[0:05] Good evening, ladies and gentlemen, it is, uh, 7:00 pm. [0:10] like to call this meeting to order of the cedar hills city council. Um, [0:14] a quorum of the council is present. The agenda has been duly posted, [0:18] uh, like to make sure everyone know that concealed carry carrying of firearms [0:23] is prohibited in the council chamber. Um, tonight we will have, [0:28] uh, the invocation of by our very own pastor victor [0:32] jackson, that will be followed by the pledge of allegiance for the asce council member hayden. If [0:36] he would lead us in the pledge of allegiance, uh, pastor victor jackson [0:40] for 10 years, as faithfully and joyfully said, building the kingdom community [0:45] church, along with his wife, ramona and before planning, [0:49] uh, building the kingdom community, the church pastor vic worked in a variety of capacities, [0:53] farming and services. Uh, these are they church. [0:58] uh, pastor vic joined dallas first church and became the first african [1:02] american pastor of the nazarene denomination. Uh, [1:06] what a loving, I love you philosophy, pastor [1:10] vic has discovered that those who serve in ministry really grow in their relationship with god [1:15] as they serve him and others. Would you stand for the invocation? [1:24] thank you so much. Uh, pro tim [1:29] allen sams, and I want to pray in the absence of a mayor. Uh, [1:33] know what's going on with him, but I know he's not here. So I want to make sure I put him in my prayer. [1:38] let us pray. Heavenly father, we come only [1:42] because you have allowed us to come. It's nothing in and of ourselves [1:46] that have gotten us to this point in our lives. And for that we say, thank you. [1:50] we say, thank you that there are new mercies each and every day. [1:55] we thank you for this day. An opportunity to put a smile on your face, [1:59] to bring glory and honor to your name. I pray for these that are [2:03] in leadership father, that you would bless them and to give them [2:08] wisdom and unity, father god, to come together for the common [2:12] good of the city of cedar hill. I pray for our mayor in [2:16] his absence lord, that you would watch over him and protect him and his family. [2:21] and what I asked that you would be in the midst of this meeting, [2:25] that the love that you display for each and every one of us, we [2:29] will display that same love to each other, [2:33] father, god, we can agree to disagree, but father god let's agree to love. I don't know what I asked her when they [2:50] leave this place, father god, they were finding homes as they left them, protect [2:55] them on the highways and byways and father will be careful to give you all [2:59] the praise to glory and honor this in jesus name. [3:41] well, we're certainly glad to have everyone here. As you may notice, the mayor is not [3:45] here. He was on a bagel unavailable to be here, but we all want to [3:49] make sure we keep him and his family in our prayers. Um, a couple of [3:53] things that I would say I'd like to, uh, make a special [3:57] note of, uh, we have professor angela phelps and her government and economics [4:01] class. Would you just worry about so everybody can know who you are, appreciate [4:06] those that have expressed interest in government. And we'll try to show you what [4:10] a good government looks like tonight. Um, moving on to [4:14] the agenda, the first item on the agenda is this citizens forum. [4:18] and we have tonight. Um, I have judith bakkens [4:23] yup. Judas june. You will have three minutes, [4:33] correct me if I'm wrong, but I understand the city limits residence [4:37] due to garage sales a year and we're supposed to obtain a permit. [4:42] I doubt that enforcement is a big priority, but it does provide [4:47] a tool to prevent folks from money and resale or retail business [4:51] out of their garages. Are there restrictions? [4:56] I'm assuming they are to what stores can be used for in cedar hill. [5:01] for example, could I make a residence [5:05] in a store or use it as a po motel? [5:10] but if I buy a house and as in any residential area, hoa [5:14] or not, I can use it as a motel, which is exactly what [5:18] a short-term rental is. These short-term rentals are analogous [5:23] to the so-called lemon socialism, where profits are privatized [5:27] and risks of socialized. The advantage of short-term rentals, [5:32] increased income are repaying individual property owners. [5:36] well, the downsides are born by the community as a whole, [5:41] a quiet sleepy neighborhood that all of a sudden has vacationers stands. [5:45] a good chance of losing its quiet, sleepy nature, the holiday [5:49] and needs, permits and licenses. And they pay a hotel tax to the [5:54] city as a cost of doing business. Does the city impose a motel [5:58] tax on these short-term rentals? If not, why not? Do [6:02] they need a permit, a license? And if not, why not? Are they [6:06] being used as bnbs bread in vec breakfast? [6:10] do you know if food is being served, they are [6:14] a bnb and should be required to meet the state's [6:18] requirements and because defied as a food establishment [6:22] and comply with those state regulations as well, [6:27] uh, those houses that do short term rentals, owner occupied, [6:32] do they have a homestead exemption? If they're not owner occupied, [6:36] do they have a homestead exemption? Anyway, the idea that [6:40] these so-called short-term rentals should be controlled by hos is quite [6:44] frankly ridiculous. The burden is tremendous. One [6:48] law firm, just one law firm, j patrick sutton has [6:52] filed 20 lawsuits against hos in 2021. [6:57] he argues that his client's rights are being taken away by amendments [7:02] to constructive too restrictive covenants. How [7:07] many other firms have, or will file similar lawsuits [7:11] regardless of how these lawsuits turn out. And it will probably take years. [7:16] it is possible that individual hos are going to have to pony [7:20] up a lot of money to defend their position, win or lose [7:24] while airbnb and other such corporations consider lawsuits [7:29] and advertising during football playoffs, just the cost of doing business. [7:34] there are over a dozen associations in cedar hill. [8:05] thank you. So as, um, since it's not on the agenda [8:09] where we're unable to discuss, but I'd like to defer this to the city manager [8:13] and his staff to, uh, respond back to you if that's okay. The [8:55] next item on the agenda, um, is a consent agenda. [9:02] consent agenda includes routine items that may be act upon with a single vote. [9:07] any council member may remove items from the consent agenda for separate discussion [9:11] and consideration. Number b closed section [11:48] carl pursuant to section 5, 5, 5 points 0 7 1 2 [11:52] consultation with attorney and 5 5 1 dash zero seven to [11:57] deliberation regarding real property of the texas local government pole consultation [12:01] with city attorney. On the matter in which the city attorney's duty of confidentiality [12:05] to the city, clearly conflicts with the texans texas open meeting act, [12:10] um, and open, uh, and deliberation regarding the purchase of rural [12:14] property were assessed. The deliberation and open meeting would have a detrimental effect [12:18] on the position of the city in negotiation with a third person regarding the following [12:22] medic property acquisition for road, a project and item [12:26] number c closed session pursuant to the provisions of chapter 5, 5, 1 [12:31] of the texas government code in accordance with authority contained in section 5, 5, 1 [12:35] 0.071 and 5.5 1.087 [12:40] consultation with attorney received legal advice regarding the master development agreement [12:44] with taj hospitality management.
