[0:55] Sent agenda, all agenda items listed with the designation of CA are considered to be routine items by the governing body and will be enacted by one motion. [1:02] There will be no separate discussion on these items unless the member of the governing body so requests and support by two other members is received. [1:08] any item removed from the consent agenda will be considered in its normal sequence on the agenda. [1:13] All right, are there any items a member of the governing body would like to remove from the consent agenda? [1:17] Yes, sir. [1:18] Doctor Aldrich. [1:19] I'm here calling 17A and 19C, please. [1:23] Take her one at a time, 17A? [1:25] Yes. [1:26] Concur. [1:30] Okay. [1:31] 17A's been removed and you said 19C is correct. [1:36] Concur. [1:37] Concur. [1:38] All right, those two items have removed are there any others? [1:41] Hearing none, I would entertain a motion. [1:43] So move. [1:45] So it's going to move by Dr. Aldridge. [1:46] Seconded by Mr. Sea Grave. [1:49] All those in favor of the consent agenda as amended, [1:52] please signify by saying aye. [1:53] Aye. [1:53] Those opposed. [1:55] The consent agenda is approved with 17A and 19C removed. [1:59] Number six A, public hearing for a bar and real liquor license application, [2:02] filed with the City Clerk's Office for Frontier Days LLC. [2:05] Doing business as Chiba Hut 3838 at Constreet, [2:08] John Wyoming. All right, we'll open it up to the public. Is there anyone in the public that would like to speak to this bar and girl license for Chebahood? [2:18] No one in the audience? [2:20] Please come forward if you want to speak to us. [2:23] You have to push that button to the green light comes on. [2:28] There you go. Would you introduce yourself, please. [2:30] Hello, my name is Seth Larson. My title is Chief Relationship Officer at Chiba Hut [2:36] toasted subs. I would be a partner on Frontier Days and the location at 3838 at [2:43] Ken Street. I currently reside down in Berthid, Colorado, but I've been coming up [2:50] here for years and here to represent Chiba Hut and answer any questions you guys might [2:55] have. Sounds good to you to tell us a little bit about Chiba Hut. [2:57] Yeah, we're a toasted sandwich concept, we have 77 total locations across the United States. [3:05] We have a long history of operating company stores even though we're a franchise brand. [3:10] We've owned and operated about 15 locations over the years. [3:14] We did refranchise those. [3:16] All of our locations do serve alcohol. [3:20] It is a smaller percentage of our sales, about 9% total. [3:25] more sandwich shop first and foremost. We provide great hospitality. We pay our people really well and [3:32] looking forward to doing business here in Cheyenne. We're excited that you're going to be here. Thank you. [3:36] Any questions from the governing body? Dr. Alderj. [3:40] Mayor Collins for you. I have a couple of questions. The first is what is your entry-level wage [3:46] that you're planning on for this Cheyenne? I was just actually communicating with our office to figure [3:52] that we're on the goal line of hiring a GM who's here locally. I believe he's starting in the [4:00] $70,000 range. Again, we try to go above and beyond. We're not a race to the bottom with minimum [4:07] wage. We pair people really well. Down in Colorado, we start them at about 16, 50 an hour. [4:14] And we do have a tipping option. I know everyone's tired of tipping everywhere. But it is [4:19] something that we've done for a really long time and so about three to four dollars extra [4:25] in tips per hour, 16 50 starting wage and we would be looking to hire at this location about 30 [4:32] people. Thank you. I also was just curious on your business card. It says tie stick with all the peppers [4:39] in a ranch water. Is that like your favorite sandwich is on your business cards? It's my favorite [4:43] It's in my email signature as well. [4:46] Very ackey chicken sandwich. [4:49] It's delicious. [4:50] The ranch water is my favorite adult beverage. [4:54] It's the key loan. [4:55] So to water with extra lime. [4:57] I'm watching. [4:58] It's like the poor poor person's margarita. [5:00] When you're in your forties, you got to watch your calories. [5:03] I welcome to Ward 3. [5:05] We're excited to have you in our ward. [5:07] And in our community. [5:08] Thank you. [5:08] Absolutely. [5:09] I appreciate that doctor. [5:11] Let's just go. [5:12] Thank you, Mr. Mayor, through you. [5:14] What will your hours of operation be? [5:17] Historically at Chiba Hut, 10 to 10 is the minimum expectation. [5:22] I would imagine that we would probably go to midnight at this location. [5:25] If allowed, but 10 to 10 historically has been the hours of operation for Chiba Hut. [5:31] 10 a.m. to 10 p.m. [5:34] Anyone else? [5:37] All right. [5:37] Thank you, sir. [5:38] Thank you, guys. [5:39] Welcome to Cheyenne. [5:40] Anybody else in the audience? [5:43] All right. [5:43] Any other comments from members of the governing body? [5:46] Do you know the purpose of the public hearing has been met? [5:48] Will assign this item to the finance committee? [5:50] And so that means it'll meet next Tuesday, [5:52] I believe. [5:54] Yep, add noon. [5:55] Give this room. [5:57] Thank you. [5:59] Number seven, ordinance third reading. [6:01] Amending the official zoning map of the city of Cheyenne, [6:03] changing the zoning classification from land located southwest, [6:06] intersection of wild, [6:13] We have a zone change before us to facilitate a new housing development on 10.92 acres of property. [6:20] Is there anybody here in the audience who would like to speak to this zone change? [6:29] Okay. Hearing none, Mr. [6:33] Seigreif. Mr. Mayor, the representation of the public services committee is to approve on third and final reading. [6:39] And I saw move. Second. Seconded by Mr. [6:42] comments from members of the governing body. [6:45] Here you know, Madam, where could you take the vote? [6:48] Dr. Aldrich, yes, Mayor Collins. [6:51] Dr. Emmins, Mr. Askel. [6:55] I. [6:56] Mr. Leiborne. [6:57] Hi. [6:59] Mr. Moody. [7:00] I. [7:00] Dr. Rene. [7:02] Yes. [7:03] Mr. Roy Bolt. [7:03] Yes. [7:04] Mr. Seagrade. [7:05] Yes. [7:05] Mr. White. [7:07] The zone change is approved on third and final reading. [7:12] Number eight, ordinance second reading, [7:13] amending section 10.24.190 critical traffic control areas, [7:18] creation and administration enhanced penalties of the [7:21] municipal code of the city of Cheyenne Wyoming, [7:23] modifying the provisions governing the creation and enforcement [7:26] of such areas. [7:27] All right. [7:28] Go out to the audience, but before we do, [7:30] we pass this ordinance last fall. [7:33] And we did our first, [7:35] Our first road, which was Gardina Boulevard, and we learned a couple of things from that, and so we brought the ordinance back to make a couple of changes recommended by our prosecutor. [7:44] And just a few other housekeeping things we learned that might make this a little easier to administer. [7:48] We'll go to the audience. [7:49] Does anybody in the audience want to speak to the ordinance on second reading. [7:55] Hearing none, Mr. [7:59] Siegrafe. [8:00] Mr. Mayor, the recommendation of the public services committee is to approve on the second reading and I'm so moved. [8:06] Second. [8:06] Seconded by Mr. White. [8:08] comments from members of the governing body. Hearing none, all those in favor please signify by saying aye. Aye. Aye. [8:15] Those opposed. The ordinance is approved on second reading. Number nine, ordinance second reading. [8:21] Amending chapter 10. 82, motor assisted scooters, electric bicycles and bicycles equipped with GPS of Title 10. [8:28] Vehicles and traffic of municipal code of the city of Cheyenne Wyoming authorizing dockless vehicle companies to conduct business in the city using the city's formal procurement process. [8:37] making a conforming amendment and repealing obsolete provisions. [8:41] All right, we have an ordinance amending the way we handle licensing of dockless vehicles, [8:46] including those motorized scooters we see all around town. [8:48] Is there anybody in the audience that wouldn't speak to that today? [8:54] Hearing none, Mr. Labord. [8:55] Mr. Mayor, the recommendation of the Finance Committee is to approve one second reading, [9:00] and I so move. [9:03] Seconded by Mr. White? [9:05] Mr. Mayor, I would like to move to amend. [9:09] Okay. [9:10] On 10.82.110 under A2, I would like to add at the end of that sentence in a timely manner. [9:21] So we'll read operations of maintenance plans, including a description of how the proposed operator will respond in a timely manner. [9:30] Is there a second? [9:39] Okay. [9:39] It's been seconded by Mr. Moody. [9:41] We'll go to the audience. [9:43] And could you give me that section again, please? [9:46] 10.82. [9:48] 1.1082. [9:51] Okay. [9:52] So we have an amendment on 10. [9:54] You got it. [9:55] To amend the add the language in a timely manner. [9:59] Anybody in the audience want to speak to that? [10:01] How about from the governing body? [10:03] Yes, sir. [10:03] who's Dr. Aldersh. [10:05] Mayor Collins for you. [10:06] In our previous [10:10] ordinance that we had [10:13] regarding the [10:14] dockless vehicles, [10:16] there had been some language that [10:18] gave them a time frame for [10:20] when they needed to respond to [10:21] for instance malfunctioning [10:26] scooters or [10:28] picking them up in a certain amount of time. [10:30] And I see that a lot of that has been [10:33] moved from the current ordinance. And so I would just like to make sure that somewhere in there [10:41] that as they're preparing their requests for proposal, there RFP, that they know that doing it, [10:49] that timelyness is important so that we don't have them laying around town or broken and dysfunctional [10:54] for long periods of time. Any other comments? Mr. Mayor. [11:00] Secretary. [11:03] And a timely manner seems rather nebulous to me. I mean, someone's definition of timely, different people's definition of time was going to be different. So if the purpose is to make a last minute amendment, [11:21] to me, I have our time supporting this, I would rather have something more specific. [11:27] And you're the comments. [11:29] Are calling through. [11:30] Dr. Aldrich. [11:31] I would like to contend that this is in the section that is for the RFP and it sends the message that we are concerned about the timeliness without mandating or dictating a 48 hour or 24 hour or a seven day period in which they need to respond. [11:52] But it will allow those who are preparing an RFP to know that that is something that we value and are looking for. [12:01] Other comments? [12:05] Mr. Maystereville, through you to our city attorney. [12:10] Can in a timely manner, how can we, how does that legally, in a timely manner? [12:18] Is it, I mean, how do you define that? [12:21] Mr. Brody, do you have a words of wisdom for us, sir? [12:26] Mr. Mayor, John Brody, City Attorney. [12:29] Councilman, I think that would just come down to the discretion of the procurement department within the city. [12:35] They would obviously read this code provision and then try to incorporate that timely requirement into the documents that they would issue as part of the RFP. [12:44] But it would be within your city staff's discretion. I think at that point. [12:50] are the questions? [12:53] Mr. Mayor, I do have TJ Bartle-Lort with his hand raised. Mr. Bartle-Lort, [12:58] welcome. Good evening, Mayor, and Council. This is TJ Bartle-Lort, [13:02] part of the team manager. The Council of Enroyables question into Dr. Aldrich's point. [13:07] The request for proposal, we can either mandate that we want a set amount of time for response, [13:16] or we can let the proposals tell us what their intended response time is and we can use that as [13:21] scoring criteria to select the firm that best meets our needs and shows the most [13:26] responsiveness to our request for proposal. So I think that we'll have that [13:31] mechanism in the RFP to find the firm that's going to best help our town [13:36] and our community with our goal. So I hope that helps a little bit on where that [13:40] language could lie and how we would interpret that and enforce that. [13:44] DJ, I think it does. Thank you, sir. I think it helps from the governing body on the [13:51] all those in favor, please signify by saying aye. Aye. Those opposed. [13:58] Mr. Reible, Dr. [13:59] Reneer knows the amendment is passed. We're back on the main motion. Mayor Collins, [14:04] I have another amendment, please. Okay. I would like to remove 10.8 to 0.1, [15:00] The operations and maintenance plan, as well as under number nine, which is the RFP proposal shall be evaluated based on criteria established in the RFP. [15:11] I think it makes it very difficult to, oh, I'm sorry. I'll let you get a second first. [15:17] Sir, second. [15:19] All right, Mr. Moody, second. [15:22] I think that when someone is preparing an RFP and I spend a lot of my day job working with RFPs, the item number 8 and item number 9, really make it difficult for someone who is doing an RFP if at any given time, we can decide that we're going to add criteria to those RFPs. [15:50] So I would like to just remove that ambiguity. [15:55] All right, we'll plot to the audience. [15:57] Is anybody the audience want to speak to the amendment [16:01] to get rid of two lines in section 10.82.1108. [16:11] And then I believe it is B9. [16:14] Yep. Anybody? How about from the governing body? [16:21] Mr. Mayor. Mr. Moody. Thank you, Mr. Mayor, through you. [16:25] I'm going to agree with my colleague from War III because I mean, [16:29] not saying you was, say, 20 years from now. There might be somebody that's against them. They could potentially [16:34] ban it. I said that they're in the finance committee. So I'm just looking after a long-term perspective. [16:40] It could be somebody that doesn't like them. And they say there's a more Tory amount. [16:44] So it's really just protective for the long-term health of a e-screw company. Thank you, [16:53] sir [16:53] Mr. Modi, I understand what you're saying. I would say that [16:58] The criteria that was put in it would only be for the request for proposal once we have a contract [17:03] I don't believe it says that I can go in and worry if future America can go in and make those changes, but I have no problem having it removed [17:10] anybody else [17:12] Dr. Randy I was I was just curious [17:17] perhaps our attorney or Mr. Bellboard can explain why that language was added back into the RFP. [17:25] I assume there was a valid reason. [17:29] Yeah, Mr. Mayor, the doctor or any John Brody City attorney. [17:34] The reason that we inserted that language was to really allow for flexibility for as the city continues to become more sophisticated in how this RFP process goes forward [17:45] that there may be, you know, policy goals that need to be incorporated in the RFP that this original draft didn't contemplate. [17:53] So the idea is that it maintains that flexibility so should compliance identify another aspect that the RFP needs to address. [18:03] And that could just be incorporated into the RFP when it gets rolled out the next, the next time it would be open. [18:10] and then I guess really that flexibility would also allow to avoid six weeks to get the change [18:17] put in the ordinance to then allow that flexibility in the or in the program. [18:23] Thank you, Mr. Mayor. [18:25] Great, Jennifer. Mr. Mayor, I do have TJ part of work again. [18:29] Welcome back, Mr. Bartlebord. [18:31] Thanks, Mayor. TJ Bartlebord, purchasing manager to just add on to our city attorney stated. [18:38] He made a great point that just to add on to the thought is that the ordinance says, [18:45] at a minimum, we want our RFP to check these boxes, but we want to have the flexibility [18:50] to add or remove criteria in the future that we feel necessary to the procurement. [18:55] And this to make a note for to the comment from Dr. Aldrich, [18:59] the RFP won't have a scoring criteria for the mayor's discretion. [19:04] the scoring rubric will be standard across all the freeze proposal that's issued. So that's not really a discretion of whether or not we like the proposal it's just [19:15] discretion to add other scoring criteria that we deem appropriate for for this for this for this procurement. So just that wanted to add that note standing by for any other questions. Thank you. [19:24] Did you, I don't remember when I read this, how often these would go back out for RFP? [19:35] TG of article board purchasing manager Mayor, I believe our intent was to do it on an annual basis, [19:40] and I think the RFP could speak to, I'd imagine my vision for how this would work with, [19:47] to start it on an annual basis and once we get into established program, the potential for maybe a contract with renewal options beyond that, [19:55] But I think until we get established, we were kind of visiting this happening annually, and [19:59] I'm sure our city attorney can elaborate if I've missteps or if he has any other shots, [20:04] thoughts to share. [20:05] Thank you. [20:06] Thank you, TJ. [20:09] All right. [20:09] Anybody else? [20:10] Yes, sir. [20:11] Dr. Aldridge. [20:12] We're calling through you. [20:14] I understand what Mr. Bartobort was saying about that it would not be something that your [20:22] the flexibility would be in the RFP that was put out not in the bids that were accepted. However, [20:31] I see as part of our job and our due diligence as a council of creating that criteria for [20:38] those RFPs. And so having the ability and our ordinance for the mayor or a design need to be able [20:49] to change that criteria for an RFP without this Council's or A Council's oversight. [20:58] I believe is a shirking of our responsibility. [21:03] Anybody else, Dr. Rainey? [21:08] As most of us know, we rarely, most RFPs are developed within the administration and we rarely [21:15] look at them that them or approve them. [21:19] So, in the fact, to me, the fact that this is not in this language is not in the contract itself and only in an RFP and it does give the administration more flexibility. [21:31] Really, we're not striking our duties because we don't look at every RFP that goes out of here. [21:36] Actually, this is somewhat of an exception. [21:39] So, I think the flexibility, the request for flexibility from the administration and not having to go back through a six week process. [21:48] ordinance process if if they do find some things that aren't working or that they need to change [21:53] annually is probably worthwhile. Um, so I would be opposed to the amendment. Anyone else in the [22:00] governing body? All right, we're on the amendment. Uh, all those in favor, please signify by saying aye. [22:06] Aye. Those opposed. No. Miss you, the hands of the nose. Mr. White, Mr. Escobel. Mr. C. Gray, Mr. [22:15] Dr. Randy Batmotion fails. [22:20] We're back on the main motion comment. Yes, I have a frozen and so on page two under 10.8 to 0.110 of [22:34] Look at A and then you go to number two. I would like to delete [22:40] number three and [22:46] delete number four [22:49] And number five, and then we turn to page three. [22:55] Miss, if I could, if these are in the definitions for the community engagement strategies, [23:01] yes, I'd like to delete that and I'd like to delete programs, reduce rates, and data sharing capabilities [23:07] and safety measures in prior education. [23:10] I guess maybe I'm not following you, sir. [23:12] You're on, could you give me the section, please? [23:15] Yes, or 10.82.110. [23:18] A and then number two. [23:22] And then run your A, keep two, but delete number three. [23:28] Number four. [23:30] Number five. [23:32] And number seven. [23:35] I might don't have a number seven. [23:37] No, we're going to do a few things. [23:41] H. [23:43] Oh. [23:44] Okay. [23:45] I was in the wrong section. [23:46] All right. [23:46] Take the measures. [23:48] Data sharing and [23:52] Change the gauge strategies. [23:53] I'm a program to reduce rates. [23:57] Okay, so a second. [24:00] Oh, and then I'd like to also. [24:03] On page three. [24:05] Just to be consistent. [24:07] So on the very top page three or number six, [24:09] if you engage your responsiveness. [24:11] And then number seven programs, [24:13] reduce rates. [24:18] That's going to be. [24:20] All right. [24:27] Okay, is there a second on that moment, amendment? [24:33] I would second that for the sake of discussion. [24:37] So we, do you want to explain your amendment before we go to the public? [24:41] Yes, so the reason I'm doing this is because that's a lot for company to do. [24:48] I mean, with the safety measures of higher education, again, that's out to the public to know about it [24:53] we don't have any laws requiring helmets for bicycles. [24:57] So why do that for these e-gooters? [25:01] Number four, this is privacy of a private company. [25:04] Number five, again, that could cost a private company a lot of money. [25:07] Keeping out the lower companies versus large companies. [25:11] Number seven, if they're a new company, let's say they don't have [25:14] an opportunity for, you know, doing this, [25:16] they have to be established. [25:18] And then for number, be there, same things, [25:22] Just basically keeping a consistent with the amendment. [25:25] Okay. [25:26] Right to the audience. [25:28] Anybody the audience want to speak to the amendment. [25:31] Okay. [25:32] I bought from the governing body. [25:34] Dr. Aldrich. [25:35] We're calling through you. [25:36] I would be hesitant to eliminate three, four, five, and seven. [25:42] I believe number three when we're talking about safety measures and writer education. [25:47] And I think that this is basic safety that a lot of times is on a decal or on a metal plate that's actually on the scooter itself that reminds writers of things like that they're not supposed to be writing them on sidewalks. [26:03] I think that that writer education and those safety measures are important and I would think that from a liability standpoint, the contractor as well as the city would be in favor of reminding people about what the safety measures and writer education are. [26:22] It's not, I don't think it has anything to do with helmets all those, although I'm sure that those are recommended. [26:27] the data sharing and reporting capabilities. I think that any company that's doing this [26:33] and as a city we would be interested in that to find out where they're being most commonly [26:38] utilized, what the average rate of speed is. There's all sorts of data that can be selected from [26:44] these. I know with geo-fencing that has some reporting opportunities that we may want to [26:54] utilize. I also think the community engagement strategies is important for any company that's [26:59] wanting to lease scooters in our community that they would want to be able to engage the community [27:05] and market these so that they're not just sitting on street corners and along the streets. And I think [27:12] a program for reduced rates would be really helpful to have a reduced rate for students or for senior [27:19] citizens or for especially events. And I think that just gives a company who may be doing an RFP. [27:26] A lot of flexibility in being able in all of these areas, being able to differentiate themselves [27:32] from other competitors and other potential contractors in the RFP process. So for that reason, [27:40] I will be a no vote on this amendment. Anyone else in the governing body? Mr. Mayor? Dr. Rainey. [27:45] I assume Mr. Bartelbor is still paying attention. [27:49] Is there, I mean, historically we asked for this information. [27:53] And, or these provisions, and have you ever gotten any push back [27:57] for many of the companies that we had been in the city in the past? [28:03] Mr. Bartelbor, yes. [28:06] Mayor, City Council, TJ Bartelbor, purchasing manager, Dr. Rini, [28:09] I feel that all of the questions are these kind of items [28:12] that we're considering in the RFP. [28:14] are pretty standard for what we would, when we're looking for qualified contractors, I think these are all very relevant items that we would consider, and now I don't know that I've ever seen where we've gotten pushed back from asking for these types of qualifications. [28:31] I think it ensures the city gets a qualified and competent contractor to perform the services. [28:36] So I do think that they are appropriate to include as is. [28:41] Thank you, Mr. Mayor. [28:42] Thank you, TJ. Anybody else in the governing body on the amendment? [28:46] Mr. Mayor, I'll withdraw the amendment. [28:49] I don't think you can do that now. It's owned by the body. [28:51] So, we need to vote on it. Anybody else? [28:54] All right. All those in favor of the amendment, please signify by saying aye. [28:58] Aye. Those opposed? No. [29:00] Uh, amendment fails with Mr. Moody Boding, yes. [29:04] We're back on the main motion. [29:06] Mr. Mayor, I just have one more amendment. So, on page three, [29:12] under 9 and C. So we'll see it says the city shall review and evaluate all proposals received in response to the RFP and accordance with the procedures. [29:25] The staff wishing the RFP and the city's formal procurement process. After that, it says the city may select one or more. [29:33] I want to lead is one or more and say the city may select any operators based on [29:42] proposals received. So it would be a simple amendment taking away one or more and just say any [29:49] operators. Is there a second? Second. All right. We have a motion in a second to change one or more to any [30:00] And it was to have multiple companies, the freemark works out itself. Let's have a lot of these, you know, three or four companies that'd be great. [30:09] Some cities are reducing it to just two or three max. And that actually does allow for healthy competition. So let's let the freemark to work it out. [30:18] That's what the intent was based on the letter. And I'm just doing this to allow for more flexibility for even small companies. Thank you. [30:25] Okay. Let's go out to the audience. Anybody in the audience want to speak to this amendment. [30:32] Hearing none, how about from the governing bodies? [30:39] All right. Hearing none, all those in [30:40] favor of the amendment, please signify by saying aye. Aye. Those opposed. The amendment fails with [30:47] Mr. Moody, voting yes. [30:51] Now we're back on the main motion. Any other amendments? [30:56] Hearing none, all those in favor of the amendment as amended, please signify by saying aye. [30:59] Aye. [31:00] And those opposed? [31:01] No. [31:02] They see the hands of the nose. [31:04] Mr. Laborant, Mr. Moodya knows the importance is approved on second rating. [31:11] Number 10, ordinance first reading, amending and updating the solid waste fee schedule and accordance with section 8.44. [31:17] 0.010 of municipal code of the city of Shionway, omning and repealing ordinance. [31:21] Number 4571. [31:23] Aye. [31:23] Will refer this to the Finance Committee. [31:26] Number 11, ordinance first reading, repealing chapter 12.28, [31:29] down-town graffiti abatement pilot program of title 12 street sidewalks and public places of the [31:34] municipal code of the city of Cheyenne Wyoming. We refer this one of the public services committee. [31:38] Number 12, resolution granting an exception to the 201 agreement for the owner of the property [31:43] located south of High Plains Road in west of South Korea, the highway between Robert Avenue and [31:48] Deschilling. All right, this is a request for a 211 agreement. A couple of weeks ago, we postponed this [31:55] to give the applicant a little bit of time to work with staff to get an outside user's agreement [32:02] for water. I would tell you that there was maybe a little bit of a miscommunication between [32:08] our staff and the applicant, which caused them to be able to miss being able to do that in a timely manner. [32:15] So I would ask for the governing bodies and indulgence maybe. [32:25] I'll go out to the audience to see if there's any comments on the 201 application. [32:42] Ms. Keller, welcome. [32:44] Hello, Mayor Collins. [32:46] And members of the council. [32:47] Thank you. [32:48] My name is Tanya Keller and I am the real estate associate broker representing the [32:53] which are the property owners and they're here with me today, so we have now submitted that application. [33:01] We were in voice over the weekend and so that's the final thing that hasn't been done, [33:05] but we have finally submitted that outside water usage agreement. [33:11] It just turned into a really tricky process because we had applied for this in the past, [33:16] But that has, since then, expired. [33:19] And so I built you to nothing that we had [33:23] to go back through the process. [33:24] And it took about nine, 10 days to get a clear answer. [33:29] And then by that time, we had arrived at the service meeting. [33:32] And we could get that application filled out. [33:37] And we are working on the payment option. [33:42] Thank you, did anybody have questions? [33:45] Thanks, Tony. [33:49] Anybody else in the audience want to speak to this to a one exception? [33:54] How about from the government? [33:55] Oh, I need amendment first. Mr. Seagriff. [33:59] Mr. Mayor, the motion to adopt failed at the public services committee. [34:03] Therefore, there is no recommendation. [34:05] However, for the sake of discussion, I move to adopt. [34:09] Second. [34:10] The second by Mr. Royville. [34:12] Comments from members of the governing body. [34:14] Mr. Mayor. [34:15] Dr. Ray. [34:16] Mr. Mayor, may I have to pause upon for two weeks. [34:18] It's moved by Dr. Randy, seconded by Mr. C. Grave, to postpone for two weeks, comments from the audience, above from the governing body. [34:29] Hearing none all those in favor, please signify by saying aye. [34:32] Aye. [34:32] No's opposed. [34:34] The item is postponed until the April 28th meeting of the governing body. [34:39] Next item is 17 a.m. page 3. [34:44] Cooperative Agreement between the City of Cheyenne and the Wyoming Department of Transportation [34:47] for 2025 thermoplastic pavement markings. [34:52] All right. [34:52] We'll go out to the audience. [34:53] Does anybody want to speak to this agreement between [34:55] Y-DOT and the city of Cheyenne on thermoplastic pavement markings? [35:02] Hearing un-Mr. Labord. [35:04] The mayor of the recommendation of the Finance Committee [35:07] is to approve an amount of... [35:09] We have a microphone. [35:12] Thank you. [35:13] Excuse me. [35:14] Mr. Mayor, the recommendation of the Finance Committee [35:17] is to approve an amount not to exceed [35:22] 244,845 dollars, and I so moved. [35:25] Second, seconded by Mr. Moody, comments from members of the governing body, Dr. Aldrich. [35:30] Yes, sir, Mayor Collins for you. [35:32] I just asked for this to be pulled from the consent agenda because I think it's really [35:37] important for our constituents and for the public to know that the city could go out and do [35:46] on its own, but in an effort to really be good stewards of the money that we are using out [35:53] of our 2023 through 2026 optional 1% sales tax fund that we are working collaboratively [36:00] with the Wyoming Department of Transportation on this project. [36:05] And I'm just wondering if our city engineer might be able to tell us what he believes the cost [36:11] would be if we were not collaborating with white dot and we're trying to do this on our own. [36:16] If he would know about what that ballpark figure would be. [36:20] Mr.ob, [36:21] do you have your crystal ball? Thank you [36:23] for your three youth, Dr. Alder. Dr. [36:24] Alder, I could guess for you, but let's just say, I think we're probably saving a proximate 20, [36:31] 25% on business my best guess, man. So maybe [36:35] maybe $40,000. Mayor, [36:38] yes, sir. Thank you. [36:39] Thank you. [36:40] we're going through. While that may not seem like a lot of money in the amounts that we deal with, [36:46] I think that every amount that we can save is one less is a dollar that we can use somewhere else. [36:53] And so, I appreciate the City Engineer's office working collaboratively with the Wyoming Department [36:58] of Transportation to be good stewards of our tax payer funds. Anyone else in the governing body? Mr. Mayor, Mr. [37:06] degree. I was not able to attend the meeting. I'm just curious when we expect the work to be [37:12] completed. I would hope before frontier days, but what if we could get a Mr. Copti, you know the [37:17] date? Mayor, through you to council, Mr. Speaker, I, we don't have a date yet, sir. I'm just for our [37:24] agreement with them. I don't, I don't even have an actual letting date from them off the top of my [37:28] Thank you. Any other questions? Mr. Mayor, Mr. Labor. [37:34] Thank you, Mr. Mayor. [37:35] I have discussed this with the City Traffic Engineer and the [37:41] Why Dot Regional Engineer. [37:46] I'm very hopeful we're going to get substantial amount of this [37:50] downtown where we really needed those markings have been pretty faded and of course that's [37:59] where as have been pointed out here is where a lot of people are hopefully down there all year [38:06] but definitely during frontier week so although this is a good process we need to do more [38:16] Those markings are critical to individuals who are crossing at that crosswalk. [38:24] And I think we all know the problems we've had in our community with crosswalks and the dangers that can happen with drivers that aren't paying as much attention as they should. [38:37] So I speak in favor of this motion and believe that we need to even do more. Thank you. [38:45] Any other comments? [38:48] This morning. [38:48] Thank you, Ms. Mayor, through you. [38:50] I want to echo my colleague from more one, not only that, but it does fit one of our city goals for more safety, especially regarding traffic. [39:00] And we want to prevent less tragedies with regards to the crosswalks. [39:03] Thank you, sir. [39:05] Comments. [39:07] All right, here we go. [39:08] All those in favor of the cooperative agreement, please signify by saying aye. [39:12] The agreement is approved. [39:15] Next item's 19c on page 4. [39:20] Consideration of bid number e-14-25 for finishing. [39:26] That's an annual basis for the city of Shayan Street now in division. [39:31] I'm always glad that you have to read that and not me. [39:33] We'll go out to the audience and see if there's anybody who wants to talk about our asphalt and hot mix and coldness contract. [39:43] Mr. Mayor, the recommendation of the Finance Committees to accept the bid from JTL Group [39:50] Incorporated, doing business as Knife River for the purchase of by two-minus asphalt hot [39:57] mix in a mount not to exceed $367,625 and cold mix in a mount not to exceed $75,000 and the [40:09] from Simon Contractors for Taco oil in an amount not to exceed [40:14] $19,200 for total amount not to exceed [40:21] $461,825 and I so move. [40:25] Seconded by Mr. Moody. [40:27] Comments from members of the governing body on the contract. [40:30] Dr. Aldrich. [40:31] Mayor Construy, I was hopeful that there would be somebody [40:34] from public quirks that might be able to [40:36] I'm just talk about the percentage change over last year in these prices and thank you. [40:47] And would also be able to understand that this actually is a decrease, so I was curious to find out about that. [40:55] Mr. Liu, welcome. [40:56] Thank you. Great avoid public works. Yes last year we paid $90.50. It did reduce $2.90 for the hot mix. [41:08] That's almost identical from last year. I don't think there's a large percentage, but it did hold prices in the oil. [41:14] Market is not something I'm an expert on. [41:18] The tonnage firm, the cold mix, did go up from 195 to 225, that is a little bit more than normal, but cold mix has always been fluctuating. It's not the best product. Well, I don't want to say it's not the best product. It's the best product for cold environments, but it does change on how they make it. [41:40] probably the mixed design changes a little bit could change that [41:44] significantly from one year to the next. [41:47] As far as tax oil, that does follow along with the $4 to $3.60 [41:51] a gallon, that's probably more in line with a well-trapped. [41:56] Dr. Aldrich? [41:57] Miracle on this for you. [41:58] I just want to once again point out that our department's been a lot of time [42:04] and a lot of energy. [42:06] I know working with Mr. Bartel Boort out of the Treasiers office to [42:10] go out for bid on items and to try and make sure that we are getting the most product or [42:17] the most service for the dollars that we're spending and I'd just appreciate the due diligence [42:23] that our employees take in order to make sure that we are being good stewards of those [42:28] public dollars. Thank you. Any other comments from members? Any other comments from members of the [42:40] approved. [42:43] Next item is 20B on page five, voucher report. Are there anybody in the audience [42:49] or on the governing body that would like to speak to the vouchers? [42:54] Hearing none next item. [42:56] Now, it's been of a public hearing to be held April 28, 2025 at 6 o'clock PM in city council [43:00] chambers, 2101, O'Neal Avenue, Cheyenne Wyoming, and via electronic conference meeting for a winery [43:05] liquor license application, filed with the city clerk's office for Wagonham Wine LLC, doing business [43:10] as Wagon Howm Wine Company, 1610 Capital Avenue, [43:13] Shion Wyoming, announcement of the defective, [43:16] the week of April 21st, 2025, [43:18] finance and public services, [43:19] committee meetings will be held in city council chambers, [43:22] 2101, O'Neal Avenue, other business. [43:25] All right, is there anybody here in the audience [43:26] that would like to speak to the governing body [43:27] under other business? [43:31] Do you know how about from the governing body? [43:33] Dr. Aldridge. [43:34] Mayor Collins, I would just like to remind everyone [43:37] that this Saturday, we will hold our ward [43:40] three council and coffee from nine [43:42] between 11 a.m. at a dust fog located at college and purging. While it is Easter weekend, [43:50] we are committed to making sure that our constituents have an opportunity to visit with council members. [43:57] Thank you, anybody else? Mr. Moody. Thank you, Mr. Mary, through you. I just want to say I will not be there. [44:03] I'm now helping with an Easter egg hunt with the Knights of Columbus, so do apologize for that. [44:08] Um, and also I, uh, Shinyom was great. I was interviewed by NTD network on it. So if you want to see it, just go there and also happy pass over and happy. So everyone, thank you. [44:20] Thank you. Anyone else? Mr. White. [44:23] Thank you, Mr. Mayor. Just wanted to let folks know that. [44:28] The rooted in Cheyenne spring planting event is set to take place on May 17th at 730 in [44:36] the morning, till noon, and I understand that there's only a few slots left for volunteers. [44:43] So if you would like to volunteer for this event, I've done it several times. [44:47] It's a great event, planting trees in the right way around our community. [44:52] I think we're up to 1,700 trees over the course of the program. [44:58] I encourage folks to get some. [45:00] Everybody shows up. Here is a life is going to be here. So big event there for that. Yep, it's going to be a fun day. Anybody else? [45:12] I neglected to remind everyone that the football, which benefits the shine animal shelter will be held on the 25th and so a week from Friday and I believe that there are tickets to available. [45:26] Also, as the Council's representative to the shine and a more shelter board, I would encourage [45:31] your participation. [45:35] Thank you. [45:36] Mr. Labour. [45:37] Thank you, Mr. Mayor. [45:40] In the very recent past, there's been a lot of action and discussion of spatial analysis [45:47] and movement in the city for security reasons and for space reasons and I'm very curious Mr. [45:57] Mayor, when we would want to really start taking a look at the expenditures involved in creating [46:06] flex space at the new courthouse that we have downtown, it is that second floor has some [46:17] of those factors ready, but I think it's going to take some attention to do that. [46:22] And I recognize that our reserves right now are substantial and that construction costs are [46:29] not going to go down, I don't believe. [46:31] But it would really be beneficial if we took a look at that and really have some idea of when and how that might happen since we do have the report of this building. [46:44] We do know that there's been a lot of discussion about moving around, excuse me. [46:51] And so I'm very interested in pursuing some knowledge about that. [46:57] What exists? [46:59] What might be accomplished? [47:01] Because that's flex space is going to be used at some point. [47:05] And I think it's time that we took a look at that and tried to understand it. [47:10] Thank you. [47:13] Thank you, Mr. Slaveworth. Anybody else? [47:17] All right, hearing none. We're adjourned. Thank you so much. [47:18] Happy Easter. Happy Passover, everyone.
