Using and we know the date- [3:37] often want to build housing to [3:40] promote their mission to provide [3:42] housing. For people however due [3:44] to zoning restrictions and [3:46] approval- limitations are there [3:49] sometimes it's- difficult or [3:52] often impossible. For them to do [3:56] so we know that- from- analysis [3:58] a few years ago from the turner [4:00] center which is being updated as [4:02] we speak. Looking at only the [4:04] largest counties in california [4:05] so not even all the counties a [4:07] small subset of the counties [4:08] said in a fight- I believe- [4:12] thirty eight thousand acres are [4:13] potentially a potential plans. [4:16] for affordable housing if you [4:18] take the whole state and god in [4:19] the nonprofit colleges it's a [4:21] lot more. This will be a game [4:23] changer. For the construction of [4:29] . 101% of portable housing- open [4:35] up tens of acres of land. That [4:37] will be affected prioritize- [4:39] builders particular non does the [4:41] bill that bill a hundred for [4:43] housing they won't have to can. [4:44] with the market rate developers [4:45] which is often a barrier in [4:47] terms of accessing. We have a massive [5:27] coalition- behind this bill of [5:30] affordable housing advocates [5:31] faith based. Organizations and [5:34] advocates- are labor unions- [5:36] business organizations I'm very [5:39] proud of this broad coalition [5:41] and I respectfully ask your aye [5:43] vote. As we all [7:48] know the shortage of housing has [7:51] created a desperate crisis first [7:52] stay in california's families [7:53] last year the california [7:54] department of housing and [7:55] community development released a [7:56] report enumerated in our [7:57] challenge we need to build at [7:59] least one million affordable [8:01] units over the next eight to ten [8:03] years. Has large property [8:03] holders faith based institutions [8:05] and private colleges are an [8:06] important position help us meet [8:07] this need as previously stated [8:09] there tens of thousands of acres [8:11] that are possible for us to use [8:13] to build affordable housing many [8:15] in very higher particularly [8:16] areas. These organizations as [8:18] long standing community anchors [8:19] which to lead in addressing our [8:20] housing and homeless crisis our [8:22] faith partner see this as an [8:23] extension of not only their [8:25] mission but also their moral [8:27] calling. The problem we're [8:27] trying to solve is that while [8:29] many these institutions are [8:30] ready to build and support [8:32] affordable housing the current [8:32] zoning prevents it our partners [8:34] you can take a year at the [8:36] minimum and we're typically [8:37] several years to all these [8:38] projects to move forward. That [8:39] kind of delay can cost us [8:40] hundreds of thousands of dollars [8:42] on these units and discourages [8:43] and prevents us from building [8:45] homes for low income families [8:45] and working families. This bill [8:47] insure that we apply reasonable [8:48] streamlining principles that are [8:50] religious communities can't open [8:51] their doors to californians in [8:52] need. We ballots approach by [8:54] including strong labor [8:55] requirements and worker [8:56] protections as well. As you can [8:58] see the analysis the bill has [8:59] support for about a hundred and [9:01] eighty groups from across the [9:02] state. Including labor equity [9:03] housing groups faith groups. [9:05] offer muslim jewish and [9:07] christian communities as well. [9:08] well collectively- just support [9:09] and I'm happy to help. Answer [9:15] questions as needed thank you. Driven by [9:54] our jewish values in our own [9:56] history of oppression countless [9:58] synagogues are eager to address [9:59] our homeless crisis homelessness [10:01] crisis. And support our [10:02] neighbors that are most in need. [10:04] and we know that our friends in [10:05] the muslim christian and other [10:07] faith communities share the same [10:08] important values. Faith [10:10] communities are some of the [10:11] state's leading organizers of [10:13] volunteering charity efforts to [10:14] help our neighbors experiencing [10:17] homelessness. But food your [10:18] donation drives temporary [10:20] shelter options and similar [10:21] campaigns are largely bandaid [10:23] solutions. Just yesterday the [10:25] sacramento bee reported a third [10:27] death this winter due to the- to [10:29] weather. Inclement weather for [10:31] people who are homeless. The [10:32] jewish sage maimonides has a [10:34] famous teaching about the latter [10:35] of giving charity. Where the [10:37] highest rung the most impactful [10:39] way you can give is to help [10:41] someone succeed themselves. In [10:43] fact this lesson is sometimes [10:44] credited as inspiration for the [10:46] proverb about teaching a man to [10:48] fish. Our community is [10:50] desperately want to create [10:52] permanent solutions for those [10:53] experiencing poverty hunger [10:55] housing insecurity and [10:56] homelessness. And we we're ready [10:58] with a quip for it synagogues [11:00] and other faith institutions own [11:02] large properties all over the [11:03] state's many in communities [11:05] where portable housing is [11:06] desperately needed. And many [11:08] with lan to spare. But we need [11:10] to pass this bill to remove the [11:12] red tape and prohibitive. [11:16] processes that make it hard to [11:17] build a portable housing. For [11:18] some pay institution this op. [11:19] could be their lifeline [11:21] providing revenue that can [11:22] stabilize their organization's [11:23] finances. This bill is a [11:26] creative solution to address the [11:28] critical issue of our time. And [11:30] gives it if communities of faith [11:32] important opportunity to form a [11:33] real minutes for. [1:00:12] as as I understand it when I [1:00:15] worked in local government a [1:00:17] lot. Once you change zone for [1:00:20] the zoning for one and made it [1:00:22] more dancer last dancer added v. [1:00:24] and all these other things it [1:00:26] affects the ability of other [1:00:29] property that is probably zone [1:00:31] for the same thing. That's [1:00:34] actually zone for it- to get [1:00:36] through the process itself- so [1:00:40] how do you address that if the [1:00:42] city is not going to be involved [1:00:45] . So that their general plan. [1:00:49] all of their elements that are [1:00:51] part of the general plan don't [1:00:53] get thrown out of whack. And out [1:00:55] of whack means in disfavor. With [1:00:59] that housing commission here in [1:01:02] california- I thank you for the [1:01:05] question a couple a couple [1:01:06] things this is not our [1:01:08] government cause a quorum court [1:01:09] throws out of local zoning the [1:01:11] there is land that may not be [1:01:13] zoned for residential- that's [1:01:15] owned by religious institution [1:01:16] that will now be zoned. For it- [1:01:19] the bill which is a good and [1:01:21] this was extensively negotiated [1:01:23] in governance and finance [1:01:24] committee with senator mcguire [1:01:26] who is the chair at the time. [1:01:28] three years ago- it it there are [1:01:30] a local height limit- often [1:01:32] applies or might be local have [1:01:35] an a plus one if it's in our for [1:01:38] commercial. Local zoning- it [1:01:43] hasn't made make some changes to [1:01:45] particularly for areas that you [1:01:47] know. The church land might not [1:01:48] be zoned for residential. But in [1:01:50] terms of the general or the [1:01:51] housing element I don't think it [1:01:53] has any effect. On on the rest [1:01:55] of it it's a city has owned for [1:01:57] different things in different [1:01:59] parts of the city- battle [1:01:59] remains. This will help cities [1:02:02] meet the arena. Because we know [1:02:05] the city sometimes own parcels [1:02:06] consumers are big fights about [1:02:08] this about whether a parcel is [1:02:09] actually realistic right and we [1:02:12] have a history with which to [1:02:13] which we tried to move away from [1:02:15] cities zoning a cemetery for [1:02:16] high density housing or a- brand [1:02:18] new target that was as bill two [1:02:19] years ago for high density [1:02:21] housing. Sites that we know [1:02:22] we're never going to get bills- [1:02:24] we tried to move away from that [1:02:25] but there's always disputes and [1:02:27] we know that there are. Even now [1:02:29] man that's identified that. They [1:02:30] hope will become available to me [1:02:32] that may not so this will be [1:02:34] helpful to cities in meeting [1:02:36] their the hardest part of arena. [1:02:38] the their most cities don't even [1:02:40] meet the market rate arena. But [1:02:42] almost no city meets are below [1:02:43] market rate units the hardest [1:02:45] part to me. This will help [1:02:46] cities meet. That obligation. [1:02:49] right yeah and I've heard this a [1:02:50] lot- in just a three years I've [1:02:53] been people I've been dealing [1:02:54] with this. In this legislature [1:02:56] for more than three years it's [1:02:58] been five six seven years I see [1:02:59] old bills that come through. And [1:03:01] not one of them has been [1:03:03] successful in dealing with- to [1:03:04] talking about otherwise we all. [1:03:11] wouldn't be here- I think. You [1:03:14] know my issue with bills. Blake [1:03:16] this. Is that. Here we go. We [1:03:19] kind of taking bites out local [1:03:20] ca. I that's the- it's not the [1:03:22] problem the problem is. Over the [1:03:24] last. To forty years the state [1:03:26] has imposed so many regulations [1:03:28] and such a process to get [1:03:31] through. That we have. Created a [1:03:34] situation where our supply. Is [1:03:36] severely behind the demand. And [1:03:40] no matter how hard we try and [1:03:42] what other fixes we do. We see [1:03:45] we just can't seem to fix that- [1:03:47] I know court current for [1:03:50] affordable housing projects. [1:03:51] that were started when I just [1:03:53] first got back on the city [1:03:55] council eight years ago. And [1:03:57] they're just now getting the [1:03:59] financing from each cd. To be [1:04:01] able to start the project so [1:04:04] that it didn't fix the process. [1:04:07] whatever that law was that they [1:04:09] were using to get this process [1:04:11] going it didn't fix it. What [1:04:13] needs fixed. Is the state's [1:04:16] entire process for building [1:04:19] everything. Because not only is [1:04:22] the housing falling behind but [1:04:23] once you build housing once [1:04:25] you've cleared the path to build [1:04:27] all the housing. We still have [1:04:29] roads flood control we have to [1:04:31] try to attract jobs we need [1:04:33] water infrastructure commercial [1:04:35] buildings to support that [1:04:36] housing. Affordable and safe [1:04:39] transit lines we need schools [1:04:41] and all of that is being [1:04:42] affected by the state's process. [1:04:45] and none of what we have tried [1:04:48] to do in the last five years or [1:04:50] ten years even. Has fix that. [1:04:53] and so we keep throwing sequel [1:04:55] exemptions into this project and [1:04:57] that project. But at the same [1:05:00] and then nothing's working. And [1:05:02] so at some point we're gonna [1:05:04] have to face the fact. That we [1:05:06] got to put everybody to work [1:05:08] doing all of those things but [1:05:09] all of those things are being [1:05:11] obstructed. By our process if we [1:05:14] don't address that is a state [1:05:17] we're never going to solve this [1:05:18] problem. I'm sure for I first of [1:05:23] all I. I don't disagree that the [1:05:25] state's men's puts roadblocks in [1:05:27] the way right and some of the [1:05:30] work I've done. Has addressed on [1:05:31] some of the issues that you've [1:05:32] that you've reyes I don't [1:05:34] disagree with what I do disagree [1:05:35] with is suggest that only the [1:05:37] state because we know that when [1:05:39] cities say. You're not allowed [1:05:41] to build any housing in this [1:05:42] area where you can build multi [1:05:44] unit over nocturnal we're gonna [1:05:46] reject all affordable housing [1:05:47] there are extractions that [1:05:49] happen. At the local level two [1:05:51] unfortunately. We have passed [1:05:53] streamlining bills no losses [1:05:54] since I've been here which is a [1:05:56] little over six years of. That [1:05:58] have been very successful in- [1:05:59] you know for example the next to [1:06:01] we're gonna you're gonna hear [1:06:03] that there are a for affordable [1:06:04] housing. The approval time goes [1:06:05] from several years to several [1:06:06] months- so- I partially agree [1:06:09] with you but I partially [1:06:10] disagree. Right and I understand [1:06:12] that. But mine be mindful that. [1:06:15] local agencies especially newer [1:06:17] cities. Were all made to go [1:06:20] through an x. Currently [1:06:21] expensive process doing a [1:06:23] general plan is a- is a long [1:06:26] process it takes probably three [1:06:28] to four or five years sometimes. [1:06:29] cost millions of dollars for the [1:06:32] community and it's all based on [1:06:33] what they're being told by the [1:06:34] state there general plan has to [1:06:37] include. And. So they include [1:06:43] all those things. Then there [1:06:45] give the bad of gray. That need [1:06:47] to be in for people to be to [1:06:48] come in and build. And then we [1:06:50] tell cities. Hey you guys are [1:06:52] doing your job. Searches do and [1:06:54] what we are they were told to [1:06:55] do. And now we're we're coming [1:06:57] out- with this exemption in that [1:06:58] exemption. To tell them that hey [1:06:59] you know what you guys are doing [1:07:02] your job you're not letting [1:07:03] these things through. They [1:07:04] can't. They can't by law because [1:07:06] that's when the third element of [1:07:07] this comes and that's the [1:07:09] lawsuit that comes at the end of [1:07:12] the parade. It just stop [1:07:14] everything. And we if we don't [1:07:16] fix that we're not going to fix [1:07:18] this problem and that's I I'm [1:07:20] I'm kind of tired of. Throwing [1:07:23] throwing solutions at the [1:07:27] problem there aren't working. [1:07:28] because we're not looking at the [1:07:29] underlying problem site. That the [1:08:51] things that will actually make a [1:08:53] difference and I really [1:08:54] appreciate this year- let me [1:08:56] just say that I've supported [1:08:58] this bill in the past and I [1:08:59] really appreciated this year [1:09:00] the- the religious institutions [1:09:03] being here because- this is [1:09:06] going. To provide an [1:09:08] opportunity. For outreach into [1:09:11] the community to build housing [1:09:13] that's desperately needed and in [1:09:15] communities that may have been [1:09:18] the most recalcitrant about [1:09:20] building affordable housing my [1:09:22] experience serving in local [1:09:24] government- is that- I'm- being [1:09:28] the mayor of a blue collar [1:09:29] community. We built housing [1:09:32] affordable housing in our [1:09:33] communities but thirty miles [1:09:35] away from us twenty miles away [1:09:37] from us the wealthier [1:09:38] communities. Abrogated the [1:09:39] responsibility and did not build [1:09:42] affordable housing at all. And [1:09:43] so it really put a lot of [1:09:46] pressure on those fund that [1:09:47] represented- I'm from a rural [1:09:50] agricultural community. You know [1:09:52] put a lot of pressure on us so [1:09:54] the more that we can change the [1:09:57] entire community and to do it [1:09:57] through- this bill I think it's- [1:10:00] a really important thing. Let me [1:10:02] just say that- I'm really sad. [1:10:07] and- the- at the disagree b. The [1:10:09] different- unions- I'm I'm I'm [1:10:14] there with you. By I want. To [1:10:17] have union protections want to [1:10:19] make sure we have good paying [1:10:21] jobs and that we're doing [1:10:22] everything we can to lift up the [1:10:24] work- and the workers both [1:10:28] because- quite frankly a lot of [1:10:30] these- housing units are are [1:10:32] going to be starter homes for [1:10:34] union members to be able to get [1:10:37] into and build. Build wealth and [1:10:38] leave something to their [1:10:39] families and so this is really [1:10:42] really important. But but the- [1:10:43] but the battle over the language [1:10:45] has me you know very concerned- [1:10:48] I don't. I don't want to be the [1:10:51] this is a housing bill. And it's [1:10:53] got some. Huge impacts on the [1:10:56] labor community but but I want [1:10:58] to hope that there's a sweet [1:10:59] spot where we can get to yes and [1:11:01] so there I think are many of us [1:11:03] here at the dyess- that want to [1:11:05] see. The disagreements between [1:11:08] the trades and the carpenters [1:11:10] resolve so that we can have a [1:11:12] happy peace and I'll be here [1:11:14] together and- hold hands and- [1:11:16] and move forward I don't want to [1:11:18] be killing housing bills [1:11:19] because- we can agree on things [1:11:22] like I just don't this is such a [1:11:24] critical issue that- we can't [1:11:26] wait any longer. And so- I'm [1:11:29] going to ask them senator wiener [1:11:31] if he's willing to continue to [1:11:33] sit at the table and to try to [1:11:35] work this thing out this comes [1:11:37] aye. Am I which is [1:14:40] considered moderate income below [1:14:41] market rate housing with the [1:14:43] bulk of the day under eighty [1:14:45] percent- low very very low [1:14:47] extremely low the average. Am I [1:14:49] always must be 80% or lower. We [1:14:51] also know that because of the [1:14:53] nature of- the state for the [1:14:57] housing funding streams as an [1:14:58] incentive to make sure that you [1:14:59] have. Some of the very low and [1:15:01] extremely low- income housing [1:15:03] and these projects as a big [1:15:05] financial incentive to do that- [1:15:07] so we are actually making sure [1:15:08] that were housing. Other people [1:15:10] who were in the most desperate [1:15:11] need. For a but this bill only [1:15:13] applies to a 100% deed [1:15:15] restricted below market rate [1:15:16] housing okay my second question [1:15:18] was the restricted- and then as [1:15:20] as far as- it. The conversation [1:15:24] regarding. The labor disputes- I [1:15:27] think it's very challenging when [1:15:29] you know the majority of us do [1:15:31] you want to support working [1:15:32] people getting paid fairly and [1:15:33] much more I know that that is a [1:15:35] deep deep concern of the larger [1:15:37] body- this is the housing [1:15:39] committee and I do just want to [1:15:40] frankly state. That if there's a [1:15:43] disagreement we have to [1:15:44] prioritize affordability. [1:17:51] and I know that you're- also a [1:17:53] personal environmentally [1:17:54] conscious that you're a [1:17:55] concerned about the colocation [1:17:57] or lack there of- of affordable [1:18:00] housing and jobs which is. A [1:18:02] tremendous concern in you know [1:18:03] in our own area city so one [1:18:05] eight knowledge all that as well [1:18:07] as- the obviously the- the [1:18:09] excellent work to your committee [1:18:12] stuff. Does in- assisting you in [1:18:15] in producing this work product. [1:18:17] I've relied upon the myself at [1:18:19] times over the last couple of [1:18:21] years so thank you for all that- [1:18:27] similar to- as- bureaus. Of [1:18:30] course- know you will expect [1:18:33] this is a maybe we've talked [1:18:34] about it- I'm a co author on [1:18:36] this bill I call through the [1:18:38] bill in the whole. The lack of this [1:19:48] language in in my humble opinion [1:19:50] again that's for sure of labor [1:19:53] committing somebody gets [1:19:53] immersed in this stuff day in [1:19:56] and day out- the current [1:19:58] language doesn't drive [1:20:00] apprenticeship- been and isn't [1:20:02] going to lead to a trained [1:20:04] workforce. It obviously won't [1:20:05] lead to application of a trained [1:20:07] workforce but won't even lead to [1:20:09] the creation or the building of [1:20:11] a trained workforce in the [1:20:12] state. Which the last time I [1:20:14] checked was lowest per capita of [1:20:16] all fifty states- in [1:20:18] apprenticeship programs in [1:20:21] general not just in [1:20:21] construction. So that has to be [1:20:24] resolved so that were in [1:20:25] integrity with the values that. [1:20:28] it leaves my caucus holds your [1:20:30] caucus or caucus holds a going [1:20:33] forward- because that's not what [1:20:35] we stand for not what we stand [1:20:38] for in terms of workforce [1:20:38] development- it taking a step [1:20:40] back is. Is does not okay- so [1:20:44] really. All sides needed come [1:20:46] forward in a dress all sites are [1:20:49] not putting that on the author [1:20:50] se but I do think it's an [1:20:53] unfortunate. Circumstance of the [1:20:54] way. We operate as a legislature [1:20:57] those rules have been here long [1:20:59] before any of us. That we would [1:21:01] have a bill whose primary [1:21:03] contention is labor standards. A very significant housing [1:21:11] bills but whose primary [1:21:13] contention is not the housing [1:21:14] piece in the production piece [1:21:16] but the labor peace starting [1:21:17] off. In the in the non labor [1:21:21] committee and then with all due [1:21:22] respect to center cut the owes [1:21:24] report work in government [1:21:25] finances going their- where. The [1:21:29] committee staff in in a people [1:21:31] who focus jurisdiction only on [1:21:33] issues or are not. Spent not [1:21:36] spent fifteen or twenty years [1:21:38] twenty five years the working [1:21:40] through these issues in a in a [1:21:41] professional manner so. That [1:21:44] also is not on the author or [1:21:46] this committee of I think it's [1:21:48] an unfortunate circumstance that [1:21:49] we have to proceed based on our [1:21:51] own rules and rules the way [1:21:53] rules has has a sign bills. In a [1:21:55] way that the deep seas issues [1:21:57] hanging up before they're in. [1:21:59] really the proper forum- in the [1:22:03] proper technical- for a in the [1:22:07] proper. To get a he know in a [1:22:10] way that I think would be [1:22:12] singular in consistent with all [1:22:14] of our values- consistent with [1:22:18] all of our values is not to have [1:22:21] multiple. Multiple standards. On [1:22:25] residential construction work [1:22:26] for so frankly work construction [1:22:28] work force in general. At times [1:22:31] last year. Through no fault of [1:22:33] anyone here. We had up to five [1:22:38] different versions of. But [1:22:40] workforce standards in different [1:22:42] bills being proposed- in moving [1:22:46] through the legislature. Again [1:22:49] without any real attempt to [1:22:51] consolidate those into a [1:22:52] statement of what our values [1:22:55] really are in that regard a [1:22:56] singular universal standard that [1:23:00] would apply to this kind of [1:23:02] work- so as center caballero [1:23:04] said anything center will have a [1:23:06] - all. Alluded to at least a one [1:23:09] per words into her mouth. But my [1:23:11] vote. Would not be my vote on [1:23:15] the floor. If we somehow arrived [1:23:18] all the way to the floor- [1:23:20] without still having addressed [1:23:22] all these issues senate [1:23:23] certainly willing to do my part- [1:23:26] it's not somebody else's work [1:23:27] it's all of our work but it has [1:23:30] to be resolved as far as I'm [1:23:32] concerned. Before we get to the [1:23:33] final day of reckoning because [1:23:35] otherwise I think it puts us in [1:23:37] the spot. Where people like me [1:23:38] of saying it's okay it's okay to [1:23:41] have to not know what. What are [1:23:43] standard really is. In you know [1:23:47] to move forward bills that [1:23:49] frankly are at odds with each [1:23:50] other- maybe your bill my bill [1:23:53] for example last year was two [1:23:54] other bills that were at odds [1:23:56] with each other. We approve them [1:23:58] both as if. As if. Multiple [1:24:01] standards- okay in something [1:24:05] that's- so vital. To creating [1:24:07] equity in a california for all. [1:24:10] so since I said more than I [1:24:12] thought it would on this bill I [1:24:14] will save us next bill but I do- [1:24:17] you know we- have a couple [1:24:18] questions we get. Five very much [1:25:43] support this bill I a when I [1:25:45] first saw it and heard the [1:25:46] concept it seemed to make so [1:25:49] much sense to me when I. Think [1:25:50] about my community which I came [1:25:51] from being the mayor of there [1:25:52] are so many faith communities- [1:25:54] that. Would be interested in [1:25:55] this and they're providing a [1:25:56] 100% affordable for their [1:25:58] communities so it's a way to [1:25:59] build community- from within a [1:26:02] very local can control type of [1:26:05] structure. And so I think when [1:26:07] I. Think about why this is so [1:26:09] needed it really comes back to [1:26:10] the reality that the low housing [1:26:12] supply in the state which is [1:26:14] estimated to be two point five [1:26:15] million units a million of them [1:26:17] should be need to be affordable [1:26:19] and the next. Eight to ten [1:26:21] years- that that problem the low [1:26:23] the lack of supply is really a [1:26:25] major driver of our other [1:26:26] problems in the state like [1:26:29] homelessness. And a lack of [1:26:31] upward mobility people's ability [1:26:33] to access opportunity also- the [1:26:36] mega commutes that then- [1:26:38] contribute to climate change. A [1:26:40] whole bunch of problems that [1:26:42] really. In my mind swirl around [1:26:45] this problem of a critically los [1:26:47] housing supply. So when you- [1:26:50] when this bill and you also- [1:26:52] referred to it it could unlock [1:26:55] thirty eight thousand acres of [1:26:56] land. And I think that that [1:26:58] seems like. A really tremendous [1:27:00] potential to do a lot in our [1:27:01] state and I'm- I go back to the- [1:27:04] accountability and oversight [1:27:05] hearings that we had just. Last [1:27:07] week about it in this committee- [1:27:10] and the reality is that housing [1:27:13] creation remains stagnant. So [1:27:15] even though in the state we've [1:27:16] had some really great bills that [1:27:18] have created streamlining. And [1:27:19] some bright spots like the [1:27:21] number eighty is have- gone up [1:27:23] by a factor of ten but overall [1:27:27] across the state the great ab [1:27:28] show that were still. So we're [1:27:30] real we're not making the [1:27:31] progress we need to if we really [1:27:33] want to- deal with homelessness [1:27:34] in a substantive way and- and- [1:27:37] the middle class- housing [1:27:39] affordability crisis that we [1:27:40] see. So I agrees my colleagues [1:27:43] that I hope these disagreements [1:27:44] get resolved with labor the [1:27:46] labor factions and it's very [1:27:48] painful- to be to be talking to [1:27:51] your friends and- to see these [1:27:53] disagreements and- to hope that [1:27:55] there's a way to find that [1:27:56] middle ground it is. Clearly [1:27:58] true that you everybody needs to [1:28:00] come to the table in good faith [1:28:01] in order to find those places. [1:28:03] but really focusing on the need [1:28:05] for us to create the housing as [1:28:06] a top priority and to find- fair [1:28:10] standards that also create good [1:28:12] jobs and allow people to access. [1:28:14] a middle class lifestyle you [1:28:15] know all of those things are [1:28:16] really what we're going for I [1:28:18] think we should all share those [1:28:20] values. And so the question is [1:28:21] how do we get there and hi- have [1:28:23] every faith in all of the [1:28:24] negotiating partners that will [1:28:26] be able to but I also just want [1:28:28] to say thank you and I'm excited [1:28:30] to support this bill today. [1:28:33] thank you- senators- breaks here [1:28:35] I do have a couple of comments- [1:28:38] actually more questions. I [1:28:40] understand that we and [1:28:41] california is one of the leading [1:28:44] statements. California is one of [1:28:46] the leading space when it comes [1:28:47] to- many areas sleeper- berman [1:28:53] to laws and you name it we have [1:28:56] it- I had the privilege to sit [1:28:57] on labor- committee. These past [1:29:01] two years with center cortese. [1:29:03] and I think popped into my head [1:29:07] with regards to- some of the [1:29:08] comments and concerns that we [1:29:11] saw with bills are going to [1:29:11] committee and- and I'm not sure [1:29:14] if. Center to you would like to [1:29:16] comment or not but- it was with [1:29:18] regards to enforcement. And I [1:29:22] know that this bill is trying to [1:29:25] address some of these [1:29:27] conservative from some of the [1:29:28] safety concerns- but with [1:29:30] regards to enforcement- how. [1:29:35] what elements are components you [1:29:36] have here. Yeah they've cards [1:29:38] within that scope. Yes [1:29:43] absolutely it we there is a in [1:29:45] the can and with wait staff. [1:29:47] clinical plenty of ca. That do [1:29:50] follow the law and to the right [1:29:51] thing for the workers they're [1:29:53] all. We have we stuffed issues [1:29:56] in this. And so this bill [1:29:58] requires a payment of prevailing [1:30:00] wage the same prevailing wage [1:30:02] that you would get in a skilled [1:30:04] workforce situation. Plus non [1:30:05] health in and the other [1:30:07] requirements- and then if there [1:30:10] is a violation the labor [1:30:11] commissioner tim force or the [1:30:13] person whose. Wages of [1:30:15] installing can enforce it- and [1:30:18] but I also want to stress that [1:30:19] for that enforcement sb there [1:30:21] are this bill is voluntary. [1:30:24] right now no one no builder a [1:30:26] church anyone is going is [1:30:28] required to utilize this bill if [1:30:31] they choose to opt in and [1:30:32] utilize a spell. And they all [1:30:34] these provisions including [1:30:36] enforcement- applied they. Could [1:30:43] decide to do it. The l. Way and [1:30:46] close to reserve infancy cal. [1:30:46] and have a sequel los in and [1:30:48] every else and by if they choose [1:30:50] to do it- it'll committee or the [1:30:53] underpaid- your- okay so the are [1:30:56] . Only in [1:32:45] the categories where it's [1:32:46] falling short of its goals the [1:32:47] purpose of sb thirty five and [1:32:49] that's also as before twenty [1:32:51] three it's to help cities are [1:32:53] falling short catch up and meet [1:32:56] their- our- we've had extensive [1:32:57] discussions today about the [1:32:58] profound of shortage- sb thirty [1:33:01] five- went into effect in twenty [1:33:03] eighteen it was a slow. Start as [1:33:05] is often the case of new housing [1:33:07] bills- and then started [1:33:08] accelerating almost nearly [1:33:11] twenty thousand new homes. Have [1:33:12] either been streamlined or I'm [1:33:14] process to streamline under sb [1:33:16] thirty five today hi my city of [1:33:18] san francisco three thousand. [1:33:20] new homes hi it's been a very [1:33:22] successful and has dramatically [1:33:24] reduced the approval time it is [1:33:26] primarily. Benefitted below [1:33:29] market rate housing about 75% of [1:33:31] the of the units- we have- made [1:33:36] some changes to the bill to make [1:33:38] sure that the- mixing com [1:33:40] element is more- successful- and [1:33:43] so I'm sure and we just talked [1:33:45] about some of the labor [1:33:47] standards and perhaps a little [1:33:47] stunned. Again so colleagues- sb [1:33:52] thirty five is a it really is I [1:33:54] think one of our bedrock housing [1:33:55] laws that expires in a couple [1:33:57] years we want to remove the [1:33:58] sunset. Now because people were. [1:34:02] cities and builders planned [1:34:03] years in advance- and we don't [1:34:06] want to wait until the last [1:34:08] minute. To decide if this bill [1:34:10] is going to expire that would be [1:34:11] harmful to the bility of cities [1:34:12] and builders- to plan five as [1:34:16] with the last bill- we've [1:34:18] already had some conversations. [1:34:26] with the building trades about [1:34:27] with his bob dot two meetings so [1:34:30] far. Continue to hope that we be [1:34:31] able to get to a road. And I [1:34:33] respect ask. I know secret about that at [1:35:02] every income level what's going [1:35:04] on at the end house what's going [1:35:06] a lack workforce housing [1:35:07] affordable housing but a housing [1:35:09] and all income levels. There's [1:35:10] another crisis going on in [1:35:14] residential. We look at the [1:35:14] residential industry primarily [1:35:16] what frame multi family type [1:35:18] three if you like construction [1:35:19] the type house we mostly need [1:35:22] produced. There's over three [1:35:23] hundred thousand nonunion [1:35:24] workers in. That work force [1:35:29] currently. And they are [1:35:30] exploited talking a little bit. [1:35:32] and that work force- is not been [1:35:34] organized we intend to go out [1:35:37] and with the tools- in this bill [1:35:39] has the strongest labor [1:35:40] enforcement language. Of any [1:35:42] bill we can find or any law [1:35:44] throughout the county country so [1:35:45] subtly pervading wages health [1:35:47] care requirements opportunity [1:35:49] for friendship but also the [1:35:50] strongest labor force language [1:35:51] empowering labor management [1:35:52] committees to bring justice to [1:35:54] those jobs. The reality is- [1:35:57] right now only one in seven [1:35:59] traits workers in the state of [1:36:01] california qualify under skilled [1:36:02] and trained in the residential [1:36:04] industry. Maybe one in ten and [1:36:07] of your large residential [1:36:08] projects so this is not from [1:36:11] more the carpenters are coming [1:36:12] from some by having a fight. [1:36:14] with anyone in the labor [1:36:15] movement it's about those [1:36:17] workers out there and it's about [1:36:18] production- sb thirty five [1:36:20] itself very successful bill [1:36:21] shows a clearly. The primary [1:36:23] success sb thirty five required [1:36:25] prevailing wages to be paid for [1:36:27] affordable housing production [1:36:29] below market rate production- [1:36:31] currently there are. Maybe one [1:36:33] or two projects will require [1:36:34] skilled and trained but nothing [1:36:35] is moved yet no housing is [1:36:37] happen. So again when it comes [1:36:40] down to it what we're looking at [1:36:41] is we will not support any labor [1:36:46] . Stance refill our scrushy [1:36:47] neri. We have every into with [1:36:49] the it's our prime purpose as a [1:36:50] labor organization construction [1:36:51] to reach out and help those [1:36:52] workers pull up into the union [1:36:55] flag family. We see that [1:36:57] strongly as pro labor pro union [1:37:00] standards that are also pro [1:37:02] housing production again in an [1:37:04] industry. Than unfortunately [1:37:07] overall has been ignored. The [1:37:09] carpenters union is actually the [1:37:11] largest footprint many labor [1:37:12] union in the residential [1:37:14] industry- we have a third of the [1:37:16] registered apprentices out [1:37:17] there. And overall all crafts we [1:37:20] have the most amount skilled and [1:37:21] trained certified workers it's [1:37:23] easy to track the numbers- you [1:37:26] know through elam to send [1:37:27] everything else but also can the [1:37:29] d. A. S. Graduation rates so [1:37:30] again we are absolutely all in. [1:37:33] for apprenticeship an [1:37:33] opportunity. But those workers [1:37:36] that are out there now and we do [1:37:37] need to increase the work force [1:37:39] upwards eighty thousand workers [1:37:40] per year so we not only need the [1:37:42] current nine you workforce [1:37:43] residential. We need to grow [1:37:45] that and grow opportunity. But [1:37:47] we cannot leave that work force [1:37:49] out and we need to produce [1:37:50] housing fast. So with the [1:37:53] platforms to go out bring [1:37:55] workers rights on those jobs. [1:37:56] and grow its the organizing [1:37:58] opportunity of a lifetime for [1:38:00] any labor organization. Again [1:38:02] whether be vying to ensure not [1:38:04] skilled and trained will exclude [1:38:06] those dire work for workers and [1:38:08] will actually screwed about a [1:38:10] hundred thousand. Union members [1:38:11] currently in the state of [1:38:12] california we can't afford that. [1:38:14] so we appreciate your support on [1:38:16] this. We [1:38:47] are a mission driven affordable [1:38:48] and workforce housing developer [1:38:51] I'm in the state of california [1:38:53] we've got approximately fourteen [1:38:55] projects in over six hundred [1:38:56] units in the pipeline- serving a [1:38:58] broad range of incomes. I [1:39:00] created a novin developments- to [1:39:03] focus on missing middle housing [1:39:04] workforce housing is we're very [1:39:06] much interested in figuring out [1:39:07] how to make mixed income work as [1:39:09] you know mostly bills and- [1:39:11] funding is focused on very low [1:39:13] and low income housing however [1:39:14] the majority of our population [1:39:15] is in the missing middle and so- [1:39:18] were very keenly aware of the [1:39:19] of. Sb thirty five reviews it on [1:39:21] two projects- and neither of [1:39:24] them would have been approved [1:39:25] without sb thirty five in fact [1:39:27] we had a- council members- in a [1:39:30] political environment- working [1:39:33] to- use a small you know section [1:39:36] of the bill that allows for a [1:39:38] council oversight hearing. To [1:39:40] basically over derail our [1:39:41] project and stop it from getting [1:39:43] approved- and so it wasn't it [1:39:45] was with the help of the [1:39:47] carpenters union. Him be law. [1:39:49] act's housing accountability [1:39:51] unit and sb thirty five that we [1:39:53] eventually. Got housing approved [1:39:56] on a site that was entitled for [1:39:58] housing- so it's a very useful [1:40:00] building wouldn't who are [1:40:01] projects would have happened [1:40:02] without it- it was through this [1:40:04] implementation that it revealed [1:40:05] some of the challenges and I [1:40:07] think some of the improvements [1:40:09] in sb thirty five- particularly [1:40:11] around the use for mixed. Income [1:40:13] housing the labor standards as [1:40:14] written or more stringent for. [1:40:17] mixed income projects were let's [1:40:18] say only half of the project is [1:40:20] receiving state subsidy. The [1:40:22] other half is privately finance [1:40:23] and- labor standards are way [1:40:25] more difficult to meet so it it [1:40:27] naturally moves people or [1:40:29] developers into. Bill building a [1:40:32] 100% affordable housing projects [1:40:33] because- you're able to leverage [1:40:38] . The funding for the entire. [1:40:39] and the cost is lower and so- [1:40:41] the whole heartedly agreed [1:40:42] senator cortese there should be [1:40:43] a single standard across- this [1:40:45] bill for whether it's mixed [1:40:47] income or- if it's a 100% [1:40:50] affordable housing project I [1:40:51] think that'll- help to [1:40:52] streamlining create. Missing [1:40:54] middle housing because it's not [1:40:55] an either or it's an anti and we [1:40:57] need. A deeply affordable [1:40:59] housing but we also need missing [1:41:01] middle housing- other challenges [1:41:03] that the council oversight [1:41:04] hearing I think this makes some [1:41:06] great changes to that- so it's [1:41:07] not misused- and then the fact [1:41:10] that it streamlines the print [1:41:11] versions permanently so that we [1:41:13] have access to the streamlined [1:41:14] process beyond twenty twenty [1:41:17] five is a critical changes that [1:41:19] we support- ultimately sb. Four [1:41:21] twenty three also replaces [1:41:23] restrictive hiring rules with [1:41:24] high road labor standards for [1:41:26] all construction workers- and- [1:41:31] again you know I think- our [1:41:33] example of our project- the [1:41:35] skilled and trained workforce [1:41:36] requirements. Really didn't work [1:41:39] out and we had to take a project [1:41:40] that started out as fifty fifty [1:41:42] affordable housing and turn it [1:41:44] into a 100% affordable housing [1:41:46] project- total timidly make it. [1:41:47] viable so with that- again [1:41:51] strongly urge you to support- [1:41:53] this bill today and- happy to [1:41:56] take any questions thank you for [1:41:57] your time. I served my [1:56:24] apprenticeship and work with [1:56:26] tools in the field for about [1:56:28] half of my career. The other [1:56:29] half I spent creating and [1:56:31] directing our electrical [1:56:32] industry cut- office of labor [1:56:34] compliance. Well my job involves [1:56:37] speaking with workers on public [1:56:39] construction projects in san [1:56:40] francisco. We're all [1:56:45] construction workers union and [1:56:46] nonunion. Should receive by law [1:56:50] prevailing wages and more [1:56:51] premises registered in state [1:56:53] approved apprenticeship training [1:56:54] programs are mandated the [1:56:55] opportunity to work a percentage [1:56:57] of hours on projects. So that [1:56:58] they may learn their craft from [1:57:00] experience and skilled journey [1:57:01] persons all too often I meet [1:57:04] workers who are unaware that [1:57:05] they're entitled to prevailing [1:57:06] wages workers who don't have the [1:57:08] benefit of union representation [1:57:10] for example. And many of whom [1:57:12] are immigrants with limited [1:57:13] english language skills or [1:57:15] otherwise vulnerable. I've [1:57:17] helped many of these folks who [1:57:18] are too afraid to speak up about [1:57:21] wage theft or other abuses [1:57:22] fearful of losing their jobs. [1:57:25] too afraid to say no. Even when [1:57:27] asked to perform work they had [1:57:29] no experience in. Putting their [1:57:30] lives. And the lives of their [1:57:34] coworkers at risk. No one can [1:57:36] contest the wrong in subjecting [1:57:38] workers to dangerous work [1:57:40] they're not trained to perform. [1:57:42] and what about the folks who [1:57:43] occupy and use the building [1:57:45] being built by the unskilled. [1:57:47] whether it be a school a [1:57:49] hospital or housing. For those [1:57:51] building safe. I think it's an [1:57:54] important question. I was glad [1:57:57] when california legislators [1:57:58] passed skilled and trained [1:57:59] requirements for construction [1:58:01] workers ensuring that baseline [1:58:02] percentages of workers on public [1:58:04] and fast track housing in [1:58:05] california would be required to [1:58:06] be graduates of state approved [1:58:07] apprenticeship training [1:58:08] programs. Or have equivalent [1:58:11] measures of skill and experience [1:58:13] . These programs make high skill [1:58:15] high paying careers accessible [1:58:16] to people of color women like me [1:58:20] . And vulnerable folks. Like [1:58:23] many of those I met on san [1:58:24] francisco jobsites. People for [1:58:26] whom skill training is the [1:58:27] difference between fear and [1:58:29] empowerment between being abuse [1:58:31] worker. And being a valued [1:58:33] worker stepping on to the path [1:58:35] of the middle class. Sb four to [1:58:38] three removes the requirements [1:58:39] do you skilled and train workers [1:58:42] and employ apprentices. Don't [1:58:44] let exploitative profit driven [1:58:45] developers get rich at the [1:58:47] expense of the safety of [1:58:48] california's construction [1:58:49] workers. Please do not allow sb [1:58:52] four to three to move forward [1:58:53] unless it is amended to retain [1:58:55] strong language mandating [1:58:57] skilled and trained measures. [1:58:59] california's construction work [1:59:00] force. All of us. Deserve these [1:59:03] protections. We oppose [2:00:09] this on policy but we oppose [2:00:12] this as a matter of principle. [2:00:14] it is unacceptable to strip [2:00:16] labor protections and labor [2:00:18] standards from any worker in the [2:00:20] state of california whether [2:00:22] they're a construction worker a [2:00:24] nurse a teacher a firefighter a [2:00:26] truck driver or any other. [2:00:29] person in california who works [2:00:32] in this state. For those reasons [2:00:36] we must oppose this bill. [2:31:03] replacing one set of labor [2:31:04] standards with a different set [2:31:06] of labor standards- and the [2:31:08] carpenters can explain why it [2:31:09] will cover many many more. [2:32:20] c. D. That no no it's the [2:32:22] cities. Well you know there's [2:32:24] two hundred cities out there [2:32:25] were more there's actually three [2:32:27] hundred and eighty three- trying [2:32:29] to get. In compliance with their [2:32:32] housing elements so that they [2:32:33] can deal with the new members [2:32:36] the rain and numbers that have [2:32:37] come out. And until that [2:32:39] disconnect is fixed so that [2:32:41] there's actually a better [2:32:42] process for them to get their [2:32:44] housing element approved hard [2:32:46] for me to give. An extension in [2:32:49] time to process it's kind of [2:32:51] broken right now I'd like to see [2:32:53] that process addressed- before [2:32:56] we go on and give an extension [2:32:58] to an already broken process. [2:32:59] it's easy for cities that got [2:33:02] sixty five units. Of affordable [2:33:04] housing. Put in as their arena [2:33:07] number but the ones who got [2:33:10] three thousand to four thousand [2:33:11] units. Going to be impossible [2:33:12] for them to do that and housing [2:33:14] elements don't just get produced [2:33:15] overnight. You can do in a week [2:33:18] you can do you can barely do in [2:33:20] two years. And so that's what [2:33:22] they're struggling with and [2:33:22] that's why you heard from some [2:33:24] of the cities. If we can fix [2:33:26] that process I'd be more [2:33:27] inclined. To you to some of [2:33:29] these other streamlining methods [2:33:31] because I'm all about [2:33:32] streamlining but it has to be [2:33:34] done on our end to end our our [2:33:37] agencies need to be responsive [2:33:38] to the cities. They can't just [2:33:39] say hey you guys didn't do it [2:33:41] right. Try again. And that's [2:33:43] what a lot of them have gotten [2:33:45] really frustrated out there and [2:33:46] I think- in and I think that's- [2:33:48] the issue that. You're cities [2:33:50] are having. So that's my comment [2:33:53] I don't know if you've talked a [2:33:55] cd about this. But hard for me [2:33:56] to support until they fix their [2:33:58] problems. I mean. [2:34:46] they're also advocates whose [2:34:48] there are plenty of advocates [2:34:49] you think you city has been too [2:34:51] soft in some cities so it should [2:34:53] is getting pulled in a lot of [2:34:54] different directions right now [2:34:55] and I think they're acting. It was [2:36:51] straight up prevailing wage for [2:36:54] anything that was mixed income [2:36:56] below above I think twenty five [2:36:59] units I believe that's the [2:37:01] number it's gone up to- was- [2:37:03] skilled. Skilled workforce- [2:37:05] this- replaces dive- structure [2:37:11] with prevailing wage for [2:37:12] anything eleven and above and [2:37:14] what once it hits fifty that and [2:37:17] the health care requirements [2:37:18] kicked and as well as the- the [2:37:20] apprenticeship- requirements in [2:37:23] the bill and the wage theft is [2:37:25] ubiquitous throughout that sort [2:37:27] of a how the structure change [2:37:28] okay. So I guess. And again I [2:37:35] don't want to for the off but- [2:37:37] what I want to you is your will. [2:37:39] to modify some of those either [2:37:42] the numbers if that's the issue [2:37:44] . Or or is it the range is it [2:37:46] the mix of units in terms of [2:37:49] mix- ford or portable. Which are [2:38:24] items that are in about the [2:38:26] skilled workforce versus prime [2:38:27] wage which we think our trust in [2:38:29] the bill but- you know sometimes [2:38:31] people say you you think you're [2:38:32] addressing it but it's drafted [2:38:34] wrong and my- responses well [2:38:35] tell me how it struck the wrongs [2:38:37] I want to drop things correctly. Anymore the deal [2:40:30] they agreed to in twenty [2:40:30] seventeen which I respect no one [2:40:31] is permanently bound to anything [2:40:33] near deal that they agree to [2:40:35] people can change our minds- [2:40:37] but- you know I think initiation [2:40:40] you know and that kind of [2:40:42] dialogue. Would be helpful as [2:40:43] you can tell them temperatures a [2:40:45] little bit high- not right now [2:40:47] but we've all seen that with [2:40:49] bills that I think. Everyone had [2:40:50] bills that temperature gets [2:40:52] really high. And then as things [2:40:54] progress. Over the course of [2:40:59] legislative year. People start [2:41:00] talking come to table. But [2:42:37] essentially- in in very clearly [2:42:41] telling constituencies- court [2:42:43] residential constituencies [2:42:45] surrounding developed- I'm sorry [2:42:49] sites that are to be developed. [2:42:51] the because of sb thirty five- [2:42:54] are precluded from from holding [2:42:57] any meaningful hearings or [2:43:01] discussions with the community. [2:43:02] on those projects. I know. That [2:43:05] that's not in the bill I know [2:43:08] that serving in the bill [2:43:09] understand the bill would- in [2:43:12] effect do away with the [2:43:14] necessity of a secret here read- [2:43:16] but it also knows that there's a [2:43:19] whole set of hearings leading up [2:43:21] to that moment including general [2:43:22] plan hearings- zoning hearings [2:43:24] in in a lot of other things. [2:43:26] where the city council puts [2:43:28] imprint on what they want to see [2:43:30] an area. Including objectives [2:43:32] only standards that said- is [2:43:37] what can be done. With the [2:43:39] extension. Of the sb thirty five [2:43:42] through this bill for twenty [2:43:44] three this time around- to give [2:43:47] us a fair shot is legislators in [2:43:49] in terms of reporting- those. [2:43:54] misleading statements are women [2:43:55] call the misunderstandings [2:43:56] because it's hard for me to [2:43:57] believe that any. City is- let [2:44:01] alone one as sophisticated as [2:44:03] the third largest city the city [2:44:04] california is in getting the [2:44:06] proper legal advice in the [2:44:08] proper understanding of the bill [2:44:10] like this before they go out and [2:44:12] talk to their constituents. [2:44:14] regis it seems to me that we [2:44:15] need to do some of that work if [2:44:17] we want not to have blame [2:44:18] shifting going on for a lack of [2:44:21] community process in the [2:44:22] neighborhoods could you speak to [2:44:24] that agent one of there's a [2:44:26] willingness to try to. Come up [2:44:27] with something- in terms of [2:44:28] state assistance maybe through a [2:44:30] cd or somehow to get the word [2:44:33] out constituents that they do [2:44:35] have the right to continue [2:44:35] asking for. Community meetings [2:44:38] and discussion yeah. One thing [2:44:41] that- figured about does not [2:44:42] hello. The ability to facilitate [2:44:44] wants to hold a hearing or or [2:44:46] neighborhood meeting. They can [2:44:48] do that- in my experience having [2:44:50] watched the implementation of [2:44:52] this bill for carefully for the [2:44:54] last five years. If you are try [2:44:56] if you're a developer with your [2:44:58] nonprofit for will developer [2:44:59] mark redevelopment if you were. [2:45:01] in this and this for this whole [2:45:02] affordable developers because [2:45:04] there has been very very little [2:45:05] on the market rate side- but- it [2:45:09] is in your interest. To engage [2:45:11] with the local community even [2:45:13] though you have the ability to [2:45:14] trigger a three thirty five and [2:45:16] your- annual alternately trigger [2:45:18] it. Which will protect the bill [2:45:19] from sickle education for [2:45:21] example. Five your life is gonna [2:45:23] be a heck of a lot easier. If [2:45:25] you have engage with the [2:45:27] community and with the city [2:45:28] council pine department- because [2:45:30] sometimes it may be that they [2:45:32] just want a few changes here and [2:45:34] there consider this. And then it [2:45:35] de escalates the situation and [2:45:37] because you do have cities to [2:45:39] try to nit pick every every [2:45:40] little possible loophole it's a [2:45:42] lot easier if the city is like. [2:45:43] okay we're okay with this [2:45:45] projects were not going to do [2:45:47] that. And so and I think a lot [2:45:49] of the not not every developer [2:45:50] there's a range of developers. [2:45:52] but there are plenty of [2:45:53] developers who I think do. Not [2:45:54] engage ahead of time and sb [2:45:56] thirty five. Allows them to [2:45:58] protect that. Of the project [2:46:00] from from from the lawsuit so [2:46:03] it. Any idea maybe you and I [2:46:04] should talk any ideas you have [2:46:07] I'm. I'm open to it- I mean into [2:46:14] times so. [2:47:22] both of these facilities as- was [2:47:24] explained to me at the time [2:47:25] we're not only state of the art [2:47:28] but have capacity. Capacity to- [2:47:31] you know to add a premises. Into [2:47:34] attached them to jobs. When I [2:47:36] read the language in the [2:47:38] standards. In this bill asking [2:47:40] the but this of the carpenters [2:47:42] because- of your support for the [2:47:45] bill sponsorship of the bill- it [2:47:48] appears to me. If I'm if I'm [2:47:53] reading this right in the marina [2:47:56] verbatim all of- the on page six [2:47:59] of sixteen of my documents here [2:48:03] - culture to the construction [2:48:05] cowboys must either participate [2:48:07] in an apprenticeship program [2:48:08] pruebas de california division [2:48:10] of apprenticeship standards. As [2:48:12] specified for request. The [2:48:15] dispatch of the princes from the [2:48:17] state approved apprenticeship [2:48:19] program as specified. So if the [2:48:21] contractor chooses. That [2:49:01] the contractors off the hook you [2:49:03] know in terms of driving [2:49:04] apprenticeship and training and [2:49:06] enrollment in the trades could [2:49:08] you respond to the certainly- [2:49:12] and thank you for the question [2:49:13] senator. The language that [2:49:14] you've quoted is a substantially [2:49:16] the same language that is [2:49:17] applied for decades to the [2:49:20] public works sector of [2:49:21] california which is accounting [2:49:23] for about 20% of all [2:49:24] construction in the state of [2:49:27] california. Where it is either [2:49:29] shall employer shall request. [2:49:31] it's also language and we have [2:49:33] successfully put thousands of [2:49:35] apprentices we have nineteen [2:49:38] thousand carpenter and drywall [2:49:39] and power driver premises [2:49:40] throughout the state that are [2:49:43] actively registered as is- [2:49:45] brother brad shaw said earlier [2:49:45] turned out. And had graduated [2:49:48] more than any other single union [2:49:51] in the state. It public works [2:49:52] has been in an important part [2:49:54] along with private work for a [2:49:56] check a cheating that level of [2:49:57] success. I would also note that [2:49:59] the language of having that [2:50:01] request a good faith effort [2:50:03] which is has to be documented- [2:50:05] is parallel to th at the federal [2:50:08] level language in the inflation [2:50:10] reduction act. Enacted in twenty [2:50:13] twenty to the state building and [2:50:14] construction trades council [2:50:15] lauded as a massive win for [2:50:18] californian californians. It's [2:50:20] language that in with that puts [2:50:22] forward pairs prevailing wages [2:50:24] with the partnership that's been [2:50:25] a winning combination for [2:50:26] decades already. For the ira it [2:50:30] is the inflation reduction [2:50:32] activities to expand into a new [2:50:35] market place for energy [2:50:37] efficiency work supported by tax [2:50:40] credits. Similarly given the non [2:50:42] union status of the private [2:50:44] residential world and I should [2:50:46] note half of publicly subsidized [2:50:49] a 100% affordable housing which [2:50:52] is not. We will be expanding. [2:50:58] massively in fact we already [2:51:00] have over the past five years of [2:51:02] sb thirty five being in effect [2:51:05] have seen dozens of projects. [2:51:07] that have employed union journey [2:51:09] level workers and union [2:51:11] registered apprentices on the [2:51:13] other hand we have not seen. [2:51:16] union journey level. Workers [2:51:18] party or union apprentices [2:51:20] employed on projects that are [2:51:23] held to a skilled and trained [2:51:24] workforce pro. Stand [2:51:25] requirements retinoid. I didn't [2:51:28] say I want. To impose somebody [2:51:31] else's language I'm just asking [2:51:32] you why have permissive [2:51:34] language. Win win. And I know [2:51:38] appreciate everything the [2:51:39] carbons are done to- to grow and [2:51:43] develop their own apprenticeship [2:51:44] program. Larger than the any any [2:51:47] other union within the overall [2:51:49] scope of the building trades but [2:51:51] I also know from first talking [2:51:53] to your leadership that the [2:51:54] objective is to grow that much [2:51:56] more to keep growing as- an and [2:51:57] I don't know how you get there. [2:52:00] that's why I asked the question [2:52:02] how do you assure us for [2:52:02] guaranteed us that this language [2:52:04] gets you there if it's [2:52:06] permissible would make more [2:52:06] sense to say. The objective so you [2:52:52] can get your developments done [2:52:54] much more quickly. But in [2:52:56] exchange you need to do not just [2:53:00] two of these things [2:53:01] permissibility if they work and [2:53:03] if they don't proceed nonunion- [2:53:06] but you need to do one or the [2:53:09] other. Or in effect- signatory [2:53:12] what by would we say that with [2:53:13] language that that. Simply says [2:53:18] you you've got to have. What [2:53:19] would have other been your non [2:53:20] union force in the list before [2:53:22] that sb thirty five project [2:53:23] overly thomas b. The [2:53:42] language which again you know [2:53:44] has been part of california law [2:53:45] for public works for decades his [2:53:47] excellency works is I under I [2:53:48] and I under I understand if I [2:53:50] just ask you to speak to this [2:53:52] bill. This for this bill what it [2:53:54] what this offers and I would be [2:53:56] happy to share with any member [2:53:58] of the committee a map of where [2:53:59] registered apprentices live [2:54:00] currently. There are parts of [2:54:02] california where frankly not [2:54:04] every single trade has an [2:54:06] adequate number of registered [2:54:08] apprentices today tomorrow and [2:54:10] for quite frankly walt the [2:54:13] carpenters. Apprenticeships are [2:54:15] open to anyone who's seventeen [2:54:17] or over and with the g. D. Or an [2:54:19] equivalent. That's not the case [2:54:21] necessarily for all of the other [2:54:23] pressure programs. We believe [2:54:25] that we are in a housing crisis. [2:54:28] and it is critical to ensure [2:54:30] that we get as much as possible [2:54:32] organized within the streamlined [2:54:35] housing world. And that's- down [2:54:39] to corner for is it takes two to [2:54:40] tango it requires unions and [2:54:42] pressure programs that are in [2:54:43] growth mode- to participate that [2:54:46] are- perhaps at times even [2:54:48] willing. To send an apprentice [2:54:51] to a non union job that's that [2:54:53] that's an opportunity to spread [2:54:56] the union gospel quite frankly. [2:54:58] a member go there but- your- you [2:55:01] know your your responses to my [2:55:03] questions that I don't want to [2:55:05] I'm not here to. Back to [2:57:53] pre great recession levels maybe [2:57:55] a little bit higher since about [2:57:58] twenty seventeen since and [2:57:59] despite two hundred seventy [2:58:01] five. Streamlining building code [2:58:04] changes as- hcd has told us we [2:58:06] haven't really seen we haven't [2:58:08] really moved the needle the [2:58:09] fundamental problem is materials [2:58:11] and prices are just ask about [2:58:13] escalating it wildly and quite [2:58:16] volatile- rents. Have gone down [2:58:18] in the land the highest demand [2:58:19] areas and frankly I think this [2:58:21] is something that a lot of [2:58:22] people to hold their of been [2:58:24] multiple lawsuits and sb thirty [2:58:26] five projects if you actually [2:58:26] take a look at the dashboard. In [2:58:29] a cd there are sixty there are [2:58:30] over sixty five hundred units [2:58:33] in. The I thirty five projects [2:58:36] that would have had skilled and [2:58:38] trained standards a number of [2:58:39] them including one of the ones [2:58:41] that- the club put forward by [2:58:44] the by the gentleman who spoke [2:58:47] in support. Were held up through [2:58:48] a variety of different [2:58:49] procedural delays so in short [2:58:52] it's- your explanation is. As [2:58:57] economics economic concerns and [2:59:02] - in litigation to some it yes. [2:59:04] I think so I don't want to over- [2:59:07] we don't have time to. Dominate [2:59:09] the meeting here but- if there's [2:59:12] anything else say it and I just [2:59:14] want to say hey- thank you for. [2:59:18] your answer which is slated to [2:59:20] the prayer witness and also a c. [2:59:22] just like said per witness I [2:59:23] think this needs to be it is an [2:59:25] issue that needs to be resolved. To try to make things go [2:59:49] but I think as we've been saying [2:59:51] that continuing sort of private [2:59:53] sector streamlining in light of [2:59:54] this broad in the broad [2:59:55] conditions that we have in the [2:59:57] market right now is pushing on a [2:59:59] string. To be [3:00:55] able to bid on the strongest. [3:00:56] three will to yes this is this [3:00:58] debate in some ways about which [3:01:00] contractors are allowed to bid. [3:01:03] on jobs skilled workforce you [3:01:05] have to have a certain [3:01:07] percentage of your workers- come [3:01:09] out of. Particular meet certain [3:01:11] qualifications service terms of [3:01:13] apprenticeship program- at and [3:01:15] so forth and they qualifies [3:01:18] under the skilled workforce [3:01:18] standard- and the contractors [3:01:21] have to employee tax percentage [3:01:22] depending on the craft. To [3:01:24] qualify to bid on other [3:01:26] contractors are not those [3:01:29] contractors who will qualify. In [3:01:33] the school workforce can still [3:01:34] bid. The be more contract who [3:01:36] were. To bid this work spanned [3:01:38] the pool contractors who can bid [3:01:40] and we know that in. Parts of [3:01:42] the state there might. Very few [3:01:44] contractors who can meet the [3:01:46] skilled workforce standards. So [3:01:48] it doesn't exclude them they're [3:01:50] still included in the ability to [3:01:53] bid for these jobs. Also in [3:01:58] regards to the apprenticeship [3:01:58] programs. When you limited to [3:02:01] justice to this skilled [3:02:04] workforce training still [3:02:05] workforce. You're limiting the [3:02:07] amount the- the number of [3:02:09] apprenticeship programs that [3:02:10] actually qualify to be able to [3:02:13] bid on these jobs to this would [3:02:15] open it up to an array of [3:02:16] apprenticeship. Programs that [3:02:18] aren't- that are actually [3:02:21] approved by the state. Is that [3:02:25] correct. Yes yes okay. So it it [3:02:30] opens up more apprenticeship [3:02:32] programs- in the state to be [3:02:35] able to. To work for this in it [3:02:38] also- opens the ability to have [3:02:41] more opportunity for work for [3:02:44] approximately four hundred [3:02:46] thousand workers that don't [3:02:48] necessarily- belong to a [3:02:51] specific apprenticeship program [3:02:53] but belong to any apprenticeship [3:02:55] program. In the state the mayor [3:02:57] may not. And also when we talk [3:03:01] about workforce standards I was [3:03:03] just asking for clarification on [3:03:05] that whether or not. Fusing it [3:03:08] meant labor code or construction [3:03:10] code- the versus- and I believe [3:03:14] it's labor code labor code is [3:03:17] labor code in california right. [3:03:20] any construction house to meet [3:03:23] those standards- in california [3:03:27] is that is that not correct [3:03:28] labor code is they were cut it [3:03:31] doesn't very. Her apprenticeship [3:03:33] program or no apprenticeship [3:03:34] program or any apprenticeship [3:03:36] program. Is that correct- I see [3:03:40] people nodding their head may [3:03:41] day kerr with the carpenters the [3:03:43] labor code is essentially [3:03:44] designed for public works there [3:03:46] are there are workers there are [3:03:48] other codes for the workforce in [3:03:52] general. But on public works you [3:03:53] have to meet the labor codes [3:03:55] that have to do with prevailing [3:03:57] wages and prices. And if you are [3:03:59] non union contractor you still [3:04:00] have to meet those codes if you [3:04:02] don't have a premises because of [3:04:04] their labor management programs [3:04:05] generally. Use than request [3:04:07] practices from the programs that [3:04:10] have them. If they fulfill that [3:04:13] request then you met your up the [3:04:16] standard for apprentices if they [3:04:18] don't. Meet their request of [3:04:20] third don't send to they don't [3:04:21] have them or in some unions [3:04:23] don't send them to non union [3:04:25] contractors. Then you've gone [3:04:26] through the process of asking [3:04:27] and not receive them so you have [3:04:29] for fill that requirement you [3:04:31] cannot pay anybody [3:04:32] apprenticeship wages after that [3:04:35] because that's also did- the [3:04:37] governed by the labor code [3:04:39] sections. But the wages are [3:04:41] outside of labor code sections. [3:04:43] I think the minimum wage that [3:04:45] applies to all workers on [3:04:46] construction or anywhere [3:04:48] actually. You do not have to [3:04:50] meet any other labor any other [3:04:52] way each and in that for [3:04:54] construction. And that this bill [3:04:57] will specify prevailing wage [3:04:59] that's correct on the floor. And [3:05:00] it's not like it's not a public [3:05:02] works as senator criticizing [3:05:04] this. Asking but it does require [3:05:06] you meet a prevailing wage which [3:05:08] you have to pay. And it does [3:05:10] require if you don't have a [3:05:11] prince's over fifty units you [3:05:13] then have to request apprentices [3:05:15] through the normal process that [3:05:17] you would request princes to [3:05:18] print ship. Part of friendship [3:05:20] standards if you get them you [3:05:22] have to use them and some crafts [3:05:24] will send them some won't. As [3:05:26] you heard and if you don't get [3:05:28] them but you've applied then [3:05:29] you've met. Your requirement but [3:05:35] you cannot pay hey those. [3:05:36] prevailing mean those approach [3:05:38] wages which are lower. [3:08:34] it became ineligible rescue [3:08:36] thirty five because sb thirty [3:08:38] five currently has no mechanism [3:08:40] and it is a project otherwise [3:08:42] fully qualifies. But the state [3:08:45] has to make some sort of [3:08:46] decision no matter how minor [3:08:48] that decision it simply gets [3:08:50] kicked out of sb thirty five. [3:08:51] and the purpose of this [3:08:52] provision is to say that if [3:08:54] there is not senate state owned [3:08:56] property I know that yeah I [3:08:58] think you have a bill to [3:08:59] streamline on state. Owned [3:09:03] property. The state having to [3:09:05] make it this. Does not x. The [3:09:07] project rescue three five and it [3:09:10] would be the of euro service. With sb three [3:12:24] forty one strikes the right [3:12:26] balance of incentivizing local [3:12:26] governments to adopt pro housing [3:12:29] policies while not penalizing [3:12:31] developers who bring a former [3:12:32] housing to low income families [3:12:34] who need for but housing in [3:12:36] these less housing friendly [3:12:38] jurisdiction. The bill plus pro [3:12:40] housing incentives in housing [3:12:42] element compliance rituals only [3:12:43] to state programs which cities [3:12:45] and counties as opposed to [3:12:47] private a former housing [3:12:47] developers. I'm here in [3:14:02] support of sb three forty one a [3:14:04] bill that would more [3:14:06] appropriately align incentives [3:14:06] for housing element compliance [3:14:08] and housing policies. Our city [3:14:10] is a nonprofit affordable [3:14:12] housing developer providing over [3:14:14] twenty five hundred rental homes [3:14:15] throughout the bay area. With an [3:14:16] additional one thousand units in [3:14:19] pre development and [3:14:20] construction. Unfortunately our [3:14:20] ability to access funding for [3:14:23] these people and projects is [3:14:24] currently jeopardized by [3:14:25] regulations that penalize [3:14:26] affordable housing developers. [3:14:28] for the shortcomings of local [3:14:29] jurisdictions. Nonprofit [3:14:31] developers like our cd cannot [3:14:33] apply for funding receiving [3:14:34] award or have funds disbursed by [3:14:37] the state unless the local [3:14:38] government. Where are four wheel [3:14:39] housing developments are located [3:14:41] has met certain housing element [3:14:42] compliance milestones. This [3:14:44] spring three of our developments [3:14:46] will compete for state funding [3:14:47] under the affordable housing and [3:14:48] sustainable communities program [3:14:50] and all three of those [3:14:51] developments are in [3:14:52] jurisdictions without a [3:14:53] complaint housing element. As a [3:14:56] result we will take on it the [3:14:57] significant an undue risk of [3:14:59] preparing extensive applications [3:15:01] and potentially even executing [3:15:03] award agreements. Pending the [3:15:04] result of a local government [3:15:06] process that we have absolutely [3:15:08] no control over. This will have [3:15:10] replication throughout the [3:15:11] capital stack of these [3:15:12] developments as tax credit [3:15:13] investors and private lenders [3:15:17] react to the additional [3:15:18] uncertainty. The threshold [3:15:19] requirement has the unintended [3:15:20] and unfortunate consequence of [3:15:22] adding additional complication [3:15:23] and cost affordable housing [3:15:25] development process. This issue [3:15:28] is not isolated to the three [3:15:29] developments at this moment in [3:15:30] time. Over 75% of our city's pre [3:15:33] development portfolio is located [3:15:35] in one of the many bay area [3:15:37] jurisdictions that do not [3:15:38] currently have a compliant [3:15:39] housing element. And [3:15:41] additionally some jurisdictions [3:15:42] that we work in one have a [3:15:43] complaint housing element for [3:15:45] another year or more. Sb three [3:15:48] forty one would remove the [3:15:49] threshold requirements the state [3:15:50] enforcement of housing element [3:15:51] law does not delay affordable [3:15:54] housing construction. Realigning [3:15:56] this incentive will ensure that [3:15:57] developers like rcd can continue [3:15:59] to build affordable housing for [3:16:00] the low income californians who [3:16:03] desperately need it. For example [3:20:37] home to two point no but only [3:20:40] public agencies can be the lead [3:20:42] applicant for these projects sb [3:20:44] four fifty six law expand [3:20:45] program eligibility. For this [3:20:48] funding by allowing community [3:20:49] based organizations that [3:20:51] currently provide transitional [3:20:53] housing or emergency shelter to [3:20:55] be eligible for use only home [3:20:57] key projects we have some [3:20:58] amazing. Nonprofits around [3:21:00] states that are very experienced [3:21:02] and helping you to get off the [3:21:05] streets and helping them [3:21:05] transition. To a better life one [3:21:07] of the most california. Counties [3:21:09] do not have to specific homes [3:21:11] programs- and we need to make [3:21:14] sure that are non profits that [3:21:16] help these young people- are [3:21:18] able to help them exit and [3:21:19] access is funding directly and [3:21:21] not have to rely on. The [3:21:23] possibility that the local [3:21:26] government will try to access. [3:21:28] the funding. If we can help [3:21:30] these young people stabilize [3:21:32] their lives and become pals at a [3:21:34] younger age- we will avoid- them [3:21:38] spiraling into chronic [3:21:39] homelessness and help them get [3:21:41] on a better track can help save [3:21:44] their lives. Creasing lee difficult to [3:28:22] afford the high cost of housing [3:28:26] . And with their fixed incomes [3:28:28] that they live on our in [3:28:30] adequate to cover rising rents. [3:28:33] for extremely low income renters [3:28:34] roughly eight out of ten spend [3:28:36] more than 50% of their monthly [3:28:39] income on rent. People with [3:28:40] disabilities comprise about 46% [3:28:44] of those who experience [3:28:45] homelessness an african american [3:28:47] households are more than five [3:28:48] times as likely to experience [3:28:50] homelessness as compared to. [3:28:53] general population californians [3:28:55] . So while there are programs [3:28:56] such as the home safe program in [3:28:58] the homeless disability program. [3:29:00] there is no comprehensive state [3:29:02] program to provide housing [3:29:04] subsidies for older and disabled [3:29:06] adults who are on fixed incomes. [3:29:08] and housing vouchers such as [3:29:10] section eight and other things [3:29:12] like that often can take years [3:29:14] for applicants to access there's [3:29:16] most of us know they have long [3:29:19] waiting lists. And the only [3:29:20] accommodate fraction of eligible [3:29:22] applicants so what sb thirty [3:29:25] seven does is provide a rent [3:29:26] subsidy targeted to those older [3:29:28] adults and the adults with [3:29:31] disabilities. Who are homeless [3:29:31] or at high risk of falling into [3:29:33] homelessness it establishes the [3:29:36] older adults and adults with [3:29:37] disability housing stability act [3:29:40] within the department of housing [3:29:43] and community development. To [3:29:43] administer an offer competitive [3:29:44] grants to nonprofit [3:29:46] organizations continuum's of [3:29:48] care and other organizations [3:29:50] that can provide the service. In [3:29:52] the grantees will provide [3:29:54] subsidies to help older adults [3:29:56] and adults with disabilities [3:29:57] remain housed with the subsidies [3:30:00] covering the difference between [3:30:02] 30% of households. Income in the [3:30:06] units reasonable rent. By [3:30:07] investing in subsea such as this [3:30:08] we can help. These californians [3:30:12] who deserve to be house and with [3:30:14] that I would like to have dr [3:30:16] markel margo shell- who is a [3:30:20] researcher on homelessness and [3:30:22] sharon rappaport from the- [3:30:25] california state policy for the [3:30:26] corporation for supportive [3:30:29] housing be the witnesses. In our recent [3:30:39] statewide study of homelessness [3:30:41] almost half of all adults [3:30:43] experiencing homelessness in the [3:30:44] state are now fifty and older. [3:30:47] we know from our research as [3:30:48] adults were fifteen older and [3:30:50] homeless have health problems [3:30:51] much more similar to those of [3:30:53] adults in their seventies and [3:30:55] eighties and approx me half of [3:30:56] them first become homeless after [3:30:59] fifty. These are not folks with [3:31:01] a lot of significant substance [3:31:03] use and mental health problems [3:31:04] but their house is terrible. [3:31:07] very how you to emergency [3:31:08] departments very high use of [3:31:11] hospitalizations prolonged and [3:31:12] avoidable stays in nursing homes [3:31:14] and they die at three and a half [3:31:16] times the rate that they would [3:31:18] be expected had they been house. [3:31:20] california's housing [3:31:21] affordability crisis [3:31:22] disproportionately impacts older [3:31:24] adults they're more likely to be [3:31:26] severely cost burdened and this [3:31:27] disproportionately affects older [3:31:29] black californians as well. [3:31:32] let's say in our longitudinal. [3:31:35] study of older homeless adults. [3:31:37] the good is 80% became re housed [3:31:39] over the course of the study the [3:31:41] bad news is 50% of those who [3:31:43] regained housing became homeless [3:31:44] again. Within about a year of [3:31:46] becoming every getting their [3:31:48] housing the only thing that [3:31:50] prevented that. With subsidies [3:31:52] the folks a subsidy state house [3:31:53] to everyone else just returned [3:31:56] nearly announced returned to the [3:31:57] streets. Homelessness among [3:31:58] older adults is reaching crisis [3:32:00] proportions in their states [3:32:01] subsidies for these individuals [3:32:03] at high risk of homelessness and [3:32:05] those who recently exited [3:32:06] homelessness. Are in evidence [3:32:08] bay based way to prevent this [3:32:10] catastrophe would be happy to [3:32:13] take any questions if you have [3:32:15] them. Good afternoon sharon [3:32:19] members I'm sure in report with [3:32:21] the corporation for supportive [3:32:22] housing a national nonprofit [3:32:24] working to solve homelessness. [3:32:25] we are one of five sponsors of- [3:32:28] sb thirty seven. Sb thirty seven [3:32:31] offerings offers proven [3:32:32] interventions to achieving the [3:32:34] master of the california master [3:32:36] planned for aging goal of [3:32:37] preventing and ending [3:32:39] homelessness among older adults [3:32:41] . As the analysis suggested and [3:32:42] doctor crystal mentioned housing [3:32:45] subsidies are one of the most [3:32:46] successful interventions in [3:32:48] preventing and solving [3:32:49] homelessness. Unlike other state [3:32:52] programs as b. Thirty seven uses [3:32:54] a flexible approach to providing [3:32:56] housing subsidies. They can find [3:32:58] shallow subsidies to allow [3:32:59] people on fixed incomes to [3:33:01] remain house. And a few local [3:33:03] programs follow this model of [3:33:04] funding subsidies- and have [3:33:07] found that as little as two [3:33:09] hundred dollars a month. Can [3:33:10] keep somebody and housing- [3:33:12] safely for the rest of their [3:33:15] lives. It also allows local [3:33:16] grantees are for deep subsidies [3:33:18] for those who are experiencing [3:33:20] homelessness. The most [3:33:22] challenging task of crafting a [3:33:23] prevention program is [3:33:25] identifying people who would [3:33:27] become homeless without the [3:33:28] assistance so as to be thirty [3:33:31] seven uses data from the [3:33:32] california policy lab. To [3:33:33] identify risk factors and [3:33:35] predictors and added in a five [3:33:37] people most likely to fall into [3:33:39] homelessness. In this way as b. [3:33:42] thirty seven is unique as it [3:33:44] dedicates resources to those [3:33:45] truly at risk of homelessness. [3:33:47] three one time funding the [3:33:48] program would serve tens of [3:33:50] thousands of older adults and [3:33:51] people with disability at the [3:33:53] greatest risk of becoming [3:33:54] homeless. The similar to other [3:33:56] state programs finally this [3:33:59] program calls on the state to [3:34:00] connect participants to federal [3:34:02] vouchers. The bill [3:37:29] creates the community anti [3:37:31] displacement preservation [3:37:33] program for cap within the [3:37:36] department of housing and [3:37:36] community development. In that [3:37:38] program will provide financial [3:37:39] resources and technical capacity [3:37:41] building to community [3:37:43] organizations and local [3:37:44] jurisdictions that which to [3:37:46] acquire funds subsidized housing [3:37:49] from the speculative market [3:37:51] where the residents in that [3:37:53] housing are at risk for [3:37:56] displacement. And then the after [3:37:58] the purchase would preserve it [3:37:59] as affordable rental housing for [3:38:01] homeownership opportunity. A [3:38:04] large majority of low income [3:38:05] californians live in [3:38:07] unsubsidized affordable housing [3:38:10] housing which is privately owned [3:38:12] and currently somewhat [3:38:14] affordable to low income [3:38:15] households but of course over [3:38:17] time may not be or could be sold [3:38:19] in might not be. So due to a [3:38:21] variety of reasons this unserved [3:38:23] diced affordable housing is [3:38:25] rapidly disappearing in response [3:38:27] local communities have begun to [3:38:30] acquire it. And preserve it the [3:38:33] strategy is known as acquisition [3:38:35] rehabilitation. Or act recap. [3:38:40] yeah under. This new pro cap hcd [3:38:43] would admit. A program to [3:38:45] provide grants and loans for [3:38:47] applicants an eligible borrowers [3:38:49] such as nonprofits are local [3:38:50] public entities such as housing [3:38:52] trusts. Can help offset the cost [3:38:55] to acquire and rehabilitate fund [3:38:58] subsidized market rate housing. [3:39:00] s. B. Two two five also creates [3:39:02] a technical assistance program [3:39:04] to support cap borrowers by [3:39:06] providing peer to peer learning [3:39:08] and consultation to assist with [3:39:10] resident engagement in education [3:39:12] property assessment affordable [3:39:14] housing operations and a [3:39:16] spectrum of ownership and [3:39:17] stewardship models. So that the [3:39:20] any- are borrowers under the cap [3:39:22] program can be sus successful- [3:39:26] so this is an innovative [3:39:27] partnership that will help [3:39:28] preserve housing that is [3:39:30] currently affordable but is not [3:39:32] in any kind of program to [3:39:34] preserve its long term put [3:39:36] affordability. And to testify in [3:39:38] support we have just seen [3:39:39] markets from the enterprise [3:39:40] community partners and amber lee [3:39:42] leslie with housing california. Through enterprises [3:40:20] work both in california and [3:40:22] across the country we've seen [3:40:24] first hand that there's no [3:40:25] silver bullet to addressing our [3:40:27] housing and homelessness crisis [3:40:29] we need a comprehensive approach [3:40:31] and preservation specifically [3:40:33] acquisition we have which is the [3:40:35] focus of this bill. Is an [3:40:37] important tool in the state's [3:40:38] toolbox to promote affordability [3:40:41] prevent displacement and prevent [3:40:42] homelessness. For a communities [3:40:45] across the state local nonprofit [3:40:47] organizations community land [3:40:49] trust cities housing authorities [3:40:51] have been doing this type of [3:40:52] innovative acquisition work over [3:40:55] for over a decade. As a senator [3:40:58] described these organizations [3:40:59] are purchasing rental housing [3:41:01] from the private market were low [3:41:02] income households live today and [3:41:04] preserving it as deed restricted [3:41:07] affordable housing for the long [3:41:08] term. Cap was envisioned and [3:41:10] designed based on the lessons [3:41:12] learned and best practices from [3:41:13] these local efforts the design [3:41:15] of this program is grounded in [3:41:17] this engagement with local [3:41:18] practitioners. As well as [3:41:20] lessons learned from other state [3:41:22] programs at the housing [3:41:23] community development [3:41:24] department. We modeled at this [3:41:26] program off of the success of [3:41:28] each city's golden state [3:41:28] acquisition fund which for over [3:41:30] a decade has provided [3:41:32] acquisition capital for land to [3:41:34] build new housing. Cap is [3:41:36] designed in this model as a [3:41:38] partnership between each city [3:41:40] and nonprofit lenders who can [3:41:42] distribute program funds quickly [3:41:43] and efficiently to the [3:41:45] nonprofits and public sector [3:41:47] partners they need to purchase [3:41:48] these residential buildings at [3:41:50] the speed of the private market [3:41:52] . These nonprofit developers [3:41:54] community based organizations [3:41:56] housing authorities will then [3:41:57] manage these buildings as deed [3:41:59] restricted affordable housing [3:42:02] either rental or homeownership. [3:42:04] we like to say acquisition [3:42:06] preservation is a to bird one [3:42:09] seat approach the program both [3:42:09] prevents displacement and [3:42:11] homelessness for residents [3:42:12] living in these buildings today [3:42:13] while also growing our supply of [3:42:15] deed restricted affordable homes [3:42:17] for decades to come. It is a [3:42:19] fast and efficient strategy [3:42:21] would deals closing in months [3:42:22] rather than years and also often [3:42:25] has cost efficiency is relative [3:42:27] to new construction. We hear [3:42:29] from our local partners [3:42:30] regularly about the impact of [3:42:32] their acquisition rehab efforts [3:42:34] the families were able to stay [3:42:35] in their communities close to [3:42:36] jobs and schools. But we also [3:42:38] hear about the missed [3:42:40] opportunities the community [3:42:41] minded landlord for example [3:42:43] who's approaching retirement and [3:42:44] wants to ensure the stability of [3:42:46] their tenants. And sell to a non [3:42:48] profit organization rather than [3:42:50] institutional investor. But [3:42:52] there's not currently a state [3:42:53] program for these organizations [3:42:56] to utilize in these instances. [3:42:57] sb two to five in cap were [3:42:59] designed to fill this gap and we [3:43:01] respectfully urge your aye vote [3:43:02] to support continuing to move [3:43:04] this bill forward and this [3:43:05] conversation forward this year [3:43:07] happy to answer any questions [3:43:08] thank you. So the idea before [3:43:50] you today the cap program I was [3:43:52] born from the work of the stable [3:43:54] homes california coalition of [3:43:56] which are organizations are part [3:43:58] in a press community partners [3:43:59] and housing california. To [3:44:01] create housing policy solutions [3:44:02] that responded to the economic [3:44:05] strains placed upon vulnerable [3:44:07] communities at the height of the [3:44:08] pandemic. Since twenty twenty [3:44:10] our coalition of cap supporters [3:44:11] has grown to include community [3:44:13] development corporations. [3:44:15] community land trusts nonprofit [3:44:17] housing developers intent [3:44:19] advocacy groups and so far [3:44:22] ninety five organizations have [3:44:23] endorsed the cap program. [3:44:25] capitalizes a strategy for [3:44:27] growing california's housing [3:44:28] stock that was will rise by [3:44:30] project home key. But cap is [3:44:32] unique because it provides [3:44:33] critical resources to protect [3:44:35] existing housing units without [3:44:37] long term affordability [3:44:38] covenants from being lost to the [3:44:40] speculative housing market- I [3:44:43] just wanna share a bit of data [3:44:45] that. And most of [3:45:03] those have been in southern [3:45:05] california in the bay area and [3:45:06] fresno and san diego and also [3:45:07] here in sacramento. So the [3:45:09] legislature must continue to [3:45:11] invest in programs that keep for [3:45:13] housing- and create more [3:45:15] housing. A couple keep low [3:45:17] income californians in their [3:45:18] homes and increase the supply of [3:45:21] affordable housing more swiftly [3:45:22] than the- a is your swiftly and [3:45:24] effectively than the car. Ab it- then is- [3:49:56] brought up to a market level and [3:49:57] the people who are living there [3:49:59] can no longer afford so what [3:50:01] this would do is create a [3:50:02] program to help support those [3:50:04] entities that want to purchase [3:50:06] these type of properties and [3:50:07] already in my district we have a [3:50:09] number of community land trusts [3:50:11] that have been doing this for [3:50:13] some time. And so we have a [3:50:14] number of properties that were [3:50:16] that are now permanently [3:50:18] affordable or thirty five year [3:50:20] you know deed restricted in [3:50:21] such. That weird then the [3:50:23] tenants are- you know are able [3:50:25] to afford it no have confidence [3:50:27] that they're going to be able to [3:50:29] afford it for long term. So it's [3:50:31] yes it is it is not increase [3:50:34] supply however it keeps certain [3:50:36] housing that otherwise wouldn't [3:50:39] be affordable. But their [3:50:41] portable because we're [3:50:42] subsidizing not necessarily no. [3:50:46] it's it- it it's more that we [3:50:49] are supporting the- those [3:50:52] entities that want to try to [3:50:54] purchase this type of program. [3:50:56] this type of a building there [3:50:58] might be a- armed. I'm trying to [3:51:01] understand the concepts it would [3:51:02] initially help. The so if I'm [3:51:05] that land trust for example the [3:51:08] way they can programs [3:51:09] constructed. That if it succeeds [3:51:12] in is approved and signed into [3:51:13] law. That there might be grants [3:51:16] or loans to that land trusts for [3:51:18] example or another entity that [3:51:20] is trying to buy that it's not [3:51:22] an ongoing subsidy it's not [3:51:23] something that. Continues to be [3:51:25] subsidized overtime it's more de [3:51:28] initial helps and do the initial [3:51:30] acquisition were the initial [3:51:32] rehab. So the grants to make it [3:51:34] so that it becomes affordable it [3:51:36] may not it it makes it in in [3:51:38] naples the entities trying to [3:51:40] purchase it to purchase it or re [3:51:43] habit.
