[0:00] Ready? [0:13] » I'd like to call call to order and record record our quorum. We do have a [0:19] quorum of four members. Thank you for being here today. It's much appreciated. [0:25] Um, we have several business items, but [0:29] before we get into that, we need to take a look at the minutes from the last [0:32] meeting, and they are attached. [1:32] Whoever feels ready to uh make a motion to uh [1:35] » I make a motion to approve the minutes of September 23rd. [1:41] » Is there a second to the motion? >> A second. [1:46] » I second. >> Having received a motion and a second, [1:52] place it up for vote. All those in favor signify please by saying I. [1:58] » I >> I [2:01] » I >> I. Motion passes 40. [2:06] Turn back to our agenda. [2:10] The board will elect a chairperson and a vice per chairperson from its members to [2:15] serve a two-year term. I'll open the floor up for that. Who would like to [2:20] serve as our chairman again? Anybody [2:30] have a nomination for the chairman? >> Um, if I may, I'll nominate myself. [2:37] » You nominate yourself? Yes. So, uh, Cal Grady has nominated himself. Is there a [2:43] second to his nomination? >> I'll second. [2:47] » And who the second come from? I'm sorry. And who in what position are you nom [2:52] nominating yourself chair or white chair? [2:55] » Just a a simple chair. >> Neither neither. [3:01] So my understanding is Kyle Grady has self nominated himself and it's been [3:06] seconded for chairman. Is that correct Mr. Grady? [3:10] » Yes, sir. >> Okay. So, a motion has been made [3:14] uh for Kyle Grady to be chairman and um it's been seconded. [3:20] I'll take the vote now. All those in favor of appointing Kyle Grady as the [3:25] chairman of the board of adjustment, please say yay or nay. [3:32] » Yay. >> Okay, I hear yay from [3:34] » yay. Richard Martinez. >> Richard Martinez. Yay. The other yay was [3:38] yay. >> Yay. Mr. Ready? [3:42] » Yes, sir. >> Yay. Yay from you. [3:44] » Let's make it a unanimous then. It's yay. [3:47] » Okay. So, it passes. So, sir, you are now the chairman. Now, we're going to [3:51] vote on the vice chairman. Since you're the chairman now, you can take over at [3:55] this time. Okay. Do you appoint for vice chairman who would like to make their [4:01] position known, please? >> I'd make a recommendation for Lamar [4:04] Gillian to be vice chair. >> Lamar Gillian. [4:07] » I accept I accept that nomination. Thanks. [4:19] » I second. >> Motion's been made and seconded for [4:23] Lamar Gillian as vice chairman. It's your turn to take over the meeting. [4:30] Yes. Call for a vote, gentlemen. I [4:36] » I [4:51] now continuing on for uh register for Nicholas [4:57] um you say his last name Nicholas [5:03] Department of Community Development [5:09] Mr. Grady, can I be recognized? >> Yes, sir. [5:12] » So, we're on number two. Back to the agenda. [5:21] » Okay. >> Okay. Mr. Grady, for a moment. Um, for [5:24] all of you, number two is the open hearing that that Mr. Grady will open [5:29] and then you can also call if there's no one here to speak to the topic from the [5:35] community you can call staff which Nick is here to speak to topic as well. Then [5:41] you'll hear the comments and then you will close the hearing. Each time you [5:45] open and close you need to state the time. [5:49] » Okay. >> Number three, Mr. Grady and everyone [5:53] you now open discussion about what you heard. You do not discuss in number two, [5:58] you discuss in number three. And the three items that are on the agenda, each [6:02] one is like that. So you'll have three public hearings where you will hear [6:06] information, you will close the hearing, and then you open for discussion. So in [6:12] that regard, number three goes with number two, number five goes with number [6:17] four, and number seven goes with number six. [6:22] And you need to read all of what's on number two. and then state the time and [6:27] open the hearing. Mr. Grady. >> Okay. So, I would say time is now 506 [6:32] and we'll be doing uh board will conduct a public hearing to receive public [6:36] comment for the citizens on the variance application submitted by Albert Devila. [6:44] A property located at 2910 Hillrest Drive, Baloney Heights, Texas 7201. [6:49] legally described a CB5894A block one lot zoned O1 [6:58] lowrise office. The applicant is requesting variances of [7:03] section 150.28B commercial business and sections [7:08] 153.3.4.2F [7:11] side setback and a and 153 uh 342 G rear setback of city code EOA [7:20] chairpersons. Uh we'll begin with an open public hearing. [7:25] » There was no one from the public here to speak to that topic. So you may call [7:28] staff. >> Okay. Uh staff [7:31] Nick the first one. We'll start on uh slide 2910 Hill Press Drive. [7:55] You got it. Great. And then we'll start on property information. [8:00] » Okay. Good evening, board. Glad we're finally meeting after many months. Um we [8:05] have uh three applicants tonight. Uh the first one's going to be 2910 Hillrest [8:09] Drive uh for Albert Davila of Davila Electric. Um again, zoning is 01 lowrise [8:16] office. Uh we've gone over the legal description. And this is described as [8:19] BCAP property ID 358171. Next slide, please. [8:30] So, we're going to have three different variances that are going to be requested [8:34] here. The first one's going to be 150.28B [8:38] commercial businesses. Um, this has to do with the quantity of cargo containers [8:43] located at the property. So currently as ordinance reads um the you may store [8:53] » is everyone on this page now? [8:57] » Yes. >> Uh quantity of cargo containers. So you [9:02] may store maintain otherwise keep a maximum of two cargo containers on a lot [9:06] or property within a non-residential zoning district. The cargo container [9:10] must be placed on an approved surface and the building official must approve [9:13] its location. So, as you can see that underlined section there, maximum two [9:17] cargo containers is the requested variance area where they're requesting [9:21] um a relief to five cargo containers on property. Uh the second requested [9:26] variance is 153.4.2. This is going to be off to the right [9:31] hand side of that page. Um FNG, this is going to be your setback table. Uh [9:36] currently that setback table is set at five feet from the rear and from the [9:40] side. Um this just has to do with um you know where these cargo containers can be [9:45] placed in relation to that back fence and that um sorry the rear of the fence [9:49] and then the side of the fence. Uh five feet is already you know well within [9:53] distance but you know whenever you go place they're not out there measuring [9:58] you know so this is you know I believe within four four and a half feet. So [10:01] it's not really much change uh to what that tabular form already is. Next [10:06] slide, please. [10:10] They're continuing on from that 150.28 commercial businesses and the tabular [10:14] form. So, requesting a 4T and requesting the five car containers. Next slide, [10:18] please. [10:21] So, just to go over this ordinance intent. Um, this allows commercial [10:25] property owners the ability to utilize cargo and shipping containers as [10:28] additional storage options for their businesses without the financial [10:32] investment of expanding or renovating the permanent structure. Um, cargo and [10:36] shipping containers should not adversely affect the character of the [10:39] neighborhood. Uh, this is pulled directly from our municipal code of [10:42] ordinances um from the u city plan 2040. That's the intent of adopting this [10:48] ordinance and the requested variances do not affect the intent of it. [10:55] This next slide you're going to see the current placement of the shipping cargo [10:58] containers. We have three uh directly right behind the building that is not [11:03] viewable from the rideway and then two that are viewable from the rideway only [11:07] if the gate is open which I believe most of the business operating now that gate [11:11] is closed. So um most if not all the time all cargo shipping containers are [11:16] not viewable from the rideway um or from neighboring properties. They are um yes [11:22] a little bit encroaching on that 5 foot setback but you know by six inches max. [11:26] we're not, you know, too close where it's causing any fire hazards or [11:29] anything like that. Scroll down, please. [11:36] The third variance that is being requested has to do with wall signs. [11:40] This is going to be your ordinance 153.12.10, [11:44] which oversees wall signs. Um, Hillrest Drive is classified as a minor min minor [11:49] arterial, excuse me. Uh, but any 01 zoned uh office on Hillrest Drive is [11:56] considered the Hillrest District where there is no authorized signage allowed [11:59] there. As you can see, if this was just the minor arterial that we're looking [12:04] at, um, it's allowable up to 80 square feet. Next slide, please. [12:09] The proposed sign that they're wanting is only 36 square feet. Nowhere near [12:13] what would be um encroaching on the 80 square feet. That's maximum allowable on [12:17] Hillrest Drive. Um anywhere else that is not 01 zoned area [12:24] before you go. There you go. Off to the right there. That is the proposed sign [12:27] that they're going to be using um on the wall there just to identify their [12:31] business and proponent will promote a little bit more visibility there and [12:35] establish them as a sense of place because there's not really much signage [12:39] on location right now. Scroll down please. [12:43] There's going to be a loose placement of the sign. Um I believe the sign has been [12:47] with their business for many years now. I think that they brought it from the [12:51] previous location before they relocated to Bakoney Heights. [12:55] Slide please. So ordinance intent for uh signage here. [13:01] So city recognizes the safety, commercial, emergency and information [13:04] needs for signs. This article has been adopted to protect the health, safety [13:07] and welfare of the citizens by regulating the location, construction, [13:10] duration, size, height, installation and maintenance of all signs within the [13:14] jurisdiction of the city in accordance with LGC article 216. Additionally, this [13:20] article is intended to enhance property values, maintain aesthetic [13:23] attractiveness, and promote commercial opportunity in the city, and support and [13:27] further the objectives of the city's comprehensive master land plan. I [13:31] underlined that last section there because the requested variances for this [13:35] wall sign is clearly aligning with the intent of why this ordinance was [13:39] adopted. It's not straying away from and it's not causing any harm to [13:43] neighborhood characteristics or anything like that. There's no issues with [13:47] safety. um emergency uh needs and this just promotes the commercial needs for [13:52] this business. Next slide, please. [13:57] So, with all these public hearings, we're required to send a 200 foot um [14:02] public hearing notice to any uh residents, commercial, businesses that [14:08] are within that range. Uh we received one response that was not including your [14:12] packet because it was received after the the packet was due here. Uh we received [14:17] one in favor of the change. U this is from the property owner of 2922 [14:22] Hookrest. Rest of the properties that these were sent out to were [14:25] non-responsive. Um they do not oppose or in favor of the change. So we have one [14:30] in favor of this change. Uh recommendation is shipping containers. [14:34] Um well one to approve the variance for shipping containers, but they do not [14:37] adversely affect the character of the neighborhood and do not pose a fire [14:41] hazard or risk or anything like that. aligns with the intent of the ordinance [14:44] and helps support this business. Same thing with the wall sign is my [14:48] recommendation is to approve this variance clearly aligns with enhancing [14:52] the character of the neighborhood helps promote this business falls in line with [14:56] the full intent. [15:06] Okay. So as of now there's any further questions or [15:11] comments. The Time is 5:15. We'll begin closing. [15:17] Anyone with public comments? >> No, just staff. [15:23] Okay, then we'll begin closing public hearing and move on to [15:32] now we'll be considering the act the board [15:35] will be considered we'll consider an active variance application submitted by [15:39] Albert for the property located at 29 [15:43] 1 Hill drive 721 requesting variances of section 15 [15:51] commercial businesses Section 15 [15:54] to F side setback 4 to DG rear set. Apologies rear setback [16:03] of code city code UA chair. [16:14] » If you have any questions I'm more than happy to answer them. We also have the [16:17] business owners here. You may sir, go ahead. [clears throat] [16:21] » I have a question. >> Microphone is [16:25] » Yes. >> This uh [16:29] original application was submitted October the 29th, 2025. [16:36] » Correct. And when I read some of the [16:42] requirements to reapply, [16:46] I um no appeal under this article should may be filed by the same applicant [16:52] within 365 days of the date filed upon which the [16:57] board denied such appeal. Are you familiar with that? [17:01] » I'm familiar with that. This uh appeal has not been denied. They never had a [17:05] hearing in October. [17:09] There's a denial letter right here. >> That's a denial for a permit. That's [17:12] that's the prerequisite for them to apply for the board of adjustments. [17:18] » This first application to the building department um if it does not fall within [17:22] the municipal >> for the shipping for the shipping [17:24] containers. >> Yes. [17:30] and and and this uh denial letter, you're telling me he did not come before [17:35] this board in request? >> He has not come before this board. I [17:39] don't believe this board has met since July or August of last year. [17:44] In order to apply for a hearing with the board of adjustments, they need a denial [17:49] letter from the building department that they were not allowed to uh pull their [17:53] permit. That is a denial letter there that I've included in your packet that I [17:58] filled out, not the board. [18:07] » Great. September 23rd was the last meeting. [18:10] » It's It's confusing. It's it because I'm clearly reading it. [18:14] Thank you for submitting the car container permit application for the [18:19] commercial property. After reviewing your application, we get to inform you [18:23] the permit is denied. >> Correct. They apply for the permit with [18:27] the building department, not with the board of adjustments. They cannot come [18:31] before the board of adjustments without a denial that they cannot pull that [18:36] permit. The reason that they're seeking the request for a variance is because [18:41] they were unable to pull a permit under the current code. [18:47] So any there's going to be denial letters for all the applicants tonight. [18:50] That's the prerequisite to be here tonight for a hearing. [18:58] » All right. Thank you. >> Any other question? [19:04] » Anyone ever had anyone have questions? >> Again, the property owners are here if [19:10] you have questions for them. >> Yes, of course. Of course. Uh we would [19:14] like to hear um Um [19:20] time is 5:19. Upon request, um I would like to hear the property owners. You be [19:26] so kind. They will step forward. >> Mark, [19:30] » thank you. [19:33] » Go ahead. [19:39] » Mark Electric. What questions do you have? [19:45] Do we have copies of the neighboring the neighbors the [19:52] acceptance or denial? >> The in favor or against? [19:57] » Yep. >> I have one year that was submitted. [19:59] That's why it's not in your packet. Would you like to see it? [20:01] » Yeah. I mean, it's 93 pages or so here. I I I can't find it. [20:40] All right. Thanks. [20:55] » I just want to >> Mr. Chairman, may I speak? [20:57] » Yes, of course, sir. Thank you very much. [20:59] » Mr. Mr. Gillan, do you mind if I say one thing really quick? [21:01] » Of course. >> So, in your packets as well, I've [21:04] included a list of all property owners within 200 ft. This is what it gets [21:08] mailed out to. This is before every presentation. So, everybody receives [21:12] this letter. The page right after the addresses of anybody within 200 feet is [21:18] going to be the public notice that is sent out. Everybody gets this public [21:22] notice within 200 feet of those property owners. If I don't receive anything, [21:26] then it's, you know, they're not against it and they're not in favor of it. The [21:30] only one that we have recorded for this one is one in favor. Nobody against the [21:34] variances that are requested today. If I do receive it before applic the [21:40] packet's due, it will be included in your packet. But if not, then I'll just [21:43] bring it like I did tonight. Thank you, Mr. Geller. [21:52] Mr. Dala, I I do have the floor, right? [21:57] » Yes. Yes. >> Mr. Dava, hello again. Uh on the on the [22:00] Con containers, the presentation we had said there the setback was going to be [22:06] four feet for some of them and three feet for the others. Is there reason is [22:10] there a reason why you can't accommodate the five foot? I believe five foot is a [22:15] is a city standard. Is there a reason why you can't make four five and 35? So, [22:20] when they were first dropped off, um they again they're not measured when [22:24] they're dropped off a giant trailer. So, we were trying to get as close as [22:26] possible as we could to the five foot. Um at this point, they're full of [22:31] equipment. They're full of scaffolding. They're full of [22:34] everything. They're full. So, the only issue would be moving all the vans out, [22:40] moving the the curbs for the vans out of the way, unloading all the trailers, [22:45] hiring someone to come and and move them that extra half foot or foot. So, it [22:51] would just be an additional expense that I was hoping to be able to avoid. [22:55] » If if I may continue, uh, uh, what kind of fencing do you have around the [22:58] property? >> It's an 8ft wood fence. [23:01] » 8 foot wood fence. >> Yes, sir. [23:02] » Con those ConX containers probably will not be visible. Is that correct? [23:06] » They're 8 foot tall. No, sir. They're not visible from [23:08] » Okay, that's all I have. Thank you. >> Thank you, sir. [23:13] If >> I could just provide a little background [23:14] information, Mr. Davila was given a verbal response uh that there was no [23:20] permits required for a cargo container. Um, which is why they're placed on [23:24] property right now before a permit was issued. Um, this was prior to me taking [23:30] over the position for permanent. So, uh, he would not have moved forward without [23:35] that verbal confirmation from the department who was here before me. So, [23:38] um, but here we are on the situation. So, [23:41] » thank you. [23:48] » I have a question. Is this a a two-part one for shipping containers and one for [23:57] a sign? The same >> correct? Okay. [24:02] Um, I haven't heard anything about the sign [24:06] yet, but I I I'm going to make a motion to approve the shipping containers [24:14] » if that's appropriate. >> If I may. [24:17] » Yes. >> I'm I uh second that motion. [24:25] » For a vote to approve. [24:29] Hi. >> Hi. [24:33] » Hi. >> Hi. Motion carries. [24:36] » I'm gonna have Roy pull back up the sign here. Let me scroll up here. There we [24:41] go. Right there. Fantastic. So, um, one more, please. Actually, [24:46] uh, no. Back up. Back up. Back up. Fantastic. Right there. So, um, part of [24:51] the variance is right. So, the shipping containers recovered one. Uh, wall sign [24:54] was the other one. 153.12.10. Um, so I just want to reiterate here, [25:00] uh, Hillrest Drive is a minor arterial. Any minor arterial in the city that is [25:06] not part of the Hillrest District is allowed to have an 80 square foot sign. [25:11] Hillrest District is considered 01 property, 01 zone properties along [25:16] Hillrest Drive where there is no authorization of wall signs in that [25:20] area. Scroll down, please. The sign that they're proposing is 36 [25:26] square feet, less than half of what would be allowed in any other area for [25:31] uh along a minor arterial. Scroll down one more. And then here is just the [25:36] proposed location. That is not two size. That is just me drawing a circle on the [25:40] picture there. So please don't take that to scale. Um I think it's pretty close [25:43] though. Great. Fantastic. So we're taking very little uh area of that front [25:48] facade there. I just um Joe included in your packet [25:53] the ordinance for board of adjustments and how we make decisions for these [25:57] variances. Um I just want to go over that one time really quickly. Um they [26:02] need to uh provide hardship um as to why we're approving these variances, right? [26:07] That y'all made that decision for the shipping containers already. Um it is a [26:11] hardship for these 01 zone properties not able to advertise their business in [26:17] the the means that they're allowed to right. Um it is selective to uh [26:23] discriminate against the 01 properties here in the Hillrest district. This [26:27] fully meets the criteria and and that is why I'm providing the recommendation [26:30] that we should be approving this variance for the wall sign. That is less [26:34] than half of what they would be allowable um in any other minor arterial [26:38] section of the city. [26:43] If you have any questions, please let me know. [26:45] » May I be recognized? >> Yes, sir. [26:49] » Would you back up uh to the first picture? We saw that sign there. There [26:54] it is. Del Electric. Okay. Um, [26:59] it it definitely does not violate the area of signage, but because it's in a [27:07] non-residential area, [27:11] it they have to come before before us. Am I understanding that correctly? [27:15] » They they have to come before the board because they're in a [27:20] » uh unique district. So any of those 01 zone properties like I talked about are [27:24] considered the Hillrest district where there's no wall signage allowed. [27:27] » That that's the reason. >> Okay. [27:28] » Yeah. >> So if they had any other zoning along [27:31] Hillrest or if they were one of the apartments or closer here to the justice [27:35] center, they'd be allowed to do this. But just those last couple properties [27:38] along Hillrest are not allowed to have the signage. [27:40] » So as I understand it, the the uh only problem with moving out on this sign is [27:47] where it's located on that street. it correct. It is the how the property is [27:52] zoned. >> Yeah. [27:53] » Yeah. >> Yeah. Okay. Okay. Thank you very much. [27:56] » You got it. >> Appreciate that. [27:57] » And then Mark, can you do me a favor? Can you tell me how long y'all had that [28:00] sign? >> Uh that was on our original shop. We've [28:04] had it for at least 20, maybe 30 years. We had it built years and years and [28:08] years back, and we're just hoping to keep on using the same sign everyone's [28:12] used to seeing. Okay. Thank you. [28:19] Uh we will begin voting for the approval of the sign now. All in favor? [28:24] » Motion to approve. >> No, you need to call for the motion. [28:27] » Oh yes. Uh call for the motion. Call for the approval of the motion of [28:32] the sign as right now as of 529. All in favor? [28:38] » Just call for the motion without guiding them to approve. [28:43] » Call for a motion. [28:47] I make a motion to approve. >> I second. [28:51] » Okay. Third. I approve. [28:56] » Excuse me. Excuse me. After you get the approval of the motion, you call for a [29:00] vote on a motion. And did I did I not hear that? [29:05] » My apologies. Um, call for a vote. >> There you go. [29:08] » Thank you. >> I [29:11] » I >> I [29:12] » I motion pass. [29:22] Great. Thank you all. So, um, we'll get permits [29:26] » this week and then y'all are good. >> I'd like to thank the board for their [29:30] time. Appreciate that. >> Thank you, sir. [29:45] The time is now 5:30 and we'll begin today. The board will be conducting the [29:50] public hearing to receive public comments for the citizens on variance [29:53] applications submitted by Lewis Espinar for properties located on at 610, 612, [29:59] 614, 618, 620, and 622 on Gentleman Road, Balcony Heights 7201. [30:07] Legally described as CB 5894, lot G3G. Uh count uh country gentleman states uh [30:16] subsidiary CB subdirectory CB 5894 lot 3H country gentleman estates [30:25] subd CB5894 lot 3J uh country gentleman establish [30:32] subd CB5894 block 3 M country gentleman estabates [30:38] subd CB 5894 [30:43] Country Gentleman Estates Subdoman [30:52] estates subd zoned R five townhouse residents. The applicant is requesting [30:58] variances of section 153 31 53 uh C and 153 315 [31:09] 3E of chapter chapter 8 of the city code. [31:20] We'll begin with an open public hearing. >> There's no citizens signed up to speak. [31:25] You may call for staff. Okay, call for staff permits. [31:30] » Okay, we'll have another presentation here. Um, let me just give a little [31:32] background. I failed to do that in the last one. So, um, Mr. Espinar here, um, [31:38] over there, uh, submitted an application to renew two variances. These are two [31:42] variances that were granted back in 2021. This is for the properties located [31:47] at 610, 612, 614, 618, 620, and 622 Gentleman Road. that has six uh zone uh [31:55] R5 zone properties uh here along Gentleman Road. That's going to be the [31:58] the one vacant lot that you see when you drive down off to the left behind [32:02] Chick-fil-A there. Uh the request of variance renews uh renewals would allow [32:06] the proposed residential development to proceed without modifying the existing [32:10] utility configuration which Mr. Espanar has spent quite a bit of money making [32:14] sure those utilities were put there. Uh and as reducing it will also uh let me [32:21] back up here proceed without modifying the existing [32:25] utility configuration or reducing the number of proposed dwelling units with [32:28] the current configuration for the platting of that property. Uh the [32:32] application the applicant has also requested a waiver of a variance renewal [32:35] fee for the board's uh consideration here. Um you can request a waiver of [32:40] fees if it is a renewal. Um that is the the only criteria there if it's renewal. [32:47] So again these were granted back in 2021. Um he's looking for renewal of [32:51] those two variances. Variances do expire after one year if there is no movement [32:56] on that variance that was granted. Can you pull up the presentation please? [33:04] Not the email. Not the email. The PDF. [33:23] Keep going down. You got it. Long ways down there. [33:33] Fantastic. Again, this is for 610 through 622 Gentleman Road, all even [33:38] numbered properties. Scroll down, please. [33:42] Um, without reading all those legal descriptions again and all the property [33:46] IDs, I think we understand that this is uh 610 through 622 Gentleman Road, R5 [33:53] Townhouse Residences. [33:58] So, just to provide a little context, here is the current site along Gentleman [34:01] Road um on your your screens in front of you. Um the left is going to be an [34:06] aerial view. Uh the right is going to be a street view from Google Maps there. [34:12] I don't have an exact timeline of how long that's been vacant. Um Lewis can [34:16] give a better answer here later on when y'all call them up for questions. Scroll [34:21] down, please. So, the variance variances requested [34:25] here. Um the first one's going to be 153.3.15 [34:30] 3C site requirements. And again, my the the outlining is going to be the [34:34] important information that we're looking at here, what they're requesting [34:37] variances uh from within that ordinance. So, first one is C. All parking lots, [34:43] stalls, or garage entrances for town um townhouse units shall be accessible from [34:47] the rear of the property by alleys or internal drive aisle accessing the rear [34:52] of the unit. In so far as practable practable [34:58] practable, I can't get it. Exterior off- streetet parking facility shall be [35:04] grounded in bays at the interior blocks. No off- streetet parking space shall be [35:08] more than 100 feet by the most direct pedestrian route from a door to the [35:12] duelan unit it is intended to serve. So the requested area variance is rear [35:17] access uh for parking there. Uh the next request is 153.3.153E [35:25] design requirements and this is garages and parking areas shall not be [35:30] emphasized along street frontages. Uh attached detach garages in the rear yard [35:35] with access to midblock streets or private shared driveways along the rear [35:38] of the property are preferred. And that underlying area is the area that we're [35:43] going to be looking at. uh the way that he has his layout right now is going to [35:47] be um front access for the vehicles, not rear access. Uh given the size of this [35:53] property, there's just no feasible way for us to to force him to have any rear [35:57] access for these vehicles. If so, then you're limiting the amount of units that [36:01] he's able to put on that property in addition to um [36:06] changing up the utility designs right now where there's existing water, uh [36:11] sewer, and electric for all six of those properties configured for this internal [36:16] front access for vehicles. Scroll down to the next slide. [36:22] This is a loose configuration of layout. Um, so those six um squares, the blue [36:28] and the red squares on the left are going to be how those houses, not to [36:32] scale. Please note that's not to scale, but how they will be aligned. Um, you're [36:37] going to see that long kind of rectangular area between those squares. [36:41] That's going to be your driving access aisle where the vehicles would drive [36:45] through that little alleyway and be able to access their garage through the front [36:49] of their home, not the rear of their home. on the right again is going to be [36:52] that uh aerial view of the property. Scroll down, please. [37:01] So, just going back to the ordinance purpose, right? Um this is 153.3.15 [37:07] R5 town houses. I've highlighted those green areas because this is where we're [37:12] kind of aligning where this variance is and how it falls in line with the [37:15] current ordinance. So the intent aligns with ensuring location and design [37:19] standards are compatible with the surrounding property which this does [37:22] satisfy the need. Uh make efficient, economical, comfortable and convenient [37:27] use of scarce land and open space uh resources. This does it is an infill [37:32] property that we're trying to make sure is redeveloped. Um there has to be [37:36] unique creative ideas to uh be able to place housing here which Mr. Espanar has [37:41] uh been able to do. um and then serve the public purpose of increasing density [37:46] by providing an alternative uh to conventional arrangements of yards and [37:50] building areas which this needs to. Uh this property is uh well below an acre. [37:56] Um it is fitting the need for density right it is fitting six uh houses there. [38:02] Uh there's no change on um lot minimum size which it is going to meet the need [38:08] for. It is just changing up the um access for those cars there. Next slide [38:14] please. Excuse me. Once we start looking at our [38:18] city plan uh 2040 here uh permitting these variances addresses issues [38:23] identified um and all these issues are identified by residents, right? Uh that [38:28] um table on the right that you see, these [38:32] are all answers that were provided by residents back in 2022, 2023, addressing [38:36] the strengths, the weaknesses, the threats that this community is facing. [38:40] Um it's addressing aging housing stock. We're able to get six new homes in this [38:44] community. Uh population decline, right? We're making sure that it is a a dense [38:48] area or a denser area. um where we're making sure more uh residents move into [38:54] the area and it's satisfying the the need of there being a lack of inventory. [38:59] Right? Uh there are two different areas that are zoned R5 town home, but there's [39:04] no town home places here in the city, right? So, we're making sure we're [39:08] satisfying all these needs that were um identified by our residents. [39:13] Next slide, please. >> [clears throat] [39:16] » Before I go into the recommendation, I just want to say this is another [39:19] property where we send 200 foot notices to. I received no written uh notice of [39:25] in favor or opposed. I did receive one phone call that um they are not opposed [39:30] to the changes and this is from the property owner of Chick-fil-A. Um this [39:34] is the one uh directly behind this property. They have no issues with [39:38] whatever variances are being requested here. Um again the recommendation here [39:42] is going to be approve the renewal of both variances. Right? The board has [39:45] already made a decision before to approve this in the past. Uh the request [39:49] of variances do not adversely affect the neighborhood character or the intent of [39:52] the ordinance which is very important here. Uh the approval of variance will [39:56] also strengthen and address goals that have been outlined by the community [39:59] input in the city plan 2040. That'll be the end of my presentation. [40:12] So uh to receive it to receive the public comment is [40:17] Lewis Espinar here today to speak? Yes. Please [40:22] please step over to the mic. Thank you. [40:36] Good evening. This is Louis Eser. I'm open for any questions. [40:46] » Lewis, do do you have anything do you want to provide to them before they ask [40:49] any questions? Any background information that that I didn't cover for [40:53] you? >> No, I think you covered it all pretty [40:55] well. It's it was originally designed to to get started and if you look at the [41:00] dates that we kind of tackled this co hit shut everybody down for about a year [41:05] and a half and banks changed their minds on a lot of stuff. So, I've been I've [41:09] been holding it because I know it's a great location for medical center and [41:14] that's how I see the city of about is a medical center uh draw um where you're [41:22] so close to a well what I what I'm seeing is a revitalization of the med [41:27] center also with new buildings businesses new colleges u all kinds of [41:34] good stuff happening. So, uh, my my intent was to build six town homes for [41:39] people that wanted to live in the area that used the medical center, nurses, [41:44] doctors, whatever that may [41:51] Then we need to close. Anyone else have any other comments? [41:58] So 542 [42:03] in the public hearing [42:07] motion to vote. >> You need to read the next. [42:11] » May we have a discussion among the members? [42:14] » Uh yes. You need to [42:19] number five goes along with number four. [42:22] » My now that you've closed it, you need to read to the board number five and [42:28] then you can open it for discussion. >> Okay. My apologies. Board will consider [42:33] the act of variance applications submitted by Louis Spinar for the [42:36] properties located at 610, 612, 614, 618, 622, and 622 Gentleman Road, [42:43] Balcony Heights, 78201, Texas requesting variances of sections [42:48] 1528B, commercial businesses, and sections uh sections section 153 3153 C [42:57] and 153153 E. [43:01] of city code and the request of waiver fees overbearances renewal. [43:10] » Excuse Mr. G. Can I be recognized? Uh Nick, this may be more of a question [43:15] towards you regarding the renewal of the variances. Um are these fees that were [43:21] discussed to be propos uh proposed you wave are these uh items going to be [43:27] brought up in another year if there's no further development on property on [43:31] gentlemen? >> If Mr. Espanard does not move on the [43:36] granted variance if y'all grant it and it expires after another year and he [43:40] wants to come back and ask again then it will it will probably be brought up [43:44] again. >> Okay. And uh second once um you know Mr. [43:50] Espinard develops a property uh this variance is no longer an issue as [43:56] there's going to be existing property on that site. [43:59] » Correct. >> Yeah. Yeah. Once the the variance is is [44:02] granted and he's acted on it and developed his property then it is set in [44:07] stone. >> Okay. Thank you. [44:15] Turn on your mic. >> Whenever it's red, it's on. [44:23] Sorry about that. Yeah, the properties develop utilities [44:32] sewer and water impact ready. I get this [44:39] forward done within the [44:50] » Let me just clarify a little further. The second he gets a permit, he's acted [44:54] on the variance. >> Understood. That's Thank you for [44:56] clarification. >> Y [44:58] » may be recognized. >> Yes, sir. Um, I'm looking [45:02] [clears throat] back to the part of the handout to the days of November 19th, [45:07] 2021 when uh [45:11] a request for relief from our codes was issued [45:19] and uh are the the appeal for [45:25] this time. Is it the same? I think one of them is the same. That's uh the [45:30] parking lots. Are they the same as the ones that expired or do we have a new [45:35] one in here that I'm >> No, no, they're they're going to be the [45:38] same. They might be numbered a little different if if the ordinance has been [45:41] amended over the past five or six years, but [45:44] » it's the same request. >> Thank you very much. [45:45] » You got it. [45:53] Ask Mr. Grady ask for further discussion. If not, you can call. [45:58] Anyone else who has comments or thoughts? [46:03] » I'd like to be recognized. >> Yes, sir. [46:05] » Make a motion to approve. >> Motion second. [46:09] » I second. >> Thank you. [46:18] » Call for a vote. >> Yep. Call for a vote. Mr. [46:25] Hi. Hi. Hey. [46:30] » Hi. >> Yeah, I have it. [46:36] » Let me let me clarify really quick. You need a warp person I to approve [46:44] the super majority for board of adjustments. [46:49] I unless you're saying that we need [46:52] another individual or because since I'm chairperson [46:55] » 3 31 will deny this variance request. [47:08] » Mr. Ready, would you like to ask Mr. Sers if he wants to add [47:28] Mr. Gilling. [47:45] If there's any further clarification I provide, let me know if you have [47:48] questions. If not, then [48:00] so the the requested variance it it is the ordinance reads that for a [48:07] townhouse, they would need to access their home with a vehicle at the rear of [48:12] their house. So the [48:21] Correct. [48:24] » Correct. >> After [48:29] » if it's not acted upon, if Mr. Espanard did not act on that variance back then. [48:43] » May I be recognized? >> Thank you very much. Yes, Mr. Mr. [48:48] Sellers. [clears throat] >> What has happened is they have run into [48:53] some problems. They may have been financial or otherwise and they let this [48:58] variance that would you remember Miss Slayen of course when she was here when [49:02] Miss Slayen was here she um u process the approval by the previous board for [49:10] him to go ahead that's why I asked the question has anything changed from [49:16] the variances he was asking in 2021 to now and and the answer I got from uh [49:26] Nick was that no, they have not changed. >> There's no change. [49:30] » So the things that were approved in 2021 still are still needing to be reapproved [49:37] because you have one year to start your project. [49:41] Mr. Espanar's group did not get that done for whatever reason, which in my [49:46] opinion is immaterial. Why he didn't cash flow? I don't know. Whatever. So, [49:53] he's coming back again and asking us to approve his his uh [50:00] appeal. And I strongly suggest [50:06] that you would reconsider because this property is set vacant for [50:11] 5 years. It was previously approved by another council. It's a It's a good [50:16] project and it use it takes makes good use of a limited space we have for [50:23] building. So, if you would reconsider, we would ask that the chair call for a [50:30] vote again and see if we can move out of this. I don't know. I probably violated [50:34] every rule in Robert's rules of order by what I just did because I've never faced [50:40] this situation before. But I think we have the authority to go back and ask [50:44] for review and a second vote. And I'll leave that over to staff. [50:53] Thank you, Mr. Mr. Gayen. Okay. Okay. So, once again, so I would like to [51:01] make a motion to reconsider the previous vote and call for a new vote and see if [51:06] we can get it passed. >> Motion to approve. I believe Mr. Sers [51:11] has a question. [51:20] » I still don't know what we're here for. Is it a driveway, a parking lot? Is it [51:28] access to the rear? >> I'm going to bring up the [51:31] » I don't know what we're here for. >> Bring up the the PowerPoint. [51:38] Yeah. It's on the right. [51:43] Yeah. Scroll up. [51:48] » Let's You know what? Let's stop right here. [51:58] » Yeah. [52:12] ordinance does not [52:25] access. [53:02] sauce. That's [53:30] Okay. So, what is different now that this was voted on and passed five years [53:37] ago? [53:54] Mr. Chairman, I think we have a motion on the floor. [53:57] » Is there a second? >> Second. [54:02] Motion to vote. >> Call for the vote. [54:06] Okay. I vote vote I >> I [54:12] vote >> I [54:14] » I motion passes. >> There's also action on his fees. Request [54:21] a waiver for fees. [54:32] Anyone have comments on that? I'd like to make a motion first and get it on the [54:35] floor for discussion. I make a motion to uh wave the fees for this project. Okay, [54:42] » I second. [54:46] » Call for discussion. Call discussion, gentlemen. [54:50] » Call for discussion. >> Reapplication fee. [54:55] » It is a relication fee. >> All right. Yeah. Yeah. [54:59] Second already has a second. [55:05] Motion to vote. [55:10] » I I [55:19] thank you. [55:22] » Time is 5:55. [55:27] Okay. Now on to the next item of business. Bo [55:34] will conduct a public hearing to receive public comments from the citizens [55:37] regarding the variances. Variance applications submitted by uh Jalan [55:43] Dodson. Apologies if I got your name wrong. Executive signs for the property [55:47] located at 6700 Highway 10 west of Bummy Heights, Texas [55:54] 7201. Legally described as CB5508D, Methodist Texan Hospital, Watt 17RA, [56:03] [snorts] zone 02, high-rise office. The applicant [56:07] is requesting variances from sections 1531 [56:14] 17B through D and 1531 1214B [56:19] through D of city code VA chair persons. We will begin for an open public hearing [56:26] at 56. >> There are no citizens to speak. You may [56:31] call staff. >> Okay. Uh staff. [56:37] » Well, uh we're getting here. [56:45] One more. Sorry. No, no, no. I'm talking other [56:49] way. [56:53] going right there. [56:57] Yeah, I'm going to So, just to give a little background here, um, Executive [57:02] Signs, who we have a representative for on behalf of Methodist Texan, has [57:07] submitted a variance application for new directional signs and new monument signs [57:12] at 6700 IH10 West. That is going to be the main Methodist Texan here in in the [57:18] city off of the frontage road of I 10. uh the prop proposed signage uh [57:24] currently um that they want exceeds the height, the service area, and the [57:29] quantity limitations established by the uh current code. Uh requested variances [57:34] would allow the installation of signage to improve navigation throughout the [57:38] property for visitors and emergency vehicles while enhancing the facil's [57:42] visibility and identification. [57:47] We're we're going to go um through the entire packet that I have here for [57:50] y'all. Uh here's the permit uh denial letter that we have uh filled out for [57:54] them. Uh as they apply for this signage permit, we have to deny it based on what [58:00] is currently adopted. Scroll down, please. [58:04] Keep going. Keep going. They filled out their application of why [58:09] this is causing them. Hardships drop right there. Fantastic. So, there's [58:12] about I I don't know the exact quantity. Jacob can give a better uh answer here [58:17] whenever he comes up here for for questions. But I'll go through quite a [58:21] few of these slides where this is going to be the proposed signage that is [58:24] directional and monument. Um if y'all take a look at your screens, you'll [58:28] you'll see quite a few of them and whether they're existing and they're [58:31] going to be added or they're going to be removed. um I'm sorry, existing and then [58:37] they're going to be be removed and add a new one. Or if there's no existing sign [58:41] there and they're going to add a new one in place of a vacant area. So here are [58:46] the proposed directional signs. There's a couple different variations depending [58:49] on the direction or the placement of it. Um scroll down please. [58:54] These all are going to be proposed at six foot high. Scroll one click one [58:59] click up other way. There we go. Four foot wide. So, 24 square feet, um, six [59:05] foot high signs. Scroll down, please. Keep going. [59:12] Keep going. Keep going. Keep going. You'll see that a lot of these look the [59:15] same. Stop on the ER one, on the red one. Fantastic. Um, I just want to [59:20] reiterate that this is going to help clarify visibility throughout the the [59:23] Methodist Texan campus, right? Um the last thing that you know we want or I'm [59:28] sure Methodist wants is for somebody to not find the ER or whatever emergency [59:33] area that they're trying to locate um there. So this is going to help provide [59:36] a lot of directional um overview to anybody that's uh either visiting and or [59:43] um emergency vehicles that need to uh find what area they're trying to [59:47] navigate to. Right. Um I did speak to Methodist Texan earlier today. Uh they [59:51] did note that this is one of the only hospitals in the San Antonio Bear County [59:56] area that has the emergency department at the rear of the building and not the [1:00:00] front of the building. Um so this uh signage, the ER signage and a lot of [1:00:04] this monument signage, I'm sorry, directional signage is important for [1:00:07] them to be able to navigate, provide anybody that's uh there an ability to [1:00:11] find it when most people are used to just driving to the front of the [1:00:14] hospital and being able to to find it there. So we're kind of in a unique [1:00:18] situation here. Scroll down, please. Keep going. [1:00:23] And again, you'll notice a lot of these directionals are going to look the same. [1:00:26] Keep going. Keep going. [1:00:37] Zoom in on that that uh right before that one. Here you're going to see a lot [1:00:43] of the proposed signage placement throughout the property. Um a lot of [1:00:47] them are directional. We have a few monuments. Uh the ones that are denoted [1:00:51] as number one and number 13 along the front are going to be the monuments. [1:00:56] Excuse me. All the rest of those signs, those those yellow circles up there with [1:01:01] any other number besides one or 13 is going to be your directional signs. [1:01:04] Scroll down, please. [1:01:08] Here is going to be the proposed change to the monument sign. This is the [1:01:12] existing monument sign there. Uh again, I talked to Methodist earlier today, the [1:01:17] director of facilities management. You did note that, you know, the signage [1:01:20] hasn't been changed in 20 something years. They're looking to to not only [1:01:24] freshen up the the signage, but they have a very common issue with people [1:01:29] driving into this sign, right? It is not easily viewable. There's only one ground [1:01:34] light that's facing this. So, it is a a common issue that he has to deal with [1:01:38] getting replaced. And if you're not familiar with monument signs, they're [1:01:42] they go from between 10,000 and probably 50 100,000. They're very expensive signs [1:01:47] to to constantly keep maintaining. Hold down, please. [1:01:52] There. Yep, there we go. Here is going to be the proposed new monument sign. [1:01:57] Uh, if I can see it is 10 foot six high and 8 foot wide. This is not only [1:02:03] providing more visibility from the frontage road. Um, it's providing more [1:02:08] visibility from the highway, anybody passing by, but it it's also internally [1:02:12] lit, which is going to provide more visibility at night. uh hopefully and uh [1:02:17] probably prevent more people from keeping running into the sign. Right. [1:02:21] So, there's two different proposed locations for this sign. One that you [1:02:25] just saw that's going to replace the existing and then one that's going to be [1:02:28] at a different area that doesn't have a current sign, a monument sign in place. [1:02:33] Scroll down, please. This one's going to be replacing the [1:02:37] existing at the main entrance along the I 10 front road. Scroll down. [1:02:46] We're going to skip that one. Scroll down. And this one's going, you got it. [1:02:51] This one's going to be added as a new sign that is not currently uh have [1:02:56] anything there, right? It's just an empty patch of field, right? If you miss [1:02:59] that first entrance, this is going to be your second one. We want to be able to [1:03:02] provide that visibility that way nobody's missing their access into the [1:03:06] hospital. Go down, please. Just to reiterate, here are the [1:03:11] locations for the signs. uh one and 13 are going to be your monuments. All the [1:03:16] rest of those signs there are going to be your uh directional signs providing [1:03:20] navigation to any area of the facility whether it be parking, the ER, any other [1:03:26] uh department they need to uh kind of navigate to. Scroll down. [1:03:31] Fantastic. Let's get to our presentation. Scroll down a little more. [1:03:34] So, property information. Uh Shon Donsson was the one that um applied for [1:03:38] this for executive signs. We have Jacob Dodson uh who [1:03:42] Can you remind me your position? President. Fantastic. Even better. Um, [1:03:47] of executive signs here to speak on behalf of Methodist Texan. Uh, address [1:03:52] against 6700 IH10 West. This is one of the only properties that's zoned O2 [1:03:57] Highrise Office. Um, our BCAP property ID is going to be 1303200. [1:04:04] Go down, please. So, we saw a lot of the pictures of the [1:04:09] current site. Um, here's what it looks like for the monument sign areas. One [1:04:13] does not have a sign on it. Another one has a sign that is within the [1:04:16] limitations of what the ordinance says right now. I want to say it's probably [1:04:20] around 5T, 5'6, something kind of at the max of what a mon size is allowed to be. [1:04:26] Hold on. So, requested variances, we have quite a [1:04:31] few here. So, um, on our directional signs, there's a maximum height of three [1:04:36] feet that is set by the ordinance. They're requesting that their [1:04:41] directional signs be changed to six foot in height. The maximum area uh currently [1:04:48] allowed is 12 square feet. They're requesting it to be 24 square feet. And [1:04:54] the maximum number of signs is one for every 10,000 square feet of space. So [1:04:59] it's it's based on calculation. Um I don't know the square footage area of [1:05:04] the hospital. Um, but I'm sure it's not 150,000 square feet. We're requesting 15 [1:05:10] signs on property there. Um, again, this is just to provide uh, you know, [1:05:15] directional enhancements to visitors and, uh, emergency vehicles, KDN, EMS [1:05:21] services that need to be able to locate services very quickly at the hospital. [1:05:25] The requested variances for monument signs. Um, what's currently allowed is [1:05:29] going to be 5 foot six. They're requesting that their signs be 10 foot [1:05:34] eight. Um the maximum area is that's allowed currently is 50 square feet. [1:05:39] They're requesting it to be 80 square feet and there is a limitation of one [1:05:44] sign per frontage. Um so as you saw there they're requesting two signs along [1:05:50] IH10 the frontage road there. One is a pre-existing and then one is a vacant [1:05:55] area that serves as their secondary entrance to the hospital campus. Please, [1:06:03] » just to go over signage again, here are the two kind of main design layouts for [1:06:06] them. One is just a general navigation sign and then one is very specific to [1:06:11] the ER for them. Here's your your monument signage one [1:06:16] more time with um with height and width, right? 108 and then [1:06:22] six foot wide. Um it is a much larger sign, right? So, we're making sure that [1:06:26] we're allowing them the visibility for people that need to locate the the [1:06:31] emergency services that Methodist provides with ease. Right. And if you [1:06:35] missed this one, you want to be able to access the second one. And there's [1:06:38] currently not assignment. Scroll down, please. So, ordinance intent, it's going [1:06:43] to be the same as what we uh viewed earlier for Dila's wall sign. Um, you [1:06:48] know, the we're recognizing the safety, commercial, and emergency and [1:06:51] informationational needs, right, for the signs. This is clearly falling within [1:06:54] that within that intent that you know we need to make sure emergency [1:06:58] andformational needs are satisfied right and that's what they're requesting that [1:07:03] variance for. Um it's intended to enhance properties uh property values [1:07:08] which this will right Methodist has a very strategic plan to make sure that [1:07:12] they keep continually enhancing their property and signage is just part of [1:07:15] that plan. Uh maintains the aesthetic attractiveness which this does. It's a [1:07:20] very modern update. Um and it promotes commercial opportunity not necessarily [1:07:25] commercial opportunity but you know um enhancing to make sure those people come [1:07:28] and and view the hospital uh with ease right it supports the objectives of what [1:07:33] our master plan has on so I did not have any responsive [1:07:40] requests to this property right we sent it to two 200 foot notice to everybody [1:07:44] within that area uh no phone calls no responsive letters mailed back to me but [1:07:51] you This is something where there's undue hardship to [1:07:55] a property that serves a more purpose than most of our commercial properties, [1:08:00] right? It is a emergency service that is provided to the city. It is an undue [1:08:04] hardship that's placed on them. Uh, Methodist is explaining that this is a [1:08:09] compliance issue as well that emergency vehicles need a certain limit, certain [1:08:14] requirement for their signage. So, these emergency vehicles, EMS, fire, police, [1:08:18] whatever it is can access their property and navigate with ease and it just helps [1:08:23] the visitors as they need to go there as well. Um, so recommendation from staff [1:08:28] is to approve this variance for both directional and monument signs. I think [1:08:33] that's my last slide, right? [1:08:37] So once we get into discussion, I'll be happy to answer any questions. [1:08:46] » Is Mr. Shell and Dodson here with us? >> Oh, yes. Oh, [1:08:53] » so before we do that, you need to close the public hearing state. [1:08:58] » The time is 609 and we're closing the public hearing and begin receiving [1:09:03] public comments from Mr. Johnson read yes [1:09:10] the board will consider an act of variance applications submitted by [1:09:14] Johnson of executive signings for the property located at 6700 [1:09:20] highway 10 west heights Texas 7201 requesting variances of sections 150.2 [1:09:28] commercial businesses and sections 153.127 [1:09:32] BD and 15324 BD [1:09:44] was your name again sir Jacob Jacob Dawson [1:09:48] mic [1:10:02] Jacob Johnson with Executive Science. [1:10:14] Anyone have any comments? [1:10:28] My concern would be blocking the traffic, the view of the [1:10:34] traffic at intersections, particularly on one and 13 when you're [1:10:40] pulling out in front of the access road there. [1:10:44] It seems like limited vision. [1:10:51] » Have y'all considered that? >> Well, so are you talking about on the [1:10:55] front edge road of I 10, [1:10:59] » right? >> That right there. [1:11:00] » Right. >> Well, I mean the there's a setback that [1:11:02] goes up along the property line for the signs to go with. So really the only [1:11:07] people that it would go is when they're leaving, but it would be set back enough [1:11:10] where they can see shouldn't. >> How far back would it be set back? Um, I [1:11:15] need to check to see how far we have it set off, but the existing one is within [1:11:20] where it should be. And then the second one would be at least that far back. [1:11:25] Let me clarify a little further. Right. So, um, we see the existing one right [1:11:29] there. Um, as you're pulling in, there's no obstruction to view for that traffic [1:11:33] on the frontage road. Uh, the road directly behind it is going to be your [1:11:37] exit road. Um, you can see oncoming traffic. It's set back enough where [1:11:41] you're able to see, right? Let's go down to that bottom one. [1:11:47] Maybe [1:11:50] is in the original. [1:11:58] » It was down. >> Oh, did we skip it? Go. Go back the [1:12:01] other way. [1:12:13] that one more. >> Yeah, there we go. That one. So, um, [1:12:17] this one's going to be your exit, right? There. There's no need to view to the [1:12:20] right as your [1:12:25] or not. [1:12:30] Hey, Dave. Dave, turn to Michael. [1:12:36] Just worried about the [1:12:41] the view the sign blocking your view of oncoming traffic as you're pulling out [1:12:46] on number nine. >> This one I'm looking probably 20 25 foot [1:12:51] setback from the main road. So that's what you're looking at on your left of [1:12:55] your screen there is going to be crossroads [1:12:58] boulevard and then at the bottom of your screen right there that's going to be [1:13:02] Denny Lane which is private access road. It it's not set back very far from Denny [1:13:08] Lane but it not a city rightway street, right? So, we can't really regulate that [1:13:12] setback crossroads. We're well within the setback to make sure that it's not [1:13:17] obstructing any view there. >> There's an existing sign there. [1:13:21] » There is an existing sign there. Yeah, >> that's the only really questions I had. [1:13:25] All the concerns I had. [1:13:30] » May I be recognized? Of course, Mr. Gillian. Go ahead. Uh, first of all, I'd [1:13:34] like to say Dave uh beat me to the gun on that one because that was my concern, [1:13:39] too. Line of sight to uh oncoming or crossing [1:13:44] traffic to the hospital to the hospital. But after going back and looking at the [1:13:50] pictures again, it looks like line of sight will not be a problem. We have [1:13:54] more bushes in our city that block site than this sign will ever do. Um, so I [1:14:01] think it's u I think it's going to be okay. Um, [1:14:05] what we have to realize if we change if we change this to six feet [1:14:13] it it's not a legal change of the code but people will be asking for more [1:14:19] variances on it but I I don't think this one this one in itself is a problem. [1:14:24] Thank you. I think there's maybe two or three [1:14:28] properties in the city that have directional signs. Um Methodist being [1:14:32] one. Um and it's going to be your drive-ins, right? Or drive-through, [1:14:36] sorry, drive-through restaurants. So Chick-fil-A, that one's going to be [1:14:39] another one that has directional signs. Um those are the only ones that really [1:14:43] provide any um desire or kind of need to have them, right? But this, like you [1:14:49] said, Mr. Gill, this one's kind of a little bit different of a situation, [1:14:52] right? It's a hospital where we're serving those needs for um emergency [1:14:57] services, not you know commercial needs. Right. [1:15:01] » I have one more questions please if I may. [1:15:04] » The sign the sign itself excuse my voice. [1:15:08] » Yes sir. >> I'm working outside today and a lot of [1:15:09] that pollen got in my throat. [clears throat and cough] [1:15:12] » The sign itself is an inert sign. It's not a video sign. [1:15:16] » No sir. >> Is is it a lighted sign? [1:15:18] » It's it's internally lit. The two monuments. Yes sir. [1:15:20] » Yeah. So it is a lit sign which you you have to have at night anyway. [1:15:24] » Yes sir. >> Thank you very much. [1:15:25] » Yes sir. [1:15:30] » May I have the floor? >> Of course. [1:15:32] » Lamar just in response to [1:15:37] your concerns about other [1:15:42] uh future complaints. I spent five years on planning and [1:15:47] zoning. The entire five years I spent on planning and zoning was spent on signs. [1:15:54] Fortunately, I got out before the final outcome. [1:15:59] Uh but it was a battle from day one as to the location and the sign and the [1:16:07] size and it and it's a it's been an ongoing issue forever [1:16:15] and it really needs to be revisited and and I think a lot of variances [1:16:21] should be allowed. With that said, I don't have a problem [1:16:26] with these signs. [1:16:34] May I be recognized? >> Of course. [1:16:35] » I'd like to call a motion to call the question. [1:16:39] » Second. Call the motion to the question. [1:16:45] » We we have now no one person can call the question without a vote of the [1:16:51] governing group. So, we need to go and ask for a vote to call the question [1:16:55] because what this does, for those that don't know, it stops all discussion [1:16:59] about this particular item that's on the agenda. [1:17:03] » So, my motion is to call the question. [1:17:08] » Motion to vote. Motion vote. I'm going to make a motion to pass. [1:17:16] Yay. >> Thank you. Hey. [1:17:26] passes. >> Okay. Now you can call for a motion to [1:17:32] approve or disapprove because all discussion has stopped. [1:17:37] » Motion to approve or disapprove. >> Make a motion to approve. [1:17:42] » So make a motion to approve. Second. [1:17:48] » Copy the vote. >> Okay. Motion to vote. I thought we just [1:17:51] did. >> Oh, [1:17:54] I'm I'm lost. >> I thought we just voted on stopping the [1:17:58] discussion. And now we need >> We need to have [1:18:00] » I'm the person that got lost. [laughter] >> Now we need the motion to approve or [1:18:05] disapprove. And you have a motion on the table to approve and and you just [1:18:09] second, I believe. >> Yeah. Okay. My vote is yay. Okay. [1:18:13] » Yay. Yay. >> And yes. [1:18:22] I've been so used to having everything on record to make sure everyone hears [1:18:26] their part and go by the line. My apologies. [1:18:30] » So you can uh call for adjournment because you finished your book of [1:18:33] business. >> Okay. So call for adjournment. [1:18:35] » Motion to approve to adjurnn. Second. [1:18:40] » Second. >> Yeah. [1:18:44] » We we have to vote on it. Okay. >> Is a motion on the table? I [1:18:48] » I >> I The time is 6:19.
