Uh 318 Ives is located in RP [2:09] and the RP district only allows for single family residential plus one [2:15] additional occupant as the if the property is owner occupied the [2:20] surrounding properties majority nonconformity in regards to the [2:24] multifamily rental status staff is aware that there's a high number of non [2:29] non-conforming properties in the area of the RP district and there's a map in [2:34] your packet that was provided. There's actually two maps. Uh the first map [2:40] shows the area and the rental properties that are in that area and how many units [2:49] are in that rental by color. [snorts] And then the other map is a little bit [2:56] confusing. Um, but it shows where the R what the like what properties are zoned [3:04] RP in the city and then if those properties [3:09] have the P exemption, which means that they're a primary resident for um [3:17] the occupant, which usually if something is a primary [3:21] residence for an occupant, I'm actually if a if it's a primary residence for an [3:26] occupant. It's not a rental. That's usually how we catch them like or can [3:32] kind of figure it out because if you're primary residence, you're not renting [3:36] unless you have a single occupant rental. [3:40] So um and then it shows like which one are active rentals, which one were um [3:49] primary residences um in 2007, which is when the RP [3:56] district was established and which ones have always been primary residents. [4:03] So that's what that map means or [snorts] shows. Uh the RP zoning, it's [4:10] relatively new. As I said, it was only in 2007, which sounds not new, but in [4:16] zoning world, that's new. Um resulting in a high number of legal non-conforming [4:22] properties, which means they existed prior to that RP's district being [4:27] established. since the establishment of RP 318ISE had [4:32] been used as a single family residence. So, it was conforming to the ordinance. [4:38] Um, since it was conforming, the variance would be required to allow the [4:44] non-conforming use to exist on the property. [4:49] The house itself is situated on par. It gives a partial number and it has four [4:54] bedrooms and the applicant plans to prepare a surface in the rear yard [4:59] adjacent to the alley for parking. [5:04] Uh the case of the zoning board of appeals arises from the fact that the [5:08] majority of the surrounding properties are legal non-conforming multifamily [5:12] rentals. When purchasing the property, the applicant was under the impression [5:16] that there are area allowed for multifamily rentals due to the high [5:21] number in the area. During the renovation and rental inspection [5:25] process, the applicant was informed that they could not rent out the unit to [5:30] unrelated occupants because it would classify as a multifamily rental, which [5:34] is not permitted in the RP district. [5:39] Um, the next section of your staff report goes through the standards for [5:45] variances and staff's analysis of those standards. Uh, due to the uses of the [5:51] surrounding property and the proposed use of this house standing in contrast [5:55] with the intention of the ordinance, staff cannot recommend outright approval [6:01] of this ordinance as there is very limited hardship that wasn't [6:05] self-created. [8:16] We have tried to find ways to make school affordable [8:20] um not just for us but for um the people that also will live with him. Um, one of [8:26] the ways for us was to purchase a home and allow our child to live there with [8:31] roommates that help share the costs of living. Um, we are asking for a variance [8:37] to be able to use this property as an open owner occupied student rental for a [8:41] total of three renters. Um, when looking for a home in the [8:47] rental district, we did so in good faith um with good intentions, thinking it was [8:52] an appropriate rental district. um as this is what we were told. Um we [8:59] were shocked to learn um otherwise near completion uh of the renovations. [9:04] Um and solely the result of misinformation, misunderstanding from [9:10] the realer that we um had on the other side of the transaction and we apologize [9:16] that we have to be here for this now. Um, however, throughout the process of [9:20] transforming this property, we pulled all of the proper permits. Um, we went [9:25] above and beyond on the renovations. The property was truly an eyesore on the [9:31] street. It was very overgrown. Um, the wind there were no windows on [9:37] the um exterior or the porch on the side of the house. Um, it was overgrown with [9:43] vines. There were animal feces in there. Um floors needed leveling. The kitchen [9:49] was very dilapidated. In place of the kitchen sink was a washer and dryer um [9:55] that was hooked up there. The um there was a stove plugged into the middle of [10:02] the floor of the kitchen. So made the kitchen basically um [10:08] nonfunctional to the average person. Um, bathrooms [10:14] um were also very outdated, 50 plus years [10:19] um for the age of the vanities. Um older plumbing, unsafe electrical. Um and [10:26] those are all things that we took care of. Um, and we're very proud that it is [10:31] now not an eyesore and it not only um looks beautiful, but it also helps to [10:37] raise the property value um for the Big Rapid School District as a whole. Um, [10:44] but especially on that street and for the neighboring properties. [10:48] Um, [10:51] let's see. Um, we um invested in it, substantially [10:58] improved it, and brought it back to a condition that contributes positively to [11:03] the neighborhood while increasing surrounding property values. The [11:07] proposed use is consistent with the established residential renter character [11:13] and actual use of this particular street or block. Um we are are asking for a [11:21] sight specific variance because of the unique circumstances of this property [11:25] and this particular block. There are in fact students living next door that have [11:30] moved in in this past week um there now. [clears throat] [11:34] Um the property is already a rental district or in a rental district. The [11:38] surrounding properties are overwhelmingly [11:42] rentals. Um, student rentals already exist immediately around it. Our son is [11:48] now an owner of the property, so it will be owner occupied and maintained. And [11:52] the physical property has been renovated to accommodate residential [11:57] uh rental use. The home um was well is well prepared to support student [12:03] housing. It has four parking spots, not on the street. The permit was pulled and [12:08] approved for that. There are house rules to keep things in order. Um, Payton will [12:14] be maintaining the home and the yard um and overseeing the management of the [12:19] property. Our proposed is not [sighs] our proposed use is not materially [12:27] different than the use of the surrounding properties. Um, I will also [12:31] be stopping by uh periodically. I'm we're we pass this town on our way more [12:37] north of here a lot. Um the rental division has inspected it and [12:43] approved the home and the other things that were approved there were um the [12:49] plumbing and electric which we pulled permits for. That's all new throughout [12:52] the home. Um we aren't asking the city to to change the character of this [12:57] neighborhood. We're asking the city to recognize the character that already [13:00] exists. Um, we have demonstrated our commitment to this property and this [13:05] neighborhood through our substantial investment and rehabilitation. [13:09] Again, it would be owner occupied and we understand that some properties have [13:14] established or grandfathered rights. We aren't asking the city to disregard its [13:18] regulations. And uh [16:13] we've watched it deteriorate year after year. Um that's why we're so glad to see [16:20] the new owners step in and completely renovate it this summer. They've shown a [16:24] real commitment to upgrading the home so that four individuals can live [16:29] comfortably there. There's four bedrooms, as you stated, a bath and a [16:32] half. Um, we've toured it. It's beautiful. Um, they've also upgraded the [16:38] off streetet parking, which is nice um to easily handle four cars. So, um, [16:45] based on the significant investment they've made, I have full confidence [16:49] that they will continue to maintain the property to a high standard. And luckily I [17:36] was in a position to buy one and I did and kind of like these folks did that [17:40] the next summer I gutted it, redid it all and I've held on to it and I've I've [17:45] held on to for the fact that uh I've been landing grad students. I just love [17:50] staying in touch with these kids and giving them a nice place. I also went [17:54] down the rabbit hole of how hard is it to figure out what that area would look [17:58] like in zoning. We I'm realtor uh so I kind of got in like to the city site. It [18:04] was very hard for me to distinguish, okay, why was mine approved? And I [18:08] understand the city's responsibility to itself to monitor where these homes, you [18:13] know, what's going on with these homes. That being said, like mine's a rental. I [18:17] believe the three to the left of me are, the ones behind are. So, I could [18:22] certainly see there was no malicious intent that if I looked at that, too. [18:26] Unless I really came in and probably spoke to the zoning director, I would [18:30] have complete expectation that was going to be a student rental available. And [18:35] what's already been said, they've done a phenomenal job of it. I haven't been in [18:39] it. I drove by yesterday cuz I actually had my certificate renewed yesterday. [18:44] And uh I just know I don't know them personally, but when you own it, you [18:50] take care of it. And these guys, I don't think are looking to be slumlords and [18:53] buying 10 of them or nothing. And I hope it works for them. That has tremendously [18:59] helped my situation with my daughter. And the reason, even though I don't know [20:14] these folks, the reason that I'm very confident they're going to do a [20:19] good job long before they got flagged, so to speak, on the very, you know, on [20:26] the zoning difficulty, they did something that [20:31] a lot of landlords don't do in this city. They actually brought up the level [20:36] of the windows and like on the the sun porch, they spent a lot of money redoing [20:42] those windows. And I've seen a lot of folks that make a lot of money in [20:46] rentals in this town simply cover windows up. Have you all seen that where [20:51] they just make a whole wall of windows disappear because it's drafty or [20:57] whatever? And they did that on their own. They have a good eye and I think [21:02] they'll be an asset. And no offense to you, sir. I hope they do buy 10 [21:06] properties here. [laughter] >> That's what they buy. [31:30] So, as I stated, the home was in such disrepair that in my opinion, I think a [31:37] reasonable opinion would be it would be very, very difficult for anyone to buy [31:40] that home and first of all see all the rentals around them and say, "I'm going [31:44] to buy this and move my family of three into here and fix it up because it [31:49] needed a massive amount." There was $15,000 worth of electric work done. Um, [31:53] and that was pulled with the county on the permits done the right way. um all [31:58] new plumbing. So that was another permit. It was not functional. It could [32:02] not have no conventional loan would have approved that um let alone a FHA loan [32:08] because it was in such disrepair. So that was when I made that statement that [32:12] that's why it was just bringing the whole neighborhood down. Um and never in [32:16] a million years did we we would have never bought it if we knew we couldn't [32:19] rent. We were given misinformation. Not that that's an excuse for us not doing [32:23] our homework. No, I just wanted to know why a single family would have, in your [32:29] opinion, it would be difficult. >> They wouldn't have the means to know how [32:32] to fix up a house. I mean, it needed everything. All new plumbing, all new [32:35] electrical, all new flooring, all new kitchen, bathrooms. Um, the average [32:39] single family person wouldn't see the equity they could build. Got [32:44] » to do it. And because I swing a hammer every day, I was able to make it make [32:47] sense. And certainly since my my son's going to live there, it made a little [32:51] bit more sense. Um, and no, we don't plan on buying any more rentals in Big [32:54] Rapids. Okay. >> For no other reason. All of those are going to have an appraisal and the appraiser that [33:25] comes through is also going to do a health and safety inspection which would [33:28] not have passed. They would have [33:36] requested the seller to repair them in order to underwrite the home. So, it's protecting the [53:49] natural environment, [53:53] ensure cap uh compatibility with adjacent use of the land. [53:59] They're all rentals and some of them look pretty good, too.
