Uh but we have developments on the way and there's [3:36] future coming and I thought maybe there'd be some way [3:40] to get a a moratorum to stop the future stuff [3:45] uh on the basis of like u uh if the city water system isn't big [3:52] enough to accommodate the new development that maybe they would hold [3:57] it off something to that effect. Uh but uh I was talking with uh Dave Jones [4:04] there, our our solicitor today, and he explained a little bit more to me uh [4:11] regarding uh [snorts] our rights as far as [4:15] township on what we can do to try and stop some [4:20] of this so we can lighten things up. When you look at the fact that a [4:24] development goes in with uh say 100 homes, that's 200 more cars that go on [4:31] this road out here. And when you look out there at 11:00 in the morning and [4:37] see gridlock both directions, you know there's something wrong. And but we're [4:42] dealing with that. It's going to get worse. [4:45] Um I don't know, Dave, u do you have any comments on this as far as explain how [4:51] we stand on this? Well, it's it's under the Pennsylvania Municipal Planning [4:55] Code. If a if a developer comes in with a plan that meets the requirements of [4:58] the zoning ordinance and the subdivision land development ordinance, they are in [5:03] fact entitled legally to an approval. I'm not speaking sight to a a a [5:10] ordinance requirement that has not been met. So, that is part of the issue. [5:14] Pennsylvania's long long been a property rights states that if you own a piece of [5:18] property, you're allowed to do what you're permitted to do with it [5:21] reasonably. Um there's a lot of case law about municipalities trying to put [5:26] moratoriums on development and they've all been turned they've all been [5:30] reversed and said you can't do that. So um unfortunately I I just have to tell [5:35] you what the law is. It's not my position necessarily, but um I drive [5:39] through this this traffic sometimes, too. But at the same time, we can't [5:42] control 11:15 or Route 15 and and that's a state road. And that's not just [5:48] because of the development here. [clears throat] That's because [5:49] development south of us, development north of us, west and east of us, and [5:53] it's just more and more people on the road. So, [5:55] » thank you. Now, the changes they want to make are more like acceleration [6:43] ramps and de acceleration ramps for uh roads that um [6:50] uh come out and say have a stop sign or something like that at Route 15 plus to [6:56] help it for the businesses to get on and off which I think would help things but [7:01] uh that's 5 years away and uh I the biggest problem that I see [7:09] is the fact that we're we had in our comp comp plan, we had uh interchanges [7:17] that we thought should go in um and uh different locations and some [7:23] roads that would uh back up these interchanges [7:27] and uh 5 years from now they're going to be gone. Um I can wait till it gets [8:34] pulled up. Um but we did come through with pulary plan uh in 2024. We had two [8:40] waiverss associated with that that were approved as well. Um it's a 252,000 [8:45] ft industrial facility with associated loading docks with 33 loading docks, 41 [8:53] trailer spaces, and 88 employee spaces. [9:00] I apologize. [9:09] » Uh the building provides fire access 360 around the building and there's a fire [9:13] water tank um solely for the facility located on the property. We have NPDES approval as well as uh chapter 105 [9:34] permit approval for a roadway that crosses a stream that we are providing a [9:38] culprit access through. Now, um traffic is expected to be approved by PENDOT [9:45] here in the next couple weeks. [clears throat] Very hard to know down [9:47] the time frame as I'm sure you know. Um but all the major things have been [9:52] ironed out. Our sewer and water are tying into the extensions already [9:56] provided by the TCU project uh directly above us this south. Um and we also have [10:03] electric on site. Um there are some minor improvements to [10:10] your road coming mainly widening your shoulders um and repaving lanes. Um kind [10:16] of matching what TC did just continuing that down further. There you go. So that [10:22] is the um lot one to the bottom of the screen is route 15 [10:29] and then on the right hand side is your road. Um up above to the north is your [10:34] residual lot too which is pretty much just open field going to remain that [10:38] way. Um up here [10:43] that's where our storm basin will be going. Um majority of the runoff reaches [10:47] that [clears throat] and then it discharges further to the left hand side [10:51] down to dogwood run. Um again we all permits with D for that already. [10:57] Um here is the fire access. I talked about [11:02] fire that was discussed with fire chief um and ultimately approved as well the [11:07] gold marana plants. When this pro uh project got started, I did [11:20] some research on on what needed to be done [11:25] uh with certain things as far as oil separators. Okay. The oil separator deal [11:31] was I checked on what the new road tractor's maximum fuel capacity was and [11:39] the maximum fuel capacity was like uh uh I think it was like 730 gallons [11:47] and the possibility of a fuel tank rupture in a parking lot even if it's [11:52] just a fender bender or just a failure of a a fuel [snorts] line or something [11:58] like that where you can start having a spill. You should be able to contain [12:04] the maximum gallons so it doesn't get into the screen and actually get it [12:09] before it goes into your basement. And it's a simple thing to do and I find out [12:16] I was trying to get from your people the information as we went along and along [12:21] and along what was going on and they kept saying, [12:25] "Well, we'll get back to you. will get back in. Never did it. I finally find [12:30] out you're putting in standard fuel station like service station where [12:37] you get gas uh drain systems and that's it. There's [12:42] one every one of them is going to catch I think it's 30 gallons or 40 gallons of [12:48] fuel and from there on it's going to go in the stream there. If you have another [12:55] uh storm drain 30 ft away and some of it goes in there [13:00] and it captures 40 40 gallons and start sending it into the stream, that's what [13:06] you're going to have. You're supposed to have a system right before the the basin [13:14] where all the all the water or whatever from the parking lot comes down into one [13:20] pipe and right before it goes in there have an oil separator [13:26] and they changed it all around and come up with this storm drain deal which [13:31] ain't going to do it. So there if you know it's already passed, it's already [13:37] in place. But if there is a problem and it gets into the spring and it goes down [13:43] into yellow, somebody's going to have a big clean up. [13:47] » I mean, >> yeah. [36:00] um it's just meant me necessarily that you have to be certified under that [36:06] program in order to apply for this grant. That's that's about it. If the requirement is that you lose all [36:21] discretion, they would need the 287g participation because it is [36:24] discretionary. Correct. >> Correct. [36:28] » Right. So for them to add if if the second requirement were well [36:38] you don't have a choice you don't need 287g it would just say you have to [36:41] commit to participating in all those activities that you you imagine all the [36:47] major task force activities and so on and so forth. We certain I'll certainly [36:51] look into it by next week. who's trying to look into that. But from a logical [36:54] standpoint, they wouldn't bootstrap it to 287G [36:58] if it's not discretionary on they wouldn't need 287G at all. [37:03] » Right. And I think that, you know, the part [37:06] there allows departments that don't participate in 287G to have a pathway as [37:11] well. Um, in the [37:24] agreement, there were three different options to choose from in that [37:28] agreement. Um when I when uh my personal drawings weren't detailed enough, I went [44:33] and uh and got my own engineer to draw plans um which were submitted with the [44:40] voting uh permit. Um and then at that point in time uh [44:46] um I uh had gone to Asia. Um the uh property [44:55] um you know a lot of people haven't been there uh think that I should have been [45:01] able to get equipment down there. Um but it's a 20x40. I don't have too many um [45:08] uh too much equipment that can get down in [45:12] there to get that done. So I dug it up by hand. Um it was a lengthy process. Um [45:18] and then um uh and it was quite surgical as well since I was doing it. Um and um [45:26] if I would have gotten [laughter] equipment down there, I would have never [45:28] been able to get the dirt on the other side of the prop other side of the [45:32] building in the basement out the way I was able to get them out as as I did it. [45:37] Um so uh [clears throat] so that took a long time. Um and with with the [45:44] buildings from as I went before I got the um uh drawings from my uh engineer [45:52] and then submitted that like the memorandum of understanding was wrecked [45:58] right from the beginning that timeline and as I submitted that timeline before [46:02] you guys in a written letter that I wrote to you guys that was like like off [46:09] the top of my head. Um, and then I had no idea at the time, my own ignorance, I [46:15] had no idea what the solicitor was. Brandon had told me that um, that I had [46:20] some papers to sign from the solicitor. And so I waited um, and then it took [46:26] took off to get the paper. I got the I got them two days before I went to Asia. [46:30] I actually mailed them to Brandon in San Francisco as I was heading out of the [46:34] country. I signed them because I don't know what you guys are. you guys [46:39] were good enough to suspend um being uh [46:44] the engineer, pure engineer, and and so um I I just signed them to get to get [46:50] them signed and get me going. Um but that that that timeline's been wrecked [46:55] since the beginning. Um but I I got I got um uh Dave's [clears throat] been [47:00] out to the site. Um uh he's seen it. Um uh at this point in time, I've been [47:06] laying block today. Um, I got I I keep looking at my phone. Um, where I got the [47:12] instruction I think was a Monday, a week ago. [clears throat] Um, and um uh and [47:17] then uh I poured I actually for Friday. Um, and I had to get I I I launched a [47:26] cement mixer down in there and then I had 80 bags of uh concrete that I mixed [47:32] in a cement mixer. took me about well I got done at 8:00 at night and I started [47:36] at like 11:00 so I was poured and then I I went I went [47:42] on Saturday morning to get block of coal [47:48] um cement and then they were closed uh so I couldn't I couldn't start playing [47:54] well I couldn't start with a newer block I had some block that I was able to lay [47:58] my first course with um and then I I went this morning and got uh how the 90 [48:05] 90 block um uh and been laying I made a sec part of the second course today and [48:12] um and then uh had to offload my truck and that's why I was late um because I [48:17] just got done offloading 90 block and every one of those bags was carried from [48:24] the road down and then down to the basement. Uh, two labors actually helped [48:30] me with doing the cement bags. The block I did I did I just carried down to once [48:35] this one [clears throat] just down to the top of the the basement [48:39] because um uh it I don't [clears throat] know if they shared any picture but um [48:46] or Brandon um I I I have to pump the water once I get rains um because it's [48:52] fills up down there. So, I have a I bought a small utility pump to pump the [48:56] water out on the windows and um so that's been an ongoing issue with the [49:02] the [clears throat] digging with the heat and the and the water and the rain [49:06] that we've had. Um um but I'm I mean I'm not on the timeline, but I'm I'm there [49:13] every day. Um so, m Mr. and you're, you know, by the end of August, you're to be [49:20] finish the roof and clean up all the debris and then close in the structure [49:23] throughout the month of September. So, [clears throat] um, and within that [49:28] memorandum of understanding, it it it says default by owner. If the event the [49:32] owner fails to meet one or more of the repair milestones above, township shall [49:36] immediately renew enforcement action on the dangerous building provisions. [49:39] » I understand that, sir. >> We don't have a choice. I mean, is [49:42] that's an agreement that you you agreed to based on the timeline you submitted [49:46] to the board. I mean, we have residents that have filed complaints based on the [49:58] concern of that being a dangerous a dangerous house, a dangerous building, [50:04] right? The only thing is the only way anybody's going to get hurt there is if [53:13] they're trespassing on this property if something were to happen. So my name is Shane [1:02:43] Macintosh. I'm president of Billsburg Area Soccer Club. uh Daryl Stlair who is [1:02:48] our fields director. And on top of the um the remote lighting fixtures that we [1:02:56] use annually to help facilitate soccer practices for kids in our community, um [1:03:01] we've come across an opportunity to implement a capital improvement to [1:03:05] Chestnut. Um, this would include a series of lights that would be [1:03:10] permanently fixed to the ground and provide a more permanent um, ability for [1:03:16] us to provide that soccer to kids in the evenings. Um, the capital to make this [1:03:23] improvement is rather significant. Um, the maintenance of said lights we would [1:03:29] be looking to take responsibility of. Um, and in return for that investment in [1:03:35] the community, we were hoping to have some guarantees of of use of the fields [1:03:38] for our kids that play soccer. Um, and so we were looking for [1:03:44] both the some advice from the solicitor um, and any sort of guidance that you [1:03:50] would have as a board of supervisors to our organization to implement this in [1:03:55] such a way that is agreeable to you. um a huge benefit to the community but also [1:04:00] an important resource to build soccer club to implement our soccer programs. [1:04:06] » Yeah. So Mr. Solicer in this case is there a type of like possible lease [1:04:11] agreement or how would we handle it? I just want to ensure that you know next [1:04:15] year we say oh it's all lacrosse and there's soccer next year you know the [1:04:18] year after they put these lines. >> Yeah. So there are ways to do that and it may be over a period of [1:05:06] time or kind of amvertises out the price of the you know improvements because we [1:05:13] don't want to give it to you forever either or if you go away you know things [1:05:17] like that. So um there are certainly things we can talk about and get in [1:05:20] place. I've done that and >> I usually do it more for schools and [1:05:24] municipalities. you see that more with where people putting lights on fields [1:05:28] and turf stadiums and things like that, but you know, it's for usually the the [1:05:33] program at the schools. So, certainly something we can work through. She said, "I got two jobs I go [1:36:41] to and plus this." And I said, "Why?" She said, "Because of paying her college [1:36:46] tuition." >> Okay. So, I got to talk to her and I [1:36:51] found out that she went to college to be an engineer [1:36:55] and she's the kind of engineer um uh like you have in a township. [1:37:02] And I got talking with her a little bit, but she says she doesn't do that kind of [1:37:06] work. She works for Penoni. And um what she does is she works [1:37:13] uh for them, but she gets paid by Pendot and she's paid to uh do research on [1:37:22] roads in townships. It doesn't cost the township anything. [1:37:28] She she does stuff like uh [clears throat] checking how much [1:37:31] traffic there is and and uh whether the road is needed or whatever and if it if [1:37:38] it's a road that isn't there uh she can recommend to pend on to put [1:37:45] you know to put it on the list to put a road there. So these roads that we need [1:37:50] for interchanges, which are going to go up in smoke here within the next 5 [1:37:55] years, if we can get them to come in for free and lay out these roads that we [1:38:02] need so that nobody builds on them, so we got them when we need them in, you [1:38:09] know, 5 years. We need interchanges. >> No offense, D. Didn't we just do a [1:38:13] comprehensive plan? >> Yeah, but guess what? [1:38:44] Um, I know that um that uh this girl's name is Haley Chavik [1:38:49] and uh she that's what she does and I can find out but I don't know if uh uh [1:38:57] and you have to see the scope of what what that is because yes there's [1:39:00] companies that do traffic studies as far as traffic counts and stuff. It's not [1:39:05] designing roads and and doing studies. >> [clears throat] [1:39:10] » I'd like to, you know, see what the specifics are because I don't think [1:39:14] they'd come in and design a route 15 bypass and look at it. They're not doing [1:39:19] traffic counts, you know, intersection, uh, crash data reports, stuff like that. [1:39:23] I know, you know, that type of stuff. Well, the like for um the drawings that [1:39:28] we have in our comp plan, she she could look at this stuff, look where the roads [1:39:34] go, figure that's the best way or another know the roots better or [1:39:38] whatever it is and then recommend hear from her if that's what she can do [1:39:44] because we don't really know what she can do. [1:39:47] We met with PennDOT right after they had the whole presentation about Route 15 [1:39:51] resurfacing and and redoing in the next couple coming up the next couple years. [1:39:55] And all three of those interchanges that are in the comp plan are have been and [1:39:59] are in front of not only the PENDOT but your county uh planning commission. [1:40:04] Okay. And uh that's been vetted and not really approved, quasi approved, but um [1:40:10] it's already been down the pipe long enough to where the York County Planning [1:40:14] Commission representative basically is telling us that you we are so far ahead [1:40:18] of having those projects in the pipeline to be able to get uh approved by PENDOT. [1:40:24] Okay. >> So um this might get us the approval. [1:40:29] That wouldn't it would it would have to if it if she did came up with some other [1:40:33] idea it would be at the very bottom of the list of projects which would be [1:40:37] probably 20 plus years out >> and they're not going to require the [1:40:41] rightway until they're ready to fund the project which [1:40:44] » that doesn't help us on >> no matter what is going to say what's [1:40:49] going to happen with the interchange nobody else no consultant not even our [1:40:54] county planning commission it'll be pendot that makes the final approval [1:40:59] present to present something. [clears throat] [1:41:01] » I see the way I understand it, the roads we got now, there's going to be a [1:41:06] development going across one of them. >> When those roads are gone in 5 years, [1:41:12] we're done. >> There there is not going to be anything [1:41:16] but these [clears throat] new entrance deel deceleration grants and [1:41:22] acceleration ramps. And we're going to be looking, if they were put in right [1:41:26] now, it would help a little bit, but we're looking at a disaster. And this is [1:41:32] a disaster for this town. The Route 15 in Carol Township is super important [1:41:39] because of the businesses on it. And we get a lot of revenue off of that. That's [1:41:44] going to all be destroyed. And Pendot's having a ball doing it. If we don't do [1:41:49] something to stop it and get this fixed, we're going to be in big trouble. We're [1:41:54] already in big trouble because it should have had a bypass drawn up for nothing [1:41:59] back in the '90s. That would have been land that was bought. They start buying [1:42:03] land to do the bypass when it was necessary. Well, guess what? We don't [1:42:08] got nothing. There's no plan. It's it's nothing but a band-aid to hold us for 5 [1:42:14] years. And at the end of the 5 years, we might as well not even have it. We we, [1:42:19] you know, in a way, you know, if you're talking to Dave and that, we might as [1:42:23] well go out and encourage all the building we can get. Eventually, [1:42:27] somebody important from the state might live in this area that can't get to work [1:42:33] and maybe we'll get something, but the only way we're going to get it is start [1:42:37] tearing homes down. And that's where we're at. And I don't like that. as [1:42:41] residents homes. I, you know, something should be done. I [1:42:47] mean, we can't let this go. >> Yeah.
