As we begin this meeting, I'll ask everyone to please [2:03] silence cell phones and other electronic devices, reminding council that our [2:06] procedure bylaw prescribes the use of technology during council meetings. It's [2:10] 5:01 p.m. I'll call this council and council planning meeting to order. [2:16] We acknowledge that we are meeting today on the traditional territory of the [2:19] Missasaga and Asha now of Balderville. Is there any discussion? Uh [3:25] just to advise the the delegation um could not appear because his spouse has [3:31] taken ill. That's it. Um they they will return. I suspect we will reschedu so [3:37] that we can all see the uh the pottery. Any discussion? Any further discussion? [3:43] All in favor? Being none opposed? That motion's carried. [3:50] and a motion moved by councelor McClin and seconded by councelor Butwell that [3:52] council approve the August 20th 2026 council agenda as amended. Is there any [3:58] discussion? All in favor? There being none opposed, that motion's carried. [4:05] Members of council, have you any declarations of pecuniary interest? And [4:08] if so, please state the general nature thereof. Council mccosland. [4:14] » Uh yes. Thank you, Mr. Mayor. and through you I do have to declare for [4:20] sorry item 12.2 um as the applicants are family members. [4:27] » Thank you for that. Anyone else? Thank you. [4:35] [gasps] >> That brings us to our close session. It [4:39] is moved by Council Rowley, seconded by Deputy Mayor Anderson, that council [4:42] resolve into close session August 20th, 2026 at 5:03 p.m. [4:48] Pursuant to the Ontario Municipal Act, RSO 2001 is amended subsection 2392A, [4:53] security of the property of the municipality or local board relating to [4:56] cyber security and information technology systems. and C proposed [5:01] appending acquisition or disposition of land by the municipality or local board [5:04] discussion regarding the potential acquisition of certain property for [5:08] municipal use including consideration of related strategic financial and [5:12] negotiating implications and D [clears throat] labor relations or [5:16] employee negotiations. Is there any discussion? All those in favor? There [5:20] being none opposed, that motion is carried. [5:25] We'll give staff a moment to trans [1:31:40] Hey, good evening everybody. It's 6:30 p.m. I'll call this meeting back to [1:31:43] order. I have a motion moved by councelor Butwell, seconded by councelor [1:31:47] Wielden that council rise and report from close session August 20th, 2026 at [1:31:51] 6:31 p.m. in accordance with subsection 2392 of the Ontario Municipal Act to [1:31:57] discuss matters pertaining to security of the property of the municipality or [1:32:00] local board relating to cyber security and information technology systems and a [1:32:06] proposed or pending acquisition or disposition of land by the municipality [1:32:10] or local board. discussion regarding the potential acquisition of certain [1:32:13] property for municipal use, including consideration of related strategic, [1:32:18] financial, and negotiating implications and labor relations or employee [1:32:22] negotiations. And further that council received [1:32:26] confidential information that provided that was and provided direction and that [1:32:30] a procedural motion to adopt the closed session minutes of July 27th and July [1:32:35] 29th, 2026 was voted on during the closed session. Is there any discussion? [1:32:40] All in favor? Being none opposed, that motion is carried. [1:32:50] Are there any announcements? Councelor Wield. [1:32:54] » Thank you, Mayor. Uh, I just wanted to thank everyone from the public who came [1:32:57] out to the uh session last Wednesday evening at King Edward Park about the uh [1:33:03] the land banking initiative. um phenomenal to see people coming out [1:33:08] and and expressing their values and and contributing to what will be um I think [1:33:13] maybe one of the the central projects of the coming term. So, uh thanks to [1:33:18] everyone about that and it's not too late to participate folks. There will be [1:33:21] more opportunity to uh engage on that project in particular. Um and please [1:33:26] reach out to any of us if you have questions about it. It's uh it's a [1:33:29] really exciting and important thing. >> Thank you for that, Council Mossland. [1:33:35] Um, thank you, Mr. Mayor. And through you, I just want to say thank you to all [1:33:39] the participants that we had out um at our soapbox derby. We kicked it off um [1:33:45] first year for the municipality running it as opposed to the Lions Club. And we [1:33:50] had a lot of participants out and also thank you to all of our sponsors. Um [1:33:54] without both of those parties, it would not be able to happen. And we had our [1:33:58] great first responders there from firefighting and St. John's ambulance [1:34:02] and our auxiliary officers there to um see how fast the kids were going down [1:34:06] the hill. So it was really fun and hopefully it's better next year. [1:34:10] » Go ahead. >> Thank you. Um we did have the DBA there [1:34:14] as well taking u photography and videography of the event and I was just [1:34:17] wondering if we could share that video. >> Is it Do we have it available now? [1:34:21] » Yeah. >> Deputy clerk. Go ahead. [1:34:25] » Thank you. >> Way to sneak in a delegation hand. [1:35:18] Can't believe [1:35:56] Very nice. Thank you very much for that. Thank you to the BDA for the video. Uh [1:36:00] Councelor Butwell, thank you. >> That looks like tons of fun. So, while [1:36:05] the soap box derby was going on, we were in the throws of the 10th annual Bridge [1:36:10] Hospice indoor yard sale. uh two-day sale uh loaded exclusively with uh [1:36:16] Brighton residents um belongings that were then resold. 100% of the proceeds [1:36:21] of that sale go to the bridge hospice. We brought in a uh moderately decent [1:36:27] amount of $2,200 for the hospice. It was up from last year but still our second [1:36:31] lowest. Uh we made that announcement online and we have had four individuals [1:36:37] don four individual donors step forward and contribute and we are now up to [1:36:43] $3,530. So thank you to those donors who all [1:36:48] formed a part of that after the fact. Um it really meant a lot to not only the [1:36:55] volunteers but to the people from the hospice who are kind of in the [1:36:59] background egging us on to try to keep getting more. So, if anyone would like [1:37:03] to donate, um, please get in touch or donate directly to the Bridge Hospice [1:37:07] themselves. Thank you very much. >> Thank you. Anyone else? Councelor [1:37:13] Rowley. >> Thank you, Mayor. I just want to add a [1:37:17] little bit to uh, Council Member Cosland's announcement regarding the [1:37:21] soapbox Stervy. Um, did speak with one of the residents on the street after it [1:37:25] was all over. I believe you were already gone. Great compliments. They were [1:37:29] hoping that we uh use their street again. And I did see in the video it was [1:37:33] missed that there was one minor accident. There was one car that did go [1:37:36] in the ditch. >> What about this? [1:37:40] » Someone needs to learn to drive better. Maybe next year. [1:37:44] » Been a local politician. I heard. >> Yeah, it was. It [laughter] was the [1:37:48] younger ones. [1:37:56] No one there council either. [laughter] [1:38:01] » I do have another couple of announcements. I want to um publicly uh [1:38:06] thank that maybe uh Director Linen could take this to his u parks and recreation. [1:38:10] It was uh brought to my attention a few weeks ago that um the Aris Marcus um [1:38:16] soccer field sign had been taken down years ago and it had been missed and um [1:38:22] uh manager uh Halum got all over that and we now have a new Aeros Aris Marcus [1:38:29] community soccer field sign. So check it out. It's got the new logo on it. It [1:38:33] looks really great. Um, as well you and I learned a lot more about chickens and [1:38:38] grain a week or so ago on the Poly Egg tour and that was with u more residents [1:38:44] from the county. That was also an awesome day. So that's all I got. [1:38:48] » Thank you, Councelor Wright. >> Um, I have an announce not so much an [1:38:55] announcement just as a sharing of an experience um that's not quite as much [1:38:59] fun as everything else that we've heard so far on the table. I went around to [1:39:02] several businesses through the industrial park um and those that are [1:39:07] impacted right now by all the infrastructure construction and there's [1:39:12] a lot of unhappy businesses at the moment. Um so we had some good [1:39:16] discussions and I had a great discussion with Mr. Heggerman hoping to follow up [1:39:19] with him again um soon but I just want to remind everybody listening to just [1:39:24] please take a breath. There was a woman that came into my store um who said that [1:39:30] she was at the point of giving up to going to her appointment and she, you [1:39:35] know, checked herself, took a deep breath, looked at the map, figured it [1:39:39] out, got to where she needed to go because there is a way to get to where [1:39:42] you need to go. You just need to be a little bit more patient than what um you [1:39:46] would normally have to display. So, just really encouraging everybody to continue [1:39:50] to support the businesses that are impacted um by the infrastructure [1:39:55] construction. It will land well in terms of the infrastructure. It's going to [1:40:01] look beautiful when it's done and it's going to be brilliant to drive on and [1:40:04] walk through and all those things. Um but we are in the the midst of the chaos [1:40:08] at the moment. So, just take that breath and keep going. [1:40:13] » Thank you for that. Any other announcements? [1:40:16] Um, we had Pop Palooa on uh Saturday as well uh in the park. I had an [1:40:21] opportunity to go around see some of the vendors and thank uh Prescll Animal [1:40:24] Hospital for hosting that event in Memorial Park. It was uh it's fun. It's [1:40:29] fun to see the dogs. Anyone else? [1:40:34] Uh moving on to the adoption of the minutes. It's moved by councelor Rowley, [1:40:37] seconded by councelor Wright, the council adopt the July 27th, 2026 [1:40:40] council and planning meeting minutes and the July 29th, 2026 special council [1:40:45] meeting minutes as presented. Is there any discussion? All in favor? There [1:40:50] being none opposed, that motion's carried. [1:40:57] [gasps] We have no public meeting on the agenda, [1:41:00] but we do have a statutory public meeting uh for a planning issue coming [1:41:04] up. Uh the delegation the presentation from [1:41:08] uh Nick Grumoff the archaeological assessment has been cancelled. Um Mr. [1:41:13] Grumoff was unable to join us this evening. [1:41:21] Brings us to citizens comments. I saw one madame clerk but it was with regard [1:41:25] to the delegation. So it's been withdrawn. Is there any others that you [1:41:28] know of? Thank you. [1:41:38] It does bring us to our statutory public meeting. The municipality of Brighton [1:41:41] takes steps beyond the requirements of the planning act to engage the community [1:41:44] and land use planning initiatives. The municipality also holds a statutory [1:41:49] public meeting on the planning item and then receives a staff report with a [1:41:52] recommendation on which council will make a decision. It is during this [1:41:56] meeting that council depends on the community to provide input for our [1:42:00] decision. This input may be received in advance of the statutory public meeting [1:42:04] by sending correspondence to the clerk's office and/or by making an oral [1:42:08] submission to council at the statutory public meeting. This will best inform [1:42:12] council on the land use planning matter prior to council making our final [1:42:15] decision. The province's regulations now limit appeal rights to only the [1:42:19] applicant and specified regulated persons. For details or information on [1:42:23] the new appeal process, please visit the municipal website or contact the clerk's [1:42:27] office. And with that, I have a motion moved by [1:42:31] councelor Butwell, seconded by Councelor McCoslin that council move into the [1:42:34] statutory public meeting at 6:41 p.m. Is there any discussion? All in favor? [1:42:40] Being none opposed, that motion's carried. [1:42:50] [gasps] There's only one item in our statutory [1:42:53] public meeting this evening. It's with regard to a proposed zoning bylaw [1:42:57] amendment on 15064 telephone road. The owner is um break. The purpose of the [1:43:05] meeting is to address requirements under the planning act for hosting a public [1:43:08] meeting before council makes a decision and to obtain public input towards [1:43:12] making any decision on the proposed zoning bylaw amendment. [gasps] [1:43:16] So planner Britain, by what method and on what date was notice of the [1:43:19] application given? Through your worship, notice of zoning [1:43:23] bylaw amendment application Z32026 was provided in compliance with the [1:43:28] planning act with a public notice sign posted on the property on July 30th, [1:43:32] 2026, as well as a notice of complete application and public meeting mailed to [1:43:37] all land owners within 120 meters of the subject lands on the same day, July [1:43:42] 30th, 2026. Notice also circulated to all agencies as required under the [1:43:47] planning act. >> Thank you. Planner Brent, would you [1:43:51] please explain the purpose and reason for the subject application before [1:43:54] council this evening? >> Uh through your worship, the purpose of [1:43:58] subject zoning bylaw amendment application Z3 2026 is to seeks to [1:44:02] reszone the portion of the agriculture Azone and environmental protection EP [1:44:07] zone into a rural residential zone. Uh the meaning the new lot with an existing [1:44:13] dwelling. The subject lands are located at 1506 Telephone Road and uh as [1:44:19] previously seen, the subject lands were taken to council as part of a proposed [1:44:24] consent BO5206 on July 27th, 2026. Sorry, July 27th, [1:44:31] 2026. Thank you. Um under section 53 of the planning act the um the uh sorry [1:44:37] severed lands are a48 hectare or 1.19 acre parcel that contain this dwelling [1:44:44] and garage that are surplus to a farm in operation. [1:44:50] » Thank you planner. Are there persons present who have questions or comments [1:44:53] regarding the proposed application? [1:45:00] Any questions for members of council? [1:45:05] Planner Britain. Any final comments? >> Through your worship? None at this time. [1:45:10] » Thank you. I have a motion moved by councelor Rowley, seconded by councelor [1:45:13] Wright, that council enacts a bylaw to reszone portions of the severed lands [1:45:17] from agricultural zone and environmental protection lands to the rural [1:45:21] residential exception number 58 zone and the retained lands into the agriculture [1:45:26] agriculture exception number 38 zone. Is there any discussion from members of [1:45:31] council? All in favor? Being none opposed, that motion's carried. [1:45:39] And with that, I have a motion moved by council right, seconded by council rally [1:45:42] that council move out of the statutory public meeting at 6:44 p.m. Is there any [1:45:47] discussion? All in favor? There being none opposed, that motion's carried. [1:45:58] brings us to staff reports. The first report is the designation of 18 of an [1:46:02] 1880 hops barn at the Cardington Community Center. Manager Warren, we've [1:46:07] read your report. Do you have anything to add or highlight, sir? [1:46:11] » Through you, uh, Mr. Mr. Mayor, I will just say that the the barn has the barn [1:46:15] was a real priority of uh of the heritage advisory committee based on its [1:46:21] importance to Brighton's cultural heritage, not just the the structure [1:46:26] itself, but also the importance of the hops industry in the in the second half [1:46:31] of the 19th century. Um and uh yeah, B after we get the the word from council, [1:46:37] we will start to get some photos ready and on the municip on the municipal [1:46:41] website, you can expect to see a notice of intent to designate probably in the [1:46:46] next two weeks probably. Yep. [1:46:51] » Thank you, Mr. Warren. I have a motion moved by councelor Rowley, seconded by [1:46:55] deputy mayor Anderson that council endorse the heritage advisory committee [1:46:58] recommendation to prepare a formal notice of intent intention to designate [1:47:02] the 1880 hops barn under part four of the heritage act and that council direct [1:47:07] staff to post a notice of intention on the municipality's website for a period [1:47:11] of 30 days in accordance with the notice requirements under the Ontario Heritage [1:47:15] Act. Questions or comments from members of council? Council Rowley. [1:47:20] » Uh thank you mayor. glad to see this happen. Um, will this by uh any chance [1:47:26] once this is done, will this kind of maybe tie up any kind of activities that [1:47:30] can happen there in that barn because of the designation once it happens or um I [1:47:35] know there hasn't been a whole lot going on there yet, but uh certainly um the [1:47:39] vision is at sometimes to um host activities and events in there. Will [1:47:43] that will this um uh change any of that >> through the chair? don't think it would [1:47:49] change it in any way and I know it is certainly the intent of the advisory [1:47:52] committee that it be used. Absolutely. [1:47:57] » We've set policy around that as well already for how it can and should be [1:48:01] used or how it may be used, how it may be rented or borrowed or whatever we [1:48:06] want to however word whatever word we want to say. [1:48:09] Anything further on the motion? All in favor? There being none opposed, that [1:48:14] motion's carried. [1:48:22] » [sighs and gasps] >> Next report is with regard to a request [1:48:26] to approve revisions to a consent application B 05206 [1:48:31] B06 2026 for 400 Chatten Road. Uh planner planner Brittnull, we've read [1:48:38] this report. Do you have anything to add or highlight? [1:48:41] » Uh through your worship. Um I did just want to clarify. So, the consent [1:48:46] applications are BO6 2026 and BO7 2026. Um, and I did let um the deputy clerk [1:48:54] and municipal clerk know when I caught the error. Um, there were some very [1:48:58] tight timelines. Um, so I hope that that error in the title does not reflect how [1:49:05] much work and time has been put into this to this staff report. Um and how [1:49:09] much you know goodwill let's say between yourself, your worship and uh the [1:49:14] proponents as well as planning staff to give this file the proper consideration [1:49:22] and demonstrate the appropriate size and appropriate zoning as discussed with [1:49:28] county planning staff. So hopefully very quickly I'm I'm summarizing what I [1:49:34] what I see needs to be said. It's BO7 2026 and BO6 2026. [1:49:40] » So the motion before me, we need to change the notation of the consents to [1:49:45] read B 06 2026 and B 07 2026. Is that correct? [1:49:50] » Yes, sir. >> Thank you. That's what I'm going to [1:49:51] read. Uh, councelor Butwell, you've signed this as the mover. Are you okay [1:49:55] with that amendment? >> I am. That's why I started them on your [1:50:00] sheet. >> Very well. Thank you. I wondered where [1:50:03] those asterisks came from. Thank you for that. Councelor Wen, as a secondary, [1:50:06] you're okay with those amendments, and I can assure uh the planner that it uh [1:50:10] that minor typos do not uh do not indicate any uh uh falling down of the [1:50:15] department at either the county or the municipal level. And I want to thank our [1:50:20] staff for working together to uh help round this out for the uh for the [1:50:24] Harrington family. The mo the motion is moved by councelor [1:50:27] Butwell, seconded by councelor Wen, that council approve minor revisions to the [1:50:30] previously approved consent applications B062026 [1:50:34] and B 0720 26 that would permit an extension of depth to the two [1:50:39] residential lots to be created and that council consider the revisions to be [1:50:43] minor in nature without need for additional notice or service. Is there [1:50:47] any discussion? All in favor? Any opposed? That motion is carried. [1:51:02] Next report is with regard to community grants and aid program. Treasurer [1:51:05] Kramer, we've read your report. Do you have anything to add or highlight [1:51:09] » through your worship? Um I think I'll just take a moment and highlight a [1:51:13] couple of things if that's okay. Um so just to take everyone back I did uh [1:51:20] present the high level concept of the policy that's [1:51:24] in front of you tonight back in April. Um I think staff myself uh and Elena and [1:51:31] um everyone else who contributed received some really good feedback from [1:51:35] council and I we've incorporated all that feedback into the policy that's uh [1:51:40] in front of you tonight. Um I will say in revising the policy the goal was [1:51:44] definitely to streamline the process for applicants, staff and even council um [1:51:51] the whole process throughout but also to provide clarity on the type of [1:51:55] applications that should be supported through this program. Um so I think [1:52:01] we've achieved that um open to questions. The one thing I will point [1:52:04] out the final page of the the report is a one-page summary of for the applicants [1:52:13] that they can refer to and get the information that they need for the [1:52:17] program to kind of give them some guidance. I will say the the policy [1:52:21] morphed a little bit from as much as I think the policy does streamline and [1:52:25] make the whole overall program more uh simple, the policy isn't uh necessarily [1:52:32] a one pager. So, uh, it does try to capture all the controls and everything [1:52:36] in place that needs that council wanted to see, but I think are are also really [1:52:40] effective and and should be there for a program like this. [1:52:45] » Thank you, Mr. Treasure. I have a motion moved by councelor Butwell, seconded by [1:52:48] councelor Wen that council approve the revised grant community grants and aid [1:52:52] policy attached as attachment one repealing and replacing policy FI40 as [1:52:57] amended June 4th, 2018. with the revised policy applying commencing with the next [1:53:03] annual grant intake. Is there any discussion? Councelor Bwell. [1:53:08] » Uh thank you through Mr. Mayor to Mr. Kmer. Thank you so much for this. Um I [1:53:12] know it's been a long time coming. Um my seconder coincidentally we're next to [1:53:17] each other so we both signed it. Um we this is something that we've discussed [1:53:21] at length uh multiple years in a row and having a process that is much more clear [1:53:26] and as you said streamlined is it was definitely helpful from a practical [1:53:30] standpoint for st uh for council but also I think is a lot clearer uh and [1:53:36] transparent for those that are applying. It's it there's an there's a level of [1:53:40] understanding that they can get simply by going through this process that they [1:53:45] could not before necessarily. Thank you. Thank you, Councelor Wield. [1:53:51] » Thank you, Mayor. I I want to uh echo that and and also add that the other [1:53:56] great thing about this is that it also depoliticizes the process. Um we are [1:54:02] responsible for the overall budget and for managing the public purse. Um, but [1:54:07] when we are making decisions about local nonprofits at this table and applying [1:54:12] scrutiny to them, it it was always something that felt awkward to me and [1:54:17] I'm sure it felt even more awkward to the nonprofits that we were discussing. [1:54:22] And so I uh I think this is uh a great step forward and uh that last page that [1:54:27] you pointed out, Mr. Kamer, is excellent. It's very clear and uh even [1:54:32] welcoming. We definitely want people to want to apply for this and so having a a [1:54:37] clear and open process like this. Um, A+ very good [1:54:44] » treasurer >> through your worship. Just one more [1:54:47] thing I actually did want to point out is just the timelines um for the program [1:54:51] both this year and moving forward. Uh this year just given that it's just [1:54:56] being approved and we want to make sure there's an opportunity for everyone to [1:54:58] understand the new process. Um, and also, uh, you know, we're going to be in [1:55:02] the middle of an election. So, um, this year we'll be we're aiming to get [1:55:07] everything out on the website by September 1st. We're hope hopeful to do [1:55:11] that. Um, and we're going to be closing the applications on October 31st. Uh, [1:55:17] with November being used as evaluations, follow up, anything that needs to happen [1:55:22] at that time. uh with a presentation to council on the results of of anything [1:55:28] that we've received in December. Uh in the future though, everything would be [1:55:32] kind of moved up a month. So, we'd use September to receive applications, [1:55:35] October to review, November to present. I think this aligns well with uh the [1:55:40] preferred budget schedule um that we want to be using going forward. It'll [1:55:44] feed right into it or be a part of it, but it will be somewhat separate. I know [1:55:49] in the past it's always been like on budget day on budget presentation day. I [1:55:54] think this is a little bit now we've identified the amounts the thresholds [1:55:58] and it's a little bit of a separate process on its own but going in tandem [1:56:02] with the budget. >> Thank you Mr. Treasurer Councelor [1:56:06] Wright. >> Uh through you Mr. Mayor. Just wondering [1:56:09] will all past participants be given a heads up through email or letter mail um [1:56:15] alerting them to the new process? treasurer [1:56:19] » through your worship. Yes, that's a good idea and we'll make sure to do that. [1:56:23] » Thank you both. Councelor Rowley. >> Uh thank you, mayor. Just um wondering [1:56:28] how it will affect um uh certain applications like Proctor [1:56:33] House. Certainly don't want to see um them losing their funding over [1:56:37] something. >> Will they will they be considered into [1:56:40] this as well? If I read the report right, it would be one of the automatic [1:56:43] sort of grants under the cemeteries and heritage aspect, but I'd turn that over [1:56:48] to the treasurer to confirm [1:56:52] » uh through your worship. I'd want to get back to you. I'm not familiar with each [1:56:55] organization that went through the process last year, so I wouldn't want to [1:56:59] comment on the spot. Um, but I could follow up. [1:57:01] » Okay, that would be great. Thank you so much. Don't want to see them lose their [1:57:05] » grants indeed. And thank you both for that. Anything further? [1:57:11] All in favor? Any opposed? That motion is carried. [1:57:24] That moves us to the report with regard to 2026 tax writeoffs. Uh, Treasure [1:57:30] Kramer, we've read this report. Do you have anything to add or highlight? [1:57:34] » Through your worship. Uh, just quickly, this is typically an annual report. Um, [1:57:39] but with guidance from our our tax collector, uh, there's a couple [1:57:44] properties on here that would um, be more advantageous for us to do this now [1:57:48] instead of waiting till December uh, just given some of the billing cycles [1:57:52] and timing. Um, so you will see a midyear this year. Uh, in past there [1:57:57] probably wouldn't have been a midyear. So there will be a midyear report and [1:58:00] then if any further um, writeoffs come in, we would you would see one at year [1:58:04] end as well. >> Thank you for that. And I have a motion [1:58:07] moved by councelor Vwell, seconded by councelor mccosland. The council [1:58:10] approves the 2026 tax writeoff report and authorizes staff to adjust the tax [1:58:14] account as identified in this report. Is there any discussion? Councelor Butwell. [1:58:20] » Thank you, Mr. Mayor, and through you to Mr. Kamer. Um, for the fourth line item [1:58:25] on your report, the property damaged by fire, uh, does that does this tax write [1:58:31] off, is that tied to the the demolishing of that building or the suspension of [1:58:37] the use of the building that hasn't been demolished, [1:58:40] » treasurer? So, we've had a couple, right? [1:58:44] » Uh, through your worship, I I'd want to say it's because the structure is no [1:58:48] longer there. So, the assessment is going to be changing. [1:58:50] » Okay. So that the a property where the building is no longer there at all. All [1:58:55] right. Thank you. >> Thank you both. You're good. Okay. [1:58:58] Anyone else? >> Go ahead. [1:59:03] » Uh [clears throat] thank you. Uh it was it's kind of Mr. Mayor. Um to Director [1:59:09] Walsh, if I could just ask a quick question. We have another building in [1:59:13] town here that had a structural fire and there's it's no longer being used. Has a [1:59:18] demolition permit been issued for that property? Because it's been a good seven [1:59:24] months now. Um, and if not, do we have an order out [1:59:29] on that? >> We do have an order and the uh chief [1:59:31] building official is working with the insurance company on that. [1:59:34] » Okay. >> And I think they're very close to [1:59:36] issuing a demolition permit if they haven't already. [1:59:38] » Okay. Thank you. I just noticed that just prior to our uh I guess it would [1:59:43] have been July 1st activities, there was some debris that had fallen towards the [1:59:49] public spaces. So >> Mhm. [1:59:51] » Thank you. I'll I'll alert the CBO of the recent occurrences. Okay. Thank you. [1:59:59] » Thank you both. Anyone else? All those in favor? Any opposed? Motion's carried. [2:00:07] Our [2:00:14] next report is with regard to PW202607 Dundas Street Water Booster Station. [2:00:20] Manager Gooding, we've read your report. Do you have anything to add or [2:00:23] highlight? >> If I could, Mr. Mayor. Um, [2:00:27] [clears throat] >> Director Lennon. [2:00:29] » Yes. >> Thank you. And through you. Uh just want [2:00:32] to quickly summarize this report by saying this project was initiated in [2:00:36] 2024 and the preliminary budget numbers were derived from market values and [2:00:42] typical design criteria at that time. Uh the report does detail the factors that [2:00:47] impacted the final costs primarily being the long-term care home servicing [2:00:51] requirements. Um, council can expect that funding [2:00:55] options for the balance of the project will be included in 2027 budget. And [2:01:00] wanted to mention as well, this is a critical project for the long-term care [2:01:03] home opening, planned opening for 2027 and for future development planning. [2:01:09] That's staff are happy to answer any questions. [2:01:12] » Thank you for that. I have a motion moved by councelor Rowley, seconded by [2:01:15] deputy mayor Anderson that council award tender PW202607 [2:01:20] Dunda Street Water Booster Station to Peak Construction Group limited in the [2:01:24] amount of 2,46,1908 [2:01:28] inclusive of a 10% contingency and the expense portion of the HST. Is there any [2:01:34] discussion? Councelor Wright? Um, I think it's fair to say that, um, [2:01:41] none of us want to see any delays in this project. Um, we all want to see the [2:01:46] the long-term care facility come on board. Um, but I personally have some a [2:01:52] big question about where the remaining uh 1.27 million is going to be funded [2:01:58] from. were being asked to approve um extra funding of no small amount [2:02:07] and and I recognize that, you know, timing is is everything and and that [2:02:12] look uh the that Omni wants to come on and open at their appropriate time, but [2:02:19] I need to ask where is this money going to come from? And I I know it says in [2:02:24] the budget, but we're being asked to approve it now pre-budget without a [2:02:29] direct line to funds. And I think that question needs to be answered before we [2:02:33] can approve anything. [2:02:38] Treasurer, through your worship, councelor, right? Um it's [2:02:45] it's an awkward position to be in. Um and I and I wish I kind of had a a [2:02:50] better answer in the sense of um what what it's going to require is more [2:02:54] evaluation. Um this project is technically 95% development charge [2:02:59] eligible. Uh the challenge is is the development charge study was developed [2:03:04] um with a different cost and and it's not smaller am [2:03:10] insignificantly less amount. So what it would require us to fully fund it from [2:03:15] development charges would be an evaluation of the impact to the DC rate [2:03:19] going forward. Um it'll require us to open up the bylaw to do a public [2:03:23] consultation. And so that's what we're going to have to look at going forward [2:03:28] if the development charges is the right tool going forward uh and what that'll [2:03:32] mean, how we're going to fund it, what kind of timing. Um the there's also [2:03:38] alternatives uh using the water rates. Um, [2:03:43] and I know in conversations with uh the manager of infrastructure, uh, I know [2:03:49] some of the we've been funding a certain amount every year. And so as we look to [2:03:53] 27, I think there's going to be, uh, an eye to maybe doing a little less [2:03:58] infrastructure work in order to accommodate this project. We'll be able [2:04:02] to look at debenture financing and spreading the the cost over more years [2:04:07] than just 27. So without um the full picture of 27 of everything coming due [2:04:15] and the development charge picture not in front of me um it's hard to say [2:04:19] exactly what the solution is going to be. I'm confident that there is a [2:04:22] solution and we will get there. Um but this is in order for the project to move [2:04:28] forward uh we kind of have to approve it without um that solution in front of us [2:04:34] today. followup. [2:04:39] » Yes. Thank you um to you, Mr. Mayor. I'm I'm not sure who's to answer this [2:04:44] question. I did send some questions to um Mr. Gooding earlier today and the [2:04:51] comment back. Um I'm just trying to find it here. [2:04:58] Um, [2:05:02] given the long lead times for major equipment, an award was required to [2:05:06] allow equipment to be ordered and keep the booster station on schedule. Does [2:05:10] this mean that the award has already been given prior to [2:05:15] council approval? >> Mr. Gooding, [2:05:20] » excuse the mayor. No, no, it is not. >> Okay. [2:05:25] Okay. So there's obviously product that needs to [2:05:29] be purchased. So [2:05:33] I get that this needs to come out of the 2027 budget, but product and everything [2:05:38] needs to be purchased now. So pardon me. Oh, sorry. Um [2:05:47] I'm also wondering aside from that question, how did we get to this 2 [2:05:54] whatever? Um, it is I I get that construction cost increase and all of [2:06:01] that, but Omni would have presented a plan and [2:06:08] sprinkler requirements legislation have not changed since about 2014. [2:06:13] They knew what their building size was going to be, how many rooms were going [2:06:16] to be. I'm just wondering how did we get to the cost of a million and then plans [2:06:24] are finalized and then we've jumped to over two. That's that's a huge jump. [2:06:31] Like are they going for the, you know, all the bells and whistles possible in a [2:06:37] sprinkler system? I don't know if there's multi levels of different [2:06:41] sprinkler systems. I'm just wondering how did we get to a more than doubled [2:06:46] amount from where we started? And that's rec also recognizing that I think we [2:06:51] doubled the amount to begin with from 500,000 to a million to begin with. [2:06:57] So it's just I'm just very concerned and trying to join the dots. I [2:07:02] » think it's a good question. Who wants to field it? And and we're not paying for [2:07:06] their sprinkler system. We're just paying for a system to get the water to [2:07:09] it. >> Yeah. it but it was the contingent on [2:07:13] their final plans that it was noted that all of a sudden we needed bigger booster [2:07:17] station and all things. >> I think I think there's an answer to [2:07:20] this question director >> hopefully through you Mr. Mayor. Um so [2:07:26] originally um there was discussion with the development uh on where that booster [2:07:31] would take place on their lands or municipal lands and initially when the [2:07:36] budget was provided it was using industry standards for a standard [2:07:40] boosting station. Um it was determined that the boosting station would be [2:07:46] municipally owned on to replace existing boosting [2:07:51] vault if you will that's in the ditch line currently on Dundas Street. it [2:07:54] needed to be upgraded and um by the time we got detailed data from [2:08:00] » Could you draw the microphone closer to your mouth so we can all hear you [2:08:03] better? Thank you. >> Apologies. Um by the time we get [2:08:05] detailed information from Omni, it impacted the size of the the pump [2:08:10] required and the size of the generator to back up the the large pump for the [2:08:15] fire needs. Um so that didn't um arrive in our hands till much later in the [2:08:21] process. [2:08:27] Councelor Bwell. [2:08:30] » Uh thank you, Mr. Mayor. And then I suppose Mr. Linen, you're on you're on [2:08:35] tap right now. Um so by the time their final design came through, they then [2:08:41] presented us with a different requirement than what we had proceeded [2:08:45] on originally. So, how come um we as a municipality, the collective we [2:08:53] um need to pay over $1 million for their I don't want to say it's a mistake, but [2:09:00] the lack of information flow. Um we are, you know, we had an original amount of 1 [2:09:06] million including the property acquisition. Um I [2:09:13] calculate it. I ran think I ran the report there was a 20% uh increase in [2:09:18] the last since 2025. 20% increase in cost of materials. I found a little high [2:09:24] but okay we're we're we're rounding up 20%. That brings me to 1.2 million. [2:09:28] We're now being told we need $2.2 million um to service [2:09:34] this one player and their needs. Um uh my question I suppose and I don't know [2:09:41] Mr. Lynen if you have this information. How do we what what tools are available [2:09:47] to us as a municipality to recover those costs from the individual corporation [2:09:53] that is requiring this increase in capacity and pressure. Um I don't uh I [2:10:01] think a million dollars is a significant enough amount. Um where was the [2:10:05] breakdown in communication along the way? Um, and how how do we go about not [2:10:11] being on the hook for their either change of plans, their um [2:10:18] their in them increasing the scope or the requirements cuz the municipality [2:10:24] proceeded based on what their purses were and now their needs are in excess [2:10:30] and we have not budgeted for this and I'm not comfortable um and I appreciate [2:10:36] Mr. cream that you're saying I really don't have an answer for you. I would [2:10:39] much rather that than um than blowing smoke and say we'll figure it out down [2:10:44] the road because it's a million dollars. That's a 10% well 9% [2:10:50] tax increase for the entire municipality. [2:10:55] » Well, actually no, I know it's I I know it's it's userfunded, but the users are [2:11:00] going to be at this point the increased capacity and pressure is strictly for [2:11:05] one player. and future development [2:11:08] » and future development that's not actually there, [2:11:12] » right? That's why future development charges would come online as well to [2:11:16] help pay for it. >> So, I suppose the question I was going [2:11:19] for because there's another question in here and I might as well just ask it [2:11:22] now. Um, we had the booster station down at uh Prescll where the users wanted to [2:11:28] tie into that and they were they had a higher um usage fee. [2:11:34] Have have there been any discussions about recovering that but from the [2:11:38] people who actually require the additional servicing? [2:11:42] » So, I will turn the floor over to you in a second, Mr. Lynon, but I do want to [2:11:46] point out two things. >> Um, we're not being asked to pay $2.2 [2:11:50] million. It's 2.046. Just be clear about the number%. [2:11:55] » I get it, but it is the low bid. It's also the low bid. It's not like staff [2:11:59] are saying we need $2.2 million. The low bid is 2.0. 046 with all the [2:12:05] contingencies just I don't I don't want anyone to think that staff are doing [2:12:09] something here providing us with the lowest bid [2:12:12] » I actually think that staff is not the ones who made the air [2:12:19] » I think you guys did what you the best you could with what you had to work with [2:12:21] » don't want the municipality to get in a strange liability situation by making [2:12:25] comments about developers so go ahead >> thank you and through you Mr. Mayor [2:12:31] [clears throat] Councelor Blowwell. Yeah, you're you are correct. It's a [2:12:34] it's been a complicated process. Um originally, [2:12:39] um when we were looking at ownership of the boosting, the original budget figure [2:12:45] was based on supplying water to this the site. I'm [2:12:50] not sure that the developments requirements have changed. We just [2:12:55] didn't have the details until much later in the game. [2:13:06] Do we know how much we've collected from this developer to build the 256 bed or [2:13:11] whatever the number is long-term care facility [2:13:14] in fees and charges and development charges? Do we have an idea round [2:13:20] figures what that is? >> Um to the mayor to ask the question to [2:13:26] council. that the DC uh charge came in about around $950,000 [2:13:32] and then also through the site plan and control agreement they need to do a lot [2:13:37] of off-site improvements. Um I can't remember the exact figure on that but [2:13:42] that was the extension of the water man it was sidewalks it was urbanization of [2:13:47] Dondas and a portion of Georgina. So that uh you know [2:13:54] I'm not the best person to put a number on that. It's right in the site plan [2:13:57] agreement because then they provide security to ensure to get done. Um but [2:14:01] it was it was like another million dollars. Yeah. [2:14:05] Is is my recollection. But >> Right. And they would have they would [2:14:08] have had a building um >> the building permit fees. Yeah. At uh an [2:14:13] institutional rate. >> Yeah. [2:14:14] » Yeah. >> And before I get off this topic, do we [2:14:18] know what we'll collect from taxes on an annualized basis from a building of this [2:14:22] nature? We don't. Yeah, I should have asked you that before. Sorry. Um, okay, [2:14:29] Councilman Cosland. Okay, thank you, Councelor Bwell. [2:14:34] » Uh, thank you. And I just want to compare very briefly. It is it's not the [2:14:38] same scale, but there is a residence on the west side of Georgina. Um, it's the [2:14:44] most northerly residence on the west side, a newer home construction, and [2:14:48] they wanted to bring uh natural gas up to their property line. Um they were [2:14:53] told that by the municipality it would have to be a larger [2:14:57] pipe I guess it is um and they had to bring it all the way to the north end of [2:15:02] their property not just the south end of their property because for down the down [2:15:07] the down the track there would probably be development in that area long term. [2:15:12] So they had to pay more to accommodate [2:15:17] um what our needs were. If the Omni Center requires more [2:15:24] than what our regular offering might be, then to me, [2:15:30] especially given the timeline conflicts that might have happened or or the [2:15:35] little bit of a mess up in not mess up in timeline, but the timeline issues [2:15:40] that you experienced. Um, I really feel like they that this should not be on [2:15:48] that this amount we should look at some way to recuperate it from that [2:15:52] developer. I'll just leave it out there. [2:15:55] » So, I'm not I'm not I'm not going to disagree with you. I'm I'm a big fan of [2:15:59] growth paying for growth and development paying for their own development ways, [2:16:03] but we have a legally binding agreement with this developer [2:16:08] that does not include the concept that you've put out on the floor. So, I don't [2:16:12] know how we would go back to the developer and ask for more at this [2:16:17] stage. Maybe staff has a has a idea, but I don't. [2:16:23] » So, if I sitting on their hands, I'm going to say they don't. So, go ahead. [2:16:27] Councelor Bel. >> Um, [2:16:30] what I am hearing is that we have an agreement that we'll just provide them [2:16:34] what they need. They didn't necessarily tell us in a timely manner [2:16:39] what it was they need. I'm I'm dumbing it down. um they didn't necessarily [2:16:43] provide us with what they needed and staff then came to us at council and [2:16:48] said, you know, we need a million dollars for this when really um [2:16:53] unknowingly you should have asked for one or $2 million for it. Is that kind [2:16:58] of how I'm understanding the 2.046 billion? And again, not be staff simply [2:17:06] didn't know, right? Is that what I'm hearing has happened? [2:17:10] I think that's the long and short of it. Councelor Wielen. [2:17:16] » Thank you, Mayor. Um I I think it is important to acknowledge [2:17:21] that in so far as or even though uh Omni currently is the main beneficiary of [2:17:28] this pumping station, it is designed to provide adequate water pressure for that [2:17:34] entire part of the community as it develops. And so that's what the future [2:17:39] development charges are for and things like that. It uh growth, paying for [2:17:44] growth doesn't mean that uh the first person there pays for [2:17:48] everyone's growth. Um and so there was always going to be a [2:17:53] scenario in which we would be paying out more for something than Omni was going [2:17:58] to put up for this. That's the way that works. Um I I don't know that there's an [2:18:02] alternative to spending the money. And the question I always like to ask when [2:18:07] we are going to spend money is what's the cost of not spending this money? [2:18:13] Because there's always a cost to not spend money. There's no free lunches [2:18:16] here. I think the cost is we delay a [2:18:20] significant long-term care facility in our community that I'm not willing to [2:18:24] do, but I'd look to staff to see if there's a different cost [2:18:32] through unis. That's correct. They're they're proceeding with their [2:18:35] development and they have a target completion date and it's and to be [2:18:39] operational, it's contingent on supplying adequate water for for the [2:18:44] building and for fire. And I suspect that if we don't go down [2:18:48] this road, we would have to engage our solicitor at some point with their [2:18:52] solicitor. And I'm not willing to go down that road either because now a [2:18:55] million dollars becomes two real quick. Councelor Butwell. [2:18:59] » Um, so much like councelor Wen, when these [2:19:05] things come up, you go, how much is it and how are we going to pay for it? We [2:19:09] know how much it is. We know that we are obligated to at this point proceed [2:19:13] forward. So, without an answer on how we're going to pay for this, I don't [2:19:18] think we should be making this decision this evening. I think that I would very [2:19:22] much like to find out what the plan is to how are we going to pay for an extra [2:19:28] million dollars. Um, >> treasure [2:19:31] » 1 27 according to councelor Well, I mean, [2:19:37] right, >> Mr. treasure [2:19:40] » through your worship. Uh, one thing I will note if I look at um the projected [2:19:45] end of 2026 reserve balance for the water race itself, there is a projected [2:19:52] 2.8 uh almost 2.9 million in that reserve. Um, so it's not like there are [2:19:57] zero funds to pull from. The complication in this project is the fact [2:20:01] that it is development related and so there needs to there will have to be a [2:20:06] decision and an analysis on what the impact to the development charge would [2:20:09] be um whether or not we would ultimately recoup it um and the equity of that that [2:20:16] you know I think that's the resulting conversation that's happening here. Um [2:20:20] we through development charges we can look at area specific charges um which [2:20:26] would put in a charge for a specific area but I'm not sure that that's the [2:20:31] path that we would want to go down in this um for this type of project or for [2:20:36] this community. Every time I've seen area specific charges in other [2:20:40] communities, it's been for larger areas and specific infrastructure needed that [2:20:47] without that that area couldn't develop. Um, so there are some elements that meet [2:20:52] that criteria, but I'm not sure on the scale it would meet the criteria. Um, so [2:20:57] this is all part of what we're going to look at. I think there is a there is a [2:21:00] safety net there in in the reserve. Um, and just that wouldn't be the targeted [2:21:06] funds to pull from at this time. Um, for you know, maybe this the answer is to [2:21:12] say it's from reserves. I think um, and then we could do further analysis. I [2:21:17] mean, the funds are there, but not knowing the longer term impact that [2:21:21] has on next year's capital the year after. It's it's just not a [2:21:25] recommendation. So, we're kind of stuck in a place where we need to uh we need [2:21:30] this development. We need the approval to move forward on the development. Um [2:21:34] but there's some balls up in the air on the finance side. I wouldn't say that [2:21:38] there's no answer, but there it's just the answer is not in front of us. But we [2:21:44] have the money in the bank so we could use the reserves if we needed to at the [2:21:48] end of it all. But the recommendation or the information in the report suggests [2:21:53] we we deal with this through the 2027 budget because there may be other [2:21:57] mechanisms beyond the reserves that we can use and not drain our reserves. So [2:22:01] if we were to provide direction to drain the reserves, that would be it. There [2:22:04] would be no then further direction to staff to take other another look at [2:22:09] development charges. I suspect staff would do so anyway because you're smart [2:22:12] people and and you want to make keep the municipality whole. I get all of that. [2:22:17] But what I don't want to do is have this council provide direction on where the [2:22:21] money comes from knowing that there's options, potential options available [2:22:27] that won't drain those reserves. The good news I'm hearing is that it won't [2:22:31] affect the rates and it won't affect those who are on the system. This will [2:22:35] be this will be coming from either reserves andor reserves and development [2:22:39] charges from a future development charges study. [2:22:44] » Dear worship um short answer yes uh that that's correct [2:22:50] in terms of uh you know I think the the target will be development charges [2:22:54] because this is very much a development related project. Um but anytime any [2:22:58] project goes grows in scale and then we have to pull from reserves that prevents [2:23:02] us from funding another project. So I I don't want to say it doesn't impact [2:23:05] rates at all. Um because ultimately it's coming from the same pot. [2:23:10] » Understood. Councelor Ray [2:23:16] my these items these products that need to [2:23:20] be ordered um because we don't want it to delay into the future and have the [2:23:23] cost go all the more up yada yada yada. Those things need to be paid for now. [2:23:30] So, like, am I understanding that correctly? [2:23:34] Like, do we have like a 30-day, 90day, 120day leeway for the bill to come in [2:23:38] and and pay up? Because I'm not I'm not hearing that. And [2:23:46] pushing this off to the 27 budget and telling whoever we're ordering these [2:23:49] from, well, you'll have to wait for our budget. That might not fly for them [2:23:53] either. So, >> I I don't I don't think we'd wait to [2:23:57] order it. It would be how we finance it would come from the 2027 budget. So, [2:24:01] » so we wouldn't order until the 2027 budget. [2:24:03] » I think we would order immediately and then deal with the funding issue in the [2:24:08] 2027 budget. So, we we would we we would borrow from reserves, if you will. I'm [2:24:13] going to turn this over to staff to confirm all of this. But my [2:24:16] understanding is we if the stuff is needed now, we're going to get it now. [2:24:20] We'll deal with the financing issue through the 2027 budget, but Mr. Gooding [2:24:24] is about to jump out of his seat if I don't turn the floor over to him. [2:24:28] um through the mayor is we don't pay for the material till it's delivered on [2:24:31] site. So I anticipate uh in 2026 we'll see the building show up. Um but the [2:24:36] internal components, the backup generator, all that uh it'll end up [2:24:39] being deferred to 2027 before we actually uh receive it and have to pay [2:24:43] for it. >> When does when does the when does Omni [2:24:48] plan on coming online? >> Is it next year? [2:24:51] » Yeah, mid year. Yeah. Councelor Rally. [2:24:57] » Uh, thank you, Mayor. Um, so just looking, we approved a million bucks [2:25:03] last year. We've spent only 25% of that. So, I'm guessing some of that will be [2:25:08] spent whether we order parts or build the building anyway, right? So, there is [2:25:13] money there already to be spent, money that we haven't spent yet. Correct. So, [2:25:17] we can move along. just basically waiting for how to uh then provide the [2:25:24] other 1 million next year for the mechanics of the of the plant. That's [2:25:30] what we're looking at, right? Just just to be clear. Thank you. [2:25:35] » Thank you both. Councelor Bellwell. >> Uh through you, Mr. Mayor, to I guess [2:25:41] Mr. Gooding, because you seem super keen on this one. Um has the equipment been [2:25:46] ordered already? >> No. No, it has not. [2:25:49] » Okay. And the um what is the name of sorry my rolly thing is not [2:25:56] peak construction have they begun any any prep work anything? [2:26:03] » We've had plenary discussions with them and asked is just get an understanding [2:26:07] of of their approach to this project. They're going to be supplying various uh [2:26:10] different models or whatnot that that has available to them. We asked them if [2:26:14] initially we've asked them if there's any savings we can get and I mean one [2:26:17] thing they've identified is $80,000 is going from a natural gas generator to a [2:26:21] diesel generator. It's just it's difficult to get too far into the weeds [2:26:25] for them is and unless we have a formal contract signed. [2:26:28] » Um and a follow up if I might. What are the payment terms with peak or what what [2:26:33] are the general payment terms standard payment terms? Are is it a st a stared a [2:26:38] staged payment schedule? Typically, it's monthly and as it's as it's delivered [2:26:42] and then there's a hold back period for for payment, [2:26:46] » would they be willing to work with the municipality on figuring out how this is [2:26:52] going to be paid knowing that we are good for our bills? [2:26:58] » I I have asked them is is if identifying what we can push to 2027 in order to [2:27:03] improve cash flows. Um, unfortunately the building needs to be put in this [2:27:06] year so that we can work in it through the winter in order to hit that June [2:27:10] deadline. So there'll be preliminary site works [2:27:14] the building um perhaps the some of the plumbing underground works um and such [2:27:18] that'll have to be done in 26 uh but I don't believe it'll exceed that initial [2:27:23] $780,000 that we have right now approved. [2:27:27] council rate. >> Has Omni been approached at all in [2:27:32] goodwill um that they would help cover some of this cost [2:27:38] if not all cost? >> There's a bunch of shaking of heads. [2:27:44] » Thank you, Mr. Mayor. Uh no, nothing no formal discussions have taken place uh [2:27:48] with Omni at this time. [2:27:53] » What What are the What are the options there? I'm looking at Director Walsh. [2:28:00] uh through the mayor council. Um I think you've said it accurately [2:28:06] earlier that we have that site plan agreement. It has the costing in it. The [2:28:10] site plan agreement does say that we will install an upgraded water booster [2:28:14] station uh because it had to be replaced anyway. It was failing. It fails [2:28:20] multiple times a year commonly. Um and uh so I I I don't think there's a lot of [2:28:28] options going forward as I think you've described earlier. We can we can talk to [2:28:33] Omni and see uh what they're willing to do but to our experience to date they're [2:28:39] getting pretty tight with their budget. Um I think manage of infrastructure has [2:28:44] related that uh even little things happening on site um there's multiple [2:28:49] staff with major push backs. though they are very very costconc conscious uh [2:28:55] corporation. Um so I think we are we are um lucky to have benefited from the [2:29:02] offsite works that they have committed to uh to get their approval. U but now [2:29:07] that they've got their approval it's they're [snorts] watching every every [2:29:10] dime literally. Um just a side note uh not in relation to the question um [2:29:17] very quick calculation on the water utilities that they will be giving from [2:29:22] a 256 bed uh long-term care home with a 3,000 square ft commercial kitchen and a [2:29:29] corresponding laundromat. It is about 300,000 in water utilities over about 10 [2:29:35] years not adjusted for inflation. >> Thank you for that. Yeah. Councelor [2:29:40] Bellwell. [2:29:44] » Um through you um director Walsh um much as they are cost conscious [2:29:51] and careful with how they spend their money. So should we be cost conscious [2:29:56] and be careful about how we spend our taxpayers money? Um, [2:30:01] » this is not >> No, rec I know rec he cut in recognizing [2:30:07] that is user pay. Um, I'm We've over doubled the amount that this [2:30:16] council has approved and I think that we definitely need to be very careful about [2:30:23] how we turn around and pay for this um because we're paying for this upfront um [2:30:29] and without a clear path on how this is going to be paid. And I appreciate uh to [2:30:35] Mr. that Mr. Kramer is saying, you know, there's there's options available, but [2:30:41] you're not willing to make a recommendation. Um, you and I are both [2:30:45] financially a little bit cautious. I think um I I am not comfortable um [2:30:52] making this decision at this point um to be in favor of this. Not that I don't [2:30:57] want this facility to be up and servicing the people of our area. Um [2:31:02] it's going to happen anyways. I just think we need to have a better [2:31:04] understanding of where this money is coming from. [2:31:08] » I understand that. But delaying this delaying this will delay it till the [2:31:13] next council because we're going to lame duck at two o'clock tomorrow [2:31:17] [gasps and sighs] which means we delay the entire project [2:31:20] until December or we delay the the letting of a contract till December [2:31:25] which means we delay the opening of a long-term care facility until whenever [2:31:30] that happens to be when Omni gets back on site because they're going to have to [2:31:33] move their their entire group somewhere knowing that they can't open this [2:31:38] facility. in June and I'm not willing to hold the project up knowing that we have [2:31:44] the money in the bank if that's where it needs to come from and knowing that the [2:31:48] team has a plan to look at development charges for potential [gasps] [2:31:53] um for potential recuperation of the money. So I I I think we need to make [2:31:56] this decision and if you're not in favor of it, so be it. But I think one way or [2:32:01] the other we need to make this decision. Councelor Rowley, [2:32:04] » thank you. um a point that you brought up um director Walsh that we would have [2:32:09] been making improvements to this um pumping station anyway correct as far as [2:32:14] we would have already been investing some of our own money regardless of [2:32:17] whether omni was going up there council councelor uh yes we would be needing to [2:32:23] make that correction the water services folks indicated that it was failing on a [2:32:26] regular basis and um so and it's on uh it's on Dundas Street which is a [2:32:33] collector road. Regina is a collector road. Uh Omni's made improvements that [2:32:38] technically uh should have come out of DC's but it was developer paid for. So [2:32:43] there is in in my brain uh if you if you look at the development charges act and [2:32:48] whatnot that they've paid an extra already for those improvements when the [2:32:54] taxpayer should have been contributing to that. [2:32:56] » Thank you. >> The user the user should have been [2:33:01] contributing to that. Thank you councelor. Right. [2:33:04] » Um I'm sorry to go back to this again and I get that we have an agreement, [2:33:11] but if the design because we already had a plan in place for the upgrades that [2:33:16] were going to cost a million. It seems to me by the way the report is [2:33:22] worded that it was the most recent report of the water demand that Omni was [2:33:29] going to be needing which seemed like an upgrade from the original [2:33:36] plan of what was needed that that is what has triggered this like massive [2:33:42] upgrade to the booster station. Um, if it was a scope change, is the is [2:33:51] OMI then not responsible to cover the scope change? [2:33:59] » It's not a scope change to their development. It's a scope change to our [2:34:02] project. >> But was it not an increase in demand on [2:34:06] the water infrastructure from them? Like like that's the way it read to me in in [2:34:11] the report. Maybe I' I've read it. >> Director [2:34:15] through you, Mr. Mayor. Um, no, I think the [2:34:20] if Omni had provided the water boosting requirement for their building, then we [2:34:25] would have supplied water to the property. But because we're supplying [2:34:29] the boosting station, by the time we got the details on what they needed cuz we [2:34:34] wouldn't have needed that information from them had they provided the [2:34:37] boosting. Um, so by the time we received that information, it was late in the [2:34:41] game and that's why we're here having this conversation. But it doesn't change [2:34:45] the scope or the amount of water required. It's just who is [2:34:51] being responsible for the boosting of that water. [2:34:57] » Any further discussion? Councelor Butwell. [2:35:00] » Uh, thank you, Mr. Mayor. And just a quick question to any and all um manager [2:35:07] staff. I'm thinking it's much more likely a [2:35:10] planning issue. So Mr. Walsh um has Omni approached Brighton about an additional [2:35:16] location and for a second building. [2:35:19] » I don't think we should discuss someone's private property matters in [2:35:22] open session. [2:35:27] » I I think we best be careful with that. >> Yeah. [2:35:34] But perhaps you could answer that question to council Bwell after the [2:35:36] meeting or by email. Thank you, Council W. Thank you, Mayor. Uh, so what I'm [2:35:42] hearing is that we were going to have to replace the booster station anyway. We [2:35:49] need to make it bigger because of the amount of demand that's there. Because [2:35:54] if nobody was building there, we would have just rebuilt the same one. Um, but [2:35:58] since there's going to be more people there, we need a bigger one. [2:36:01] um that was always going to be the case. Um [2:36:06] through a matter of timing or anything else, an error was made regarding the [2:36:11] cost that was going to acrue on this. We have the money to pay for it anyway. [2:36:18] Um, and there will be future options for making that payment process easier [2:36:26] uh that we can address in the next budget or the next council will address [2:36:29] in the next budget. So, what I'm hearing is that we need it. We were going to do [2:36:35] it anyway. It needs to happen. If if we for some reason delay in doing it, it's [2:36:41] going to cost more and it's okay because we can pay for it. So I'm in. [2:36:49] Sounded like you answered your own question. Councelor Wa. Yeah. Anything [2:36:52] further on the motion. I'll call the vote. All those in favor, [2:36:59] please. >> Madame clerk, council rally has [2:37:02] requested a recorded vote. [2:37:12] Councelor Emily Valley. [2:37:17] Councelor Jeff Wen. >> Yes. [2:37:21] » Councelor Bobby Wright. >> No. [2:37:27] » Deputy Mayor Ron Anderson. >> Yes. [2:37:31] » Councelor Anne Butwell. >> No. [2:37:36] » Councelor Hannah Mccclausland. >> Yes. [2:37:40] » Mayor Brian Ostrander. >> Yes. [2:37:43] And that's carried. [2:37:54] Thank you everyone. That brings us to uh report PW202617 [2:38:00] drinking water quality management system representative agreement. Director [2:38:04] Linen, we've read your report. Do you have anything to add or highlight? [2:38:07] » Yes, just quickly, Mr. Mayor. This is essentially a renewal of a agreement um [2:38:13] for drinking water quality management services. [2:38:18] » Thank you. >> Thank you for that. I have a motion [2:38:19] moved by councelor Butwell, seconded by councelor Wen that council received the [2:38:22] staff report regarding the requirement for a drinking water quality management [2:38:26] system representative and that council authorized the mayor and the clerk to [2:38:30] enter into a multi-year agreement with Patricia Scopalanos. [2:38:34] Is that about right? Patricia, I'm sorry. for the purpose of providing [2:38:38] drinking water quality management system representative services. Is there any [2:38:42] discussion? All in favor? Any opposed? That motion is carried. [2:38:53] Next report is with regard to amendment to the procedural bylaw 051 2024 [2:38:58] respecting religious observances at council and committee meetings. Madame [2:39:01] clerk, we've read your report. Do you have anything to add or highlight? [2:39:05] » Thank you, mayor. No, not at this time. [2:39:10] » Thank you. I have a motion moved by councelor McClin, seconded by councelor [2:39:13] Butwell, that council receive this report for information and that council [2:39:16] approve an amendment to procedural bylaw 051 2024 to add a new section entitled [2:39:22] religious observances as follows. Religious observances. No prayer, [2:39:26] religious invocation, religious reading or other religious observance shall be [2:39:30] included as part of the proceedings of any council committee of the whole [2:39:34] advisory committee, local board, special counsel, regular council, or inaugural [2:39:38] council meeting. Is there any discussion? Council Bwell. [2:39:43] » Um, thank you, Mr. Mayor, and through you to the clerk. Um, Madame Clerk, uh, [2:39:48] does this include references to, um, um, like meeting council meetings [2:39:54] specifically? You tend to end the meeting with God Save the King. Um, does [2:40:00] that include that as a reference? [2:40:06] » That isn't in the procedural bylaw. Um, but I would think that it would probably [2:40:12] include that. Well, then we're going to get a legal [2:40:15] opinion on that one. >> Okay. [2:40:17] » Because I don't believe saying God saved the king is a prayer. It is part of our [2:40:22] one of our national anthems for goodness sakes. So, I think uh I think it's [2:40:27] probably fine. But if uh if a legal opinion is required, it will. This came [2:40:30] out of a a lawyer's letter I received. someone in our community um objected to [2:40:36] the fact that I uh in the past all councils in the past have um asked for a [2:40:42] a local clergy person to be present at inaugural meetings to offer a blessing [2:40:46] on the new council. I continued uh that tradition in the last two terms and uh I [2:40:53] received a lawyer's letter saying that um the 2015 Supreme Court ruling uh [2:40:58] prevents that from happening. So, we have uh did done a little research. It [2:41:02] seems that that is correct. So, we're just adding I think we've added [2:41:05] inaugural council meetings to this to ensure that no future mayor does [2:41:09] anything silly like pray at a council meeting. [2:41:16] Is there anything further for members of council? [2:41:19] » I'm going to shut up. [2:41:23] » Do you have something to say? All in favor? Any opposed? That motion's [2:41:29] carried. [2:41:35] » Moving on to the CA ongoing report and capital projects update. CEO, do you [2:41:39] have anything to add or highlight? >> Uh through you, Mr. Mayor. Just one [2:41:41] thing. There's an item here uh with regard to the parking bylaw update. Um I [2:41:45] just want to recognize that staff did pull that together uh to try to get it [2:41:49] on this agenda as it does indicate August 20 2026. Normally I don't require [2:41:54] a lot of time to review reports but that one is quite substantial and I asked for [2:41:57] additional time so that's why it's not on your agenda but you will see that [2:42:00] draft uh bylaw in September. >> Thank you for that motion moved by [2:42:05] councelor Rally seconded by deputy mayor Anderson that council receive the CA [2:42:08] ongoing report and capital projects update discussion for members of council [2:42:12] councelor butwell. >> Thank you Mr. Mayor and through you to [2:42:16] director Linen. How goes the tennis club? Says summer 2026. I'm looking for [2:42:21] an update. >> I should have known that was coming. [2:42:24] Council council and >> thank you and through you. [2:42:29] [clears throat] Yes, there's good news. There's progress. We met with the uh [2:42:33] tennis club again. Uh they asked for some minor changes to the agreement that [2:42:38] we've had drafted in their hands for a while. Had a verbal that they're willing [2:42:43] to sign it. They just haven't given us a copy with a signature on it yet. [2:42:52] Thank you. Anything further from members of council? [2:42:58] All those in favor of the motion? Any opposed? Motion is carried. [2:43:08] That brings us to bylaws. The first is a amendment to the procedural bylaw. It's [2:43:13] moved by councelor Wright, seconded by councelor Rally. The council gives a [2:43:16] bylaw its first, second, and third reading and finally passes on this date [2:43:20] being a bylaw to amend procedural bylaw number 051 2024 [2:43:24] respecting opening ceremonies at council and committee meetings. Is there any [2:43:28] discussion? All in favor? Any opposed? That motion's carried. [2:43:34] The next is with regard to a joint municipal election compliance audit [2:43:38] committee. It's moved by councelor Rowley, seconded by councelor Wright. [2:43:41] The council gives a bylaws first, second, and third read reading, pardon [2:43:44] me. and finally passes on this date being a bail to appoint members of the [2:43:48] joint to the joint municipal election compliance audit committee for the 2026 [2:43:53] election. Is there any discussion? Councilor Rowley, [2:43:56] » I'm not certainly familiar with all of these names. Do we know if any of these [2:44:00] are Brighton residents? Just asking. >> Madam clerk, [2:44:05] » I'm not 100% sure. I can take a look and get back to you about that. [2:44:11] » Thank you both. And anything further on the motion? All in favor? [2:44:15] Being none opposed, that motion's carried. [2:44:19] Next is with regard to the tender PW202607 [2:44:22] Dundas Dundas Street water booster station. Moved by councelor McCoslin, [2:44:27] seconded by councelor Wielden that council gives a bylaws first, second, [2:44:30] and third reading and finally passes on this date. Being a bylaw, authorized the [2:44:34] mayor and the clerk to execute an agreement between the corporation of the [2:44:36] municipality of Brighton and Peak Construction Limited for tender PW20267 [2:44:43] Dundas Street Water Booster Station. We have no reports or minutes of statutory committees, boards or external [2:47:06] agencies. We have nothing listed under correspondence, direction items, [2:47:09] endorsements, comm communications or petitions. We have one item I think [2:47:14] under FYI correspondence. It's a letter from the Ministry of Citizenship and [2:47:19] Multiculturalism. It's moved by councelor Butwell, seconded by councelor [2:47:23] Wielden that council receive for information the letter from the Ministry [2:47:26] of Citizenship and Multiculturalism dated August 6 regarding the deadline [2:47:30] for designating non-desated heritage properties on municipal heritage [2:47:34] registers. Is there any discussion? Councelor Wright. [2:47:37] » Um yes, thank you, Mr. Mayor. I was hoping that um I think it's Mr. Walsh [2:47:44] that would should comment on this maybe. Um, and it's not a it's not a comment on [2:47:50] the Heritage Committee's ability or inability to get stuff done, but I'm [2:47:55] just commenting more on the extended deadline of this to get houses [2:48:01] designated. How many have we actually managed to designate in the time frame [2:48:06] that we were given? director. [2:48:11] My call uh to the mayor to councelor right my call on the assistance of uh [2:48:16] manager uh Ron Warren but my recollection is that we've had um [2:48:23] one attempt but the land owner then objected and we didn't follow through on [2:48:27] it and we have the hops barn um and that's about it. Um [2:48:35] if that's my recollection is accurate. >> True the chair that is also my [2:48:38] recollection. >> Mhm. Yeah. So the the deadline is uh I [2:48:43] believe uh end of January 27 >> and the heritage advisory committee is [2:48:48] aware of this and doing what they can to move it forward. Correct. [2:48:56] » To the mayor council. Yes. And it's been helpful to have a change of policy that [2:49:01] we can initiate the designation process uh by having the committee direct uh [2:49:06] contact the landowner directly uh before commencing all the work. [2:49:11] » Yeah. >> Thank you for that. Anything further for [2:49:14] members of council? All in favor? Being none opposed? That motion's carried. [2:49:23] Brings us to question period. Is there anyone in the gallery that has a [2:49:26] question that would with anything that appeared on tonight's agenda? Mr. Smith [2:49:39] introduce yourself, David. >> I'll get you to introduce yourself. [2:49:42] » Oh, I'm sorry. Uh David Smith, 40 Forest Drive, Brighton. At the early part of [2:49:48] the meeting, uh, Councelor Wen spoke to the, uh, land banking, uh, project [2:49:56] and, uh, the open house that was held and, uh, I have I have a question and [2:50:04] I'm not sure how to get how how to ask it really or or who to ask, but here [2:50:10] here I go. Um, councelor Wen, you uh recently published a blog posting. Uh, [2:50:19] » I'm I'm going to get you to stop. If you have a question about councelor Wen's [2:50:22] blogs, I would suggest you reach out about council Wooden's blog. I have a [2:50:26] question about council's position and as to whether or not council's position and [2:50:33] view and vision on this landmaking exercise is [2:50:38] consistent with councelor Wen's blog. [2:50:44] » Okay, I can't answer that question. I honestly haven't read the recent blog. [2:50:48] So, I'll have to go and look at that and formulate [2:50:51] » as a counselor. Can councelor Wielen, who spoke in such [2:50:57] glowing terms about the meeting that was held the other day or the open house [2:51:00] that was held, can councelor Wen speak to his understanding as to whether or [2:51:06] not his blog post is consistent with the town's vision, council's vision for [2:51:17] this project? I'm >> I'm sure he can in a private discussion [2:51:20] with you at some point, but I won't allow it at this meeting. No. [2:51:24] He spoke to the matter as a counselor. >> You and he can have a conversation about [2:51:29] this. This this item was not on the agenda. [2:51:32] » Well, it is on the agenda. He put it on the agenda. [2:51:34] » No, he didn't. He he offered an announcement about a land banking [2:51:38] openhouse. That was not on the agenda, sir. So, you and he can have a private [2:51:42] conversation about whether councelor Wen feels he's okay. If you if you object to [2:51:47] something councelor Wielen has done or think he's out of bounds, you may file a [2:51:52] a complaint with the integrity commissioner and and that's how that [2:51:55] would be. Uh >> I understand why you'd want to close [2:51:58] this down. >> I know, but I am so thank you for that. [2:52:08] » That brings us to our confirmatory bylaws. Moved by councelor Rowley, [2:52:11] seconded by Deputy Mayor Anderson. that council G. Sorry, I should ask.
