] supervisors for which they'll go to the [11:51] property they'll photo it um house [11:55] there's an address on the house so it's [11:57] documented and that on property law will [12:00] be issued at MVB for the additional [12:02] waste we're not going to leave it on the [12:04] street it's got to be picked up we all [12:06] know that's the one you know function [12:08] and operation in the city has to be [12:09] complete every day uh we can't go back [12:11] tomorrow and repick it up we'll fall too [12:13] far behind so it will be picked up so [12:15] it's not left for you know neighbors to [12:17] complain about um but it would be a [12:19] violation as you know as any other the [12:22] day when people put their trash out [12:23] before 2:00 I you know we wrote a number [12:26] of them today because you know uh [12:29] have um you know 9:00 this morning for [12:33] tomorrow's pick up so um the way to do [12:36] this is enforcement if you don't enforce [12:38] things nobody's going never follow the [12:43] rule so follow in terms of billing you [12:45] want to touch on that quarterly the [12:47] suggestion is to build quarterly for [12:49] this rather than building every we we [12:51] wouldn't build it's really on the me [12:53] it's it's sort of like if you're in the [12:56] suburbs you know if you have a bulk [12:57] items you call ahead part a trash [12:59] collector and say I've got some material [13:01] out there they'll schedule a day when [13:03] they may have two people on that truck [13:05] or not they'll you know the property [13:07] owner will come down here whether he [13:08] makes arrangements with his tenant um [13:11] tell us they have X items to pick up or [13:14] you know this we'll fill out and on that [13:16] sheet you'll see that there's a pickup [13:18] date so normally it would be the next pickup um you know if they came [13:22] in [13:23] 10:04 you know on a Thursday may not be [13:26] Friday's pickup it may be the following [13:28] Friday but we would tell them have it [13:29] out on this date it'll all be picked [13:32] up so for the ones who doesn't have that [13:35] doesn't have what you know online or [13:38] come into City Hall and have those [13:39] stickers and just put it out like that [13:41] to the C would that be picked up and [13:43] then build y we we're not going to leave [13:45] anything on the curve as we do right now [13:48] we're going to pick it up but the [13:50] property owner will be [13:52] built well that's the proposal that we [13:55] would continue to do that the final [13:58] decision sto and what the city council [14:01] adopts in the modified [14:06] code go ahead please so the bill if it's [14:09] say a [14:11] refrigerator and they didn't come down [14:13] and get the sticker so you build them is [14:15] it the same amount or is it increased [14:17] because they did not come down in De am [14:20] same amount we do have administrative [14:22] fee we ration $50 that's in the city [14:24] code currently but again if it's up to [14:28] city council want on to the neighborhood [14:29] meetings it's only been discussed it's [14:31] still a decision with the council and if [14:35] you if you leave it there or you don't [14:39] come down and you pick it up and there [14:41] is [14:42] no bill for it and I don't know why [14:45] we're proposing this week smells W [14:47] anyway I mean this is to sort of curtail [14:50] the offenders that are just putting [14:52] there all the time people who are [14:54] bringing trash in from outside the city [14:56] because they have Apartments here and [14:57] they're leaving in front of their [14:58] apartment buildings because it's free [15:00] pickup beer and the reason for the [15:02] question is if I don't come and get a [15:06] sticker you going to take it anyway [15:07] building it so why am they going to come [15:08] down here and because based on that [15:12] you're still going to get an [15:12] administrative fee so it's going to be [15:14] more money all right there's still [15:16] administrative Fe attached to violations [15:18] within the C code so if you choose to [15:22] there would be a violation plus the [15:26] pickup go ahead please you you brought [15:28] up a good point about people bringing um [15:30] garbage from outside the city so um for [15:34] if someone I mean what if someone from [15:35] outside the city just brings trash in [15:37] front of my house and we have no way of [15:39] knowing unless you go through the [15:40] garbage that it wasn't my [15:42] trash and so how do we and then it [15:45] becomes between the homeowner or the [15:47] renter and the either the garbage um the [15:51] nuisance inspector or the city like to [15:54] determine who really put that trash [15:55] there but we do go through the trash and [15:57] we look for mail okay but yes it does [15:59] happen in fact people come in and drop [16:01] it on the city property normal places [16:03] are on wad Street shelting Avenue the [16:05] Alleyways it happens on our own property [16:08] and it may happen um and I believe law [16:11] can answer that because the one time I [16:12] was informed that it's presumed if it's [16:15] in front of your house it is yours and [16:17] that was the last um advice I got from [16:20] Corporation Council fire new coration [16:23] Council um I don't think it's going to [16:26] happen every day on a daily basis but [16:27] there's a possibility it's going to [16:28] happen happen um we pick up trash all [16:31] over the city that's just left in random [16:34] places and you know it it it [16:37] happens it's not a perfect [16:42] system go ahead please Mr lean um what [16:45] was sort of the general reaction from [16:47] the neighborhood associations and thank [16:49] you for going to all the neighborhood [16:50] associations to talk about this it was [16:52] taking well a lot of the um neighborhood [16:55] ass realize that there are a lot of [16:57] properties that are just access and you [17:00] know to go back to your question [17:02] is you know we might get a bag or two or [17:04] an odd item that someone dumps but it's [17:06] really going after the um viors who put [17:09] just excessive amounts of waste on and I [17:11] don't think they're going to bring [17:12] trailer loads or truck loads into [17:14] somebody's house and start just [17:15] unloading it they'll probably get [17:16] noticed you're going to have once in a [17:18] while some point dump a TV or a single [17:20] item in some of these I work some of [17:22] these houses but to get back to you they [17:24] did take it uh good um one of the things [17:26] was a better way of maybe addressing how [17:29] get the stickers um and it's something [17:31] that was discussed can be done online um [17:35] you know there's things we can look at [17:38] um some say it may be an inconvenience [17:39] to actually come here and you know [17:41] purchase stickers but again if you think [17:45] about it you know and you say okay hey I [17:47] got a slow day today I'm going to run [17:49] over the see Hall I'm going to just grab [17:51] a dozen stickers just Happ for the year [17:54] that's they're there you know you can [17:56] call in there's things we can do but we [17:59] have to start somewhere or we're just [18:01] going to continue to pick up excessive [18:03] amounts of waste and never get to a uh [18:07] an [18:11] end go ahead did we try something this [18:13] similar to this um was there anything [18:16] similar to this [18:17] Tri back a few years ago not since I've [18:21] been here I mean I know we did the the [18:23] big push on um recycling years ago and [18:27] we all know recycling is now [18:30] you can add about $500,000 to you know [18:32] our waste expenses because of recycling [18:34] because you know 4 years ago was [18:36] absolutely free it is not fre them we [18:38] you've heard me say before we pay more [18:41] to get rid of and dispose of our [18:42] recycles than we do our nsw so um [18:46] there's almost a half a million dollars [18:47] in additional cost just on [18:50] newy and so could you tell us which [18:53] neighborhood associations that you've [18:54] been to and also for those cuz [18:57] neighborhood associations some of them [18:58] don't have large turnout so what is the [19:01] prop plan to reach people who don't ever [19:04] go to Neighborhood associations or don't [19:06] engage in that way in the community [19:08] obviously if you make a decision on what [19:10] we do and how we finalize it it's going [19:12] to be you know um media it'll be on our [19:16] website um I imagine put it in the [19:20] newsletter um the paper maybe on the [19:22] news it has to be you know there's going [19:24] to be a a program to reach out to [19:26] everybody I'll continue to go to [19:28] Neighborhood meetings they have their [19:30] websites they've been they can share it [19:32] through their some of them have [19:34] newsletters um but I've been to the [19:36] stock aade I've been to B I've been to [19:39] uh the G plot and the North [19:44] End uner Union Chris was there yeah and [19:49] one night um I had a special meeting um [19:52] for the GE there'll be meetings at the [19:54] same time and a budget meeting so I I [19:56] couldn't get all three places so up for [19:59] Union so it's five chis Chris Chris did [20:02] a presentation to on that and uh at the [20:04] one meeting um the representative from [20:05] Sun was there and she was going to [20:08] um spread the word a little to goe so I [20:12] was thinking like um this is probably [20:14] going to be something that people will [20:17] with our best efforts of kind of [20:18] educating people and get trying to get [20:20] the word out that we'll see the real you [20:23] know once we start to implement it um [20:26] then people will start saying oh I [20:27] didn't you know I was unaware whatever [20:29] but I think that's kind of just what the [20:31] natural progression of this is going to [20:32] be until people to it become kind of a [20:34] norm so I was thinking um I don't know [20:36] if this was discussed but you know [20:39] something like um so as we begin to [20:43] implement it we see that person has [20:45] eight bags so it's you know a couple [20:48] more bags than what they should have or [20:49] you know eight or nine bags and it's [20:50] like instead of maybe the violation at [20:53] that point then maybe something goes in [20:55] the door to say hey this is a almost [20:57] like a warning well was to do a soft [21:01] stop which we don't we we know [21:03] implementing something like today we [21:05] start running a bu violations isn't [21:08] going to help um it'll be a soft start [21:11] and there will probably be some just [21:12] reminders okay they don't like alert you [21:15] warnings but a reminder that you know [21:17] City implemented a new garbage structure [21:19] and you know it may take you know maybe [21:23] 60 days or 90 days I don't know for [21:25] people to acclimate it but we're not [21:27] looking to just say starting today we're [21:29] going to start writing all these [21:30] violations of heights there's going to [21:31] be a soft start um to bring this program [21:34] on [21:38] board Miss sorry thank you Mr chairman [21:42] again my thoughts on this are the [21:44] council can move in a timely manner we [21:47] normally do the distribution of the [21:49] garbage schedules on a voluntary or [21:53] handout basis this year we would look to [21:56] do a for of a direct mail or making sure [22:01] not only the garbage schedule but the [22:04] new criteria is delivered to each and [22:07] every pickup point then as Paul's [22:10] outline Mr Farley's talked about is [22:12] doing almost a no penalty enforcement [22:15] period so people might get some type of [22:18] citation saying that you're doing this [22:21] wrong but there's no penalty you've got [22:24] to be in compliance and as he saying 60 [22:28] days days 90 days as we educate people [22:31] and uh find tune the [22:36] system thank you so I I I appreciate all [22:39] the time that a lot of people have put [22:41] into this and I will say that we're one [22:43] of the only large municipalities in the [22:45] area that hasn't implemented um some [22:48] type of structure for uh putting bulk [22:51] items out at the at the curb um when we [22:54] were in these um talks I um always asked [22:58] about the uh as I call them the [22:59] connected2 family that are cut into uh [23:02] two three four Apartments um and uh you [23:06] know maybe only on the books as a two [23:09] family um I I would really like to see [23:12] some uh housing sales pulled and and and [23:15] code just checking into um the amount of [23:17] apartments that are in some of these [23:19] buildings that are putting out a lot of [23:22] excessive trash um another thing is you [23:26] know we just had a holiday [23:29] um last week so you get maybe an extra [23:32] day of trash which flows into your seven [23:36] bags now being 10 bags or whatever so um [23:39] I had originally asked the committee for 10 bags and we kind of cut back on [23:43] that um and as far as trash bags I mean [23:46] we only use 13 galon trash cans in our bags in our kitchen but then you [23:53] can put out 735 gallon bags but these [23:56] are 13 G yes so there only the seven [24:00] yeah it's listed on here seven 13 gallon [24:02] bags I I thought I saw 35 okay so and [24:06] again as as as I say I mean there's just [24:08] two of us that live in my house and a [24:10] lot of times I put out you know I have [24:12] six just for two of us uh being that we [24:15] cook all the time um and and we do [24:17] create a a lot of trash um but I would [24:20] like to see you know I I I don't want to [24:22] see and I I'm not calling this people [24:24] being penalized by any means but um you [24:27] know and repeated at our meetings my [24:29] mother-in-law put out a can of trash [24:31] this big um as a single senior woman um [24:34] and then if she wants to throw out a [24:35] lamp she just you know they have to add [24:37] to this I mean [24:39] there's and I understand it needs to be [24:42] done um I I understand if we addressed [24:44] this last year um we wouldn't even be [24:47] having this discussion because for 30 [24:49] some odd dollars per unit everything [24:52] would still be being picked up um but I do realize the importance of of these [24:58] bulk uh items being put out and a lot of [25:03] individuals abusing the [25:05] system and we would be cognizant of [25:08] certain holidays and we know we know the [25:10] month of November coming up people get [25:12] confused there's four holidays and you [25:14] know Thanksgiving is going to generate a [25:16] lot of trash so there's some common [25:19] sense that we have to use too um you [25:21] know that you know on a Monday after the [25:24] long than evening weekend if there's two [25:26] extra bags I think you know [25:29] we have to work things in a little [25:30] differently but but I mean I I understand that all this we we [25:37] worked it out over and over and over [25:39] again in in our meetings and we we [25:41] really tried um I also I also thought of [25:45] scales uh on on trash trucks so when [25:48] you're picking up a bulk curb side um [25:53] you know it gets weighed and build out [25:56] so I I I still think I and I know that [25:59] you know we have we need to increase our [26:01] Revenue but I I also think that there's [26:03] still more that can be done on how we [26:07] can put this out and and again it's not [26:10] going to be fair for everyone I realize [26:12] that but try to make [26:16] it if I can here's two things the scales [26:20] will never work no to to outfit the [26:22] trucks our debt service would increase [26:24] so much we have to raise a lot of rates [26:26] to begin with okay and then trying to [26:28] way everything that's on a curve we [26:30] better double our overtime across the [26:32] board and hope that they want to stay in [26:34] work um it just uh you know logistically [26:36] would not work on the side where the [26:39] people who put out maybe one or two bags [26:42] um again if you're in the suburbs you're [26:45] going to buy one can that's what they're [26:47] going to charge you for whether you put [26:48] one bag in it or you put all seven bags [26:50] in it you're going to pay there's got to [26:52] be a a baseline to everything and um I [26:56] appreciate the time you put in and and [26:58] Mr mic who who worked in trash who was [27:01] very knowledgeable we reached out to [27:04] anyone who has uh U commercial [27:08] um um suburbs who have it and you're [27:11] right it's one can top Clos same with [27:15] recycling um so I I I know that [27:18] something needs to be implemented I do [27:21] and [27:23] um go ahead please so I'm glad you [27:26] brought that up Mr Toro I was going to [27:27] ask I imagine you were one of the the [27:30] key people who are part of this [27:32] committee from start to finish is that [27:35] correct I started it yes and then with [27:38] this proposal like you take credit and I [27:41] do not take credit for this prop like [27:44] your feedback and comments are reflect [27:46] in this document is that not correct [27:47] some of them are yes so I would say in [27:49] some of your reservations are you not [27:50] confident in what you presented I think [27:52] that would be the cause for pause at [27:54] least for myself so do you feel good [27:56] with this I wasn't part of the final [27:58] presentation that Mr Leon's been going [28:00] to neighborhoods and presenting so there [28:03] are maybe some of my ideas in there but [28:06] no I am not presenting this to you Mr [28:09] Willam so does this document not reflect [28:11] the conversations that you initiated or [28:14] I had part in some of these initiations [28:17] I I again put 10 out 10 bags on the [28:19] table versus seven um Miss Porterfield [28:23] sat there uh for most of the meetings as [28:25] well so yeah so of your discussions what [28:28] percentage would you say this reflects [28:30] those [28:31] discussions um we talked about pricing [28:34] for units on you know for whatever both [28:38] might put out and again I brought [28:39] forward constantly what I just brought [28:41] forward again was the amount of [28:44] apartments in the city that that aren't [28:45] regulated that need to be looked into um [28:48] so they're putting out you know three [28:50] times the amount of trash uh I I always [28:53] brought up my mother-in-law's little [28:54] tiny can and now all of a sudden you [28:56] know she might have a mattress that goes [28:59] out and and and a couple of other things [29:01] and she's at $50 or she begins to get [29:03] her stickers now it's $100 when had we [29:07] addressed this properly um I don't think [29:11] we'd really be going through any of this [29:13] and I appreciate you raising so getting [29:15] into my two questions that was a good [29:17] point so your comment was if we raised [29:20] fees to the $35 that was proposed last [29:22] year this would be a new point we [29:24] wouldn't have to address this issue now [29:26] I would say at this present time with [29:28] the proposed fee increases there's been [29:30] no push back at least from myself so [29:33] would that not address this issue at [29:34] least this year so wouldn't this not be [29:37] a topic of concern based on your comment [29:40] I'm sorry I don't understand your [29:41] question if we raise fees is this an [29:44] issue um how much are you proposing to [29:46] raise the fees this year I would say the [29:48] mayor proposed $52 per year which [29:51] exceeds the $35 from last year so if [29:54] we're trying to just repeat the cost of [29:56] increasing municipal waste [29:58] my concern is if you change too much we [30:01] can't evaluate the efficacy of any one [30:03] change so that's one of my cautions but [30:06] then also to your other issue which I [30:08] drew an issue to your rental [30:09] certificates with families being [30:12] miscategorized isn't there a considered [30:14] effort from like code enforcement to [30:15] make sure properties are what they say [30:18] they are so if that's a concern I think [30:20] that is also an area we need to make [30:21] sure we address this to the point if [30:25] buildings are misidentifying themselves [30:28] we have to make sure we right side that [30:31] issue well the buildings are not [30:33] misidentified it's when people do the we [30:36] Warrior thing and wejust their buildings [30:39] to something we're not aware of and they [30:40] don't come in and get their proper [30:42] permits so we don't know what's like [30:44] them so when they convert a a two unit [30:46] to a three unit or a four unit we're not [30:49] always made aware that not everybody [30:51] comes to the City Hall against the [30:53] building permit and follows the [30:54] procedure and a couple of things is yes [30:57] the [30:59] you know if you if you rais the fee just [31:01] across the board um that's going to [31:04] address everybody pays the same you get [31:06] you it's not going to address the people [31:08] who are still taking advantage of it and [31:10] putting out the big buls of trash the [31:12] whole point of this is to address the [31:14] people who are putting the excessive [31:15] amount of trash out in the bulk items [31:17] and they answer the question about a [31:19] mattress I think for a hun you know I [31:21] think the mattress on a queen says is [31:22] $10 so you can put out a whole bedroom [31:25] array for about $45 [31:29] and I don't know I don't buy new [31:31] mattress every month but I don't buy a [31:33] sofa every couple weeks so it's very you [31:36] know most people keep these for 20 years [31:39] um but again you have a a straight base [31:42] feed adjustment and I as I spoke earlier [31:45] we've seen an increase of a half a [31:46] million dollars cuz just recycle we [31:49] never paid for recycle we're paying a [31:51] half a million now for just [31:54] recycle so that might address some of [31:57] our cost that are going up just [31:59] naturally but we still have to address [32:00] the cost of the people who are just [32:02] putting out you know boatloads of [32:04] material along their property and just [32:07] paying a modest view for it and so just [32:10] closing comment I think that's why it's [32:11] important to be intentional with our [32:12] words so the $35 increase proposed last [32:15] year just raising that would not have [32:17] addressed this [32:18] issue it [32:21] the me yeah I I you know until we get [32:26] some data on what we're picking up we've [32:27] never gathered data we pick up we do [32:29] know that you know we call them you know [32:31] the jackpots and the truck pulls up and [32:33] it takes you know another truck to come [32:57] proposal so last year's budget was a $52 [33:00] increase it was a dollar a week last [33:02] year again we had to [33:06] get uh people to continue to work [33:10] here uh Jud with the council we gave the [33:13] drivers pay raises to just stay [33:15] competitive not only with other [33:17] localities but with Private Industry and [33:21] so there's an expense here and right now [33:25] it's all random there is no way that I [33:27] can manage this and build in operational [33:30] efficiencies with the structure that's [33:32] in place today and what is on the code [33:34] what I've told you before it's in the [33:37] code nobody in the city's compliant it's [33:40] much easier to do the enforcement it's [33:42] just $50 a day will be the fine [33:45] basically for [33:47] everybody my garbage is not [33:50] compliant the code says clear bags I'm [33:53] using white garbage bags I can't find [33:56] clear bags [33:58] and just to address it when this was [34:00] brought to us um last year into the [34:02] budget it was discussed as excessive [34:05] garbage jackpot so it wasn't I don't [34:10] think um we discussed all these um what [34:13] we call it these bulk items here was [34:16] discussed last year it's more of [34:17] addressing excessive garbage last year [34:20] and you're correct Mr Mard [34:24] the jackpots is the staff coins to turn [34:29] is a [34:30] clear situation that has Universal [34:34] acceptance those are wrong and incorrect [34:39] but where do you draw the line it is a [34:42] far more complex analysis from people [34:45] how do you put in [34:58] place something that is fair Equitable [35:01] and [35:03] manageable so so um there's seven um CH [35:07] gallons trash bag for one container so [35:10] if I were to have two two cans out there [35:12] with seven bags is that a violation [35:14] would that be a violation well it's a [35:15] single unit yeah you're you're either [35:17] given you know seven bags tied sitting [35:19] at the curb or one 45g can now you can [35:23] take your seven bags and put it in the [35:24] can if you want to keep a nice meat you [35:26] know backyard [35:28] and it's your choice I mean some people [35:30] could fit maybe nine or 10 bags in in a can if they'll fill them all the [35:33] way but it's it's either or it's 145g [35:37] can or seven bags a lot of people don't [35:39] cans they just bring their bags up they [35:41] said I'm at the curb and if they're [35:43] seven bags we're going to take of stole [35:46] the discretion of the council there [35:48] would be [37:17] the jackpot so that's one issue then the [37:19] other issue is just the increase of cost [37:22] and the increase of Labor and that is [37:24] something that will be addressed be via [37:27] you know increasing the fees all across [37:29] the board but I think that a lot of [37:31] times in that conversations those issues [37:33] were getting conflated and even maybe so [37:35] now the point being that the fee [37:37] structure is for is to try to manage [37:41] some of these jackpots that's happening [37:43] and then propos increases is for the [37:46] general am I correct about look at the people [38:19] who are increasing it even more because [38:22] they're just taking advantage of what [38:24] they're putting out there because right [38:26] now it's there's no [38:28] so to your point would know that [38:30] wouldn't have addressed what we're [38:31] talking about and I think so and the [38:33] other thing is you know Mr turo I think [38:36] you your concern around like the [38:38] apartmentss and to your kind of Weekend [38:40] Warriors I think one of the positive [38:42] byproducts of this will be those places [38:44] might be more easy to identify for C [38:47] because now we'll pull up we say listen [38:48] you got this is a two family house and [38:50] you're giving me you know six units [38:52] worth of trash you know that might be [38:53] some indicators where we can start [38:55] communicating maybe that makes us more [38:56] effect move work more efficiently within [38:58] our Cod Department nuisance officers [39:00] will generate a notice and we can give [39:03] it to codes to do an inspection to see [39:05] that they put in extra two apartments [39:06] that we wen't aware of there we go thank [39:09] you and mayor whenever this is roll out [39:12] we intend to have online service so [39:14] people can purchase stickers online [39:16] we're looking at all those scenarios [39:18] would you maybe be able to purchase in [39:20] local stores so there would be a [39:22] neighborhood convenience uh one scenario [39:25] is that we might mail out [39:28] a couple of stickers to everybody at the [39:30] beginning of the year so you get [39:32] some uh there's an assumption you're [39:34] going to have something that's going to [39:36] exceed the limit that still the [39:39] prerogative of the city council to [39:41] actually Implement that or put it in [39:43] code and then we'll manage it going [39:46] forward go ahead please so mayor you [39:49] brought this up about the flare and [39:50] translation bags and I see that there's [39:52] no change within the code but as you [39:55] stated they're difficult to find so if [39:58] we're going to do this I I think that we need to also address the part of the [40:02] code that can't that can't that people [40:05] can't comply with because they don't [40:06] have the ability to comply with as [40:08] opposed to changing all this and then [40:09] somebody puts it out in impacts on um disadvantaged [45:46] um households for U frequently dis [45:49] disenfranchised I think My worry is [45:51] again to Mr Toro's point like I I can [45:54] actually speak for myself there are some [45:55] Le where you have a lot of bags other [45:57] weeks where you don't and my fear is who [46:00] was that discretion up to if the focus [46:03] is on jackpots so I don't know if [46:05] there's a way to write in to legislation [46:07] our Focus area is on the excessive 12 to [46:10] 15 range however to mayor's point we [46:13] need to actually Define what is [46:14] appropriate but I'm in agreement with [46:16] having a no penalty enforcement I think [46:18] there also needs to make there needs to [46:20] be a considered effort with how do we [46:22] get feedback from the community um so I [46:24] think we need to uh focus on that uh as well I give you an [46:29] example my sons live outside the city [46:32] and they have you know one can for [46:34] recycle one private pickup he's got too [46:37] much garbage stays in the garage because [46:39] next week he hopefully doesn't have as [46:41] much and he goes into the camp um you [46:43] know it's how it's done outside it's in a private sector private world [46:48] you know I got four extra bags well I [46:50] know he's not going to take it I leave [46:53] it next to can they help get out because [46:54] they have the war on them truck so it [46:57] stays an extra week and he gets it in um [47:01] you know I [47:01] mean we have a rule if if it's designed [47:05] on and we sort of stick by the best we [47:07] can you know there is a soft start um [47:11] but you know if you start letting [47:13] everybody go it's two bags this week [47:15] well it's three next week then I don't [47:17] know soundly and I think [48:01] we identify any other administrative [48:03] work to go to that that could alter that [48:06] the administrative work um you [48:09] know they're picking it up now so [48:12] whether they pick up seven bags and if [48:14] that's what is decided with the council [48:16] pick up the seven bags going if [48:18] nothing's done and they go to the house [48:20] and there's 47 bags and three counes [48:22] they're going to pick it up anyway [48:23] because that's what we do um the [48:25] administrative were the guys picking up [48:27] that work like doing administrative work [48:28] I have four supervisors and I have four [48:31] nuisance officers and if we're running [48:33] short I'm out there Mr one is out there [48:37] um but we have management staff that's [48:39] out there to assist these issues [48:42] document thingses um the burden wouldn't [48:44] be on the drivers or the labor loaders [48:46] that are actually loading the garbage [48:47] start start taking pictures and you know [48:50] adding another they've got a l like you [48:53] said and they work very hard to do what [48:54] they do thank you I'll [48:58] I I I just want to be clear that I know [49:00] this is necessary [49:03] um and uh to make a point of uh [49:06] commercial uh trash pickup uh my [49:10] daughter's friend that took her almost a [49:12] month to get rid of her uh children's [49:15] boxes from Christmas last year because [49:17] she had to you know break everything [49:19] down put in the garage fill the can you [49:23] know the next week whatever whatever so we've been very fortunate [49:27] um up to this point of being able to to [49:30] get rid of all of our trash in the way [49:32] that we have but again um we need to be [49:35] start start being uh you know a little [49:38] bit more conservative and and um maybe [49:42] even uh little uh piles in our yard [49:45] compost piles of food scraps um things [49:48] like that so um again it's it's now one [49:51] thing I think some of you come back to [49:53] me and said that they've seen an [49:54] improvement based on our nuisance office [49:56] is going out and addressing the early [49:58] hours absolutely and the reason we saw [50:01] that Improvement is we've been writing [50:04] violations because you know we write [50:06] them and people are being educated that [50:10] it's got to be 2:00 or [50:14] later just follow to Mr Williams [50:18] Point his points which are correct but I [50:23] believe that as we go through this it's [50:26] actually going to reduce our waste [50:27] stream because today we have so many [50:29] people that are taking advantage of it [50:31] because there are no rules in place and [50:34] again I'm trying to not do too much at [50:39] once even though we had a robust [50:42] discussion a year ago about this if you [50:44] go back the prior year in my budget [50:47] message I again referenced jackpots in [50:51] that so it's been two years to get us to [50:53] this point if we go to and I'm not [50:57] suggesting this it's just hypothetically [50:59] that some Community might want to go to [51:01] standardized sizes for [51:04] cans and then we can automate the arms [51:07] on the garbage [51:08] trucks which uh other municipalities [51:12] were they've done that reduces their [51:14] workman's comp [51:15] cases and so it's how do you again build [51:18] that efficiency in have rules in place [51:21] that make sense to people and we really [51:25] still have a uh a great system here the [51:29] transfer station the city owns and we uh [51:32] have advantaged by an outside contractor [51:35] is available for people uh not only [51:38] within the city but in the region who [51:40] can go and dump there so if you have uh [51:44] MSW you can go in uh if you have cndd [51:47] material you can go in and then there [51:49] are also private companies immediately [51:51] adjacent to that site who do a lot of [51:54] recycling so if somebody has paper if [51:57] they have metal Goods so they can go [51:59] down there and actually get a little bit [52:01] of money for uh the material that [52:04] otherwise might just be treated solely [52:06] as [52:09] garbage I just ask Mr Brian just a brief [52:12] us on the [52:14] dra I know there there's been a lot of [52:16] comparison to the suburbs versus the [52:18] city but an urban area versus suburbs [52:21] most of the people out there are [52:22] homeowners we're we're dealing with a [52:24] lot of renters in the city so I don't [52:26] know that can necessarily kind to try to [52:29] um apply the same thing but I mean I [52:31] live in I don't have a garage people in [52:32] the city do but and maybe many people [52:34] that are homeowners in suburbs and [52:36] surrounding areas have garages that [52:38] doesn't apply so I want to be careful [52:40] that we're not trying to compare [52:42] ourselves to a municipality or a [52:44] surrounding area even within the SK [52:46] County that this it's not going to be [52:48] the same kind of [52:51] thing I was sitting here at the [52:53] inspection report since the mayor [52:55] mentioned the transfer station the state [52:56] inspected our transfer station today and [52:59] um it was all satisfactory no violations [53:03] and nothing there so our contract [53:05] operator trans [53:10] station I I do want to say that uh the [53:13] city of Troy did buy chance for every [53:16] resident um you know oh yeah so the city [53:22] no no no I I know we're not suggesting [53:24] that but we did have AR funds but again [53:27] their trucks now can uh use the one arm [53:30] to to empty things and and I know Mr [53:32] Leon reached out to troit again and the [53:34] committee we we did reach out to every [53:36] municipality that was Amsterdam Troy UDA [53:39] um H just just recently so again we're we're moving in in a direction [53:46] where you know we need to go um but I [53:48] think there's a little bit of work that [53:49] the council can still do so and that's [53:52] why we're here we're here discussing it [53:54] to move forward because um it's added in [53:56] the 2025 budget the revenue associ with [54:00] this increase Mr Brian can you just [54:02] brief us on on the changes of draft [54:04] legislation [54:06] um thank you Mr chairman uh in your [54:09] packets this week uh you've gotten a [54:12] rough rough outline working draft of the [54:14] sections of the code there's going to be [54:16] various sections of the code that [54:17] they're going to have to be uh amended [54:20] the new materials underlined at the [54:22] bracket materials taken out um we've [54:24] already talked about the size of it the [54:26] garbage cans and the plastic bags um [54:30] based on follow Mr fund mentioned [54:33] earlier and the concerns council members [54:36] um there's a 164-1 n it's not all the [54:39] way in there but it's uh penalties for [54:42] offenses subdivision one that will be a [54:45] grace period uh following the effective [54:47] date of the amendments to this chapter [54:49] this is language that was in the [54:50] original chapter 161 when they enacted [54:54] it there was a there was a vision of a [54:56] grace period put in the original chapter [54:59] 161 um this is um going along with that [55:03] uh the original uh 161 grace period but [55:06] updating it uh when there shall be only [55:09] a verbal written warnings issued to [55:11] violators of this chapter during this [55:12] time period from the effective date of [55:14] the Amendments which would be January 1 [55:17] uh uh to the enforcement date of April [55:19] 1st there shall be an intensive program [55:21] of notification education on amended uh [55:24] procedures and Associated fees [55:27] so it's mandating the city to go through [55:29] a a procedure for the first four you [55:31] know 3 months uh uh before any sort of [55:35] enforcements going in and that's really [55:37] language that was from the original [55:38] chapter 161 when that was enacted so [55:41] just updating that and applying it to [55:43] this particular case it was en Vision [55:45] when this uh this chapter was put in [55:49] that there would be a it would have to [55:51] be an education perod and that's just [55:53] updating it for these [55:54] amendments um [55:57] as uh also we're looking at various [56:01] sections of [56:02] 161 D Article Five is really the fee [56:06] based uh system of collection of solid [56:09] waste and recyclables Article Five of [56:11] chapter 161 is the the fee schedule that [56:14] we've been discussing as far as the fees [56:17] to all residencies this is kind of this [56:20] is uh going into greater detail than and it's in there right now besides [56:25] going once again for the sides of the [56:27] cans and the the plastic bags it is [56:32] trying to wrap it my it is dealing with [56:35] that issue of excess res residential [56:39] Solid Waste or bulky items it's it's [56:41] dealing with the if it's more than what [56:44] it is said here then it's then those [56:47] fees will be in place those stickers [56:51] will be required so um that is said [56:56] setting forth was the schedule um [56:59] dealing with the the schedules we saw [57:01] separately that are also part of this um [57:03] Furniture couches [57:05] Etc um and then Property Owners May [57:09] purchase excess uh residential Solid [57:12] Waste stickers to fix to their items [57:14] there was a discussion of $5 per sticker [57:16] that's just a that's in there if the [57:19] council wants to change it that's up to [57:21] then stickers will be available at the [57:23] city clerk's office and the department [57:25] General Services office [57:26] right now that's just for discussion [57:29] purposes if everybody's okay with that [57:32] as we go forward that can stay in there [57:35] um and then each property owner be [57:37] issued free excess residential solid [57:39] voice stickers each calendar year once [57:41] again that can be adjusted that's just [57:44] you know for discussion purposes if you [57:45] want to come back and amend it [57:50] um and then it goes through other [57:53] sections that are not being amended and [57:55] then dealing with the issue is of uh the [57:57] depositing of public collection for [58:00] public collection of solid waste not [58:01] originating in the city shall be [58:03] considered an unclassified misdemeanor [58:05] that's under [58:07] 16126 penalties for offenses creating a [58:10] new paragraph D indicating that if that [58:13] is done then there'll be a fine up to [58:16] $1,000 or up to 100 day 180 days per per [58:21] occurrence so that's upping the the [58:24] people who may be bringing trash you [58:28] putting the penalty to that [58:30] particular uh [58:32] violation so the way ahead the way ahead [58:35] is you've got a working draft in front [58:37] of you you've got the permits uh the the [58:39] schedule of fees that Mr lefon uh gave [58:43] you last week as well you can call for a [58:45] public hearing which would be on uh [58:47] November 12th Tuesday November 12th if [58:50] you put it on for these this working [58:53] draft plus the the schedule of fees that [58:56] fond put together can be posted on the [58:59] city's website for for comment so at [59:02] that public hearing on the [59:04] 12th um you that would be the time [59:07] period for public comments on this at [59:10] Citywide and then this would come back [59:12] to the uh committee uh for final action [59:18] uh so uh that's the way ahead um this is [59:21] just a working draft it's it's it's [59:24] indicating those areas of the code that [59:26] need to be changed and uh and dealing [59:30] with the plastic bags and the excess [59:32] solid waste and the fee schedule and uh [59:35] so really based on that it's it's a it's a public hearing on this on the [59:41] fees and then any sort of amendments [59:44] changes whatever you know after the [59:47] public hearing you can adjust [59:50] accordingly Mr I just want to touch on [59:53] 16124 um the U EX sorry 25 [1:00:01] exemptions yeah those exemptions are not [1:00:03] being changed the exemptions that are in [1:00:06] the current ordinates are not being [1:00:10] [1:13:11] and tweak it and make sure that [1:13:12] everything is you know Qui aesthetic uh [1:13:15] as far as you know triggering how these [1:13:17] alarms are being triggered and things so [1:13:20] um so I just wanted to add that [1:13:29] just council members concerns we dealt [1:13:34] with it with two false alarms but then [1:13:35] there was a discussion I recall that there was a discussion that they're [1:13:39] supposed to come back regarding the the [1:13:41] fees CU right now those fees that are [1:13:43] highlighted is 2550 75 they're [1:13:46] highlighted but not changed because we [1:13:48] were waiting for that number um that's [1:13:53] so with that mind um you could table [1:13:58] this until two weeks and and you know [1:14:01] the effective date would still be [1:14:02] January 1st to get that full report but [1:14:06] it my recollection that's okay I didn't [1:14:07] put any new numbers into that part of [1:14:10] the the proposed ordinance because that [1:14:12] we didn't get there was a do out from [1:14:15] the the PD regarding additional numbers [1:14:18] that was my [1:14:21] recollection essentially comparing other [1:14:23] municipalities and and first [1:24:16] so there's a couple months to address [1:24:18] those [1:24:21] concerns and yes we can follow the um if [1:24:24] we need to to kind of find out where we [1:24:26] are in terms of receiver and are we [1:25:13] paying them are we compensating them [1:25:16] enough for what they're doing in terms [1:25:17] of their [1:25:19] position the question across the table [1:25:21] was uh we don't know so I disc [1:25:24] discussing with the mayor last week here [1:25:25] at the table was like to call for a [1:25:28] study to see where we are in terms of [1:25:30] compensation for [1:25:32] management and the discussion was to [1:25:35] move a resolution to kind of authorize [1:25:39] this uh this [1:25:41] study am I missing anything on that I [1:25:44] think [1:25:46] I go ahead I think we did also say that [1:25:49] we could still move forward with our [1:25:50] budget discussion as is and then um r [1:25:54] return to this you know if we needed to make any adjustments or [1:25:58] whatever that because we couldn't do the [1:25:59] market study in time to continue our [1:26:02] discussion that is correct yeah this [1:26:04] will not affect our budget 2025 budget [1:26:06] is more of a study to see where we are [1:26:08] in terms of compensation for management [1:26:11] yeah and that will come back to us and [1:26:12] then we as a council will discuss that [1:26:14] what do we [1:26:18] do so what I would like a resolution to uh carry out this study [1:26:27] I'll make a resolution I think we talked [1:26:29] about the office of Human Resources you is the two other [1:27:35] streets um neighborhood sorry street [1:27:38] that we have mhm and I would like the [1:27:40] council to um recommend that we move [1:27:43] forward to direct the assessment office [1:27:48] and the Law [1:27:50] Department to review these petition [1:27:54] and to come back to the council with any [1:27:56] finding [1:27:58] whatsoever so that we can able to start [1:28:00] work with these um neighborhood [1:28:03] leaders to identify and to put things in [1:28:07] place so that we can get these two um [1:28:10] Street in for the sidewalk program for [1:28:14] 2025 [1:28:17] 2026 go ahead please do we have an [1:28:19] updated one for Ms street I was [1:28:22] submitted in 2010 [1:28:24] yeah we do have a couple fiction there a couple [1:28:30] of I see streets receiv in 2023 which is [1:28:34] great [1:28:36] yeah there's a lot of part in terms of [1:28:39] Adry but yes review what we have and [1:28:42] then we can ask them for updated um in [1:28:45] terms of if they are changing the [1:28:46] address changing name similar to what we [1:28:49] did in Central Parkway there people you [1:28:51] know changing ownership so we'll have to [1:28:53] reach out to the new owner and kind [1:28:56] asked them for the permission to sign [1:28:58] onto this sheet something similar we did [1:29:01] all of us did at um Central Parkway I [1:29:03] mean M it be it be M it would be fair [1:29:06] for us to go back and ask them to redo [1:29:08] all this petition they have done their job it's it's a hard process [1:29:12] absolutely they went out there they got [1:29:14] petition it's you know no fault of all [1:29:17] of us that it takes so long yeah it took a while for us to address it and [1:29:23] here we are in terms of moving forward [1:29:25] and to address um the sidewalk program [1:29:27] and then we'll review Mullen Street as [1:29:29] well because it's over a year and a as [1:29:31] well B Street will be um that is the [1:29:34] purpose of us moving forward to address [1:29:37] good thank you go ahead please so um as was pointed out there's so this is [1:29:42] 2020 excuse me 2010 that this was done [1:29:46] and um so people may have moved I know [1:29:48] some people actually I know but some [1:29:50] people are no longer living living [1:29:53] period um so what is going to be the [1:29:56] process um you did kind of mention it [1:29:58] before about so what is going to be the [1:30:00] process in terms of updating it are we [1:30:02] going to use our our tax roles at this [1:30:05] point to see if who we need to go how we [1:30:06] going to yes correct yeah that's how um [1:30:09] it's done so the assessor office will print out a role theti Street and [1:30:13] then it will review by The Corporation [1:30:15] Council that's how it's done in the past [1:30:18] and if there if the names doesn't match [1:30:19] here then we'll have to go back out and [1:30:21] get the new owner to sign up [1:30:25] if they decide to go with the program [1:30:27] but have the community leader go back [1:30:28] out on help to get petition updated [1:30:31] petition for those um change in when [1:30:35] okay so that's where we're going that's [1:30:37] our starting place okay thank you is the [1:30:40] same is still the same program like a [1:30:42] doll 55 L whatever [1:30:46] okay5 going to be being are we [1:31:17] going to absorb the additional cost if [1:31:18] there is one and I imagine with [1:31:20] everything going up that there is or or [1:31:23] going to be increased in um what the [1:31:26] homeowner has to pay I think that those [1:31:28] are things that have to be considered as [1:31:29] we move forward with [1:31:35] this yeah it was one of the suggestion I [1:31:37] made last week in terms of the the AR [1:31:39] money that um we're we're hoping that [1:31:42] will come back to us we can able to as a [1:31:44] council with the mayor put some money in [1:31:46] that program back at that point in time [1:31:48] to see if we can help these uh these [1:31:51] areas to address the sidewalk [1:31:54] and yes we can address the cost at that [1:31:56] point in time and we move forward do we amend it and change it from $55 [1:32:02] upward good suggestion and we we can [1:32:05] address that as we move [1:32:09] forward go ahead please I just say it's [1:32:11] important as we've already started kind [1:32:13] of allocating projects to this Aram [1:32:16] dollars that we haven't even received [1:32:17] yet I just want to make sure we're [1:32:18] intentional with how we're prioritizing [1:32:21] the conversations we're still going to [1:32:23] have and hopefully an [1:32:30] hour I'm sure would we will address that [1:32:32] then I think there are some capital um [1:32:35] money in the capital budget for sidewalk [1:32:37] program still some well there was some [1:32:39] money that was bonded for this type of [1:32:42] uh undertaking specifically and you were [1:32:45] not able to find the petition for [1:32:46] Raymond Street no I can't I looked all [1:32:49] the email and if anybody's listening if [1:32:52] anybody council considers changes to [1:35:10] chapter [1:35:12] 264 um public hearing will be held on [1:35:15] but that date can't be correct it's 1021 [1:35:22] 1028 Madam president um if I can just [1:35:24] speak a moment on that real quick goe uh [1:35:28] I in your packets this week is the [1:35:30] ordinance that's that's the moratorium [1:35:33] ordinance it's modeled after the Vape [1:35:35] Shop ordinance that uh you passed [1:35:37] earlier this year um you'll notice that [1:35:40] there's uh additional definitions put in [1:35:42] there for cannabis establishment micro [1:35:45] business on-site consumptions so it's prospectively looking ahead as to [1:35:51] the various licenses that may come come [1:35:53] our way so when we're doing the review [1:35:57] uh of the uh the zoning code we'll be [1:36:00] looking at those definitions and uh uh [1:36:03] and [1:36:05] uh that at some point that'll be [1:36:07] incorporated into our zoning code um not [1:36:11] already done some of those are already [1:36:13] in the code from as you remember from [1:36:15] back in the Vape but some of those are [1:36:17] not like onsite consumption and micro [1:36:19] business for example and uh [1:36:24] so um if there's anything as we begin [1:36:27] this process I've had discussions with [1:36:28] the the planners in development about [1:36:31] the the way ahead here if you have [1:36:34] any areas that you would like to see [1:36:36] these not see these uh by way of review [1:36:39] real quick um the uh vape shops are in [1:36:42] the industrial zones M1 M2 and the [1:36:45] commercial zones [1:36:48] uh C4 and C5 um which is downtown and [1:36:52] the Upper State Street commercial [1:36:55] Corridor [1:36:57] um if you want you always looking to [1:37:00] expand some of these establishments in [1:37:02] the C3 Waterfront District which is the [1:37:05] harbor area um that area that Waterfront [1:37:08] development District I'm just throwing [1:37:10] that out there I'm not saying anything [1:37:12] one way or the other but um what areas [1:37:17] you would want that like as I said C4 [1:37:19] and C5 vape shops M1 and M2 vape shops [1:37:22] if you want to have these in those areas [1:37:24] or you want to have them some other [1:37:26] areas depending on the type of [1:37:28] establishment based on their [1:37:30] definitions um please send me you know [1:37:34] as as a group send each other an email [1:37:37] to me and so we can take your concerns [1:37:41] as we start drafting this and at some [1:37:43] point [1:37:44] probably um November December get some [1:37:48] sort of working draft ordinance for you [1:37:50] to take a look at um start working on [1:37:55] that this uh this will this ordinance [1:37:58] will take effect on November uh your [1:38:01] next meeting is the 12th so it would be [1:38:04] the next day which would be November [1:38:06] 13th and would go into February uh 11th [1:38:10] February 11th which is approximately 90 [1:38:14] days so so it's a day certain so [1:38:17] everybody knows nobody's counting days [1:38:19] on calendars or anything like that it [1:38:21] says when when it's going to expire [1:38:24] good so I just wanted to throw that out [1:38:27] there for you on that point um and if I [1:38:31] can go on to the next one the the if I [1:38:33] can what's the next one meeting the the [1:38:36] uh the comment period for that location [1:38:40] on Broadway um so no okay okay just I [1:38:46] want I want to just say a couple things [1:38:47] about this one we kind of have this [1:38:50] discussion I just want to make sure [1:38:51] there's Clarity for individual ual who [1:38:53] will already have their license by the [1:38:56] state of New York right are they will [1:39:00] they be impacted by [1:39:01] this I know that there's some people who [1:39:04] don't have their license but have [1:39:05] submitted to us for our [1:39:07] location and what would the difference is what we can control is [1:39:13] pursuant to the ordinance is that if [1:39:16] they have filed paperwork for a [1:39:18] certificate of use or site plan Etc by [1:39:23] our start date of [1:39:25] November uh [1:39:27] 12th then we have to proceed with that [1:39:31] okay we have to proceed with that [1:39:32] because they got their uh requests in [1:39:36] before the moror okay so they may still [1:39:39] be working with our working with the [1:39:42] Office of cabis Management but they have [1:39:44] submitted that um request for site plan [1:39:47] certificate of use any of those listed [1:39:50] uh items under the uh moratorium then we [1:39:54] have to process that all the way through [1:39:56] oh okay and um the other thing we as we [1:39:59] had had this discussion before you said [1:40:01] that you're going to be looking to ocm [1:40:03] the office of cannabis management to [1:40:05] make sure that what we're doing here is [1:40:07] not outside of what we are allowed to do [1:40:10] based on what their guidelines are that [1:40:11] that's that's correct and we got to you [1:40:13] know there's as you know there's certain [1:40:15] distances that they have put into the [1:40:18] regulations those are the regulations [1:40:20] and that's what we got to do um the Town [1:40:23] of Babylon as you know that was our Vape [1:40:25] Shop model um they had a uh they had [1:40:28] conversations with the office of [1:40:30] cannabis management and they had a uh [1:40:33] they U set [1:40:35] a a uh a distance of 750 ft from a [1:40:40] residential district that the office of [1:40:43] cannabis management was okay with so [1:40:45] just putting that out for an example so [1:40:49] as we go through this and as we really [1:40:52] get into the uh the details of what we need to do um [1:40:57] we'll give you the uh uh updates and [1:41:01] then if necessary reach out to office [1:41:04] Canabis management for for guidance on those issues but I'm just that was [1:41:09] something that another municipality did [1:41:12] in in in in working up their [1:41:15] code other any more any other questions [1:41:18] regarding this [1:41:20] item okay so we'll have that public [1:41:22] hearing on the [1:41:23] 28th uh the next item is discussion of [1:41:26] ocm 30-day notice for 10 excuse me 1708 [1:41:30] Broadway okay there we go um as part of [1:41:34] the application process under rule 11 [1:41:37] 19.3 um as part of the application [1:41:40] process that goes before the office of [1:41:42] cannabis management and the Bureau of [1:41:45] can Bureau of cannabis control um the [1:41:49] municipalities is afforded an [1:41:50] opportunity to weigh in on a particular [1:41:52] location [1:41:54] um we have a 30-day this was filed last [1:41:56] week this is a location [1:42:00] uh on Broadway I believe it's the it's [1:42:03] the Old Key Bank building on the top of [1:42:07] uh Broadway so that just to be an idea [1:42:12] um we have we the city as 30 days you [1:42:15] have take a look at it if you have any [1:42:18] questions concerns comments Etc um we [1:42:22] can [1:42:23] we when I'm saying we the Law Department [1:42:26] can funnel those questions uh to the [1:42:31] Office of candidas Management for their [1:42:34] review and uh and uh if they have we [1:42:38] have any concerns regarding that [1:42:40] location then as part of the review [1:42:43] process at their level they have to [1:42:45] address our [1:42:47] concerns so um right now there'll be [1:42:50] Friday the 15th of November is the [1:42:53] 30-day deadline so I would you if you [1:42:56] have any issues concerns um we can check [1:42:59] back here in a couple of weeks if if you [1:43:01] want to discuss this [1:43:04] um in further detail if you've thought [1:43:07] about you know whatever your concerns [1:43:09] are and then we'll make sure we'll get [1:43:11] those to the uh cannabis management uh [1:43:14] agency before the [1:43:18] 15th so in in terms of municipality U [1:43:21] replying that does not take into we [1:43:24] don't we don't have to do anything by [1:43:25] asking the public we don't have to get [1:43:27] public just say this is the way they [1:43:29] view this is know as a 30-day comment [1:43:33] period from the community board or for [1:43:36] the from the government so this is [1:43:38] purely a uh uh as the policy makers for [1:43:42] the [1:43:43] city giving that process so it's a very [1:43:46] short window um so uh so whatever [1:43:51] concerns you have as a group yes I don't [1:43:55] recall that happening um with the [1:43:57] opening of the one on State Street well [1:44:00] that they that was I'm just is this no [1:44:03] that was that was [1:44:06] actually well on its way you because but [1:44:11] I think as as we go through this process [1:44:14] mward we're we're moving forward that [1:44:16] this is this the clerk gets it it's [1:44:19] distributed it's 30-day period so I [1:44:21] think um as the role out of this process [1:44:24] has gone through um I think that uh um I [1:44:29] think going forward will be a better way [1:44:31] of [1:44:33] having okay but that that was a [1:44:37] uh that was moving along and I think we [1:44:40] got something maybe in July at that [1:44:42] point and uh so but that was [1:44:47] already [1:44:49] processed so so I think I think from [1:44:52] both local level as well as the state [1:44:55] level we're getting in the [1:44:59] syn you're right Mr T that wasn't it [1:45:02] didn't it didn't go through this process [1:45:03] and although I just want to be clear [1:45:05] that we all of those things were [1:45:07] received in the Law Department in terms [1:45:09] of yeah and we [1:45:33] one on Union Street was on the uh was [1:45:37] well well long before and we got it in [1:45:41] July so in terms of that that one in in [1:45:45] 501 State [1:45:46] Street because dasne was in involved the [1:45:49] dormatory authority was involved with [1:45:51] that [1:45:53] is that why they had the opportunity to [1:45:55] just wait so long don't I don't know [1:45:57] okay I
