[0:04] We were messing around one day and one [0:06] of the girls at work her husband was [0:14] in college. [0:31] Hang on. [0:50] » It's a queen. [1:14] » [clears throat] [1:14] >> Thank you for coming tonight. Um, I'd [1:16] » Thank you for coming tonight. Um, I'd [1:16] like to ask you to silence your phones [1:18] and join us for an invocation and then [1:20] the pledge. [1:23] Stephanie, would you offer our [1:25] invocation tonight? [1:26] >> Sure. [1:26] » Sure. [1:26] >> Heavenly Father, we just come to you [1:28] » Heavenly Father, we just come to you [1:28] this evening and we just ask for your [1:30] grace and your provision. We just ask [1:33] that you help us with making decisions [1:35] uh that is best for the community and we [1:38] just ask for your peace and we thank you [1:40] for this weather that we're having. We [1:42] just ask that you cool it down just a [1:43] little bit. And uh yeah, thanks Lord. [1:47] And we pray these things in your [1:48] precious name. Amen. [1:49] >> Amen. [1:50] » Amen. [1:50] >> Please join me in the pledge. I pledge [1:52] » Please join me in the pledge. I pledge [1:52] allegiance to the flag of the United [1:55] States of America and to the republic [1:57] for which it stands, one nation under [2:00] God, indivisible, with liberty and [2:03] justice for all. [2:12] » All right, the next item on the agenda [2:14] is items of community interest. Um, I [2:17] don't think there's a lot of big [2:18] [snorts] events this month. If I'm other [2:21] than school starting, if you guys think [2:23] of anything, does anybody in the public [2:24] have a meet um item they'd like for us [2:27] to know about? [2:29] If not, then we're going to move on to [2:30] the city manager report. [2:33] >> This is mostly good news for the week. [2:35] » This is mostly good news for the week. [2:35] Uh, the bid came in on the rock and [2:38] draining project well below the [2:39] engineers estimate and we will be [2:42] awarding that project at the next [2:43] meeting. The estimate within the $2 [2:46] million range and the base bid was [2:48] alternative bids. All came in at [2:50] a,ion300,000 [2:52] uh and change. The lowest bidder was [2:54] wall contractor LLC from Denton. They're [2:58] highly recommended company. We look [2:59] forward to working with them. As you [3:01] would will recall, we are self-funding [3:04] this project with Surface Funds. This is [3:07] uh the project that we're doing uh the [3:09] resolution [3:11] 2026-23 [3:13] for financing. If we'd need to borrow [3:15] money for this project, I don't think we [3:18] will, but better safe than sorry. And [3:20] this was recommended by Governor [3:22] Capital, our financial advisors. The low [3:25] bidder for the Glenn Hills Lift Station, [3:27] which you're voting on tonight, is Venus [3:29] Construction Company. Their bid was of [3:32] $800,299.79, [3:36] was $400,000 lower than the previous bid [3:39] that we had. Initially, we bid out the [3:42] project before we had a clear easement [3:43] to build the lift station. So that the [3:45] project had to be rebid because of the [3:48] amount of time it took to get get the [3:50] easement. It turns out that we will save [3:52] around $400,000. [3:54] This project is being funded by alone [3:56] with the Texas Water Development Board. [3:59] Uh if you recall, the legislature passed [4:02] the bill that requires we have a [4:03] wildfireification plan in place by [4:06] January 2027. [4:10] uh which is this coming January. We g [4:12] the information uh that the cost of the [4:14] wildfire mitigation plan and utility [4:17] pole inspection plan would both cost [4:19] around $200,000 to have professional [4:22] engineers write the plans for us. Javis [4:25] Kirk Higgins uh met with a company to do [4:28] the pole inspection for us and we'll be [4:30] able to write a plan that should work. [4:33] However, we con were concerned with the [4:36] wirefire mitigation plan would be very [4:39] difficult for us to figure out what the [4:41] PUC wanted as a plan because they had [4:44] not given anyone a template for what [4:46] they wanted. Uh at the TPPA meeting last [4:50] month, I let the head of the PUC know [4:52] that smaller utilities like us were [4:55] having problem financing the plant [4:56] because we did not have the financial [4:59] resources that larger utilities have. [5:02] Right. After I spoke, a couple of people [5:04] who work for Impact Engineering [5:06] approached me and said that they could [5:08] do a wildfireification [5:10] plan at a reasonable cost. Two gentlemen [5:13] from Impact came week before last and [5:17] told us about their process and we've [5:19] decided to work with them to put the [5:20] plan together at a much lower cost than [5:22] we initially thought. We should have a [5:25] mitigation plan well before the date [5:27] will outline in January. [5:29] >> Any questions? So that 200,000 estimate [5:33] » Any questions? So that 200,000 estimate [5:33] is that for the pole inspection and the [5:36] plan together? [5:37] >> Yeah, that's what I put in the budget [5:38] » Yeah, that's what I put in the budget [5:38] for those things both together. So it [5:41] looks like we're going to come out on [5:42] the good on that. [5:43] >> Is that the I mean what what is the I [5:45] » Is that the I mean what what is the I [5:45] mean what are they looking for? I guess [5:47] you don't really know. [5:48] >> We really don't know. Uh you just pretty [5:51] » We really don't know. Uh you just pretty [5:51] much have and see if they'll approve. [5:54] >> Wow. [5:56] » Wow. [5:56] >> Yeah, that's what we say too. Wow. [6:01] Any other questions? [6:05] » All right. Well, let's move on to the [6:06] public hearing which is for the [6:08] municipal budget. We are going to open [6:11] the public hearing at [6:14] 605 [6:20] and Bart is going to present the [6:23] the budget. Council members, you have [6:25] budget in your packet. [6:28] So would you mind presenting it to the [6:30] council and the public? [6:31] >> And a quick overview of the budget. You [6:33] » And a quick overview of the budget. You [6:33] all have a copy of it. Should have u the [6:37] utility fund will have revenue of [6:41] 13,50,90. [6:44] Uh we budgeted for expenses 13,9,000 [6:50] 50 which will leave us a surplus of [6:53] balance in the utility fund of $41,037. [6:58] The general fund revenue should be [7:01] around 13 million71,861. [7:06] Uh expenses in the general fund uh will [7:10] be in the vicinity of uh 13,278,431 [7:17] uh which will give us a $423,430 [7:21] surplus. The total surplus for both [7:24] revenue and general fund will be [7:26] $464,467. [7:29] Hopefully the majority of that surplus [7:32] we'll use on the rocking pillar along [7:34] with some other surplus fund. Uh the tax [7:38] rate uh is budgeted at 0.575 per $100 [7:43] valuation which will bring us in [7:45] 2,990,988. [7:49] Uh the certified values this year were [7:52] 520,71,84. [7:58] Any questions? [8:01] the [8:04] [snorts] [8:06] departmental contract services, they [8:07] went down quite a bit. [8:08] >> Yeah. [8:09] » Yeah. [8:09] >> From last iteration to this one. [8:11] » From last iteration to this one. [8:11] >> That was that was a mistake I made when [8:13] » That was that was a mistake I made when [8:13] I was doing the budget. I left revenue [8:15] of $200,000 out of the [8:20] general fund, uh, which, uh, I shouldn't [8:24] have left out because we're spending [8:25] that money on Rocket Pillar. [8:28] We're using surplus funds. So, messed it [8:31] up. So, I had to move numbering around. [8:33] So, [8:34] >> I mean, it looks like [8:35] » I mean, it looks like [8:35] >> I fixed it before we did the budget. So, [8:37] » I fixed it before we did the budget. So, [8:37] >> it brings it in line with what we've [8:40] » it brings it in line with what we've [8:40] been actually spending. [8:42] >> Yeah. [8:43] » Yeah. [8:43] >> So, [8:46] » So, [8:46] [clears throat] [8:48] >> so I want I want the public to be aware [8:49] » so I want I want the public to be aware [8:49] that this budget is online. If you want [8:52] to go through it [clears throat] [8:54] at home, your phone, wherever. If [8:56] anybody wants a copy of it, give me your [8:58] email address and I'll send you a copy [9:00] of it. [9:06] » So, did anybody have any I'm assuming [9:08] you all went all over it. So, if anybody [9:11] had any questions [9:13] >> or are we going with the [9:16] » or are we going with the [9:16] contingency for the health insurance? Is [9:19] that going to be more most in line? I [9:21] sent y'all an email this week about what [9:25] our insurance advisory company said. [9:28] They're still battling with Blue Cross [9:30] Blue Shield. There was I think five or [9:34] six companies that turned down uh our [9:38] policies because of basically you could [9:41] call it the experience rate. uh we have [9:44] uh some sick people or a lot of claims, [9:49] let's put it like that. And so they're [9:52] trying to negotiate with Blue Cross Blue [9:55] Shield and they still don't have us a [9:57] solid number yet. That's why I left that [10:00] contingency in there. [10:03] >> Does the public have any questions? [10:09] council. [10:13] » Okay. Well, I'm about to close the [10:14] public hearing. [10:17] So, if that's the case, then we'll close [10:19] the public hearing at 609. [10:22] [snorts] [10:24] Now, we'll open the podium to public [10:26] comments if anybody has any. [10:30] Um, I ask you to go to the podium and [10:32] state your name. And if Barbara needs [10:35] you to spell it, [10:41] My name is uh Isaiah Durr. [10:45] >> You want to spell that last name? [10:46] » You want to spell that last name? [10:46] >> Uh Durr. D E R R. [10:52] » So [10:54] am I. Good to [10:55] >> go ahead. [10:56] » go ahead. [10:56] >> Okay. Uh, members of the council and [10:58] » Okay. Uh, members of the council and [10:58] citizens of Buouie, I'm Isaiah Durr and [11:00] I'd like to publicly oppose the idea of [11:02] having automatic license plate reader [11:04] cameras or ALPRs, otherwise known as [11:07] flock cameras in our town. In this day [11:09] and age, we live in a uh constant [11:11] surveillance state with our smartphones [11:13] containing age verification, facial [11:15] recognition, web cookies, ad tracking, [11:17] and thumbrint scanning. It's no secret [11:19] that online scr uh security should [11:21] always be our priority. So, why are we [11:23] not embracing further? So, why are we [11:25] embracing a further breach of our [11:27] privacy? A LPRs have been reported to [11:29] identify your Bluetooth chips, uh, track [11:32] your individual phone, not just your [11:33] plate number, and have been reported to [11:35] pick up residential conversations [11:37] despite flocks claim that they are [11:38] unable to do so. Some ALPR, such as the [11:41] Flock Commodore, have been proven to [11:42] physically track humans in their phone [11:44] screens. The argument can be made that [11:46] there is no expectation of privacy on [11:48] public roadways but with devices like [11:50] the flock drone and flock condor. How [11:52] are we to feel safe in the fact that our [11:53] residential privacy is not in jeopardy? [11:55] In addition to this, there have been [11:57] several reports of officers of the law [11:59] misusing ALPRs for personal use or [12:01] failing to use these tools for what they [12:03] intended to do. The statistics for [12:05] violent crimes being solved with ALPRs [12:07] is shockingly low. and in an area with [12:08] such a low crime rate, I failed to [12:10] understand what our community would gain [12:11] from the installation. Aside from an [12:14] unnecessary infiltration of our daily [12:16] lives, obviously, I'm not the only [12:17] citizen concerned with this matter. I [12:19] have lived in Buoie my entire life, and [12:20] just like many of you, I contribute to [12:22] the local economy, and my taxes benefit [12:24] our local systems, just like many of [12:26] you. The petition to have ALPR's banned [12:28] in our city is nearing the required [12:29] amount of signatures. And I implore you, [12:31] my neighbors and friends, to consider [12:32] adding your name to stand up for the [12:34] privacy and safety of our people. Thank [12:36] you for your time. [12:37] >> Thank you. Thank you. [12:42] » Anybody else? [12:45] >> Oh gosh. [12:49] » Uh, good evening, ladies and gentlemen. [12:50] My name is Wes Stell. I've lived here in [12:52] town uh I guess jeez since 1973. [12:56] Uh, grandpa bought the shop, dad run it. [12:59] I got to run it for a while. Um, as far [13:02] as the flock cameras go, uh, I somewhat [13:06] do agree with the young man. The [13:08] residential privacy, especially in a [13:10] town like this, is very important to a [13:12] lot of us. That's why we've moved here. [13:13] That's why we like living in a small [13:14] town like this. Everybody knows [13:16] everybody. It's kind of a secure place. [13:18] It's safe for all of us. Um, the flock [13:21] cameras being in town, I am [13:25] somewhat opposed to that. However, on [13:28] the other side of that coin, I would [13:30] like to point out that down in [13:31] Jacksboro, they've got a lot of flock [13:33] cameras set up at the city limits and [13:36] they have really cleaned up Jacksboro. [13:38] They really have. Um, they've gotten a [13:41] lot of drug busts. They've gotten a lot [13:43] of arrests and anybody that's lived here [13:45] in this town knows, [13:46] [clears throat and cough] [13:47] excuse me, knows that we have had a lot [13:50] of problems with drugs in this town. I [13:53] for one have been a victim of that in [13:55] the 90s. Admittedly, if they had had [13:58] flock cameras back then, I'm sure I [14:00] would have gotten in a lot more trouble. [14:02] And it's hard for me to admit that in [14:03] front of everybody, but I'm 50. I guess [14:05] it's time. But [14:08] I would feel remiss if I saw flock [14:11] cameras right downtown. [14:14] I [14:16] admittedly it is a major intersection [14:18] where the highways come through, but I [14:20] feel like if we had the perimeter like [14:22] they do in Jacksboro and have the flock [14:25] cameras set up. If somebody left town, [14:28] say one of your family members left [14:30] town, they would be able to know, well, [14:31] they left Buoie at such a time they got [14:33] through Decada, they got through Fort [14:35] Worth, they left Fort Worth, they got [14:36] through Decada, but they haven't made it [14:38] home. I can understand how it's a very [14:41] effective tool to help with the public. [14:44] But again, as I'm trying to play devil's [14:46] advocate, on the other side of the coin, [14:48] there are have been several internet [14:51] reports, nothing that I've seen [14:53] personally, but you always read and you [14:55] always see that uh some officers have [14:58] used the flock cameras uh incorrectly. [15:01] And I'm not saying that our police [15:03] would. I'm saying that maybe a license [15:06] plate reader might read a license plate [15:07] number wrong or things like that. But [15:10] these are the things that [15:13] we as the public and we as the world are [15:15] having to deal with now with the way [15:16] technology is. [15:18] I [15:21] want to let you guys know that I [15:22] somewhat I I I really oppose the flock [15:24] cameras being in town. I don't know if [15:26] we really need them. You know, [15:30] I don't know if I need to get flocked [15:32] running to Brook showers to grab a [15:33] bottle of milk or not. But if I'm going [15:35] to Fort Worth and I get caught on a [15:37] flock camera and I don't make it back [15:39] home, that flock camera might help to [15:41] protect me. It's a slippery slope and I [15:45] would advi I'm here to say that I would [15:46] like to advise the city council and the [15:49] public, all of us, to look at this with [15:53] an open mind and try [15:57] to work together. if the public doesn't [15:59] want it in town, [16:02] if that's what the resol because they're [16:03] doing the uh they're they've got the [16:05] thing where you can sign up now. Uh and [16:10] >> if you want to sign up, I'm taking too [16:12] » if you want to sign up, I'm taking too [16:12] long. I'm sorry I ramble. Anyway, thank [16:13] you for your time. Uh and y'all have a [16:17] good evening. [16:17] >> Thank you. [16:18] » Thank you. [16:18] >> I ramble. I'm sorry. [16:24] » Anybody else? [16:27] All right. Well, let's um move on from [16:30] public comments. Let's go to the consent [16:32] agenda items. In your packet, you had [16:34] the meeting minutes from both the [16:37] workshop and the regular meeting [16:40] on the 28th. [16:44] So, I would entertain a motion to accept [16:46] the agenda items uh the consent agenda [16:49] items as presented. So, move second. [16:54] >> Post [16:56] » Post [16:56] second. [17:00] Holstein. [17:02] >> Hi, [17:03] » Hi, [17:03] >> Sprouls. [17:03] » Sprouls. [17:03] >> Hi, [17:04] » Hi, [17:04] >> Post. [17:05] » Post. [17:05] >> Hi, [17:05] » Hi, [17:05] >> Mcuan. [17:06] » Mcuan. [17:06] >> Hi, [17:07] » Hi, [17:07] >> Trux. [17:07] » Trux. [17:07] >> Hi, [17:08] » Hi, [17:08] >> and Shaw. [17:08] » and Shaw. [17:08] >> Hi. [17:09] » Hi. [17:09] >> Thank you. [17:15] Next item on the agenda is [17:18] the discussion of the proposed 2026 27 [17:23] budget for the Buoie Economic [17:26] Development Corporation and the Buoie 4B [17:28] sales tax of which we'll start with the [17:30] Buoie Economic [17:32] Corporation. [17:39] Good evening, council. I'm Carlos [17:41] Swaford. I'm president of the 4A board. [17:44] In your packet, you have two pages of [17:48] our budget, which is an expenditure [17:50] budget. First page, all the line items [17:54] you'll see are very close to last year's [17:57] amounts. There's been very little [17:59] changes. Um, the insurance is, [18:04] as Bert was saying, we don't know for [18:06] sure what ours is going to be either. [18:08] So, we've just plugged in a flat fee, [18:12] but other than that, it's very close to [18:15] what our expenses run. And again, with [18:19] very little change over last year. On [18:22] page two, you'll see that our [18:23] expenditures are 2.2 million. Sounds [18:27] like a lot of money, [18:29] >> but when you work under business [18:30] » but when you work under business [18:30] expansion and recruitment. You see that [18:33] most of that money is going to finish [18:36] our spec building in the industrial park [18:39] and um we always try to have money left [18:43] over for small projects that might come [18:46] up during the year. But the big [18:49] expenditure for our year is finishing [18:51] that spec building and hopefully getting [18:54] a a lease or a renter or get it sold. [18:59] Anybody have any questions on anything [19:02] you've seen? [19:05] » What buildings are covered in your [19:07] building maintenance? Is it just the [19:08] office across the street? [19:10] >> Well, no. I mean, we own the we call it [19:14] » Well, no. I mean, we own the we call it [19:14] the big green giant building out on 81 [19:17] where the waste management company is. [19:20] Even though their lease they take care [19:21] of most of little maintenance, but [19:24] [clears throat] this last year we did [19:25] have to do some work on the loading [19:27] dock. So, we do have expenses that come [19:30] up. [19:30] >> We also own the building um [19:35] » We also own the building um [19:35] that's Montg Street, Sanders Street. Um [19:40] the I call it the old dress factory, but [19:43] most of you are not as old as I am, so [19:45] you know it as something differently. [19:48] But, uh we own that building and we've [19:50] had some expense with it. We've had to [19:52] do some roof repair that insurance [19:54] didn't cover. replace a couple broken [19:57] windows, you know, that kind of thing. [19:59] And then, of course, we have maintenance [20:01] on our office building. [20:06] Anything else? [20:08] Any other questions? [20:11] » Thank you, Mr. Sford. [20:18] » All right, let's go ahead and and hear [20:19] the 4B sales tax corporation. [20:23] [clears throat] [20:24] >> Good evening. I'm Wallace representing [20:27] » Good evening. I'm Wallace representing [20:27] the 4B. Uh you also have our budget with [20:30] you about two pages there. Overall, I [20:33] know uh pretty much our expenses we [20:37] budgeted a decline of about 8% and our [20:40] revenues are approximately the same. So [20:46] really, we've got a couple of projects [20:47] that we're finishing the project uh out [20:50] by the pickle ball court. We've got uh [20:53] playground equipment, covered playground [20:56] area, and we're in the process of [20:58] working on some other stuff out there to [21:00] improve the park system and make it a [21:03] lot better for our citizens. [21:07] » It's fantastic. Any questions? [21:11] >> I know, council. [21:13] » I know, council. [21:13] >> Thank you. [21:14] » Thank you. [21:14] >> I like I love the length of your budget. We rebid it. It came in [27:43] $400,000 cheaper than what the initial [27:46] bid was. And [27:47] >> Sounds great. [27:48] » Sounds great. [27:48] >> Well, and the reason it happened is is [27:51] » Well, and the reason it happened is is [27:51] when we bid it before, we were coming [27:53] out of the COVID era and and the [27:55] government money was flowing and [27:58] everybody was busy and now they're not [28:00] so busy and they're kind of hungry. So, [28:01] we get better pricing. So, [28:05] >> that's basically what it is. [28:06] » that's basically what it is. [28:39] a resolution expressing the city [28:42] council's intent to place a proposal on [28:44] a future council agenda approving a [28:47] property tax rate in accordance with the [28:49] Texas property tax reform and [28:51] transparency act of 2019 scheduling one [28:55] public tax rate hearing and establishing [28:57] the date to vote on same [29:03] does everybody understand that [29:05] >> yes [29:06] » yes [29:06] >> so the the tax rate will go on the next [29:09] » so the the tax rate will go on the next [29:09] agenda [29:09] the next agenda on it. Yeah, the next [29:11] agenda. [29:13] >> Um, it was presented tonight to you as [29:15] » Um, it was presented tonight to you as [29:15] 575. So, the one we have, [29:31] this resolution that we have is not [29:34] says 09.59. [29:40] should be [29:40] >> no the budget that was presented tonight [29:42] » no the budget that was presented tonight [29:42] >> the budget has this one but this [29:44] » the budget has this one but this [29:44] >> right but the [29:44] » right but the [29:44] >> the resolution we're looking at [29:46] » the resolution we're looking at [29:46] >> the resolution will be presented at the [29:48] » the resolution will be presented at the [29:48] next meeting with the tax rate [29:49] >> so gotcha you just want to schedule [29:51] » so gotcha you just want to schedule [29:51] something [29:51] >> yes [29:52] » yes [29:52] >> got it so moved [29:53] » got it so moved [29:53] >> thank you [29:55] » thank you [29:55] >> Shaw do I have a second [29:58] » Shaw do I have a second [29:58] >> post it true [30:00] » post it true [30:00] >> I [30:01] » I [30:01] >> Shaw [30:01] » Shaw [30:02] >> I [30:02] » I [30:02] >> Sprouls I [30:03] » Sprouls I [30:03] >> Holstein [30:04] » Holstein [30:04] >> I [30:05] » I [30:05] >> muan [30:05] » muan [30:06] >> I [30:06] » I [30:06] >> post [30:08] » post [30:08] Thank you. [30:11] » Next resolution is 202623. A resolution [30:14] of the city council of the city of [30:15] Buouie, state of Texas, declaring the [30:17] intention of said city of Buoie to [30:19] reimburse itself from the proceeds of [30:21] one or more taxexempt financings for [30:24] certain expenditures to be made in [30:26] connection with the rock and bridge [30:27] street. As Bert told you earlier, this [30:29] gives us the option to borrow money [30:32] should we need to. Although we do have [30:34] it budgeted in our budget. You you saw [30:37] that at the last meeting. So unless [30:39] something goes tremendously wrong, we [30:41] shouldn't need this. But we are covering [30:44] all the legalities for making this [30:46] happen. [30:46] >> This was rec recommended by Government [30:49] » This was rec recommended by Government [30:49] Capital Corporation who is our financial [30:51] advisor. I usually follow them exactly [30:55] what they tell me to do because they're [30:57] pretty bright. [31:00] >> So we're not offering anything or doing [31:01] » So we're not offering anything or doing [31:01] anything at [snorts] this present time. [31:03] This this thing if we got into the [31:07] project and decided we need to borrow [31:09] money, it would kind of be illegal. So, [31:11] this makes it legal for future use. So, [31:14] >> do we need to do that full amount, I [31:17] » do we need to do that full amount, I [31:17] guess, or [31:18] >> you're just you're not doing any amount [31:20] » you're just you're not doing any amount [31:20] at all. You're just saying [31:21] >> just not going to exceed this. [31:22] » just not going to exceed this. [31:22] >> You're just giving yourself the [31:23] » You're just giving yourself the [31:23] opportunity to be able to borrow. [33:15] >> And the Sprouls made the second. [33:17] » And the Sprouls made the second. [33:17] >> Yeah. [33:18] » Yeah. [33:18] >> Um Post. [33:19] » Um Post. [33:20] >> I [33:20] » I [33:20] >> Mcuan. [33:21] » Mcuan. [33:21] >> I [snorts] [33:21] » I [snorts] [33:21] >> Shaw. [33:22] » Shaw. [33:22] >> I [33:23] » I [33:23] >> Truax. Hi, [33:24] » Truax. Hi, [33:24] >> Holstein. [33:25] » Holstein. [33:25] >> Hi. [33:25] » Hi. [33:26] >> And Sprouls. [33:26] » And Sprouls. [33:26] >> Hi. [33:30] » I'm gonna I'm gonna tell you all [33:32] something. Um, when we were in the [33:34] budget workshop, we had proposed in the [33:37] budget 5.9 I mean 0.594. [33:40] >> But when Bert and I were looking at the [33:43] » But when Bert and I were looking at the [33:43] numbers again, we were able to bring [33:44] that down to the 575. So that's why it's [33:47] changed from the workshop. [33:50] >> [clears throat] [33:50] » [clears throat] [33:50] >> So, the second part of this um [snorts] [33:53] » So, the second part of this um [snorts] [33:53] motion is to schedule a public hearing [33:55] for August the 25th, 2026. Do I have a [33:57] motion? [33:59] >> So, moved. [34:00] » So, moved. [34:00] >> Sprouls. [34:02] » Sprouls. [34:02] >> Second. [34:03] » Second. [34:03] >> I um yeah, so moved. [34:05] » I um yeah, so moved. [34:05] >> Holstein. [laughter] [34:07] » Holstein. [laughter] [34:07] >> Jesus. [34:08] » Jesus. [34:08] >> It's okay. [34:09] » It's okay. [34:09] >> Mchuan. [34:10] » Mchuan. [34:10] >> Hi, [34:11] » Hi, [34:11] >> Post. Hi [34:12] » Post. Hi [34:12] >> Sprouls. [34:12] » Sprouls. [34:12] >> Hi [34:13] » Hi [34:13] >> Holstein. [34:14] » Holstein. [34:14] >> Hi [34:15] » Hi [34:15] >> Truax. [34:16] » Truax. [34:16] >> Hi [34:17] » Hi [34:17] >> And Shaw. [34:17] » And Shaw. [34:17] >> Hi. [34:18] » Hi. [34:18] >> Thank you. [34:20] » Thank you. [34:20] >> Couldn't find my words. [34:24] » Couldn't find my words. [34:24] >> All right. So the next item on the [34:25] » All right. So the next item on the [34:25] agenda, this is lengthy. Sorry, but I [34:27] got to read the whole thing. [34:29] >> Um it's resolution 2026 24 resolution of [34:32] » Um it's resolution 2026 24 resolution of [34:32] the city council of the city of Buouie, [34:33] Texas approving a negotiated settlement [34:36] between Atmas City Steering Committee [34:38] ASCS and Atmas Energy Corporation. [34:41] Midtex division regarding the company's [34:43] 2026 rate review mechanism filing [34:46] declaring existing rates to be [34:48] unreasonable. Adopting tariffs that [34:50] reflect rate adjustments consistent with [34:52] the negotiated settlement. Finding the [34:55] rates to be set by the attached [34:57] settlement tariffs to be just and [34:59] reasonable and in the public interest. [35:01] approving an attachment establishing a [35:03] benchmark for pensions and retiree [35:05] medical benefits requiring a company to [35:08] reimburse ACS sees reasonable ratem [35:11] expenses determining that this [35:13] resolution was passed in accordance with [35:15] the requirement of Texas Open Meetings [35:17] Act adopting an a savings clause [35:20] declaring in effective date and [35:21] requiring the delivery of this [35:23] resolution to the company and ACSC's [35:25] legal council. Would you like to [35:27] approach? [35:29] [laughter] [35:32] U first I want to apologize for being [35:34] late. I was at another city council [35:36] meeting. So thank you so much Sandy for [35:38] putting me at the end. I have documents [35:40] if y'all want to see them but I mean [35:43] feel free. Anyway, um I just I I'll be [35:46] really brief first. I I just I wanted to [35:48] inform the public that because uh your [35:52] city council has chosen to be a part of [35:54] the ACSC coalition. Um the rate for [35:57] their attorney is rolled into the rate [35:59] that's passed on and that rate is still [36:01] much lower than what your rate would be [36:04] if they weren't a member. So they're [36:06] very conscientious about trying to do [36:08] what's best for the community, all the [36:10] residents and commercial customers and [36:12] of Atmas Energy. So I just wanted to [36:15] inform them. um on this. I I know that [36:19] Mayor Burus has one, but um I just [36:21] wanted to give you all an update of the [36:23] city profile of how uh Atmas has [36:25] partnered with the city of Buouie. Um we [36:28] we show that we have spent uh 5.8 [36:31] million and plus dollars in capital [36:34] expenditures within the city limits in [36:36] the last five years with uh 2.2 million [36:40] just last year. Um, that's for [36:43] replacements, for repairs, for new new [36:46] pipe in the ground, unfortunately, gas [36:48] leaks that have to be, it's [36:50] all-encompassing. [36:51] So, um, and, um, we have 1,774 [36:56] customers that you are helping to save [36:58] funding for. So, thank you for that. Um, [37:01] we have roughly 22 employees that live [37:04] within a radius of 30 miles of Buoie, if [37:07] not within the city limits. So we we do [37:10] that because we want our employees to be [37:13] invested in the communities, not just as [37:15] an employee, but as somebody who pays [37:17] taxes and has their kids go to the [37:19] school and eat in the restaurants. And [37:21] so um the very last um piece of [37:24] information that's important is in the [37:27] past year, um Atmas has contributed [37:30] $274,000 [37:31] in donations that have uh directly [37:34] impacted Monte County in one way or [37:37] another. Um 50% of that is for energy [37:40] assistance though. So if you have a [37:42] resident who is in need of services, you [37:45] know, they have a leak on their side of [37:47] the meter and they've lived in that [37:48] house for 50 years and they just don't [37:50] have it in their budget to pay for it. [37:52] Um that money goes to helping citizens [37:55] like that and I have my contact [37:57] information on the bottom because people [37:59] just don't want my card anymore. So, if [38:02] you happen to have any questions or [38:04] somebody asks you something and you want [38:07] to know more about things like the [38:08] energy assistance, please feel free to [38:10] call me. On the back page, it does talk [38:13] about rates here, but you received the [38:14] big packet. Um, the back page is 811 [38:18] because today's National 811 day. So, I [38:21] just wanted to plug in to remind people [38:23] to call 811 before they dig so they're [38:25] not cutting our lines because if they're [38:26] cutting our lines, they're cutting your [38:28] lines. And everybody pays a price. And [38:30] the most important thing is that we just [38:32] want people to be safe. So, um, does do [38:35] y'all have any questions for me? [38:39] >> When you're looking at your capital [38:41] » When you're looking at your capital [38:41] expenditures here on this, is that [38:44] >> for our area? [38:45] » for our area? [38:45] >> It's within the city limits of Buouie, [38:47] » It's within the city limits of Buouie, [38:47] Texas. [38:47] >> That's a lot. [38:48] » That's a lot. [38:48] >> It Yes, sir. But we do have some older [38:51] » It Yes, sir. But we do have some older [38:51] infrastructure that we're trying to [38:52] replace because we want to be safe. You [38:54] know, we want all of our piping to be [38:56] safe in all of throughout our community. [38:58] So little bits at a time, we're we're [39:00] eating that elephant and and trying to [39:02] go back in and put poly where old pipe [39:05] might be. And you see the pie chart, it [39:07] shows you coated steel, very good pipe, [39:11] uh plastic, very good. That bare steel [39:13] is what we'll be continuing to replace. [39:15] And there's 8% steel left in the [39:17] community. [39:22] » Yes, sir. [39:23] >> Is this request for consumption or is it [39:36] Yes, sir. [39:40] » Um, it's it's just the rate that the [39:43] railroad commission deems reasonable for [39:45] reimbursement per customer. [39:48] $1,200. [39:58] » If you were to contact uh customer [40:00] service, we could see what we can do [40:02] about reducing. [40:04] >> Oh, dang. Okay. [laughter] [40:07] » Oh, dang. Okay. [laughter] [40:07] Yes, sir. [40:11] » Yes, sir. Yes, sir. cheaper. [40:17] » I know that commercial customers pay a [40:19] higher rate than residents do. [40:23] >> Wow. [40:26] » Um I I also want Boy, you haven't been [40:30] here very long, but this is something [40:32] that we do every single year. and the [40:34] group that does the negotiating for us. [40:38] I know that they do negotiate a rate for [40:40] the city of Buouie citizens because I [40:42] also have a home on the outside of the [40:44] city limits and there's considerable [40:45] difference. So, it is a good savings for [40:48] our residents. [40:52] Any other questions? [40:55] Pamela, thank you very much. [40:56] >> Thank you so much. Thank you. [40:57] » Thank you so much. Thank you. [40:57] >> We appreciate it. Do you have to make [40:59] » We appreciate it. Do you have to make [40:59] another city council meeting tonight? [41:00] >> No, [laughter] it was no Kona. That [41:02] » No, [laughter] it was no Kona. That [41:02] never happens. No, Conan and Buoie had [41:04] the same night. So, [41:07] >> okay. Well, then um we will take a vote [41:11] » okay. Well, then um we will take a vote [41:11] and I'm not going to reread all that, [41:13] but we will take a vote on resolution [41:14] 2026-24 [41:16] and I would accept a motion to accept as [41:20] presented. [41:22] >> So moved. [41:24] » So moved. [41:24] >> Shaw. How did I not [41:28] second? [41:29] >> Shaw. True X. All right. [41:33] » Shaw. True X. All right. [41:33] Uh Mcuan [41:34] >> I [41:34] » I [41:34] >> Post [41:35] » Post [41:35] >> I [41:35] » I [41:35] >> Sprouls [41:36] » Sprouls [41:36] >> O I [41:37] » O I [41:37] >> Holstein [41:39] » Holstein [41:39] >> O I [41:39] » O I [41:39] >> Trux I [41:40] » Trux I [41:40] >> and Shaw [41:42] » and Shaw [41:42] >> next. [41:43] » next. [41:43] >> All right at this moment we are going to [41:45] » All right at this moment we are going to [41:45] slip off and go into executive session [41:48] at 6:40. Council, please leave your [41:50] phones and anything to write with or [41:53] papers in here. Um and we will slide out [41:56] and we'll just it'll just be the council [42:04] Way to go. [42:07] I don't I don't [1:36:58] Well, we got I got two of them. [1:37:01] >> Okay. [1:37:02] » Okay. [1:37:02] >> 6:42 to 7:35. [1:37:15] » You got cold in here. Just get all those [1:37:17] people out of here. [1:37:22] » Warm it up. [1:37:22] >> Where did everybody go? [1:37:26] » Sometime in the morning when they come [1:37:28] in. [1:37:30] >> Is it cold? [1:37:33] » Is it cold? [1:37:33] >> I know. The girls too. [1:37:36] » I know. The girls too. [1:37:36] >> You know, we used to have those wooden [1:37:37] » You know, we used to have those wooden [1:37:37] things that we prop. [1:37:39] >> I propped them open at one time and then [1:37:42] » I propped them open at one time and then [1:37:42] somebody [1:37:50] No, they went to the bathroom. [1:37:52] >> I told them they couldn't talk anymore [1:37:54] » I told them they couldn't talk anymore [1:37:54] until they got back in here. [1:38:15] Just never know. [1:38:17] [snorts] [1:38:18] >> He's right there. [1:38:27] » It got cold. [1:38:30] >> It was warm. [1:38:31] » It was warm. [1:38:31] >> It was warm. Yes, there is. [1:38:34] » It was warm. Yes, there is. [1:38:34] >> It felt good. It felt good in there. [1:38:37] » It felt good. It felt good in there. [1:38:37] >> Okay, [1:38:38] » Okay, [1:38:38] >> I'm going to call us back to order at [1:38:39] » I'm going to call us back to order at [1:38:39] 7:37 [1:38:42] >> and I'm going to ask the council if they [1:38:43] » and I'm going to ask the council if they [1:38:44] have any action. [1:38:50] All right, no action. Then uh I'm going [1:38:52] to close our meeting tonight at uh 7:38. [1:39:02] Two weeks it won't be as good and you'll [1:39:04] just [1:39:07] sate. [1:39:09] Thank y'all.
