[4:43] Members of the authority would like to provide a brief [4:46] the update on the authorities finances infrastructure initiatives MS4 compliance and several other matters since our last meeting as of July 31st, [5:00] The stormwater fund revenues total approximately $868,000 already exceeding the annual revenue budgeted, which was approximately $795,000. [5:15] expenditures total approximately 520,000 dollars or 65.5% of the budget, leaving a current revenue [5:23] over expenditure position of approximately 347,000 dollars. [5:30] The fund remains in a strong position, although additional engineering, some mapping, [5:36] CCP projects, and MS4 maintenance, and a capital expenditure are still anticipated during the [5:45] staff is already preparing the 2027 stormwater authority budget and it will be available for review [5:55] and action at the next quarterly meeting which will be November 16th, but I'll forward copies in the interim, the email. [6:07] Some of you are already aware that there has been an important legal development since our last meeting, [6:13] Following the Pennsylvania Supreme Court's Westchester stormwater feed decision, a proposed [6:19] class action lawsuit was filed off August 12 against the Pittsburgh Water and Sur Authority, [6:26] challenging its stormwater feed. [6:29] The plaintiff's alleged that the PWSA stormwater charge should be considered attacks rather than a fee, [6:35] and further contend that, as a municipal authority, PWSA lacks the authority to impose such attacks. [6:42] The lawsuit seeks among other relief repayment of previously collected stormwater charges and an injunction against continued collection. [6:53] It is important to emphasize that these are allegations and the newly filed lawsuit not a court decision in the filing does not invalidate Brettwood stormwater fee. [10:49] And preparing which we're being included in the 2027 operating capital budget for the storm water source authority. [11:00] So overall, the authority continues to make good progress, we're beginning to see the pieces of the program.
