[0:00] appreciate uh your attendance today. We will start off by having our invocation [0:05] by Commissioner Perry. [0:09] » Our dearly father, we come before you this time grateful for the many [0:11] blessings that the house has blessed us with. We're grateful for the opportunity [0:15] we have to live in this free country and here in this wonderful county. [0:19] We ask you to please bless everyone who resides here and communities who serve [0:23] here that be blessed and protected and that thou will continue to watch over [0:27] us, those who serve us here in the community. We're grateful for the [0:31] service that those first responders and military personnel provide to us. We ask [0:36] continue to bless bless them and their families for the service that they [0:39] provide. We ask thy spirit this day that we can accomplish the things that we [0:43] need to accomplish here in the business of the people of Oxar County. We pray [0:47] that thy spirit will always guide and protect us. And we pray that thou will [0:50] bless us with the moisture that we need so we can continue to prosper and do the [0:54] things we need to do here in the community. We say this in his name [0:56] Christ. Amen. >> Amen. [0:58] » We will have our pledge of allegiance given by human resource manager Jennica [1:02] Standard. >> Algiance with me [1:08] to the flag of the United States of America and to the republic for which it [1:15] stands. One nation under God, indivisible, with liberty and justice [1:21] for all. [1:26] » Thank you, Commissioner Perry and Jennica. We appreciate that. I need a [1:30] motion of approval of the minutes of the July 7th, 2026 meeting. [1:35] » I will make a motion. >> I will make a motion to approve the [1:40] minutes of the July 7th, 2026 meeting. >> I'll second it. We have a motion by [1:46] Commissioner Bingham to approve the minutes of the July 7th, 2026 meeting [1:51] and a second by Commissioner Perry. There's no further discussion. All in [1:56] favor say I. >> I. [1:57] » Motion passes. Thank you. Okay. Under administrative review [2:02] reports or future agenda items. Commissioner Perry, do you have [2:05] anything? >> No. [2:07] » Commissioner Bingham? >> Nope. [2:08] » I have nothing either. Uh under former agenda items, the proposal of uh island [2:14] annexation into Garden City uh 120 or uh 12800 [2:20] North 7,000 West. Uh I'm I'm familiar with it. Scott, do you want to talk to [2:27] it? [2:38] » Scott Lions Community Development Department. Um, I believe all three of [2:42] you are pretty familiar with this at this point. Uh, [2:46] essentially what this comes down to is when when there's an annexation that is [2:51] directly adjacent to a city boundary, that city is required to notice the [2:56] county, but they do not need the county's approval to annex that [3:00] property. when there is an island annexation. So, a piece of property that [3:05] is not directly adjacent to the city's existing boundary, as is the case here, [3:10] this piece of property is separated by a few other properties from the city [3:14] boundary. Um, it is within just a couple hundred feet, then an island annexation [3:20] per state code requires that both the city uh approve that annexation and that [3:26] the county approve that annexation. So, both parties would need to approve it. [3:30] So, with that said, the city um in your letter, you have their May 20th at their [3:38] council meeting, they uh approved this annexation. Um and so then it would need [3:44] to be approved by the county. Uh you don't have to approve it. Uh but it is [3:50] being this property is already being serviced by uh Garland City's water. Uh [3:56] the water line runs from the west side of this west side of the interstate [4:02] actually across in front of this property and then into Garland City from [4:05] there. Uh the letter that you have from Garland City addresses some other [4:10] concerns regarding zoning, emergency access and services, um right-of-way [4:16] width, snow, and also has a letter from their fire chief. Um, I think that [4:22] addresses many of the questions that have been brought up over the last month [4:25] and a half. Um, but yeah, that is kind of some background on that particular [4:31] request. >> Okay. So, um, I was the one that had the [4:35] questions and I sat down with Scott after our last meeting and I'm [4:40] comfortable with, um, the answers that we received. So, I would um make a [4:45] motion that we approve the proposed island annexation in the Garden City at [4:50] 12,800 North, 700 West. >> 7,000. [4:55] » 7,000. There is another zero. Excuse me. >> I'll second that motion. [4:59] » We have a motion by Commissioner Bingham to approve the proposed island [5:03] annexation into Garland City, um 12800 North, 7,000 West, [5:11] and a second by Commissioner Uh Perry, there's no further discussion. All in [5:17] favor say I. >> I. I. [5:19] » Okay. Passes. Thank you very much. Uh emergency management mark. [5:24] » Nothing new. >> We're good. Okay. Very good. [5:28] » Nothing new that we're already dealing with. [5:30] » Okay. Good deal. Um ARPA [5:35] LF, we're good there. Uh, Commissioner Perry, would you like [5:41] to take a few minutes and talk about employee recognition, please? [5:43] » Yeah, our employees of the month are not here because they're working. Um, [5:47] they're we we tried to get them here and they have got a busy schedule because [5:52] our employee of the month are full-time members of our weed department. It's [5:56] Wyatt Freeze, Courtland Richards, and Kaden Marshall. We just want to bring [6:00] out the fact that uh they not only do they they go out and do the job, but [6:04] they go the extra mile. They try to make sure that they're helping the farmers [6:07] and the people who have lot land in the county um attack the weed problem that [6:13] occurs so that it doesn't encroach upon their neighbors and go to other places [6:16] like that and uh they put in many numerous hours. The other thing that's [6:20] neat about these weed department that they had the weed department but they [6:23] work with the road department and so sometimes if the road department needs a [6:27] little extra help they can cut come across and help them out and they're [6:30] willing to help other departments in the county out. We just wanted to recognize [6:33] those three that uh year round are constantly uh trying to help out [6:38] anywhere they can because during the winter months we don't have to deal with [6:41] weeds. They have to deal with getting grants and things like that, but they [6:44] step in and help other departments during that process. We just want to [6:46] congratulate our weed department for being our employee of the month for the [6:49] month of July. >> Yeah. Can I can I add as we talk to [6:54] other uh counties, they recognize that we have a great weed department, too. [6:59] They mention that all the time. Yep. We appreciate them and all that they do. [7:04] We appreciate our employees. So, um, auditor's office requesting property [7:12] tax abatement on parcel number 03-223-0034. [7:18] Karen Wit, you guys could come up. Charlene, [7:24] » you can move a couple chairs. That's great. Marcy, [7:25] » sorry, Marcy, I didn't even see you. Apologize. How are you, Marcy? [7:33] right there. [7:49] So, this is Karen Wit. Um, she has filled out paperwork for homeowners [7:57] tax credit. her income is above the limit [8:02] and it is because her husband's passed away this past year and we have to [8:08] include his income with it. >> So, um, [8:14] do I need to in introduce myself before I start talking? [8:18] » I think I think we know you Marcy's got it. [8:21] » Okay, I'll let Karen talk. >> Okay. [8:26] Um, I just He passed away in June and I just feel [8:32] that my taxes are more than I can pay with the income that I have now. [8:39] And so I'm lost all his other income that I [8:45] could pay the taxes with. And so I just want my taxes reduced that I can [8:53] pay. I don't know how to say that. I think [8:58] you did great. >> You did great. [9:00] » And you'll be putting him nervous. >> You'll be putting him for the circuit [9:03] breaker in the future, right? >> Yeah. Okay. [9:06] » She's just over the limit this year. Just over the limit. Okay. [9:09] » Yeah. >> Yeah. [9:10] » So, how much are we talking about, Marcy? Do you have a number? [9:13] » Yeah. Those figures. So, we're requesting the county portion, [9:17] which is up to $1,412 [9:22] or 50% of her property taxes, whichever is less. [9:28] And that's what state code tells us we can do. [9:31] » Okay. [9:35] » Okay. [9:41] » Okay. If you're ready for a motion, I ready for a motion. I'd make a motion [9:44] that we uh honor this request for property tax abatement on parcel [9:48] 03-223-0034 [9:52] for the 14, 12, or 50% or whichever is less. [9:56] » Second. >> We have a motion by Commissioner Perry [9:59] to approve tax abatement on parcel number 03-223-000034 [10:07] uh as explained by Marcy. Uh, and a second by Commissioner Bingham. If [10:12] there's no further discussion, all in favor? I [10:14] » I >> I [10:15] » Thank you very much. >> Thank you. [10:18] » Thank you. Thank you. [10:23] » Okay. Public hearing on a proposed [10:27] agricultural protection area in the Riverside area. Uh, Cape Nurse. [10:33] » Mara, you got to go to Mara. >> Okay. Um, this particular egg protection [10:39] was brought in for an application in April. There are 55 parcels totaling [10:45] 2,24.82 acres. Um, all notices have been sent [10:51] out to those within 1,000 ft. Um, and it has been sent to planning, zoning, and [10:58] the agricultural board um for review. And all parcels were found to be in the [11:04] AHZ zone. And um [11:10] I guess that's it. If you want to open the public hearing, [11:15] » make a motion that we open a public hearing. [11:18] » I'll second it. >> Protection. [11:19] » We have a motion to open a public hearing and a second by Commissioner [11:23] Bingham. Open a public hearing by Commissioner Perry. Second by [11:27] Commissioner Bingham. Public hearing is now open. [11:32] invites [11:36] to come speak. [11:43] » Okay. Diana Hardy Bighgam. Um the boxer committee of liberty opposes [11:48] agricultural protection areas because they are unconstitutional. [11:53] Landowners are already protected under the Utah Constitution Article 1, Section [11:57] 1 and Article 1, Section Two. Our government is bringing fear upon the [12:02] land owners to make them think if they are not put in an agricultural [12:06] protection area they are not protected. Our rights come from God not man or [12:11] government. Government was instituted among men for the protection of our [12:15] ineligible rights given by God. The Utah state legislature is violating their [12:20] oath oaths by creating quasi government agencies. We are a republic and we elect [12:27] our representatives, not appoint them. Representatives keep violating their [12:32] oath of office by going along to get along instead of being the checks and [12:36] balance to make sure their state representatives are following the US [12:40] both the US and state constitutions as well as themselves. It is extortion for [12:46] the government to acquire to require land owners to pay a fee in order as the [12:51] state and local representatives say to have protection. As the saying goes, I'm [12:57] here for them. I'm here from the government and I'm here to help. [13:01] Government wants to regulate and control. They are not. They and they are [13:06] doing this by usurping power they do not have. The land owners are being deceived [13:11] by their own government because they lack the knowledge that what the [13:14] government is doing is unconstitutional. Government is taking advantage of the [13:19] people due to their lack of knowledge of both the US and state constitutions and [13:23] our true and correct history. The government-run education system has not [13:27] educated the people correctly. Only the honest in heart will be able to restore [13:32] a republic form of government. Thank you. [13:38] Okay. Is there anybody else that would like to talk to this? [13:43] If not, I need a motion to close public hearing. [13:46] » Make a motion we close the public hearing on the egg protection area. [13:51] » Second. >> We have a motion to close the public [13:53] hearing on the eye protection area. A second by Commissioner uh by [13:58] Commissioner Bingham or Commissioner Perry. Second by Commissioner Bingham. [14:01] All in favor? I. >> Public hearing is closed. [14:11] resolution. Yep. Need a motion. [14:18] » All right. I'd make a motion that we pass resolution [14:22] 26-23 approving a proposed um agriculture protection area. [14:28] » I'll second that. We have a motion to approve the [14:32] annexation uh or the proposed agricultural [14:36] agricultural protection area by Commissioner Perry and a second by [14:42] Commissioner Bingham. All in favor? >> I I motion passes. Thank you. [14:50] Okay. uh Children's Justice Center state [14:56] contract uh number 2632 for the fiscal year of 2027 and Sterling Marks hasn't [15:02] come talk to us. How you doing Sterling? [15:11] » Sterling Marks for the Boxiller County Children's Justice Center. [15:17] Um just a requirement as we do new contracts each year that we come before [15:22] the commission to to get that contract signed uh which is between the state and [15:29] um our county. So just showing our commitment to [15:35] to be partners in in helping to protect the kids of our county. So [15:43] any questions about it? [15:48] Commissioners, do you have any questions? [15:51] » I don't think it's changed dramatically. So, [15:54] » yeah. I didn't get that either. >> Nope. I I make a motion to approve the [15:59] Children's Justice Center state contract 2632 for fiscal year 2027. [16:04] » Second. >> We have a motion to approve Children's [16:07] Justice Center state contract number 26-32 [16:11] for the fiscal year of 2027 by Commissioner Perry. and a second by [16:16] Commissioner Bingham. All in favor say I. [16:19] » I. >> I. [16:20] » Okay. Thank you very much. Appreciate your time. [16:23] » Okay. Uh updates on county meeting schedule. Commissioners, I think you [16:28] » I've got it here if you want to. >> So, just what I'd like to do is I'm [16:32] going to make a motion. We're going to change the county commission schedule [16:36] and I'll kind of explain what we're going to do. We can't right now. We'll [16:39] continue to have our August 12th commission meeting. That'll be our next [16:41] one. That'll be our afternoon one. Then we will cancel our second commission [16:46] meeting during the month of August, which is August 26, which is the middle [16:49] of fair week. And instead, we'll then adjust our schedule from there moving [16:55] forward for the remainder of the year, September, October, November, and [16:59] December, and do the first and third Wednesdays of those months as commission [17:03] meetings with the similar type of schedule. the afternoon um meeting being [17:07] the late afternoon meeting or evening meeting being on the 1st and then the [17:12] afternoon meeting the daytime meeting being on the 2nd or the third Wednesday [17:16] of the month in there. So schedule would go as follow. We would cancel August [17:19] 26th. Then we would have a September 2nd, September 16th, October 7th, [17:24] October 21st, November 4th, and then on this in November, rather than being the [17:31] third Wednesday, we will do the third we'll do the third Tuesday, which is [17:35] November 17th. We'll move our commission meeting to that day in order to hold the [17:40] canvas for the election that will be held in November. We can do the canvas, [17:44] follow it up with the commission meeting immediately afterwards. So that would [17:47] change it to the 17th and then we'll have December 2nd and December 16th [17:51] would be our commission meetings for the remainder of the 2026 year. That's my my [17:56] motion. >> Second. [17:58] » We have a motion by Commissioner Perry to adjust our commission meeting [18:03] schedule. A second by Commissioner Bingham. [18:06] » All in favor say I. >> I. [18:08] » I. >> That'll make it so we're not meeting on [18:10] Christmas and Thanksgiving and other dates. So yeah, that's as well as [18:14] » we could we could have Christmas here if you wanted. [18:16] » Yeah. Well, my wife would not appreciate that. [18:21] » Okay. Um Indigent Defense Commission uh grant [18:28] agreement 20 number 2634 or 26-34 [18:34] by Michael McInness. How are you? >> Good morning. [18:37] » Good to see you. Michael McInness is here for the uh cash and boxelder public [18:41] defenders office. So on the agenda today we have a few [18:46] contracts and we also have our grant agreement from the IDC which is the [18:50] Indian defense commission. Just to update the commission the IDC uh they [18:57] continued all of our grants from last year. So they approved those. We didn't [19:00] lose any grants which is positive since the IDC hasn't received funding uh from [19:05] the state. So, and and there's a lot of work that goes into those grants. I also [19:10] want to that goes into our part, but I also want to thank Charlene and her [19:13] office. They do a huge part of that as well. A lot of her staff does the f the [19:17] finance and the numbers of that. So, that was all taken care of and and [19:20] approved. [19:25] » Okay. Very good. Thank you. Need a motion. [19:30] I'll make a motion that we approve Indigent Defense Commission Grant [19:34] Agreement 26-34. [19:37] So, we have to do these individually. >> I think so. [19:41] » Yep. I'll second it. >> We have a motion by Commissioner Bingham [19:44] to approve Indigen Defense Commission Grant Agreement number 26-34 [19:51] and a second by Commissioner Perry. All in favor say I. [19:55] » I. >> Okay. Okay, I'll make a motion that we [19:58] approve Boxholder County agreement 26-35 for indigent legal services legal [20:03] assistant grant manager contract with Miriam Bell. [20:08] » I'll second it. >> We have a motion by Commissioner Bingham [20:12] and a second by Commissioner Perry to approve Boxelder County agreement number [20:16] 26-35 for engine legal service legal assistant grant manager contract with [20:22] Miriam Bell. All in favor say >> I. [20:27] I [20:30] » Okay. I will make a motion that we approve Boxer County agreement 26-36 [20:35] for indigent legal services public defender contract drug court with Lane [20:40] Huff. >> Second. We have an We have a motion to [20:43] approve by Commissioner Bingham Box Elder County agreement number 26-36 [20:50] forent legal service public defender contract for the drug court with Lane [20:55] Huff and a second by Commissioner Perry. All in favor say I. [20:59] » I. >> I. [21:01] » Okay. I will make a motion that we approve. [21:03] » Commissioners, if I can interrupt for a second. Sorry, that's me. I'm talking [21:06] really loud. Um, I did want to note that these contracts based on the grant [21:11] agreement, um, the grant agreement plus our current [21:14] budget is not enough to cover the increases in these following contracts. [21:21] It will require you during the December meeting to increase the budget. Um, [21:26] because this grant is on a fiscal year and we're on a calendar year. Um, the [21:30] difference is about $3,000. So, >> okay, [21:34] » just so you're aware. >> Thank you. Well, I think Michael's got [21:36] to work on that, right? [21:40] » Okay. I will make a motion that we approve Boxer County Agreement 26-37 for [21:45] indigent legal services public defender contract district court with Logan [21:51] Bushell. >> I'll second it. [21:54] I have a motion by Commissioner Bingham and a second by Commissioner Perry to [21:58] approve Boxelder County agreement number 26-37 [22:02] for Ingenant Legal Service Public Defender contract District Court with [22:07] Logan Bushell. >> All in favor say I. [22:11] » I. >> I. [22:14] » Okay. Okay. I make a motion that we approve Boxholder County Agreement 26-38 [22:18] for indigent legal services public defender contract justice court mental [22:23] health court conflicts with Malone Mulgard. [22:27] » I second it. We have we have a motion by Commissioner [22:31] Bingham to and a second by Commissioner Perry to approve box Elder County [22:35] agreement number 26-38 forent legal services public defender contract [22:41] justice court mental health court conflicts with Malone Mogard. All in [22:47] favor say I. >> I. [22:48] » I. So Michael what is the conflicts with Malone Mgard? So if there's a conflict [22:55] with any and in in juvenile court, justice court or um district court, [23:01] let's say that the there'll be multiple defendants in a case, [23:05] » then we have to spread the work around or if there's conflicts, let's say that [23:09] there's some issues with uh the two public defenders representing them in [23:13] district court, Mr. Mulgard will take those cases. [23:16] » Okay. Sorry. >> Thank you for that information. Uh, I [23:20] make a motion that we approve Boxar County agreement 26-39 for indigent [23:24] legal services public defender contract juvenile court Kurt Elguson. I'll [23:30] » second it. >> We have a motion by Commissioner Bingham [23:33] and a second by Commissioner Perry to approve Box Elder County agreement [23:37] number 26-39 for Engine Legal Services Public Defender Contract Juvenile Court [23:43] Kurt Helen Heljensen. All in favor say I. [23:49] » I. >> I. [23:52] » Okay. I make a motion that we approve Boxer County Agreement 26-40 [23:56] for indigent legal services public defender contract for juvenile court. [24:01] Kimell Christensen. >> I'll second it. [24:06] » We have a motion by Commissioner Bingham and a second by Commissioner Perry to [24:09] approve Boxelder County agreement number 26-40 for engine legal services public [24:15] defender. Boxel public defender contract for juvenile court Kimble Christensen. [24:22] All in favor say I. >> I. [24:25] » Thank you. >> Appreciate it. [24:27] » Thank you. >> Thanks, Michael. Appreciate all you do. [24:29] » Okay. Um, under community development, um, ordinance number 662, zoning map [24:36] amendment unzone to MG-EX. And Scott's going to come talk to us [24:42] about all these. Thanks, Scott. [24:48] Okay. Scott Lions Community Development. Uh this ordinance 662. [24:54] This is uh request for a two parcels um in the Hansel [25:04] Valley area to be reszoned from the unzoned to the MGEX which is mining [25:09] corey sand and gravel excavation zone. Uh the two parcels total 1,240.5 [25:18] acres in size. Um the two parcels uh are used for agriculture and uh [25:28] historic gravel excavation. Um the property to the north, southeast, and [25:33] west is all unzoned. And this application went to the planning [25:38] commission uh at their July meeting last week. A public hearing was held. Uh [25:43] there were a few comments. All comments were in support of the request requested [25:49] reszone and the planning commission uh found that it meets the approval [25:54] standards established in our code. I'll go through those real quickly. Uh when [26:00] reviewing for a change in zoning, the following four approval standards uh are [26:06] to be considered. whether the proposed uh amendment is consistent with goals, [26:12] objectives, and policies of the county's general plan. Whether the proposed [26:15] amendment is harmonious with the overall character of existing development in the [26:19] vicinity of the subject property. The extent to which the proposed amendment [26:23] may adversely affect adjacent property and the adequacy of facilities and [26:28] services intended to serve the subject property, including but not limited to [26:33] roadways, parks and recreation facilities, police and fire protection, [26:37] schools, storm water drainage systems, water supplies, and wastewater and [26:41] refuge collection. Uh so as stated, the planning commission held their public [26:45] hearing uh reviewed those approval standards and have forwarded a [26:51] recommendation of approval on this request. [26:55] » Yeah, Scott, can you tell me I noticed on here that um when you're looking at [26:59] that they originally wanted a lot more than that and then they downsized. Do [27:03] you know what the >> are they going to come back and ask for [27:07] more? >> They are here. They're more than welcome [27:08] to answer that. But yeah, the original request came in with six parcels and uh [27:13] a little bit after that original request they decided to scale it back in size um [27:17] down to just two parcels. >> Okay. No, no discussion in planning [27:20] commission about that. Just >> No. Yeah. By the time it got to planning [27:23] commission, it was scaled down and uh just the the uh 1,240.5 [27:31] acres is what was considered at the planning commission level. [27:36] » Okay. So, you're ready for a motion? Ready for a motion? Yes, sir. [27:40] » I would make a motion to approve ordinance number 662, zoning map [27:44] amendment from unzone to MG-EX. >> I'll second it. We have a motion by [27:51] Commissioner Bingham and a second by Commissioner Perry to approve ordinance [27:56] number 662, zoning map amendment unzone to MG-Eex [28:03] as uh information given to us by Scott Lions. All in favor say I. [28:08] » I. >> Motion passes. [28:13] » Uh, next item is the ordinance 664. This is a text amendment that addresses [28:20] multiple uses, mult multiple sections of the uh, county land use code. Uh, so as [28:27] you've heard from us before, occasionally what we'll do in our office [28:31] is the land use code is essentially a living document. um constantly receiving [28:36] adjustments and things like that. Uh also state code is a living document [28:42] constantly receiving adjustments. So with those two things um always being [28:46] changed uh there are a variety of reasons that we may need to come back [28:52] with kind of a group uh change like this. So, we kind of keep tabs on [28:58] different sections when we realize numbering is off or we realize there's [29:02] conflicting uh sections of our code and our code or our code and state code and [29:09] we make note of those and then you know whether it's uh two, three, four times a [29:13] year, we'll kind of cluster those together in one amendment and bring [29:16] those to the planning commission for their review and then uh once they've [29:21] had a chance to review it, hold a public hearing, then we'll bring them to you [29:25] for final approval. approval. So, uh, as you go through these amendments, uh, the [29:31] they were all included in your packet, but it's everything from, uh, changes in [29:37] numbering. So, section 2-2180 is a reference uh, in one section of our [29:43] code, and it should be 2-2190. So, it's just changing those numbers. state code [29:48] in uh November of last year, the county section of state code that applies to us [29:53] went from 1727A to 1779. And so uh there's multiple sections in [30:00] our code that reference 1727A of SE of state code and we've had to go in and [30:06] change those to 1779 so they're consistent with the new location of [30:10] state code. Um, we found that there were regulations for flag lots were addressed [30:18] in two separate sections of our code. Uh, one in five-1 and one in uh 6-1. One [30:25] of those applies to all areas of the county. One of those applies to new [30:28] developments. And those two sections uh had conflicting requirements. So we went [30:34] through those requirements and uh made them consistent with one another and [30:40] then asked the planning commission to review those and uh then put that those [30:46] consistent regulations uh in those locations. Um something that the [30:52] planning commission did want to address that is new uh protection strips. uh [31:01] they wanted to clarify. So, historically in the county, uh we haven't permitted, [31:06] at least in the 15 and a half years I've been here, have not permitted protection [31:09] strips. A protection strip is when a uh usually what happens, it's when a [31:15] developer puts in a new development and at the end of their where their road [31:19] ends, they'll create a parcel that's about a foot wide. Um and they'll [31:24] maintain ownership of that parcel. That's essentially their way of not [31:29] allowing that road to extend into the adjacent property without that adjacent [31:34] property paying them uh you know handsomely for access to that road. Uh [31:40] so we one of our planning commissioners [31:44] came to us and said hey we should do away with the or make it clear that we [31:51] don't allow protection strips actually include that in our code instead of just [31:55] having that as a historically we haven't allowed these things. So, that's one [32:00] thing that was added. Uh, a clarification in our development code [32:04] section that, uh, makes it clear that a developer can't begin work on site [32:11] until, um, the subdivision has been approved. Uh, we've seen some developers [32:18] starting work without uh, final approval on the subdivision, trying to get a [32:23] little bit of a head start. Uh but we wanted to be clear that site prep work [32:27] shouldn't get started until they've sat down and had a pre-construction meeting [32:30] with all you know myself, the county roads department, the county engineer. [32:35] We generally have one meeting with all all departments involved uh and the [32:40] developer and his contractor. So um also another one is violation on property. [32:46] So, if there's a current violation on a property that's going through the [32:50] enforcement procedure that the the uh landowner can't is not uh [33:01] no land use permit or building permit would be issued on that property until [33:05] that violation has been cured. Um, we have another one of our zones or [33:12] three I should say three of our zones, the MU zone. Um, MU160, MU80, MU40. Each [33:18] of those zones, we've had different areas of our code where they're called a [33:23] mixeduse zone or a multipleuse zone. Um, and so we went in to make those [33:29] consistent. And what we proposed to the planning commission is that we actually [33:33] call it a minimal use zone because those zones being the large acreage and the [33:37] description for those zone, if you read what the intention of those zones is, [33:41] you often find them um on hillsides or in areas uh like out west where you have [33:49] very little infrastructure to support development. Um, and so instead of [33:54] calling them a mixeduse zone, which is commonly referred to in land use as like [34:00] commercial and residential as a mixeduse zone, uh, or calling it a multiple use [34:05] zone, which could be confusing, uh, we proposed to rename it to a minimal use [34:11] zone. Planning commission very much liked that idea. It makes the purpose of [34:16] the zone uh, much more clear. Uh, so that was forwarded on as well. Um [34:23] and then finally uh the last proposed change was regarding noticing [34:30] requirements just bringing those more consistent with state code. So state [34:35] code on a uh public noticing for zoning map amendments [34:40] uh requires that the property owners are are noticed. Uh we have always noticed [34:46] the property owners uh as well as adjacent property owners. Um, so we [34:52] would like to continue to notice adjacent property owners. We feel it's [34:55] helpful to have uh their feedback and input. Uh, but on we've seen we've had [35:01] some zoning map amendments over the last couple years that are much larger in [35:06] size and it has been very taxing to notice the property owners and the [35:10] adjacent property owners. It's turned into hundreds if not thousands of [35:14] notices. So, we're proposing on these very large uh zoning uh map amendments, [35:21] uh we're proposing areas over 5,000 acres that uh the just the property [35:28] owners are noticed, not the adjacent property owners. [35:32] So, all of those went to the planning [35:35] commission at their meeting last week. Public hearing was held. Um there I [35:40] believe there was no comment on those at the public hearing. The planning [35:45] commission found that the proposed amendment meets the approval standards [35:50] and they forwarded a recommendation of approval. [35:53] » Okay. With that in mind, I'll make a motion to approve ordinance 664 text [35:58] amendment multiple sections of the land use code. [36:02] » I'll second it. We have a comm we have a motion by Commissioner Bingham and a [36:06] second by Commissioner Perry to approve ordinance number 664 text amend [36:11] amendment amendment multiple sections of the land use code as explained by Scott [36:17] Lions. There's no further discussion. All in favor? [36:20] » I. >> Motion passes. Thanks Scott. [36:25] » Okay. Next one is ordinance 659 zoning map amendment. Uh this is a reszone uh [36:32] from the RR5 zone to the RR20 uh zone. The RR20 zone, not to be confused with a [36:39] 20 acre zone, it is actually a 20,000 square foot zone. So approximately a [36:44] halfacre zone. Um what happened on this one is the current property owners, they [36:52] acquired the home approximately five years ago and they are now attempting to [36:58] sell the home and uh their lender reached out to our department and found [37:05] out that the parcel the home sits on is actually an illegal parcel. if the home [37:10] were to burn down, uh, they would not be eligible for a rebuild building permit. [37:16] Um, and so they asked, okay, what can be done to correct this situation? And [37:23] really the two options are to either being that it's in an RR5 zone, rural [37:29] residential 5acre zone, it's a halfacre parcel, they would need to acquire an [37:33] additional 4 and a half acres to come into compliance with the zone or they [37:37] would need to change the zoning to a halfacre zone to be in compliance with [37:41] the zone. Uh so they've requested the uh RR20 being a halfacre zone. Um, and that [37:51] was taken to the planning commission. Planning commission held a public [37:54] hearing last week on it. Um, like I said in the staff report, comments were [38:00] generally in support of that change. Uh, the residents in the area understood [38:05] that that home has been in play. The home was built 45 years ago, I think is [38:11] what I said, constructed 1976 to 77. um zoning was adopted in 78 and then the [38:18] home was split off from the farm in ' 84. So it was about 6 years later that [38:23] split is what created the illegal parcel. Um so the neighbors understand [38:29] that it's just bringing this into compliance. The the concern that was [38:32] brought up a few times during the public hearing was that this didn't set some [38:35] sort of precedence in the Bothwell area of halfacre zoning on a larger scale. [38:41] With that said, the planning commission uh following the public hearing, they [38:46] went through the approval standards. They found that it met the four approval [38:49] standards. Um and that they also requested that this particular ordinance [38:56] include a statement that the property only owner only desires to bring the [39:02] property in compliance with with uh current zoning ordinances and it's no [39:06] way trying to set a precedent to reszone other properties in both. Uh so that was [39:12] added to this specific ordinance. Any questions? [39:18] » Nope. I'll make a motion that we approve ordinance 659 zoning map amendment [39:24] reszone from RR5 to RR20. >> I'll second it. [39:28] » We have a motion by Commissioner Bingham, a second by Commissioner Perry [39:32] to approve ordinance number 659 zoning map amendment reszone from RR5 to [39:40] RR20 as discussed by Scott Lions. If there's no further discussion, all in [39:45] favor say I. >> I. [39:46] » Motion passes. Thanks, Scott. >> Okay, next item is agreement 2642. [39:54] Uh you should have received a cover letter as well as copy of agreement and [39:59] map um regarding this. So this this agreement would be with a company [40:04] Rotherm. Uh this is a geothermal lease for subsurface resource development. Um [40:14] so essentially if you if you look at that map in the proposal uh the the [40:22] Rotoirm is looking at they're working towards leasing properties from [40:29] basically west of Honeyville to west of Brigham City. Uh there's a large [40:34] geothermal pocket in that area that has uh you know no geologists I don't know [40:41] how long it's existed but it has been ha it has had interest and has had test [40:46] wells drilled and different things like that uh for decades and decades going [40:52] back to 60s7s somewhere in that time. Um the temperatures that have come from [40:59] those test wells have uh my understanding is have never been quite [41:03] hot enough for uh previous geothermal technology. With newer technologies are [41:09] that are coming out it it uh they can function on that the temperatures that [41:15] are there. Uh so with that said, Rotom uh one of the companies that uses these [41:21] newer technologies has or is in the process of working with land owners [41:27] throughout that corridor that pocket to lease uh the subsurface uh resource [41:34] development rights. Um where it comes to the county is we [41:39] essentially have a spiderweb of roads throughout that area, right? So they're [41:43] leasing property property and then they hit a road and they need to subsurface, [41:50] you know, go underneath that road and then property property road. So what [41:54] this uh proposed lease does, it would lease the land beneath the road for them [42:02] to extend their infrastructure from the north end of that pocket to the south [42:07] end of that pocket. Um anyway, questions [42:14] » I can't answer them. Glenn can answer them. The the attorney's office has [42:17] reviewed this agreement. Um as well as the applicant or the the the uh Rotoirm, [42:23] they are here as well. Uh and they would be happy to answer. [42:26] » Well, I think we ought to have the Rotom guy come up and talk a little bit about [42:29] to this. I think that would be appropriate. You know, one of the things [42:32] that's interesting, I've had some uh citizens that [42:36] three citizens have called me and asked me kind of about it. You know, we talk [42:40] about it's two miles down and so, you know, obviously we have some I you know, [42:47] just ideas. Is it like an aquifer or we drilling down into it somewhere else? [42:52] and and so I just think for our citizens it'd be good to have kind of a little [42:56] bit of an idea what it is and and and what you're doing, what is the impact of [43:00] the properties and those type of things. And so anyway, we're glad to have you [43:04] here. >> Thanks for having me. It's uh Michael [43:06] Dabs with Rotherm Energy Corporation. So we are what we call a waterless [43:11] geothermal system. Um we're not your traditional geothermal. We operate on a [43:15] much lower temperature and you're totally correct. What we do is we drill [43:19] down 2 miles and then we go horizontally for two to three miles and then we [43:22] connect those horizontal wells. So essentially what we're creating um and [43:26] this simplifies it is the back of your fridge 2 miles below the ground. So if [43:31] you look at the back of your fridge, it has a bunch of coils that gets rid of [43:34] heat and it has a compressor. What we're doing is we're taking that compressor [43:37] out. We're putting in a turbo expander and we're attracting the heat. So we we [43:42] pump down a liquid refrigerant, the same one in the back of your fridge. It goes [43:46] down as a liquid. It collects heat two miles out and two miles back. It turns [43:51] into a gas, comes up up the hole really really fast, turns the turbo expander. [43:56] We condense it. We throw it back down and we recycle that fluid millions and [44:00] millions of times. Our surface footprint is about 3 to four acres for a [44:04] production pad. And that 3 to 4 acres can generate heat from surrounding area [44:09] of about 960 acres. So our footprint is very very small. [44:16] Does that answer some of your questions? >> Yeah. [44:18] » Okay. >> Do you have that in writing? [44:22] » We do. Yeah. Yeah, we do. >> But I should clarify that this [44:26] agreement, the lease agreement is just the ability to use that property [44:34] underground. It does not any sort of permitting or anything like that. They [44:38] would still need to go through any state permits and county land use permits, [44:42] which is where more of the details of that uh site locations and things where [44:47] the wells are going to be and different things like that will actually be [44:50] located, what those will look like as far as the access and uh you know, [44:55] everything else that gets reviewed during uh site plan review would be [44:59] addressed at that phase. >> And I've actually had the opportunity to [45:02] look at some of your agreements. Um what I what I think would be really [45:07] good what I would like to see you do is have because the people that have come [45:10] and talked to me they have this agreement right and they're looking at [45:13] it and you know they're looking at this going what what the heck is this and [45:17] trying to understand well they bring it to me and want me to understand it and [45:20] I'm kind of in the same place and so Scott and I had a conversation [45:24] the other day about well this morning about this and so I just think [45:28] especially those people um where you're going to you're going to [45:34] under their ground, maybe giving them some type of a a a sheet explaining to [45:40] them what this really is. Because the packet that I looked at, it just talked [45:44] about the agreement, but it didn't really I mean, it was there was some [45:48] information in there, but a lot of people when it gets real technical and [45:52] they would like it more in layman's terms so they kind of have a better [45:55] understanding and I would like to see that happen. [45:58] » Sure. So, but >> well, we've been we've been actively [46:01] meeting with every landowner that will answer our calls. [46:04] » Yeah. Both. >> And we and the three that I've talked [46:06] to, all three had packets, but in the packet really the explanation, so I've [46:11] got one of the packets and I just took a few minutes to read through it and I was [46:14] like, "Wow." >> So, any feedback, we're welcome to. [46:18] Okay. We're we're literally we've only been here since about August of last [46:22] year. So, uh, we're super happy to work with everybody and we if somebody wants [46:26] to meet with us, we're meeting with everybody that [46:28] » No. And I and I appreciate I mean the people I've talked to, you know, were [46:32] they just didn't quite understand what it was. Yeah. [46:34] » Not that they weren't, >> you know, willing to willing to allow [46:38] it. They just were kind of concerned as to what it was. And so, [46:40] » so one question then, you have you say you're going to have a three or four [46:43] acre footprint. >> Yes. [46:45] » And so you're generating power. So you're going to have transmission lines [46:48] that go from that point. Then you'd have to then get approval. [46:52] Correct. [46:56] » And and all of those details would be addressed at the land use permitting [46:59] phase. >> Okay. [47:01] » So, [47:08] as far as this item goes, if you so choose to approve the agreement, uh it [47:12] would be that agreement 2642 and there is a memorandum uh that goes [47:18] along with that agreement. So we'd have to approve the memorandum [47:23] as well. >> Correct. [47:27] » And to clarify that memorandum uh that was not included in your packet. [47:33] Uh but the attorney's office has reviewed that memorandum. Uh there was [47:38] an understanding that it was unnecessary, but we've since talked [47:43] about it and it is necessary. Uh, I guess the memorandum is what gets [47:48] recorded in the recorder's office to establish [47:53] essentially establish that lease. >> And so this this agreement just allows [47:58] them to move forward, but it does not they're still going to have to come for [48:01] permitting and all those type of things. >> Correct. [48:03] » Okay. [48:06] » So I would Are you ready for a motion? >> Yes, sir. I will make a motion that we [48:10] approve agreement 26-42 with Rototherm Utah geothermal and the [48:17] memorandum associated with it. >> I'll second it. [48:21] » We have a motion by Commissioner Bingham and a second by Commissioner Perry to [48:25] approve agreement number 26-42 Rototherm Utah geothermal lease [48:32] with the memorandum as uh discussed. If there's no further discussion, all in [48:39] favor say I. >> I. [48:40] » I. >> Yeah. [48:43] » Thank you very much. Appreciate your explanation. [48:45] » No problem. [48:50] » Uh, next item, ordinance 663. So, this is another zoning map amendment. Um, [48:58] this one is on the coattails of many other zone changes that have come before [49:03] you over the last few months. Uh this applicant is requesting that uh his [49:09] parcel consisting of 74.1 acres be zoned from the unzoned to the agricultural [49:16] heritage zone. Um he is in an area third ward area west of [49:22] Lwood where uh group reszone came in. he was not aware of that uh group reszone [49:29] application or some somehow missed out on it, but did want to join his [49:33] neighbors in zoning his property to the agricultural heritage zone. Uh the land [49:38] use surrounding this specific parcel uh is all agriculture and the zoning [49:45] surrounding this parcel to the uh north and west is unzoned and to the south and [49:51] east is zoned agricultural heritage zone as part of that group effort a few [49:56] months back. Um, the planning commission held a public hearing last week on this [50:03] and uh there I'm trying to remember if there [50:07] was any public comment on it. There was no public comment uh in opposition to [50:11] it. I don't believe there was any public comment on this specific item. Um the [50:16] planning commission did go through the approval standards uh whether the [50:20] proposed amendment is consistent with goals, objectives, and policies of the [50:23] county's general plan. whether the proposed amendment is harmonious with [50:27] the overall character of the existing development in the vicinity of the [50:31] subject property and the extent to which the proposed amendment may adversely [50:35] affect adjacent property as well as the adequacy of facilities and services [50:39] intended to serve the property. They found that this proposal met each of [50:44] those approval standards and they based on those findings they forwarded a [50:48] recommendation of approval. So, I'll make a motion that we approve [50:53] ordinance 663 zoning map amendment unzoned to a Heritage Zone. [51:00] » I'll second it. >> We have a motion by Commissioner Bingham [51:02] and a second by Commissioner Perry to approve ordinance number 663 zoning map [51:08] amendment from unzoned to a Heritage Zone. If there's no further discussion, [51:14] all in favor say I. >> I. Motion passes. Thank you. [51:18] » Thanks, Scott. Appreciate your time. [51:22] Okay, the fire department going to talk a little bit about ordinance 6 number [51:28] 661. Kevin's going to talk to us about that. How you doing, Kevin? [51:32] » Good. How are you? >> Good. [51:38] Uh, this one is for uh I've had it in the past for wildland urban interface uh [51:45] sprinkler systems. kind of a grant system to help offset some of the costs [51:48] for installing a sprinkler suppression system. Uh this time I wanted to include [51:54] not just the WOOI area but some of the other area for some of the sprinklers [51:58] that we're getting. >> Okay. [52:01] » Budget permitting. [52:05] » I'll make a motion we approve ordinance 661. [52:10] » I'll second it. We have a motion by Commissioner Perry and a second by [52:14] Commissioner Bingham to approve ordinance 661. [52:19] If there's no further discussions, all in favor say I. [52:22] » I. >> Thank you. That passes. Thanks, Kevin. [52:28] And I guess the next one is agreement 2633. [52:33] » This one is bringing Thatcher Penrose fire uh completely underneath us. They [52:38] have been overseen by the water department out there. Uh the water [52:42] department can't fund them legally. They can't they really don't want the [52:47] liability on their hands and so therefore thatcher is pretty well broke. [52:52] So they want to come underneath us. We'll provide their help provide [52:56] training uh equipment and >> it's great. [53:00] » Watch them grow. >> Good. [53:02] We need a motion. Make a motion to approve the agreement 26-33 for the [53:07] assumption of fire protection services and transfer of assets for the Thatcher [53:10] Penrose area. >> Second. [53:12] » We have a motion by Commissioner Perry and a second by Commissioner Bingham to [53:16] approve agreement number 26-33 for assum assuming fire protection [53:22] services and transfer of assets as presented by Kevin Lloyd. If there's no [53:27] further discussion, all in favor say I. I. [53:31] » Motion passes. >> Thanks. Appreciate Kevin. [53:35] Okay. Um the treasur's office requesting forgiveness of fees and penalties on [53:40] parcel number 03-051-0110 [53:48] for Tiffany Reman. >> How are you? [53:51] » Good. How are you? >> Good. [53:53] Um, so I have a small parcel that um is like a little triangle piece in front of [54:01] my driveway on the west side of my house. And when I originally moved into [54:05] the house um you know, we had these two parcels that weren't put together. Um [54:11] and so inevitably I get this stating you didn't you didn't pay for [54:16] this small parcel, but I've been paying um I have it on autopay every month. um [54:22] with the treasur's office to pay my property taxes. And I just I'm in the [54:27] process of including this um with Robert Fain up in Manoway. He's over um [54:34] planning and zoning. So, he's going to help me um combine [54:39] these two parcels into one so that I don't have this struggle. Um this is [54:44] like the second notice I've I've received this second year. I've received [54:48] a late notice for delinquent delinquency of property tax, but like I said, it [54:53] gets lost in the shuffle because it's not included on that original um lot of [55:00] mine. So, I was just hoping to just beg for forgiveness with this fee and get it [55:05] fixed so that we don't have this trouble next year. [55:08] » Okay, Sean, you want to come and talk to us a [55:12] little bit, please? >> And I have this map she showed me. It's [55:17] just this little tiny slice right there. >> Okay. [55:21] » But um >> what what is owed on this? [55:24] » Um >> what is owed? [55:26] » Yeah, the the fees and the fine >> $62. [55:29] » Yeah, as of today is $61.85 of that $61.85. [55:36] Uh $26 [55:41] is penalties and interest. She told me up in the office it was $19 [55:47] for debt. >> Um, [55:50] » this is the original amount I believe. >> Yeah, the original tax was 1901 this [55:54] year, 1704 last year. Both years are unpaid. So, I'm adding two penalties at [56:01] $10 each and then interest of 426 and 154. [56:06] » So, if we were to wave the penalties and interest, we'd be waving $26. Is that [56:10] correct? >> That's correct. Oh, I thought it was [56:12] like I thought it was more than that, but [56:14] » And then you're still going to work on getting that all put together. So, [56:17] » it's already >> Robert thing's working on that for you. [56:20] » What's that? >> Did you say [56:22] » Robert? Yes. I've emailed him everything and he's just he's working on getting it [56:26] taken care of. >> Well, yeah, that's I hope we can get [56:28] that because we just don't want you have to come back next year. [56:30] » No, I don't want to come back. I just I mean I've told them I said this has been [56:35] a pain to have these two. >> I'm sure [56:37] » these two and this is just a little small section of um like like I said [56:43] it's right in front of my mailbox and it just gets forgotten about. [56:45] » Yeah. >> Because it's not added to my property [56:47] tax. >> Sure. [56:49] » So >> sense. [56:51] » Okay. Commissioners, I need a motion. I'd make a motion that we forgive the [56:55] fees and penalties on parcel 03-051-0110. [57:02] » Second. >> We have a motion to forgive the [57:04] penalties and fees by uh Commissioner Perry and a second by Commissioner [57:10] Bingham on parcel number 03-051-0110. [57:17] Tiffany Reman. All in favor say I. >> I. [57:20] » I. Thank you. [57:22] » Thank you. [57:26] » Okay, we're now to our public comment period. [57:30] Those wishing to make public comment shall sign the comment role and will be [57:34] responsible for the following rules outlined in the county commission rules [57:38] and procedures. And we have Deanna Hardy. [58:19] Okay. Deanna Hardy Bighgam. The Boxella Committee of Liberty opposes quai [58:25] government agencies. Our republic is being destroyed from within from all [58:29] these quasi government agencies which are unconstitutional because the boards [58:33] are appointed not elected. These quasi government boards tax the people without [58:38] their consent. Therefore, you have taxation without representation. The [58:42] same problem our founding fathers incurred by King George III and the [58:46] British Parliament. The 10th complaint in the Declaration of Independence, [58:50] which we just celebrated its 250th anniversary says, "He has erected a [58:55] multitude of new offices and sent hither swarms of officers to harass our people [59:00] and eat out their substance." The 17th complaint says, "For imposing taxes on [59:06] us without our consent." The 21st complaint says, "Altering altering [59:11] fundamentally the forms of our government." Maida is another quasi [59:16] government agency which is ran by an appointed board and taxes the people [59:21] without their consent altering and changing a republic form of government. [59:26] The history of the present king of Great Britain is a history of repeated [59:29] injuries and usurppations all having in direct object the establishment [59:34] establishment of an absolute tyranny over these states. History keeps [59:40] repeating the same mistakes over and over again. We ask you again follow the [59:45] contracts which are the constitutions. Repentance is necessary to restore a [59:51] public form of government that was guaranteed to every state in this union. [59:56] Quote, "Anything contrary to the Constitution is null and void and of no [1:00:01] force." Thomas Jefferson. The Boxella Committee of Liberty opposes interlocal [1:00:06] agreements because they give tax exemptions advantages to certain [1:00:11] businesses. The data center also known as the surveillance center is being [1:00:17] given an interlocal agreement where they will be given tax exemption and the [1:00:22] people will be paying higher taxes. Example, the taxing entities like the [1:00:27] school district, mosquito abatement and the bar water conservy district wave the [1:00:31] taxes they would have received for 20 25 plus years. But then those same quasi [1:00:37] taxing entities tax the people several times through the years without the [1:00:42] consent of the people like we've experienced since interlocal agreements [1:00:46] were established. We ask you again restore the free market [1:00:50] as stated in our Utah Constitution article 12 section 20. Stop giving [1:00:55] special privileges to certain businesses or monopolies. Thank you. [1:01:01] » Thank you. [1:01:07] Okay. Our warrant registering [1:01:12] on that [1:01:19] Mr. B. Thank you. [1:01:34] Sir, [1:01:44] this is all the volunteers for the fair. We get the rest of them. [1:01:49] » So, yeah, just know that there won't be meeting after that one. So, we got to [1:01:52] get them all in on that one. [1:02:18] So, is this supposed to be June or July >> for the warrant register? [1:02:24] » It says it says six on it, not seven. >> Today's July. [1:02:27] » That's July. Yeah, [1:02:31] » that's right. [1:02:35] We're just having so much fun. We want to go back to June. [1:02:37] » Good. Good call, boy. >> Yeah. [1:02:42] » Time just goes by too fast. [1:02:53] We'll get to change hers to the second, too. [1:02:58] Good catch. [1:03:01] Okay. >> Okay. Very good. [1:03:06] » Need a motion to go into close session. >> I'd make a motion we go into close [1:03:09] session to discuss pending litigation. >> Second. [1:03:12] » We have a motion by Commissioner Perry and a second by Commissioner Bingham [1:03:15] going into close session. All in favor say I. I. [1:03:17] » I. Okay. Now close session. [1:03:34] I I just I hadn't hand wrote it down. I don't have it. [1:03:39] » Well, no. Um but we can hurry and give it to you if you want. Let's see. So, [1:03:43] it's just >> So, what you've got is [1:03:47] » cancelling. So, we have August 12th is our next commission meeting. It'll be an [1:03:50] afternoon meeting. Then we'll have
