council president raising [3:53] a question on that but that just [3:54] happened it's still in the code [3:57] requiring that to be a standing [3:59] organization where we take references [4:01] from and so at this point [4:05] to look to be able to get a quum on the [4:09] board would ask for the council to move [4:12] this forward well the email said that [4:15] they're disbanding it and deactivating [4:17] it for now so sun's not even going to [4:18] meet until they can get a number of [4:20] people there the email that Lori sent [4:22] and um she's going to send it to the [4:24] entire Council I just was got that one [4:26] which I forwarded to you so I would hope [4:29] that we could wait until they made that [4:30] final decision before so you're going to [4:32] change the criteria for the police [4:35] Community review board also we would [4:37] have to if they're going to deactivate [4:39] because they're on it's in the cold that [4:40] they are part of them but they're saying [4:42] they're not going to meet anymore [4:43] something that we don't have control [4:45] over so if we could just wait until they [4:48] she's on vacation right now and she [4:49] comes back and we can have that [4:51] conversation on what that would look [4:52] like and hold up until [4:54] then Mr um I have been in contact with [4:58] the chair for the even prb unrelated [5:00] this issue I will be attending their [5:02] upcoming meeting in March I know they [5:04] had a number of suggestions for changes [5:07] so I don't think that would be uh that [5:10] fall in line with addressing and [5:11] bringing up this issue as [5:17] well so I was wonder if we could just [5:19] hold it for two weeks until m m uh the [5:21] president of of sun comes back and have [5:23] a conversation with her and I don't know [5:25] if we'll need to change the code but [5:26] they she her email clearly was that [5:28] they're going to not be meeting [5:32] okay I don't have any problem with that [5:34] I don't have the information any other [5:35] questions comments concerns around that [5:38] I'm go to okay all right I'll bring you [5:41] back two weeks um second item this is the code so this [7:37] is [7:38] the and because the reason um is that 12 [7:43] noon is because the legislative [7:44] conference happens at 1:30 1:45 so Sam's [7:47] given that additional working um with for quite some time for [9:18] a couple years now and finally we were [9:21] able to pass the noise amended noise [9:24] ordinance and I think it's fitting that [9:26] we um we also passed um look at a formit [9:30] application that we put in place so that [9:32] we do not deny someone who would like to [9:35] do a 5-year-old birday party in the [9:37] backyard but at the same time we want to [9:39] put things in place that we can hold [9:43] these private events in your backyard [9:47] but at the same time have respect for [9:49] others in the surrounding neighborhood [9:51] so what we have here and I want to thank [9:53] Corporation Council and staff for [9:55] working with this and put this together [9:58] and chief Clifford and team to review it [10:01] and to come back with changes to the [10:03] coporation council and to kind of um [10:07] preliminary um agree with the format [10:09] that we have in front of us here so what [10:11] we have here I would like to just you [10:13] know open up for discussion review and [10:15] if you would like to suggest any changes [10:18] or you would like to add anything or [10:19] delete any any stuff let us know applicant just just [11:54] putting us on notice this is a [11:56] fundraising event or is it's a [11:58] professional fundraiser is going to be a [12:00] fundraising EV if you don't want to have [12:02] that in there you don't have to have [12:03] that in there that was something we saw [12:05] in some of the applications out on one [12:07] Island they have that mhm cuz I would [12:09] think that there might be you know um [12:11] smaller Grassroots organizations that um [12:15] I I guess is that going to influence a [12:17] decision about whether somebody gets a [12:18] permit because just as an example [12:21] someone might be having an event at The [12:22] Pavilion at Central Park for example and [12:24] they might just be a [12:25] Grassroots volunteer organization that [12:28] doesn't have um staff at all or [12:30] professional you know you know what I'm [12:31] saying so I'm not sure if we need that I [12:34] guess what I'm I mean if go ahead so I [12:37] think it's just for a point of [12:38] information I don't think it's going to [12:39] prohibit them from from smaller groups [12:42] that you talked about from doing it it's [12:43] just for our information to know who's [12:45] actually putting it on is how I see that particular question okay and then [12:50] um just two other things one is um in [12:53] terms of the proof of identity which I [12:56] think it needs to say proof of identity [12:58] but um same on still on page one down a [13:03] little bit got it um just wanted to [13:06] inquire about that so I want to make [13:08] sure that we're not um putting up a [13:10] barrier um you know if someone doesn't [13:13] have a driver's license I know it says [13:15] other form of photo ID but you know that [13:19] might be a passport um but I mean what [13:22] would be the other acceptable photo ID I [13:24] think the the beauty of that is official [13:26] it it doesn't limit you [13:29] from an official means some sort of [13:31] government entity whether it be a [13:33] passport or Sheriff's ID or a driver's a [13:35] non driver's license ID issued by Motor [13:39] Vehicles something like that so the so [13:41] the because we are asking the [13:45] individuals to be have a responsible [13:46] contact responsible person Etc this is [13:49] just a matter of confirming that we'll [13:51] take some sort of official ID so the [13:53] person who's signing this is who they say they are so it's it's I think [13:59] by saying official photo ID we're not [14:01] limited to any particular Source but it [14:05] has to be a government and I think [14:07] that's implied okay and then my final [14:09] thing is um [14:12] whether we need to ask someone's age I [14:15] mean would there be um you [14:19] know if it was just a teenager with no [14:21] parent or Guardian um is that something [14:24] that we want or once again I think it's [14:26] for situational Awareness on [14:30] right no we we don't have that on here [14:32] we don't ask we don't ask them for their [14:33] age I'm not again I'm not trying to put [14:35] up barriers but I just want [14:37] to I I don't you [14:41] know I we have not asked and you're [14:44] saying we should ask is that what you're [14:45] saying I'm not sure I mean again must be [14:49] over yeah that's what I was if it's [14:51] using a public space if it's using no [14:53] these are private um private this is not [14:56] for public space these are for private [14:59] um private events then maybe somebody [15:03] would need to have a parent or Guardian [15:05] so whe rather than ask someone their age [15:07] we could if if if you feel there's a [15:09] stipulation there should be a [15:10] stipulation that younger a person under [15:13] 18 let's use that it for example then we [15:15] could always put in there that um [15:17] permits are only issue to individuals 18 [15:19] and older well or have a parent or [15:21] Guardian signature or something the that [15:24] means that the parent would have to get [15:25] the permit maybe the parent would be the [15:26] getting the permit that's not a bad IDE [15:29] yeah right so why don't we just add [15:31] applicant must be over 18 yeah we I just [15:35] good point good point no that makes [15:37] sense so we can just put applicant must [15:39] be over 18 years yes any other questions [15:43] or comments um M Toro thank you so I I [15:48] again will there be a cost associated [15:51] with this yes that's what I was going to [15:52] address we discuss it but um we just [15:55] want to bring it to the council um there [15:57] is no cost in the there is no fees for [16:01] this I mean the the sound noise [16:06] ordinance does not set a fee it says [16:10] that that it this is issued by the chief [16:12] of police and it does not set a fee so [16:15] whether you want a set a fee that's [16:16] going to require an amendment to the [16:18] city code right now this is in keeping [16:21] with the code this is this is an [16:23] application based on the code if you're [16:26] looking to formalize through a fee then [16:29] you're going to have to have a public [16:30] hearing and then the ordinance is going [16:32] to be have to be amended so it's up to [16:35] you what you want to do on on on that Mr [16:38] I was say can can I finish I have a few [16:41] questions is that was it an additional [16:44] question or were you going to comment on [16:45] that additional questions I think people [16:47] going to comment on that response okay [16:50] Mr so quickly what I was going to say is [16:52] that um this seems like a tool so in [16:56] case there's somebody at their house and [16:58] having an event [16:59] and it's loud and police have to respond [17:01] and therefore we have a record of the [17:03] point person who we can say listen you [17:05] know this is the person in J in charge [17:07] of this event so I think that that was [17:09] the purpose for this more than uh trying [17:12] to uh further tax people have another [17:15] fee I don't think that that's the [17:17] intention and then Mr M yes and exactly [17:20] to the point when this was discussed [17:22] initially is how do we utilize our [17:24] police resource in a better way rather [17:26] than we sending to office or there just [17:28] to tell someone loading music down here [17:30] we have information on the desk and [17:33] precin to call this individual to let [17:35] them know that you're you know music is [17:37] loud we're getting complaint you need to [17:39] turn it down if you don't turn it down [17:40] we have to come out here we're going to [17:41] have to issue a citation so this is kind [17:44] of like helping to kind of utilize or U [17:47] the Staffing in a better way at the same [17:50] time um in terms of fees yes we did [17:53] discuss it initially but um we didn't [17:55] arrive we were talking about 100 we're [17:57] talking about 50 we were talking [17:59] $25 so I say let's bring it to the [18:01] counil and let's see what collectively [18:04] we can add because yes this will will be [18:08] taken away sometime to put the permit [18:11] together and things like that and to [18:12] kind of like Mand this in a way that you know if there has to make calls and [18:17] things like that so this this individual [18:19] which we hope not um so I think um I [18:23] have in agreement that we put a fee [18:25] attached to this but how much I will [18:28] defer to to my colleagues to say what [18:30] about the best possible fee we can [18:31] attach here and at the same time yes [18:33] once we put a fee to this we'll have to [18:35] call for a public hearing so I'd say in [18:38] my response to that I would kind of [18:40] respond the the opposing I don't agree [18:43] with us putting in place a fe I think [18:45] especially in a year where taxes both in [18:47] the city and county I think there was an [18:49] article saying that those have increased [18:51] I would agree with Mr Farley that this [18:55] my support for this was to provide a [18:57] clear means of addressing just um [19:00] excessive noise and then also providing [19:02] the police as you highlighted with the [19:03] point of contact I think if we attribute [19:05] a feed to this too early I think it [19:07] might deter people from processing [19:09] forward with these um again I would look [19:11] at this from a cost savings to your [19:13] point Mr M if officers have this [19:15] information at the beginning um this may [19:18] make it easier for them to address potential uh calls for excessive [19:22] noise and I know Mr turo had additional [19:25] points but mine was going to say to add [19:27] in a component that required or expected [19:30] anyone submitting for a permit to notify [19:33] their adjacent neighbors just so that [19:36] ensures that there is just clear [19:37] communication all [19:42] around we can add that about the [19:45] application applicant acknowledgement [19:47] form we'll just add that and bold you [19:49] know a whole bunch of acknowledgements [19:51] down here we just add that Mr Carl um [19:56] thank you so I guess uh my next question [19:59] would be um we know that the response [20:02] time for police for noise complaints can [20:04] be very [20:05] lengthy um who intends to make these [20:08] phone calls and um having a party do you [20:12] think uh the individual hosting the [20:14] party has a cell phone on them all the [20:16] time and if the music's Lou are they [20:17] going to be able to hear the phone call [20:19] which would prompt a visit from the [20:20] police anyway meanwhile the neighbors [20:23] next door are trying to enjoy an [20:25] afternoon um of peace after a hard week [20:29] of work or whatever gardening and [20:32] there's loud noise I probably have more [20:35] noise complaints and a combination of [20:38] all of you sitting around the table from my neighborhood at times uh where [20:42] the complaints are addressed 2 4 6 8 [20:47] hours later and only because that our [20:50] Police Department is busy making other [20:52] calls in the city I'm not in favor of a [20:54] permit to make noise um I just don't [20:59] think uh it's something that we should allow especially [21:04] just we're going to tell you there's six [21:07] points now that we just passed for noise [21:11] but yet you where you're allowed to make [21:13] noise if someone says you can make noise [21:16] at a certain hour I I just don't think [21:18] that we should have a sound here in the [21:21] city Miss bfield so I don't I don't see [21:24] this as a permit to make noise it's just [21:26] trying to regulate because they because [21:28] the noise is already being made the [21:30] noise is already being made I'll finish [21:31] my point and so this isn't u a permit to [21:35] say hey you can make noise cuz they're [21:36] already doing it this is a way for us to [21:38] keep track of what's going on and and [21:40] also we just added that the neighbors [21:42] would have to be informed so this is [21:44] just what for us to try to get a better [21:45] handle on what's already going on and [21:48] making people aware that you're you [21:50] signing this permit that you will go by [21:51] these guidelines that you will inform [21:53] your neighbors and those things it's [21:55] already happening we're just trying to [21:57] essentially regulate what already [21:58] happening not not saying make more noise [22:01] cuz I am not going to pull a permit to [22:03] make noise I don't I don't do that now [22:05] and many of my neighbors don't do that [22:06] now so I'm expected to start happening [22:09] since we have this so who who who Mr [22:11] mudon will be responsible for calling [22:14] these individuals that are hosting a [22:17] city code um is clear that the police [22:19] department is responsible for this this [22:22] forment must yes I mean and just to [22:24] follow up on the council president's [22:26] earlier comments the individuals by [22:29] acknowledging you still have to comply [22:31] with this connected city code in fact [22:33] they're giv a copy of the ordinance and [22:38] they still have to comply with the you [22:41] know the the the sound re you know you [22:43] know this the sound the noise limits as [22:47] set forth in that code this doesn't give [22:49] them an exemption this this is just [22:51] saying this is what we're doing we're [22:54] putting you on notice this is what I got [22:56] to do and is just for for us and the [22:59] city to go out and if there's any issues [23:01] they have a point of contact in which to [23:03] reach but in order to get this there [23:06] they're getting given a copy of the code [23:08] and the acknowledgement says and says I acknowledge the sound reproduction [23:12] rules of section 1824 J applied [23:15] regardless of a sound permit any [23:18] violations of disconnected noise ordance [23:20] will be prosecuted so it's putting them [23:22] on notice in sound reproduction is um [23:26] you know noise you know between the [23:27] hours 11 p.m. and 6:00 a.m. the [23:29] following day I mean you can go through [23:31] all the requirements of that section [23:34] dealing with that applies and they're [23:37] put on notice that [23:39] applies so they that's it's it's it's a [23:44] point of contact it's putting them on [23:46] notice and uh uh the noise ordinance [23:50] requirements all comply uh before [23:53] switching to Mr mudaron I would say I [23:55] think an underemphasized point from our [23:58] previous Year's budget proceedings was [24:00] the fully um fully approving the [24:04] budgeted request from the fire [24:06] department and the police department so [24:07] on paper they have all of their [24:08] requested positions now does that mean [24:10] they have them in departments no because [24:13] there's some individuals going through [24:14] the academy however that pipeline was [24:16] fully funded so I'd say the expectation [24:19] very much is for them to respond based [24:21] on their priorit of calls but I would be [24:24] hesitant to not enforce this sort of [24:27] progressive measure based on the [24:29] perceived challenges or obstacles again [24:30] to miss porterfield's point I think [24:32] having information on the front end [24:34] ensures that any response is more [24:36] streamlined which is Saving Time Mr M [24:40] yeah um thank you Mr Brian for [24:42] clarifying this I mean on page three it [24:45] outlined that the requirements and the [24:47] followup documents that will be [24:50] accompanying this formit so in my words [24:53] it's not a free-for all I mean you have [24:54] to apply for this um this song format [24:58] it's not a noise formit it's a song [25:00] formit so we just need to clarify those [25:02] words because words matters and uh they [25:06] clearly um given um private um homeowner [25:10] an opportunity to have an event there [25:11] but at the same [25:12] time you are doing it in a way that does [25:15] not affect your M birs and the [25:17] information that is being that is being [25:19] put on the application is to help our [25:22] police department and I'm sure there are [25:24] police officers there at the desk that [25:27] can eventually identify this and we're [25:29] not going to have 10 15 20 formates per [25:32] week I mean this going to come in a few [25:34] formates for weeks but theyve been able [25:36] to manage it better and this is you know [25:39] that's how we looked at it in a way of [25:40] managing it and utilizing the resource [25:43] in a better way mrle yeah I think um [25:48] adding on to what Shar this is just this [25:50] is a piece this is about accountability [25:52] as well as efficiency so if you have so [25:56] if we're you know if the concerns there [25:58] are our um police officers limited uh [26:02] ability to respond to some of these [26:03] things and thank you for highlighting [26:04] that Mr that um the the request was [26:07] fully funded what this does is instead [26:10] of those to earlier point two officers [26:12] may be going to a house whatever you [26:13] have a point of contact so which makes [26:15] it more efficient so it really should be [26:17] doing um addressing another one of your [26:21] concerns around like well you know 2 to [26:23] 6 hours responding now if there's some [26:25] if a call comes in they can say let me [26:27] speak to Mr John hey you have your sound [26:30] permit here um to let you know that [26:32] there has been some complaints and being [26:33] able to mitigate that and and it's [26:35] really around that level of efficiency [26:37] and accountability for the person people [26:39] are far less likely to violate um the [26:43] code if they are going about it um and and doing this in the right way and [26:48] now it's the educational piece of hey [26:50] this is what the code is this is what it [26:52] says M [26:53] Patrick um I'm still thinking about my [26:56] question so Mr if someone doesn't get a [26:59] permit then what [27:01] happens same thing Happ well I mean my [27:04] answer to that would then they get shut [27:06] down because that's [27:08] required something bring automatically [27:10] we'll get somebody over there in 4 to 6 [27:17] hours but I I do know and I think at one [27:20] point when we've talked about these loud uh parties or music or Sound [27:25] or whatever you want to call it that happens in the neighborhood [27:28] I I believe that the police have the [27:30] ability to confiscate the equipment that [27:33] I right there are depending on the set [27:37] of circumstances yes and do we have any [27:40] way and I thought I I thought that they [27:42] said that they do have a deciel kind of [27:44] reading uh so that or if they can hear [27:49] it 50 F 50 ft so [27:52] 50 yeah it's the there's a DB [27:55] rating so many bells and also a what the common sense [28:01] component where if it can be heard so [28:04] many feet away within a certain 50 50 ft [28:07] yes yes and if it can be Hur in any [28:10] residence regardless of whether the [28:12] windows of the open are open or not so [28:14] it's 50 ft open or Clos it doesn't [28:17] matter if somebody's can hear it they [28:19] can hear it as they approach and it's [28:22] obviously so one more question so should [28:24] neighbors you know notify your neighbors [28:26] and your neighbors aren't willing they [28:28] might be having a little afternoon [28:30] brunch in the backyard and they're not [28:32] in favor of this I mean can they reach [28:34] out to the police department and say U [28:37] my neighbor is putting a request in for [28:40] a having a DJ birthday party in the yard [28:43] and uh I'm having something of my own [28:45] that won't be of any nuisance to anyone [28:49] um then what happens Mr far so wouldn't [28:54] I mean again I think it states really [28:56] clearly that you still even with [28:58] applying for this permit you still have [29:00] to operate within the existing [29:02] parameters of the code so that doesn't [29:05] take away any of that so if I put in for [29:08] a sound permit and my neighbor was [29:11] putting in for a sound permit and then [29:12] I'm having um tea in my yard and their [29:15] sound is still loud or louder than what [29:18] it should be then we still have those [29:21] existing graduated interventions that we [29:23] would have now so um it this doesn't in [29:26] any way shape or form allow people act [29:28] outside of the code as it exists this [29:30] just is another piece of accountability [29:32] and efficiency to make sure they do [29:35] so so should Che and every per they will [29:39] uh they will accompany the city the [29:41] section with regards to this uh the [29:44] noise every everybody will get a copy [29:46] everybody will have a copy attached to [29:48] the form it so it's really going to be [29:50] defined in there and they're going to be [29:52] knowledgeable to know that you know if [29:55] there are things that stipulate how do [29:57] we conduct ourselves not because you [29:58] have a permit you are free to do [30:01] whatever you want there are also [30:03] limitation Mr [30:06] Mayor I'll defer to the council member [30:09] Mr oh thank you so where will they will [30:12] the permits be available online will [30:14] they file in the F office or the police [30:16] department they'll be filed with the [30:17] police department because the current [30:19] code says the police chief or their [30:21] designate will issue it so it's a matter [30:24] of working up the rules and regulations [30:27] that the internally with the police [30:29] department but the code already says the [30:31] police chief can make rules and [30:32] regulations to implement [30:36] this uh Mr Mar [30:38] yeah [30:40] again in terms of quantity sometimes we [30:44] get uh 8 10 15 sometimes 20 calls for [30:47] noise backed [30:49] up uh to make this [30:52] enforceable I don't believe you can [30:54] allow just anybody to apply for the [30:58] perit it has to be a property owner [31:01] somebody who has dominion and control [31:03] over the site and that if in fact there [31:07] is a poor choice in their judgment that [31:13] the strength becomes you ability to go [31:15] back [31:16] and they are fined cuz you get there the [31:20] police get there and say oh uh it's not [31:22] me it's John mudon that started this [31:26] permit but he left an hour ago oh no [31:29] it's uh Carl Williams that did it you [31:31] get this circular debate from people who [31:34] are doing these events and you have to [31:37] be able to have some ability to assess [31:40] the penalty and go back to the property [31:44] owner is what I believe the strongest [31:48] message that we can send to try and get [31:50] compliance from this m and I think one [31:54] of the idea that we asked for the ID the [31:56] ID matches the address uh for the [31:59] applicant so can then that brought one [32:02] question should we say resident and [32:04] non-resident or should we remove the [32:07] non-resident because that's a a good [32:09] point brought up by in terms of buy you [32:13] know linking this to the [32:14] homeon or the person who's living at [32:17] that address sorry I should broaden that [32:20] Miss Patrick I guess you could change I hear what you're saying and that's a [32:23] good point but if they're the owner [32:25] might be the non-resident in other words [32:27] so it might just the the semantical [32:29] semantics in terms of owner or or or [32:33] something like that but that's a that's [32:35] a good point and the only other question [32:37] that I had was um a process question of [32:40] did did you um talk about this with with [32:44] the police department yeah [33:17] you have to produce the permit that's [33:19] been issued um and in terms of homeowner [33:22] or resident or whatever we're going to [33:24] call them I guess for me the question [33:26] becomes what if it's a PR event but it's [33:28] at a it's someplace else it's in it's at [33:33] a different venue rather than someone's [33:36] home then it's not the homeowner but it [33:38] definitely with the ID and whoever those [33:41] things should match but the question [33:42] comes up again what if it's I'm not [33:44] holding it at my home I'm holding it [33:46] someplace [33:48] else I um go [33:50] ahead yes I mean there is a responsible [33:54] party has to be on premises Point time [33:57] so there has to be they're they're agreeing that you know they're [34:02] consenting to the inspection as well as [34:04] that the responsible P [34:06] primary party or primary point of [34:08] contact shall be at the premises at all [34:10] times wherever the premises is right yes [34:13] that's where we're talking where this [34:15] point is okay and um my other this is [34:19] food for discussion do we want to add [34:22] something that says if after a violation [34:25] or a number of violations that people [34:27] are no longer [34:28] issued permits for a certain amount of [34:29] time well though then we would have to [34:31] change the code for that there's nothing [34:33] in the code right now so you want you [34:34] would have to the code okay Mr U thank [34:38] you so I I do like the idea of the [34:40] property owner for sure um having to get [34:43] the so if it's hold off premisis like in [34:46] a park a lot of people have things in a [34:48] park do they need a permit to use the [34:50] Park area they already do that's already [34:53] done Park Department right so they'd [34:56] have to um [34:58] you know being in Central Park and up at [35:01] Hill h a lot I mean there's just a lot [35:03] of um it it's beautiful you know uh [35:05] individuals who decide that day they're [35:07] going to just set up overide the duck [35:10] pond and have themselves you know little [35:13] canopy bring a barbecue you know all the [35:15] kids are there they got music flaring I [35:17] mean is that being enforced that they [35:19] have a permit to be there at that [35:22] time and now with a sound permit as [35:25] well you just brought up premises I'm [35:28] wondering Miss Patrick I think it more [35:31] is just um on the public um on the for [35:34] example just to stick with the Central [35:36] Park it's the Pavilion I mean it's know [35:39] if they were on the you know the grass [35:41] um somewhere in you [35:44] know near the rose you know on the other [35:46] side of the Rose Garden I don't think [35:48] you required to have a permit to use the [35:51] public facility in aart I'm sorry [35:53] interrupt is a news person from Channel [35:54] 13 supposed to see you at some point did [35:57] you do you know anything we're [36:50] taken in so we're making some adjustment [36:52] here so added to this application is [36:55] applicant must be over 18 years [36:58] and you must notify adjacent neighbors [37:02] and um thank you for your point U permit [37:05] must be posted so that way it's visible [37:07] that uh if the police happen to show up [37:09] there well they already know that [37:11] there's a permit but it must be visible [37:13] to others to to notify the the [37:15] surrounding [37:17] neighbors I'm still going to go back in [37:19] terms of the cost I mean this across the [37:22] board if you should not be charging or [37:23] just could be pastro [37:28] M bfield I'm I'm not in favor of [37:29] charging at this point Mr Farley and [37:32] know Miss [37:35] Patrick so I yeah I I think that right [37:37] now this is again about accountability [37:39] and some level of efficiency so at this [37:42] point I think that we don't need to [37:44] assign a fee um to it uh because if [37:48] anything this operates in the way we [37:49] think it will make the enforcement of [37:51] the existing noise ordinance uh easier [37:55] to enforce without having those [37:57] resources out so I don't see the logic [37:59] behind the signing a feed to it at this [38:03] time I mean I'm fine with that I think [38:06] that um you know they'll have to pay a [38:07] fine which is in the ordinates if if [38:10] they you know break this [38:13] it Mr [38:17] Toro M uh Mr chairman you could always [38:20] revisit this issue and add a fee and [38:23] like to see how this rolls out and if [38:25] you feel you want to add a fee to it you [38:27] can do it a later date so you have that [38:31] op U just being responsive to Mr M's [38:34] question um Mr to you response um I'm [38:37] not in favor of the permit to begin with [38:39] but I if anything that has to generate [38:42] time and paper and energy into um having [38:46] a permit issue should be charged to [38:51] fee and I just say uh in response to [38:54] that U definitely reating what Mr [38:56] highlighted this is a living document um [38:58] just because something has passed [38:59] doesn't mean it's going to fully address [39:01] all the issues so I think it's going to [39:02] require us to continue to UM Vet any [39:07] complaints or U comments that we reive [39:10] in regards to this and just as a city [39:12] it's our requirement to be responsive to [39:14] those in Good [39:16] Nature Patrick yeah that was kind of [39:18] what I was going to say was um maybe you [39:20] know once first of like when would this [39:22] go into when would this start and then [39:25] um could we have an evaluation period [39:27] you know set something like 6 months or [39:29] whatever I don't know but um where we [39:31] come back and um evaluate whether this [39:34] is working or you know what are the [39:36] tweaks that type of [39:40] thing is this is this change the the [39:44] code in there and in [39:49] the existing fee structure for say the [39:53] street closing perits or is that able to [39:58] be done by resolution [40:01] or by ordinance Chang got be ordinance [40:04] especially for this [40:06] because right now it's the noise [40:08] ordinance doesn't have it never created [40:10] that so it's just the council or time [40:13] has always tried to move away from the [40:15] change by ordinance but to be able to [40:18] change it by resolution so that if you [40:20] were putting it in it just simplifies [40:23] the process down the road what what you [40:26] could do do going forward is amend the [40:31] code allow for the fee and then say any [40:34] subsequent changes to the fee will be [40:35] done by [40:37] resolution but still I mean that's going [40:40] forward if you decide to do a [40:42] code Mr chairman just for the you know [40:45] for the short term I will go back take [40:48] the revisions that were discussed here [40:50] tonight and then two weeks I'll give you [40:53] a final draft and then you can take one [40:56] last look and then you can just pass [40:59] that out the committee it doesn't [41:00] require any legislative action and then [41:03] our office the and affordable entertainment [44:10] truly evaluating them on their [44:12] commitment to uh mentoring and putting [44:15] in place a lot of Youth Development [44:17] opportunities truly speaks for itself so [44:19] I am uh calling in the existence that [44:21] this will be a successful partnership [44:23] and I hope that I will see you all on [44:25] their opening night on the 20 [44:27] I
