So, [15:47] we would probably want to continue to [15:48] have, you know, negotiations and make [15:50] sure that we're getting working with [15:52] Willard to continue to provide service [15:54] to those folks in South Willard until [15:56] the day comes if they choose to be part [15:58] of Willard at some point. But until [16:00] then, yeah, we I think as a county, as a [16:02] county, we that you're the best option [16:05] to provide that public. [16:06] >> You guys are doing Yeah. And you guys [16:08] are doing a phenomenal job. [16:10] >> On the law enforcement side, we [16:11] obviously have to deal with uh our [16:13] sheriffs, the sheriff's department would [16:14] be the issue with the law enforcement [16:16] part, but I think from fire and EMS [16:17] side, we would we would definitely [16:19] support you guys moving forward with [16:21] that. Um anyway, it basically [20:07] allows the county commission to one [20:09] decide if they want to surplus that [20:11] particular piece of property. um that uh [20:15] you know it may be something the county [20:17] wants to hold on to. They may find some [20:19] use for it, whether that be for fire or [20:21] sheriff or roads or who knows what. Uh [20:24] if it's not a piece that they want to [20:26] hold on to, um then it likely makes [20:29] sense to either get back, you know, on [20:32] the tax books, something like that. Uh [20:35] so this policy outlines how that is to [20:39] take place. So step one is to decide if [20:42] it, you know, if if it makes sense to [20:44] surplus it or not. And then uh if if [20:48] decided that surplusing makes sense, [20:50] then the county commission needs to [20:52] decide how uh h how to value that [20:56] property. Um so it sets forth five [21:01] different ways to do that. uh sealed [21:03] competitive bid, a public auction, [21:06] evaluation by a qualified and [21:08] disinterested appraiser, um the Boxler [21:11] County Assessor's Office, or other [21:13] professional publications or valuation [21:15] services. So, so those are the those are [21:18] the five different ways that um a value [21:21] could be applied to that property in [21:23] order to um determine this the sales [21:26] price for it. Once that is decided, then [21:30] you would direct um me to take it [21:33] through the process. We run it through [21:34] the planning commission. Planning [21:36] commission reviews it per this policy. [21:38] Couple things they look at as far as um [21:41] the general plan and things like that. [21:43] And then their recommendation comes back [21:45] to you and we're supposed to go through [21:48] a noticing period and then um you would [21:51] take action from there as far as the [21:54] final sale of the property. So step one [21:57] would be determining if you want to [21:59] surplus it and how to value it. [22:03] >> Okay. [22:04] >> Commissioners, [22:07] >> is there discussion? [22:08] >> Is there a best way to figure out how to [22:09] value it? I don't [22:11] >> how that [22:12] >> So So he may have done some research. Uh [22:15] I've spoken I believe it was your wife [22:17] that stopped by. I spoke with her for a [22:19] little bit and kind of gave her the [22:20] rundown as far as what the different [22:22] options are that you that that are have [22:25] been used historically. Um, [22:30] I think the two the two main ones that [22:32] I've seen often times when we surplus a [22:35] piece of property, it's it's kind of [22:36] these smaller slivers or triangles, [22:39] awkward pieces of property that that [22:42] nothing really can be done with them [22:44] except for uh, you know, usually it's an [22:46] adjoining neighbor that is [22:49] >> okay there's this 2,000 square foot [22:52] piece adjacent to my property and in [22:55] that case uh, the property may only be [22:58] worth a couple hundred dollars and so it [23:00] doesn't make sense to have an appraisal [23:02] done where the appraisal is going to [23:03] actually cost more than the property and [23:05] so you have used the assessor's office [23:07] to value that in in those scenarios. [23:10] There have been other scenarios where uh [23:12] you know an appraisal has been requested [23:15] and that appraisal has been the [23:17] responsibility of the interested party [23:19] uh and sometimes they go through with [23:22] it. Sometimes they say, uh, that's going [23:24] to in the end, you know, it might be [23:27] $6,000 for the parcel and, you know, [23:29] a,000 or two for the appraisal and that [23:32] the appraisal price just pushes it to [23:34] where it no longer makes sense for them [23:36] >> and they kind of abandon the, you know, [23:38] the quest to acquire that piece of land. [24:04] We're willing to pay that price and it [24:07] fits under one of those ones. And that [24:10] was the evaluation in 25 which is the [24:13] latest that I could find on public [24:15] record. Um if there's a newer valuation [24:17] from the assessor's office, we'd also be [24:19] willing to pay that price. Um the family had over [36:06] six square miles of land up there in the [36:08] Devil's Gate Valley. We were the ones [36:10] that put the roads in originally for [36:13] sheep and cattle grazing. So, um it's [36:18] been a problem ever since. We used to [36:20] have an old cable up there with the [36:22] white rocks that said no trespassing, [36:24] but then it was declared a public road [36:27] sometime I don't know in the early [36:30] 2000s. Um there [clears throat] was a [36:33] originally a gate and a cable up there [36:35] established. Uh there was a new one put [36:38] up there in the year 2007 to close the [36:41] Devil Gate from [clears throat] the [36:43] public because they were doing such so [36:46] much property damage running all over [36:48] the place going through the meadows. Uh [36:51] so [clears throat] it is our intent that [36:54] this is a road closure. There should be [36:56] a road closure. Otherwise, it's [36:58] restricted access by the 52-inch [37:00] vehicles, and that's not [clears throat] [37:02] not fair to us as property owners that [37:04] don't have a 52-in vehicle to go through [37:08] there. But we should have access to our [37:09] road to kind of see what's damaged. So, [37:11] if you're closing the road, then call it [37:13] a closure, not a limited access. Close [37:15] it completely. So, it's my testimony and [37:20] my my request that we look at that [37:23] seriously that uh one, you're [37:25] restricting me as a land owner to be [37:27] able to go up there and check on my [37:28] property after the 15th of November. [37:32] That's generally speaking when they [37:34] close it. Uh but it's not a road [37:36] closure. It's a restricted access. So, [37:38] anybody with a a small vehicle can go up [37:41] there and do whatever they want. and we [37:43] the land owners don't have keys and [37:44] can't go up there and check on things, [37:46] make sure that our property is not being [37:48] destroyed. Uh and then it's open back in [37:50] the spring, [clears throat] [37:52] but we don't have a chance to go up [37:54] there and really notify the uh county [37:57] roads that, hey, the road's still not [37:59] accessible. really better hold off and [38:01] keep it from, you know, the church has [38:04] gone up there and done a lot of work [38:06] this year and I'm sure they don't want [38:08] that road destroyed at their expense [38:10] that they did uh to make it so it's [38:13] easier to get in the church camp. So, um [38:16] there's a couple of things. If if you're [38:18] going to allow the uh restricted access [38:20] instead of a road closure, then I think [38:22] that that you as a commissioner uh [38:26] should agree that the property owners [38:27] that have property up there be able to [38:30] be given a key that we don't have to go [38:32] and fight for a key. We can have the [38:34] access to a key so that we can go and [38:36] make sure that people aren't destroying [38:38] that are going in there on a restricted [38:40] access. So, that's one of the requests [38:43] that we as land owners up there have [38:45] agreed that we're asking for. However, the upper three miles [41:00] of that road takes much much longer to [41:03] melt off, become passable than the lower [41:05] three miles. [41:07] So, I'm asking the commission to [41:08] entertain the idea of putting an [41:09] intermediate gate at the White Rock [41:11] Willard Peak Road Split where landowners [41:15] could once it becomes passable in the [41:17] lower three miles access their property [41:19] safely start winter renovations, [41:22] closures, and spring openings earlier [41:25] than allowing and waiting for the upper [41:28] portion of that road to be melted off. [41:30] It's a very distinct time difference [41:33] there for accessibility to the private [41:34] properties. [41:36] So, I'm asking the commission if they [41:37] would entertain that idea and accept [41:39] that as a possibility to place that [41:43] intermediate gate at that strategic [41:45] place. [41:46] >> And you're saying put the intermediate [41:47] gate rather than going down into Devil's [41:50] uh Devil's Gate area would be going [41:52] continuing up into Willard Peak. It [42:13] would the the terrain creates a natural [42:16] barrier for passage around the gate. So, [42:19] I think it would be easily monitored and [42:21] I think it would be able to be uh [42:24] enforced the closure rather than having [42:26] vehicles go around. It's really a [42:30] natural spot for the for the train to [42:31] put the gate there, allowing then once [42:34] again restricting that upper passage for [42:36] safety purposes, which I understand, but [42:38] yet allowing private owners to access [42:40] the lower portions that are melded off [42:42] and safely passable. [42:44] >> Okay. So, when you say there is a [42:46] natural place to put it, I haven't seen [42:48] a place anywhere where somebody can't go [42:49] over with a motorbike or side by side.
