One nation [0:26] under God, indivisible, with liberty and [0:28] justice for all. [0:30] >> You may be seated. [0:35] » Clerk, would you call the role of [0:36] council members, please? [0:38] >> Layman [0:39] >> here. [0:39] >> Kodak [0:40] >> here. [0:40] >> Cassidy [0:41] >> here. [0:41] >> Baker [0:42] >> here. [0:42] >> Grin [0:43] >> here. [0:43] >> Mendoza [0:44] >> here. Kernie [0:45] >> yes here. [0:46] >> Everybody's here. Do we have a motion to [0:48] approve the minutes from the previous [0:49] meeting? [0:50] >> So moved. [0:51] >> Second. [0:52] >> We have a motion by Mendoza. Second by [0:53] Baker to approve the minutes of the [0:55] previous meeting. Clerk, would you call [0:56] the role, please? [0:57] >> Layman, [0:58] >> yes. [0:59] >> Kodak, [1:00] >> yes. [1:00] >> Cassidy, [1:01] >> yes. [1:01] >> Baker, [1:02] >> yes. [1:02] >> Grin, [1:03] >> yes. [1:03] >> Mendoza, [snorts] [1:04] >> yes. [1:04] >> Gernzi, [1:04] >> yes. [1:05] >> The minutes have been approved. Do you [1:07] have any communications? [1:08] >> I have none. Thank you. [1:10] >> Report of the committee's finance [1:11] committee. [1:12] >> And nothing new to report. However, the [1:13] next meeting will be held on Tuesday, [1:16] August 18th at 5:30 p.m. in council [1:19] chambers. [1:20] >> Great. Thank you. Public affairs [1:21] committee. Law and Ordinance [2:23] Committee. [2:25] >> Nothing new to report. The law and [2:26] ordinance committee will meet again on [2:28] Tuesday, August 18th at 5:15 here in [2:31] council chambers. [2:33] >> Thank you very much. Report of officers. [2:35] Mr. Mayor, [2:36] >> I have nothing to report. Thank you. [2:38] >> Thank you. Director of Law, [2:40] >> thank you. Our levy ballot measure has [2:43] been submitted to the board of [2:45] elections. They have then sent it off to [2:46] the secretary of state. So, we're on our [2:49] roll with that. Um, now we just have to [2:51] wait for word back from the secretary of [2:52] state, but we should be all good to go [2:54] for the general election. [2:56] Um, also, as far as the new business, [3:00] the um EMS [3:02] legislation that you see, the second [3:04] piece of new business, we would be [3:06] asking that that be passed as an [3:07] emergency tonight just to meet some [3:09] deadlines. Um, I can't recall the exact [3:12] deadline, but the fire chief is here and [3:15] he can answer any questions you guys [3:17] have as far as the purpose of the [3:19] legislation or what it is or deadlines [3:21] or anything like that. That's all I [3:23] have. [3:24] >> Thank you very much. Uh, director of [3:26] finance. [3:28] >> Thank you, Mr. President. Um, I just [3:30] have one new uh piece of legislation [3:32] tonight. It's a then and now for a an [3:35] invoice that we need to get paid. I'd [3:38] ask that we wave the three readings on [3:40] that, please. [3:43] That's all I have. [3:46] >> Thank you. [3:48] >> All right. At this time, we'll move into [3:49] the public portion and we have Deb Tyson [3:52] on the docket. For speaking time, we [3:56] just ask that you limit your comments to [3:58] 10 minutes or less. [4:01] >> Well, [4:03] I'm pretty proud of Fosttory and all the [4:05] events that we've had this summer. [4:07] I'm excited about tomorrow night, the [4:11] school bash. Um, [4:14] I also am proud of a lot of community [4:17] members. Uh, I would like to see less [4:21] negative from the social media part. [4:26] uh especially since they don't seem to [4:28] be back here uh showing up because [4:33] if you have something to say any of you [4:37] can be approached I've done it uh before [4:41] we ever get here and [4:44] if we work together as a community [4:47] positivity is contagious but so is [4:50] negativity [4:52] and I think the positivity [4:54] produces better results [4:57] and yeah, I'm very proud of this town. [5:01] That's all. [5:02] >> Thank you. [5:05] >> We also have Renee Vogelong on the [5:06] docket. Welcome back. [5:09] And we just ask you to limit your time [5:11] to 10 minutes or less. [5:13] >> I will try. Anyhow, Renee Vogelong, 702 [5:17] East High Street. [5:19] Um, [snorts] first off, I got I got me a [5:22] little cheat sheet. memory don't go too [5:24] well now. [snorts] Um, the splice pad, I [5:28] noticed that when it was first brought [5:30] up, there was no age limit. It could be [5:32] anywhere 60, 70 years old, be able to [5:34] use it. But the stuff they put into it [5:38] is for now what? 12 recommended 12 and [5:41] under. [snorts] But you look at [5:43] Defiance, you look at other other places [5:46] and they say 12 and under needs to have [5:48] a parent or guardian in the splash pad [5:50] with them. Okay. So, we got one that's [5:54] just for kids. We still haven't and we [5:56] got a nice park. That's a great park [5:58] they put up there [snorts] uh for for [6:00] inclusive, but uh what's what's the [6:03] teens supposed to do? We still haven't [6:05] did anything for the teens. Um you know, [6:09] uh I brought up a while back and got [6:11] some uh little backlash about the why. [6:15] Um you know, once or twice a month [6:17] during the summer, the city come out. It [6:20] was it would be cheaper for the city to [6:22] go rent out for the day a couple times a [6:26] month for the kids to go in there and [6:29] enjoy a swim, you know? I mean, I [6:32] understand the the ones that's members [6:34] might not like it too well on that, but [6:35] they're still getting paid. They'll [6:37] still get money through it, you know. I [6:40] mean, there's got to be something else. [6:42] Uh maybe we can find a piece of property [6:45] and put up a little skate park. Uh, [6:48] cities are doing that. Um, again, all [6:49] over the place getting skate parks up [6:51] for the teens. Um, Buckley um courts [6:56] over there. Uh, I've went by there a [6:59] couple times and there's kids out there [7:01] and one day I went by there, he had a [7:02] push broom. He was sweeping off the [7:04] area. So, they got a quarter court [7:07] basketball, not a half court, quarter [7:10] court basketball for four kids to play [7:12] basketball at. Sit there and watch. four [7:14] kids tried to play basketball, I think, [7:16] you know, what's wrong? That part of [7:19] that could have been cut out. Leave them [7:21] have a little at least half court [7:22] basketball. Um, so [7:26] but that that's uh and and in in the uh [7:30] splash pad in the park uh before damages [7:34] start. What's wrong with putting up a [7:35] couple cameras just like they got out to [7:37] the recycle? They don't have to be [7:40] looked at or reviewed and unless there's [7:42] a problem, they can go back and see [7:43] them. That's what they do out there. [7:45] They don't watch them all the time 24/7. [7:48] If there's an issue, somebody's dumped [7:49] something wrong or whatever, they go in, [7:51] they call down, they get go back on the [7:54] film and look and see who did it. This [7:56] could be done there, too. It could be it [7:58] could [8:00] stop it before it starts on the damage. [8:03] The other thing is data centers. They're [8:05] talking about them over in Hancock [8:07] County. Now, if they start getting too [8:09] close to our water systems, which we I [8:12] guess do Arcadia, I guess Arcadia gets [8:14] our water. Um, what's that going to do [8:17] coming backwards? Okay. Um, is there [8:21] something that can be done brought up? [8:23] Hey, we're going to put a hold data [8:25] centers within the the limits uh of of [8:29] our water systems, you know, uh keep it [8:32] out of there somehow. [snorts] Another [8:34] thing is corner of East High and [8:36] Springville. A couple years ago, I [8:39] brought pictures in and showed everybody [8:41] with my car sitting beside the manhole [8:45] for the water system how high up it was. [8:48] It wasn't just tire height. It was up [8:51] quite a bit. It was up to where it was [8:54] on my uh I had a PT cruise at the time [8:56] and it was up to the side of the car [8:59] saying here just not too long ago there [9:02] was a pickup that went by there. He sat [9:04] in front of our driveway and changed his [9:06] right rear tire because he hit it. It's [9:10] not off the road that far. There's a [9:11] little bit of grass there. I've gave [9:13] ideas uh putting up a little guard [9:16] around it, different things. Um [9:18] nothing's been done except these. I [9:21] think there's five of those snow orange [9:23] snow sticks so you can tell where [9:26] there's something at. There's five of [9:28] them around that around it. That don't do anything. Um [9:34] these door knockers, [9:36] I'm tired of them. I got a sign at my [9:38] house and it says, you know, no [9:42] trespassing, no soliciting. [9:45] They will still come up and ring that [9:47] doorbell. And I'll tell them, "Don't [9:49] want anything? Go." [9:52] They stand there. They want to argue [9:53] with you. Oh, no. You got You need to go [9:55] with us for your electric. You need to [9:57] go with us for this, for that. I don't [9:59] want that. I got a and and and I'm [10:03] staying with it. I ain't going with this [10:05] other stuff and having my rates jacked [10:06] up. But we need to calm down these [10:09] solicitors somehow. They're getting to [10:11] be still. I know you're laughing at me. [10:13] You think it's funny. [10:13] >> No, no, no. I'm not laughing at you, [10:16] >> okay? because I've had that scenario, [10:18] too. [10:19] >> And and it's it's uh it's getting very [10:21] bad. They're very pushy. Um had some [10:24] other people that they've been pushy, [10:26] too. Uh one was an elderly lady. They [10:28] don't need to do that. She lives right [10:29] down the street from me. Uh her husband [10:31] died a few years back and they went down [10:34] there and they had her almost crying. [10:36] Now, this is ridiculous. You tell them [10:38] to get off your property. We want them [10:39] off the property or let's stop and only [10:42] have certain type of solicitation out [10:44] there. these guys just need to be done [10:46] with. Um and uh and and can we [10:50] [clears throat] find a way to put this [10:51] back on the ballot to vote in instead of [10:55] voting out on this uh the stuff for [10:58] these electrics and that? This is crazy. [11:00] We got to get that changed again. Get it [11:02] back to like, you know, hey, if we want [11:04] it, we will call you and tell you we [11:06] want on it. Not know we're automatically [11:08] going to be put on it if we don't call [11:09] you. Um, the other thing, um, it upsets [11:15] somebody, it upsets somebody, but I'm [11:17] going to say it. This, uh, doing away [11:19] with the, uh, the, uh, three reading [11:23] rule. There's a reason to have the three [11:26] reading rule. [11:28] That that way, if the public hears it, [11:30] they can come in, they can talk about [11:32] it, or they can just get a hold of a [11:34] council person and talk about it. Hey, [11:36] why is this being done? Why is that [11:38] being done? just because finance [11:40] director comes in and everything I think [11:43] I might have missed one or two of the [11:45] meetings on YouTube that maybe it wasn't [11:47] asked for that let's avoid the three [11:51] reading rule we need this pass through [11:53] because of time constraint you know what [11:55] if there's that much of a time [11:56] constraint you knew about it beforehand [11:59] and if you don't know what this three [12:01] reading rule is for and needed for maybe [12:04] we got the wrong person in that position [12:07] and Maybe maybe we need to start voting [12:10] these people in instead of just being [12:13] appointed. [12:15] Uh the other thing is and I'll be done [12:16] with it is there's a number of empty [12:19] lots. [12:20] Seeing a lot of towns in Ohio, smaller [12:23] towns, that's taking these empty lots [12:25] that the city ends up with and they're [12:28] putting one or two tiny houses on. Does [12:31] it meet the zoning? No. because they put [12:35] things in there so it can be done. At [12:37] least you get a one person or a two [12:39] person in a house and at a reasonable [12:43] rate. I don't know how you want to do [12:45] that, but something needs to be done. We [12:47] need to get more housing in town for [12:51] singles and couples. So, [12:55] thank you for your time. It's good to be [12:57] back. [12:58] Sorry, but I had to say it. You have a [13:01] good day. [13:02] >> Thanks, Renee. [13:04] All right. At this time, we'll open it [13:05] up to members of the general public who [13:07] are not on the docket that wish to [13:08] address council. We just ask that you [13:10] state your name for the record and limit [13:11] your comments to three minutes or less. [13:16] » Good morning, evening. Jill affiliator, [13:18] 402 West Culbertson Street. I just want [13:20] to touch base real quick. Um, I want to [13:25] say that I am appreciative. We had an [13:27] issue with um our Friday night event [13:31] overlapping with an event that was being [13:34] done at the green space. Now I [13:36] understand that the city has nothing to [13:38] do with the green space. So we all get [13:39] denials if we try to use the green space [13:41] and we have to go through each [13:44] individual person. Totally understand [13:45] that. The good thing is is that because [13:48] people are working together, we were [13:50] able I was able to talk to the library. [13:52] We renegotiated the time frame so that [13:54] both events can happen and that is the [13:57] kind of thing we need to see in [13:58] Fostoriia. We know that there might be [14:01] overlaps. We all know that we trying to [14:03] get things going in the community and if [14:06] we all work together, we'll be able to [14:08] make it work. That's one example. [14:10] Saturday's [snorts] [14:11] example is another one. We have farmers [14:14] market. We have a person who's assisting [14:16] with farmers market because we don't [14:18] have that group put together yet again. [14:21] and that person didn't have her food [14:23] truck people, but I have a food truck [14:25] group. We're working together because [14:26] we're going from one event to the next [14:28] event and we're coexisting so that it [14:31] makes it for a really great group event [14:34] so more people will come down to partake [14:36] weather permitting. We're going to keep [14:37] our fingers crossed. So those are the [14:39] kind of things that I want to see more [14:43] of. That is what the community keeping [14:45] it local for the locals working together [14:47] to make it happen. But we can't do that [14:50] if we don't have cooperation at all [14:52] different levels. And we can't get angry [14:54] at one another because well, they're [14:56] taking my space there. It's all about [14:59] making it work. And I was really [15:01] appreciative of the library who was able [15:04] to we worked it out. We made it so that [15:06] it was going to be hopefully a really [15:08] good event for both parties. So, I'm [15:10] hoping we can see more of that coming in [15:12] the future. I'm still putting my [15:14] paperwork in to the parks group to see [15:17] if they will at least entertain next [15:19] year to have the nonprofits come in once [15:22] a week and man that concession stand so [15:25] that we keep it local. The money stays [15:27] local. it stays with the nonprofitt [15:30] chairperson and it doesn't have to be me [15:32] if they don't want me to be doing it but [15:34] at least somebody who could make sure [15:36] that it happens so that we can all [15:39] community effort community engagement [15:43] community thank you thank you right any [15:46] other members of the public wish to [15:48] address council [15:51] chief root were you planning on speaking [15:54] or just here for questions on that [15:56] resolution [15:57] Perfect. So, we'll hit that if if we [16:00] have questions when we get to that one, [16:01] we'll we'll ask. So, stay tuned. All [16:04] right. We will move into um actually [16:07] seeing no old business, we will move [16:08] into new business. Um and we will start [16:11] with the first one, [16:13] [clears throat and cough] [16:15] >> a resolution approving and ratifying the [16:17] prior acts of the department heads and [16:19] safety service director and approving [16:21] then and now certificates for set [16:23] expenditures and declaring an emergency. [16:26] Move to suspend the three reading rule. [16:29] >> Second. [16:30] >> All right. We have a motion by Podak, a [16:31] second by Cassidy to suspend the three [16:33] reading rule on three separate [16:34] occasions. Clerk, would you call the [16:36] role, please? [16:36] >> Layman, [16:37] >> yes. [16:37] >> Podak, [16:38] >> yes. [16:38] >> Cassidy, [16:39] >> yes. [16:39] >> Baker, [16:40] >> yes. [16:40] >> Grind, [16:41] >> yes. [16:41] >> Mendoza, [16:42] >> yes. [16:42] >> Gernsey, [16:43] >> yes. [16:43] >> The three reading rule has been [16:45] suspended. [16:46] >> Move to adopt. [16:47] >> Second. [16:48] >> We have a motion by Mendoza, second by [16:50] Cassidy to adopt. Clerk, would you call [16:52] the role, please? [16:53] >> Layman, [16:54] >> yes. Podak, [16:55] >> yes. [16:55] >> Cassidy, [16:56] >> yes. [16:57] >> Baker, [16:57] >> yes. [16:58] >> Grind, [16:58] >> yes. [16:58] >> Mendoza, [16:59] >> yes. [16:59] >> Gernzie, [17:00] >> yes. All right, that does carry because [17:03] resolution number 2026-5757 [17:14] [snorts] [17:15] [clears throat] in an ordinance to [17:17] authorize, direct, and empower the [17:19] director of public service and safety to [17:21] execute a memorand memorandum of [17:24] understanding with the Ohio Department [17:26] of Medical ODM for the emergency medical [17:29] service EMS. MS supplement payment [17:33] program authorizing [17:35] intergovernmental transfers IGIS of [17:38] permissible public funds and declaring [17:40] emergency to exist. [17:42] Does [17:42] >> anyone wish to have any discussion on [17:44] this ordinance? [17:46] >> I would like the fire chief to explain [17:49] that further. [17:50] >> Perfect. Come on up, Chief Root. And [17:55] he's [snorts] got a whole folder, so I [17:57] think he's prepared. [17:59] as long as we're not more confused [18:01] afterwards. [18:01] >> I was just going to say I'll try to do [18:03] my best. Um, so this leads back to the [18:06] 2024 [18:07] pro, same program. It's just the state [18:10] got a hold of it and the state kind of [18:12] put their own little twist to the whole [18:13] thing and then the PCG group that we've [18:16] signed up with initially to kind of get [18:18] our foot in the door is back making sure [18:21] that everything's kind of lining up. So [18:24] now we're at the point where we have to [18:25] get thisou with them to make sure it [18:28] moves forward and we participate in the [18:29] program. So and essentially what it is it's a Medicaid supplement that comes [18:35] in to us that helps to offset the cost [18:38] for a Medicaid run. Okay, sorry. [18:42] Probably one we're getting right now. Um [18:44] so we we run 300 to 350 Medicaid [18:49] patient [snorts] runs annually. Um, and [18:52] let's say on an average we get $200 to [18:54] $300 from Medicaid on that initial run. [18:58] Well, there's additional federal funding [19:00] that if you get into a program like [19:02] this, other states do it and now the [19:04] state of Ohio is trying to do it. we can [19:06] kind of get into that program and we [19:08] facilitate the whole entire thing with [19:10] the assistance of PCG the public [19:13] consulting group and they help us get [19:15] this additional funding you know cuz and [19:18] it could be with our run volume that [19:20] we're looking you know I don't want to [19:21] say exact numbers but it's let's say $40 [19:23] to $70,000 additionally annually and [19:25] it'll be just like an annual submission [19:28] that will run through the groups ODM as [19:31] well as PCG and then the auditor's [19:33] office and stuff like that so it's kind [19:34] of still you know obvious Obviously, [19:36] this is hasn't occurred yet. It's just [19:39] now happening for the state of Ohio. [19:40] Other states have been doing this for a [19:41] decade, you know. So, that's the bare [19:45] bones, I guess, easy description. I wish [19:48] I had more, you know, answers to some of [19:50] it, but I can try to answer any [19:52] questions if you guys have it. [19:54] So this ordinance as I understand it we [19:57] are actually becoming a provider within [20:01] ODM for Medicaid reimbursements [20:05] which is step one. We would still we [20:08] have this separate contract with IGT to [20:10] actually be the [20:13] like the party the third party that [20:16] takes care of the billing for us. [20:17] Correct. [20:20] PCG PCG take 10% of the federal [20:23] collected funds. [20:24] >> Right. So, but what we're agreeing to [20:26] tonight is we're actually going into a [20:29] memorand of understanding or a [20:31] cooperative agreement with med the Ohio [20:34] Department of Medicaid. That's what this [20:36] is. [20:37] >> Are we going to need to [20:41] sign a new agreement with that [20:44] >> with PCG? No. Okay. that that one we did [20:47] before to start this whole thing up that [20:49] is still in effect. [20:50] >> We already have that piece in place. [20:52] >> Mhm. Yep. [20:53] >> I'm trying to connect the dots on why [20:55] this is an emergency. Um [20:58] >> so their de PCG has a deadline of I [21:01] believe the 16th of August to get them [21:03] all in from the participating parties [21:05] that signed up early. [21:07] >> Okay. [21:07] >> And that's why I just got the email last [21:10] week [21:10] >> from them. I you know how that works. I [21:12] do know how it works. [21:13] >> It's crazy. So, [21:14] >> but we have a deadline of [21:16] >> they want it by the 6 [21:18] >> of August. [21:21] >> And you just received it within the last [21:23] two weeks. So, [21:24] >> and that's a federal program and that's [21:26] the time table they like to work on. [21:28] >> Yep. [21:29] >> Exactly. Okay. [21:30] >> So, it's it's a little bit early. I [21:31] think it's the end of August for ODM, [21:34] >> but PCG's got to get everything [21:36] together, get it collected, make sure [21:38] they're everything drives, and then they [21:39] so they want it quicker. So, we wouldn't [21:42] be able to achieve it within three [21:43] readings. [21:44] >> Okay. I think that information is [21:45] helpful for people to understand. [21:47] >> And I apologize. I mean, trust me, they [21:49] I wish they had they they've been [21:52] keeping up with things from time to [21:53] time, but ODM [21:55] is their their own entity. We don't [21:58] really hear a whole lot from them unless [21:59] I need something from us. [22:00] >> Right. [22:01] >> Okay. All right. Well, thank you. Yeah. [22:04] >> Anything else? [snorts] [22:05] No. Good seeing everybody. [22:07] >> Thank you, Chief Root. [22:08] >> Thank you. [22:09] >> Stay safe. Any [22:16] further discussion [22:18] at this point? We can entertain a motion [22:20] to suspend if you anyway so inclined to [22:22] do so. [22:24] >> We have a second. [22:26] >> Second. [22:28] >> We have a motion by Cassidy, a second by [22:30] Baker. Clerk, would you call the role, [22:32] please? [22:32] >> Layman, [22:33] >> yes. [22:34] >> Kodak, [22:34] >> yes. [22:35] >> Cassidy, [22:35] >> yes. [22:36] >> Baker, [22:36] >> yes. [22:37] >> Grime, [22:37] >> yes. [22:38] >> Mendoza, [22:38] >> yes. Currenty. [22:39] >> Yes. [22:39] >> All right. The three reading rule has [22:41] been waved. [22:41] >> Move to adopt. [22:43] >> Second. [22:44] >> We have a motion by Cassie, a second by [22:46] Baker to adopt. Clerk, would you call [22:48] the role, please? [22:49] >> Layman, [22:49] >> yes. [22:50] >> Kodak, [22:50] >> yes. [22:51] >> Cassidy, [22:51] >> yes. [22:52] >> Baker, [22:52] >> yes. [22:53] >> Grind, [22:53] >> yes. [22:54] >> Mendoza, [22:54] >> yes. [22:55] >> Grenzy, [22:55] >> yes. [22:56] >> Right. That does carry. It becomes [22:58] ordinance number 2026-58. [23:01] 58. [23:04] » Thank you. [23:07] » [clears throat] [23:09] >> An ordinance enacting new section 145.10 [23:13] of chapter 145 of the codified [23:15] ordinances of the city of Australia, [23:17] Ohio entitled regulations of special [23:19] events within city limits and declaring [23:22] emergency to exist. [23:23] >> That was the first reading of that [23:25] ordinance and concludes new business. Is [23:27] there any need to go into executive [23:28] session this evening? [23:31] Seeing none, is there any miscellaneous [23:33] business this evening? [23:37] Also seeing none, I would entertain a [23:38] motion to adjurnn. [23:41] >> I'll move. [23:42] >> Second. Have a motion [snorts] by [23:44] Cassie, a second by Baker to adjourn. [23:46] Clerk, would you call the role, please? [23:48] >> Layman, [23:48] >> yes. [23:49] >> Podc, [23:50] >> yes. [23:50] >> Cassidy, [23:51] >> yes. [23:51] >> Baker, [23:52] >> yes. [23:52] >> Grind, [23:53] >> yes. [23:53] >> Mendoza, [23:54] >> yes. Gernzy, [23:55] >> yes. [23:55] >> We are adjourned at 6:27.
