[6:25] >> And for the record Alex [6:27] Van dam bird planner with [6:28] planning and as commissioner [6:31] Nina stated we do have a case [6:32] before you today. [6:35] They are requesting specific [6:37] use permit for a secondary [6:40] living you that address is one [6:40] Haven would You have a location [6:41] map he's in the middle of a [6:44] residential a single family [6:46] neighborhood. [6:48] Here are some images of the [6:49] subject site so this is the [6:52] House and the ad the secondary [6:52] living unit will be attached to [6:55] the rear of the seen from that [6:58] side Street. [6:59] And the site There is [7:00] a correction from the staff [7:02] report, the staff report stated [7:03] that the [7:05] addition would be set-back 25 [7:08] feet from the street side [7:09] property line it will [7:12] be setbacks 15 feet about 15 [7:12] feet does meet the utc [7:15] standards for residential [7:18] single family, 7.2. [7:19] The accessory or primary [7:19] dwelling additions would need [7:22] to be set back 15 feet and they [7:25] will meet that. [7:31] Here is the floor it has one [7:33] bedroom living area kitchen [7:34] a bathroom. They do intend to [7:34] incorporate the primary [7:37] bathroom shower into the [7:39] secondary [7:39] living unit, leaving the [7:42] primary bedroom with a half [7:44] bath attached to it. [7:44] And the elevations, the West [7:47] Side elevation is the one that [7:48] faces the street [7:52] that elevation will be clad in [7:53] brick to match the primary [7:54] residence, the the back of the [7:55] addition would be citing which [7:57] matches some of the accident [8:01] scene on the House current. [8:04] The recommendations if the [8:07] commission. [8:10] They will be [8:12] creating a half past in the [8:12] primary bedroom if possible to [8:15] keep that a full Baston out a [8:16] full gas and the secondary [8:17] living unit. It MAY just just [8:20] suit the House and then to [8:21] revise the window design and in [8:22] the rear of the addition to [8:25] lure those windows down to [8:28] first floor height. [8:28] Was [8:29] opposition 4 letters in [8:30] opposition received from 3 [8:33] different addresses. And I'm [8:36] available for any questions. [8:40] >> To the commissioners have [8:43] any questions for our staff at [8:46] this time. [8:50] >> I will open the public [8:50] hearing and called for speaker [8:51] had rumors believe you're the [8:54] applicant which please come [8:57] forward. [9:01] >> We promise to be nice we are [9:03] South. You have a clock that [9:04] you'll be able to see once it [9:06] gets started up there. But go [9:08] ahead [9:09] and start tell us your name and [9:12] the city that you live in we do [9:13] not need your address. [9:16] >> My name is even sending in [9:19] Arlington Texas. Well I like to [9:20] start right. [9:23] Thank you for the opportunity [9:26] to bring in my case he [9:29] thank you Todd and access for [9:30] only patients and guidance to [9:33] my name is Pedro Muniz haven't [9:34] given the context of [9:37] who we are as a family and why [9:38] we are applying for [9:39] these permit. I'm the general [9:41] manager at the kind of let it [9:42] rest right in Arlington, I've [9:45] been in mcconnel r is for 33 [9:48] years. [9:50] Prout Arlington residents for [9:52] 33 years as well me and my wife [9:56] we've been married for 33 [9:57] years. [10:00] It's evident that we use we met [10:06] Here for. We have [10:07] 3 kits all of the morning race [10:08] here in Arlington on them a [10:11] graduates 2 of them still live [10:14] with [10:22] and my mom my mom, us and Iran [10:23] and the wheelchair. She's [10:26] 85 years old. She's she's been [10:31] struggling with diabetes for [10:33] 25 years. Last year her liver a [10:34] push and decreased so she's [10:37] owned and this is 3 times a [10:40] week. [10:46] She had a pacemaker implanted a [10:49] so this comes with [10:54] >> she's been these all of [10:55] conditions sadly. [10:56] >> How make her less and less [10:57] dependable what used to be used [10:58] to be an open seat, she's there [11:00] with our family. I'm lucky [11:03] enough to have a. 5 brothers [11:06] and 3 sisters. [11:07] 5 of them leaving here in [11:10] the Metroplex and we all are [11:11] very are [11:14] very grateful to still have our [11:17] mom with us. And we take turns [11:19] so that they [11:21] she says she doesn't have a [11:24] house she comes to each one of [11:25] us. Every I it is Sunday and [11:29] Monday so she comes to me and [11:31] always she spends a day of [11:35] 2 days in my In there same with [11:37] all my brothers and [11:38] sisters that that able by [11:39] spending and when they when [11:41] they would make sure that she [11:44] is. [11:44] First of all I don't want [11:47] somebody at all times couple [11:50] usual, she fell and she has [11:50] here injury so we try to [11:51] prevent that from happening we [11:52] helped me go to the restroom. [11:55] Well we feature we taken to the [11:57] clinic and stuff like that. [11:58] So all these moving from home [12:01] to home is causing the stress [12:04] and. Mostly for [12:07] her so. My petition is to give [12:11] her a a more permanent. [12:14] Better quality of life. [12:15] So she could have a [12:15] home over on and we can come to [12:18] their instead of shoot coming [12:21] to us. More convenient she [12:24] has 4 and others and for that [12:27] over you has so as you can we [12:30] have a big family and. [12:31] I love [12:34] on calls nieces nephews and all [12:35] that so they they will be [12:38] able to the said more often [12:39] these have permanent place. [12:42] Rather than moving from one [12:42] house [12:43] to another. So I believe [12:44] approve these projects will get [12:48] better. MAY convert time when [12:51] she's with us. [12:54] Hollywood I will improve a [12:55] lot so [12:58] as the men as the main reason [12:58] why we're paying for these [12:59] projects, I'm not looking for [13:02] financial benefit, I know my [13:03] tenant so the property taxes [13:05] will increase. But that they [13:06] had the benefit of I mean my [13:09] mom and a veteran mind and will [13:12] the prices to us. [13:14] I know that I was told by [13:16] Seminole contractors I could [13:19] apply for a permit and not have [13:23] to go through. But I'd rather [13:24] I'd rather do it [13:25] right away. And under the [13:25] supervision of the city of [13:28] Arlington that we love so much. [13:32] There are any the commissioners [13:35] have questions of the applicant [13:38] this time. [13:43] >> Thank [13:44] you MISTER Ramirez for and [13:45] doing things the right way I [13:47] know we have some people in the [13:50] neighborhood that that start [13:50] their projects and then they [13:53] get shut down because they [13:54] didn't get through that [13:55] proper channels to get permits [13:58] and that sort of thing as a [14:01] baby boomer myself. [14:05] It's it's so important that [14:06] that we have some place to take [14:07] care of our parents if they're [14:09] not able to take care of [14:10] themselves and I do see that [14:13] more and more as people are [14:15] living [14:17] longer life and and you're very [14:18] fortunate to still have your [14:21] mother here I I do not have my [14:22] mother my father still [14:25] around so. But I do understand [14:28] the necessity that that older [14:29] generations are having now [14:29] as far as not being able to [14:32] care for themselves in. And we [14:35] prefer to. [14:37] Have them with family if [14:38] possible though one of the [14:40] things that I did want to ask [14:41] you [14:41] about is. [14:43] >> The backside of the addition [14:45] that you're thinking of putting [14:49] on is all siding. Would you be. [14:53] Would you be amenable to [14:56] matching the backside of that [14:59] edition with. [15:02] >> As far do you have like [15:05] brick that goes halfway up your [15:06] house and then you [15:08] have sighting. Yes, yeah could [15:09] would you be amenable to doing [15:12] that said that it matches both [15:15] sides. That was my [15:16] biggest concern and is that I [15:19] wanted it to match and not just [15:20] be all citing where it just [15:20] stuck out. Yeah okay all right [15:23] so you be okay with yeah all [15:26] right, thank you. Any [15:29] other questions. [15:32] >> So first of all thank you [15:34] for being a longtime resident [15:39] and I love with Carter were [15:42] so I have a lot of concerns [15:43] with this [15:44] but listen Utah male escort, [15:45] several points in there because [15:45] I'm concerned about what [15:47] happened and later on when you [15:48] sell your [15:49] house what what that is but [15:52] just to make sure I understand [15:55] this right. [15:58] Your goal is to mom [16:01] lives there and then various [16:02] family members come [16:04] stay within the sodus mother [16:04] says his 2 brothers district so [16:05] you're you're making that is [16:07] her central point is that [16:10] correct that's correct. [16:12] Everything in my head and [16:12] you've got my vote. I mean the [16:15] questions commissioner Johnson. [16:22] >> Yeah thank you for being [16:24] here at a great thing you're [16:25] doing and we're we're all very [16:25] very supportive of that so that [16:28] were on board with you for the [16:29] for [16:30] all this you've seen the staff [16:30] recommendations if they [16:33] recommended 2 items are you [16:35] amenable to doing [16:36] those yes. 1 one thing I I I do [16:38] see about [16:41] >> the removal [16:42] of the. [16:43] >> a shower from the master [16:44] bath and I you know I asked [16:46] about well how big is the is [16:47] the [16:49] main house and I think it's [16:49] around 1800 something years and [16:52] it does seem to me that better. [16:57] Construction development [16:59] if you leave that master bath [17:02] with a full bath or a master [17:02] bedroom area with a full [17:04] bathroom and are you are you [17:06] able and im mean to adding a [17:09] format and leaving the master [17:11] bath full. [17:11] >> I don't have a problem with [17:14] the nation is that that the [17:17] roof peach. [17:21] They're [17:23] coming down like this if So [17:24] that leaves I think the whole [17:25] way with the water and rain [17:27] will come down and if it extend [17:28] well essentially [17:29] 2 things if I extended the [17:33] device from the shower. It will [17:36] be a difficult. [17:39] I'm not sure how would they. [17:42] Make their roof and in an [17:44] extended. That's from. [17:44] I'm gonna be honest with you [17:47] when I'm planning on moving [17:50] anywhere. [17:50] And for us my way is that [17:53] second the U.S. From us the [17:57] class that anyway, it's [17:57] so so, and it it would [17:58] were into it says that 2 feet [18:01] so you're saying it's a net [18:04] gain for you [18:06] >> And this and that thing is [18:07] that the the the wall and they [18:08] exist in house that we have [18:11] that will be next to the wall. [18:14] We use it as a family room is [18:15] get that to be beautiful [18:18] Windows and endeavoring some of [18:18] the line into that room and so [18:19] I wouldn't want to block it. [18:22] But if you that has to be done [18:25] them in. I guess we'll find [18:27] a way well I [18:27] I understand the explanation [18:30] and accept the explanations [18:33] that that finally thank you [18:36] Sir. Commissioner matters. [18:38] I too in phantom a part of why [18:41] Thank Sir. [18:44] >> I would go there. Sometime [18:47] this week. [18:49] You will to the staff [18:52] recommendation I was kind of [18:55] ambivalent about that. [18:58] >> It to me to do what was [19:01] necessary. But if you mean will [19:02] to do it [19:05] that's fine. Will race a point [19:05] Mike. [19:08] >> Certainly isn't there's no [19:09] secondary means of egress. [19:11] >> The loft bedroom, you know [19:12] what I mean. [19:16] >> I think that extent the [19:17] nation and we had it [19:18] we know I think we know and and [19:21] so that it would be a. [19:22] >> In the bedroom here in the [19:23] U.S., yes outstanding isn't [19:24] that's on the problem. [19:27] >> Yes, she is she suggested [19:27] that in that. [19:28] >> That's what we really need [19:31] to change so to to make it [19:33] right. Thank you Sir. And the [19:37] comments Christians. Thank you [19:40] Sir. [19:40] Are there any other speakers [19:43] here in support of this [19:45] project. [19:48] MISTER Mayor is a feels have [19:49] see for just a moment. [19:52] I have a 2 additional cars that [19:56] are in opposition. [19:57] Jamie Lynn and opposition if [19:59] you would please come to the [20:02] microphone when. [20:05] Yes, I said he's hiding back [20:08] there. [20:10] James you just give him a c [20:13] still there. Yes, yeah, okay [20:17] will be patient. [21:30] >> You know have to pull up a [21:33] presentation but just hit [21:36] right. [21:39] Showing that Haitian. [21:49] >> Thank you that's just your [21:52] name and city of residence, we [21:53] don't no longer [21:55] >> it's well actually I'd like [21:57] to get my Jane land because I [22:00] share a fence line with heiress [22:02] family. We have known [22:05] them for 20 years we've been on [22:06] good terms or children grew [22:08] up together. Yet even though we [22:09] share that fence line they fail [22:12] to communicate to us their [22:12] plans to do with [22:14] zoning change. So I feel like [22:16] that's not really a neighborly [22:17] thing to do I think they should [22:18] have come to us to discuss it [22:20] first not that they legally had [22:23] to do that. But it [22:24] what then a [22:25] nice because the zoning change [22:27] is a big deal. This isn't just [22:28] adding on [22:29] like a rumor expanding their [22:29] house or anything this is a [22:32] huge deal because this could [22:33] set [22:37] a precedent for the entire I [22:37] think it's problematic that [22:40] the government allows that [22:43] legal. Mechanism so [22:44] to speak to [22:45] change the zoning because in a [22:47] lot of cases that pits neighbor [22:50] against neighbor and it [22:53] diminishes the community. [22:55] We witnessed had with [22:55] the pastor when they got those [22:56] as up so we know how that went [22:59] to trial underneath their [23:02] homes. [23:04] So that to say I'm [23:04] zoning change. Well it's an [23:07] honorable thing to care for an [23:09] aging parent. [23:10] We can clearly established that [23:14] this additional dwelling unit [23:14] is not intended for paid [23:15] Sarah's mom. Since an 85 [23:18] year-old woman in a wheelchair [23:19] would not be able to access a [23:21] loft bedroom upstairs, I'm I [23:23] guess I'm a little [23:26] confused about the design of [23:29] this [23:30] in addition, the zoning [23:33] permitting construction faces [23:36] takes to considerable amount [23:38] of time. So I don't see a [23:38] justification for a permanent [23:40] zoning changes for a temporary [23:44] living situation trying to make [23:46] this make sense but it [23:48] does not. Again this is [23:48] something that impacts the [23:51] entire community I understand [23:51] their need what they're [23:54] wanting. But there MAY be a [23:57] better way to do this and [24:00] I did have a discussion with [24:01] His wife and I know she told me [24:02] they had another house in [24:03] Mexico that they were planning [24:04] to retire to this worries me [24:06] because if they end up selling [24:08] at some point in the near [24:10] future. What are we going to be [24:11] left with because in essence, [24:15] it's like a duplex because it's [24:16] a separate entrance [24:18] to separate the unit, I'm [24:18] worried that in the future they [24:21] might rented out for airbnbs [24:22] you know every moves in here [24:24] and or rented out for long-term [24:25] and I understand according to [24:26] the the ordinance or whatever [24:26] you're not allowed to do that [24:29] kind of led to rent out. [24:31] How [24:33] do we manage that in the future [24:34] going forward how do we control [24:35] that code we have a hard time [24:36] with them now we've got so many [24:37] issues in the neighborhood that [24:39] we've been trying over and over [24:43] to rectify and we're not seeing [24:45] a lot of progress in [24:46] some areas. Now I do know that [24:47] the mayor is also another [24:48] rental properties is there a [24:52] way because I know in that [24:52] documentation that he sent to [24:55] the city that the his adult [24:55] children would be interested in [24:58] possibly living in that [24:59] accessory and I mean maybe they [25:00] can live in one of the rental [25:01] houses, I just think there's [25:03] other options besides doing a [25:04] complete zoning change. [25:06] And I think this needs to be [25:08] brought to the commute and he [25:09] you know usually applicants [25:11] will have town hall meetings [25:11] with the neighbors and have [25:13] discussions again we didn't [25:13] even know about into a few days [25:16] before this is coming before [25:19] you. [25:20] So I'm also I wasn't sure on [25:23] the windows I know their spine [25:25] to this South and to the West [25:28] is there another window planned [25:31] for. This structure. [25:36] Because I'm just concerned [25:37] about it being intrusive into [25:37] our yard. I don't know if [25:40] there's going to be a window [25:43] facing our yard or not. [25:46] Ski won't come up and dress up. [25:53] >> There's no wind only because [25:55] you're on the East Side or the [25:57] side of [25:58] the property. There's no one no [25:58] on that there are 3 windows to [26:01] the north and that one window [26:04] on the West elevation. [26:05] >> Yeah, I know that they'll be [26:08] good stewards of this but [26:09] nothing is forever and then [26:10] chilly this and we will move on [26:10] probably as the wife told me [26:13] they're planning to retire in [26:14] Mexico. [26:16] What's going to happen to that [26:19] property after that we MAY not [26:20] be able [26:21] to control who does what with [26:23] that accessory unit at its [26:26] innocence like a duplex and I [26:27] got into a single [26:28] family neighborhood and I'm [26:28] really upset about the city [26:31] coming in and trying to change [26:34] zoning. I'm after the [26:36] fact so [26:37] and there is a plumbing issue [26:38] at the curb. I don't know if [26:38] that's going to be address it's [26:41] been going on for years there's [26:43] considerable subsidence [26:43] the leaks been going on for a [26:44] very long time and you can [26:47] actually measure this how much [26:47] it sunk. [26:48] So I don't know if that's going [26:49] to be something required to be [26:52] fixed before they. Propose any [26:54] new construction. [26:56] And then parking and I know the [26:59] city does not allow doesn't [27:02] specify the need for. [27:03] Extra parking but if you're [27:03] going to increase the [27:06] population density that's [27:07] something the [27:08] city MAY think about putting [27:09] into the ordinance because [27:10] you're going to be increasing [27:13] population density if you're [27:16] adding living units. [27:20] I have for right now thank you. [27:20] >> I direct the commissioners [27:23] have any questions for [27:26] commissioner Blake. [27:30] In reference your pothole or a [27:31] problem [27:31] with the. [27:32] >> The sewer have you used to [27:33] ask Arlington happened place [27:34] that has occurred. [27:36] >> Quest know that teachers [27:36] aware that my husband. [27:38] >> I walked by there a lot and [27:42] we've talked to him about and [27:42] yes trying to fix [27:43] it. But. [27:45] >> If you would have to go and [27:46] ask Arlington eyesight or feel [27:46] downloaded to your phone you [27:48] can take a picture and send it [27:48] them and they won't respond. [27:51] >> Okay so okay, thank you [27:54] thank you. [27:55] >> Are you aware of this really [27:56] isn't a zoning change this just [27:59] in addition with this. [28:02] >> Special use permit just want [28:02] to make sure you [28:03] knew that. [28:04] >> For something that's not [28:06] already allowed under the [28:08] current single-family [28:09] zoning correct. [28:12] >> It is allowed in the City [28:16] Council passes a niche [28:19] let me the elephant in the [28:21] every time one of these cases [28:23] comes out and it's used to not [28:26] be as often. On this body off [28:29] and on. [28:32] I mean, here's a look on a but [28:34] used to be not very often but [28:35] with the economy being what [28:37] it is we've seen a lot more [28:38] these come through not just [28:38] your neighborhood but a lot of [28:41] neighborhoods within the city [28:44] limits of origin. [28:48] Yeah how we set up here, [28:48] we know [28:49] that the person that's going to [28:51] live in this unit has to be a [28:55] relative. [28:56] So when the mom to a [28:56] passes away. I'm a physician as [28:57] you well know, and I know what [28:59] I heard all the diagnosis [29:00] season. [29:03] And I know what near future [29:06] brings. So some could live in [29:09] their daughter. But you can't [29:11] rent out anybody else. But your [29:13] point is well taken what [29:16] happens if they ran it out too. [29:17] Anybody not a relative. [29:20] You have to report it using the [29:23] Askari to nap. And the city [29:24] will come out and [29:24] enforce your yes they're not [29:27] supposed to do that they're [29:28] also [29:29] not load kid in the area period [29:32] airbnb is not allowed at all in [29:35] your neighborhood [29:35] because it's not in the [29:37] entertainment zone, again if [29:41] any neighbor in your in your [29:41] vicinity is doing short-term [29:42] rentals report the city will [29:44] come out in But the ordinance [29:47] and find them. [29:50] You the death of the difficulty [29:53] that you have is. How do you [29:54] access code enforcement. [29:57] How do you get people come out [29:58] and actually [29:59] do something and I'm going to [29:59] reference what he just said [30:02] again because I do it all the [30:05] time. [30:05] In central Arlington I don't [30:06] live in one of the New York [30:07] Times I live in the 1950's. [30:10] How do I keep my neighbors [30:12] from. [30:13] Parking cars in their yard and [30:16] how do I keep their fence from [30:18] leaning over. [30:19] >> Our report report report and [30:21] report and eventually Coke [30:23] compliance [30:23] comes out and eventually things [30:26] get done, but I got to be like [30:27] a dog with a bone. I can't [30:30] let go because if I do then [30:33] this neighborhood [30:33] goes down. So I'm going to ask [30:36] you as a neighbor if this [30:37] passes the City Council. [30:39] You have got to be vigilant. [30:40] You and your neighbors, not [30:43] allow them to do what you just [30:44] described. [30:47] Well in a moment to listen to [30:48] reply if [30:48] you'd like. [30:51] >> Well, yeah I I do do that [30:53] not you [30:53] could actually walk around our [30:55] neighborhood and find a 100 [30:56] code by and you can make your [30:56] full-time job, I'm just going [30:59] to say that sure okay me so you [31:01] pick and choose [31:02] your battles but I know talking [31:03] to Nicki Hunter, you know she [31:03] was telling me there was a [31:06] discussion I guess about a week [31:09] ago about boarding houses and [31:09] people are renting out rooms in [31:12] their homes, the city can't get [31:14] a handle on that. [31:14] So why I mean I'm on board but [31:17] the mother-in-law quarter I [31:19] don't have an issue [31:22] with that I have an issue with [31:22] the big picture [31:23] going forward. How is say how [31:24] in the world are they going to [31:25] regulate this I just don't see [31:28] any way for them because it's [31:29] difficult at best [31:30] now to manage the wrenching out [31:33] of intervention. It will rooms [31:36] and [31:37] single-family homes [31:37] and here you know listening to [31:38] what the city manager there [31:40] they're cutting code [31:43] enforcement. [31:44] That doesn't make any lodge if [31:45] you're going to increase the [31:47] population density we need to [31:48] increase code officers, we need [31:49] more hands on deck and I feel [31:52] like until the city can manage [31:52] with it has we need to put a [31:55] full stop in some of the stuff. [31:59] >> But unfortunately this body [32:01] don't have that authority. [32:01] >> Well an even if you like [32:02] deny it city County. [32:05] >> Improve and I understand [32:06] that [32:08] too so well thank you, but I [32:08] just wanted to give my input [32:09] because I do share a fence line [32:12] and they have been good [32:12] neighbors. [32:14] I just am concerned with what [32:16] happens 5 years out looking at [32:20] further out then just hearing [32:21] now. Thank you very much. [32:25] Thank you. Semiconductor some. [32:37] The sticker somehow. [32:39] >> Please state your name and [32:42] your city of residence stickers [32:46] in Arlington Texas. [32:50] >> Let me start by saying that. [32:57] I'm a little disturbed. [32:59] That symbol of [33:00] the members already indicated [33:03] their support before hearing [33:06] any out everybody else. [33:12] I agree with what Jane had [33:14] already said this is not by at [33:17] t and now this is about what [33:20] happens tomorrow. [33:24] But they intended use but this [33:27] property is going to be. [33:31] I have every atv big problem [33:32] approving this the course later [33:33] this going to be more traffic [33:33] there's going to be more [33:36] parking needed at this already. [33:40] Not [33:40] a hearing to ordinances as far [33:43] as parking goes far, I'm just [33:46] going to property. [33:46] I for one have been turning in [33:49] code complaints because that [33:53] car is continually. Part at the [33:56] stop sign. [33:58] I took a picture yesterday [33:58] going home. 9 to 9 times out of [34:02] 10 when I go home and change [34:03] same neighborhood. I got a [34:04] whole it's a car at the stop [34:08] sign. That's against the rule. [34:12] And that leads me [34:15] to ask what else is against [34:18] their will. [34:19] If you're not here in Arlington [34:21] on and from that but else I'm [34:25] not hearing too. [34:28] Hall a lot of traffic. [34:30] In our neighborhood because [34:31] of that 2 schools, Bryant [34:32] elementary is down within [34:35] walking distance from this [34:36] house. We have our stress I [34:39] think we have in our obviously. [34:41] Before and after [34:42] school trapped I think we don't [34:45] need parking issues at this [34:48] property. [34:51] Trian only. [34:54] I do not trust the process that [34:58] the city would be and they re [34:59] involved with the [35:02] future use off this property if [35:03] it turns out to be a vandal. [35:06] Because Arlington that's not [35:08] operate on [35:09] a project the basis everything [35:11] is a complaint basis so that [35:14] puts a burden on that front. [35:16] I already turning [35:17] in com. Let's call it a [35:17] violation of thing just [35:20] neighborhood and this is one of [35:23] my target homes for parking. [35:25] I respectfully ask that you [35:28] can see for my comments and [35:31] tonight. [35:43] >> There being no questions of [35:45] you thank you [35:46] very much. Now MISTER Mayor is [35:47] you have an opportunity to [35:47] replied to the opposition if [35:48] you'd like come forward make [35:50] any additional statements. [35:54] You certainly MAY do so. [35:59] >> I just wanted I apologize [36:02] to James yeah we within never [36:06] his forte. As long as we've [36:07] been in the same house [36:08] 24 years. The key is good We [36:10] love you know her daughter and [36:12] I get [36:14] such a we should have come to [36:14] you and tell you whether plans [36:17] where because he didn't think [36:18] it would be in a [36:19] safe port first to go all [36:21] around the neighborhood and [36:24] tell anybody but. Just want to [36:25] apologize and that it. [36:28] And the situation with the with [36:31] the hat home [36:34] and Mexico. [36:35] That's we bought a piece of [36:36] land over there and when the [36:38] planning on retiring mixing [36:39] Coleman once we get 65 or 67 [36:42] proudly well the spending some [36:43] time some time here we've got 3 [36:46] gets here so we asked which was [36:47] stuck in Arlington. [36:50] What cowboy fans we stay here [36:50] we're not going anywhere. [36:53] I mean I do think Bush is [36:56] commissioner family. [36:58] >> MISTER Ramirez is you know, [37:01] I'm just going by what MISTER [37:02] Gerson said as far as the [37:04] parking around your house. [37:05] I know you have a corner lot. [37:08] Yes, so you are on Haven would [37:10] and Marquette. So there should [37:13] be plenty of room for you to [37:15] park [37:16] year without. [37:19] >> Being close to a stop Yeah [37:21] we we were [37:21] nowhere really. [37:22] >> Like I said we have 2 kids [37:23] living still with us as to [37:24] Carson my wife's tonight, [37:27] that's for cars but there's one [37:30] of [37:31] the parks. In front of our [37:32] mailbox we thought it would be [37:35] it would is far enough from the [37:37] from the spots [37:39] to time. We don't part on the [37:40] stop sign, but if that's an [37:41] issue we'll all make it a point [37:42] to park on the other side was [37:43] going to say it might be better [37:44] if we don't have a partner out [37:45] of our own cats, I have a [37:45] problem with that he's never [37:48] come up, nobody's ever said [37:49] anything, [37:50] I'm sorry. [37:51] >> All right, hey no problem, [37:51] maybe you know sometimes [37:54] education just a lot of bright [37:55] and that's. [37:55] >> And they got on the right [37:58] tool to say one thing and in [37:58] that's what this is for right [38:00] right Prince that's right. [38:03] Thank you, thank you. [38:06] Commissioner Blake. [38:07] Maybe for you or maybe for [38:08] Alex, but just want to verify [38:11] proper notice to go out. [38:14] On this is correct that's [38:15] correct. So. [38:15] >> Yeah just a staff I can [38:17] answer we did send out property [38:18] owner notifications were mailed [38:19] and the sign was placed on the [38:22] property and thank you, I'm to [38:25] adhere to state laws. [38:26] >> Thank you. MISTER Mayor as [38:29] get is there anyone. In the [38:31] audience [38:31] who wished to speak on this [38:33] item and did not have an [38:36] opportunity to do so. Not [38:39] saying you know for sure. [38:41] State your name the city that [38:42] you live in and if you did not [38:43] fill out a blue car art similar [38:46] to this if you do so after you [38:50] finish. [38:54] Remember your name and the city [38:55] that you live in [38:55] a rented. [38:56] >> Washington and I live in all [38:59] it takes is thank This is [39:00] something that what do [39:03] at all. But the true feels [39:06] about the [39:07] common law [39:08] is playing a park in there it's [39:11] a call a lot has the front and [39:14] all down thus at his side is [39:15] very low. So him his family [39:17] could Park there I have [39:21] sympathy for. [39:24] Because the couple weeks ago. [39:25] And the steps that might be [39:28] 40 here. So I understand the [39:30] situation of him making [39:31] have a proper place and [39:34] somebody to have to look at [39:36] that. But a [39:39] forest Dakota. In the parking [39:42] on o j. [39:42] And I hope I don't [39:45] but that's a big call in a lot [39:46] of people can Park there. [39:47] >> Thank you for your sorry for [39:50] your loss Sir and thank you [39:53] very much for speaking. [39:56] Questions or comments. [40:02] Seeing no other speakers at [40:03] this Close [40:03] the public caring and ask the [40:06] commission for any questions [40:07] comments or motion. The [40:10] commissioners have any [40:13] statements that like tonight. [40:15] >> I just want to say something [40:16] I know we as neighbors all want [40:18] to be good stewards of our [40:20] neighborhood [40:21] right and one of our [40:21] commissioners lives in your [40:22] neighborhood and I know she's [40:24] very active in the neighborhood [40:26] and spends a lot [40:27] of time communicating and [40:28] sending town Council meetings [40:31] and things like that and so I [40:32] would encourage you all [40:34] as neighbors. If you're having [40:35] issues with parking and things [40:37] like that please address those [40:39] with your [40:40] Council person please bring [40:42] that up and ask Arlington out [40:43] that also has an option to [40:44] report that Street parking is [40:46] the hand is handled by the city [40:47] Police Department not [40:50] actually code so there's 2 [40:51] variances there that [40:52] you can I have to deal with but [40:53] I do suggest that you take this [40:55] to light and encourage people [40:56] to [40:57] do that. I also think that it [40:58] might be a good idea for you [41:01] all to work with your Council [41:03] person [41:04] and maybe creates a [41:05] neighborhood community meetings [41:06] where we all can help educate [41:07] each other and other neighbors [41:08] on those things because I think [41:11] that does make a successful [41:12] society and where [41:12] we live we're all of y'all can [41:15] get along and have improvements [41:17] as the user not going away. [41:17] Single dwelling unit permits [41:20] are not going to go away we're [41:21] going to see more [41:23] and more that was and so being [41:23] able to address the needs of [41:26] the community as well as the [41:27] resident is very important. [41:28] So I do appreciate you, but all [41:29] coming forward and talking when [41:31] it's not your thing because [41:34] that's important. Wilson thank [41:37] you. [41:40] >> I have a motion to approve [41:41] by commissioner like a second [41:41] by commissioner winkles [41:44] commissioner black, but you [41:46] state your motion. [41:47] >> I will try someone MAY need [41:50] to clarify a couple things on [41:51] it that I'm like [41:51] to prove. A motion to approve [41:54] this up 26 dash '02 24 oh one k [41:56] that [41:59] would drive with the following [42:00] additions of brick on the [42:03] facade on the rear and sides of [42:05] of the dwelling. [42:08] To match the existing pro the [42:11] home as well as. [42:13] As well as the addition of [42:14] the staff recommendations and [42:15] my question is on clarification [42:18] what what did we decide on the [42:21] bathroom. [42:22] >> It's going to be left alone [42:25] has a plan so they're going to [42:27] have a half bath main house a [42:30] full bath. [42:35] >> In the in the new unit per [42:38] remove the. But they keep the [42:41] full bath in the. [42:42] And I for bath in the in the [42:45] edition that was with staff [42:48] recommendation. [42:51] Right now as it stands there [42:54] will be a half bath left. [42:54] And a full bath in the new year [42:57] a kind of stands right now with [42:58] a half bath and the [43:00] and the home and a full [43:00] bathroom and the new unit right [43:03] as well we're going to take the [43:06] windows and move them down. [43:10] No no work for them. [43:13] Well yeah window. [43:17] I think I got there right all [43:20] right so brick a full bath and [43:21] the new unit, a half men [43:22] the other. [43:25] >> And the adjustment of the [43:28] Windows as discussed. [43:33] We're not making any [43:35] adjustments to anyone do okay [43:38] crash Windows but the applicant [43:39] as a man the bull and has said [43:42] he would do it with staff to [43:45] add a window as far as it. [43:49] Whoever sleeps in the loft. [43:52] >> Is that going to be a [43:55] friendly amendment. Some of [43:58] it's a motion in progress. [44:03] >> That's that's ok but that [44:04] with that so that's a motion [44:07] guy all right commissioner [44:10] winkles is that your second. [44:16] >> support term we're going to [44:19] prove that s up 26 0, 2, [44:20] With many of all second are [44:23] second floor window being [44:26] added. [44:27] Brick by brick facade along the [44:28] rear of the home that is [44:31] correct. Nice way to state it. [44:35] >> And hope in the minutes will [44:38] show that I'm sure so with that [44:42] cast your vote please. [44:46] Motion passes 8 to nothing [44:50] thank you very move on to the [44:53] next case. [44:56] Pt 26 dash 0, 8.70 to 0 for [44:57] Mitchell Parkway this [45:00] application for approval of a [45:01] change in zoning from [45:04] residential state. The plan [45:06] development for [45:08] residential state. Plus unlike [45:09] a lot Rick utility substation [45:11] with a development plan on [45:12] approximately 10 and a half [45:14] acres at this time I call on [45:18] staff to present its report. [45:18] >> Good evening [45:19] commissioners for the record [45:20] Kevin Charles Prince will plan [45:22] a planning and development [45:25] services. [45:27] This evening, we're looking at [45:28] up to a parcel of land a piece [45:28] of property that's [45:30] approximately 10 acres in size [45:31] currently zoned residential [45:34] estate and as mentioned before. [45:38] The rig. The request is for [45:39] plan development for [45:39] residential state. Plus in the [45:42] electric utilities substation [45:46] with the development plan. [45:46] In the past 5 years [45:48] is only one zoning that speedy [45:52] 24 dash 15 that was with the [45:55] installation [45:57] of it cell tower grated to [45:57] 75 feet in high at the high [46:00] school there timber to review [46:03] that school. [46:10] It the adopted plans [46:10] that are going provide public [46:11] utilities and infrastructure [46:12] that accommodate the continued [46:13] growth and demand of the area I [46:15] think really that so we need to [46:18] say about that. [46:21] Again the south of state [46:23] highway [46:23] 3.60 corridor development [46:26] strategy is to promote the [46:28] history of the use history [46:28] to meet and identity for the [46:31] corridor and liver city [46:32] investments to serve as [46:35] a catalyst and leverage area [46:36] schools as community assets. [46:38] Here you see a layout of the [46:42] site is it is proposed. [46:47] Proposition a is for the [46:48] construction of a new encore [46:48] electric utility station and [46:51] all of the affiliated equipment [46:54] boxes. [46:54] The equipment that are required [46:57] as well as screening fence. [46:59] No [47:00] other permanent structures are [47:04] being proposed for the noise to [47:07] cite a. Actually causing [47:09] the entire. Location does also [47:12] would be a secure site per the [47:14] applicant. [47:15] For the utc all non residential [47:18] developments show the gva a [47:19] positive [47:20] preservation plan, however, [47:23] there are stipulations that are [47:26] currently in the unified [47:28] development code that [47:29] public utilities when you're [47:32] performing installations or [47:33] improving [47:37] sites, however. With this [47:39] stated the intention is to. [47:40] Basically just address those [47:41] trees that are located within [47:43] the potential building [47:44] footprint. [47:45] And to preserve all of the [47:47] trees that that are not going [47:47] to be. [47:50] Caught up in the easements or. [47:54] Areas were grading needs to [47:56] take place in order for them to [47:59] prepare the pad site. Level 3 [48:02] buffer. [48:03] Excuse me as a level 3 buffer [48:06] is required which would be 30 [48:07] feet the [48:08] site exceeds. [48:11] >> This on all 4 sides Dorf [48:12] West North East South [48:12] and West. With a commercial [48:15] property is adjacent to [48:19] residential development. [48:21] As well as one tree per [48:22] 300 square feet of the The [48:24] applicant is proposing to [48:26] install a new 6 foot tall [48:27] masonry wall around the entire [48:29] site there exceeding the 30 [48:30] foot buffer as I've mentioned [48:33] before with the smallest to Rio [48:34] to the [48:34] north being 50 feet from the [48:37] property line and the through [48:38] this area of to the side being [48:40] over 500 feet from the property [48:44] line. [48:44] These are of photographs [48:45] of the [48:48] as you can see it's a heavily [48:49] vegetated site. [48:52] You could barely see I guess [48:53] you just barely see the peak. [48:56] Of a roof of a house right [48:59] here. [48:59] So I [49:00] that you have a significant [49:02] amount of vegetation that is [49:05] currently on the site. Here you [49:06] get to give us a peek of maybe [49:09] another residence there that [49:12] one is to the north. [49:14] The [49:15] property lines very very [49:15] heavily screened by the [49:18] existing vegetation that is [49:21] located on the property. [49:24] Is an issue for the 2 have [49:25] want eviation a deviation is [49:26] the installation of the require [49:28] trees that would be required in [49:29] in [49:32] the buffer. Generally speaking [49:34] if this was a. [49:35] If this was a site that did not [49:37] really a sight it did not have [49:40] any trees they would be where [49:41] to install [49:41] 224 trees along the East with a [49:44] self property lines into roles. [49:47] What they are doing is they're [49:48] preserving [49:51] a 100 38 trees outside of the [49:54] building footprint. [49:55] And trying to preserve those [49:55] trees alone to propose a as [49:58] well as those right now said to [50:00] make sure the screen while [50:00] this creates a [50:01] significant buffer as you saw [50:03] from the photographs of the [50:05] site. [50:06] And staff feel that this meets [50:07] the intent of the buffer as [50:10] hopefully they won't even be [50:11] able to see [50:12] the site besides the [50:13] the equipment that exceeds the [50:15] 6 foot tall fence from any of [50:18] those property lines. [50:22] Staff to feel that this request [50:25] will Philly need due to [50:26] a significant growth in both [50:27] residential and commercial uses [50:29] in the South the center of the [50:31] city of Arlington. [50:32] The applicant is coming corn [50:34] only on Corey, let's cool [50:38] delivery delivery company llc [50:38] staff did not receive [50:40] any letters of opposition or [50:41] support staff did receive in [50:43] worries about what was [50:46] happening at the site. The site [50:49] is currently an planned it. [50:51] If if request [50:53] is approved and when they do [50:53] get ready to come in with their [50:56] play that we will look at any [50:57] type of drainage Street excess [50:57] things of those natures do in [51:00] that process staff available if [51:02] there any questions [51:03] or comments. [51:07] >> Thank you. MISTER Charles [51:07] well we do have a question [51:08] commissioner center. All just [51:10] kind of forgot to ask this [51:11] question at work session this [51:12] green wall there's an image on [51:14] the development plan it looks [51:15] like [51:15] brick thin wall but then the [51:18] detail shows like it's a [51:19] prefabricated [51:22] screen will which one of these [51:23] going to be a pretty [51:23] foot prefabricated. [51:26] >> Style screen wall masonry [51:28] but but the lone panels slide [51:29] in place they want to I asked [51:32] him to provide an image so that [51:33] you can also see. [51:36] The equipment. The focus the [51:36] things of that nature is we [51:39] really do have and that they [51:42] should try for. Yeah so I asked [51:45] him to put that on there. [51:48] >> Commissioner Gruber. [51:50] >> Sorry I forgot test this too [51:50] but when they get into planning [51:51] to go through all those studies [51:52] or any kind of required sound [51:54] study you think they'd have to [51:56] do is part of the [51:56] planning process make sure [51:59] there's not some kind of [52:00] planning We. [52:03] If it is recommended heavily by [52:06] my engineer then so be it. [52:07] >> Or by fire a new vent we [52:08] will ask them questions and [52:08] reference to any type of sound [52:10] a generation type of the issues [52:12] they [52:12] MAY have I know that mostly do [52:15] below homs and clicks yeah. [52:18] >> Maybe a little bit [52:19] >> crackling mention Saturday [52:22] and I think the only thing they [52:22] have mechanical that would [52:23] make up maybe a little bit of [52:24] noise as I know they have fans [52:24] for the cooling of [52:34] but if staff had a concern that [52:37] guests as for the yes Sir. [52:41] >> Thank you MISTER Charles [52:41] thank you Sir just I'm open to [52:44] the public hearing and called [52:46] for [52:46] the first speaker all I see [52:49] African to come forward have a [52:52] card from MISTER Rob Myers. [53:06] Thank you MISTER Meyer's name [53:09] and city own. [53:11] >> Good [53:11] evening Commission. [53:12] >> My name's action Miller, I [53:15] am a project manager in our [53:18] right of way group. [53:18] And involved in at the [53:21] permitting and zoning aspect of [53:23] this [53:23] new substation I the [53:26] opportunity to present. Before [53:29] you [53:31] all tonight. So just kind of [53:34] going into high-level the need [53:35] for [53:38] this station. Currently on [53:40] Corps operates and owns [53:43] a 15. Substations and switching [53:45] stations and we have to in [53:46] the pipeline. One of which [53:49] being this is this is our [53:52] Thelma who were calling it [53:55] substation I'm in really they [53:56] need for this [53:56] is. [53:59] >> We have our our Saint [54:02] Theresa just north of the [54:03] Interstate 30 Courtland which [54:06] is east of the west of this [54:08] site east of South [54:11] Cooper Street and Webb just [54:12] west of highway [54:14] Those are. [54:15] >> All at a level of capacity [54:18] that that takes us that we take [54:19] a look [54:22] at it, we're estimating that [54:23] within the next 5 years that [54:24] those substations will reach [54:26] what we allow for they're [54:29] they're amount of capacity and [54:31] so we [54:32] we're taking a from the [54:35] sighting perspective of where [54:38] can [54:38] where can we operate a new to [54:39] pick up the additional load at [54:41] that's In this particular area. [54:46] So we landed on this [54:47] side we have to for a new [54:50] substation we look at where our [54:53] existing transmission. Lines [54:56] are [54:56] this site is north [54:59] of our existing a 3.45 kv [55:01] transmission [55:01] lines so it provides an [55:04] adequate amount of space for us [55:05] to operate [55:08] and construct just under 3 acre [55:08] substation [55:10] I'm being this site is a is [55:11] about just over 10 acres. [55:14] I don't know commissioner their [55:17] sight. [55:34] So this is our Thelma [55:37] substation like I said it's [55:39] just under 3 acres. [55:39] Ultimate for transformer [55:41] substation with to control [55:44] cabinets there on the West [55:44] Side. One point occurred [55:46] correction is that the [55:49] substation will beast Greene [55:50] within a [55:51] foot Mason very screening law [55:54] as opposed to the 6 foot and [55:55] that staff mentioned [55:58] and we do have our single point [56:01] of access which the road [56:02] our property. [56:03] So we pick in that back of [56:06] using utilizing that existing [56:08] to access [56:09] our station and typically [56:10] whenever I say access. This is [56:12] an man station. However our [56:15] crews go [56:15] to ours our science twice a [56:18] month to typical f-one 50 to do [56:20] regular maintenance take reads [56:22] off of the top of the station [56:24] and any kind maintenance and [56:28] things that are required. [56:31] And. From [56:35] commissioner Finley you had [56:37] mentioned that there is in the [56:38] work session that there is a [56:41] need in the area which we [56:43] definitely see that [56:46] what this substation does is it [56:49] transforms to 3.45 k v. [56:49] Electricity at steps it down to [56:50] the distribution level which is [56:53] where we see our wood pulls our [56:54] distribution poles [56:55] and goes into directly serving [56:55] the residents and businesses [56:58] within the city of Arlington [56:59] and [57:01] we're estimating typically with [57:04] this they can and on load of [57:07] about [57:08] 10,000. Customers that it [57:09] directly serves. So hopefully [57:12] we can provide to increase and [57:15] then continue to [57:17] provide reliable services to [57:17] the area. And with that I also [57:20] have engineer with kimley-horn [57:21] MISTER Rob Myers as well [57:24] as our area manager MISS [57:26] Tiffany Richmond. [57:27] Addressing questions that the [57:29] commission MAY have thank you [57:31] for your time. [57:34] To the commissioners have [57:36] questions at this time [57:37] commissioner center. [57:39] >> a question of you explain to [57:42] the reason why the placement of [57:44] the. Substation was at [57:45] that location. And how you [57:46] actually connect to the [57:47] transmission and what several [57:49] players underground above [57:51] ground. [57:54] >> So we do have our existing a [57:56] 3.45 Katie transmission line [57:59] that's just along the south [58:02] side [58:05] so we will be [58:07] transmission line. [58:10] I'm into this substation that [58:11] will get dispersed to the [58:14] distribution level. And so [58:14] whenever we looked at I [58:16] mentioned. [58:17] >> Earlier we have are 3 [58:17] >> substations that were [58:20] estimating are going to be a [58:23] day. [58:24] A higher level than what we [58:25] find And so how we like to play [58:28] season. One along an existing [58:31] transmission line. [58:34] And that those substations are [58:37] even spaced amongst [58:38] the city to adequately serve [58:40] the different residents and [58:41] businesses in the various [58:41] areas. [58:44] >> It MAY be to clarify why did [58:44] you had you place it [58:45] on the property on the property [58:46] that was you know put it closer [58:48] to the transmission lines. [58:51] >> So we do have. [58:55] We do have a flood plain that [58:58] basically cuts off this corner [59:01] as well as [59:02] there's a a branch of a [59:06] that picture versus cut through [59:08] this property as also to [59:09] minimize the amount of [59:12] impervious coverage. That we [59:15] are. [59:17] By extending a driveway further [59:18] down or increasing the amount [59:20] of runoff on to the site that [59:22] we've got a drain. A way to [59:23] drain away from the station. [59:26] So this provides a quick in and [59:29] out for us. [59:33] Also minimizes the from east to [59:37] west and point we [59:37] placed it right in the middle [59:38] of the property. So that we're [59:40] not want one side closer to [59:44] residents any other. [59:47] New questions. [59:54] >> Are there any other speakers [59:57] in support. [1:00:03] MISTER Richards swing you'd [1:00:06] like to be a speaker, but it's [1:00:08] just you're [1:00:09] interested in hearing the [1:00:11] opinions so please come forward [1:00:12] and tell us what side you're [1:00:14] fall. [1:00:15] >> You never night MISTER [1:00:18] CHAIRMAN, a name and the city [1:00:20] that you live [1:00:23] got a few MISTER Swing by your [1:00:25] name. So it starts You [1:00:25] live in. [1:00:28] >> You have a little Elm Metro [1:00:32] Parkway on mission Parkway. [1:00:36] Setback to be actual physical. [1:00:39] Property that's required the [1:00:43] city code. [1:00:45] And I would like for that. [1:00:48] They're talking about the [1:00:52] screening fans. Also like for [1:00:57] to restrict the noise, a [1:01:00] maximum them actual high over [1:01:03] the solid acoustics sound. [1:01:06] Well some of the conflicts cell [1:01:08] walls and plant much. [1:01:08] >> Your evergreen screaming [1:01:14] trees around the property [1:01:18] To address the drainage. [1:01:21] I talked to are. [1:01:25] Talk to them in our own e-mail [1:01:26] MISTER MISTER Charles hurt us [1:01:29] and he and he said the drainage [1:01:30] would be. [1:01:31] Addressed in the playoffs on [1:01:33] the plan was approved talk [1:01:36] about that Randall's Street [1:01:37] that Street running North and [1:01:40] south. On the North and there's [1:01:43] a public storage. [1:01:45] >> gas company. Gas [1:01:46] company had asphalt public [1:01:48] storage has concrete all of [1:01:51] that [1:01:51] water dumps to Mitchell Parkway [1:01:53] and Grindstone court half of [1:01:56] grants do and it runs down. [1:01:59] Right now it runs down [1:02:00] to it ft empty field. It's not [1:02:01] a problem he goes in the field [1:02:04] dissipates good. But when that. [1:02:09] Substation he's still in there. [1:02:10] They can't them [1:02:11] I can't bill something in there [1:02:13] is going to stop that. It's got [1:02:16] to flow. And that they can [1:02:16] leave the street [1:02:18] like Indians. Encore coming up [1:02:19] there but bigger colder to get [1:02:22] down the street though some way [1:02:23] it's got to get a rail. [1:02:25] Substation the balling craik [1:02:28] bohman spring 2 run double [1:02:31] like. [1:02:34] Any questions. [1:02:39] >> The question was a statement [1:02:42] so MISTER Charles was correct [1:02:44] during [1:02:45] the planning phase, the design [1:02:46] engineer would submit plans for [1:02:48] utilities back in their [1:02:50] stadiums are going to walk over [1:02:51] there. You know that you can't [1:02:53] walk yet you can hear me can [1:02:54] you hear me I can understand [1:02:57] you can understand a lot of [1:02:59] mumbling. [1:03:01] We're hearing you want to come [1:03:02] back and probably understand [1:03:05] you MAY all come talk to you [1:03:08] after what about that. [1:03:13] Any other speakers in [1:03:16] opposition. [1:03:19] >> Saying that on the applicant [1:03:20] has an opportunity if they so [1:03:23] choose to to speak in rebuttal. [1:03:29] MISTER Mayor, thank you. [1:03:38] >> Related to the gentleman [1:03:40] just a comment [1:03:42] about drainage can we learn is [1:03:46] currently preparing a drainage [1:03:46] study. That will be [1:03:49] along with Platte and we fully [1:03:50] intend to meet all [1:03:50] of that. A city of Arlington's [1:03:52] codes and requirements along [1:03:56] with our development of the [1:03:59] site. [1:04:01] And it's related to the [1:04:02] setbacks maximum set backs This [1:04:04] this thirty-foot setback along [1:04:07] the Eastern and Western. [1:04:10] So as well as the 20 foot on [1:04:13] the front yard and 10 foot of [1:04:13] honor act and we are all of the [1:04:16] maximum the code requirement of [1:04:19] a setback. [1:04:25] >> Most are one calls [1:04:26] one question. [1:04:27] >> You're not going to come in [1:04:27] and totally clear the lot and [1:04:30] then builder substation and [1:04:31] builders [1:04:31] are here. [1:04:33] >> Next year you're going to [1:04:34] try to maintain the existing [1:04:35] green in JULY the property [1:04:36] lines if I understood Charles [1:04:39] correct. [1:04:41] >> So that's [1:04:42] that then. [1:04:43] >> The landscaping it's not [1:04:44] landscape and its growth [1:04:45] national growth that has helped [1:04:45] that has developed over the [1:04:48] years that is along the [1:04:49] property lines on [1:04:50] they either side of the [1:04:51] property into the rear of the [1:04:52] property you're hoping to [1:04:54] maintain as much as that is [1:04:55] possible with giving your [1:04:58] overhead access line from the [1:04:58] main line to the substation. [1:05:01] >> Yes commissioner winkles [1:05:04] that's [1:05:04] We would for the new [1:05:05] transmission line connection [1:05:08] from our existing transmission [1:05:08] line into [1:05:10] the station. We we are [1:05:10] intending we can't have any [1:05:13] Growth underneath there because [1:05:15] if we need to. [1:05:16] Fix those lines we need to easy [1:05:19] way for crews to get in there [1:05:19] to to [1:05:22] restore power to our customers [1:05:23] and [1:05:26] and yes we are on course goes [1:05:27] to be is [1:05:28] minimally invasive as to allow [1:05:31] us to be able to provide safe [1:05:34] reliable electricity. [1:05:38] >> So I'm assuming you don't [1:05:38] build these just because you [1:05:41] want to good because we do. [1:05:44] So that's a good thing. [1:05:45] So yes, Sir [1:05:46] so that more importantly my my [1:05:47] question is really centered [1:05:49] around the storm water that [1:05:51] comes through that [1:05:52] Street that washes over into [1:05:52] that because the more [1:05:53] impervious stuff we put on the [1:05:56] ground the more storm water we [1:05:59] have. And it has to go [1:06:01] someplace so. [1:06:01] Can you commit on the record [1:06:02] that your engineers are going [1:06:03] to design a plan that is not [1:06:06] back that up and does not cause [1:06:09] more. [1:06:14] Downstream from you so that [1:06:15] it's actually dealt with [1:06:15] it that property is right now [1:06:18] it's being dealt with is what [1:06:19] it sounds like to me and it [1:06:22] goes into that point so I don't [1:06:24] want us to [1:06:24] build something that causes [1:06:25] more problems for the people [1:06:27] upstream or downstream from [1:06:31] that runoff. [1:06:31] That will be you all's problem [1:06:32] if it creates more problems so [1:06:35] the residents can come back to [1:06:38] the city and say they said they [1:06:41] would [1:06:42] fix it. But [1:06:42] Yasser commissioner Blake I can [1:06:43] commit that will meet all of [1:06:44] the city of Arlington's [1:06:44] requirements and standards [1:06:46] related to drainage. [1:06:49] >> And I. [1:06:50] Allow robbed to kind of speak [1:06:50] more to urge strange, I know [1:06:53] they're working on their [1:06:56] training said. [1:06:57] >> Just want to add to [1:06:57] that percent your name and the [1:06:58] city that you live in yes, Sir [1:06:58] Myers and of Frisco [1:07:03] thank you. [1:07:05] When we do our we also do a [1:07:08] timely analysis. We. [1:07:09] >> The we and analyze the time. [1:07:12] >> And watershed so it's not [1:07:13] just [1:07:13] our site. [1:07:14] >> We make sure that we cover [1:07:16] everything within the watershed [1:07:18] which goes beyond that site so [1:07:21] everything that is determined [1:07:24] based on the runoff cold fish [1:07:24] and all these storm water [1:07:26] maintenance Emmanuel from the [1:07:29] city of Arlington we'll we use [1:07:30] to determine any impacts that [1:07:31] are so it would cause and how [1:07:33] to mitigate. [1:07:35] >> So is that a fair [1:07:36] assessment that sinjar working [1:07:36] with [1:07:37] electricity that will kind of [1:07:39] care about where that water [1:07:43] goes, yes, Sir. And [1:07:46] the questions. [1:07:47] Is there anyone here who want [1:07:50] to speak that did not have an [1:07:53] opportunity to speak. [1:07:55] Please come forward. [1:07:58] State your name and city that [1:08:00] you're following [1:08:02] these carts I did not have to [1:08:03] finish if you walk over there [1:08:04] and Trump this card to use [1:08:04] state your name and the city [1:08:06] that you live in place tomorrow [1:08:07] chop and I live [1:08:08] in Arlington. Thank you I [1:08:08] actually live in grants on [1:08:09] court 7200 I'm going to be [1:08:12] actually right next to the [1:08:15] House. [1:08:17] More of the same thing Richard [1:08:18] is because there is a foot [1:08:21] issue. On both sides of the [1:08:24] street. [1:08:25] The water can almost get inside [1:08:28] the House when it's heavy so [1:08:29] that was mine. [1:08:29] Everything else that they [1:08:32] talked about was addressed and. [1:08:37] >> Whenever you 133 trees are [1:08:39] we talking [1:08:40] about 5 Tino trees are we [1:08:41] talking about one or 2 year old [1:08:43] trees. [1:08:46] >> I would like for them too [1:08:49] plant more trees. [1:08:50] Whenever they build everything [1:08:53] but that's my only concern [1:08:55] because the flood issue is my [1:08:55] main concern. [1:08:56] >> Then there are the reason [1:08:56] you want them to build that [1:08:57] reason to put the ball because [1:08:59] Sir if they're going to tear [1:09:02] down trees, I mean just we [1:09:05] placed want to use. [1:09:08] So water is coming from the [1:09:11] north moving South and history. [1:09:15] You might understand that if [1:09:18] it during heavy rain the water [1:09:20] comes up comes over [1:09:21] the curb. You're not occur [1:09:21] their worker there's barges set [1:09:22] right because covid so the [1:09:23] water rises. [1:09:29] They're almost just how close [1:09:33] to your house get out of water [1:09:34] it can be just that. [1:09:35] And there's whenever the water [1:09:38] comes down the cover it can [1:09:41] handle its own water rises and [1:09:42] the ghost the House and close [1:09:42] to them backyard and actually [1:09:43] where our property line from [1:09:46] Mitchell and going still no [1:09:48] water runs [1:09:48] through the to all the trees [1:09:49] and tall the electric poles and [1:09:52] it floods on both sides. [1:09:59] So obviously that's an issue. [1:10:02] MISTER Charles. [1:10:03] I have a question where are you [1:10:06] are you aware. [1:10:09] >> Was just told [1:10:10] the Times. [1:10:11] >> In Jenin group is aware of [1:10:12] what what was just talked We [1:10:14] know the status of the stream [1:10:17] is the in the [1:10:20] rule type hardage We [1:10:21] also understood the issues that [1:10:21] they have right now however, [1:10:24] the applicant has its risks [1:10:26] possible for the water [1:10:26] that is coming onto their [1:10:27] property and potentially [1:10:29] dispersing from their property. [1:10:38] To be Frank they are not [1:10:39] responsible for. Existing [1:10:41] conditions that are not being [1:10:42] created by their property to [1:10:42] the north. [1:10:45] >> There are 5 different women [1:10:46] in terms of their [1:10:47] only response for making sure [1:10:47] that they don't make the [1:10:50] problem worse that they cannot [1:10:52] they cannot. [1:10:53] >> Create a situation where [1:10:54] they're dumping more water off [1:10:56] of there sight than what is [1:10:59] currently taking place. You [1:11:02] know at that point. [1:11:03] >> We'll turn one of my [1:11:06] concerns would be during the [1:11:10] actual construction phase. [1:11:13] That could be a real problem [1:11:14] grand construction, but they [1:11:16] would have zeroes in control in [1:11:19] place we recall and yet we have [1:11:20] requests whip a storm water, [1:11:22] Bush and Prevention out there [1:11:26] that is standard practice. [1:11:28] >> Does staff where of if and [1:11:31] when there might be any him [1:11:32] group wants to [1:11:35] that Street in order to change [1:11:36] the the drainage high. [1:11:38] >> To the best of my neither of [1:11:41] those streets Greystone or [1:11:43] Mitchell are currently on. [1:11:43] Any type of bond program, what [1:11:46] they're fair development [1:11:49] program for improvements at [1:11:49] this time. [1:11:50] >> Thank you you're welcome. [1:11:52] Sir, MISTER Chair or anything [1:11:54] else you want to say. [1:11:57] Anything else you want to say [1:12:00] those are questions. [1:12:04] Thank you Sir very much. [1:12:08] Are there any other questions [1:12:12] comments. [1:12:15] Commissioner Maddux. [1:12:20] >> Yeah I have a question that [1:12:21] MS. [1:12:24] To that. Yeah sure that's in [1:12:25] front of us. But the comment [1:12:25] from people hear about flooding [1:12:28] concerns me it just seems like [1:12:30] we just said. [1:12:33] Not really what we're dressing [1:12:34] ended and this crew read. [1:12:35] Didn't seem like we're [1:12:38] addressing it in the future [1:12:40] what avenues mayhem. [1:12:43] 2 to pursue a problem is this [1:12:46] I'm like is Jen. [1:12:47] This MAY not be proper thing [1:12:48] you discuss that, but it came [1:12:50] up again in the end it concerns [1:12:50] me. [1:12:52] >> I'll take a stab at [1:12:54] answering that question. [1:12:55] Because it's been asked for [1:12:59] over the many years have served [1:13:01] appear. [1:13:04] The only thing that we can [1:13:05] never and the developer is you [1:13:08] cannot make the problem worse. [1:13:12] They do not have to and are not [1:13:15] required by city ordinance to [1:13:17] improve neighboring neighbor. [1:13:20] They just can't make the [1:13:24] flooding any war so face of a [1:13:27] solution. [1:13:28] For example we were to approve [1:13:32] this cause Council can so you [1:13:35] know what. [1:13:36] As much as we [1:13:37] need the electricity, I'm not [1:13:37] saying they're going to do this [1:13:40] but Council cuts as much as we [1:13:41] need the electricity. [1:13:42] We MAY choose to not do this [1:13:42] until this problem specs [1:13:45] otherwise we're going to flood [1:13:48] our neighbors out. [1:13:48] Where the rubber meets Road and [1:13:51] that's where that decision has [1:13:52] been made we hear and [1:13:55] only decide is this an [1:13:56] appropriate use for [1:13:59] this piece what if we could [1:14:01] vote now and they can pill to [1:14:04] City Council. If we are [1:14:06] concerned based on [1:14:07] our knowledge and our personal [1:14:07] experience appear we think that [1:14:09] they're really going to flood [1:14:12] there. Our citizens. We can say [1:14:13] no. [1:14:16] All they're required to do is [1:14:19] to not make it work. And I get [1:14:22] that I do. [1:14:23] That's [1:14:24] not the. [1:14:24] >> Real tools, my question to [1:14:27] my question was what can we [1:14:30] tell them do we [1:14:31] have any vice to give them says [1:14:34] we can address it in this body [1:14:36] too address a [1:14:37] problem that it seems like it's [1:14:40] very real to them that needs to [1:14:41] be addressed. [1:14:42] >> About what can we tell them [1:14:45] neighbors and what can we tell [1:14:46] Council MAY was incorrect. [1:14:47] >> How do we get them to solve [1:14:50] a problem that's not related to [1:14:52] the issue that some fun of us. [1:14:52] What sounds like a real [1:14:55] problem. [1:14:57] >> I'll let staff [1:14:58] answer that. [1:14:58] >> Well one thing I would I [1:14:59] would definitely advise them to [1:15:02] reach out to our storm water [1:15:03] division of public works. [1:15:07] Every storm water concern is [1:15:07] logged in [1:15:08] our record. So that people are [1:15:08] aware of it because quite [1:15:11] frankly it doesn't really help. [1:15:14] >> Telling us [1:15:16] it helps. [1:15:16] >> Telling the actual engineers [1:15:17] who are doing all of the [1:15:19] planning for the future. [1:15:21] And they [1:15:22] will know. There are a number [1:15:23] of plans that are in the [1:15:25] pipeline to fix certain areas [1:15:25] that [1:15:28] they know traditionally have [1:15:29] been issues so I would I would [1:15:32] Bice folks that are concerned [1:15:34] about storm water issues too [1:15:34] to contact public works let [1:15:36] them know that they are there [1:15:40] issues on Mitchell Parkway and [1:15:40] let them know to include that [1:15:41] in there additional studies for [1:15:44] the future, I'm not saying it's [1:15:44] something that would be [1:15:45] fix nics this year. I'm not [1:15:46] saying that it's something that [1:15:46] would be fixed in 5 years. [1:15:49] But at least it would start the [1:15:52] process. [1:15:55] >> MISTER Charm for you. [1:15:59] As MISTER Cho and a question [1:16:02] for you. [1:16:13] Marrocco more, thank you or [1:16:14] have you ever reported anything [1:16:17] to the city regarding the the [1:16:17] amount [1:16:18] of water. Well okay if you [1:16:21] before you leave tonight please [1:16:24] talk to staff. [1:16:24] Let them give you the full [1:16:25] members of the people that you [1:16:27] can contact so that you can [1:16:27] report the issue that you have [1:16:30] if no one ever reports that [1:16:34] nothing will ever happen. [1:16:34] I'm sorry that you have had [1:16:37] your opportunity all right, [1:16:39] thank you for that. [1:16:42] Sure MISTER Johnson could I [1:16:44] just want to add one [1:16:44] more thing. [1:16:45] >> There this is if this is [1:16:48] approved tonight, it's going to [1:16:48] counsel and if you and any of [1:16:51] your neighbors wish to show up [1:16:53] a council and state as [1:16:54] eloquently as you did tonight [1:16:56] that the water comes up to [1:17:00] steps. [1:17:03] They'll correctly say the same [1:17:04] thing the doctor Nunez said [1:17:04] that you know tonight we're [1:17:07] talking about this one project [1:17:08] that's [1:17:10] desperately needed. I [1:17:12] understand but you're going to [1:17:13] have Council members. They're [1:17:13] listening including your [1:17:16] council member I think that's [1:17:18] probably the quickest way [1:17:18] to make this will squeak a [1:17:19] little bit more side I just [1:17:22] want to alert you that that [1:17:25] there won't be another chance [1:17:26] with a [1:17:27] more pay and on the council [1:17:29] that I don't know the date that [1:17:31] unfortunately I won't [1:17:32] be here. [1:17:33] >> Well, maybe maybe some of [1:17:34] your neighbors can show up and [1:17:35] I figured you've got an [1:17:35] opportunity to let them know [1:17:38] about this problem, yes, but [1:17:38] even [1:17:39] whenever you these guys [1:17:42] whenever they're planning on it [1:17:43] would and that is. [1:17:46] B common sense to just fix it. [1:17:48] I think we're I feel like we're [1:17:51] going to wait until they build [1:17:52] it and [1:17:53] then it floods or if it does [1:17:53] and then we're going to come [1:17:55] and then we want to try to fix [1:17:58] a problem I would just be logic [1:18:01] engineering too. Yeah, he [1:18:03] thinks is flood before even [1:18:04] creates. You to state the [1:18:04] prospective well I I just [1:18:07] really encourage you to say [1:18:10] that one more time. [1:18:16] >> Yeah, but say it one more [1:18:19] time before Not not not to [1:18:20] so since I haven't closed the [1:18:23] public session. [1:18:26] >> More thank you. [1:18:29] Last representative come [1:18:32] forward please. [1:18:36] I have no authority [1:18:39] to do anything I can make you [1:18:40] do anything that's not what [1:18:43] I'm asking. But having her what [1:18:43] you just heard how do you [1:18:46] anticipate responding to City [1:18:47] Council when this [1:18:49] concern about almost Neighbors [1:18:52] up there. What do you think [1:18:55] your response possibly pay. [1:18:58] Really if you don't have an [1:18:59] answer can't give an answer [1:19:01] that's a set-piece take that as [1:19:02] well so your [1:19:02] question is. [1:19:05] >> What is on core intend to do [1:19:08] with. [1:19:08] Drainage issues outside [1:19:11] of on Corps property and I call [1:19:13] it being a [1:19:14] good neighbor. Right one thing [1:19:15] that that if you're if I'm in [1:19:16] front of Council and they asked [1:19:19] that question I would say they [1:19:21] don't court or by constructing [1:19:24] our electrical substation we [1:19:25] will not make it any worse. [1:19:25] That's what I thought that that [1:19:28] might be the newsroom. I care [1:19:31] k. [1:19:35] >> I would like to just [1:19:38] elaborate a little bit of what [1:19:39] CHAIRMAN Talked about as [1:19:42] far as falling into the storm [1:19:43] water management team. [1:19:47] Do it every single time it [1:19:50] floods not [1:19:50] just once because they need [1:19:53] to now depending on how much [1:19:56] rain we get and how [1:19:58] much flooding your scene so [1:20:01] they can docu and it and it's [1:20:01] not just one call. [1:20:05] They can document how many [1:20:07] times [1:20:08] it actually happening and [1:20:08] that's really important for [1:20:11] them as far as you guys getting [1:20:12] taken care of [1:20:15] you know the flooding issue [1:20:16] because they'll look at your [1:20:17] situation and and ok there [1:20:20] flooding every single time as [1:20:22] compared [1:20:23] to somebody to only floods [1:20:24] maybe once every 6 times it [1:20:27] rains so it's really important, [1:20:30] I know it's a pain but it's [1:20:32] really important to call in [1:20:34] every single time you're [1:20:34] flooding. So that they can [1:20:37] document that and keep that on [1:20:40] record [1:20:41] ok, thanks. [1:20:44] >> MISTER Mayor, thank [1:20:44] commissioner winkles sorry. [1:20:48] >> MISTER Omar, even if you [1:20:50] can't be at City Council you [1:20:51] can write the letter it can be [1:20:52] PRESIDENT Of the case before [1:20:52] City Council. So it's [1:20:53] documented with every [1:20:54] representative that you do have [1:20:55] some concerns about the [1:20:58] flooding. [1:20:58] >> So please [1:20:59] do that the email it's on the [1:21:00] website how to do that you can [1:21:02] just e-mail it to them and that [1:21:04] way they have [1:21:05] that documentation to support [1:21:05] that you understand we need [1:21:08] this but you have some [1:21:11] concerns. [1:21:14] >> But this time I'm going to [1:21:17] close the public hearing. [1:21:22] Do you have any comments [1:21:22] amongst ourselves our motion. [1:21:25] All right commissioner winkles [1:21:28] have a motion. [1:21:31] That MISTER Center commissioner [1:21:33] center I just want [1:21:34] to clarify. [1:21:35] >> The applicant made a [1:21:36] statement that they want to a [1:21:39] foot race, rich cream or [1:21:39] proposing an 8 foot makes for [1:21:40] scream all. The application as [1:21:43] 6 feet do we need to making a [1:21:46] motion to that sounds like [1:21:47] we do. So whoever makes a [1:21:50] motion if killer agreeable to a [1:21:52] foot please make the motion. [1:21:55] Commissioner Michael would you [1:21:56] state your [1:21:58] motion please. [1:21:59] >> Yes, I'd like to make a [1:22:00] motion for pd 26 dash 0, 8, [1:22:03] 2870's for Mitchell Parkway for [1:22:06] approval of [1:22:07] the jet change in zoning from [1:22:08] residential estate to plan [1:22:10] development for residential [1:22:13] estate plus and electric [1:22:14] utilities substation with a [1:22:15] development plan including the [1:22:16] change the recommended change [1:22:19] from my 6 foot fence to an 8 [1:22:21] foot fence masonry. [1:22:25] >> Commissioner Johnson is that [1:22:28] your second second. [1:22:34] Motion passes 8 to nothing. [1:22:38] Thank you all for coming. [1:22:44] Moving on our next case pd 26 [1:22:47] dash 0, 9, 20 to 45. [1:22:48] Carter drive. Commission for [1:22:48] approval of a planned [1:22:51] development residential [1:22:52] multifamily arm of 20 [1:22:53] 2 uses with the development [1:22:56] plan on approximately 5.8 9 [1:22:58] acres. This time [1:23:01] because staff to make his [1:23:02] presentation [1:23:04] MISTER Colson. [1:23:04] >> Chair commissioners for the [1:23:05] record the post and principal [1:23:06] planner planning and [1:23:06] development services we have [1:23:09] for up to 26 dash 9 interested [1:23:12] 20 to 45 car [1:23:15] to drive. So [1:23:16] currently zone rmf [1:23:16] 22 residential multifamily 22 [1:23:18] with a request for planned [1:23:19] development for residential. [1:23:22] Multi-family 22 uses with a [1:23:23] development plan. [1:23:27] And this is just the location [1:23:30] side to show existing [1:23:33] cross a car to drive from the [1:23:35] site pd 22 dash 6 [1:23:38] was approved in OCTOBER of 2023 [1:23:40] is multi-family [1:23:43] multi-family plan development [1:23:46] commercial component as well. [1:23:47] And it with the comprehensive [1:23:50] plan of this is is a [1:23:52] development creating [1:23:52] housing choices. In the area [1:23:55] this does align with the goals [1:23:56] outlined in the conference [1:23:59] plant and is compatible with [1:24:02] the surrounding uses. [1:24:03] In this a 5.8 9, 9 acre [1:24:04] site post 36 a unit [1:24:07] multi-family development, 6 [1:24:08] units per acre [1:24:09] as compared to the maximum [1:24:12] forearm and 22 is 22 units per [1:24:14] acre it will consist of 9, [1:24:16] 2 story structures. All units [1:24:20] will have 2 bedrooms the units [1:24:20] will 1801,816 square feet [1:24:23] in size with premier access [1:24:26] being off of car to drive. [1:24:27] There's also portion of the [1:24:28] site is within the fema flood, [1:24:30] plain area along the northern. [1:24:33] And eastern [1:24:35] property That's 20% of the [1:24:39] that up area will maintain is a [1:24:40] recreational [1:24:41] area with without walking [1:24:43] trails that would also be a dog [1:24:44] Park in the area [1:24:47] as well. All of the tree [1:24:48] preservation of the site needs [1:24:51] the requirements as far as [1:24:52] landscape buffers [1:24:53] the set It will mean all of [1:24:55] those requirements all of the [1:24:57] trees within that. [1:24:57] Floodplain area will be [1:25:00] preserved as they create along. [1:25:03] Actually along both both [1:25:05] buffers you have come our [1:25:08] commercial zoning to the north. [1:25:10] Cause [1:25:10] commercial zoning and uses to [1:25:13] the north and East almost [1:25:16] property lines. [1:25:17] The existing trees create a [1:25:18] natural buffer 20 actually on [1:25:18] the site you really can't see [1:25:21] the if you will either one of [1:25:21] those [1:25:22] other sites. Looking between [1:25:25] those trees you really can see [1:25:25] the site. [1:25:29] In these of the floor plans as [1:25:30] as provided to [1:25:31] your earlier. These are the [1:25:32] floorplans going to assist [1:25:34] again of 2 bedrooms a week 2 [1:25:37] and a half bath. [1:25:38] These are the elevations [1:25:39] again the elevation of this [1:25:40] elevation shown here that those [1:25:44] they're going to be too. [1:25:44] Units [1:25:45] that face, Carter drive they're [1:25:47] going to consist of additional [1:25:50] break as compared to. Those [1:25:51] facing internal to the site. [1:25:52] So it's going to be a [1:25:52] multi-family development but [1:25:54] he's going to give the [1:25:58] appearance of townhomes. [1:25:58] And these are just other [1:26:01] elevations. Site photos again [1:26:03] this is looking West on to the [1:26:04] site or east of us are on to [1:26:04] the site and then the next [1:26:05] Photo you have the commercial [1:26:08] retail centers you can see some [1:26:10] of the trees. Only [1:26:11] this basis, small portion from [1:26:12] this site that you can actually [1:26:12] see the site but if you [1:26:14] actually interior to the site [1:26:15] you can see [1:26:15] all that this tree line that [1:26:18] you see here extends down that [1:26:22] entire life. [1:26:23] And this is that it is an [1:26:25] existing multifamily just south [1:26:28] of the site. [1:26:31] And then across this is a sign [1:26:33] Carter from [1:26:36] the site and again that's where [1:26:40] the pd 22 dash o will be. [1:26:43] Again there to for this First [1:26:48] of which as it requires a level [1:26:50] 2 screening in buffering [1:26:51] has it but commercial [1:26:54] properties on the eastern and [1:26:55] northern property line. [1:26:56] So they have the actual buffers [1:26:56] again though that's going to be [1:26:58] all floodplain area. They are [1:27:01] touching anything in that area. [1:27:03] Provides the recall 15 foot, [1:27:06] let's landscapes it back on [1:27:09] both sides which [1:27:10] it needs. And again all of the [1:27:13] trees within those areas it's [1:27:15] going to there's going to be a [1:27:16] combination of protected [1:27:16] species and I'm not protect the [1:27:19] species, but again the critics [1:27:20] a natural buffer. [1:27:23] And and what they're doing [1:27:24] again is that they're meeting [1:27:25] the setback requirements, but [1:27:26] they just aren't providing the [1:27:27] fencing along that again you [1:27:30] have the trees which create a [1:27:31] natural buffer. [1:27:34] And again the site is accessed [1:27:36] off [1:27:36] of a Carter drive which is a [1:27:39] minor our chair, you per the [1:27:40] unified [1:27:41] development code. This is a [1:27:44] multi-family development with [1:27:44] less [1:27:48] units so should access off of [1:27:51] and made the collector again [1:27:53] card is is classified as [1:27:54] a minor like, but again that's [1:27:55] a that's the only access point [1:27:57] to the size of the really can't [1:28:01] avoid that deviation. [1:28:01] Again [1:28:04] this is an occasion We know [1:28:05] about 11 notices. We did not [1:28:08] receive any letters of support [1:28:11] or opposition. [1:28:12] And this [1:28:15] 36 unit development multifamily [1:28:17] development adjacent to a 616 [1:28:20] unit development and it [1:28:21] generally conforms with the [1:28:22] surrounding uses. If the [1:28:22] planning and zoning commission [1:28:25] is inclined to recommend [1:28:26] approval to [1:28:27] City Council. Staff has the [1:28:28] following recommendations to [1:28:31] improve the project and [1:28:32] additional parking on the site [1:28:35] and hear identified just some [1:28:36] locations for potential. [1:28:39] Additional the applicant and [1:28:42] speaking with the applicant. [1:28:43] And they'll speak more to in [1:28:44] their presentation. There they [1:28:47] are amenable to some parking [1:28:51] and this general area. [1:28:54] The porches in columns along [1:28:55] car [1:28:58] to drive, I'd be does Isis to [1:28:58] create some variation of most [1:28:59] the homes and wrought iron [1:29:02] fencing be prepaid stalled [1:29:04] along. Carter [1:29:05] drive providing a sense of [1:29:05] security for the residents [1:29:06] again in speaking with the [1:29:08] applicant. They army noble to [1:29:11] that [1:29:12] as well and It was mentioned [1:29:13] an applicant was speak more to [1:29:16] this as well as mentioned [1:29:18] because the amenities [1:29:18] will be they're going to [1:29:21] provide a dog part they're [1:29:22] going to in [1:29:23] the floodplain area just going [1:29:23] to keep that is an Opel open [1:29:26] natural recreation area with [1:29:28] trails [1:29:29] and benches speaking to the [1:29:32] applicant was mentioned [1:29:32] upstairs that up and [1:29:33] work session about possibly [1:29:34] creating a Pavilion maybe with [1:29:36] some grills things of that [1:29:39] nature. [1:29:40] Speaking with them they are [1:29:41] amenable to doing that they [1:29:44] would more to that in their [1:29:45] presentation. [1:29:48] And staff is available for any [1:29:50] questions. [1:29:53] Thank you. MISTER Commissioner [1:29:56] center. [1:29:58] >> So that's a work session [1:30:01] sites roughly 5 little over 5 [1:30:02] acres right [1:30:05] 5, 8, But it's incumbent with a [1:30:07] lot of Lane [1:30:08] gas pipelines do you know top [1:30:08] of your head. What the [1:30:11] developable area is. [1:30:14] >> That [1:30:15] I can I can't tell get say off [1:30:18] the top of my head, but 20% [1:30:18] roughly [1:30:19] 51,000 square feet. [1:30:20] >> Is in the flood plain but [1:30:22] then you've got the gas [1:30:24] pipeline labelle side on this [1:30:24] is out. [1:30:25] >> All and all along Carters [1:30:26] will you have those so that [1:30:27] some more than half you would [1:30:30] think. Was isn't developed, I [1:30:32] was safe if. [1:30:33] If not more than at least close [1:30:33] to somewhere in the [1:30:36] neighborhood give or take in [1:30:38] this is not good. No thank you. [1:30:41] Any other questions at this [1:30:43] time. [1:30:46] Thank you very much MISTER [1:30:48] Coulson. [1:30:49] >> At this time open the public [1:30:53] hearing on call the first [1:30:56] speaker. [1:31:01] Sir your name and city that you [1:31:01] live in good evening. My name [1:31:02] is Jeff with able engineering [1:31:04] and I live and die in a Texas. [1:31:07] >> Like to say at this this is [1:31:10] my first time stand at a podium [1:31:12] in front of a city of [1:31:13] Arlington commissioners and I [1:31:13] just want to say thank you for [1:31:14] the opportunity but I've had [1:31:17] the opportunity to to watch [1:31:18] your [1:31:18] work session and then be a part [1:31:19] of this it's it's very [1:31:21] impressive and I appreciate the [1:31:24] effort that you put into these [1:31:25] certainly respect what [1:31:25] you do. And that this project [1:31:28] we we've had a fantastic [1:31:31] experience far as far as soak [1:31:32] working with staff and. [1:31:33] And just trying to put together [1:31:35] a to get in front of you for [1:31:39] consideration, so. [1:31:40] Thank you for the opportunity [1:31:43] and I don't want to make a big [1:31:43] presentation because I believe [1:31:45] you have a lot of questions [1:31:46] that were brought up in the [1:31:49] world session if its would like [1:31:50] to do [1:31:51] more of a conversation with you [1:31:53] if we could to address the [1:31:55] concerns that [1:31:55] you had and and during the [1:31:56] conversation if there are more [1:31:57] things that pop up and that I [1:31:59] worked to address those as [1:32:00] well. [1:32:04] Just high-level on in and also [1:32:07] forgive me because. [1:32:07] I'm never run the system [1:32:10] this is this my presentation [1:32:13] that that I share with you. [1:32:16] So forward to slide. [1:32:22] So so the site plan [1:32:22] that is on the on the screen at [1:32:25] the moment, we Staff's request [1:32:29] we added. 2 parking spaces at [1:32:32] that location. And then in the [1:32:33] work session, it seemed like it [1:32:33] was it was asked if we could [1:32:35] add a couple parking spaces [1:32:36] over here between the bills [1:32:38] wanted to and that's that's [1:32:41] certainly something that we [1:32:42] could add as well what we we're [1:32:43] trying to do is because the [1:32:46] parking that has been provided [1:32:47] exceeds what was required by [1:32:47] the city. Also know that [1:32:50] there's a reason those numbers [1:32:51] are established. But we also [1:32:52] want to get neighbors. We do [1:32:54] want to create an issue on the [1:32:58] site for the tenants to [1:32:59] live here. So I'm adding [1:33:00] more parking is good. We tried [1:33:01] to limit the amount of parking [1:33:01] because we were trying to [1:33:02] maximize the amount of green [1:33:04] space that could be provided on [1:33:07] the site. So if staff [1:33:08] asks for right to shuttle [1:33:09] parking worth displeasure the [1:33:09] commissioners for us to has [1:33:10] more parking and certainly [1:33:12] we're going to work to add that [1:33:15] parking. [1:33:16] Our 2 locations that were [1:33:19] requested for that that I would [1:33:21] ask that I'll give you the [1:33:22] reason why we didn't consider [1:33:24] it it's it's here at the end [1:33:28] and of the of our first time [1:33:29] and then over here next [1:33:30] to this surface lease area, [1:33:33] those 2 spaces as as far as [1:33:36] adding the first one [1:33:37] right here. We would [1:33:37] be wiping out a tree to put the [1:33:39] parking spaces so we're trying [1:33:43] to preserve trees. And and not [1:33:45] put any parking there but if a [1:33:46] if it's a pleasure of the of [1:33:49] that mission and staffers to [1:33:52] put parking there that that too [1:33:53] he is a is a reasonable place [1:33:54] to add the parking spaces it's [1:33:55] in a good good location [1:33:56] relative to the walking trail [1:33:57] that out there and it could [1:34:00] provide. There's a there's a [1:34:02] benefit [1:34:02] down here though the reason [1:34:05] that I haven't put any parking [1:34:06] in that area are reasons for [1:34:07] developing it. It's it's not [1:34:07] easily accessible it's a great [1:34:08] space to pull him to but it's a [1:34:10] hard space to try to back out [1:34:14] of a turn around and leave. [1:34:17] So so that's why we didn't have [1:34:18] we do have the [1:34:18] 2 spaces right here that are [1:34:19] easier to get into that and [1:34:21] then kind of 3 point turn [1:34:25] maneuver to to to come and go [1:34:28] so so. [1:34:33] And providing parking spaces or [1:34:34] or the conversation [1:34:37] that certainly I think a couple [1:34:37] of parking spaces there. [1:34:41] We're already agreed to the [1:34:43] parking spaces there. [1:34:43] If it comes that we need to put [1:34:44] parking they're happy to do [1:34:47] that and I think those parking [1:34:51] spaces would be very visible. [1:34:54] In terms of amenities for the [1:34:55] We again we were trying to keep [1:34:57] the space as green as possible [1:35:01] a week. Dog parks and be a [1:35:06] I'm pretty useful area outdoor [1:35:06] We we have a very large walking [1:35:09] trail and just natural space in [1:35:09] that floodplain area but for [1:35:10] the residents to enjoy as well [1:35:13] in terms of putting a Pavilion [1:35:16] and. [1:35:17] A grilling space that there's [1:35:19] 50 feet in between those units. [1:35:22] They're they're maybe space on [1:35:23] their to add one. [1:35:24] You know we could find [1:35:26] somewhere here I'd like to have [1:35:27] a little more centrally [1:35:29] located, but if we can get [1:35:30] something worked in that area. [1:35:31] The our our client, the owner [1:35:31] of the property amenable to [1:35:34] that and that's something that [1:35:37] we can. [1:35:40] To work into this plan. [1:35:45] Speaking to the variances that [1:35:46] we had as far as fences are [1:35:46] concerned, don't know how big [1:35:47] of an issue that is with the [1:35:48] commissioners if if you'd like [1:35:51] me to speak about that more [1:35:52] happy to if it's not an issue [1:35:54] that I would like to respect [1:35:55] your time and. [1:35:58] And talk about other parts of [1:36:01] the project. [1:36:07] >> I would [1:36:08] like to The reasoning by not [1:36:10] getting the the community cause [1:36:11] the other communities around [1:36:14] you. The built ones in the [1:36:14] planned ones in [1:36:15] the future Earl are gated [1:36:18] community. So what's the reason [1:36:18] for not [1:36:19] doing here. [1:36:19] >> So so the first reason for [1:36:20] for not getting it is and which [1:36:23] is also the reason why we don't [1:36:26] have a fence along card. [1:36:29] The reason we had shown a fence [1:36:32] along Carter is in it to the [1:36:35] staff Staff. [1:36:36] Point in their The property is [1:36:36] encumbered with several gas [1:36:39] pipelines and right away that [1:36:39] go with that [1:36:40] the entirety of our the draw [1:36:43] this line is shown on the plan, [1:36:46] but it's roughly right all [1:36:46] right through here is [1:36:49] everything over here is in [1:36:51] fact. [1:36:51] Right away for pipeline. [1:36:54] So we have coordinated with [1:36:55] summit midstream about this [1:36:58] development in terms of their [1:36:59] surface least that's [1:37:00] right here. All of their [1:37:01] pipelines they have no [1:37:03] objections to what we're [1:37:04] proposing as as far as that [1:37:05] we're building and how we're [1:37:06] going to screen their their [1:37:06] service space which will speak [1:37:09] about that that gravel spaces. [1:37:12] If we get permission from them [1:37:13] to put the game are put to the [1:37:15] fans, it's a lot harder, then [1:37:17] we'd love to [1:37:18] put that the wrought iron fence [1:37:19] there it would look nice it [1:37:22] would give the sense security [1:37:24] we just. [1:37:24] Because we don't have a a lot [1:37:25] of space on the north side of [1:37:28] the site long it floodplain to [1:37:31] have a. [1:37:32] Have Gates and truly have [1:37:32] everything from insecure we [1:37:35] just will propose and have a [1:37:38] fence or have a gated. [1:37:39] I would be willing to believe [1:37:40] that if and I did not have to [1:37:42] have this conversation with my [1:37:43] client but if if it came [1:37:46] back that it was the pleasure [1:37:47] of the commission staff for [1:37:48] this too the truly gated and if [1:37:50] we were able to get permission [1:37:51] from some of the extreme to [1:37:52] actually a place that because [1:37:54] it would be located in the [1:37:55] right of way then and I [1:37:55] believe that something that [1:37:58] would be incorporated into this [1:38:00] project. [1:38:03] >> Continue along those lines, [1:38:05] you know. [1:38:06] Thank you for attending work [1:38:10] session upstairs parking is a [1:38:11] concern. But [1:38:12] commissioner centers you know a [1:38:15] really important point even if [1:38:18] there were no fence anywhere. [1:38:19] Having that [1:38:19] gated controls a number of cars [1:38:22] to get into this neighborhood. [1:38:25] And [1:38:30] I just As as we think through [1:38:31] this process. If it's gated. [1:38:34] Maybe parking isn't that big of [1:38:37] an issue anymore. [1:38:44] >> What do you think of that [1:38:45] thought well I think there's an [1:38:46] there's an opportunity to [1:38:46] educate the community whether [1:38:49] its offense within the easement [1:38:51] which I probably think is not [1:38:52] the best solution because they [1:38:53] don't want it there and I know [1:38:55] that for a fact you can put it [1:38:57] outside [1:38:58] their easement Tory to create a [1:39:01] gated community that secure for [1:39:02] the residences. [1:39:05] You know the densities way less [1:39:05] than what is allowed in the [1:39:08] current zoning which we applaud [1:39:09] you for doing [1:39:10] I'm quite frankly, I'm glad you [1:39:13] could make a deal work with [1:39:14] that many unit, [1:39:17] so as CHAIRMAN Mentioned in the [1:39:20] work session. We [1:39:22] want quality we want [1:39:22] to create a sense of community [1:39:25] that's with the amenities the [1:39:28] gathering spaces for these [1:39:31] people to to live socialize [1:39:32] feeling, sick, you're safe and [1:39:33] where they live so I think [1:39:35] those are important elements [1:39:38] that. You don't need to be [1:39:39] reflected on on [1:39:40] your design. So that's why [1:39:43] we're we're bringing these up [1:39:45] both in work session and now [1:39:48] for you to kind of think about [1:39:51] and digest. [1:39:57] >> a little the additional [1:39:58] information as far as the. [1:39:59] The area. That's that's the [1:40:01] surface lease. But for for the [1:40:05] gas equipment. [1:40:06] Heard in [1:40:09] in the the work session, it's [1:40:10] not a gas. Well there's not [1:40:10] working equipped there this is [1:40:11] actually it's for the [1:40:14] maintenance of the pipelines if [1:40:15] anybody is familiar with a [1:40:16] pig water. You know that that's [1:40:17] what this is where the pipeline [1:40:18] actually comes on the ground is [1:40:21] place where they can access it [1:40:23] and then the launch. [1:40:24] I want to pay in the thing and [1:40:25] it's are testing the pipeline's [1:40:27] keeping things clean stuff like [1:40:28] that. So it's that's what [1:40:31] this is that that our project [1:40:34] is being developed around. [1:40:38] >> When you are discussing this [1:40:41] case where staff [1:40:42] did anyone. Here in recommend [1:40:45] that you speak to sue Phillips. [1:40:49] >> I have to and he's on [1:40:52] my face and I just sent an [1:40:54] e-mail to MS. [1:40:55] Phillips apologizing. That one [1:40:55] it's it's terrible terrible [1:40:56] mistake on our part to not have [1:40:58] reached out to I have reached [1:40:58] out to her now. And most [1:41:03] certainly want to sit down and [1:41:03] Apologize in person for that of [1:41:06] course, but also get feedback [1:41:09] from her as far as the city [1:41:10] staff certainly did [1:41:12] their job. I'll have to own and [1:41:13] I did not I missed that one. [1:41:14] >> Well thank you for for [1:41:16] saying that and I appreciate [1:41:18] you. [1:41:21] Being forthcoming so here's [1:41:22] where I'm coming from I said [1:41:24] upstairs and sat down here [1:41:26] during the public session. [1:41:26] Number one I really think it [1:41:28] ought to be gated and I think [1:41:31] that you need to if I'm away [1:41:32] putting [1:41:32] Gates into early little bit [1:41:35] further so that you don't [1:41:39] encroach upon that gas. A gas [1:41:42] I think that can [1:41:43] be done. The second thing is [1:41:46] because these are all going to [1:41:47] be fire lines as we spoke [1:41:48] upstairs parking. He's going to [1:41:52] be legal anywhere and on those [1:41:53] streets. [1:41:54] We're concerned that if there [1:41:57] are family functions that [1:42:00] occurred [1:42:01] parking could be an issue so I [1:42:04] think you know that you're in [1:42:05] need to come back to us with [1:42:06] that us a tweet plan because I [1:42:09] want this project to be built. [1:42:12] Don't get me wrong this is a [1:42:14] great project. [1:42:15] I applaud you for having to [1:42:18] deal with all the easements in [1:42:18] the [1:42:22] flood plain. It needs to be [1:42:23] tweaked just a little bit. [1:42:26] One of the tweaks is a gate [1:42:29] second tweet is finding some [1:42:30] additional parking and the [1:42:33] 3rd tweak if anyone more [1:42:34] amenity and I don't care what [1:42:35] it, yes, sue Phelps might be [1:42:38] able to help you with that with [1:42:41] that. But whether it's a [1:42:43] covered billion or whether [1:42:44] something else. But the concept [1:42:45] that I want you to remember [1:42:47] because we were sent here and [1:42:49] they'll say the council you're [1:42:53] creating a community. And if [1:42:53] you're going to create a [1:42:54] community that needs to be some [1:42:56] way for these people to get [1:42:58] together and a [1:42:59] walking trail. Although I [1:43:01] applaud you for that punch the [1:43:02] dog Park. It's [1:43:06] not enough. I think there needs [1:43:06] to be an evening gathering [1:43:07] kind of place and it doesn't [1:43:09] need to be expensive but it [1:43:13] doesn't be anything [1:43:13] you know. I looked at the [1:43:14] rear elevations of some of the [1:43:15] Center for those sliding glass [1:43:18] doors, I mean that lead to the [1:43:21] back. [1:43:24] Double the worst like that for [1:43:25] the most part but there's a but [1:43:26] there are doors that lead to [1:43:28] the back and so come back that [1:43:31] slide before that the layout [1:43:33] so imagine any one of [1:43:33] these buildings. Especially [1:43:34] towards the northern part where [1:43:37] you've got all this green space [1:43:37] which [1:43:38] is fantastic. You've got all [1:43:41] these double doors opening up [1:43:44] to a common space. [1:43:48] And what can neighbors do [1:43:49] inside of that common [1:43:50] It maybe so maybe it's a [1:43:52] sidewalk that goes up and down [1:43:54] through there maybe it's just a [1:43:56] gazebo is shade people can sit [1:43:58] out there have a glass [1:44:00] of wine. It doesn't need to be [1:44:01] high and but it needs to be [1:44:04] solid so that's my suggestion [1:44:07] because. [1:44:10] Right now what I'm what I'm [1:44:11] way towards the [1:44:12] continuance for you to come [1:44:15] back having tweak this plan but [1:44:17] my thoughts how different the [1:44:18] other commissioners, maybe they [1:44:20] don't feel the same way I do, [1:44:24] but that's how I feel. [1:44:25] I would go as we want to [1:44:28] thank goodness gotten him once [1:44:29] in a [1:44:31] >> Real quick a question for [1:44:32] the applicant if you visit with [1:44:35] the pipeline operator at the [1:44:35] site. [1:44:39] >> Yes Sir MISTER Summit [1:44:40] midstream to respond to all [1:44:40] of us. [1:44:41] >> Yes and and have they [1:44:44] advised to whether or not they [1:44:44] would sign off on a [1:44:47] key between on that area [1:44:48] between them and this [1:44:49] pick launching. [1:44:50] >> So so the answer that is no [1:44:51] because we didn't have a gate [1:44:54] in our plan I can go back to [1:44:55] Justin and and talk with them [1:44:56] about that. It's been our [1:44:56] experience in the past with [1:44:59] with Gates on because because [1:45:00] the [1:45:01] the pipeline. They they were [1:45:02] still maintaining access to all [1:45:05] of their facilities, yes this [1:45:06] if we [1:45:06] were to located again and just [1:45:07] just in the pipeline world and [1:45:09] other projects that we work on [1:45:11] as long as they [1:45:12] have okay Keiko where they can [1:45:13] get in and out I wouldn't [1:45:14] expect that to be an issue and [1:45:15] certainly if we have a wide net [1:45:17] for them to be able to get the [1:45:18] truck in that I would [1:45:19] expect that. [1:45:22] >> I was just I'm just [1:45:25] concerned because you. [1:45:26] You've got a lot of [1:45:26] location there between you and [1:45:29] the property so I I just I want [1:45:30] the [1:45:33] know that that MAY be something [1:45:37] that's beyond the [1:45:37] applicants can trolls so [1:45:38] obviously would advise you to [1:45:40] to get a sign off from them [1:45:41] before you have to move [1:45:45] forward, but just just to make [1:45:45] sure that's clear I I didn't [1:45:46] realize the gate discussion was [1:45:49] coming up today, so I didn't [1:45:52] brief and I didn't either so. [1:45:54] I also think you [1:45:55] should do. [1:45:55] >> Continues and make sure to [1:45:56] talk more with the community [1:45:58] especially starlink and renewal [1:46:01] and. [1:46:02] But one of the things [1:46:03] that needs to be added and [1:46:03] they're not only the facing [1:46:06] towards the main thoroughfare, [1:46:08] there. [1:46:12] You've got the makings of a [1:46:15] really cool apartment. [1:46:16] And if you made them more like [1:46:16] individual townhomes where [1:46:19] there was a lot of variance not [1:46:22] monotonous. [1:46:25] For playing on across her up [1:46:26] for plans, facing going across [1:46:27] and and really very that you [1:46:28] can make something really nice [1:46:30] and that's what we're looking [1:46:33] for and understood. [1:46:34] >> I don't [1:46:34] always like I do not want to [1:46:37] say, but you know and say [1:46:38] understood but [1:46:41] but but in this case the [1:46:42] low-density that [1:46:44] we have and and there there is [1:46:46] a price point that we have to [1:46:49] in terms of the cost of [1:46:49] construction has got to speak [1:46:50] with our architect on it and as [1:46:51] far as colors and things like [1:46:52] that making making the [1:46:53] buildings more interesting that [1:46:54] way. They're certainly work [1:46:57] that can be done in terms of [1:47:00] and build a relatively small [1:47:02] for what we're doing so if [1:47:02] already by right we can be [1:47:03] multi-family with none of the [1:47:06] articulation that would that [1:47:06] would really be required. [1:47:07] We're trying to make something [1:47:10] special here and we want to [1:47:11] make it just as nice as [1:47:13] possible. But we're we're [1:47:14] limited to how far that nice [1:47:15] can go a point well taken and [1:47:17] I'm certain we'll take that [1:47:20] back [1:47:21] to architect. [1:47:22] >> Well that you will probably [1:47:22] get that same feedback from [1:47:24] City Council know p probably [1:47:25] cover clear here. [1:47:25] >> I understand you all have [1:47:28] been very kind by the way we [1:47:31] should. Commissioner Johnson. [1:47:33] >> I just have a quick question [1:47:34] MISTER Hamilton I want to [1:47:37] understand your vision as well [1:47:41] as possible. Who do you [1:47:41] consider [1:47:43] your target enter on You think [1:47:46] an empty nesters are you [1:47:47] thinking families with children [1:47:50] there what who you're going [1:47:52] after here and there in [1:47:53] your mind. [1:47:53] >> So so so we were targeting [1:47:54] families with children or we [1:47:55] would put playground amenities [1:47:55] things like that [1:47:59] >> in here we're looking more [1:48:00] for just an empty nester are. [1:48:02] Young professional something of [1:48:02] that nature that just they [1:48:03] don't need a lot of space they [1:48:04] don't want a lot of room to [1:48:06] know that they have to take [1:48:06] care of its just a a nice [1:48:08] place it feels like a home, [1:48:09] it's not up that don't feel [1:48:10] like an apartment multi-family [1:48:12] so we're trying to make [1:48:13] something just. For young [1:48:16] professional or an empty [1:48:19] nester. [1:48:22] Great question to ask. [1:48:26] >> I think I'm in agreement [1:48:29] >> lean continue just to give [1:48:30] you a chance to talk with [1:48:33] Suu Phillips. [1:48:34] >> And you're here thoughts [1:48:35] >> I think I would be ok if if [1:48:37] the gate fall soon you're not [1:48:40] able to get and I think it's [1:48:41] still a good project and. [1:48:44] I think if you could make the [1:48:45] changes with some amenities and [1:48:46] there and tying it together [1:48:46] some sidewalks and those green [1:48:48] spaces I think that that would [1:48:51] look great. [1:48:54] Just wanted to say [1:48:55] congratulations for finding an [1:48:56] undeveloped piece of property [1:48:59] is zoned rmf 22. I'm sure [1:49:00] that's not very [1:49:01] >> It be worth noting are sort [1:49:04] our client has owned this [1:49:06] property for many [1:49:07] many years. So is it wasn't a [1:49:09] speculative thing he sees that [1:49:10] makes more sense that yeah. [1:49:13] >> That this was for sale it [1:49:16] would have gone a long time [1:49:17] yeah so [1:49:17] I appreciate all so you're we [1:49:19] can make and it's a quality [1:49:22] project. Yeah just what you [1:49:25] know my thoughts. [1:49:25] >> So for the sake of [1:49:28] conversation and just to help [1:49:31] me understand. [1:49:32] I understand I'm [1:49:35] hearing continuances Yes, [1:49:36] because you're in my in my [1:49:36] asked for anything else I have [1:49:37] a feeling that I would get a [1:49:40] break in the action for your [1:49:41] very correctly and let [1:49:41] me make the process a little [1:49:42] shorter and any time that [1:49:43] you're speaking if you want to [1:49:44] say the U.S., you know I'd like [1:49:44] to request a continuance we [1:49:47] have to give it to him [1:49:50] understood. [1:49:56] Well because we haven't had any [1:49:59] other speakers yet. [1:50:01] Got to go through that [1:50:03] anything else you want to say [1:50:04] any other questions. You're [1:50:07] going have an opportunity to [1:50:10] come back. [1:50:19] Well look computer minutes. [1:50:21] All right. Are there any [1:50:22] other speakers in in support of [1:50:23] this project that are here [1:50:26] tonight. Are there any speakers [1:50:29] in opposition. [1:50:31] Is there anyone who hasn't had [1:50:34] an opportunity to speak that [1:50:37] would like to speak. [1:50:39] Sir if you have any last [1:50:42] comments you're welcome to come [1:50:46] up here and make your case. [1:50:47] I just have to go through [1:50:47] all the legal mumbo jumbos [1:50:48] appreciate that I've learned if [1:50:50] I'm given an opportunity to [1:50:51] speak out better. [1:50:55] So thank you for that it again [1:50:55] if [1:50:56] if if if our only option moving [1:50:57] forward is continuous that I'm [1:50:59] going to ask for that [1:51:01] continues, I wasn't sure if [1:51:03] there was if it would be the [1:51:06] pleasure of of this commission [1:51:08] to to prove with [1:51:08] the comments are or you go back [1:51:09] to staff and you get reconciled [1:51:12] between now and City Council [1:51:12] then that [1:51:15] I would've I would ask for that [1:51:16] to happen to allow the project [1:51:16] to move forward but in all [1:51:19] honesty we've been we've been [1:51:19] working on this [1:51:20] project for better part of the [1:51:23] year now. So I don't want to [1:51:25] mess that up. [1:51:26] But trying to rush anything now [1:51:27] are trying to keep something [1:51:27] going for a couple more weeks [1:51:28] so. If a continuance is what I [1:51:29] need to ask for them. [1:51:35] For so when [1:51:35] what we've just for your [1:51:38] edification at least for for [1:51:40] into what we've [1:51:40] learned is that whenever a [1:51:41] payday comes a plan development [1:51:43] come with a development plan [1:51:43] comes in front [1:51:47] of us. It has to be. [1:51:50] We have to know exactly what [1:51:53] we're voting. [1:51:55] We've made a mistake in the [1:51:56] past or trying to do active [1:51:59] negotiation during a meeting [1:52:01] and we don't want to do that. [1:52:02] And that's why I think [1:52:03] continues works well in this [1:52:07] situation said when you come [1:52:08] back you're going to tell us [1:52:09] exactly what. Because that's [1:52:12] what he does for we don't watch [1:52:16] it too. Work with staff and [1:52:17] then try to go to Council [1:52:17] because we don't know what's [1:52:20] going to come out of that [1:52:22] process and we can't [1:52:22] advise Council read by [1:52:25] everybody we take that [1:52:26] seriously 10 years is easier [1:52:28] for us because when you come [1:52:31] back in week. Give you a 9 to [1:52:32] nothing vote hopefully [1:52:34] next time. Council can look at [1:52:35] that and they're not going to [1:52:36] be if this is very difficult to [1:52:38] say no to 9 to nothing vote [1:52:41] from the spot. [1:52:42] I'm [1:52:43] not not saying it's impossible. [1:52:46] Yeah know they can totally [1:52:47] River she has 9 to [1:52:47] 0 a problem. [1:52:50] >> Real real quick. I'm sorry I [1:52:53] never got an [1:52:54] answer Jeff I Hamilton MISTER [1:52:54] Hamilton yes, I just want to [1:52:57] make want to be clear for the [1:53:00] record. You [1:53:01] have to 2 writes no you don't [1:53:01] have to have to request a [1:53:02] continuous tonight you can [1:53:02] certainly ask for a vote [1:53:04] tonight, but I think you've [1:53:07] heard from the commission kind [1:53:08] of their concerns [1:53:10] and up we know which way the [1:53:11] vote would go if the vote is to [1:53:13] night tonight. They don't [1:53:14] recommend recommend you going [1:53:15] forward you can request a [1:53:17] hearing before the pnc but I [1:53:18] would [1:53:21] advise you Council before [1:53:23] Council us before [1:53:26] Council sorry but I do need to [1:53:28] let you know that that time [1:53:29] period within be a initial 2 [1:53:30] weeks waiting for that hearing [1:53:32] to take place and then staff [1:53:35] would have to then post that [1:53:38] notice which would set you [1:53:40] back quite probably 6 weeks [1:53:41] versus I think the commission's [1:53:42] been very clear with you if you [1:53:42] request it continue its [1:53:46] tonight. The new control your [1:53:49] own destiny and you know [1:53:52] believe when this staff [1:53:53] recommending if if they were [1:53:55] continuous granted the U.S. And [1:53:57] this is an issue [1:53:58] all kids I could hear this and [1:53:59] then have it something prepared [1:54:01] I think realistically the [1:54:03] OCTOBER 7th. [1:54:04] So you'd be looking at OCTOBER [1:54:05] 7th that if it was continue [1:54:08] date certain. Which would [1:54:11] definitely be. [1:54:14] I mean the only other option [1:54:15] would literally be to put you [1:54:18] if if you are tonight tonight [1:54:20] it was appealed [1:54:20] the council. You practically [1:54:22] could get on the 29th of [1:54:25] SEPTEMBER for Council. But then [1:54:26] at that time they would have to [1:54:29] send a new notice which means [1:54:32] you would be after. [2:00:13] We also purchased Missouri I [2:00:16] can go to that site plan on [2:00:19] here. [2:00:25] We also purchase the building. [2:00:30] So all these cars are clear. [2:00:30] And we've changed that we're [2:00:33] going to update this building [2:00:35] paying it. [2:00:37] And bring it up to the standard [2:00:37] that we're going to do on the [2:00:40] new buildings just to kind of [2:00:43] update the area. I know has nothing [2:01:36] to do with this case, but you [2:01:38] again investing [2:01:39] in property. Cleanup [2:01:40] redeveloping and just want to [2:01:42] appreciate are you doing that [2:01:42] and thank you for being in [2:01:45] Arlington. [2:01:48] >> Thank you appreciate that. [2:01:51] You know I love getting up here [2:01:52] and coming in with [2:01:53] one mindset, changing it while [2:01:53] you didn't give a big [2:01:56] presentation really didn't [2:01:58] like. It would never read [2:01:59] it that the more we learned [2:02:00] about that or what are what are [2:02:00] you planning on doing with that [2:02:03] lot where you got rid of all [2:02:06] those cars. [2:02:10] We don't really know yet and we [2:02:10] did get cleared it's already [2:02:11] clear and we have other [2:02:14] businesses we might move into [2:02:14] it, it's got a lot of space [2:02:15] Hector along. [2:02:17] >> Potential not really sure [2:02:20] just yet but. [2:02:23] Part alone is another 3 acres, [2:02:24] so it's kind of a lot of [2:02:24] potential. [2:02:25] >> So so you are you kind of [2:02:26] thinking that you're wanting to [2:02:28] have a business Park where you [2:02:31] have. [2:02:33] All the businesses making all [2:02:33] the money there and that's [2:02:34] increasing taxes. Yes, Sir, [2:02:37] yeah that's the idea or not. [2:02:40] >> We're also surrounding. [2:02:40] Surrounding the [2:02:43] property with a 6 foot privacy [2:02:45] wooden [2:02:46] I think the neighbors would [2:02:48] appreciate that so that will be [2:02:52] helpful. [2:02:58] Commissioner [2:03:04] number our discussion [2:03:06] of stairs. [2:03:08] >> You'd be willing to include [2:03:09] a micro brewery distillery [2:03:12] winery. You what you'd like to [2:03:15] exclude that. [2:03:19] >> If the commission is [2:03:20] agreeable to appreciate a [2:03:20] lot bigger. [2:03:21] >> To that so we'll see what [2:03:22] happens to it with the motion [2:03:25] as we go forward any other [2:03:28] questions. [2:03:33] And I thank you for bringing [2:03:35] this business here all right. [2:03:36] I have in addition to see [2:03:39] London Todd you're not speak or [2:03:42] you your your support. And I got married and [2:04:21] my wife my beautiful worth so I [2:04:21] lost that [2:04:27] >> was it Cynthia. [2:04:30] Say did a great job presenting [2:04:33] that space [2:04:34] that area growing up in [2:04:37] southwest Arlington I went to [2:04:40] Martin knew [2:04:40] the area went to Baylor and [2:04:43] started in question will say [2:04:44] why graduate from college and [2:04:47] with that industry are real [2:04:47] estate specifically. [2:05:04] I'm the broker on the steel and [2:05:07] working with Grandma and Jeremy [2:05:08] up their business and so. [2:05:09] >> With that I just want to [2:05:10] state that I think it's very [2:05:12] clear that the highest and best [2:05:14] use overhears industrial real [2:05:17] estate. It's been clear with 5 [2:05:18] other properties being rezoned [2:05:21] from this current zoning to [2:05:23] industry [2:05:24] type zoning.
