[0:12] » Mr. Collins? >> Yes. [0:13] » Mr. Bryant? >> Yes. [0:14] » Mr. Horton? >> Yes. [0:15] » And I vote yes. [0:21] Okay. Upon the motion, um, the board in the close session under Virginia code [0:26] section 2.2-3711 2-3711 A5, A6 and A8. I'll ask each member to certify. I'll start with Mr. Erling. >> I will abstain since I was not privy to [1:28] the majority of the closed session. >> Okay. Mr. Horton, [1:32] » I so certify. >> Mr. Bryant, [1:33] » I so certify. >> Mr. Collins, [1:35] » I so certify. >> Mr. Moore, [1:36] » I so certify. >> And I so certify. [1:39] » Okay. At this time, I'll ask Mr. Brunt if he'll lead us an invocation and [1:42] pledge, please. Let's pray. Heavenly Father, we thank [1:46] you for another opportunity to be here tonight. God, we just ask that you would [1:50] just guide us in all our decision making. Lord, we just want to be a [1:54] blessing for the county and the citizens in Jesus name. Amen. Amen. [1:58] » Amen. I pledge allegiance to the flag of the United States of America and to the [2:04] republic for which it stands, one nation under God, indivisible, with liberty and [2:10] justice for all. [2:17] Mr. Chairman, I'd like to make a motion to agree to the agenda to add another [2:22] close session at the end. >> Okay. Have a motion. That's [2:29] discussion. >> Okay. Have a motion for one finish close [2:34] session at the end of the meeting. Do I have a second? [2:36] » Second. >> Okay. Start the button. Mr. Early. [2:38] » Yes. >> Mr. Horton? [2:39] » Yes. >> Mr. Bryant? [2:40] » Yes. >> Mr. Collins? [2:42] » Yes. Mr. Moore, >> yes. [2:43] » And I vote yes. >> Okay. Next on agenda is citizen time. [2:48] Um, of course, we want to welcome you into our meeting. Um, please be advised [2:52] that outbursts or disruptive behavior will not be tolerated. [clears throat] [2:56] We need to maintain a respectful and productive environment for all [2:58] attendees. Please direct all comments to the board as a whole referring from [3:03] addressing individual members or employees. Personal attacks on [3:08] individual board members as well as use of profane insults will not be [3:13] tolerated. Scope of topics should pertain to issues within the purview of [3:18] the board of local government. Topics beyond the board's control or unrelated [3:22] to local governance are not appropriate for public comment. Question and answer [3:26] public comment is not a question and answer session. um we will not respond [3:31] to you. We give you the opportunity. It's three minutes to talk and uh [3:36] is a time limit [3:40] and if you spoke on the same subject in the past 6 months, we'll ask that you [3:44] speak on something different. That being said, we'll start with Jeff [3:50] Wimberly. I get that correct? [clears throat] [3:56] » Mr. Chairman, now I make a statement. >> Yes, sir. [4:01] » If Mr. Warin is invited to the second close session, I think it would be [4:06] appropriate for him to speak to the board then as opposed to now [4:10] » on the airport. >> That's fine with me. [4:13] » I have no problem with that. >> Okay. [4:15] » Would you be able to hang around for that? [4:17] » Yeah. >> Okay. Thank you. [4:21] » All right. Next, we have Malcolm Smith. [4:27] Good evening, chairman, members of board. My name is [4:34] Dr. Nin Smith. I live at 45 on Mclofflin Road in Laurel Fort. [4:41] I'm here because a damn fail in Carol County and people downstream including [4:49] myself, 30 other citizens paid the price. [4:55] That dam is Virginia Dam 03504. [5:01] It let loose 150 million gallons of water and whatever else was in that [5:09] lake. It belongs to Old Mill. It is regulated [5:14] by DCR. I know that Old Mill's wastewater system. [snorts] Did you [5:20] know? Did you know they have a wastewater plant there at Old Mill Golf [5:26] Course and their dam failed and that wastewater [5:32] plant is below the dam. [5:37] These are not vague allegations. These are regulated facilities. [5:44] There are records and there are inspections. [5:48] There are compliance requirements. And there is a very simple question for [5:54] this board. What did Carol County know [5:59] about this dam before August 2nd? [6:08] And what did Carol County do after August 2nd? [6:14] I have 30 members of my community who've signed a petition asking for time and a [6:20] meeting in front of this board because nothing was done. In fact, the [6:27] only way the county found out that this dam is breached is because I called DCR [6:35] who then sent a letter. I hope all of you read. [6:40] What did Carol County do? Well, I've been digging in the records about this, [6:44] Dan. What I'm finding is very deeply troubled. There appears to be roughly a [6:51] 20year history of non-compliance uh by this owner of Old Mill, an owner [7:01] who you brought before you and celebrated for over 30 minutes. Yet [7:05] you'll only give me 3 minutes to talk about it. [7:10] 20 years they've been out of compliance. Not 20 days, [7:15] 20, not 20 weeks. 20 years they've been out of compliance. [7:20] If that is wrong, if that's wrong, if that information is wrong, correct me. [7:28] You can't. If that's true, that they've been out of [7:34] compliance. Listen, I got two more minutes. [7:38] » I'm going to give you another minute. >> Thank you. [7:40] » Uhhuh. [7:44] » Why wasn't something done when this stand was out of compliance for 20 [7:48] years? People downstream were flooded when it failed. And now the question [7:54] becomes even more important. What happened after the fail? Did this county [7:59] demand answers? Did each of you demand answers? Did it Did you contact DCR? No, [8:06] I did. Did you contact DEEQ? No, I didn't. [8:13] Find out what really happened in the office. [8:18] Put the complete history of ban 35 03504 out on the table for all of us. Get DQ's [8:27] records about the waste facility. Did it breach when the dam did. Find out [8:33] exactly what happened during the August flood. Find out what the emergency [8:38] notification system was supposed to do. And that's where they're mainly out of [8:44] compliance. you have some work to do about this [8:49] errant neighbor and I look forward to hearing what you're going to do. [8:53] » Thank you, sir. >> Thank you. [8:57] » And next we have Greg Alger. [9:08] » Good evening, y'all. [clears throat] >> Good evening. [9:12] » I'm coming just to talk about a little bit about what So my family and friends [9:16] were concerned about several people in this room and it's the recoccurring [9:21] thing here the data center [9:26] a lot of the people that I know doesn't think the board's really [9:30] concerned about I don't know if that's true or not [9:35] but what I've been told is you know y'all are supposed to represent us our [9:40] beliefs our values it's not like we're asking for y'all doing something illegal [9:46] But nobody I talked to has mentioned wanting a data center in this town. [9:53] Nobody. There's too many negative side effects [9:59] uh from having. [10:03] We just want to know that we're being taken care of. [10:07] Most people think zoning is not the only option. There's got to be another what [10:12] option out there. Uh [10:18] and I guess something I want to ask supervisors as a whole. You really want [10:23] your kids growing up with these data centers and their neighborhood effects. [10:28] You want your grandkids, your nieces, your nephews, your neighbors, you want [10:33] them having to hear these data centers, deal with the water shortages, the rise [10:37] of electric bills that we get from. [10:42] Why can't we leave these data centers in Lowland County, Prince William County, [10:46] Fairfax, and where all these areas that support Abigail Spamber? [10:54] Um, they don't care about this part, this part of the state. [11:00] Um, do we really think that data centers [11:03] will fit in with our tourism industry around here? Nobody else does. [11:09] Um, and if if it's an revenue, tax income, [11:14] revenue thing, why can't we get more factors in this place in this county? [11:18] I'm a lifelong I have lived in Carol County my whole life. [11:23] We had the we had Mayfield, we had cross crew, we had all these other packers, [11:30] they closed down and we haven't really gotten a lot of jobs. We had Magnolia [11:35] for decades. Now look at Magnolia. We are losing people to take younger [11:43] generations are now going elsewhere so they can find jobs. [11:48] So why can't we get factories in here instead of a data center? [11:53] Uh, it's something else that some of the folks that I know one board must be [12:00] reminded of that no matter how long you've been on the board, no matter how [12:04] what your last name is, what you've done respectfully, [12:09] come election time, each and every one of you can be replaced if you don't [12:13] represent your constituents. [applause] Thank you. [12:23] Okay, next is Ron Mclofflin. [12:28] » You don't want to speak? Thank you, sir. Okay, next is Jean Bergetta. [12:33] » Yes. [12:40] » I just um want to first start off by saying I'm not for zoning and not for [12:46] data centers. I don't think I'm sorry. I don't think those are our only You know, [12:50] it seems like there were big being given uh started out the noise about data [12:56] centers and then it became the noise [snorts] about zoning and then it became [13:00] we have to have both of those things. It sounded like from this board that in [13:04] order to uh reel in data centers we need to have zoning. So in other words, both [13:09] things are an inevitable thing it sounds like from this board. And I don't [13:14] believe that's the truth. And honestly, I think that uh a lot of the there's [13:20] been a lot of uh I'm trying to be nice about this obiscation as far as what uh [13:27] the data centers approaching Carol County. It seems like we've been told [13:32] many times, oh, nobody's approached us yet. It hasn't it isn't a thing. But in [13:36] fact, it is a thing. And it has been approached has been being talked about [13:40] for quite a while now. So, um, you know, I don't think that we're being [13:44] represented, uh, truthfully [clears throat] and with, [13:48] uh, you know, clarity. And I think we deserve that as as residents of this [13:52] county. And as as the man said, you know, you guys are elected to represent [13:56] us, and I'm not, you know, that's what we deserve and that's what [14:01] we expect. So my question is to this board um at any point are we going to [14:08] receive that clarity and that uh transparency as far as what's going on [14:14] with these players who want to come in here and extract from our community, [14:19] take our resources, drive up our electric rates, pollute our our [14:25] environment with noise and water pollution and whatever else. you know, [14:30] they're they're obviously uh talk a good game. They're going to tell us what they [14:35] what we want to hear, but I think that we need to go dig a little deeper. And I [14:39] think as your representatives, it's you guys who should be doing it for us [14:43] because we elect you to do that. So, anyhow, I thank you for the time and uh [14:49] appreciate it. >> Thank you, sir. [14:50] » Thank you. [14:59] » [applause] [15:03] » Okay, that's all I have. So, moving on, I will entertain a motion to approve the [15:08] minutes that was presented in your agenda. Make that motion. [15:13] » Have a motion by Mr. Collins. I have a second. [15:15] » Second. Okay. Start the vote of Mr. Horton. [15:18] » Yes. >> Mr. Bryant? Yes. [15:19] » Mr. Earling? Yes. >> Mr. Collins? Yes. [15:21] » Mr. Moore? >> Yes. And I vote yes. Okay, next on the [15:25] agenda is invoices would be the invoices A81726. [15:30] I'll entertain a motion to approve that invoice [15:34] » as presented in your packet. >> So move. Okay. Motion by Mr. Moore. Do I [15:38] have a second? >> Second. [15:40] » Okay. Second by Mr. Warden. We'll start the vote with Mr. Warden. [15:43] » Yes. >> Mr. Early. Yes. [15:45] » Mr. Bryant. >> Yes. [15:46] » Mr. Collins? >> Yes. Mr. Moore? [15:48] » Yes. >> And I vote yes. [15:50] » Okay. Next on the new business, um, we have a public hearing for the [15:55] lodging tax. >> Excuse missed the consent counter. [15:59] » Oh, I'm sorry. I apologize. Um, we'll back up a minute. I'll entertain a [16:03] motion to approve the consent calendar as presented in your packet. [16:06] » I'll make a motion. >> Okay. I have a motion. Do I have a [16:08] second? >> Second. [16:10] » Start the vote to Mr. Moore? Yes. >> Mr. Collins? Yes. [16:13] » Mr. Bryant? Yes. Mr. Horton? Yes. Mr. Early? Yes. And I vote yes. [16:18] » Thank you, Mr. Okay. Next, uh we have a public hearing [16:22] for the lodge and tax and I'll open that public hearing at 7:35 [16:31] and no one signed up to speak on the lodge. [16:42] Leave it open for a minute. [16:54] right now. [17:07] Watch. [17:18] Okay, I'll close the public hearing at 7:36 [17:24] on the agenda. I'll entertain a motion to [17:29] approve the lodge and tax as advertised or whatever your pleasure is. [17:36] » I'll make that motion, Joe. >> Okay. I have a motion by Mr. Horton. I [17:40] have a second. >> Second. [17:42] » Second by Mr. Early. We'll start the vote to Mr. Moore. Mr. Chairman. [17:45] » Yes, sir. >> Mr. Chairman, [17:47] » I just wanted to uh see if you could uh uh amend the [17:56] the uh motion to approve the ordinance amending and restating the reordance of [18:02] chapter 27 221 article. >> Yes, sir. Sir, [18:08] » thank you. >> Oh, that you have in your packet. It's [18:10] on the back side of it. This will this will take care of the 12%. [18:17] » Okay. So the motion would read would be to approve the ordinance. [18:21] » Okay. So I need a motion to approve the ordinance. Please move. [18:23] » Okay. Do I have a second? >> Second. [18:25] » Okay. Start the vote over with Mr. Horton. [18:28] » Yes. >> Mr. Early. [18:29] » Yes. >> Mr. Bunt. [18:30] » Yes. >> Mr. Collins. Yes. [18:31] » Mr. Moore. >> Yes. [18:32] » And I vote yes. >> Okay. I did skip over. It wasn't on my [18:36] agenda sheet, but invoices. I'll go back to invoices. entertain a motion to [18:41] approve um invoice B September 7, 2026. >> I like that motion. [18:49] » Okay. I have a motion. I have a second. >> Second. [18:51] » Okay. Start voting. Mr. Early? >> Yes. [18:53] » Mr. Horton? >> Yes. [18:54] » Mr. Bryant? >> Yes. [18:55] » Mr. Collins? Yes. >> Mr. Moore? [18:57] » Yes. >> And I vote yes. [18:59] » Okay. Next on the agenda is the public hearing for the school budget amendment. [19:03] And I'll open it up at 7:38. [19:09] No one has signed up for that. Mr. Watson, you want to tell us about the [19:12] » Okay. Uh, we approved the uh went through the process and approved the [19:16] budget this year to provide funding for uh Carol County Schools. Uh when we went [19:22] through the process, we knew that the budget was not approved from the state. [19:26] So, the funding would change based on uh the approved uh Virginia state budget. [19:35] The uh reason for having the uh public hearing is because the total budget [19:41] change would be more than 1% of the uh budget. [19:48] Out of this that's the uh total revenues that were received by the schools would [19:52] be uh 1,296,87. [19:57] of that only 277,594 [20:03] uh is local effort. Okay, we fund the school system at U [20:10] require local effort plus the additional programming and this is part of that as [20:15] well. So this is not an addition on top of u our local required effort or the [20:21] additional funding. So, okay. >> Uh, part of this funding they received [20:25] was for special ed at risk uh school federal dollars for school uh [20:32] improvement, but the total amount of the change would be1,296,87. [20:38] Um [20:42] uh if the board would like to uh move forward with it to vote to approve the [20:48] uh bud budget appropriation request for fiscal year 2627 [20:57] close the public hearing at 7:40 school budget amendment and I'll [21:02] entertain a motion. So move. >> Mr. Chair, can I read a statement before [21:06] you do that? Today's discussion involves county budget. Discussion may include [21:10] funding does include funding for Car County School Board. As many of you [21:13] know, I have a position appointment with the Carol County School Board. With [21:16] regard to the proposed funding of the school board, um the proposed funding [21:21] would affect the entire school system generally not myself individually. As a [21:24] consequence, I'm a member of group of three or more individuals who are [21:27] employed with Carroll County School Board. Similarly affected by the [21:30] decision on the proposed funding. Therefore, in this situation, the [21:33] exception of Virginia State Local Conflict of Interest Act BA Code section [21:38] 2.2-3112B warrant applies to this situation. In [21:43] compliance with that se section, I hereby declare that I'm able to [21:46] participate in this discussion and voting on this topic fairly, [21:50] objectively, and in the public interest. >> Okay. Thank you, Mr. Collins. And you [21:54] did make a motion, Mr. Moore. So, do I have a second? [21:58] » Second. Okay. Any discussion? Not. We'll start the vote with Mr. Moore. [22:03] » Yes. >> Mr. Collins, [22:04] » yes. >> Mr. Erling, [22:05] » yes. >> Mr. Bryant, [22:06] » yes. >> Mr. Horton, [22:08] » yes. >> And I vote yes. [22:11] » And next on the agenda is our last public hearing, and this is for the [22:18] disposition of property. This this is the same one that we talked about the [22:22] civic league for a while. Okay. >> We'll start that public hearing at 7:41. [22:32] I won't sign up for that one either. [23:11] Okay, we'll close the public hearing at 7:42 [23:16] and I will entertain a motion if [23:26] You're talking about the ball field behind the It's called the Civic League [23:29] building, correct? >> I was used for the helicopter. [23:33] » Yeah. The property that we're looking at uh [23:39] disposing of would be the ball that I'm not sure if uh both of them are listed. [23:46] Yes. I think the original uh had a vote in [23:52] there, but it only be the ball. Okay. So, I'll entertain a motion [23:59] if we want to do that or not. Somebody get Okay. Have [24:04] a motion on Mr. Bryant. I have a second. [24:12] » This is a question. What? We're just going to be conveying that property to [24:17] the church. Is that correct? >> Yes. [24:22] They're going to keep the field up for the helicopter in return. Is that [24:26] correct? >> I believe that's what they're going to [24:30] maintain it >> and give it the uh allow some people to [24:34] use it as far as we still use it as a landing thing. [24:38] » And I use it for baseball field too. >> I'll second I'll second it. [24:42] » Okay. I have a second. So, uh, we'll start the [24:45] vote with, uh, Mr. Moore. >> Yes. [24:48] » Mr. Collins, >> yes. [24:49] » Mr. Early, >> yes. [24:50] » Mr. Brown, >> yes. [24:51] » Mr. Horton, >> yes. [24:54] » Okay. Next under new business is the pop, excuse me, personal property tax [24:59] relief. Uh, this was revised. [25:07] So whereas the per personal property tax relief act of 1998 Virginia code 58-1 [25:14] 3523 extra session has been substantially modified by the enactment [25:18] of chapter one of the exit assembly 2004 special session 1 Senate bill 5005 and [25:26] the provisions of item 503 of chapter 951 of the 2005 acts of assembly the [25:31] 2005 revisions to the 20046 appropriations act here after cited the [25:37] 2005 appropriations act. So now there therefore be resolved by the California [25:42] board of supervisors that qualifying vehicles obtaining within the county [25:46] during uh tax year 2026 shall receive personal property tax relief in the [25:51] following manner. So personal use vehicles valued at $1,000 or less will [25:56] be eligible for 100% tax relief. Personally use vehicles valued at $1,01 [26:02] to $20,000 will be eligible for 22.55% tax relief. Personally used vehicles [26:09] valued at 20,0001 or more shall receive 22 shall only [26:16] receive 22.55 tax relief on the on the first 20,000 of the value. and all other [26:22] vehicles which should not meet the definition of qualifying business used [26:25] vehicles, farm use vehicles, motor homes will not be eligible for any form of tax [26:28] relief in this program. >> So I'll entertain a motion that we adopt [26:32] this resolution. >> Okay, I have a second. [26:36] » Second. >> Any discussion? [26:39] Start the vote. Mr. Early, >> yes. [26:41] » Mr. Horton, >> yes. [26:43] » Mr. Collins, >> yes. [26:44] » Mr. Bryant, >> yes. [26:45] » Mr. Moore, >> yes. [26:48] » Okay. Next on the agenda is a board request for school resource uh officer [26:54] funding and this is the requested funding in amounts of 163,000 for SRO [27:00] positions at the Ray Center and Laurel Elementary. Is that correct, Mr. Kemp? [27:05] Yes, [clears throat] sir. >> All right. These funds were included in [27:07] the budget in anticipation of the grant reward, but we didn't get the the grant [27:11] is what I'm understanding. Okay. So, um, of course, we do have letters from [27:17] Sheriff Kemp and Mr. Huff, uh, Mr. Edwards asking us to fund these [27:24] positions. So, I'll entertain a motion that we fund these or [27:30] the board. So, we get motion. >> Make a motion by Mr. Bryant, a second by [27:34] Mr. Moore. >> So, we'll start the vote with Mr. [27:37] Collins. >> Yes. [27:38] » Mr. Early, >> yes. [27:39] » Mr. Moore, >> yes. [27:40] » Mr. Brunt, >> yes. [27:41] » Mr. Wley, >> yes. against. [27:45] » Thank you. >> Okay, next on the agenda is old [27:48] business. Does anyone have any old business? [28:02] See what Chris? [28:06] » Yeah. Okay. Okay. So, next on the agenda, we have a resolution um where [28:11] the governor of Virginia has announced an additional 4 days off on Friday, [28:14] September 4th in reservance of Labor Day, which has already happened. So, [28:22] » four hours off, >> four hours off. They got a half a day. [28:24] So, we just adopted the resolution that we approve the additional four hours [28:28] off. [28:31] » So, move. >> Okay. I have a second. [28:36] Second. >> All right. Start a button. Mr. Warden, [28:39] » yes. >> Mr. Bryant, [28:40] » yes. >> Mr. Early, [28:41] » yes. >> Mr. Collins, yes. [28:42] » Mr. Moore, >> yes. [28:43] » And I vote yes. >> Yeah. Okay. [28:47] » All right. Now, we'll move on to old business. Does anyone have any old [28:50] business? [28:59] Okay. If not, we're going to move on to uh board member comments. And I will [29:04] start with Mr. Early. Uh, Mr. Chairman, I think board member [29:08] comments should wait until after the closed second close session. [29:21] Um, >> yeah, we've already made the motion [29:25] right before it. So, we're going to go ahead and [29:33] » I'll save my comments for last. >> Okay. I'll start with Mr. Horton. [29:40] » Uh, just want to say thank you to all the staff for everything you're doing. [29:44] Um, I would like to make a motion if I could, Mr. Chairman. [29:47] » Yes, sir. Uh, first motion I'd like to make tonight, I'd like to make a motion [29:50] to give Piper Cap Rescue Squad requested $33,66969 [29:57] to reimburse them for funds used from their savings to repair and upgrade the [30:02] equipment received from [music] Rescue. >> Okay, have a motion to have a second. [30:07] Second, >> Mr. Watson, is that good? That form is [30:11] that >> which one proper gap is that? We just [30:15] need to have a uh a motion to approve the amount and to appropriate the funds. [30:20] » Okay. All right. We've got it done. I've got a motion in a second. I'll start the [30:24] vote with Mr. Morris. >> Yes. [30:26] » Mr. Collins. Yes. >> Mr. Early. [30:28] » Yes. >> Mr. Bryant. [30:29] » Yes. >> Mr. Hordley? [30:30] » Yes. And I s >> And I do have another motion I'd like to [30:34] make. Uh Mr. Chairman. >> Yes, sir. I'd like to make a motion to [30:38] replace the proced board members, the current board me board member from the [30:41] proced board for Carol County with Ronnie Collins and Tracy Moore. [30:46] » Okay. I have a motion that we're going to we'll be replacing Mr. Early and Mr. [30:50] Watson. Correct. >> That's correct. [30:52] » With Mr. Collins and Mr. Moore? >> That's correct. [30:54] » All right. Do I have a second? >> Second. [30:57] » Any discussion? Mr. Chairman, I would absolutely love to step away from it, [31:02] but you probably need to have the bylaws changed. If the board would like, I will [31:06] not attend meetings, but the bylaws say that it has to be the county [31:10] administrator and appointment of the board. Okay. So, I'd be more than happy [31:16] not to go, but you wouldn't have that person there. [31:22] By law, say administrator. >> Yes, sir. Okay. I thought it said a [31:26] county employee as well. I hope. [32:06] Thank you. [32:14] [snorts] [32:58] » [clears throat and cough] [33:11] » Okay. I've got governor body members and employees may serve. It's under 1.4. [33:16] board article one [33:21] the received bylaws. Okay, I stand corrected [33:31] as members of the respective governor bodies of each member locality may be [33:35] appointed as me authority as many as may employ [33:39] employees of such political subdivisions and employees member authority locality [33:44] made as condition of the appointed employees contract for the member [33:48] locality. >> Mr. chairman. Um [33:51] just looking through the code, I think, um this isn't something we discussed [33:55] ahead of time, so this is something I might recommend you table for now. [33:59] [clears throat] Um just to make sure that um that we have authority to do [34:03] that midterm. Um some bodies that you all point to, you have the right to [34:10] remove at will. Um but the enabling legislation [34:17] um 15.2-6 2-6400 ETSC uh appears to provide a set term of [34:24] four years for members. Second [34:30] » um obviously respect Mr. Dur I think we'll go ahead and vote. [34:35] We have a motion. Who made a motion? >> I made a motion. [34:38] » Okay. Do we have a second? >> A second. [34:40] » Okay. We'll start the voting with Mr. Moore. [34:45] » I have a second. >> Mr. Collins. [34:46] » I have a statement. Mr. Harden, >> yes. [34:49] » Mr. Bunt, >> yes. [34:50] » Mr. Early, >> no. [34:51] » And I vote yes. >> Thank you. [34:57] [clears throat] >> And the last thing I got tonight, just [35:00] want to tell all the citizens, thank you guys for coming out and participating [35:03] tonight. We we appreciate your guys uh interact interactions with us and we are [35:09] listening. I just want to tell you guys, thank you again. That's all I got. [35:15] » Okay, Mr. Bryant. Yeah, I just uh echo what Mr. Orton said and just appreciate [35:20] you guys coming out. Uh we are working on things. I know it don't seem like it, [35:26] but we're we're definitely working on things. We do have the best interest of [35:31] the citizens and the counties and appreciate our staff and this board. [35:36] That's all I got. >> Thank you, Mr. Moore. [35:41] » I'd like to echo what Bill said. you know, thank everybody for coming out. [35:46] Um, you know, we had a good time at the fair and good [35:52] to see the citizens. Thank all the volunteers and the people that worked at [35:57] the fair and our county employees. You know, I was up there for a couple nights [36:00] and our county employees were there, a lot of them every night working the [36:04] fair. So, that was good to see. Appreciate them. [36:08] Um [clears throat] that said, you know, [36:14] I know that some of the things have been hot topics for our citizens, you know, [36:18] and seems like me and Mr. Collins got put in a hot seat on the procedure board [36:23] now. So just bear with us, understand it started tonight. So that's all I have to [36:28] say. >> Thank you, Mr. Moore, Mr. Collins. [36:32] » Yeah. First of all, I want to thank everybody for coming out. I appreciate [36:36] the fact that you're here being involved. That means a lot to this [36:40] county. Means a lot to me as a board member. U Thank you for your patience to [36:44] the county as we work out the details of the trash. I know we've had some snafuss [36:51] and some a lot of people happy, a lot of people that have concerns. But you know [36:56] what I'm trying to tell people is when you contact me, we'll get something [36:59] done. Mike's been wonderful to work with and getting the the things ironed out, [37:04] but we're close. to getting all that ironed out and it's a it's a great [37:07] benefit to our people. So, I'm glad that it's there and I appreciate your [37:12] patience. Thank you to our county staff. Thank you to our fire, rescue, sheriff's [37:16] department, EMS. I mean, the the way this county works together. I appreciate [37:21] that very much. So, thank you for all that. And that being said, Mr. Chairman, [37:25] I have a motion that I'd like to make. >> Yes, sir. Mr. Collins. Based upon the [37:29] clear and consistent opposition expressed by the citizens of Carroll [37:32] County, I move that the board of supervisors decline to pursue or adopt [37:36] the proposed countywide zoning zoning ordinance. Further, that we withdraw any [37:40] previous direction or referral concerning that proposal, request that [37:44] the planning commission terminate its con consideration of it, direct county [37:48] staff not to spend additional time or public funds developing countywide [37:52] zoning unless specifically authorized by future recorded vote of this board. [37:57] Thank you, Mr. Collins. I have your motion [38:00] um that basically we're going to direct this uh excuse me, the planning [38:05] commission to stop work. We're not going to work on zoning. Um so, do I have a [38:10] second for that motion? >> Second. [38:12] » Second by Mr. Bryant. Any discussion? If not, I'll start the vote. Mr. Moore, [38:18] » yes. >> Mr. Collins? [38:19] » Yes. >> Mr. Bryant? [38:20] » Yes. >> Mr. Horton? [38:21] » Yes. Mr. Early? I abstain as a member of the planning commission and other vote. [38:26] Yes. [38:30] [applause] [38:35] » Anything else, Mr. Cos? >> Oh, I'm sorry. That's all I have. [38:38] » Okay. Um, so I've got a few things I want to get into. Um, [clears throat] [38:45] one thing on the This will be our This is, you know, the the old meal. Um, you [38:51] know, there was 8 to 9 ines of rain that night. Um, we do have sympathy empathy [38:56] for the for the people there, but we we've explained to um Mr. Smith several [39:02] times, we're not the enforcement agency. Um, we don't have regulatory, we don't [39:07] regulate or have enforcement authority over impounds. And there was no [39:11] emergency action response as implemented because no one called 911. No emergency [39:15] calls were made. I mean we're boots on the ground will come if you call for [39:18] emergency but no one called we weren't even notified [39:24] by him until almost a week later that there been a damage and these already [39:28] noninvoked emergency response procedures are determined that emergency existed. [39:32] So there was no emergency response for us to be Yeah, they they are in [39:37] violation which we know that but the again we're not the enforcement [39:41] enforcement is DCR which um you want to say anything about that Mr. [39:47] Fel Monica I mean I know you're all working with them and and they're [39:50] they're going to regulate it and get it you know then we'll have a copy of it on [39:53] on hand and that's that's where it lays. >> Yes. So I would just say that DCR is [39:59] actively involved and they are the regency [40:16] agency and they are actively involved in working with the dam. Um I know they [40:21] submitted a formalized letter advising them of the status of their [40:25] non-compliance. Um, and we as uh emergency management, we're definitely [40:30] in support of any action that needs to happen. We are to be a stakeholder and a [40:35] community partner with all of our dam owners. And at their request, we work [40:39] with them, help them, give them guidance, participate in tabletop [40:43] exercises, review their plans, and things of that nature. But we can only [40:48] do that when those dam owners that are required by the regulation to submit [40:53] that to us. So, um, our plan moving forward is to reach out to all of our [40:58] dam owners and, um, ask them if they do have an emergency action plan, would [41:03] they share that with us, which they are supposed to do, but we can ask them. And [41:08] our plan moving forward is to at least on an annual basis reach out to each of [41:13] our owners, let them know that we're interested, and if we don't hear from [41:17] them, then we will let DCR know that we have not heard anything. Right. [41:21] » And I feel like that would be our due diligence. Okay, thank you. [41:24] » I appreciate that. Thank you. >> I hate he's laughing, but um okay, the [41:29] next thing um that I have I want to discuss, you know, talking about data [41:34] centers. Um and again, I mean, some of you's been here, you know, I've lived [41:38] all my life here, too. I've got kids here. You know, it's hard to find jobs. [41:43] I mean, I know what you're talking about. And there I've drove away most of [41:45] my life to work. We're not sitting here meeting with data centers. It's a buy [41:50] right state. you know, you can be working one right now and I wouldn't [41:53] know it, you know, and you can start it up. So, it's not like we're sitting down [41:57] having conversation with all these data centers to come in. Um, you know, is [42:02] there some things we can do? I'm hoping um in the PSA one thing we did do was we [42:08] passed a policy that uh we passed it tonight as a matter of fact that any any [42:14] commercial or industrial user that would require more than 40,000 gallons per day [42:19] of drinking water capacity of such a daily consumption would have to come to [42:24] the PSA board to get approval. So that's that's a big step. [applause] [42:30] So, they can't just come in and PSA and take 300,000 gallons. They've got to [42:34] come for permission. Um 40,000 gallons seems like a lot of water, but that's [42:38] not a lot of water. I mean, you know, there's there's a lot of places use more [42:42] than that. But but that's a big step in my opinion, and I thank the PSA board [42:45] for taking that step uh that we did. Um, another thing that I that I would would [42:52] like to do is um Monday, Chris's not here, so if you need to know what Monday [42:57] is, [43:01] Monday, I'd like to advertise a meeting um Monday, September 14th at 5:30 [43:09] um to draft and adopt a data center ordinance [43:15] that we can um move forward with. If you'll advertise that, Mr. Watson. [43:20] And also um I think we need to have a a joint meeting with Britta [43:26] on Tuesday. [43:30] Uh 5:30 will be Monday the data center and Tuesday is 5:30. Let's do 5:30 for [43:38] Tuesday as well. [43:45] » Do what? >> No, [43:50] it's the third. So we have a services. [43:55] Yeah, we should be good. Now they'll meet the week of the 21st. [43:59] » Will those be public? >> Yes, there'll be some public portion. I [44:04] mean, we're probably going to u you know have some conversations. You know, this [44:07] is our first conversation with proceed as a board. So, uh but we will have some [44:12] public comment. Yes. Or or at least give you some transparency of what we talked [44:16] about. >> Public is invited. [44:18] » Yes. >> Will it be here? [44:20] » Yes, ma'am. Yes, ma'am. >> So, the the main money probably won't [44:25] last very long. It's it's you know we'll have to draft an ordinance for the um [44:29] data centers and but you're welcome to come at 5:30. Uh we'll do them both at [44:34] 5:30 if that's if that works for everybody. Make it simple Monday and [44:38] Tuesday. Okay. And [44:45] make sure I'm not missing anything. [44:56] And I think we miss >> I do have one. [44:58] » Okay. >> And I and I'll have to ask Mr. Watson on [45:02] the appropriation for the do I need to appropriate that from the CIP or [45:07] » which one >> for the ambulances? [45:10] » It would have to be appropriated for the CIP. [45:12] » Is the CIP is that a line item on the CIP? Now [45:16] » it would have we would have to I can adjust it. We only have 450,000. [45:23] » So my motion could be to to $539,695 [45:30] for ambulance and >> two ambulance [45:33] » and direct staff for the two ambulances and [45:38] » appropriated out of the >> appropriate out. [45:40] » We have 450 and CF now. >> Correct. That's my motion. [45:43] » Yeah. Okay. >> All right. Um have a motion that's uh [45:48] appropriate 539695 for two two ambulances [45:53] with Carol EMS. >> Second. [45:56] » Second. Is that Mr. Mr. >> Mr. Okay. I'll start the vote. Mr. [46:01] Collins. >> Yes. [46:01] » Mr. Moore. >> Yes. [46:02] » Mr. Early. >> Yes. [46:04] » Mr. Bryant. >> Yes. [46:05] » Mr. Harden. >> Yes. [46:06] » And I vote. Yes. [46:11] » Okay. And that's all. Do you did you want to say something for [46:14] » I did. I I wanted to echo what Mr. Bryant said. You know, we do listen. I [46:19] think it's obvious by some of the actions we've taken tonight that we do [46:22] listen. Uh to the gentleman that launched manufacturing back here, it [46:28] went to China and it ain't coming back. You know, new tech is where jobs are [46:34] going to be created and that's some perhaps data centers or something else, [46:38] but we're not going to have furniture pl factories or textile factories here in [46:43] Carol County. That those days are long gone. We need to look to the future and [46:49] the future is information and that's what data centers are. Also want to say [46:54] I'm sorry I could not attend the uh county fair. I know it was a big [46:57] success. The weather was pretty good. I had uh other obligations that I had to [47:02] tend to and uh I wish I could have been there. But again, thanks to the staff [47:06] for all they do. >> Thank you. [47:09] » Mr. Kemp, I think he wants to address Sheriff Kemp. If you'll come on forward, [47:13] please sir. >> Good evening, gentlemen. [47:17] » Good evening. >> Good to see you all. Just want to take a [47:19] moment of your time. personally thank you for working with my office and with [47:24] our school system on behalf of all of us for what you decided to do. I [47:30] know it wasn't easy. I know we were faced with a decision that we wasn't [47:34] expecting July 14th when that very Department of Criminal Justice Services [47:38] worked hard to try to make sure that burden was put on all of us. You've all [47:42] read that information. But I just want to publicly say um I hate that we all [47:47] hate to got put in that situation from our state, but we all know that that's [47:51] what we do. We signed up to do this community. So I want to personally thank [47:54] all of you and and the staff and the county administrator's office for taking [47:58] time with this community, my staff, the community, the schools and helping make [48:01] that happen. >> Thank you so much. [48:03] » We appreciate Thank you. [48:08] » Mr. Nothing. Did you want to say anything? [48:10] » I just echo what sheriff said. Thank you all. [48:13] » Thank you. Okay. I want to move on to uh county administrator comments. Nothing [48:19] tonight. County attorney comment. >> Not today. [48:23] » All right. Thank you. And we're going to um go back into close session. Mr. Burn [48:28] under the airport finish our conversation. That's only thing we'll be [48:31] discussing and then there will not be a meeting. Uh [48:34] » yes. Uh Mr. Chairman, that would be uh 2.2371181. 2371181 [48:39] discussion, consideration or interviews of respective candidates for employment, [48:42] assignment, appointment, promotion, performance, de motion, salaries, [48:46] disciplining, or resignation of specific public officers, appointees or employees [48:50] of any public body. And as you said, it should be related to the uh airport. [48:55] » Okay. >> And what what was that under a [48:58] » A1? >> A1. And um well before we're while we're [49:02] still in in open session um I would ask Mr. Early to the extent that you were [49:08] present for part of the discussion uh in close session um just if you could [49:13] certify um that during the portion that you were talking about during the first [49:16] close session [clears throat and cough] um that only members that only matters [49:20] that were lawfully exempt from disclosure were discussed while you were [49:24] there. [snorts] Can you reference the 3711 section that [49:32] I was present for? I will certify that. >> Yes. [49:35] » A8. >> Uh, and a [49:39] » a >> A8. Yes. [49:42] » I so certify that A8 was in accordance with the close session motion. [49:52] Um it was um also covered the [50:02] city. We also under [50:07] A6 I'm sorry. >> Yeah, A6 would be fun. [50:13] » It was the funding stuff and A6 also certify. [50:18] » Thank you. [50:24] Okay. So, we need to make a new motion to go into close session under A1. [50:28] » And Mr. Chairman, I think we add in two. [50:35] » Is A1 all Mr. Duran? [50:43] » That's all that I have. >> Okay. [50:47] So I entertain a um upon motion the board of command to close session for [50:51] discussions authorized by Virginia code section 2.2-3711A1. [50:56] It's of course going to be about our board discussion. Um and we're also in [51:00] in this motion uh we're going to invite back in close session Jeff [51:06] » Wry. >> Thank you Wry. Okay. So I have a do I [51:10] have a motion? So >> move. [51:12] » Okay. Second vote. Mr. Horton. [51:16] » Yes. >> Mr. Mr. Bryant. [51:17] » Yes. >> Mr. Erda. Yes. Mr. Collins. Yes. Mr. [51:19] Moore. >> Yes.
