knows it's from 7:00 a.m. to 7: p.m. and on Friday the the 10th I'm sorry we will [11:32] be closed in observance of Veterans Day okay um mayor Commissioners uh city [11:39] manager I would like to recognize uh one of our our student athletes here at PJ [11:44] Memorial uh he participated in our summer program uh Taff this summer and [11:50] uh and uh he was uh uh n uh nominated uh for a u local athlete of the year he he [11:59] also when once he got uh that nomination he qualified for regional athlete of the [12:05] year and with that saying uh uh Mr J Pettis senior here at P psj mamor he won [12:13] the State athlete of the Year award from Taff the Taff [12:18] games [12:24] congratulations congratulations coach you want to come coach J [12:29] just kind of little little bio for Mr bio about uh Mr J Pettis here J Pettis has been playing [12:54] tennis since it was in sixth grade and is and is now now uh becoming a senior [12:59] at PJ Memorial High School Jay is one of those honest players and most respectful [13:05] players in all of South Texas all of the players admire and look up to him he has [13:09] an amazing professional attitude and his fighting efforts are great to see out in [13:14] the court he's he is a great student captain of the High School tennis team [13:18] and is like a third coach on our on the tennis team he's always stries to help [13:23] to improve uh his teammates he has participated in TS the last years Co was [13:30] his ninth grade year last year at Tav he won the boys 18 singles gold and 18 boy [13:36] 18 boys silver and doubles as a 16-year-old this year at tff he won Gold [13:42] in both 18 doubles and singles Jay has been n named MVP three years in a row uh [13:49] in in 5A for the school he plays for phj memor High School contract will run from November [16:17] 14 2023 to November 11 2024 the contract will keep the same flat rate of [16:24] 5885 for the year and includes an additional $2,000 [16:29] two $26 for the new artwork uh that will be [16:33] produced to feature the new city logo the Billboards are located Facing East [16:38] at the north side of the expressway uh on 493 and Donna and then [16:43] west facing uh the [16:47] East uh on Cesar Chavez the um they receive an average of [16:53] 81884 weekly Impressions the Billboards are used to advertise a hotel motel HS [16:58] in the area staff recommends approval on this item so Bobby do we uh does a hotel [17:05] motel tax pay for this or yes sir that's where we come from yes sir I think I [17:09] asked about it last year to find out is there a way to [17:14] like as far as number-wise return on the investment is there is there something [17:19] other than the 88,000 weekly Impressions right the only [17:25] the only thing we have is like how many people get to see [17:29] the the 818 as far as having an Roi on it a specific number on that um I'm sure [17:34] Lamar can can do that they can come back and and let us know but I think last [17:40] time they did do the same thing and we ended up approving the uh can we [17:44] um can we take a look if this does get approved can we take a look to um [17:50] revamping that because it just there's not a lot of color to it there's not a [17:54] lot of if you see the one it will include that yeah it's really OB [17:59] yes it's I think I mentioned that last year too and it it that's uh what this [18:03] uh contract will include it's another $2,000 that will put in the new logo and [18:08] it'll be it'll be new basically new face do you have like something as how it [18:12] would look or do we have anything um I don't think anything was included in the [18:17] packet can we can we table that till can can Lamar provide something to us before [18:24] we approve this um type of up with this position yes sir okay item G consideration action to [20:09] approve a contract renewal between the city of Alamo and Valley Initiative for [20:13] development investment Inc vaita uh yes mayor the city of Alamo has been in [20:17] partnership with vaita for several years the city annually approves a contract [20:21] with vaita that authorizes a sum of $12,500 that'll be used to promoting [20:26] encouraging training and development for of animal residents to help create a a [20:30] competent Workforce which will benefit new or expanded business enterprises [20:35] this contract will allow the city of animal and VA to continue the [20:38] partnership staff recommends approval Bobby is there a way that we can um I [20:44] guess publicize more of this to to our residents on our City website I know [20:50] this is a very good program to to uh help uh people get educated and get a [20:55] better job uh but I like I like to see this more on our social media page and [21:00] promoting it um is there somebody here from representative from there I don't [21:06] believe a rep from Vias here but we could have our uh public information [21:11] director get something out in regards to that and also get with VA and just to [21:14] explain how this program works because I know it it's helped out uh some friends [21:19] of mine and also some family members uh go back to school and get a better job [21:24] um so if if we can maybe somehow get this information out to the public [21:29] okay motion to approve second second have [21:32] appros motion south [21:56] on Alamo road then then heading uh East on Business [22:00] 83 do we have a theme yet our theme is I guess an oldfashioned Christmas [22:08] more of the Vintage retro kind of Christmas what's the what's the time on [22:12] it we're starting at 6:30 that'll give kids and staff and parents time to get [22:18] to HB so that way we can start at a decent time right motion to approve [22:47] 16,128 89 for these five uh time clocks okay are these comparable for all [22:54] of them all the like at parks and everywhere else it's for yeah the fire [22:58] station ADC Waste Water treatment plan in City okay all right motion to approve [23:03] second second we approve percent ofci by post motion carries item J consider an [23:08] action and approval of an ordinance amending the code of ordinance title one [23:12] chapter 6 City officer and employees section 1- 6-4 Personnel policy [23:18] guidelines uh yes mayor Commissioners in your packet you will see a revised [23:22] version of our old Personnel policy um I went ahead and did a couple updates [23:27] regarding attendance appearance updated holidays [23:30] manual leave uh evaluation city property and vehicle use equipment uh I'm sorry [23:35] City equipment social media in addition I had placed an updated highlighted [23:40] regarding um our alcohol and drug policy um that is again that is updated I went [23:48] ahead and investigate it through different cities um so I just kind of [23:51] pick kind of what was needed on our end also there is something that we wanted [23:58] to discuss which is on page 55 and at the moment the city has a pol [24:03] not a policy but we have a practice of we do manual leave um if if certain [24:10] employees don't use their vacation time they tend to roll over however I have [24:14] checked other cities none of the other cities have it um and speaking with our [24:19] HR and finance director they do prefer that we do eliminate this [24:24] practice who who uh who who was part of of adding to this policies and who was [24:32] part of um was it just you or you the city [24:36] manager did you get the directors involved was there input from the [24:39] directors as far as maybe what some concerns they might have uh what [24:46] they see day in and day out that we did speak to HR and Finance in several [24:50] occasions depending on the topic uh there was different things in regards to [24:56] uh the drug policy the um I think there was something about mental awareness yes [25:01] uh there was uh items in regards to like the our vacation leave where they see [25:06] like well this is this is problematic for us uh this is how we can see a fix [25:11] for it and so that's what Alex is is talking about where um right now we have [25:17] it where we actually carry over we allow a carryover of time and it's either we [25:23] allow this and give them 90 days and now it's in writing give them 90 days to use [25:27] it or we simply remove that manual leave aspect to it and just you know either [25:33] use it or lose it you know like a lot of other cities do it and so that's one [25:38] thing that we wanted to bring before you and see what you what you thought do we [25:43] have I would just like to make sure that we CU there's a lot of changes I went [25:47] through the different changes and and there's just a lot of things that's [25:51] being added on just a quick notice from you know we got the agenda three days [25:57] ago um and now we're adding a lot of lot of [26:00] new stuff I would like to possibly sit down maybe all of us together um [26:07] together with the city commission and the city staff as directors maybe or who [26:11] you choose to be and and uh really make sure that we're so you want to have a [26:16] workshop well I would think that maybe that might be something because like I [26:19] said going through it there's a lot of red there's a lot of and we just want to [26:24] make sure that every that everything is going to be you know we're putting the [26:28] employees in a position or the city in a position where at the end of the day [26:32] we're going to well you put it on paper sure and we didn't have a lot of time to [26:36] really review review it and ask questions I think I mean obviously [26:40] you've sent it to Legal um but you know there's I I don't know if there's still [26:46] a few we could uh table it and and the next meeting we'll have a workshop [26:51] before the meeting and then we can have as an action item after the workshop [26:55] Chris I mean is that something as far as your office I mean I know you you got [27:00] this part of it and and we just really want to make sure that legals also I [27:04] mean uh I it'll give us I mean I got to look at it because we we get the packet [27:08] just like you guys but and I so I had to go through all of it but again um you [27:14] know it's if you want to do the workshop I think that's a good idea can do it [27:17] before that way at least the entire commission gets to kind of review the [27:22] because I like I like it I was like I said I was reading through it I like it [27:25] but there's just a few things that that I think [27:28] all of us taking part in sit down before we make this this vote on it uh I think [27:35] we might be a good idea Bobby so entitlements start when when do they [27:38] start in like the calendar year or how does it work I'm sorry like your [27:43] carryover entitlements that you have um so it depends on the I believe it goes [27:47] by anniversary date and so from then on it you get a certain number of hours per [27:52] year and then once it hits your anniversary date if you don't use your [27:56] vacation by then you'll lose it so you mean the anniversary when you first [28:00] started working when you first started working correct oh so it's not like at [28:03] the begin calendar year no it's not how many hours do they get per uh per year [28:08] it depends it depends on the the amount of time that they're with a city um if [28:13] they're with the city I believe it's one to five [28:18] years they get 80 hours one to five years and then from 5 to is it [28:23] 10 and it it increases more gradually until so if they don't just to say for [28:29] example uh year one they use no vacation time year two it's going to roll over [28:35] all lady8 way [28:54] setan accumulation system say [29:00] have 8 hours [29:05] it'ss oh that's got [29:09] it that's that was one that's just one one one just one example one part of [29:16] this that I would like to see I mean I would think at 15 years and over um [29:20] there's no incentive for the people who have the employees who have been here [29:24] over 20 years 25 years May maybe that maybe we could add something to that [29:31] part too and not just max it they if it's over I think they get four weeks [29:34] it's four weeks 20 days but if you got an employee who's given the city 25 [29:38] years maybe we can give a little bit just that's just an example of what I [29:42] was reading through that I think if we sit down and talk about some of this [29:46] stuff okay um well uh we the [30:39] east side of uh Cesar Chavez the Alamo site if you will it does have a mechanic [30:44] shop if you will you may recall we had a similar cup an identical cup for Mr [30:49] Hernandez which was a property owner that went well but you know he's busy so [30:54] uh we have a new applicant uh for the um with pretty much the same conditions [31:00] if you will days and hours of operation are noted in the write up there's one [31:04] hydrant just outside the the gate that will service the the property we did [31:08] hold a public hearing with the with the planning zoning Commission on the 18th [31:12] of October no was no opposition at all the applicant did appear at that time [31:17] because we didn't have any problems when Mr erandis was was there we don't [31:22] foresee anything as well uh you know it should run smoothly a lot of the [31:27] clientele we suspect are the workers and the the clientele that're having their [31:32] vehicles fixes so we kind of a recommendations for staff goes is for a [31:36] life of use secure business license course comply with the county health [31:41] codes as far as securing the food handler certificate or what called [31:44] Health cards and of course meet all other requirements with regard to the [31:48] food vending codes um pnz and staff are the same at court and we recommend in [31:54] his favor this is a public hearing this is a public hearing hearing is the [31:58] applicant [32:00] here [32:04] okay no okay this is a public he Bobby does does I'm just curious does Code [32:08] Enforcement ever go out and and I guess go make sure these like like those areas [32:14] are these food vendors are being up to standards or anything like that or no um [32:19] at a minimum they they do it in the beginning stages of of when they start [32:24] and then of course the health department verifies that they're compliance with [32:27] minimum Health requirements County Health Department the Fire Marshall does [32:31] that as well the the county health officers go at least once a year not [32:35] more and the Fire Marshall has to go at least once a [32:39] year thanks this is a public hear and any other [32:44] comments okay we for Town housee condomin [33:25] townhouse condomin simply the name of chapter six from duplex multif family [33:30] townhouse and apartment District to multif family and townhouse district and [33:34] established regulations for townhouse uses uh yes just a little bit of [33:39] foundation couple of months ago my office was a approach about townhouse [33:43] development looking at the zoning code there we don't have any townhouse RS [33:47] although the district if you will the R2 does indicate duplex multif family [33:53] townhouse and apartment District so one of the attempts that we the we did here [33:57] is go ahead and and draft it in ordinance format and provide uh [34:03] townhouse requirements if somebody wants to build develop a townhouse subdivision [34:07] then these are the rules that staff will use and impose and enforce during the [34:10] subdivision process one of the things is May indicated a few moments ago is [34:14] actually just simplifying the name to be multif family and town housee zoning [34:18] District so that's one of the things that it does some definitions there as [34:21] well I was surprised to see under the current Archer zoning District a [34:24] permitted use is hospitals or animal hospitals in the residential zoning [34:29] District we're going to scratch that out and actually the next item move it to [34:33] the commercial zoning District whereas I we believe that would be more [34:37] appropriate of course the meat and potatoes of the ordinance are the coats [34:41] the setbacks the area requirements and things of that sort which is listed in [34:44] here we did hold a meeting with the planning zoning Commission on the 18th [34:48] of October where they viewed uh the uh the ordinance in detail and uh they [34:54] recommended approval with no changes actually actually so staff at pnz are on [34:59] the same uht as well in recommending favor of this [35:04] ordinance second the second we appr c i motion carries item M consider [35:11] consideration and action to and to discussion and possible action on an [35:15] ordinance to amend title 10 zoning regulations chapter 9 commercial [35:18] District to add amend certain permitted permitted and conditional uses and [35:23] enhancing is building setback Provisions uh yes noted a few moments ago one of [35:28] the things that we are doing is extracting the hospitals animal [35:31] hospitals from the R2 inserting it here pursu to this ordinance it's approved uh [35:36] the other thing we're kind of uh also trying [35:40] to uh have commercial uses be commercial not have the risk of having a single [35:45] family home if you will along the expressway those that are there are [35:49] grandfathered they're honored great we will support them building permit will [35:53] be issued as well but there was a a new lot that's commercially zoned [35:57] it should be a little bit more more challenging to to do um and uh as far as [36:03] the um there's some other minor adjustments uh as well on the setbacks [36:09] it just kind of does the these front setback zero the side setback zero uh [36:15] the rear setback 15 however in the setbacks uh one of the things that staff [36:20] needs to be alerted future staff if you will is also don't forget to look for [36:24] the easements and don't forget to look at the plat notes because the specific [36:28] plat note on the recorded subdivision signed by everybody's a legal instrument [36:33] so that setback prevails over the general zoning code we just kind of [36:37] enhanced that the the verbiage on setbacks to alert everybody to just be [36:41] sure to look at that and not make any inadvertent mistakes if you will uh we [36:46] did take this ordinance to the pnz on October 18th and they supported it uh [36:51] unanimously and staff is of course recommending for it as well motion to [36:55] approve second second second Pro pres motion carries item n consideration [37:01] action to discussion possible action ordinance amending Title 9 building [37:05] regulations chapter 1 building codes to add a new regulation for mandatory [37:09] debris containment during construction new provision being in the building code [37:13] section 9-1-1 A1 residential code section [37:18] 9-1-1 D2 A1 and the property maintenance code section [37:23] 9-1-1 D9 A1 uh yes uh really what this amounts to is that during construction [37:30] they's say some apartments are next to a vacant field uh they need to have a [37:35] containment area for their debris liftover Lumber paper shingles whatever [37:41] they're incidentally disposing of you need to contain it you need to contain [37:46] it and uh some verbiage is in here as well for Mr V of course to do the the [37:51] the building inspector to do the the the professional thing and courteous thing [37:54] is you know it's a little messy here it's is is flying over to the ad joiners [37:59] I'll give you 24 hours of getting it done and uh if not I'm going to need to [38:04] put a stop work quarter but usually contractors are are very receptive in [38:08] doing it that way that's the last thing they want to do is stop uh so that [38:11] verbage is in here also they do seek professional bins uh dumpster a rolloff [38:17] they must go with the city's uh Solid Waste provider uh whoever that may be by [38:22] contract uh so this is what this ordinance does and uh we recommend in [38:27] his favor was there was there not anything in there before did you just no [38:31] no yeah so it was kind of hard I know I've called Bobby a couple times about [38:35] it so if if it does pass I just hope that we we [38:40] enfor if it does occur there's a a protocol in there as well so that we can [38:46] go ahead and and work with them you know we don't want to stop the work either [38:49] but you know they do need to be responsible for the area yeah I think we [38:52] had a perfect example over here south of the city hall and that's uh something [38:56] that hopefully we can stop from moving forward correct make a motion to approve [39:01] second second we approve fav say I I motion carries Mo consider an action to [39:06] to discussion a possible action orders to amend Title 9 building regulations [39:10] chapter 1 building codes section 9-1-1 d8 electrical quote outlining [39:16] regulations for electrical vehicle Supply equipment in section 91-1 3F is [39:21] to establish a fee for Ev Port inspection uh yes this actually came in [39:26] internally to to my attention from staff apparently there has been some [39:31] electrical vehicle charging stations built uh in the city and they wanted to [39:36] know about the codes and I said well what does the code say so they look and [39:40] there isn't any uh it's it's fairly near if you will and then we discovered in [39:44] the researching process actually there's a Senate Bill [39:48] 10001 that's effective SE September 2023 indicating you know some uh registration [39:54] requirements and safety requirements and what uh the state uh departments that [39:59] are overseeing if you will and that's that's great but one of the things that [40:03] this does do is provide the parameters uh some regulations as to if you're [40:08] going to have an electrical vehicle charging station use these rules they're [40:11] reasonable uh and uh so uh we believe that they are I presented these actually [40:17] to C enforcement and the building inspector building inspector have some [40:20] remarks I went ahead and injected that in there as well as far as maximizing [40:25] the safety uh for the charging units of course he he needs to do inspections for [40:30] each charging port uh we kind of thought 25 bucks per Port would be appropriate [40:35] and fair as well so these are um based on the the statute cities are going to [40:41] need to adopt them I don't think any other city has them so far um be that as [40:45] it may uh we generated the code here in Alamo we believe it's fair and we [40:51] recommend in in its favor Mr zala can we make sure uh also if this one passes [40:56] that uh our employees are properly trained on on how to uh inspect um these [41:02] charging stations when they're going to get built and cuz it's like you did say [41:06] it's something new to it's something new uh I don't know what what training might [41:10] be out there till we can make sure that um these chain these charging stations [41:15] are being built to exact that's correct and and what what we do with with Mr [41:21] vaka inspector certainly he um each year at least want even more he he goes and [41:28] takes some of the training that's required this I'm sure is going to be [41:31] one of the the topics because this is fairly new but it does have to be under [41:36] control really the whole purpose is just to make make sure it's safe and for us [41:40] to to be trained to to doing it correctly so I'll be sure when the train [41:44] is available to to send them off make a motion to approve second second we [41:47] approve of FCI I motion carries item P consideration action uh consideration [41:54] and action to discussion and possible action to men Title 11 subdivision [41:57] regulations chapter 3 design standards and required land Improvement section [42:02] 11- 3-15 parks and other public use by adding a new provision to require Park [42:07] frees during the permit process for non- residentially Zone planted properties [42:12] where Park fees were not received or when residential unit increments occur [42:17] through sundry zoning regulations uh yes what uh the city of [42:23] Alamo imposes Park fees during the subdivision process if it's 100 lot [42:28] single family we we impose 100 times the park fee value if it does have a [42:35] frontage uh of commercial component if you will along a major Street we don't [42:40] impose Park fees for that or any commercially Zone lot the reason for [42:44] that is because there's a reasonable expectation the commercially Zone lot [42:47] will be used for commercial purposes however there is a risk of commercially [42:52] owned properties uh being used for residential purposes either through a [42:56] rezoning or through a conditional use permit or some other process if you will [43:01] when that happens we're out Park fees because we should have gotten those Park [43:07] fees during the subdivision process what this legislation does is when that [43:11] happens the city will be made whole we didn't secure it two years ago when the [43:16] subdivision was was recorded but since you reone the property uh to multif [43:23] family residential and you're going to put 25 Apartments I need those Park fees [43:27] if you will now uh we're going to put one of the things that this does have is [43:32] a plat note that indicates that for any reason uh any commercially non [43:39] commercially Zone lot be rezoned or used for residential purposes the city you [43:44] know will St to impose those Park fees so that we can be made whole the whole [43:48] purpose of the park fee is that developer is generating inviting [43:52] families to to live and reside in Alma which is great but these uh families [43:57] also have to recreate someplace and it's logical that the developer should go [44:03] ahead or owner should go ahead and and be part of the process in giving the [44:08] city some money to um improve our amenities the you know the parking [44:13] amenities and things of that sort more swings or whatever the case is so this [44:17] ordinance actually safeguards us to be sure that we're not missing [44:21] out how much how soon are those Park fees [44:26] uh uh received they are received before the plat is recorded before the in a in [44:33] a normal setting uh if you want your sub and and they know already up front we [44:39] give them a list this is what you need to to record the your subdivision you [44:43] know tax shts and things of that sort an approved drainage report from the County [44:47] Drainage District don't forget the park fees as well uh it's 20 L time $500 [44:53] which is the the prevailing rate so make the check out to the city of Alamo all [44:58] right so before they record the plat mayor signs it and everybody else signs [45:02] it but I can't take it to get recorded unless they get those Park fees and to [45:06] be perfectly Frank with you the park fee check is usually the first thing they [45:09] they give us anyway so what uh does that just go into the general fund is that [45:15] that goes into no sir so how how how much do we have in there I think Sandra [45:24] or so when can we put that to work yeah [45:29] yeah yes throughout the year um Sandra's been using that fund okay to you know [45:36] fix roofs uh add amenities add add certain things to the existing parks [45:41] that we have okay so U that's what she's been [45:45] doing to to answer your your question that it does not go into the general [45:49] fund those Park fees go into a park fund and can only be used for Park purposes [45:54] and just because isn't a park fund doesn't that you can use it for just [45:57] flat out maintenance if you will they need to be used to improve uh the [46:02] amenities adding more or if something's falling down replacing it things of that [46:07] sort so things like And in regards to [46:10] commercial you say there's no fees if it's commercially zone right right up [46:14] front I don't collect Park fees again because we we expect and we want it to [46:18] use it for commercial purposes but just in case it does get rezoned or used in [46:23] some sort of fashion for residential purposes [46:26] then the plot note and will hit and we will need to get that as a part of the [46:30] building permit process right make a motion to approve [46:36] second Mo to second we approv present c i motion carries item Q consider an [46:41] action to discussion and possible action to amend title 8 Public Utilities [46:45] chapter 1 water use and service section 8-1-3 water use regulations to have [46:50] owner agent pay incidental service and material cost for additional water [46:54] meters in the building process and to include that that the owner agent be [46:57] responsible to repair damage utility infrastructure reimburse the city for [47:01] the reparation work uh yes um last week my office was [47:07] approached by uh by Public Works uh in regard to a subdivision That was [47:15] supposed to have just one 2in meter for let's say fourplex and then during the [47:20] process of construction the contractor owner of the [47:24] apartment blot the construction indicate you know what I'd rather have four [47:28] meters so it seems that there's no regulation I think this when the city [47:33] was doing that they were actually eating the cost for the for meters uh I said [47:38] okay the other thing that was that was brought to my attention when I talked to [47:42] Julio and Mel from water billing was the issue of uh sometimes they inadvertently [47:48] bust our water lines or water systems and they need to be fixed up as soon as [47:53] possible is there anything in the Cod when you fix it to get reimbursed with [47:57] or whatever so what this ordinance does is it shuts those windows down um [48:03] whatever the city has to be made whole it is unjust for the city to be the [48:09] taxpayers to being the incurring a cost that is not reimbursable by by uh the [48:15] landlords or the owners of Apartments whoever wants an additional water met it [48:18] should pay for it that happens in every other City this is what this does what [48:23] you want that's fine you need to pay up front then we'll see it and then we'll [48:27] get it installed also the other component is if if you bust our lines we [48:31] got to fix it if not I'll fix it because it's an emergency it's a water leak but [48:35] there's going to be a cost involved then a detailed uh invoice will be presented [48:39] by public work to the owner uh to go ahead and getting it reimbursed if not [48:44] it may impede a final occupancy final approval and of course the city always [48:48] has the arm if needed to use Municipal Court we don't use that as said like a [48:54] last resort but but that's there anyway so this is what that ordinance does I [48:58] did present this to Public Works who a director who is here to Mel as well as [49:03] far as the verbage got a little bit changed a bit I think was improved and [49:07] we recommend in its favor Bobby uh like these lines that we have like an LA [49:13] palasio subdivision I know it's water from North Alama water right but we're [49:17] still responsible any any busted lines in that area [49:21] right no if the lines are busted the north Al they will take care of it what [49:27] okay what about the ones on 495 the NOA divisions are same you know [50:20] we want to work with with with commercial uh prospects we do that all [50:24] the time that's as much as possible we work with you but we do have ordinances [50:29] we do have laws that we need to comply with so at the end of the day just meet [50:33] our CS so and that's so the the request has been made that we have issued I [50:37] think the last one that we issued was Dutch brothers that went very well uh [50:43] they activated their business very attractive as well now one of the things [50:47] they did file a subdivision the ISS not the issue the um observation by staff [50:53] was that the engineers are for from Mississippi uh tomorrow morning I just [50:58] got with Ronnie before the meeting started we're going to have a a phone [51:01] call with the representative of the of the Dollar Tree his name is Adam Brer a [51:08] nice fell talked with him a few times so but we need to talk with each other uh [51:12] they only filed the plat no utilities nothing of that sort uh they have filed [51:18] the plans to build a store but before we go there we need to look at the [51:22] foundation of the subdivision because in the sub division they haven't even [51:26] extracted the required ride of way off of Alamo Road they just this is our [51:31] property and this is what we're going to subdivide so well so the first thing [51:34] cities do is extract the rideway especially on state roads to the m [51:39] Thorofare map and we need an additional 10 ft so their footprint needs to be [51:44] adjusted back or forth U that's for their call so we need to uh one of the [51:49] other observations if you look at the map here is that this is the parent [51:53] tract do the overall tract Mr H is here and he's conveyed the let's say the East [52:01] component having access to the public Street to Dollar he is landlocked they [52:06] have provided what's marked in red as a driveway access easement code is either [52:11] take the street to the lot or the lot to the street kind of like Oklahoma shap [52:16] this is what they chose to do I don't know they needs to follow that process [52:20] because there's a viance request there has to be one uh so that has to be [52:24] presented to the plan is on the commission the city council and that'll [52:27] be uh part of the recommendation here as well we want to help them but we need to [52:33] uh our recommendation is favorable to the request we don't object to it but [52:37] first these are the the five conditions some of them are similar to the ones [52:41] we've seen in other other um applicants the city commission to vote on the [52:46] driveway versus the street variant we need to know that as well so that needs [52:51] to follow protocol uh and the will issue to the building permit after the noise [52:56] to proceed the reason that's important is because the construction plans would [53:00] have been seen revised corrected and now public works and Engineering are fine [53:05] with the with the infrastructure so here should we meet with a contractor be sure [53:09] that they know what they're doing and you know our codes our inspection [53:13] requirements now here's your notice to proceed that's one and here's your [53:16] building permit as well the other uh condition would be no occupancy until [53:21] the subdivision is recorded um unless way meet all requirements of the code [53:27] subdivision code and of course get a business license to activate that's [53:31] that's uh basic code this is our recommendation that's the best we can do [53:35] at this point but we do have a conference call with him tomorrow but [53:38] mid morning or so is there a a limit on dollar stores Dollar Tree stores this is [53:43] just a personal question um that I have do other cities put a limit on these [53:47] types of stores do know uh cities don't typically put a limit on it unless your [53:53] ordinance says that usually Dollar Trees have a certain radius that you know [53:58] let's let's not overbuild if you will if once on uh on one location a quarter [54:03] mile away let's put another one they certainly have a a marketing uh gurus [54:08] that would give them that information but to answer your question no cities [54:11] don't typically impose it Mr zot um does uh did they not buy the whole property [54:18] or what no they just bought the Eastern component how many heart yellow that's [54:24] what they bought oh okay I thought I thought they had bought the whole [54:29] property Mr H owns The Remnant there's an alley here and I believe an alley on [54:34] theu which is recently developed subdivision it does not have public [54:40] Street Frontage so they only purchased 1.13 Acres they only purchased that [54:44] property correct so they purchased it with the [54:50] understanding about the road or is that I mean that's kind of that's what we're [54:54] going to talk about tomorrow what my basic [54:57] concern is uh is the access I understand about I've seen the deed i' I've read [55:03] that the deed Mr H signed to to Dollar Tree reps and it does indicate the [55:09] driveway access and the cross AIS iny reement fine uh but that doesn't meet [55:15] our city codes city codes basic especially when life safety is concerned [55:20] with these fire and is you need public streets typically [55:25] yeah because we're not going to send anybody out to those neighborhoods the [55:28] back to the North or anywhere correct have to go to Al Road okay I was in the [55:35] understanding that they had bought the whole property it's okay it just seems a [55:38] little small one acre to put in a store that size yes [55:44] sir so so how I guess my question is how do we uh regulate I guess the back part [55:50] where when it starts overgrowing with you know with grass and weed and stuff I [55:56] know that behind um Dollar General there used to be an [56:01] issue with the residents were complaining that that there's a lot of [56:05] mosquitoes and stuff because nobody was cutting the backyard I mean the back [56:08] area of Dollar General um as the so in that situation [56:14] you do have people that live on Orga Circle right so how do we make sure that [56:20] that they do cut that yard so it doesn't overgrow there's a a couple of ways to [56:26] to answer that uh actually all all the layers apply one is that the the manager [56:32] needs is pretty much uh responsible for their property uh if they're not then [56:37] we'll get a call either our billing inspectors up and down or Code [56:41] Enforcement Officers is a very visible area there as well Alamo road we use it [56:45] every day well it take us look you know looking over there uh the residents will [56:50] help us as well uh sometimes we can't cover everything but we appreciate those [56:56] calls I like that uh like this city as well as other ones you have an annual [57:00] wedy lot notice I just have to send the property owners as one time certified [57:04] letter from that point on I get the call here's the work order go go get it cut [57:08] Alex uh that's the way it works so would be um it wouldn't be Dollar General it [57:13] would be the the actual owner can you say the the property to the back the [57:17] back oh you talking about the H property yes oh is responsible for his own [57:21] property now I don't know recall and the the Wy lot code if there's a difference [57:27] between property no it's commercial owned uh he needs to cut it okay that's [57:32] it's no toys about it would we be able to table this item um just so that [57:37] there's just so many um you know issues to talk about and we can come back and [57:43] well if there's issues that you want to other ones that you want actual business cuz I know in Dollar General it was same thing again you know [58:27] you have residents complaining about trash and stuff going on to the [58:30] properties and and apparently didn't get put up the way it was supposed to put up [58:35] you know uh by by code they required just code [58:41] the subdivision process we can really add another Hammer there I'll explain [58:46] how do if there's a commercial piece of property that is building next to the [58:51] residence component they must go ahead and build a buffer now J's property is [58:56] vague and Commercial however we have control of the subdivision and in that [59:01] subdivision we can certainly put uh a plat note in the cting side plan [59:05] approval required and I don't mind doing this I've done it before going before [59:09] pnz first and then going to city council as uh City commission as well so that [59:16] you can see what they're building and the buffering requirement that can be [59:20] added pretty easily in the plat note uh that we will require a perim one if you [59:25] will for you know uh debris containment Etc purposes as well I want I want this [59:33] to show also that we're not uh pushing away business or against moving forward [59:39] with business but uh there's just a lot of concerns being that that property in [59:43] the back um is is is going to have a lot of questions that we need answered [59:48] before we can move forward with it being a landlocked property that we're not [59:52] going to send traffic to to anywhere else but they got to come out you're [59:57] you're exactly right so that's why U the suggestion to having it tabled is is [1:00:04] probably a wise move here because in order for condition number one the city [1:00:09] commission to act on the variance on the driveways the street you can't do that [1:00:13] this evening anyway they have to move forward and percolate that subdivision a [1:00:17] little bit better uh so that we can take it to pnz and I don't mind having a [1:00:21] special pnz meeting either if needed so that that will reflect our attitude to [1:00:26] getting them in here but uh we we need those answers so would have of that means is that the our codes and requirement are being complied with [1:01:09] period however you know this this individual applicant did have the right [1:01:13] to apply for the variant so he did so one of the things that we're looking at [1:01:16] is is who's on zba and were they still okay on membership this is when I was a [1:01:21] little bit shocked and I'll I'll I'll take that hit and so far that all of our [1:01:25] zba members are terms have expired um and you can see below as far as the as [1:01:32] far as the zba there are supposed to be five regular members you have the option [1:01:35] of two alternates you have the names of the people that are the current uh five [1:01:40] regular members and the two alternates uh their term of offices for two years [1:01:46] instead of my suggesting this instead of appointing today and then erasing pretty [1:01:51] much one year is on November 6 if you to appoint them that the two years start [1:01:56] from this point forward so that way we can conserve that extra extra time on of [1:02:00] service this is really a discussion for the city commission would like [1:02:11] to
