[0:53] I'll be voting tonight, despite the fact that I'm the chair tonight, Mr. Volta, because [0:57] the town is missing one meeting. I think he's missed four and 16 years. So as president [1:05] of the council I'm filling in for him tonight and I will be voting. That's nice. [1:27] Here's [1:27] A present. [1:31] Please stand for the pleasure of leaving the [1:40] states of America, and we'll be hearing all [1:43] of you. [1:44] One of the nation under the eye, the individual, the liberty and justice for all of you. [1:57] We'll have just a moment of final touch, please. [2:14] Next up, the agenda is approval of the minutes through August 12, 2026. [2:19] Are there any additions or corrections to the minutes from August 12th? [2:29] I'm sorry, get so much tape, Roy, you know what I'm saying, you have a question to ask. [2:35] Please email them to all of you. [2:37] There wasn't. [2:37] Okay. [2:38] I didn't. [2:38] Maybe I clicked it off on the stick. [2:40] Okay. [2:41] Yeah. [2:41] They will email. [2:42] Okay. [2:42] That's fine. [2:43] Thank you. [2:43] It's never second. [2:45] Second. [2:46] It's been moved in seconds. [2:47] It's been moved in seconds. [2:48] It's been moved in seconds. [2:49] It's been moved in seconds. [2:49] It's been moved in seconds. [2:50] It's been moved in seconds. [2:52] It's been moved in seconds. [2:52] question, all in favor, please signify by saying aye. [2:55] Aye. [2:56] Opposed? [2:56] No, I just haven't the minutes from August 12th are approved. [3:01] And now we'll open the public hearings, [3:03] public hearings for zoning amendment application [3:06] for 9.50 pine street, that's parcel under 201-2128. [3:14] To classify the property as R3, [3:17] two family resident district, and a bit of D1, [3:20] Maybe a good shopping district will allow for sale of property as a residential instead of this. [3:28] For [3:31] anyone that wishes to speak about this property here. [3:36] There's not but someone make a motion to hold it over here. [3:41] Thank you. [3:42] Two more times. [3:42] Okay. [3:45] I'll say twice more. [3:46] Sorry. [3:47] I'm not sure that's a record, but I'll say it. [3:49] Is there anyone else that wishes to speak in regard to the zoning application for 9.35? [3:58] If anyone wishes to speak about the zoning app amendment application for 9.35, you get not. [4:08] I'll make a motion. [4:18] Next time I list is public comment the time limit of five minutes unless otherwise approved by the council. [4:26] Anyone that is too people who wish to make public comment. [4:31] I go through it and I [4:37] will protect your side. [4:40] I [4:52] mean, I'm speaking for my friend Paul Grindy, who is not able to be here tonight, but I am reading [4:59] whatever message that he wrote, okay. So speaking as Paul, I have traveled the downtown [5:07] 5th Avenue several times per week since 1995. I am baffled that someone would think it's safer [5:14] to cross seventh and superior by the flashing lights that many drivers just blow through rather [5:20] than the stop lights at this avenue or even worse crossing with no lights. Those of us that [5:27] ride three wheel bikes will tell you that they are very difficult to walk. In addition, most [5:33] that ride three wheel bikes have mobility problems and walking anything is a problem. We will be banned [5:40] from the downtown. I have been a member of the geeseers nearly 15 years. I have never felt [5:47] unsafe at our meet-up place. We have enough parking for those that haul their bikes in, room together [5:53] for those that ride their bikes in. Bathroom is available before and after the ride and a place [5:58] to socialize after the ride. What are we trying to fix? I have not seen anything that will deal with [6:06] that people doing unsafe things on the walking trails. [6:10] My concern is that we handle that like we do [6:13] when a few people damage the public bathrooms. [6:17] I, E, shut it down for everyone. [6:20] The one thing that I have not heard [6:22] that will improve safety is require helmets. [6:25] Isn't it interesting that we have an answer [6:27] that will really make a difference [6:29] and that's not even discussed? [6:32] Thank you. [6:44] I'm not a resident of the city of Anago, but I own property and am a taxpayer here in [6:51] the city. [6:52] And I'm an avid biker. [6:56] The attention to the ordinance came about mostly because I've heard so many comments [7:02] from people about the scooters and motorized [7:07] sites that are zooming through intersections [7:10] and causing safety problems. [7:12] So when I started looking into it [7:14] and I got a copy of that before the school ordinance, [7:16] thank you to Michael Wetzel and Chief Gil Pursnick [7:20] and Sarah Wrett for meeting with me [7:23] so I can better understand what's being proposed. [7:25] So I applaud all the people at least coming forward [7:29] and doing something quickly because I'm [7:31] hearing that somebody's going to be injured terribly or worse. The scooters and some e-vikes [7:42] and some abusers of those vehicles are running through intersections. I live over on the [7:49] east side of town by city park and it's it's just awful when you see them. Morning and [7:55] at night, sometimes at night with no lights on and there's just no wind and there's no control. [8:02] A couple things in the ordinance, I just want to point out that so everyone's hoping [8:07] that all of you read the ordinance, I know it can be boring, but what you have to understand [8:12] too is that they classify bikes by state stations of class one, two, and three. [8:19] And I actually have an electric assist bike that's a class 3 electric assist bike. [8:26] And I'm an advocate of electric assist bikes and what I tell people is if I stop pedaling [8:32] I'm going to fall over period. [8:36] Okay. [8:36] So everyone needs to get their head around the electric assist bikes, class 1 and 3 are bikes [8:42] that you have to pedal. [8:43] You can't not just stop pedaling. [8:45] I mean, that class 2 bike, if I'm looking at this the right way, Joel help me out, is [8:52] you basically have a thrive, just like a mini bike, and when you want to go, you pull [8:58] you pull the lever and the way you go, and those are the ones that are causing problems, [9:04] I mean scooters and bikes. [9:07] Yesterday afternoon, I was walking on the trail, the boardwalk trail, and sure enough, [9:12] their three kids went through and one of them was on what I would call a motorbike. [9:18] It might have met the classification of a class to bike, didn't have to pedal [9:22] because as they came up to that little hill that comes to Clark Pumana they just [9:27] went right up the hill, not going to run at all. So I appreciate that you're trying to [9:34] to regulate the bicycles, the e-bikes, the scooters. [9:39] You've got to do something. [9:41] Meeting with staff, it sounds like this is a starting point [9:44] and they're willing to look more in detail [9:47] to find it over the winter months, which is good. [9:50] I just hope you find the balance between people like me [9:54] and I don't like to persist by it. [9:57] When it says it goes 28 miles an hour, [9:59] I have had it going 28 miles an hour, [10:01] but then I can't pedal any faster [10:03] to get it going in the past. So people need to realize that kind of thing. [10:07] Find that balance between the ones that are all there, [10:10] abusing and and people like me that try to follow all the safety [10:16] rules. I'll also put a plug-in for [10:19] I'm a member of the Ango Bike and Ski Club. The Geezer's group is a [10:25] part of the Bike and Ski Club and many of you might know that we're in the [10:30] of that has, for 30 plus years, done all the maintenance and enhancement of the [10:35] Guardsky-Plowitz cross-country ski, hiking and biking trails. And so we've been in [10:39] this business a long time. Sarah provided me again with a copy of the bike [10:44] relic maps. We were one of the clubs that was involved in getting that map done, so [10:50] people would follow St. Charlotte's around town. So I'm hoping that all of you kind of [10:55] keep this in mind that you got to address the problems. [10:59] Chief has assured me that he doesn't have, I believe, one year too. [11:04] He doesn't have the time and resources to pull over someone like me [11:07] that I'm at being rock flicks like. [11:10] But we have to get that across to people too because [11:14] organises are ordinances and sometimes you just got to get some [11:17] something on the books so that your enforcement people are able to go forward. [11:21] So, thank you very much. [11:24] Thank you. [11:26] Thanks, public comments. [11:28] We'll take in a consideration when discussing the [11:31] or the answers to your advice. [11:33] Thank you. [11:35] Okay. [11:36] Let's move on to the consent. [11:39] There are no committee reports. [11:41] We'll move on to the consent agenda. [11:44] The consent agenda. [11:46] The resolution number is 56.26. [11:49] contract with this one of those fireworks with 2027, 5726. [11:55] The legend transfer of up to $45,000 in the votes account to heavy trucks with purchase [12:00] of a tandem truck. [12:02] 58-26. [12:04] You pair a wastewater treatment plant equivalent fund. [12:07] 59-26. [12:08] You pair a water plant ballistic pump. [12:12] 60-26. [12:14] You place on a wastewater treatment plant lower number five. [12:17] 61, 26 inspection of waste water treatment. [12:21] Land-moved disinfection system. [12:24] And 62, 26 lines, slowly handling requests for fits. [12:33] Those are the items that are to be considered [12:35] to be considered to be a motion of the top. [12:37] I'd like to say, I'd like to remove 57, 26 pieces. [12:49] Okay, so it also includes department manager reports as well, okay, okay, anything else that should be legal. [12:57] Let's vote on those that we all agree on. [13:01] 26, 26, 26, 26, 26, 26, 26, 26, 26. [13:07] So, promotion to adopt a concert agenda. [13:13] Second. [13:15] Second. [13:16] Second. [13:16] Moving second into adopt a concert in genuine, [13:18] less, the resolution of the 70th and 70th and 26th. [13:23] All those that came in second, five are saying, [13:25] Adam. [13:25] I will follow. [13:27] Roll call. [13:28] Okay. [13:34] When you're going to have to vote on your, [13:37] I [13:41] can vote. [13:42] Do you hear something like a vote? [13:46] I'll vote on the gas. [13:49] 9-0. [13:53] Okay. [13:54] The agenda item now is the budget transfer of the $45,000. [13:59] The report account to heavy trucks to heavy trucks or bridges of a tent of truck. [14:06] Questioning about the condition of the roof as far as we have had the roof repaired, and [14:13] if that was the reason for an excessive amount in that account, I have not seen a report [14:20] on what the problem were in the roof and what we're going to do to correct it for the [14:28] So, one or three years ago, we had a problem with a lot of moisture in our building, but we thought we needed to do growth. [14:38] But we brought in an engineer, a havoc engineer, and he recommended that we raise the heat and run our air exchanger a lot more. [14:50] But prior to that, I had moved the money from a salt sand building to that because I thought that the roof was bad. [14:56] And I needed to move the money so that we could face the roof of it. [15:01] That's where it's always been. So, that's why it's there. So, you know, actually some day I'll move it back over and put it in the salt hand shed because we have now added more time on our air exchanger, which takes the moisture. The moisture was kind of sending on the end of the building and dripping down. And we thought that we had a bigger problem than what we actually had. So, in the last three years, we have kind of fixed that problem, but that just never got me. [15:30] I'm going to talk to that out. [15:32] We approved number 5726. [15:36] The budget transfer of the $47,000. [15:39] Okay, there's a second. [15:41] The motion is seconded, that we adopt the budget transfer of the $45,000. [15:46] Now there's a growth account to heavy trucks through the purchase of a tandem truck. [15:50] Any clue in the discussion? [15:51] I just got one question. [15:52] What is a tandem truck? [15:55] It's one of our dumb trucks from Holland, [15:57] and gravel, black snow, this is a small version of what you see. [16:22] Okay. [16:26] We'll move on to the new business, the ordinances, the revision of Section 42-167, [16:34] in control of the Postural Race Direction [16:37] to public silver's regarding streets traps. [16:41] So this was the item that the move for last month's agenda, [16:47] the ordinance was not ready, [16:48] and I also wanted to have a list of all greased trap owners [16:51] to include for the council as well as a copy of the board [16:54] of the notice will be made on all streets trap owners. [16:58] Should this be a proof? [17:02] Otherwise, I mean, if this was approved by the public works [17:06] and that's a lie. [17:09] And again, this is just looking to get a call in a baby step toward enforcement, just [17:17] cutting down on the amount of grease and fats that oil is making its way to put waste [17:20] better treatment, which is overtaxing our various mechanical systems and assets. [17:27] I'll [17:34] make [17:37] a motion to adopt 1388 be to approve to approve. Yes, the section 42167 of the Industrial [17:49] to waste for a free stretch. [17:53] Okay, any good discussion? [17:55] It's not a whole figure. [17:56] Say hi. [17:57] Hi. [17:58] Oh, it's not a tool. [17:59] Hi. [18:00] Hi again. [18:02] Can I talk that? [18:04] That's my mom. [18:05] Of course. [18:06] It's so exciting. [18:08] Thank you. [18:09] Oh, you're welcome. [18:09] Thank you. [18:10] 9-0. [18:12] That's right. [18:13] I'm going to talk that. [18:15] Okay. [18:17] I'm from 1-3-9-E. [18:20] Approved zoning appendent application requests to amend ordinance number 1095 be the municipal [18:27] code of vicinity of anecdotes to ask the class what the property of 950 behind street [18:32] cars will number 201-121-2128 as our treat to family residents district instead of be one [18:39] neighborhood shopping to allow for the sale of property as the residents instead of a business. [18:45] I'm [18:49] prepared to make a motion to accept and adopt 1389P to approve the zoning amendment. [18:58] I'll second. [18:59] But move the second that we approve the zoning amendment application request to amend the ordinance number 1095B, the municipal code. [19:08] To classify, we're probably at 959th Street as R3 to family residents instead of B1. Any further discussion? [19:16] Is that the place that used to be a store on that corner of delicacies and that's why [19:27] they need to change it because I remember it being a store like 60 years ago. [19:34] Any further discussion? [19:36] That's not a little bit. [19:37] Almost in favor. [19:38] Say aye. [19:50] Okay, [19:53] let's [19:59] move on to 139-0-D. Approved convention of sections 38-302-38-304-38-306-38-308-308 bicycles and safety and close to cars. [20:15] definition of operation of bicycles, elected bicycles, elected motorized [20:19] devices, elected scooters, and personal assisted mobility devices. [20:28] This is, I guess I'd like to leave on, but I am probably, I like, I like biking myself, [20:35] I like cyclists, I like having a lightly cycling community. [20:40] This is not about trying to punish any of what this is, I guess the goal behind this [20:49] ordinance was threefold. Number one was, the ordinance was not intended to correct [20:53] all instances of what I'll call a wooleanism. That may correct me if I'm wrong [20:58] chief, but I mean riding bikes unsafely on trails and on the streets and [21:02] on sidewalks is already illegal. It's a matter of enforcement, which we can't have [21:06] officers everywhere at all times. People are going to get away with what they can [21:10] get away with. You know, regarding helmets that was not addressed in the ordinance [21:15] because kids need to be allowed to do stupid things on bikes, including not wearing helmets. [21:21] And the opinion of staff and administration is that it's when kids, [21:26] riders, operators start to endanger other people through their actions that the city needs to get involved. [21:34] Wearing a helmet is, if we start handing helmets, if we start to see an uptick in injuries, [21:40] do we start candy, double pads, knee pads, you know, at what point do we draw on the line [21:47] where what do we call, what is victory in that center? [21:50] And I, I don't have an intention for the city to become what I'll call an interesting [21:56] for the city operates like an overprotective parent towards his residence. [22:01] The second item with this is it's meant to put a, I want to draw attention to the function [22:07] of public infrastructure, which is that sidewalks were always intended for pedestrians for some [22:12] with the general task of a single person moving at a speed of under five or six miles per hour. [22:18] The men will be starting adding things that are slightly larger or slightly faster. [22:23] Now we're upsetting the balance of the public right-of-way between the motorized vehicles and what [22:27] pedestrians are doing. [22:32] The value question I ask is in the scenario where we have, let's say, a three-wheel [22:37] pedal assist, bicycle going down the street, and the mother with the double stroller coming down [22:42] and the other, the same sidewalk, [22:44] who needs to step into the traffic [22:45] to make room for the other. [22:47] To make a little less dramatic one, [22:49] same bike rider, a couple holding hands. [22:52] The point, when I look at that example, [22:54] I go sidewalks were made for the pedestrians [22:57] to be out, safely in the same right-of-way [23:00] as motorized vehicles. [23:02] And to that point, you know, bicycles [23:04] do occupy an awkward middle ground [23:06] of having the relative size and profile [23:10] of the pedestrian, but the relative speed [23:11] of all the right vehicle. To me, that means that infrastructure needs to be designed around their [23:17] use. They're vitally, which we currently don't have in downtown America. Right now, we don't have [23:23] the ability to accommodate through angle parking of the various intersections. The third one is that I'm [23:31] not going to advocate for any ordinance that we don't have the intention of enforcing. And as it is, [23:37] I don't want the anti-go PD going on. I don't think Chief wants to see. They're going up to kids on [23:42] bikes and asking them, you know, do you have a driver's license? Where is your helmet? [23:48] Do you have this? Because that is not going to create a positive impression of our law enforcement officers [23:54] on the community or kids we want to make the community safe, but we also want to have a positive [24:03] opinion of our law enforcement. I don't want them doing things that are going to jeopardize [24:08] that's a condition because this is an arrow piper-scrutely of that sort of thing. [24:12] This [24:16] is a contentious issue at this point, [24:19] and so the other thing I want to emphasize [24:22] with this is this is not when [24:27] the ordinance was being written, I made sure it was clearly [24:32] marked and designated, and that's because I do want points in downtown, but we can't just [24:38] look at problems isolated from everything else going on. [24:42] I think there would be a negative trickle down effect to not be either going farther than this resistance is going or not going far enough. [24:55] There are, you know, speaking, looking at other communities that have done work, it's like this that are trying to enact more age based restrictions. [25:03] There have their legal counsels raised questions about, you know, it's unclear if this can legally be enforced. [25:10] If the state has laws, separate laws for age 12 and under, but we start getting a little [25:15] bit older. [25:16] It's not as clear-cut according to other units. [25:22] And so this is what informed of this, [25:28] and that was what it led with the staff to make [25:30] this recommendation. [25:36] Never read the coordinates before this. [25:39] Now I read it a few times, but I used to take my truck bicycle with just 27 speeds and [25:44] to school right down, right down to how the people were late. [25:48] This doesn't allow that. [25:50] Now unless there's a bike link. [25:53] Okay, but I could up to this point. [25:55] I guess. [25:56] Now on the sidewalk. [25:57] Now on the sidewalk. [25:58] Never ride on the sidewalk, so. [26:00] So this is the change. [26:02] This is a change. [26:03] And to clarify, this is in alignment with the city's established, [26:10] as a bike city, our formal bike route that was adopted in 2014. [26:15] It does not go down to have new ones against Lincoln or George. [26:21] It moves on to 4th and 7th. [26:23] I can't speak to why that was done, but I know that it was done. [26:27] It was approved, and that is the current opinion of the city. [26:32] The current stance of this city, I should say, based on previous ones. [26:36] Who has this been reviewed by? [26:38] Ms. Ordinance? [26:39] Yes. [26:39] This is the main people working on it [26:43] where myself, Chief Who's Nick, [26:45] and then Sarah Rack joined in as well. [26:48] Do you think maybe they should be some people [26:50] from the outside, because it's a good point, [26:53] I think 16 and another are a lot of the violators. [26:57] You know, you have people writing likes coming at you, [27:00] they don't realize it, so I think one of mine is I. [27:06] I killed myself. [27:07] Okay. [27:07] So I mean, I saw this was on here, but I just agreed it. [27:10] and as Gary K. Red from Mr. Rodriguez. [27:16] So the library is the main point, and these are adults. [27:19] But even for myself, if I want to write my back [27:21] from my house to the where I work, I'm going to have issues. [27:25] And I have staff who work on 10th Ave, [27:27] and they're also going to have issues. [27:31] So it is, I understand the point. [27:35] And I don't ideally ride downtown with the parking [27:40] the way it is before it was much easier. But Claremont is a light. So from where I live, [27:47] if I want to loop, I'm going to come out of the library and I'm going to use the light [27:51] as a vehicle in the lane to crash. So if you're going to establish that there is a bike lane, [27:59] then you need to create a bike lane because I know there are a lot of individuals who only means [28:06] of getting around is a bike. [28:10] And this intersection impacts the library [28:12] where they are regularly going. [28:14] And that's the same for the old geezers. [28:17] They meet at the library and use the light. [28:21] I can see kids because there are a lot of kids [28:24] who ride stupid during that intersection. [28:26] They go against the light. [28:29] I myself do not always wear a helmet in tap. [28:33] I wear it on the road. [28:33] I don't know where it didn't have your result you had to make a choice and you don't want accidents, but [28:41] writing a bike as a vehicle in the highway you're subject to the same laws. If you don't have a bike lane [28:48] that is the only intersection downtown and for anyone around this square [28:54] that's it. Even if that's where to go out the parking lot it's gonna go out the parking lot in [28:59] 64 because he values the lake to get across to get 10 because crossing anywhere else is not [29:05] safe. [29:08] So this intersection of not having anything at Claremont in fifth from fourth to sixth [29:15] is going to impact a lot of people's accessible transportation around town. [29:22] Kids? [29:23] No. [29:23] There's, I mean, even if you're coming from the middle school, if there are ways to all around [29:28] and they're going to, they're going to spend as much as passed anyways. [29:34] But for adults, that intersection, having that as a no-bygones, [29:40] is going to limit accessible transportation. [29:45] It's not that you're not allowed to have a bike donk. [29:48] I would say you're not allowed to operate the bike donk. [29:50] You can walk the bike across the intersection. [29:53] This is an outline of bike existing, and it's just not within operation. [29:58] If I wanted to go out for it and... [30:00] Turn for work, in winter, I have a fat bike, and basically walks through my bike door. We're going down for. Until I get to third month and then it's still going around. Access from fourth. [30:15] If I turn that thing on the parking lot, I think you can't access the market. Yes. And originally, when this citywide bike route was put into place, the reason that that fourth avenue route was was was put into the route. [30:32] It's because you have that bag access to the parking lots and the businesses without having to be on fifth avenue, which is not designed currently, currently for bicycles. [30:45] And it is unsafe. [30:47] And the reason that it goes down along the seventh is because we already had an identified route for our students that were crossing back and forth. [30:57] I'm 45 with the assistance of crossing guards during school and we worked and received [31:05] funding from the hospital to put in rapid flashing beacons we also have the boys and girls [31:09] collaborate there. So those intersections and crossings were thought out so that it was [31:17] meeting the needs for the greater population still providing the most amount of safety to [31:23] the greater population and identifying that unfortunately we just didn't have a well-designed [31:30] downtown four bicycles and we were optimistic and hopeful that that would have been included [31:36] in the new design, however it wasn't. So those routes still are the citywide and identified [31:43] bike routes with the consideration that you can hop off, walk your bike, although not ideal [31:50] if you're on a trite bike you still have the option to take those alternative routes [31:57] that are safer. You're now going to imagine that's the only intersection which makes it easier [32:03] to cross. I don't care about riding a bike downtown. I'm not riding a bike downtown. It's been [32:08] driving downtown without in your car because of the way parking is an oversized vehicle and you can't [32:20] but you are forcing people to go around how are you going to educate them all but that's the [32:28] route they want to take. So we do have the signage that the community donated to her and it was [32:35] installed in the Angle-Bikensky and Angle Optimus. There's Becky at the whole brochure. [32:40] Is there going to be signs on the street? [32:43] Okay, so we'll know that it will go by itself. [32:46] We currently have signage that's on the side of us. [32:50] I think the sidewalk's always no issue. [32:55] I think we have objections to it, [32:57] and I recognize that, but we need to move on. [33:00] It typically is a thunderous public comment. [33:02] Thank you. [33:03] Thank you. [33:04] If you had permission of the council, [33:07] so you know, doing the ordinance, [33:09] I think it's a really good ordinance, [33:10] But I think we need some community input, but what are we about to do anything like this? [33:17] You know, there's some very valid questions, I think those under 16, I think those [33:23] of where the lot of need to apply more than the adults, so I can have some issues with the [33:32] ordinance. [33:32] In that regard, just the fact that it needs to be efficient, they review nice community members. [33:38] we should have a community review on yet before we adopt it. [33:41] I don't think we're ready to do that, Kim. [33:43] And I guess the question I have, [33:44] don't maybe even help with this. [33:46] I have to eat next to once our water rise, [33:49] fully water rise to once to 20. [33:52] Did we have a lot of issues? [33:54] No, I mean, we've always had issues [33:55] with bicycles downtown and specifically on the sidewalks, [34:01] whether there was a sign or not, frankly, [34:04] There's always been people that have used sidewalks, but I mean I don't think it was a huge issue for us, or at least it wasn't [34:12] raw to our attention as much as it is being now. [34:16] Because I guess as a person trying to live downtown walking, I never noticed as much of an issue as I have a [34:25] recent with these motorized things I zoomed by like a motor scooter. I don't know if it's because I'm [34:31] getting older and I don't see things as quickly or my reactions aren't as quickly but I never [34:38] noticed that being much of a problem as I was wondering you are. Should we address this? In segments, [34:46] you know the ones that are fully motorized. Again, I'm just playing devil's actor. [34:53] Yes, [34:53] asking about why it happened. Now, we've had more bounce on businesses open up recently. [34:58] Can you mention her there? It's been come more of a problem just for the owner. They're [35:02] trying to walk away from store to store going to any of my fifth avenue because now we [35:07] have like six or seven fairly new businesses and see more foot traffic. As far as saying [35:13] children are ones doing them both to bike rate. I've been down to many times. There's people [35:17] my age are 40s, 50s, they have no problem going down that on a penalty and as fast as they can go. [35:24] And it's been an issue in the last year and a half, two years I would say, I've brought [35:29] brought to Joe's attention a while back. And that's what kind of prompts it. You might suggest [35:34] me the worst, because they can really go. These scooters are bad too because they go right [35:40] wrong. Matter of fact, one day I was walking down there. I came on to the Cooper's mercantile, [35:44] stuff in front of an e-scooter. Well, they're black marks for me in the sky. [35:48] How they stop because they're going to get a problem if they don't. [35:53] So it is an issue down there. I know maybe we need [35:56] to tweak a little bit as we go along, but I think we should [36:00] doubt that now and see what needs to be done as we go along. [36:04] I agree. I look at it. I believe this is a [36:08] starter, but we're going to be investing this again and again. I'm sure. [36:13] because since our last meeting, I've almost ran over two of those. [36:17] If I hadn't been an alert driver, I would have hit one. [36:20] Because it seems like when you don't have to pedal, anything goes. [36:24] And that's a problem you have. [36:26] And so, I agree with you. [36:28] I think we should guess something fast. [36:30] I'd like to see a brochure of some kind, [36:32] bend it out for the benefit of kids, [36:34] and get them all over the city so they know what the rules are up here. [36:38] This ordinance is not going to be an event, but by most kids. [36:42] So we do something I think I'm in there and I think in the schools and library, wherever [36:48] it might be, so they know how to conduct themselves with these contractions. [36:52] I call them contractions. [36:53] I can do that because I have a three wheel electric bike myself. [36:57] And I know you will obey the signs. [36:59] Everything else, you don't violate anything just because it's not a car. [37:04] And so I say, let's start, pass it, we're going to address it again, I'm sure. [37:11] First time some kid gets randled where we're going to be talking about it again. [37:15] But I would sure like to see a group show of some kind put together and we could hand out, [37:20] so every kid knows how they're supposed to conduct themselves without reading the city ordinance. [37:28] So if people can remember back at the illness maybe last year I want to say, don't over the complete timeframe for any ways, I was pre-advocate of a bike lane. [37:43] But especially on Fifth Avenue I think it was that I talked about. [37:50] I don't remember that part back, certainly I don't remember it six years ago because I was [37:57] born then, but I was, and still I am a huge advocate of the bike links and we need to [38:09] have them. [38:11] It's not just for safety because it really is, but it should be for, oh, it's the world [38:19] I'm looking forward to looking at a law type of deal. [38:25] So if you have one of the books and someone say, [38:29] cause if you're in a pedestrian walk away, right? [38:33] And if someone were to hit you in the pedestrian walk away [38:38] and across the lights, that is like you have more [38:42] of a right to sue and get more money [38:46] or something along those lines. [38:47] I don't exactly remember what it is. [38:49] I'm sure Joe knows more about that than I do. [38:53] But in the same sense, if you have a bike lane, [38:57] you have more of that incentive to say, [39:00] hey, if someone's going to, if someone hits me, [39:02] or if someone fish tails me or whatever, [39:05] you want to call it, and you have to go to the hospital [39:08] or you have to get some kind of incentive [39:10] to, like, broke a leg or something like that. [39:13] You have that right, more of a right, [39:15] to sue that person and get more insurance money or whatever it is. [39:20] So that's why the bike lane was coming to play. [39:23] So it is so different than the pedestrian walk away. [39:27] So I'm more than willing to work with people to get a bike lane [39:33] in any of our streets really, but more specifically, [39:36] 5th and 4th, because that's where, like Tony said, [39:40] that's where more of the traffic is when it comes to the library [39:43] I don't really care about that, but I care about being able to reflect on itself. [39:54] I'm for it. Yes, there is no easy solution to a bike lane on fixed. There is it. [40:02] Fourth is a stillestraining or claimant is stillestraining, claimant is feasible. [40:09] It's not. [40:13] Again, I think that's a part of fit that development, that's a whole other ballpark of what you want [40:19] you to have time to be. [40:21] Yes. [40:22] Any further discussion? [40:24] Mary? [40:25] I have a lot of discussion, but I was going to wait till we had a motion, but the [40:33] highest [40:34] risk of injury or accident or trouble is from children. Children and teens are the problem. [40:42] Adults are not the problem. And helmets are the greatest thing that can protect them. I don't [40:50] think allowing kids to be stupid and wear a helmet and get run over is really a very positive way [40:58] of looking at this, I think we should actually mandate helmets and that would save children's [41:06] heads. [41:07] And if a parent can afford to buy them an easter, I think they can afford to buy a helmet [41:11] personally. [41:13] And I also believe that the downtown problem is not adults, it's not gland driving his bike [41:23] down the road. [41:24] It is not the geyser's riding down, crossing fifth and superior, we cross, we either cross [41:31] in the bicycle lane or we cross with the traffic, if we have enough people, we have a right [41:36] to be in the traffic lane, and it's certainly safer there in the intersection of fifth [41:41] and superior than it would be just crossing somewhere else. [41:45] So I do feel there are other issues with this, and I don't think I feel that the adult [41:52] should not be uncoded in the restrictions of these streets. [41:55] I think it's fine to restrict it to 16 years of age or under 16, I would say, actually, [42:02] because the 16-year-olds probably have their driver's license and they know the rules [42:07] of the road. [42:09] So I just don't see the point how this really advances your goal of having bike lanes by [42:15] keeping everybody out of the tunnel. [42:17] I don't want to see how it really relates, yeah, [42:24] I guess that's all the thing that I did to my head right now. [42:32] Oh, there's one other thing going in there. I'm sorry. [42:37] In one of the sections that says riders should be single file sections 38-306. [42:42] and another section that says 38-304-8-3, it says they can write true or [42:49] breast so I don't feel that it needs to be clarified because it says two [42:53] different things in that ordinance. [42:55] Okay, it's gone, so that's the only thing that we appreciate the concerns [43:01] for the bike roads downtown. [43:05] Trying to be looking at the whole situation, I think [43:09] obviously, to make it done properly, you're going to redo traffic and parking lanes and [43:22] everything downtown to create a bike lane because the reason there isn't one downtown at this [43:28] point in time is because of the parking situation. So there's probably once, we need to see there's no [43:40] problem and trying to look at what some of those solutions will be, but definitely there's [43:46] going to be a significant cost to make that happen. [43:52] I mean, don't misconstru this is not caring for people or injuries or anything, but it's [44:00] easy to say we need a bike lane, but then we have to look at how best we can do that. [44:08] and it's not just changing an ordinance, okay? [44:12] I mean, this needs to be, [44:14] I mean, if we're talking bike lanes and fifth day of, [44:17] fifth day of, we have to figure out the best [44:22] way to make that happen. [44:25] When the bike clubs and the library, [44:27] people have to do an educational program, [44:31] with the kids to try to get them on track [44:33] to what we're trying to accomplish. [44:35] I mean, is that something that we're already talking [44:38] into the fire department by doing I can see if you have the library so yes and I know Julie's [44:44] wasn't happy to do stuff and Joe's having such and such so absolutely yeah I guess start somewhere [44:50] with you know trying to get him on track this is this is proper way of riding bikes in the streets [44:58] and self-stop. [45:00] Okay. Typically, you know, there's a public comment. Okay. We do have some, we didn't. Okay. [45:05] So these have one more person. Was that correct? I just want to make a comment about the double bike safety. [45:13] And the animal bike and ski club in cooperation with the Optimus club for years has had a bike safety, uh, [45:21] rodeo, um, it went away for a few years there. And now it's back. And we do it at the [45:27] I'll put the fairgrounds, we just did it in August. [45:31] If we give away, and we sponsor helmets, give away helmets, [45:37] we give away bikes, we do all that kind of stuff. [45:39] But if the city goes forward with this, [45:41] the best thing they can do is get education out wherever they [45:45] can get it out of the terms of what's going on. [45:48] It'll be more appropriate probably next spring [45:51] than it would be now. [45:52] So there is existing mechanisms to get the information on. [46:00] Can I come in for a minute? [46:01] I feel like in my role, and since we have such a good turnout here today for community members and the council has questions, since this was my idea, I would like to take some e-floor, right? [46:14] I just want to, I've been taking a few notes and I just want to make a couple things clear and I may be repeating myself from a P&L for those that were here but [46:25] so everywhere I've been in my new role, right, people come to me with this problem but they don't have a solution. [46:31] The goal is not to produce revenue, it's not to bring the hammer down on people that are being responsible. [46:37] It is simply a foundation or a rock that we can chip pieces away and try to form something [46:43] that is agreeable. [46:44] In my opinion, this is a good start. [46:47] So if somebody, and I mentioned this before too, officers have discretion, right? [46:51] So we can talk to people and we're not going to be picking on somebody that is writing [46:57] responsibly with a helmet or a vest and doing the right thing. [47:01] It's not even going to attract my officer's attention because we have a lot of other fires [47:05] but all versus somebody that's on their bike in the know-the-zone, right? [47:09] Now, the enforcement can be there for us to issue citations or take enforcement actions, [47:15] and it's a something something for us. [47:19] When we make contact with people that are on bicycles in certain areas, [47:24] we don't want to be the ones that are making a poor community contact. [47:29] We want to educate, we want to prevent future behavior, [47:32] and make sure people realize what they're doing is either a wrong, b, against the law, or just not a healthy choice for them to be doing. [47:43] All the week you mentioned having brochures, today actually my school resource officer was in the high school with an e-bike and a table full of information. [47:55] I think it was part of the health department that had healthy days or something at the high school. [48:00] But, promoting this ordinance and promoting bicycle safety, I helped with the Automus Club at the bike safety room, I've been there, I held up the signs, I drew the chalk on the floor, right? [48:14] So I get it. [48:16] We can easily put this out to the public so people are clear on what we mean here and what we are going to do in order not to. [48:24] And to your comment message about, you know, kids that are 16 should have a driver's license. [48:30] You would be surprised at the number of unlicensed drivers out there. [48:34] There are kids that don't get their license until they're 18 sometimes, or not at all. [48:39] There's kids that don't have a license and decide to drive their mom's vehicle at 12 years old. [48:43] We've seen it. [48:45] So it's dangerous either way we look at it, right? [48:48] So I just wanted to point out that there aren't a significant number of unlicensed drivers that don't know the rules of the road, and if they aren't right, they still might not know. [48:59] So hopefully we can promote this and get it out there to the public so they have a clear understanding. [49:04] So I said as a previous meeting, education is the key, I think the education is the key thing here. [49:11] Right. [49:11] If we want them to stop and look both ways. [49:15] Right. [49:15] And if we can stop and make contact with somebody and have a positive contact with them, [49:20] and have this in our back pocket saying, this is the role. [49:24] This is what you need to know. [49:26] And we can refer them to either the city of any website or somewhere where they can find that information. [49:31] Yes, Chairman. Yes. I move that. We approve that redation. Is that written? Section 3802, 38304, 38306, 38308, 38308. [49:46] Nice second. It's good move. Seconded to that. We approve section 3D, 0308, 38306, 38308. [50:07] Okay, [50:14] I agree with you that, you know, kids should wear a kind of stuff. [50:21] However, the only part that I disagree heavily on [50:25] is that the state or the, in our case, the municipality should not regulate people to have [50:36] helmets on all the time when they're running e-bikes or scooters or whatever. [50:41] You gotta let kids be kids, in a sort of sense, because there are a lot to make state mistakes. [50:49] And I mean, you can laugh at that all you want. [50:51] You're allowed to die and you're saying it's okay. [50:54] Well, can I speak this? [50:55] Yes, please. [50:56] Well, you just spoke to me. [50:57] Can I speak for it? [50:59] You see? [50:59] Your phone. [51:06] It's yellow kids, be it kids, and let them make mistakes, [51:09] because that's how they learn. [51:13] I was the same way, we're all the same way, pretty much. [51:16] I would hope to make mistakes, and that's how we learn. [51:21] Maybe not right away. [51:22] But certainly in the future, that's how you learn. [51:25] And I mean, I've fallen off my skateboard a lot of times, gotten bruised, knees, and twisted legs and stuff like that, but did I learn? [51:36] Yeah, where, how it, and all of this stuff, but when you start mandating everything, you know, that complete that is like a police state. [51:45] That's not what anyone wants. I'm sure Mary wants it, but I strictly don't. [51:51] But I'm not, no, that's not the part. [51:55] Okay, yeah, I'm done. [51:56] Very tired of something else one day. [51:58] Well, I wonder, I want to know if I can make an amendment now that we have a motion second. [52:03] You can amend it, you can table it, you can do whatever you need to do. [52:06] It takes presidents of the main motion. [52:09] Okay, then I make a motion to table this for further study. [52:14] There's like a move [52:18] to the second that we table the motion and table the motion means [52:21] that it's taken up in the next session. [52:24] It doesn't mean that it's dropped. [52:26] Matter of fact, you know, I think this is something that needs to be done. [52:31] I can tell you that. [52:32] I'm not so sure. [52:34] We need some humanity input. [52:37] And to me, in your table, I would also include that we go to public works and that a committee [52:42] be formed and that they report back at, you know, the next household meeting, and we could [52:48] adopt the motion of that. We're only putting it off for 30 days. So we have the motion [52:54] in the second. [52:58] Okay, all those in favor of cabling the motions on the next meeting. [53:03] Signify by saying aye. [53:06] All right. [53:10] We may be better do a show of hands at the time. [53:12] I'm going to choose the roll call. [53:14] OK, we'll use the roll call. [53:15] Oh, thank you. [53:18] Always the favour of tabling the motion. [53:20] To table and be very glad to public works. [53:24] Is that correct? [53:25] OK. [53:26] And brought back to the next console meeting. [53:30] Both, yes. [53:32] OK, so it has the motion is to table the motion referring [53:35] to public works to come back to the next console meeting. [53:38] Yes. [53:39] Mary. [53:40] That's correct. [53:41] Thanks a lot. [53:41] for [53:45] the needs to get done. [53:48] Or you've got the right to do it. [53:50] No. [53:51] You have pushing. [53:52] What? [53:52] On [53:56] what's had been cast? [53:59] Six to three motion carries today. [54:05] Okay, look at this done. [54:07] It was actually a wonderful. [54:08] So I'll have some committee. [54:10] I can put them on the screen. [54:11] Okay, committee will see the cards. [54:15] There's a set of all of them. [54:17] You can go on double range screen today. [54:20] So it's good to read this number, I'll ask. [54:22] Okay. [54:25] The next item is six. We'll go into motions. We'll find the city representative to the city plan for the next item. [54:44] Yes, with my recommendation at home, he, I believe, wrote an email back on that. [54:49] that is how many of these are about that. [54:52] That's just briefly touched on that. [54:54] It's not an obvious choice to make the parts [54:56] for a cemetery director, a number of plan commission. [54:59] There were two considerations that one is that [55:02] there will be zoning ordinance coming to plan commission [55:05] next month to give the commission a little bit more teeth [55:09] when it comes to site plan reviews. [55:12] I'll go into a lot more in detail in that next month [55:15] that's being, but as part of that would be [55:18] be a more formal stamp review process [55:22] that the commission can get a more distilled version [55:25] of what's going on in the plan, [55:26] how that aligns with ordinance or state code. [55:30] And so within that stamp review would be representatives [55:32] from the Civil Native Administration of Building Inspection, [55:35] as well as engineering serving public works, streets, [55:39] police, fire, and that sort of administration. [55:44] And so it's my preference that someone who was on the commission [55:49] as the staff representative is not involved in that review, and it's just like the commission on that, and also to a [55:56] by and minus four in section two, dash five, two, two, Sarah is a city resident, so we did not get violation of that [56:04] ordinance, which mandates that a non-resident is a non [56:10] -most committing to commissions. [56:13] It will be in the item is to point this in representative Sarah rep to the city planning commission. [56:19] Placing Charlie right. [56:20] Placing Charlie right. [56:21] It goes for time. [56:24] I'll make a motion to that. [56:27] That's Sarah rep raises. [56:29] Also, move the second that we appoint city representative Sarah rep to the city planning commission.
