[0:07] [music] [0:16] Good evening and welcome everyone present and watching online. I would [0:19] like to call the Monday, March 9th, 2026 planning commission meeting to order. [0:24] Please rise and join us in the pledge of allegiance. [0:30] I aliance to the flag of the United States of America and to the republic [0:36] for it stands. One nation under God, indivisible, with liberty and justice [0:41] for all. >> All right, I see Miss Shantel to my [0:47] right filling in for Tracy. Could I get a roll call for attendance, please? [0:51] » Commissioner Ingressol, >> present. [0:54] » Commissioner Pumprey, >> present. Commissioner Silkenberry, [0:57] » present. >> Commissioner Richell, [0:59] » present. >> Commissioner Sanderson, [1:01] » present. >> Commissioner Kra, [1:04] » present. >> Commissioner Graham, [1:06] » present. >> Vice Chairperson How [1:09] » here. >> And Chairperson Henny, [1:11] » present. Thank you very much. At this time, I would entertain a motion to [1:14] approve the consent agenda for the February 23rd, 2026 meeting minutes. [1:19] » So moved. >> Second. [1:20] » Motion and a second. All those in favor? >> I. [1:23] » Same sign for opposed. >> All right. I'll now open the public [1:26] hearing for agenda item number four, UDC text amendment, UDCT01269774. [1:36] [clears throat] And I would ask for uh staff [1:39] presentation. [1:42] » Good evening, commissioners. My name is Nick Hutchson. I'm the interimm director [1:46] of city development. Uh before you tonight is a proposed UD UDC text [1:50] amendment related to short-term rentals. The purpose of this amendment is not to [1:56] prohibit short-term rentals, but to establish a more clear and enforceable [1:59] standard that addresses life safety, neighborhood compatibility, and tax [2:04] compliance. This item comes forward in response to city council's direction and [2:09] community concerns related to STR operations, particularly around noise, [2:15] parking occupancy, and the city's ability to ensure hotel motel tax [2:20] compliance. At a high level, this amendment modifies [2:24] three sections of the code. First is chapter 605 business licensing. Second [2:29] is chapter 655 hotel motel. And third is the UDC. There are key operational [2:37] standards. Uh for occupancy, two persons are allowed per legal bedroom plus two [2:42] additional occupants, a maximum of 10 occupants unless otherwise approved by [2:47] the fire marshall. parking. Uh, one off- streetet parking space per bedroom up to [2:52] four spaces. For properties located in downtown, on street parking within a [2:57] quarter mile may be used to satisfy this requirement. For noise and events, there [3:02] are quiet hours of operation from 11:00 p.m. to 6:00 a.m. And outdoor amplified [3:08] sound is prohibited during this time, and it does not allow for commercial or [3:12] ticketed events. Life safety uh requires smoke detector, [3:17] carbon monoxide detector and fire extinguishers [3:21] as a self compliant report and a code compliant egress. [3:28] For local contact, a responsible agent must be available 247 and respond on [3:34] site within 60 minutes. The development advisory committee has reviewed this [3:38] item at their January 20th meeting and recommends approval. Based on the [3:42] analysis provided in the staff report, staff recommends approval of the UDC [3:47] text amendment for short-term rentals as presented. [3:52] » Any questions for staff? [clears throat] [3:58] » Um, all right. Um, [4:04] I'll repeat one of my concerns during the work session about requiring the [4:08] local host agents to be uh required to respond on site within 60 minutes. Um, [4:14] that's still an issue for me, but we were [4:18] um Is there anybody in the audience who [4:21] would like to speak in favor of this project? [4:24] Anybody in the audience would like to speak in [4:27] opposition to this? [4:36] » Your full name, please. >> My name is Laura Wade. [4:41] I realize that the proposal is addressing only short-term rentals. [4:46] However, I believe that it is very limited [4:51] for the commission to only look at short-term rentals. It does not address [4:56] midterm rentals um which [5:03] is then not looking at the safety of anyone beyond 30 days. If this is [5:09] proposed to [5:13] address the needs of the community as well as the needs of the rental [5:18] individuals, we're we're not really [5:22] addressing the needs. If we're only looking at those that are [5:26] renting for 30 days, we're also then not we're not looking at a comprehensive [5:32] plan because then our community also is not asking the same for landlords. We [5:39] only ask for them to voluntarily submit their contact information. We're [5:46] asking for short-term rental landlords, hosts to be available or have [5:52] an agent available 24/7, but we're only asking for our landlords in the [5:57] community to voluntarily give contact information [6:01] if they were needed to be contacted in case of an emergency. It seems like [6:05] quite a disparity. It seems to me that it would be a better for our commission [6:11] to look at a comprehensive plan that would address all of these areas and not [6:17] just that of short-term rental. And I agree with you, Mr. Henning, that a 247 [6:23] 60 minute uh uh prompt response time. I'm sorry. My [6:32] husband has decided that we should take this venture. But there are times when I [6:38] can't be available within 60 minutes and he is working and I know [clears throat] [6:44] that he can't. Um it's just not realistic. [6:50] Um, I want to comply and I will agree that if if the proposal is the same as [6:56] it was last month, it does it also does not address how we're going to fulfill [7:05] the safety requirements. Who's going to meet those? Who who's [7:10] going to police? Excuse me, that's not really the best term, but who's going to [7:18] police that that the properties are meeting the safety requirements? [7:23] It's purely voluntary if we are not implementing something that requires [7:30] and that would have to be funded, but for the the fire department to come out [7:33] and and and to inspect each property, um I just think it needs to be more [7:40] complete. I want our guests in our community to be [7:46] safe, but I just think it needs to be thought out better. [7:51] » Thank you for your comments. You've been heard. And uh also, as you know, feel [7:56] free to come back in two weeks and share your thoughts with the city council. [8:00] » Thank you. >> This is our body recommends uh what they [8:03] do and it'll be their final decision. Anybody here that would like to speak in [8:07] opposition to this? [8:11] Seeing none and hearing none, I will close the public comment section of this [8:15] hearing. Um, I will reiterate my concerns [8:20] [clears throat] about the requirement of the local responsible agent to [8:27] be available 24 hours a day and respond on site within 60 minutes. [8:32] » [clears throat] >> When we get to a motion, I would uh [8:35] encourage an amended motion to reduce to just eliminate on-site [8:41] and that the local host shall respond within 60 minutes to complaints or [8:47] emergencies. Um [8:50] any comments on that or anything else for staff before we get to Yes, Mr. [8:54] Crow? >> Uh like to say a couple things. Um, [9:00] thank you for allowing us to come back to this from our last meeting, get a [9:05] chance to research and study it. Thank the audience, the citizens who came here [9:10] today to express themselves about what they what they're concerned about makes [9:14] sense about discussing what the comprehensive plan talking about [9:18] short-term, midterm, and what she suggested and having a plan in place for [9:23] everybody. and we want to make sure that we're taking care of all of our [9:26] residents and our neighborhoods are safe. Of course, that's the main [9:30] objective. Um, I would support responsible [9:34] short-term rentals with clear enforceable standards that protect [9:38] neighborhood integrity and property values rather than overly restrictive [9:42] owner and occupancy mandates. I believe requiring a [clears throat] local point [9:46] of contact, somebody who can respond within 24 hours to have somebody [9:51] designated is a is maybe a practical way to ensure accountability. [9:56] Enforcement should be complaint driven and focused on repeat verified [10:01] violations with registration escalating penalties and potential permit [10:06] suspension for chronic offenders. responsible pro property owners [10:10] shouldn't be overburdened but persistent problems should have real consequences [10:16] and we talked about uh some enforcement mechanisms [10:21] and I had a chance to look at some I'm sure the rest of you probably glance at [10:25] something I saw something where it mentioned something about registration [10:28] and permit requirement u doing that annually reg doing an annual [10:33] registration with the city uh having a 24-hour contact require environment. [10:39] They must respond within a set time frame. And maybe a three strike rule [10:45] repeated verified violations for such things as noise, nuisance, and safety [10:51] would result in fines and possible permit suspension. And also permit [10:56] revocation for chronic violations, but only after due process. And of course, [11:01] complaintbased enforcement. enforcement should be triggered by documented [11:06] complaints but with no random inspections and getting to the point [11:10] where the group brought in they came in there talking about the child care [11:14] centers I think that's very important that's something that should be [11:17] addressed [clears throat] we should probably have some kind of stipulation [11:21] to protect the children and in those type of areas for whatever our zoning [11:26] requirements are and again to address uh the lady who came in and talked about [11:32] the mid uh term rentals as well. I think that's something we should consider. [11:37] That's all I have to say. Thank you. >> Any other questions for staff or [11:43] discussions uh amongst ourselves before I close the public hearing? [11:49] Public hearing is now closed. Before I ask for a motion, I have a [11:54] question for legal. I typically as a chairman don't make [11:58] motions myself. Is that something that is allowed by the chairman or if I want [12:04] to change somebody else's motion, is that how they do it? [12:08] » Um, yes. Uh, typically what I see is that um, [clears throat] normally [12:12] someone else besides the chair would make the motion. [12:18] » All right. Uh, the public hearing is closed. At this time, I'll ask for a [12:22] motion for the UDC text amendment. [12:29] I'm going to give this a shot. >> Yes. [12:30] » Um I move to approve UDC 01269774 with the following amendment. Uh to [12:40] eliminate the on-site verbiage altogether and response time within [12:47] 24 hours. >> I have a motion. [12:51] » I would like to see response time of 60 minutes. [12:55] » Well, we have a motion. >> So that's what we vote on. [12:59] Um, >> do I have a second? [13:03] » Second. >> I have a motion and a second. [13:06] » Could I get a roll call, please? On. >> Commissioner Graham. [13:12] » Hi. >> Commissioner Cradle. [13:15] » Hi. >> Commissioner Sanderson. [13:18] » Hi. >> Commissioner Richell. [13:21] » Hi. >> Commissioner Stokenberry. Hi [13:27] » Commissioner Ingresol. >> Hi. [13:29] » Commissioner Pumprey. >> No, [13:34] » Vice Chairperson How? >> I [13:37] » and Chairperson Henny. >> I [13:41] All right, that passed. And that item will be recommended and heard by the [13:44] city council at their next meeting on Monday, March 16th, [13:48] uh 6 o'clock in this very room. Moving on. Uh agenda item number five and [13:54] seven. I will open the public hearing for general development plan GDP [13:58] 12259749 for Mcatee Village with the preliminary [14:02] plat being heard concurrently. I will ask for exhibits from our our city [14:06] attorney. [14:13] » This is being continued. There probably is no exhibits at this time. [14:16] » I do not have any. Okay. The applicant has requested the continuence of these [14:20] items to Monday, March 9th, 2026. How about a motion to continue this? [14:26] » Excuse me, chair. >> Yes, [14:27] » I think that's going to be continued to March 23rd. [14:32] » Yes, March 23rd. The date is wrong. >> I stand corrected. This will be uh [14:38] continued and or to be heard by the [14:43] » on the March [snorts] 23rd meeting. I'll second that. [14:48] » Yes. Uh I have a motion. >> You motion. I'll second. [14:52] » Okay. Motion in [laughter] a second. Thanks for helping me through that. [14:55] » Yeah. >> Um all those in favor. [14:58] » Any deni? Any no. >> All right. That motion passes. [15:02] » At this time, I will open the public hearing for agenda item number six, [15:06] which is conditional use permit CUPC 0126-9786 [15:11] for Mony's daycare. I will ask for exhibits from our city attorney. [15:16] Um yes, Mr. Chairman. Um I have as exhibits one exhibit that's the staff [15:21] report and all of that's attachments. >> All right. And looks like we got a staff [15:27] presentation. Mr. D. >> Uh good evening, commissioners. Uh [15:33] before you this evening is a request for approval of a conditional uh use permit [15:38] for a inhome daycare located at 9305 Southwest Orca Court. Uh the proposed [15:44] daycare will operate in a manner that does not oper or alter the character of [15:48] the scale of the existing single family resident or the surrounding [15:52] neighborhood. Uh inhome daycarees are identified as a conditional use within [15:57] residential districts and are required to remain subordinate to the primary [16:01] residents residential use of the property. [16:06] uh with the proposed conditions listed in the staff report, the request is [16:09] consistent with the intent of the zoning district and is compatible with the [16:14] surrounding residential properties. In addition to maintaining and renewing a [16:19] valid uh business license, the daycare must remain in compliance with all [16:23] applicable city, county, and state requirements governing general daycare [16:28] operations. Um I'm happy to answer any questions, and the applicant is here to [16:33] answer any as well. Thank you for that. Any questions for [16:37] staff before we hear from the applicant? [16:42] » All right. Is the applicant here would like to speak on behalf of the project? [16:45] » Yes. [16:51] » Hello. My name is Mav Rafi. This is my mom, Monro. She's the owner of Mon [16:56] State. [16:59] » Would you like to talk at all about your your your project? [17:02] » Yeah. So my mom has been in the daycare inh home daycare business for a long [17:08] time now about 15 16 years. We uh we've been Lee Summit residents for over 20 [17:14] years. She did have an inhome daycare in another part of Lee Summit in Charleston [17:19] Park area that was also approved and um we are trying to expand into a facility [17:26] daycare uh within the next couple months. This is just temporary for us to [17:31] be able to resume business until we can secure our outside facility and will no [17:36] longer require the inh home daycare. >> Anything else? [17:42] » That's it. >> That would be it. [17:43] » Okay. Thank you very much. >> Any um any questions up here before we [17:49] hear from the public? >> All right. Thank you very much. [17:53] » Seemed like news to you. The temporary. >> Yes. [17:57] » No. it. >> Huh? [17:59] » No comment. >> All right. Um, [18:06] is there is [clears throat] there anybody in the audience that would like [18:09] to speak in favor of this project? [18:14] » Is there anybody in the audience that would like to speak in opposition to [18:16] this project? >> Name and address. [18:20] » I think I did a lot of work for nothing. [clears throat] [18:24] » Hi, good evening. >> Address, please. My name is Mike Aerson. [18:28] I live at 9309 Southwest Orchid Court. I'm just east of [18:34] where the proposed daycare is wanting to go. [18:38] So, let me give you a little background. We got [clears throat] lucky. We hit the [18:40] jackpot in 2021 after living in Independence my entire [18:45] life. I'm 67 years old. My wife is in her 60s. We spent our entire life there. [18:51] We hit the jackpot, moved the Blue Springs, moved into a little nicer [18:55] upscale neighborhood. The perfect scenario was finding a [19:00] culde-sac that backed up to nothing but woods. And we found that and it's been [19:07] absolutely wonderful. We have one of the smallest of all of the actual culde-sacs [19:14] in the neighborhood. There's only five homes. [19:17] That's it. Five. Clark and Robin live at the main entrance that ties into Orca [19:22] off of of Conch. And then there's four homes wrapped around the bottom of the [19:28] circle. Out of those five homes, three of them [19:32] have retirees. My wife and I are retired. Clark's retired. We have le uh [19:40] police officer detective that's retired. So you kind of get the feel for what our [19:46] little culde-sac kind of looks like. We love kids. We all have kids. We've [19:51] raised kids. We have grandkids. So so on and so forth. One of the things that we [19:57] got was this ladder. And oh, excuse me. And unfortunately, this didn't go out to [20:02] our entire neighborhood because it had a boundary limit on it of 185 ft. That's [20:08] it. So nobody else outside of who's here. one of the neighbors son's having [20:14] a birthday so he's spending that with his family so didn't have a lot of time [20:18] to really get prepared and you know with something like this it could either be [20:23] in the favor of the neighborhood or maybe not as favorable for the [20:28] neighborhood so that's why I'm here so what I did in the process of trying to [20:32] find out we didn't have a lot of time to put things together I couldn't believe [20:36] how efficient the blue springs government actually is this thing right [20:41] here I thought I'm going to find out what there is to know about home [20:46] industry. That's what I wanted to know. I wanted [20:49] to learn about it. And when I got to gleaning through some of the pages here, [20:53] one of the most important things here is on this page. It says things to [20:58] consider. If you live in a neighborhood managed by a homeowners association, it [21:03] is a good idea to check whether it can restrict your business activities. [21:09] Well, I'm here to tell you that we have a very robust website. [21:16] All the information that you need if you live in that neighborhood could be found [21:20] on that website. ARC request forms. That's the first thing that needed to [21:26] happen with this case was that they needed to glean through, get an ARC [21:31] request, send it in, let it go through the approval process. [21:36] » Hold on just one minute. We didn't I didn't tell you this in the beginning, [21:38] but we usually have three minute time limits. [21:41] » Okay. >> So, your three minutes three minutes is [21:43] up. But since I didn't tell you that and we don't have a huge gallery tonight, [21:47] I'm I'm gonna let you go a couple more. >> Okay. [21:49] » But wrap it up. >> All right. I will [21:50] » respectfully. I said, so I also with everything that I handed you guys, this [21:55] is straight out of our uh covenants and bylaws and it kind of directly ties in [22:01] with what this right here document says. So, I want to make certain that you had [22:06] all the information that you needed. A couple questions that I had for them, [22:09] not knowing what I know now, is on their website, which is fabulous. [22:15] They got a really nice website. I mean, it was not something that you would see [22:20] on Facebook, somebody wanting to watch children, but it says they care for up [22:24] to 10. Well, the license that they were applying for is a limited, [22:30] but in the application they were saying six, which would make it a general [22:35] instead of a limited condition where it's four or less children. So, that was [22:40] one thing. Playing outdoors, they have no fenced in area there. And they back [22:46] up to one of the two entrances, main entrances into our neighborhood, which [22:51] is uh Timber Meadows. My concerns are [22:58] we have a swimming pool. We have a a walking trail that goes all the way [23:03] around. What happens if they take the kids out and somebody falls and gets [23:07] hurt? >> You put one minute, please. [23:09] » Yeah. >> On the clock. [23:10] » So, I I'll just keep it just where we're at right here. Everything that I have in [23:14] the document was gleaned out of just one provision that seemed to have uh a lot [23:21] of different things in it. And I certainly hope that you guys, you know, [23:25] based on what I just heard, if this is temporary, this could be a m a moot uh [23:32] situation that we have right now. If that is in case the fact, [23:37] okay? Because right now, uh the neighbors that are here, we're not in [23:42] favor of having a daycare in our culde-sac. [23:48] » Thank you, sir. You have been hurt. >> Hey, thank you. [23:52] Is there anyone else that would like to speak in opposition to this project? [24:01] » All right. Seeing none and hearing none, I will close the public comment section [24:04] of this public hearing. Anything else for staff up here? [24:09] » Chairman. >> Yes. [24:11] » Over here. [laughter] >> Sorry, Chris. Throw you off. Uh, I just [24:15] wanted to put on record that the resident letter that was sent out, um, [24:21] the applicant has been found to be in substantial compliance with our posting [24:24] requirements, um, with a correct public notice and posting on the their site. [24:32] Um, however, the resident letter that was sent out had the wrong dates. So, we [24:36] will be uh reissuing a new uh resident letter with the correct city council [24:41] date before next week. So this will not be heard [24:44] » a little bit. >> So a new res a correct resident letter [24:49] will be sent out with the correct city council date. [24:52] However, they were found in substantial compliance with our posting requirements [24:57] for the conditional use. So they are able to move forward. [25:02] » So the council will hear it in two weeks >> Yeah. And um [25:09] in regards to 185 foot notification rule, [25:12] » please clarify that. My understanding is that that's like a state rule, a state [25:15] law. >> Yes. [25:16] » So it's not the city of Blue Springs that limits that. It's a state statute [25:20] that municipalities follow. >> So if if if that's a concern that can be [25:24] taken up with the state, but the city of Blue Springs is following the state [25:27] statute. [25:31] » Yes. Down here. >> Yeah, I have a question. I was going to [25:35] ask were there any other letters sent out uh against this? [25:39] » No [25:42] chair. >> Yes. [25:43] » Yeah. >> We we close the public comment section. [25:50] » So I have a couple questions. One is I guess I'm not I haven't run into this [25:55] before, but when if there are restrictions in a homeowners [25:59] association, how does that work on conditional use permits? We don't um [26:03] carry out HOA bylaws. So that would be between the HOA and the applicant. [26:08] » Okay. >> And for clarity on the limited versus [26:14] general, can we >> Yeah. So uh limited daycare use um for [26:18] the city blueprint standards is a one to four children. Um that does not require [26:23] them to have a business license with the city as well as state licensing. Um or [26:28] we don't require them to present the state licensing to us. um whether the [26:31] state requires them to get one um I'm not sure but at least for the general um [26:38] to obtain a business license which is um kind of where one of the conditions [26:42] comes in that they have to meet all state requirements which is kind of [26:46] where the fencing that the the residents brought up would come into play is [26:50] they'd have to meet all the requirements for the state to obtain state lensure [26:55] and then they would be given a city business license [26:59] » and just to clarify If I just to be specific this the application is for [27:03] limited or is for general? >> It's for general. So because so what [27:06] triggered this is because when they submitted the business license and we [27:10] saw the number of children that's when uh myself reached out to the applicant [27:15] and we started this process. >> Okay. Um [27:21] I think that's my questions. Thank you >> chair. [27:24] » Yes. Um, so this temporary like you know two months 60 days like can a [27:32] conditional use permit be given for just a limited period of time? [27:36] » That would be Yeah. >> Yes. [27:40] » Can can I add something? [27:44] » I'll defer to you, >> Mr. Chairman. It really is if if the if [27:49] the commission would like to hear my testimony, you're welcome to. We will I [27:53] will open back up the public comment section [27:56] » and I have >> Let me finish please sir. We will limit [28:00] any comments to two minutes and you must approach the podium and state your name [28:04] and address and you will be heard. [28:13] » Robin Hoff stutter. Um if it's a temporary and they are approved for that [28:19] and it goes over what happens? uh city staff takes that into [28:25] consideration and they have to deal with I'll let you ask that question. [28:30] » And how many temporaries can you get in a row? [28:33] » So it [clears throat] would um after the temporary conditional use permit expires [28:39] or lapses, then they would fall into code enforcement and we would start the [28:45] process for issuing citation and resolving the issue um to cease [28:50] operations. Can you apply for another temporary right after that one expires? [28:57] » There wouldn't be anything that would prohibit them from doing that. They [29:00] would um >> So it could be longer than two months. [29:04] » That's what I'm >> No, they would have to go back through [29:06] the same process that they're going through now um through a public hearing. [29:11] » Okay. >> Thank you, [29:16] » chair. One more question. Uh or I guess anybody else from the public? [29:21] We open it back up. >> Hi, Mike Anderson [29:27] 9309 Southwest Orca Court. >> So, a couple things that I wanted to I I [29:32] mean, so the letter that we got that said that it was a limited conditional [29:38] was incorrect. >> Correct. [29:40] » Okay. Because based on the amount of traffic in the mornings and at night, [29:45] it's not meeting that criteria right now. And just to state for the record, [29:49] they moved in in December, late December, and about mid January. This [29:54] thing is opening and functioning every day, every single day. So, are they is [30:00] are they in compliance if they've opened their daycare without the permit that's [30:05] required to watch children? I guess that's my question to you guys. [30:10] » Answer would be no. This would bring them into compliance. [30:15] » Excuse me. This would bring them into compliance, [30:19] » but they could. Sorry, >> I'm I'm a planner. [30:23] » No, helpful. >> I'm just filling in. [laughter] [30:26] » Um, but they had four or less. Yes. So, they need a permit at that point to run [30:32] the business with that amount of uh kits. [30:35] » So, with them now wanting to go to six or however, [30:40] » um, that's where this is going to bring them into that compliance. [30:43] » Okay. Is there any oversight that happens at this level to make certain [30:48] that they are complying with those things? [30:51] » That would be with the state. This would this is their [30:55] uh where they would be bringing into compliance. On top of that, it would be [30:58] state that would be handling like the operations and health and safety of the [31:03] children and like operations and making sure they're meeting all the standards [31:07] that the state has set forth for daycare. [31:09] » Okay. So, let me ask one more question. And so with the amount of children that [31:13] they are watching today or that they may watch in the future either in our [31:18] neighborhood or outside of it on her website she says she makes them meals. [31:23] Does that bring in the Jackson County Health Department to make certain that [31:26] things are >> You can speak before or against it but [31:28] this is not a question. All right then I'm done. [31:31] » Okay. >> Thank you. [31:32] » Thank you. [31:36] » Anything else from staff? Uh just uh to reiterate as one of our conditions is [31:42] that they would have to meet all city, county, and state requirements set forth [31:47] for a daycare. >> Yes. [31:50] » And also, as a side note, it's not uncommon for somebody to be operating a [31:53] business and not be in compliance because they simply didn't know. I'm not [31:57] saying that's the case here. And then when they're brought to attention, as [32:00] long as they come into compliance, we see that all the time. And that's [32:03] standard. It's not standard. It's It happens. They happen to this frequency [32:08] and there's a certain amount of grace and and acceptance that comes with the [32:11] fact that a lot of the public sometimes just does not know. [32:15] All right. Um, anything else from staff? Any final [32:20] words from the applicant? [32:24] » Sorry. >> Yes. [32:25] » Mava from 9305. Um, I just want to clarify that we are actively looking for [32:32] a facility. We are we have an agent. We've actually looked at a couple places [32:37] in the last couple weeks. We are looking to get out of the inhome daycare [32:41] business and into a bigger facility because it just makes sense for us. [32:45] She's been in the business for 20 years. This whole time, she's always been [32:48] compliant with city state. She's never operated under the table. None of that. [32:53] I mean, me and my sister take that very seriously. It's other people's children [32:56] you're watching. You have to be very compliant. That's why we're here. We did [33:00] not know. And that's why, you know, Logan's helping us, you know, go through [33:04] this process and be able to be compliant with whatever HOA needs, this, uh, the [33:09] city needs, the state needs, whatever we need to do. [33:11] » And just to, uh, answer your question about the 10 children, the website was [33:15] built like six years ago. We just haven't updated some of the verbiage. [33:19] And, uh, I'll be sure to update that so it says the right amount of children. [33:24] » Thank you. Anything else? >> All right. Anything else from any out [33:30] there. I'm just going to make a broad open. [laughter] [33:33] » I'm done. >> All right. Sure. [33:37] » Okay. All right. I will close this public hearing. [33:41] I will bring it back up here. Unless there's any further discussion amongst [33:44] us commissioners, I would ask for a motion. [33:52] » So, I have a question. Is is one of the conditions [33:58] um limiting the amount of time that the conditional use permit can be in place? [34:03] » That is not current. >> That is not a current um condition. [34:08] » Okay. [34:11] » Is that something that we need to amend? >> It's optional if you want to or it can [34:16] pass as is. >> Yeah, you could make a motion to [34:21] Okay. So [34:25] » everybody's doing >> Can I attempt that? [34:28] » Yes. Yes. >> It's open for a motion from anyone up [34:31] here. Chair, I will make a motion to approve Monise Daycare CUPC0126-9786 [34:40] at 9305 Southwest Orchest Court with a time period of 90 days [34:49] um that the conditional use permit is issued. [34:56] » We can we can discuss this amendment, can we? Okay. [34:59] » Yeah. My thoughts on that is it needs to be six months to a year. [35:02] » Uh I agree in the sense that since the applicant stated they're looking for a [35:06] place, but there's so many variables that go into finding a new home and in a [35:12] commercial space. Uh there's financing, there's availability, there's market [35:15] conditions. I would uh I would make a motion to amend that to one year. [35:24] And what happens now? [laughter] We're just ready for a second. [35:29] » We're ready for a second on your amendment. [35:31] » On the on the amended motion, >> chair. [35:33] » Yes. >> I second the amendment. [35:34] » All right. I have a motion and a second. Roll call, please. Shantel. [35:41] » Commissioner Ingresol. >> No. [35:45] » Commissioner Pumprey. >> No. [35:48] » Commissioner Stokenberry. >> I [35:52] » Commissioner Richell. >> No. [35:56] Commissioner Sanderson. >> Hi. [35:59] » Commissioner Kra. >> Hi. [36:02] » Commissioner Graham. >> Hi. [36:05] » Vice Chairperson How >> I. [36:08] » And Chairperson Henny. >> I [36:15] pass. >> All right. That motion passes and it [36:18] will be heard by the city council. They're meeting on Monday, March. [36:24] » March 23rd. No. April 6th. >> April. [36:27] » April 6th. >> Chairs. [36:30] The motion. [clears throat] The vote was on the motion and so now you need to [36:34] make a vote [cough] on the adoption of the cup. [36:41] » Okay. >> Right. [36:43] » As amended. Right. >> Okay. Now I would ask for a motion for [36:48] the cup portion of this project with the amendment of 12 month expiration on the [36:53] CU. Ready for a motion? >> Chair. [36:57] » Yes. >> I make a [snorts] motion to approve [37:00] conditional use permit for Mony's daycare zupc 01269786 [37:07] at 9305 Southwest Orca Court with the amended condition for one year. [37:16] » All right. Roll call, please. Sean, >> I need a second. [37:18] » Second, please. >> Oh, yeah. Second. I'm all flustered. I [37:22] have a motion and a second. Now we're ready. [37:24] » How about a roll, please? >> Commissioner Graham. [37:28] » Hi. >> Commissioner Kradall. [37:31] » Hi. >> Commissioner Sanderson. [37:33] » Hi. >> Commissioner Richell. [37:36] » Hi. >> Commissioner Stokenberry. [37:38] » Hi. >> Commissioner Pumprey. [37:42] » No. >> Commissioner Angresol. [37:44] » No. [37:48] » Vice P. Vice Chairperson How. >> Hi. [37:51] » And chairperson Henny. Hi. >> And that passes. [37:55] » All right. That passes. That passed and it will be heard by the city council at [37:58] their next meeting. >> April 6th. [38:02] » Yes. [38:06] » Sorry. For clarification, it's actually it's not the next meeting. It's April [38:10] 6th. >> April 6th. [38:13] » April 6th. Yes. >> That's when we'll be heard. [38:14] » Yes. [38:18] » All right. Moving on. Any other business up here. We have [38:23] we've completed our agenda. Does anybody have anything else staff up here? All [38:28] right. I would ask for a motion to adjurnn. [38:30] » So move. >> Second. [38:31] » Have a motion to second. All those in favor. [38:33] » Any opposed? >> Thank you. Thank you. This meeting is [38:36] now >> journal. [38:41] That was good.
