[0:00] Heat. [0:12] Heat. [0:36] Heat. Heat. [0:43] Heat. Heat. [0:56] Heat. Heat. [1:07] Okay. [1:28] September 10, 2026. [1:39] to the flag of the United States of America and to the [1:45] stands. My nation [1:49] with liberty and for all [2:10] tonight. We do have a forum so we can go ahead and vote on stuff tonight. [2:15] Tonight's hearing is a result hearing um for Miss Don and Sun Resort and um she [2:25] has to have stopped in the resort. So that [2:29] um we need to consider [2:34] and Mr. Would you like to take the questions for you if you don't mind? [2:39] » Sure. [2:42] Um to start off with, one of the questions I have is when did you [2:46] actually stop being a 11 years ago? 11 years ago. [2:52] And um you've been getting uh business licenses [2:58] for uh up until this year uh for >> Yeah. [3:04] Okay. [3:08] And then um another question I have is um at the council meeting it was [3:14] mentioned that um you can possibly order out $40,000 or there's a $40,000 number. [3:23] Could you explain that to us? >> If I sell as residential, I would get [3:29] more money than commercial. >> Okay. Did you have an appraisal any [3:33] chance? you know, I'm waiting to see what's going on with this. Perfect. Um, [3:38] and what is your desire? Um, this one that uh the only thing I'm wearing right [3:45] now is my house and the cabin next door. Okay. Uh, is there something in [3:52] particular that you're looking to show that you have? Uh, are you familiar with [3:58] the zones? Just like I all I want is the house in like a mother-in-law. [4:05] » In other words, you want a residential one zone, [4:10] » whatever that is. >> That's a single single dwelling or [4:13] single residence. >> Yeah. [4:15] » On the property [4:19] home, right? As long as it's small in the [4:23] house. Absolutely. It is. [4:30] something [4:33] um [4:37] which again just a statement I don't know a lot of times partial property is [4:42] more valuable than this in general that's why I wish you had probably [4:52] » I mean I'm trying to tell you you're going to get something to check in [4:56] personal property is more valable. >> Well, maybe you don't realize that maybe [5:03] you do. Uh but if you have the property up for sale, you do not have to reszone [5:09] it. >> Okay? [5:12] » You can keep it as and sell it as a C4 commercial property. This is an option [5:19] for you. It's in or our ordinances and such. so that you know what your options [5:25] are. >> Okay. [5:26] » Okay. >> Yeah. [5:28] » All right. I mean, which gives you some choices and depending on what you would [5:31] like to do yourself. We're here to go along pretty much with what you feel [5:39] best for what you need at this particular time because we have a set of [5:45] parameters. >> We've got to sell it right now. [5:50] Eight years ago, I tried reszoning and I had a veteran family that was actually [5:56] trying to buy and they just wanted to do their own family [6:02] and just keep it as a multif family, but that didn't work. [6:08] Okay, they couldn't get a commercial lo. [6:14] Um tonight, um we've been required to make a decision on which way you want to [6:20] go. Do you have whether your thoughts here before us tonight? Are you going to [6:26] keep it resort or are you going to do uh residential? Um unfortunately, we cannot [6:33] give you the gift of time. We have to make a decision tonight. So, what would [6:38] you like to see at the resident? Is that what you were [6:44] talking about? [6:49] Thank you. You do realize I mean I don't know but you [7:02] » I understand but usually is more valuable. [7:09] When I tried to sell I tried selling it 3 years ago as a commercial and it was [7:15] nothing. Nobody was even like offered me 45,000. [7:22] Well, I just want to tell I myself [7:29] values. So we're not going to get into what the values are because we don't [7:34] have um but thank you. Uh let's open it up to citizens comments. Okay. [7:41] I believe there's a few citizens of um citizens contact. [7:54] I know it hasn't been a resort in a long time here. No. And uh um you know it was [7:59] a long time ago and everything behind. Does that go up to the core of [8:04] engineers? No. It does. Okay. Um, you know, does that set a precedent that if [8:10] somebody else has a resort and they want to make it R1 and then if the the new [8:19] state deal with only happen to have a 400 square ft tiny home or [8:25] will that set a precedent that some of these other resorts, Driftwood do the [8:31] other be able to have smaller cabins and stuff, will they being able to [8:38] request our money and come sell off individually is out. I don't believe it [8:44] will set a precedent, but it doesn't stop any of these other resorts from [8:49] trying the same thing as we're seeing here tonight. [8:53] Um, unfortunately, uh, the rules are the rules, uh, and we can't stop that. Um, [9:00] well, you can't just sub you couldn't just subdivide it either. [9:05] And on the reasons for this hearing is simply [9:09] she has stopped operating as a resort. >> Yeah. [9:12] » Okay. Which then requires mandated a resoning. [9:18] » Now that could be R1, R2 or R3. >> Yeah. [9:22] » That's why we're asking her what her choice would be in this matter because [9:26] she the resort owner would have that. >> Is the property next to it the boat not [9:32] owned? Is that is that commercial? That's commercial. Um, the back side of [9:37] her is all poor man. The other side of her is city floor and across the street [9:45] from his home. So, if she was fortunate, she wants to move and sell it and she [9:50] sells it. If somebody borrowed it and wanted to go back to see or would that [9:55] be an option for >> it would be an option. they would have [9:58] to come back to us as a resone application. Um because it would [10:04] potentially be a new person um they would be able to come back immediately [10:09] and ask for a reason um with Miss Jones's case after tonight. If she [10:15] decided to switch back, she has to wait in here one one year. Thank you. [10:30] 505 shortest drive. Uh my wife and I, we own Lodge uh adjacent to Glory property. [10:38] Um and a year ago, we started hearing more things that she was interested in [10:43] possibly moving and selling her. After some time of reflection, [10:49] uh we decided that it would be a good opportunity for us to expand our [10:52] operations and based off of the new resources that we heard from. Uh we made [10:58] a couple approaches to her saying that we were interested in p in possibly [11:04] purchasing the property from her when she was ready to sell. Um and based off [11:09] of the last competition uh my wife had with her in August, she was creating.com [11:16] and uh we would like to to purchase it, have a local property to expand our [11:22] operations. Um we were not aware of that was for sale 3 years ago. Um eight seven [11:29] years ago when we had it for sale and we're not in position to buy that. We [11:33] were just starting out. Um and now in place where we are looking to expand our [11:40] operations. So you should be confident. Yeah. And [11:45] and last we talked to her in I believe in the middle of August. She was waiting [11:49] to hear back on appraisal and she's going to let us know and then here we [11:54] are. this committee uh is we're here to determine what she wants to do and if it [12:02] goes residential and of course ours is just a recommendation to the city [12:06] council. We are not making a final decision tonight ourselves. We are [12:11] making a recommendation out of this committee to the city [12:14] council. But if she wants to go ahead with an R1 and city council then approve [12:21] that, then you would have to come back to us and request a resoning as just [12:26] stated. So you guys know all this I mean right this business between you guys. [12:32] Yeah. So that's all I have. Thank you for [12:40] anybody else on this. uh tire on cheap uh 56 short drive [12:47] adjacent properties. So my question would be as an R1 building would that be [12:52] able to be rented out as multiple dwellings to your separate households? [12:58] She would have to live in one of the buildings and she would be able to rent [13:04] out the other one. Um the beginning of the year the state [13:09] passed city law that said everyone in a single family growing um can have a [13:16] mother-in-law apartment. There's size limits. Um I'm not sure [13:23] makes that but it's grandmother. >> Okay. It's existing so we're not going [13:28] to push that issue. You should get rented out as on your own property. you [13:33] can build a mobile company and you can rent it out. So, um if it becomes a [13:39] business and she's doing Airbnb, she'll have to uh apply for her business [13:44] license to get inspected. Um it would probably be in her best interest to get [13:49] inspected and we don't have people. So okay that [13:56] was that was just where I was I guess bit fuzzy on the on the matter be out of [14:03] the multi family property at that point one is a single family [14:07] Okay. >> R2 becomes like a duplex. R3 would be [14:11] like an apartment complex. >> Okay. So, you would be hardressed to be [14:16] able to put multiple buildings back on she [14:21] doesn't give her the automatic breaking. Um especially if she decides to go with [14:28] res. [14:33] Thank you. Thank you. Anybody [14:39] else like to see [14:49] Locus Avenue voting on them in a couple weeks? Um, [14:56] and now to hear that there may be a a commercial interest in them, is there [15:02] some way that we can word this so that [15:07] the people that want to buy it on a commercial basis could have a time [15:12] window to do that. And then if that didn't work, [15:17] then we could go to the residential zoning. I I don't I'm [15:25] just asking. I really honestly do not know. Is there is there a way that we [15:29] can I don't I mean and I don't know if [15:33] you're if if you're open to that if you're open to listening to an offer [15:38] from them or whatever but I I I would hate to see it get shifted to one thing [15:44] and then all of a sudden somebody live turn it into a you know business which [15:51] would be great for the community and then all of a sudden they're back here [15:54] going oh no we need another zoning chain. So, is there a way that I and [16:00] again I really this is an honest question because I don't know is there a [16:03] way that we can put some kind of grace period in there where we can [16:12] it will come to you. Uh there will be a grace period between the time tonight [16:16] where we make a recommendation and generate a recommendation and when it [16:21] comes before you at a council meeting or if you decide to do a special meeting I [16:26] don't know how you're going to handle it. Um that would be I would consider [16:30] that period in the next meeting. I think it's what a week and a half away. Yeah. [16:36] Okay. [16:42] » Yeah. Okay. So, that would be in your hands. Uh tonight we are required to [16:49] make a recommendation to the council. Uh or against not sure how it will go yet. [16:55] Um but then we will give you the information as a councilman and uh city [17:02] council. Okay. Do what you wish. Correct. And it will be in your hands. [17:07] If you want to indicate what that would that's [17:14] okay. All right. Thanks. [17:31] Uh my question would be I went across a lot of locks around [17:38] here. Nor [17:46] do you know how many blocks there is over there? 3/4 of an acre. It's not [17:52] split into lots or anything. It is uh every property is split into a [17:59] lot. So I'm guessing there's three lights. Okay. So what would [18:06] I guess my question would be if you put it into R1 [18:13] someone buys the property other than Tyler. [18:19] Um and they wanted to subdivide that. Take those lots, put them in three ways, [18:25] bring three free lots there, build free properties there [18:30] that still be all and then Tyrone across the street. [18:39] Yeah. Um that is entirely possible. Somebody has a residential property. The [18:46] only thing that would be standing in her way of or anybody's way of uh building [18:52] other houses is where the buildings that are existing sit on the land. If they're [18:57] on property, we're going to have a problem. Mhm. And that's going to slow [19:02] down. So say somebody coming in that down [19:12] correct that way. Absolutely. [19:19] Thank you. [19:23] Anybody else have any uh comments close [19:30] commissioners discussion? Um, I'll share because um [19:38] because [19:41] um I am not thrilled about switching this [19:46] to our um or any zone. Um, one of our biggest problems is we cannot [19:58] resone property for somebody to share properties. [20:10] Um, with that said, um, if you want to go with our that would be the only thing [20:16] I would consider. Um we have to make a decision one way or [20:22] the other. Um and also [20:28] part of this which would go to council on their decision [20:33] would be because it affects other people's property around. [20:38] There's an interference business. There's a lot to consider on this and [20:44] just doing it for her. [20:49] I'm not saying not to. I'm just saying that's something that each time I'm [20:54] telling you got to think about because if you're doing damage [21:01] or costing business to a surrounding property, [21:06] well, in my eyes, you're hurting the business now. [21:11] So how's it beneficial? Is this something to take in consideration [21:17] individual? Well, well [21:23] speaking for me, we're here to deal with the ordinance [21:28] involved. This is an either or. This is not you know we can have personal ideas [21:36] about it or opinions and we are literally here to because we have a [21:43] resort that is no longer a resort instead must be reson known or must be [21:47] being told as a resort to stay the way it is. Cut dry [21:54] and what I would like to find out before I make a vote again is Mrs. Gnick. [22:00] What would be your final decision before this council as or committee as to what [22:05] you would like to do to reszone or to sell as a resort that we can recommend [22:12] to the city council? Tyler or [22:19] I prefer to do it actually RT [22:24] R2. Why would you do R2? That's um that's [22:28] duplexes and you don't have a duplex. [22:33] Um we cannot give you R2. Um R3 is apartments. R1 is single family. Um, we [22:42] just can't give you something because you want it. You have to have a pretty [22:46] good justification for it. I'm sorry to say. [22:51] So, R1 would be probably the only option that I see this board considering [22:56] tonight. Um, or stay [23:02] commercial. Uh, your choice by all means. [23:08] and see what they're thinking as well. [23:16] » Well, we have to make a decision tonight to pass the city council. If you may [23:22] want to take some time and discuss it with them, that would be I'm not fine. [23:26] I'm not going anywhere. >> Okay. [23:28] » Okay. It's just we're kind of pressed on time on this for you and stop here a [23:34] little bit. Make your recommendations [23:43] now [24:02] is not a decision. City council takes our recommendation and why we recommend [24:08] it such that they are going to consider all that and I guess if you want to come [24:14] back later to the city council meeting here in a couple of weeks and say hey we [24:18] want you know where we'd really like to go they're going to make the final [24:22] decision so [24:26] give you more time [24:32] press to say okay two weeks we have to decision, right? But [24:39] it's more decision for you where which direction you want to go. [24:52] the last year. That's uh here's what I would recommend [25:00] and you know leave it or whatever but I would recommend that if if you want to [25:05] change our committee votes on that send their [25:10] recommendation whatever that vote is to the council. We've got a week and a half [25:15] before the council meeting. Obviously, the council doesn't want to punish you [25:20] or anybody else or shut down anyone's business opportunities. So, it's a week [25:25] and a half for you to talk to Tyler and see if you can work something out. And [25:30] if you can or if you can get close, then you come to the council and say, "Look, [25:35] we're in the middle of that. Nothing's going to happen until we vote on it." [25:42] » What is going on with the citation? Well, I mean that that's that's out of [25:46] our hands, but let's eat the elephant one bite at a [25:51] time. And if if that gives you a little bit of leeway to [25:57] try to work something out. If that looks promising, then that's great because [26:02] we'd like to support you getting what you want. Obviously, they want [26:06] something. Everybody wants something. Let's try to accommodate everybody here. [26:11] that gives you a week and a half and it's not set in stone but in a week and [26:14] a half we have to make a vote on it because [26:18] we can you know we can lengthen that if we want to if if you come to us and or [26:25] they come to us and say hey this is heading in the right direction we think [26:28] we can make this work and we just need another week or another another month [26:33] um once it's out of your hands correct you got it done [26:38] » correct >> okay so I I I think that's the best [26:42] compromise that we can come up with right now. I I I don't know if if that [26:47] works for you guys or works for you or, you know, I just want to buy people time [26:52] to to get this done. So, cuz I would much rather see, honestly, I'd much [26:58] rather see a resort go back in there and and somebody use it as rental property [27:03] or short-term rental property and have some place for people to stay because [27:08] we're headed in that direction. we need those rooms and but and on the flip side [27:14] of it, I don't want to just say, "Oh, you know, I don't care what you want." [27:18] You know, that's not that's not cool either. So, I think right now we've got [27:22] a week and a half that we can we can maneuver and then at that week and a [27:28] half somebody comes to the council and says, "This is where we're at." [27:33] Um, and I I get you on the citation. I don't I don't honestly not taking off [27:40] working. >> I I [27:43] not I'm not done with that issue. I'm just [27:48] trying to solve this problem, which is the problem I feel I can solve right now [27:53] and and get everybody some breathing room. So, my recommendation would be for [27:58] you guys to make your vote, talk to the council, [28:02] make the recommendation to the council, and then we have to man up and do what [28:06] we need to do. Okay? So I I there's one other councilman, two other council [28:11] sitting in the room. So and I don't hear anybody with their hair on fire about [28:16] what I'm saying. So you know I don't speak to the council on this one person. [28:21] But I think that's a compromise that that everybody can kind of live with and [28:25] then that gives everybody some maneuvering room and you guys do your [28:30] job then you give it to us and then we have to do our job. [28:35] That's those are my thoughts. Thank you. Any discussion amongst the [28:40] commissioners? No, it's again the final resolution that [28:46] you'd like us to recommend to the uh to the council. [28:54] Well, with that said, I'm going to make a motion that we uh recommend a resone [29:00] to R1. Do I have a second? I'll second to that. [29:06] Any more discussion? [29:10] All in favor? I opposed. I [29:22] um actually you don't have to think anymore because there's only three of us [29:26] tonight and because we split our votes. Um we needed a majority of the full [29:32] commission which would be three people. There's only two people potentially [29:36] going to vote tonight. The recommendation is not to resone it to [29:42] R1. You have the option to go to the council and bring your case with them to [29:48] change it if you so desire or keep it under. [29:54] With that said, I'll take a motion to make that motion. [30:00] All in favor? [30:04] Now the meeting is over. I know we can't talk about multiple things, but with [30:08] your family coming here for rezoning and possible attempts to have the uh [30:14] property possibly sold at commercial veterans out, that's not our business [30:19] that's between them. Um I think a logical decision would be to start [30:23] considering maybe dropping the citation. Um, but for no longer having the units [30:29] there and no one living there other than herself, uh, I think maybe it's a great [30:34] way to kind of play this over the situation. I don't know if that's [30:39] doable, especially from the citizens. May I respond to that before everybody [30:44] gets up? The commissioners have all discussed [30:50] this. We have agreed to drop the citations if she would either come [30:56] before us, reszone or put it up for sale. [31:02] She never came to us and that's why the citation is out there. The prosecutor [31:07] and her attorney both know this deal is on the table. Um, and it's on my it's in [31:15] the hands of the the court at this time. So tonight is involved in that does not [31:23] apply to that [31:27] to request but you deny it. So then that means that [31:31] you can't >> it's not over it's not over because it [31:34] has to go to the council but we only make a recommendation. when you wrote [31:38] the >> correct and I also have put it in the [31:43] hands of the prosecutor and her attorney with it is up to them [31:48] » on your recommendation >> on our recommend the commission [31:55] you're asking and I think it's a reasonable request [32:00] for that >> it's already done so it's already been [32:06] done Um it's up to the prosecutor at this time. Uh that's not up to us [32:12] anymore. We we put the operata. Um we do not control the courts. Unfortunately, [32:18] she did not contact us when she had a violation letter and she ignored us for [32:24] 30 days. She ended up with a citation at that point and went to her court. Um [32:31] that took it out of our hands. Uh and that's unfortunate for her. Uh, I went [32:36] to an attorney before any of those letters I got from you. You did well. [32:43] » I went to an attorney to have that girl convicted and when I called my property [32:56] did not communicate with us for what we had to do and I I want to apologize. [33:04] I should have come to you. I came to stone and that's who gave me the [33:10] citation even though I already had her evicted [33:14] long before that I got the citation the information [33:19] we were given and that's unfortunate. She was before [33:24] um that I guess I should have to bring up. Sorry Lori. um it went out of our [33:30] hands when the citation went out and it's now in this uh the court's hands. [33:37] Uh your prosecutor and the prosecutor attorney [33:42] and um I think it would be wise for everyone [33:47] to review the actual process and how it happened because I'm not sure that the [33:52] full picture is being played out yet. And that's [33:57] we [34:00] close. [34:07] Um even though we don't have any official poll with the court, could the [34:12] council make recommendation to the court? you could um claim already asked [34:19] and um for some reason um I believe the attorney is the one that has been [34:26] procrastinated and put it off what reasons I have no idea I'm not to that [34:37] conversations about that weren't supposed to happen or part of why [34:43] » um I where you're going with that, but I was instructed I was ask questions on my [34:51] um position as the chair of Honey. The prosecutor asked [34:57] me questions, I answered them. I was only there to assist. I was not [35:02] controlling the court case. The >> not even her court case was brought up [35:09] until further at some point. So you're trying [35:14] to put it on her her prosecutor, her parent [35:19] our meeting had nothing to do with her. [35:24] The meeting's over, folks.
