[2:08] 810. We'll go ahead and call the meeting to order. [2:12] I pledge allegiance to the flag of the United States of America and to the [2:17] republic for which it stands, one nation under God, indivisible, with liberty and [2:23] justice for all. Father, we come to you again to do the business of the people [2:27] of Brown County. Father, give us a measure of your wisdom so that we can [2:31] make good decisions that benefit the most people possible. Bring you over the [2:36] in Jesus name. Amen. Uh good morning everybody. Welcome to [2:41] the meeting. Um we'll go ahead and start with county [2:45] personnel or public comment. Is there any like to come up? Come on up. [2:50] » I'm gonna turn my >> Sure. Um Ian Sheets resident. Uh a few [2:55] weeks ago I approached you guys about a um request to provide the assessment by [3:04] evaluation by property class to all the different taxing entities uh in the in [3:09] the county so that the different taxing entities can make more informed [3:13] decisions about their mil levies and so forth. Um this I know from personal [3:18] experience I'm not I'm coming as a resident not as beha on behalf of the [3:21] school board but as a member of the school board this is something that has [3:25] been requested from the appraisers's office uh for multiple years it's been [3:29] provided with for a fee. Um in my opinion it is something that in the name [3:36] of transparency and being informed as a voting member of a taxing entity uh and [3:43] being accountable to the public. I think it would be great if the county just set [3:47] a precedent that this is provided to the various taxing entities because all of [3:51] the valuation comes through obviously the Brown County Appraisers office. Um [3:55] after I last spoke with you, we discussed it in the meeting. Uh Levi [4:00] Thompson, the board clerk, had then um reached out to Markham's office and he [4:05] wanted $50 in order to do this. Now, obviously the school can afford to pay [4:11] $50 as I would think any taxing entity would do it. However, um I think that it [4:17] is first of all something that if it's only $50, I'm assuming it's probably [4:21] about an hour hours work for in our case the template should be built and for all [4:26] of these entities once the templates built it's just a matter of printing it [4:30] with the updated information. Um, what I would ask is while we're willing to do [4:35] it, if it's that's what it takes, that the county commission set a precedent [4:39] that this is just something that is provided to the city of Horton, city of [4:43] Haywa, the two school districts, the cemetery districts, whoever they are, [4:47] whoever is responsible for setting mill levies um so that those organizations, [4:53] those bodies can make the most informed decisions about the impact that it's [4:57] going to have on the taxpayer. So, uh, I wasn't planning on coming this morning, [5:01] but I looked at the calendar. We're having a budget meeting next Monday, and [5:05] I thought in order to give time, uh, to put the wheels in motion, uh, to get [5:10] that printed out, I thought I would just stop up here. So, so I'm a little more [5:14] cash than I would normally be, but anyway, that's the uh, that is the long [5:18] and the short of it. So, I would ask for your consideration. [5:20] » So, you're talking about the Excel spreadsheet that has the percent change. [5:24] » Uh, yes. Yes. Yes. >> By by property class. So there's the [5:29] residential, there's the A, there's the commercial, etc. You showed me the [5:33] county's version of that last time uh and and said this is something that you [5:38] guys always have. Um obviously the >> the uh the scope of it is slightly [5:44] different between the different organizations. So the USD415 has a [5:48] different um taxing body. Yeah. Then then does this then does USD430 for [5:55] example versus the city of Iwa. So these would be bespoke to the different [6:01] districts. >> So they're going to be customized to [6:04] » correct. >> Correct. In order to be relevant. Yeah. [6:07] » Customized >> or the most precise I guess. [6:10] » But like you're saying once the template's built then it's just imported [6:13] each time >> I would think. So yeah, let's call [6:16] » Y. So for example, like the county is very similar to the school district and [6:20] it's got a good portion of residential, it's got a good portion of a it's got [6:23] all the commercial. Uh the city of Haywapa would be very different because [6:27] there's not agricultural property, right? And so the the well [6:31] » there could be there could be a a little bit but not within the not within the [6:36] city is going to be mostly residential and and commercial property. So the [6:40] balance and how that affects what that net increase or decrease or so forth is [6:44] is going to be different. And that's why it's important to have ones that are [6:48] actually precisely designed to match what that um taxing constituency I'm [6:54] failing to get the word if that makes sense. [6:56] » Taxing body. >> Yeah. Yeah. [6:58] » School cities and that's need to go. Well, I think that there's I would say [7:03] anybody who sets a mill levy. Yeah. >> Uh and the only other one I can think of [7:07] is this the townships. >> Um and then there's cemetery board, [7:14] » but that doesn't mean everybody's going to request it. [7:16] » No. No. >> They haven't been. So, [7:18] » no. Now, I would say that that you know, you if you started with the big ones, [7:22] granted because we've requested it. I don't think the city of high office has [7:26] ever requested one. I don't have no idea about South Carolina. Um, if you started [7:31] there, I mean, we're going to request it today regardless of whether there's a [7:34] $50 fee or not, but uh, once those templates are built, you could continue [7:39] to add to the smaller and smaller ones like the as time would allow. I would I [7:44] would like to think that over the course between this year's budget season and [7:48] next year's budget season, probably all of those could be created, but if you [7:52] got the major the major taxing bodies, that would probably be a great start. So [7:58] this is that that's it. Um uh I think from from our end as far as the group [8:03] that I'm associated with, they'll make the request regardless. Um but it's just [8:07] I think would be good government in order to provide this to to the [8:11] different groups as just a matter of precedent. Okay. [8:15] » All right. Thank you very much, guys. Thanks. Ian [8:20] public or county personnel comment? >> Yes. [8:22] » All right. Come on. I was at the shop this morning and uh [8:30] the road superintendent stopped by. Uh Vicki, do you recall the question? [8:36] Vicki, the conversation we had about action had to have had his test done by [8:41] a certain date and you told me that it couldn't be done [8:45] that way because it wasn't writing. the phone. [8:52] » So Jerry gave me a referral for that. He wrote me up and he also wrote me up for [8:58] calling that call. We got to go into session. [9:03] » Good. So how much time you need? >> Five. [9:07] » Five. >> Sure. Okay. [9:09] » Okay. I'll make a motion we go in executive session with the commissioners [9:13] John Salen Road forman John Sen and county clerk to discuss non-elected [9:18] personnel and duties performance. >> Yeah. Five minutes. [9:23] » Is there a second? >> I'll second it. [9:24] » Move and [clears throat] seconded. All in favor say I. [9:26] » I. >> I. Okay. Motion carried. 5 minutes. [14:49] Okay, we're [clears throat] out of executive session. Back into regular. No [14:53] binding action taken. However, I will call for an executive session with the [14:56] same people for the same reason for five more minutes. Is there a second? I'll [15:00] second. Okay, move and seconded. All in favor say I. I. I. Okay. Motion carried. [15:05] Five more minutes. 8:29. [20:25] All [20:28] right. Okay. >> All right. We're back in regular session [20:32] out of executive. No binding action taken. [20:35] » All right. Thank you for coming in. >> Okay. [20:41] Back on schedule. The only thing we had on here was minutes. Uh things change. [20:45] Um let's just look at item number one just for sake of completion. And it's [20:50] the minutes from July 31st meeting. Are there additions, corrections, or [20:55] comments to the minutes as presented? [21:04] » I didn't have any questions. [21:08] » I don't either. Bill, did you have anything? [21:10] » Yeah, we talked about that too at the country club [21:16] around here something 30 about 30 foot tube or something in it. [21:20] » Oh, it should Yeah, should be two 24 by 30. So, so I went down the this Can I [21:25] get off this a little bit? What about the country code or what you want to [21:28] say? What the minutes? >> Um, is it the minutes? You see a problem [21:33] there, >> right? That's the only thing I saw on [21:35] the minutes. >> Yeah, let's go ahead and [21:38] » Okay. >> It should be uh two 24 by 30s because [21:43] it's a 60 foot. [21:49] » Does that say anything else you saw in the minutes? [21:52] » Okay. So, if there's no other corrections or comments, is there a [21:55] motion to approve the minutes as amended? [22:00] I'll move we or approve the minutes as amended. Is there a second? [22:05] » Second. >> Okay, it's been moved and seconded. Any [22:07] discussion? Not. All in favor say I. >> I. I. [22:10] » Okay. Motion carry amends are approved. Yeah. [22:12] » So, I was just drove down by the country club and [clears throat] [22:18] I'm not sure no matter what size of the tube you put in there and else you do [22:22] something. I mean, looks like a rock just runs down the driveway and dumps [22:26] right in in front of a tube. So, it's always going to do that. And whether [22:30] it's an 18 inch tube or a 20, eventually it's going to fill back up in there and [22:36] say do something else >> possibly, Bill. But, um, Tammy called [22:39] the ACS office to have them look at the the [22:43] drainage. And so by going with the 24 inch tube, it's going to drain better [22:47] than it ever has. >> Before if that makes sense. The tube [22:50] there is undersized. >> Okay. But it goes downhill and it [22:55] flattens out >> along the road. It's all flat. So [22:58] » are you talking about the water that comes out of the country club? [23:00] » Yeah. >> Towards the ditch, towards the county [23:02] ditch >> and comes in on the south side. [23:05] [clears throat] >> Yeah. [23:06] » They went on it. >> Correct. So it come down and then then [23:08] it uses the tube to head >> right north. [23:11] » So it's coming down at a fast speed and all that stuff down there, but then it's [23:15] flat going along the road. So there's no speed in the water going along there to [23:19] force it on through. >> So the proper way to do that would be to [23:23] on we can't tell them what to do, but I also know that the the person out there [23:27] doing their maintenance is willing to come up with some ideas and that's what [23:30] they've been doing. So because of that, the proper thing to do would be create a [23:34] soil on the driveway that would cause the water to go to the north side of the [23:38] tube and not go through the tube without any kind of a speed. Basically you're [23:42] saying, >> right? [23:43] » And and if that tube is truly level, yes, [23:47] » if it's if it's got grade to it, it will, but they're looking at that. [23:51] » Okay. >> Yeah. [23:51] » So So there's there's multiple problems out there, [23:54] » right? >> But but number one, the existing tube is [23:57] is und sized for the number of acres it drains. [24:00] » Okay. So anyway, >> I I understand what you're saying. [24:03] » Okay. Just so >> the idea, and I appreciate you doing [24:07] that, the idea is on these is not to just replace stuff, but to actually look [24:10] at what causes the problem and see if we can come up with a solution so our guys [24:15] don't always have to go out there and try to keep tubes unplugged, then right [24:20] be better. >> In my opinion, if it's doesn't don't [24:23] change upstream, it's going to just keep doing that. [24:25] » Right. I understand. But I didn't really I just happened to drive out there and I [24:30] thought well I look at it while I'm going by and I didn't question what the [24:36] plan was. >> You can do that. [24:39] Nobody's going to question you. >> I appreciate that you do do that though. [24:44] I know. >> So [24:46] » that's just my input to >> Right. [24:49] » Are you in contact with people out there? [24:51] » I will be. I we talked about this at Friday's meeting. Okay. Right. [24:56] » And so I haven't contacted them over the weekend. I didn't think it needed to be [25:01] Saturday or something. So I will contact them this week. [25:04] » Yeah. >> I thought probably hadn't. So I can put [25:08] my two cents in. >> We appreciate. [25:12] » Hi. >> The fans brothers just calling me. He [25:16] wanted to know if we could store 160 cubic yards of ple [25:23] at our district one location or I want the location for their project [25:30] that they have here in my book. >> Are they are they the ones doing the [25:34] chip and seal for the city on Oregon Street? [25:37] » Yes. >> Okay. So, this is good because you have [25:42] John here that that would affect most >> and that's why I asked you. Okay. [25:47] » He Adam said it would be about five truck. [25:55] Yeah. [25:58] » So we're are we talking like end dumps or semi trucks or what are we talking? [26:09] » Okay. >> John, does that affect you in a in a [26:12] negative fashion? Does it does it hurt your operation? No, scrape scrape ground [26:19] clean so they can put that down >> because that lot's kind of a it's almost [26:24] like a a 3/4 rock crushed rock. It's like clean gravel in that lot. Correct. [26:30] » Is that the other lot or the lot using a lot [26:40] » and that would be this month. Well, I mean, unless you have a reason [26:47] you don't want to, I think it's great to let contractors work with us because we [26:51] may need them in the future to do something. [26:56] » Yeah. [26:59] » No, it's fine with me. [clears throat] [27:03] » All right. >> All right. Don't leave me. I got a [27:06] question for you. >> What's your question for? So on Friday [27:10] after I left here, I got a call and there said there was a tree down on [27:14] Acorn Road north of 170th. So I think somebody called evidently maybe called a [27:22] shop in Fairview and Jerry was over there, but they didn't check answering [27:26] machine. So maybe the answering machine needs to be changed. So it says to call [27:31] your number or some other number. What? [27:41] The call would be forwarded to another phone. [27:44] » Okay. Something something needs to be done [27:49] cuz that tree was there I said at 4:30 in the morning when we went to work. So [27:53] it was there sitting there all day halfway across the road. So we need to [27:58] better communications there somehow. [28:03] » What would you recommend Tammy? [28:07] things that have [28:11] that be. >> Who would do that? [28:18] » When you when you say us, you nick. Yes. Okay. Do you mind doing that? [28:25] call. [28:31] » I was going to say, is it a is it one of the same phones like right here where [28:35] you can go into and enter a message or >> I think [28:49] maybe [28:54] So, so would it be possible if Bill met you over there [29:00] » because you have a key to the office to get in there? Obviously, [29:02] » with me, would >> Okay. [29:06] » The first office has >> Okay. So, could Bill meet somebody over [29:10] there at a certain time? And if you go over there, obviously grab a county [29:13] vehicle and run over there. [29:18] » I I don't know. >> Okay. know that I need [29:20] » as long as you know where it's at and how to get in. I'm just [29:22] » Yeah, >> I I thought maybe he just change a [29:27] message on there to >> to call this number. [29:29] » Yeah, I still have >> Well, you're right. You'd have somebody [29:32] to do that, but >> pretty simple. [29:35] » Fair enough. So, you you'll do it then and then if there's any problems, you'll [29:39] let us know. >> Appreciate that. [29:43] » Thank you. >> Okay. Anything else on your list? [29:47] Um, not this one. [29:53] » Okay. So, you want to present that? Have you seen this Mickey? [29:56] » No. No. I It's just another Bible reading on square deal [30:03] signed it the third Thursday of no third Saturday [30:08] of the month. Okay. [30:12] third time they went from 11:00 a.m. to 1 p.m. [30:17] » Okay, this is just to reread what he said. It's it's Is it a continuation of [30:22] what they've already been doing? >> So, they did it for two weeks or [30:26] something. Then they decided they didn't we did it every week was enough. [30:29] » Okay. So, we have a property use request of the courthouse yard. They don't want [30:36] to go inside. >> No, they don't want to go inside. [30:37] » Okay. for Bible reading on the square for the third Saturday of the month [30:41] 11:00 a.m. to 100 p.m. And this is for the August 15th, September 19th, October [30:48] 17th, 20 which finishes the year basically December 19th. So that's what [30:54] we have here. Is there any questions or comments on this? [31:00] Looks like it's filled out completely. Does someone want to make a motion to [31:04] » I move we approve the request for bother reading on. [31:08] » Okay. Is there a second? >> Seconded. Okay. It's been moved and [31:11] seconded. Is there any discussion? If not, all in favor say I. [31:14] » I. >> I. I. [31:15] » Okay. Motion carried [31:20] 26. [31:23] Okay. Any other business? [31:30] » I did. Okay. >> I did not watch the video. I will say [31:34] that, but I read through everything. [31:40] » Um, I am, but before we do that, Bill, or do [31:45] you guys have any comment on it or can you [31:49] » are you familiar with this organization? >> Yes. [31:51] » Okay. That's why I was hoping you'd just kind of give me a little background. So, [31:57] so what they said they do, they kind of look into what the federal government do [32:03] or the state government and seeing what's going to affect [clears throat] [32:07] taxpayers or the land use part of it. And uh so we joined a couple years ago [32:16] in the middle of the year and Lucas and I made the funds for it. [32:21] » Okay. And so this this year they just let us go on another year. I think we [32:28] probably joined in the middle of the year so we year without any more cost. [32:34] But I think what she said I think it'd be good if we could put what that video [32:39] was so people are watching could see it. But I don't know how you do that. [32:47] » Let's say conflict of interest. [32:50] » Okay. >> Okay. That's fair. Anyway, I think it [32:53] shows that what they're doing and it's like it said trying to increase [33:00] our rights. >> Do you have a copy of that ballot? [33:04] » It's on our >> No, I haven't down that far. I'm sorry. [33:09] I just remembered the big copy. >> Is it This is the same thing. [33:13] » Yeah, it's the same thing. [33:17] So, so the reason I was asking is I trust your opinion on I mean you're [33:21] familiar with this organization and you believe you trust this organization, [33:24] » right? >> Yeah. So in the reason we got involved [33:27] with them had a lot to do with that corridor the NR [33:32] what was the transmission line corridor the five mile [33:35] » the grain belt >> grain belt [33:36] » or the one that was going to be five miles I forget the acronym now and but [33:40] they've done some work on on oh like the lesser prairie chicken [33:45] things like that in western Kansas that that makes a pretty good sense [33:49] » most of the counties are out more in the west [33:51] » right >> yeah so I mean after I went through it I [33:54] I saw no problem in voting to allow them to excuse me to participate, [34:00] » right? Because it would was there a cost? [34:03] » No, >> there's no cost involved with it. [34:06] » So, what I saw when I read through this, too, is I mean, my personal feeling on [34:09] this, but I would not be for the government being able to reclassify and [34:14] and doing anything that would give a land owner less u control of his land. [34:20] And and the way I I see this is if it was the pass, if the government was to [34:24] do this, they would have the it would have more overreaching power. [34:28] » Am I saying that correct? I mean, by reclassifying animals that are from [34:33] endangered, you >> that's [34:36] » it's very similar to when they they uh what's about a navigable body of water. [34:40] Correct. When we went through that correct at the And so this is very [34:44] similar >> which really affects any land owner that [34:46] has any kind of creek running through it problem. So whenever the an agency of [34:52] the federal government tries to increase their powers, [34:56] » yes, >> that's what we're [34:57] » Okay. So as a member of KNRC, Brown County, is do we do we have enough [35:02] information to vote on this ballot so we can send it off? [35:05] » So the the question, should the Kansas KN&RC be authorized to participate uh in [35:10] federal litigation defending the repeal of the US Fish and Wildlife Services [35:14] Regulatory Definition of harm under the Endangered Species Act? And yes, we [35:19] authorize them or no, we do not. How do you vote on that? [35:22] » I vote yes. >> I vote yes. I vote yes, too. So, we'll [35:26] just check that box. >> Okay. Do we have to make a motion? [35:34] » No. [35:38] » Okay. Okay. Okay. On question number two, should KN&RC be authorized to [35:42] participate in litigation defending the repeal of US Fish and Wildlife Services [35:47] blanket section 4D rule? How do you vote? [35:51] » Yes or no? >> Yes. [35:52] » Yes. >> I would vote yes. Okay. So, yes. Um, the [35:57] date of vote is 8326. [36:01] [clears throat] And if anybody wanted to look in this, there was a reason they [36:03] broke it into two votes. If you read through their [36:09] Okay. Okay. Then I would make a motion to submit this ballot [36:15] um to KN&RC so that they can [36:19] count it. Is there a second? I'll second it. It's been moved and seconded. Is [36:23] there any discussion? If not, all in favor say I. [36:26] » I. I. I. Motion carried. [36:31] » Okay. Is there any other business to come before the commission? [36:41] Okay. Five minutes uh executive session. I'll make a motion for a fiveminut [36:45] executive session. My elect personnel performance with three commissioners in [36:49] the county. Uh is there a second? >> Second. [36:54] » It's been moved and seconded. Any discussion? If not, all in favor say I. [36:57] I. I. Okay. Motion carried. 5 minutes 8:49. [42:26] five. Okay, we're out of executive session back into regular. No binding [42:29] action taken. However, I will again call for uh another executive session for [42:34] five minutes with the same people for the same region. Is there a second? [42:39] » Moved and seconded. Any discussion? Not. All in favor say I. [42:42] » I. A motion carried. Five more minutes. 8:50. [48:06] That's on the list. All right. All right. We are out of executive session. [48:10] Back into regular. No binding action taken. Is there any other issues to come [48:14] before the commission? >> This is election week. [48:19] » Tomorrow is the big day. >> Bill, can I just say one more thing [48:23] about that? >> One more thing. tree. So at 4:30, I went [48:26] over there to see what I called Jerry and he said it'd be good if I could go [48:30] see because if it was just a little bit it would, you know, I could go clean [48:34] that up myself. I got over there and the knee houses that live close there, [48:38] they're out there working on it and so I helped them a little bit and got it [48:42] cleaned up. So they the citizens were doing a good job. [48:46] » So a local family nih >> n how you say it? [48:50] » Kneas I think. >> Okay. All right. might be needing to go [48:54] back. He just lives around the corner there.
