[0:00] We're ready to get started. OK, uh, it is, it is, uh, September 29, 2026. It's 6 [0:08] p.m. I'm, I'm calling this meeting to order. We're gonna begin with a pledge to Vlad [0:12] Mayor Prote, will you do the pledge, please. [0:18] All right, I pledge allegiance to the flag of the United States of America and to [0:25] the Republic for which it stands, one nation under God, indivisible, with liberty [0:32] and justice for all. [0:35] Honor the Texas flag. I pledge Jesus to Texas, one state under God, [0:43] one and indivisible. OK, uh, Kelly, can you see the invitation, please? [0:52] Heavenly Father, thank you, uh, for today, God, and for your grace, and Father, I [0:56] just ask that you be with us this evening as, uh, as we make these decisions for [1:00] our city for our future. God, uh, be with each and every one of us in this room, [1:05] in this community, and Father, be with our, uh, police forces. They're out on the [1:08] streets. Put, put a hedge of protection around them. God, we just thank you for all [1:12] that you've given us. In your name we pray. Amen. Amen. OK, uh, Laurie, would you [1:19] please do the roll call. [1:24] Cy Ditzler. Here Milton Wallace, Angie Saxon. Patrick Hadnott, Kelly [1:32] Smith, Bob Verrier, we do have a quorum. OK, uh, but there's, I don't have any agenda [1:40] changes. Do any council members have any agenda changes? OK. All right, at this time [1:47] we go to the visitor citizens forum. I'm gonna turn this over to the Americo exam. [1:53] Any sheets there with the list on it? [2:00] I mean she [2:08] I mean [2:19] OK, for the open forum, we have Mr. Harvey Musberg. [2:30] Make sure you state your name and your location. [2:39] Uh-huh. [2:47] My name is still Harvey Musberg and I live at 520 Ridgeway and because of previous [2:54] strokes I'm hard of hearing and my doctor says I'm deaf but I don't listen to him. [3:00] Uh, I've just noticed on the uh. Uh, city website of the meeting live. The [3:08] closed caption isn't on and I don't know why, uh, but, uh, I did not, I was not coming [3:16] here to, uh, speak about, uh, the, uh, disability of death. I came to, uh, talk for [3:23] just a moment about, uh, filling a void. Uh, a lot of people know that we're in a [3:30] drought and hopefully tomorrow, uh, we're going to start getting rain, maybe the [3:35] next day, so it's really gonna help our drought, but if you'll get on Google, if [3:41] everybody would get on Google, all the people who are watching, uh, uh, Ms. Fletcher's, [3:47] uh, uh, Facebook page, get on Google and ask, is there a blood [3:55] shortage in East Texas? Um, I Uh, I have a bandage right now [4:03] because I donate platelets. I don't donate blood. I donate platelets. Uh, I'm, I'm [4:10] past 8 gallons. I'm working on 9 gallons of donated platelets. Uh, I wanted to bring [4:16] it to everybody's attention. That, uh, you can go over here to Carter Blood Bank [4:23] in Tyler, uh, and donate blood or plasma, you can donate full, whole blood or [4:30] plasma or you can donate platelets. There is a shortage right now. Um, my, uh, previous [4:37] donation of platelets went to somebody here in Tyler area and, uh, previous to that, [4:45] my platelets had to be. Uh, hurried over to, uh, the city of Dallas and I thought, [4:53] how embarrassing of all the people who live in Dallas County, Tarrant County, people [4:59] who live in Plano, Richardson, how many millions of people live over there, but my [5:04] platelets had to be rushed over to Dallas County. There is a drastic shortage right [5:10] now, so, uh, I'm sorry, I'm not speaking about something that the council can do [5:15] anything about. I'm speaking to the citizens and the viewers, uh, here in Chandler. [5:22] Please be aware that we need blood, we need platelets, we need plasma. Uh, there [5:28] is a very, very drastic shortage right now. And because there's no closed caption, [5:34] I won't be staying for the meeting and I wish all of you Godspeed and luck on, on [5:40] accomplishing all the wonderful things that everybody wants to happen. Thank you. [5:47] Thank you. [5:51] And thank you for your donation as well. All right. That is the, Last person, [5:59] the only person's name on the open forum. [6:08] Uh, did you hear me? I can't hear you now. Are you on mute? [6:16] Uh So, you're on mute. [6:23] Yes, uh, Mayor Protem, please carry on for the meeting. Oh, OK. Just here there, [6:31] uh, they can see you and I think it works aesthetically quite, quite, quite, quite [6:36] well. Thank you. All right, next we go to the public hearing. Um, we [6:44] have And a sign up sheet here for the open hearing, but Mr. Moosberg was the only [6:50] person who signed up, so that takes care. I think maybe so, but he signed on both [6:57] of them, so. Either that was OK, so moving on in the public hearing number 1, we're [7:05] gonna conduct a public hearing to receive comments for or against um the annual budget [7:12] which said we didn't have anyone uh there uh do we want number 2 is to conduct a [7:17] public hearing to receive comments for and against it as well against the tax rate, [7:23] uh, which we didn't have anyone there as well. So we'll move on now to the regular [7:29] session. [7:33] In the regular session. Number one Consider amendment for the fiscal year 2526 [7:41] budget by appropriating a portion of the fund balance from water fund to cover expenditures [7:48] this fiscal year exceeding previous appropriate and approved annual water budget [7:54] funds and directing staff to take all actions needed to fully balance the 25-26 budget. [8:01] So we're gonna ask our. Financial officer to explain. OK, so you all have a spreadsheet [8:09] in front of you. Um, the highlighted areas are the ones, those are the expense lines [8:14] that are actually over budget, but the ones that aren't highlighted are actually [8:18] carrying those. However, there is the equipment purchase line. And that's toward [8:25] the bottom, 2nd from the bottom. So what happened is we did a loan for equipment, [8:31] uh, the skid steer, a trailer, and a truck, and that money was actually deposited [8:37] in FY 25 in September. Budget was already done. It wasn't budgeted for since it had [8:43] been adopted already. So the equipment was purchased in that next year, October, [8:49] November. So that's about 200,000 that wasn't planned for in the budget and then [8:56] if you look at the end you'll see about 973,000 that's been paid toward, uh, [9:03] grants. We've gotten reimbursement but we had to pay that and so that wasn't budgeted [9:09] in the budget and when the revenue came in we didn't recognize that and put it in [9:12] the budget to absorb those expenditures. So we have to cover those. Um, we can't [9:17] end the year on a, on a deficit, um, and so we need to move money from, [9:25] sorry, money from fund balance to Make this even and then we need to make have more [9:31] money to make all the bills, payroll and everything that we're gonna have for September, [9:37] so. I don't, I don't know how much it's gonna be. I know that we're, we're gonna [9:42] have to do 571,082 66 cents for sure. I was looking at it earlier and [9:51] I, I think to be safe so we don't end up back here on the 13th trying to make it [9:56] right again, I think that we should just do um 350 on top of that and that will go [10:04] back in fund balance if we don't use it that way we just move it there we're safe, [10:09] we don't know what bills are coming in and then it just goes back into fund balance [10:12] if we don't use it so if you're good with that. Uh, can I ask a question? Yes sir. [10:19] What is the total? What is the total that you're wanting to move? So 25. [10:26] Let's see. [10:37] So let's just do 920,000 if everybody is OK with that. And we have enough in, in, [10:44] we have enough in our fund balance. You have enough, yeah, you have enough in your [10:48] fund balance, um, and next year I actually budgeted for the revenue and the expenditures [10:54] for the grants. To the best of my knowledge, uh, I got with Caitlin and so as the [11:00] year goes on, grants pop up all the time and so what we would normally do is once [11:04] that money comes in, you would just recognize that revenue. It puts it there, you [11:08] put it in the expenditures and you don't have to worry about that at the end of the [11:11] year if you take care of it as it as it comes in. So you're, so give that amount [11:16] again that you're asking the council to approve please. 920,000. OK. 920,000, [11:24] so, OK. That's, you've answered my question. Thank you. Um, I have a couple of questions, [11:31] Kay. Um, do we know what our water fund balance is? So [11:39] before this adjustment, so in your budget packet, um, that I ran just as of August [11:45] 31st, and I actually looked at it again, but in the, in the packet it was 2,015, [11:52] and so, um, it was a little bit more than that when I ran it today. OK, so, so we're [11:57] talking about moving a little less than half of our fund balance and as I understand [12:03] what you've told me previously. Um, uh, uh, a substantial part of this [12:10] shortage is expenses that we incurred in fiscal year 2526. But we will [12:18] get reimbursed, and those reimbursements have not yet. Right. Yes, I've signed, um, [12:25] I've signed several of them, and it just takes time for them to get that money back [12:29] to us, but we should be getting that in the next few years. So we are temporarily [12:32] drawing down our fund balance, but then when the reimbursements come back, the fund [12:38] balance will be restored. And the other portion of this has to do with the purchase [12:45] of the skid steer equipment. Could you explain again how that Uh, affected the year, [12:52] the yearly budget, so the, the, the loan, the loan took place and the money was actually [12:57] deposited in September of 2025. So I don't know how that process went. Um, but when [13:05] the budget was adopted, it wasn't in there for that expense to be incurred, so the [13:10] money went in FY 25 in September and then once the new budget started, the equipment [13:16] was purchased, so that money effectively is part of the $2 million. The dollar fund [13:22] balance that we have that just was deposited early and now we have the expenses in [13:29] this year. I just wanted to be clear that that that the water department is self-sufficient. [13:36] This is just a matter of Accounting for things within one calendar year when events [13:44] kind of overlap before and after that year, yeah, and grants are there you can handle [13:49] them several ways, and this is how the city of Chandler handles it. So, um, like [13:54] I said, you can try to budget the best of your ability, but with grants they pop [13:57] up and things like that happen, so you just have to be. You have to be glad you have [14:01] the fund balance to cover it since you get free money. So, and do we know approximately [14:06] how much reimbursement is outstanding for the, for the, uh, generator project? [14:14] I believe it's 900 and. Let me look. [14:27] 942,759 is what we're expecting next year. I mean for FY 27. So if we were to [14:34] look at this from the standpoint of a of a business operation. In accounting that [14:41] money might show up as accounts receivable. Yes, yes, it'll be, it'll go into the [14:46] revenue and I budgeted already for what needs, and you'll see the budget amounts [14:51] less because we're expecting money that we've already paid in the next year. So that's [14:56] how that'll show up. Thank you. [15:01] Any other questions about? [15:06] That [15:11] I move that we approve the fund balance transfer of 920,000 from the [15:19] water department reserves to cover these expenditures. Do I hear a 2nd? I [15:27] 2nd that. has been moved by Mr. Vallier and seconded by Mr. Hadnott, that we approve [15:35] the movement of $920,000 from fund balance into to [15:43] cover. Yeah, and I'll probably just put that into the grant expense line just to [15:47] keep it clean and it'll still be negative right there, but it'll still raise that, [15:51] the, the total overall for the rest of the budget. All right. All those in favor [15:57] say aye. Aye. Anyone opposed? Yeah, I've, I've, [16:05] Alright, 2. Consider and act on ordinance [16:10] 0-2026-0925. An ordinance of the city council of [16:18] the city of Chandler, Texas approving and adopting a budget for the city for fiscal [16:23] year October 1st, 2026 through September 30, 2027. And providing that expenditures [16:31] for said fiscal year shall be made in accordance with said budget, providing for [16:37] repeal of ordinance in in conflict wherewith providing saving a savings clause and [16:44] providing for effective date. [16:49] Any comments you all have? Is, is this when you want me to talk about the budget? [16:56] Is just kind of go over the highlights of it. Is this the appropriate time, or sure, [17:03] OK, so I just have some points to make. Basically it's the same budget from our, [17:09] from our meeting the last time. There were some changes that you all voted to make. [17:14] So I'm just thankful that we have a budget and we're about to, about to adopt it, [17:19] so. First, the, um, the trash, the revenue and expenditures removed from the utility [17:27] to the general fund. There is a contingency line added to the general fund and the [17:34] utility fund. The general fund's contingency is 24,500 and the utility funds has [17:40] a contingency of 84,75207. Um, grant revenue, uh, [17:48] was added in in expenditures so that we can maybe be on top of that this, this next [17:55] year as more come up, like I said, we'll recognize that revenue. We'll put it in [17:59] expenditures so that we can, can stay on top of that. The 5% cola is added. There [18:05] were 3 vacancies that you all discussed, utility clerk, technician, and court clerk. [18:10] Those were all kept at full time. And one, the utility clerk being frozen until further [18:17] notice, you all decided you wanted to discuss that before that position was actually [18:20] hired. The 2% above the cola was included for [18:28] Brent in the utility department. Uh, Justin talked about the, the license that he [18:33] has and so you all agreed on that. Um, there's a slight difference in the EDC, um, [18:41] the transfer out is slightly different than the transfer in. That's not a big deal. [18:46] It's like a $200 difference instead of changing all the numbers and contingency and [18:50] all that, and it's because it was like it was last time I left that alone. It's not [18:54] gonna, it's not gonna, it's not gonna be a big deal, but I did want to point it out [18:58] that I do know that those aren't exactly the same. So overall, Fontenna is roughly [19:06] 4.3 million. Fund 10 is 3,93,35902. [19:14] Where are you at, please? I'm just kind of recapping how much the budget is overall. [19:19] Um, overall we have about an $8.9 million dollar budget with all of the funds. There [19:27] is a 489,000 discrepancy, which is the deficit. 473,000 of that is [19:35] EDC. They, um, they budget using their fund balance so that if projects come up they [19:41] have that. Most of the time they they don't use all of that, but we budget it so [19:46] that they can have access to that if they need it. And then there we used. Fund balance [19:53] for fund 70 to bring in some court technology money so that we could, it was in there, [20:01] we just didn't budget for it until this year so we can do some upgrades to the courtroom [20:06] and if things come up throughout the year, we can replace mics or do what we need [20:11] to do there. And then the capital fund 50, we brought cash over so that the roof [20:18] at we were given the OK. Um, Joseph actually spoke with someone that said that yes, [20:24] those funds could be used. So we're gonna get the roof fixed at City Hall with the. [20:31] I think it was 111 or 10, I can't remember on that one. Brought some cash over so [20:36] that we can get the roof fixed so it will quit leaking, um. I think, I mean, [20:45] those were all discussed last time. Um, if you have any questions, I'll be glad to [20:50] answer it. As you know, the budget, um, is gonna raise less revenue from property [20:57] taxes this year of 29,721, which is a 0.36% decrease from last year's [21:04] budget. And the tax rate has gone from 0.488058 to [21:12] 0.486284. There's a taxpayer impact statement that has to be included [21:20] this year, so this isn't what's going to be put online and um. With with [21:27] Laurie once uh you all adopt it of course I'll run it through the financial system [21:33] print that out um and put the appropriate paperwork but the taxpayer impact impact [21:38] statement is actually something new this year so that's in there so you all can see [21:43] that um. So that the taxpayer can see what it does to uh a median homestead taxable [21:50] value, the increase decrease in taxes so they can actually see that. So I included [21:56] that. And That's a lot of information, but you all have looked at it several times, [22:03] so if you have any questions, I'll be glad to answer them. And thank you for all [22:08] your help and, and your work in it because you all have met with me and, and helped [22:14] me throughout the process. So I appreciate that. Thank you. I have a couple of questions [22:19] that um they're they're just sort of follow up items to what's here um. [22:27] We, we identified as part of the process of budgeting for this year that there are [22:34] several funds that have substantial amounts of money. That for whatever reason the [22:41] city has never spent Um, I, I think the core technology fund we, we addressed, [22:48] um, this year, um, but there's, um, I believe the number was $248,000 [22:57] in motel tax revenue that frankly we haven't figured out how to spend. Uh, there [23:04] are, um. Regulations on how that could be spent. I'd, I'd like to ask if there are [23:11] any specific plans underway to determine. How we could put that money to use for [23:18] our city. I know Joseph has been brainstorming that, so I'm going to let him talk. [23:26] There are some, uh, uh, programs that could be, uh, utilized for, for parks for that [23:31] specific fund. Uh, I spoke with, uh, Austin because he has had some involvement, [23:36] uh, with schools, uh, specifically the, the truancy fund, uh, has to be, uh, utilized [23:42] in a way, um, where. It it helps with the kids basically [23:50] and so maybe something in the parks where there's some kind of garden or some kind [23:53] of utilization of that fund, uh, something that we've already discussed. On the and [23:58] on the motel tax there's there's some gray areas and there's some loopholes I think [24:04] we just have to be innovative and we have to to come up with a plan. That everybody [24:08] can agree on that we can use that money for so um once the budget year starts we'll [24:14] have more time to start looking at that um I didn't budget all that cash in there [24:19] but it's definitely something that we can talk about and um and possibly bring in [24:26] throughout the year if we if we need to do that. [24:31] I'm sorry. Did you want to talk? [24:34] Um, so on that, yes, um, it's just, it's difficult to find the things that we can [24:40] spend that money on. It just, it just seems to me that Chandler is likely not the [24:46] only small city in Texas that has one motel. And not a lot of The typical [24:54] size kinds of projects that it has cities would use motel tax for, so there have [25:00] to be, I, I believe that there's somebody in this state that's been smart enough [25:04] to figure out how to use that money. Yeah, you have to, um, it has to benefit, it [25:10] has to, you have to prove that it brought in revenue of some sort, um, and you have [25:16] to tie that with, with the expenses. So we just, we just need to look at it, get [25:20] with maybe some cities that have. Figured out how to spend that and maybe that TML [25:26] meeting might be an opportunity to network with some other small cities. I, I just [25:31] hate to see a quarter of a million dollars sitting in the bank, not doing anything. [25:37] Yeah, and then we also want to make sure the way we spend it benefits the city as [25:41] much as possible, you know, there's some advertising opportunities that maybe could [25:45] be spent out of that fund, but that's a great point that, you know, we can network [25:48] at TML with some of these cities. Are any of these, uh, funds sitting in interest [25:54] bearing accounts? They all, yes, they all earn interest. Yes, the minimum. Yes, we [26:00] need to look into investing. We do, uh, currently we do not invest any funds at all, [26:06] um, so that's, that's a goal, um, to start looking into, well, that fund alone would [26:10] qualify for a money market account which would pay you just right under 4% rather [26:14] than the 0.78%. So all of these funds are in one account together with, uh, the exception [26:21] of the LEOSE account. It's by itself. [26:29] Any other questions? [26:33] I, I'd just like to make a comment that, um, I know that um y'all have worked long [26:39] and hard in this, in this product, and, uh, Um, starting with a blank slate, [26:46] um, and, and first learning where your chair is and, um, getting a computer, [26:54] um, um, just a tremendous task to undertake in just a couple of months after starting [27:00] and, um, I would just like to compliment you for your, for your efforts in this product [27:06] and, uh, the opportunity to have a balanced budget. Without a tax increase, without [27:12] a water rate increase, without a trash rate increase is a tremendous accomplishment [27:18] for the city, and you both deserve a lot of credit for that. Thank you. I think a [27:24] lot of people had a hand in it though. I think it's, it's more than just me. I mean, [27:28] the staff has been great. They had to do extra just so I could get this done and [27:33] so, uh, Laurie and Jamie have been amazing tools for me and so they're very much [27:40] appreciated as well. That's right. That's right. and, and Joseph, I, I know late [27:47] at night you guys are both working on these because I got emails from you guys asking [27:51] questions and back and forth 1011 sometimes and on weekends. You guys have put forth [27:58] a monumental effort and I really, really appreciate everything you've done as well. [28:03] I think, uh, I mirror everything that Mr. Valer says, absolutely. Thank you. All [28:10] right, thank you. OK, so with that being said, any other questions? Any other comments [28:16] at this point? Big breath. All right. So, um, Do I hear a motion [28:24] at this time? [28:27] I make a motion that we adopt the um Fiscal year 26-27 budget as presented. [28:36] And do I hear a second? [28:42] I have to read the ordinance. Yeah, where's this at? [28:49] Well, no wonder you didn't speak up. [28:53] Uh, I make a motion that we adopt the, uh, budget as presented fiscal year 26-27, [29:00] an ordinance of the, uh. You want me to just read the ordinance number? OK, ordinance [29:06] number. 0-2026-950925-A. [29:15] An ordinance of the city of. Ordinance of the City council of the city of Chandler, [29:20] Texas approving and adopting a budget for the city for fiscal year October 1, 2026 [29:26] through September 30th, 2027 and providing that expenditures for said fiscal year [29:33] be made in accordance with said budget, providing a repeal of ordinances and conflict [29:39] here with herewith providing a savings clause and providing for effective date. [29:48] Alright, do I hear a second? I'll second what he said. OK. OK, it has been moved [29:55] by Mr. Smith and secondly by Mr. Valera that we, uh, Accept the [30:03] ordinance 0-2026-0925. All those in [30:11] favor say aye, aye aye. You wanna post? Yeah ayes have it. [30:18] All right. Moving on to #3. Consider an act on ordinance [30:24] 0-2026-0925B, an ordinance leveling, uh, ad volum [30:32] taxes for the use and support of the municipal government of the city of Chandler, [30:37] Texas for the 26-27 fiscal year, providing when taxes shall become due and when [30:45] shall the same shall become delinquent if not paid, providing. For a severance, a [30:52] severability clause providing for a repeal clause and providing for an effective [30:59] date. OK. All right. All of that. Alright, so any questions or [31:07] comments about this? Staff, you all wanna Anything on that at this point? No. OK. [31:15] This is effectively the no new revenue tax rate. [31:24] Any comments?
