[2:31] For Donald Murphy, fashion number 537, Charles County Animal Control. [2:36] Officer Murphy, whenever you're ready. [2:40] On Tuesday, May 12, 2026, that approximately 1143 hours, I met with Haskell Campbell at [2:45] his residence of one seven-pender drive in the plate of Maryland. [2:50] We did a follow-up compliance check for his canine, cane, who was deemed potentially dangerous [2:55] ambitions to unact over 21st of 2025. [2:58] With all the debates except for seven in that, cane was reclaimed the next day. [3:02] and was issued a rabies vaccination expiring on October 22nd, 2026, along with the county [3:08] license in a microchip. I conducted an initial appliance check on Tuesday of December 9th, [3:16] 2025. Mr. Campbell was not home. Mr. Campbell did call later that day in advice he was, [3:21] he has a fence out back for his canine cane, but it is not in the double enclosure, [3:27] and there was no danger stalk signs on the property when I was there. [3:31] Mr. Campbell advised that night at night time Cain is kept in the 8 by 10 shed that is temperature control. [3:38] On February 26th, 2026, I conducted a follow-up visit again at Mr. Campbell's residence. [3:45] Cain was inside a kennel approximately 4 foot tall, had plenty of space but had a lot of debris on the ground. [3:52] This was a single kennel approximately 8 foot long by 10 foot wide. [3:56] Mr. Campbell did have a lot for the fence, but it was not a proper door. [4:01] The kennel was not a double enclosure, it was not a big proof, and it was not a climb [4:07] group. [4:09] Please see exhibit one for the photos of the housing conditions of the K9K. [4:17] No dangerous dog signs for observed on the property. [4:21] I informed Mr. Campbell multiple ways to repair the issues and become compliant with [4:25] the board's orders, and advised him that I will conduct another follow-up to check the status [4:30] in a few weeks. On May 12th, 2026, when I arrived, there were no danger assaults posted, [4:36] a no danger assault signs posted on the property. Mr. Campbell showed me a multiple B wear [4:41] dog signs that he had in his truck by and formed him again that they must say danger assault. [4:48] The kennel was still the same with no double enclosure, no gate, and offense was still too short. [4:54] Mr. Campbell advised he had ordered new fencing a week ago and that he has not made any changes yet. [5:02] A issue citation 7595 for failure to comply with the Charles County Animal Regulations and keeping of a potentially dangerous animal. [5:10] All the events occurred in Charles County. [5:13] Is there any questions? [5:17] Thank you, sir. [5:20] Mr. Haskell Campbell. [5:32] Please raise your right hand. [5:33] Do you declare an affirm under the penalty of perjury that the testimony you're about to give us the truth? [5:39] Yeah [5:39] Please state your name for the record. [5:47] Can you place it down please? [6:01] And Mr. Campbell you can go whenever you're ready, [6:36] sir. [6:40] That's okay [6:41] What's your testimony? [6:43] Oh, okay. Well [6:46] Some of these days [6:48] We're most of [6:50] But I have got a newfound point, Mr. Campbell. [6:54] I didn't get to send him a picture yesterday, I got a sign up, and a lock is on the gate. [7:00] Can he bring the mic closer, please? [7:03] And a lock is on the gate, thank you. [7:06] And it was also want to make him new, but I told him about his 10 years old. [7:10] They don't live no more than 12, 10, 2, 12. [7:12] It's not an option. [7:14] Well, he said, he said, I got a position to waive it. [7:20] Is that? [7:20] That's what we said at the court. [7:22] I mean, the old got to, yes, if I said it, [7:25] and it doesn't sign up a paper stating that waiving [7:28] the because of the dog's age or medical condition, yes, [7:33] it can be null and bowl. [7:37] And I found I got in touch with some mind and child's [7:39] kind of because child's kind of kept telling me [7:41] they didn't have enough workers to handle. [7:46] King courses. [7:47] That's what they were just king courses. [7:48] So I found I got a tattoo one night. [7:50] Don't have a poem into September 30. [7:52] Let's see, I ordered it again. [7:55] Okay, now I bought the crown with the double enclosures. [7:57] You see, [8:00] I don't know what I ordered this one, but when I got it, I wasn't what I thought [8:04] I was getting, but it's a little better. [8:06] I sent them some pictures. [8:09] It's better than what I had, but I got a shop at the right place to get to dumb and [8:15] close. [8:19] Does anyone have any questions for Mr. Campbell? [8:25] I don't see Murphy. [8:26] Do you receive pictures of? [8:29] I don't even close yet. [8:30] I have received pictures today at 5.34 pm of pictures of a new enclosure, but it is not up to [8:40] compliance of the board's orders, which is a double enclosure, and it still is in at eight feet high, [8:47] either. It's still a four foot, about four foot height. He does have a tarp over top of it, [8:55] but other than that, it's still not up to the standards of six. It's six feet. [9:01] 60. My apologies. Six. Okay. All right. Thank you. When you were here before for [9:08] King, is this the where he lived then? The residents? No. And this pen of [9:17] sorts. No. No. Where did he live when he got out and did the bite? Oh, he [9:24] wasn't in it. He was he was he was mostly chained up and then I put him in [9:29] He's right with me, so he wouldn't chain up before. [9:32] So this is how he lives 24-7. [9:37] Okay. [9:37] He got a picture. [9:38] He lived now 24-7. [9:40] Yes, that. [9:42] He sent me pictures tonight of the newly updated. [9:46] He's in a, he's, like he said, a night he's in a, he's in a, he's in a, [9:55] Is there another questions? [9:56] I just hadn't cleaned it up when he came. [9:59] I have a question. [10:00] So, sir, you said during the day he lives in this pin, but at night you bring him into this garage. [10:11] Do you have intentions on following that order and bringing this up to code? [10:16] Yes, ma'am. [10:21] Is there a motion? [10:24] I have a motion. [10:26] Sir. [10:28] After hearing the testimony presented this evening regarding citation, [10:31] in $7.95, I make a motion that the Board finds. [10:37] Mr. Campbell, in violation of [10:42] $2.30-12.5, [10:45] felt it comply with Charles County Animal Control Regulations [10:48] and keeping up with dangerous and vicious [10:49] or pitant animal, or potentially dangerous animal. [10:55] Mr. Campbell had $350 still held in a bay inch [11:01] from the October 21st hearing, who was held in the bans for a period of 12 months, so it still [11:10] has two months going. [11:20] I think [11:23] he should have to pay $100 of that $350 that was held in the bans, [11:32] and there's [11:33] new fine of $500 that will be held in a band for a period of six months to give him [11:42] time to get into compliance with the regulations. [11:45] Yes, sir. [11:45] Sir, second. [11:47] Second. [11:50] Oh, there's some favor. [11:51] Hi. [11:52] Any opposed? [11:54] Any abstain? [11:56] All right, Mr. Campbell. [11:59] Yes, ma [12:02] 'am. [12:02] The board graciously has found you in violation of $123-12.5, a failure to comply with the [12:14] Charles County Animal Regulations and keeping of a dangerous and orvicious or potentially [12:19] dangerous animal. [12:21] But they find a $500 that they are going to hold again for six months. [12:31] Okay? [12:33] What we did for you in the October case was we held $350 in advance if you did not come back [12:40] in 12 months and you were here 10 months later. [12:43] You are now required to pay $100 of that 350 and I will give you 30 days. [13:03] Thank you, [13:28] sir. [13:28] Whenever you are ready, ma'am. [13:30] citation 7583 and 7584 animal control versus Felicia Johnson Yoda [13:46] please raise your right hand [13:49] Do declare and affirm under the penalty of poetry that the testimony you're about to give us the truth [13:54] Please state your name for the record [14:00] Whenever you're ready, sir [14:07] on June 28, 206 the child's kind sure his office received a report of an animal bite [14:12] We're going to bite to the hand that occurred at 2907 Halifax Street in World of Maryland, [14:18] 20603. [14:19] On June 20, 1926, and approximately 1213 p.m., [14:22] are responded to 2907 Halifax Street in World of Maryland. [14:26] Upon arrival, I made contact with a resident who advised that she was not involved in the [14:30] attack. [14:31] She advised that a contractor, David Eskato, was performing worker her residence. [14:34] She advised that when Mr. Eskato exit the residence, two can ask Ransuwar's him in [14:38] attack. [14:38] The resident advised that both canals reside at 2909 Halifax Street, which is directly next [14:44] to her residence. [14:45] She provided me with footage of the incident from her rental doorbell camera, which can be [14:49] seen in the exhibit one. [14:51] In the video, two people with tight canals can be seen running towards Mr. Scotto while given [14:57] out, drawn out barks, the dark brown people with... [15:00] Okay, no, I can then be seen by the Mr. Scottish Lieutenant, calls at 100-Jump One to the Homeowners vehicle. The latter brown pit will type okay now and can be seen following alongside the dark brown okay now and mirror it in this behavior. If this time I would like to call Mr. David Ascottle for which testify. Mr. Skado. [15:24] Chairman of the head. [15:27] Do you declare and affirm under the penalty of hergery that the testimony about to give to the truth? [15:32] Please stay your name for the record. [15:34] David is called. [15:38] Sure. [15:38] Go ahead. [15:39] Tell us what happened. [15:42] It was simple. [15:44] It's just basically I was doing that service calls. [15:45] You know, I'm like, you know, one of my customers. [15:49] And when I get out of the house, the two dogs actually, they were chasing on me. [15:54] They were seeing a little bit, you know, dangerous to me. [15:57] And then one of them actually bite my left hand. [16:01] That's the shows from the picture. [16:05] Luckily, you know, I was able to jump up into the car or the watch, you know, they were actually going to do something different. [16:14] After that, you know, the dogs actually somebody on the street just knocked the horn and the dogs actually went back to the house. [16:24] I think after that, it's actually just talked to the owner. [16:27] So were they still trying to get you when you jumped up on the hood of the car? [16:31] Yeah. And you were on the homeowner property, you were working on not their property. [16:39] No, they're property. [16:42] Doesn't anyone have any other questions? [16:44] Which is the dog that did you? [16:49] I don't remember. [16:51] There were two, one of them, they were more, you know, [16:56] uh, dangerous than the other. [17:00] Do you remember which color what color the dog was? [17:06] I'm not sure, I can't remember that. [17:07] Yeah. [17:08] Is that one? [17:08] It's just like a grave, something like that. [17:11] This is a vision. [17:13] The bite report says it was Bishop. [17:15] Any other questions for him? [17:19] Thank you, sir. [17:21] Officer Engram. [17:22] Surely after I responded to 2009, [17:24] 0.9, Halifax Street, and a attempt to make contact with the owner of the K9's, I received [17:28] no response and left my contact information asking the owner to contact me. [17:32] I then spoke with Mr. Eskato by phone and completed his portion of the contact report, which [17:36] can be seen in the exhibit too. Mr. Eskato advised that he would provide photo of the injuries [17:40] which can be seen in exhibit 3. On June 30, 26, and approximately 11, 26, and I respond to [17:46] 2.9, 0.9, Halifax Street to follow with the owner of the K9's. Upon arrival, I may contact [17:51] with Felicia Yoda, the laugh that she was on her [17:53] of the two canons involved in the incident. [17:56] I'd then issue citation 7.5, a three, a 7.5, [17:59] a four for Bishop and Bella for individual kind of license, [18:02] and dangerous and or potentially dangerous animal. [18:05] All of us occur within Charles County. [18:08] Any questions? [18:10] All right, thank you, sir. [18:11] Miss Yoda, [18:17] please raise your right hand. [18:19] Do you declare an affirmative [18:20] of the penalty of poetry that the testimony [18:21] you're about to give us a truth? [18:23] Yes. [18:23] Please state your name for the record. [18:24] Thank you. [18:27] Anybody ready? [18:28] Okay. [18:29] I've got a statement. [18:30] I understand as I spoke to the clerk that I needed to make copies for the committee as [18:35] well. [18:35] I'll read it, but then I'll give you the copies to share. [18:39] First of all, I wanted to express my sincere concern and regret for the event that happened. [18:48] My family and I take this incident very seriously and we're committed to taking a [18:51] separate steps and short doesn't have it again. [18:54] Bishop and Bella both are members of our family. [18:56] Bishop has spent with us close to nine years [18:58] and before the sensitivities never bitten [19:00] or physically harmed anyone. [19:01] This includes interactions with family members, visitors, [19:05] and others who have encountered [19:06] we have encountered in moreable activities. [19:09] Our dogs are secured and our backyard. [19:11] We have two gates on each side with two doors [19:13] that are properly marked. [19:15] It's say, you know, dog and premises, [19:17] you know, it's a server and warning dogs and premises. [19:19] On that day, my husband and our son were working in the backyard. [19:23] They were moving materials in and out, and one of the doors was left a jar, which provided an opportunity for them to actually get out of the house. [19:31] I was in the house, watching my grandson and his mother had just arrived when we were alerted that this had happened. [19:39] We went out as soon as we found out, brought first aid to Mr. Scotto, recommended, and faculty and faculty recommended that he go to someone to seek. [19:49] seek medical care, both for dogs or up to date, [19:52] rabies, shots, and all the recommendation of animal control. [19:57] We registered both of them with the county, [19:59] was unaware that we needed to do that, [20:00] but we registered both with the county, [20:02] since then we've returned into our vet. [20:05] Our dog is not a violent dog, [20:07] because he's actually kind of a goofy dog, [20:08] but although this does not escape, [20:11] this was unintended, we understand our responsibility [20:14] to keep our dogs safely contained in our property. [20:17] This is a serious incident, [20:18] and we are committed to making sure that it never happens again. [20:21] Since the incident, as I said, we've gotten our obtained our license. [20:25] We've taken them both to the vet just to make sure everything is good. [20:28] We share copies of the license and proof of rabies with the clerk. [20:32] Additionally, we have increased our diligence with assessing and securing our gates. [20:35] We're looking into an option of using the key instead of a latch. [20:38] We're on our end. [20:39] We're going to purchase a muzzle for Bishop to wear in public, [20:42] or when he's on walks, as it was also recommended. [20:45] And we've been increased our supervision whenever the dogs are outdoors and using additional [20:49] restraints that's needed. [20:51] Our dogs are valuable members of our family if I said and we are both committed to their [20:54] world being in a safety brand neighborhood. [20:57] We also reimbursed Mr. Scadow for his costs at patients first when he went to actually [21:02] see to get help to get the intention to need. [21:06] We have to receipts for that. [21:07] We was a Zell transaction to his account. [21:12] That's it. [21:12] Any questions? [21:13] Thank you, Ms. Yoda. Anyone have any questions? [21:19] Questions? Part of the violation was an individual license. Did you get the individual license? [21:25] Yeah, I did. I presented those receipts to the fur. [21:31] You should have them as well. [21:32] There are attached to the rabies report as well. [21:37] Oh, I see it. Sorry. [21:39] Okay, I'll do have a motion. [21:42] Four, seven, five, eight, three. [21:48] I have a motion. [21:49] Sir. [21:51] After hearing the testimony, presented this evening regarding [21:54] sottation, 7583, I make a motion at the board [21:58] behind. [22:01] Mrs. Yoda, in violation of [22:04] 230-10A, individual county license with a zero dollar [22:09] fine. [22:12] No, this is for the dog visual. [23:54] But she will give you a book that I'll show you everything you can always reach out to animal control and they can help you. [23:59] Okay. Also, 7.5.8.4. The neighborhood that we live in is a very common peaceful neighborhood. [28:29] You know, children playing around grandparents walking their grandchildren. So it's just a [28:34] generally nice area. There's nothing for me at the time that I felt that I needed to worry [28:39] about. So I walk inside maybe about five minutes later. You know, I put my purse down and then I [28:45] gather two of our pets that are vaccinated to pet some. I put them on a leash and I get their [28:51] doggy bags and then we go outside and I lock the door and I'm getting ready to walk down [28:56] we have about two stairs from the front door down to kind of the road area. I do see the [29:05] people maybe just out of the corner of my eyes I turn to turn to lock my key and I'm turning [29:10] back I see this people. I don't know maybe like 20 feet away from the house but he's [29:15] around the house so I don't see him when I'm walking up, coming in for the first time. [29:22] So now that I'm coming out of the house, I see this people, and I see that he kind of [29:27] is maybe sniffing around in the grass. [29:28] He puts his head up, and that's when he sees me, and then he sees my dogs. [29:33] And by the time I turn back around, I'm standing right in the front door. [29:37] I'm turning back, haven't even walked down the two steps. [29:40] Trying to unlock the key, the dog is already attacking one of my dogs, and it happens [29:45] so fast, I don't even know. [29:47] I couldn't even get to my key to unlock the door. [29:50] So now the dog has one of my dogs, Cory. [29:53] In his mouth has grabbed him kind of by the ribcage area, [29:57] and has him in the mouth is thrashing. [30:01] And all this just happened immediately after me walking out. And I'm calling for help. I'm yelling, help, help. Because I can't pull the dog. I can't pull the dogs apart. And I have a little dog there. So I'm kind of frantic. I don't know what to do. So as I'm yelling, help, and as I'm trying to unlock my door to get back inside, one of our neighbors runs up and he throws a metal pole at the people. And that's when the people finally let's go. [30:30] So I'm inside, and the neighbor, the owner of the dog comes up and tells me you know that was my dog. [30:37] He's usually enclosed, but due to gardening and landscaping, the gardeners left the door open. [30:45] I don't know, fence open, and that's how the dog got loose, and she had been looking for him for a while. [30:51] And by the time we got to the vet, we went to emergency care, and there was a lot of internal damage, [30:56] a lot of internal bleeding, and I think you have the pictures there of everything that happens. [31:02] The total cost is roughly $12,000. It was an eight hour surgery that required 150 internal [31:11] stitches to repair all of the damage, [31:15] broken ribs, just a lot of things that I think you have in your record. [31:19] And our dogs are vaccinated, but from the animal control record, it doesn't show that their dog was [31:24] We can, that, that's not, we can handle with that. [31:29] Anything else in reference to this incident? [31:32] Not medical records or anything else. [31:40] Maybe just to say that the neighbor, the owner of the dog [31:43] did come up and wanted to see my dog to see how the, [31:48] like, the condition that my dog was in. [31:51] At first it looked like it was just punctured wounds [31:53] because I couldn't obviously see all the damage [31:56] that had happened inside. [31:59] But since my dog was bleeding, my dog just kind of crawled into a corner and didn't want to be moved. [32:04] So I just didn't think that was a good idea for me to kind of put him on display for someone else to see. [32:10] Okay. [32:10] Does anyone have any questions? [32:12] Yes, ma'am. [32:13] Ma'am, is your dog okay now? [32:15] He is okay. [32:16] Yes. [32:17] We are a Christian family, so we did pray a lot and we prayed a lot over him. [32:21] It was an eight hour surgery, and then four days after that to keep him in kind of like intensive care just making sure that he was okay, but he's surprisingly made it through. [32:31] Okay, good to hear anyone else. [32:34] All right, thank you very much, ma'am. [32:36] Sorry. [32:37] Officer Hayes. [32:41] On May 14th, the 26th that approximately 255 P.M. [32:46] Ms. Lane did contact me by phone. [32:48] I was able to meet Ms. Lane at our office on Chesapeake Street at that time, an animal and animal contact report was completed and both dogs replaced on a quarantine. [33:00] Exhibit one shows that contact report. Exhibit two shows photos of course injuries provided by a water for emergency care. [33:08] On May 15th, the 2026, I made contact with Ms. Lane at her residence at that time citation number. [33:14] 7, 6, 1, 9 was issued to Ms. Lane for her canine crash for animal at large individual license [33:22] failure to provide a current rabies vaccine and dangerous and or vicious or potentially dangerous [33:27] all events did occur inside Charles County. [33:30] Thank you, does anyone have questions for Officer Hayes? [33:34] All right, thank you, Ms. Lane. [33:50] Please, please raise your right hand. [33:52] Do you declare an affirm under the penalty of poetry that the testimony you're about to give [33:56] to the truth? [33:56] Please take your name for the record. [33:59] You bet Lane. [34:01] So basically what happened was [34:03] Landscapes were there. [34:06] Our dogs we have two are contained in the yard. [34:10] A large yard and they kind of didn't close it all the way. [34:16] When I let crash out, he ran out like he normally does. [34:20] But the door, I didn't notice that because it was just a little crack he pulled the rest of it. [34:26] But it started raining. He doesn't like like rain. He did not come back to the door [34:31] So that made me go out and look for him and that's what I noticed. He was missing. [34:36] Got my car started driving around the neighborhood and looking for him. [34:40] And she said the neighbor was chasing him down the hill with a stick. [34:45] So I grabbed him and put him in my car. [34:47] The neighbor told me I think he attacked a dog up there. He pointed to the house and said, [34:53] Okay, I'll go up there and see, Crash is in the car. I went straight to the house to inquire what happened is the dog hurt [35:01] What's going on and they was like well the dog somebody was on the ring camera and [35:07] This young lady was at the door not the one that testified there was some the one that testified was on the ring camera [35:14] So I'm asking her can I see the dog is the dog her? [35:18] I'm willing to take dog to the hospital whatever was how badly did my dog hurt your dog [35:23] First of all, he's registered to my son. [35:26] That's my son's dog, he brought home for college. [35:30] So, nobody would let me see the dog, nobody would let me see [35:33] anything. [35:34] And then they sent me, because I left my phone number, [35:37] I showed them where I live, like if you have any issues, [35:40] come let me know. [35:42] They sent me an email, a voicemail, the next day, saying [35:47] that the dog had to go to the hospital, [35:49] because when I spoke to the lady, one. [35:51] Miss Lane, I just want to let you know that we cannot handle anything a reference to any civil litigation monitoring. [35:57] I just, did you witness this, did you, did you like that? I need the facts of this incident. [36:05] I heard it and I started running up the hill because I'm way down at the bottom of the hill but I was on my deck. [36:11] So I heard this screaming and I heard I've been ran up there. [36:16] didn't see anything. I don't know what crash did to this dog. That's why I wanted to see the dog, [36:21] to see what damage he did with the crash did. The photos I have here, I see the long one, [36:26] is a surgical score that my dog did not do. The puncture wounds, he may have done with his claws [36:34] because him and my other dog, when they tussle, they injury each other slightly with scratches and [36:41] because of their claws. So when she contacted me, I told my son about it and my son contacted [36:49] her back. And that's how we are. And I spoke with this lady because we were supposed to have [36:56] a hearing the next week. It was canceled because she couldn't make it. We made another schedule for [37:01] another time. Then they called and said, well, can you come tomorrow? And I'm like, no, I can't come tomorrow. [37:06] You just don't call it me. I've backs of the case man backs of the case. That's it. Okay. Does anyone have questions from a plane is crash up to date on rabies vaccine? Yes, and of do you have like a rabies certificate or license for us? [37:36] These two. [37:36] Do you have the people work? [37:40] Also license? [37:45] Would they get any? [38:02] Is that what you think? [38:03] Yes. [38:08] five of our rabies vaccine for the canine crash. It was given on May 17th, the 2026 and it [38:17] expires May 17th of 2027. [38:23] The tag number is 1, 2, 6, 9, 6. [38:32] Then I do have a county license for [38:34] the canine crash. Tag number is 6015 and that was issued on 517 or 26. And we'll expire on 517 [38:44] of 2027. Thank you. [38:48] You need just no questions for Miss Lane. [38:53] Yeah. [39:01] Miss Lane. Does your son live with you? [39:04] He came home in college. [39:06] Is he the registered owner of crash? [39:09] He is. [39:11] Is he here today? [39:13] He can't be. [39:14] Okay. [39:16] Will crash reside with you or will he be going somewhere with your son once school's far back? [39:23] No, he's graduated. [39:25] He's working. [39:26] So when he moves, [39:27] Chris is going with him. [39:30] Because at this point, [39:31] you're taking possession by signing this ticket [39:34] of this dog that if we deemed dangerous and vicious, [39:37] that is in your name. [39:39] Yeah, that's what I did not want, [39:41] because he's registered to my son. [39:44] My son is his caregiver. [39:47] He just lives in our house. [39:49] He came home from college with him. [39:51] So, my dog is there, and he's straight, but can he come past and sign at another time? [40:05] She did she take possession when she signed the first ticket. [40:15] Please raise your hand. [40:16] Do you declare an affirm under the penalty of poetry that the testimony you're about to give to the truth? [40:21] Please say your name for the record. [40:23] Jeffrey Thomas, Chief of Charles County Animal Control and Care, [40:26] Bachelor number 526. [40:29] So, one more time, what's the question? [40:31] She is signed and taken possession of crash? [40:35] Yes. [40:36] So the way that it would work at the time that Officer Hayes didn't investigate, she's [40:43] owner, custodian of the Canine, it resides inside her house and I don't believe her some [40:48] was there. [40:50] So if he wants to take ownership, all he has to do is call animal control everything that's [40:55] happening right now, would transfer to the dog regardless of where he goes, but she accepted [41:00] citation as owner custodian. Okay. Good. Because if your son does move [41:06] out of Charles County, he is required to notify the county and what she's [41:13] moving to the condition of the stipulations of the strong. [41:20] We don't know we haven't voted. However, there's no option. I mean so if he moves [41:28] out of the county he asked to know the five. Is there a motion? [41:36] I have a motion. [41:40] After hearing the testimony presented this evening regarding citation [41:45] 7619, [41:47] I make a motion that the board finds Ms. Lane in violation of 230 dash to [41:55] an individual county license with a $0.00. In violation of 230 dash 12 animal at large [42:02] with a $50 dollar fund. [42:06] In violation of $2.30 dash 9A, [42:09] federal to provide rabies, [42:11] proof of rabies with a $0 dollar fund. [42:17] In violation of $2.30 dash 12.5, [42:20] dangerous and or vicious or potentially dangerous [42:23] with a finding of dangerous and vicious [42:25] with a $300 dollar fund [42:28] with $100 held in a bans for a period of six months [42:34] and all relevant abatement. [42:37] Thank you, sir. [42:38] Is there a second? [42:39] I'm a second. [42:42] No, there's a favor. [42:43] Aye. [42:44] Any opposed? [42:47] Is there a discussion? [42:48] Any abstain? [42:50] Aye. [42:50] All right, Ms. Lane. [42:51] And reference 27619. [42:54] You've been found in the violation of 23010A individual license, [42:58] which is a zero dollar fund. [43:00] You've been found in violation of 23012 animal at large, [43:04] with a $50 fine. [43:05] You have been found in violation of 239A with a zero dollar fine. [43:12] You have been found in violation of 232.5, dangerous, and or vicious with a $300 fine for a total of $350 [43:25] dollars with a hundred held in a band with one hundred held in a band with two hundred and fifty [43:32] dollars do and I can give you forty five days for that. Additionally, you crash is now [43:38] going to have to follow the following in abatements. A mountain clerk will give you this book. E-1-2. [43:44] Partying, ma'am chair. Was the abatements part of the original motion? Yes. [43:50] He won 2, 3, 4, 5, [43:57] and G. And again, now this dog is deemed dangerous and vicious. If you're [44:05] some who's out of this county, he's got to notify wherever he moves, that he's bringing a [44:09] dangerous and vicious dog into their county. [44:13] And Madam Clark will give you the book and the [44:15] information that you thank [44:30] you I thought you won't want any one before before the last [44:38] okay [44:41] when are you ready man clerk [44:45] citation seven four nine one animal control services versus [44:49] D.R. D.R. and T. Washington welcome [44:58] back off to Ingram [45:06] On July 17th, 2026, I received the report of five pit bull type canines, attacked and killed a puddle type canine. Upon arrival, I made contact with Diannese Washington, who advised that he was the son of the owner of the pit bull type canines. I also made contact with the Kaya Washington, the owner's sister, who advised that she wouldn't as the incident, was Washington advised that the canines belonged to her brother, Delante Washington, who was on a cruise and unable to be reached at the time. [45:29] Ms. Washington advised that she wouldn't still not take Washington's pit bull type K now. [45:33] Pinky runs towards Chloe, a black bull type K now. [45:36] She advised that Pinky bit grabbed and shook Chloe and so Chloe was deceased. [45:41] As her Chloe deceased in the front yard, the attacking K now, when it's residents, which can be seen in exhibit one. [45:46] I think completed a bite report, which can be seen in exhibit two. [45:49] At this time, I like to call Kyashan Tumisha Washington for the test of life. [45:54] Okay. [45:56] Is it Ms. Washington? [45:57] Yes. [45:57] Ms. Washington. [46:06] I made contact with the owner of the CsK 9 Kioncher Washington. [46:10] His Washington has asked the Tmitry Washington also when the attack was unable to identify [46:14] all of the Kioners involved, both witnesses were able to identify P.K. as a attack in K9. [46:19] P.K. was gone upon my rival, and a doctor I was sent an attempt to contain P.K. [46:24] An issue of citation 749 wanted to be on the Tmitry Washington for P.K. for individual [46:28] county licences for the Tmitry Washington to provide proof of a current rabies vaccination [46:31] and dangers and or potentially dangerous animal. All of them as a curious [46:34] at Charles County. Okay, I have a couple of questions. All of them live in the same house. [46:40] Yes. So there's two houses on the property, directly next to each other, but it's [46:44] kind of a section of the property. Okay. And so animal one, owner, is Deontay or DeLontay? [46:58] The owner of the dog is Delante Washington, but Delante Washington wasn't home at the time. [47:02] He's on a cruise. [47:03] So his son was the next person there. [47:06] Kind of had all the information about the dogs, which is Delante Washington. [47:10] And Kyusha Washington is the sister? [47:13] Kyusha Washington is another family member. [47:14] So it's kind of like a family. [47:17] Yeah, it's kind of like a family. [47:18] Got it. [47:20] Okay. [47:21] Thank you. [47:23] So, I need miswashing ten. [47:28] Yes. [47:28] Correct. [47:29] Is the, all their last things are washed. [47:32] Just want to talk about some research. [47:32] Does anyone have any more questions for Auster and all of certain grownups? [47:36] I have a question. [47:37] So, you said a trap for him to get caught? [47:39] Yes, for Pinky. [47:40] Got caught? [47:41] No, Pinky wasn't caught. [47:42] So, Pinky is still at large? [47:44] Yes. [47:44] At this time, we haven't had any signs of her or anything of that sort. [47:47] We've been out. [47:47] We patrol the area multiple times. [47:48] So, we haven't been able to find Pinky. [47:50] Did Delantever come back in the country contact you as far as I don't know. He's never contacted me [47:57] I gave my his information to his son and told him that he could contact me to put to the citation we ran in his name [48:02] When I was never contacted after I'd contact them once with Tom's blood had no success. Is your victim here? Is [48:10] No, doesn't seem that they're here today. So no Washington. Did we double check the hallway just to see? [48:19] Mr. Washington, so come on up, [48:32] please raise your right hand, do you declare an affirmative [48:35] of the penalty of poetry that the testimony you're about to give us a truth? [48:39] Please state your name for the record, [48:44] Mr. Washington, so you are not here, but this [48:47] was your dog. [48:49] Okay, go ahead. [48:51] All right, they called me and said that the dog that I had smart dropped dog, Pinky, I had [48:56] like three months. [48:58] They said it's something to shit, tag the dog, or they ran over the two. [49:02] I don't know what happened. [49:02] They said the dog was dead, Pinky was gone, and that was all out of no, it's like I [49:08] hung. [49:10] I wasn't there, I don't know what happened. [49:13] So Pinky is your dog. [49:14] Pinky is a dog that somebody dropped off when I was walking my dog, and I kept it. [49:19] But Pinkie's the pet ball. [49:21] Pinkie's not the one. [49:22] Pinkie's the one that did it. [49:24] No. [49:25] OK, Chloe. [49:27] Chloe, OK. [49:28] And where's Pinkie now? [49:30] I don't know. [49:31] She left and never came back. [49:33] Have you looked for her? [49:33] Yeah. [49:34] And they said a trap for her and everything. [49:36] Somebody said they'd seen her like three miles down, [49:38] street by her store, but I haven't seen her since. [49:42] Where did Pinkie left? [49:44] She was with me. [49:45] Somebody dropped the off, like three months ago. [49:48] They see me with my dog in the yard, in the house, and on a leash. [49:53] The shoes freeze like this, somebody dropped her off like right here, and so the dog was in the yard. [49:59] You know, nice people, so I got her, she was nice, kind of meaning at first, but she was calm down after a while. [50:06] So that's why I kept it. [50:10] And Chloe's your sister's dog. [50:12] That's my cousin though. [50:13] Doesn't stalk. [50:15] And she's not here. [50:16] Okay, [50:21] and your son who witnessed this he didn't win and see if he he was taking kids [50:25] Oh, I was dead [50:27] Oh, I was gone. Okay. Okay [50:31] You have any questions for Mr. Washington? [50:38] Did you get pinky at the time that you had or did you give her rabies vaccine or get a lot of shoes kind of means you spookie [50:44] You know scary so I'm trying to get her nice and you know please at least people before I take her anywhere [50:49] Yeah, okay, so I know they get a chance and nothing really would hurt [50:53] Did you know the people that dropped her off? [50:56] No, I seen the car before, what the dog, [50:58] didn't they like a week before? [51:00] It was a couple, they dropped her off. [51:02] So then, speak to you, they just dumped her. [51:04] Yeah, they seemed like I had a couple of dogs. [51:06] They seemed like my dog. [51:08] So I, you know, week, week later they seemed, [51:09] I seemed the dog, you know, running around in front of the house. [51:13] So I got her and thought, you know, something was on with the check [51:15] around, nobody dog enough. [51:17] Did you ever contact the county about her being stray or anything like that? [51:21] And I went down to the court and they stored it to ask anybody and they said anybody know [51:26] that my number seemed like lost their dog, nobody never contacted him. [51:31] So I have a question, did you call the shelters and see if they have your dog, if they [51:34] have pinky? [51:35] No, I didn't. [51:38] Okay. [51:40] When you say [51:45] that, that's for your life. [51:48] Was pinky contained? [51:49] Did you have like a crate or was pinky out of it? [51:52] Did you have a cage? [51:53] You had her own pin. [51:55] Somehow she got out of it. [51:56] I don't know what happened. [51:58] I wasn't near. [51:59] So I can't really tell you what exactly happened. [52:03] Madam Chair. [52:04] Yes, sir. [52:05] Just for a couple of hours to keep in things for the record. [52:09] Your Mr. First name again? [52:12] Yes, sir. [52:13] OK. [52:15] The citation was written to us, son. [52:17] I want to make sure that the correct Mr. Washington is taking ownership of the [52:20] Canine Pinky. [52:22] It seems several times during testimony. [52:24] The Canine was dropped off three months ago. [52:26] He was carrying for the Canine. [52:28] He's accepting the citation at this point for the record. Yes, sir. Thank you [52:38] Any questions? [52:42] May I have a motion someone? [52:51] I have motion. Go for it. [52:55] Sir, real quick before he does it, you might want to check the shelters. [52:59] Yeah, I work at the Humane Society on the director. [53:01] Oh, gosh. A shelter might have pinky right now and you just don't know it. [53:05] Oh, right. [53:08] Yep. [53:08] Yeah, sir. [53:10] Okay. [53:12] Can we [53:14] We don't have the dog. How does that work for any type of violation or violation? [53:23] You can't call me complains if it isn't the dog, if it isn't. [53:31] No, I mean, just in general, if it doesn't have the dog. [53:33] If it doesn't have the dog, can he send out with the dog? [53:37] No, no, it doesn't have the dog. [53:38] So I think for purposes of maintaining the safety of the community, [53:43] I would encourage animal control to continue their efforts to locate Pinky. [53:48] hopefully Pinky is shown up in a shelter and Mr. Washington continues to exercise ownership [53:59] or a custody of Pinky and all of the developments would follow Pinky. At this stage [54:09] I understand it's kind of a unique situation where the dog itself is at large and can't be [54:16] So, if this board does decide to find Pinkie Dangerous and or Vicious, or Dangerous and Vicious or potentially dangerous, and then follow with all of the relevant abatements, [54:31] you could always tailor the motion to say once Pinkie is in the ownership or custody of Mr. Washington, then the abatements would follow. [54:44] To me, it doesn't make a lot of sense to have a double enclosure and signs and all the stuff that goes along with it for a dog that may or may not appear again. [54:55] So, just something to consider. [54:57] What are your intentions with Pinky? [54:59] Are you going to keep her vet her? [55:02] Well, it was, because she seems to use a nice dog, a nice, friendly personality, and everything. I was more people. [55:09] Mr. Sherman? [55:10] Madam Chair. [55:10] Yes, sir. [55:11] But just for the ownership and the follow-up on this Hodges, why you had Pinky, did you happen to get her microchip? [55:19] You know, I didn't. [55:19] No, she was kind of a spook, it's scary and little, like, it's scary, so I didn't really, she's coming around. [55:26] So I was a way to see come around. [55:28] I could take around people for she, you know, I do what they were. [55:31] So anything that comes into the Charles County Animal Care Center, I believe, maybe at the, at the Humane Society, [55:38] We would scan it to be my courtship, but it's still always a good idea. [55:42] Chips do move. [55:43] Maybe a scanner doesn't pick it up. [55:45] It's always good for you to take the time in and possibly try to ID. [55:49] Thank you. [55:50] Okay. [55:51] Thank you. [55:51] Thank you, sir. [55:53] Yes. [55:55] After hearing the testimony presented this evening regarding citation. [56:01] 7491. [56:02] I make a motion that the board finds Mr. Washington. [56:05] In violation of 230-10A, individual county license with $50 fine. [56:12] In violation of 230-9A, prove for rabies with $150 fine. [56:19] In violation of 230-125, dangerous and or vicious or potentially dangerous with a finding of dangerous and vicious with a $200 fine. [56:31] for a total of $400 with $350 held in a bans for a period of six months, also all relevant [56:44] abadements to follow once Pinky is located. [56:50] All those in paper? [56:52] I second that. [56:55] I have a quick question. [56:56] So, the motion is, once Pinky is located, is that located in Return to Mr. Washington, or is that located in shelter somewhere, I'm assuming it will go back to located in Return to Mr. Washington. [57:15] Thank you. [57:18] All those in favor? [57:19] Aye. [57:20] Any opposed? [57:22] Any abstain? [57:22] Is there a discussion? [57:25] All right, Mr. Washington. [57:26] And reference to Pinky and Citation 7491, you have been found in violation of 230 10A individual license with a $50 fine. [57:38] You have been found in violation of 239A, valued provide rabies with a $150 fine. [57:44] You have been found in violation of 230 125 with dangerous and revicious with a $200 fine for a total of, what did you say 450? [57:58] $350 is going to be held. $50 will be doing 30 days. If you come back before this board [58:06] with Pinky in the next six months, those fines will come back. We are also putting a [58:13] baitments on this order for Pinky if she were to come back into your possession. [58:23] So you [58:28] 2, 30, 12, 5, E, 1, 2, 3, 4, 5, 6, 7, 8, and G. She will give you a list of the things that you [58:39] will now have to comply with if Pinky comes home and is now yours. [58:44] Listen, Pinky's deemed dangerous to vicious in this county and I understand this is a lot [58:48] to deal with, but if you see her, you need to tell somebody, you need to notify the county [58:53] that you have seen her in and around your property so that she does not hurt somebody's [58:57] child. Okay, thank you. [59:00] Mr. Washington, do you have a picture of Pinkie? [59:02] No, I do not have a picture of you. [59:03] Okay. [59:04] I had one of my cousin got one supposed to send it to me. [59:06] Okay. [59:07] Because I would say if you had one, I could tell you if I have one. [59:09] That's what I was thinking too. [59:11] Do you have a side of two? [59:12] Thank you. [59:22] Madam Clark. [59:28] 17607 Animal Control Services vs. Myra E-Hemoniz. [59:42] Please raise your right hand. [59:44] Please raise your right hand. [59:49] Please raise your right hand. [59:53] Please take your name for the record. [59:55] In a morning sure officer shine a blue badge number 534 which all can be in a morning sure [1:00:05] On Sunday, August 16, 2026, at approximately $1,900, I was fondered to the residents of 3,1505 Apple Creek Lane, a ward off Maryland, for the report of a contained stray canine. Upon my arrival, I observed a red and white male Husky type canine that animal controls familiar with through past experiences known as Jericho. Jericho is known to animal control for a history of aggression, both towards previous finders, and towards previous finders. [1:00:33] animal control officers. Jericho has previously been picked up by animal control officer [1:00:39] Hayes on 1031, 2025, an officer kneel on 747, 2026, at scene in exhibit 1. Please note [1:00:49] that the shelter staff has noted Jericho as aggressive under the observations of all three [1:00:54] intakes as seen in exhibit 1. At this time, I would like to call forward officer Hayes [1:01:00] as my witness. [1:01:02] Officer Hayes. [1:01:09] On October 31, 2025, I was dispatched to a residence in Waldorf for a canine that had [1:01:16] followed the caller home while she was out walking her dog. [1:01:20] The canine was reported to just be hanging out on her front porch of wooden leaf. [1:01:25] Upon my arrival, I observed the canine to be a red and white male husky type known as Jericho, [1:01:30] standing on the front porch. [1:01:32] It was Halloween, there were children out trigger treating, it was a heavily populated area. [1:01:38] When I approached Jericho, he became very territorial, he was growling and showing his teeth. [1:01:44] Jericho was guarding the front porch as if he lived there. [1:01:48] For those familiar, he was showing a lot of signs of resource guarding. [1:01:52] I utilized my catchflow when I was able to contain Jericho and place them on my vehicle. [1:01:57] It's reported to the Charles County Animal Care Center under Profile 30748 and all of its [1:02:04] occurred to the Charles County. [1:02:08] Thank you. [1:02:09] Officer Burr. [1:02:11] And at this time, I would like to call for what Officer Niel's mobile. [1:02:15] Officer Niel. [1:02:18] Please raise your right hand. [1:02:19] Do you declare an affirmative the penalty of perjury but the testimony about the gifts [1:02:22] of the truth? [1:02:23] Please state your name for the record. [1:02:25] Officer, can a Niel batch number 539 for Charles County Animal Control? [1:02:29] on July 4. A little bit before one o'clock in the morning I was dispatched for a [1:02:37] stray animal pickup. We had worked overnight on a large scale seizure. So I called [1:02:45] the complaining party to request that she hold the canine into working hours. She advised [1:02:53] that where they had had the canine since 9 p.m., the canine had turned on them and became aggressive [1:02:59] in their house. And at that point they had the canine on a leash, the leash shoved through [1:03:05] a storm door and they were holding it on the inside of their house. The canine was on the outside [1:03:09] of their house. They were unable to leave their residents due to the behavior of the canine. [1:03:15] Upon arrival, the canine immediately sang me, began lunging, growling, and barking aggressively. [1:03:25] I attempted to catch pull it when it reached the end of the leash that was in that storm door. [1:03:32] It then retaliated against the glass itself of the storm door trying to get at the fallers. [1:03:40] I was able to catch pulled a canine once it was taken to the Charles County Animal Care Center. [1:03:47] It actually required three officers to get it off of the truck, due to its demeanor, and damaging nature towards our equipment. [1:04:00] Thank you. [1:04:02] Mr. Burrah. [1:04:05] Upon my arrival, Jericho is located in the Kavaj and upon seeing me, [1:04:10] began bearing his teeth, growling, barking, and charging at me. [1:04:14] Utilizing both vocal commands in my catch full, I was able to contain Jericho and place [1:04:19] him on my truck while I then transport him to the Charles County Animal Care Center. [1:04:24] Once of the shelter, it did take me an extensive amount of time to then place a pole back [1:04:29] on Jericho to get him off my truck due to the fact that he was showing more aggressive [1:04:34] signs. [1:04:35] He actually broke through two casings to the cable to two different catchables and at this point [1:04:43] I actually called for backup from Officer Inglom who at that point was in route to me. [1:04:49] I did manage to get Jericho on a poll and into the shelter at that time. [1:04:54] On August 17th, I made contact with the owners, Myra Haminas, who advised that Jericho [1:05:00] keeps digging holes under the fence, but that Jericho is supposed to be under the watch [1:05:04] of a 15-year-old daughter. [1:05:07] I advised Ms. Haminas that Jericho was found approximately one mile away when I picked [1:05:12] month last night and described his behavior from each time he had been picked up by both myself [1:05:17] and the other previous animal control officers. A potentially dangerous animal impound notice was [1:05:24] issued as seen in exhibit 2. Citation 7606 was issued for running at large, third impound [1:05:31] and a potentially dangerous animal due to the continuous history of safety threats towards people [1:05:37] and less than a year's. I do have a bill from the Charles County Animal Care Center for a total of $110, [1:05:45] which is good to know tomorrow should the board allow jail code to be replaced. [1:06:08] Misamines has [1:06:09] waived of 14 days to be held tonight in all events that occur inside Charles County. Thank you. [1:06:14] Does anyone have any questions for us to bear? [1:06:33] Which one of you is testifying? [1:06:35] So she has to use in the dollar transfer. Okay. You both have to be sworn in. [1:06:51] Please raise your right hand. [1:06:54] Well, do I move up a little high, too? [1:06:58] Oh, I guess we'll see it where the translation line? [1:07:14] What is your name? [1:07:15] My name? [1:07:16] And up, please raise your right hand. [1:07:21] Do you solemnly swear in a firm that you will make an accurate, complete, and impartial [1:07:26] translation of all communications during the preceding. [1:07:30] Please speak into me. [1:07:34] Please state and spell your name for the record. [1:07:37] I'm [1:07:45] just pushing it in a whole day. [1:07:47] I mean, I'm going to go there. [1:07:48] Yeah, as long as it's green. [1:07:51] So now we need to swear my brain. [1:07:54] So you're going to have to repeat after me. [1:07:57] Yes. [1:07:57] Please raise your right hand. [1:08:00] Well, so you need to translate this to her. [1:08:04] Please raise your right hand. [1:08:06] Do you declare an affirm under the penalty of perjury that the testimony you're about to give is the truth please state your name for the record [1:08:28] Just push it once and when it's on green it's on might a human is right now. I'm tell me what happened [1:08:38] So, basically, Jericho, he keeps making a time at the end. [1:08:47] I thought she was, she said that she was her dog, she was control over. [1:08:52] I can tell. [1:08:52] I can tell. [1:08:53] I can tell. [1:08:53] I can tell. [1:08:54] So, [1:08:58] who is testifying today? [1:09:00] I have a sponsor for the dog, right? [1:09:02] So, I can tell. [1:09:05] Well, she's saying that she, she's like, she signs the people, [1:09:09] but I'm the one that takes care of Jericho. I'm the one that I'm the owner of Jericho, please. [1:09:17] Okay. Please raise your right hand. Do you declare an affirm under the penalty of [1:09:22] perjury that the testimony you're about to give is the truth? Please state your name for the record. [1:09:27] Edna said, Edna, how old are you? 50. Okay, so that's the problem. [1:09:34] There you go. [1:09:36] I'm sure. That's where we're at. [1:09:40] She is not legally allowed to own a dog, so it would be myera, except in full responsibility. [1:09:48] I understand that it may be her chore or her job to take care of the canine, but myera is the owner. [1:09:55] Thank you. [1:09:55] Now it's making more sense. [1:10:00] Because you are not legally allowed to take responsibility for a dog at 15 years old. [1:10:04] Your mother has to legally be responsible and take possession of Jericho. [1:10:10] What's your mother witness to this last escapade? [1:10:23] No. [1:10:26] So no one knew that Jericho was out only in my older brother. [1:10:39] Do you have anything to add? [1:10:41] Do either of you have anything to add to this incident? [1:10:45] So Jericho is out, nobody knew animal control picked him up. [1:10:51] Where does Jericho live? [1:10:54] Jericho is in the backyard tied up because he likes to make holes and stuff. [1:10:59] So we haven't tied up to make sure he doesn't make holes. [1:11:01] But somehow, in some way, he, like, undid his being and he decided to make a hole in it. [1:11:08] Because you know, that he cannot live tethered in Charles County. [1:11:11] He cannot live in the backyard on the chain. [1:11:13] I mean, he doesn't live there, but you keep him outside during the day, because he doesn't like being inside at all. [1:11:21] In Charles County, you can only keep a dog tethered for, I think, it's four hours at a time, 24 hour period. [1:11:31] My apologies, it's four hours in the 24 hour time span. Okay. [1:11:39] That's just what you're at a vacation in the future. [1:11:42] You say that Jericho likes to have you taken any steps besides the tethering to try to curb that. [1:11:53] Yeah, we tried to cover it. He stays on covering it. We tried multiple times. We tried heavy stuff. He stays moving it. [1:12:01] Have you seen any of Jericho's aggressive behavior towards people who are not family members? [1:12:10] And I would as he won't have been taking us from here and get them from here. [1:12:15] No, give them, give them, give them, give them away from here. [1:12:17] People that are not family, yes, but people that are family, he's not aggressive to them. [1:12:22] Okay. [1:12:23] Okay. [1:12:24] Is it, um, this is the third time in the year that Jericho has been loose, um, in the community [1:12:33] in which he is being aggressive to our animal control officers, like how are we going to stop this? [1:12:43] Like what's going to happen? Like how come Jericho is not inside? [1:13:05] in one of the yoke from the plane, [1:13:08] in six tapalasia, or you can never see it. [1:13:11] How do you come with him? [1:13:12] The time when she said that my older brother would take him out [1:13:17] instead of taking him outside to use a bathroom or something [1:13:20] or just let him play outside and he would still make holes [1:13:23] and under that's why he would just make holes [1:13:27] in the under the game, the fantasy. [1:13:32] Is Jericho fixed? [1:13:33] Is he fixed? [1:13:36] No. [1:13:38] No. [1:13:40] Does he have his shots? [1:13:42] I don't know. [1:13:43] It's not social. [1:13:44] Okay. [1:13:45] Let's do a shoulder attack. [1:13:47] That question. [1:13:48] Since he's been impounded several times, and has not done very well, have you considered [1:13:53] surrendering him to the county? [1:14:18] I'm giving up your ownership of them to the county, surrendering them. [1:15:00] Is that a consideration today? So, [1:15:06] there is consideration that she would sign the dog over to general control today. [1:15:12] I think I'm not going to get a call. [1:15:18] Like... [1:15:18] Madam Chair? [1:15:19] Yes sir. [1:15:20] If I can interrupt. [1:15:21] I think myself or my officers would be better equipped. [1:15:25] It's a tough home situation. [1:15:27] I would take both of them out and in the evening exactly. [1:15:30] We can bring in the option. [1:15:31] But the only option is going to be. [1:15:34] You can. [1:15:34] And then we can come. [1:15:35] We can be. [1:15:38] So, how do we, do we pause this for now, Madam Clerk? [1:15:46] I recess this one. [1:15:48] I make a motion to table 767 for now. [1:15:54] Is there a second? [1:15:55] Second. [1:15:56] All those in favour? [1:15:57] Aye. [1:15:58] Any opposed? [1:15:59] And for the purpose that animal control is going to do their explanation. [1:16:02] We can all come back and reconvene. [1:16:04] And they're going to explain to you what that would mean today. [1:16:06] I know what they're going to explain that you have to explain that to your mother right now because you're 15. [1:16:17] Is this the so you this is when you would like a break. [1:16:26] Okay. [1:16:27] Yep. [1:16:27] Sure. [1:16:28] We are going. [1:16:30] Can I get a. [1:16:31] Yep. [1:16:32] Four or five minutes recess. [1:16:34] Oh, there's a favorite. [1:16:35] I would do a second. [1:16:36] Is that good in favor? [1:16:37] All right. [1:16:38] Any opposed? [1:16:38] Okay. [1:16:39] I'll park there you go man five minutes. [1:17:03] Okay, we are back in session at 7.33 coming back to [1:17:07] citation 7.607. [1:17:12] Are we in a grants officer brewer? [1:17:17] So what we will do is dismiss our citation [1:17:22] and then it's now turned over to animal control for the record. Yes, sir. [1:17:28] Just for the record. Myra Zalais, owner of K9 Jericho, has elected the sign. [1:17:37] They came in over on profile number 3, 6, 2, 1, 5, 7, and also on the ticket. [1:17:43] It's been explained. Our PTS is on the ticket. [1:17:47] The owners request and understand that the K9 will be euthanized at the shelter tomorrow. [1:17:52] Okay, [1:17:57] so I will make a motion for citation 7, 6, 0, 7 that it be dismissed. [1:18:05] Is there a second? Is there a second? All those in favor? [1:18:10] Any opposed? Is there a discussion? Any abstained? [1:18:15] Okay, so for seven, six, zero, seven, for myriiness, my apologies, if it's not right, we have dismissed that ticket. [1:18:28] So the violation she was in on the ticket itself, they have been dismissed. [1:18:40] So that's it on our end. [1:18:43] Okay, all right, thank you very much, ladies. [1:18:45] Thank you. [1:19:00] This is two different. [1:19:04] There's two more? [1:19:04] Yes. [1:19:05] Okay. Okay. Okay. Okay. Got it. [1:19:11] Whatever you're ready. [1:19:14] File number 26-11 are Kiba Sandwich versus Clinton Brown. [1:19:20] The Sandwich. Sandwich. [1:19:22] Yes, ma'am. That's fine. Thank you. [1:19:25] Please raise your right hand. [1:19:27] Do declare an affirmative the penalty of perjury [1:19:29] that the testimony you're about to give us a truth. [1:19:32] Please state your name for the record. [1:19:34] Make sure you speak in. [1:19:45] Whenever you're ready, [1:19:46] My name is Sandra Jen, please be mindful of the three minutes time-frame. [1:19:53] Okay. [1:19:53] Thank you. [1:19:54] So I brought this matter because there have been numerous occasions where my neighbor's dog has been outside and attended. [1:20:03] Most recently, my son and I had a couple months ago though. [1:20:09] My son and I were walking at dogs in the evening and my neighbor's kids were outside. [1:20:14] And the dog was outside running around in the yard, which would normally be fine if the dog did not leave the yard. [1:20:23] We have had a number of incidents where their Gemma Shepherd has left the yard and come over to our dogs. [1:20:30] I have one small multiple, who has a very, has Napoleon syndrome. [1:20:36] And then I have a three-year-old pebble, three-old pebble, it's skittish. [1:20:41] They have had numerous incidents, whereas she's on alert every time we walk past [1:20:46] their house, because that German Shepherd always comes out the yard. [1:20:49] This particular instance, my son was walking ahead of me, and the dog, actually, went [1:20:55] around the back of the house, came around to the side, so it was sort of like coming this [1:21:00] way. [1:21:00] And when the dog came up behind my son, and his dog, their German shepherd, the Niferci was kind of sniffing her, then she kind of tried to jump on her. [1:21:10] And my son had to swing our dog away to try to keep them from interacting. [1:21:14] For me, that was the last dog, because I have smoked to my neighbor a couple of times. [1:21:19] It's like, okay, we'll take care of it, and which would be fine, but it's always happened. [1:21:23] It might die down for a couple months or so, but it'll happen again. [1:21:28] But this particular instance, my adults could have gotten into a fight. [1:21:33] My son could have gotten hurt. [1:21:34] It was like the last dog. [1:21:37] And even since then, they haven't had interactions, [1:21:41] but the dog still has been out on attended at times. [1:21:45] Or if the kids are watching the dog, the dog doesn't necessarily listen to the kids. [1:21:48] The dog doesn't listen to the father. [1:21:51] When he's outside, we have no issues. [1:21:52] But it's just I don't want that issue to be the story that we've heard some of the stories that we've heard today. [1:22:00] And I've like I said I've spoken to them a couple of times. [1:22:03] And after that last instance, it was, no, I'm not dealing with it no more. [1:22:08] I'm not going to keep calling animal patrol. [1:22:10] I'm not going to keep speaking to y'all. [1:22:12] Because to me, a puppy would know rules become a dog with no rules. [1:22:17] And I just don't want that stuff to happen. [1:22:19] And like I said, I have a, I have a people and to me in history, people are always [1:22:26] the aggressor. [1:22:27] She's very docile, but that doesn't mean she won't do anything and I just didn't want [1:22:32] that to happen. [1:22:33] So that's why I brought this and my other neighbors have had issues, I've reported to the [1:22:37] HLA, they tell me to talk to them, I've talked to them, so I've been going around [1:22:42] a circle. [1:22:43] So this is like my last resort. [1:22:44] Okay, questions. [1:22:51] Okay. Thank you, ma'am. Mr. Brown. Is it Mr. [1:22:58] You can have a seat right there, sir. [1:23:05] Can you turn on your mic? Please turn on the mic, sir. [1:23:10] Please raise your right hand. Do you declare an affirmative the penalty of perjury that the testimony you're about to give us a truth? [1:23:16] Please state your name for the record. Please speak into the mic. [1:23:20] Mr. Brown, go ahead. [1:23:24] Just here to get this over with, I got electric fence, I put a lock up so the kids don't [1:23:29] let them out and just really get this over with, so whatever you ought to say, I paid [1:23:34] and move on. [1:23:41] So there's no concern that the dogs come after property, and I got electric fence, and I [1:23:47] just got a lock on the back door, the front door, so the kids don't go out, my kids do [1:23:51] play in a yard, I got five kids, so this is dog live outside, no dog live in the house. [1:23:56] So this is only on the dog's outside. [1:23:59] Yes, and I was family dog. [1:24:01] When did you get the electric fence? [1:24:04] Ah, what a week ago. [1:24:05] I got a picture to show you that. [1:24:07] I want to see it. [1:24:08] I want to get it over. [1:24:09] How is the dog responding to the electric fence? [1:24:12] Fine. [1:24:15] Yeah. [1:24:16] My dog's a good dog. [1:24:18] I've been, I've lived here long and in her. [1:24:20] So, I've been there in front of her. [1:24:21] So. [1:24:22] But I understood. [1:24:23] So I'm a sitter. [1:24:25] Get it over. [1:24:26] There's a dog up to date on. [1:24:27] I'm sorry. [1:24:28] Yeah. [1:24:29] He's talking more dogs than that. [1:24:30] Is the dog up to date on his rabies and stuff? [1:24:32] Dog up to date. [1:24:34] Okay. [1:24:35] What is this dog's name? [1:24:38] Reseldo. [1:24:41] Can you spell that? [1:24:43] Nope. [1:24:46] You're going to make it real difficult. [1:24:47] I can't spell it. [1:24:48] I don't know how to spell it. [1:24:49] So what would be on her back record? [1:24:52] What would be the back records? [1:24:54] So right now we cannot verify that you have this electric fence. [1:24:56] And we cannot verify any better. [1:24:58] I have pictures to program. [1:25:00] Did you bring that? [1:25:01] Did you submit that for evidence? [1:25:03] I have on my phone. [1:25:04] Did you submit that to evidence? [1:25:06] Okay, so there's no verification. [1:25:08] I'll show you now. [1:25:09] No, thank you. [1:25:13] Does anyone have any questions? [1:25:22] Is there a motion? [1:25:25] I have a motion. [1:25:27] Yes, ma'am. [1:25:29] Having heard the testimony for about number 26-11. [1:25:35] I find the defendant, Mr. Brown, in violation of 12.5 points C, with a $50 fine, and [1:25:52] the abatements? [1:25:54] No, no abatements. [1:26:00] Is there a second? [1:26:01] Second. [1:26:02] Is there a discussion? [1:26:07] I have a discussion. [1:26:08] I don't think he's going to follow anything that we say, and I think that if he does not, if [1:26:12] is added to that it is here and a judicial proceeding is anything like he is being a neighbor [1:26:17] his neighbors somebody is going to get hurt putting that on record well right now there [1:26:22] hasn't been any correct and he was the thing is that you know what we're charged with [1:26:28] yes given this process of dangerous animal not now it was being charged got to you if it [1:26:33] was a timid a yes but unfortunately the charge of it is in to respond to is this [1:26:40] And it's just for future reference, do you have to do this? [1:26:46] The public nuisance portion, more pertain to this. [1:26:50] So if, in fact, it ever happens again. [1:26:53] Look at, because I'm not going to tell you what to check, [1:26:56] but look at all of them and check what all applies. [1:27:01] So if his dog, any neighbor's dog, [1:27:05] is approaching you on the street or what have you, [1:27:08] There's other more effective things that could be checked on here. [1:27:19] That's what I was like, I don't know that I believe that she's potentially dangerous. [1:27:23] So that's part of the discussion. [1:27:25] That's my thing is I don't know that I would, if this is kind of deeming her dangerous or whatever. [1:27:29] I don't know that I believe that I believe this. [1:27:31] So that's where I, for this thing, would say I would fire not guilty of this. [1:27:36] And maybe you can't change it. [1:27:37] Yeah, I can't change it. [1:27:38] But I don't know that I'm, that has been shown that she's potentially dangerous. [1:27:42] I agree with you, Dr. Quick, she's a bit in her brain. [1:27:46] She's just loose. [1:27:48] Yeah. And she shouldn't be. [1:27:48] Intimating because of her size. [1:27:50] Yeah. And she's out. So, yeah. [1:27:53] So, I would say that I would. [1:27:54] So, are we one? [1:27:55] We're not one second man. We're in a voting process. [1:27:58] So, who second did that? [1:28:01] I did. [1:28:02] Okay. [1:28:02] But then we have, we're not going to get a full vote. [1:28:06] Well, we can vote on it because we have Ms. Greenleaf. [1:28:10] All those in favor of Ms. Nanzales' vote motion, aye. [1:28:20] All those in favor? [1:28:23] Those who are opposed. [1:28:27] I guess, aye. [1:28:28] Okay. [1:28:29] Any of the things? [1:28:31] So at this point, the motion passes. [1:28:34] So on a dog that I don't know it's name. [1:28:47] Mr. Clinton Brown's dog has been found in violation of 125C, potentially dangerous animal [1:28:55] on any animal bias action constitute a physical threat to human beings and other domestic animals [1:29:00] or both with a 50-hour fine and I can give you 30 days to pay that. [1:29:05] Madam Clerk, if she can. [1:29:13] So I wanted to say this, when you had mentioned, it's just because it's out, it wasn't [1:29:19] just because it's out, because it's been actually like barking that kind of thing. [1:29:23] That's why I bought it. [1:29:23] We agreed with you. [1:29:25] So I just wanted to bring it to a tent. [1:29:27] Yeah, sure. [1:29:28] Yeah. [1:29:28] What we have checked off that why can actually judge, yeah, you're an A, I don't, I don't [1:29:33] just agree with the decision. [1:29:34] I just want to stop them. [1:29:35] But I just want to say that part. [1:29:38] Yeah, I'm fine with that. [1:29:39] It happens again. [1:29:39] All right, thank you both. Thank you. [1:29:54] Thank you, man. Thank you. [1:29:56] I owe 26-12. [1:30:32] On May 18th, Ms. McCall was seen on my green camera with her dog loose with no leash, [1:30:46] defecating in my yard. [1:30:51] She didn't control her dog. I did see her get a leave the dog to go, I guess. [1:31:01] And then she came back. She was in camera view and came back to try to get the dog. [1:31:08] But she wasn't in a hurry to get her dog. She just let the dog home in my yard like it was a dog park. [1:31:18] On May 19th, the very next morning, around 9.55 am, the dog is roaming in my yard again, [1:31:30] defecating. [1:31:32] And she was in Oresh, left the dog again, like a dog park, defecate all in my yard. [1:31:40] And I guess he had to really go because he kept defecating all in my yard. [1:31:45] Not in one spot, but like three different places and both incidents were captured on video. [1:31:51] She was very reckless because I opened the door to say get your dog. Stop, can you stop your dog from pooping? [1:32:00] She said you want me to get my dog now and I said yes. She said no. [1:32:06] And [1:32:08] I [1:32:08] I was live it and I told her I'm gonna call you know call the police. I want to shoot the dog. [1:32:14] Um, but I said I'm going to call the, you know, call the police. [1:32:18] She wasn't controlling her dog. [1:32:19] The dog came up towards the door. [1:32:23] She still wasn't getting her dog. [1:32:25] She was knelt down with a bag trying to pick up some defecation, but she just didn't control [1:32:32] her dog. [1:32:33] So the dog came up and she yelled at me, closed your door. [1:32:37] So I did slam the door because the dog would have came into the house. [1:32:40] But I got even matter and cracked the door to say, [1:32:44] this is why your dog needs to be on a leash. [1:32:47] I caught you the day before on camera, you didn't control your dog. [1:32:52] And I said, I'm calling the police and slam the door, [1:32:55] and then having further interaction. [1:32:58] And she just allowed the dog to keep defecating my yard. [1:33:02] Okay. Any questions? [1:33:04] I have a question. [1:33:05] And you checked one of the choices of intimidate pedestrians, neighbors and pastors, I mean, do you have a story? [1:33:14] Say that again? [1:33:15] That the dog was intimidating, pedestrians, neighbors and pastors, I mean, can you have any testimony regarding how the dogs intimidate you? [1:33:24] Yeah, when he came up to my front door and she didn't do anything. [1:33:28] The dog came up to my front door and he was being aggressive toward you then. [1:33:31] I almost are unpredictable. I don't know what that dog was going to do. [1:33:37] No, the dog was in Rowling. [1:33:40] It wasn't Rowling. [1:33:44] All right. Thank you, Ms. McCall. [1:33:48] You can stay there, ma'am. She can go on the side. [1:33:55] All right. [1:33:55] Whenever you're ready, please raise your hand. [1:33:58] Do you declare an affirm under the penalty of perjury [1:34:00] that the testimony you're about to give to the truth? [1:34:02] Please state your name for the record. [1:34:06] Whenever you're ready, Ms. McCall, [1:34:07] if you could just tell me what kind of dog you have. [1:34:09] He's a lot of half of him anymore, but he's a staffer, a staffer, a staffer, whatever. [1:34:14] Okay, go ahead. [1:34:16] So, I was in the process of moving. [1:34:19] And so, we were in the garage sorting through stuff, gone through stuff. [1:34:22] He did get out. [1:34:23] He's not typically outside. [1:34:25] She had never seen him before that. [1:34:27] For sure, she'd never seen him before that. [1:34:29] He does a typically outside. [1:34:30] He was a great train. [1:34:31] He was not outside dog, like if you put him on a leash, he wouldn't move. [1:34:34] He would just lay down. [1:34:35] He was like that when I got him. [1:34:37] So when he did run out there, I wasn't shot, but you can see me on the camera that she sent on the video [1:34:44] Literally running to get him. I grab him. I try to drag him. He starts pooping. I [1:34:50] Don't know what you want me to do at that point. He's literally pooping [1:34:54] So I run back I get a bag because there's nobody outside. I run back I get a bag we live on a cold a set [1:35:00] Everybody knows us. They know I'm not gonna have no aggressive dog [1:35:03] I run back, get the bag, I come back, I'm picking up the poop. [1:35:07] You can see me on camera, put my hands up like this because she immediately opens her door and goes, [1:35:11] if you don't get him, I'm going to shoot him. Whoa. How do you start off like that? [1:35:16] And so I'm like, okay, I can't get him right now. He's pooping. I can't stop him from pooping. [1:35:23] When he finishes, I will take him in the house promise. So I pick up the poop, we go back in the house. [1:35:29] She's never seen that dog again. He actually lives with my brother and DC now. [1:35:32] I'm most about a more city, so none of us live there. [1:35:36] She's never seen that dog before. [1:35:38] She never seen that dog after. [1:35:39] Everything that she checked off, except for, he got out, [1:35:43] makes no sense to me. [1:35:46] Just ask you a dog, never mind. [1:35:48] That doesn't have anything to do with that. [1:35:52] Isn't there any questions from us in the comments? [1:35:55] Not yet, [1:35:58] ma'am. [1:35:58] No questions? [1:35:59] Yes, ma'am. [1:36:00] It happened two days in the wrong night. [1:36:02] It had seen the dog before. [1:36:04] Because she did it in the second day. [1:36:05] Right. [1:36:05] as it been in the last month. I mean that was May. This is August. [1:36:09] No, I was in fact that situation I haven't seen the doll back in my yard. [1:36:14] Now, so this happened one day, two days, two days in a row. [1:36:18] Yes. But had you, and she spoke to her and said keep the dog away and the dog never came back after May 17th. [1:36:25] I haven't seen that that was captured on my camera. No. [1:36:29] Okay, so she was being semi-nebrily and kept it all off your property after you said something to her on the 17th, but not so it happened on the 18th and 19th. [1:36:42] Okay, excuse my dates, but the same, okay. Does it not have emotion? [1:36:56] I have emotion. [1:36:57] Sorry, please. [1:36:59] After hearing the testimony presented this evening regarding file 26-12, I make a motion [1:37:07] that the board finds, Ms. McCall, [1:37:14] not in violation of 12-4A1M or large, she was in [1:37:28] or a passapy, in violation of 12-4, 12-4, a defecate on public or private property, and [1:37:38] it happens on two dates, so that's $50 for each date for a total of $100. [1:37:45] Any bans? [1:37:46] No bans. [1:37:47] Is there a second? [1:37:49] Second. [1:37:50] All is in favor? [1:37:52] All right. [1:37:52] Any opposed? [1:37:54] Okay. [1:37:56] Miss McCall. [1:37:57] And reference to file number 26-12, the board found you not in violation at the dog vina [1:38:04] at March, not in violation of 124A and intimidate pedestrians neighbors pass the buys, in violation [1:38:14] of 124-8 times 2 for $50 times 2 with a fine of $100, and I can give you 45 days to pay [1:38:24] that. [1:38:24] even if I picked it up immediately after. Yes, ma'am. Your dog can't. You are late or [1:38:31] defecate on your neighbor's lawn. It's just one. [1:38:36] It wasn't leashed. [1:38:39] All [1:38:43] right. Thank you, ladies. Thank you. [1:38:56] You're okay. Okay. Whenever you're ready, ma'am. [1:39:00] File 26-09, Jacqueline Smith versus Mary Price, Miss Smith. [1:39:18] Are both of you testifying? Okay. One of you whoever is not going [1:39:22] first sit back and I will call you up. [1:39:26] Thank you. [1:39:28] Ms. Smith, [1:39:31] please raise your right hand. [1:39:33] Do you declare an affirm under the penalty of perjury [1:39:35] that the testimony you're about to give us a truth? [1:39:38] Yes. [1:39:38] Please say your name. [1:39:40] Yes, Jack, will Ms. Smith. [1:39:42] OK, Ms. Smith, for the record, we are not [1:39:45] going to talk about any of the documents you provided me [1:39:51] that are not in relation to this incident. [1:39:53] Nothing from 2020, nothing from 2015. [1:39:57] We are not going to discuss anything about 2019 and 2023. [1:40:04] Only thing that we are going to discuss is these current dates and times. [1:40:10] All right. When you're ready. [1:40:12] All right. [1:40:14] This has been going on for the record since I've got half past a year. [1:40:19] Okay. [1:40:20] I have rheumatoid arthritis and I have lupus. My daughter also has lupus. She also has a [1:40:31] pacemaker. She has a mechanical heart valve. She's on the kidney transplant list for the [1:40:38] second time. I'm her caregiver. [1:40:44] The stress calls. I need to know about this. I cannot. I need to know [1:40:48] dog barking outside between the hours of 11 and 3 or 4 a.m. and being rotated out because [1:41:01] it's more than one dog and you can hear them being rotated out on a video I sent because [1:41:07] the voice is the dogs are barking. [1:41:11] So you say you're not going to talk about anything. [1:41:17] I can be $4.20.20. [1:41:19] I'm not allowed to discuss anything over one year from today's state. [1:41:24] I cannot discuss. [1:41:25] We cannot hear anything outside of these dogs barking current. [1:41:32] Okay. [1:41:34] I found this complaint because I needed to stop. [1:41:38] It is affecting my health. [1:41:40] It is affecting my daughter's health. [1:41:43] It has affected my marriage. [1:41:45] I just got divorced. [1:41:46] that was one of the issues because he had to hear that he asked to get up before I am. [1:41:54] So if you're not getting any sleep and your sleep's getting interrupted, that's a problem. [1:42:01] So the effects currently, my health, the pain, I endure and we, those are all civil [1:42:10] issues that you may want to do something in civil court. I need you to tell me about these incidents [1:42:16] of those dog sparking and those dogs sparking only, not the ramifications of the dog sparking, [1:42:21] just the dog sparking. Okay, the incidents are she's placing the dogs out to bark in the middle [1:42:29] of the night. They are sometimes trapped on their deck and there is a gate on the deck that locks [1:42:39] and traps them there. So I've assumed being trapped in when you're used to being free all the time. [1:42:46] And as dark outside, you were barked. [1:42:50] So I don't know how she's getting on the bark, [1:42:53] but I assume that's how it's happening. [1:42:55] The barking has not happened since I fell this complaint. [1:43:05] Filed on, [1:43:10] did you file on May 19th? [1:43:12] I fell through the computer it could have been May 19th. [1:43:16] Talk to me about how she is abusing the dogs. [1:43:19] They're trapped on the deck, sometimes it's cold, sometimes it's hot, like 90 degrees, [1:43:30] summertime hot, okay, and then in the winter, if my blinds are open, the doll is going [1:43:38] to be outbark. [1:43:40] If I open my window because I want to turn my air conditioning off because I cannot live [1:43:46] air conditioning with arthritis. If I open it, the dogs are going to bark. [1:43:51] To the dogs are outside 24-7. They live out of the night. When I have called and complained [1:43:57] to the police, that was done this year. I told him I didn't want to take any drastic action. [1:44:04] This to me is drastic. I'm usually in bed right now after I take my shots in my medication. [1:44:10] Okay. I didn't want to have to take her to court and sue her for the rest. I didn't want [1:44:19] to have to do any. Okay. We're going back to this. [1:44:20] Who is your witness? My daughter who lives with me. Okay. Are you going to testify to any [1:44:27] different facts other than the dogs, multiple occasions on the deck? Do you have any different [1:44:34] testimony for a difference incident? Are you speaking to me? No, you're a daughter. I don't [1:44:40] If I need to bring her in, she's not sworn that I'm asking her to, she have any additional information before I bring her up to swear her in. [1:44:53] I mean, you do, and we're going to bring you up and swear you in, but if you don't have anything additional, I don't need you to come off. [1:44:59] But if you have something... [1:45:00] I think different, more than welcome to come up. All right, come on. And what is your name? [1:45:05] Erica Coward. Okay, Madam Clerk. I hate something else to say. [1:45:09] Okay, I'm going to let her speak for a second. [1:45:14] This woman does not live. [1:45:16] Ma'am, I don't know who she is. Ma'am? [1:45:22] Why should she? [1:45:23] You have to, you have to be sworn in. [1:45:24] One second. [1:45:26] Please raise your right hand. Do declare an affirm under the penalty of perjury that the testimony you're about [1:45:29] to give is the truth? [1:45:31] Yes. [1:45:32] Please state your name for the record. [1:45:33] Erica Caler, Erica spell that for me, you lost name, see it's in cat, O-W-A-R-D, [1:45:41] Magic Doll, got it, I think, go ahead, ma'am, as she said, you know, I'm also ill as well, and I'm [1:45:54] sorry, [1:45:54] Um, I'm ill as well and the barking is constantly at night because you and I will let our dogs out, probably nine, ten, a clock, and that's it. [1:46:12] No. I'm up one. I hear the dogs. I'm up three, four. I hear the dogs. I'm not getting [1:46:21] asleep. I need to sleep to live. [1:46:26] So this is a constant problem. Like I said, like my mother said, [1:46:31] I have Lucas. I'm on dialysis. I need rest. I can't rest with her dogs outside at one in [1:46:43] clock in the morning. So are the dogs kept outside all night? No, they're not kept outside all night, [1:46:49] but the dogs are outside at night at one in two o'clock in the morning, barking because she's left them [1:46:57] out there. How long are they out at one time to bark? Because you have a lot of dates with sometimes, [1:47:04] listed, so are they out for ten minutes, for half hour, for an hour, sometimes, ten minutes, [1:47:09] sometimes the hour or so at a time in the middle of the night in the middle of the night I hear it [1:47:16] maybe 10, 20 minutes just about you know after that it's hard for me to get back to sleep [1:47:28] because I've been walking up with the incestant bark and Miss Smith you've fought the police [1:47:38] I can't even talk about the multiple times because they want this year. [1:47:44] Okay. [1:47:45] It was in May. [1:47:48] I can't remember the date I did send it. [1:47:53] It was in the letter I had written. [1:47:55] Because I had brought a letter to the HOA this year also about it. [1:47:59] They would do nothing. [1:48:01] What I was about to say is this lady who signed up to testify [1:48:06] There's not a living at home. [1:48:07] That's not your concern, ma'am. [1:48:09] She's not there. [1:48:10] She's not there. [1:48:10] She's not there. [1:48:11] I don't even know who she is. [1:48:19] Is there any questions for Ms. [1:48:22] Erica or Ms. Smith? [1:48:26] Thank you very much. [1:48:28] Mary Price. [1:48:42] Thank you, ma'am. [1:48:43] Please raise your right hand. [1:48:45] Do you declare an affirm under the penalty of perjury that the testimony you're about to give is the truth? [1:48:50] Please state your name for the record. [1:48:52] Mary and Christ, make sure you speak into the mic. [1:48:59] Ms. Price, go ahead whenever you're ready. [1:49:05] Do you, is this a home or a house or townhouse? [1:49:08] Pardon me? [1:49:08] Are these or houses or townhouses? [1:49:10] Or, I'm, I'm not speaking to you. [1:49:13] If those two go home. [1:49:16] Man, cutting me off is rude. [1:49:19] I'm speaking to her. [1:49:20] I will give back to you guys if you need another minute. [1:49:22] Is this a home, a townhouse condo? [1:49:25] What do you, what do you, what do you do? [1:49:26] It's a single house. [1:49:27] Okay, thank you. [1:49:33] All right, whenever you're ready. [1:49:34] I have two chihuahua's. [1:49:39] Yes, sometimes they're on the deck. [1:49:42] They like the hot weather, the chihuahua's like hot weather. [1:49:46] They're not outside all day, they're not, yes, there's a gate on the decks. [1:49:53] So I could watch them and they're not out in the yard. [1:49:59] Yes, sometimes it's one, two, three o'clock in the morning. [1:50:03] I do not sleep well, so when I'm ready to go to bed, [1:50:09] the dogs go out. [1:50:11] The one dog, the one dog, yes, when we go out. [1:50:15] That's it for some reason. [1:50:16] When we go out the last time, she does a bark mark bark. [1:50:21] And that's it. [1:50:23] They're not out there for hours in the cold weather. [1:50:28] or the hot weather? [1:50:32] I don't think they're saying that. I think, but in the middle of the night, even a bark [1:50:36] is what is disturbing them. So I don't think they are not saying it's all night long or [1:50:40] what have you. I really wish that you two could have come to some sort of compromise because [1:50:45] I understand your sleep. This is different than y'all's sleep. But in the middle of the night, [1:50:51] I mean, is it possible to carry them off the deck? Can you go in a different part of the yard [1:50:57] Or do you only let them out? [1:50:59] I have found that if I the one that does the barking, I take her out on the leash and for some reason when we go out in the yard and she's on the leash [1:51:09] She doesn't bark. It's when I let her go out and I don't know if she's afraid. I don't know why she barks it and she's a dog. She's a dog [1:51:19] So yeah, I mean that's right, but at one but it's not a car. It's not a constant bark like [1:51:27] It's not a constant form. [1:51:28] Okay. [1:51:37] Form is price. [1:51:42] I have a question. [1:51:44] So since you've discovered that this dog does better, on at least, is that your plan going [1:51:48] for a way that, if she had to go out, you take that on at least the work and then try to avoid [1:51:53] as much as you can. [1:51:55] You know, when we understand dogs are going to bark. [1:51:57] We also understand that once you're in the morning, your neighbors, they're trying to sleep [1:52:00] because they're on a different sleep schedule. [1:52:02] Well, [1:52:08] when this was filed, [1:52:12] and you guys said that it has significantly changed in shoefile, [1:52:16] so whatever she's doing seems to sort of be working, somewhat, [1:52:24] if you can, [1:52:41] is there any [1:52:42] way that you could like, and I'm just asking, is there any way that they, their last time [1:52:46] they go out is like nine o'clock or something, and then they don't go out the next morning [1:52:50] or that they have to go out a lot because they're little dogs. [1:52:53] Well, because of the advances, small, they do go out every few hours. [1:53:00] I mean, I'm going to do my best to try to get them out by, I don't know. [1:53:04] What's the cut off time? [1:53:07] I mean, whatever you guys kind of agree on, I'm thinking if, you know, they go out [1:53:11] a last time at a certain time, then you know, you know, that's it, and then [1:53:15] you know, they won't come back out for a while. [1:53:16] I've been trying to do it earlier, like by 11. [1:53:23] All right. Thank you. [1:53:24] Thank you. [1:53:25] You're welcome. [1:53:29] Is there a motion? [1:53:33] I'm not going to get you messages. [1:53:38] Let's come down on this. [1:53:44] Let's ask questions. [1:53:45] I'll make one. [1:53:47] I was going to go ahead. [1:53:48] I love it. [1:53:50] Having heard the testimony in file number 2609. [1:53:57] I find the defendant Mrs. Price. [1:54:00] In violation of 12-4-A. [1:54:05] Barker make harsh or excessive noises to disturb the quiet. [1:54:14] With, because there's two dogs with $50 for each dog, [1:54:18] so a hundred dollars fine total [1:54:23] for this complaint. [1:54:25] No abatement, no abatement. [1:54:28] No. [1:54:32] Is there a second? [1:54:37] Is there a discussion? [1:54:39] Does it be a home? [1:54:42] Do you want to hold 50 dying on a day? [1:54:44] Yeah, I do. [1:54:44] that because misprice has said that census has happened so and it can always come back. [1:54:54] It's not like it goes, I'm not asking for it to be only 50. [1:54:57] It can always come back, whether we do two months, six months, eight months, you know, [1:55:01] it can always come back. [1:55:02] Okay, so I amend the mission to for $124-a $100 with $50 hell in advance for six months. [1:55:12] Okay, is there second? [1:55:14] Second. [1:55:16] All those in favor? [1:55:17] Aye. [1:55:17] Any opposed? [1:55:19] Any abstain? [1:55:20] Any discussion? [1:55:21] Okay. [1:55:22] Miss. [1:55:25] You have been found in violation. [1:55:27] Oh, I'm sorry. [1:55:29] I'm sorry. [1:55:30] I'm sorry. [1:55:31] I'm sorry. [1:55:31] Miss. [1:55:32] You have been found in violation of 12486. [1:55:37] Mark or make other harsh or excessive noise so as not to disturb the quiet comfort or [1:55:44] repose of members in the community. [1:55:47] You have been charged $50 per animal for a total of $100. [1:55:53] The board is holding $50 of that in a baguette. [1:55:56] If you come back, if Miss Smith brings you back before this board, that fine potentially comes [1:56:05] back. [1:56:06] So right now, I'll give you 30 days to pay the $50. [1:56:09] If you come back before the board, if Miss Smith brings you back before the board, [1:56:13] it would six months, ma'am. [1:56:14] Six months, that $50 will come back to the front. [1:56:18] All right. [1:56:18] Thank you, guys. [1:56:21] And I hope it continues. [1:56:22] I hope your neighbors can get some sleep. [1:56:23] I hope you can get some sleep. [1:56:26] Thank you. [1:56:36] You know, I didn't go quiet. [1:56:37] I needed the charging number on this. [1:56:39] So it was like I wanted to see it then. [1:56:54] Next on the agenda, ma'am? [1:56:55] I'm administrative discussion for the rules for vision. [1:57:00] I'm handed over to Mark. [1:57:02] So I'm going to keep it very brief. [1:57:05] As of now, I know that this past May, [1:57:08] we had discussed as a board, [1:57:11] certain rules proposed changes to the rules [1:57:14] that this board had agreed on, [1:57:17] seconded and had given County Attorney's office [1:57:20] the marching orders to draft those rules [1:57:24] bring it before this board here. So all my lists of stuff to do. So I want this new board that [1:57:31] we have here because there are some new members. I want to put a bug in your ear and actually [1:57:39] consider some other changes that you think should be implemented while we have this rules revision [1:57:45] process underway. For instance, hearing procedures in requiring that evidence be tied from a relevance [1:57:53] perspective as well as a timing perspective, if there's a complaint that needs to be brought [1:58:01] within one year, how far back do we want the evidence that is in support of that complaint, [1:58:08] how far back do we want to go? Because 2015's a long time from 2026. As opposed to relying [1:58:16] on past practices and, well, we've always done it this way. I, as you were legal counsel [1:58:24] and my partner here, would feel much better if we had something in writing. That says, [1:58:29] no, your submission can't be considered. It's too old. This is what the rule says. So that's [1:58:35] where I'm trying to get to. So the rules process is underway. My email is always open. My door [1:58:42] always open. Chief understands that as well. So we are here to support you guys and want to [1:58:49] bring that back to the forefront. Okay. Thank you. Thanks. [1:58:57] In the last thing I have is our next meeting is Wednesday, September 2nd, 2021. So we start meeting [1:59:04] on Wednesdays. I know. [1:59:19] Are we back in the other room? No, we're still in here. There's still [1:59:24] Instruction in that room until further notice [1:59:31] and you buddy else chief [1:59:34] Not under this time [1:59:41] Motion I'm old to adjourn second that
