[33:56] >> and I have some comments [34:00] also. [34:01] We received notification of the [34:04] request for the change, and we [34:09] received comments from some of [34:10] the [34:10] owners, because 76 of them all [34:15] received the same notification [34:15] of the rezoning. [34:16] The biggest thing we have from [34:17] the owners is confusion because [34:20] we can't tell what's happening [34:20] here. [34:21] This is an attempt to take part [34:23] of a commercially zoned [34:26] property and take about 280 [34:29] feet, the narrow section on the [34:30] side, to get to the back and [34:34] expanded in the back to build a [34:34] house back there. [34:37] I wouldn't think it would be a [34:41] normal rezoning request, so we [34:44] are going to object to the [34:44] rezoning at this time. [34:49] >> we can get clarification for [34:50] you because if I heard you [34:51] correctly, you said you were [34:51] unclear? [34:56] The mac we were unclear because [34:57] number one, does it meet the [35:01] zoning requirements? [35:02] Is the zoning assistant of [35:05] corpus christi, thumbprints of, [35:09] does it meet the unified [35:14] developing [35:20] code, and how will they [35:21] determine if there's any [35:21] violation of the corpus christi [35:22] ordinances before the zoning [35:23] request is considered? [35:23] Based on that, we feel like [35:24] their needs to be more [35:30] information presented to us. [35:31] They're is a site plan in there [35:32] but you can't really tell where [35:32] the house will be located or [35:33] what size it is. [35:33] We don't know if it will be on [35:34] the rezoned area or not. [35:40] Also, when you go from a [35:40] commercial to a residential, [35:41] the setbacks would change from [35:45] 10 feet on the side and the [35:46] back to 5 feet so that would [35:51] put it closer to our property. [35:52] I think we might agree with the [35:56] rezoning if we have more [35:56] information. [35:57] So if you could table this, [35:57] possibly? [36:01] >> well emma that May be a [36:08] possibility, but this is a [36:09] public hearing, and I do [36:09] appreciate you being here [36:10] asking these very valid [36:16] questions, and we will give [36:17] them an opportunity to address [36:17] those questions. [36:18] You can stay at the podium just [36:21] in case you have additional [36:24] questions as he answers your [36:25] current questions. [36:25] >> I believe the first question [36:26] was whether the proposed a lot [36:35] meet the requirement for the [36:35] district. [36:36] The answer is yes, the property [36:37] has been planted as a single [36:37] lot, so it's two separate lots [36:39] currently, one is the business [36:39] and then the residential which [36:42] is the subject property today [36:53] which is already a platted lot. [36:57] So does meet the requirement. [36:58] The other was does the zoning [36:59] meet the competence of plan? [36:59] Right now, that was part of the [37:00] report that we said is not [37:09] consistent with the future land [37:09] use. [37:10] The future land-use called to [37:11] be neighborhood commercial, but [37:11] as we look at it it now creates [37:13] a buffer, which typically, soa [37:13] zoning start off. [37:15] It's a major street. [37:16] We have residential and then [37:20] either single-family or multi [37:21] family, and we progress back. [37:24] So this new zoning create a [37:24] buffer between the commercial [37:27] lot and anything behind it. [37:37] Then also, does it meet the [37:37] udc? [37:38] Yes, it does meet the [37:38] requirements and the applicant [37:39] has already submitted their [37:39] building primary for the [37:40] residential, which is simply [37:44] waiting on the rezoning [37:44] process. [37:45] So the home they are proposing [37:49] does meet all the requirements [37:49] already. [37:54] >> I received an e-mail from [37:54] jesse hernandes, is he in your [37:55] department? [37:58] >> yes he is. [37:59] Pay period he said yesterday [38:00] that the plan had not been [38:00] submitted. [38:07] >> they have submitted it and I [38:07] apologize that there was [38:11] confusion on themalso, I sent [38:19] an e-mail to Councilman, [38:20] although he replied, I guess he [38:22] is out of the country. [38:25] It would be nice if you could [38:26] be here for this. [38:33] >> for your questions answered? [38:33] >> well, not really. [38:34] Have you seen the actual [38:34] description of the property [38:38] that's being rezoned? [38:39] It's very strange. [38:39] 280feet is a very narrow piece [38:42] that goes back and expands in [38:42] the back. [38:44] Behind the existing commercial [38:47] piece of property, which as you [38:52] can see in the pictures, -- [38:56] >> if you could bring up that [38:57] picture he is speaking to, and [39:01] explain the process, that would [39:02] be helpful. [39:02] >> I'm not sure that we can go [39:09] to the other aerial photograph. [39:12] >>> okay, it's kind of hard to [39:13] see on the aerial, but I think [39:19] what he is referring to is, [39:19] this is a large commercial lot [39:20] right here. [39:22] What the applicant has done is, [39:30] this shaded area behind it has [39:30] been platted as a separate lot [39:34] and there's an extension of [39:39] that lot to rock hill road. [39:39] So I think that is what is [39:41] being considered an odd shape, [39:48] but it's not anything -- it's [39:48] not anything out of the [39:48] ordinary. [39:51] there are several lots that are [39:52] shaped that way. [39:52] They are predominantly in a [39:56] commercial application. [39:57] This is not to pull of a [39:57] residential lot but it does [40:00] still meet the requirements of [40:01] a residential lot or access of [40:05] the public road or square [40:05] footage. [40:08] >> also, this is the first [40:12] reading, and we will have a [40:13] second reading in the interim [40:15] and then we will have anot`oo$0@6cj% [40:17] opportunity to speak with your [40:17] representatives. [40:22] Not unless I here from any [40:22] thing from the council. [40:28] I know Ms. Mcintyre has her [40:29] light on but hearing your [40:29] questions uncomfortable voting [40:30] on the first reading and then [40:30] if something changes from now [40:32] until the second reading, can [40:41] you meet with Mr. [40:41] Pfeiffer also? [40:42] And then in the interim, Mr. [40:42] Karzai. [40:42] Because our next meeting will [40:44] be on December 9 and we will [40:45] have more time in there. [40:48] And there's the second reading [40:50] as far as finality. [40:52] Should there be a successful [40:57] vote on the first reading. [41:00] >> Ms. Mcintyre? [41:01] >> I'm missing the notification [41:05] map and area on our [41:05] attachments. [41:10] The site plan and notification [41:15] area diagrams. [41:16] >> you are correct. [41:21] I apologize for that. [41:22] >> could you get those by the [41:22] second reading? [41:23] >> yes I will. [41:27] >> thank you for bringing that [41:28] to our attention. [41:32] Is there any other questions, [41:33] or anyone else from the public [41:39] that has a comment on item [41:39] number 26? [41:40] Motion to close the public [41:42] hearing, please. [41:48] We have a motion and second. [41:48] All in favor? [41:50] Any opposed same sign? [41:52] Motion carries. [41:53] Ms. Huerta? [41:55] >> the passing of the [42:02] ordinance on its first reading. [42:04] [Roll call] [42:05] The ordinance passes. [42:07] >> incorporated you. [42:08] Item number 27. [42:14] >> are you handling item number [42:14] 27? [42:15] >> yes im. [42:16] Item number 27 is an ordinance [42:24] amending the wastewater master [42:24] plan. [42:25] If you the request has been [42:25] spitted to realign and increase [42:27] the line size of the proposed [42:28] wastewater line. [42:29] The existing master plan calls [42:33] for an a inch line increasing [42:36] to a 10-inch line and this [42:37] amendment would allow all of [42:39] these lines to be changed to 12- [42:41] inch lines and also realign the [42:46] line to move slightly to the [42:47] north of the existing [42:47] subdivision. [42:49] I think this would be better [42:50] served to the west of the [42:54] subdivision and by realigning [42:56] it would also [42:58] prevent multiple distribution [43:04] lines in the subdivision. [43:04] So, bye doing so, the planning [43:05] commission and staff recommend [43:11] approval of this amendment with [43:11] the [43:12] wastewater line. [43:14] >> after this item will move [43:15] towards public comment. [43:15] Is there a motion to open up [43:18] the public hearing? [43:19] Pay period motion and second. [43:21] any discussion? [43:27] All in favor? [43:27] Any opposed? [43:27] Motion carries. [43:28] Anyone from the public have a [43:29] comment on item number 27? [43:30] Motion to close. [43:34] I have motion and second. [43:34] All in favor? [43:41] Any opposed same sign. [43:41] Motion carries. [43:41] Ms. Huerta. [43:42] >> for passage of ordinance 27 [43:47] on its first reading -- [Roll [43:54] call] [43:54] The ordinance passes. [43:55] >> thank you. [43:57] I'd like to open up public [43:58] comment if you could move [44:08] forward and state your name and [44:09] address. [44:11] Good afternoon honorable mayor [44:11] and council members. [44:17] As you can see, I fixed my [44:21] chair, and I'm very glad. [44:22] Day is a day of giving, for [44:31] those who May not know. [44:32] And they say if we get $5, the [44:32] agency gets $5. [44:37] Many Ms. Abel and I live at [44:38] 1701. [44:46] I've been running the website [44:46] business association for the [44:47] past five years, and it wasn't [44:48] going to do it this year [44:48] because I developed my own [44:49] foundation and I was preparing [44:50] for this coming year to raise [44:50] the money for it. [44:53] I'd like to think the board of [44:57] directors for giving me the [44:57] opportunity to continue with [44:59] the website association this [45:00] year. [45:01] It would probably be my last [45:05] year, that I've been blessed [45:07] because I've been able to raise [45:12] the last years, 100 people, [45:12] $100. [45:19] And is here I started. [45:19] early. [45:28] And today I've been able to [45:33] have 92 people, and all I need [45:40] now is a people to accomplish [45:40] 100 for the fourth year. [45:43] I'm here to thank you mayor and [45:46] council, and in all the 92 [45:47] people that open up their [45:54] hearts, their wallet and their [45:54] purse. [45:55] Because it's your kindness that [45:55] helps the disadvantaged. [45:56] I know there are lots of [46:09] projects that are available, [46:09] and these people continue to [46:15] help me year [46:16] after year. [46:19] And it's the same people over [46:20] and over again. [46:27] I May not be blessed [46:28] financially, I May not be able [46:30] to pay my bills, but I have [46:32] been blessed with [46:32] my friends. [46:40] I have so many people that I [46:41] can believe it. [46:42] Money doesn't even help the [46:43] loneliest person in the world. [46:46] Thank you so much. [46:47] >> thank you for all your work [46:47] and taking the initiative for [47:03] such a great cause. [47:09] >>> my name is dana or. [47:10] I spent my childhood between [47:13] corpus and chapman ranch when I [47:20] was 15, the farm became I'm [47:21] from residence through the [47:21] early 80's. [47:22] I grandmother was a chapman and [47:22] she and my grandfather made [47:23] their living from the farm. [47:26] From them I love under quite [47:27] respect for land, loving of [47:36] wildlife and the absolute have [47:37] taboo of trespassing. [47:37] And loved the sounds of coyote, [47:38] bobwhite and whippoorwill, the [47:39] heartless wind beating through [47:40] salt cedars and have only knows [47:42] banging pipes under the house. [47:46] i've known dwindling numbers of [47:47] our cat and jackrabbit to [47:49] always watch my feet for [47:50] snakes, and the taste of coffee [47:52] made with well water. [47:57] I've sent out countless times [47:58] to catch the sun before it [47:58] drops, walk the half-mile in [48:00] the dark to [48:04] watch the gin operate during [48:04] harvest. [48:05] I on her my farmer of 49 years [48:06] who can drive equipment at the [48:11] base of a wind turbine, reaping [48:14] crops high and low, the same [48:15] base around which dear will [48:17] adapt to sound and continue [48:18] grazing. [48:22] I like growing cotton and hope [48:26] to stuart responsibly when my [48:30] grandparents bequeathed. [48:30] Within consecutive years of [48:31] drought, what good sense it [48:35] makes to farm the wind. [48:37] I've believe growth can be [48:39] brought fairly and without [48:39] duplicity. [48:41] This council at that are out [48:42] there lucky stars that janet [48:46] and had heart are no longer [48:49] living to witness these [48:50] shenanigans. [48:50] And I imagine you could guess [48:52] with some of those consequences [48:55] would be, if they were still [48:55] alive. [49:07] >> incorporated you, you, Ms. [49:25] Or -- thank you Ms. Orr. [49:25] And, if you could turn on both [49:27] of the microphones just in case [49:43] she has to come back to refer [49:47] to her. [49:48] >> my name is diane vandermark [49:49] and I on property at chapman [49:50] ranch both in the annexed area [49:56] and the area that has not yet [49:56] been annexed. [49:57] Thank you, mayor for putting us [49:57] in touch with the city [50:00] manager's office, they were [50:00] very helpful. [50:01] They were able to get some [50:02] answers but they raised other [50:04] questions for me. [50:09] I have here at the top of the [50:10] chart, the cost of revenues is [50:11] presented by the city council, [50:11] revenue of 20.9 million just [50:17] based on the fully built out [50:20] $500 million, 575 turbine wind [50:20] farm. [50:23] I understand that's an [50:26] appraisal, this revenue will [50:29] come over the 30 year life of [50:30] the wind farm. [50:32] I have next the cost for the [50:33] water and sewer to meet the [50:38] requirements of the first [50:39] annexation at 13.3 million. [50:39] I have not been able to see a [50:41] written estimate on that. [50:44] These costs must be paid within [50:50] no more than four and half [50:51] years. [50:51] Full services must be provided [50:52] within two and half years [50:57] unless it is not feasible. [50:57] The city May extend the time [50:58] but all capitol improvements [50:59] must be substantially completed [51:04] within four and half years of [51:04] these improvements must be part [51:05] of the city's capitol [51:06] improvement plan by the end of [51:08] this two and half year period [51:08] of time. [51:11] The water and sewer lines as [51:17] you can seeon the map there [51:17] ought traverse an area that is [51:18] targeted for development and is [51:22] not annexed at this time. [51:23] The water and sewer lines only [51:28] approach the furthest edge of [51:29] the stem property and I [51:29] understand they have planted a [51:32] development agreement so they [51:33] will not taxed. [51:37] The property does not even -- [51:38] excuse me, the water and sewer [51:45] line does not even touch the [51:46] chapman ranch. [51:46] Those who benefit from the [51:47] lines and those who are paying [51:48] for the water and sewer lines [51:50] are a completely different [51:50] group of people. [51:51] If you insist upon proceeding [51:53] with the second annexation, the [51:56] owners are planning to pursue [51:57] every remedy to get water and [52:02] sewer to the ranch proper [52:02] including the orders of the [52:03] building which is located at [52:03] the intersection of 286 and 70 [52:06] which is where most of the [52:07] houses are located. [52:08] The water and sewer line should [52:11] establish rose and services for [52:13] the area that is annexed. [52:17] This is not including the cost [52:18] of bond sales and interests, [52:23] and does not include buyer, [52:24] services and other areas. [52:26] What we have been able to [52:33] discover is the they have [52:34] signed at development agreement [52:35] so the area is 1.5 square miles [52:36] which is 3.5% of the total wind [52:37] farm. [52:40] The city had projected revenue [52:46] and included that in the 20.9 [52:53] million at 703,000. [52:53] I'm not finished. [52:56] >> if you could wrap up. [52:57] >> phase I would show the [53:01] deficit to the city of [53:02] 6,237,182, and if you go [53:04] through part of [53:05] phase iii, which would have to [53:09] be the third phase because it [53:11] exceeds the 5-mile et today for [53:11] the [53:13] second annexation, it would [53:18] require an additional 7 miles, [53:18] so there's another 733,000 plus [53:21] dollars we're taking out to [53:22] make a total deficit on the [53:28] overall wind farm of 5,472,000 [53:30] and $37. [53:32] Thank you. [53:32] >> thank you. [53:35] Icy Mr. Pearson back there, you [53:37] need a chance to look at this, [53:45] or do you have any comments on [53:45] this? [53:46] >> they have labeled that as [53:46] information presented by the [53:47] city manager's office and that [53:47] is not accurate. [53:50] We have given some of the cost, [53:52] the $13.3 million number and [53:54] some of those numbers I've [53:54] never seen before. [54:01] The numbers are related to their [54:01] calculations. [54:02] >> can you speak with her and [54:02] then you all can come back and [54:06] we can get clarity on this? [54:06] Thank you. [54:11] >> I can clarify so that right [54:11] now. [54:12] >> well, this is in-depth [54:13] information and he has stated, [54:17] it sounds like you all need to [54:17] have [54:17] another conversation. [54:22] So we will do it at another [54:22] appropriate time. [54:26] >> the infrastructure costs [54:27] were [Overlapping/multiple [54:27] speakers] [54:28] >> I have more than generously [54:34] giving you four minutes, thank [54:34] you very much. [54:35] We certainly do welcome you to [54:35] come back and speak again, and [54:39] if you could get with staff so [54:40] you could get clarity on those [54:42] numbers that would be very [54:42] helpful. [54:46] >> my name is david owing and [54:49] I'm one of the owners of the [54:50] chapman ranch. [54:53] To clarify on the numbers, the [54:53] estimate for the second [54:54] annexation was based on the [54:59] length of the line, for the [55:00] first annexation, and if you [55:04] keep following it out, wendy [55:07] four-44, it's another three and [55:08] half miles. [55:08] So we are assuming that the [55:12] first line of possibly 5 miles [55:13] with 13.3 and three and half [55:13] miles would be somewhere around [55:15] 11 million, and that's where [55:19] our estimate of the number came [55:19] from. [55:24] On October 30 first we met with [55:25] was pearson and he stated that [55:29] the city's tax revenue estimate [55:33] for a 350-megawatt wind farm is [55:33] 20.9 million, and the cost of [55:35] only the first phase of [55:41] annexation is 13. [55:42] 3 [55:42] million. [55:44] In a private conversation with [55:47] me at the planned cc meeting [55:52] that I attended last week, [55:53] julio dimas describes the $13.3 [55:59] million figure as a cost [55:59] estimate from the city's [56:00] engineering staff for extension [56:02] of the water and sewer lines [56:03] only along the oso creek along [56:07] 20 or 44 county road 37. [56:12] I asked him for a copy of that [56:13] estimate, for which he said [56:14] something along the lines of, [56:16] it was an estimate by engineers [56:18] but there is no actual document [56:22] that he could share with me. [56:29] So I took that to mean that the [56:31] $13.3 million figure is a rough [56:33] estimate as opposed to the [56:36] detailed estimate or hard [56:36] number. [56:37] A rough estimate is very [56:45] different from the. [56:45] Or expect estimate. [56:50] My question is, are you making [56:52] decisions based on estimates or [56:53] is there documentation that can [56:54] be [56:55] shared with us justifying the [57:03] revenue and cost estimate? [57:04] Incorporated you. [57:05] >> thank you Mr. Owen, you have [57:05] asked some very good questions [57:06] and we will certainly make sure [57:09] and get back with you. [57:34] Thank you. [57:36] >> thank you. [57:40] My name is tom hartman, I'm [57:41] from annapolis maryland, home [57:44] of the united states naval [57:44] academy. [57:45] Before you, you have a printout [57:54] from the navy.Mil homepage, [57:59] and this is dated October 27, [57:59] 2014. [58:02] It states, defense logistics [58:09] agency for energy issues and [58:17] rsp to secure up to o 55 [58:17] megawatts of renewable energy [58:22] for navy inflations in the [58:23] state of texas. [58:23] And I read, department of navy [58:24] announced October 27 that the [58:27] defense logistics agency for [58:29] energy issue request for [58:31] proposal for the renewable [58:32] energy to help our three [58:39] department of navy [58:39] installations in texas. [58:40] Once awarded, the contract will [58:44] serve naval air station corpus [58:46] christi, anal air station [58:48] kingsville, and a joint reserve [58:55] base in fort worth, texas. [58:56] With up to 55 megawatts of [59:01] renewable electricity from a [59:03] new, off-site generation [59:08] facility over a period of time [59:09] of 10 years. [59:11] So let's examine what this [59:12] means. [59:12] Number one, apex clean energy [59:16] is working on it proposal to [59:20] supply energy in this regard [59:21] from the chapman wind farm, [59:25] because it will be a new site. [59:26] Secondly, apex believes they [59:31] will have a true advantage [59:32] because the proximity to the [59:34] two facilities will enable a [59:36] more direct connect in, which [59:40] would give them a price [59:41] advantage. [59:43] so in conclusion, I recommend [59:45] you look again at what you are [59:47] trying to do. [59:50] The navy, naval air station, [59:57] and apex clean energy are [1:00:01] compatible. [1:00:05] >> thank you. [1:00:09] >> john kelly, 2631 austin. [1:00:10] I was in the neighborhood [1:00:10] today. [1:00:13] I wanted to point out that [1:00:14] given the previous statements [1:00:15] as well as our opportunity to [1:00:17] delve further into the [1:00:17] documents that have surrounded [1:00:21] this issue from the beginning, [1:00:23] it is very clear [1:00:23] that this council participated [1:00:27] in what could only be [1:00:30] determined as either extreme [1:00:33] ignorance, or [1:00:34] fraud, when they, back in [1:00:36] September, discussed at length [1:00:39] how they were against the wind [1:00:42] farm because it was going to [1:00:43] harm the naval air base one of [1:00:45] the very same time in the [1:00:49] agenda maranda him on September [1:00:55] 30th, it says very clearly the [1:00:56] property tax revenue from the [1:00:57] proposed apex wind farm [1:00:58] be used to pay for the utility [1:01:03] structure needed in the new [1:01:03] annexed area. [1:01:05] Completely contrary to the [1:01:10] logic of preventing the wind [1:01:10] farm. [1:01:11] It's estimated that the [1:01:11] property tax revenue generated [1:01:16] from the proposed wind farm [1:01:18] would be sufficient to pay for [1:01:19] the debt needed to be used to [1:01:20] fund installation of utility [1:01:20] infrastructure of approximately [1:01:25] $13 million to the newly [1:01:25] annexed area. [1:01:27] Obviously there you are not [1:01:35] trying to prevent the wind [1:01:35] farm. [1:01:36] There is nothing in here that [1:01:36] says we are going to try to [1:01:37] prevent the wind farm. [1:01:37] You also know that the legal [1:01:38] case come quite frankly, you [1:01:40] could win. [1:01:41] The matter what it's likely to [1:01:50] result in the early territory [1:01:51] judgment against you. [1:01:54] We are building a wind farm. [1:02:01] You knew that, and you know it [1:02:01] now. [1:02:02] So the whole purpose of this [1:02:03] thing was to take money from [1:02:03] one group of people and give it [1:02:09] to another group of peopleto [1:02:09] feather their own pockets with [1:02:10] this annexation and expansion [1:02:11] on the south side. [1:02:14] It's very clear, mayor, you've [1:02:15] been involved with the plan of [1:02:19] the extension of the 202444 as [1:02:21] well as the 286 extension. [1:02:25] If you looked at the planned ac [1:02:28] emma the three proposals are [1:02:28] fraud. [1:02:36] Another them include any and [1:02:37] sticks extensive infill for [1:02:37] redevelopment, they all include [1:02:39] the same southside plan with no [1:02:39] alteration. [1:02:40] I would like two-point out [1:02:43] that, we still have not [1:02:46] received the response to our [1:02:49] written request for esther [1:02:51] risley on an opinion, and I [1:02:53] know he's not equally required [1:02:54] to do so but it seems like it [1:03:01] would be a, and courtesy to [1:03:01] citizens. [1:03:06] And that's both the revenue and [1:03:09] expenditures, and we have built [1:03:13] with an attorney specializing [1:03:13] open [1:03:13] meeting -- [1:03:18] >> if you could wrap up your [1:03:18] comments. [1:03:19] >> he feels we have a very good [1:03:19] case and we will make the [1:03:22] decision based on what we how [1:03:25] we want to [1:03:25] proceed. [1:03:29] >> for clarification on the 24- [1:03:32] 44, that the collaboration for [1:03:32] board future transportation [1:03:34] that has [1:03:37] been corroborated and worked [1:03:38] with and planning with the [1:03:39] texas department of [1:03:39] transportation. [1:03:46] So I will warn you emma very [1:03:51] directly, be careful of making [1:03:54] accusations of fraud. [1:03:55] That is my first and final [1:03:55] warning. [1:03:58] >> I did not make an accusation [1:03:58] of fraud, I said it's obviously [1:04:00] been long in the planning. [1:04:06] The fraud is setting up here [1:04:06] and pushing and saying you are [1:04:07] trying to protect the airbase [1:04:13] when that's not the intention, [1:04:13] obviously. [1:04:14] >> for clarification, be very, [1:04:14] very careful. [1:04:15] We stated everything on record [1:04:19] of our intent, it's not to be [1:04:20] debated at this point, but be [1:04:24] very careful when you state the [1:04:26] word, fraud. [1:04:27] >> I was. [1:04:32] >> is there anyone else here [1:04:34] for public comment? [1:04:34] >>> okay. [1:04:43] We will move forward to the [1:04:44] item regarding -- we even [1:04:44] needed a clarification on the [1:04:45] vote. [1:04:52] Are you ready to discuss that? [1:04:54] >> yes im. [1:04:56] >>> this is within the city [1:04:59] manager's inherent contract and [1:05:04] execution of authority him [1:05:05] because it's $50,000. [1:05:09] And it's the contract execution [1:05:10] to ensure maximum transparency [1:05:13] of the public to see what's [1:05:13] going on. [1:05:16] This is one of those. [1:05:19] We can make this legal [1:05:20] authorization by changing it [1:05:27] from a wrestlers resolution [1:05:27] authorizing to endorsing the [1:05:28] cities managers execution of [1:05:28] this within his inherent [1:05:39] execution of contract [1:05:39] authority. [1:05:40] And that the resolution [1:05:41] endorsing the city managers [1:05:43] execution of a letter of intent [1:05:47] to proceed a [1:05:48] desalinization facility, and an [1:05:59] amount not to exceed $50,000. [1:05:59] And, it would replace sections [1:06:00] one and two of the resolution [1:06:00] with the city managers [1:06:05] execution of the letter of [1:06:05] intent to proceed and economic [1:06:07] feasibility study with the [1:06:15] corpus christi canonical [1:06:19] regional development facility. [1:06:20] It is hereby endorsed an amount [1:06:20] not to exceed $60,000 which is [1:06:22] within the city managers [1:06:22] contract [1:06:23] execution authority. [1:06:27] >> that's item number two. [1:06:29] Ms. Huerta, do you need that [1:06:29] amendment? [1:06:33] >> yes I do. [1:06:41] >> we have a motion, is there a [1:06:41] second? [1:06:43] Is there any discussion? [1:06:45] All in favor? [1:06:47] Any opposed? [1:06:48] Okay. [1:06:50] Is there anyone from the public [1:06:54] who has a comment? [1:06:59] I'm going to take a step back [1:07:02] on item number 42, approving a [1:07:06] letter of intent to proceed [1:07:06] with the seawater [1:07:09] desalinization facility and [1:07:09] economic feasibility study? [1:07:10] Okay. [1:07:14] I don't see any at this point, [1:07:15] but is there a presentation [1:07:17] that you would like to make on [1:07:19] item [1:07:24] number 42? [1:07:25] Okay. [1:07:26] thank you. [1:07:28] >> mark van slyke, item number [1:07:31] 42 is a wrestlers resolution [1:07:33] endorsing the city manager's [1:07:34] plan to [1:07:38] execute is a intent for the [1:07:38] feasibility study. [1:07:44] Key aspects of the agreement [1:07:45] are two parts, one is for a [1:07:46] feasibility study and the other [1:07:46] is an option for request for [1:07:49] proposals for the [1:07:50] desalinization facility. [1:07:51] The funding will come from the [1:07:51] corpus christi regional [1:07:57] economic develop went operation [1:07:58] and they develop and industries [1:07:59] of corpus christi. [1:07:59] Any additional expenses will be [1:08:00] paid for by the city of corpus [1:08:01] christi. [1:08:05] To create a technical working [1:08:06] group that will assist in the [1:08:07] selection of program manager [1:08:11] and development of the scope of [1:08:11] work. [1:08:12] It identifies deliverables that [1:08:15] are desired including a price [1:08:15] per thousand gallons and as [1:08:16] part of the scope development [1:08:18] the technical working group [1:08:19] will review the scope of the [1:08:19] ongoing projects to be sure [1:08:23] that we do not duplicate [1:08:23] efforts. [1:08:24] And I can answer any questions [1:08:26] if you so desire. [1:08:27] >> thank you very much. [1:08:30] Anyone from the public that has [1:08:34] a comment on item number 42? [1:08:34] Mr.Mcgill. [1:08:37] >> this is related because we [1:08:39] have the desalinization study. [1:08:45] On March tenth, we were given [1:08:46] that item to pass on second [1:08:47] reading and it was going to be [1:08:47] a report in October. [1:08:52] Is that report available? [1:08:56] >> I will have to check on the [1:08:57] status of that. [1:09:02] >> that report was due to be [1:09:03] given to us in October, so [1:09:07] being related, I thought it was [1:09:08] timely to ask. [1:09:16] >> is there anyone else? [1:09:16] To vote on the item as amended, [1:09:19] item number 42, and for the [1:09:25] record, Ms. Huerta? [1:09:26] >> councilmember roxas will be [1:09:32] abstaining from this item. [1:09:40] >> [Roll call] [1:09:41] The resolution passes. [1:09:47] >> thank you very much. [1:09:53] Item number 41. [1:09:59] Are lena stone, city are [1:09:59] auditor. [1:10:00] I'm here to request the [1:10:03] approval of our city audit [1:10:03] plan. [1:10:07] Last week received the proposed [1:10:09] plan and the first revision is [1:10:16] to include an audit of road [1:10:20] construction, and by including [1:10:20] that, we need to shave some [1:10:25] hours off of another audit to [1:10:26] include this, so those are the [1:10:27] other documents that you [1:10:28] received last week. [1:10:32] So the first item is an audit [1:10:35] of our new enforce system. [1:10:37] >> is there any way that we [1:10:42] could make that larger? [1:10:49] May be on the 53.7%? [1:10:52] Let's go a little bit lower so [1:10:54] that we can try to get the [1:10:56] whole picture. [1:10:59] There we go. [1:10:59] That's very hopeful. [1:11:03] If you could make it just a [1:11:04] little bit smaller, please, if [1:11:05] we could have the visual for [1:11:19] the public [1:11:19] as well. [1:11:20] >> I will speak on different [1:11:27] sections and scroll down if I [1:11:29] need too. [1:11:29] >> sure. [1:11:29] >>> the first four items are [1:11:30] audit projects. [1:11:36] The first is an audit of our [1:11:37] mis and the enforce system to [1:11:37] make sure general and [1:11:38] application controls are [1:11:40] adequate in the new system. [1:11:42] The second is an audit of the [1:11:51] airport and the leases with the [1:11:52] rental car and other lessees to [1:11:52] make sure that they are paying [1:11:53] accurately and timely. [1:11:54] These two audits were included [1:11:56] in this year's plan but we had [1:11:56] to postpone them because of the [1:11:57] inclusion of other audits that [1:12:09] we are currently working on. [1:12:16] -- compliant with implications [1:12:17] and pick let's be proactive and [1:12:24] make sure that everything is [1:12:24] followed. [1:12:26] The third is the financial [1:12:34] services and their bank [1:12:43] reconciliation process. [1:12:46] By ordinance, we are required [1:12:48] to provide follow-up audits on [1:12:52] previous audits, so items five. [1:12:53] 11 are the follow-up audits [1:12:55] that we plan to conduct next [1:12:58] year on the audits that we have [1:12:58] performed [1:13:00] this year. [1:13:03] We have some significant audits [1:13:06] that are less significant as [1:13:09] you can see by the audits [1:13:09] assigned, the priorities might [1:13:14] be which follow-ups take longer [1:13:15] and again, this is a budget of [1:13:18] hours subject [1:13:21] to change. [1:13:21] Item 12 is, where we put some [1:13:26] hours in for our city auditors [1:13:26] hotline, we received [1:13:29] allegations of fraud, waste and [1:13:30] abuse through that. [1:13:30] Some of the issues are fairly [1:13:32] benign and you can do [1:13:35] investigation in very little [1:13:38] time, then we pass off to the [1:13:39] city manager's office if we [1:13:41] felt his office is more [1:13:42] qualified to mention. [1:13:44] And some take a considerable [1:13:46] amount of time. [1:13:52] We have put a few hundred hours [1:13:52] and for that. [1:13:54] At this point we think the city [1:13:58] has a pretty good handle on [1:14:01] petty cash account and change [1:14:02] funds. [1:14:06] So that just allows us the [1:14:07] latitude, if an issue does come [1:14:08] up or if we feel the need, we [1:14:14] could go in and performed on [1:14:15] [Indiscernible] [1:14:16] Unannounced audits. [1:14:19] The bottom portion is audits [1:14:19] from this year that will carry [1:14:23] over into next year. [1:14:24] It will be an audit of minas up [1:14:27] old court fee collections, and [1:14:31] we are in the process of doing [1:14:32] the [1:14:35] follow-up of the ub oh audit [1:14:39] that was conducted as part of [1:14:39] the plan. [1:14:44] When you add all of these up [1:14:44] your right at $5000 which is [1:14:45] pushing us to the very limit of [1:14:45] what we [1:14:49] think we can get done. [1:14:51] It might be a tad optimistic [1:14:54] but again, it's just a budget [1:14:55] subject to change is approved [1:14:56] by the [1:14:56] audit committee. [1:14:58] The committee did approve this [1:14:59] this morning in our meeting and [1:15:02] we are asking that you approve [1:15:06] it as well. [1:15:07] >> thank you. [1:15:07] Is there anyone from the public [1:15:11] that has a comment on item [1:15:12] number 41? [1:15:12] >>> okay. [1:15:13] Mr.Scott. [1:15:14] Do we need to have an amendment [1:15:24] on this one as well, Mr. [1:15:25] Easily? [1:15:25] The audit -- it's a document [1:15:32] that needs to be incorporated [1:15:32] therein. [1:15:33] >> okay, and what is your [1:15:33] language? [1:15:33] If we can vote on that [1:15:34] amendment I'd like to hear from [1:15:45] Mr. Scott on the audit [1:15:45] committee. [1:15:48] >> we have our committee. [1:15:50] The language to incorporate the [1:15:53] amendment is to -- to [1:15:58] incorporate the audit plan [1:15:59] proposal that has been given [1:16:02] out to counsel on this day. [1:16:03] >> thank you. [1:16:05] Is there a second? [1:16:16] >> all in favor, any opposed? [1:16:16] Motion carries. [1:16:17] >> I was just going to redirect [1:16:22] that the audit committee met, [1:16:24] liberated and endorse this [1:16:24] amended plan. [1:16:28] >> we appreciate that and thank [1:16:28] you for your team and working [1:16:33] on this plan as we move [1:16:33] forward. [1:16:34] Is there anyone else on the [1:16:40] public that has any comments on [1:16:45] item number 41? [1:16:48] Mr.Mcgill? [1:16:49] >> thank you. [1:16:49] Arlene and I'd just want to say [1:16:50] that you and your team are [1:16:51] doing an exceptional job, and [1:16:51] it's in this next budget cycle [1:16:52] we have the opportunity to have [1:16:58] had someone, that would be a [1:17:01] great idea. [1:17:04] >> thank you. [1:17:05] Well done. [1:17:11] >>> we are going to vote as [1:17:12] amended. [1:17:12] Ms. Huerta? [1:17:13] >> for passage of item number [1:17:18] 41 as amended on emergency -- [1:17:24] [Roll call] [1:17:25] The ordinance passes. [1:17:25] >> incorporated you very much. [1:17:28] We are going to move forward to [1:17:33] executive sessions. [1:17:34] Item number four, for [1:17:37] consultation with attorneys [1:17:39] regarding fire collecting [1:17:40] bargaining and negotiations the [1:17:49] >>> we are going to go ahead [1:17:52] and, reconvene the meeting to [1:17:56] item o. Number 28. [1:17:58] Regular agenda item, second [1:17:59] reading approval, texas state [1:17:59] lease purchase agreement. [1:18:03] >>> good afternoon, was person, [1:18:07] assistant city [1:18:11] manager. [1:18:19] Assuming the council approved [1:18:21] the today, the agreement will [1:18:22] become effective 61 days from [1:18:23] today's date. [1:18:26] Middle of January. [1:18:28] Eighteenth of January. [1:18:31] I stand [1:18:32] ready to answer any questions. [1:18:34] >> anyone has a public comment? [1:18:36] None from the council. [1:18:42] >> we need six vote [1:18:45] >> okay. [1:18:46] Can you help us find [1:18:48] Mr. [Audio not understandable [1:18:52] ] Thank you [1:18:53] >> don't ask me to sing.
