[0:00] officially
[0:09] starting.
[0:11] >> Okay. Um we're going to start with
[0:12] opening remarks by council member Nolan
[0:14] Denim.
[0:16] I'm
[0:17] >> going to give my opening remarks in the
[0:18] form of a prayer.
[0:22] Our father in heaven, we come before
[0:24] thee at this time as this council
[0:26] meeting and give thanks for this form of
[0:28] government and this freedom and nation
[0:30] which we have
[0:32] >> during this month of July. We recognize
[0:34] our freedoms and those who have
[0:36] sacrificed so much and we pray thy
[0:38] blessings upon them who have served in
[0:41] the past and those who are serving now
[0:42] and their families as well as they are
[0:44] away.
[0:46] I pray that we will do the things in
[0:48] accordance and that we will
[0:51] be able to give consideration to all
[0:53] things that are placed before us. We ask
[0:55] for these things and do this in the name
[0:57] of thy son Jesus Christ. Amen.
[0:58] >> Amen. Now, if you'll join me in a pledge
[1:00] of allegiance, please.
[1:05] » I aliance to the flag
[1:08] >> of the United States of America and to
[1:11] the republic for which it stands, one
[1:14] nation under God, indivisible, with
[1:18] liberty and justice for all.
[1:25] » Thank you, Nolan. Appreciate that. Um,
[1:28] has anyone had a chance to review the
[1:30] agenda and would like to make a motion
[1:31] about the agenda?
[1:33] >> So, move.
[1:34] >> Second. It's been moved and seconded
[1:36] that we approve the agenda. Those in
[1:38] favor say I.
[1:39] >> I. Any opposed?
[1:41] >> Okay. What about the minutes from the
[1:43] last council meeting?
[1:46] I would accept a motion about that.
[1:49] >> I'll make a motion to approve them.
[1:51] >> I'll second that. It's been moved and
[1:53] seconded that we approve the minutes
[1:54] from our July 14th council regular
[1:56] meeting. Those in favor say I.
[1:58] >> I. I.
[1:59] >> Any opposed. Okay.
[2:02] All right. Move on to the report of the
[2:04] county executive.
[2:05] >> Um I have some matters involving
[2:07] appointments, but it's entangled with
[2:09] the fireboard and what's happening
[2:11] there. And I have a discussion item
[2:13] involving the fireboard. So I'll explain
[2:15] what we're dealing with on appointments
[2:18] there. I don't have any anything to
[2:20] suggest an action on uh tonight. I do
[2:24] have um a report on our efforts ongoing
[2:28] with Powder Mountain and I would ask
[2:30] that you allow my deputy Mr. Web to give
[2:35] you an update on
[2:38] excuse me that's [snorts] not Powder
[2:40] Mountain that bear river
[2:42] health department.
[2:44] >> Okay.
[2:45] >> There's much health department didn't
[2:48] even have to say his name three times to
[2:50] summon him. [laughter]
[2:53] » We've talked a number of times about the
[2:55] interlocal agreement for health.
[2:57] >> Can you identify yourself for the
[2:59] recording?
[3:00] >> Kurt Web executive.
[3:02] >> Thank you.
[3:04] >> And Jordan will explain what we've
[3:05] agreed to. There are some and where we
[3:08] are on it. There are apparently a few
[3:10] details that still need to be worked
[3:11] out, but they're mostly administrative
[3:14] and I'll let him discuss it.
[3:19] Yeah, thanks. Uh Jordan Matthysse,
[3:21] director of the Bear River Health
[3:22] Department. So, we've been in
[3:24] discussions with uh Weaver Morgan Health
[3:26] Department. Um just some historical
[3:30] background with regards to Powder
[3:33] Mountain. We've already had some um I
[3:37] would call them uh gentleman's
[3:39] agreements with with them on food
[3:41] service for for Powder Mountain for
[3:44] years. um meaning it was really
[3:47] expensive for us to pay for a ski pass
[3:49] and ski to the ones that were in um Cash
[3:53] County. So, we just said, "While you're
[3:54] doing the others, go ahead and take care
[3:56] of the others and permit them." So,
[3:58] they've been doing that for years. But
[4:00] now that the development's growing, uh
[4:02] we did feel like it was appropriate to move towards a a formal interlocal
[4:07] agreement between
[4:09] um between the two agencies for public
[4:13] health uh programs and and regulations
[4:16] um of the development. Um so the
[4:20] duration it the you have a copy of this
[4:23] and on page three
[4:26] well let me go on page two um the the
[4:31] things that we're really delegating um
[4:34] and asking them to take care of are food
[4:37] service any on-site wastewater
[4:40] permitting um public swimming pools and
[4:43] spas general public health complaints
[4:45] and emergency um response
[4:48] Uh that would be something like say in
[4:50] the development there's a diesel spill,
[4:53] we would expect them to address that
[4:55] rather than us addressing that. Um as
[4:58] well as they would address any of the
[5:01] fees. Um they would also be responsible
[5:04] for any grievance or appeals to permits
[5:07] or things like that. Um and then the
[5:11] other question was can we really
[5:13] delegate legal action? The answer was
[5:16] probably not. and that we would um we
[5:20] would each have responsibility for um
[5:23] legal representation
[5:25] um and but that we would coordinate. So
[5:28] if somebody's not if somebody's actually
[5:31] breaking public health law in Cash
[5:33] County, we're going to have to take care
[5:35] of that, but it's probably going to be
[5:37] picked up by them. And so then there's
[5:40] going to be that coordination and
[5:41] handoff uh with us. Uh section four
[5:45] talks about the funding. Um there is no
[5:48] exchange uh between the parties with
[5:50] regards to to any sort of money. Um all
[5:55] these things are based off a permit. Um
[5:58] and so uh all the food, swimming pools,
[6:03] wastewater, they're all based off of a
[6:05] permit. Uh the only thing
[6:08] >> according to their fee schedule. Yeah,
[6:09] that's what I was going to ask because
[6:10] it just says the fees will be decided by
[6:12] the board of set by the board of health.
[6:14] Is it their board of health?
[6:15] >> It's their board of health.
[6:16] >> Okay. That wasn't
[6:17] >> the board of health has by by law their
[6:19] board of health has the responsibility
[6:21] to set their fees.
[6:22] >> Okay.
[6:22] >> Um and they will set them according to
[6:25] that. Uh so they'll be uh they are
[6:28] different from the fees that we have set
[6:30] by our board of health. Um but the uh
[6:35] the only issue that would ever run into
[6:38] is on those spill related issues um or
[6:41] emergency response, but then there's
[6:43] going to probably be some sort of legal
[6:44] action and then we'll get involved and
[6:46] we'll we'll take care of that. Um so
[6:50] there should not be any exchange of any
[6:52] sort of funds between the parties. Uh
[6:56] that's that's the gist of it. where it's
[6:59] at currently is they had some other
[7:02] priorities. The attorneys in in Weber
[7:04] County had some other priorities said
[7:06] that they would get their redlinined
[7:08] version back to me tomorrow. Um so I'm
[7:11] anticipating that. But the things that
[7:13] they said that would be in there was
[7:16] some language from their risk uh from
[7:19] their insurer that they wanted to be put
[7:21] in there that would cover them by their risk insurance. So it it seems
[7:27] like it is more administrative changes
[7:29] that they just need to feel feel
[7:31] comfortable with with regards to theirs.
[7:33] It has been reviewed by Cash County
[7:35] Attorney's Office and given the green
[7:38] light as it stands right now. So I'll
[7:42] get those changes over to them once I
[7:44] have them.
[7:45] >> So I have a question Jordan. Then when
[7:47] it when we get a final version with the
[7:50] red lines and we both parties are
[7:52] comfortable with it then it is a
[7:53] legislative action to approve it like do
[7:56] or signatures from us
[7:58] >> according to the interlocal agreement
[7:59] you've designated that administrative
[8:02] ability to me so I would be the
[8:04] signature on the interlocal agreement
[8:06] >> that I
[8:07] >> this interlocal agreement because you
[8:09] approved the other interlocal agreement
[8:11] so does that make sense?
[8:13] >> Yep.
[8:14] >> Perfect. Thank you. Who else? Ash County
[8:16] attorney will still sign it.
[8:18] >> Yeah. Anybody have questions for Jordan?
[8:22] >> Kurt Webb, deputy executive. Again,
[8:25] that covered what I was going to say,
[8:27] but I want to make sure it's clear is
[8:28] that that
[8:30] because this doesn't because everything
[8:33] is fee based and it it won't affect our
[8:36] budget, then it then the signature on it
[8:40] is just an executive thing. This
[8:42] isformational.
[8:44] However, uh Sheriff Jansen is here later
[8:47] on because the agreement with the with
[8:50] the uh with law enforcement may have an
[8:53] impact and so that takes the resolution.
[8:56] >> Okay. Thank you.
[8:58] >> Thanks, Kurt. Anybody else have any
[8:59] other questions about that?
[9:03] » All right. Um Elma, you're next on the agenda. Request to the council to
[9:09] approve a change in the scope of the
[9:10] restaurant tax for 2025.
[9:14] Elma Burgess, uh, Cash County, uh, grant
[9:18] administrator. So, the fairgrounds
[9:20] received a an award in 2025 for $25,000.
[9:24] Uh, this was to support their suicide
[9:27] and mental health awareness. Um, they
[9:30] had asked for those funds for a concert
[9:32] in the park. Uh, the reason that we're
[9:35] coming uh this evening is because that
[9:38] is going to change a little bit for this
[9:40] uh coming year. um instead of a concert
[9:43] in the park, they're going to they have
[9:46] found a uh organization. It's called One
[9:49] Degree of Separation.
[9:51] They provide uh suicide prevention
[9:53] training and uh comedy along with
[9:58] lifesaving education.
[10:00] So, this award in 2025,
[10:03] um they need to spend that by December
[10:05] 31st, 2027. and they want to change from
[10:09] the concert in the park to this um other
[10:12] training program. And that anticipated
[10:16] that it will be held uh later this fall
[10:19] around August, the end of August. And
[10:22] they anticipate the event to be about
[10:24] $10,000. They have spent some of the
[10:26] money from that award. Um approximately
[10:30] half of it has been spent. So they have
[10:32] that those funds available. So, they're
[10:35] just asking um for a change in scope, if
[10:38] you will, and just wanted to get
[10:40] approval from the council if uh if you
[10:44] desire to approve that. And Bart is here
[10:47] if you have any specific questions.
[10:51] >> I had a lot of questions about this. Um
[10:54] and I can't remember I don't know if I
[10:56] asked did I ask you to get answers for
[10:58] me, Andrew? Were you able to do that
[10:59] yet?
[11:00] should be available on your iPad on the
[11:03] original grant application.
[11:06] >> Okay. Yeah. The question I had was when
[11:08] they applied for the grant for the
[11:09] $25,000, what was the scope of that? Was
[11:12] it supposed to be all for that um
[11:15] concert? And then how much of it did
[11:17] they spend
[11:18] >> for the concert? And um then did they
[11:23] apply for more money in 26? Have they
[11:25] did they apply for wraps money in 2026
[11:28] for any kind of suicide concert for that
[11:31] year?
[11:31] >> So, no, they didn't apply in 2026
[11:35] and the scope of work and I sent the
[11:37] application um to Andrew. Um so, the
[11:40] scope of work was basically that concert
[11:43] and some um what they've spent it on is
[11:46] some advertising.
[11:49] They did hold an event um I think it was
[11:52] on Thursday of last year of the rodeo
[11:55] affair weekend and um they did have an
[11:58] event but this other one would be for
[12:01] this year but they didn't apply for
[12:03] another um award.
[12:05] >> Okay. Okay. Thank you. That was that was
[12:08] the questions I had was how how did they
[12:12] what was the scope of the original grant
[12:13] application?
[12:16] Okay. What else? Somebody have questions
[12:18] about this?
[12:19] >> I this [snorts] one degree of
[12:21] separation. I've never heard of it.
[12:24] >> I'm on their website right now.
[12:25] >> Neither. I looked at the website and
[12:26] it's a they have a comedians do a
[12:30] stand-up routine that's brief um and
[12:32] they emphasize that it was clean comedy
[12:35] and then they organize a panel of these
[12:37] comedians to talk about just mental
[12:40] health awareness type things. And the
[12:42] premise is that comedy is often a venue
[12:45] that um anything can be discussed. And
[12:49] so they're trying to lead the by example
[12:52] in discussing potentially taboo topics
[12:55] in an open type forum. So I didn't know
[12:58] much about it either. I guess I still
[13:00] don't. But
[13:01] >> is this event going to be tied in with
[13:03] other events too at the rivers or is it
[13:07] a standalone?
[13:09] I Mark can probably answer that.
[13:11] >> Yeah,
[13:12] >> because I know there's a lot of several
[13:14] other organizations that have been
[13:15] trying to get off, you know, their their
[13:17] feet off the ground and have tried some
[13:19] things and I was wondering if these they
[13:20] were all coming together.
[13:22] >> So, um, thanks for for letting me speak
[13:26] to this a little bit. Um, I met I
[13:28] brought and I have with me Adam Vald
[13:30] Valdez is with one degree of separation,
[13:33] so he can answer any of the more
[13:34] specific questions. Um they held an
[13:38] event in Spanish Fork just a few weeks
[13:41] ago and some of our committee members
[13:44] went down to this event. Uh Jill
[13:47] MacArthur from Bear River Health
[13:49] Department and and some others and come
[13:52] back um quite impressed with what they
[13:56] had seen down there. Um we're still kind
[13:59] of playing with this. They do have an
[14:01] event scheduled for um August 29th
[14:05] and that's kind of our target. But the
[14:09] goal, my goal would be to try and
[14:14] um do this event when we can target some
[14:18] influencers, you know, the people that
[14:20] um can get them into to uh school
[14:23] assemblies and businesses and those
[14:26] things to expand the reach because uh
[14:30] any of you that have known me for very
[14:32] long know that this is a a passion of
[14:34] mine, suicide, mental health awareness.
[14:36] this um and I you know it's important
[14:40] that we get the word out. So whether we tie in with this event at the
[14:45] Riverwoods or we do something um later
[14:49] on is still a little bit up in the air.
[14:52] Um we're just asking for the change of uh funding or or permission on our
[15:00] wraps application. So we have a little
[15:02] bit of mobility to to kind of figure
[15:04] that out and go whichever way works out
[15:08] best.
[15:10] >> Is the venue change just more compatible
[15:14] at the Riverwoods versus
[15:16] Adam come from Wasatch Properties. So he
[15:19] has ties there and uh before he met with
[15:24] me he had they kind of had set something
[15:27] up at the Riverwoods. We could certainly
[15:30] hold an event like this at the event
[15:31] center, too. Um, you know, we could hold
[15:34] it inside or outside or
[15:36] >> It may be hard to book that on that on a
[15:38] weekend, though.
[15:38] >> Yeah. Yeah. Exactly. Weekends are pretty
[15:41] tough.
[15:41] >> Yeah.
[15:43] >> So, either way, you're not exactly sure
[15:45] which which date or what how you're
[15:48] going to spend that money, but it has to
[15:49] be spent by December 31st.
[15:50] >> I think we have December 31st of next
[15:53] year.
[15:53] >> Oh. Of next year. 2027.
[15:55] >> 27th.
[15:56] >> Okay.
[15:57] >> Yeah. But I I think it's important that
[16:00] we try and target those influencers that
[16:03] could then push it out and get more
[16:05] people involved. And um you know 29th
[16:09] that's right after school's starting.
[16:11] >> Yeah.
[16:11] >> Might be hard to get some of the people
[16:13] from the school systems to attend at
[16:16] that point where maybe a little later in
[16:18] the year um we might have better luck.
[16:21] So
[16:23] >> yeah. Okay.
[16:24] >> Any other questions for Bart?
[16:27] Yes, Matt.
[16:30] >> Esteemed auditor.
[16:32] >> Thank you. F County auditor. Um my
[16:35] concern when we had other applicants
[16:36] request scope changes. Um a couple of
[16:39] cities come to mind. Uh we've we've told
[16:42] them they need to go back through the committee process. And I I suspect
[16:46] that and and maybe Mr. Murray, the
[16:48] county attorney could opine here, but I think we're probably maybe at that
[16:52] point where we we should probably send
[16:53] this back through the committee process
[16:55] and process that that scope change.
[16:59] >> Okay. Thank you.
[17:02] >> Those of you that are on the wraps
[17:03] committee, what is your thoughts about
[17:05] that?
[17:06] >> That would actually be really hard to do
[17:08] right now.
[17:10] This close to
[17:12] >> tying into that event, it would be
[17:14] really hard to do right now.
[17:17] come back,
[17:19] >> but
[17:22] I know in the future things change. I
[17:24] imagine next year's application would
[17:25] probably be dramatically different now.
[17:28] So,
[17:29] >> think of when River Heights has come in
[17:30] and they've changed their we
[17:33] >> and those have been very capital kind of
[17:36] a capital expenditure type things you
[17:38] know that we've worked with versus
[17:40] >> comes to mind first of all is when they
[17:42] change from one park to the other park.
[17:45] Yeah, let's define the scope change
[17:47] because I think that's a valid concern.
[17:49] But what I think what we're talking
[17:50] about is there was going to be a
[17:52] concert, some form of entertainment with
[17:55] the topic of suicide awareness and
[17:56] they're switching it for something
[17:58] >> with same idea of suicide awareness. I
[18:02] mean, I don't know.
[18:04] It's apples to apples, I think.
[18:05] >> So, is it going to use all the funds
[18:07] this year, do you think, or just a
[18:10] portion?
[18:11] >> Well, they have 11. I thought that said
[18:14] 17
[18:14] >> and this would cost 10.
[18:16] >> Yeah. So, it it may well we'll we'll
[18:19] certainly still try and get some
[18:21] sponsorship. We've done a lot with
[18:22] sponsorships in the past and we do have
[18:25] roughly $17,000 that's earmarked in the
[18:29] foundation account also for this
[18:31] purpose. So there there's other options.
[18:35] Um but this is the option with a time
[18:37] limit on it. Right. So that [snorts] was
[18:40] kind of the thinking behind that. Yeah.
[18:42] Bart, I I think I'm confused. Is there
[18:44] another event that you're trying to
[18:46] piggyback with at the Riverwoods or it's
[18:48] just a venue change?
[18:50] >> Um, just a venue change and that's not
[18:52] for sure yet. We may still do it at the
[18:54] event center. Um, I I I want to leave
[18:57] those options open.
[18:59] >> So, it might not even happen in August.
[19:02] >> Correct.
[19:03] >> Okay.
[19:05] Do we um This one we need to take
[19:07] a vote on. Correct, Andrew?
[19:12] That's a good question. Uh I think first
[19:16] and foremost I think not to put Mr.
[19:18] Murray on the spot but if he could opine
[19:21] on to I haven't seen what the actual
[19:25] what you're actually looking at for
[19:26] scope. Just sitting here listening when
[19:28] I'm hearing concert versus comedy show
[19:31] I'm not really seeing a big difference
[19:33] whether it's someone singing or someone
[19:35] out there
[19:36] >> social
[19:38] I'm not necessarily seeing a change in
[19:40] the scope of what we're doing
[19:42] entertainment event for suicide
[19:44] prevention so I'm not sure if this is
[19:45] even actually necessary but I haven't
[19:48] seen the
[19:49] >> that that's just scope shooting from the
[19:50] hip a little bit on what's been talked
[19:52] about you're not seeing the actual scope
[19:55] >> so maybe we don't even need toote vote
[19:57] on it that it's
[19:59] >> that's my question. Do we need to take
[20:00] an official vote or not?
[20:02] >> Well, if your intent is to approve what
[20:05] is being requested, I think just to be
[20:07] safe
[20:09] to make a vote,
[20:10] >> I would I would move that we go ahead
[20:12] and support this change for this year
[20:15] and uh to keep this uh uh event and this
[20:21] purpose going strong.
[20:23] >> I'll second it. Okay, it's been moved
[20:25] and seconded that we approve this
[20:27] request um from the county fairgrounds.
[20:29] Is there any further discussion?
[20:32] >> Is it possible to listen to the
[20:34] gentleman from one degree of separation
[20:36] just so we have more information on
[20:37] that?
[20:38] >> Absolutely.
[20:38] >> Is is he the comedian? [laughter]
[20:42] >> No, you're the comedian.
[20:43] >> The first two minutes is is the bit and
[20:45] then the next two is a question.
[20:47] >> Would you please state your name?
[20:49] >> Adam Valdez with one degree of
[20:51] separation. I I'll keep it brief. Um
[20:54] just to give you some a snapshot of the
[20:58] presentation that one degree has done in
[21:00] the last eight months. They've been to
[21:02] all 50 states, 12 countries. The
[21:05] Pentagon invited them to present at Camp
[21:08] David. That's not public. Well, I guess
[21:11] it is now. Sorry. But uh it can't be
[21:15] advertised, but great organization,
[21:18] great presentation. It's it's gotten a
[21:21] lot of traction. There's ties that the
[21:23] founder has ties to Cash Valley. So, he
[21:28] wants to see this brought to the valley
[21:30] and so,
[21:33] uh, yeah, happy to answer any questions
[21:35] if you have, but that if that helps you
[21:37] get kind of comfortable with the
[21:39] presentation.
[21:41] >> Anybody have any other questions for Mr.
[21:43] Valdez?
[21:43] >> Maybe just give them the opportunity to
[21:45] correct what I said earlier. If there if
[21:47] there was anything inaccurate in my
[21:49] description earlier, I will give you the
[21:51] opportunity to correct the record.
[21:53] >> No, I I think it was uh fairly accurate.
[21:56] It's uh it's it's a different approach
[21:59] to some a very sensitive uh subject,
[22:04] right? So um there there's evidence that
[22:09] uh to make the case that talking is um
[22:15] the it's the first step, right? So
[22:17] mental health it's complex. There's a
[22:20] lot of you know everybody's been touched
[22:22] by it in some capacity
[22:25] and uh so they're very careful to stay
[22:28] in their lane. All they're doing is
[22:30] advocating uh and and providing tools
[22:33] for people to feel comfortable to start
[22:36] the process and talk about uh you know
[22:39] if they're struggling.
[22:41] >> Is that helpful?
[22:42] >> Yes. Thank you.
[22:44] >> Okay. I have a motion and a second. Is
[22:46] there any further discussion? Those in
[22:48] favor say I. I.
[22:50] >> Any opposed?
[22:52] >> Thank you so much.
[22:54] Okay. Sean Mil,
[23:00] » are we setting a timer? [laughter]
[23:03] >> Thought that was gonna come from
[23:04] Councilman Eric.
[23:06] It's
[23:06] >> the only guy we beat up over there.
[23:08] >> I know,
[23:11] >> but an appropriate target for [laughter]
[23:14] >> time
[23:19] » to be among friends.
[23:22] >> Well, good evening council. My name is
[23:23] Sean Milm, your economic development
[23:26] director by contract through the Bear
[23:28] River Association of Governments or
[23:29] Bragg. Um, this evening I'm just looking
[23:32] to give you a
[23:36] annual report on the activity from the
[23:38] last year in succinct uh form as I can
[23:42] and to preface the CEO board's
[23:45] recommendations for the ensuing fiscal
[23:46] year 27. So last year you'll uh you know
[23:51] you're reminded that this is what you
[23:52] had authorized the application that was
[23:54] approved by GOED later was uh retain and
[23:58] recruit um which I can explain a couple
[24:00] of activities here um update the
[24:04] county's economic assessment and
[24:06] strategy which was last done in 2020
[24:11] and uh should be updated which will be
[24:13] conducted later this year by the uh end
[24:15] of Q127. seven and then a matching grant
[24:19] for the airport that there is a call
[24:21] sign for the airport LGU. Uh you'll
[24:23] recall that Dr. Jones uh with S Swubar
[24:31] oh goodness with a consultancy of a name
[24:34] who I cannot pronounce right now from
[24:35] memory. I can see it spelled. But
[24:37] anyway, he had made a number of
[24:39] recommendations to improve the
[24:41] operational efficiency and fiscal
[24:43] feasibility of the airport, of which the
[24:46] county has undertaken several of those
[24:47] steps in the last couple of years. And
[24:49] you had set aside some money as
[24:51] recommended by the CEO board, which for
[24:53] the audio record and uh to remind you is
[24:56] the county economic opportunity advisory
[24:59] board aka CEO board. They are advisory
[25:01] to you only. you have the ultimate
[25:03] authority and they had recommended that
[25:05] to the extent that you could utilize
[25:07] that funding to help progress some of
[25:09] those recommendations to do so. Um what
[25:14] I' I've already mentioned that the
[25:15] county's economic development assessment
[25:16] and strategy uh will take place here
[25:19] shortly will begin shortly and and go
[25:22] through Q1 of 27 when it's expected to
[25:24] be updated. A number of you will
[25:26] obviously be uh sought out for input so
[25:30] that you can give your guidance on what
[25:33] your observations for the economy are,
[25:35] where you'd like it to be, as well as a
[25:37] number of other stakeholders throughout
[25:38] the county. As far as the airport growth
[25:40] goes, um this was envisioned and held
[25:43] aside for the
[25:46] selfserve fuel farm. Uh that was a
[25:49] recommendation made
[25:51] by Dr. Jones uh for reasons that I would
[25:55] rather defer to the county executive if
[25:56] he would like to expand on that is
[25:59] likely going to go into next year and uh
[26:04] I can speak more about that in another
[26:06] subsequent slide.
[26:09] Uh just a number of just photos of some
[26:12] of the activity that has expanded in the
[26:14] last calendar year that you're familiar
[26:16] with. Shriber there in the upper middle
[26:18] uh you may have heard is expanding in
[26:20] Logan City. their production capacity
[26:23] and that was approved with a a red tiff
[26:26] which is a rural economic development
[26:27] tax incentive financing. Uh it is the
[26:30] state's contribution for increment tax
[26:32] increment financing or tiff and uh did
[26:35] not require county participation to uh
[26:39] facilitate the company growing in our in
[26:42] our county. Of course the airport you'll
[26:44] notice Greenfield Meling was in there as
[26:46] well as um Pepperage Farms etc. The CEO
[26:50] board met recently and has proposed the
[26:52] following for the subsequent year's
[26:54] application which is due by September
[26:56] 1st. Um there are a couple of changes
[26:59] this year that I'll speak about uh real
[27:02] quickly in tandem with the next agenda
[27:03] item. But before I do, the proposal is
[27:06] to keep the contract with Bragg the
[27:08] same. That is the same dollar amount
[27:09] allocation for the last four years. Um
[27:12] no inflationary adjustment or otherwise.
[27:15] Um I'm going to skip over the special
[27:16] projects. I'll come right back to that.
[27:18] And I alluded to a moment ago, LGU, a
[27:20] matching grant um that was approved this
[27:23] last year was not able to move forward
[27:26] because the project uh didn't have uh
[27:28] sufficient full funding and the funds
[27:31] alone from this grant would not be
[27:32] enough. the CEO board, uh, which at any
[27:35] time I invite council members Mark Herd
[27:38] and Keegan Gerity to chime in if they'd
[27:41] like as members of the board, uh,
[27:43] recommended that another $18,000 be
[27:46] allocated to that. Combined with fiscal
[27:48] year 21's uh, unspent funds, that would
[27:51] be a little over $30,000 to go towards
[27:53] that same project to uh, fund a tank
[27:56] replacement and other hardware necessary
[27:58] for the self-s served fuel farm. Now to
[28:01] come back to special projects. The first
[28:03] couple of years of this uh grant program
[28:06] a number of years ago in the west campus
[28:08] of Bridgerland Technical College a a new
[28:11] project or a new program was being
[28:13] created called the business innovation
[28:16] yeah business and innovation center led
[28:19] by Mark Alexander and it was all about
[28:21] helping entrepreneurs become market
[28:23] ready and increasing their chance and
[28:25] likelihood of surviving and growth. and
[28:29] he did such a fantastic job and was able
[28:31] to show year-over-year growth on job
[28:33] numbers that you guys had decided to
[28:35] fund it for a second year. And then
[28:37] there was even consideration for a third
[28:39] year, but he politely declined it having
[28:41] secured funding elsewhere uh within
[28:44] their institution
[28:46] in order to keep the the program going.
[28:48] You may and are likely aware of this,
[28:50] but it's become so successful they
[28:52] bought the old Hurf Jones building or um
[28:54] Transchill building across the street
[28:56] from West Campus and now completely
[28:58] outfitted that into a super duper
[29:01] expanded version of the business and
[29:03] innovation center which they're now
[29:04] branding the hub. And the idea is that
[29:07] for up to two years, he helps these
[29:09] entrepreneurs through guided mentorship.
[29:11] Some of it is projects with one another
[29:14] and requirements to to meet together and
[29:16] as well as his own professional coaching
[29:18] with he and his team to help them get
[29:20] off the ground and help boost organic
[29:23] homegrown businesses.
[29:25] Well, as part of their expansion efforts
[29:28] and the growth of the campus's other
[29:29] programs, they're hoping to move the
[29:31] commercial kitchen, which is still
[29:32] located in the old West Campus location,
[29:35] across the street into Herf Jones. But
[29:37] as you can imagine, and anybody who's
[29:39] ever opened a restaurant knows,
[29:41] stainless steel and all of that kitchen
[29:42] equipment is fairly expensive. So he's looking for a means of bridging a
[29:47] gap of $80,000 to move that over. The
[29:50] good news is he has 60 clients, that 6
[29:53] clients that are using the commercial
[29:55] kitchen to grow their homebased kitchen
[29:58] uh business. So the um CEO board met and
[30:02] I've met with Mark Alexander as a
[30:04] follow-up since that CEO board meeting
[30:06] and he's told me that specific number of
[30:07] 80,000 is a gap that he'd like to have
[30:10] bridged and so that 20,500 is proposed
[30:13] for there. At this point I'll pause
[30:16] before going over the last slide which
[30:18] is a series of recommendations that
[30:20] forecast into the future.
[30:23] >> Any questions?
[30:24] >> Thanks for Sean. I I think the what
[30:26] Bridgerland is doing is amazing and the
[30:29] amount of small businesses they can help
[30:32] in in that for $20,000. I think that's a
[30:35] pretty big bang for the buck um for to
[30:38] affect small businesses in this county,
[30:40] which we all like to see. I'd like to
[30:42] see um if we're going to do economic
[30:45] development to help the the smaller
[30:47] businesses, too. So, I like that.
[30:52] Anybody else have question?
[30:55] comment. Okay.
[30:57] >> Felt like there was a Ben Stein
[30:59] opportunity for Ber Beer there. Um the
[31:02] next agenda item then I if if you were
[31:05] to approve before I go to the next
[31:07] agenda item. This is the CEO board's
[31:09] recommendations for next year. As noted
[31:11] earlier, the application is due by
[31:12] September 1st, but there are a couple of
[31:14] changes. One of those changes is the
[31:17] next agenda item, but I'm going to leave
[31:18] this here for a moment because I want to
[31:19] go back to the last slide. But um
[31:22] council members uh Keegan and Mark as
[31:25] well as executive George Danes need to
[31:28] be removed from the CEO board. Goed has
[31:31] um updated their administrative rules
[31:33] and one of those rules is they no longer
[31:35] want to have any elected official or an
[31:36] official that could possibly vote on the
[31:39] recommendations that come before you and
[31:41] this body as county council um be on
[31:44] that advisory board. Um that change has
[31:47] already been implemented in Cash, excuse
[31:49] me, in Rich County. Uh Boxelder, uh
[31:51] we're still working on as well because
[31:53] all three of the counties here in the
[31:55] Bragg Service Area had a member of the
[31:57] legislative branch that was a part of
[31:58] that. Uh for reasons that I think you
[32:00] guys have well noted repeatedly that you
[32:02] like to have a member. Um one of the
[32:05] things that I've ensured with them that
[32:07] you could have an exeicio that doesn't
[32:09] vote. Uh but again all of our meetings
[32:11] are always public and so any of you all
[32:14] of you would be welcome to the CEO board
[32:15] meetings where you could get a feel for
[32:17] the robust discussion that takes place
[32:20] with the group on various economic
[32:22] development updates. At this point I
[32:24] would defer to Keegan or Mark if you'd
[32:27] like to opine or say anything further
[32:30] about that.
[32:32] >> Uh I made my comments and my opinion on
[32:34] this matter clear last meeting if you
[32:36] remember.
[32:38] But I'm grateful for the opportunity. I
[32:39] have been a part of the CEO board. But I
[32:42] can I can get behind the state's
[32:44] initiative given most counties have
[32:46] commissioners, which is a different
[32:48] function than what we as council members
[32:50] and the separate executive fulfill. But
[32:53] it's a it's a rule from the state that's
[32:55] one size fits most.
[33:00] » I'm done. Sorry, Sean.
[33:02] >> I'm just not taking your bait.
[33:04] [laughter] You're my boss and I agree
[33:05] with you, but Yeah, sometimes
[33:07] [clears throat] a blunt instrument is
[33:08] used instead of a scalpel. So, yep.
[33:12] >> So, what that means functionally for
[33:13] that second agenda item tonight that I'm
[33:15] listed for is that you need those three
[33:17] and then another CEO board member in the
[33:19] last month has mentioned some personal
[33:22] complications that would preclude them
[33:24] from being an active participant. So,
[33:27] that member would like to be excused and
[33:29] that'll be four members that need to be
[33:31] replaced. Now, I don't have any
[33:32] suggestions for you this evening. The
[33:34] CEO board discussed some folks in their
[33:36] last meeting. Um, I think we still need
[33:39] to met those out according to how they'd
[33:41] like to. Uh, I will tell you that Brian
[33:44] Carver, formerly with Bragg, now with
[33:46] JUB Engineering, has been the vice chair
[33:48] for the last couple of years, while
[33:50] Councilman Mark Herd has been the chair.
[33:52] He now is the chair, and they're waiting
[33:54] to assign a vice chair until we get
[33:56] those other seats occupied with folks.
[33:59] um for the time being because of the
[34:01] quantity of folks that you've had on
[34:02] that board, we can still operate and
[34:04] still have uh enough that meet the state
[34:07] requirements, you've had in excess of
[34:10] those five minimum seats. So, um you now
[34:13] have five seats with the four vacancies.
[34:16] They've also as part of those
[34:17] administrative rules updated that the
[34:19] terms are no longer two years, they are
[34:20] four years. And so, I will come before
[34:23] you uh before long. I'd like to do it in
[34:26] the next month if you would permit. uh
[34:29] come before you with some names for your
[34:30] consideration and approval and thereby
[34:34] reestablished a staggered times and
[34:36] terms so that some would end uh you know
[34:40] two years in between the others. Uh any
[34:43] questions on those or any input for me
[34:46] or the CEO or board members to consider
[34:48] for membership? Um, you know what, Sean?
[34:51] I think it might be helpful if you sent
[34:52] us a list of the current makeup of what
[34:55] board members are left so that we could
[34:57] say, "Oh, I think I have a suggestion."
[34:59] >> Perfect.
[34:59] >> For someone else, that would might be
[35:00] helpful.
[35:01] >> You okay if I send you the primer from
[35:03] the state as well as to what those five
[35:05] minimum seats need to have as a
[35:07] perspective? Perfect.
[35:08] >> Yeah. Send it to Andrew and he'll get it
[35:10] to us.
[35:10] >> We'll do. [snorts]
[35:12] Okay. So, then I come back. Um, oh, one
[35:14] of the other administrative rules. I say
[35:16] O as though it was an afterthought, but
[35:18] it's kind of a big one. They want to
[35:19] make make sure that there's a formalized
[35:20] contract. What we've had is an open
[35:23] transparent process here in these public
[35:25] meetings since this grant was
[35:26] established a number of years ago in
[35:29] 2020. But now GOED would like to see
[35:31] that actually codified. And so I would
[35:34] like to work with attorney uh Dane
[35:36] Murray to put together at least a
[35:39] rudimentary contract that addresses
[35:40] things that I believe well I know some
[35:42] of you and I don't know if all of you
[35:44] saw certainly council members uh Keegan
[35:47] Mark and I believe executive Danes may
[35:49] have received an email from James Dixon
[35:52] about six or eight weeks ago that noted
[35:54] what some of those expectations are to
[35:56] be in a contract. Overarchingly you need
[35:58] to have an objective. what is it that
[35:59] you want to accomplish from economic
[36:01] development goals for the county and
[36:03] then what are some metrics to make sure
[36:05] that you're holding me accountable in
[36:07] this function that I serve for you. So
[36:09] we will need to have that adopted and as
[36:11] part of the application that gets
[36:12] submitted September one as well. So with
[36:15] your permission I'd like to reach out to
[36:18] attorney Danes and get something like
[36:20] that put together for your review.
[36:23] Okay. Then the last element are just
[36:25] some future recommendations that the CEO
[36:27] board has suggested um that you know
[36:31] again they're an advisory board to you.
[36:33] have the ultimate authority in what
[36:35] I uh submit on your behalf in the
[36:37] application for each year's annual
[36:39] funding.
[36:40] uh some of those and I'll read them
[36:42] aloud here for the benefit of the audio
[36:44] recording. Following an update of the
[36:46] strategic plan, renew the living on edge
[36:48] marketing or branding campaign that was
[36:50] engaged some 10 years ago roughly.
[36:53] >> I think it was called Logan on the Edge.
[36:55] >> Oh, Logan on the edge. Okay.
[36:57] >> Yeah. Probably has a very different
[36:58] meaning than living on the edge. Um all
[37:01] right. The second one is study of
[37:03] economic impact of specifically league
[37:05] sports and outdoor recreation. I noticed
[37:07] that you have an agenda item related to
[37:09] recreation centers this evening. I say
[37:11] nothing more, but you know there is a
[37:13] significant um tourism aspect to league
[37:17] sports if you have the facilities for it
[37:19] and the season. The third one is
[37:21] continued progress on furthering the
[37:23] airport upgrades which you've seen last
[37:25] year and this year. Next one is
[37:27] horizontal up infrastructure or capital
[37:29] improvements. This would be akin to like
[37:31] extending water, sewer, uh broadband,
[37:34] electricity, things of that nature that
[37:37] might make bare ground or green field
[37:40] attractive to commercial investment. The
[37:43] next one, small business or
[37:45] entrepreneurial revolving loan funds to
[37:47] recapitalize those payments. Uh some
[37:50] folks might know this is like a micro
[37:51] fund, a microloan fund. uh there's a way
[37:54] that uh payments could also become
[37:57] future principal to then loan out again
[37:59] in the future and kind of repeat the
[38:01] cycle. This would go along with what
[38:03] chair Sandy mentioned about
[38:04] entrepreneurial support. And then the
[38:07] last one is targeted corporate
[38:08] recruitment campaign. So like Logan on
[38:10] the edge, but this one is are there
[38:12] particular industries that you would
[38:14] like me to go out and specifically go
[38:16] target and woo to Cash County? Maybe
[38:19] it's food processing, value ad
[38:21] processing, or something of that nature.
[38:23] >> Trader Joe's.
[38:24] >> Say again.
[38:24] >> Trader Joe's.
[38:26] >> Got Costco. Got Target. You know, it's
[38:28] the next one in the cross.
[38:30] >> Sorry.
[38:31] >> No. No. It
[38:32] >> maybe the last text you received for me
[38:35] or text.
[38:35] >> Yep. Yep. Uh, very fair. We do have some
[38:39] challenging um demographics for
[38:42] discretionary spending per household for
[38:44] Trader Joe's. We don't.
[38:45] >> But I don't think it's What's that?
[38:47] >> We don't. just make it happen.
[38:49] >> Okay. Noted. And ma'am, yes, ma'am. Uh
[38:53] so it would be things of that nature. Uh
[38:56] one that's coming up as an example. I'm
[38:58] not scheduled to go to it or attend it.
[39:00] Um but it's a manufacturing conference
[39:03] that's advanced manufacturing in
[39:04] Chicago. Happens every other year. You
[39:07] might, for example, decide that that's
[39:09] something you want me to try to get
[39:11] particular companies that the CEO board
[39:13] and others uh could help vet and be
[39:16] like, "Okay, they're expected to be
[39:17] there. Want you to go make an
[39:18] introduction given the metrics, uh,
[39:21] demographics, um, you know, supply chain
[39:24] elements of our community and tell them
[39:26] that we'd really like them to be here."
[39:28] So, that's that. That's the annual
[39:30] report. Um, council members, I really
[39:32] appreciate again the time to to give
[39:33] this to you each year and to take away
[39:36] from you uh your guidance and how you
[39:38] might want me to start working on an
[39:40] application between now and the next
[39:42] meeting before you. So, I welcome any of
[39:44] that feedback at this time.
[39:46] >> So, back to the the the three that you
[39:50] want us to approve that so that you can
[39:52] put that in the application or give you
[39:54] a different idea if we have one.
[39:56] >> Yes, ma'am.
[39:56] >> Okay, perfect. And we need to do that by
[39:59] a vote, a legislative vote. Okay. I'm
[40:03] always not sure. Okay. Does anyone have
[40:06] some ideas or discussions about that? Do
[40:08] we want to um wait two weeks to do it?
[40:11] Um think about it. You want to give that
[40:13] some more thought or is someone ready to
[40:14] make a motion
[40:16] discussion?
[40:17] >> Two weeks would be good because he's
[40:19] going to come up with a contract, right?
[40:22] >> Oh, I don't know if they'll have it in
[40:23] two weeks, but
[40:24] >> Well, two weeks will help. Yeah,
[40:26] >> that's all I'd recommend.
[40:28] [clears throat]
[40:29] >> Okay,
[40:31] we can certainly continue it. This is
[40:32] the first time we've um looked at this.
[40:35] >> Great.
[40:36] >> And I'll see what kind of work I can do
[40:38] with Trader Joe's. And then
[40:40] >> you've got two weeks.
[40:42] >> Okay.
[40:43] >> Thank you very much.
[40:44] >> Thank you, Sean. I appreciate it. Okay.
[40:46] It is a little past 5:30. I think we
[40:48] need to do our public hearings. Um,
[40:52] someone like to make a motion on 7A.
[40:57] » Yeah. I move to set the public hearing
[41:01] for August 11th, 2026 at or about 5:30
[41:04] for ordinance 2026-33
[41:08] square footage exemption for
[41:09] geotechnical reports. 2026 COG project
[41:13] 20200 East 2026 COD project Wolfpack Way
[41:18] from 400 North in Hyde Park to 4700
[41:21] North 2026 COD project 600 South from
[41:24] 600 east to 1,000 east in River Heights.
[41:28] 2026 COG project 200 West corridor and
[41:31] 300 South roundabout safety improvement
[41:34] in Providence City. 2026 COG project 300
[41:38] South Safety Improvements in Providence
[41:39] City and 2026 COG project 1200 East
[41:43] North End project.
[41:46] >> Thank you. Do I get a second on that?
[41:48] Okay. It's been moved and seconded that
[41:49] we set those public hearings for August
[41:51] 11th that have been um read to us. Um is
[41:55] there any further discussion about that?
[41:59] >> Those in favor say I.
[42:00] >> I. Any opposed?
[42:02] >> Okay. We have one public hearing tonight
[42:04] for resolution 2026-24,
[42:07] opening amending the Cash County 2026
[42:10] budget fifth amendment.
[42:14] Um Matt, do you want to
[42:19] come and be?
[42:22] Uh yeah, Matthew Funk again, Cash County
[42:24] Auditor. Um counties, uh our off our
[42:28] office is uh before you at the behest of
[42:30] uh the appropriations committee. We have
[42:33] um let's see 14 items last I think one
[42:37] that's going to get struck. Um uh are
[42:41] there any questions that I can answer
[42:42] for you or answer for the public at this
[42:44] time in the public hearing?
[42:47] >> I think we can open it up to the public.
[42:49] >> Very good.
[42:50] >> Okay. Is there anyone here from the
[42:51] public that would like to speak at this
[42:53] hearing about our budget opening?
[42:56] This would be the time.
[43:00] Okay. Someone will make a motion to
[43:01] >> close public hearing.
[43:03] >> Second.
[43:03] >> It's been moved and seconded that we
[43:04] close public hearing. Those in favor say
[43:06] I.
[43:07] >> I. Any opposed.
[43:09] Okay. So now we can go back to our
[43:11] presentation from Jason Slight.
[43:14] >> Is it Slight or Slate?
[43:16] >> Slight.
[43:18] >> I'll say it different every time. I'm
[43:21] sorry.
[43:22] >> My name is Jason Slight. I'm an audit
[43:24] partner with Jones Simpkins. Uh we'll go
[43:26] over the audit quickly tonight. Um, our
[43:29] firm based here in Logan, Utah, just
[43:30] about a mile west of here, had the
[43:32] opportunity to work with the county on
[43:34] its uh, financial statement audit again
[43:36] this year. I presented it um, two weeks
[43:39] ago to the audit committee. We had a
[43:40] lengthy discussion about um, various
[43:44] information in your financial
[43:45] statements, how the county did, and the
[43:47] reports that we issued today. I'll just
[43:48] go over those reports really quickly.
[43:51] Um, we issue four reports in a
[43:53] governmental audit in in this case at
[43:55] least. Uh the first is found on page
[43:57] one. Uh it's a auditor's report that
[44:01] includes our opinion um regarding the
[44:04] fairness of the presentation of the
[44:06] financial statements, the information in
[44:07] the financial statements. Um that
[44:10] opinion is across all opinion units. The
[44:12] county has multiple opinion units. Um
[44:14] these financial statements include
[44:17] um 20 separate funds um which are a set
[44:21] of self-balancing accounts. There's your
[44:22] general fund, CCC CCCOG fund, and then
[44:26] several non- major funds. There's um
[44:30] >> two custodial funds that are included.
[44:32] Um there's your entitywide governmental
[44:34] activities, and then your aggreate
[44:37] aggregate discreetly presented component
[44:38] units, which is which consists of three
[44:40] component units, the health department,
[44:41] the airport, and the NPIC. So that first
[44:45] report on page one encompasses all of
[44:49] those opinion units. And as you can see
[44:51] in in the very first second paragraph of
[44:54] page one, we issue an opinion that these
[44:56] financial statements are presented in
[44:58] accordance with generally accepted
[44:59] accounting principles. That's based on
[45:01] the audit that we performed in
[45:03] accordance with generally accepted
[45:04] auditing standards which include
[45:06] performing risk assessments. Uh focusing
[45:09] on the riskiest areas. Um we'll use
[45:11] sampling approaches to less risky areas
[45:14] or to smaller areas. Uh we'll look at uh
[45:17] supporting documentation for your larger
[45:19] more significant risky items. Um we also
[45:23] look at the county's design of its
[45:25] internal controls, the functionality of
[45:26] those controls, whether or not we see
[45:28] any deficiencies or weakness in the
[45:30] controls or in the design or function of
[45:32] those controls um and u and then and
[45:38] then report based on materiality. Uh
[45:40] materiality is um an interesting term
[45:44] but basically what it means is if
[45:46] something is being omitted from these
[45:47] financial statements and a reasonable
[45:49] user of the financial statements were to
[45:51] change their opinion um based on the
[45:55] understanding that something was omitted
[45:57] that would be considered material. Um
[46:01] as of as I mentioned earlier we didn't
[46:03] identify anything that would be
[46:04] considered material that's been omitted
[46:06] from these financial statements. So
[46:08] that's the first uh auditor's report.
[46:09] The second one is um on page 104
[46:14] um which is a report that's issued in
[46:17] accordance with governmental accounting
[46:19] standards or governmental auditing
[46:20] standards [clears throat]
[46:22] um where we we will let you know if we
[46:24] identified any weaknesses or
[46:25] deficiencies in your controls or any
[46:28] non-compliance with grants or other
[46:30] agreements um throughout our audit
[46:33] process. And I'll get to that later, but
[46:35] I just quickly we did not have any
[46:36] findings this year and I I'll highlight
[46:38] that in a little bit. Um the third
[46:40] report is um on page 106. It's a report
[46:45] regarding the county's compliance with
[46:48] um specific federal audit compliance
[46:51] requirements um associated with federal
[46:54] expenditures. Um when the county spends
[46:56] more than a million dollars in federal
[46:58] funds, it's required to have what's
[46:59] called a single audit in accordance with
[47:02] the uniform guidance which which is
[47:03] issued by the Office of Management and
[47:05] Budget or the White House. Um, we are
[47:09] required to test 40% of your federal
[47:12] expenditures. You have 14 million in
[47:14] federal expenditures across all units
[47:16] this year. Um, we tested three programs
[47:20] actually all at the health department
[47:22] this year. Um, and we have no findings
[47:24] related to those. Those were uh the WIC
[47:26] program, substance abuse, and an um
[47:29] epidemiology grant. And then finally on
[47:32] page um 113, the state of Utah requires
[47:35] us to test the county's compliance with
[47:38] various compliance requirements and
[47:40] statutes, various state law items. Um
[47:44] those there are certain requirements
[47:46] that we test every year like your
[47:48] budget. Are you are you passing a
[47:50] budget? Are you passing amendments
[47:52] appropriately? Are your expenditures
[47:54] exceeding your budget? Things like that.
[47:56] Um and then certain things that rotate
[47:58] um whether or not your cash management
[48:01] process is is appropriate. Um we have no
[48:04] findings with with that um state
[48:06] compliance um requirement. Um if you'll
[48:09] turn to page 109, it's basically a
[48:12] summary of what it's it's called the
[48:14] schedule of findings of end question
[48:15] costs. Um it's basically a summary of
[48:17] what I just went over and all the
[48:20] different um
[48:22] uh reports that we've issued. It lets
[48:24] you know that we've um issued unmodified
[48:27] opinion on your financial statements and
[48:29] that we've identified no no um
[48:32] weaknesses that would be considered
[48:34] material weaknesses in your internal
[48:35] controls or in your controls over
[48:38] compliance with your federal programs
[48:40] and we haven't identified any
[48:41] significant deficiencies. Um that's an
[48:44] improvement from last year. Last year we
[48:45] had one material weakness and one
[48:46] significant deficiency. Um, I mentioned
[48:50] this in our audit committee meeting, but
[48:52] the county's policies and procedures
[48:53] have always been really well written and and in really good shape. Um, the
[48:58] material weaknesses and deficiencies
[48:59] have been because of a significant or
[49:02] material adjustments that were required
[49:03] to bring these financial statements to a
[49:06] material correct position. Um, those adjustments weren't required this
[49:09] year and I attribute a lot of that to
[49:12] your your team. We work a lot with Matt,
[49:14] Britney, um, in the finance department,
[49:17] um, and then Craig in the treasur's
[49:18] office and then several other groups
[49:20] within throughout the county. Um, but we didn't have any significant
[49:25] adjustments this year. Um, and uh, I
[49:30] think a lot of it was was attributed to
[49:32] just turnover that was happening.
[49:34] There's been quite a bit of turnover the
[49:36] last few years, some changes um, in in
[49:38] how the uh, county has approached its
[49:40] financial reporting.
[49:42] um the roles and um so I think that was
[49:46] what was causing most of it, but your
[49:48] policies and procedures have always been
[49:49] good and so no findings there this year.
[49:52] Um and I think I'll leave it at that as
[49:55] far as the highlights of how the county
[49:57] did county had a good year. Um, when you
[50:00] look at the county as a whole and you
[50:02] include all of its assets and its
[50:03] liabilities, including like its capital
[50:05] assets, which would be like roads,
[50:06] buildings, and things like that, you
[50:08] added $3 million roughly to the bottom
[50:10] line. Um, from like a budget basis, um,
[50:14] were more break even. So, your your
[50:17] expenditures pretty much matched the
[50:19] revenues that came in if you're looking
[50:21] at it more like a cash basis or or a
[50:23] budget basis. So, um, uh, property taxes
[50:27] and and sales taxes were pretty big
[50:30] increases this year, but you had
[50:31] expenses go up as well. Um, open space
[50:34] purchases, things like that. So, all the
[50:37] break even year from a budget
[50:38] perspective.
[50:42] » Any questions for me?
[50:43] >> I I have some questions.
[50:44] >> Okay. Did you go to page 81?
[50:53] I was what I was interested in is
[50:56] comparing our budget to the original
[50:59] budget, then the final budget, and then
[51:01] the actual
[51:03] >> and then the variance.
[51:05] Um I I think I understand what those
[51:08] terms mean. Um
[51:11] but the substance of it is is we
[51:14] projected that we would in our final
[51:18] budget for 2025
[51:22] we would show a loss of 5,189.
[51:26] >> Mhm. But but this reports that our
[51:30] actual was not a loss but a gain of 929
[51:35] increasing our fund balance by 929,000.
[51:40] Correct.
[51:40] >> Is that correct?
[51:41] >> Yeah, that's within the general fund
[51:43] only.
[51:43] >> Okay. What I don't understand is is some
[51:46] math. I can't I can't make the numbers
[51:50] seem to get there. Let me start with the
[51:52] one in change in fund balance. If we
[51:55] have a negative 5189, we go to a
[51:59] positive 929.
[52:02] You show a difference of 4,114.
[52:06] I don't see how that correct. It would
[52:08] be larger than that.
[52:11] >> I could see that. Yes, it might be a formula. And then the the preceding
[52:18] line which [snorts] says uh total other
[52:22] funding sources that 476 also seems to
[52:26] me to be in error.
[52:29] >> Okay, I can look into that and see.
[52:31] >> And then the preceding line total
[52:33] transfer out seems to be an error as
[52:37] well.
[52:39] And I I don't I mean I'm I just want the
[52:44] numbers so we know where we are. And I
[52:46] don't know whether the 929's wrong or
[52:49] which of these is right or wrong, but
[52:52] the math doesn't work in the bottom part
[52:55] of that sheet.
[52:56] >> The 929 is not incorrect. The final
[52:59] budget column is not incorrect. It looks
[53:01] like it's a it's a u formula issue in
[53:04] the variance column.
[53:06] Well, I I thought that too, but when I
[53:10] look at total transfer in of 2,445,
[53:14] total transfer out of 13
[53:19] 213, and then a negative 10611.
[53:24] >> That's the sum of the net of those two
[53:26] is the 10611.
[53:27] >> Pardon me.
[53:28] >> The net of those two numbers is the
[53:30] 10611.
[53:35] Why?
[53:36] I I don't think my calculator will agree
[53:39] with you on that
[53:41] >> of the 132 and the 24.
[53:44] >> Yeah, I don't don't think that's
[53:45] correct.
[53:46] >> It's also going to include the 156 up
[53:48] above. Pardon me.
[53:49] >> It's also going to include the 156,000
[53:51] up above the
[53:52] >> Okay, so that would explain that
[53:54] differential there.
[54:00] [snorts]
[54:02] Maybe it does, but I I'd like you to
[54:06] correct that page if you would. So I it
[54:09] for my purposes in figuring out where we
[54:11] are financially
[54:13] because I'm in the middle of the um 26
[54:17] budget and I want to know where we were
[54:19] last year and I you got to get that math
[54:22] correct on that. So you want to just
[54:25] substitute a page for that when you run
[54:28] those calculations again, please?
[54:30] >> Yep.
[54:35] Thank you.
[54:36] >> You bet. Any other questions?
[54:40] >> Anybody have questions for Jason?
[54:44] >> Okay. Thank you so much. We appreciate
[54:46] >> all your hard work.
[54:49] >> Okay.
[54:51] Um, we need to take a take a vote on
[54:55] this. Um, do we want to hold off on that
[54:58] until we get that page corrected?
[55:01] I I think it's just math. I think if if
[55:04] the 929's correct, I don't think the
[55:07] variance numbers are significant. Do you
[55:10] I don't I don't
[55:11] >> supplementary information. So, no, it
[55:14] doesn't.
[55:15] >> As long as the 929 is correct, I think I
[55:19] think you should go ahead and approve
[55:20] it. Would you I don't see any reason not
[55:22] to approve the audit. I read it.
[55:25] Excellent audit. Most of it is just
[55:29] >> Okay. Does someone want to make a motion
[55:31] on that?
[55:33] >> I move that we accept the 2025 annual
[55:36] external audit report as presented by
[55:39] Joan Sim Simkins.
[55:41] >> I'll second.
[55:41] >> So we moved and seconded that we accept
[55:43] the presentation of the 2025 external
[55:46] audit. Is there any further discussion?
[55:49] Those in favor say I.
[55:51] >> I.
[55:51] >> Any opposed? Okay. Thank you. All right.
[55:58] The next is 6E. That would be our
[56:02] executive.
[56:03] >> Okay. Do you want me to address you from
[56:05] this seat or do you want me to address
[56:07] you from the podium? I think it's going
[56:09] to be a 10 or 15 minute back and forth
[56:12] on this.
[56:12] >> I think the podium might be easier for
[56:14] those at home to hear and for us to so
[56:17] we're not all looking straight across.
[56:19] Okay.
[56:19] >> Is that okay with all of you guys?
[56:21] >> Yeah.
[56:24] >> [clears throat]
[56:35] » George Danes, County Executive. Um, I've
[56:39] kind of found myself in the role of
[56:42] assisting the
[56:45] fire board and the county council with
[56:47] their uh effort to create the fire
[56:51] district and to move forward. Um,
[56:54] there's a number of subjects that are
[56:56] all in active consideration and I I
[56:59] think if I walk through them in the list
[57:01] that there's there. First of all, the
[57:03] fire district status and the board. Um,
[57:09] in the course of trying to
[57:12] uh amend the bylaws,
[57:17] we went back and forth about issues of
[57:20] selection of the board members. Um,
[57:24] there was some turmoil. Um, Amy Hugi
[57:27] resigned. We um asked attorney Mark
[57:32] Anderson, who's experienced with to pick
[57:36] it up and and my directions and request
[57:39] was that he go back to the beginning and
[57:41] see what we needed to do to fix the
[57:44] fireboard. His initial report to me was
[57:47] we we have a fundamental problem with
[57:50] the way the fireboard
[57:53] is organized. The statute requires
[57:58] an appointment process for all fireboard
[58:01] members. What we had allowed to happen
[58:05] uh was that for example when a mayor was
[58:09] replaced by a new mayor, we just assumed
[58:12] that the new mayor became the
[58:14] replacement on that. So that
[58:18] disqualified two of our board members.
[58:22] uh Lindseay Peterson's selection didn't
[58:25] follow the statutory rules either. So
[58:29] because of those problems, his
[58:32] recommendation to me was that we
[58:36] reconstitute the board and we go through
[58:38] the process of selecting the board
[58:42] members again because you can't pass
[58:46] bylaws without the board being in place.
[58:50] So that's that's the fundamental. So we
[58:52] have to kind of start over. Um the
[58:56] process and I appreciate Andrew helping
[58:59] me with this. The process for
[59:01] appointment the board is set out in the
[59:03] statute and it requires that you
[59:06] advertise for 30 days.
[59:09] And so to get a jump on that process,
[59:14] we have started the advertising as of
[59:18] >> Friday. Friday and we put out a request
[59:23] um for
[59:25] uh people to apply to that board.
[59:29] The way that will then work is I will
[59:32] make u
[59:34] a proposed set of appointments to the
[59:37] county council and the county council
[59:40] with with the advice with your advice
[59:43] and consent then I will appoint members.
[59:45] we'd have to hold the period open for 30
[59:48] days. So until that time, we don't have
[59:52] a board that can take action. The two
[59:56] county council members who are members
[59:59] of the board, Dave Ericson and Katherine
[1:00:02] Bu do not need to go through that
[1:00:04] process.
[1:00:06] So they they are appropriate board
[1:00:09] members. Um I believe that Larry
[1:00:12] Jacobson would also be u went through
[1:00:16] the correct process and so he's also an
[1:00:19] appropriate board member. But rather
[1:00:22] than worry about that
[1:00:26] what we've done is requested that uh
[1:00:30] people apply and so I will come back at
[1:00:33] the end of 30 days with a proposal to
[1:00:37] make appointment. It is my intent,
[1:00:41] not a decision, but it's my intent to
[1:00:44] ask the mayors who have been serving and
[1:00:47] who were elected to those positions to
[1:00:50] serve on the fire board. Um, and the
[1:00:54] fireboard group has suggested that we
[1:00:58] enlarge the number of mayors and so I
[1:01:02] will come back with a list that matches
[1:01:05] what they had proposed in their bylaws,
[1:01:08] but the bylaws will have to be approved
[1:01:11] after we have legal appointments to the
[1:01:13] board.
[1:01:15] So, any questions about that? You
[1:01:18] enlarge the enlarge the number of
[1:01:22] members,
[1:01:23] but we are not specifically advertising
[1:01:26] just for mayors.
[1:01:28] >> Right.
[1:01:28] >> Okay.
[1:01:29] >> Yeah. What what I'm hopeful, Dave, is
[1:01:33] that we'll get um
[1:01:37] applicants that would fill the slots
[1:01:41] by city and by um district. and that we
[1:01:47] can then appoint from that. Uh I'm
[1:01:50] actively recruiting mayors to file
[1:01:54] applications
[1:01:55] and um but that will be my decision and
[1:02:00] yours when we have our full list of
[1:02:02] applicants.
[1:02:03] Um I at this point I know I have four
[1:02:06] applicants which is um
[1:02:10] >> I would not don't disclose those yet.
[1:02:12] >> Okay. All right. Anyway, I have four
[1:02:15] applicants at this point.
[1:02:17] the the budget
[1:02:20] >> the budget awaits the the appointment of
[1:02:23] the fire board. Um
[1:02:26] >> George, may I? So, first is the
[1:02:29] appointment of the fire board, then the
[1:02:31] approval of the bylaws from this body.
[1:02:34] >> Well, um actually it's the fire board
[1:02:37] that will approve the
[1:02:38] >> Okay. Okay. And so we this body does not
[1:02:40] need to approve the bylaws.
[1:02:41] >> Yeah. I I think what we'll do is we'll
[1:02:43] show you the bylaws to to get your
[1:02:46] commentary about them, but the bylaws
[1:02:48] are typically done by the organization
[1:02:51] whose bylaws they are.
[1:02:54] >> Okay.
[1:02:55] >> So, how many board members do you need?
[1:02:58] >> Well,
[1:02:59] >> you have a number.
[1:03:00] >> The proposal is 11, but that again is
[1:03:04] for the board to decide how many. Um,
[1:03:09] I will make u
[1:03:13] a recommendation
[1:03:16] for the number that would accumulate to
[1:03:19] a total of 11 because that's what I
[1:03:22] anticipate the bylaws will be. But until
[1:03:25] the bylaws are passed, I'm kind of
[1:03:30] chicken or the egg sort of a situation.
[1:03:32] Joanne,
[1:03:33] >> what's the minimum number right now?
[1:03:35] >> Pardon me. What's the minimum number
[1:03:37] right now?
[1:03:40] >> Isn't it three?
[1:03:41] >> Three.
[1:03:41] >> There isn't a minimum number in the
[1:03:43] state statute. There neither a minimum
[1:03:46] nor a maximum in the state statute.
[1:03:49] >> But if we go back to our original
[1:03:50] bylaws, it's the three members.
[1:03:53] >> Yeah. I mean, you you could go back to
[1:03:55] that three or you could um Anyway,
[1:03:59] that's that's to be dealt with later.
[1:04:03] And we do have three right now at least
[1:04:05] because you mentioned Dave, Katherine,
[1:04:06] and Larry.
[1:04:07] >> The executive and the executive.
[1:04:09] >> Oh, so four.
[1:04:10] >> No. Yeah.
[1:04:11] >> Or the bonafide ones right now.
[1:04:13] >> I think so.
[1:04:15] >> Okay.
[1:04:18] Okay, with respect to the budget, of the current county fire department
[1:04:28] would would be the budget for the
[1:04:31] remainder of this year. They will set a
[1:04:34] new budget for when the fire district
[1:04:37] takes over the county fire department,
[1:04:40] which we anticipate could be as early as
[1:04:44] October or as late as sometime next
[1:04:46] year. But until that time, the county
[1:04:49] fire budget will govern their budget.
[1:04:54] Um, the levy, provided we get a legal
[1:04:59] board appointed
[1:05:01] by the August September period, they
[1:05:04] will be in a position to set the levy
[1:05:06] for the 2027 tax year. We're we're our
[1:05:12] schedule is such that unless there is a
[1:05:14] problem, we think we will make that
[1:05:17] standard. [clears throat] And right now
[1:05:21] the U north committee and the south
[1:05:24] steering committees are working to work
[1:05:27] on that budget. They're they're meeting
[1:05:30] and they're actively involved in doing
[1:05:32] it. We haven't stopped the process while
[1:05:35] we get this board problem straightened
[1:05:37] out. But um I spent
[1:05:42] six hours beginning at 9:00 until about
[1:05:45] 2:30 today working with the south
[1:05:47] committee. That's the third or fourth
[1:05:49] meeting I've attended there. I've I've
[1:05:52] also attended meetings in the north. So
[1:05:55] they're actively working on their budget
[1:05:59] on what the levy will be, what personnel
[1:06:02] are needed. Uh, Chief George has been
[1:06:05] involved with that and been very helpful
[1:06:07] to everyone and I must say he's he's
[1:06:11] done a very good job of providing
[1:06:13] information that's helping them decide
[1:06:16] how the fire district would operate and
[1:06:19] what the alternatives are.
[1:06:23] Um, it it also says establishment of a
[1:06:27] county municipal services tax. Let me
[1:06:29] explain what we're talking about there.
[1:06:33] Um,
[1:06:34] right now
[1:06:37] the fire district or the county fire
[1:06:40] department covers all of Cash County
[1:06:44] outside of Logan. Now, some of the
[1:06:46] cities have contracted to provide
[1:06:49] services to obtain their services from
[1:06:52] Logan City or other cities, but the fact
[1:06:55] the matter is is everything outside of
[1:06:57] Logan is um
[1:07:01] involved in the fire district. But
[1:07:04] there's a there's a taxation problem in
[1:07:07] that if you're in a city, you're paying
[1:07:11] taxes to the city for your municipal
[1:07:14] fire department and you're paying a
[1:07:17] county um taxes for the county fire
[1:07:21] department. So there's there's two
[1:07:23] levels of taxation
[1:07:25] that are occurring. But if you're in the
[1:07:28] unincorporated area, you're not paying
[1:07:31] the same amount that a person in the
[1:07:33] city is, but you're receiving the same
[1:07:35] service.
[1:07:37] So for example, if you live within the
[1:07:40] boundaries of Mend City, you're paying
[1:07:44] um Mend City uh 400 mil, 300 mil,
[1:07:50] something like that on your property
[1:07:52] taxes that would go and you're also
[1:07:54] paying an assessment with your water
[1:07:56] bill every month for fire and EMS
[1:08:00] service.
[1:08:05] But residents of Manden city are also
[1:08:08] paying the county tax. People who live
[1:08:12] right outside the boundary of Mendon are
[1:08:15] paying the county but not paying
[1:08:17] anything toward the city. But the city
[1:08:19] covers both areas equally.
[1:08:23] So that's that's a problem. And what
[1:08:26] we're proposing is that the county levy
[1:08:30] a municipal services tax that's roughly
[1:08:34] equivalent to what citizens inside the
[1:08:38] city pay for fire service.
[1:08:43] So so that it would equalize between the
[1:08:46] incorporated and the unincorporated
[1:08:48] areas. So that if you're in the Mend
[1:08:51] fire area, which includes both Mend City
[1:08:55] and the area around Menden, you'd pay
[1:08:59] roughly the same amount. Not exactly,
[1:09:02] but roughly the same amount. The same
[1:09:04] thing would be uh around Paradise. If
[1:09:09] the same situation exists there, there
[1:09:12] are more citizens in the Mend fire area
[1:09:15] that live outside of Mendon than live in
[1:09:18] Mendon. But Mendon serves the whole
[1:09:21] group equally. Same thing with Paradise.
[1:09:25] Same thing with your area Nolan is
[1:09:28] you're covered by either Wellsville or
[1:09:31] High. Same situation. So what we would
[1:09:34] do with the municipal services tax is we
[1:09:37] would take the unincorporated area and
[1:09:40] levy a tax that's roughly equivalent to
[1:09:43] what you would pay if you were within a
[1:09:45] city. Now we'll determine
[1:09:48] the council will determine what level of
[1:09:51] that is but that gives us a mechanism to
[1:09:54] equalize the two groups.
[1:09:57] Any questions about that?
[1:10:05] Okay. Anything else that you have
[1:10:07] questions or you'd like to ask about
[1:10:09] what we're doing? U I should just say
[1:10:12] that um again, Chief George is providing
[1:10:16] is a is a primary source of information
[1:10:19] about alternatives and how it's being
[1:10:22] run. Um, both areas of the county are
[1:10:27] working on it and I think they'll have
[1:10:30] proposals ready
[1:10:32] um in late August, early September and
[1:10:36] you're you're going to get a chance to
[1:10:39] look at all of that before it goes into
[1:10:41] effect.
[1:10:44] So do you anticipate this will be an
[1:10:48] increase for the citizens like in Mendon
[1:10:51] or outside of Mendon or will it be a
[1:10:55] decrease?
[1:10:56] >> It it depends on on the level of fire
[1:10:59] service they want. Our rough
[1:11:02] calculations
[1:11:04] are that it will be pretty close to the
[1:11:07] same but the revenue will be
[1:11:10] reallocated. That is the the amount of
[1:11:12] money we spend on fire will be roughly
[1:11:15] the same the total dollar spent but it
[1:11:19] will be reallocated
[1:11:21] be between who's paying it. For example,
[1:11:25] I have a property in Logan City
[1:11:30] and another property that's in Cash
[1:11:32] County. I just got my notice of
[1:11:34] valuation
[1:11:36] on my Cash County uh
[1:11:40] notice. I have a thing called the Cash
[1:11:43] County Fire Fund.
[1:11:45] That fund doesn't exist on my Logan
[1:11:47] City. So that
[1:11:51] >> it's kind of hard to equate it. Right.
[1:11:53] >> Right. But but it isn't that the county
[1:11:56] has increased the bill, but they're no
[1:11:59] longer charging Logan for county fire
[1:12:01] service. So the the same dollars are
[1:12:04] being spent, but they're going to be
[1:12:06] reallocated. That's also true to some
[1:12:08] extent in the unincorporated area, which
[1:12:12] has underpaid compared to the cities
[1:12:15] outside of Logan. So there's going to be
[1:12:18] reallocation. So there people are going
[1:12:21] to see differences in their property
[1:12:23] taxes because of this. Um,
[1:12:28] my cash county general fund has gone
[1:12:32] down. That is what I pay
[1:12:36] to the cash county general fund has gone
[1:12:40] down because you've separated the fire
[1:12:43] to just the unincorporated. So, one has
[1:12:45] gone down and one has gone up. Joanne,
[1:12:49] >> if you only have land in the county and
[1:12:52] it's in the unincorporated area, you're
[1:12:53] going to see a pretty good tax increase.
[1:12:56] >> If you're in a city which has been
[1:12:59] >> supporting a regular fire department, I
[1:13:02] don't know that it'll change that much,
[1:13:05] but it just depends.
[1:13:06] >> But it doesn't specify how much is going
[1:13:09] to fire in the Logan City one, right? It has the amount of our county fire
[1:13:15] budget is set right in the tax notice at
[1:13:19] 3,99370.
[1:13:22] That's that's that's
[1:13:24] what has been allocated to the Cash
[1:13:28] County Fire Fund.
[1:13:29] >> Or did you mean in Logan City? What
[1:13:31] percentage of our taxes are being
[1:13:33] allocated specifically to fire services?
[1:13:35] if it indicated or if it's a lump sum
[1:13:38] including other things or if the fire is
[1:13:41] separated on your bill so that you know
[1:13:44] how much.
[1:13:45] >> Yeah, there's a specific line that says
[1:13:47] >> Okay,
[1:13:48] >> Cash County Fire Fund and my my
[1:13:53] assessment
[1:13:54] for the general fund of Cash County has
[1:13:57] gone down.
[1:13:59] Okay,
[1:14:02] >> I just need some clarity. You mentioned
[1:14:04] that we would decide the tax that's in
[1:14:07] the unincorporated,
[1:14:10] but where does the district decide that?
[1:14:12] Is that
[1:14:13] >> Can you well clarify between the two,
[1:14:16] the fire district and the council?
[1:14:17] >> Yeah. Yeah, I will. The um the cities
[1:14:22] decide what they're going to tax their
[1:14:24] citizens for fire. We're going to make
[1:14:27] the same decision for the unincorporated
[1:14:30] area, but it will it will be just that
[1:14:34] slice that is roughly equivalent to what
[1:14:37] the cities are doing. But then the
[1:14:40] entire unincorporate or the entire area
[1:14:43] outside of Logan is taxed on the fire
[1:14:46] district. The fire district includes the
[1:14:49] cities and the unincorporated area where
[1:14:52] our municipal services levy if you
[1:14:55] choose to do this will only include the
[1:14:58] unincorporated county. So essentially,
[1:15:01] if you take a mendon citizen, he's going
[1:15:04] to have his a portion of his fire and
[1:15:06] EMS costs going to be paid through the
[1:15:09] city general fund and a portion is going
[1:15:12] to be paid the cash county and they're
[1:15:14] going to put those two together to take
[1:15:16] care of the citizens in Mend. The
[1:15:20] citizens who live in the men fire area,
[1:15:23] >> Petersburg,
[1:15:24] >> are now going to pay a a municipal
[1:15:27] services levy to Cash County
[1:15:30] and the county.
[1:15:33] So, so they will be roughly equivalent
[1:15:35] and and that money will come to Cash
[1:15:38] County and we will go to Mend and say,
[1:15:40] "Mend, you need to provide equivalent
[1:15:44] fire service for those unincorporated
[1:15:46] citizen that are in the Mend fire area
[1:15:50] that are not within your city that and that will be money under your
[1:15:55] control to do that with."
[1:15:59] >> So, I have a question. So is this
[1:16:01] arrangement predicated on the assumption
[1:16:03] that all the cities will continue to
[1:16:06] participate
[1:16:07] or are there is there a possibility that
[1:16:10] some may say we don't want to contribute
[1:16:13] to this district anymore we can do it
[1:16:15] ourselves and would that change the
[1:16:18] calculation by which all the other
[1:16:20] participating cities would pay into it?
[1:16:22] The the answer is is because we're using
[1:16:25] vouchers, it won't change much because
[1:16:28] if for example, North Logan said we want
[1:16:32] out of the fire district. Okay, that
[1:16:35] means we would no longer they would no
[1:16:38] longer pay into this fire fund, but we
[1:16:40] wouldn't be giving them a voucher for
[1:16:42] the money that was collected from them
[1:16:44] either.
[1:16:47] >> So, it's up to them to decide how they
[1:16:49] want to reallocate.
[1:16:50] >> We only have one city that seems to be
[1:16:54] considering that right now and and it's
[1:16:57] really up to them what they choose to
[1:16:59] do. That that city is um buying the
[1:17:02] services from Logan. We're going to turn
[1:17:05] over virtually everything we collect to
[1:17:07] that city in a voucher because we're not
[1:17:11] providing fire service to them. So if
[1:17:14] they feel like they're better off to be
[1:17:16] out, it's not going to change the
[1:17:18] financial metrics that we're working
[1:17:21] with because we're not planning on using
[1:17:23] the money collected in that city to run
[1:17:27] the fire district.
[1:17:29] It's the operation. We would be taking
[1:17:32] that money and giving it back. I've got
[1:17:35] a well, let's see if I've got it here.
[1:17:38] I've got a big sheet here of
[1:17:42] that's a year and a half of the budget
[1:17:45] for the prospective fire district. And
[1:17:51] I guess I should turn it right side up.
[1:17:55] Probably so small you can't see it, but
[1:17:57] essentially it shows a great deal of the
[1:18:00] money that's coming in is going to go
[1:18:02] back out to the cities because they're
[1:18:04] providing their own service.
[1:18:07] For example, Smithfield doesn't get much
[1:18:10] in the way of fire services from the
[1:18:12] fire district. So, they're going to get
[1:18:15] almost all of the money that's collected
[1:18:17] in Smithfield will go back to
[1:18:18] Smithfield. Same thing with Providence
[1:18:21] and and so forth.
[1:18:24] >> I see. It's It's like you're in a
[1:18:26] cafeteria and everyone has a meal
[1:18:28] ticket, but if you bring your own lunch,
[1:18:29] then you get credit for the
[1:18:31] >> Yeah. lunch.
[1:18:32] >> That's way it works. And it's not down
[1:18:35] to the penny. Keegan, but it it's
[1:18:38] designed to be roughly fair
[1:18:40] >> and
[1:18:42] the hope is there's enough cities that
[1:18:44] want to participate in it that it's
[1:18:47] efficient and coste effective to
[1:18:49] continue to provide the service. Um,
[1:18:53] Chief George and I spent the morning on
[1:18:55] this trying to go through how much it
[1:18:58] would cost to provide EMS service
[1:19:02] through the district in the southern
[1:19:04] area and how much would have to be
[1:19:06] collected to make that work and um it
[1:19:10] it's kind of coming together keen is
[1:19:12] what I would say. So, George, we have a
[1:19:16] meeting of the fire board. I don't know
[1:19:19] who it's it constitutes right now, but
[1:19:22] it's scheduled for August 6th. Um,
[1:19:26] it it will still be in open public
[1:19:28] meeting or
[1:19:30] >> I don't think we can take any action at
[1:19:32] that meeting, but I don't think it's a
[1:19:34] bad idea. They they should all listen, I
[1:19:37] think, and hear all of this information
[1:19:39] as well
[1:19:40] >> because they will eventually many of
[1:19:43] them may be members of the board.
[1:19:45] >> Yeah, Katherine, I'm I am taking this
[1:19:48] information to them. They are aware of
[1:19:50] what I'm explaining to you today, but I
[1:19:53] think it's a good idea to do that. I
[1:19:56] think we put out a public notice so the
[1:19:58] public can be there. the fact that we
[1:20:01] don't take any action. There's a lot of
[1:20:03] times you have a meeting and don't take
[1:20:05] any action. And I think that's what we
[1:20:07] ought to do is we ought to take the uh
[1:20:10] mayors who have been serving on it, who
[1:20:12] are knowledgeable, put them on, put them
[1:20:15] up and talk through it and explain what
[1:20:17] we're doing and get input.
[1:20:19] >> Will Mark Anderson be able to be in
[1:20:21] attendance to build some of our
[1:20:23] questions?
[1:20:23] >> I think he will be able to be in
[1:20:25] attendance. He's he's given us some
[1:20:27] opinions already. He's he's encouraged
[1:20:30] us to get the application process out.
[1:20:33] Um it's it's really rather simple the
[1:20:37] appointment process.
[1:20:40] >> Yeah.
[1:20:40] >> And and like I've said, I my my
[1:20:43] disposition depending on who applies is
[1:20:46] to probably use the mayors as the
[1:20:49] initial board, but I think over time it
[1:20:53] will make sense for some of those people
[1:20:55] to be replaced by fire professionals.
[1:20:59] And by the way, the group that I met
[1:21:01] with this morning, which was the the
[1:21:04] group in the south, are really anxious
[1:21:07] to have Chief George be re retain the
[1:21:11] title of being the district fire chief
[1:21:14] and assist them in operating the fire
[1:21:17] district.
[1:21:20] he is wellliked and well respected. So I
[1:21:23] think I think things are are coming
[1:21:26] together in that effort.
[1:21:29] Dave,
[1:21:30] >> Matt may be the one might answer this
[1:21:33] question. And on the municipal on this
[1:21:37] possible county municipal services tax,
[1:21:42] is this only is this only applied to uh
[1:21:46] improvements or is it applied to raw
[1:21:50] land? It it it's it uses the same
[1:21:53] taxable value as your property taxes do.
[1:22:00] » That right, ma'am?
[1:22:01] >> That's right.
[1:22:01] >> Okay. Because I thought I was wondering
[1:22:04] if it was something that went to
[1:22:06] households,
[1:22:07] >> you know, and uh you know, and and it
[1:22:11] basically uh collected via per
[1:22:15] household. No,
[1:22:16] >> but it is it is basically based on
[1:22:20] property taxes.
[1:22:21] >> Yeah, it it isn't perfect because you
[1:22:24] have the green belt situation,
[1:22:26] >> but if you think about land that's in
[1:22:29] green belt, land in green belt doesn't
[1:22:31] use much of the way of fire. So, in in
[1:22:34] some ways, it it's actually a pretty
[1:22:36] good measure as to what's fair.
[1:22:40] Businesses are going to pay 100%
[1:22:43] of their assessed value. That seems fair
[1:22:46] as compared to residences which are
[1:22:49] going to pay 55 or 54. What is it?
[1:22:54] >> It's 55.
[1:22:55] >> Is it 55 or 54?
[1:22:57] >> 55.
[1:22:59] >> Okay. So it it would be the taxable
[1:23:02] value.
[1:23:04] If we put our municipal services tax at
[1:23:08] a range that's comparable to the cities,
[1:23:11] it will give us quite a lump of money to
[1:23:14] use to um make the right decisions in
[1:23:19] the fire district.
[1:23:21] And and that money will not be under the
[1:23:24] control of the fire district. It will be
[1:23:27] under the control of the county.
[1:23:35] » Okay. Thank you.
[1:23:36] >> Thank you for the update. Lot lot going
[1:23:39] on.
[1:23:41] Okay. Initial proposals for
[1:23:43] consideration of action.
[1:23:45] The resolution 2026-24
[1:23:48] opening and amending the Cash County
[1:23:50] budget fifth amendment.
[1:23:58] Good evening, council members. Um, the
[1:24:01] auditor is scheduled to do the main
[1:24:03] presentation answering of any questions.
[1:24:05] But, um, you all received a memo at the
[1:24:09] beginning of this meeting. Essentially
[1:24:12] uh due to a legal opinion that was
[1:24:14] issued, one of the proposals on the
[1:24:18] budget amendment is
[1:24:20] um was not done through the correct uh
[1:24:23] process that we have in code and
[1:24:25] requirement from state law. So in the
[1:24:28] meantime, we can get that fixed. But
[1:24:30] what I'm trying to say is
[1:24:32] uh I would heavily advise you all to
[1:24:36] specifically
[1:24:37] uh amend resolution 2026-24
[1:24:40] by replacing the original exhibit A with
[1:24:43] the revised exhibit A. Uh the revised
[1:24:45] version removes item six as uh it's it
[1:24:49] was listed in the original. So I would
[1:24:51] advise someone to make that motion
[1:24:54] before proceeding
[1:24:56] on the consideration of the rest of the
[1:24:58] resolution.
[1:25:03] And for those of you looking in your uh
[1:25:06] your file sharing system, if you can't
[1:25:08] see it, go to the top and just refresh
[1:25:10] the system.
[1:25:12] >> This?
[1:25:13] >> Yes.
[1:25:17] » Does someone want to make that motion
[1:25:18] before we get started discussing this? I
[1:25:21] will go ahead and I move to amend
[1:25:23] resolution 2026-24
[1:25:25] by replacing the original exhibit A with
[1:25:28] the revised exhibit A dated July 28,
[1:25:32] 2026, which removes item number six as
[1:25:35] presented.
[1:25:36] >> Second.
[1:25:37] >> Okay, it's been moved and seconded that
[1:25:38] we amend resolution 2026-24
[1:25:41] by replacing original exhibit A with the
[1:25:45] revised exhibit A. Is there any further
[1:25:47] discussion about this? Those in favor
[1:25:49] say I. I.
[1:25:51] >> Any opposed?
[1:25:53] >> Okay, that motion passes. So now
[1:25:56] our auditor will go through these one at
[1:25:59] a time.
[1:26:02] » All 37 pages.
[1:26:04] >> There's not 37 pages. There's two coming
[1:26:06] out.
[1:26:07] >> There are 14 uh items here. Uh one has
[1:26:11] just been struck. Uh it's it's still
[1:26:13] numbered there, but the amounts have
[1:26:14] been taken out. Um let's uh let's look
[1:26:17] at those 14. We'll start with number
[1:26:19] one. Um the executive
[1:26:23] suggested uh and I agreed that we
[1:26:26] discuss with the appropriations
[1:26:27] committee the removal [clears throat] uh
[1:26:30] of the fuel canopy project from the 2026
[1:26:33] public works budget. The appropriations
[1:26:35] committee uh approved that and we bring
[1:26:37] that uh to you today tonight uh for your
[1:26:41] consideration. Uh number one would um uh
[1:26:45] remove from from being constructed the
[1:26:49] uh proposed uh fuel canopy at the Hyram
[1:26:52] Roadshed um for a savings of $175,000
[1:26:59] to the general fund and $58,800
[1:27:02] to the municipal services fund. Uh are
[1:27:05] there any questions that I can answer on
[1:27:07] number one?
[1:27:10] And this was approved a couple years
[1:27:12] ago. No,
[1:27:13] >> this this is a new one.
[1:27:15] >> This was approved. Well, it was approved
[1:27:16] last fall.
[1:27:17] >> Okay.
[1:27:17] >> Uh in the 2026 uh budget,
[1:27:20] >> this year's budget,
[1:27:20] >> and this would amend that and take that
[1:27:22] out.
[1:27:27] Number two, um, in the the 2026 Cash
[1:27:31] County budget, we had a line item in
[1:27:35] there for the airport fuel farm that was
[1:27:39] based on the assumption that they would
[1:27:40] get a $1.1 million grant from uh from
[1:27:44] Wraps. That proved to be a little
[1:27:47] optimistic. Uh, WAPS declined to to fund
[1:27:50] that. I think that was the appropriate
[1:27:51] decision. Uh and so for number two, we
[1:27:54] would ask that we remove uh that $1.1
[1:27:57] million uh fuel farm uh expense as well
[1:28:02] as the the grant revenue which we're not
[1:28:04] going to receive.
[1:28:08] Are there any questions I can answer on
[1:28:09] number two?
[1:28:13] Number three. Number three, four and
[1:28:16] five all deal with the fixed guideway
[1:28:20] tax. Now, this is something the Cash
[1:28:21] County Council uh approved several years
[1:28:24] ago. It's a sales tax that can be used
[1:28:28] uh either for transportation uh or for
[1:28:31] public safety or any combination uh
[1:28:33] thereof, but the appropriate uh name for
[1:28:36] it is fixed guideway. Number three, uh
[1:28:40] we've gone back and
[1:28:43] with with the benefit of additional
[1:28:45] hindsight and with the benefit of more
[1:28:47] months of of those appropriations under
[1:28:50] our belt, we realize that we uh
[1:28:52] undersshot the amount of fixed guideway
[1:28:54] tax that we uh think we're going to
[1:28:56] collect. We think in fact that we're
[1:28:58] going to collect uh more fixed guideway.
[1:29:01] And we realized that uh in the 2026
[1:29:04] budget that we approved last fall, we
[1:29:06] didn't quite have the allocation set
[1:29:09] appropriately between public safety and
[1:29:11] fixed guideway. So number three will
[1:29:15] increase uh the amount estimated for the
[1:29:18] fixed guideway revenue for 2026 to
[1:29:22] 8,961,936.
[1:29:29] That's for 202. That's what we received
[1:29:32] in 2025.
[1:29:33] >> No, this is what we expect to receive in
[1:29:36] 2026.
[1:29:37] Okay.
[1:29:39] >> Okay.
[1:29:43] » Number four,
[1:29:45] uh, deals with just the transportation
[1:29:50] portion of the fixed guideway tax. Now
[1:29:52] the county council in the past has set
[1:29:56] uh the allocation of fixed guideway so
[1:29:59] that 40% of it goes to transportation.
[1:30:03] That is that is unchanged. What number
[1:30:06] four proposes to do though is to uh
[1:30:10] allocate uh
[1:30:12] 70% of that transportation portion to
[1:30:17] COG
[1:30:18] and allocate 30% of that transportation
[1:30:23] portion uh to uh county use, county road
[1:30:27] department, public works department use.
[1:30:33] This is basically
[1:30:34] >> so just to be clear of the 40 of that
[1:30:36] slice of the pie that slice is going to
[1:30:40] >> 7030 of that 40 will be be allocated.
[1:30:44] Yeah.
[1:30:44] >> So what it comes down to in reality is
[1:30:47] 12% of the total tax comes to the county
[1:30:51] and 28% goes to COG if you look at it as
[1:30:55] a big
[1:30:55] >> if you look at it as as the
[1:30:58] >> entirety of the fixed guideway revenue
[1:30:59] stream. But um uh I I think I like the
[1:31:04] you know the 40% that we're allocating
[1:31:06] to transportation 70% of that would be
[1:31:09] COG. 30% of that would would be uh
[1:31:13] staying with the county.
[1:31:15] >> Could you go back to number three?
[1:31:17] >> Yes, ma'am.
[1:31:18] >> And give me those numbers again.
[1:31:20] >> Yes.
[1:31:20] >> So are they higher or lower? I was
[1:31:22] trying to keep track. We believe we're
[1:31:23] going to collect more uh fixed guideway
[1:31:27] sales tax revenue than we had previously
[1:31:29] estimated when we passed the 2026 budget
[1:31:34] last last fall, last winter. Uh we
[1:31:37] passed a budget assuming how much we
[1:31:40] were going to receive. We now believe
[1:31:42] that that was low. We believe that we're
[1:31:45] the correct amount of what we think
[1:31:47] we're going to receive in 2026 would be
[1:31:50] 8,961,000.
[1:31:54] » So number three then proposes to amend
[1:31:57] the budget to increase that expectation
[1:32:00] to 8,900,000.
[1:32:03] >> Thank you.
[1:32:07] » Could I just take a one second in in
[1:32:10] that presentation, Matt? the 12%
[1:32:15] or the
[1:32:18] 30% 12% of the whole 30% of the 40 same
[1:32:22] dollar amount.
[1:32:24] >> That 12%
[1:32:26] that we retain at the county would go
[1:32:29] into the capital projects
[1:32:31] for our road department
[1:32:34] and it would also
[1:32:36] one of the things it's it can be used
[1:32:38] for is airports. So that becomes a tied
[1:32:43] funding source that we can use for both
[1:32:46] capital projects for roads and for the
[1:32:49] airport without funding those two things
[1:32:53] from our general fund.
[1:32:56] That that's the goal we have of trying
[1:32:59] to move the guideway monies that are
[1:33:02] limited to transportation
[1:33:04] to take out some of the transportation
[1:33:07] things that we typically put in our
[1:33:09] general fund.
[1:33:13] Yeah, that fixed guideway money can be
[1:33:15] used for the the design, the
[1:33:17] maintenance, the construction of uh of
[1:33:20] those transportation airport uh or or
[1:33:23] roadways.
[1:33:26] Number uh five, following up on what
[1:33:29] George just said, as you will probably
[1:33:32] well remember, every year Cash County
[1:33:34] takes from its general fund and supports
[1:33:37] the Cash County Airport, C Logan Cash
[1:33:39] County Airport. Well, with the fact in
[1:33:43] mind that we can actually pay for that
[1:33:45] out of the fixed guideway tax, what
[1:33:48] number five proposes to do is go back
[1:33:51] and undo the the general fund allocation
[1:33:54] that we made last fall and replace that
[1:33:58] with with $200,000
[1:34:00] coming out of fixed guideway. So, that's
[1:34:03] going to be a $200,000 savings to the
[1:34:06] general fund, which is is very
[1:34:09] desirable. and we'll we'll replace it
[1:34:11] with that fixed guideway revenue.
[1:34:14] >> And because we're
[1:34:17] basically the county is now responsible
[1:34:19] for their portion which went from
[1:34:21] 100,000 to 200,000, we've now found a
[1:34:25] funding stream through the guideway to
[1:34:27] take care of that.
[1:34:28] >> Yes. Yes. Exactly.
[1:34:34] » Are there any more questions on the
[1:34:35] fixed guideway portion of the budget
[1:34:37] opening? Matt, weren't we also going to
[1:34:41] roll out the the capital portion of the
[1:34:46] road budget and replace that with
[1:34:48] guideway money as well?
[1:34:50] >> Not in this opening, but we we we are
[1:34:52] going to do we will get to that
[1:34:54] >> for the 26 or for the 27 budget if we
[1:34:57] don't do it earlier. But yes,
[1:35:00] >> six is gone.
[1:35:02] >> Okay. Um number six has been struck.
[1:35:08] uh six, seven and eight uh all focus on
[1:35:10] wraps. As I said, number six has been
[1:35:12] struck, but seven and eight we need to
[1:35:14] do a little ministerial, a little
[1:35:16] clerical uh correction.
[1:35:19] uh we did not carry forward um from the 2024 budget the appropriation that
[1:35:27] we need to pay for the feasibility study
[1:35:30] for the recreation center that was uh
[1:35:33] awarded and appropriated from wraps in
[1:35:36] 2024. We're now ready to pay that bill.
[1:35:40] So we need to reauthorize that in the
[1:35:42] 2026
[1:35:44] uh budget. And that's what number seven
[1:35:46] and number eight do.
[1:35:51] Number nine, also uh a small ministerial
[1:35:54] uh clerical item. Uh we had the same
[1:35:57] issue with $2,826
[1:36:00] of ARPA money that was previously uh
[1:36:03] authorized, but needs to be rolled
[1:36:05] forward into 2026 so that it can be
[1:36:07] spent on the TV translator equipment.
[1:36:14] All right. Now we move into um some
[1:36:17] items for the sheriff. You may remember
[1:36:19] that the last time that that that we
[1:36:21] were discussing the budget uh that that
[1:36:24] I had mentioned that we needed to
[1:36:25] replace the uh the fire control panel uh
[1:36:28] in the jail. Um if I can steal a line
[1:36:33] from Cool Hand Lo Luke, what we had here
[1:36:36] was a failure to communicate.
[1:36:39] Uh the sheriff uh had had given us
[1:36:42] instructions and we just misunderstood
[1:36:43] them.
[1:36:44] Um, number 10 proposes to go back and
[1:36:48] roll back that mistake that we made in
[1:36:50] the June uh, budget opening. What we had
[1:36:53] thought we were doing was taking money
[1:36:56] from subscriptions and memberships, from
[1:36:58] fuel, from professional and technical
[1:37:01] and special department supplies, and we
[1:37:04] had thought that we were uh allocating
[1:37:06] those to the fire control panel. That
[1:37:08] was that was a misunderstanding on our
[1:37:09] part. That 133,000 in fact needs to go
[1:37:13] to repair and maintain patrol vehicles.
[1:37:16] So number 10 rolls back that mistake.
[1:37:18] Number 11 puts that 133,000 uh where the
[1:37:22] sheriff actually needs it so he can he
[1:37:24] can maintain his his equipment.
[1:37:28] Then that gives us number 12, which is
[1:37:31] where we ask for $110,000
[1:37:34] for that fire control panel that we had
[1:37:37] previously discussed.
[1:37:39] That comes out of the improvements
[1:37:41] budget.
[1:37:41] >> It comes out of the uh the capital
[1:37:43] projects budget.
[1:37:49] » Okay. Number uh number 13 and number 14
[1:37:52] both relate to to development services
[1:37:55] trails. Um, number 13, the under state
[1:37:58] law, we collect um fees from uh
[1:38:03] homeowners that are requesting building
[1:38:05] permits and we can use that fee revenue
[1:38:09] only for services that relate to those
[1:38:13] building permits, building inspections,
[1:38:15] what have you. Uh, every so often we go
[1:38:18] through and and true up our accounts.
[1:38:20] And in this case, we realized that um uh
[1:38:23] Mr. Phillips department uh had rendered
[1:38:26] uh $61,500
[1:38:28] of services uh in that effort in the
[1:38:32] building permit phase that uh that his
[1:38:36] department needs to be reimbured for. So
[1:38:38] that allows us to take 61,000 out of
[1:38:41] that highly restricted fund and move it
[1:38:44] over to the general fund where uh
[1:38:46] particularly to roads where it can be
[1:38:47] more readily utilized.
[1:38:51] Uh finally, number 14, uh Deep Canyon.
[1:38:56] This is a project that we've been
[1:38:58] working on for several years, and
[1:39:01] previously Wraps had uh allocated
[1:39:04] $100,000
[1:39:06] to uh pave the Deep Canyon Trail Head
[1:39:09] parking lot. Uh we need to do two things
[1:39:12] here. We need to reauthorize that for
[1:39:14] 2026.
[1:39:16] But in the entering uh intervening
[1:39:18] several years, uh the costs for that parking lot have increased and we
[1:39:23] think in fact instead of $100,000, we're
[1:39:26] going to need 150. So this reauthorizes
[1:39:29] the $100,000 from wraps and allocates
[1:39:33] $50,000 from municipal services to
[1:39:36] finish that uh that parking lot at Deep
[1:39:38] Canyon.
[1:39:40] >> Is Deep Canyon our bridge to nowhere?
[1:39:45] >> It is.
[1:39:46] No, the bridge to nowhere accomplish
[1:39:48] nothing. I guess deep canyon, if you're
[1:39:49] a trail person,
[1:39:51] >> will accomplish something.
[1:39:53] >> This is what some of the locals call
[1:39:54] Wayne's Loop, and it's also a way to
[1:39:57] access the Wellsville.
[1:39:58] >> Yes, it's a way to access access to
[1:40:00] >> popular trail. Anyone that goes up there
[1:40:03] >> and and I'll be honest, the nice thing
[1:40:04] about this is we get people coming from
[1:40:06] outside of Cash County coming up here to
[1:40:09] Cash County to hike that trail. and and
[1:40:11] we do appreciate that tax revenue when
[1:40:13] they stop at a convenience store or
[1:40:15] whatever. And and so that is nice. And
[1:40:18] most of that Deep Canyon money, of
[1:40:20] course, was was provided by the state.
[1:40:22] And if the state wants to spend its
[1:40:24] money that way, then we'll certainly won't say no.
[1:40:33] » Okay. Thank you very much, Matt, for all
[1:40:36] that information. Um, I don't know if
[1:40:38] you guys want to make a motion to accept
[1:40:41] these as a whole. If there's some that
[1:40:43] you want to pull out and discuss further
[1:40:45] and um, talk about those one at a time.
[1:40:48] Um, I need some direction from the
[1:40:50] council how you want to proceed on this
[1:40:53] budget amendment.
[1:40:56] >> I [clears throat] I'm very Matt is very
[1:40:59] good and very clear in in his concise
[1:41:02] descriptions. It's logical. It's I I
[1:41:06] love these corrections.
[1:41:08] So, as amendment four, is it it we we
[1:41:11] we're not even We never really I thought
[1:41:14] did anything with amendment four.
[1:41:17] So, we're going to jump over to
[1:41:19] amendment five, which then includes all
[1:41:22] of what we were looking at previously.
[1:41:25] Okay. That's what I I want that's how I
[1:41:27] saw it, too. I just uh
[1:41:29] >> I just want to make sure we're not,
[1:41:32] >> you know, jumping past something.
[1:41:34] >> No, no, no, no.
[1:41:35] >> And with that, I I would move that uh we
[1:41:38] go ahead and accept uh I believe it's
[1:41:41] resolution 2026-24,
[1:41:46] uh the budget fifth amendment.
[1:41:50] >> Second.
[1:41:51] >> Okay. It's been moved and seconded that
[1:41:53] we accept resolution 2026-24.
[1:41:56] Is there any further discussion?
[1:41:58] >> I just have a question. Yes, this is
[1:42:00] kind of a stupid one, but
[1:42:03] >> So, does that actually increase any
[1:42:06] taxes? It sounded like it's just trading
[1:42:09] >> going from fun to Is that what it is?
[1:42:12] There's no increase in there, right?
[1:42:14] >> Or is that 100,000
[1:42:16] >> spending? I I suppos Well, there's a
[1:42:18] couple. There's the Deep Canyon uh
[1:42:20] parking lot
[1:42:21] >> for 50 and the sheriff's fire panel for
[1:42:24] 110. Uh those are the ones that come to
[1:42:27] mind, but I submit to you that both of
[1:42:30] those are needed. Certainly the fire panel
[1:42:35] >> and and the way it works like we passed
[1:42:37] a solid budget for this year. Anything
[1:42:39] that changes that has to go through this
[1:42:42] process, Joanne, but also it's not going
[1:42:44] to increase taxes. It would just if
[1:42:46] there's extra money, it would come from
[1:42:47] our reserve fund. Um but our tax late
[1:42:51] does not do anything to the tax that we
[1:42:54] have already passed for this year. Okay.
[1:42:56] >> It's just just accounting for it, making
[1:42:58] sure that every especially because with
[1:43:00] the county, we want to make sure every
[1:43:02] dollar is accounted for in the right
[1:43:04] place. Um so that we can be really
[1:43:06] transparent and um Matt's done a really
[1:43:10] great job of doing that. So, okay, I
[1:43:13] have a motion and a second. Anybody else
[1:43:15] have any questions or discussion?
[1:43:17] >> Maybe just if they're going to be more
[1:43:18] budget amendments than Rocky Movies or
[1:43:21] if we'll be about the same. No, here
[1:43:24] here's the we we the schedule we have is
[1:43:26] to do one per quarter. This puts this
[1:43:29] one is a little off schedule. So, we
[1:43:30] will have another budget opening in
[1:43:32] September. Um that'll go to the
[1:43:34] appropriations committee in late August
[1:43:37] and um hopefully it's very minimal.
[1:43:40] We'll see.
[1:43:40] >> But that'll be Yeah, we'll be back at
[1:43:42] that point back on our regular regularly
[1:43:43] scheduled schedule.
[1:43:45] >> That's the third quarter amendment.
[1:43:46] >> That's the third quarter.
[1:43:47] >> Okay.
[1:43:48] >> Excellent.
[1:43:48] >> All right. We have a motion and a
[1:43:51] second. Those in favor say I.
[1:43:54] >> I. Any opposed?
[1:43:56] >> Thanks so much, Matt. Okay,
[1:44:00] Andrew 8B.
[1:44:16] Again,
[1:44:24] good evening members of the county
[1:44:26] council. Before you is resolution number
[1:44:28] 2026.
[1:44:30] This [clears throat] is appointing
[1:44:31] members to the Cash County Regional
[1:44:32] Recreation Center feasibility study
[1:44:34] committee. So, they would oversee and
[1:44:37] direct countywide recreation initiatives
[1:44:40] in terms of the study.
[1:44:42] So, a little bit of background. During
[1:44:44] the last county council meeting, it
[1:44:46] resolution 2026-25
[1:44:49] was passed that established the
[1:44:51] recreation feasibility study committee
[1:44:53] itself. The resolution set up and
[1:44:56] defined a legislative study committee
[1:44:58] composed of up to three members of the
[1:45:00] county council as well as six advisory
[1:45:03] members from geographically defined
[1:45:06] areas in the county. uh this resolution
[1:45:08] itself 26-26
[1:45:11] would be the one that would appoint
[1:45:13] members to the study committee so it can
[1:45:15] conduct its business.
[1:45:18] Right now the names that are currently
[1:45:19] in the resolution uh again this is these
[1:45:24] names are placeholders and can be
[1:45:25] stricken and replaced with other names
[1:45:27] if the county council so desires. But
[1:45:30] right now, the current names listed in
[1:45:32] the appointing resolution are are
[1:45:35] council member Katherine Bu, council
[1:45:37] member Karity. Uh, from the county seat,
[1:45:40] Melissa Dahi,
[1:45:42] >> sorry, apologies. Uh, with the
[1:45:45] unincorporated county, it would be
[1:45:47] Nathan Player. From municipality north
[1:45:49] of the county seat would be Emily
[1:45:51] Schmidt. The other north would be John
[1:45:54] David Jorgensson. From the south, you
[1:45:56] would have Nathan Larson and JD Jensen.
[1:46:00] Um, [clears throat]
[1:46:02] if there is any desire to strike any of
[1:46:04] the names or replace them with any, now
[1:46:07] would be the time. But otherwise, this
[1:46:09] resolution is is ready for passage. Do
[1:46:12] you have any questions?
[1:46:14] >> Which part of the unincorporated county
[1:46:16] is Nathan from?
[1:46:18] >> That's a good question. I
[1:46:21] >> Nathan uh player lives in Petersboro.
[1:46:30] Where does JD Jensen live?
[1:46:34] » I also believe some of the proposed
[1:46:36] names are here if anyone has any
[1:46:38] questions for them.
[1:46:44] » Okay. I' I'd be happy to discuss this or
[1:46:47] take a motion. Um if they're here and
[1:46:50] they've sat this long in the meeting and
[1:46:51] they have something they'd want to say,
[1:46:53] uh chair, would you be immunable to
[1:46:55] them? That would be great.
[1:46:57] >> That would be great.
[1:46:59] >> Yeah, I know John David's here. Um,
[1:47:01] >> and Nathan Lowerson is here and Melissa
[1:47:05] is here. So, if you guys want to address
[1:47:07] us,
[1:47:08] >> yes, please.
[1:47:10] John David's saying no. [laughter]
[1:47:13] >> I have questions.
[1:47:16] >> Save your comments for the committee.
[1:47:18] [laughter]
[1:47:19] >> Melissa, is it would you
[1:47:21] >> I have to say
[1:47:22] >> Okay. Thank you for your willingness to
[1:47:24] serve.
[1:47:25] >> Does this committee uh is there any bud?
[1:47:28] Do they have a budget that they work
[1:47:29] with at all? Okay. So, it's
[1:47:31] >> will they volunteer?
[1:47:32] >> Are they our study that we pay tens of
[1:47:36] thousands of dollars for? Is that
[1:47:37] something that they look at?
[1:47:39] >> They would be directing the staff on
[1:47:41] that and giving them answering questions
[1:47:43] for them. So, it's already paid for.
[1:47:45] >> Okay. I just don't want the funnel
[1:47:47] approach.
[1:47:48] >> So,
[1:47:49] >> Joanne, did you have something? Yeah. I
[1:47:50] just have I would like to find out from
[1:47:53] them their involvement in government
[1:47:56] currently or previous.
[1:47:59] >> Perfect. Great. Are you guys willing
[1:48:01] John David you want to start us out?
[1:48:02] >> That gives you an idea of what you could
[1:48:04] say up here.
[1:48:05] >> My checkbook my involvement with
[1:48:07] [laughter]
[1:48:09] >> pay tax.
[1:48:10] >> So would it be reading it out?
[1:48:12] >> Can introduce yourself please.
[1:48:14] >> My name is John David Jorgensson. Uh I'm
[1:48:16] from Smithfield. I think the most
[1:48:19] relevant uh uh piece of information for
[1:48:22] this is that there's been an ad hoc
[1:48:24] committee that I'm sure you're aware of
[1:48:26] and I have been a member of that
[1:48:28] attending the meetings uh meeting with
[1:48:30] the VCBO uh representatives and learning
[1:48:33] uh about the process what's gone into
[1:48:36] this and so have a lot of background
[1:48:37] information there. uh have also talked
[1:48:40] to the the my mayor in Smithfield uh uh
[1:48:46] extensively about this and also the uh the director of the Smithfield Rec
[1:48:53] Center to make sure that's part of the
[1:48:54] discussion and would continue that.
[1:48:58] >> Thanks for that.
[1:48:59] >> Thanks John David. Appreciate it.
[1:49:02] Melissa just say
[1:49:13] Okay. My name is Melissa Deli. Um, I
[1:49:15] don't know how far back you want me to
[1:49:17] go, but [laughter]
[1:49:18] I have been involved on Logan City Parks
[1:49:21] and Wreck Committee or advisory board
[1:49:24] for probably
[1:49:26] I don't even know, six years maybe. Um,
[1:49:29] I being part of that board, I started
[1:49:32] the discussion throughout the county of
[1:49:34] trying to get a rec center here in the
[1:49:36] county. Um, and I'm currently serving on
[1:49:38] Logan City Council. So, that's where I'm
[1:49:41] at.
[1:49:42] >> Thanks.
[1:49:43] >> Thank you, Melissa Nathan.
[1:49:53] » Hi, Council. Excited to serve. U
[1:49:56] currently in my second term uh as a
[1:49:59] council member in Nimby City was a big
[1:50:01] part of their committees and things of
[1:50:04] our own feasibility study um and have
[1:50:07] personally benefited from recreation
[1:50:09] organized or unorganized throughout the
[1:50:11] county my whole life. So
[1:50:15] >> thank you. Are there any other members
[1:50:17] that of this committee here tonight?
[1:50:20] >> Um Emily had mentioned to me that she
[1:50:22] was not going to be able to be here
[1:50:23] tonight. She asked me to express her um
[1:50:27] interest in serving her gratitude to be
[1:50:29] on the list and apologies for not being
[1:50:31] able to be here. And I will just add to
[1:50:35] Joan's question. Emily is currently
[1:50:36] serving on the North Logan City Council.
[1:50:41] >> Okay.
[1:50:42] >> Anyone know Nathan Player well or JD
[1:50:44] Jensen that could speak to their
[1:50:46] experience or Yeah. So, I know Nathan
[1:50:50] Player. Um, he lives out in the
[1:50:54] unincorporated. He has I feel like what
[1:50:56] I know about him, he has six kids. Um,
[1:50:59] he, uh, grew up in Hollow Road. He's
[1:51:03] just always wanted to be involved in the
[1:51:04] county and I thought this was, as soon
[1:51:06] as I text him, he said, "Absolutely, I
[1:51:07] will." And so I thought he would just be
[1:51:09] um being in the un incorporated I
[1:51:11] thought would be an added benefit where
[1:51:14] he doesn't belong to a specific
[1:51:16] municipality.
[1:51:19] >> JD is associated with Mend. Um he's
[1:51:22] involved in their recreation site, runs
[1:51:24] the softball program which is huge in
[1:51:26] Mend. So, um,
[1:51:32] was hesitant because he's very busy at
[1:51:34] work, but I hope they have the meetings
[1:51:36] after work. So, I imagine all of you are
[1:51:39] involved in work. So, that was his point
[1:51:43] and I said, I hope that works out. So,
[1:51:45] >> so just to be clear, everyone whose name
[1:51:48] is here has been asked by someone if
[1:51:49] they're willing to or not.
[1:51:51] >> Yes.
[1:51:51] >> This won't be a surprise.
[1:51:53] >> That's great. And I apologize for not
[1:51:55] having got clarification on this
[1:51:56] question before the meeting, but usually
[1:51:59] we do appointments, advice and consent
[1:52:01] and that kind of process.
[1:52:03] Explain to me why that is not why we're
[1:52:05] how we're doing it this time. And I
[1:52:07] figured Andrew would know that off the
[1:52:09] top of his head.
[1:52:10] Um, so the reason why this would be
[1:52:14] appointment via resolution is it if you
[1:52:17] look at the C cash county optional plan,
[1:52:20] I believe it's under
[1:52:22] section 3.10, 10. It enumerates the
[1:52:25] powers of the county council and one of
[1:52:27] them essentially states the ability to
[1:52:30] investigate um any matter of county
[1:52:33] business or to contract external um
[1:52:37] external parties for consulting on how
[1:52:39] to best conduct certain county
[1:52:41] businesses. Long story short, this would
[1:52:43] be it says it in the resolution. It this
[1:52:46] would be a legislative uh study
[1:52:48] committee because ultimately what this
[1:52:51] committee would be bringing back to the
[1:52:53] county council would be a report and
[1:52:56] recommendation for you all to consider.
[1:52:58] So the idea being uh if the county
[1:53:01] council wants to establish its own
[1:53:03] committee to conduct or expedite its own
[1:53:06] business, that is the business of the
[1:53:07] county council. But um does that answer
[1:53:11] your question?
[1:53:12] >> Yeah, it does. I mean that's that's
[1:53:14] essentially what I thought was the case.
[1:53:16] I just wanted to be sure.
[1:53:18] >> Okay. Does someone want to make a
[1:53:20] motion?
[1:53:21] >> So I'm unclear.
[1:53:22] >> Okay.
[1:53:24] >> We have a
[1:53:26] piece of legislation you passed a few
[1:53:28] weeks ago that has a process for
[1:53:31] appointing people so that we vet them.
[1:53:35] Are you saying that when you appoint a
[1:53:37] committee, you're not going to go
[1:53:38] through that same process?
[1:53:41] >> I don't know.
[1:53:43] >> Well, I I mean I
[1:53:45] >> Yeah, that's an legitimate question,
[1:53:46] George. Um I believe when we passed the
[1:53:50] resolution to say that we were going to
[1:53:52] form this committee, it was unclear how
[1:53:54] the appointments would be made. It was
[1:53:56] not clarified in that.
[1:53:58] >> I don't object to to you doing that. But
[1:54:00] I just want to call it to your attention
[1:54:02] because
[1:54:04] when you appoint a study committee,
[1:54:07] you you will have people who want to
[1:54:11] discuss whether that's a good idea or
[1:54:13] not. And that's very similar to other
[1:54:16] committees that we organize and go
[1:54:18] through. So, this this is a meaningful
[1:54:22] thing and we're talking about a rather
[1:54:25] large sum of public money that might be
[1:54:27] devoted to this. And I don't want to get
[1:54:30] halfway down and then have someone say
[1:54:34] your process didn't didn't make for
[1:54:39] public application. It was
[1:54:44] » Yeah. And I because this is the we have
[1:54:47] never done a committee like this before.
[1:54:49] But I think that um some clarification
[1:54:52] on that we could we could um continue
[1:54:55] this for two more weeks and talk about
[1:54:57] that process um because I know there
[1:55:00] were a lot of questions people asking so
[1:55:01] how are you going to choose that
[1:55:03] committee and it wasn't clarified in the
[1:55:06] statute or the ordinance that we passed
[1:55:09] and so um it's a
[1:55:12] >> excuse me could the council also give
[1:55:14] some guidelines because the executive
[1:55:16] pointed out some things a couple council
[1:55:19] meetings ago as
[1:55:21] where is this going to be located and
[1:55:23] who's going to run it and all of those
[1:55:26] things I think some clarifications as
[1:55:28] that committee comes point can we bring
[1:55:30] those together and this continuation of
[1:55:32] the two weeks does that make sense
[1:55:34] >> yeah like I would think that they would
[1:55:36] designate their first meeting and choose
[1:55:37] their own leader um but this is such a
[1:55:40] this is just such an advisory comm it's
[1:55:43] just a committee to look at the
[1:55:46] information that is already being ga
[1:55:48] gathered by BCBO and then bring a
[1:55:51] recommendation to the council if they
[1:55:53] can come to a conclusion of this would
[1:55:56] be the best choice for the county. Um,
[1:55:59] and so it it it ultimately it is our
[1:56:01] decision whether we accept their
[1:56:03] recommendation or not.
[1:56:05] >> Understand, but I just like to give them
[1:56:06] some
[1:56:07] >> Yeah.
[1:56:07] >> clarification points.
[1:56:09] >> I think that would be really helpful.
[1:56:10] Um, Andrew,
[1:56:12] >> I believe the county executive is right.
[1:56:14] Under Cash County Code 12, sorry,
[1:56:17] 2.12.270,
[1:56:20] uh, I believe there has to be at least
[1:56:24] one week of time for members of the
[1:56:28] county council to be able to see the
[1:56:30] name and then request any information
[1:56:32] that they may so want. So, I would
[1:56:34] suggest moving it to the next meeting.
[1:56:36] >> Okay. I think I feel comfortable with
[1:56:38] that. We have to buy a diet coke for the
[1:56:40] executive for [laughter]
[1:56:42] >> I I brought a I brought a case
[1:56:44] >> say I think these are excellent people.
[1:56:46] I think the idea is good. I just
[1:56:49] >> when we make rules we we probably ought
[1:56:54] >> Yes. And and I I think that's the most
[1:56:56] important thing and I've been saying it
[1:56:58] all along. So, I really appreciate you
[1:56:59] bringing that out in this because I
[1:57:01] think we have to follow the codes and
[1:57:04] follow the rules and do things according
[1:57:07] to the books at all times.
[1:57:09] >> Is there is there a time frame from this
[1:57:11] for this committee?
[1:57:12] >> Yes, March 1st of 2027
[1:57:16] is when the
[1:57:17] >> Okay.
[1:57:17] >> So, yeah, there is a there is a set time
[1:57:20] frame.
[1:57:23] >> Okay. So,
[1:57:24] >> I just have a question well or a comment
[1:57:27] I guess. I'd like to see kind of an
[1:57:30] unbiased
[1:57:34] member or few members maybe. Does it
[1:57:37] have to be could we enlarge it to
[1:57:40] include some unbiased ones because
[1:57:44] >> that we would have to change the
[1:57:45] resolution that we passed two weeks ago
[1:57:47] or the last
[1:57:48] >> I think in yeah in that question there's
[1:57:50] an implication that maybe the names on
[1:57:52] here biased.
[1:57:55] Um maybe you could define that more.
[1:57:58] >> Well, just um
[1:58:01] sort of neutral because I'll bet if I
[1:58:05] ask these people what they thought, they
[1:58:08] already have an opinion from their
[1:58:11] experience. It sounded like and maybe
[1:58:14] somebody that doesn't already have an
[1:58:16] opinion that' be helpful on the
[1:58:19] committee. I don't know that they they may have come with certain
[1:58:23] experiences, but I don't know that
[1:58:24] they've already formed an opinion.
[1:58:26] Several of them have not looked at the
[1:58:28] any of the information from BCBO. They may their experience might help
[1:58:32] them to form an opinion based on what
[1:58:36] they what they learn, but I don't know
[1:58:38] that that comes as a as a given that
[1:58:41] they already have an opinion. They just
[1:58:43] come with certain experiences, and I
[1:58:45] think that a lot of those are really
[1:58:46] valuable. Um I don't know how you I
[1:58:49] don't know how you judge bias
[1:58:50] >> or if they do have an opinion once they
[1:58:52] find out the cost and financing of it
[1:58:54] that the opinions may very well change.
[1:58:56] >> Yes.
[1:58:57] >> Yeah.
[1:58:58] >> So
[1:58:59] >> I don't think anything's a foregone
[1:59:00] bias.
[1:59:01] >> Yeah. There's no foregone conclusion.
[1:59:03] >> I don't think of any of them. But I
[1:59:05] don't know how you would I don't know
[1:59:06] how you would judge bias anyway. That's
[1:59:08] not it's pretty intangible.
[1:59:11] >> It's kind of like going to your
[1:59:13] mother-in-law saying who is your
[1:59:14] favorite son-in-law and why am I?
[1:59:18] you know, serious. That's that's that's
[1:59:20] kind of how people look at things like
[1:59:22] that. And that's when they ask they all
[1:59:23] everyone's got some a little agenda
[1:59:26] sometimes sitting inside them or their
[1:59:30] experiences. Uh the one thing I've been
[1:59:33] really disappointed in was that one
[1:59:35] questionnaire that went out. I thought
[1:59:37] that was the stupidest thing I've ever
[1:59:39] seen in my life. It was the funnel
[1:59:41] approach. And that's what I was hoping
[1:59:43] that this this committee
[1:59:47] its diversity would probably grow a
[1:59:49] little bit. So, but uh I think that I
[1:59:52] think that we'll be able to get to an
[1:59:54] answer.
[1:59:56] So, but I like the time frame, too. So,
[2:00:00] >> anybody else want have something they
[2:00:02] want to discuss on that before we move
[2:00:04] on? We'll we'll bring that up next in
[2:00:06] the next two weeks. And I don't know,
[2:00:08] Andrew, if we need to um refine the
[2:00:12] appointment process in the next two
[2:00:14] weeks or how we what what exactly are we
[2:00:16] going to accomplish in the next two
[2:00:18] weeks before our next meeting?
[2:00:20] >> Yes. I believe the point of having that
[2:00:23] timeline available is for any member of
[2:00:25] the county council to request specific
[2:00:28] information from any or all of the
[2:00:30] proposed names.
[2:00:30] >> Got it. Okay. So, that's up to us if we
[2:00:33] if anyone has any concerns to have those
[2:00:36] conversations. And would you maybe
[2:00:38] supply us with um contact information
[2:00:41] >> if you all send it to me? Yes.
[2:00:44] >> Okay.
[2:00:45] >> I think we're referring to the members
[2:00:47] of the proposed.
[2:00:48] >> No, he but he doesn't have their contact
[2:00:49] information is what he's saying.
[2:00:50] >> I'll send it to you. [laughter]
[2:00:52] >> Half of them you could get it from.
[2:00:54] >> We have
[2:00:57] to I can get a hold of.
[2:01:00] >> All right. We have one more thing on our
[2:01:02] um agenda. The resolution 2026-27
[2:01:05] approving the Powder Mountain Law
[2:01:06] Enforcement and Search and Rescue Enter
[2:01:08] local agreement with Wever County. Um
[2:01:11] Kurt and Chad, are you guys going to do
[2:01:13] that together? Who's going to take the
[2:01:14] lead on that presentation?
[2:01:24] » Okay. Well, thanks. I'll keep this
[2:01:26] pretty short. Kurt asked me to come and
[2:01:28] talk about theou with Powder Mountain.
[2:01:30] If you guys probably already know, the theou we had before was from like
[2:01:34] 1994
[2:01:36] and we've been operating under that ever
[2:01:38] since this whole thing with the fire
[2:01:39] district came up and it needed to be
[2:01:40] redone. Um so in my mind it was easier
[2:01:44] to to peel the law enforcement piece out
[2:01:46] because I can just deal directly with
[2:01:47] the Weaver County Sheriff and and not
[2:01:49] get it wrapped up in all the other
[2:01:50] things. Um, so theou that I think you
[2:01:53] have seen, um, he he did put a a value
[2:01:56] to things if we needed those services
[2:01:59] over there. Um, but I don't expect that
[2:02:01] there's going to be anything that's
[2:02:02] going to change in the way the process
[2:02:04] has been working for the last 25 years
[2:02:07] with any funding or any billing going
[2:02:09] back and forth between Cash County andor
[2:02:10] Weber County as it deals with law
[2:02:12] enforcement services provided over
[2:02:14] there. there's such just a tiny piece of Cash County in the Weber side that
[2:02:19] would generate calls for service. Um,
[2:02:21] and him looking back over I I I wanted
[2:02:24] to be fair with him. I'm like, look and
[2:02:25] see what the cost is. I don't want to
[2:02:27] stick you with something that because
[2:02:29] we're friends. Um, but he looked back
[2:02:31] and looked at the addresses in the
[2:02:32] geoence on where the people are mostly
[2:02:36] in Powder Mountain from the Cash County
[2:02:38] side and he can't come up with two or
[2:02:40] three reports in the last 25 years that actually would be something for
[2:02:45] them. Um, we already split search and
[2:02:47] rescue calls between Cash and Weaver.
[2:02:52] When somebody calls from the mountains,
[2:02:53] it depends on which tower it hits off of
[2:02:55] and which which search and rescue gets
[2:02:57] called out. So, we share resources back
[2:02:58] and forth already as it gets closer to
[2:03:01] the border. Um, so I really don't
[2:03:03] anticipate any cost coming from Weber um
[2:03:05] by signing this. It just really lets us
[2:03:07] work back and forth like we've done for
[2:03:10] the last 25 years.
[2:03:12] >> Phil, any questions I can
[2:03:13] >> Is there a time frame on this how this
[2:03:16] stands?
[2:03:17] >> Was it four, five years or or I think it
[2:03:20] was four or five years and it's
[2:03:21] renewable with the signature.
[2:03:23] >> I thought it was three and then reviewed
[2:03:25] annually. I thought it
[2:03:28] was what I was trying to understand on
[2:03:30] it. So
[2:03:31] >> yeah, I think the la the lastouou that
[2:03:34] we had that has long since been out of
[2:03:36] place. I think the the deal made is long
[2:03:38] before my time was the county would pay
[2:03:41] Weaver County forfeit the taxes
[2:03:42] collected on those properties that are
[2:03:44] in Weber County and that was the payment
[2:03:45] towards the the services. We've never
[2:03:48] paid Weaver County a penny in 30 years
[2:03:51] for the services, but we've always
[2:03:53] worked great together back and forth.
[2:03:56] What really creates a bigger issue is we
[2:03:58] can't get over there in any timely
[2:04:01] manner in the winter. Um, and if an
[2:04:03] arrest happens in at Powder Mountain,
[2:04:05] it's in our county. They're part of the
[2:04:07] first district, which is backing cash,
[2:04:09] not in Weaver, which is the second
[2:04:11] district. So, if there's a case over
[2:04:13] there that needs an arrest made or
[2:04:14] something, they can do the keep the
[2:04:17] peace. We can always go over and do it.
[2:04:19] But he's they will be the first
[2:04:20] responders and they're happy to be a
[2:04:22] good partner.
[2:04:23] Is there, and maybe Kurt can answer
[2:04:25] this, you or or Chad, is there any um
[2:04:31] anything in here that addresses what if like there's two or three houses
[2:04:35] that get built up there? They're in Cash
[2:04:36] County and they're just rowdy houses and
[2:04:38] they're like all of a sudden the the
[2:04:41] calls are going to exceed any kind of
[2:04:43] taxes that we would
[2:04:45] >> Well, I think the way the the way theou
[2:04:47] reads now, it's not it's nothing to do
[2:04:49] with the taxes anymore. or it's on a
[2:04:50] billable hour by Weber County for
[2:04:52] specific services.
[2:04:53] >> Um so I think if if things got build
[2:04:56] over there and things were creating a
[2:04:58] lot more work for Weber County then we
[2:04:59] might have a discussion about what the
[2:05:01] cost of this truly is going to be. But
[2:05:03] um with the newou it takes the taxes and
[2:05:05] in lie of taxes and all that stuff out
[2:05:07] of the mix and it's just right down to a
[2:05:09] cost per hour.
[2:05:10] >> Okay.
[2:05:12] >> That kind of stuff be addressed in a
[2:05:14] three-year that's why the
[2:05:16] >> that's why has a term of three years,
[2:05:17] right?
[2:05:18] >> Yeah. There there were a couple things
[2:05:19] in there that maybe I'm I read a lot of
[2:05:23] it. I made notes, but I can't access
[2:05:26] them now, so I'm going to go off memory,
[2:05:27] but I want to say there was a 180day
[2:05:31] cancellation
[2:05:32] >> notice, which seemed long. I don't
[2:05:34] >> I think it was 90. I think it was just
[2:05:36] it might be 180. I thought it was 90
[2:05:38] like a general out clause in most
[2:05:39] contracts.
[2:05:40] >> Yeah. So, I was just thinking maybe we
[2:05:41] want to tighten that up. And then also
[2:05:43] there was no um well maybe there was
[2:05:45] some but I don't remember a a process
[2:05:49] for renewal or what happens if you don't
[2:05:52] renew like it just terminates
[2:05:55] >> like are the are the
[2:05:57] >> are there I don't know guidelines set
[2:06:00] forth to how to renegotiate that and
[2:06:02] what happens if there isn't one.
[2:06:04] >> I don't have it in front of me. I I I
[2:06:06] think if I if I remember the reading of
[2:06:08] it is um it's either three or four years
[2:06:10] is the expiration date to it and that we
[2:06:13] have to contact them if we want to
[2:06:16] renegotiate or continue on with theou as
[2:06:18] it as it as it spills. Is that correct
[2:06:20] Andrew?
[2:06:21] >> Y three years for the initial agreement
[2:06:24] and then
[2:06:26] essentially a yearbyyear renewal which
[2:06:30] can include
[2:06:32] >> a renegotiation.
[2:06:33] >> Yes.
[2:06:34] >> Yeah. But we have to instigate
[2:06:35] >> just maybe defining that a little bit
[2:06:37] more on what the renegotiation looks
[2:06:39] like and what happens if it doesn't. Um,
[2:06:42] and then the other thing was insurance,
[2:06:44] which is probably a small thing with the
[2:06:47] volume of calls, but if it got bigger,
[2:06:49] like if one of their guys goes out and
[2:06:52] it's on our property, is it covered by
[2:06:54] their workman's comp and their insurance
[2:06:56] and everything like that? Okay.
[2:06:57] >> Yeah. Yep.
[2:07:00] >> Cool.
[2:07:02] >> Okay.
[2:07:03] Just to clarify so we make sure we're
[2:07:06] giving clear direction to the sheriff
[2:07:08] and to the executive's office. Keegan,
[2:07:10] you're saying you want something
[2:07:13] more concrete than section.
[2:07:15] >> Well, I'm just I'm I I'm pointing it out
[2:07:18] because we're going to be on the hook
[2:07:19] and I've I've learned the hard way on
[2:07:21] contracts, you know, in in my
[2:07:23] professional career that sometimes the
[2:07:25] same people aren't in the room who made
[2:07:27] the agreement and sometimes if things
[2:07:29] are vague, it gets complicated. um in
[2:07:33] the event of an incident.
[2:07:34] >> So I'm just making sure we're you're
[2:07:37] what you're saying is you want section
[2:07:39] five changed because
[2:07:40] >> I think I think three-year term with
[2:07:43] annual renewal and then um termination
[2:07:47] is agreement of this agreement will be
[2:07:51] um excluded anything less than 60 days
[2:07:53] prior to expiration of the regular term.
[2:07:57] You have to make indication you want to
[2:07:58] do something different.
[2:08:00] >> 180 you got no you got 60 days to let
[2:08:03] them know whether or not we want to make
[2:08:04] a change
[2:08:05] >> and then the next paragraph is either
[2:08:07] party may terminate this agreement for
[2:08:09] any reason upon no less than 180 days of
[2:08:12] written notice.
[2:08:14] >> Well then number
[2:08:14] >> you have the 60 days to say yeah we want
[2:08:16] to just renew it and you have 180 days
[2:08:19] to say no we don't want to renew it.
[2:08:22] Here's what you got to do. So that
[2:08:24] starts the clock in two different ways.
[2:08:26] Okay.
[2:08:27] >> Probably addressing what your concern
[2:08:28] is.
[2:08:29] >> Yeah, I think it does. I wish I had my
[2:08:32] notes because I it's more clear there.
[2:08:34] >> Yeah. On line four says you can
[2:08:36] terminate the agreement immediately upon
[2:08:38] written notice if the other party
[2:08:40] materially breaches any provision within
[2:08:42] 30 days of receipt of written notice.
[2:08:44] So, there's several different back
[2:08:46] stops, too. Um,
[2:08:48] >> I don't disagree with your sentiment at
[2:08:50] all,
[2:08:51] >> but I felt like this was really pretty
[2:08:54] tight for the concern that I would had.
[2:08:56] And so I just don't want us to chasing
[2:08:58] around if we didn't need.
[2:08:59] >> No, that's good.
[2:09:00] >> I I think with the liability piece of
[2:09:01] it, and that's a good point to make. Um,
[2:09:03] but it's a really a statewide thing is
[2:09:05] because we're law enforcement, we have
[2:09:07] statewide jurisdictions, so to speak,
[2:09:09] because that's where our license comes
[2:09:10] from, post. Um, if I'm on my way I-15
[2:09:13] and I stop for a crash and I get run
[2:09:15] over by a car and I'm acting in some
[2:09:17] official capacity
[2:09:20] and I'm and I'm on duty at the time on
[2:09:22] the clock, so to speak, the liability is
[2:09:24] going to fall with Cash County. No
[2:09:26] different than Weaver County task force
[2:09:28] that comes up here and helps us with the
[2:09:29] SWAT rate or something.
[2:09:31] That's part of just being general
[2:09:33] postcertified is you could take law
[2:09:35] enforcement action anywhere in the state
[2:09:36] and be impossible to have anou with
[2:09:39] every every community. So every agency
[2:09:42] just takes that risk if you venture
[2:09:44] outside of your of your jurisdiction.
[2:09:46] >> Okay.
[2:09:48] >> So are you comfortable with that?
[2:09:49] >> Yeah, I think that clarifies the
[2:09:51] concerns I had. That's great.
[2:09:52] >> All right. Does someone want to make a
[2:09:53] motion on that?
[2:09:58] » Make a motion that we adopt resolution
[2:10:01] 2026-27
[2:10:03] approving the Powder Mountain Law
[2:10:05] Enforcement and Search and Rescue
[2:10:06] Interlocal agreement with Weaver County.
[2:10:10] Second.
[2:10:10] >> Okay. It's been moved and seconded that
[2:10:12] we adopt resolution 2026-27.
[2:10:15] Is there any further discussion? Those
[2:10:17] in favor say I.
[2:10:19] >> I. Any opposed?
[2:10:21] >> Okay. All right. In other business, the
[2:10:24] our September 8th county council
[2:10:25] meeting. Um I thought we were going to
[2:10:27] take that off the the agenda, but here
[2:10:30] here's the situation. UAC starts the
[2:10:34] night of the 8th, which is our county
[2:10:35] council meeting, but the only activity
[2:10:37] that night is the board meeting, which
[2:10:39] would take um Councilman Ericson away
[2:10:42] from our regular meeting so that he can
[2:10:44] attend the board meeting on our behalf.
[2:10:46] And then the next day, the next two days
[2:10:50] um the UAT conference is in Provo. And
[2:10:52] so, do we want to The thought was, well,
[2:10:56] maybe we need to reschedu our meeting on
[2:10:57] the 8th, but I think if we can have a
[2:11:00] meeting without Dave here for that one
[2:11:02] night and then go down early the next
[2:11:05] day, it would save a lot of hotels. We
[2:11:06] wouldn't have to reschedule. But how
[2:11:08] what do you guys feel about that?
[2:11:09] >> I want to sleep in my own bed.
[2:11:11] >> Okay. [laughter]
[2:11:14] >> But that's just one voice.
[2:11:15] >> Yeah. Tell us what you tell us what you
[2:11:16] think because we can reschedule that
[2:11:18] meeting on the 8th. We can move it.
[2:11:19] Well, that's what I was going to ask is
[2:11:21] the alternative dates would be
[2:11:22] >> the 15th.
[2:11:24] >> we meet on the 15th and the 22nd of
[2:11:26] August.
[2:11:27] >> Regardless, I'm not going to go down
[2:11:28] September.
[2:11:29] >> On the go ahead and meet and I'll I'll
[2:11:32] zoom in or something.
[2:11:33] >> Yeah.
[2:11:34] >> See, I could just add my two cents here.
[2:11:39] If you could postpone that meeting, it
[2:11:41] would give me a little longer to get my
[2:11:42] fireboard set up, get the budget, get
[2:11:45] all these [laughter] things done.
[2:11:46] >> In that sense, no, we're not
[2:11:49] If you can put it off a week, it would
[2:11:51] be helpful.
[2:11:53] >> That's the September meeting, not
[2:11:54] August. We're talking
[2:11:56] >> Well, that is the September meeting. You
[2:11:57] were talking about sliding that another
[2:11:59] week. That would be helpful.
[2:12:01] >> Okay. What What do you guys
[2:12:03] >> I'm not going to have a board at the
[2:12:05] best until August 28th, I think.
[2:12:08] >> So, so our August meetings are the 11th
[2:12:10] and the 25th, and then so September,
[2:12:13] we'd either have to do the first, move
[2:12:16] it up, or do the 15th after. that.
[2:12:19] >> Yeah. And the let's see September. So,
[2:12:23] let me get my calendar up here.
[2:12:28] » Yeah. I just need to know what you guys are thinking. Um,
[2:12:33] do you want to move that meeting to the
[2:12:34] 15th? Councilman Counciloman,
[2:12:37] >> two meetings in
[2:12:40] » there's a there's a lot of September 8's
[2:12:43] a very important date for us because
[2:12:46] >> tax if you're going to do a tax
[2:12:48] increase. Um we we have to get to the
[2:12:51] printer with that information
[2:12:54] midepptember. September 15th would be a little late.
[2:12:57] >> I remember that now. We would we would
[2:12:59] really prefer a decision if possible on
[2:13:02] September 8th if that's
[2:13:03] >> I think our treasurer would appreciate
[2:13:05] that too that if we met on the 8th
[2:13:07] >> I'm gone
[2:13:09] >> I'm not going to have a fire board until
[2:13:12] August 28th. Isn't that the
[2:13:16] >> 25th?
[2:13:17] >> My job 30 days and I have a fireboard
[2:13:21] and one of those entities that we're
[2:13:23] talking about the tax level
[2:13:26] is is you're talking about in one week.
[2:13:31] >> Yeah, it it's we're we're in a tight
[2:13:33] spot there. We're up against a printer's
[2:13:35] deadline and we're up, you know, we've
[2:13:36] got the fireboard issue and I'm not sure
[2:13:38] there's a a resolution that makes
[2:13:41] anybody really happy.
[2:13:44] you
[2:13:46] I realize you only have two meetings a
[2:13:49] month, but you could keep the ETH and pencil in the 15th as well.
[2:13:58] >> Good.
[2:13:59] The council meeting
[2:14:00] >> so much fun. Why don't we do it more
[2:14:02] often? [laughter]
[2:14:04] >> We can move it to Friday night. No.
[2:14:07] >> Yeah.
[2:14:09] >> I want a description of your idea of
[2:14:12] fun.
[2:14:15] Okay. So, so the general idea for now is
[2:14:17] to keep the ETH so that we can make sure
[2:14:19] and meet our tax obligation. If we want
[2:14:21] to um as as things progress towards
[2:14:24] there, if we need to talk about another
[2:14:26] meeting,
[2:14:27] >> um
[2:14:29] >> we can certainly have that discussion.
[2:14:33] >> Yeah.
[2:14:33] >> Anybody?
[2:14:34] >> That's fine.
[2:14:35] >> Is that okay?
[2:14:35] >> Yeah.
[2:14:36] And I don't know that I I might
[2:14:38] even be out of town September 15th. I
[2:14:39] I'm trying to figure that out. So, okay.
[2:14:43] Council member reports. Joanne, do you
[2:14:46] have something you'd want to report to
[2:14:48] us?
[2:14:48] >> I enjoyed the the 250 anniversary
[2:14:52] events. I went to several of those. They
[2:14:55] were excellent. That's my only thing.
[2:15:00] >> I don't have anything that needs to come
[2:15:01] before the council.
[2:15:03] >> Me neither.
[2:15:05] >> Catherine.
[2:15:06] >> No, Dave.
[2:15:07] Well, next week's our Cash County Fair,
[2:15:09] the number one event in the whole
[2:15:12] >> year. So, uh, Y
[2:15:14] >> that starts big time next week. So,
[2:15:17] >> so fair board meeting tomorrow, right?
[2:15:19] >> Fairboard meeting.
[2:15:20] >> 9:00.
[2:15:20] >> Um, where how many people are going to
[2:15:23] be at the fair Friday night? All of us,
[2:15:26] >> think. So, yeah.
[2:15:27] >> Yeah, we're going to be there. Um,
[2:15:29] Lamont Pollson called me. He's got a big
[2:15:31] wagon with horses and he's
[2:15:33] >> It's the same wagon that we used out
[2:15:35] there. It's really
[2:15:37] >> in Louis.
[2:15:38] >> Tell him to add another Clydesil if
[2:15:40] we're all going to be there.
[2:15:41] >> Another what?
[2:15:41] >> Clydesil.
[2:15:43] >> What are you saying?
[2:15:44] Kegan?
[2:15:47] >> You'll be pretty proud of with all of us
[2:15:49] on there.
[2:15:49] >> I think Keegan was going to bring his
[2:15:51] wallet and that's why he needed some
[2:15:53] extra cooling power.
[2:15:54] >> Yeah, we had my
[2:15:57] >> Oh, there's a there's a fair dinner and
[2:16:01] >> they're having fair. It's just it's for
[2:16:03] the people that are involved in the
[2:16:06] fair.
[2:16:08] >> I'll give that one to you.
[2:16:09] >> It's the rodeo dinner 7 o'clock on
[2:16:11] Tuesday, August 4th. And they've asked
[2:16:13] for an RSVP if you can make that.
[2:16:17] So, I don't know if you all got that
[2:16:18] invitation, but check your check your
[2:16:20] emails for that.
[2:16:22] Okay. I the only thing I have to is just
[2:16:25] that we continue to meet with the
[2:16:27] executive on Monday mornings and I think
[2:16:29] those are very um productive meetings.
[2:16:32] We're able to gives us a chance to
[2:16:34] really flesh out and talk about some of
[2:16:36] the things that are going on and I'll try and do a better job of giving
[2:16:40] you all a report like here's what we
[2:16:42] discussed and here's kind of where some
[2:16:44] of the where we're at with some of those
[2:16:46] things. That was my intent all along. I
[2:16:48] just haven't done a good job of that. So
[2:16:50] I'll do better.
[2:16:52] Funny story is do you know how Janine
[2:16:56] and the county put all the flags out
[2:16:58] front?
[2:17:00] So we have a picture of an individual
[2:17:04] coming and turning them all upside down
[2:17:07] and poking them in the ground.
[2:17:09] >> Oh no.
[2:17:09] >> Then then the we have a camera on the
[2:17:12] thing. Couldn't identify the person that
[2:17:15] did it. But about 30 minutes later, two
[2:17:18] men in work clothes are jump out of
[2:17:21] their truck and go along and turn every
[2:17:24] one of them back up.
[2:17:25] >> Good job.
[2:17:26] >> That That's
[2:17:27] >> Yeah,
[2:17:27] >> good for them.
[2:17:28] >> Good for Cash Valley citizens. That's
[2:17:31] awesome. I love it. Okay. Um
[2:17:34] >> Andrew, Burger King.
[2:17:36] >> Yes. Andrew
[2:17:36] >> King,
[2:17:40] if you all would like me to register you
[2:17:42] all for the UI conference, please let me
[2:17:45] know. Yeah, we need to get registered
[2:17:46] right away. So, let Andrew know if you
[2:17:48] can go to the conference on the 9th and
[2:17:50] 10th and if you need a hotel room on the
[2:17:52] ninth of the 9th or if you want to drive
[2:17:54] back and forth, it's in Provo.
[2:17:55] >> We communicated that last meeting,
[2:17:56] right?
[2:17:57] >> Everyone just text me. So, I I'm double
[2:17:59] sure.
[2:18:01] >> Yeah, please send Andrew a text right
[2:18:02] away. Maybe if we're driving down like
[2:18:06] Wednesday morning, maybe we could all
[2:18:08] ride together or some of us could ride
[2:18:09] together or we can save a little money
[2:18:11] and carpool.
[2:18:14] Okay, you are going because you're
[2:18:16] riding with me. Okay. Um, does someone
[2:18:18] want to make a motion on 11A, please?
[2:18:21] >> I move. Is this my room? Sorry. I move
[2:18:24] to enter into executive session held in
[2:18:26] the council conference room for
[2:18:27] discussion of the character,
[2:18:28] professional competence, or physical or
[2:18:30] mental health of an individual pursuant
[2:18:31] to Utah code 52-4-205A.
[2:18:36] » Second. It's been moved and seconded
[2:18:38] that we move to closed executive
[2:18:39] session. Those in favor say I. I. I. Any
[2:18:41] opposed?
[2:56:35] Right.
[2:56:36] >> Someone make a motion to adjourn.
[2:56:38] >> So moved.
[2:56:39] >> Second.
[2:56:39] Move and second we adjourn this
[2:56:41] meeting. Those in favor say I.
[2:56:42] >> I. Any opposed? Okay.
