[4:10] council. [4:23] Um, by the way, like I just attempted and um, when you're speaking tonight, if [4:28] you could actually if you do speak, just remember to turn your microphones on. Um [4:33] first part of this is uh for the village of council uh village of Battavia [4:38] council August 10th 2020 public hearing zoning um [4:44] zoning amendment and go ahead. Do you want to take the role for the zoning [4:48] amendment? >> Mr. Owens. [4:51] » Yes. >> Mr. Zagar [4:54] » here. >> Mr. Dorsy [4:56] » here. >> Mr. Smith [4:58] » here. >> Mr. Stton [5:00] » here. >> And Mr. Wilson [5:02] » present. >> And what I'm going to do is I'm we're [5:04] going to actually say the pledge of allegiance for now and in also the the [5:08] council meeting is everybody can rise currently face towards the flags and so [5:12] we can have the pledge of allegiance and Mr. Wilson, can you lead us in that, [5:17] please? [5:24] » To the flag of the United States of America and to the republic for which it [5:29] stands, one nation under God, indivisible, with liberty and justice [5:34] for all. >> Thank you, Mr. Wilson. [5:38] » And also thank you to all the veterans in this room. and thank you for all our [5:42] active duty and retired uh for everything you've done for our country. [5:46] God bless you, >> Chip. [5:50] » Good evening. [5:55] » So, this is a public hearing for a text amendment to our zoning code. Uh it has [5:59] to deal with the planned unit development uh final development plans [6:03] and the final authorization for the acceptance or denial of that. uh [6:09] previously and under the current code, the final determining [6:14] uh entity is the planning and zoning commission. Uh with the update to the [6:19] zoning code, it will fall back on to council. So there'll be an extra step [6:25] and the final development plan with the final approval being by council. [6:30] And that's pretty much it in nutshell. Does council have any questions? [6:37] Council, we have any questions? [6:45] » Okay. Any questions from the public or [6:49] statements from the public? [7:00] » Can I take the Can I take that to her? [7:24] If I if I wanted to find out where these documents are to read them to see what [7:30] the actual text amendments are, where do I go, Chip, to find that [7:36] They're chapter 1132 under the zoning code. Um it's all under planned unit [7:43] development. So it's the whole chapter on planned [7:46] unit development was revised. >> There'll be new amendments added to the [7:49] existing book and then the others will go away. [7:52] » Correct. >> Yes. This this will supersede those. But [7:56] of course the zoning in effect at the time is the zoning that has to be [8:00] honored. So this is going forward. Any [8:09] other any other questions from the audience? [8:17] » I don't think I need a mic loud enough. >> But it [8:25] » No, it's it's overall it's just a standard review process. We're just [8:29] adding that last step to it. [8:37] The whole purpose of this was to put the control on particularly on planned unit [8:43] developments because they are so large and impactful onto council and take it [8:49] out of the committee's hands. [9:02] There are no other public uh comments. We'll close the public hearing 1905. [9:10] Is there any discussions by council? [9:19] That being said, uh we need a council vote to approve the text amendment for [9:23] chapter 1132 plan unit development final development plan uh approval process. [9:30] Um Mr. Owens, >> yes. [9:35] » Miss Zagar, >> yes. [9:37] » Mr. Dorsy, >> yes. [9:39] » Mr. Smith, >> yes. [9:41] » Mr. Stton, >> yes. [9:43] » Mr. Wilson, >> yes. [9:46] » It's approved. We will adjourn the meeting. Is there a [9:51] motion to adjurnn? >> Some move. [9:54] » Second. >> Owens. [9:58] All in favor? >> I. [10:00] » All opposed. 1906. [10:13] » All righty. This is the call to the order to the [10:18] Betavia Village Council. This is the agenda for the regular council meeting [10:21] Monday, August 10th, 2026. We have already done the pledge. Um, can [10:28] you do roll call, please, sir? >> Mr. Owens [10:33] » here. >> Mrs. Zagar [10:35] » here. >> Mr. Dorsy [10:37] » here. >> Mr. Smith [10:38] » here. >> Mr. Stton [10:40] » here. >> And Mr. Wilson [10:42] » here. Time is 7:07. [10:46] » Thank you, sir. The agenda item that was uh the commendation, the they're not [10:51] here, so um might have to wait till the next council meeting. [10:57] So, we'll move right on to the public comments. We actually we have uh two uh [11:02] public comments are public particip excuse me participation during this [11:07] meeting is welcome and and conducted in the ordinance with the Ohio law [11:11] including Ohio revised code 2917.12. All attendees are expected to engage [11:17] respectively and avoid any conduct that disrupts or interferes with the orderly [11:22] conduct of the meeting. Individuals wishing to speak should follow the [11:26] established procedures and be recognized before uh addressed by the body or the [11:31] council. Failure to comply with uh may result in removal or ensure the meeting [11:36] u proceedings in an orderly manner. Persons wishing to make comments will be [11:40] limited to three minutes each. There will be a limit of 30 minutes total uh [11:45] minutes for the public comments. First person is Mr. Gallagher. [12:06] It may be timed out. All right. How's that? [12:09] » All right. Chuck Gallagher, Claremont County Airport. [12:12] Uh, first of all, the website, some nice, pretty pictures. Uh, [12:17] fundamentally, I can't [12:28] It is useful. [12:47] I like [13:07] comments on the index policy. [13:22] in the past. [13:43] 49. [14:09] I guess we're all familiar. [14:15] 2018 [14:26] I think your annexation policy. [14:52] I was there last week [15:10] by the end of next year. [15:16] Also, also for the county [15:22] right across the street 650. [15:36] » Hey, uh, Chuck. >> Thank you, [15:38] » Chuck. When's the So, when's your, uh, growth plan meetings? When do they [15:43] normally happen? >> I'll let you know. [15:46] » Okay. >> Okay. [15:52] » Okay. >> Thank you. [15:55] » Thank you, sir. [15:59] Mr. Condo, let's do a change out on the microphone. [16:04] Thank you, sir. [16:08] » Two. We'll see how it goes. Um, so first of all, I just want to thank Wayne and [16:13] his crew for always being awesome. I put a bunch of brush out and I came home the [16:19] next day to a uh empty road, so they must have swept it up and everything. [16:24] So, uh, continue to be impressed by the service that I get from the public um, [16:29] employees here. So, appreciate that. >> Thank you. [16:32] » Um, ironically, also want to talk about the website. So, I've been up here a [16:37] couple times this year. I think if I remember right, I think of February is [16:40] the first time I came up. [clears throat] Just letting you guys [16:43] know where the accessibility for the website stood. Um, you know, I come from [16:46] a expert opinion on this. This has been my career for 25 plus years. Um, I'm not [16:52] looking to get any extra work. I'm not doing any consulting work. So, I'm just [16:55] recommending uh that you guys spend some effort here, but it won't be with me or [16:58] at least if it if it is, you're not going to pay me any money. I'm willing [17:01] to give some of my time if that's what it takes. [17:05] Um, I was excited to see that we had a new website. Uh, I was less excited to [17:09] see that it actually scores worse on the accessibility uh standard. So, it's [17:13] actually a 42 now out of out of a 100. Um, I realized that if you don't know [17:19] the standard, it's hard to meet it. So, what I asked for tonight is just engage [17:25] some expert somewhere to please help. Um, I turn reduce motion on on my [17:30] browser and I'm with a video that moves at the very first thing I see on the [17:34] website. That should not happen. I get sick of motion, [17:40] right? So, the importance of a website today is just as important as this [17:44] physical building. You have more people walking through the front door of the [17:46] website than you do of this building. Everybody that needs to have access to [17:51] the website, it needs to work for them, right? This is table stakes in 2026. So [17:56] please, whatever you do, whoever you engage, find somebody knows what they're [18:00] doing and please improve it and I'm willing to to meet or talk offline if I [18:05] can be of help there. No cost. Okay. Um these are basic basic things. [18:10] Secondarily, I was going to mention what actually Chuck happened to mention is [18:13] there's no documents on there. It's just not it's just not acceptable. It wasn't [18:17] ready to go live apparently. Um, it should have been it should have been [18:21] delayed until those documents were up there because I I remember earlier this [18:25] year there was a resolution passed that the agenda would be posted to the [18:28] website prior to the meeting. You didn't meet that and you knew ahead of time, [18:34] right? I don't think this is a surprise to anybody. So, please spend the time. [18:38] It's important. More people are going to visit the website than walk through that [18:41] front door. Thank you. [18:46] » Thanks, sir. [18:52] fiscal sir. >> Good evening, village residents and [18:57] council. Um, do we have a approval for the amendments for June 13, 2026? [19:06] » Make a motion to approve the minutes. [19:11] » Okay. And that's [19:18] Can she speak? >> Absolutely. [19:20] » Well, hold. Do you want to wait till my my part? [19:24] » No, no, no. [laughter] >> Because you were the historical [19:28] president. You're the historical president. So, whatever you want to do, [19:32] you would since you're the historical president. [19:35] » Absolutely. >> We'll pause. [19:42] regular complaint. [19:46] » Uh my name is Kelly Wright. I'm uh the president of the Claremont County [19:51] Historical Society. We're new residents here uh in the building. And I just [19:55] wanted to invite everybody here on council and the audience to mark your [20:00] calendars for a couple of dates. The first is Sunday, September 20th. Um, we [20:06] are participating in the Ohio Open Doors program. That is a program offered [20:12] through the state historic preservation office. We are trying to get the state [20:17] to pay attention to some of our lovely real estate here in the village. And if [20:22] we get our foot in the door with this program, we have an opportunity to bring [20:26] historic preservation specialists who normally if you had to pay out of pocket [20:30] to get people like that to come down and look at your house, your property, and [20:33] say, "Hey, what do I do with this?" or I have this substrate, what it would be uh [20:38] just ridiculously expensive, but we're we're trying to get our foot in the door [20:42] so we can bring those experts down at other occasions who would make their [20:46] services available free to village residents. Um that program will be from [20:51] uh 2:00 to 4 on that Sunday. We will have the armory open. We will give a [20:56] presentation of our newly refurbished space in here that [21:01] we're working very hard on. and um we will offer refreshments and that program [21:06] is paid for by the Ohio State Historic Preservation Office. Uh on October 3rd, [21:12] we are lucky enough to have uh the Ukrainian violinist Dr. Andre Isakov, [21:17] who is a professor of violin at Ohio State University. He's going to play a [21:23] program for us. I do not have the entire program yet, but the folk piece that he [21:27] has chosen um for his performance at 7:30 on the night of October 3rd is [21:33] Yankee Doodle. Um he's also asked if we have a piano here, and I was very happy [21:38] to say yes, we actually do have a very nice Baldwin piano here. So, I believe [21:44] he's bringing a pianist with him as well. And uh we're going to have him [21:48] evaluate our uh historic violin made here in Claremont County while he's down [21:51] here. Um, I also wanted to mention as a an aside that um I concur with the [21:57] gentleman's comments uh earlier uh about the friendliness and helpfulness of the [22:02] officials and staff of this village. I've lived here for 26 years. [22:08] They haven't always been friendly. They always haven't always been open-minded. [22:12] This is the friendliest climate that I have seen, the most helpful climate that [22:16] I've seen in this village. And it fills me with a tremendous amount of hope. um [22:19] not just as a resident but as a property owner here. And um on the subject of [22:25] accessibility um I teach online and in person and I [22:31] have to have 100% compliance in my courses on accessibility. I would be [22:36] happy to work with you and see if we could make use of some of the resources [22:40] with University of Cincinnati to make sure that we're in compliance on our [22:45] website here uh because they are a juggernaut of this process. Uh but I've [22:50] been I've been making my courses compliant for two decades before it was [22:55] mandated. Okay. So, I understand what you're saying. I believe in it. It's [23:00] possible. It's a pain in the ass. It >> is a total pain in the ass. [23:06] But I'll help you on My name's Kelly again. I will help you on it because I [23:09] do fundamentally believe in it and it's just it's hard to find the resources to [23:14] do it unless you really really work at it. So anyway, that's that's my [23:20] stickick. That was more than two minutes. I apologize, but anyway, I just [23:23] wanted everybody to put that. >> Hi, Kelly. I just wanted to thank you [23:26] guys for putting on the um the [clears throat] performance that we had [23:30] a couple weeks ago for the Fourth of July with the orchestra here, the [23:34] community orchestra from women. >> It was fun, wasn't it? [23:36] » It was really nice and uh we had there was a great crowd here and um I just [23:40] really appreciate you guys getting that organized. [23:42] » Thank you. That is a 40 piece band and the two people I talked to to schedule [23:46] that met in high school band at Williamsburg High School when they were [23:50] teenagers and they've been married 70 years and they're still playing [23:53] together. Thank you. [23:55] » Anyway, thank you [23:59] » again. Sorry you wouldn't wait for my part, Kelly. [24:04] » Sorry, you're good. Yeah, I'm kidding you. But thank you. And I just wanted to [24:08] say like I said uh today to the historical society. Welcome again. And [24:13] again, it's it's our honor to have you here and I just wanted to say thank you. [24:18] » So, just let you know. God bless you. >> Okay. [24:24] All right. Um, I got a motion for Mr. Owens and a second. Was that Mr. Wilson? [24:30] » Yes. >> Okay. By roll. Mr. Owens. [24:33] » Yes. >> Mr. Wilson. [24:35] » Yes. >> Mr. Stton. [24:38] » Yes. >> Mr. Smith. [24:39] » Yes. >> Mr. Dorsey. [24:42] » Abstain. I wasn't here. >> And uh, Mr. Zagar. [24:46] » Abstain. >> Perfect. Now on to the July 2026 bank [24:51] reconciliation. Uh, do I have a motion to approve the July 2026 bank [24:56] reconciliation? >> I'd like to motion to approve the 2026 [25:01] uh July 2026 bank reconciliation. >> And do we have a second? [25:07] » Okay. And by roll, Mr. Smith? >> Yes. [25:11] » Mr. Wilson? >> Yes. [25:13] » Mr. Stton? >> Yes. [25:14] » Mr. Dorsey? >> Yes. [25:16] » Mrs. Zagar? >> Yes. [25:18] » And Mr. Owens? >> Yes. [25:21] All right. We [clears throat] also have uh new [25:25] business resolution 36 uh 363-26. Uh the resolution is the authorize the [25:32] purchase of uh the assembly of the street department costing authorization [25:39] of uh the village administrator and fiscal officer to obtain financing for [25:44] the assembly and execute all documents related to the purchase and financing of [25:50] that assembly with the chassis. [25:57] Do I have a motion to approve 36 363-26? >> Any questions? [26:03] » Or if there's any questions, I did negotiate the interest rate down. I will [26:08] throw that out there down to 5 a.5%. So, and it'll be similar to the one that was [26:13] in 2022. [26:19] » And do I have a second? >> I'll second. [26:23] » Okay. And by roll, Mr. Wilson. >> Yes. [26:27] » Mr. Owens, >> yes. [26:30] » Mrs. Zagar, >> yes. [26:32] » Mr. Dorsy, >> yes. [26:34] » Mr. Smith, >> yes. [26:36] » And Mr. Stton, >> yes. [26:38] » Thank you. All right. Um, proclamation number [26:44] 0001-2026. [26:47] Mr. Stton, did you want to read this again? [26:53] » Okay. Would you like me to read it? >> Or do we need to read it? [26:59] » Okay. [27:10] » The short form, right? >> Yeah. I'm just going to read the [27:14] statement. >> Yeah. Um proclamation number 001 uh-2026 [27:21] the proclamation expressing the policy goals of the village of the Betavia [27:26] um regarding development tax abatements and exations and coordination uh with [27:32] local taxing authorities and you see you can you can actually [27:37] everybody has a copy you can read it verbatim as as uh as you can read [27:41] through that and I'll just add a little bit on Um, [27:46] this is pretty much what council has been stating since January of their [27:52] their goals and their different views on annexation compared to the previous [27:57] council and it encompasses that as much. We can always explore the type one [28:02] annexation at a later date. But um, the type one is very very difficult because [28:08] of changes in the law and we haven't done it in over 10 years. I believe Mr. [28:12] Moore >> at least at least 10 years. [28:21] I'm just going to go ahead and read the um I'd like to read the end. Be it uh [28:24] further proclaimed that the village clerk is directed to transmit copies of [28:28] the proclamation to the Bavia local schools uh direct um district uh board [28:34] of education, the central joint fire EMS uh board uh the Betavia trustees, the [28:40] Claremont County Board of Commissioners, Claremont County Port Authority and [28:44] other um interested governmental entities as evidence of the uh village [28:49] uh commitment to COP uh cooperative I'll read that and cooperative planning, [28:55] responsible economic development, and physically sustainable growth. [29:01] Sir, >> do we have a motion to approve [29:03] proclamation 0001-2026? [29:10] » And a second. >> Second. [29:13] » Okay. By roll, Mr. Wilson? >> Yes. [29:16] » Mr. Dorsey? >> Yes. [29:17] » Mr. Owens? >> Yes. [29:19] » Mrs. Zagar? >> Yes. [29:21] » Mr. Smith? Yes. >> And Mr. Stton. [29:24] » Yes. [29:27] » Excellent. Old business. Second reading. Uh just [29:31] the village of Betavia ordinance 1574-26. [29:34] This is the ordinance creating rules and guidelines for the operation of underse [29:39] low-speed and utility vehicles within the village of Betavia, Ohio. And that's [29:43] for Harvest Meadows and Streamside. [29:51] Okay. And then uh Chief Williams, >> Chief Williams, you'd like to step [29:57] forward and give your report, Chief. >> Thank you. [30:09] » Mayor, council, uh this is your July 2026 [30:13] uh council report. Uh there was only one event uh for the police department uh [30:18] which was the America 250 event. um which was a huge success and we did not [30:24] have any interactions or police actions during that event. [30:28] » That's awesome. >> Uh the numbers for the month, we had 268 [30:31] calls for service. There are 57 traffic stops, 13 citations, 44 written [30:37] warnings, 14 crash reports, three arrests, two warrants served, 20 [30:43] incident reports, three offense reports. There were 36 public records requests. [30:48] There were 13 mutual aid requests and there were 155 blockheads. [30:55] Does council have any questions? I I just have a quick comment that I [31:00] love that that we're not like a a speed trap that people are going through. I [31:07] love the fact that there are 44 written warnings and only out of the uh traffic [31:11] stops, you know. I just want to make that I like that. [31:18] Well, thank you, sir. [31:29] Yeah, our jobs are trying to uh to change people's outlook on speeding, not [31:35] necessarily to make them spend money out their pockets. So, if uh writing written [31:40] warnings will help, then we'll write written warnings. So, [31:45] » any other >> any other questions? [31:48] » Any other questions for Chief? >> Thank you. [31:51] » And thank you for everything you and your department does for the village. [31:55] Thank you, Chief. [31:58] » Mr. Moore. >> Thank you, Mayor. Uh, in the last month, [32:02] my office was quite busy with matters relating to the village. Um, some of [32:07] which people in the audience may have heard about. Um, I do want to ask [32:11] council if we could have an executive session at the end of the meeting [32:15] pursuant to Ohio Revised Code section 121.22 [32:20] G3. That's to meet with legal counsel to discuss pending or eminent litigation. [32:26] U, there's no request for action to be taken. So, we can do it later rather [32:30] than have the crowd sit here while we meet. Um, so I would ask for that later. [32:35] Uh the only other thing of of note in the last month that took place was we [32:39] did have a meeting with the court on the CRT zoning violation matter. Uh we had [32:45] previously mediated the case and thought there was potentially a framework that [32:49] could be discussed to move forward toward the possibility of resolving the [32:52] condition of the property. Um and as is uh of note in relation to that property, [32:58] um promises were made and then promises could not be followed up on and that's [33:03] not by the village. Therefore, uh we've asked the court and Judge Brock was kind [33:08] enough to get us on his schedule and we are set for trial in November. There [33:12] will be a trial in November. At that point, um it will be a request from me [33:18] as the solicitor for the village uh for in the event that we are successful [33:22] final orders with respect to the condition of the property. There is [33:26] currently a permanent injunction on the property. So, it would simply be a [33:30] matter of uh should we succeed in order to allow the village to go in and [33:34] remediate the multitude of vehicles currently parked on the property. Um [33:41] those are the things my office took care of in the last month uh that are a [33:45] matter of public discussion that are not attorney client privileged. Thank you. [33:51] » Any questions for our solicitor? [33:56] Hearing none. Thank you, sir. Thank you for all your work. Zoning Administrator [34:01] Chip. [34:05] » As far as the zoning goes, uh we have a total of 200 permits uh registered so [34:10] far this year. Uh streamside new homes are at 28 and Harvest Meadows is at 74. [34:17] We're currently working on 11 active violations, uh which two are in the [34:21] court process. um that we currently have no planning and zoning commission cases [34:27] scheduled. Um as far as the administrator side, Maddox Industrial [34:33] Transformers is sponsoring another music on Main tomorrow night uh in the Kathy [34:38] Turner Park right here next to the building. I did speak with a developer [34:42] of the Harvest or the uh Riverpoint Apartments. Um they are going to be [34:47] starting within the next week marking where the buildings are going to go and [34:52] they hope to start moving more dirt to the site uh soon afterward. Uh he did [34:58] advise that with the amount of dirt that they needed to bring in, it may take two [35:02] to three months to bring it in and move it where they need to move it. [35:08] No update on the streamside rental properties. uh Betavia Schools, they [35:13] continue to support our commercial development. Uh the school was happy [35:17] with the progress on the park that we've made on Broadway. Uh if you haven't been [35:21] down there, we did create a full circle walking path now. Um so you can actually [35:26] walk around the property without having to go in the grass or on Clark Street in [35:30] the back. Um and it's uh few people that I spoke to out there are u really [35:36] enjoying it and they like that it's there. Um, [35:39] no updates with UC Claremont. Uh, I did speak with Casey's. Uh, they're moving [35:44] along on the construction. Uh, they were ran into some delays with pouring the [35:50] footers for their canopy. They had hoped to be open by the end of September. Uh, [35:55] but it looks like it's probably going to be mid October before they open. Now, [35:59] um, still working with the engineering firm for the final engineering for the [36:04] foundry sidewalk grant. uh the Herald Road interchange, that project has been [36:09] completed. Um I didn't receive any response back [36:14] from Norton Signs on when they plan to start the construction of the sign there [36:19] at the uh Red Barn property. Um public works, they started clearing the [36:26] riverbank area of the the low brush and everything. It's they've done a great [36:32] job and went really quick to get that done to start working on that park [36:36] project. Um Wayne, I did have one question for you. You know when they're [36:40] start supposed to start the paving project? [36:44] » Yeah, it's >> I hadn't heard either. Still waiting on [36:47] the start date for the pave road paving project. And that concludes my report. [36:55] take just in case the people wanted to know, do you want to say where that [36:59] paving project is going to be at? >> Um, yeah. I'm not sure what area it is, [37:03] but it's up Shelly Drive and up that area is where most of the roads will be [37:07] done. There are some spots in a couple of other roadways that are deteriorated [37:12] that are also going to be fixed during that paving project. [37:15] » Okay. Thank you. I I also have uh so I just want to make [37:20] a comment. So on Herald the Herald Road, uh boy, we need to do something there, [37:27] you know, as far as the the people trying to leave uh on Herald Road and [37:31] get on the 32 or uh we need like a turn lane. We need something needs to be done [37:36] there. Uh especially even trying to slow down if you're going uh westbound on 32 [37:42] towards Herald Road, trying to turn right, there's no turn lane there. and [37:46] uh something needs to be done there to uh h how do we how do we get the ball [37:51] rolling on that because that's uh public safety. And so the original plan was [37:57] after this improvement was made to look at grant funding through the Ohio [38:03] Department safety grant to do an acceleration and deceleration lane on [38:08] both sides of 32. [38:13] Is there anything we can do to speed that process up? I mean, do we u It is [38:19] pretty dangerous up there. I' i've driven up to both neighborhoods. Uh but [38:23] especially um that one it is scary to uh get off the highway there, especially [38:29] during traffic time. Um so I also have a concern about um what we're doing to [38:36] make that better or how we can maybe expedite that. [38:45] Yeah, I have a question. It was already brought up by the public about the [38:50] agenda not being posted online in the and the previous minutes. I understand [38:57] the discussion this past week that was supposed to be taking place. is could we [39:02] get a timeline on when we're going to get into a routine of putting the [39:08] information up there for the public? [39:13] » Yeah, I spoke with uh John today um about that and they are they have a [39:20] bunch of line items that they're still working on to finish up on the website [39:23] and that's part of it. Um, he did get the mid or the agenda [39:30] on Friday that I sent him, but that portion of the website, [39:36] I don't know if he didn't have it completed or or what, but it didn't get [39:41] put up there. That's why I sent Mr. Gallagher the uh [39:45] agenda today. >> Yeah. And and that's also another thing [39:48] of when the uh the motion was approved back earlier in the year, January or [39:54] February. Um I know there was discussion of [39:58] setting up a time frame for the agenda to be completed, not just for the [40:03] public's benefit, but for council's benefit so that we have time with it. [40:08] Could we get it up by w by noon on Wednesday of the week before the meeting [40:13] so council has at least a day and a half to look it over and recommend any [40:19] changes before it gets posted for the public. Please [40:27] well and I apologize to everybody for the agenda. I was not I again the agenda [40:36] it falls on me when the agenda does not get um put onto the website. Um but I [40:42] thought and again I might be wrong. I thought the agendas went out to the [40:46] council on Wednesdays. Did they go not go out to the wind? You [40:50] might want to because I thought they did. I'm sorry. I might be wrong on [40:53] that. [40:56] » Yeah, I sent it out on Wednesday. I try to start it right with you on Monday. So [41:02] I don't um I mean I can go back and look at the [41:06] emails and send them out again uh to show everybody the time stamp, but I try [41:10] to get it out. >> That's not the situation. It wasn't [41:12] complete yet. >> There was still a very preliminary [41:16] agenda at that point. >> Gotcha. [41:19] Yeah. A lot of times, like I said, I apologize. We'll try to get the um get [41:23] this done, especially with the website. It's so still in its infancy. I just [41:30] remember it's what just last year we just started to do have our own website [41:35] um as of last year. So we are it's it's still moving forward but again I'll make [41:41] sure that that agenda gets on there for the next meeting. Definitely. Uh Scott, [41:47] are you okay if I just give a small update about um the website and uh there [41:52] there's a small committee that's been working on that? [41:54] » Yes. Um and uh this was um uh topic of conversation at our last meeting to make [42:03] sure that these things were up. Um so uh correct uh I'm sorry that that did not [42:07] happen. Um however uh couple of things to look forward to. There will be a form [42:12] on the website in the near future. Um we'll have um a notification system uh [42:18] with like email and text message that businesses and residents can sign up [42:23] for. Um that way when we get the minutes done, we can email them to you. Um and [42:30] uh any other pertinent information that needs to be sent uh to let businesses [42:34] know maybe there's, you know, something going on in the park or whatever. So, [42:38] um, that should be happening in the next week to have those forms up hopefully by [42:42] the next at least the next, uh, council meeting. So, um, you know, there's lots [42:47] of exciting things happen. We're trying to make things more available and, you [42:50] know, show up on your phone for you. Um, it just takes a little bit of time to [42:55] get everything up and going. So, uh, thanks for your patience. [43:00] Thank you. Thank you, council. Okay, [43:06] this is my part. Um just a couple announcements and I need council's help [43:11] with this. Um September 26th is a yard ta sale um for this year the yard sale. [43:16] Is there a time and date you want to do that for? [43:22] Any any dates? We usually did it after >> third weekend. [43:27] » Third weekend >> right after [43:29] » unless you wanted to change it. I don't I know we talked about doing it the day [43:32] of fun fair. We never want to do that. >> We never want to do that. [43:37] Correct. >> So, we'll What date is that? So, the [43:42] third [43:46] » I'd have to look that up. I'm sorry. [43:51] » 18th. Thank you. Is that all right with council making it the 18th? [43:56] » Sure. >> Which is on a Friday. Thank you. [44:03] Yeah, that's a 20 27th, isn't it, Sherry? [44:09] » Yeah, I think it's 27th or 28th. >> Um, next item up for bid Halloween [44:16] trick-or- treat. I remember once I did a early and I had my patus handed to me [44:23] for that one. Um, sorry. I didn't mean to say petucas for those who didn't want [44:29] to hear that. Um, so do you want to make it from 6:00 to 8 [44:34] again on the 31st? >> Yes. [44:39] » I just want to make sure >> 6 to8 is that all [44:45] that >> you will be haunted. [44:47] » I know. I know. Great time to be haunted. October. [44:50] » Has a township set a time. Same thing. The 31st, right? [44:55] » 31st. >> Yeah. [44:56] » Okay. Perfect. Thank you. >> So, the 31st is everybody from 6:00 to [45:00] 8. >> Yeah. [45:03] » Okay. Christmas Eve in the village. [45:08] » Any ideas when you would like to What was our What was our date for the [45:12] Christmas last year? [45:18] » First Friday. Do you want to keep it the first Friday in uh No, wait a minute. [45:23] Williamsburg. Does anyone know when Williamsburgg's [45:28] because it usually that was a conflict? >> And I don't want to be on the same [45:33] schedule as Williamsburg this time. I'd like to be separate from them if that's [45:37] » we don't have to decide right this second. [45:39] » No, we don't. >> We could look into that. Look into that [45:42] and make sure that that date works. >> May not have set the date. [45:45] » They might not have. And that's just something that maybe the next council [45:49] meeting if we or you can just send in or text in what you what dates you were [45:53] looking at. >> That's all right with you. [46:05] Christmas in the village. >> I don't [46:12] » Okay. >> Yeah, I'm gonna have to check to see [46:15] what date. >> Okay, I'll check with that. [46:22] Okay. >> Yeah, I think they said it was December [46:25] 5th. I think it's a Saturday. >> December 5th. And evidently, um, [46:32] Bruce has already scheduled some of the stuff for that. [46:36] » Okay, >> there you go. I think it's going to be [46:39] September 5th then. >> December, [46:42] » I'm going to see December 5th. Uh, times [46:50] » that >> we had it from four [46:54] to eight. [46:59] Right. If I remember, people showed up a lot earlier. [47:06] » Five to nine. Is that all right with the council? [47:10] » Okay. >> All other concerns or considerations [47:15] from the village council. I just like to if nobody's gone by the [47:20] work along the river and seen what the village is clearing out down there and [47:25] the views that you're starting to get of the of the river and you can see where [47:31] the walk's going to be. It's really going to be a beautiful place down there [47:34] when it gets finished. And if you get an opportunity, you really should walk or [47:38] drive down there and take a look at it. And again, I just to to um say just a [47:47] little bit more about that. Just as a reminder, this is something that has [47:52] been always in the mind of having something else to attract more people [47:57] and something for our for our residents to do, especially in a continuation of [48:03] our main street. So, that project will be at least 2,000 feet long, and I call [48:10] it a rivercape because that's what it's going to be. The uh media that's going [48:15] to be put down as a we don't know as of yet if it's what hard surface wise, but [48:23] still in in the uh infancy of that thought, there will be places to sit. [48:30] There will be overlooks and kind of like Sycamore Park Park, we could even do [48:35] something that um we can use for picnicking. So, our residents and and [48:40] alike would like to come down to the village and uh actually see our [48:45] riverscape because there's not a lot of villages around that have a rivercape. [48:51] we were very very lucky even though we've been comparisons to some to some [48:55] other areas or communities but now we have our own riverscape um and I think [49:01] it's a very exciting time where again uh for our residents to be able to take [49:08] advantage of that at some point in time and have that uh riverscape available to [49:13] them. Take your families there and make sure you see the riverscape because it [49:17] is beautiful. Anything else from the council? [49:24] » Go ahead. >> So when that riverwalk is done, that's [49:27] going to be a like a boardwalk, right? It's is it [49:32] » like is it a wooden boardwalk? No. Or is it a path? [49:35] » It would be more like a path. >> Okay. [49:37] » It'll be more like a path. Now again, the media is that's going to go down the [49:41] surfacing. I don't know if it's going to be black [49:44] topped like we just did at our other park over here or it's going to be a [49:48] concrete path. I think I'm not an engineer and I don't know what goes best [49:53] right next to our river, >> but probably black top. [49:57] » Black top. >> Okay, so there you go. Probably black [50:00] top, sir. >> And do you Wayne, do you have any [50:04] how long or how wide typically paths like that are? No wide. [50:10] » Yeah. [50:14] Well, like Mr. Stton said, I mean, thank you to your department for all your work [50:19] doing that. And it used to be we never were able to see that that that [50:24] riverscape. Never going down that way, but now you can. But thank you for all [50:28] your hard work. Anyone else [50:36] get to hear me again? Sorry. uh committee meetings and reports. [50:41] Monday, September 7th, the office will be closed for happy Labor Day. Gosh, [50:46] it's gone so fast. Tuesday, September 8th, 4:30 p.m. financing planning [50:52] committee meeting. Monday, September 14th is our regular council meeting. [50:56] Tuesday, September 15th at 7 o'clock, a planning and zoning, and a second [51:00] council meeting if needed. And just as a reminder um um what our historical [51:07] society president said this doesn't put it on your calendar October 3rd of [51:11] violin the violin program in 7:30 here at the armory in December September 20th [51:17] 2 to 4 um and what was that again I said historical [51:21] » Ohio open doors >> Ohio open doors very exciting and again [51:25] thank you for all your hard work [51:30] » God bless you Um, executive session. >> Mr. Mayor, if I might, from the cemetery [51:37] board meeting, just so everyone's aware, the Sex has resigned his position. That [51:42] was a temporary appointment made in 2008. Um, he's now resigned from. Uh, so [51:48] if you know of anybody who's interested in a part-time job to work as a cemetery [51:52] section, that position is available and I believe it has been posted in the [51:55] lobby out there. Um, we are working toward a temporary appointment so that [52:01] there's no gap in service and I'm sure that will be taken care of [52:04] appropriately. I'd also like to ask on behalf of the the cemetery board that we [52:09] publish their meeting dates on our website and also through our agenda so [52:13] that that information is more publicly available to people who would like to [52:17] participate or at least know when those meetings are going to be. [52:24] » Thank you, sir. >> Sure. Um, one I just like to add in, uh, [52:29] August 24th is a second meeting if needed if needed. So, just let you know [52:34] I did did not have that down. >> Okay. Executive session. Well, any other [52:40] comments? >> Yes. Before we go into executive [52:42] session, I'd like to explore the possibility that there'd be more than [52:48] one executive session tonight. Uh, one concerning personnel and the other one [52:53] concerning internet. uh security um in the appropriate language to look [53:00] at both of those. >> That would be an executive session [53:04] pursuant to Ohio Revised Code section 121G1 [53:08] to discuss matters relating to personnel personnel training. [53:17] And how about the internet because of the security nature of it? [53:23] » That would be Ohio Revised Code section 121G5 [53:30] which has to do with and that's top my head. I may have to supplement that one. [53:34] Uh that's matters relating to public safety andor uh the safety in general of [53:39] the village and internet security does relate to safety. [53:47] But I will I will supplement that uh just shortly. We don't normally get to [53:51] five. And again, meeting with council is G3 pending and eminent litigation. [53:59] Do I have a motion to enter into executive session [54:03] » and we need to delineate why we're going in. So this would be um [54:09] let's just do it by number. Ohio pursuant to Ohio revised code section [54:13] 121G1 to discuss matters relating to [54:16] personnel. We will leave come back go back out come back in because three [54:21] different reasons three different executive sessions. [54:25] » So the first is a personnel. >> Yes. [54:27] » Okay. So is there a need for administrator or a fiscal officer to be [54:31] there? >> I don't believe so. [54:34] » Okay. Very good. >> All right. By roll [54:39] » I need a motion first. [54:44] Okay. By roll, Mr. Wilson, >> yes. [54:47] » Mr. Stton, >> yes. [54:48] » Mr. Smith, >> yes. [54:50] » Mr. Dorsey, >> yes. [54:52] » Mrs. Zagar, >> yes. [54:54] » And uh Mr. Owens, >> yes. [54:57] » Time is 7:51. >> Thank you, ladies and gentlemen. We [55:02] shall return shortly. [55:25] Maybe [55:32] I'm not awake that early. [55:37] I'm still [1:24:23] Welcome back, council. Are we ready? >> Motion to return to regular session. [1:24:30] Do I have a motion? >> I'll I'll make that motion. [1:24:33] » Okay. And a second. Mr. Wilson. >> Okay. And by roll, Mr. Smith? [1:24:39] » Yes. >> Mr. Wilson? [1:24:40] » Yes. >> Mr. Stton? [1:24:43] » Yes. >> Mr. Dorsey? [1:24:44] » Yes. >> Mrs. Zagar? [1:24:46] » Yes. >> And Mr. Owens? [1:24:48] » Yes. >> Time back is 8:21. [1:24:51] » And we have a little bit of an interlude. I'm going to let the mayor [1:24:54] take over. You got to turn that on, though. Yes sir. [1:24:56] » So um before um before in the agenda I had a uh accommodation and the uh person [1:25:05] is here currently if that's if it's all right with the council. Can I give this [1:25:08] accommodation to someone a citizen that has gone above and beyond um what we ask [1:25:15] of our citizenship um typically um Mr. Stamper, can you [1:25:20] meet me up here up front? [1:25:42] I just um some there's an an event that happened [1:25:46] here. Stand stand right here towards the audience. There was um [1:25:51] this young man who's standing next to me. I just want to read this for him um [1:25:55] because this is about him and this is a this is a mayor's accommodation for [1:26:00] outstanding sum citizenship presented to Brian Stamper in recognition of the [1:26:06] extraordinary compassion initiative and selfless actions during a wellness check [1:26:11] and led by a discovery of an elderly woman in urgent need of assistance. your [1:26:16] quick thinking and immediate uh contacting emergency services and re and [1:26:20] uh remaining to help demonstrates exceptional concern for the well-being [1:26:24] of another person. Thank you for doing that. Your willingness uh to act without [1:26:29] hesitation exemplifies the highest standards I do say again highest [1:26:34] standards of citizenship, compassion and service to others. Your actions serve as [1:26:39] an inspiration to others and reflect the values that strengthen every community, [1:26:44] even the village of Bavia or the community you're from. The village of [1:26:47] Battavia is honored to recognize your outstanding character and extends this [1:26:51] sincere appreciation of your exemplary conduct. And this is signed with the [1:26:56] seal of the village of Bavia presented on this 10th day, August 2026 by the [1:27:01] mayor and council um mayor Scott Runk and the entire council. I just want to [1:27:07] I'd like to you just to just to give a a brief statement on what you did that [1:27:12] day. I mean, this just says a little bit. Can you just tell us what you did [1:27:15] to help that to help that woman? Go ahead. This is Mr. Champer. [1:27:20] » Well, I'm a maintenance man at Amanda Acres in Amelia and one of my tenants [1:27:27] had water coming through her kitchen. And so I investigated [1:27:35] and I seen the water was coming from the apartment next to her. And so I went [1:27:42] knocked on her door. I noticed her screen door was locked. [1:27:50] I knew she had to be in there. >> Yes, sir. [1:27:53] » So I called my boss. She said, "Well, do call the sheriff. Do a wellness check." [1:28:00] and we found her in the bathtub. >> She was in there for three days [1:28:07] » and she's How is she doing now? >> She's doing good now. [1:28:11] » Yeah. >> But again, for your exemplary service to [1:28:14] the community, I just wanted to just extend this to you and this is your [1:28:17] award and I just thank you for being here tonight and uh God bless you for [1:28:21] everything you've done for the community. [1:28:23] » Thank you. >> God bless you. It's an honor. [1:28:25] » Thank you. >> God bless you. God bless you. Thank you [1:28:28] ladies and gentlemen. [applause] Thank you, sir. [1:28:31] Thank you for that recognition moment. [1:28:48] » This one's G3, right? >> We're actually going to go out of order [1:28:51] having said that. Okay. G5. Uh, if I may, mayor, I did hear back, uh, [1:28:57] Williamsburg is planning on doing their December event the first Friday, first [1:29:02] weekend in December. I wrote back and said, "Well, we may have already, uh, [1:29:06] rented the horse here." And the response was, "Oh, well, [1:29:11] so it'll it'll be a battle of the [1:29:15] villages." Gosh, >> and let's let's teach those people in [1:29:18] Berg a lesson. >> Oh gosh. [1:29:19] » And if you listen to me next week, you're going to hear me say, "Let's [1:29:21] teach the people in Betavia a lesson. Uh you can just chalk it up to a lawyer [1:29:25] talking out of oh just making a statement. [1:29:29] » Thank you sir. [1:29:34] » So >> exactly. So at this point I would ask [1:29:36] for executive session. I said it was five. It is G6 [1:29:41] 121.22 G6. That's to discuss details relative to security arrangements and [1:29:47] emergency response protocols for a public body or public office. if the [1:29:52] disclosure of matters could reasonably be expected to jeopardize security of [1:29:56] the public body. Uh this is to discuss um the internet and uh cyber security [1:30:02] for the village. >> Do we have a motion to enter into [1:30:05] executive session pursuant to 121.22 G6? [1:30:11] » So move second. >> Okay. And uh by role Mr. Dorsey. [1:30:16] » Yes. >> And Mr. Stton. [1:30:18] » Yes. >> Uh Mr. Smith, [1:30:21] » yes. >> Mr. Wilson, [1:30:22] » yes. >> Mrs. Zagar, [1:30:24] » yes. >> And Mr. Owens, [1:30:25] » yes. >> Timeout is 8:26. [1:30:28] » Do we need to have uh either the fiscal officer or the administrator in this [1:30:32] one? >> Okay, thank you. So, if Chip and Sorry, [1:30:38] you stay here. We'll be right back. [1:49:27] Welcome back, council. Uh, do I have a motion to enter back into regular [1:49:31] session? >> So moved. [1:49:33] » Second. >> Okay. And by role, Mr. Owens? [1:49:36] » Yes. >> Mr. Dorsy? [1:49:38] » Yes. >> Mrs. Zagar? [1:49:40] » Yes. >> Mr. Smith? [1:49:41] » Yes. >> Mr. Stton? [1:49:43] » Yes. >> And Mr. Wilson. [1:49:45] » Yes. >> 8:46. [1:49:47] » At this time, council, I would ask for a motion to go to executive session to [1:49:50] discuss pending uh or eminent legal matters with council pursuant to Ohio [1:49:55] Revised Code section 12122 G3. >> And so move. [1:50:02] » Okay. Do we have a second? >> Second. [1:50:04] » All right. Uh by role, Mr. Dorsey. >> Yes. [1:50:08] » Mr. Smith, >> yes. [1:50:10] » Mr. Stton, >> yes. [1:50:12] » Mr. Wilson, >> yes. [1:50:14] » Mrs. Zagar. >> Yes. [1:50:16] » And Mr. Owens. >> Yes. [1:50:18] » Time is 8:46. >> Is it all right for our uh fiscal [1:50:21] officer and our administrator to come into this meeting? [1:50:25] » Um actually no. [1:50:29] » Okay. You're good. >> Um no. [1:50:32] » Okay. Thank you, sir. [3:00:48] Council, [3:00:58] » welcome back. Council, >> mayor.
