[24:14] Today I wanted to make a few [24:15] announcements about materials [24:16] that are available for public [24:19] review on our website and in [24:22] public library richardsons and [24:23] also let you know -- libraries [24:25] and let you know about our [24:26] schedule. [24:28] In June, we held workshops to [24:29] get residents to start creating [24:31] a vision for corpus christi and [24:33] to help create guiding [24:34] principles to serve as [24:37] generally the constitution for [24:38] ] [24:40] Our plan that gets written. [24:42] So this vision and principles [24:44] document, I pass that had out [24:47] today, it is also available [24:50] online at plan cc2035, on the [24:50] front page of the website. [24:53] It was a result of the June [24:54] public meetings and I wanted to [24:56] let you all know about this. [24:58] It is a draft document, it [24:59] remain as draft and it is part [25:01] of the plan when it is adopted. [32:43] Having said that, one thing [32:46] that came to our attention is [32:49] that the address of the [32:51] increased costs of the services [32:53] to the former, or the [33:02] residences of the city prior to [33:03] contention that the above [33:06] resolution, which is regarding [33:07] the funding of utility improve. [33:13] S on the south side, if m2 444 [33:14] with property fax taxes from- [33:15] -property taxes from the area, [33:17] which was passed here on the [33:20] 14th, that it was passed [33:23] illegally as it fails to meet [33:24] the standard for acceptable [33:26] public notice under the texas [33:29] open meetings act section 7, [33:33] you know, the various notice [33:33] requirements. [33:34] Those, for example, a [33:36] government body must give the [33:38] public advance notice of at [33:40] subjects they are going to [33:41] consider in open meeting. [33:42] The notice has to appraise the [33:46] public of the subject toss be [33:47] considered during the meeting. [33:49] And government actions taken in [33:50] violation of the notice [33:54] requirements of the act are [33:55] avoidable. [33:57] The resolution was passed [33:59] without reading or attachment [34:00] to the written agenda made [34:01] available to the public, [34:04] denying the measure to raise [34:07] the taxes, or the tax burden on [34:08] those that are not annexed in [34:13] recorder to provide the [34:14] services without any revenue. [34:15] neighbors first request that [34:20] the city attorney rule in his [34:21] writing, whether the passage [34:22] mutes the requirements under [34:24] the texas open meetings act. [34:26] We also request that if the [34:27] city attorney finds that it [34:30] does not meet the requirements [34:32] that the adoption of the [34:38] resolution and be voided and [34:45] resubmitted for a vote. [36:30] And I also want to ask you to [36:35] reconsider based on the fact [36:36] that the etj, or the [36:38] jurisdiction that the cities [36:41] are allowed to have is put [36:43] there by the legislature and it [36:45] is put there for the benefit of [36:46] the city and also for the folks [36:49] of the county to know where the [36:51] reach of the city's understand [36:51] nuance is. [36:54] And in your move, you formed a [36:59] q tip and now you are annexing [37:00] area outside of the etj, and [37:02] have plans to double that, I [37:04] think, or make a phase two. [37:08] This is a trend based on [37:10] property rights, it is a [37:11] disturbing trend because people [37:14] in the county don't know what [37:15] the definition of areas that [37:17] you consider part of the [37:17] community are. [37:20] I think that is what the letter [37:20] said. [37:23] And so I would like the council [37:23] to define the community. [37:26] I would also like the council [37:29] to have master plans for the [37:29] items. [37:31] None of the area that you have [37:33] annexed as a master plan and [37:36] none of the area in the etj [37:38] that I am familiar with as a [37:38] master plan. [37:42] Right now it is by paint ball [37:44] and it is not very effective. [37:45] it is not orderly or [37:45] predictable. [38:36] And no one in the city has to [38:37] pay the tax revenue. [38:38] That means it is all coming [38:41] from the owners that you seem [38:45] to not care about, this the [38:46] plan is punitive. [38:46] You have drawn it around [38:47] everyone out there except the [38:50] people that are in the wind [38:50] farm. [38:52] The only exception to that is [38:54] that q tip, you had to get 500 [38:57] feet so it would all connect. [40:41] The public hearings were held [40:43] before the resolution was [40:43] brought up. [40:45] So there was not a chance for [40:47] the public to discuss or have [40:50] input on to the costs that were [40:51] being put on them. [40:54] Therefore, the notice fails.
