[2:42] No, [2:45] they like me. [3:08] Yeah. Know once you figure it out, you're like, "Oh, wow. That worked." [3:11] Pulled it up. >> Oh, was it this way? [3:17] Yeah. [3:25] Look at that. [3:29] [clears throat] [3:33] There we go. [3:44] » Okay. I also learned the old guy for both [3:49] staff and officials. I'll be here. We can expand like [3:53] whatever. You know that one. >> Just carry a magnifying glass. [3:57] » No, that's not cool. >> A monle. [4:01] » Yeah. >> Actually, I had a lady do that tell me [4:06] about that in Lowe's one day. Started living. She goes, "And man, just take a [4:10] picture of it." >> Oh, yeah. Blow it up. Yeah. [4:12] » Wow. Makes sense. [4:43] What? [5:02] We good? >> Yes, we're good. [5:05] Like >> to welcome everyone to the September [5:08] 3rd, 2026 Bellingham Zone Board appeals meeting. Uh, can I get a motion to open [5:13] the meeting? >> Motion to open the hand. [5:16] » Yes. Second. >> A second. All [5:18] » in favor? >> I believe we have people streets on the [5:24] agenda tonight, right? >> Yes. [5:27] » So, come on up, guys. [5:33] Rachel, what we're going over the waiverss tonight? Is that what we're [5:36] doing? >> Yes. [5:38] » Yes. Going over the waivers. I think uh the attorney um I think that was a [5:41] comment from both deals and Thomas and the board um was to just elaborate on uh [5:46] the waiverss >> the waiver list. So they did go back [5:49] through and there's some that you know we don't need anymore, some that you [5:52] know we still do, but they did elaborate on those. Um they've also revised the [5:57] plans um since the last and Thomas review and they're going to revise them [6:02] again. Um there weren't too many issues again from what I could see on there, [6:07] but you know um we'll let the board um decide. The traffic review came back [6:13] that was and I think they only had one item on that one. [6:17] » One outstanding comment. >> Yeah, one outstanding comment. And I [6:20] think that that was sent just um today probably. So if you haven't had a chance [6:23] to look at it, that's >> it wasn't anything big. It wasn't [6:28] anything large. Um >> great. So, we actually need to go over [6:32] all of these lately or just the ones that are extremely pertinent for us. [6:37] » We uh we have our attorney on the line or during Stephanie is uh here. So, you [6:42] know, generally what we like to do if it's okay with the board is you can kind [6:45] of walk through the waiverss and and say, you know, kind of expand or ask any [6:49] questions that you have um just because they draft the waiver list and you know, [6:54] some of them may be frauds you can talk through. Um but like Rachel said, some [6:58] of them have been taken out or modified based off what we need. U typically the [7:04] the planning board one is gone. The parking space one is gone because we now [7:08] meet that uh regulation. Um so if you don't mind, you know, if we could I can [7:14] hand it over to her. She can kind of talk through them and then if you guys [7:16] have any questions, uh she's on Zoom. So uh can you hear me? Okay, Stephanie? [7:21] » I can. Yes. Can you hear me? Okay. >> Yep. Yep. Uh, take it away, please. [7:27] » Okay, fantastic. Um, good evening members of the board. Stephanie Kefir [7:31] from Small and Vaughn in North Andover. Um, on behalf of the applicant [7:36] and and really how you would like the waivers approached this evening is it [7:42] boards vary the way that they would like to do it. I can go through them one by [7:45] one or if the board had specific questions about certain ones. So, let me [7:51] know what your pleasure is and and I'll proceed. [7:55] You want me to share it on the screen? I can do that, too. [7:57] » Yeah, if you don't, [8:01] » I do read through. Nothing really screams. Oh my god. To me. [8:09] Okay. [8:16] Would [8:22] you like me to start walking you through it or do you want to? [8:25] » Yeah, why don't you? >> Absolutely. So, the first page of the [8:30] waiver list is obviously just an explanation of the authority pursuant to [8:35] 40B that allows us to seek the waiverss from local requirements and regulations. [8:40] And and just to pause here for a second and clarify, pursuant to the board's [8:45] authority and power under chapter 40B, there's no waiver given to any state or [8:50] federal requirements. So obviously, these are only related to local [8:55] requirements and and those local requirements that were in effect as of [8:59] the date that the 40B application was submitted. [9:04] Um [clears throat] likewise within kind of the introductory there you may see [9:08] note one that's highlighted or bolded rather. Um, basically that just [9:13] highlights the provision of the uh 40B regulations at 56057 [9:19] that when seeking waiverss, if there are uh zoning bylaws that are um or or uh [9:26] provisions within the zoning ordinance that are [9:31] by special permit, a waiver is technically not sought. So within the [9:35] waiver list, sometimes you'll see us asking for something that requires a [9:38] waiver because it's a special permit. That's technically not required, but we [9:43] just highlight that because within your zoning ordinance, sometimes there's [9:46] special permits that are granted by this board and sometimes there are special [9:50] permits that are granted by the planning board. [9:53] So, with that said, I'll launch in if you want to turn to the next page. So, [9:58] it's page two of the waiver list. And what we're seeking um from the first [10:05] the first requested waiver is under article four, the street opening. um [10:10] sections 191 uh 12 through 15. And basically that provision just [10:17] provides out a street street opening permit um is to be issued by the DPW [10:23] director to authorize extensions, driveway access, utility connections [10:28] subject to the standards and and pavement moratoria um unless that's [10:33] otherwise been waved. And this because this is a 40B, this is more of an [10:37] administrative waiver because this is a comprehensive permit and the board, the [10:42] zoning board issues all local approvals, including those by the DPW. We've asked [10:46] for that to be procedurally waved, the comprehensive permit. It subsumes all [10:51] your local permitting. Um, but just to clarify, we're not seeking to um to wave [10:57] the DPW standards. It's just that process that there's a separate permit [11:02] that's issued by the DPW director, him or herself. [11:07] So, if you have no questions on that, I'll move on to our next waiver request. [11:13] » Nope. Go right ahead. >> Okay. Um, [11:16] you someone jumped the gun there. So, the So, the next one was actually Oh, [11:20] sorry. It is there. It's the uh wetlands protection bylaw. That waiver request [11:25] has been withdrawn. So, since we were last before the board, the uh the [11:30] applicant has submitted a notice of intent to the conservation commission um [11:34] for jurisdictional work both under the act and the bylaw. So, we're withdrawing [11:39] that. So, that makes your job a little easier on that one. And then on starting [11:44] on page three, we've requested a waiver under sections [11:51] 242 and three. And basically that's the provision that says that the building [11:57] inspector um has to certify that any buildings [12:02] that are that are uh created um that they comply with the applicable zoning. [12:09] Obviously because this is a 40B it's it's by nature it's in conflict with [12:14] that because we're seeking waiverss and we're and we're seeking to develop [12:18] pursuant to chapter 40b. So the waiver request is just that it um the inspector [12:25] of buildings is to enforce the zoning bylaws with the caveat that it's as [12:30] modified by the waiverss approved by the comprehens by the um by the board under [12:35] the comprehensive permit. So it just clarifies that [12:41] um the following or the next waiver request is under 240 [12:48] 15 uh 24022 and through 24027 and as I had previously suggested in the [12:58] introductories there's that note that under chapter 40B [13:03] you don't need to seek a waiver or something that's permitted by special [13:06] permit. So this this waiver request is really more of just a clarification [13:11] that 40B waivers are not required for uses or developments that's permitted [13:16] subject to a special permit review process. Essentially, it's because the [13:19] zoning board of appeals is conducting all review within the comprehensive [13:23] permit review process itself. From there we go on to the waiver [13:30] request under 240 uh16 through 2421 uh development plan approval. [13:39] Similarly, this is basically a procedural waiver that uh [13:45] under under those provisions of the bylaw development proposal that are [13:49] subject to a development plan approval by the planning board. Um and again this [13:54] is chapter 40B. It's a comprehensive review conducted by the zoning board [13:59] appeal. So more of a procedural waiver there. [14:03] Um from there it gets into the use regulations [14:09] within the uh within the zone by article 5 if you will and specifically 24031 [14:18] that's your uh use regulation schedule for both principal and accessory uses. [14:24] So the project is within the residential district and within that per the bylaw [14:30] there are only single family and two family residential use is allowed other [14:34] multif family is not allowed. So project here is a multif family. It's 58 aid [14:41] restricted rental units um together with um one community building as an [14:48] accessory structure. And then for accessory uses to to the project we have [14:53] surface parking, earth removal, the common septic system related to [14:58] pertinances, water, storm water, landscaping, uh lighting and screening, [15:02] signage. And so for that we requested a waiver from 24031 [15:09] for the um principal and accessory uses that are otherwise allowed within the [15:14] residential district. [15:19] Um from there [15:23] um moving from uh the intensity of use regulations. So under article 7 of the [15:32] ordinance, all buildings uh erected in any district be located in a lot that [15:37] has the minimum requirements under 24040. [15:41] So if I this is somewhat of a two-step here. So under 24040, [15:46] that's your intensity. The project does meet minimum lot size. [15:52] um it does meet the minimum frontage, the front yard setback, the rear yard [15:58] setback, um and the sideyard setbacks as it's currently designed. And we've we've [16:03] provided you this red line so you can see the adjustments that um were um have [16:08] been made on the most relevant plans. [clears throat] [16:12] The um this somewhat plays in however under our the following waiver request [16:20] that we have under 24037 and that's that regulation pertains to [16:25] the number of buildings that are permitted on a lot. And so subp part A [16:29] of 37 provides that not more than one one single family or two family shall be [16:35] erected on a lot. So, we've asked for a waiver under 24037A [16:39] to allow for the 10 multif family buildings and the one accessory building [16:43] all on the 5.2 acre lot. And then secondly, subp part 37B [16:51] provides that more than one principal building um or use other than a single [16:57] family or two family may be erected provided that. And then it goes on to [17:01] provide that um the lot and yard area requirements are met for each building [17:08] um and used without counting them anytime twice. Um but there's no um [17:15] increase in lots. So we've asked for a waiver of that because what the proposal [17:20] is to have the 10 buildings, 58 units, and the one community building as [17:25] located on the approved site plan. So if one were to strictly seek compliance [17:30] under 24037B, you would have to go back to the um [17:37] 24037A with those setbacks for each to look at [17:41] each of the buildings. So that's why here we've requested waiverss for both [17:45] of them. So when under 24040 [17:51] when you look at the setbacks from all the buildings as a whole, no waiver is [17:55] sought. However, if one interprets 240 37B to say that you have to look at each [18:01] of the individual 10 buildings and the community building, um it's not clear [18:07] that we would meet each one of those sideyard and front yard setbacks if you [18:12] can't count them twice. Um does does that make sense to the board? [18:18] » Does to me. Yeah, I've read to all these. So, [18:20] » okay. [18:24] Actually, before you go on, >> yes. [18:27] » Ask my board members. Have all you guys read through all these waiverss? We had [18:30] time to read through them all. >> Yeah. [18:34] » Okay. Do we have And yeah, I mean, just be for a sense of time, too. Um, is [18:39] anything sticking out that we need to have before she goes through and kills [18:44] herself reading 6,500 words? I mean, in all fair, that's true. everyone. Is this [18:51] something that's jumping that you want explanation on for way? Because to me [18:55] it's pretty been pretty standard. >> I know [19:02] I said yeah maybe just might miss my understanding. Um [19:08] um real quick question on the um I guess [19:13] the very first one. Um, I'm just wondering how how is it like [19:18] the same enforced if if we do a a waiver on it. [19:24] I mean, that's [clears throat] pretty [19:25] » for the 340-2 and 3 or for the street opening. Sorry for [19:32] this >> 12 through 15 [19:34] » uh 19112 and 19115 >> you will be issuing the permit with [19:41] consultation from the DPW for the street opening. [19:45] » Okay. So since that come from DPW come from us. [19:48] » It'll come from us. Yeah. We'll probably that's my understanding white out DPW [19:52] and put ZBA on street street opening. You know that's essentially you know [19:56] what will happen. >> Okay. But it still be be within the DPW. [20:01] » Yeah. I used to build houses forced to basically throw our waiver. [20:05] » Yeah. >> But you aren't going to be required to [20:07] like go out there and you know no DPW >> roadway stuff. [20:13] » Oh, the new guy is going to have to >> Yeah. [20:17] [laughter] >> I'm sorry if I go Brad. [20:20] » Um I have dug through these waves because [20:24] we've had them for a couple days now. Um, I don't think there's any one of [20:29] them that's really jumping out and saying, "Hey, what are you doing here?" [20:32] They're pretty standard comprehensive permanent wave. We all [20:37] know what's going on in there. Is the board okay with her not reading [20:42] everyone or wanted to continue? >> I I'm just looking at one of them. I'm [20:47] just curious with earth removal just because that has impacted traffic. Is [20:52] there anything >> that that's why I mean let's hit on the [20:55] ones that >> cuz I know Yeah. I don't know how much [20:57] they're broken but I know in the past sometimes like that we have [21:02] » Would you mind hitting on and I don't look for the number right now so bear [21:05] with me. >> So it's under article 17 the earth [21:09] removal provisions. >> Yeah. [21:12] » Okay. So what Thank you. The applicant here is seeking a waiver of the [21:19] earth removal provisions from uh 240 subp parts 113 through 118. [21:27] Um which which um subp part 114 speaks to that there's a permit that's issued [21:32] by the board of appeals and that it's subject to a bond. And what we're [21:37] requesting here is that the comprehensive permit include a waiver of [21:42] that and that the the specifics for the earth removal. Um it within the subp [21:48] parts there it talks about the plans that would be submitted which I think [21:51] that we've through the engineering engineering plans have been submitted [21:56] today and then obviously the final um plans that will be part of the building [22:01] permit application. It's going to have you know that level of detail. Um what [22:05] we've requested is that the earth removal be um addressed through the [22:12] detail that's going to be on the building permit level plans um together [22:16] with the submission of a construction management plan. That typically happens [22:20] prior to or as the applicant's preparing to submit its building permit [22:24] application. And then it'll be um you know, I'm not quite certain how [22:27] Bellingham likes to do this. If they have a meeting with the building um [22:32] inspector and then certain other people, like a a pre-construction meeting, if [22:36] you will, and they and the applicant would submit a construction management [22:40] plan, which would detail the earth removal, um how much is going to be [22:44] removed, the schedule for doing that, and and and that level of detail. So, [22:48] it's not it's not seeking to not provide the information. What it's seeking is to [22:55] um wave the separate permit um special permit approval process and to provide [23:02] um the detail as to the earth removal within a construction management plan [23:07] and to have that obviously be a condition of the comprehensive permit. [23:12] And um aside from that though, the applicant is also seeking to have a [23:17] waiver of the earth removal bond. Um >> about in the past those conditions come [23:25] through us. >> That's what I was wondering. I know [23:27] we've had ones before us for earth removal. [23:29] » I think it's a certain thresh threshold, right? [23:32] » Yeah, >> it is. [23:33] » The earth removal special permit. Okay. >> Is through you guys. [23:36] » Well, it had it has been in the past. Yeah, [23:38] » that's why I mean the project behind us came to us. [23:42] » Um >> yeah, you are the special permit [23:45] granting authority >> over threshold of earth removal. I think [23:49] it's a certain number. >> I don't you know what that number is? [23:51] » I I believe it's 2500. Um I'm sorry I don't have the ordinance [23:56] provision right in front of me and and I believe that we are going to exceed that [24:00] amount. Um the amount of um export is is going to be greater than that from the [24:06] site than the um than the that get you below the threshold. [24:12] » So you're looking for a waiver of that special permit from us. Is that what [24:17] you're asking for in this? >> Correct. Correct. And what we're what [24:21] we're requesting is that the board um wave the the submission requirements for [24:28] that wave wave that process if you will. And um again to have the comp permit [24:34] itself though be conditioned to include a condition that construction management [24:38] plan um that the applicant and its uh contractor will will prepare that and [24:44] submit it prior to issuance of building permits. Um and and obviously that will [24:48] include the earth removal schedule and the earth removal details. [24:55] » Maybe it's a question for uh Rachel. Do you know with this then I guess maybe [24:59] because before it has come before the Ford. Yeah. Would this be something that [25:04] um like uh your office and the building inspector then would be involved with [25:09] the earth removal plan? >> Yes. Yeah. you guys are still quote [25:16] unquote I mean it's not a special permit that you're being issued but the [25:20] requirements for the earth removal are included in this which is this um what [25:27] is it a construction management plan I thought I had put it in here I didn't [25:30] see that I put in the requirement of submitting a construction management [25:34] plan as a standard um condition um [25:41] does that answer or no I think I mean to me I think as long as someone with um [25:46] which I assume but like the building inspectors [25:49] » yeah I mean I think >> part of the planning [25:51] » that's coming before us because we we don't want the land stripped [25:55] » and we also want to manage the dump trucks in and out [25:58] » that's remember during school hours traffic hours [26:02] » which if that's something that can be handled administratively [26:06] I'm okay with it but >> that's not something you don't want to [26:09] handle administratively. It's one of the things we do talk about when we have [26:14] this pre-construction meeting is we talk about okay when are you going to be [26:17] starting oh okay it's during school then you need to watch out for these are the [26:21] school bus routes this is the timing you know that kind of stuff there's a sort [26:25] of like a checklist that we go through that they'll provide um you know items [26:28] on that so that >> but I can yeah [26:32] » that's me >> I'm confused about the lawyer or [26:39] um the bond that normal. [26:46] » So for earth removal projects, you typically have a bond, you know, that's [26:51] collected um for that. It's usually a B, again coming from the community I came [26:55] from, it was $5,000 base and then X amount, you know, more over a certain um [27:00] cubic of yards. and that would be held in a bond that the town would hold until [27:06] the project was completed or as it progressed um moving forward. Um but if [27:11] the question is is it normal to wave the bond for a comprehensive permit? [27:17] » Yes, I normal. >> Yeah, they they can do that. Um [27:21] » the last one we did, we we did not the bond on it. [27:25] » No metal. We did not one on the other one yet. Actually, we [27:30] did on the other one. going some so it's at the discretion of the board I guess. [27:34] Okay. Cuz I know the bond I guess is good at insurance but um if it's a I [27:39] mean a good um applicant. [27:43] » The other ones I think we held the bond on because um the anticipation was the [27:48] town was going to take the road and we held the bond until the town was down. [27:53] » Yeah. And um you know like on the Curtis one that one had like a a sewer line [27:59] that was going through that the town is going to be taking you know that um [28:02] infrastructure over. So that I can understand. Um this is a private septic [28:06] roadways are going to be private >> um you know we do have something in here [28:10] about um holding a $3,000 just sort of >> Yeah. Okay. Um you know for that the [28:17] neighbors water line again just in case we you know find something that happens. [28:22] Uh so [28:26] you know [28:30] » any other questions on the waves of assessment [28:35] I just got to save from [28:40] is there reason I guess the the title five restrictions regulations they [28:44] originally were seeking a waiver but then decided not to. I mean, I guess [28:49] that falls with that, but in a way, I guess it's [28:53] » just the local ricks. They can't wave the state rerecks. They can just ask to [28:57] wave our local rags. >> Okay. But didn't land better than what [29:01] it was anticipated to as well. I >> think so. I would have to ask the [29:05] engineer about that one. >> Yes, it was a good park. Less than two [29:07] minutes and groundwater was pretty deep. So, there was no there's no issue that [29:12] the land can support uh a shared system there. And you if you do remember they [29:17] are they're designing the system not at the reduced rate of what seniors [29:23] typically um produce what the design rate is for that they're producing it at [29:27] a larger you know adult regular people >> I don't know what you [29:33] » nonen that's above the minimum kind of like or [29:38] it's like a higher >> correct yeah it's higher yes this is it [29:41] you know it's design the rate that they're designing their septic at is a [29:46] you know for larger um size so it'll be able to handle whatever you can throw at [29:51] it. [laughter] [29:54] » Sorry bar here designed it age restricted. [29:58] » Yes. Thank you. [laughter] [30:01] » All right. So is is the board okay moving off of the way it was at this [30:06] point so we keep rolling [30:11] this? Yeah. >> Yeah. James. Okay. [30:15] What else we here for tonight? I've got my own questions for you. So, [30:20] » um, no, I that's Thank you, Stephanie. I If you want to stick around or go, [30:26] whatever, it's up to you. Um, >> well, if the board was going to discuss [30:29] the decision. >> Yes. Yeah. So, yeah. [30:32] » No, happy to stay on. >> Uh, great. I would say the only other [30:36] update is we have our first Concom next week. Um, so that that was kind of all I [30:43] had. Um, if you have any questions, we have Peter here, uh, as well. So, you [30:47] know, happy to answer though. >> Traffic just came in today traffic. So, [30:52] we're not going to lower traffic. Is that correct? [30:55] » Correct. I mean, I can re I was just going to bring that up. [30:58] » If there's one comment, unless it's something crazy, we I, you know, an [31:03] intro on the fly. um traffic. >> It seemed like the traffic, you know, [31:10] agrees with our findings uh as well as uh you know, the parking I know which [31:16] was an issue. Um we have a lot of parking also which is good. [31:20] » Um >> as far as the um sidewalks and 88 flying [31:26] wheelchair ramp stuff that it's all in the new plans. [31:30] » Yeah. >> Yes. [31:31] » Yep. So it was um comment 10 um which just [31:37] talks about the striping. So I will share that [31:46] pavement markings. [31:57] » It'll provide your striping gland. >> Okay. stripe and glam including stop [32:02] sign. Do we have a stop sign on? >> No. [32:05] » All right. So, I had a stop sign. >> It's just a free-for-all. [32:09] » Actually, that's been in all along. Had a stop sign there. [32:12] » Yep. >> At the exit. [32:14] » Yep. >> Stop sign. [32:17] » Yep. We can we'll make sure to include that uh next time. That's not issue. [32:23] » Yeah, that was the only comment. The rest of um the rest of them all have all [32:27] been resolved. >> Yep. So, and if I may chime in even, it [32:32] may even just be easier to have that as a condition of approval that the the [32:37] final plans that get submitted have that striping on there. [32:41] » Whatever the board's preference is on that [32:45] » plans um [32:51] stop sign. [32:55] Um, this may be, and I know we've got a [32:59] couple lawyers here, so um, and I brought this up for Rachel [33:04] earlier today. Everything says townhouse on it. [33:10] » Are we I I just The special permit says [33:14] townhouse. Your project says townhouse. Is that technically town houses, per se? [33:19] Is that going to be an issue with state funding? [33:24] No, I mean it's kind of the name we've gone off of, you know, I don't it [33:29] doesn't classification when it comes and please Stephanie cut me off if I'm being [33:34] incorrect here, but it's just a name we've been using just because in our we [33:39] feel that they are like these are attached kind of town homes. That's the [33:43] name of the project. Um it may change. I'm sure we'll pick another name when it [33:48] like it's all said and done. That's just been kind of how we've referred to it [33:51] internally. >> I don't think it means anything to us as [33:53] a board or a town. The name um just legally with the state found for party B [33:59] where it's not called a townhouse. >> Yeah. [34:01] » I just thought >> Yeah. When we had to fill up the app you [34:05] don't have a townhouse as an option. It's kind of like rentals, condos, uh [34:09] subdivision. So, uh I don't believe I didn't have to is Yeah, it won't affect [34:16] anything. Um, the other question I have, and I'm [34:19] pretty sure the rest of the board members [34:22] hopefully remember being a water man. >> Yep. [34:25] » Um, there could very well be a water water team going through that property. [34:31] » Yes. So, which we have looked into. Um, you know, we reached out to DBW. DBW's [34:37] answer to us was kind of the same as we're not sure. So, um, we we have a [34:42] something in there in escrow. Um, if we were to hit the water man and and not I [34:48] mean what we would do is obviously like go into action and figure out how to [34:52] like kind of move it on the either on the property um to where it's no longer [34:56] going to you know >> number 16. [34:59] » Yes, >> it is. Um and and I just I didn't find [35:02] that strong enough. We'll be honest with you. [35:05] » And and my and I'll tell you what my concern is. [35:07] » Yep. Um, all well and good. We'll put a blind up and x amount of dollars for the [35:13] town to repair it or move it. But if that water m is hit at 4:30 on a Friday [35:19] afternoon, >> um, I want wording in the decision that [35:24] it gets temporary, something happens. >> So, the other residents aren't without [35:30] water until someone gets around to it on Monday at noon time. [35:33] » Let me see. I just again I I drop check the residents too. [35:38] » Yeah. No, >> not that I'm saying your food is just [35:40] going to walk away. >> Yeah. Yeah. [35:43] » Why? >> No, I got to take care of that. [35:46] » Yep. I understand. That's that's completely [35:48] » Is that too much to put in there, Rachel? Or [35:52] » Oh, might have something. >> No, I think that's we can we can um find [35:58] something that's a little bit stronger. Yeah, [36:01] » on that. Yeah, >> I said the concern that you know bulk of [36:05] the guys are gone. It's 4:30 and one last guy hits it and like oh well it's [36:10] » Yeah, >> we'll deal with it Monday. It's not fair [36:11] to the residents. >> Yeah, the timing too because it's with [36:15] the septic. >> Maybe we want to try and do that like [36:19] ahead of time. >> Yeah, we we'll get you know we will do [36:23] what we can to try to like see ahead of time or like be very careful in that [36:27] area. Um our our hope is if it is there we won't hit it. We we'll we'll like [36:32] we'll find it and be like okay how are we going to you know adjust this on the [36:36] fly. So >> it's not going to be taped. It's not [36:39] going to be macked. >> It happened a few years ago. So [36:43] » no it does. We just we run a project this week over in Upton and there was [36:48] like a Phantom gas line from the 60s that just showed up and so everyone's [36:52] like all right stop. And we can see it decaying even though it's decaying. [36:56] We're like, we still got to stop and figure out what this is. So, [36:59] » I just want to make sure that people that connected to that water man don't [37:02] go without water because >> yep, [37:04] » we're waiting for the time, wait for this or that. Just need a regret. [37:08] » Absolutely. We can definitely work on some uh language that would hold us to a [37:12] timely response or we're definitely not opposed to that. I can help out. Um [37:18] before I open up to everyone else, the other thing that I did have and I don't [37:22] see it in our decision, um [clears throat] [37:27] the land clearing starting to land cleared where everything's in place with [37:31] the state. >> Okay. [37:33] » We have had other projects in the town. >> Mhm. [37:36] » That have been and again not saying you guys are do this, but they've been land [37:40] cleared, went into appeal, went into court, they [37:43] no longer have the funds to do it, and now we got a vacant property. So no land [37:48] clearing. >> So everything is done new. The last one [37:51] that we did with Sanka Meadow, we held them to after no land clearing. [37:55] » Okay. >> And I'm glad we did because the [37:56] project's not going forward. >> Well, it's it is it's Yeah, it is. [38:00] » It might eventually, but it's been years. [38:02] » Yes. Yeah. >> Um no land um clearing [38:06] » till everything is ready. >> Yeah. The issuance of um state [38:14] » the state held that one up. >> Yeah. [38:19] We could do I'm just trying to think of of of where would make sense to [38:23] » Yeah. Yeah. >> We could do [38:24] » Stephanie also you can chime in too if you have any word smithing. [38:30] » Yeah. So, you know, I think the the one concern is [38:34] that you don't want to make it such that you can do no prep work before building [38:38] permits. Um and and I think that the draft decision currently has it written [38:42] that um you're to have uh your final approval [38:47] from um the EOHLC before building permits. Um [38:56] » we could do so when we apply to the state usually means like financing is [39:00] ready, we're ready to go. Um would it maybe be on once we apply for a final [39:06] approval from the state then we can start just because I know the [39:09] construction guys were in here they would be chewing my ear off saying like [39:12] we want us we want to get the site ready you know just in case you know we're up [39:17] against time up against the elements the time of year you know I think at that [39:21] point when we apply to the state that means like everyone's kind of ready [39:25] we're putting in money to the state we're getting our approvals and we'd be [39:28] a you know max a month or two out from like BGO kind of construction there [39:35] » if we hold true to what we've done in the past. No. And again, I'm just one [39:40] person in the board members, but um when Suna was in front of us, we we had the [39:46] same thing. And it was one something with state kicked it back and [39:51] they never broke ground. Again, that's just my opinion. [39:57] » No, I've seen it before. uh for the sunken meadow uh was no grading, land [40:02] disturbance, issuance of any building permit or construction of any structure [40:06] or infrastructure shall commence until the project receives final approval from [40:10] the subsidizing agency and evidence of said approval is provided to the ZBA. [40:17] That was the wording from sunken meadow. So when they got their final approval, [40:23] how do we >> from the subsidizing agency [40:28] » and Okay. >> And the reason why I bring it up and the [40:33] vote is is held other people do it. Um we've got many lots in this town that [40:38] have been cleared. >> Mhm. [40:40] » And then they just sit. I I can think of three right now that are cleared and [40:45] nothing ever get built on them. We just we just don't want that in the [40:50] town. I'm just and this is a great project we're work you guys have been [40:53] great working with us but there are things we just got to protect our [40:56] residents with too >> I guess and I I completely understand [41:00] and you know I don't the last thing I ever want to do is like just ugly empty [41:03] lots around town I guess the only other thing we've done in the past is we kind [41:07] of put a no cut line so you know I don't know if it would ever made sense I mean [41:12] we came back with the construction team says this is where we would want to like [41:15] move early if we could and then would you know preserve most of the site If [41:20] something were to happen where then we stop like then it's you know that's the [41:23] only only compromise. You know what I'm talking about Peter? [41:27] » Yeah. Like a a staging area. >> Yeah. Some some kind of staging area [41:32] where we could circle on the plan saying we will disturb like you know this area [41:37] and we can come back to you know sounds like might have one more you know. But [41:42] so that that's just one idea. So when would you be submitting this to [41:48] because you still have to do revised plans. [41:51] » Yep. Um we'll have one more you know look for [41:55] the Beals and Thomas. Again I think that's a condition what we've done [41:59] before at least we've had it in planning board decisions you know prior to [42:03] building permit final plans with X Y and Z type of a thing. Um and any [42:08] outstanding items from peer review be wrapped up. um which again there was [42:12] maybe less than a handful of those um items. Um and then once you get that and [42:19] you submit it to EOHLC, how long is like what's that timeline anyway? [42:24] » My experience it's >> for them to get back to you [42:26] » if and Stephanie if you know maybe you know about I believe it's about two [42:30] months. So it it it varies and and I'm not quite [42:35] certain what the standard is right now um only because the um the woman who had [42:40] been kind of the head of the LIP program at EOHLC, [42:44] she left about two months ago. Um and my last final approval I did for a lip [42:50] project took a little longer than expected. Um but you know it used to be [42:56] sometimes you could almost get a turnaround in three weeks. Um, so I [43:00] think that, you know, two months probably if if if everything is there [43:06] for them and you keep kind of like following up saying, "Do you have any [43:09] questions? Is there anything we can do?" You know, just kind of the attorneys [43:12] being an annoyance. Um, you know, I think a two-month is isn't a reasonable [43:17] time frame. Um and and just for the board's [43:20] edification, you you probably know this, but as the applicant is preparing its [43:24] application, there would be notice to the town because the applicant's going [43:31] to go back to the select board and ask for um their letter of support that they [43:35] need as part of that final approval application. [43:39] Um and and pretty much once that is requested, the the applicant's pretty [43:45] much on the heels of making the submission of to the state for final [43:48] approval. >> So how long for your gifts made to the [43:53] state? [43:56] » That I do not know. It depends on construction timelines, financing, um [44:03] you know, may apply for some possible grants. So that I don't know, but we [44:08] wouldn't clear it if there's a a you know four, five, six months gap in [44:12] between us applying to state and the end of these hearings. So [44:26] » how do I feel about the staging? >> If I could even propose an interim um [44:32] time frame um when the as part of the final approval application process, the [44:37] applicant has to prepare an affirmative fair housing and marketing plan that [44:41] gets submitted to EOHLC as well. um kind of different parts of ELA, EOA, EO LHC, [44:48] review those um the the final approval application and then the U marketing [44:53] plan. But it's it's it's a good indicator that the applicant is getting [44:59] close to doing final approval if they've already submitted um the uh the fair [45:05] housing and marketing plan to get that um because that that's a big that that's [45:09] kind of a a time suck um at HLC. [45:21] I thought so. >> I mean, I Yeah, I get where you're [45:24] coming from trying to mitigate potential risk from there. Yeah. Being this gap in [45:33] » final approval >> just got burned the past two years with [45:36] this. >> Yes. [45:38] And >> we hel we held our standard and it was a [45:41] good thing we did. [45:48] I agree with you. I mean, I think it's Yeah, I think the um it's just that [45:55] concern that they might that he's at previous projects that their crews are [46:01] slow, so they just send them they clear the site. [46:04] » They're waiting for >> Yeah. [46:06] » Nothing happens. >> Yeah. [46:08] » Yeah. It's been a volatile timing in development. There's a lot of projects [46:12] on the sidelines right now waiting for rates to get better and other things [46:15] which >> exactly. [46:17] » So I I I I completely understand. I'm just trying to think if there's any [46:20] » and I and I don't want to hold up uh you know I'm sure in your mind you have a [46:26] construction cycle that you know we're applying by this date of November 1st [46:30] and I we got our guys coming in and you know [46:33] » yeah you can usually get like a good amount of work done before building [46:38] permits are pulled. I guess the only other thing and Is there a possibility [46:41] of like an escrow for this like where it's if we don't you know we apply and [46:46] we don't you know pull a building permit within a four or five months maybe we're [46:53] stretching here just >> yeah I mean those because you're you're [46:55] going to not those trees aren't going to grow back [47:00] » yeah and the poison ivy you know um >> can't blame the dollar bills so that's [47:03] true >> but I think like you said past projects [47:07] though that's happened that neighbors get like dust control issues [47:12] » and then the project just sits because funding something happened with funding [47:16] the state kicks back something >> I mean [47:19] » so even if it was like I mean you're obviously a uh you know it's a a good [47:23] kind of working relationship even with best intentions sometimes things can [47:28] happen >> another pandemic could slow shut [47:31] everything down you know that doesn't happen but no I I get completely [47:35] understand the board's concern especially if it's been an issue [47:39] recently it Yeah. [47:44] » Staging area. Uh if you just want to make sure I completely understand [47:49] what size [clears throat] of the staging room is that just kind of basically [47:53] where the house and I guess there's some kind of garage there. Um because right [47:58] now they're just like aren't they just uh abandoned? Is that right? [48:02] » Yes. Yeah. Right. That is because we would probably want we demo that. Um I I [48:07] honestly I'd have to ask the construction team more of like what they [48:10] would need uh given the site and what a staging area would [48:15] » if you're when you're clearing I mean is it something that it's it only makes [48:18] sense if you're clearing a substantial amount of the lot [48:21] » generally. Yes. >> But there's not anything like you could [48:23] do like this is a little area to clear. >> Yeah. [48:26] » Kind of get the roads and everything. Okay. clearing is relatively quick, but [48:29] then the the longer is moving there and cutting and billing and getting [48:33] » and I mean the way that the last decision was written is the the decision [48:38] was approved. >> Mhm. [48:40] » But there was the I'm not sure the word I'm looking for [48:45] » um that they couldn't do anything till they were fully funded by the state. [48:50] Yeah, I did. >> It wasn't affecting, you know, the the [48:54] potential of the board approving or denying the decision for it. It's just [48:59] » that was one of the conditions that they had. [49:01] » One of the conditions >> and I checked back on another um [49:04] decision and you also had it in that one too. Taft estates. [49:08] » Yeah, I don't remember that one. >> Oh, I remember. [49:14] » I've only been here four months. [laughter] [49:17] Um yeah, that's just something that hasn't been that thought came my mind [49:21] about a week or so ago. We haven't discussed it as um that has been [49:27] outstanded. So >> Okay. All right. Yeah. If it's a [49:30] condition that's you know appeared in the other I understand why it's in [49:33] there, you know, we could work around that. So [49:36] » um anyone else have anything for those in [49:39] the public questions? [49:43] Yeah. >> Anyone in the public comments, [49:47] questions? >> If I passed our concerns, correct? We're [49:52] » not far past anything. >> No. [49:53] » Name and address if you don't mind. >> Gary Bubble with 18 Judy Lane. [49:57] » Okay. >> Still have concerns on on a few things. [50:00] Um, [50:04] people must both come to my place and take a look at what I'm going to lose [50:06] and what I'm going to what's going to be altered and changed for me. That never [50:10] happened. I know he's looking to put in a tree line. He says my elevation is 12 [50:14] feet to my grass. 6 feet to my deck. I'm 6 foot person. That's another 12 ft. You [50:20] okay this tree line to be maintained at 12 to 14 ft. You didn't ask put it up on [50:24] an earthworm. U it's going to take years for them to grow for us to gain privacy [50:29] back again. Um the statement was made from Mr. Lois in the last meeting that [50:35] 126 is a state road. It is not a state road that is owned by the town, [50:40] maintained by the town. He said he couldn't put up lights there because it [50:44] was a state road. That is false. It becomes state at the highway, the [50:48] on-ramps and the offramps. Um, [50:53] anybody think about where they're going to get two and a half million gallons of [50:56] water extra year for this development? We got a 300 a unit at the golf course. [51:02] We got Blackstone Street. We got Paduzi doing North Street. in this development. [51:08] We got warehouses that are empty that aren't filled and as soon as they are [51:11] filled, they're going to start drawing one or two. Is that was that a concern [51:16] throughout this at all? >> I think that has come up one bit. [51:20] » Oh, did is that something you address conservation or [51:26] » the water usage? [clears throat] I one thing um [51:30] » DPW has a requirement where all new projects have their um hydrarology run [51:35] through a hydrarology model. We have a hydraology model to sort of see how it's [51:41] going to affect um their system and then they'll have to you know pay to upgrades [51:47] um to it. warehouses um and historically just don't draw that much water and so [51:51] DPW actually at least again in my past experience they liked it because it [51:56] didn't draw a lot of water warehouse properties but [51:59] » so it's something that they have to deal with DPW [52:02] » a lot of DBW was in the tech review meeting so they're aware of of kind of [52:07] the project and and you know the amount of units we're proposing so and they you [52:11] know I think every department came up with concerns you know water usage [52:15] wasn't one of them Um, so I would also say uh 126 is a state uh state road is [52:24] way way I'm looking at it. Although routes are all while they're not like [52:27] the the highways uh and I apologize I use the term highway the routes those [52:31] routes are owned by the state and under mascots's uh jurisdiction [52:37] » the state highway layout um website. >> Yeah. Yeah, it has a root number and [52:41] » Yeah. Yeah. >> Actually, it's just Google, but it is a [52:45] state road. um civic maintenance responsibilities [52:49] sometimes involve local towns acceptance. [52:55] Yeah, that's that's something it happened I think in like the 90s where [52:59] towns were offered to you know have increase in their chapter 90 funding to [53:05] sort of take over maintenance of those roadways so they wouldn't have to be on [53:09] the tip you know for any improvements um because but it's DOT still owns those [53:16] roads we have again in the community surrounding my last community they [53:20] decided to do that we didn't and it took forever to get any roadway improvements [53:24] because it had to go through the state and prove [53:27] » did the intersection of 140 and Maple Street. The state did all that. [53:32] » Yeah. >> I have [53:35] » Yep. Go ahead. >> Off the site, it said on route 126 and [53:37] no mass the portion known as North Main Street is entirely town owned and [53:41] maintained rather than stateowned. Even though the route 126 is designated state [53:46] route, Massachusetts Department of Transportation and the Mass GIS [53:49] administrative road records clarify North Main Street as a town accepted [53:53] roadway. The town of Bellingham holds a legal jurisdiction and layout rights [53:57] over it. [54:02] » Okay. >> I think the only question that came up [54:06] on that is were we going to ask them to put a traffic light up there, [54:10] » which is why you sent the traffic it up for traffic review. [54:12] » What's traffic review? >> That just came in today. Okay. [54:17] » Well, the second review came in. You've already already had the first review [54:21] done. [54:26] Um, this project couldn't happen without [54:29] portb and a border selectman granted it. And you don't have to allow it to this [54:36] size. You can shrink it down on density. You can shrink this down. Um, [54:44] I'm not thrilled that 40B is coming in behind my home value, property value. [54:50] Um, I'm concerned. I'm concerned. I'm going to see and hear [54:54] these people behind me. It's It's close to my property. [54:59] I ask that you ask them to put their trees, maintain a 20ft height, [55:05] put it up on an earth burn, do something, make a concession so that [55:08] what they're taking away, I don't have to endure with what they're putting in. [55:17] » What number you rely on? >> 18. [55:18] » 18. Good. [55:22] » I would uh I you know we do have a clear cut line there and I know there's the I [55:27] believe on the landscaping plan we do have the uh app with the green what's [55:32] the technical term >> green [55:33] » green giants >> we have the green giants which you know [55:37] are some of the they're deer resistant uh you know grow at a relatively solid [55:42] pace and uh do you know behind them when they're first put in six to seven feet [55:46] » six to seven feet and they you know I can get a box before those get to a [55:52] height for privacy. [55:59] » We did walk the site, by the way. >> I I I know you did. Yep. Absolutely. [56:04] And your thoughts on that? What the people were going to lose and the [56:07] puffers? Quite a bit. Quite a bit. I invite you to come out to [56:14] my property and take a look. [56:19] Mr. Massi was supposed to come out, but that never happened either. [56:24] » The other thing to know about the fact the elevation it does like it kind of go [56:28] it goes up as well. Um, so you know, I do think the most affected neighbor [56:34] would be the one directly to the left of us. So, you know, between the no cut [56:39] zone, the, you know, a lot of landscaping and keeping in mind the [56:43] rating plan was picked with great care, you know, we're doing everything we, you [56:48] know, we we we can to prevent any kind of disturbance to the back when it comes [56:53] to the visualization. Um, and keeping in mind too, these are one story, you know, [56:59] units. It's it's most multif family and and probably the most cost effective way [57:05] is one building three or four stories tall. So even next door on depot court [57:12] those are twotory uh buildings. So will be shorter than those. [57:17] » So so behind something like uh um 18 what's the cut line then? The no cut [57:23] line. Sorry. So I want to say it's like so that area. [57:29] Can you go back to the grading plan? So he's at 18. So those contours are two [57:35] foot contours as you look. So So it's two 46. There's a 8ft difference there. [57:42] 10 foot difference cuz that's 266. So that's 276 in his backyard and all the [57:48] way down is 266. See how that is kind of highlighted? That area right there is [57:53] like 42 feet from the tree line. The widest part is 42 and the lowest part is [57:59] like 25 where that recharge area is. And that's a cut. And like like David had [58:04] said, those structures are only one and a half story. So I mean how I mean I [58:10] don't know how high that would be, but 30 ft. [58:15] » So it's actually we had that dimension. >> We had that dimension on one of the [58:20] plans. I don't think [58:22] » well what the height of those are, but they're only one and a half stories, you [58:26] know, so they're they're not as tall as uh even a regular house. [58:31] » As tall as a house would be as tall as a house. [58:40] » But that area right behind 18, that's like 42 42 feet wide. And those trees [58:44] are going to stay. And they're all big trees. They're all tall. [58:47] » Yeah, you have them all locked. >> [clears throat] [58:50] » And we try I tried to kick that area as far. I had to do a cut though. So that's [58:56] why because the unit above that there's a big cut to get that lower. So that you [59:01] know so we're trying to put we're trying to put those units on the high side [59:05] lower down into the ground. So you're just looking you're not looking at a [59:09] structure. You're looking at the top of the growth [59:13] that 21. [59:17] So those units are only 21 from finish grade to the top of the roof. They're [59:23] only 21 feet 4 in. And that's why we kind of sunk sunk them down in the [59:29] ground. I mean, and like I said, I I pushed all [59:34] that grading, but I need to get any runoff around the buildings and into the [59:40] drainage system. So that's why it's kind of a little bit wider there because [59:45] it's, you know, where the backyard is flat and it's basically the same [59:50] elevation as the unit and we're trying to get it around that unit right there. [59:57] But it's it's probably the that area behind [1:00:01] 18 is probably the widest buffer throughout that whole back area there. I [1:00:08] mean just in that one up up in that upper corner too, but that it's only [1:00:12] right in the middle between you know 18 and that other one that it's where it's [1:00:18] narrow [1:00:21] and that was the intent you know to sink the structures down so it wouldn't [1:00:26] affect the neighbors. [1:00:30] » Anything else? [1:00:33] » Yeah, awesome thought. Um, you walked the property, you said, you saw the [1:00:40] ribbons. I can see them out my kitchen window how close that cut line's going [1:00:43] to be. I'm sure when you walk it, you saw my whole backyard or right from [1:00:47] where the ribbons were, it's going to be completely over. Uh, what waiting for [1:00:52] sixoot trees to grow is just not ideal. And then to be maintained at 12 to 14 [1:00:57] feet, it might be great for them not to look up, but me looking down, it's not [1:01:02] so great. Um, [1:01:10] I guess that's about it. >> Anyone else? [1:01:15] » Quick question on the um >> neighbor depot. I'm sorry. [1:01:19] » That's right. >> Yeah, Vader. Um, so if you looked at the [1:01:23] property, they had they had put the fence and the green giant you said upy I [1:01:29] believe. Mhm. >> Um and at one point the last meeting I [1:01:32] think they moved the access road um along that property line. [1:01:37] » Yep. >> Um and it was also mentioned that the [1:01:40] fence would be on erected on uh our [1:01:44] » on your side. Is there enough room? I mean the green giants grow from what I [1:01:48] understand pretty good. There's enough room between the fence and that [1:01:53] uh I'm sure you should know, but it seems like uh [1:01:59] there's not much room for them to [1:02:05] blow it up. >> Yeah, the access road in the and the [1:02:08] trees in the fence. It doesn't seem like the maybe I'm just looking at them [1:02:12] wrong. Now, so those circles that you that I showed on the plant, that's [1:02:17] roughly a a 10-ft diameter. [1:02:21] So that I mean that's not how they're going to be when they're first planted. [1:02:25] They're going to be able to grow wider, but they would have to on on this side. [1:02:31] They would have to be maintained and trimmed. They're going to have to do [1:02:34] some kind of trimming. >> Yeah, I was as all all our landscaping [1:02:37] that we're proposing would be maintained. So yeah, I guess there is [1:02:41] enough room. Uh obviously we would make sure that the they don't get too big on [1:02:46] our side uh where it would affect the fire lane going in. So [1:02:50] » and the access drive was was part of the fire the meeting with the fire chief. [1:02:55] » Yes. >> So that's how that access drive was. [1:02:58] » Yeah. That's I love that. Thank you. But um I'm just curious looks like the fence [1:03:04] line still right on the property line. It was agreed, I guess, to bring it in [1:03:07] onto your side of it and then then the trees come in too. I'm assuming [1:03:12] » on our side. Yeah, the trees would be on our side so we can obviously maintain [1:03:16] them. Uh I mean that's it's just on the property line right now or just as [1:03:21] designed. I think maybe a good idea is we put in the conditions, you know, that [1:03:25] the fence would be uh on our side and maintained um you know, in forever. So [1:03:31] that that could be a good way just to make sure that there's, you know, no [1:03:34] funny business 50 years. >> That's that's that's good. Also, you [1:03:38] brought up point of trimming these bushes. I mean, [1:03:42] thank you. Because they're going to be trim on both sides, so they don't knock [1:03:47] the fence over and wind up in this gentleman's backyard, too. So, [1:03:50] » what's the distance between the property line and the edge of that fire lane? [1:03:55] » At the closest point, it's probably uh I would say it looks like it's eight feet. [1:03:59] Okay. Up near the corner. I mean I mean I could try to adjust that access right [1:04:04] and push it down a little further >> or I mean there are problem [1:04:07] » but I am in the process >> there are pro yeah there there might be [1:04:10] other species of >> yeah those are just good because the [1:04:14] deer don't >> they don't well but of arborite that [1:04:19] might be a little bit thinner still tall um you might have to plant them a little [1:04:23] bit but so that way they don't get they're not as bushy out [1:04:26] » okay >> so they might be like a you know an [1:04:29] eight foot diameter at mature size. >> Yeah, we can I can [1:04:34] » but again I mean you can also just trim them. [1:04:37] » Yeah. Yeah. Let me let me talk to my landscaper now between the next meeting [1:04:41] and just see his thoughts and whether he thinks you know if he has a better [1:04:44] suggestion or you know saying kind of what what you know how those would be [1:04:49] maintained and we can definitely put that in the order of conditions. [1:04:55] I could there was also talk of a walking trail between Depot court and this place [1:05:00] of residency. Um the last thing you want is people walking around your your [1:05:06] property even though it's not on your property, you know, from place to place. [1:05:11] I think there's plenty of room. You put sidewalks in for them to go for common. [1:05:14] I think the walking trail between both places to me is a bad idea. [1:05:18] » Yeah. It's actually not on the plans right now. [1:05:20] » Yeah. No, but for >> it was just the sidewalk. Just the [1:05:23] sidewalk was >> just the sidewalk going up on Depot [1:05:27] Street. >> That's it. But yeah, the first party [1:05:29] mentioned >> it was it was mentioned in an earlier [1:05:32] meeting. >> Um yeah, it truly was. [1:05:35] » Yeah, there's someone I don't know if it could have been me. It was throw out an [1:05:39] idea at some point of of that possibility, but I think what we landed [1:05:42] on is we're extending our sidewalk and uh Depot Court's sidewalk. So they're [1:05:47] connected. Depot Port right now has a sidewalk that goes to the road. So, [1:05:51] we're gonna give it a location hopefully over to where we are. [1:05:55] » It goes to the road. It connects to the the block up there. [1:05:58] » Yeah. But I think it's like they don't have the sidewalk kind of like here. So, [1:06:01] it just kind of goes there and then their driveway. So, it's you know that [1:06:04] way the we'll probably connect down to that. So, um and then then it connects [1:06:09] the park. So, all right. Any questions, comments from [1:06:15] board members? [1:06:19] I mean, I think it seems like that that gun has shown good faith to try to work [1:06:24] with the buffer as as uh well as can be expected. there's a big elevation change [1:06:30] and I think that they've massaged and moved around the [1:06:35] buildings and I think um it seems reasonable for a close design to me. [1:06:46] Um Rachel, what are our next steps for this? Um I don't know if you and again [1:06:52] just because it seemed that a couple times somebody was making a motion to do [1:06:56] a decision. So I was like we can just we'll do a decision to you know we can [1:07:01] walk through it um on the conditions um if you want to try and go through [1:07:07] those tonight um and do a vote approve or deny. Um [1:07:15] » okay >> we can do that. Again I just following [1:07:18] the conversation. I think I only missed one meeting. Um so, but I did have [1:07:23] meeting minutes. Watch the recording of it. Um [1:07:26] » because currently we're still open. Meetings still currently be open. [1:07:29] » Yes. Yeah, your public hearing is open. Um still [1:07:33] um if there's any information that you need. I think again there's there's [1:07:38] minor things with the um peer review that need to be wrapped up which again [1:07:42] we can condition that as uh prior to building permit. Um, also adding in that [1:07:47] condition um, from what you've done before on the land clearing as well, [1:07:52] » the condition on the water man >> on the water man. We're going to [1:07:54] strengthen that a little bit um, on that. I I can word smith something on [1:07:59] that one too. Um, [1:08:04] and then the fence um, I'm going to say set one foot [1:08:08] onto um, 46 depot inside of that um, property line. Um, that's similar to [1:08:16] other towns I've worked in. >> Yep. [1:08:21] » I think what else question the board what you folks would [1:08:25] like to do [1:08:30] again. We're still an open meeting. So, we want to close it. We want to keep it [1:08:36] open. Um, our next meeting won't be until November. [1:08:40] » Yeah. We won't have quorum in October. N [1:08:46] » and so far Peter's missed a meeting already. So he can't do another Mullins. [1:08:51] I think you've missed a meeting. So he can't miss another he can't miss another [1:08:55] meeting. >> Um or else he'll be he won't be eligible [1:08:58] to vote. And then they would have to readvertise again in order to get a full [1:09:03] board um to be eligible to vote, which is, you know, [1:09:07] » not not fair to the applicant. >> Yeah. Um, so if you want to deliberate [1:09:11] on it, you open, close, you know, whatever. Um, [1:09:15] » just one thought. Um, just asking out to the neighbor. Um, [1:09:21] would having a little section of fence, would that be desirable? I mean, because [1:09:26] I think they I get where you're coming from and I, you know, I think I could [1:09:29] see being in your possession and not being thrilled. [1:09:33] would having any kind of aortion if the applicant was willing to do any kind of [1:09:36] aortion offense to obscure the view. >> It would it would be considered I'm not [1:09:41] here to bleed them for offense. >> Okay. [1:09:43] » I just want privacy. >> No, [clears throat] I'm just just trying [1:09:46] to think if there's anything >> if you guys go there and see what I'm [1:09:48] losing, you know, it's it's it's everything out the back. I get it. Yeah, [1:09:54] » you have the right to cut all those trees down and clear cut. I get that. [1:09:58] But um >> I think the hardship is in the natural [1:10:01] landscape just kind of that there's a a fair grade change and I think it is good [1:10:06] that they're one story. So I mean I'm just throwing something out there. If [1:10:10] there's any story helps >> might help, you know, be looking them [1:10:14] out at it. >> Okay. [1:10:16] » The idea of having a 40D product behind it is not thrilling. You have the right [1:10:20] to shrink it down. Hoping you take that into consideration [1:10:24] uh by density. Um, it would be entertained. A a resolution [1:10:31] would be entertained. What it is, I don't know. Plant much taller trees, buy [1:10:36] them already much larger. Put them up on an earth burn. Do something. So, there's [1:10:42] density put back so I don't have to see or hear it. [1:10:45] » Okay. The only issue I would have with having a I understand having a larger [1:10:49] calipiber any um would be good, but there is a higher risk of it not taking [1:10:55] to its new location because it's now used to it's older. I get it, you know, [1:11:00] same as people. I move around as a older person and uh I don't I don't like it, [1:11:05] you know. Uh it's just, you know, when it's a smaller caliper, if you but you [1:11:09] can get a tree that is going to grow quickly, you know, put on a couple of, [1:11:14] you know, feet in a few years. >> Um that's just my concern. Um is if you [1:11:19] get a larger tree, there is a there might be a higher chance of it dying and [1:11:24] then >> that's not what we want either. We don't [1:11:27] want to look at dead trees. >> And you know, and please don't think we [1:11:31] take it lightly. I I can just be very honest with you. I know there's at least [1:11:35] two board members sitting here that have 40B projects. They're above us, too. Um, [1:11:41] I'm one of them. And I know Brian is as well. So, we [1:11:45] » I was going to ask you guys, where you live in town? [1:11:48] » Oh, I got one right by here. >> He's got one right next to I have a 40B [1:11:51] at the end of my driveway. It It didn't affect my house value. I'll tell you [1:11:55] that. But >> it didn't. [1:11:56] » No, it didn't. >> It's been in for 15 years. [1:11:59] » I can tell you. I worked for the town for 29 years and the police for fire [1:12:02] have been at the one down here and the other one quite often. They got their [1:12:06] own keys. They bring problems. >> Well, this is what if it was all [1:12:10] veterans, great. Bring it all. >> This is an over 55 development, too. So, [1:12:15] » place that's pretty quite busy, too. Um, it is a fence the resolution if you [1:12:21] can't put bigger trees, maybe. I don't know. But some sort of resolution would [1:12:25] be nice. I think you can f I would I would [1:12:29] suggest that the applicant take a look at with their landscape architect [1:12:34] looking at some species of trees that can put on some height you know quickly [1:12:39] or fast growing trees. >> Yeah. [1:12:41] » To you know again that's just my concern. If you want to spend the money [1:12:45] on a you know much larger caliber tree that's fine. No, just because I think [1:12:49] you nailed it on the head is we have tried that before. The the the reason we [1:12:53] do the the green giants is because they're they're they they maintain green [1:12:58] because they're thick rebellent. They grow pretty fast. Like it's not [1:13:02] » the least expensive tree we go with or like the tallest tree. It's the one that [1:13:06] like it's the most sturdy. It's going to grow and we find that provides the best [1:13:10] shading. So, it's it's that's kind of why we we go that way. [1:13:17] Okay. >> Can I get a copy of that uh traffic [1:13:20] study? >> It's online. [1:13:22] » It's online. >> Absolutely. [1:13:23] » Thank you. >> Yeah. Absolutely. [1:13:25] » Any other uh still it's still open unless someone wants to [1:13:32] make a motion to close bulk here. >> I [1:13:37] No, I was just Stephanie, >> you can't make a motion. [1:13:39] » Yeah, I can't make a motion. [laughter] [1:13:43] Can't make one. Um, [1:13:46] » may >> Yes. May I ask one question? [1:13:51] » Um, go ahead, Stephanie. >> Thank you. So, if the if the board isn't [1:13:55] going to meet again um until November, um if they're not prepared to [1:14:05] well, under 40B, you can vote the decision um and then you have 40 days to [1:14:11] issue the decision. So you have time and that you can then go and review an [1:14:17] updated draft of it and get it out. So voting it doesn't mean that you have to [1:14:22] issue the written decision within a day. Um and the other part of my comment was [1:14:28] if you aren't comfortable with that at this point, is there any ability for the [1:14:33] board to have a special hearing yet later this month um rather than wait [1:14:36] until November? Um we myself and Rachel did discuss that [1:14:42] at one point. Um >> the only time I would be available um in [1:14:49] this room would be available um is the 17th. The planning board meets um the [1:14:53] 10th and the 20. So I would not be here. Um but I'm sure you not that you can't [1:15:00] do anything without me like you guys are capable adults. [1:15:06] » [laughter] >> Um [1:15:10] » I can do the sub but what >> I guess you run the risk of yeah people [1:15:16] schedules it gets >> tricky [1:15:18] » I guess so Stephanie would an option be that the board votes to accept the site [1:15:24] plan and you know the waiverss tonight with an understanding that we would need [1:15:29] like can they condition a clean letter from uh Beals Thomas with like you know [1:15:35] you know appropriate plans or changes made. Is that possible? [1:15:39] » You you can do that as a condition of a comp permit. Yes. Just because it's it's [1:15:43] it's just wrap-up items at this point with respect to the bills and Thomas. So [1:15:48] if if the board's inclined, they can they can vote and condition that you [1:15:53] know one of the conditions um you know before building permits obviously um is [1:15:59] that the the you know peer review has has acknowledged you know close out of [1:16:04] all of any of any open comments >> um and and like [1:16:08] » yeah I have some you know standard language that I've used in planning [1:16:11] board and as well as your decisions too um before [1:16:15] » and plus we have 40 days to go through the the decision And it would it's [1:16:19] essentially we're doing the same thing that we normally do is you're making [1:16:22] you're decide making a vote subject to draft conditions or draft conditions and [1:16:26] standard conditions and the following special conditions. You don't have to [1:16:30] get them perfectly wordsmith tonight. That's usually what I do. And then you [1:16:34] know then you do you do whatever your vote is and then I write up that [1:16:39] decision you know making it planner flourishes you know great word smithing [1:16:44] that I do. Um and um then you just come in and sign it. [1:16:49] » You want me to make a motion? >> Yeah, [1:16:52] I did entertain the motion um to close the public hearing. [1:16:56] » I'll make the motion to close the public hearing. [1:16:59] » I have a second. >> Second. [1:17:01] » All those in favor? >> I [1:17:03] » I [1:17:07] have a question first because I'm not really sure [1:17:11] what's the value in closing right now. Do you want any new information? [1:17:18] Do you need any new information to make your decision? [1:17:22] Like substantially new information. Once you once it's closed, then you [1:17:27] don't you can't take any new information. You take clarifying [1:17:30] information except what's conditioned within your decision. You know, like [1:17:34] we're going to >> So, how do we proc this later on like as [1:17:37] it's being developed? So, we're out of out of it after this [1:17:40] » once once we condition it. um they have to follow all our conditions. [1:17:45] » Mhm. >> Yes. [1:17:46] » We won't actually follow it unless the building inspector comes back and says, [1:17:49] "Hey, this is outside the scope of your decision." [1:17:52] » Okay. >> So, they process. [1:17:54] » Yeah. >> If they decide that they're going to put [1:17:56] up a 15th building, three stories high. >> The only thing that's probably going to [1:18:01] come before you is on any of these permits like the DPW street opening [1:18:04] permit. That'll come back before you at some point, you know, when they're [1:18:07] ready. any of those things, those will come back before you. But that's not a [1:18:11] public hearing. >> It's just a permanent. It's [1:18:14] administrative. >> Yeah. Yes. [1:18:21] » Okay. [laughter] [1:18:26] » Discussion with the board. Thoughts, [1:18:30] concerns? [1:18:34] You can speak. You can't vote. to speak. [1:18:38] » My first uh my first real looking at this. So, it's [1:18:43] kind of just learning how the process works. And [1:18:49] » I mean, you know, I'm I'm still concerned about traffic in that area. [1:18:54] You know, it's it can be very difficult to get in and [1:18:59] out of that area. >> I've actually been down the past three [1:19:03] or four mornings for something else. [1:19:08] at home's going to disagree with you. >> That's observation bias. Maybe [1:19:12] » it is. [laughter] I was I was actually there quart 8 this [1:19:16] morning. I pulled back out about 910. I think at like four o'clock different but [1:19:23] » yeah that whole >> I will say that with that in the past [1:19:28] because I know Brian Salsbury would be a stapler for that and say like are we [1:19:31] going to calculate the worst case scenario and it still didn't really [1:19:34] change anything with the >> trafficis [1:19:38] » I feel like I don't fully trust all the traffic analysis but you know at all but [1:19:43] I also feel like it's hard to >> I don't know how you um [1:19:49] » quantif ify it or condition it. >> No, no. It's just an observation that [1:19:54] every time they say it's not going to happen anything right there. [1:19:57] » Yeah. >> I've never read a traffic study that [1:19:59] said this is going to impact traffic. >> Every single one of them says this will [1:20:03] not impact traffic at all. >> Yeah, it's true. Yeah. [1:20:09] » You do have a peer review that was done, you know, independently for you though [1:20:13] that says the same thing. Yeah. >> The same thing. [1:20:17] » I agree with you. I know it is kind of to me it is sometimes frustrating [1:20:21] because it does seem like every time they say it's never going to impact. [1:20:25] » Yeah. And I mean maybe it's not in the grand scheme of [1:20:30] things and maybe it's other things going on but it is a very congested [1:20:34] » area. So [1:20:39] that's that's my one right questions. >> No, I don't think so. I I think I'm [1:20:46] comfortable. [1:20:50] » I just want to make sure they [clears throat] [1:20:53] they do the best effort, you know, to uh for the ones that are on the left side [1:20:58] or I guess I guess that be the west side. [1:21:02] » Yeah, be the left side. >> Um you know, work with the the [1:21:10] mothers there. >> Absolutely. Um, but I think, you know, I [1:21:13] think uh everything's been worked pretty well over that. [1:21:16] » I mean, I don't um go back to that. I mean, I hate using the word BM. Um, I've [1:21:22] seen them. I'm not a huge fan of them and and I'm not sure you even have the [1:21:28] width to get a a 10-ft burm up there. The width you would need for a 10-ft [1:21:33] burm, you'd wind up clearing more trees to get a burm in there. [1:21:37] » Yes. Because >> 10 feet you've got to be what 20 20 30 [1:21:42] feet wide taking down more trees >> and you've got terrible storm water I [1:21:47] think like your control for storm water like the things going up and then really [1:21:52] and then like you're saying like I get like you need to you can't have the [1:21:55] thing slope right to the back of the building. [1:21:58] » No, >> you want some sort of a flat area. I [1:22:01] » think you want to take up more trees, but the width is what the height of it. [1:22:07] I hate burps. It's worse than the sound is. [1:22:12] » You brought up something hate. >> I just We've allowed it a few projects [1:22:17] and I'm just like, why did we do that? Um [1:22:25] Rachel, you have the [1:22:29] um the water man. [1:22:32] » Yes. Jack, we're going to strengthen that language. [1:22:36] You have the um Oh my god, I brought a metal blank. [1:22:41] The clearing the land clearing. >> Yes. [1:22:44] » And wasn't there one more? >> This the fence. [1:22:47] » The fence >> the I have water main strengthen. Um use [1:22:53] the no land clearing from sunken meadow, the construction management plan that [1:22:58] could that's part of our um pre-construction meeting. Um but I can [1:23:03] put it in there just so it's there. Um and then final plans to show the line [1:23:08] striping and a stop sign. Uh the fence um over by 56 Depot Street to be set one [1:23:15] foot onto 46 Depot Street's property. Um that's what I have for the special [1:23:22] additional conditions that have come out of this discussion tonight. [1:23:25] » Do we need to put in that it's they maintain they continue maintenance on [1:23:29] it? >> I will I think I might have some [1:23:31] language in here already. If I don't, I will put that in there along with the [1:23:34] landscaping maintained in perpetuity. >> Um, [1:23:40] have the rest of the board, have you read her preliminary decision that she [1:23:44] emailed? [1:23:47] » And now, do you want that word changed townhouse to something else? [1:23:52] » No. As long as it's not okay. Listen, if if we're going through all this effort, [1:23:56] they're going through this effort, the neighbors going through it. I don't my [1:24:00] thought was I don't want that one word to get to the state of whoever's [1:24:04] approving it and say oh these are town host and just dump everything right back [1:24:08] to them. That was my only concern. >> Okay. [1:24:11] » I just in fairness to everyone put effort into this. Ask them [1:24:16] and neighbors and >> Yeah. Okay. [1:24:19] » That's as long as it's not going to screw up their application. It's on [1:24:23] them. If it does [clears throat] [1:24:27] on them, >> right? Yeah. [laughter] [1:24:30] Okay. >> Do we want any wording for the west [1:24:33] side? [clears throat] [1:24:39] » Um, do you want uh fencing along the rear of the property line? [1:24:45] » I don't know. Fencing will help. >> You You're putting up six foot green [1:24:50] giants. >> Yeah. [1:24:51] » And a sixoot fence. What's that going to >> Yeah. That sounds like the neighbor is [1:24:56] saying too that it's um it's got the second floor and [1:24:59] » yeah the old >> I think what you said was good James [1:25:02] that kind of that I guess just the applicant kind of working [1:25:06] » with the abutter >> say that [1:25:08] » going as as >> you can't [1:25:11] » maintaining whatever you can >> landscaping including some trees that [1:25:16] have maybe more of a canopy understanding yes that means it's [1:25:19] deciduous so it's going to lose its leaves but even then that's you [1:25:24] how how long how you know that's that's something a tree that has a canopy so [1:25:29] that way he's not looking at that >> you know see where the your landscape [1:25:34] architect can fit one of those in. Yeah, we [1:25:38] » I mean, yeah, that's that's something that I could think of because again, you [1:25:42] look at something with 21 feet, there's plenty of trees that could get well [1:25:46] above that, you know, quickly. Um, and have a canopy that comes up and over, [1:25:51] you know, and provides enough. >> And I think the hard thing is the the [1:25:54] elevation differences that you put up a 50ft tree. [1:25:58] » Yeah. because you're looking down on >> but then that canopy is going to be out [1:26:03] you know you know >> so the current cut area how tall are [1:26:08] those trees [1:26:11] » yeah I thought >> yeah they're they're big pines [1:26:16] » they're over they're over 20 ft >> yes [1:26:19] » the non cutter is already you know >> yeah right [1:26:22] » I think we yeah all we can do is kind of ask that they maintain as best they can [1:26:27] » I yeah >> they're [1:26:33] What do you guys want to do? [1:26:38] » Make commercials. [1:26:42] » We haven't heard from you for a while. [1:26:47] [laughter] >> Well, you're not listening to [1:26:51] a long time. >> Been quiet over there past. [1:26:57] tired. Um, yeah, I mean I, you know, I don't [1:27:02] think we need more information other than what we still have to receive. I [1:27:07] guess I have one clarifying question, Rachel. Um, if we vote and approve and [1:27:13] it has the 40 days, will we have that time period to review the additional [1:27:19] submissions and the new plans? Yeah. >> Okay. Yeah, they may get that stuff [1:27:24] prior to even having that, you know, meeting that that happens a lot too. [1:27:29] This just gives you that buffer that okay, this is your stop dead date. Like [1:27:32] if you do not have it by this, you know, you're not getting a building. [1:27:35] » And when you email us or when Amy emails us that the other question I have here, [1:27:40] thank you for bringing that up, was is the 20-day appeal period, is that from a [1:27:46] vote, if it was approved, is that either way they got 20-day appeal. Is that from [1:27:51] today or 40 days when we sign off from the file decision? [1:27:55] » 20. It's 40 days from today. If you whatever your vote is today, you have 40 [1:28:00] days to get that decision. And then as I understand it, once you as soon as you [1:28:05] submit that >> decision, that's when the 20 days [1:28:09] starts. >> Yeah. [1:28:15] » Yeah. Um Okay. I will make a motion to approve [1:28:23] the the special permit [1:28:26] » comprehensive permit >> comprehensive permit with the [1:28:32] conditions that Rachel is going to >> specified [1:28:36] deliberation in our deliberation >> and draft and uh the draft conditions as [1:28:42] presented in the draft conditions as presented. Anything more missing than [1:28:47] that? [1:28:56] » I know you're looking at me. Do you want me to second? [1:29:00] » Don't tell me what to do. It's going to be a long night. [1:29:03] » Yeah, there's other people here. I'll second. [1:29:07] » Well, we have a motion. We have a second. Um, we have to do a roll call on [1:29:11] this. >> Yeah, might as well. You did it for the [1:29:13] last one. So, oh, do we also need to do the waivers um individually [1:29:18] um or do a vote to uh approve the waivers as presented? [1:29:24] » All right. Should we >> do this vote and then you know you could [1:29:26] do your the waivers as as well. Is that order okay, Stephanie? Or [1:29:32] » I sometimes prefer the vote on the waiver first, but um [1:29:35] » Okay. >> All right. We can hold on that vote. [1:29:38] » Does the motion withdraw you need me to withdraw? [1:29:42] » No. No, >> I entertain a motion to accept the [1:29:45] waiverss um and hold. [1:29:52] » So move >> second. [1:29:56] All those in favor? >> I [1:29:58] » I >> All right. So, we have a motion and a [1:30:02] second to approve the comprehensive permit with the inserts that you're [1:30:08] going to put in. And we're still waiting for comments back on the one item [1:30:13] traffic study. >> Yes. Yes. [1:30:18] um >> which that was one of the um special um [1:30:21] conditions subject to the draft conditions as presented and the special [1:30:25] conditions um as discussed during your deliberation. [1:30:30] » We'll do a roll call. >> Liz I [clears throat] [1:30:36] can't I [1:30:43] motion passes. [1:30:47] the lawyers run out of the wrong question. [1:30:49] » Yeah. Right. >> Okay. Um so yeah, 40 days to do that. I [1:30:55] could I probably have it, you know, minor tweaks here and there. Um probably [1:30:59] by end mid end of next week um to you guys. [1:31:04] » I'm here until the 25th. So >> Okay. [1:31:08] » All right. Great. And then we we'll respond just to you just to me. [1:31:13] » Yes. Not Not reply. >> Not reply. [1:31:16] » Yes. I will make sure I will blind copy you as well so you don't you know set [1:31:22] you guys up for success. >> God damn it. [1:31:25] » No. >> Okay. Awesome. [1:31:28] » Good. >> Thank you. [1:31:30] » Thank you. >> Thank you Stephanie. [1:31:33] » Thank you Stephanie. >> Thank you Stephanie. [clears throat] [1:31:37] » Thank you. Have a good evening all. [1:31:41] Thank you. try. [1:31:47] » Okay. [1:31:51] I guess we're not. >> So, [1:31:54] um the next item we have on the agenda [1:31:59] » actually has approve meeting minutes. I >> have some question. [1:32:04] » Liz um did have an edit. The copy that you have in your packet doesn't have [1:32:08] that edit, but I did change it. Um the LA end it was to close the meeting of [1:32:12] August 8th as opposed to August 6. So I did make that change in the final [1:32:17] version. Thank you for double checking. >> Oh [1:32:22] maybe >> I'm just sometimes I throw things in [1:32:25] there, you know, just to see if you guys are paying attention. [1:32:30] » We should Can we still approve them with the Yep. Yeah. I understand motion to [1:32:35] move the minutes from May 6th, 2026 [1:32:40] » as amended. >> As amended [1:32:43] moved >> second [1:32:46] favor I >> Okay. Um [1:32:50] I don't even remember doing this but next item on the agenda is certificate [1:32:56] completion statement of Curtis Apartments development. [1:33:00] » Uh vote to release of the covenant. Yeah. Um [1:33:04] » honestly I don't know about the covenant accept that when we did this but [1:33:09] » that's okay it happened. Um so they are going through their um transferring of [1:33:15] ownership of this. So we're going through the comprehensive permit with a [1:33:18] fine tooth comb um and tying up all of those ends. Um and one of them was this [1:33:23] um only thing so you know they have completed which is that letter um bowler [1:33:30] um provided to us as well as um as plans too the we're not taking over the it's a [1:33:36] private property still it's just a sewer um that goes through their line u but [1:33:43] that's we're not taking ownership of the private property [1:33:47] » selling it amazing anyways [1:33:50] » so um if you is vote. Again, they are entitled to a release because [1:33:54] everything's completed. Um, sign it. One person can't sign it [1:34:00] because they need to have it their um thing notorized. [1:34:04] » Okay, great. Awesome. >> So, [1:34:07] » so motion to release [1:34:14] » release the covenant. >> Release the Curtis. [1:34:17] Curtis located at 165 Street, Bellingham, [1:34:21] Massachusetts. >> Okay. But so moved. [1:34:24] » No, I need a motion, dude. >> Okay. Motion to release as as stated. [1:34:28] » A second. >> Second. [1:34:29] » All in favor? >> I [1:34:36] can hear for just for that. Yeah. >> I Yeah, I told them that that you didn't [1:34:41] need to come. So, Yeah, [1:34:51] » unless you guys want to hang out more. >> No, I I definitely say a motion to [1:34:56] adjourn this meeting. >> Second. [1:34:58] » Okay. >> All those in favor? [1:35:01] » I. >> And we are closing the September 3rd, [1:35:04] 2026 meeting. >> There's no October. [1:35:07] » No. Great. That's great. Fantastic. I can't say this.
