[0:16] - Bonsoir et bienvenue à la [0:18] séance du conseil municipal du [0:21] mardi 23 mai. [0:24] >> Good evening and welcome to [0:27] the regular meeting of the [0:28] municipal council on Tuesday, [0:30] May 23rd. And now the city clerk [0:35] will take on the adoption of the [0:37] agenda. BEACONSFIELD SÉANCE [0:42] ORDINAIRE DU CONSEIL MUNICIPAL [0:50] - En faveur. [1:41] >> In fact, tonight is a special [1:43] night for all of, us I think, [1:45] and for Serge who joined us this [1:46] evening. As George just [1:48] mentioned, he was on our [1:50] planning advisory committee for [1:51] 12 years, actually. Quite a [1:54] dedicated 12 years, I might add. [1:58] Surge, the years I've been here, [1:59] he's been here as, well we've [2:01] interacted many times on a [2:02] monthly basis on various [2:05] projects on the PC. Sege Sege so [2:07] it is our, we are delighted to [2:10] see again surge and to wish you [2:13] well and I know you are stepping [2:14] down. With other projects in the [2:19] works these days. We didn't want [2:21] that to go by unrecognized at [2:22] the same time. But beyond that, [2:27] I think you've been a great [2:28] example, I think, of community [2:31] engagement and resident [2:33] engagement and some of the [2:34] things we do as part of this [2:35] committee. I think we also [2:38] appreciate your dedicated years [2:41] of volunteer-ism that you've [2:42] given to that. You've helped [2:44] along other members and [2:46] everybody here to help build our [2:48] city over the last 12 years. We [2:49] think about it in that [2:51] perspective. I also think you [2:54] better our city in a lot of [2:55] ways. For all of those things [2:56] and many other, things we want [2:57] to thank you for all your [2:58] contributions and you are here [2:59] tonight, for those on the [3:01] webcast, we wanted to extend our [3:04] thanks to yourself and have [3:06] everybody be aware of that at [3:07] the same time. So, with that in [3:09] mind, we have a little something [3:10] to present to you, Serge. [4:50] >> It's not over. [4:51] >> Thanks, guys. [11:34] >> Thank you for your [11:36] confidence, you may call 28001 [11:38] if you want to speak to a police [11:39] officer at anytime or you can [11:42] reach us by email at P D Q one [11:46] at SPVM dot Q C.ca. Thank you [11:48] very much. [11:52] - Est-ce qu' il y a des [11:53] questions pour le commandant? [11:55] Any questions for the [11:56] commandment? Go to the mic, [11:59] please. [14:22] - Merci beaucoup. Une autre [14:23] question? Any other questions or [14:25] any comments? Merci. Now we will [14:39] proceed with the written [14:41] questions we have received. Then [14:43] we will go to the floor. The [14:46] first question is from Nicole on [14:51] Crescent. She asked two [14:53] questions. Question one is on [15:00] 40.1 item. I noticed this item [15:03] mentions pesticide laws. Does [15:04] Beaconsfield use pesticides in [15:05] sewer? Does Beaconsfield use -- [15:11] in or near the sewers? I hope [15:15] not. Because the bait kills fish [15:16] and many other animals. Please [15:18] do not use rodent aside. Here is [15:24] an article about how dangerous [15:26] it is to aquatic environment. [15:29] She is giving us an article. [15:34] Please do not ever use it in or [15:37] near sewers, the bait goes up [15:39] the food chain and will end up [15:41] in the rivers and in fish. [15:44] Rodenticide cannot effectively [15:46] be filtered out of the water. [15:52] You have already asked this [15:53] question before. This question [15:56] has already been answered by the [16:00] administration and the answer [16:01] is, no, the city does not use [16:05] rodenticide in or near the [16:06] sewer. Question two, the new [16:10] definition of building includes [16:13] vacant lots. What will [16:14] Beaconsfield do to ensure that [16:16] the lots are being built on or [16:19] in fact vacant and do not [16:22] contain mature trees or wetland? [16:26] Beaconsfield define vacant lots [16:28] as a non environmental-y [16:30] sensitive space with no mature [16:32] trees? In this bylaw, which is [16:37] item 40.2, the term vacant is [16:41] used in the sense of a [16:43] construction and not of the [16:44] environment. Environmental [16:48] protections are provided for the [16:51] environment quality act, for [16:54] example protection of wetlands. [16:55] And other Beaconsfield bylaws, [16:59] as an example, zoning for trees, [17:01] it is not the intended purpose [17:02] for this bylaw section to take [17:05] such environmental elements into [17:06] account. The next question it [17:14] came from octane Via. [17:18] - Bonjour, c'est sur l'item 45. [17:24] 2. [18:57] Public questions. Yeah, sure. [19:10] >> My name is Peter Samson. I've [19:14] been a resident and a taxpayer [19:15] here for 39 years. Some of you [19:18] already know me. I don't need to [19:22] provide you with an address. I [19:26] have a slightly unorthodox [19:27] question to ask. If you bear [19:30] with me, you will understand [19:33] where I'm coming from. The do [19:37] it, I have to start off in a [19:39] strange way. I will ask the [19:43] question and then I will go with [19:44] the preamble, to bring you up to [19:49] date on how this is come to [19:50] light. About -- last year, as a [19:57] matter of fact, I became a [20:02] little bit concerned about the [20:03] noise levels being generated by [20:06] the Generac generators, [20:11] emergency generators. And with [20:15] good reason, I am flanked by two [20:17] of these machines on my [20:19] property. After six or eight [20:24] hours of a planned outage, I [20:33] wasn't happy with the situation. [20:34] I looked for guidance. Just to [20:38] go back, as I slipped up on the [20:40] question, the question is, would [20:45] it be possible to trade you, [20:48] this council, up even or even [20:54] sweeten the deal with the town [20:55] of Blaine Ville? That's the [20:59] question. It's an orthodox. But [21:01] as I said, this goes back to [21:04] last year and when I became [21:10] concerned about the noise level, [21:13] I contacted, discreetly, via [21:16] email, both the Mayor and my [21:20] councillor and began a little [21:22] bit of discussion via email on [21:24] what was going on. The fact that [21:27] I couldn't find anything in the [21:30] regulations within the city of [21:34] Beaconsfield that addressed in [21:35] this situation. There were [21:38] absolutely no parameters. It was [21:39] wide open. So, eventually, we [21:45] ended up with my councillor and [21:47] I having an in-person meeting [21:49] because the emails or not really [21:50] working very well. It wasn't [21:54] really coming to a proper [21:55] conclusion. About time, my [22:02] councillor had been in touch [22:03] with many of you. The feedback [22:08] he had received from you was [22:10] that this was really not a [22:11] problem. You couldn't see it as [22:15] being a problem. Every time [22:19] there was a reason given for not [22:20] doing anything, basically that [22:25] reason came at the same calibre [22:27] as my dog ate my homework. It [22:30] was at that level. The final [22:35] part of the discussion, the [22:37] in-person discussion over my [22:38] kitchen table, was, well, we [22:42] don't want to do anything, we [22:44] don't think it's a problem. Have [22:45] you tried talking to this [22:46] individual? In this day and age, [22:52] where if you open a wrong card [22:54] or you can get shot, I would [22:59] have to go to my neighbour when [23:03] they are not breaking the law, [23:06] because there is the law, and go [23:08] on their property, ring their [23:14] doorbell, and no matter how [23:16] nicely I would say, it I am [23:17] telling them, I really don't [23:18] like what you are doing. Okay? [23:23] What could go wrong under those [23:24] circumstances? The City supposed [23:28] to be practically -- protecting [23:30] me and my interest is telling [23:31] me, go out there for yourself. [23:34] Okay. That's what the Council [23:38] had said to me through my [23:41] councillor. Okay. I had to live [23:44] with that. Now, fast forward to [23:50] the beginning of April. A [23:56] situation affected all of us. In [24:00] my particular case, and I [24:01] believe in the case of my [24:02] councillor as well, we were out [24:07] for 120 consecutive hours. So, [24:12] at that particular point in [24:13] time, we had the two Generac [24:16] systems that started up, doing [24:18] their wonderful duet. Followed [24:22] by a third portable that is [24:24] really noisy. And shortly [24:30] thereafter, a fourth came. I had [24:37] these generators, the noise [24:38] being generated by them in a [24:41] 270-degree radius from my house [24:44] for the better part of 120 [24:47] consecutive hours. Does this [24:52] sound like it's not a problem? [24:57] You could have fooled me. When I [24:59] was looking out of my kitchen [25:03] window, looking at that [25:04] neighbour, who had their house [25:07] lit up like a television studio, [25:12] I bore no malice towards them. [25:13] Why? Because they were doing [25:18] everything that was within the [25:19] law. [25:21] >> Will you be coming to a [25:23] conclusion? [25:24] >> Yeah. We come to the [25:25] conclusion. The conclusion is [25:27] that this Council has done [25:29] nothing with regard to that. [25:32] Yet, there is a Council that has [25:33] done something. That Council is [25:41] Blainville. They have [25:46] regulations, 53, just covering [25:51] nuisance noise. And they have a [25:55] curfew! It says, even, even [26:01] under emergency situations that [26:05] the noise level, those machines [26:06] have to be turned off from 9:00 [26:09] at night until 7:00 in the [26:10] morning. What do we have in [26:13] Beaconsfield? Zip. Okay? And [26:18] then in a separate regulation, [26:19] they also have something that [26:23] governs the level of noise is [26:26] acceptable for the machines. [26:29] It's 55 decibels. [26:34] >> Besides Blainville, are there [26:35] any other cities that you know? [26:37] >> No, I have not researched the [26:38] entire world. This I became [26:40] aware of and these are bylaws. [26:42] They enforce them because I know [26:45] that, in fact, in at least one [26:47] case, I was told about that the [26:49] police were at the door when [26:52] people were going over the [26:53] curfew. [26:56] >> Okay. I'm going to ask Mr. [27:00] below to give you more [27:01] information about this. [27:03] >> Thank you for the [27:04] information. I understand it [27:07] could be annoying to have so [27:09] long hours of machines. I went [27:12] through that near my property. [27:16] Overnight, it is not nearly [27:17] interesting, I find. These [27:21] aren't exceptional [27:22] circumstances. Last time was 25 [27:23] years ago. We can have the [27:27] Blainville bylaw says it is that [27:28] information. Thanks for letting [27:29] us know. [27:34] >> The thing I find so [27:36] irritating is the fact that I [27:38] raised this issue last year and [27:41] if you were watching the TV, TV [27:43] news, channel 12, okay, from [27:47] five until seven every night, [27:49] there are Generac commercials [27:51] after Generac commercial after [27:53] Generac commercial. This is not [27:54] something that is going away. [27:57] >> For the sake of transparency, [27:58] I have a Generac. [28:02] >> That's fine. [28:03] >> Thank you very much. Yes, [28:06] next. [28:18] >> Hi, Frank. Item 40.9, I [28:23] believe it is my property. I was [28:28] just sitting there. I looked up. [28:33] He mentioned nuisance. I said, [28:37] well, let's look at the [28:38] definition of nuisance. First of [28:41] all, it's illegal. It's [28:44] obnoxious. It's dangerous, okay? [28:49] There is danger. Why are we [28:51] using this word? Nuisance. [28:58] >> What is your question? I'm [29:02] not sure where you are going [29:04] with this. [29:05] >> It's the same in French as an [29:06] English in your documents. [29:07] Nuisance. [29:10] >> Nuisance? [29:11] >> There is no French word for [29:12] it. [29:13] >> What is your question with a [29:14] nuisance? [29:15] >> No, no. [29:16] >> Have you experienced a [29:17] nuisance? [29:19] >> I opened that. I want to [29:21] thank you. I sent you an email. [29:22] I assume you looked at it. I [29:27] have a way to solve the problem [29:30] we have, I have. I hope when you [29:34] come to that point, you consider [29:38] that I've been here 50 years. [29:40] >> What is the problem? [29:42] >> The problem is what is a [29:43] nuisance? Am I illegal? Am I [29:46] obnoxious? I'm not any of that. [29:52] >> Are you talking about [29:55] measures that the City has [29:57] taken? [29:58] >> No, I'm talking about the [29:59] words you use. [30:01] >> Okay. I'm going to ask Mr. [30:04] bottle to answer your question. [30:06] I think he has a lot of [30:07] information to give you. [30:09] >> What? Yes. [30:13] >> Generally speaking, the word [30:15] nuisance is used when it could [30:18] be dangerous, might be annoying [30:19] for others. I believe you are [30:23] having traction. Occasionally, [30:28] with the fire department and [30:30] other governmental agencies as [30:31] well. I know there is a [30:34] situation here that is being [30:36] looked at and soon we will be [30:39] able to fix it in the best, in [30:42] your best interest at first and [30:44] for you as well. [30:45] >> I'm trying to do my best. [30:49] I've obviously sent you a [30:51] picture of what I plan to do and [30:54] I don't see why I'm violating [30:56] anything. I'm doing my best. [30:59] >> I see that picture that you [31:01] have sent. [31:02] >> I sent it to the Mayor. [31:05] >> I didn't see it. We have our [31:07] bylaws. It's applying the bylaws [31:12] as per our rules and sometimes [31:15] the bylaws don't please one [31:17] neighbour or many neighbours. [31:19] Those are the bylaws. In order [31:20] to allow you exceptions, we have [31:21] to change our bylaws. [31:25] >> I'm not asking for that, sir. [31:26] All I'm asking is, nobody has [31:29] ever complained to me. I know [31:31] they maybe complain to you guys, [31:32] but they haven't complained to [31:33] me. I listen. [31:37] >> As you heard, the previous [31:40] resident the microphone [31:42] complained that the neighbour [31:43] was not appealing -- complained [31:44] to the city about neighbours, [31:47] not be the first time that [31:49] someone complains to the city [31:51] without notifying their [31:52] neighbour. [31:55] >> Anyway. I hope you do [31:58] something, as a 50-year citizen [32:01] of the city, I can salvage what [32:04] I did wrong. Thank you. [32:06] >> Thank you. Another question? [32:25] - Bonjour, Mesdames et [32:26] Messieurs. The city signed an [32:35] agreement with and why our sea [32:39] in November 2019 where item 14, [32:44] -- La Ville sont gages à démolir [32:45] assez frais le hangar à la date [32:49] du cinquième anniversaire de la [32:50] signature de l'entente. Since [33:07] it, we are now three and a half [33:09] years down the road, the [33:10] deadline is five years. Since we [33:15] can be expecting that this will [33:18] require many millions to destroy [33:19] and rebuild, my question is, [33:23] what is the total budget as of [33:26] today to demolish and rebuild [33:27] these facilities? [33:32] >> Again, I will ask Mr. Boileau [33:34] to answer your question. [37:17] - Aucune. Dernière question, [37:18] c'est plus une remarque, [37:19] peut-être. Monsieur le Maire. [37:24] And you notice the water levels [37:28] disappearing? I'm related to [37:31] what happened two years ago the [37:32] St. Lawrence River seaway, [37:38] whatever group published the [37:40] report and we commented. What [37:43] they were saying is that, more [37:47] and more, there will be problems [37:48] with the water levels. What's [37:51] happening? What has been [37:52] happening in March, April it was [37:56] the water flowing from the [37:57] Ottawa River. Now, it is still [38:02] high because now is the overflow [38:03] from the Great Lakes. It is [38:05] still okay. But still take no, [38:10] keep track of those numbers when [38:12] you answered to us two years [38:13] ago, you said checking every [38:16] month or whatever, I hope you [38:18] are doing that every spring [38:20] because the problem will grow, [38:21] as you can see, around the -- [38:24] >> I check it every day, in [38:25] fact. I know that Mr. Boileau [38:31] and Mr. Shabbat -- [38:35] >> You agree a tie, don't you [38:36] agree? [38:37] >> Every year, it goes up. It [38:41] goes up to slightly below what [38:45] we consider minor, you know but [38:53] the flow is controlled upstream. [38:57] >> Up to a certain level, they [38:58] said. [38:59] >> The control upstream is not [39:02] to flood the Lac-Saint-Louis. [39:07] >> In the report, when they were [39:09] saying, I can bring you back the [39:11] report if you want, at one point [39:13] they will have to make a choice [39:17] between flood north or west that [39:18] would be, let's say, the Great [39:22] Lakes, or flooding the [39:24] downstream here. [39:25] >> Lake Ontario. There is an [39:27] understanding now that [39:30] Lac-Saint-Louis -- in 2019, the [39:34] situation was worse. [39:37] >> No, I agree. [39:38] >> We still had no flooding. [39:39] >> The report was about 2017 and [39:40] 2019. They were saying, in the [39:44] future, it will get worse and we [39:46] have no control over the [39:49] situation if it goes to high. [39:50] >> We will get there when we get [39:51] there. [39:53] >> Well, that day it will be too [39:54] late. Thank you. [40:01] >> Other questions? [40:07] - Bonjour. [43:39] - Oui. Merci beaucoup. Bonne [43:40] soirée. [43:45] - Est-ce qu'il y a d'autres [43:46] questions? Any other questions? [43:50] Alors, nous allons procéder avec [43:53] l'agenda. Madame la greffière? [43:58] >> Approval of the minutes of [43:59] the Beaconsfield public [44:01] consultation of April 24th, 2023 [44:03] at 7:30 P M. [44:07] >> Second. [44:08] >> All in favour?
