[0:02] prepared to um [0:04] make a motion regarding the execution of the MOU between Town of Bridgewater and [0:09] the District of Lunenburg. That should be in your [0:13] package. [0:22] Everyone's pulling up their document. [0:33] I mean, I can read it. Move it. [0:36] I'm just looking for someone to uh [0:39] move that we authorize to >> do you Someone got it? [0:42] » I I can I got it now. >> Okay, thank you. [0:45] » Yeah, you're welcome. So, I move that Town Council for the Town of Bridgewater [0:48] authorize the execution of memorandum of understanding between the Town of [0:51] Bridgewater and the Municipality of the District of Lunenburg establishing a [0:54] framework for uh collaboration and infrastructure investment to support the [0:58] expansion of Exit 12A business/industrial park as presented in [1:02] document number 26-116C. >> Thank you. Seconded by Councillor Wynot. [1:07] Further discussion. Hearing none, all those in favor? [1:11] Those opposed? Motion is carried. Uh down to 11.2 conveyance public streets [1:16] for Cedar Drive and Hollow Drive. >> And I do have Nick and [1:21] and Jonathan here if the Council would like to receive [1:24] kind of a a summary of what's being requested. [1:27] » I think so, just because we are uh you know, this is a a public meeting. So, if [1:31] someone could just yeah, just summarize what we're doing, that would be [1:34] great. Nick, I guess that's I guess that's you. [1:39] » Yes. Yes, no problem. Um apologize, my camera doesn't seem to be working. It's [1:44] telling me to restart my computer and I won't go through that process right now. [1:49] So, um you'll just uh um have to listen to me instead. Um [1:55] So, yes, this item relates to the public takeover of uh two new streets adjacent [1:59] to Etna Street in the Glen Allen area of town. [2:03] Uh subdivision question proposes 52 [2:06] dwelling units of two units semi-detached nature, therefore 26 lots [2:11] with two unit dwellings. The subdivision also includes two new [2:15] public streets, Cedar Drive and Hollow Drive. Street names were approved by [2:20] council in January of this year upon having a received recommendation for the [2:26] Cedar Drive and Hollow Drive street names from the Heritage Advisory [2:30] Committee. Today staff recommend the council [2:33] approve the acceptance of Cedar Drive and Hollow Drive as public streets and [2:38] authorize the development officer to accept the street deeds on behalf of the [2:42] town. This approval, however, would be [2:45] conditional on the developer submitting all required acceptance requirements [2:49] under part nine of the subdivision bylaw to the satisfaction of the town [2:54] engineer. Additionally, staff recommend that if [2:57] the developer chooses not to complete the landscaping within the street right [3:00] of streets right of way adjacent to future building lots at this [3:05] time, that council authorize the development [3:07] officer to enter into a servicing agreement with the developer [3:12] before approval of the final subdivision plan. [3:15] Under this agreement, the developer would be required to provide a [3:18] performance surety acceptable to the to the town equal to [3:23] 125% of the estimated cost of completing the landscaping work in this case. The [3:28] security would ensure the landscaping is completed to town standards at a later [3:33] date, usually within 12 months. Uh regarding that second part, the [3:38] performance surety part, staff believe that the developer intends to complete [3:42] the required landscaping, so for full completion of the streets and services [3:47] by the end of this week. Therefore, performance surety process is [3:51] quite likely not needed. Uh however, staff are still seeking this approval in [3:56] the event that it's that it's needed to be sure no delays in receiving and [4:00] approving the takeover package uh per the subdivision bylaw acceptance [4:05] requirements. So, in accord in accordance with the [4:08] subdivision bylaw, before the town can accept any new streets and services, [4:14] the developer must submit the takeover package for approval. [4:18] So, this includes a a 12-month maintenance surety in the [4:22] amount of 10% of the actual cost of construction of the streets and [4:26] services, reproducible record uh records and [4:30] as-built drawings of engineering design, all test reports, operating procedural [4:34] manner manuals, copies of the survey plan and all deeds, [4:38] easements, etc., etc. Any new streets cannot be deemed public [4:43] streets until such time as the acceptance requirements have been [4:46] satisfied. Uh normally, the streets and services [4:49] would be completed to the town standard, takeover package submitted, and upon [4:54] approval by the engineering department, staff would recommend that council [4:58] declare the the subject streets as public streets vested in the town. [5:03] And then we go and we'd register the plan of survey and the deed to transfer [5:07] the street parcels. And then once [5:11] those are public streets, subdivision of lots and issuance of building permits [5:15] can proceed. Building lots cannot be created without [5:19] public street frontage, thus the the necessity of of this process. [5:25] In this case, council approval council's approval would be conditioned on an [5:29] approved takeover package. This approach would allow staff, under [5:34] the authority of council, to review and approve the takeover [5:37] package and begin the process of creating the street parcels and [5:41] transferring ownership to the town as soon as possible, [5:45] rather than needing to take time to approach Council later on. [5:48] Uh the advance approval will allow the developer to create the lots and obtain [5:52] permits to construct sooner. Um so with that, I'll um [5:58] yeah, I'm here to answer any any any questions that's uh that Council may [6:01] have. >> Any questions? [6:05] Folks, I mean this is normally how we do things. We're just doing a little bit [6:09] ahead of time for the developer. Uh Deputy Mayor? [6:13] » Uh I was just going to kind of confirm that they the entire point of this is to [6:17] allow them to start building faster. And [6:22] and then all of the same conditions still have to be met, correct? [6:26] » I think that's correct. Yeah, we're we're we're trying to uh streamline this [6:30] this process as as much as we can, but yes, all the requirements do need to be [6:34] met prior to uh takeover official takeover, opening of that street, [6:39] creation of lots, and uh and construction of homes. [6:42] » Perfect. Thank you. >> Any other questions on this? [6:50] All right, I'm looking for some direction from Council for staff. [6:55] Councilor Now, thank you. >> Uh I move that Town Council of the Town [6:59] of Bridgewater accept Cedar Drive and Hollow Drive as public streets and [7:02] authorize the development officer to accept the street deeds on behalf of the [7:06] town condition uh on behalf of the town conditional upon the success uh [7:11] submission by the developer of all required acceptance requirements under [7:15] part nine of the subdivision bylaw to the satisfaction of the town engineer, [7:19] and further that Town Council authorize the development officer to enter into a [7:23] servicing agreement with the developer to complete the landscaping uh [7:28] within the street street right-of-way adjacent to the future buildings prior [7:33] to approval for the final subdivision plan. [7:35] » Thank you. Seconded by Councilor Frigault. Further discussion. [7:41] Hearing none, all those in favor those opposed, motion is carried. Thank [7:46] you. Thank you, Nick. And then our last one last one for this [7:50] is again that that land transfer Don was [7:55] talking about in camera. So, I'm just looking for some direction on [7:59] that one as well. [8:04] Oh, Deputy Mayor McDonald. [8:09] Did you >> my fingers on to unmute and and get back [8:11] to my agenda in a timely manner. Okay. So, I move that town council for the [8:15] town of Bridgewater authorize the execution of the proposed exchange [8:18] agreement between the town of Bridgewater and the province of Nova [8:21] Scotia, which sees provincially owned PID 60020799, [8:28] approximately 0.84 hectares, transferred to the town and portions of the [8:33] town-owned PID 60020807 [8:38] and PID 600 23868, combined approximately 0.64 hectares, [8:46] transferred to the province for the purchase price of $1. [8:49] » Thank you. Seconded by Councilor Conklin, birthday boy. [8:55] Um all those in favor [8:59] those opposed Not like in favor of my birthday, but in [9:02] favor of the motion. Okay. We should have a vote on Mike's [9:06] birthday. Mike might vote against Mike's birthday. [9:08] Um and then finally we have We do need a motion for the cost-share [9:13] um agreement with Nova Scotia [9:16] Power, right, Tammy? >> Yeah. [9:19] » discussed in camera. >> That's right. So, it would be to [9:22] authorize the execution of the cost-sharing agreement between Nova [9:26] Scotia Power, Town of Bridgewater, and the Municipality of the District of [9:29] Lunenburg in the form as generally presented [9:33] in camera, accepting non-substantial revisions to the agreement that may be [9:38] made prior to execution. So, that would be if legal counsel had something to to [9:42] change that was not substantive in nature. [9:45] » So, I'm prepared to make uh the move that. [9:49] As as stated by the CEO, Counselor Newell, thank you. Seconded by Counselor [9:54] Wynant. Further discussion on that? Hearing none, all those in favor? [9:59] Those opposed? Motion is carried. Thank you. That brings us to the end of our [10:04] regular agenda. Um so, we're going to [10:07] um don't forget we're going to jump on to the other one. So, I'm looking for a [10:11] motion to adjourn. [10:15] Um Counselor Caldwell, seconded by Counselor Frigault. We are adjourned and [10:19] um we'll see council on the other on the other link. [10:22] Thanks, folks. Thanks, staff.
