I would [12:54] invite you all to attend. We [12:58] will be having food as well [12:58] and then bowling in between [13:00] those conversations that are [13:01] it's not a townhome, but it is [13:04] a town In addition to that, I [13:08] wanted to thank the members of [13:09] Sugar am e Church for the [13:12] invitation to the cookout this [13:14] weekend. It was also to [13:15] village 2020 for their [13:17] neighborhood cleanup Really [13:18] appreciate that. And then [13:21] shout out to the manual in my [13:23] alumni gathering as always, a [13:24] good time. We have the [13:25] opportunity to honor folks in [13:26] our community as well with [13:27] awards in some super proud to [13:31] be a thunder bolt and then [13:31] working do you have the [13:32] opportunity to attend Brick [13:34] city as well and so close that [13:37] the evening after that with [13:40] the blaze celebrating the [13:41] accomplishments of young men [13:41] in our communities and raising [13:42] money for scholarships. So we [13:43] had a good time this weekend [13:47] and shouted to my in turn j [13:49] for weathering all And then [13:50] finally, I'm gonna say much [13:51] because I will absolutely cry. [13:53] But, you know, COUNCILMAN [13:56] Theres my And so thinking [13:57] about the on this body without [13:59] her is just absolutely [14:01] devastating. I know you'll [14:03] continue to do incredible work [14:03] from wherever you are, because [14:05] that's who you are as a [14:06] person. But he will be sorely [14:12] missed on this body. Thank [14:15] Thank you. Councilmember para [14:16] i had to say happy anniversary [14:17] to Harriet and Kevin, [14:22] especially the area she for [14:23] those of that don't know, she [14:27] makes beautiful holiday crafts [14:28] for every single holiday and [14:30] they're like the only way been [14:31] able to pry my children into [14:31] being okay with Missouri has [14:32] as long as I have is because I [14:33] bring those every holiday and [14:36] they expect them now. Also [14:37] happy birthday COUNCILMAN [14:38] Louis on AUGUST 15 since I [14:39] will be here to say a little [14:42] bit closer it's yeah. Coming [14:42] right up close enough that I [14:45] can say it. And I'll just say [14:48] really quickly, I You know, we [14:49] have to have this technical [14:50] meeting on Wednesday to accept [14:51] my resignation from council. I [14:54] said pretty much what I needed [14:55] to say in JUNE when announced [14:56] that that this was I was going [14:59] to need to do. But the main [14:59] thing that I wanted to add to [15:02] that tonight is just to say in [15:05] thinking back over the last 3 [15:06] years and both how much I [15:07] love. I mean, you guys know [15:09] that I love my job. I really [15:10] do. I love being here with all [15:13] of you. It's been amazing, [15:14] it's there's elements of it [15:17] that are very hard. It's a [15:19] very hard time to be a public [15:20] figure. It's a very hard time [15:21] to be a public servant of any [15:24] kind. And that's that sort of [15:27] come home to me more and [15:28] having had a chance last 3 [15:31] years to have like the deeper [15:33] and broader relationships with [15:34] a lot of our city employees [15:35] who just there's a ton of you [15:35] on the room, obviously because [15:41] that was our but it's not [15:42] getting any easier time to try [15:44] to do what government doesn't [15:48] have translate to the public. [15:49] And it's interesting to come [15:51] in here and full-time obsessed [15:52] with the city and county of [15:54] Denver and everything it does, [15:56] which Oscar, believe because [15:58] weekly, but my 4 year old and [15:59] I talking about earlier this [16:03] morning because she was [16:04] shocked to learn the red [16:04] rocks, a sleek city facility, [16:05] you know, and so we make a [16:06] list of like all the things [16:06] the city employees do. And we [16:10] talk about how that's we do [16:13] that from but basically a part [16:14] of resources that we all make [16:15] together. You know, like it's [16:16] this really basic government [16:20] stuff. And I just feel so [16:23] worried all the time about how [16:24] badly that translates to the [16:25] public. Like I just don't [16:26] think people know me. Know [16:29] they don't know the half of [16:31] what what we do in the city to [16:32] just make a place where [16:34] everybody can be safe. What [16:36] you want to raise kids. I [16:37] mean, I moved here because I [16:38] wanted to raise my kids here. [16:39] I'm not from here like almost [16:40] all of your from but not I'm [16:44] like the new girl on the dais [16:45] and it's getting harder and [16:47] harder because people perceive [16:50] the value of government. [16:51] There's like a real question [16:52] right now about just the value [16:53] of the project of like, are we [16:56] going to keep, you throwing [16:58] our lot together paying our [16:58] taxes and feeling happy about [17:01] what they go to all of that [17:02] has been under attack from so [17:04] many different angles for so [17:06] long. And I know that makes it [17:07] very difficult to be a public [17:11] worker in almost any position. [17:13] People have been, you the even [17:14] some of our public health [17:17] workers during covid face like [17:18] physical attacks like just [17:18] really I it's hard not there [17:19] to be one of the people trying [17:22] to hold the ship together [17:23] people are doing that every [17:26] day and so many little ways, [17:28] you know, my child reason had [17:29] this is the school's media [17:31] that, know, you're not getting [17:33] called anyway. That's all I [17:34] want to say. I just it's a [17:38] it's a rough time to to be in [17:39] the public And I'm really, [17:40] really sorry to be stepping [17:43] out of it because I love being [17:45] And I also know that, you [17:47] know, it's just a huge it's a [17:50] lot to carry. And so when you [17:51] leave, you feel like you're [17:51] like leaving that what other [17:54] people very able hands appear. [17:58] But it's a lot. So and I and I [17:59] all 12 of were best Laker [18:02] because bakers dozen I've ever [18:03] been part of I love you a lot [18:04] and I hope you on Thank you. [18:06] Thanks, MADAM. PRESIDENT, [18:18] thank you. Thank you. [18:19] Councilmember parity and [18:20] Wednesday. There will be more [18:23] to come. So we just appreciate [18:24] you being here today. And we [18:26] have a full Baker's doesn't [18:28] appear. So this is kind of [18:30] nice to have everybody on the [18:32] dais tonight. I have a few [18:34] announcements and one I want [18:39] to start with acknowledgement. [18:40] And I think a lot of you have [18:41] heard us talk about it. It's [18:44] been the news, but to [18:46] acknowledge the shooting that [18:48] happened in District 4 and it [18:49] took place in my district on [18:51] JULY 20th that resulted in 8 [18:53] injured and one loss of life. [18:56] It was a tragic event that has [18:58] deeply affected our [18:59] neighborhoods and the families [19:00] and the victims. And I want to [19:02] extend my condolences to them [19:05] all. And there's really no [19:10] words that can ease that pain [19:11] community members have asked. [19:13] And I think that it's [19:14] appropriate also that we just [19:16] take a moment of silence to [19:18] recognize the loss of life, [19:19] not only in my district, but [19:21] in other districts and [19:22] individuals who are recovering [19:23] and healing. So if we could [19:29] just have a moment of silence. [19:42] Thank you everyone for doing [19:46] that. There are a few other [19:50] announcements that I do have a [19:53] one is on AUGUST. 15th [19:53] Saturday at the South by [19:54] Southeast. We are doing a [19:58] concert in the park and we are [20:00] having swing band this year. [20:03] So it starts at 04:00pm Thomas [20:04] Jefferson High School with tj [20:05] Orchestra and then will have a [20:08] swing band in the park on [20:10] AUGUST. 15th in Bible Park. We [20:12] invite you all to come. There [20:16] will food trucks as well as [20:17] number of different agencies [20:19] that will be there to also do [20:19] outreach and answer any [20:20] questions that people might [20:23] have. And then one last [20:26] announcement and its moment of [20:27] personal privilege. [20:28] Congratulations to you on 20 [20:31] years. I am also celebrating [20:34] tonight are today I wedding [20:35] anniversary my husband and I [20:35] just want to say thank you and [20:36] couldn't do it without is [20:40] incredibly kind patient and [20:41] generous. So for those of who [20:45] know, John, he's just the love [20:47] of of my life. And we've [20:49] celebrated another wedding [20:51] anniversary of arson earlier [20:54] summer. So it's a lot of love. [20:57] And I just want to I'm here. [20:59] I'm gonna come home soon. So [21:05] thank you for All right. [21:06] Sorry, House, all stop. [26:42] Appreciate it. So if [26:43] consistent feedback from my [26:44] constituents, it is my [26:46] responsibility to ensure that [26:47] the public is aware of every [26:48] tax being approved as an [26:50] expenditure and payment of [26:51] funds for a settlement with [26:53] the city and county of Denver. [26:54] My office is tracking every [26:56] dollar by department and as a [26:58] running total with your [27:00] approval. 26 11, 14. 26 [27:02] 11:41pm. Tonight. The city [27:03] will prove settlements in the [27:05] amount of 30,015 1000 to [27:05] settle cases. Vatican [27:10] SEPTEMBER. Brought against the [27:12] Department of Transportation [27:12] infrastructure. The approval [27:13] of these items tonight brings [27:14] the 2026 total of taxpayer [27:17] dollars in city settlements. [27:20] 2, 3 million, 992,000 dollars. [27:22] This funding is John from [27:23] liabilities claim pool of [27:23] money in order to pay the [27:26] claims tonight. So we have to. [27:30] We have had to make 3 million [27:31] dollar rescission that comes [27:34] from the city's general fund [27:34] continue to and it does not [27:37] come from agency specific [27:38] budgets. And so therefore, we [27:40] must pay extra attention in [27:41] this budget environment that [27:41] we are watching out for how [27:42] the city spends our money and [27:43] they were making decisions for [27:44] the future with this [27:47] knowledge. Thank you. Thank [27:48] you, MADAM Secretary. Please [27:50] put the next item on our [27:51] screens council Bill 10. 48 it [27:51] before an ordinance admitting [27:53] to the vote of qualified and [27:55] registered electors of the [27:56] city and county of Denver to [27:57] special municipal election on [27:59] NOVEMBER. 3rd, 2026 a proposed [28:01] amendment of the charter of [28:02] the city and county of Denver [28:04] mater at modernizing the [28:05] sections concerning the Civil [28:07] Service Commission and the [28:08] Department of Safety and [28:12] Council Bill 10. 55 a bill for [28:13] an ordinance farming the [28:14] municipal code upon passage of [28:17] the charter amendment. [28:17] Modernizing the sections [28:18] concerning the Civil Service [28:19] Commission and Department of [28:20] Safety. Councilmember [28:21] Sandoval, please go ahead with [28:24] your comments on council 10. [28:27] 48 10. 55. Thank you. MADAM [28:28] PRESIDENT, just want to I [28:31] thank you to everyone who help [28:32] I just get to this point [28:34] referring this to the for [28:36] people who are wondering what [28:38] does this civil service [28:40] commission do? It hires all of [28:43] our and fire department and we [28:45] are making an update to the [28:47] Civil Service Commission. So [28:49] you'll see that on your [28:50] NOVEMBER Ballot River sharing [28:51] COUNCILMAN Tyson, I started [28:53] working on this MAY of last [28:55] year year, want to give a [28:58] special thank you to wrap in [29:00] from the office said see to [29:04] help grounded our work equity [29:06] with an equity Chief Thomas [29:08] Chief Civil Service [29:10] Commissioner our city [29:12] attorney's. Thank you, John, [29:13] for helping us with all of [29:15] this to special shout out to I [29:18] an and Melissa, we could done [29:20] this without any of your [29:22] getting us this far. And so if [29:23] anyone has questions on this, [29:24] this is the last time be able [29:24] to speak to it because you [29:28] have to call me before 9 are [29:30] after 5 because they can't [29:31] campaign for something that [29:32] forgot about But I'm happy to [29:35] talk to you about it because [29:36] it's a really good and update [29:38] decide to give a shout out to [29:39] COUNCILMAN Torres, thank you [29:40] for being my partner on all of [29:42] this. Throughout last year. [29:43] Thank you, MADAM PRESIDENT, [29:47] thank Councilmember Torres, I [29:47] did what she said. This is [29:52] just a great good governance [29:52] process and the independent [29:55] monitor was also one of the [29:55] folks that was involved in all [29:57] of our workshop meetings with [30:00] it. 0, Trish and folks are [30:02] very attentive to how we [30:06] update the charter. And as my [30:06] colleague Councilmember Sawyer [30:07] says of do this everywhere all [30:09] over the charter. There's a [30:13] lot of places that are really [30:15] old. I and their language and [30:17] references. So we brought this [30:19] particular section up to speed [30:24] gender neutral language. [30:24] Allowing non-citizens to serve [30:26] on the civil Service [30:27] Commission. We had already [30:29] fixed. Classified service [30:31] recruitment for police and [30:33] fire when it comes to that and [30:36] really just putting things [30:37] where they belong, throughout [30:40] the charter and into ordinance [30:42] for putting that companion [30:43] ordinance through in this just [30:44] a good governance process. And [30:45] it was great to work with all [30:45] these wonderful folks. Thank [30:49] you so much. Thank you. Thank [30:50] you. Councilmembers for your [30:52] work on 2 MADAM Secretary, [30:54] please put the next item on [30:56] our screens council bill 11. [30:56] 0, 7, a bill for an ordinance [31:00] authorizing a precision from [31:00] General Fund contingency an [31:01] appropriation to the general [31:04] fund to make a cash transfer [31:05] and appropriations. The [31:07] liability claims special [31:08] Revenue Fund Councilmember [31:08] Luis, please go ahead with [31:10] your comments on council bill [31:14] 11. 0, 7, Thank you so much. [31:15] So I I started with this item [31:18] last week when it came before [31:20] us on first reading this item [31:21] out to represent a wake-up [31:23] call for the city with regards [31:25] amount of money we're spending [31:27] in settlements. Settlements [31:30] again are not paid out of the [31:31] specific agencies budgets. [31:31] Instead, the funding is drawn [31:32] out of the liability claims [31:35] Special Revenue fund like [31:36] other special revenue funds. [31:38] That money can only be spent [31:38] on specialize uses in this [31:41] case paying out settlements. [31:42] However, when the fun is used [31:44] up, the city has to move money [31:45] over from the city's general [31:46] in order to continue to pay [31:48] out the claims. And so in [31:49] other words, every dollar that [31:51] we move can only be spent to [31:53] settle cases since was [31:54] inaugurated in 2023. Council [31:57] has approved 5 of these items [32:02] for a grand total of [32:04] 34 million, 957,300 dollars, [32:06] $320. Excuse Each of these [32:07] dollars are Each of these [32:08] dollars are one less dollar [32:11] that we could use to fund city [32:13] staff city programs and city [32:14] services. This is a staggering [32:15] amount of lost opportunity [32:16] that could have been used to [32:19] find the badly underfunded, [32:21] temporary rental and utility [32:22] assistance program. And we [32:23] could have less in personnel [32:25] cuts last year. Among other [32:28] purposes. And so I would love [32:28] to see structural changes made [32:31] that would prevent the [32:32] settlements from the city [32:34] across all agencies from the [32:35] Department of Transportation [32:35] to the Denver Police [32:39] Department. Thank you so much. [32:39] Thank you. MADAM Secretary. [32:41] Please the next item of I'm so [32:44] sorry. Councilmember parity. [32:45] Yeah. Thank you. Thank you for [32:46] calling this council I wanted [32:48] to just add one other thing [32:49] for the consideration of [32:52] public about the amount of of [32:54] settlement funding that we've [32:55] seen spend, particularly on [32:56] public safety settlements. And [32:59] that is that that relates [33:00] directly how we handle [33:04] training internal policy and [33:05] discipline within the safety [33:05] agency. So the police [33:06] department, the sheriffs [33:10] department and currently at [33:11] the Office of the Independent [33:12] Monitor. And this is an [33:15] oversight board raised [33:16] repeatedly that they have a [33:18] disagreement with those [33:18] departments, about the scope [33:21] of I am and Co Bees Oversight [33:23] ordinance, which is supposed [33:26] to give them a chance to weigh [33:28] in on policy changes to the [33:29] disappearing processees in the [33:30] police and sheriff's [33:32] departments. And so [33:33] understanding that that's a [33:33] dispute. And there MAY be, you [33:34] know, different ways to [33:36] legally parse the language. I [33:37] don't think there's much [33:38] question from the point of [33:40] view of the people of the that [33:41] we want the independent [33:43] monitor. And this is oversight [33:44] board involved. Any time there [33:45] are internal policy changes. [33:46] And so to the extent that [33:49] that's not happening, that's a [33:51] concern that is potentially a [33:52] driver of these kinds of [33:53] settlements time. And that's [33:54] happened recently with moves [33:55] to education based [33:57] disciplinary policies in both [33:59] departments and also a new [34:02] taser policy within dpd. So [34:03] it's something to be aware of [34:03] that's an issue they care [34:04] about. Thank you. Council [34:05] thank you. MADAM PRESIDENT. [34:08] But Thank you, MADAM [34:09] Secretary. Please put the next [34:12] item on our screens Council [34:13] bill 1000 a bill for an [34:15] ordinance making a rescission, [34:20] a precision from appropriation [34:23] in the culture and recreation [34:24] Special Revenue Fund series to [34:26] make a cash transfer to an [34:27] appropriation in the park [34:29] legacy. Capital Improvement [34:30] Fund Councilmember Gilmer, you [34:32] please put council bill 1000 [34:33] on the floor for final [34:36] consideration. I met council [34:39] bill. 26 stash 1000 be placed [34:42] upon final consideration pass. [34:48] It has been Seconded. Comments [34:49] by members of Council on [34:50] council bill. That's probably [34:53] better way to say it. 26 dash [34:56] 1000 councilmember Sawyer. [34:57] Thank you, MADAM PRESIDENT, I [34:58] call this off tonight so I [35:02] could vote no on it. And this [35:03] is something that I struggle [35:05] with because this is a very [35:06] worthwhile project. And know [35:07] that there is a need for more [35:10] park space downtown. But at [35:13] the same time this summer, I [35:14] have spent hours and hours and [35:16] hours with my constituents in [35:17] district 5 who have e-mailed [35:19] me who come to office hours, [35:20] who had conversations with [35:24] Parks and rec and who have [35:26] really struggled. I'll give [35:28] you 2 specific examples of how [35:33] the first one the scooters? So [35:34] we have in district 5 and I [35:35] suspect that you all have seen [35:39] this in your districts as well [35:40] in your parks, a number of [35:42] young who are as I refer to [35:42] cause. And I can say this [35:45] because I have teenagers, [35:47] feral teenagers running around [35:48] all summer long, right? And [35:49] what they're doing is they're [35:50] driving their e-bikes through [35:52] our parks. They're ripping [35:55] apart graphs in JUNE, young [35:56] child who was playing on a [35:57] playground Robinson Park was [35:59] almost hit and injured by one [36:00] of these bikes. Now I'm gonna [36:01] tell you right now this is the [36:02] responsibility of their [36:05] parents. However, when this [36:06] kind of behavior is happening [36:09] in a park, it is also the [36:11] responsibility of our park [36:12] rangers to ensure that it does [36:14] not continue. And [36:16] unfortunately, my residents [36:16] have been told by Parks and [36:17] Rec park Rangers directly. [36:20] There is not the staffing. To [36:22] enforce it. There is not the [36:24] budget to put up signage to [36:26] bring awareness to it. So [36:28] that's the first issue. Second [36:31] issue I was going to announce [36:32] that. But instead I'm going to [36:33] an announcement but also [36:34] mentioned it right now. A fair [36:35] park is celebrating its 30th [36:39] anniversary this year. And [36:40] that's really exciting. We're [36:41] going to a proclamation us all [36:43] see it in a couple of weeks. [36:45] Really looking forward to [36:46] celebrating the 30th [36:47] anniversary of major park, [36:48] which is going to happen on [36:50] AUGUST 22nd from 05:00pm to [36:51] 08:00pm in Major Park. This is [36:52] something that happens every [36:54] year. There's food trucks. The [36:55] Denver Municipal Band will [36:56] play hundreds of neighbors [36:58] come out and enjoy community [37:00] together. What they won't [37:04] enjoy is a bathroom because [37:06] Parks and Rec has told our [37:07] office the registered [37:08] neighborhood organization and [37:10] all of the residents who have [37:12] called him that they are not [37:13] the dollars or the staffing to [37:16] be able to put Porta potties [37:16] in Mayfair Park or several [37:21] other parks. In District 5. I [37:22] know that this is happening [37:25] across everyone's districts. [37:25] I'm just only going to speak [37:27] for Emmys. I statements only [37:27] speak for district 5 because [37:30] that's what I know about here. [37:31] This is a problem because what [37:33] my residents came to me and [37:37] there were not wrong. Is that [37:40] the dollars that they're [37:40] paying in taxes are not coming [37:41] back to them. They are not [37:42] getting the return on [37:44] investment that they deserve [37:45] for what they are being [37:48] charged to live in our city [37:49] when there are young families [37:52] with kids when there are [37:52] elderly families and they [37:57] can't access a room for a 30th [37:58] anniversary celebration in one [38:03] of our parks. Not ok. And so [38:05] what we're looking at here in [38:06] this ordinance is a transfer [38:08] of dollars in the park legacy [38:08] funds. The Parks Legacy Fund [38:13] was voted on by the voters of [38:18] Denver is a 0, 2, 5%, to 5 [38:20] sales tax that goes directly [38:22] to funds the maintenance of [38:24] our parks. The acquisition of [38:25] more Parkland, et cetera. And [38:25] that's what we're talking [38:26] about here tonight. 3 million [38:28] dollars to acquire more [38:30] Parkland. And that is a really [38:31] worthwhile saying that we [38:36] should be doing. But it is at [38:39] the expense providing services [38:39] to our residents who are [38:42] paying these taxes. And that [38:43] is where the problem lies. [38:46] This is an administration that [38:48] focuses on major projects and [38:50] not on the needs and the value [38:51] for their dollar for the [38:53] residents of our city. And so [38:55] I'm going to be a No tonight [38:56] because I want to make sure [38:57] that the point is me that this [39:01] is not okay that our residents [39:02] are not happy with this, that [39:03] they do not believe that they [39:05] are getting the value for [39:06] their dollar and they should [39:07] been there right. And so I'll [39:09] be tonight. Thank you. Thank [39:12] you. Councilmember Hines, [39:13] thank you. MADAM PRESIDENT, [39:13] thank you. Councilmember [39:18] Sawyer High. You are not the [39:21] only one who has concerns how [39:25] an agency is is acting or are [39:26] reacting. So I I certainly [39:32] understand it supports you and [39:34] All I your concerns are more [39:35] about parts generally as [39:37] opposed to this particular [39:41] acquisition. And I would say [39:41] high that, you know this these [39:45] funds are just 4 capital [39:46] expenditures, not operating [39:48] expenditures and expenditures [39:49] like providing additional park [39:53] Rangers services are. And this [39:56] is actually boy the first time [39:58] that any funds have been [39:59] expended District 10. And so [40:03] the Parks Legacy Fund has has [40:04] purchased areas and many other [40:07] sections of the city. This is [40:08] district ends first [40:11] opportunity have a purchase. I [40:13] still think that it's a very [40:14] good purchase and I will be [40:16] voting for it. So thank you, [40:18] MADAM PRESIDENT, thank you. [40:19] Councilmember Gilmore, thank [40:24] you. Council PRESIDENT, I the [40:27] conversation here tonight. I [40:30] just want to remind folks [40:31] that, you know, these folks [40:32] are important and the way that [40:35] we vote talks about our values [40:38] and earlier this year, I [40:41] talked extensively about a 7.9 [40:43] million dollar project that [40:48] was slated for district 11 for [40:50] a maintenance shop [40:52] conveniently parks decided to [40:54] slash that project by 5.4 [40:56] million and divert that money [40:59] elsewhere outside of District [41:02] 11 in Montbello and Green [41:04] Valley Ranch. And we're [41:08] getting a 2.5 million middle [41:09] Tuff shed in Green Valley [41:12] Ranch, whereas closer to [41:16] downtown. They're getting a [41:18] 13.3 million dollar [41:23] maintenance facility with 79 [41:23] workstations innings or Brent [41:27] amount of amenities. And none [41:28] of that for a majority [41:32] community of color. And so [41:36] this capital I acquired meant [41:37] is important, but capital can [41:39] also be utilized on building [41:43] the very buildings that we [41:45] need. So I am very happy to [41:51] vote no on in a way to push [41:53] back the irresponsible and non [41:54] accountable way that Denver [41:59] Parks and Rec has been [42:01] allocating funds and spending [42:04] with no concern at all around [42:05] equity, especially for those [42:07] who historically have been [42:09] underserved since the [42:10] inception of the city and [42:13] county of Denver. And that's [42:15] very easy to say. See the lack [42:19] of parks and park maintenance [42:20] facilities in the far [42:21] Northeast. Thank you, council [42:23] president, thank you. [42:26] COUNCILMAN Cashman. Thank [42:28] Council PRESIDENT. I agree [42:30] with COUNCILMAN Hines, it's [42:31] inappropriate use of these [42:33] funds. But I also agree with [42:34] Mike colleagues that there [42:38] there are some basic services [42:39] that aren't getting I have had [42:43] a request to for restrooms to [42:47] be open recently. An [42:48] observatory park, apparently [42:49] all restrooms now close to [42:52] 02:00pm. Because we don't have [42:55] the personnel to to do better [43:00] than that. The conditions of [43:00] our restrooms are very [43:03] frequently, atrocious. It's [43:04] basic stuff. What are our [43:08] parks replace where our [43:11] families gather bold young in [43:13] between. We've got figure out [43:15] a way to get these basic [43:18] services funded. You know, I [43:19] keep saying the same thing we [43:20] the past year have come up [43:24] with large dollar items. 4 [43:25] major projects. And that's [43:28] great that the projects on my [43:30] mind were we're needed an end. [43:32] We'll make our city a better [43:35] place to be this new park in [43:38] district Well, we'll make our [43:39] city a better place to be. [43:42] Your Lord, if we can find the [43:44] money for for these major [43:45] projects, we've got be able to [43:49] find the money to take care of [43:51] the basics. You know, keep [43:55] heart restrooms clear, clean [43:58] and open is kind of basic. So [44:02] I'll as I said, supporting [44:04] this bill, but also be asking [44:04] some hard questions, Ed, that [44:07] budget this year. Thank you, [44:10] MADAM PRESIDENT, thank [44:11] Councilmember Sandoval, think [44:13] you MADAM PRESIDENT, I have a [44:26] question real for real [44:27] investing think been [44:31] committee, we talked about or [44:33] market value. I think it's and [44:34] we're paying more for this. [44:37] Then that they came I can [44:42] remember respect but praise [44:44] that you think you remember [44:46] the terminology Miami, how [44:47] much more we're paying for and [44:50] I apologize. COUNCILWOMAN. [44:53] First, Lisa Lumley director of [44:58] real estate. It you know, some [45:05] looking right now, Kevin, it. [45:08] 5 500,000. I think it's going [45:11] over and I apologize that I [45:12] didn't have. My understanding [45:13] was we there was a different [45:14] topic to talk about. Tonight's [45:17] are apologizing my notes. What [45:18] I will say, though, is the [45:18] assessors have also been [45:23] looking in there as the values [45:24] have changed around there. [45:24] There's a lot that happening [45:28] all at once. But yes, there is [45:31] there is a window that is [45:31] reasonable within appraised [45:34] values up or down within a 10% [45:36] window. That still can be [45:37] considered an appropriate. But [45:37] you're right, there was a [45:39] business decision made as [45:40] well. Thank you. And if I [45:41] remember correctly, when we [45:44] have committee, there's not [45:48] currently any money for plan [45:50] and this park implementing [45:51] into a park from what I [45:52] understand from committee is [45:55] the building will be used for [45:55] parks and recreation staff. Is [45:57] that correct? Well, there [45:58] would be some money that we're [46:00] also, including for design [46:01] piece of that and being able [46:04] talk about a programming with [46:05] the community. Staff would [46:07] only be using during that [46:09] interim time so that we just [46:11] have activation there. So it's [46:11] just not an empty building [46:13] sitting there, not for the [46:14] long-term use. Understand you [46:16] might how much you was [46:20] projected for tick needed [46:20] dollars to turn into a park. [46:21] I'm going to need to verify [46:29] with parks. You know, well, [46:33] Starbucks wreck. We is part of [46:34] this transaction. We have a [46:36] little bit reserved to do [46:37] Initial count, something [46:37] vision planning that will [46:40] inform with the eventual bill [46:42] though costs passed. We don't [46:44] have a precise number. We have [46:45] some industry standards that [46:48] we use just is rule of thumb. [46:50] But need to get deeper into [46:51] that concept. Thing to say, [46:53] look, this is actually takes [46:53] to work in our 5 year plan for [46:54] that bill. That right now we [46:56] just be securing the property [46:59] and eventually we have. [47:01] Capacity to work under plan [47:02] beginning those conversations [47:02] about what should specific [47:04] character, this place to be. [47:07] Thank I will also be tonight. [47:09] As I mentioned in committee, I [47:11] was moved on to the full [47:12] council, but I was I said, I [47:14] did not support this team [47:16] because of face value and not [47:19] having fun mean Your mark [47:21] towards this. Although I do [47:26] know where have a park deficit [47:26] the park right across the [47:29] street from west civic Center [47:31] park is getting a huge update. [47:32] Skyline Park just got a huge [47:33] update. There have been lots [47:37] of investments and I just I [47:39] don't agree with. And that [47:39] using a half a million dollars [47:40] over face value. Thank you, [47:41] MADAM PRESIDENT, thank you. [47:44] Council member of the So [47:49] that's thank you so much. I [47:50] appreciate my colleagues [47:51] comments. I think that we do [47:52] need to look at that and how [47:54] much we spend over appraised [47:58] value. I am curious. My [47:59] understanding is this is not [48:00] zoned for a park yet. Is that [48:04] correct? Correct? It would [48:06] come back for a rezoning for [48:07] open space. The reason I ask [48:09] is that over the weekend I [48:11] found out that some local [48:12] businesses are using it for [48:15] parking. And so I was curious, [48:16] would they still be able to do [48:17] that being a park with that [48:20] person? Any public use their [48:24] parking if we acquire. Then at [48:26] that point, no, it would not [48:29] be public. Just wanted for [48:30] information on purchases [48:33] purposes. Sorry, I am. I [48:35] definitely have concerns. I [48:36] want to make sure that we get [48:37] parkway guess Iif and there [48:38] across the city. But I also [48:41] think this will be really [48:42] important to these residents [48:43] here in this area. When I talk [48:45] to the residents in district [48:46] 7, 1, of their biggest [48:48] concerns is enough park space [48:50] for all the new high rises in [48:52] this area has added quite a [48:54] bit density. And so for those [48:54] reasons, all be supportive of [48:56] this tonight. Thank Council [48:58] PRESIDENT, thank you. [48:59] Councilmember Hines, thank [49:00] you. MADAM PRESIDENT, just a [49:03] quick Skyline and civic [49:04] center, parts are things that [49:07] have been funded in part [49:09] through a different set of [49:14] funds, 10 a Parks legacy and [49:16] vast majority people live in [49:16] district 10 live outside of [49:17] the footprint for that funds. [49:22] Heart of the local. So this [49:23] helping people in district 10 [49:26] I could Participator take [49:28] advantage of those larger pots [49:32] of funds. Thank Thank you. I [49:34] actually have a question for [49:36] you as well for real estate. [49:38] But you had mentioned that [49:40] things have kind of been [49:41] changing in the neighborhood. [49:42] It does that mean that the [49:46] appraisal value has also [49:46] decreased it and no, we're [49:52] not. Not enough. Probably for [49:54] me at the moment to say that [49:54] it would make a difference in [49:58] the discussion tonight. What I [49:59] will say, though, is that [49:59] we're also fighting, though, [50:00] the challenge of even finding [50:01] any property in that district [50:05] in that area, which we have [50:07] discussed a committee as This [50:12] is something that has within a [50:14] list of assets trying to [50:16] identify something from U.S. [50:17] 15 years. This is the first [50:17] that we've been able to [50:20] identify actually move forward [50:23] West and then another question [50:25] for the amount that's being [50:27] approved since things are [50:28] fluctuating. If we approve the [50:30] amount, would you also then be [50:32] able to for the appraised [50:33] amount or does it have to be [50:35] the amount that we approved [50:37] that that's up for approval. [50:38] As far as for what actually [50:41] move forward with. Yes, it [50:42] would be the approved purchase [50:45] price, not the appraised [50:48] value. So again, we what we [50:51] are trying what we what you [50:52] had already approved in the [50:55] purchase and sale agreement [50:56] was the purchase price. This [51:00] then if I'm not mistaken, is [51:07] companion ordinance to move to [51:08] Companion ordinance to okay to [51:12] move the funds. So My my [51:16] question being we are in a [51:18] tight budget season. And so it [51:21] just to go beyond what the [51:22] approved appraisal value is. [51:22] And I know that we have talked [51:28] about this in committee. Seems [51:30] very generous. And in this [51:31] case that we have, you know, a [51:33] property owner that which [51:37] received far more than what we [51:39] had to go shaded downs from [51:41] where that had started. I will [51:42] say that. So we're we're not [51:44] just settling of appraised [51:44] value. This it studies this [51:47] was through some negotiations [51:49] where we arrived at the actual [51:54] price. Thank you. [51:55] Councilmember Kansas contest. [51:58] Thank you. MADAM PRESIDENT. I [52:01] know that committee. I had [52:01] asked the question and I think [52:02] myself and a couple of my [52:04] colleagues asked about. I'm [52:05] getting some information [52:06] around how many parks per [52:08] capita are in the each [52:11] district? I don't know. I just [52:12] searched for that, but I don't [52:13] know if that was provided to [52:18] us. So I don't know. You have [52:19] that information. The parks [52:23] per capita in each district. [52:24] We've asked about it in [52:24] committee. And so just [52:27] following up on that. Yes, and [52:30] fouled back up with district. [52:33] 10. He's one of our lowest 2.5 [52:35] per 1000 and our citywide [52:38] averages between 9 and 10. So [52:39] this us. Lisa mention a huge [52:40] priority for us to close a 5 [52:42] minute walk gap in it and our [52:44] value in one of our densest [52:45] and the lowest per capita [52:46] area. So those are 2 key Park [52:52] service, nexus metrics in [52:53] Although concerns, but from [52:54] parks system perspective in [52:55] the growth of the city, it's [52:57] those are think the main [52:59] things we're trying so and [53:00] haven't been able to find a [53:03] property over 15 years. Thank [53:04] One other question and make [53:08] this might be for you, Lisa, [53:09] because it was mentioned that [53:12] this is for that the Capitol [53:15] in Parks, legacy capital [53:15] permit fun. But it's special [53:18] Revenue fund transferring over [53:19] and COUNCILMAN Sawyer was [53:20] saying was that that fund it [53:22] can be utilized for the [53:24] ongoing maintenance of parks [53:25] and whatnot. So I guess just [53:28] real quick walk me through [53:30] this fund that it's the money [53:31] is to be taken. That is being [53:33] appropriated comes from that [53:36] parks, the Special Revenue [53:38] Fund, correct. And that can be [53:39] utilized for maintenance of [53:42] parks and upkeep of our [53:44] current parks. I mean, yes, I [53:46] looking for Dennis. Yes, that [53:47] is what it was meant for [53:48] capital acquisitions and the [53:51] maintenance. Okay. And so I [53:53] just want to be clear like [53:54] this is so these these funds [53:56] could be used in that way. But [53:58] they're being transferred over [54:01] to be utilized capital to [54:04] acquire The slant correct? [54:05] Okay. Thank you. That's Thank [54:07] you. MADAM PRESIDENT, thank [54:12] you. Councilmember parity. [54:13] Yeah, thank you so I just I [54:15] wanted to lease. I'm curious [54:18] if you know this, but I think [54:21] that location is that right by [54:25] Circle k that has slate of [54:26] just a lot like activity and [54:27] things like that for the last [54:29] couple of I can't speak to [54:31] what going on there. But yes, [54:32] this is this parcel is [54:33] actually right in the [54:34] building. It's the former [54:36] credit union drive-thru, ok? [54:38] So it is that location right [54:42] there. They're okay. That [54:42] actually now that I know that [54:45] that's the exact that Hosni [54:46] sort of visualize distance, [54:48] other green space and the need [54:50] for it. The other question I [54:51] have for you is how long will [54:53] it be until this park actually [54:54] gets built out? Like I know [54:55] we're often, you know, there's [54:56] a big lag between the [54:59] acquisition and the so that I [55:00] MAY need to call on my parks, [55:01] friends to speak to the actual [55:08] thank On most parks rec, there [55:10] will be a lag because we have [55:11] another perk acquisitions that [55:12] we've made that are working [55:14] their way through planning [55:15] process that we have poor. [55:15] Park is one that we need to [55:19] that is in the process now. We [55:19] make these land acquisitions [55:20] that we need to start working [55:23] them into the 5 year plan. We [55:23] already have lots of [55:24] commitments under capital [55:25] plan. So it's not something [55:28] that can start tomorrow. I [55:29] expect probably and early 2028 [55:32] starting that community kind [55:34] conversation about what is the [55:38] character and desired park [55:39] character. But the detailed [55:41] design and implementation have [55:41] to follow in out here. So we [55:43] don't have those projected [55:45] just yet, ok, thank you. And [55:45] if you could stay for a [55:46] second, I have couple just a [55:49] little to that. Having served [55:49] on park related committee for [55:51] the Bond. I sort of saw a lot [55:55] of those pipelines We have to [55:56] keep land acquisition one [55:57] moving and that that there's [55:58] there's a lag by nature, [56:01] right? But I am curious how [56:02] many properties we currently [56:04] on the plans to be a park, [56:06] whether their designated yet [56:06] or not that are not yet built [56:09] out around the city. I would [56:10] need to do some homework on. [56:18] That a rough, just curious. I [56:19] don't know. I can take some of [56:21] them have taken quite a while, [56:22] too construction that have [56:24] been in that purple and for [56:25] many years. And hopefully [56:27] that's not the case anymore. [56:27] Since we do more financial [56:31] resources that we did. But I [56:32] would have to fall back to [56:33] give you a number. Come to [56:35] know that's okay. And the how [56:36] do you balance between the new [56:37] acquisitions that and the [56:37] ball? That's because the [56:38] legacy fund can be used for [56:44] both right. Yes. Like the [56:45] acquisitions as one of the [56:47] core items that was identified [56:48] in that ordinance that thanks [56:49] to a ordinance. So it is a [56:50] balance. And what is the right [56:55] balance? I think part of the [56:56] question, mean, this is also [56:56] what can cause to supplanting. [56:57] There's some language about [57:02] this to be. Not back needs [57:03] that should otherwise been [57:04] addressed by the General fund, [57:05] but to be able to advance the [57:08] game plan and the other [57:09] handful of items that were on, [57:09] though, that ordinance of it [57:12] is a balance right now. We try [57:14] to have a small working [57:15] Capital Mountain, our [57:16] acquisition fund we can act [57:18] when the opportunities [57:19] available. By and large, it [57:21] this far smaller than our [57:22] annual capital plan for [57:23] capital maintenance part [57:25] buildup. Ok, thank you. Those [57:26] are my questions. Thank you, [57:28] MADAM PRESIDENT, thank you. [57:29] Councilmember Sawyer, thanks [57:30] to PRESIDENT Just wanted to [57:31] take a quick second to clarify [57:33] something that parks and rec [57:33] just said, because I find it a [57:36] little bit concerning the [57:38] previous speaker brought up [57:38] Emporia Park Emporia Park is a [57:44] park in district 5. It was [57:46] using a small amount of legacy [57:47] dollars. The rest of the money [57:49] came from the park's trust [57:52] Denver Parks. Trust a to be [57:53] able to purchase that. I want [57:57] to be very clear. The build [57:57] out the design and [57:58] construction of that park is [58:02] bond project. But it's not [58:03] coming from the Parks Legacy [58:07] Fund and it really concerns me [58:11] you know, false information [58:12] being shared up here with you [58:14] Thank you. Councilmember [58:16] Hines, thank you. MADAM [58:17] PRESIDENT my 3rd bite at [58:20] conversation. Has a question [58:22] about acres per 1000 [58:24] residents. District 10 has 2.3 [58:25] acres per 1000 residents, [58:26] which is the lowest amount of [58:30] any council district. A second [58:31] Lois Council district [58:35] discounts district 7 at 7.6, a [58:37] girls acres per 1000 [58:38] residents. Certainly we in [58:39] district and have a lot of [58:40] density and water parks. Thank [58:46] you, MADAM PRESIDENT. Thank [58:47] MADAM Secretary Roll Call on [58:54] Council Bill. 26 Dash 1000. [59:01] Council members of the dress. [59:05] Plan. I Bill Gonzalez could [59:16] hear tide Cashman. Ne parity. [59:24] I Sandoval name. So known [59:27] tourist, the plaques. And [1:00:00] 53 at the Denver Revise [1:00:02] Municipal code. Repealing or [1:00:03] outdated amusement and cabaret [1:00:04] license types. Modernizing [1:00:08] license provisions. Relating [1:00:10] to entertainment license is [1:00:11] updating application and [1:00:11] licensing fees and making [1:00:13] conforming amendments to the [1:00:14] code. Councilmember come or [1:00:15] would you please put council [1:00:18] bill? 26 stash 0, 9, to one on [1:00:20] the floor for final [1:00:21] consideration. I move the [1:00:24] council bill. 26 Dash 0, 9, to [1:00:25] one. He placed upon final [1:00:30] consideration and do pass has [1:00:33] been moved and seconded. There [1:00:34] is a another motion on the [1:00:36] floor council. PRESIDENT Pro [1:00:37] Tem Gonzalez could get us. But [1:00:38] would you like to do with [1:00:41] council 0, 9, to one. Thank [1:00:42] you, council PRESIDENT. I move [1:00:44] that council bill. 26 0, 9, 2, [1:00:46] 1, be amended in the following [1:00:49] particulars on Page 7 line. 24 [1:00:50] strike. The entertainment [1:00:52] business shall provide such [1:00:53] records following a request [1:00:54] from a law enforcement officer [1:00:56] City official that is [1:00:57] submitted in the performance [1:00:58] of their official duties as [1:01:01] part of an official [1:01:01] investigation and must provide [1:01:03] access to off premises records [1:01:03] within 3 business days. [1:01:08] Following your request. It has [1:01:09] been moved and seconded [1:01:11] questions and comments by [1:01:12] members of Council on [1:01:13] amendment one to council Bill, [1:01:14] 0, 9, 2, one council PRESIDENT [1:01:18] Pro Tem Gonzalez could get us. [1:01:21] Thank MADAM. Amendment removes [1:01:22] the language related to [1:01:22] provision of records retained [1:01:25] by entertainment businesses to [1:01:25] law enforcement or city [1:01:29] officials. I will say that [1:01:29] myself and COUNCILMAN Lewis [1:01:33] worked on this amendment with [1:01:35] with license and consumer [1:01:36] protections and really [1:01:39] appreciate their thoughts on [1:01:40] this behind this amendment. [1:01:41] And we also because we heard [1:01:46] concerns from aclu [1:01:48] specifically around that [1:01:49] language, not necessarily be [1:01:52] needed because that right [1:01:52] already exists. Law [1:01:57] enforcement can access records [1:01:58] under warrant or probable [1:02:00] cause. So that is still [1:02:01] allowable. It doesn't change. [1:02:05] City officials from accessing [1:02:06] and their investigation [1:02:07] process. And we've also [1:02:08] received confirmation that [1:02:09] both of those things will [1:02:12] remain true and that the [1:02:12] language was unnecessary to [1:02:14] have in this Bill. Thank MADAM [1:02:22] PRESIDENT. Thank you. I [1:02:22] believe we do have a second. [1:02:27] MADAM Secretary And been great [1:02:29] thank you, MADAM Secretary. [1:02:30] Roll Call on amendment one to [1:02:34] council Bill 0, 9, to one. [1:02:45] Council members. I'll be just [1:02:48] High. Maher. I can tell tears. [1:02:52] Hindsight, Cashman High. The [1:02:57] parody. Tend of tourist. [1:02:59] Watson, MADAM PRESIDENT, [1:03:02] American people. Eye, MADAM [1:03:03] Secretary, close the voting [1:03:07] and announce the results. 13 [1:03:08] 13 Eyes Amendment one to [1:03:10] council Bills. 0, 9, 2, one [1:03:10] has passed. Is there another [1:03:14] motion on that? There is [1:03:15] another motion on the floor [1:03:17] council, PRESIDENT Pro Tem [1:03:17] Gonzales. But it is what would [1:03:18] you like to do with council [1:03:21] Bill? 0, 9, to one. Thank you, [1:03:22] council PRESIDENT. I move that [1:03:23] council bill. 26 0, 9, 2, one [1:03:25] be amended in the following [1:03:28] particulars Page 10 line 11 [1:03:31] after the word rule insert no [1:03:32] video surveillance Shelby [1:03:34] required or allowed in staff [1:03:36] bathrooms. Staff locker rooms [1:03:36] are any other prohibited areas [1:03:39] described in department full [1:03:45] on Page 12 Line 12 after the [1:03:45] word rule in serve. No video [1:03:46] surveillance shall be required [1:03:47] or allowed and stuff locker [1:03:48] rooms or any other prohibited [1:03:49] areas described department [1:03:53] cool. It has been moved and [1:03:53] seconded questions and [1:03:57] comments by members of Council [1:03:59] on amendment 2 to council Bill [1:03:59] 0, 9, 2, 1, council PRESIDENT [1:04:03] Pro Tem Gonzalez could get us. [1:04:03] Thank you, MADAM PRESIDENT, [1:04:06] this amendment clarifies where [1:04:07] required video surveillance [1:04:08] shall be allowed in nightlife. [1:04:09] Entertainment business is an [1:04:10] adult entertainment [1:04:13] businesses. This came forward [1:04:19] folks in the industry [1:04:20] expressed concern on their [1:04:20] kind of their rights to [1:04:24] privacy insensitive spaces. [1:04:25] And so again, thanking the [1:04:27] Department of Licensing [1:04:31] consumer protections for [1:04:32] taking the time to meet with [1:04:34] folks and hearing that out and [1:04:35] coming forward with this [1:04:36] amendment. And so I ask for [1:04:42] support of this. Thank [1:04:43] Councilmember parity. Yes, [1:04:45] thank I just want to speak [1:04:47] quickly in support of us as [1:04:49] It's a learning for me to know [1:04:52] more about some of the work [1:04:54] conditions of people who work [1:04:55] in the entertainment business [1:04:56] in the city. And there's [1:04:58] really so much that could be [1:04:59] doing about their work [1:05:02] conditions, which are often [1:05:04] just sometimes really fraught [1:05:05] experience. A lot of danger in [1:05:07] the workplace more so than a [1:05:09] lot of other occupations. A [1:05:11] lot of ways a lot of [1:05:12] shenanigans, for lack of a [1:05:13] better word. So I just want to [1:05:14] thank my colleagues for [1:05:15] working with the aclu and [1:05:18] moving this amendment. Then [1:05:19] also some members my office [1:05:21] team who who supported that [1:05:24] work and was just a very, very [1:05:26] good catch. Appreciate it. [1:05:27] Thank you. Thank you. MADAM [1:05:28] PRESIDENT, thank you. I'm also [1:05:29] in support of this amendment. [1:05:33] We have an adult entertainment [1:05:35] business and I appreciate the [1:05:36] extra protections. MADAM [1:05:37] Secretary Roll Call an [1:05:38] amendment to the council Bill. [1:05:42] 0, 9, to council members will [1:05:52] be just fine are. Bill [1:05:54] consulted Terrace time. [1:05:56] Alright, Cashman Snow, ice and [1:06:01] guarantee tend of right, [1:06:02] Sawyer, I Torres, had a [1:06:04] PRESIDENT Romero. Campbell. [1:06:06] MADAM Secretary. Close to [1:06:08] voting and announce the [1:06:11] results. 13 13 eyes amendment [1:06:13] to the council Bill. 0, 9, 2, [1:06:14] one has passed. There's [1:06:15] another motion on the floor. [1:06:16] Councilmember Torres, what [1:06:18] would you like to do with [1:06:24] council Bill? 0, 9, to one [1:06:25] thank you, MADAM PRESIDENT, I [1:06:28] move that council bill. 26 [1:06:29] does Sarah 9 to one be amended [1:06:32] in the following particulars [1:06:35] on Page 19 strike line 18 [1:06:36] strike for Em and replaced [1:06:41] with 02:00am. It has been [1:06:43] moved and seconded questions [1:06:44] and comments by members of [1:06:46] Council on amendment 3 to [1:06:48] council. 26 Dash 0, 9, 2, one [1:06:49] councilmember Torres, thank [1:06:51] you so much. This amendment [1:06:53] specifies the hours when it [1:06:55] would be unlawful to for [1:06:57] nightlife in a team of [1:07:00] businesses and adult [1:07:01] entertainment businesses to [1:07:02] operate. This is one of the [1:07:03] sections that I think is [1:07:07] received quite a lot of [1:07:08] attention due to that, I want [1:07:09] to make sure that we're of the [1:07:12] sizing. How could this bill is [1:07:15] the process that excise a [1:07:18] license licensing or [1:07:19] protection have gun to really [1:07:22] kind of look clea at their [1:07:24] process this was one that I [1:07:26] could get entirely comfortable [1:07:26] with. And that was the [1:07:33] 04:00am. A provision. I think [1:07:35] we're not quite there yet data [1:07:36] that demonstrates that things [1:07:39] could safer with the leader [1:07:40] exit time. I think what I [1:07:43] would be interested in is if [1:07:45] we can somehow step our way [1:07:47] into this, particularly a [1:07:49] pilot, geographic locations [1:07:51] like where's this actually [1:07:53] being desired by which [1:07:56] sectors? And let's start [1:07:58] little bit more narrowly that [1:07:59] I think my future interest in [1:08:01] this tonight, though, I think [1:08:04] this bill needs pull that [1:08:08] section of being up until [1:08:09] 04:00am want to get I think [1:08:11] broader support, particularly [1:08:14] from But I think from others [1:08:15] council and for us to think [1:08:15] just think a little bit [1:08:18] differently about how that [1:08:19] later opening might actually [1:08:21] be helpful. Thank you, MADAM [1:08:24] PRESIDENT, thank you. [1:08:26] Councilmember Hines, thank [1:08:26] you. MADAM PRESIDENT, thank [1:08:30] you. Colleagues as as I talked [1:08:31] with most of you, I was [1:08:33] considering an amendment to [1:08:34] have a pilot that would [1:08:37] Resendiz JANUARY first 2030. I [1:08:42] want to thank council for [1:08:45] suggesting this. This I have [1:08:47] withdrawn my amendment [1:08:48] supporting council Torres. [1:08:51] This amendment because it [1:08:54] does. I think there are [1:08:56] opportunities for us to [1:08:57] consider particularly [1:09:00] downtown, MAY be the 5 point [1:09:04] statistical neighborhood, [1:09:05] Ballpark. But I can certainly [1:09:06] understand that the things [1:09:08] that are good for downtown MAY [1:09:11] not be good for elsewhere and [1:09:12] and frankly, we don't even [1:09:13] know if it is for sure. Good [1:09:15] for downtown. Said, thank you, [1:09:16] council Torres for bringing [1:09:19] the Amendment. I'll be yes. [1:09:25] Thank you. Cashman. Thank you. [1:09:27] Council PRESIDENT. Yeah, I [1:09:27] actually thought that the way [1:09:29] the ordinance was written, [1:09:31] that the hearing provisions [1:09:34] that would have provided an [1:09:37] opportunity to extend the late [1:09:40] night where it is appropriate [1:09:40] and that the hearing process [1:09:42] would have protected [1:09:45] neighborhoods where it isn't [1:09:46] appropriate. However, [1:09:49] appreciate this amendment. I [1:09:52] look forward and that's my [1:09:52] understanding that a working [1:09:53] group will will come together [1:09:58] to look at how could we pilot [1:09:59] this gather the data that will [1:10:02] make people more comfortable. [1:10:03] And so I'm hoping not a long [1:10:05] time down the line. Well, [1:10:08] we'll have a pilot that we can [1:10:11] not look see. Do the benefits [1:10:11] actually, I waive people's [1:10:12] concern. Why expect they will? [1:10:15] Thank you. MADAM PRESIDENT, [1:10:16] thank you. Councilmember [1:10:20] Sawyer. Thank you. MADAM [1:10:21] First, just want to say thank [1:10:22] you, Councilmember Torres for [1:10:24] bringing this forward. And I [1:10:26] want to say a huge thank you [1:10:28] to the staff not excise and [1:10:33] license. What is your name [1:10:34] down? Details I'm sorry, guys. [1:10:35] I promised by the year from [1:10:35] now. When I leave here, I will [1:10:39] get that right. This I really [1:10:42] appreciated. This has been in [1:10:43] issue of major concern for the [1:10:45] residents of district 5 and [1:10:46] frankly for the businesses, [1:10:47] including businesses and [1:10:48] business improvement districts [1:10:52] in District 5. So with change [1:10:54] and a very long email chain [1:10:55] and discussion that I had with [1:10:57] Erica Lee last week about some [1:11:00] of concerns around good [1:11:01] neighbor agreements. I voted [1:11:04] no on publication. I had every [1:11:06] intention of voting. No, [1:11:08] assuming that this change is [1:11:09] made, I think that this really [1:11:10] resolve the challenges and [1:11:11] concerns of my residents all [1:11:15] be yes. Thank you. Thank [1:11:16] Councilmember Watson thank [1:11:17] you, MADAM PRESIDENT, I have [1:11:19] one question for consumer [1:11:20] protection and licensing and I [1:11:21] have one comment. So anyone [1:11:23] from the team, if you don't [1:11:24] mind coming forward and [1:11:26] speaking to the amendments are [1:11:27] made, what impact side would [1:11:28] have on the good work that you [1:11:29] have done? And I'm just [1:11:31] sharing your thoughts. Yeah. [1:11:34] Hi. Thank you. Molly did the [1:11:35] same licensing consumer [1:11:36] protection. I'm so getting a [1:11:40] switch U.S. Yeah, great [1:11:41] question. I think that we had [1:11:43] included this provision in the [1:11:45] bill with some hopes that [1:11:46] there was an additional [1:11:49] opportunities for [1:11:50] entertainment businesses with [1:11:51] some hopes that it would [1:11:52] release some of the pressure [1:11:54] that we see particularly in [1:11:56] downtown during that time when [1:11:58] all bars and entertainment [1:12:00] business is let out and what [1:12:03] we've seen down there is, you [1:12:04] know, increase issues with [1:12:07] safety and violence during [1:12:09] that time. And so, you know, I [1:12:10] dent acknowledging that that [1:12:12] is the key area where we [1:12:13] thought this provide some [1:12:13] benefit. I think we're happy [1:12:17] to come back. It's this [1:12:19] amendment passes to come back [1:12:21] and see if right for smaller, [1:12:23] localized pilot at a later [1:12:25] time. Thank you so much, [1:12:28] Molly. I want to share that. I [1:12:29] want to thank them all deeply [1:12:31] Shane Erica Rogers. Abby, how [1:12:32] is France last name [1:12:36] incorrectly sa Correct on [1:12:37] Kellie Abrams. Rivers Sheila [1:12:39] cannot be from district 6 and [1:12:41] so many others for the work [1:12:42] that you've done over the last [1:12:46] year, maybe even longer on [1:12:47] this on my support, [1:12:48] Councilmember Torres is [1:12:48] amendment. I think it makes [1:12:49] sense and look forward to [1:12:51] working collaboration with the [1:12:54] advisory group as well as my [1:12:55] colleagues on pilots. That [1:12:55] makes sense within the [1:12:56] districts where the greatest [1:12:57] impact. Thank you, MADAM [1:12:58] PRESIDENT, thank you. [1:12:59] Councilmember parity. He I [1:13:01] just also want to smell quick [1:13:02] question. Whoever from deal [1:13:11] safety? Thank you. I because I [1:13:13] think this it's been a subject [1:13:16] to some degree of public [1:13:17] attention MAY be no one really [1:13:18] has a licensing deal. There's [1:13:18] been a little bit of media and [1:13:19] all that. Could you take us 2 [1:13:20] steps back and explain the [1:13:23] rationale. That's the [1:13:26] rationale of before provision [1:13:28] would sort of release the [1:13:32] pressure. People leaving. Yes. [1:13:36] So what we is when liquor [1:13:37] services required to end it to [1:13:40] lot of the bars we'll do or [1:13:42] their last call around one 31, [1:13:42] 45. And then everybody leaves [1:13:46] the far-right it too. So what [1:13:47] that result in is kind of [1:13:51] competition of resources for [1:13:52] that ride home to find some [1:13:55] food. People are at kind of [1:13:57] there. He can talk staycations [1:13:58] and so they run into each [1:13:58] other funds into each other [1:13:59] and there and ends up being [1:14:02] some fights. And so what we're [1:14:03] hoping is that, you know, if [1:14:05] some bars would stay up until [1:14:07] 2.30, in all cases, liquor [1:14:08] service was still required to [1:14:11] end at 02:00am. So what was [1:14:11] all that was going to be [1:14:14] extended was not any drinking [1:14:17] times, but just the additional [1:14:18] and hours of entertainment. If [1:14:21] some bars allowed people to [1:14:22] stay on keep dancing or, you [1:14:24] know, having some more [1:14:26] entertainment potentially [1:14:27] provide some options that [1:14:30] didn't include alcohol service [1:14:31] that that would stagger the [1:14:33] number of people in the time [1:14:34] since they're leaving and [1:14:35] reduce some of the incidents [1:14:37] of violence that we see. That [1:14:38] was the safety reason. I think [1:14:40] there are some other, you [1:14:42] know, beneficial reasons far [1:14:44] as far as you know, providing [1:14:45] additional entertainment [1:14:48] options and things like that [1:14:50] that I contribute to you know, [1:14:51] a thriving nightlife. But that [1:14:54] does with the key safety [1:14:54] reasons. So it was not a [1:14:55] change to alcohol service was [1:14:58] still in it, too. But then the [1:15:00] difference would be doors [1:15:01] closing on call service when [1:15:03] ended exact same time. So [1:15:05] create sort of a period where [1:15:06] hopefully people would leave [1:15:07] in waves instead of all at [1:15:08] once per Are you basing off of [1:15:09] other cities? Studies or where [1:15:13] did that idea? Come from there [1:15:15] isn't a lot of data around [1:15:17] other cities that have tried [1:15:19] this where they extend just [1:15:20] the entertainment and not the [1:15:22] drinking hours. There is some [1:15:23] data, although that also is [1:15:25] limited. But there is some [1:15:27] data that around when you [1:15:30] extend the drinking or looks [1:15:31] cities that have, you know, [1:15:35] extended hours of bars. That [1:15:37] sometimes sometimes say there [1:15:37] is data that they see [1:15:38] increased violence. And then [1:15:41] there's also data where they [1:15:41] have seen, you know, a [1:15:42] reduction in violence. So I [1:15:44] think there is some [1:15:45] conflicting data as well as [1:15:47] some completing of the data as [1:15:49] far as what we were proposing [1:15:51] with this, which was not to [1:15:53] extend any drinking hours but [1:15:53] only extend the entertainment. [1:15:56] So I think there is [1:15:57] opportunity if we can identify [1:16:01] the right locations, the right [1:16:03] timing all of that where we [1:16:04] can pilot and maybe someone, [1:16:05] you know, I mean, just telling [1:16:06] me that provide some of that [1:16:06] data. But there's really not a [1:16:08] lot out there on this [1:16:10] particular the details that we [1:16:12] were proposing. Okay. I mean, [1:16:14] it does make comments on sense [1:16:14] to me, but is better than [1:16:16] common sense. We all know [1:16:17] that. Do you all have [1:16:19] resources, though, if you were [1:16:20] to pilot this, how will you [1:16:23] will you be able created a [1:16:24] firm that our study that in a [1:16:25] way that everyone can be [1:16:26] confident feel like it's [1:16:30] meaningful, not on a total. [1:16:32] Yeah. I think that exploring [1:16:34] the pilot will give us an [1:16:36] opportunity to have some of [1:16:37] the more those stakeholder [1:16:38] conversations with residents [1:16:39] as well as businesses around [1:16:40] what a pilot could look like [1:16:41] in a way that would work for [1:16:43] them. One thing we didn't know [1:16:44] what this was, which [1:16:46] businesses would want to even [1:16:47] opt into doing something like [1:16:48] So this will give us an [1:16:49] opportunity to craft a in a [1:16:52] way that might we might see [1:16:53] more people act, more [1:16:56] businesses opt into it, but [1:16:58] will partner closely with dpd [1:17:00] the police department the [1:17:02] adoption of a pilot. If that [1:17:02] happens where we can track [1:17:04] some of the safety data look [1:17:05] at, you other pieces that [1:17:08] would be helpful to him. [1:17:09] Absent amendment. Would you [1:17:10] routinely look into that data [1:17:11] anyway to see how it's going [1:17:13] if this was just passed, as [1:17:13] Oh, absolutely, yes. Yeah. I [1:17:17] mean, we were we would be [1:17:19] committed to making sure that, [1:17:20] you know, if there was any [1:17:21] negative consequences of [1:17:23] something like this going [1:17:24] forward, that we would be [1:17:25] tracking and monitoring. And [1:17:26] if it it ended up not going [1:17:27] the way we intended than we [1:17:29] would have been making [1:17:30] adjustments anyway, ok, thank [1:17:31] This bill has been a ton of [1:17:32] work. There's a lot of calls. [1:17:34] And at that we haven't talked [1:17:35] about I want to join everyone [1:17:36] else and just appreciating [1:17:37] that. Thank you so much. My [1:17:40] thank you. MADAM PRESIDENT, [1:17:42] thank you. And thank you. [1:17:44] Council member Torres. I also [1:17:46] am supportive of this [1:17:47] amendment. I think it's a good [1:17:47] compromise to be able to get [1:17:48] to I think the conversation [1:17:52] that we're having right MADAM [1:17:52] Secretary Roll Call an [1:17:53] Amendment 3 to council Bill 0, [1:17:58] 9, to one. Council members of [1:18:06] the dress. I high. Look at can [1:18:10] do is get Harris. Hindsight [1:18:15] passion notice. I parity. So [1:18:18] where tourists I watched I [1:18:22] PRESIDENT Or a mayor, [1:18:22] Campbell, MADAM Secretary, [1:18:23] close the voting and announce [1:18:28] the results. 12 ayes 12 ayes [1:18:31] Amendment 3 to council Bill 0, [1:18:33] 9, 2, 1, has passed [1:18:34] councilmember come or were you [1:18:35] pleased the council still? 26 [1:18:36] Dash 0, 9, to one on the floor [1:18:38] for final consideration as [1:18:41] amended. I move the council [1:18:42] Bill. 0, 9, 2, 1, be placed [1:18:43] upon final consideration to [1:18:47] pass as amended. It has been [1:18:48] moved and seconded comments by [1:18:48] members of Council on Council [1:18:50] Bill 0, 9, 2, 1, as amended [1:18:55] it. Councilmember Luis, not in [1:19:00] the queue. I'm sorry. We have [1:19:02] on the script. My apologies. [1:19:04] Councilmember Hines, thank [1:19:06] you. MADAM PRESIDENT directed [1:19:11] tuition our ask clarifying [1:19:13] question about So I believe [1:19:17] this in our conversations we [1:19:19] had talked about the idea of [1:19:23] optional hearings, a mandatory [1:19:24] hearings. I think we came to a [1:19:27] good spy in that. Leave that [1:19:31] in rulemaking. I do. Want to [1:19:32] just chat about how how we [1:19:35] left the conversation. All [1:19:35] right. Hopefully we're on the [1:19:39] same page that conversation [1:19:44] rulemaking will talk about the [1:19:48] arrow key people consider the [1:19:50] density of licenses and also [1:19:51] the size of the venues of that [1:19:54] whole those licenses. When [1:19:56] considering whether a of a [1:19:59] hearing it is optional or [1:20:00] mandatory So I drive a call [1:20:02] that correctly Yes, I think [1:20:03] we'll have that discussion [1:20:06] during ruling King as far as [1:20:07] whether there should be a did, [1:20:09] you know, criteria around [1:20:10] density and or size of venue [1:20:11] that would require mandatory [1:20:12] hearing. Yeah, I think that [1:20:16] the people who live downtown [1:20:17] are they they love that they [1:20:18] get to live near where all [1:20:21] these other people have to [1:20:23] travel, too. And joy, you [1:20:25] know, and evening and then [1:20:27] travel back away. But I would [1:20:28] also just because of sheer [1:20:31] density of venues, sometimes [1:20:32] that creates additional [1:20:36] conflict just as you know, if [1:20:36] you have 20,000 people all [1:20:37] getting out on the street at [1:20:39] the same time, right at [1:20:42] 02:00am. And don't want to go [1:20:44] home but can stay where they [1:20:44] You know, I just I think it [1:20:47] really makes sense for us to [1:20:53] not just have to opt into [1:20:56] conversations really took Li [1:20:57] downtown. Those conversations [1:21:00] should be norm. Instead of [1:21:02] exception. Thank you, MADAM [1:21:05] PRESIDENT, thank Councilmember [1:21:06] Thank you so much. Council [1:21:09] PRESIDENT. I just wanted to [1:21:10] say some words. I think [1:21:13] there's been a lot of effort [1:21:14] here. I think that we still [1:21:16] have a lot of questions. And I [1:21:17] know there's going to be the [1:21:19] work group, which I appreciate [1:21:20] don't feel comfortable at this [1:21:23] time voting. Yes, because of [1:21:23] the uncertainty and because of [1:21:25] concerns I've heard from the [1:21:27] businesses my district about [1:21:29] the extra liability and what [1:21:29] will reasonable effort look [1:21:31] like? And so all no on this [1:21:34] tonight. Thank you. Thank you. [1:21:35] Councilmember Sawyer. Thank [1:21:37] you. MADAM PRESIDENT just [1:21:38] wanted to follow up a little [1:21:40] bit on what Councilmember [1:21:42] Hines said. Molly, as you [1:21:45] know, this the piece about the [1:21:48] removing mandatory hearings [1:21:50] has been an issue of concern [1:21:52] for my residents as well. I [1:21:53] really appreciate that. You [1:21:54] guys are going to address this [1:21:58] in rules and I want to ask for [1:21:59] you. I think just want to make [1:22:00] sure that gets on the record [1:22:08] is that you look at context of [1:22:09] the location, right? Because, [1:22:09] for example, when you are in [1:22:11] the middle of Colfax, they're [1:22:15] our single-family homes right [1:22:17] behind rate. That's like the [1:22:18] businesses along Colfax finale [1:22:20] and single-family homes right [1:22:22] behind And so I just what [1:22:23] might be appropriate for [1:22:25] downtown where we don't have [1:22:25] any single family homes and we [1:22:28] don't have children trying to [1:22:30] sleep what is appropriate on [1:22:31] Colfax are I think going to be [1:22:32] different. And the reason why [1:22:34] I care about this is and why [1:22:36] my residents care about this [1:22:39] is because if there's an [1:22:40] automatic approval, if there's [1:22:44] no required hearing or might, [1:22:46] you know, volunteer residents [1:22:50] have to request a hearing. It [1:22:52] puts the onus on the victim [1:22:54] rate to be aware of it to make [1:22:54] the request that there be a [1:22:55] hearing to gather all the [1:22:56] signatures to do all the work, [1:23:00] which is not fair to them. And [1:23:02] that's part of the process [1:23:03] that already exists and has [1:23:05] already problematic. But I [1:23:07] will just say kind of as we [1:23:09] move forward with the idea [1:23:13] having some automatic [1:23:15] licensure without required [1:23:17] that there be something in [1:23:17] rules and regs that makes [1:23:20] takes the kind of context into [1:23:21] account because I think that [1:23:24] it will be really important as [1:23:28] we look at the impact some of [1:23:29] businesses their distance just [1:23:30] from where people literally [1:23:30] trying to sleep, even if it's [1:23:34] 02:00am, Thanks. Thank you. [1:23:36] Councilmember Watson, thank [1:23:37] you. Council PRESIDENT Over [1:23:38] getting close to 5 o'clock [1:23:40] slimming to be very quick. I [1:23:42] want to say thank you so much, [1:23:42] Molly. A team I I thank you [1:23:45] during the amendment. I don't [1:23:49] know folks fully understand [1:23:49] crazy as h# [1:23:49] # [1:23:49] # [1:23:53] steps and [1:23:56] processes. The multi lies [1:23:56] ensures was I got was legal [1:24:00] language I use there. The [1:24:01] multiple licensors that you we [1:24:05] have and 10's of licenses for [1:24:10] the exact same process. The [1:24:10] idea that your team survived [1:24:13] through that and small [1:24:14] businesses taught themselves [1:24:16] how to walk through stuff. [1:24:19] There's written in 1920, some [1:24:21] even earlier. So I want to [1:24:22] thank team for to due [1:24:23] diligence or great work in [1:24:25] really making this complex [1:24:29] much more simple. I appreciate [1:24:29] the amendment from my [1:24:30] colleagues and I look forward [1:24:33] to partnering with you the [1:24:33] pilot any of the other [1:24:36] work that you're doing. That [1:24:38] impacts of 5 points on the our [1:24:40] district and any of the on the [1:24:40] entertainment district in my [1:24:41] district. Thank you so much. [1:24:42] Thank you. MADAM PRESIDENT, [1:24:43] thank you. Councilmember Luis, [1:24:46] thank you all. Keep it brief. [1:24:48] I just wanted thank you all [1:24:50] because and at the beginning [1:24:51] of this conversation back in [1:24:52] APRIL, I had a number of [1:24:53] businesses reached out to me [1:24:54] and had a sign-on letter. As [1:24:58] you all know in opposition and [1:25:00] you all work with him directly [1:25:01] and got into a place of [1:25:02] support. And I just wanted to [1:25:03] thank you all for working with [1:25:04] our businesses to bring them [1:25:06] to a space where they felt [1:25:07] like this is going to help [1:25:10] them and not hurt them. So [1:25:14] thank you for your work thank [1:25:16] you. I in support of this [1:25:16] tonight. Appreciate the work [1:25:20] that you've done on And also [1:25:23] we delayed this to be able [1:25:25] provide an opportunity for me [1:25:27] to well for be had. And it [1:25:27] provided opportunity that I [1:25:30] was able to communicate again [1:25:32] with residents in and in the [1:25:34] district. I think that there [1:25:35] are some really key things in [1:25:36] here about prohibiting [1:25:38] weapons, keeping records to [1:25:40] conduct a safety [1:25:42] investigations and also [1:25:44] protecting workers. Privacy, [1:25:45] ensuring businesses haven't [1:25:48] execute safety and security [1:25:49] plans that are approved by [1:25:52] your office. And then overall [1:25:53] increased accountability of [1:25:53] managers through the [1:25:55] background checks. Those are [1:25:59] real, big key things that were [1:25:59] that. I just appreciate that [1:26:00] you've worked on. So thank you [1:26:04] to you and your team. [1:26:06] Comments. Excuse me.
