[1:54:29] The surrounding area is developed with a number of parking lots serving West Broadway commercial [1:54:34] uses as well as numerous dwelling buildings ranging from 2 to 4 stories with a 5 story mixed [1:54:41] building located directly across Adam Street from the site. As [1:54:46] disowning the proposed project requires variances for [1:54:49] insufficient site in rear yard setbacks, insufficient lot [1:54:53] area, and insufficient parking. With respect to setbacks, [1:54:59] the MFR sub-discuit. [1:55:00] Mr. Chair, requires a minimum side yard of three feet, and a minimum rear yard of 20 feet, which is reduced to 15 feet, pursuant to the provisions of the shallow lot exception. On the right side of the lot, a near-zero first floor side setback is proposed with the oblastory setback approximately two feet. The left side setback is compliant. Because this lot is elapsed, there are effectively two rear yards and two rear setbacks. [2:17:37] The lot here is a 35-foot wide, 127-foot deep parcel containing approximately 4,445 square feet [2:17:45] in the cell-bossed and neighborhood districts, multi-family residential zoning sub-guest strict. [2:17:50] It is currently improved with the two-story residential building with accessory parking off a side driveway in a large rear yard. [2:17:59] My client purchased this building untended unoccupied. [2:18:03] The petitioner of my client, which is to demolish the existing building and construct a four-story five unit residential structure. [2:18:12] With an ad-grade parking garage serving each townhouse style unit individually, as well as a modest private roof debt for each townhouse unit. [2:18:19] Each unit will be an independent four-story, three-bedroom, two-and-a-half-bath unit, [2:18:24] each with the two-car garage, a small front balcony, and 168 square foot private roof deck. [2:18:31] The proposed project requires a variance for insufficient additional, [2:18:35] a lot of area, two variances for insufficient side yard, and insufficient rear yard setbacks, [2:18:42] and conditional use approval, owing to the main entrance configuration. [2:18:46] And also for the buildings height, and both of those last two relief requirements, O2, the [2:18:52] properties presence within a restricted roof district. [2:18:56] With respect to a lot of dimensions and the required additional law to area, the MFR sub-destruct [2:19:01] requires with respect to the side yard, a three-foot minimum side yard, and a 20-foot [2:19:11] minimum rear yard. [2:19:13] The project proposes a left side yard set back about half foot, but it should be noted that [2:19:19] that side of the lot in the building is bordered by a driveway serving the budding property, [2:19:25] and that the separation distance between the two buildings will be over 14 feet. [2:19:30] The proposed rear yard set back is approximately four feet. [2:19:35] Here it also should be noted that the lot backs onto a large parking lot serving a townhouse [2:19:42] a child multifamily building that is addressed on East 8th Street. [2:19:46] There's no residential butter in the rear. [2:19:49] Finally, with respect to the lots size, it is approximately 1555 square feet shy of the 6,000 square feet to co-requires for five unit development. [2:20:00] These are dimensional constraints of what is a narrow preexisting lot, not deficiencies of design. In fact, the design was adapted to the size and dimensions of the lot. Each unit is provided private open space through balconies and roof decks. [2:20:17] The adjacent watts provide, as I know, it's efficient off-site setbacks from the residential [2:20:23] uses that would otherwise be effective. [2:20:26] Effective data. [2:20:27] Excuse me. [2:20:27] The planning department review these same facts or reach the same conclusion that given the [2:20:31] scale as a running development, the narrow lot to mention, the on-site open space provided [2:20:38] and the setback conditions on the adjacent lots. [2:20:41] We believe that relief here is justified and reasonable. [2:20:45] Well, with respect to the location of the main entrances, the code required that the main [2:20:50] entrance would be dwelling based the front line line. [2:20:53] But given the site's 35 foot width in 127 foot depth is proposed here to access all five [2:21:00] units from a drive aisle with the sidewalk interior to the property within the site, with the unit [2:21:08] entrances facing that drive aisle and private sidewalk. [2:21:11] The front of the building will still present windows on all floors in a ground floor planted [2:21:15] box of the street facing frontage will remain active in inviting even without a door opening [2:21:21] on old harvest trees. [2:21:23] This configuration is not unusual for the block other nearby buildings take their access [2:21:28] out the side of the building the same way, making this design consistent with this as built [2:21:33] condition. [2:21:34] This is a fact also noted in the planning recommendation and finally with respect to the [2:21:38] in the provisions of the restricted roof district, Article 68, Section 29, limits allowable [2:21:46] building item, any launch, the height of an existing building, subsequent demolition. [2:21:51] The existing vacant building is a 17 foot two-story outwire on a block otherwise built up [2:21:57] to three and four stories. [2:21:59] This proposed 40 foot building is zoning compliant with respect to the actual table requirements [2:22:05] of subgesterate, but for the restrictive roof structure provisions, even with the additional [2:22:10] height, the site design places the dry vile along the side closest to the adjacent building [2:22:16] on the right. [2:22:17] There's the dry vile that's existing on the locked to the left and both of these conditions [2:22:22] serve to preserve access to light on air and both sides of the building satisfying the [2:22:27] conditional use of approval conditions under section 29. Because this would be [3:21:35] increasing the total number of units over the Article 79 threshold, the seven units that are [3:21:41] being proposed would be subject to the IDP requirements that 17% would require the commitment [3:21:48] one IDP unit, which we will deal with with the Mary's Office of Housing in connection with this application. [3:22:13] Madam Chairman is a board showing me surrounding media context that this section of day square is where the former [3:22:20] or Javalee's restaurant location used to be. [3:23:44] We did a critical height evaluation for this property and the critical height limit. [3:23:50] For this area is 90 feet above me at sea level. [3:23:54] Our building with its current side elevation of each and each and each. [3:23:58] With the total of building at a 48 feet will still be below the critical height limit. [3:24:03] We still are required to provide notification to the FAA and connection with any rules that we received before our building permit. [3:24:11] issue. So, I just want to point out the report that we are sensitive to its proximity to [3:24:16] the likelihood of being a special anything in the base prayer area. Next slide please. So, you have a number of problems that you tell [3:24:33] upper level as eventually use. Next slide please. [3:25:27] And the final amendment, and it's with decided that these areas could accommodate more height and more density, and that has been the focus of a lot of the new development has been happening in around the day screen. [3:25:39] But as you can see on the right side, we're able to zoom in Mr. Ambassador, we do show the area that we are filling in. [3:25:47] And we can see the set back on the editing street side is roughly about 4.25 feet, which directly addresses one of the violations that were cited at least reference in the client apartment stack of the data. [3:27:54] I'll try and quickly to just the relief [3:27:56] that is cited, first would be the restructure restriction [3:28:00] on Article 53 section 25, the Boston-Zoning Code requires a conditional use permit at any time [3:28:06] you're all sprinkling the blue flying system structure. My position is that this typically [3:28:11] involves when you are proposing either a head house or a roof deck or some other type of structure [3:28:18] upon an existing roof because we are proposing a complete renovation with a vertical addition [3:28:24] that is within the height limit. We believe that is all encompassing under the current [3:28:29] version of Article VIII that addresses the allowable height, so even though a conditional [3:28:34] use permit is typically required for restructural restrictions, this is an actual [3:28:38] renovation that building and should be committed without the VIII but a conditional use [3:28:44] permit. However, we have applied for that to accept the point D into one as necessary. [3:28:49] We're also setting for insufficient entry parking. This comes up right early now with the [3:28:59] whether or not they are subject to article 80, [3:29:03] or exempt from the minimum of arctic requirements, [3:29:06] footnotes four to table L's, specifically Stals out. [3:29:10] We didn't release that with the examiner. [3:29:12] It was not removed. [3:29:13] We do not believe this is a violation based upon the plain reading [3:29:17] of the table L. Therefore, we have to ask that the board [3:29:20] not required what we are working. [3:29:22] We were also cited for the condition of it through a lot [3:29:26] Because we do have fraud in both benefits of street and Chelsea Street, the rear yard requirements are not applicable. [3:29:35] The fraud yard requirements would be. [3:29:37] We have two options to achieve compliance. [3:29:39] One would be the setback that we're currently showing at 4.25B. [3:29:43] We've been also relaxed to do a low study and we're happy to deal with that in the designer view component. [3:29:48] should the Board approve this, so we feel that we can compile the environment with the [3:29:56] most setback in either instance or the event. [3:30:02] The maximum law coverage for this area is 75%. I do believe we are in excess of the law coverage, because I showed before, he's surrounding context of buildings, public left and right. Anything within that sort of island within a square, pretty much occupies most of the law, if not in excess, while in excess of 75%, we would not be much different than any of the buildings that are in the 80s. [3:30:30] and we therefore believe we would be appropriate for instance. [3:30:34] We've also cited for the minimum permeable lot area, not being that. [3:30:38] It's a very low threshold. [3:30:40] And for this site, I believe we will need about 275 square feet of permeable area. [3:30:45] Based upon where we're set back currently, both side and front, [3:30:49] prime, I should say, on the 19th Street side of the building. [3:30:52] I don't think we're that far off. [3:30:54] So if compliance is necessary, I believe that is achievable. [3:30:57] And it's certainly, again, a dress that's really designed for you. [3:31:01] We recite also for insufficient side wear at setback. [3:31:05] And that, I believe, involves a group of men [3:31:07] at the Chelsea Street side for right side of the building, [3:31:10] which is already a criticism on the human vision. [3:31:13] The addition that we're proposing actually does setback [3:31:17] on that right side line. [3:31:19] We don't set it back on a left, but again, [3:31:21] that being a criticism on the human condition, [3:31:24] we are exempt from compliance, provided [3:31:27] we don't increase the non-conforming anymore that already is, and I believe in both instances [3:31:34] we do not do that, so therefore we would be in the five exception for the insufficient [3:31:40] side effects of a side end. Again, a side of the institution, a front yard which we really [3:31:47] already dress, and then there's an additional citation from the middle of ground for ceiling [3:31:52] height into, and then in the every 5 district, any new constructions requires a minimum of 14 [3:31:59] feet for the ground level ceiling height, because we do have an existing condition that would [3:32:04] be a tremendous hardship to change that for a ceiling height, especially since we are preserving [3:32:09] a couple levels of level 2 and level 3, and therefore we think that variance would be appropriate [3:32:14] to the extent that that is applicable. [3:33:58] I don't really see that as an issue. [3:34:00] I think the last story could be set back a little bit, you know, maybe three feet. [3:34:06] But I do see, you know, I would be more unhappy to approve the project. [3:34:11] If there was a proposal that you would work with BPD on the actual lock coverage and to work [3:34:21] within the Sunday, even 75%, that to me is that they kind of zoning issue that I see [3:34:30] and that I've read from the BPD recommendation. [3:34:32] If I may kind of chair Mr. Baraz, I think that if we could do that, we would have gotten there. [3:34:42] In order to make that lower level unit, at least on the ground level, [3:34:52] a size that would be feasible, especially for persons with disabilities, especially with the access issues for building. [3:35:00] It is going to be difficult to get to within 75%, and I think that our total footprint in that instance would be [3:35:07] about 1,400, around 1,400 square feet. If we need to comply with that, that's going to trim that [3:35:16] that addition of the rear significantly, and I think it's going to create a condition that's going [3:35:22] to make that view of the small. So happy to work with planning on some ideas to help soften that, [3:35:28] But I don't know that we're going to get there otherwise and I don't think it's very viable.
