Please [13:57] stand. [13:59] Please, bow your head. Thank you, dear [14:03] Lord, for this great day. [14:06] Thank you for this great technology that [14:07] we have. Please help it to work today. [14:09] Dear Lord, please uh give us the proper [14:12] knowledge and wisdom to make some proper [14:14] decisions. It's in your name that we [14:15] pray. Amen. [14:18] >> Please face the flag. I pledge [14:20] allegiance to the flag of the United [14:22] States of America and to the republic [14:25] for which it stands. One nation under [14:28] God, indivisible, with liberty and [14:30] justice for all. [14:32] >> Thank you. Please be seated. [14:55] » Charles Davis [14:56] >> here. [14:57] >> Megan Davis [14:58] >> here. [14:59] >> Susette Haden [15:00] >> here. [15:01] >> Carrie Landry [15:02] >> here. [15:03] >> Tim Willahan [15:04] >> here. [15:05] >> Michael Virture [15:06] >> here. [15:07] >> We have a quorum. [15:08] >> Perfect. [15:09] >> In accordance with Louisiana Open [15:11] Meetings laws, the Bojer City Parish BA [15:13] asks for order in the quorum at our [15:15] meetings. Please silence your cell [15:17] phones. [15:52] >> Uh, next section is to approve the [15:54] agenda as written. Request a motion to [15:56] approve the agenda as submitted. [15:58] >> I move that we approve the agenda as [16:00] written and submitted. [16:02] >> Second. Second. [16:04] >> All in favor? [16:07] Do we vote? Yes. Thank you. [16:20] Motion passes. Thank you. [16:23] The first item on the agenda is uh PBOA [16:28] 1652026. [16:30] The application of Christina Ko uh [16:33] requesting a special exception used to a [16:35] 76x30 uh modular home on a track of land [16:40] being 2.2 acres more or less located at [16:42] 455 Pinerest Drive, Moer Paris, [16:46] Louisiana. Police uh police jury [16:48] district two. Um, is there someone an [16:51] applicant here? [16:53] Thank you so much. Come forward and just [16:57] state your name and briefly describe [16:59] what you're attemp trying to do. [17:02] >> Thank you. [17:04] >> Yes. My name is Christina Ko and I'm [17:06] just requesting for a module home to be [17:07] placed on our track and land. [17:11] >> Okay. [17:14] and the the module home. Do you have any [17:17] updated pictures of that or is it just [17:19] the ones from that drawing that you [17:20] have? [17:21] >> Um, I can give you like a general idea. [17:24] It's not the same color. Um, let's [17:29] I only have one piece of paper. Is that [17:31] okay? [17:32] >> Can we um Yeah, nice. Let's just pass [17:35] We'll pass it down. Okay. Can you put it [17:38] on that right here? [17:40] >> Put it on that. Oh, great. [17:51] There we go. And then don't forget you [17:53] have the button on your your panel and [17:56] you can click it to show on your [17:57] computer. [18:03] » I like it better there. [18:06] >> So, Miss Ko, what type foundation is the [18:09] home going to sit on? This is going to [18:10] be [18:10] >> it's going to be concrete slab. [18:12] >> A concrete slab. [18:13] >> Yeah. Uh well, concrete runners. I'm [18:14] sorry about that, M. Landry. Concrete [18:16] runners. [18:17] >> Runners. [18:17] >> Yes. The alternative to a slab. [18:20] >> All right. So, is that help me out here? [18:23] Pean beam. Is it going to sit on the [18:25] runners or is it going to sit directly [18:26] on? [18:27] >> No, it's actually going to sit on the [18:29] runners. It's going to be tied to the [18:30] runners. It's just something that's a [18:31] little cheaper than do a standard uh [18:34] slab. [18:35] >> Okay. [18:35] >> Yes, sir. [18:36] >> Thank you. So, is the actual house [18:38] sitting off the ground though? According [18:40] to the picture that you're showing [18:41] there, it looks like there's there's a [18:43] airspace underneath it instead. [18:44] >> Yes, it will be a crawl space. Yes, [18:46] ma'am. It will be a crawl space to [18:48] access any utilities that's running [18:49] underneath. [18:52] [panting] [18:58] » Miss Ko, is that the that's the front [19:01] elevation that we looking at, I guess? [19:03] >> Yes. This right here just example [19:05] picture. Um my house will be just a [19:06] little different. Um of course you know [19:08] with the windows how and the doors. Um [19:12] but the elevation is a 6x12 roof. So [19:15] it's not the standard uh mobile home [19:16] which is come off a 3x12 or 4x12 roof. [19:20] So mine is a 6x12. So it's way higher [19:23] and actually higher than actually the homes around the land. Um as well [19:30] >> any porch on your [19:31] >> any front porch or is it a flat face [19:33] like you see there? [19:34] >> So no it will not be well as it comes in [19:37] it will be a flat face but in the future [19:40] my husband will put a front porch on [19:43] there. Um but first just before we move [19:48] in it it we will put a a porch on a [19:51] front it will not look that plain at [19:52] all. Um I'm trying to think of what [19:55] else. Oh, and that is vinyl siding. We [19:58] will we do have the upgraded. We have [20:00] the um it's not the harder board. It's [20:02] called a smart board. The alternative to [20:04] the concrete board, more price effective [20:07] um that [snorts] we will have on our [20:09] home. And it will be is I think this is [20:11] vertical if I'm not mistaken. It will be [20:14] vertical [laughter] [20:16] >> and it will be a brick uh skirt or [20:19] skirting that goes around the the bottom [20:21] of the home. [20:22] >> Not this one here. Like I say, just a [20:23] generalized picture. Might as well match [20:25] the um the siding on the house. So, it [20:27] will be that uh smart board going all [20:29] the way down. [20:30] >> All the way down. [20:30] >> Yes, ma'am. [20:34] » And the garage there, you have a [20:36] detached garage in your original [20:37] rendering. Is that still going to be the [20:38] case? Yes, we're still trying to get [20:42] some quotes uh on the garage is is just [20:46] expensive trying to add the garage from their facility [20:52] » and your driveway coming into the [20:54] property. How is that going to be laid? [20:56] >> So, we're running into a problem [20:58] actually because from the way if let me [21:02] see if I find got a picture. Oh, I do. [21:07] Let me see if you can see that. Yeah, [21:10] it's a little blurry. So, from the main [21:14] road [21:15] on the if you're looking at the road and [21:19] I'm we're looking towards north on that [21:22] left hand side, the main sewer line is [21:24] literally coming off of that side and [21:27] oh, excuse me, it's going straight down [21:28] through the property literally to the [21:30] middle. So, I don't have that much room [21:34] to come off without going into somebody [21:37] else's lane, which I'm trying to avoid. [21:40] And I know we supposed to either have [21:41] concrete or asphalt. That's what I was [21:45] told. Um, now I can come off, but I got [21:48] to stay off at least 15 ft away from the [21:51] main sewer line for any uh feature uh [21:55] renderings there. So, I could either [21:57] come in straight and then make that turn [22:01] like the little yellow line, but like I [22:03] said, I would be approaching my neighbor [22:04] side and I don't want to cause a issue. [22:06] Or I could be uniform like the the car [22:10] and it would go straight going towards [22:14] the west and then north, well, sorry, [22:17] south into the house and I had to go [22:19] around a humongous street and the gas [22:22] lines are running through there, too. So [22:25] that's the issue that we're coming up [22:27] against right now. [22:30] >> Okay. So on your drawing here, which one [22:33] is your sewer line? [sighs] [22:37] >> Can I put my hand? Oh, I can. Okay. [22:39] >> Right [22:42] there. [22:43] And it's going straight down. [22:48] >> And you'll be on city water then? [22:51] >> Yes, ma'am. That's city water in sewer. [22:52] Yes, ma'am. [23:05] primary usage is for your single your [23:08] family to to live to to live there. [23:11] >> Yeah. Just family. Yes, ma'am. No. Yes, [23:13] sir. I'm sorry. [23:15] Just family. [23:19] Any [23:24] other questions from the board? [23:28] » Okay. Thank you. [23:29] >> Okay. Yes, sir. [23:29] >> Anybody from the audience from have a [23:32] Okay. [23:36] Step forward. State your name and uh and [23:41] write you write down your name. [23:43] >> And write down your name. Oh, okay. [23:44] >> Thank you. [23:55] Okay. My name is uh David Matthysse and [23:59] I am one of the affected property owners [24:01] in Tall Timbers. Uh I'm here not only [24:05] for myself but also 25 other affected [24:08] property owners that opposed the special [24:10] exception that asked me to speak on [24:13] their behalf. [24:15] since did the majority's people were [24:17] unable to attend. So they sent a signed [24:20] statement to represent their opposition [24:25] to the special exemption here. And I [24:29] have that signed statement [24:33] right here. [24:45] I canvased [24:48] 11 affected properties in Tall Timbers [24:51] and out of the 11 property owners only [24:53] one property owner was not opposed. I [24:57] canvas the entire neighborhood in [24:59] Pinerest subdivision which is only 38 [25:03] homes. Out of the 16 property owners [25:06] that were home at that time, only one [25:09] property owner was not opposed. [25:12] Statistically, that means 90 to 95% [25:17] of the property owners [25:20] living in the neighborhood do oppose [25:23] this. [25:24] We are not here to attack the property [25:26] owner. We welcome him to our [25:29] neighborhood. A new home built to the [25:31] community standards does nothing but [25:33] enhance the quality of our community and [25:36] increases our property values. A home a [25:39] home built to some substandards in our [25:42] neighborhood does the opposite. [25:45] What we are opposing is this property [25:48] owner trying not to be held to the same [25:50] high quality standards as other property [25:53] owners that bought in this neighborhood. [25:55] One family told me they pay a lot extra [25:58] just to get into a quality neighborhood [26:00] like Pinerest subdivision. [26:04] There are no modular homes in Tall [26:06] Timbers subdivision. There are no [26:08] modular homes in Pinerest subdivision. [26:10] And there are no modular homes in Wafer [26:13] Forest subdivision, which is a very old [26:14] subdivision there. We do not want one [26:17] [clears throat] of these lower quality [26:19] homes built in our backyard. [26:21] Once you get one in the neighborhood, [26:24] that's enough just justification [26:26] to approve another one. [26:29] In closing, I would ask each and every [26:33] one of you, [snorts] if you would [26:35] approve a home built next to you that [26:38] does not meet your community standards, [26:42] think about it, would you? Thank you [26:45] very much. Do you need this? [26:47] >> Yes, please. [26:48] >> Get right over here. [26:50] Thank you. [26:57] » Excuse me, sir. [26:59] >> Sir, [26:59] >> Mr. Matthew, [27:00] >> can you stay for just a couple of [27:02] questions? [27:02] >> Sure. Okay. [27:03] >> Is Can you state your address? [27:05] >> My address is 509 Pine Cone Drive. [27:09] >> Thank you. [27:10] >> Is that in [27:11] >> That's in Tall Timbers. [27:12] >> Tall. Where is Tall Timbers neighborhood [27:14] com in association to the neighborhood [27:17] we're talking about? Well, part of it uh [27:19] shares a property line. My my property [27:22] does. It shares about 180 ft of property [27:24] line and I think I share the most and [27:26] I'm actually right behind uh his [27:29] property there in in Tall Timbers. [27:31] >> Okay. [27:31] >> Thank you. [27:33] very much. [27:34] >> Before you go, any other questions? No. [27:36] >> Yes. [27:38] >> Thank you. [27:42] » Anybody else from the audience have any [27:44] questions or comments? [27:47] Please come forward, state your name and [27:49] write it there. Thank you. [27:53] [clears throat] [28:01] Ladies, gentlemen, I am also a neighbor [28:03] of u actually my backyard about I don't [28:07] know whether it's as much as David's, [28:08] but probably at least 150 ft or more. My [28:12] backyard is right up against their this [28:15] proposed property. Uh I don't know if [28:18] you guys remember back that huge [28:21] flooding period in I think it was 2016. [28:24] We lost a lot of homes in the Tall [28:26] Timbers area. Um [28:29] that runoff is continual. They've done a [28:32] lot to help mitigate that, but every [28:34] time it rains there's streamlets coming [28:38] down through property yards and all [28:40] that. that area that was right behind my [28:42] home that they proposed to build [28:44] something on that is going to impact [28:47] additional [28:49] uh drainage runoff. It's going to come [28:50] right into my yard and my neighbor's [28:52] yard who is also very vently against [28:55] this uh and you can see the actual [28:58] runoff going right through the yard down [29:01] in the drains over overloading the [29:03] drains actually in the tall timbers [29:05] area. So it does impact us directly and [29:08] uh again I have no problems with uh the [29:12] neighbors at all. I just don't think [29:14] that that would be in our best not only [29:17] our best interest could be detrimental [29:18] to us. So I thank you for your time [29:21] >> and and that drainage is already [29:22] occurring. You said [29:23] >> it's already occurring and this cannot [29:25] do anything but make it worse. [29:26] >> Okay. [29:28] Any other questions? I got one. [29:31] How far from the this property you [29:34] referred to on it flooded? I know the [29:36] parish bought up some [29:38] >> Right. [29:38] >> How far is this? [29:40] >> This is we're at the eastern end of [29:41] that. It's probably about Let's see. I [29:44] walk it almost every day. Half a mile [29:46] from the lowest part all to the nearest [29:49] flooding. It was probably less than [29:52] quarter mile. [29:53] >> But but it's not adjacent to this lot. [29:55] >> No, the flooding was not adjacent. what [29:56] we're getting is a runoff coming through [29:58] it and I myself have had to do [30:00] additional drainage just to mitigate [30:02] that and it's not something that we [30:04] should have had to do but again as I [30:07] said this is only going to make it worse [30:10] >> so so the runoff is occurring before [30:12] this structure is even [30:14] >> yeah yes yes it is no but what this is [30:17] going to yes it is to answer your [30:18] question [30:19] >> but it's a nice heavily forested area or [30:22] it was until it was leveled Um, so we [30:27] [clears throat] we have not had a big [30:29] rainstorm yet as we all we've been [30:33] pretty much in a drought for the last [30:34] couple months or so. So I haven't seen [30:36] any impact since they leveled it. But it [30:38] is I mean just by looking at the slope [30:40] of the land, it all slopes towards tall [30:42] timbers. That whole lot comes down. It's [30:44] going to come through my yard through [30:45] David's yard through Todd uh Franc's [30:48] yard all neighbors that are right next [30:50] to that property. So if if no structure [30:53] goes in that property right now today [30:55] ever, [30:56] >> uh [30:57] >> how's that going to change property? [30:59] >> If no structure goes in the current [31:01] property, [31:02] >> how's that going to change the effect [31:04] that it's having on you now or is it [31:06] going to change the effect? [31:07] >> I'm thinking that depending on how they [31:09] landscape it, what is Well, since it was [31:15] clearcut or whatever, that has [31:18] additionally added to the problem. [31:20] Hopefully, it'll go back down, go back [31:22] up and regrow, and that will absorb a [31:25] lot of the rain. Um, [31:29] >> are you located off of Pine Cone Drive [31:31] as well in Tall Timbers? [31:32] >> I am at the very end of uh Whispering [31:35] Pine Circle and as I mentioned before, [31:39] my backyard at least I would say 150 ft [31:42] of it is right there where that property [31:45] is. So, if you can I don't know. I don't [31:47] have a map with me, but [31:49] >> I see it. And you're saying that in your [31:51] backyard due to high rains or if we [31:53] should get the high rains since 2016 [31:55] that you have a flooding issue in that [31:57] backyard area. [31:58] >> We have water coming through it. Yes. [32:01] >> Rolling down the back side of it or [32:02] actually going into your backyard [32:04] because of that. [32:05] >> It's coming through our backyard [32:07] and our neighbors backyard. [32:10] >> Is it due to the fact that the land here [32:11] is higher than your land then? Because [32:13] the water [32:14] >> Yes, I would say so. Yes. And so it's a [32:17] natural runoff into our direction, [32:18] >> right? So I would think clearing the [32:20] land and leveling it out some would [32:22] possibly help reduce that problem. Is [32:24] that not correct? [32:25] >> Um I don't know that it is. No. Um [32:30] I can't say for a fact. I haven't had a [32:32] professional come out and view it, but I [32:34] would say that [32:36] depending on how they landscape it, if [32:38] they put in some sort of blockage, [32:40] whatever, that may mitigate it. [32:42] Otherwise, it's it's it's an issue. and [32:44] I can't see how that's going to help it. [32:47] >> Okay. [32:49] >> Any other questions? [32:52] Thank you, sir. [32:53] >> Thank you. [32:54] >> I would like to add to what he was [32:57] talking about, the flooding. [33:04] » Well, the last really big rain that we [33:06] had was in July. We had four inches. I [33:08] know because I have a rain gauge. Sir, [33:11] can you please repeat your name for the [33:12] >> Oh, my name is David Matthysse. [33:14] >> Thank you. [33:15] >> Okay. The um the last big rain we had [33:18] was in July and then we had 4 in out in [33:21] tall timbers because I have a rain gauge [33:23] and I actually have pictures of just [33:26] what 4 in of rain would do. All the [33:28] runoff that comes through our property [33:30] and everything also goes down between a ditch that runs between two houses. [33:36] And I have pictures after 4 ines of rain [33:38] that this ditch is overflowing and it's [33:41] about ready to flood one of the [33:42] properties right there. You can also see [33:44] all the dirt and everything. You know, [33:46] when they landscaped it, it's in the [33:48] water because this was the first big [33:50] rain that we had since that time. But um [33:55] the ditch itself is very narrow and uh [34:00] also when they cut down the the trees [34:02] and they pulled all that stuff, they did [34:04] level it had a lot of dips and [34:05] everything back there. It wasn't level [34:07] at all. Uh there's an old pump sewage [34:10] pump lift station that's there as well. [34:12] And um all that water will run right [34:16] down through there. And since they took [34:17] away the waterhed, we'd have even more [34:19] rain now. [34:20] >> Okay. because the roots and everything [34:22] would actually soak up a lot of the [34:23] water. A lot of it was caught in the [34:24] dips and made a lot of little ponds back [34:27] there, but since it's been leveled out [34:28] and everything and I don't know if they [34:30] can take it to wafer road or not, uh [34:33] I've looked at that. I've got like to [34:35] say pictures of the drainage all through [34:37] Tile Timbers just with 4 in of rain and [34:40] that's not a common thing. I just it's [34:43] very common thing around four or more [34:45] inches. [34:46] >> Okay. So, if y'all like to see the [34:48] pictures, the videos that I have, uh, [34:51] I'd be more than happy to show them to [34:52] you. [34:52] >> No, I think we're good. [34:53] >> Okay. [34:54] >> Thank you so much. [34:59] » Okay. [35:00] Do you guys have any other questions or [35:03] concerns, Miss Ko? [35:05] I just have uh one other comment that [35:07] was emailed to us uh Saturday, August [35:10] 29th at 2:42 p.m. It states, "Dear [35:13] members of the board, I am writing to [35:15] submit my formal opposition regarding [35:17] the proposed building and land use [35:18] variance for the modular home trailer [35:20] adjacent to my property. I am unable to [35:23] attend the hearing and personally [35:24] request that the statement be entered [35:26] into the official record. My concerns [35:28] regarding the proposed construction are [35:30] as follows. Property values. The [35:32] placement of a modular home or trailer [35:34] directly adjacent to standard single [35:35] family homes risk negatively impacting [35:38] local market comparables and depressing [35:40] surrounding property values. [35:41] Neighborhood density and tenant vetting. [35:44] If this structure is intended as a [35:45] lowcost rental unit, the lower rate [35:47] could lead to higher turnover, higher [35:49] tenant turnover, and potential community [35:52] management issues directly neighboring [35:54] my home. Um, sincerely, Mr. Zach Kidd. [36:01] Thank you. [36:10] » It's my understanding that this piece of [36:12] property, this 2.2 acres, is no part of [36:15] any subdivision. Is that correct? [36:18] >> That's correct. [36:19] >> Okay. [36:26] There's no additional comments. [36:29] I'll call for a motion. [36:38] I move to approve the uh special edition [36:42] uh exception uh for this 76x30 modular [36:46] home [36:48] uh as it's written there. Okay. Second. [36:53] >> All in favor? Let's call for a vote. [37:05] Okay, we have four. It carries. [37:10] It's 64. So, it carries. So, it approve [37:12] it passes. [37:16] Okay. Next thing is uh approve the [37:19] minutes. [37:21] Approval of July 20th, 26 uh minutes. [37:24] request a motion to approve the July [37:26] 20th, 2026 minutes as submitted. May I [37:29] get a motion? [37:30] >> I move to approve the July 20th minutes [37:33] as written. [37:34] >> Second. Okay. All in favor? Let your [37:37] votes. [37:44] Vote carries. [37:46] >> Okay. And second um, place your votes as [38:10] we for the to approve the minutes. [38:13] >> Miss Hadden, it looks like I lost you on [38:16] the internet. So, can you verbally say [38:18] your vote? [38:19] >> Yes. [38:20] Thank you. Thank you. [38:21] >> Thank you. If it passes, I'll approve. [38:24] Thank you. [38:26] Any old or new business? [38:27] >> Just uh new business. Uh our consultant [38:30] half who is working on our comprehensive [38:31] plan and UDC update will physically be [38:34] in town uh the last week of September.
