Our first item is approval of [0:18] minutes from our July 15 meeting. >> Mayor. [0:21] » Yeah. I guess if it's okay, I'd just like to make a couple [clears throat] [0:40] editorial comments before we get started. So, appreciate everyone being [0:44] here. Um, just to make sure that we're all on the same page as we start our [0:49] discussions. The nuisance review board was established two years ago and this [0:56] group that meets once a month is responsible [1:02] for reviewing complaint forms that have been submitted to the city for [1:09] consideration and to be addressed. So that's what this board every member has [1:16] been established to do. So our job as individuals on the nuisance review board [1:21] is to sit in a meeting [clears throat] kind of be the I guess mediators of [1:28] neighborhood concerns and issues and to review those you know complaint forms [1:35] that have been submitted. So that's what we've all been requested to do this [1:41] board and that's what we're going to do this morning. We have, I would say, a [1:47] record number of properties to review today. So, this meeting is going to take [1:52] a little bit of time. It's going to take a little bit of patience. And what I [1:56] hope we will do is that I hope we'll methodically and compassionately [2:02] go through each of these properties, discuss them, and with deser discernment [2:08] come up with what the right recommendation as a nuisance review [2:12] board would be. So, that's kind of what I want to just [2:18] throw out there to set the stage for the meeting even before we get into any of [2:23] the property reviews. Um so so mayor one one question I would have an addition [2:30] before we get started you know as we go through the properties I think in the [2:36] past you know as we've gone through property by property [2:42] you know if there's anyone in attendance that has input on that property [2:48] I think it's fair for them to provide their input at that point in [2:53] [clears throat] time while we're discussing [2:56] not not after we've made a decision, while we're making the discussion, while [3:01] we're having the dialogue. So, that that would be a suggestion I would have. I [3:06] know with the last meeting, we did that with one of the properties and I thought [3:10] it worked effectively. [4:18] Um, so going back to the last meeting, [4:23] [clears throat] I believe, which was on July the 15th, [4:27] we just approved meeting minutes limits. So at that meeting, we were going to [4:32] send a grass and weed letter. Um, and I believe we we say in the review of [4:40] properties documentation we have in front of us that that was sent via [4:44] certified mail on July the 16th. So my question, no one's currently [4:51] living in that property. So where do we send it? Did we send the water bill to a [4:58] another address that >> it goes to where their um property taxes [5:03] go? They're outside Decator in the country. [5:06] » Okay. So that's where they get their water built also then I'm assuming. [5:11] » Yeah. >> Okay. And that's where we would have [5:13] sent the certified letter. >> Mhm. [clears throat] [5:16] » So do we do we know that they received it? Did we have [5:20] » Yeah. The receipt. >> Okay. So they received it. Um, and for [5:25] the grass and and weed letter, they were given the normal 10 days to remediate. [5:35] And I don't know, in my opinion, it doesn't [5:38] look like they've remediated. [laughter] >> Well, if that was sent mid July, we're [5:43] in mid August now. And it's rained a lot. [5:47] And I would say this looks pretty normal for being cut. And then we've received a [5:54] lot of rain and my yard grew a lot in this past week. So [5:59] I don't know if you can say this is a month's worth of growth or did they mow [6:04] it and this is a couple weeks worth of growth. [6:09] » Okay. >> Hard for me to tell. [6:11] » Yeah. Then from a I guess from a process [6:16] perspective, I mean would we have checked them 10 [6:20] days after they would have received the letter so [6:24] that we know what it was on July the 26th? [7:29] What what I would recommend since we've been down this road with them before [7:34] that we send another grass and weed letter certified [7:39] and that we >> follow up at 10 days and if it has not [7:45] been remediated then we take steps to remediate like we would normally do. And [7:53] I guess the other thing I would recommend when we add some sort of cover [7:58] letter to these letters that we mail out, we seem to get better response [8:03] because we tell them specifically what the issue is and the concern is in the [8:09] case of this one. They're not from burn. They're not [8:14] living in the property. So they need to make sure they're mowing when they're [8:22] working on the property. When they come down to do their construction work, they [8:28] need to mow, you know, just like they were living in it. So that that would be [8:33] my motion. And I think we need to need need to send them another grass and weed [8:37] letter and we need to also include some sort of cover letter that hey [8:44] you need to take care of your property not living. [8:48] » What would be the time [clears throat] >> on a on a grass and weed letter? It's [8:53] always they got 10 days to remediate. So, we send out mowing letters that are [9:00] five days, >> which I'm fine with five days. [9:04] » So, >> I mean, because [9:05] » if I would say if it's just mowing, if it's over the 8 in, normally we have [9:10] police go out and measure. If it's over the 8 in, we send a mowing letter [9:14] » and then we follow up in five. If they haven't mowed it, the city can either [9:18] mow it or we can pay someone to >> and maybe the reason why it wasn't [9:23] checked up was it wasn't a mowing letter. It was a business letter. [9:26] » Yeah. those we stay on top of and check up with and then we invoice them for if [9:31] we would do that. >> I think that would be a better solution [9:35] for this because it's a shorter time period. There's better followup for more [9:40] followup. [laughter] So, I would alter my motion to sending a mowing letter by [9:47] certified mail to the owner um and then follow up on it and if it's not [9:54] remediate. the other things that we've talked to them about as far as keeping [9:59] the yard and stuff cleaned up while they're working on the property in the [10:04] backyard. They're doing that. It's the front yard that is on Jefferson Street. [10:09] It just doesn't look very good and it needs to be tended to better and they [10:16] don't live there. So, they need to be more responsible on making it happen on [10:21] a regular basis. At the bottom of the pictures that went with the letter last [10:25] time, we put grass seeds mowed weeds on the entire property. Both front yard, [10:30] sidey yards, backyard, and behind the garage all need trimmed. This was sent [10:34] with the letter, too. >> Okay. Um, [clears throat] and I said, "Well, I [12:12] don't know if that exactly happens, but anyway, he just said he couldn't pay it. [12:17] He's dealing with a lot of a lot of issues. His dad's sick. Um, [12:24] he's had multiple reasons for not being able to pay it." Um, so I I [12:33] said, "Well, it's it's a fine that is due and you owe the fine." and um and he [12:39] walked out. Um what what I would like to interject [13:06] this property even from our last meeting if you look [13:11] at the two pictures um Greg I think you mentioned to him at [13:16] one point in time maybe getting just a little better [13:21] organized with what you have on your front porch [13:25] and he definitely has attempted to do that. It's all kind of up by the front [13:32] door where it used to be kind of all over the place in the backyard. Um, they [13:38] have worked on some of the vegetation. I mean, you know, hauling away some of the [13:44] stuff that they've cut down would be helpful, but they've cut some stuff [13:48] down. And if you remember right, they had several vehicles that it took a [13:53] while for them to get removed. They did get removed. Um they had an unsafe [14:00] vehicle um sitting in front that was up on jacks that we asked them to make safe [14:07] and get remediated. They did that. Um so from where this was six months ago, they [14:16] have made strides. >> So what are you suggesting, Ron? Yeah, [14:21] [clears throat] >> I'm suggesting at this point I'm not [14:25] sure what more we want to push for. [14:32] I mean, I drove by this property last night and it's it's not half as bad as [14:38] it was six months ago. So, I'm not I guess would I like to see more [14:47] progress? Yeah. We can attach tax refunds, those kind of things. [15:45] I mean, I think there's two options. You could either find them again [15:54] or we could monitor the pro monitor the progress to make sure it doesn't go the [15:59] other direction. So, un those are my two options, but maybe someone else has [16:06] another option. We can find him again. But I my thoughts [16:12] are if he says he can't afford to pay the $100, he won't be able to afford to [16:16] pay the $200. So, but if he doesn't make progress, we can find him again. [17:44] » Well, the owner is his dad is living in there. [17:47] » That's what I'm asking. Where does his dad come in? He owns the property. [17:52] » His dad is sick with cancer. The rubbish in the in the front, I don't know what we can do about that. He [21:54] obviously can't afford a storage unit if you can't afford to pay the fine. [25:54] And I've that fence is not up because the fence company hasn't been down to [25:59] put it up because I think they're busy. they can't they just haven't been able [26:03] to get here from what I understand unless somebody else has something. Um [26:08] so we're still waiting on that fence um to be put up on that property. Um [26:16] and [clears throat] [26:19] the um he had he had stopped in and had a talk with me [26:26] after he got a warning letter and I think I mentioned this last at the [26:36] last meeting. He um he is on disability. His wife [26:44] was sick or had been hurt um and was off of work for several months and she's [26:51] back to work now. And so I told him at that point in time if he could just [26:57] [clears throat] make his things um more orderly looking that that would go [27:03] a long way with with our committee just to have it look a little nicer. I don't [27:10] know if he has done um done that totally, but um [27:18] [clears throat] [27:21] that that was his comments to me when he stopped in and I told him I think the [27:25] committee would just appreciate um [27:30] seeing an effort on your part to make things look a little more orderly and [27:36] not not like a mini junkyard. So [27:43] he um I thought he understood what that meant. [27:49] He sounded like he did. So, but I know the trailer [27:54] um that this is his way of trying to make money since he's on disability is [27:59] to um gather these items on a trailer and [28:04] then take them someplace and sell them. And um [28:09] so that's why we see the trailer empty sometimes and then the next week it's [28:13] full again. >> Shouldn't be a trailer on the property [28:16] like that. [28:20] » Half the time it's almost in the front yard. [28:23] » I don't know. We You know, we kicked this thing down the street for two [28:28] years. This came up in August of 24. [28:39] » We had this discussion at the last meeting when the owner was here. They've [28:46] not been on the nuisance review board list for two years. So, we can't say that they've been on for a [29:05] continuous period. They've been on for two periods. [29:09] » At the beginning, it was it was the front yard and we they addressed what we [29:13] said, >> right? So, that got addressed and then [29:16] the second time it came up, it is the scrap. It is the trailer. It is the [29:22] backyard. And at the last meeting when the owner was here, [29:28] he said he told us, you can read your meeting minutes, that the owner is [29:33] buying or the renter is buying the property [laughter] off of them on a [29:38] land contract. and he the owner had come up with an [29:43] agreement with them that the owner would the property owner would pay for a fence [29:50] and then he would add that to the amount that they owe on the house and both [29:56] sides were agreeable to that. And what we left the last meeting with is if they [30:03] can get the fence up and like the mayor said, make things a little more orderly, [30:10] then they would address the things that are in front of us. So here we are now [30:14] at this meeting. The fence isn't done. So, so my thought [30:21] reviewing this and getting ready for this meeting is I think the owner [30:27] and renter need to be requested to come to the next meeting and give us an [30:33] update where they are one month from now because I don't I don't know that we can [30:40] take any other steps other than that today.
