And a seconder for July 15th, 2026. Also [3:37] moved the minutes. Member of French, secondary, please. Member Coney, [3:41] thank you. Call a vote, member bull. In favor. Remember [3:45] to Carlo. Member French. In favor. Member Coney. In favor. [3:53] Member Sodi. In favor. I'm also a faveur for the [3:55] record of the motion has carried. And passed. Are there [4:00] any new requests by an agent or an applicant to [4:03] defer or withdraw an application listed agenda. Is C9? [4:16] Yep. Go ahead. Lalit Kumar. Yes, hire. Everyone follow. Yep. [4:26] Go ahead. Yeah, I want to just know like you [4:31] guys just, everybody's in the favor, just all people's like [4:35] favourite, favourite, favourite. So I want to know, can I [4:38] you repeat that question again for me. Oh, the question, [4:44] yeah. If there's any agent or applicant, so if you're [4:48] an applicant, do what you like to defer or withdraw [4:52] an application listed on today's agenda. If you want to [4:55] go continue with the hearing, then you don't have to [4:57] say anything. Okay, perfect. Are you good? Yes. Okay. Thank [5:04] you so much. Uh, we are moving on to regular [5:10] business. Minor variant applications. Application A4 - 26 located at [5:20] 27 Cranston Drive with the Applicant or Agent. Please introduce [5:25] yourself and present any new information. Lalik Kumar, that's you. [5:35] Yeah, it's me. Do you have anything new that you [5:40] didn't put in the application that we adhere today or [5:43] is everything that you put? Yeah. It's actually by far [5:47] the driveway measurement, right? Yeah. It's under 26 - 7 [5:54] Cranston Drive in the front of that. So there's a [5:57] specific space for that because I'm the cousin of the [5:59] person who owns this house. So I'm attending this meeting [6:03] behalf of him. Okay. So he's in right now in [6:07] the back home, right? Okay. Yeah. So there's a measurement. [6:12] So it's all most like we need relaxation of some [6:17] like inches, maybe in a feed, like less than feet. [6:22] For the driveway. We have a two drivers in the [6:24] front of our house. That's why they complete for us. [6:29] Okay. But there's nothing new on the application that we [6:34] need to know about, right? Yes. Okay. Thank you so [6:39] much. Uh, town planner or designate introduce yourself in presenting [6:43] new information. Through the chair, Sabrina's material, planning technician. I [6:48] have no new information. Thank you so much. Committee's members. [6:51] Do you have any questions or comments on the application. [6:55] Member France. Through you, Chair. I have two concerns. Uh, [7:00] the first one is that there is no sign posted. [7:03] So I'd just like clarification that there was one, but [7:06] there was no sign when I drove past. And the [7:08] second I know that the plan already noted this, but [7:11] the job's been done. Like the work's all complete. So [7:17] that's of a concern to me. Like why are we [7:19] here? Like why are they coming now. So. Thank you [7:23] very much. Thank you member French. Um, any other question [7:28] member? So the two variants requested. One is for the [7:34] second driveway, which apparently has already been constructed. But the [7:38] driveway width, that, does that apply to the driveway in [7:43] front of the garage. Through the chair, yes. So it's [7:49] both driveways combined the measurement. Okay. So when was that [7:54] driveway in front of the garage built. Through the chair? [7:58] The original driveway. Yes. The original driveway that's too wide. [8:06] Right. It's only supposed to be 10 metres and it's [8:09] 14. 28 metres. Through the chair, um, measurement for both. [8:17] So the driveway in front of the garage and the [8:19] new access combined is 14 metres. So the driveway in [8:23] front of the garage complies, but the new access, the [8:28] new driveway that added to the existing, uh, brings it [8:33] over. The permitted, um, maximum. So the driveway width doesn't [8:39] apply to one driveway. It applies to both of them [8:41] combined? Correct. That's the way the bylaws worded. Yep. All [8:46] right. Thank you member. Boy member DeCarlo. Uh, member bull, [8:52] just answer my question. Got it. Okay. Thank you. Any [8:56] of the questions or comments for committee members. Member Coney. [9:01] Through the chair to the applicant, uh, just wondering why [9:05] you want to put a driveway right across the front [9:07] of your house. What are your plans for this entrance. [9:25] To the applicant, the questions towards you. Kansiya's name. Let [9:31] me. Mr. Kumar. Yes, I'm here. So, um, my cousin [9:41] is with me too. Can I ask him the question [9:43] about this too. Uh, yeah. Go ahead. And back [9:57] there. You made it to the way they considered 3D [10:01] HSPs. But they were very solid. Sorry, excuse me. Excuse [10:05] me. You're going to have to put your miter muke [10:07] when you're ready to answer. Just, just raise your hand [10:10] or just, uh, just say you're ready to speak. But [10:13] you got to put your microphone on mute. No, no. [10:16] That's a. Gentleman. He's a way of. It's just not [10:19] very clear. If you could speak, um, slow. Or louder. [10:24] Okay. Can you speak slower and louder. Yes, sure. I [10:29] will speak soil louder. So what my cousin said. So [10:33] the space on the one outside of our house. And [10:36] one is whether the look of lover house. If we [10:39] didn't make a, like the other second driveway, it looks [10:42] not nice too. And we have a backside of the [10:45] pool too. And we did not even touch any tree [10:48] over there in the drivers near that too. That's why [10:51] we made this too. So I'm in the front of [10:54] the even dislocation. Like I'm sitting on the front of [10:59] the house right now. If anybody's want to see the [11:03] live video on it, I can show you guys. Okay. [11:07] Okay. Thank you, member Coney. So can you tell me [11:09] what is the purpose of it? I didn't understand. I'm [11:13] sorry. Can you repeat what is the purpose of the [11:16] driveway. Yeah. So it's just because of the space to [11:22] going back and through the to the pool. Right? So [11:25] the driveway is there to have access to the pool. [11:29] Yes. And the one side is the garage. And sorry. [11:38] One side is the garage. One side is the way [11:40] to the pool. So you're going to have vehicles driving [11:44] back to the pool. Is that what you mean? It [11:47] says that it's going to be, uh, proposed hardscape beside [11:51] the house. No, we don't drive back to the pool. [12:00] Okay. And just for, just for public records, can you [12:03] give us the name of the other person that was [12:05] speaking. So with me right now? The other gentleman, your [12:11] cousin. So he's in the back home. The owner of [12:18] this building. Okay. Thank you. Thank you. All right. Memorable. [12:26] Yes. I do have a question for the applicant. So [12:31] on the side of the proposed driveway, the existing proposed [12:35] driveway. You have hard scape. Um, what is that hardscape, [12:44] sorry, is it there or is it proposed? And what's [12:47] the purpose of it. Deer this way to the pool [12:53] just to be look nice. Like if it's the grass [12:55] over there, maybe with the like the rain, it will [13:00] be wet. Like we can't walk on the breast that [13:03] way. And, and you said, um, maybe I didn't understand [13:11] that the driveway was on, you need the second driveway [13:15] for access to the pool. Yes, right. I don't understand [13:19] that because you can access the pool through the house [13:25] or through the garage or on the side, other side [13:28] of the house. You don't need a driveway toxis. The [13:30] pool. Can you explain that, please? Yeah. Actually, we renovate [13:35] all the house. So what we plan like we have [13:40] a space on the side of the house. That's why [13:42] we made this. It's not on this way. It is [13:48] in the plan 2, right? Right. So it's on the [13:51] screen. Yes. So just to tell, sorry memorable to town [14:01] staff, just a couple concerns that are coming up with [14:03] me is, uh, the concerned with the AWSC. They always [14:08] thought that they're in front of. And then also. The [14:12] tree protection zone. They took some trees down. And then [14:18] it's saying from Townstaff report that you guys, they're responsible [14:21] for utility permits and everything because they're so close to [14:25] proximity to the area. So the question is from Town [14:28] staff is, is it more important that they get these [14:32] things in line before they come to the table here. [14:38] Through the chair, um, transportation had no further concerns regarding [14:42] the stop sign. They just wanted to ensure that the [14:46] residents were aware that the stop line cannot be blocked. [14:50] Um, it needs to remain visible for oncoming traffic. And [14:53] will not be removed in the future. Uh, so the [14:56] residents have been afforded this. Regarding the tree removal, um, [15:00] our municipal law enforcement has completed investigation. And they determined [15:04] that the trees were removed prior to the implementation of [15:07] the tree bylaw. And therefore, no further action can be [15:10] taken. Um, which landscape has no further concerns. Um, so [15:16] repeat that they're, they're in the middle of dealing with [15:18] the infraction of taking those movement, those trees. Just. The [15:25] entire. The investigation has [15:35] already been completed and they determined no further action can [15:38] be taken. No further acts. Okay. Memorable. Sorry. What I [15:42] read in the landscape comments and correct me if I'm [15:44] wrong that they did construction within the tree protection zone [15:49] and may have damaged a red oak tree. That's what [15:53] I was reading. And so, uh, they, and I think [15:58] it's, they should be responsible of that tree. Is damaged [16:03] if it looks like there's damage after they've constructed. Um, [16:07] so what's, you know, you say the further action. But [16:10] if they've damaged a tree because they built without a [16:14] permit or a tree protection zone, how do you use, [16:19] let's say they should be planting another tree because they've [16:21] damaged a tree. How do we enforce that? Where's the [16:26] consequence. It sounds like there was enforcement. Was there enforcement. [16:35] Through the chair there was enforcement in terms of looking [16:39] into it? Um, and going through that route. Because it [16:44] was done prior to the bylaw, there aren't necessarily consequences [16:48] that could be taken afterwards with respect to this application. [16:52] So if they can replant a tree, that would be [16:54] nice of them to do. However, it's not a requirement [16:57] from an enforcement perspective and enforcement was handled. This matter [17:01] is unrelated to the minor variants application though. So I [17:07] would just like to flag that. No, but if we [17:09] want, if we were concerned about the tree, we could [17:12] make them plant a new tree as a condition of [17:16] this variant that this committee decided to grant it. I [17:20] don't know. And do you know, is the red oak [17:27] tree damaged? Is it a live dead? Do we know. [17:37] Through the chair, I'm not entirely sure. I believe, um, [17:42] landscape may have mentioned it was, it was removed. Um, [17:45] but no further action can be taken. Landscape doesn't have [17:51] an issue with. Me. Member Corni through the Chair to [17:55] staff. So, so these people, they did the construction before [18:00] they asked for a permit. They took the tree down [18:03] when they shouldn't have. And the consequences for doing this. [18:09] Is that correct? So the chair that is correct. Thank [18:14] you. Move on. Uh, no. Member DeCarlo. Yeah, just start [18:20] a couple of questions here. Um, so I'm just looking [18:23] at the site plan in terms of its accuracy to [18:27] today's construction. And I'm wondering if, if the accuracy is [18:35] correct. So this driveway that you're proposing is what is [18:42] what's built today. It's exactly as built. This 14 foot [18:47] four inches wide. That's to the planner. City planner. Through [18:57] the chair, um, what seems to have been built today [19:01] is the, um, the proposed driveway, um, at 4. 37 [19:07] metres. Okay. And this was verified by you or just [19:11] the client or I'm sorry, the homeowner. How was this [19:16] dimetrium given to you? Uh, through the chair, this dimension [19:19] was provided on the site plan. Okay. And that's what [19:23] they went in for exactly that dimension. That's correct. Um. [19:30] So also looking through the plan and I'm looking at [19:33] the area where you're saying existing hardscape at the back [19:37] of the building. It seems that there's a structure that's [19:39] been built there and the pool. Is this new construction [19:43] that's occurred? And this question is to the, uh, homeowner. [19:49] The leap. Yes. I'm here. Yeah. So is the pool [19:53] there now or, or not? Oh, it's the pool is [19:55] there now. Okay. And you've also built a covered patio [20:01] or a covered. No, we didn't cover papillou. Sorry. We [20:06] did a covered pet to you. Okay. Did you acquire [20:09] a permit for that as well. Uh, yes. So you [20:14] had a permit for that. We, we have a permit. [20:18] We, we applied the pyramid. Okay. So you have a [20:23] permit. So the only thing that you did outside of [20:24] your perno is construct this driveway. And I'm assuming you [20:27] used the dry way to construct everything at the back. [20:30] That's probably what where this driver came to light. Am [20:34] I correct? Yes. Okay. So you're going to reinstate the [20:39] pool. You're going to have this cabana. You're going to [20:40] have this driver. Okay. So this dimension, you're very confident [20:43] that 4. 37 metres is the actual width that you're [20:47] proposing. Yes. It's a so it may the Arctic strand [20:53] the designer. Right. So the 40. 7. You mean. Okay, [21:01] fair enough. That's all the questions I have. Thank you. [21:04] Kate, thank you. Uh, any members are committee members. Sorry. [21:08] I have any comments, questions. C9. Secretary Church, does anyone [21:15] register to delegate to this application? Sir, the chair town [21:18] has received two request members of the public to speak [21:22] to the application. I have the first one, Mr. Joseph [21:25] Repe. [21:36] Good afternoon, ladies and gentlemen. And everyone on a committee. [21:42] Some of the stuff I could not understand what was [21:45] going on actually. So I will give you my version. [21:49] Where I think what happened in the last year, up [21:51] to date. So, um, my name is Joseph Repick, owner [21:56] of the 25 Cranston Drive. Now, before we begin, I [22:00] just want to make sure that this blueprint is officially [22:06] been stamped by the city of Caladin. As to build [22:12] to that specification, wherever it's on that print. Sorry. Can [22:20] you repeat that, the blueprint? Okay. Before we begin, this [22:25] side plan should have been, I believe, approved last year [22:31] or three months ago or six months ago. To give [22:33] it to owner or the builder to build everything, what [22:37] they build with the permit around the house. My biggest [22:41] concern is the softscape on the west side. If you [22:49] can see, it's actually only two feet. Okay? But. The [22:57] whole little footer, it says, it should be 3. 3 [23:02] feet and six inches. And taper down to a 5 [23:06] feet and 11 inches. That is not even close. I [23:13] just, when I received this, this letter, okay, this notice [23:17] of committee for adjustment. I really study a little bit. [23:21] And I found out, we started measuring. And it's only [23:25] 18 to 24 inches. So now my question is, why [23:30] did the construction begin. In a wrong dimensions. Okay. Thank [23:37] you. Um, that's a question for Townstaff. Through the chair, [23:44] I believe he's referring to the landscaping area. Um, the [23:49] town doesn't have setbacks for landscaping area, whether it's hard [23:52] or soft landscaping. Anyways, let's, let's move on to the [24:00] next. And that's, this blueprint, it shows exactly, um, hardcore. [24:08] And it says dotted lines. This will be a driveway. [24:13] The driver is already built. And also there is a [24:18] big three on the front of the house. Everything is [24:20] already ashwalt. Okay. So now what are we talking about [24:25] here? What I could understood that they're going to do [24:29] it now. We're going to approve this to build and [24:31] give them an expansion for another, I don't know, 18 [24:35] metres or whatever in between two drivers. Now which driver [24:38] is he talking about? One on the east side or [24:40] on the west side. And why are we expanding this. [24:48] House business or something? I have no idea. I'm a [24:52] neighbour. It's already track park over there. Some kind of [24:54] a threatened business at the back. So what should I [24:59] do now. Measurements are wrong. According to this side plan. [25:12] Is that it for today. Well, I will leave you [25:16] this and I want to leave this in the record. [25:18] Okay. It's all in here. Thank you very much. Okay. [25:21] And I need to have the answers. What is the [25:27] next. Step. I did talk to my neighbour. Before a [25:36] very nice guy. And he assured me a hundred percent, [25:40] but everything was built according to bylaws and amendments of [25:46] Kalenan bylaws. But I was very surprised when I saw [25:51] this. And now it looks like somebody opened up a [25:56] can of worms. I get it. Okay. And, uh, thank [25:59] you very much. But I need an answer why and [26:04] when are they going to move this heart. Core backwards. [26:09] Now I only have 18 inches. And also on top [26:12] of this, he installed a sprinklers. And then I'm sprinkling [26:16] on my property. And it looks like that's all his. [26:22] Visual. It looks ugly. Okay. Anyways, thank you very much [26:26] for your time. And I appreciate I need some answers. [26:29] Thank you so much. And Townstaff, can we answer some [26:31] of these questions that he has concerned. Yes. Uh, through [26:37] the chair, uh, in terms of confirming the purpose of [26:41] this application, um, and what's being proposed through this specific [26:46] application is the addition of the driveway, um, at the [26:52] top of the plan, uh, to clarify the plan does [26:56] say proposed driveway. It's been determined that the driveway is, [27:00] um, has been constructed. And it was constructed without the, [27:04] the appropriate, relief. So that's, they're now seeking the relief [27:09] for that. And that was caught through, um, an enforcement [27:12] exercise. Um, so while the plan does say proposed, that's, [27:16] that's all that, uh, this application is seeking to, um, [27:20] to address is the relief for that. Uh, we can't [27:23] speak to the proposed hardscaping or truck parking or the [27:31] sprinklers. Those would be private matters. Um, that can be [27:34] dealt with specifically with, with the, the, your neighbour. I [27:39] don't know where he went. Um, with the neighbouring resident, [27:43] um, and if there's any further concerns or complaints, it [27:47] can go through by law enforcement if he sees fit. [27:52] But. Thank you. Um. Secretary Judge. [28:02] Memorable, go ahead. Uh, can I ask a question of [28:07] the deputleman who just spoke to us. Sir. Can I [28:13] ask you a question? Yeah. So what I don't understand, [28:20] um, they say on this plan proposed hardscape, what is [28:26] there right now. Did you say right now this, this [28:30] is what I received. But in actual measurements at only [28:35] 18 to 24 inches. No, sorry. Where's the cross hatched. [28:40] It says proposed hardscape. There's the driveway. And then behind [28:44] the driveway adjacent to your property, what's theirs? It grass [28:49] now or is it? Nothing. It's a wall and a [28:53] hard asphalt. It's asphalt beside the building? Yeah. It's a [28:57] wall here in ashwater on this side, but the distance [29:00] from my property list is only a 18, 20 inches. [29:03] So there's asphalt all along the side of the building. [29:06] All the way down to, uh, to the end. It's [29:10] already been done. And like I said before, the driveway, [29:14] it's already, uh, the hard scope right here. Harscape is [29:19] all done. So I'm confused now why you're talking about, [29:23] you know, you're going to build it. You sort of [29:25] build. So a question to staff. Have you gone to [29:30] see the site. Through the chair? Yes. Site visit was [29:36] conducted at the time there was no trucks parked. Past [29:44] the driveway. Is that is their asphalt on the side [29:47] of the building side of the house. Was that asphalt. [29:54] Through the chair? I don't recall. My site visit was [30:04] for the proposed driveway that was shown in the site [30:08] plan. Not for the hardscaping that's past it. Right. So [30:11] the next question to staff, does the zoning bylaw permit. [30:18] Hardscaping to be asphalt. Through the chair, the definition of [30:26] landscaped area. I believe heartscape is, I believe it is. [30:33] You can have asphalt and concrete. But I know what [30:38] you're trying to do. Landscaping area means that portion of [30:41] the lot area of a lot required for the growth [30:44] and maintenance of grass flowers, bushes, trees, and other landscaping. [30:48] This definition may include any surfaced walk, surface patio, stormwater [30:52] management pod and swimming pool play facility deck not more [30:55] than 0. 6 metres above grade or similar, but shall [31:00] not include any driveway or ramp. Whether surface or not. [31:04] Because my question is, if that is asphalt beside the [31:07] house, you could consider it to be a driveway. And [31:12] then they've got a lot lighter driveway. If it is [31:16] asphalt and they can drive cars on it. So that's [31:22] a question for me. Just sounds like they've got to [31:27] a much wider driveway than the 14 metres. Okay, thank [31:29] you. Okay. Thank you. Thank you, sir. Um, Secretary Judd. [31:37] Threater chair. We do have another request from members of [31:40] public to speak to the application. Mr. Roman Gaber. [31:52] Good afternoon. Mr. Chair. Council. That picture is not what [32:01] is there. Um, there is, if you scroll down to [32:10] the bottom of that picture. Can you do that. To [32:16] the garage. The existing garage. There is a wall that [32:23] goes from the existing garage. All the way back to [32:28] within 90 feet of the end of the lot. I [32:38] believe that. On. The existing plan [32:48] from the outstanding. The outstanding part of the house, it [32:54] says 181 feet. Well, the wall on my side of [33:00] this property. I live at 29 Cranston. Goes to 90 [33:07] feet and it's over four feet tall. Beside that or [33:14] inside that at the back is a putting green, an [33:20] artificial putting green. And beside that is the pool. The [33:25] pool is not where it is shown on this drawing. [33:32] There is, uh, another building at the back with three [33:40] sideds enclosed. Open to the pool. I can't really describe [33:48] it any better than that because I haven't gone on [33:51] to the property. I'm not allowed to do that, obviously. [33:56] But from my perspective, it looks like there may have [34:01] been a permit issued. There may have been plans presented. [34:06] But the homeowner did whatever they wanted to do. The [34:12] driveway part, everything around the main house and the garage. [34:18] Is hardscape. Driveway exposed aggregate, whatever. Behind the garage. [34:29] Is a lean to roof. And there's all kinds of [34:35] storage under that. When I left today, there was at [34:39] least two vehicles at the back of the property parked [34:45] near where the pool is. Not what is shown on [34:50] this. My request. If I can have one, is that [34:59] somebody go out and inspect this property and compare it [35:03] to whatever permits were issued. And, um, determine what bylaws [35:11] are actually been contravened. I consider the four foot fence [35:18] on my side to be a material elevation change. I [35:25] believe that there are rules within the bylaws to elevation [35:31] changes. It changes the entire drainage off that property. So [35:39] I think there's a lot more here that has to [35:42] be investigated than a small variance on. [35:51] Certain proximity to other properties. Thank you, Roman. Um, to [35:59] town staff, I know the application is about the proposed [36:02] driveway. And that's the application. But I think there's larger [36:07] concerns here that I'm actually seeing myself. That it's not [36:13] as accurate. I think there's more issues. Do they have [36:16] permits in place for the other items. That are there. [36:28] Through the chair, uh, with respect to any additional buildings, [36:31] um, planning does not have the answers to that at [36:34] this moment. That would be a building permit matter. Um, [36:37] and the matters that were and the questions raised, um, [36:41] are really enforcement matters. Um, so at this time in [36:45] terms of, yeah, in terms of the application, like we [36:49] can't confirm. Yeah. Okay. Just a reminder to committee. We [36:52] do have to stay with the proposed. Application, which is [36:57] the driveway. Uh, in my opinion, there are concerns here. [37:02] For sure. Um, that are not accurate. What's the stance [37:06] for talent? What's the town staff stance on this application? [37:10] Now. You know, through the chair in terms of staff's [37:16] planning opinion with respect to the driveway, that's really what [37:18] we can, we can speak to. If committee would like [37:22] to make a decision on that or proceed with a [37:25] decision based on the discussion that's held, um, then certainly [37:29] can do so. But the staff report has been prepared [37:35] in planning opinion has been prepared on the proposal before [37:38] us. Thank you. Um, Lali. And then Lalit, do you [37:45] like to say something. Yes, sir. So actually I just [37:48] want to say like we have all the permits, what [37:51] we made here. Right? So what we built here. So [37:53] you guys can check even online. And you can welcome [37:58] to come check. Two. Okay. Thank you. We just all [38:02] right. Uh, member DeCarlo. Yeah. So I'm just, I'm going [38:07] to allude to what Mary Bo was going towards. And, [38:11] and I think thence with respect to what the driveway [38:15] width is, um, I mean, we just heard from the [38:18] homeowner that in fact that they want to use this [38:21] iO way to drive to the back to the pool. [38:23] So in my opinion, that's the driveway. Um, so I'm [38:29] looking at this not from the proposed what's on the [38:35] site plan in terms of the 14 metres. But I [38:38] think we need to look at the overall side yard. [38:40] If this gentleman intends to use this access point on [38:43] the side yard as a driveway. Because in fact, that [38:46] is the driveway. Outside of what's on the municipal road. [38:50] So, um, that's, you know, in terms of its actor, [38:54] I think we're falling short of what's really happening here [38:56] and what the use of this driveway is going to [38:57] be. And I think there needs to be some form [38:59] of an update. In reality of what the uses for [39:03] these spaces are. If that is not going to be [39:05] a driveway on the side, then I think there should [39:07] be some prevention of some sort of a, of a [39:10] fence, some landscape feature to block that area to avoid [39:13] some type of driveway through to the back. Um, or [39:17] you have to admit that you're going to be using [39:18] it as a driveway. One or the other. You can't [39:21] have, can't have both in my opinion. So I think [39:24] the unanswered questions here. And I think we need to [39:26] get to the root of what in fact the driveway [39:29] width is here. And knots what's shown on paper. Um, [39:34] so I, I'm, I'm just going to put that out [39:37] there for the rest of the committee to consider as [39:39] well. Thank you. Thank you member DeCarlo. Um, any other [39:47] questions or comments for committee members. Thank you. Are there [39:52] any members in the public here in Council Chambers wanting [39:54] to speak on the application. Anyone else. I see none. [39:59] Thank you. We'll now move on to a motion for [40:02] the decision regard. And it's matter. Do I have a [40:04] mover in secondary, please? Remember French. Um, I'd like to [40:12] make a motion to defer this application with costs. Um, [40:17] so that we can get an update. On the uses. [40:23] And that someone can actually go out and take a [40:25] look at this property and confirm that what's on the [40:27] paper here is actually what's happening. Thank you. That's a [40:31] long winded motion. Sorry. I have a seconder, please. Member [40:35] bull. Any questions or discussion on the motion. I see [40:42] none. I'll call a vote. Member bull. In favor. Remember [40:46] to Carlo. In favor. I'm a French. Hey Varconi in [40:51] favor. Member Sodi. In favor. I'm also a favor for [40:54] the record. This motion has been deferred. Uh, with costs. [41:00] Six months or sooner. To the applicant, well, they don't [41:05] have a sign, but. And we need a sign next [41:08] time for the applicant. Thank you so much. Moving on [41:12] to Application 8019 - 26 located at three Holland Drive. [41:17] Applicant or Agent, please introduce yourself presenting your information. Okay. [41:26] Good afternoon committee. My name is Mike Govania. I'm a [41:28] senior associate with West and Consulting and I'm here on [41:31] behalf of the owner UConn Construction Inc. Um. Just to [41:36] be mindful of time, I won't go through all of [41:38] the variances in detail. And generally, we are, um, not [41:42] in general. We are fully supportive of staff's recommendation to [41:44] approve. We accept the conditions that are attached to those [41:48] recommendations. Uh, the variances before you are to facilitate the [41:52] construction of a new addition to the building, deconstruct the [41:56] old part and rebuild a new three - story office [41:59] component at the front. We did prepare this brief graphic. [42:03] Thank you, April, for sharing that on the screen. Um, [42:06] which just gives a bit of an outline of some [42:08] of the variance areas. Um, the variances, many of them [42:13] are not officially legal nonconforming because the building was built [42:18] many, many decades ago. And there are no records. However, [42:21] it has existed since about the 80s. Um, and so [42:24] most of them is just preserving the existing condition and [42:29] addressing, um, what's necessary for the proposed edition. So I'm [42:33] happy to go through them or I can just answer [42:34] any questions of committee. Thank you. Committee members, have any [42:39] questions or comments. Sorry. Town Platten, Desert. President New Referees. [42:48] Good afternoon. Mr. Chair, members of Committee. My name is [42:51] Yvette George Community Planner with the Town of Caledon. I [42:54] do have new information to present today. I do want [42:56] to note that pages five and six on schedule C [43:00] have been included in an air and will be removed [43:02] in the post agenda. Okay. Thank you. Uh, Committee members, [43:11] have any questions or comments. Remember? Sorry. Schedule D the [43:21] conditions or schedule C. So I didn't know. Through the [43:25] chair scheduled seat. There are comments that do not pertain [43:29] to this application. Comments, schedule C. Okay. Any other questions [43:39] or comments for committee members. I'm a French. Through you [43:47] chair to the delegate here. Um, how many employees will [43:51] be at this building working at this building. So there's [43:56] nine full - time employees at any given time. Um, [43:59] the reason for, so that would base on our traffic [44:03] assessment assumed nine parking spaces at the maximum time that [44:07] they would be used. The remaining 15 is for visitors [44:10] to the site which would primarily be architects, engineers, um, [44:15] potential purchasers. Um, the traffic study does support based on [44:20] the nine employees. Thank you. So two in the warehouse [44:23] and seven in the office. Thank you. Do you any [44:27] other questions or comments from committee members. Member DeCarlo. Jury [44:35] to the applicant. So current use of the building is [44:40] what. It's currently a warehouse and has a very small [44:44] office component at the front. Um, the existing office at [44:48] the front is going to be demolished to make way [44:50] for a three - story edition. Which is a combination [44:53] of office and warehouse. Okay. The same use of the [44:56] same type of business use. Same business. It's the same [45:02] owner that's existing on the property. Uh, the office space [45:05] is going to contain, um, a large, large boardroom areas, [45:10] some areas for staff members that attend the site for [45:13] site meetings. Um, but it's a full office use. Okay. [45:19] Propose use of storage at rear. What, what is the [45:21] intended of that? The outdoor storage at the rear, which [45:27] is blue on the screen is existing and permitted. And [45:32] what's that. Uh, it's outdoor storage of it is a [45:36] forming company. There's a lot of concrete forming. So it's [45:39] equipment used for the construction process and completed material. Okay. [45:46] Okay. No further questions. Thank you. Any other questions committee [45:52] members. Comments. I see none. Oh, I see none. Uh, [45:58] Secretary's name registered to delegate this application. Through the chair, [46:02] the town has not received any requests from members of [46:04] the public to speak to the application. Any members in [46:08] the public council chambers wanting to speak on this application. [46:12] C none. Now move on to a motion for decision [46:15] regarding this matter. It's a reminder to Committee attached to [46:17] staff report as schedule D draft conditions. Do I have [46:20] a mover secondary, please? Number bowl. Jim be approved subject [46:26] to the conditions and scheduled the staff report. Thank you. [46:29] Secondar please. Member French. Any questions discussion on the motion. [46:35] See non callable member bowl in favor. Member to Carlo [46:39] in favor. French in favor. Aber Coney in favor. I'm [46:45] Rasodi. In favor. I'm also in favor for the record [46:48] of motion has carried and has been approved with the [46:51] second conditions to the applicant. You could now remove the [46:54] sign. Thank you very much. Moving on to Application A [46:57] 04 - 2 - 26 located at zero Highway 50. [47:02] With the applicant or agent, please introduce yourself presenting new [47:05] information. Uh, go ahead, Daniel. Uh, hello. Good day committee [47:13] members, uh, staff and, uh, members of the public. Do [47:19] I have access to the camera? Or is it, uh, [47:25] yeah, you need to share something. No, I was just [47:28] wondering if, uh, because, um, because, um, if the camera [47:31] was working, but I guess it's okay. I don't think [47:34] you can see me, but it's okay. If you could [47:35] hear me, that should be sufficient. We can't see you. [47:39] We just, we can hear you, but I think that's [47:41] on your end more than ours. Okay. Um, just give [47:47] me one second. We have a, we do have a [47:51] plan that we can, she's ready to share the site [47:55] plan. Okay. [48:08] Perfect. Um. Just so yeah, so my name is Daniel [48:13] Branzia. I'm here from Smart Center's REIT. And we own [48:18] the property at, uh, the Southeast corner of Healy Road [48:23] and Highway 50. It's vacant lands. Um, but we are [48:27] developing it right now with two additional retail units, uh, [48:31] it will be an expansion to the existing smart centres [48:35] Bolton. Uh, shopping centre. And, um, we are now going [48:40] through site plan approval and designing the site. And the [48:44] reason why we're here is to ask the committee if [48:47] we could reduce the parking space setback. To Highway 50 [48:52] from nine metres to two metres. To seven metres, sorry. [48:55] Nine metres to seven metres. And, um, the associated planting [49:01] strip, the landscape planting strip from nine metres to seven [49:05] metres as well. Uh, overall a two metre reduction. The [49:10] reason is because, um, originally just for some background information [49:16] on this file. Originally, we were providing about 10 metres [49:20] set back to Highway 50 for the parking and for [49:24] the landscaping. However, uh, through the site plan approval process, [49:29] which we're going through now, the region of peel has [49:33] requested a road widening. So they would like to take, [49:37] uh, approximately 2. 44 metres along the frontage of the [49:40] property, which basically puts us a little bit short of [49:44] the zoning requirement. So it wasn't an intentional design by [49:50] us. It was a requirement to meet peel regions Road [49:53] Widening standards. And so we are going to, um, provide [50:01] some enhanced landscaping along a regional Route 50. It's going [50:05] to look really great when it's built out and done [50:08] lots of trees and bushes and native species. Uh, the [50:12] public realm is going to look really nice. And, um, [50:16] ultimately this would really only affect 17 parking stalls, uh, [50:20] along Highway 50, as you can see at the, at [50:22] the bottom of the plan, uh, which is the only [50:26] Parkinson's be affected. And, uh, everything else would, would, would [50:30] match the existing shopping centre and the overall design. So [50:33] we, we hope that the committee. Will support our request. [50:36] And if you have any questions, uh, please let me [50:39] know. Thank you. Thank you very much. Uh, talent doesn't [50:44] planner. Please introduce yourself through your chair to the committee. [50:49] Good afternoon. Chris Bean planner with the town of Caledon. [50:51] I have no further information to add. Thank you. Members [50:56] of the committee, have any questions or comments, concerns. I [51:01] see none. Secretary Treasure, has anyone registered delegate to this [51:05] application. Through the chair to town has not received any [51:09] requests from members of the public to speak to the [51:12] application. Thank you. Any members of the public council chambers [51:16] have any questions or comments on the Application. C none. [51:22] We'll now move on to a motion for decision regarding [51:24] this matter. Do I have a mover in Secondary, please? [51:26] Memorable. Application be approved. Secondary member French. Thank you. Any [51:36] questions or discussion on the motion. Is the nine call [51:41] a vote member? In favor. To Carlo. In favor. I'm [51:45] a French member. Member Coney in favor. Member Sodi. And [51:49] favor. I'm also in favor for the record. Emulsion has [51:52] carry. This matter has been approved to the African Please [51:54] Remove the sign. Great. Thank you. Thanks. Have a good [51:59] day. Bye bye. Moving to Application A 048 - 26 [52:04] located at 41 Barry Down Drive. Would the Applicant or [52:09] Agent introduce yourself presenting new information. Good afternoon. [52:19] Um, I'm the Applicat on behalf of the homeowners. And [52:22] the new information. Today. Thank you. Uh, Town doesn't it, [52:27] planner. Please introduce yourself for sending you information. Through the [52:30] chair, Cindy Juba, planning technician. I have no new information [52:33] to provide. Thank you Committee members. Any questions or comments [52:38] on the application. C9. Secretary has a registered delegate to [52:45] this application. Through the chair, the town has not received [52:49] any requests from members of the public to speak to [52:51] the application. Did you have. It? Yep. Memorable. Question? Yeah. [52:57] I said I didn't see your hand. Sorry, I missed [52:59] it. Um, a question to the applicant. Has this addition [53:05] already been constructed? Yes. Yes, it has. Without a building [53:10] permit. That's correct. [53:23] Any other questions or comments? C. None. Ball. Okay. [53:33] Um, are there any members in the public? Did I [53:37] ask you a little? No, I have not. No. Secretary [53:42] Treasure. Is anyone? We did that, yeah. Aaron, you want [53:45] to council Chambers have any concerns or comments on the [53:48] Application. See none, but I'll move on to a motion [53:53] for a decision regarding this matter. Do I have a [53:54] mover in secondary, please? Member Sodi. I moved out the [53:58] application be approved subject to the schedule's DNE. Thank you, [54:05] Secondar, please. Remember, Coney, thank you. Any questions or discussion [54:13] on the motion. I see none. We now call a [54:17] vote, member bull. In. Favor. Thank you. Remember to Carlo. [54:27] In favor. Of a French. Favor. Remember Coney in favor. [54:34] Our sodi. In favor. I'm also in favor for the [54:37] record. This motion is carried. As matter has been approved [54:39] with the second dish. Thanks. You can now remove the [54:43] sign too, please. Thank you. Thanks. Uh, moving on to [54:46] Application 8. Yeah. Yeah. Sorry. So this is the second [54:54] application that's come before us today. That has already been [54:59] built, already been done. And then they're coming and asking [55:02] for forgiveness. I don't know, like what are the consequences? [55:08] Is it okay for everyone to just go build and [55:10] then come and see us? And, you know, if they [55:12] do it within the specs, it's okay. I don't think [55:15] this is right. You memorable. But I'd like to staff [55:22] to report back to us on what the consequence is, [55:26] uh, the town. In terms of law and policy on [55:29] people who build without building permit. Like to know that. [55:33] There has to be a consequence, right? All right. Thank [55:41] you. Um, moving on to application A 50 - 26 [55:48] located at 28 McFal Street. With the applicant or agent, [55:53] please introduce yourself in presenting your information on the Application. [56:03] Good afternoon. I am John Vanderwald. The agent for Michel [56:08] Payne here, the resident. At 28 McFaul and homeowner. We [56:15] don't have anything too much to add other than there [56:19] was a complaint lodged by the one neighbour at 22 [56:25] McFal. Do I respond to that now or after she [56:29] has spoken? Maybe after she's a registered speaker today. So [56:34] maybe after she, once she comments, then you can. Thanks, [56:39] John. Thank you. Would the town planner yourself presenting a [56:46] new information? Through the chair, Yvette George Community Planner. I [56:51] have no new information to provide. Thank you. Do the [56:54] members of committee have any questions or comments. Remember. [57:04] Con. Uh, yes through the chair to the applicant. The [57:11] complaint we received by the neighbour does seem legitimate. It [57:18] is going to take a lot out of his views [57:21] of his windows. So I have a concern about that. [57:29] Do you want me to respond to that? Yes, please. [57:32] Okay. Um. On the property survey that Michelle has had [57:39] done, okay. Um, the neighbor's house is 1. 2 metres. [57:46] From the property line. This is an open carport, okay? [57:52] And it's proposed to be one metre away as well. [57:57] So do that in English, uh, okay. It's seven foot [58:02] four away from the property line. Um. So it's still [58:09] a fair distance away. Okay. [58:19] And it is an open car part. She parks her [58:22] car there already. So all you're going to see is [58:25] a little bit of the roof. Uh, in the area [58:30] photos, we can see a temporary graduate. That has been [58:34] removed. That has been removed. And that was actually right [58:38] on the property line. Okay. That was actually placed right [58:41] on the property. Yeah. That has been removed. A while [58:46] ago already. Okay. Okay. So it's not, it's not there. [58:50] It's not there now. No, it's not. No. Okay. So [58:53] it will be less, we're a metre further away than [58:57] that. Uh, temporary carport was. Okay. Okay. Thank you. Thank [59:05] you. Any other questions or comments from committee members? C9. [59:13] Secretary. Memorable. Maybe for the applicant. [59:25] When I look on that street, there are no other [59:28] garages in the location that you are proposing them. A [59:32] lot of people park in their front yard. Are they [59:34] have garages in their backyard. So it's not covering up [59:38] other people's windows. Have you contemplated putting something in your [59:43] backyard. So it's not, so it isn't adjacent to your [59:48] neighbor's windows. Should I speak for us? Yeah, you can [59:51] speak there, Michelle. Do the chair? Yeah, just state your [59:55] name, please. Michelle Payne, homeowner of 28 McFall Street. Of [1:00:01] the 11 properties on 28 McFarland McFaul. Street. 367 of [1:00:11] them. Have garages. One is technically on judge. They all [1:00:15] have garages that were either set back. Or attached within [1:00:21] the house. Even the complaint of, um, 22 has a [1:00:27] garage setback. The layout of my property, unfortunately does not [1:00:34] allow me to make a garage. Set back behind my [1:00:39] house. Due to the way it was built prior to [1:00:43] my purchasing of it in 2022. If I was to [1:00:46] put a garage further back, I would be taken down [1:00:51] too many trees and disturbing too much of a landscape. [1:00:57] The other houses that Mrs. Mc O'Grady has indicated in [1:01:02] her complaint package of not having garages. The one right [1:01:08] north of me, which is number 36. Their property, their [1:01:14] house takes up the whole width of their property. It's [1:01:19] a two - story red brick house. And they're parking [1:01:21] is all in front of their house. From one side [1:01:25] of the property to the other. The house next to [1:01:29] that, number 38 is a grey house, one and a [1:01:33] half story. To the north of their house, they have [1:01:38] availability to build a garage or a cardboard. If they [1:01:43] so desire. Their driveway to the right of their house [1:01:48] also can accommodate multiple cars. She also included a picture [1:01:53] of number two George Street, where there's no parking, no [1:01:59] garage. But there is an old barn that's been on [1:02:01] the property for over 100 years. That if they chose [1:02:05] to, they can park in. But that property's driveway is [1:02:10] very much to the east of the house, and they [1:02:12] can accommodate multiple cars. I would. Like to have this [1:02:18] lean to just to protect my vehicles from the elements. [1:02:23] When I had that temporary carport on my driveway, I [1:02:27] had not heard one issue from the Mrs. Oedy regarding [1:02:34] it. It also stood at eight feet tall. There was [1:02:39] no complaints through the bylaws regarding that to my knowledge. [1:02:44] So four years of that being structured there. She did [1:02:48] not say anything to me. And, um, only now is [1:02:53] she bringing up an issue with me wanting to put [1:02:57] this lean to in this comfort. Okay. Thank you so [1:03:03] much for that. Thank you. Memorable. So a question maybe [1:03:09] to your consultant. When I look at the pictures of [1:03:12] the lean - to that you had there, it was. [1:03:17] Below the height of the windows on the adjacent property. [1:03:22] Um. So how, when I look at your plans, I [1:03:30] think the roof of the carport is higher than that. [1:03:36] I'm wondering, is there, would it make a difference. If [1:03:41] you reduce the height of the carport roof? Cause that's [1:03:47] really the issue. And if so, would it change the [1:03:51] effect on the neighbours. So excuse me, you're asking to [1:03:57] reduce the height over at the closest to 22 McFal [1:04:02] then. Is that what you're asking? Uh, to the south. [1:04:11] Yeah. Or. Yeah, to decrease the height overall. Would it [1:04:17] make a difference. Um. Right? Because when I will look [1:04:26] at the lien to the, I don't know what you [1:04:28] call it, the fabric one. It wasn't as high. It [1:04:33] was considerably lower than what you're proposing. So it wouldn't [1:04:38] have the same impact. What you're proposing now, what have [1:04:41] it's more significant impact on the neighbours? Not necessarily. No, [1:04:48] because don't forget that carport was right at the property [1:04:52] line. Okay. And it did have, um. Michelle has a [1:04:57] picture of it there. I may present. I have a [1:05:00] picture. I'm looking at a picture of it right now [1:05:02] on Google Maps. Okay. Are you looking at this picture [1:05:04] here? Absolutely. I'm looking at. A car in it, but [1:05:08] I'm looking at it. That centre peak of that temporary [1:05:17] carport. Stood eight feet tall. And. That and her windows, [1:05:25] how tall are her windows from the ground? Her windows [1:05:28] are about eight feet off the ground. Cause I, I [1:05:32] was just over there. Uh, this morning and took a [1:05:35] look. And to the windowsill, it's just under eight feet [1:05:39] to the window sill because she's got three rolls of [1:05:41] block, which is two feet. Then the floor level. And [1:05:44] then, then the window above that. So this, I've also [1:05:53] did a, um, a bit of a sketch where. The [1:06:01] sunlight would come. Number one, it's facing north by northwest. [1:06:07] Okay. So you don't get a lot of sunlight from [1:06:09] that anyways. Okay. But I took a shadow line from [1:06:13] the peak of the main house. I don't know how [1:06:16] I can show this to you other than pass it [1:06:20] round. Um, I took a line from here. If you [1:06:24] can see it down to the edge of the roof [1:06:29] and down further. Okay. Can you see that. That there [1:06:34] is 5'11, which would be at her house. Her windows [1:06:38] are way higher than that. Okay. Okay. So it would [1:06:43] not really. So the car report was higher. The original. [1:06:48] Those freestanding carport was higher. It was higher. In the [1:06:53] middle. It's a peak. Was a peak. Not at the [1:06:56] end at the where it was adjacent to a property, [1:07:01] how high it was. It wasn't, it wasn't the peak [1:07:02] of it. Right? It was six feet at the side. [1:07:11] Six feet to eight feet. It would have been, uh, [1:07:18] right about here. Okay. Which is the property line. That's [1:07:22] where the current port was. So it's, it's really not [1:07:27] appreciably higher. And what's your proposing by look on your [1:07:30] site plan. Just so that I know is eight feet, [1:07:36] eight inches. To. To talk of the beam. Top of [1:07:42] the beam with the top of the roof being higher. [1:07:47] Right? Yeah. Okay. Do you want to lower. It. Like [1:07:52] a foot? Yeah. I mean, if, if it, if it [1:07:56] makes it, uh, more palatable to council, we can lower [1:08:00] that by a foot if you like. But we need [1:08:04] room for Michelle still to be able to walk under [1:08:07] and clean her car and et cetera. Right. Understand that. [1:08:10] Yeah. Like we can increase the slope of that roof [1:08:12] and drop it. Drop it a foot if that would, [1:08:15] uh, appease. Counsel. We're open to that. Okay. Thank you. [1:08:22] Thank you. Okay. Any other commit questions? Remember DiCarlo. Sorry. [1:08:28] And members through you, Chair. Um. Just working through some [1:08:33] of the technical aspects of this. I mean, he's typically, [1:08:36] typically these three metre access ways were provided for these [1:08:41] types of communities to allow for a rear yard access [1:08:44] of a car or a garage or some sort. And [1:08:48] that's the reason why they kept these three metre side [1:08:50] yards just to allow you to do that. If you [1:08:53] wanted to. And that was the, that was way the [1:08:57] zoning was written at the time. Fast forward to today, [1:09:03] if we were to look at this as an accesser [1:09:05] structure, the only reason why this is here today and [1:09:09] we're asking for this one metre is because it's attached [1:09:11] to the house. That's the only reason. If it wasn't [1:09:13] attached to the house, this structure could stay at one [1:09:17] metre without a problem. And we wouldn't have this meeting [1:09:19] here today at all. It's just because it's right tied [1:09:22] to the house. And, um, so I think by reducing [1:09:27] the height by a foot, um, is it going to [1:09:30] help anything? You still have a root surface. You're going [1:09:33] to look at when you look out the window. Regardless. [1:09:36] Um, as you slope and upwards, um, I mean, the [1:09:40] only thing that I can suggest here is I don't [1:09:42] know why we have this huge, uh, overhang on the [1:09:46] outside of it. I'm assuming that the one metre is [1:09:52] to the, to the post, not to the, not to [1:09:55] the soffit. Am I correcting that assumption. Yeah. Yes, you [1:09:59] are correct. So it's to the soffit. It's not to [1:10:02] the post? No, it's to the, uh, post. Okay. So, [1:10:06] you know, possible reduction. Most definitely would, you know, would [1:10:10] be the best thing to do is try to reduce [1:10:11] that overhang. I don't think you needed that large. You [1:10:16] can, you know, get it to a six inches and [1:10:18] do what you need to do. You're already sitting at [1:10:20] eight, eight foot eight. Um, to the underside of the [1:10:24] soffit. But that structure that's proposed on top, I can [1:10:28] guarantee it's going to be a lot thicker than what's [1:10:30] shown there. Looks like a little piece of two by [1:10:31] six. That's not going to happen, it's not going to [1:10:33] work. It's going to have to be a little, probably [1:10:35] double that size. No, I do. Two by six would [1:10:39] work for rafters. That pass is building code. Uh, I [1:10:43] beg to differ on a snow load. I don't think [1:10:45] you're going to, I don't think you're going to get [1:10:46] it at one run. When you're dealing with a roof [1:10:50] load at that slope because that's technically a flat roof. [1:10:53] Not a slope roof. When you're down less than 412. [1:10:58] So I think you should relook at those factors. Um, [1:11:02] so again, um, I don't think, you know, the height [1:11:05] is an issue here. I think it's more so, you [1:11:07] know, uh, looking at it in terms of the four [1:11:09] tests and whether or not it is appropriate for the [1:11:11] area. You know, in my opinion, I think it does [1:11:14] meet all the four tests. It's, it's not, uh, it's [1:11:18] in keeping, uh, with, with what's going on there, what [1:11:22] was intended to happen. It is, uh, desirable. I don't [1:11:25] think it's a, you know, we're dealing with a massive [1:11:27] structure that's taller than the existing house. Um, you know, [1:11:31] the reasons why this does meet the four tests in [1:11:34] my opinion. And I don't think, uh, an overall, you [1:11:37] know, amendment to what's proposed here other than that soffit [1:11:40] be reduced to six inches potentially. Uh, because you're going [1:11:43] to have to put a gutter on that edge of [1:11:45] it just to keep the water from, from sloping off [1:11:48] and eroding soil anyways. Um, cause it will do that [1:11:52] at the base. So, um, and erode your footies. So, [1:11:57] uh, I, I, that's my opinion. I don't, you know, [1:12:01] I really think that this is a cut and dry [1:12:03] case regardless of, of, uh, what's been stated today. Thanks. [1:12:07] Thank you. Member French. Thank you. That was one, one. [1:12:11] Okay. Thank you. Remember Coney. Um. Sorry. Um, sorry. Yeah. [1:12:20] Go ahead. Through the chair to member de Carlo, did [1:12:24] you suggest that it should be reduced by one foot [1:12:27] the height of it. Uh. No, I suggest to keep [1:12:31] the height as is, but reduce the overhang beyond the [1:12:34] post. Um, you see how it's, it seems like it's [1:12:38] two feet beyond. Uh, I would just go six inches [1:12:41] after that post. And not intrude more into that one [1:12:45] metre side yard. Because you're basically sitting, uh, probably a [1:12:49] foot away from the fence line to her, to her [1:12:52] sight line. So it's actually pushing it back to the [1:12:54] post. But the height is already there. I mean, eight [1:13:00] foot eight. Is a typical garage door height for any [1:13:04] vehicle. Uh, you know, uh, if the snow on it, [1:13:09] you know, you can imagine you might lose a few [1:13:11] inches as it is. So, you know, eight foot eight, [1:13:13] you're on the bare minimum of, uh, of, of, of [1:13:16] many types of vehicles. Thank you, member DeCarlo. Uh, yeah, [1:13:24] we'll get the, okay, any other questions for committee members. [1:13:27] C9, Secretary of Treasures, anyone registered delegate to supplication. Through [1:13:32] the chair town has received one request from members of [1:13:35] the public to speak to the application. They have also [1:13:37] provided written comment and it was circulated to the committee [1:13:40] members. Please go ahead and misogrady. Thank you. Sorry about [1:13:48] that. I was worried you were voting already. No, no, [1:13:51] you, we had young. Okay. It's okay. Um, I do [1:13:55] have a prearranged speech here and it might be repetitive [1:13:58] on some of the stuff, but I'd like to, if [1:14:00] you can give me the five minutes for that, I [1:14:02] want to thank you for allowing me the opportunity to [1:14:04] speak today. My name is Judy Prima and I'm here [1:14:07] to speak on behalf of my friend Lindo Grady understanding [1:14:11] how difficult it can be to speak publicly. I have [1:14:14] offered to help wrote today being a friend of Linda's [1:14:16] for over 40 years. I will respect your time in [1:14:19] knowing you have had the opportunity to review the submitted [1:14:22] opposition statement in advance of the herring. Which in our [1:14:25] opinion, identify that the minor variants did not comply to [1:14:28] all the four tests. If I may quickly summarize the [1:14:32] proposed carport is asking to be a mayor one metre [1:14:35] from Linda's property rather than the bylaw setback required of [1:14:39] three metres, though a couple of metres on paper reads [1:14:42] to be minor and insignificant in reality, each metre counts, [1:14:47] especially if you consider beyond beyond the property line that [1:14:51] the current neighbouring house is a mayor one metre from [1:14:53] the driveway. In addition, we believe the one metre does [1:14:57] not take into consideration the overhang, which we just confirmed [1:15:00] today. Which will further negatively affect the natural light coming [1:15:04] into your windows, where she currently works from home 90 [1:15:08] percent of the time at our dining room table. The [1:15:11] slope group would become an eyesore in obstructing the view [1:15:14] from her windows, her bottom window is seven foot high. [1:15:18] And now she would have to be looking at a [1:15:20] carport roof line, an overhang and a whole carport roof [1:15:24] rather than the current open space that she has. With [1:15:26] the water running off the slope roof directly onto her [1:15:29] property during heavy rainfalls, which we all know have become [1:15:32] extreme these days. This could easily flood her basement, which [1:15:35] she uses as added living space when her children and [1:15:39] grandchildren visit. Linda has shared that the applicant, Michelle. Uh, [1:15:44] purchased her home approximately four years ago. And I understand [1:15:47] that the relationship between Lyndon Michelle, thus far has been [1:15:51] good and respectful. You know, the carport, for example, six [1:15:54] foot, Linda's window is seven and it's the peak that [1:15:56] was eight. So Linda had shared that the applicant, Michelle. [1:16:00] Purchased her home approximately four years ago. And I understand, [1:16:05] I think I'm repeating myself that they've had a good, [1:16:06] good relationship. Linda has lived in her modest home for [1:16:10] 20 years where she was a sole provider in raising [1:16:12] her two children. And since become a grandmother, Linda continues [1:16:16] to work hard to the stay and continues to work [1:16:18] long hours at her dining room table in hopes of [1:16:21] looking forward to retirement one day. Over the 20 years [1:16:25] that Linda has lived there. Prior homeowners approached Linda with [1:16:28] considering adding a garage or car porch next to her [1:16:31] home in which she shared her concerns with them. And [1:16:34] no minor variants application had been submitted until today. Today [1:16:39] at the new homeowner Michelle in being a respectful neighbour, [1:16:43] she is. Uh, did text Linda prior to applying to [1:16:45] the minor variants. Michelle Ascalinda, if she would be opposed [1:16:49] to the minor variants, explaining that she did not want [1:16:52] to incur a cost to apply for the minor variants [1:16:54] and if it was a problem with Linda. She had [1:16:58] communicated to her prior neighbours share that she was not [1:17:02] in agreement with building a structure being so close to [1:17:04] her home. Today, Lind is here before the Committee of [1:17:08] Adjustments in opposition of the minor variants is noted in [1:17:11] her submission. And though Linda empathizes why Michelle would like [1:17:15] a carport, Michelle knowingly purchased a home without a carport. [1:17:20] Linda will be 65 years old this year. And as [1:17:22] we all know, a homeowner's large assassin - free retirement [1:17:26] is their house. In addition to the concerns expressed already, [1:17:29] the true potential of Linda's resale value of her home [1:17:33] may not truly be realised. In fact, it could neglectly [1:17:37] impact her resale value should this variance be approved, in [1:17:40] that the home's main dining room and bedroom windows would [1:17:43] have an unsightly obstructed view of a car pour affecting [1:17:46] the natural light coming into the main living areas. Most [1:17:50] concerning is the stormwater runoff directly on to Linda's property, [1:17:54] increasing the risk of the basement flooding, requiring cost of [1:17:58] remediation, and who's going to pay for this. Today, Linda [1:18:02] is asking the Committee of Adjustments to please consider all [1:18:05] the information provided. Please kindly take into consideration the negative [1:18:10] impact this will have on Linda's quality of life that [1:18:13] she's enjoyed for the past 20 years. The negative impact [1:18:16] of Linda's future resale value as she is entering into [1:18:19] her retirement years. And to respect, remember that Michelle, knowingly [1:18:23] purchased a home for years ago, that did not have [1:18:25] a carport. Perhaps a solution today. I'm going to repeat [1:18:30] what some of you said, in which we ask both [1:18:32] Michelle and the town of Caledon to consider would be [1:18:36] an extending the driveway further back into Michelle's yard to [1:18:40] allow the carport to be built immediately behind Linda and [1:18:43] Michelle's house. The trees are industries on Linda's property. She [1:18:47] just mentioned that to me. In addition, the roof slope [1:18:51] should be reconfigured to ensure water runoff does not come [1:18:54] directly onto lendus property. This solution would provide to Michelle [1:18:59] her desired carport and in turn address Linda's concern that [1:19:03] could actually satisfy both parties and better suit the character [1:19:06] of the neighbourhood with all the cars and garages being [1:19:10] set back. Today, Linda's asking the committee to either reject [1:19:14] the minor variants as submitted for the reasons explained today [1:19:18] based on the Nugget Impact of the Carport being built [1:19:21] in such close proximity to her house or to defer [1:19:25] the decision of the minor variants to allow Michelle in [1:19:28] her contractor time to redesign the carport and move in [1:19:32] it back away from between the houses. I would also [1:19:35] ask if this is an option to move the carport [1:19:38] back, the Michelle and her contractor consider including Linda prior [1:19:43] to coming back to the Committee of Adjustments to reassure [1:19:45] Linda that the stormwater runoff from the roof is being [1:19:49] addressed. The suggestion could actually address both Michelle's needs and [1:19:54] Linda's serious concerns in which they both could continue to [1:19:58] have a good, respectful relationship. And it would maintain the [1:20:01] character of the neighbourhood. We just want to know if [1:20:04] this is possible. And we thank you for consideration and [1:20:07] would be pleased to answer any questions you may have. [1:20:10] Thank you. Any questions for the, uh, neighbours. C none. [1:20:20] Thank you so much. Are there any members in the [1:20:26] public here in Council Chambers? Wanted to speak on this [1:20:28] application. Uh, yeah, you can comment to the comments yet. [1:20:36] Right. Thank you for the chair and committee members [1:20:46] of hearing my refuttal. Just makes you stick to the [1:20:49] like proposal part of it. Yeah. Thanks. Um. Ms. Ogrady [1:20:55] claims that a carport roof will hinder her natural light [1:21:01] coming in through her curtains. In the four years that [1:21:04] I have lived at this property, these fixed closed windows [1:21:08] have never, ever seen the curtains drawn in the dining [1:21:13] room or lifted in the bedroom so that she can [1:21:16] look out and see. The open space of the side [1:21:20] of my house. Or former carport. In her suggestion of [1:21:27] moving the carport backwards neglects the fact that right behind [1:21:34] the side of my house, there's a hot tub that [1:21:37] was there previously before I purchased the house. And a [1:21:41] duck adjacent to the hot tub. The trees and foliage [1:21:47] I mentioned earlier are on my property. I have the [1:21:51] people prior to me put in electrical lighting systems through [1:21:55] the ground to light up portions of the backyard. I [1:21:59] have a lilac tree. I have two other trees beside [1:22:02] the lilac. Missile Grady has two very big maple trees [1:22:08] that are close to our property line. That would take [1:22:11] down trees if needed to be moving things back. There's [1:22:17] really no option to move a carport backwards. Into the [1:22:22] property behind her house and my hips. Considering my house [1:22:30] goes much further back into my property than her property. [1:22:36] If mistal grady had asked me, I would have told [1:22:40] her from the beginning, I have every intention of having [1:22:44] eave troughs and a downspout into my property so that [1:22:49] my foliage and property will have water for the trees [1:22:52] and the shrubs. Also in the text message conversation that [1:23:00] I sent to Ms. O'Grady on Wednesday, May 13th in [1:23:04] the afternoon. Stating that I, this is what I intended [1:23:09] to do. And that I would like to have the [1:23:12] minor variant applied for. And if she had any problems, [1:23:17] I said it's an open carport, not closed like a [1:23:20] garage. Please let me know your response right away as [1:23:24] I need to submit for the variance. And if you're [1:23:26] going to have a problem with it for any reason, [1:23:29] I do not want to waste 2, 700 dollars on [1:23:32] an application. Thank you so much and have a good [1:23:35] rest of your day. Her response to me was, hi [1:23:38] Michelle, thank you for reaching out. And I appreciate your [1:23:42] following the bylaws, codes and regulations. At the moment, I [1:23:46] would have to say no, Linda, to which I responded [1:23:49] saying thank you for getting back to me. I appreciate [1:23:52] it and I will proceed with the application. On May [1:23:56] 13th, had she just said yes, I have concerns. I [1:24:01] don't think this will work for me. We would not [1:24:04] be wasting our time here. And I would not be [1:24:06] wasting this gentleman's time and my money on something that [1:24:11] she was obviously not approving of from the very beginning. [1:24:18] Yes, I bought a house that did not have a [1:24:20] garage or a carport. I don't believe four posts in [1:24:26] a roof. Hinder the look of the neighbourhood. If you [1:24:30] look at number three, George Street, and I do have [1:24:35] an image of that, which is right across the street [1:24:39] for me that I must look at every day, this [1:24:42] house has not have any siding on it for more [1:24:45] than 10 years. It has not been finished. I would [1:24:49] say that would hinder the look of the neighbourhood more [1:24:52] than four posts and a slight roof slight lean of [1:24:56] a roof. Okay. Thank you. Thank you so much. Thank [1:25:00] you. Um. Thank you to committee members. Any questions or [1:25:05] comments? Do the applicant. It's your last fraud. Nope. You [1:25:11] can be sitting next. Yep. Go ahead. Comment is the, [1:25:17] uh, applicant mentioned that these would be main windows to [1:25:21] the bedroom and the dining room. They are smaller windows [1:25:27] than, so the window at the front, which I'm assuming [1:25:30] is a dining room according to her letter has a [1:25:33] large window on the front. That would be the main [1:25:36] window. This is not blocking a main window. And same [1:25:40] thing in the bedroom. It's a smaller window facing the [1:25:44] side, but around the corner, there's also another window which [1:25:47] is much larger at the back of her house. So [1:25:50] it's not really blocking. And it's the north side. So. [1:25:59] Thank you. Day. A minute. Yeah, go ahead to rebottle [1:26:04] quickly. Two seconds. We just don't, we want to make [1:26:08] sure this is on the proposal. This is not like [1:26:10] a neighborly thing. So I understand there's certain concerns. Uh, [1:26:14] we did hear what your concerns were. We allow you [1:26:17] to rebuttal their concerns. Um, is there anything new that [1:26:23] you want to add or is it? I just wanted [1:26:24] to add that she did say sorry. No, not yes. [1:26:29] Go ahead. And then the discursins are share curtains. That's [1:26:32] it. That's all. Yeah. Thank you. Thank you. That's more [1:26:35] personal matter. So thank you everyone. We'll have the comments [1:26:42] now closed off. So we'll move on to the application. [1:26:45] There's no members in the public here at Council Schemers. [1:26:48] I want to speak in the application. We already went [1:26:50] through that. We will now move on to a motion [1:26:53] for this decision. Regarding this matter. As a reminder to [1:26:56] Committee of attached to staff report as schedule D. We're [1:26:59] draft conditions. Do I have a mover a seconder. [1:27:10] Move her a second here. Member to cart. Oh, oh. [1:27:22] My radicar. To approve application 050 - 26. Thank you. [1:27:29] With conditions. With conditions, with conditions. With detached conditions, yes. [1:27:35] The seconder, please. A member bull. Why do you hear [1:27:41] a wind sound. Any questions discussion on the motion. C9. [1:27:48] Call a vote. Member Bowl. In favor. Member DeCarlo. Favor. [1:27:53] I'm a French. Member Coney. In favor. Remember Sodir. I'm [1:27:58] also a favor for the record. The most are now [1:28:01] as carry. This matter has been approved with secondions. Thank [1:28:03] you. Moving to A Consent Applications. Application B018 - 26. [1:28:10] Located at 1 - 10 - King Street. With the [1:28:17] African or agent, please introduce yourself for presenting you information. [1:28:21] And yes, thank you. Go ahead. Yes. Stefan. Good afternoon, [1:28:28] Chair and members of the committee. Does everybody hear me? [1:28:31] Yeah. Go ahead. Great. Thank you. Uh, my name is [1:28:34] Stefan Steiku from MHBC Planning. And I'm representing the applicant [1:28:39] Emmanuel Reformed Church of Bolton. Uh, I don't have a [1:28:42] presentation today. Uh, given the scope of the application, but [1:28:44] we'll provide a quick summary to keep it brief. Uh, [1:28:47] so the Application before the committee seeks consent to establish [1:28:51] a three metre wide private servicing easement over part three [1:28:55] of the lens at 110 King Street West in Bolton [1:28:59] in favor of the adjacent property at 102 King Street [1:29:03] West. The easement will legally protect an existing water service [1:29:09] that serves 102 King Street, but crosses the 110 King [1:29:14] property line before connecting to the municipal. Uh, system within [1:29:17] the King Street right away. Uh, it might be helpful [1:29:19] to throw up the, uh, the draft R plan if [1:29:22] April or if somebody from, from the town has that [1:29:25] available. But just for the sake of time, I can, [1:29:28] I can continue, uh, it will. So the, the easement [1:29:32] will provide the necessary rights to access, inspect, uh, repair [1:29:37] the existing waterline. Um, and ultimately this easement is required [1:29:43] as part of clearing conditions, clearing the conditions associated with, [1:29:47] uh, with the, the previously approved severance of 102 and [1:29:52] 110, uh, King Street West. So as you can see [1:29:54] in front of you here, part two would be 102 [1:29:57] King Street West part one would be 110 King Street [1:30:01] West and part three is the easement. That is the [1:30:05] subject of this application before you today. Um, so as [1:30:10] I mentioned, uh, this application directly addresses, uh, three conditions [1:30:17] from a previous consent application for, for a severance to [1:30:23] sever these two lots, uh, the application for consent was, [1:30:27] was approved with conditions. Um, and, you know, we're now [1:30:31] in the process of clearing those conditions. So we, we [1:30:33] do have about, um, another couple of months to, to [1:30:38] finish clearing those conditions. And this did come up. Uh, [1:30:41] this easement did come up in discussions with region staff. [1:30:45] We, we had a, um, we had a utility company [1:30:48] go out and do the locates for all the utilities [1:30:53] and long story short, they found that, uh, that water [1:30:56] line crossing over from part two, which is 102 King [1:30:59] onto part one, which is 110 Kinyon into the right [1:31:03] of way. Uh, so as with the previous, uh, associated [1:31:07] consent application, no new servicing development or physical changes to, [1:31:11] to either property or proposed. The applicant, the application simply [1:31:15] formalizes the existing servicing array arrangement. So the two properties [1:31:19] can continue to operate. Uh, independently following the severance. Uh, [1:31:24] thank you. And I'm happy to answer any questions. Thank [1:31:30] you. Any other questions, comments for committee members. Town doesn't, [1:31:37] please introduce yourself presenting information. Through the chair, Giuseppe Russo, [1:31:41] Community Planner with the Town of Calladin. Matter as a reminder to the committee, attach to [1:33:55] the staff report is scheduled E or draft conditions. Do [1:33:59] I have a mover secondary? Member Coney. Yep. In the [1:34:06] comments from, sorry, through the chair to staff. I noticed [1:34:09] that the real T - Services are asking for road [1:34:13] widening and long entire credit view Road frontage, but I [1:34:17] don't see that as a condition. Through the chair, so [1:34:22] realty services, their position is whenever there's an application, they [1:34:26] would like to receive road widening. Road widening would have [1:34:30] been through the previous consent, but we informed them that [1:34:34] it's going to be through the future draft plan, a [1:34:37] subdivision that's coming in. Um, so it's a future application. [1:34:41] It's still their comments. I included it. We will get [1:34:44] the widening that we need. Okay. Thank you. Thank you.
