[0:03] Commissioner Billingsley [0:04] » Here. [0:05] » Commissioner Bone [0:06] » Here. [0:06] » Commissioner Childris [0:07] » Here. [0:08] » Commissioner Hall. [0:09] » Commissioner Hedley [0:10] » Here. [0:11] » Commissioner Perkins [0:12] » Here. [0:12] » Commissioner Williams [0:13] » Here. And six of our seven are here. So [0:16] we do have a quorum at this time. I'll [0:17] call on Commissioner Perkins. [0:19] » Commissioner Hall was trying to say [0:20] here. [0:21] » Commissioner Hall is now here. [0:23] » And we have a unanimous [0:26] commission. [0:37] All right, let us pray. Heavenly Father, [0:39] thank you for this day and all the [0:40] blessings that you have given us. We [0:42] just come to you tonight and just ask [0:44] that your uh wisdom be placed upon us as [0:46] we do the business of the county. We ask [0:48] for your blessings upon all the citizens [0:50] and everybody that is related to them. [0:53] Heavenly Father, just watch over us, [0:55] guide us, lead us, and protect us in [0:57] Jesus name. Amen. [1:01] » Attention. Salute. [1:04] I pledge algiance to the flag of the [1:07] United States of America and to the [1:10] republic for which it stands. One nation [1:13] under God, indivisible, with liberty and [1:16] justice for all. [1:29] Okay, we have all members are present [1:32] now. If I can have a motion to approve [1:36] the agenda. [1:37] » Make a motion we approve the agenda. [1:39] » Second. [1:40] » Commissioner Bone. Second. Commissioner [1:42] Perkins. Are there any additions or [1:44] deletions? [1:47] Okay. under me, please take off bullet [1:49] point number one as we've already [1:52] basically resolved that. [1:55] Uh, and also under me, uh, please put [1:59] 911. [2:02] I mean 911, not 911, that's 911. [2:07] And also at the end I'll be asking for [2:10] an executive session and there will be [2:13] no business to be taken after that. So [2:18] all in favor of approving the agenda as [2:21] amended raise your hand. [2:24] Any opposed? And it passed unanimously. [2:28] We come now to public comments. [2:32] First we have Mr. [2:35] Scott Roberts, [2:38] Canyon Road 43. [2:42] If you'll come to the podium, Mr. [2:44] Roberts. [2:55] First off, I appreciate you all. Let me [2:57] address the commission this evening. [3:00] Uh, County Road 43. We've been dealing [3:02] with this for since October of last [3:05] year. [3:07] It doesn't seem to get any better. [3:10] I was hoping our engineer would be here [3:12] this evening to tell us what the plan [3:14] is. [3:17] The uh ditches are horrible. I saw you [3:20] all pictures for the weekend. [3:22] And that's not just my property. That's [3:24] my neighbor's property on both sides of [3:27] the road. [3:29] They were doing really good. They came [3:31] in, they dressed the sides, [3:33] and I was ready for them to put uh seed [3:36] and straw down or I was going to do it [3:38] myself and then they come and put [3:41] another base coat of gravel down and [3:44] then just broomed it into our yards. [3:48] Now, today when I was coming home, we [3:51] had a little rain shower. I notic we've [3:54] already got ruts [3:56] and it's holding water. The road's not [3:59] crowned. I got to look at that pretty [4:01] good. [4:03] And that's going to be a that's going to [4:04] be a safety issue for us all because now [4:08] that the road is somewhat smooth, people [4:11] are driving [4:14] fast. [4:17] So, you know, I'm afraid of somebody [4:19] piran [4:22] and [4:24] I don't know. I just I just think as a [4:26] county we need to do better. [4:28] This is the first time in my adult life [4:30] that I've been embarrassed about my [4:32] yard. [4:35] And again, I appreciate you guys all for [4:38] listening to me. [4:40] I'd love to have some resolution. I [4:42] don't expect anything tonight, [4:45] but I would appreciate some followup if [4:47] possible. [4:48] » Well, I appreciate you coming and [4:50] bringing it to us. I did not know the [4:51] engineer wasn't going to be here [4:53] tonight, but we ask him. [4:54] » He's just going to be a little late. He [4:55] sent me a message, said he'd be a few [4:57] minutes late. He'll be here. [4:59] » Okay. All right. We can ask him. We can [5:01] ask him when he gets there. Anybody? [5:03] » I got a question. [5:05] » When you say holding water, the road [5:06] itself is holding water or the bar [5:08] ditch? [5:10] » The ditch. Road or the ditch? [5:12] » The road. [5:13] » Okay. [5:14] » The road is already starting to show [5:16] signs of wear. Uh grooves in the road. [5:20] And there's there there is water [5:23] standing in the road. There's no crown [5:26] at all. [5:29] » Mr. Scott, is that right? [5:31] » Yes, sir. [5:31] » Uh what portion of the road are you [5:34] talking about? [5:35] » Between 29 and 50. [5:38] » Okay. [5:40] And and what portion of that section are [5:42] you talking about? All of it. between 29 [5:45] and my home, [5:47] » Which I'm I'm If you're familiar with [5:48] that road, [5:50] » I'm the third house on the left. [5:52] » Okay. [5:52] » Back up off the hill. [5:54] » So, the the close to next to the [5:58] Littleton place. [6:04] » I'm not [6:06] » I know where the Robert's place is. I [6:08] don't know where it [6:10] » Yeah, never mind. [6:12] » But, [6:12] » Okay. Thank you. that that those are my [6:14] travels to and from work and that's what [6:17] I notice. I very rarely go the other [6:20] way. [6:21] » Okay. Thank you. [6:22] » All right. Thank you, sir. [6:23] » Any other questions for me, sir? Guys, [6:25] » No thank him to give us an update when [6:27] he gets here. [6:28] » Thank you all for your time. [6:29] » Thank you. [6:32] All right. [6:33] Next, we have Bud Enzer, County Road [6:41] » 30. [6:47] I don't know if y'all want. [6:51] » Sure. [6:56] » Just hand them all to me. I'll throw [6:57] them down here. [7:01] » Thank you. [7:16] Thank you. [7:31] All right. I am Malcolm Enzer. Everybody [7:35] knows me in around here by Bud. [7:39] Uh lived here for 31 plus years now. [7:44] Been hoping to get a road repaired all [7:48] these years. And now if you'll read, you [7:50] can read for yourself most of it. But [7:52] the biggest issue I have is [7:56] the uh scrub board or whatever you want [7:59] to call it. County Road 30 from 37 to [8:03] 16. It's not all of it, but it's at [8:07] least probably the first half a mile [8:12] is that way. [8:14] Now, we've been I didn't figure we'd [8:15] ever gentlemen speaking of the way the [8:18] edge of the roads. Well, there's [8:21] already washes all up and down 30 on our [8:24] section [8:26] and I've addressed that with Heath one [8:29] time and it's, [8:32] you know, as far as getting something to [8:33] grow there. It'll just God will have to [8:35] take care of it, I guess, [8:38] because I I don't look forward. [8:41] I kind of looked there wouldn't be any [8:43] kind of because I'd rode 43 up here from [8:46] one end to the other and the only place [8:49] been fixed is where Alan Payton went up [8:51] there and decided he'd fix around his [8:53] stuff with his people and his equipment. [8:57] But that's and we was talking about [9:00] water standing. [9:02] Like I come in today, it rained down [9:04] there and there's water puddles all up [9:06] and down 30 from 37 to to my driveway [9:11] which is County Road 884. [9:15] And I asked Heath, I said, "How's how [9:18] does potholes [9:20] how are they created?" [9:22] I said, "Is it cause of standing water [9:24] in a road?" and he pretty much told me [9:27] that's how that end up happening. [9:31] So [9:33] my my question is [9:36] why can we not have an asphalt put on [9:40] top of what's there to straighten it up? [9:44] I mean it seems it's got a pretty decent [9:47] it's got plenty of base now I think. [9:51] So, all I'm asking is consideration to [9:55] fix the road so that us that drives [9:58] vehicles that we [10:00] pay good money for [10:03] and buy them because we want them to [10:05] last. I usually drive mine till the [10:08] wheels fall off of them. But the ones I [10:10] got now are pretty new vehicles. [10:13] And since I've been having the bottom [10:14] sides of my cars really need to be [10:16] turned up, they need cars need to be [10:18] turned up down and pressure washed or [10:20] steam cleaned because all the mud is [10:22] still up under them. Cuz we had to live [10:24] with what I look like a logging road for [10:27] several months down there. [10:31] My neighbor next door to me on County [10:34] Road 30 got stuck within probably 50 to [10:36] 100 foot from her her own driveway. [10:42] uh [10:44] in the road was part of the stuff that [10:46] we put up with just like I approached [10:49] Keith about this culbert that needed to [10:51] be replaced [10:53] and they [10:55] built the road and then come back and [10:58] dug the culbert out [11:01] and I addressed that culbert didn't even [11:03] have a roof in it no longer cuz it that [11:05] old galvanized cut it done rotted out. [11:07] had been there as long as I've been [11:09] there. And that's 31 30 30 plus years at [11:12] the time they started going on. I mean, [11:15] it was just about a foot and a half of [11:17] dirt on top of it. How in the world it [11:19] ain't fell in? I don't know. It's about [11:21] a sixoot culbert that was put in [11:24] when that county road was straightened [11:26] out some. [11:29] And uh Osc my understanding Oscar Mims [11:32] owned that place and he had running [11:34] cattle on piece both pieces of property [11:36] on both sides of 30 our 80 acres that we [11:39] bought on that side on [11:43] which would be the west side of 30. [11:46] He had to allow them to straighten the [11:48] road out. They put him a cattle crossing [11:51] so he he did his cows could come from [11:53] one side of the the highway to the [11:55] other. [11:58] But there's nobody doing that anymore. [12:00] So, they really want no reason to have a [12:02] 6- foot tall cupboard in there anymore. [12:07] But this pretty self-explanatory what I [12:09] my feelings are about what's going on [12:11] out there. And all I'm asking for is to [12:15] at least give us the opportunity to have [12:17] a road just like 43, like to have a [12:19] decent riding road that you're not [12:22] embarrassed for people to come see. I [12:24] was embarrassed for people to come see [12:26] me before. Now I'm embarrassed that [12:28] people [12:30] don't want to come back if they come see [12:31] me again because they ain't gonna like [12:33] how the ride is to get to where I live. [12:38] My driveway smoother than this county [12:40] road and I maintain it with a tractor [12:42] and a blade and it ain't nothing but [12:45] gravel. [12:46] I honestly have even told Heath [12:48] personally when we were talking that I [12:51] almost felt like I wished he had left [12:52] the road alone. At least I knew how to [12:54] ride on it because I'd done patterned [12:56] how to drive on it where I wouldn't be [12:58] driving in potholes. [13:01] So now I it's just a scrub board for the [13:05] probably at least [13:07] a good full quarter mile and up to a [13:11] half a mile. [13:13] And why I'm saying this because I I know [13:17] County Road 633 up here I he had a [13:22] little discussion about this when I [13:24] called him out about that road. It's [13:26] been asphalted [13:29] from city li at the time city limits [13:32] over to [13:34] whatever the I don't even know what that [13:36] other road is that it dead ends on the [13:39] east side towards 65 six [13:44] 633. [13:46] There's three subdivision up there. [13:48] One's in the city limits. I think it's [13:50] called a crest. [13:52] And then there's one that's [13:56] Ballon. Oh, the other one's [13:59] » Low max. [14:01] » 13. [14:01] » Yeah, low max. [14:03] » I wrote it today and measured it. The [14:06] first 4/10en of a mile is in this county [14:09] and the county has now moved their city [14:11] limits out to take in this balantry [14:15] balon [14:15] » Balon way. [14:17] » They've take they've moved their they've [14:19] annexed [14:21] they've moved their sign. So now it's [14:23] only five 510 of the mile [14:27] is city now [14:29] and 410 is county. So, you're asking us [14:34] for update on 30 and why it can't be [14:38] asphalted. [14:39] » That's if you can asphalt one, why can't [14:42] you asphalt another? You did County Road [14:44] 16 down there. I know y'all had y'all [14:46] went in there and chip sealed it and [14:49] y'all done 16's been done three times [14:52] since I've lived in Chilton County and [14:54] just recently been done again and it's [14:57] chip sealed and then turn right around [14:59] put asphalt on top of it. [15:03] » All right. All right, Heath, you want to [15:06] give us the update on 30 where we are [15:08] with 30? [15:12] primarily the section between 37 and 16. [15:15] That's what he's been asking about. [15:17] » Indeed. [15:20] » All right. Thank you, commission. Um the [15:21] section between 37 and 16 is the first [15:24] section of 30 that we started last fall [15:28] uh October and I think it ran went to [15:30] November. Um it was the last road that [15:33] we did last year. Um and uh we knew [15:36] we're getting up close to cold and rainy [15:39] weather so we tried to fit it in. I [15:41] think it's um 1.8 miles or something [15:44] like that, this section. And we got it [15:47] good and based and uh as we were getting [15:50] ready to chip seal it, we did put down [15:51] the first layer and the the temperature [15:54] got cool on us. Um [15:56] um [15:59] had a little bit of uh peeling, a little [16:01] bit of peeling. Um [16:05] which is what happens when it gets too [16:07] cold um or too cool. ideally not in the [16:10] ideal temperature. And uh so with the [16:13] one layer on with some peeling, we went [16:15] ahead and uh obviously it was going to [16:16] continue to get worse and worse with the [16:18] winter. So we put the second layer on [16:20] and the second layer was solid. Um [16:22] however, you could feel some of the [16:24] ripples from the peeling. [16:27] And u um [16:30] we u we added a third layer this summer. [16:35] And uh with chip seals, the uh layers [16:38] really don't do a good job, but they [16:40] don't really level. The road is is in [16:42] good what we consider good solid [16:44] condition. It has good liquid asphalt to [16:46] it. It's got good rock. It's solid, not [16:48] potholes, but there are some small some [16:52] indentions um [16:56] » From the from the peeling. And um so uh [17:01] uh I think Commissioner Billings Lee [17:03] mentioned this at the last commission [17:04] meeting. Um some people say you can [17:06] drive 75 miles an hour over it. Some [17:09] people say you can't drive 25. It's all [17:11] really what you can accommodate. The [17:13] road is solid. We uh we hate that the [17:16] again we tried to fit as many roads as [17:18] we could last year and uh the weather [17:21] just turned cold and wet on us uh a [17:23] little bit earlier than we expected. And [17:26] so, um, uh, we think that the road will [17:28] last 20 plus years or longer [17:32] as is. Um, but it doesn't, it's not [17:34] quite as smooth as the roads that we did [17:36] this summer. Um, [17:39] um, [17:42] and so, uh, I've talked to several [17:45] commissioners and and, you know, I'm [17:47] open to the guidance. The, uh, the road [17:51] solid would be good. Um, Mr. Enzer is [17:54] correct. Um, obviously coming over it [17:56] with some plant mix, inch and a half. [17:58] We'll level it up, smooth it up, but [18:00] that's very expensive. That's usually [18:01] something we try to avoid on these low [18:03] volume roads. Um, [18:06] um, and uh, we could leave it alone. [18:09] It'll last 20 plus years, no problem. Or [18:11] we could even mill up the the worst [18:13] section he talked about, the quarter [18:14] mile nearest um, county road [18:19] uh, 16. [18:21] Um, [18:23] » I'm sorry, 37. Yeah, 37. And we could uh [18:26] redo that quarter mile. Um, [18:29] and we would probably need to, if we did [18:31] that, we would, whatever we do, if we do [18:33] something, we would need to do it next [18:34] summer. We we we are uh kind of booked [18:37] up for this this summer. Uh, of course, [18:40] November is not too far away. And, uh, [18:43] so that's kind of where we're at. [18:46] You got the place I found the rub board, [18:50] washboard area was closer to his [18:54] driveway near that cattle cover. [18:59] Did And that was after the second coat. [19:01] I had been back over since y'all put the [19:03] third. Did it get the wash board out? [19:06] » That is out. It's good right there. [19:09] » Okay. [19:10] » Back up towards 37. has got an issue [19:14] and it's but there's water standing now [19:17] y'all are really I'm going to give you [19:19] commend you people out there on the [19:21] county boy they put finally put [19:24] something down on it but we deal with [19:26] mud from that cover where they pack [19:29] nothing but clay look like in there to [19:32] change the cover out after they done [19:35] built the road they come in there and to [19:36] that road back out which I spelled it [19:38] out in that wrote [19:42] But the but the [19:45] people running that truck goes out and [19:47] fixes the pothole fix [19:53] » What y'all call overachiever. I didn't [19:55] think you fix the pothole [19:58] gravel. [20:00] » So just just to explain what what Mr. [20:02] Enzer is talking about. Um there was a [20:05] large 6ft diameter metal corrugated pipe [20:08] cover that was probably being used as a [20:10] uh cattle gap or cattle crossing [20:12] underneath the road and uh uh the bottom [20:16] had deteriorated. It needed replacing. [20:18] We ordered the pipe. The pipe didn't [20:19] come in very quickly. And by the time it [20:22] did come in, we we put it in. [20:25] Um [20:27] it was about just a a short time before [20:30] we were going to pave it. And we didn't [20:32] feel comfortable paving over that [20:33] section because we know that anytime we [20:35] put in a covert, a new covert, we [20:37] disturb the ground and we we don't get [20:39] 100% compassion. Usually it takes a [20:40] little bit of time for traffic to go [20:42] over it. Maybe a good three months is [20:43] what we like to have for the the ground [20:45] to settle. So, uh, our superintendent [20:48] made a decision not to not to chip seal [20:52] over that, I would say three to 400 foot [20:54] area. Uh, and when he and when we came [20:57] back this summer, this spring, and chip [21:00] sealed over it, um, there was a um at [21:03] the uh the the joints there. You could [21:07] feel it at the joints. I feel a little [21:09] noticeable drop or a little little bump. [21:11] Um, since then we've tried to use the [21:13] the uh uh to try to transition it with [21:16] some some liquid and rock and and made [21:19] it better, but um ideally we would have [21:22] put the cover in and gave it three [21:24] months to settle and then come over with [21:26] the chip seal and chip seal the whole [21:27] road at one time. So unfortunately we [21:29] did have those joints. [21:30] » But I brought that to your attention [21:33] before y'all started. [21:37] » Okay. That's what didn't make sense. [21:40] » All right. Anybody got any [21:43] » Hold on. Hold on. [21:45] » Anybody got any questions for Heath [21:47] about 30? [21:49] All right. You had a Mr. Scott Roberts [21:52] had a question about uh [21:56] 43 and the shoulder work [22:00] and the water standing in the road [22:05] rudded areas in the in the road. He says [22:08] » Okay. Um [22:11] so uh [22:13] uh Mr. Jim Long came to us a couple [22:15] months ago about the shoulders. Um the [22:17] county wasn't accustomed to doing a lot [22:19] of shoulder work. We're mainly taking [22:21] these narrow roads, widening them out [22:23] and trying to put down a good chip seal [22:25] and um Can Road 43 has more residential [22:29] um u a lot more houses on it than than [22:32] we normally deal with and people keep up [22:34] with their grass a little bit better [22:35] than we're accustomed to in the rural [22:36] county area. So, uh uh we talked with [22:39] the commission and we wanted to have a [22:41] focus more on uh doing a little more [22:43] prep on our on our shoulders. So, we did [22:45] add uh top soil and we also purchased a [22:50] uh a skid steer attachment called I [22:51] believe it's a Harley rake to try to [22:53] scrape out the rocks. So, that should [22:56] improve our shoulders. And um [22:59] um as far as the the uh if there is a if [23:03] there is a uh some settlement, we hope [23:05] not. Maybe it's one spot, but I I'm not [23:07] aware of any um what you call it [23:09] depressions or any what you what was the [23:11] word? [23:12] » Ruting. [23:12] » Rudding. I'm not aware of any rudding. [23:14] The base should be very solid on 43. We [23:16] we've driven 43. 43 is a good road. Um [23:21] we we feel like 43 is in in great [23:24] condition. Um [23:28] but but we would be willing obviously if [23:31] there's something out there, we would be [23:32] willing to take a look at it and see if [23:34] there's any repairs needed. So we would [23:35] be we would be more than happy to do a [23:37] site investigation and meet with the [23:40] gentleman. And if there is an an issue [23:42] and I would suppose it be isolated, [23:44] correct? [23:46] Is it a one spot or is the entire road? [23:50] » Yes, sir. Go ahead. The road [23:54] to [23:56] this afternoon [24:00] there is water standing [24:03] in the [24:06] tire tracks. [24:15] You guys did come in and you missed my [24:19] my [24:23] from the top grade of the pavement for [24:27] chicken. [24:30] Everything was looking good. But here [24:33] like three or four weeks ago, [24:35] you guys had a brush come in and you [24:37] brushed all the extra chip seal off into [24:40] our lawns. [24:43] And I shared I shared pictures with the [24:45] commissioners. [24:51] neighbors, [24:54] you know, I don't think you guys know [24:57] the other thing that that does it makes [24:58] people that travel our roads think we [25:00] don't care and so lingering is 10 times [25:04] worse, [25:12] soda water [25:16] because people think we don't care [25:19] the Could [25:20] you send those pictures to E so he'll [25:23] have them too? [25:26] » Will. [25:27] » Yeah, he can do that. [25:28] » Well, hopefully, [25:29] » Mr. Scott, as with all our concerns and [25:32] we do um ask that the public do put [25:36] their requests in to the road department [25:38] because I'm ask Mrs. Ston, are you aware [25:41] and are you aware of what he's speaking [25:44] of? [25:46] Well, we talked about um we were want to [25:49] stripe 43 and so we recently I believe [25:52] it was um [25:55] was it last week or week before that we [25:57] broomed it off and so I wasn't aware [26:00] that there was a whole lot of rocks that [26:01] came off into the yard. And as far as [26:03] rutting I'm not aware of the we have not [26:05] heard of any the ring and I haven't [26:06] heard of any complaints about the rocks [26:08] in the yard ever since we used the [26:09] Harley rake in the top soil. But I would [26:12] again [26:13] » It's been very dry lately so it [26:21] » And and Mr. Son normally you just don't [26:24] drive on all the roads that you doing [26:27] anything to. So I I would suggest next [26:29] time and he would have given you a [26:31] better answer tonight or if he didn't I [26:34] I'm going to say in his defense he was [26:36] not aware what you have brought in and [26:39] would you give them be willing to give [26:40] them the chance and then the commission [26:44] you can come back and say hey we tried [26:47] xyz because if you don't what you don't [26:49] know you know in in all fairness because [26:53] look look like it's a work in progress [26:54] to make it even better with stripes on [26:56] it. So, so I thank I appreciate you. [27:04] » He he is on the road department. The [27:06] road department is on there and you [27:08] could upload those pictures and you may [27:11] not been aware. It's kind of a little [27:13] hard to navigate it. [27:18] » Yes. And and to call the road [27:20] department. There is a number that you [27:22] can call it in as well. So, you know, [27:24] going forward, that would be a good [27:26] suggestion. Then you would have your uh [27:28] rights to say, you know, he was not [27:29] aware and certainly they'll go out there [27:33] and look at it. [27:35] » Please understand. [27:36] » Yeah. I I Yeah, I appreciate the way you [27:39] your willingness too. Thank you, Miss [27:41] Scott. [27:43] » All right. Thank you, sir. Thanks, Eve. [27:45] » Okay, we have no more public comments, [27:48] no organizational reports. [27:50] I mean, [27:51] » Can I do a comment on the road stuff [27:54] being it? [27:55] » Yeah. [27:57] » I I personally think what's happened um [28:01] is u maybe the [28:04] the [28:06] community and the commission probably [28:10] got in a little too big of a hurry [28:13] on doing some of this stuff. [28:15] And I don't think that rock should have [28:18] been swept off. It should have stayed [28:20] there for another [28:22] 3 or 4 months. [28:25] I think we got in too big a hurry to try [28:27] to put stripes on it and push that rock [28:29] off. And you know when you put tar and [28:31] gravel on the road, it's it's supposed [28:33] to keep working and working itself in. [28:36] And I I I think we all just got in a [28:38] little too big of a hurry really. [28:41] Uh, [28:43] » To the best of my knowledge, [28:45] » Do what now? [28:46] » We didn't ask for that to be done. [28:48] » Why would he listen to me about that [28:50] anyway? [28:52] » Okay. We're not We're not going to go [28:54] down this road here tonight. Okay. [28:57] » But that's just my opinion. Uh, I I I [29:01] don't think it's anybody's fault other [29:03] than everybody just gets in too big of a [29:06] hurry. [29:08] That's my opinion. [29:13] We'll get back with you, B. Promise. [29:16] » I got I mean, I had some other [29:19] pretty much got a lot [29:23] » Now. Your your five minutes is up. I'll [29:25] let you show us after meeting. Okay. Uh, [29:29] no or no organizational reports. Can I [29:32] have a motion to approve the consent [29:34] agenda? [29:34] » Make a motion we approve the consent [29:36] agenda. [29:37] » Motion, Commissioner Bone, do I have a [29:39] second? Second. [29:40] » Second. Commissioner Childris. I need to [32:43] switch those and put Brent Conway for [32:47] number one and Joe Cole for number [32:49] position five. [38:12] » All right. Commissioner Bone, [38:14] » I I have nothing. [38:17] » No question. [38:19] » Commissioner Hall. [38:21] » Yes. [38:38] » Motion Commissioner Hall, do I have a [38:40] second? [38:40] » Second. [38:41] » Second, Commissioner Bill. Any [38:43] discussion? [38:44] All in favor, raise your hand. [38:47] Any opposed? [38:49] Pass unanimously. [38:51] Anything else? Commissioner Hall. That's [38:52] » All. Thank you. [38:53] » Commissioner He [38:55] » I don't have anything. [38:56] » Commissioner Per, [38:57] » Not at this time. [38:58] » All right. Comes down to me [39:02] asking for a resolution to resend the [39:05] resolution from June 9th, 2026 to [39:07] contract with Pierce Auction to sell the [39:09] surplus items in the old courthouse. [39:12] » So move. [39:13] » Second. [39:13] » Second. [39:14] » Motion Commissioner Bones. Second, [39:16] Commissioner Perkins. Any discussion? Uh [39:19] what I will say is a change their [39:21] policies and procedures and we had to go [39:23] a different route. [39:26] All in favor raise your hand. Any [39:28] opposed and passed unanimously [39:32] and ask resolution to contract with [39:35] Cameron Ellison as auctioneer to auction [39:37] off all the surplus items in the old [39:40] courthouse and funds deposited into the [39:42] courthouse fund. [39:44] » Move [39:46] motion commissioner Billy second [39:48] commissioner bone. Any discussion? [39:51] All in favor, raise your hand. Any [39:54] opposed? And while we're on that [39:56] subject, I met with the mayor today. We [39:59] can go ahead and close and we'll have [40:02] what time necessary, whatever we need to [40:05] get everything out of the courthouse, [40:06] auction it off. [40:07] » Turn your mic on. [40:13] » Sorry about that. Thank you. Uh the [40:15] mayor said we could go ahead and close [40:17] and he would allow us to do whatever's [40:19] necessary in the courthouse because [40:21] they're not going to start anything [40:22] probably until January. This allows them [40:25] to get their process started. So I [40:28] didn't think there would be any argument [40:29] from anybody. So I said, "Okay, so you [40:32] can go ahead and prepare the paperwork, [40:34] man." [40:36] Okay. Uh need a m motion to approve [40:39] Thompson tractor invoices. [40:42] » So move. [40:42] » Motion Commissioner Bone. Second. [40:45] » Second. Commissioner Billingsley. [40:48] All in favor, raise your hand. Any [40:50] opposed? Any abstensions? [40:54] » I have family work for Thompson. [40:56] » Okay, that will be six in favor and one [40:59] abstension. U need a resolution to [41:02] combine the parks under one fund. [41:05] » I'll make that motion. [41:06] » Motion, Commissioner Perkins. Second, [41:08] Commissioner Bone. Any discussion? [41:11] All in favor, raise your hand. Any [41:14] opposed? And passed unanimously. [41:19] Okay. Uh [41:23] I I've had a lot of thoughts about data [41:25] centers and it seems to be that that is [41:29] one of the main things I get asked [41:32] anywhere anytime is about data centers [41:36] and we we passed a moratorum on data [41:40] centers. [41:41] I think I need to just do a little have [41:44] a little discussion about data centers. [41:48] Uh data centers are basically the [41:52] unknown. And the unknown is what scares [41:55] pretty much everybody. [41:58] That's generally because there are [41:59] things about them we don't know anything [42:01] about and it raises concerns and [42:04] convincing answers are hard to come by. [42:07] If those answers exist at all, data [42:10] centers operation is one of those [42:14] unknowns. In most communities where data [42:17] centers are being constructed, [42:18] controversies seem to have no end. [42:22] Whether it is backroom deals or [42:24] questions about power and water usage, [42:27] the public does not believe that their [42:29] elected officials are giving them honest [42:31] answers. [42:33] One truth is that most counties have no [42:36] power to prevent a data center or any [42:39] other industry from locating within its [42:42] borders. We passed a one-year moratorum, [42:47] but it is not enforcable. [42:49] It was fast so that any company looking [42:52] to build one here would contact the [42:55] commission office thereby giving us a [42:58] heads up because the last thing they [43:00] want now is bad publicity. As bad as [43:03] public they've had everywhere in this [43:05] state and around the country they don't [43:06] want anymore. [43:09] Now the one thing about data centers and [43:11] I didn't know didn't realize this until [43:13] I got to diving into them. [43:17] Data centers process virtually every [43:20] action done on the internet. Everything [43:23] from internet sales to remote surgery [43:26] from hundreds of miles away. If you surf [43:30] the internet or you pay your bills [43:32] online, you depend on a data center [43:35] somewhere to process that request. [43:39] The need for more data centers [43:42] multiplies with each passing year. [43:46] They're now a fact of life. The best [43:48] thing that we can hope for is to be [43:51] prepared for the one that is more likely [43:54] than not to come to Chilton County. [43:57] I ask everybody, research, AI, and data [44:00] centers. Arm yourself with knowledge. [44:04] Knowledge is understanding and [44:05] understanding helps to helps you to [44:07] debate the pros and the cons. [44:11] 20 years ago, we thought that the [44:14] suggestion of walking around with a [44:16] computer device in your hand was [44:18] ridiculous. [44:20] Where are we now? [44:22] We have a computer in our hand every [44:24] day. Data centers are coming. [44:28] We're educating ourselves about the [44:30] various types. And when I say we, I mean [44:32] us, your commission. We're trying to get [44:35] on top of this any way we can about the [44:39] various types in hopes to be able to [44:41] guide them where they can build in order [44:43] to be a good neighbor to our people. So, [44:47] arm yourself with knowledge about data [44:49] centers. There are some good ones, [44:53] one in particular in Iowa. I hope to [44:55] make a visit there sometime in the near [44:57] future. Uh [45:00] maybe get some good news. All right, the [45:03] next thing is [45:07] event center. After considering this [45:11] for a few days, of course, you know, [45:14] we've been discussing event center. [45:15] Commissioner Billingsley started the [45:17] ball rolling with the property to 212. [45:20] Commissioners Childerson Perkins have [45:21] talked to the mayor and the school board [45:24] and I think a concerted effort is better [45:27] than shotgun shooting a dozen different [45:31] ways. So after I asked McKesha and [45:36] Tiffany if they would be willing to [45:38] serve and they said yes, I have asked [45:40] Commissioner Billingsley, Commissioner [45:42] Childris and Commissioner Perkins to [45:45] serve on this committee with [45:46] Commissioner Billingsley who the one who [45:49] got all this started to serve as chair [45:51] if he's willing to be chair. [45:54] » Yes. [45:55] » Okay. So now y'all can put your heads [45:58] together. We have the money lady. We [46:02] have the uh promotional guru in Tiffany. [46:07] So, let's see if we can get a direction [46:08] on this thing. And if it's worth [46:10] pursuing, bring us something to do. [46:14] » Um, thank you for this opportunity, but [46:16] I've got to make a confession. Um, you [46:19] say is my idea. My idea came from that [46:23] lady right there, Miss Sylvia. [46:26] She's the one that planted it on me. [46:29] Do you remember that? [46:31] » Well, yes, I remember. [46:33] » Okay. So, where it came from, [46:36] » I wasn't sure where you were going with [46:38] this book [46:40] » About planning. Yeah. [46:41] » She and I I thought had about a a heart [46:44] to heart, I guess I could say. But give [46:47] her the credit for the idea. Thank you. [46:49] » All right. I'll give Miss Sylvia the [46:50] credit. Thank you. [46:56] And at this time [46:58] we have a presentation. [47:02] We have one of our own who has joined [47:05] the ranks of all the others in the [47:08] commission office. She has now obtained [47:11] a certificate [47:14] of county administration. [47:18] And so every one in our [47:24] » And her name is [47:25] » Britney Dearette and her husband happens [47:28] to be our transportation director. [47:33] » Walk around and bring this to you. I'm [47:34] not going to make you come here. [47:41] » Congratulations. [47:42] » Yeah. Congratulations. Hard work. [47:51] I think you failed. [47:58] » We need to interview music. [48:00] » I got back up. This bones down here [48:08] education institute administered by [48:10] buddy sharpness education institute [48:13] association of county commissions of [48:15] Alabama hereby certify that Britney [48:19] Djarnette has completed the mandated [48:22] education requirement for a certificate [48:25] in county administration [48:27] witness thereof [48:29] made on this 20th day of August 2026. [48:34] » Congratulations. [48:48] » You going to make it back? [48:51] » You need Children's to take over [48:56] kind of shape he's in when he gets back. [48:57] out of breath when he gets back up. [49:03] » He is the oldest stuff up here. [49:06] » You remind him of that often. [49:12] » I heard what you said. You are correct. [49:14] I left the chambers. [49:22] Uh, I'm going to answer an executive [49:24] session, but I got something that I [49:26] think needs saying tonight. Uh, [49:32] Friday is our is the 25th anniversary [49:36] of the worst attack [49:38] on United States soil. [49:41] 25 years ago, cowards came in and [49:43] attacked our country. We don't need to [49:46] forget. We need to make sure our [49:48] children understand [49:50] what was taken from America that day. [49:52] Our innocence was lost. [49:55] Our trust of people coming to our shores [49:59] was lost. [50:01] We don't ever need to forget it. So [50:04] Friday, say a little prayer for those [50:06] families who lost family, who have lost [50:11] family since then due to the illnesses [50:14] because of the dust and things from [50:17] those towers that day. So I just wanted [50:19] to make everybody aware in case you had [50:22] forgotten. [50:23] We don't need to forget. [50:26] All right. At this time, I'm going to [50:31] ask for an executive session, which [50:35] there'll be no business taken [50:36] afterwards. It will only be for a few [50:38] minutes. [50:40] And [50:41] » Mr. Chair, I can. [50:43] » Yes. Uh this I believe that the motion [50:46] that you're seeking is to enter into an [50:48] executive session to discuss preliminary [50:51] negotiations involving matters of trade [50:53] or commerce in which the governmental [50:55] body is in competition with private [50:57] individuals or entities for other [50:59] governmental bodies in Alabama or in [51:01] other states or foreign nations. Um as [51:04] you said uh you'll come you you'll [51:07] adjourn out of executive session. How [51:09] long would you estimate? [51:11] » 10 minutes. [51:11] » 10 minutes for the session. This [51:13] particular type of executive session [51:16] requires a um written or oral [51:20] declaration entered into the minutes [51:22] that the discussions would have a [51:24] detrimental effect upon the compet [51:26] competitive position of a party to the [51:28] negotiations or upon the location [51:30] retention expansion or upgrading of a [51:33] public employee or business entity in [51:35] the area served by the governmental body [51:37] if disclosed outside an executive [51:38] session. and the chairman has uh signed [51:42] such a declaration as the person with [51:44] that knowledge and I would ask that it [51:46] be made a part of the minutes. [51:49] » Okay. Can I have a motion to go into [51:50] executive session? [51:51] » I move that we go into executive session [51:54] for the affformentioned reason. [51:56] » Motion Commissioner Childers second. [51:59] Commissioner Bone, could I have a roll [52:00] call vote, please, Miss Sylvia? [52:05] » Commissioner Bill Lingsley. [52:07] » Yes. [52:07] » Commissioner Bone. [52:08] » Yes. Commissioner Childris, [52:10] » Yes. [52:10] » Commissioner Hall, [52:11] » Yes. [52:11] » Commissioner Hedley, [52:12] » Yes. [52:13] » Commissioner Perkins, [52:14] » Yes. [52:14] » Commissioner Williams, [52:15] » Yes. And it is unanimous. We are entered [52:18] into executive session. I thank
