[15:44] I'm a little nervous, really nerve racking to get up here for [15:49] me. I've been isolated. I want my life back, you know I'm kind of an extravert. [15:56] I've been forced into being an introvert, but I want my [16:03] communities help with some things. David junior was my abuser. He's also a continuously abused [16:13] other women in the community. Continuously sold drugs in our [16:17] community and is a detriment to our community and to me. [16:21] I have a paper here that I've already contracted the attorney [16:27] general's office to find out why this repetitive offender in our [16:32] community is allowed to keep re-offending women. My family moved from colorado to abilene, texas. [16:39] I was in elementary school. I remember a discussion with me and my sisters of how we were going to be able to make it with [16:48] dirt roads and horse and buggy carriages because we did not [16:54] know there were cars in texas. The other thing about texas is [16:59] men protected women and children so we felt like this was going to be a safe place for us. I am bringing a call to action [17:09] for men in the state of texas to be that again c. [17:14] for all of us women and children and to make more stringent [17:24] punishments for men who lay their hands on women and children in hour community. Sexually, physically, violently. [17:31] we've had several victims of domesticity violence lately. I ask the council look into david, birthday 0-3-12, 1981 and [17:42] find out why he's able to be a detriment to our society. Good to see you in your seat and see what you are going to do as a council person. [18:10] that's awesome. Want to make a note that ya'll are hosting the pre budget workshop next wednesday to [18:17] talking about budget items addressed and probably navigated through for our upcoming fiscal year and that's where things get [18:25] decided that are pretty important. What I think is important is this is part of that process. [18:31] every council meeting is part of that. This is a public meeting we discuss public things, policies, [18:37] things that are going on, and I find it's more of a business [18:41] meeting for ya'll. Not really set up to encourage and help citizens understand what's going on and I think each [18:49] meeting give us information to know what direction the budget is going and what costs are coming up, and if we need to [18:56] increase or reduce taxes by going below the new net revenue [19:01] rate. I don't think you are utilizing the full potential as it could be and I find many people have [19:08] plans to do things in the city withp n z or board of [19:14] adjustments. They are say what's your plan but this is the council is one of the few people that offer [19:20] that information beforehand so I'm going to address a couple of things in the consent agenda that I think it is sevens should [19:26] no more about and they can find this in the agenda packet. We actually were not able to purchase that truck we proved [19:33] last time so we saved money which I thought was a happy accident. City link is getting repaved and [19:39] funded through a grant of $300,000 and that's good to [19:44] know. There's economic agreement that has no fiscal impact but can reimburse up to 500,000 which is [19:51] confusing to me. There's street maintenance project on the docket that will be a proved for north 18th and I [19:57] think that totalled $5 million in projects to get approved to [20:01] be worked on from what the maintenance board approved through the last meeting and ya'll approved, as well. [20:09] then also we found out there's 3.9 million not reimbursed [20:14] through the texdot agreement because of different circumstances and I don't know why that is but it will women [20:21] come out of the water cip or the capital improvement project plan [20:26] so is that something that will be added and the revised budget [20:31] or will we sacrifce to make sure that's covered? These are things that are important, and if I have gotten [20:36] something wrong it's because there's not enough information as for me to read in the packet and that way you are doing your [20:44] job. This happened the media. Every monday before city council meeting the department heads [20:49] could go through to explain it to the media. [22:14] the request for you to consider is to change the zoning of [22:18] approximately 10 acres from residential district rsa to rs [22:24] 6. Location is 6498 pebble beach. [22:28] here's the location map for reference. [22:35] here's the current zoning map. Here's the current property [22:43] views. As you can see it's undeveloped. [22:49] here are the allowable uses. Notification is worse than that. [22:54] we received one in favor and 15 in opposition. Resulting in a 19-point 7 percent in opposition. [23:03] this meets all the criteria for approval in the land development code planning and zoning did hear this case and they did [23:11] recommend a denial by a vote of 5-2. The agent did repeal this for you to hear it today and I'd be [23:20] happy to answer any questions. >> questions of tim? >> there are some concerns that were shared in the responses and [23:28] opposition. One in particular. Was with regard to this wouldn't be in align meant with the deed [23:36] restrictions, can you address any deed restrictions you are aware of with this property that might come into play with [23:42] zoning? >> yeah, yeah. The deed restrictions from what I understand are not part of [23:47] this piece of property. I don't know why the original developer did not carry it on. The agent can speak to it more [23:53] than I can. The developer is in the process of creating those now. I don't know if they have a [24:01] chance but they can speak better. >> how is deed restrictions for zoning. [24:08] or do they at all? >> we're considering land-use. Not deed restriction. Does the property fit or [24:17] requesting the ones to go. Deed restrictions is another instrument they would file with the county clerk's and that goes [24:25] with the land no matter commercial residential and those deed restriction stay in place. [26:18] so this zoning request, really has do with our efficiency in [26:25] laying out the project. Can we go back a couple of [26:29] slides? Just where we can see the [26:39] proper property. [26:44] so 10.4 acres is the size of this tract currently zoned rs 8 [26:49] as was pointed out to the north is zoned also rs 8 to the [26:54] weathers is zoned a mix of patio home and to the south is medium [26:59] density and to the east tributes zoned rs 6 the zoning district [27:05] we're requesting to to go to. The property is unique. It makes it difficult to lay it out efficiently. [27:12] there's two roads connect into the track. [27:18] we're by code regardless of zoning districts. [27:23] other than those every other results in a cul-de-sac because we can't connect out to another neighborhood. [27:29] those are finished out properties. When you have a cul-de-sac you end up with what is called or [27:37] defined in the code as key lots. Typically they are also very large as compared to the rest of the neighborhood. [27:43] we have that square. So our hope with moving from rs [27:49] 8 to 6 is we can take advantage of one dimension, the width so [27:56] an r s 8 the minimum lot width is 6 feet and in the other is 60 [28:02] feet. This allows us to be more efficient with our layout and that's what this zoning rekwets [28:07] is about. It's not about anything else. What is it is not about is smaller houses. [28:13] not about tiny homes or condominiums. [28:19] it is simply about geometry and trying to be efficient with the [28:24] property that we have. My clients intention is for this to just be a continuation of the existing neighborhoods that are [28:32] out there. Like size lot and houses, that's [28:37] the intent. We're just trying to be more efficient with the layout. So you brought up deed [28:45] restrictions and I think that's important because it was talked about quite a bit at planning and zoning. [28:50] tim is right. Land-use or zoning is something totally separate from deed restrictions. [28:57] zoning is about the land-use. What is proper at this location? We can all agree single family is the only thing that's [29:04] appropriate here. That's it. I can't imagine another zoning district going here. [29:09] rs 16 single family and that's our intent. [29:15] deed restrictions on the other hand and let me give an example [29:20] to the east. This is the neighborhood currently that has been built and is currently under [29:27] construction. In and built that property there were no deed restrictions on the property, and if there were they [29:35] were from maybe 30s or 40s talking about how many cows you can have on the prompt. He comes in and develops the [29:41] plan and gets his zoning in place. He got rs 6 in place and then the property, you start doing [29:48] the horizontal construction to get your lots. Once that's complete you file your plat that subsidizes the [29:56] property. With that plat and technically the deed restrictions go with the plat because they are [30:01] referencing plat that's filed. He put in place his deed [30:06] restrictions and indeed restrictions outline typically it's 20 to 30 items candidate be anything such as maintenance of [30:16] your lawn the type of landscaping allowed. [30:20] roof pitch. How much masonry is on the [30:24] structure and a lot of times and the most important one is minimum size of the structure. And I think it's important to [30:31] understand what we have surrounding our property so to [30:35] the north and pebble beach estates and their deed restrictions were filed when that plat was filed. [30:42] that's when that occurred. Their minimum square feet of [30:46] house is 2,000 square feet. To the south in the mesa ridge [30:52] development the minimum square footage for the patio portion is [30:59] 1900 square feet. To the east the tributes, [31:03] according to their restrictions theirs is 1700 square feet. [31:08] so we have prepared our restrictions based on what my [31:12] clients intention is with the property. Those are not filed yet because those will be filed once the [31:18] flat is file but the minimum square footage is 1800 square [31:23] feet and intended to be consistent with the area. It is 100 square feet more than what is the minimum allow in the [31:34] tributes. Again, his intent is to continue the neighborhood in the same manner that is currently out [31:41] there. I don't know if it's possible but I would ask that if you guys feel so inclined, to help get [31:52] the neighbors comfortable. I totally understand their [31:56] concern about what might could happen. I think what they think might could happen is not what my [32:01] client is intending to do but if you can adds an a condition to the approval of the rs 6 to apply the minimum square foot [32:08] because that's what's currently in the deed restriction and that's what will be applied once the flat is filed o a minimum [32:17] of 1800 square feat foot for any single home built in the [32:23] neighborhood. >> do you know what specific buffering strategy that might be employed in terms of the [32:30] set-backs or matching roof lines or anything from a landscape [32:35] transition that's intended for the land-use? >> yeah, so the set-backs would be the same as required by the [32:42] zoning district. The only, so rear and front [32:47] set-backs are identical in rs 8 and 6. The side set-back I believe differs by a foot from 7 to 6. [32:56] so the set-backs are very similar. [33:00] obviously single family neighborhoods don't necessarily have a buffer that is put in place, but certainly the intent [33:09] would be privacy fence instanced like the surrounding [33:14] neighborhoods have or will have. Did not try to change it. The average home and there is [34:13] 400 to $500,000 dollars. 2200 square feet is the average [34:20] to 2400 square feet in that subdivision. [34:24] there is another gentlemen after me that has proof of all of [34:30] this. What they are trying to do is cram 41 lots in a ten-acre area. I talked to the smiths that own [34:38] that land and they had a layout and they told me I had to use [34:43] that layout. They told me the deed restrictions, I had to use them. So I chose not to buy the [34:52] property. It was 24 lots laid out just like the rest of pebble beach estates. [34:58] what they are trying to do is cram 41 lots in this area. [35:03] we have pictures of what they were going to do on their [35:08] website that we will pass out. They were going to do 2-story [35:14] houses with front garage entry. Everyone, even stock ford and I [35:19] know him very well, his lots are 80-feet wide. [35:24] there are six. But they are 80 feet wide so you can put side car garage entries. We have rear-car garage entries [35:34] at pebble beach. It makes the home different. I'm also a builder with remarkable home, so I know a lot [35:42] about building. What a front-car garage entry, [35:47] it will not make anything look the same at pebble beach [35:52] estates. I will not look like mesa ridge [35:57] vllas. It will look like the subdivision that gene landry up in chad or, they are a little [36:05] bit smaller fronts but they are front car garage entries. [36:10] another thing. R8 lots in this town. [36:15] they are dying. There are hardly any left. [36:20] I saw an agenda again. I'm a developer, but they are [36:26] trying to makes a much money as they can by craming in smaller [36:32] homes and smaller lots. I understand that. Everyone is trying to make money but not in this subdivision. [36:40] I grew up in the bayhill area. When I first moved to abilene in [36:47] 1998 or 1999 to become the store manager here. That's where we lived, but anyhow I want to finish it with, [36:57] there is an overwhelming planning and zoning voted against this and there's not hardly any r8 lots left and we [37:06] need to keep these preserved for executive custom homes. Directly south of this property. I have three main concerns about this property use. [37:46] the proposed houses that you'll see in the picture that says in [37:50] the center of that colored deal there, and neighborhoods will [37:56] decrease our property values will be decreased significantly. We feel. When a friend told me about this [38:03] proposed development. Small 2-story one car garage [38:07] home that's developer wanted to build I thought it made as much [38:12] sense as running marathon in high heels so I'm old and [38:18] retired. I jumped on google maps and noted all the addresses adjoining this property and [38:24] built a spreadsheet listing all the square footages and values [38:30] and the website and zillow and it confirms what I thought. [38:35] the average square feet with us 2484 square feet. [38:40] the average tax value was $396821. [38:45] and the average zillow value was $423158. [38:52] this development will do nothing but lower the values of our homes. My second concern is since there [38:58] will be more homes than originally platted it would increase the number of vehicles in the area. [39:05] you know buffalo gap road. It's bad enough as it is. These homes might appeal to families with teens so you could [39:13] potentially have four cars at one home with a single car garage and driveway. This means more cars parking on [39:20] the streets. My last concern is with the developer. They didn't even show up in [39:26] person at the planning and zoning meeting to explain their plans. Instead they had a [39:32] representative handle all the questions and sadly he couldn't answer the questions because he'd never been told the facts. [39:38] we thought this was not fair to him and for this reason we don't think the developer can be trusted. [39:45] I'm asking the council to align their vote with the planning and [39:49] zoning board and deny the requested rezoning of this land. Thank you so much. >> next card? I would also like to draw your attention to something that was [42:53] added to your packet this morning and that is a petition [42:58] and I was able to circulate a petition around our neighborhood [43:03] after the zoning and planning commission meeting and I'm [43:08] actually excited to be able to share with you that in my professional life I do a lot of survey work and it's almost [43:17] impossible to end up with a complete population being [43:21] represent in any kind of an endeavor but what you see in [43:26] front of you is our signatures from 100 percent of all of the [43:33] houses that are in those cul-de-sacs, not just pebble [43:39] beach which involves la hoja and all serra and the other two [43:47] cul-de-sacs there. There's a qualifying. [43:51] there are two addresses not represented here because they are occupied by employees of the city which I understand are not [43:59] allowed to sign petitions but when you look at this what you are seeing is 100 percent of the people who live in the areas [44:07] that you are going to affect, saying, no. [44:11] we do not want this change. We do not want the new plat that [44:17] goes from 26 lots to 41 which is a 57 percent increase in the [44:23] number of houses and as we've heard before, that's going to [44:29] dramatically increase the number of automobiles especially with single car garages and it will completely change the entire [44:37] environment in which all of us wanted when we chose to buy and [44:44] build in that area. You would becoming in and simply [44:48] saying, we don't care about what your intent was. [44:52] we're going to say. My question is who are you guys [44:58] serving? The people that currently live there and will live there or somebody that just wants to [45:04] increase the number of houses and their profit ma gin? Our city is growing rapidly and I understand the need for [45:41] additional housing but I strongly appose r8 to r-6 for [45:46] this specific development. The zoning exists for a reason. The original zoning and development plan reflect and [45:53] long-term vision for how the area would grow responsibly overtime. Families purchase homes with the [46:00] understanding that surrounding development would remain consistent with the vision and density that is currently there. [46:07] this request significantly changes that plan increasing the number of homes from 26 to 41 homes while also reducing lot [46:18] widths down to 40 feet condo style houses. [46:22] that's a substantial increase in the density that changes the overall character of the surrounding neighborhoods. [46:28] my concern is not with the development itself but with the [46:32] overall development that prioritizes short-term density over long-term planning, neighborhood compatibility and [46:41] traffic safety. Another concern brought up multiple times is traffic. The proposed location is near [46:49] the early childhood center and a middle school and high school [46:54] with student drivers. I believe the city should consider if the current road infrastructure will accommodate [47:02] increased traffic around schools and young drivers and I believe it's important to consider the president this sets going [47:09] forward if developers can later request higher density zoning [47:13] simply because the housing market is strong it undermines the long-term process and creates uncertainty. [47:21] I support responsible growth in abilene and that means [47:26] respecting the original planning vision and ensuring [47:30] compatibility with the surrounding neighborhoods and schools. I ask the commission and the [47:34] city council to deny this request and encourage development that remains consistent with the long-term [47:40] vision for this area. It floods pretty bad coming down [48:12] pebble beach moving north if you put homes in that area the flooding is going to get way worse and the second biggest [48:20] thing the traffic on this road. If you put these homes with this many people, whenever you come out on pebble beach and you go [48:29] to antly road you have to your west a hill that they come down. There is a lot of high school [48:40] kids that live in that area so my concern is the flooding and [48:48] the second is the traffic. Antly road in the morns ago [48:55] horrific, it's not good to get on because the traffic is so bad and then you add these kinds of homes and this many people and [49:02] it's only going to get worse. So I think kind of pump the [49:07] brakes. I'm all about growth in abilene but when we bought these homes in this area, this was never [49:12] even thought about because it is going to diminish our property [49:17] values. Our big concern is we always want growth but what it comes [49:59] with is a price. Things I know you talked about with the deed restrictions. There are you there areas and we [50:06] do pay ho a and have to keep our yards maintained and when you [50:12] bring in more homes and open access to that they are not held to the standard. We have to pay monthly dues to [50:19] keep up with that as well. When you add that kind of area, [50:24] I had spent six years as property appraiser and I have [50:28] seen where some of those areas, they are not kept up, as well. [50:32] they go in fast and bring a lot of rentals and changes and [50:37] everything like that and the property values do change. I ran analytics and you do see decreases on brand new nice [50:46] properties and that's what we're concerned about. Things in the past, things that we're worried about could happen [50:52] in the future. As the people in my neighborhood [50:58] did mention you are kind of just cramming a lot of people and that comes with problems. I ride around with my son in an [51:06] our golf cart. I've seen the new development there and it's not what we're expecting as to what's being [51:14] kind of thrown up so fast and that's why we're apposing this. We don't want that change to create a problem that we're [51:22] already seeing. I'm 38 years old and I have a long-standing to be in this neighborhood for while and we [51:28] want to see that growth but at an appropriate level, and so [51:33] just wanted to bring my voice here to and appose this for my [51:38] family and neighbors. I don't know what kind of restrictions are on these solar panels but I recently learned [1:22:01] about the pfas backers and the toxicity. [1:22:06] we can all quickly google what happens when a hailstorm hits a [1:22:11] solar farm. It shatters lots of glass. [1:22:16] quick research this morning, so pfas I don't know if everyone is [1:22:24] familiar. Forever chemicals. [1:22:28] current e.p.a. Regulation allow four parts per trillion for safe [1:22:35] water. At full is 74 acre feet, so if [1:22:44] tornado goes through and rinse up the solar panels and throws it into the watershed and the backer sheets degrade, it would [1:22:56] take point eight pounds of that substance to make the water safe [1:23:01] to drink. At current level it is at 73 [1:23:05] percent capacity and that would be point five eight pounds of [1:23:12] pfas making the entire lake not safe and not safe to eat the [1:23:17] fish. I spoke with a lot of senior [1:45:46] adults throughout my development career which is over 20 years [1:45:50] and active seniors look for same things that everybody else does. [1:45:56] they want to see amenities close by, something that they would [1:46:00] use. When you talk to seniors, when they go to new places they are looking for things like the [1:46:07] arts. They look for things like civic centers where exhibits might come or trade shows might come. [1:46:14] they look for parks and they look for places to eat. [1:46:21] if you are my grandmother you are looking for the nearest place to get a march and luckily, that's not far. [1:46:33] so I believe for senior's perspective that there is quite [1:46:37] a bit that abilene offers in it's a downtown community that would apply to seniors and people of all ages. This is wholesale and direct distribution of industrial supplies is what this company [2:17:37] does. Again, reminding the public that I'm showing you our strategic plan for economic development, [2:17:43] and the fact that the development corporation partners [2:17:47] with companies to create jobs, grow the tax base and build a [2:17:51] stronger future for abilene. This particular project includes [2:17:57] a company commitment to invest 15.3 million. [2:18:01] today, the d.c.o.a. Request is to approve in essence ratifying [2:18:09] the d.c.o.a. Board of director approval of an incentive and the [2:18:13] ability to negotiate with the company for their commitment to invest their money and create and retain jobs. [2:18:20] so they will invest 15.3 million dollars to build a 40,000 square [2:18:28] foot facility and by land and fill that building for [2:18:33] industrial use, create 24 full time equivalent jobs and retain [2:18:40] their existing three in exchange for an incentive package of $1.3 [2:18:48] million. This is our board of directors again tracy howell and buddy join us today. [2:18:55] and one of every three abilene jobs the d.c.o.a. Played a key [2:18:59] role in helping to create for our community. So mayor, that concludes my presentation of beadline. [2:19:08] will add that this is the council's ratification of the [2:19:13] d.c.o.a. Board of directors approval of the project and it then allows me to go into negotiations with the company, [2:19:25] allows us to negotiate once the company airchoired land. There are so many moving parts for our company to make a [2:19:31] decision to expand in our community. [2:20:40] almost 7 years I have been the president and c.e.o. Of the [2:20:45] development corporation of abilene, I will remind folks I was recruited here and I moved my family here because we wanted [2:20:52] to be part of the future that I knew that we were all working [2:20:56] together to create for our community. In almost 7 years, that professional team that you [2:21:05] appropriately thanks, mayor thank you for that, that [2:21:11] development team brought 50 expansions and project revamp is a project that is top of my list of proudest projects. [2:21:19] this is a project that for all the time I have been in abilene, [2:21:24] nearly weekly, my professional team has worked toward finding [2:21:30] the right user for the reuse of this property. [2:21:35] the company is -- this company is focused on purchasing a [2:21:42] blighted property that has been vacant for well over a decade. It has off and on tenants over a decade and a half but nearly 20 [2:21:51] years has been fairly blighted. And I say fairly blighted [2:22:00] because tenants have been in and out. This will be a long-term commitment. [2:22:07] the company provides engineering, fabrication a [2:22:12] construction services. They do large scale industrial [2:22:19] and energy facilities. This company has the unique skill set to revitalize this property. [2:22:26] so they have committeded or will commit 16.7 million dollars in [2:22:35] exchange, they will create 340 jobs that are well over the [2:22:46] average salary rang. So much so that the impact and return of investment of this project to our community will be [2:22:53] substantial. And again, we will announce those once the protect >> is actually completely [2:22:59] negotiated. Again, parcel of land purchased and the decisions the company will need to make, within the [2:23:07] contracts within the development corporation, the impact and return of investment will be announced an at this time. [2:23:13] the retention of 130 jobs as I mentioned, 340 jobs created, in [2:23:19] exchange for a d.c.o.a. Incentive package of [2:23:24] $2.9 million, so the company will invest there are 16.7 of [2:23:30] their 16.7 million of their money and the development corporation will invest 2.9 million. [2:23:35] again, that is invested in incremental time line within the [2:23:41] contract and by state law, there are always claw backs. Those are called performance measures. [2:23:47] we take compliance and our relationship and partnership with our companies very seriously. [2:23:54] and appreciate the acknowledgment of the success and development corporation realized.
