[6:26] >>> good morning. [6:30] If I can ask you all to turn [6:31] off your cell phones, please or [6:34] lot them on vibrate or silence [6:39] them, I would appreciate that. [6:41] And also, happy hanukkah and [6:42] merry christmas. [6:45] I am going to ask the [6:50] invocation to be given by jason [6:50] teague. [6:53] He is with asbury united [6:54] methodist church. [6:54] Welcome. [6:54] >> thank you. [6:55] Leapt's pray. [6:58] We give you thanks for this [6:59] opportunity today. [7:01] There are a great many [7:02] decisions before the council [7:04] this morning and weeny that [7:07] many of them seem routine and [7:09] just sort of ordinary, but [7:10] lord, there are also other de- [7:14] sixes before them and all of [7:16] the decisions, they can maybe [7:18] change the lives and [7:19] livelihoods of more than [7:21] 316,000 people who live in the [7:21] city. [7:24] And so, lord, we pray your [7:26] divine guidance upon the [7:29] council members and upon those [7:30] who with items to discuss [7:32] before the council this [7:36] morning, lord, we pray your [7:38] blessing and with that always [7:38] comes guidance. [7:41] We thank you and we praise you [7:44] in christ's name I pray, amen. [7:44] >> amen. [7:48] If I can ask bill green, the [7:51] director of the environmental [7:55] to lead us in the pledge. [7:56] >> I pledge allegiance to the [7:57] flag of the united states of [7:57] america, and to the republic [7:58] for which it stands, one nation [7:59] under God, indivisible, with [8:09] liberty and justice for all. [8:12] >> thank you, Mr. Green. [8:15] if I can ask my city secretary, [8:17] rebecca huerta to please call [8:19] the roll. [8:20] >> nelda martinez. [8:20] >> here. [8:22] >> rudy garza. [8:23] >> here. [8:23] >> kelley allen. [8:23] >> here. [8:28] [Inaudible-low volume] [8:29] David loeb. [8:29] >> here. [8:34] >> chad magill. [8:39] >> here colleen mcintyre. [8:39] Lillian riojas. [8:40] Mark scott. [8:40] Ron ole. [8:40] >> here. [8:41] >> miles. [8:42] >> a quorum of the council is [8:44] present and the required [8:45] officers are present to conduct [8:47] the meeting. [8:51] >> thank you very much, Ms. [8:51] Huerta. [8:55] We are going move move for- [8:59] -going to move forward to city [9:00] manager's comments. [9:00] >> thank you, mayor. [9:03] First item I would like to [9:03] bring to the council's [9:07] attention today, I want to talk [9:08] for a moment about our computer [9:10] system that we have been [9:13] working on for a year. [9:16] It is called an erp, enterprise [9:16] resource planning system. [9:19] It really is the basic [9:23] accounting system, hr system, [9:25] and support system that will [9:29] help us in our city. [9:32] We have become, as an [9:35] organization, as a society, so [9:36] dependent on technology. [9:38] It is like if the power goes [9:41] off or something happens to the [9:43] computer, it goes down, [9:45] everyone just stops working [9:47] because all of the aspects of [9:49] their work are connected to [9:50] technology in some fashion. [9:52] My paint is that this [9:54] technology -- my point is that [9:55] this technology is just vital [9:57] to the way we do our business. [10:01] A couple of years ago, we [10:03] evaluated our base computer [10:03] system. [10:08] What we found was it was [10:09] approaching 13 or 14-years-old. [10:12] It was outdated and needed to [10:13] be replaced. [10:18] We went to work on writing [10:19] specifications, making [10:22] proposals, and, excuse me, [10:25] actually, awarded the system [10:26] that worked out. [10:29] And that was kind of the [10:30] beginning of the work and in a [10:31] way, it was the end of what the [10:33] city council had to do. [10:35] You voted on it, you [10:36] appropriated the money. [10:37] But the organization then went [10:39] to work, this was well over a [10:39] year ago. [10:44] Since that time, we have [10:47] installed our base financial [10:49] system, fleet fleet operations,- [10:49] -fleet operations, hr systems. [10:53] Payroll should be up by the end [10:54] of this year. [10:58] That is key component to any [10:58] operation, obviously. [11:03] During the next year, we will [11:05] install utility billing [11:08] software community development [11:10] and regulation support [11:10] software. [11:11] And our budgeting software. [11:12] So we are about halfway through [11:13] it. [11:17] And I wanted to bring this to [11:20] the council's attention because [11:22] so many people inside have been [11:25] working so hard on this. [11:27] This is an invisible thing that [11:29] so giant operation for the toy. [11:31] I have asked people of the [11:32] people, they have been working [11:35] on that over the past year, to [11:40] come inned to, and be [11:42] recognized by the council. [11:44] Again, we are, about halfway [11:45] through the implementation. [11:48] So there is a still a lot of [11:49] work to be done. [11:51] But can we have all of the city [11:54] employees who have been working [12:05] on this system please stand and [12:06] be recognized? [12:07] [Applause] [12:08] >> and I want to express my [12:10] personal thanks to all of you [12:13] and I know there are a lot of [12:15] people who are not here. [12:17] I want to thank you for all of [12:25] the hard work you have been [12:26] doing. [12:29] So thank you very much. [12:31] The other thing I wanted to [12:33] mentioned to, mayor, is that we [12:35] have completed one of the [12:38] projects, that I want to bring [12:41] to your attention from the 2008 [12:41] bond. [12:43] Tomorrow, would be a ribbon [12:46] cutting on fire station number [12:46] five. [12:51] This is a replacement fire [12:54] station that is associated with [12:57] the joint use with the corpus [12:58] christi independent school [12:59] district, delmar, and it is [13:02] going to also be not only an [13:04] active fire station, but a [13:09] training location for our [13:10] active duty firefighters. [13:11] This new building replaces an [13:13] old building that was first [13:18] constructed in 1956 that had [13:18] become outdated. [13:20] Not as usable as it needed to [13:21] be. [13:26] The new building will be [13:28] hurricane resistant an energy [13:28] efficient. [13:31] And tomorrow at 10:00 A.M., we [13:32] will have a ribbon cut together [13:33] initiate the use of that [13:33] building. [13:37] And I can not think of anything [13:39] else for the moment. [13:41] Thank you. [13:44] >> thank you very much, Mr. [13:44] Olson. [13:47] Thank you for your leadership [13:49] in acknowledging our hard [13:51] working department and those [13:55] doing their own initiatives in [13:56] their departments related. [13:58] We are going tom brady move [14:02] forward -- we are going to move [14:06] forward now to our minutes [14:07] under I. Ms. Huerta. [14:10] >> we present the minutes of [14:11] the regular meeting of [14:13] December 9th for your [14:13] consideration. [14:16] >> thank you, they have been [14:17] presented. [14:19] Do I have a motion to approve? [14:24] >> I have a motion and a [14:25] second. [14:27] All in favor, I. Opposed, same [14:28] sign. [14:28] Motion carries. [14:32] We are going to move forward to [14:37] item l, consent agenda items 7- [14:37] 50. [14:39] Is there anyone in the audience [14:44] that would like to comment on [14:56] item l, consent agenda item, or [14:57] items, 7-50. [14:57] Please come forward. [15:02] >> I am not going be voting on [15:03] item 24. [15:08] >> thank you, appreciate that. [15:11] >> and Ms. Huerta, if you can [15:19] do that, and move forward on [15:19] consent agenda. [15:20] >> it is regarding [Inaudible [15:21] -low volume] Refining. [15:22] Other than that, we are going [15:26] to goat vot on the consent iraq [15:31] or afghanistan -- we are going [15:32] vote on the consent agenda. [15:44] [Roll call vote taken] The [15:46] consent agenda passes. [15:55] >> thank you very much. [15:55] we move forward. [15:57] Were we going to bring one [15:58] forward? [16:00] Of the people here in down. [16:04] Had we discussed that on one of [16:05] the items? [16:08] If we did not, then I am going [16:11] to move forward to the staff [16:22] presentations starting on m, [16:28] public hearing 51, please. [16:30] >> mayor, coin -- council, [16:31] director of development [16:31] service. [16:33] It is a request by a property [16:36] owner to rezone a total of [16:39] 19.72-acres for vacant land on [16:41] the north side [16:43] between airline [16:45] road and rodco road. [16:46] The property is currently zoned [16:48] farm, rural and the owner wants [16:53] to rezone to a general [16:53] commercial. [16:55] The purpose is to allow [16:58] construction of a retail [17:00] shopping center which could [17:03] include a grocery store, fuel [17:06] station, and car wash. [17:08] And if the rezoning goes with [17:11] the future land use plan and [17:14] south side area development [17:14] plan. [17:15] The planning commission [17:19] recommends approval of this [17:19] rezoning. [17:22] Available for any questions. [17:27] >> thank you very much. [17:27] Mrs. Riojas? [17:28] Okay. [17:30] Is there, I have a motion to [17:31] open up the public hearing. [17:33] I have a motion and a second. [17:37] All in favor, say I. Opposed, [17:38] same sign. [17:38] Motion kir richardsons. [17:39] Is -- carries. [17:41] Is there anyone from the public [17:45] with a comment on item m5 1? [17:47] Seeing none, a motion to close [17:48] public hearing. [17:50] a motion and a second. [17:54] All in favor. [17:55] Opposed, same sign. [17:55] Motion carries. [17:56] Ms. Huerta. [18:01] >> for passage of ordnance, [18:01] number 51. [18:10] [Roll call vote taken] [18:16] >> the ordnance passes. [18:17] >> thank you very much. [18:19] >> and let's move to item [18:21] number 52, please. [18:25] >> mayor, council members, [18:26] development services, item [18:29] number 52 is a request to [18:29] resewn approximately five acres [18:32] of vacant land that is located [18:37] on the southeast corner of the [18:37] boulevard. [18:39] The property is currently zone [18:41] hs single family and [18:41] manufactured home districts. [18:44] They want to rezone it to a [18:46] light industrial district to [18:50] allow the development of the [18:53] property into a boat and rv [18:54] storage facility. [18:54] Background on this, the boat [18:58] and rv storage use is [18:59] considered a commercial use. [19:03] The reason for the il, or light [19:06] industrial request is to allow [19:09] larger units, partly the space [19:11] that general commercial is [19:15] limited to 400 square feet [19:15] maximum per storage unit. [19:20] It is going to be used as a [19:23] large rv and boat storage, the [19:27] owner is request to go build [19:28] approximately 450 square foot [19:30] unit in the facility. [19:33] And because of that, I lirks [19:36] would be the better suited [19:36] zoning. [19:39] But the staff is recommending [19:41] the cn district with a special [19:47] permit to allow for the larger [19:48] units. [19:48] Along with that reck [19:49] degradation, -- recommendation, [19:51] there would be a number of [19:55] conditions on that permit to [19:57] allow only the uses allowednd [19:58] the neighborhood commercial, [20:01] with the except of this [20:02] storage. [20:05] -- with the exception of this [20:05] storage. [20:06] Also, any other condition such [20:10] as buffer yard requirements [20:13] along the eastbound richardson [20:14] property -- east boundary [20:16] property line and other items [20:19] such as vehicle stacking and [20:21] those kind of conditions. [20:22] So staff has requested that a [20:24] special permit with issued with [20:28] the cn zoning instead of the [20:33] light industrial, the [20:33] 5applicant [20:39] is aware of that and he finds [20:39] the conditions acceptable. [20:40] He has submitted a site plan [20:44] and at this point, we recommend [20:45] the denial of the light [20:53] industrial in lieu of the cn1 [20:53] neighborhood commercial. [20:54] And I will answer any questions [20:55] that you have. [20:56] >> thank you. [20:58] Can you show me, it was over [21:00] well, probably well over two [21:04] years ago, we had an applicant [21:05] that wanted to put a storage [21:12] unit in this area, do you [21:12] recall that? [21:13] It was with Mr. Brian johnson. [21:15] >> I do not recall the exact [21:16] location on this particular [21:16] one. [21:18] >> okay, is there any way that [21:20] you can find out exactly if [21:22] there is someone listening in [21:24] city staff, where the location [21:28] was and, and I am thinking the [21:36] difference between, and it was [21:44] denyied, there were huge [21:46] limitations on this to be [21:47] neighborhood friendly. [21:47] >> correct. [21:51] >> and so that, I just wanted [21:56] to find out where that other [21:56] location was. [21:56] >> okay. [21:59] >> and I want to make the [22:00] distinctions. [22:01] But there are quite a built of [22:03] restrictions that we put on [22:06] this one, I know for sure, [22:09] compared to the last one. [22:10] >> if I remember correctly, [22:12] that was a straight rezoning [22:12] request. [22:13] >> yes. [22:15] >> as a posed to this one, -- as [22:17] opposed to this one, that the [22:19] applicant is willing to accept [22:19] the conditions. [22:21] And I think at that time, that [22:23] applicant did not want the [22:24] restrictions. [22:26] >> yes, I mean, these are [22:27] significant more restrictions. [22:28] I know forture, I remember [22:30] that, it was a straight, any [22:33] way, I am glad. [22:35] But I would be curious about [22:36] the other. [22:37] Any way, May I have a motion to [22:38] open up the public hearing. [22:39] >> second. [22:42] >> I have a motion and a [22:43] second. [22:43] Any discussion? [22:47] All in favor, opposed, same [22:47] sign. [22:47] Motion carries. [22:52] I ask the public to come [22:52] forward. [23:15] Mr. Meyer, on item number m5 1. [23:20] >> good afternoon. [23:21] I am wayne meyer. [23:23] Live at 4038 walter road. [23:27] I am on the southwest of [23:29] yorktown, so the road, [23:31] basically from york town south [23:32] dead ends into the power plant. [23:34] So it is a debt end street. [23:37] On my side of the street -- a [23:37] dead end street. [23:41] on my side of the street, it is [23:42] all residential units [ [23:47] Inaudible-low volume]. Capt. [23:49] Bryan johnson cease project- [23:50] -brian johnson's project was -- [23:53] >> okay, it was on the [23:56] interior, closer to the [23:57] interior residential locations [24:00] instead on a secondary [24:01] arterial. [24:01] Is that correct? [24:01] >> yes. [24:04] >> is that what you are saying? [24:05] >> yes, across from [Inaudible [24:08] -low volume]. And there was a [24:11] notch out where glenn oak goes [24:12] down this way. [24:15] It was an l shaped piece of [24:15] property. [24:17] I am sorry. [24:18] >> that is okay. [24:19] >> and brian is a friend of [24:20] mine, I loaned him the money to [24:23] buy that property when I was a [24:23] banker. [24:26] And now he is doing a nice [24:27] residential development on that [24:28] will the, which is what the [24:31] people until the neighborhood [24:31] wanted. [24:33] -- people in the neighborhood [24:33] wants. [24:36] Ten years ago, I bought ten [24:40] acres and didn't need it, soy [24:42] divided it into two-five acre [24:42] tracts. [24:44] There are some restrictions on [24:45] the property with the zoning [24:47] and rather than going and [24:49] trying to do smaller lots, I [24:51] did two five acre lots. [24:52] Sold the other five acres and [24:55] both of us built nice houses on [24:56] that property. [25:00] If you take my house and my [25:01] neighbor's house, mike, mike [25:03] rodriguez, who is against this [25:05] problem correct, his fence line [25:09] is within 200 feet of this [25:14] project minus 300 feet. [25:16] the tax value is $979,370. [25:18] We sit on nice tracts of land. [25:21] We have oak trees, we have pine [25:21] trees, we have ponds. [25:26] It is a nice use of that [25:26] property. [25:27] The property on the other side [25:29] of the street was 20-acres [25:33] zoned by a woman who raises [25:33] horses. [25:35] And the other 60-acres is owned [25:38] by a woman who has horses and [25:38] does riding lessons. [25:39] And there are oak trees and I [25:41] guess it is all zoned the same [25:46] on the other side, which is low [25:47] density rural real estate type [25:48] development and I think it is a [25:50] good use for that property. [25:53] There is net any side streets [25:57] on my section and I do not [25:59] think it will ever be extended [25:59] past the power plant. [26:01] Soy only have one way in and [26:01] one way out. [26:04] So when I leave for the rest of [26:08] my day, I will driving by 14- [26:11] foot tall boat barns. [26:12] I did not want to invest thatch [26:15] money to have some residential [26:17] property rezoned into [26:17] commercial. [26:22] I just, my wife and I are 100% [26:23] against this. [26:26] And fear we have also is this [26:28] the lady that sold the five [26:30] acres to him, now she has ten [26:35] acres, and she is not from [26:38] here, she was divorced and [26:39] needed to sell property to [26:41] raise money, she wants to sell [26:43] the rest of her ten acres so [26:44] that she can leaf. [26:48] So our fear is that once this [26:50] is approved, then at some point [26:52] in the future, the next buyer [26:56] for her other two tracts of [26:59] land is going to be for other [27:02] boat and rv storage. [27:04] Well, there is commercial [27:05] property on the other side. [27:09] There are boat barns and rv [27:11] developments on the other side [27:12] of yorktown. [27:14] But not on this side. [27:20] And so, I likened this end of [27:20] walgreens to like dead oak. [27:23] There are a lot of high end [27:23] nice homes. [27:24] And on this side, it can also [27:28] be that and it is headed that [27:28] way. [27:29] Ten acres have already [27:31] developed that way and I think [27:33] there is going to be more [27:37] acreage with high end homes [27:37] immediately surrounding this [27:39] property, and it could be on [27:40] this property also. [27:41] Thank you. [27:53] >> thank you very much, Mr. [28:13] Meyer. [28:16] >> I live on the block at the [28:17] end of the road. [28:20] I am here to speak on a couple [28:20] of things. [28:22] He is correct that the storm [28:24] warning barns are on the -- barns [28:26] are -- that the storage barns are [28:27] on the east side of york town [28:29] and that property next to them [28:31] is for sale. [28:34] It is about twice the retail [28:39] value of the land that is in [28:39] question today. [28:42] So person that wants, they [28:42] could have bought that land, [28:47] but he would have had to invs. [28:47] Vest -- invest for. [28:49] It is cheeper to come to you [28:50] and buying land that is half as [28:51] much and getting it zoned for [28:56] change than it is to buy a [28:56] commercial prommerty and build [28:58] this -- property and build this [28:59] building directly across the [29:02] street from where he is want [29:03] together build now. [29:06] Secondarily, I have been there [29:07] since 1983, my family has been [29:09] there and we have a great deal [29:13] of money invested on that [29:13] property. [29:18] The navy has taken a fly over [29:22] zone and made my five acres [29:22] irregular. [29:24] And cutting into my property [29:25] would just increase the money [29:28] that I am losing for property [29:28] values. [29:30] Also, one other thing I would [29:37] like to mention is there is no [29:39] red light at yorktown. [29:44] And we are talking about large [29:47] rv and boat storage units here? [29:49] You are going have a truck and [29:51] a trailer at a very slow pace [29:53] at very early hours of the [29:55] morning when it is still dark, [29:57] that is when people come to get [29:58] their boats. [30:04] So we are talking about a very [30:08] serious traffic hazard here. [30:10] We are talking ant vehicles [30:15] that -- about vehicles that will [30:17] be turning both on from wall [30:19] wren, or from yorktown, into [30:20] the parking lot, into the unit [30:23] itself and it is going create [30:23] many, many traffic hazards. [30:27] There is a trailer park across [30:30] the street with small children [30:34] that live there. [30:38] When you have big big vehicles [30:40] in dark -- have big vehicles and [30:41] trailers, many times the lights [30:43] do not work on the trailer. [30:46] It is a lot of dangers. [30:47] It is not ongoing hurt my [30:49] property values but it is going [30:52] to hurt the safety and [30:59] happiness in our community. [31:04] Thank you. [31:11] >> thank you, sir. [31:13] >> council, thank you for [31:14] hearing me speak. [31:16] I am david [Inaudible] And I [31:18] own the fife acres a -- the five [31:21] acres next to where the boat [31:24] barn is going to do, a property [31:26] that I brought two yearsing a [31:29] to build my wife's dream house [31:29] on. [31:31] We have 123-acres -- we have 23 [31:32] acres next to this property. [31:35] I want to point out a couple of [31:36] things. [31:37] First and foremost, as I said, [31:39] I am going do be building my [31:41] wife her dream house here. [31:43] You said there are [31:44] restrictions, mayor, on the [31:45] property. [31:46] Would you want it in your [31:48] neighborhood if you were going [31:49] to build your dream house? [31:52] Would you still be okay having [31:54] your wife stare out the kitchen [31:56] window that you have tried to [31:58] build and stair together at [32:00] this boat -- and staring at this [32:00] boat market every day. [32:04] And this is a corner property, [32:07] there are several properties [32:07] like this on a secondary [32:11] roadway where where they are [32:12] building neighborhoods. [32:13] There is one at flower bluff [32:13] drive. [32:16] So the location of the property [32:17] is not an issue. [32:19] These are all estate houses. [32:21] If you look from pretty much [32:24] all the way down to well, [32:26] almost to laguna, it is all [32:28] residential on this side of [32:31] yorktown, every single one of [32:33] them, estate homes, 20-acre [32:34] tracts, five acres, ten acres, [32:37] all the way down the line. [32:39] This does not fit the use of [32:43] that portion of york town at [32:43] the all. [32:47] These are not small tract type [32:47] houses. [32:50] These are half million dollar [32:50] hours. [32:51] I do not really think if you [32:57] had that type of money in your [32:57] house, regardless of the [32:58] restrictions, you would want [33:00] someone popping up with a boat [33:00] barn. [33:02] I do not think anybody would. [33:04] As my neighborhood said, there [33:05] was a commercial property [33:06] across the street, I would not [33:08] have issues with someone [33:09] building on that property. [33:12] It was zoned commercial when I [33:12] brought my property. [33:13] So knowing full well it was [33:16] zoned that way, I brought the [33:16] property. [33:19] This property next door was not [33:20] zoned commercial. [33:21] So for someone to come in and [33:23] put something in that is not [33:24] going to bring value to the [33:26] community, it is really, it [33:28] does not make any sense. [33:30] Lastly, I want to touch on [33:33] something that is important to [33:35] the city council and the city, [33:36] the taxes. [33:38] If you look at taxes of other [33:39] facilities just like this, they [33:41] do not come near to where the [33:43] house I am going to build, as [33:46] far as the taxes it is again [33:47] rating for the city. [33:52] So yes, in the short term, they [33:55] are going to extend the sewer [33:57] line, well, yes, in the short [34:00] term, that going to happen. [34:02] In the long term the tax value [34:03] nowhere near the taxes that are [34:06] going to be drawn from my house [34:07] to houses surrounding it. [34:08] Now you are going to lower that [34:11] and it makes no sense at all. [34:15] Again, there is a lot of issues [34:15] here. [34:17] You know you have two different [34:17] people. [34:18] This is america everybody wants [34:19] to do what they want to do. [34:23] I spent eight years in the army [34:24] expending that. [34:25] But the fact that is that it [34:28] does not fit.W a neighborhood [34:29] or a residential area, a good [34:31] thing going, you do not want [34:32] room by someone who did not [34:35] want to spend the money on the [34:36] building that was already [34:36] there. [34:37] So before you vote on this, [34:44] please d not just look at the [34:48] emotional side,, look at the [34:48] taxes. [34:50] I -- side, look at the taxes. [34:53] I am going to have a $500,000 [34:53] home there. [34:54] There is a huge difference in [34:59] what the city will draw in [35:00] taxes. [35:00] Thank you. [35:01] >> thank you. [35:07] Anyone else for public comment [35:09] on item number m5 1? Motion to [35:09] close public comment. [35:13] We have a motion and a second. [35:15] Is there any discussion? [35:18] All in favor. [35:20] Opposed, same sign. [35:20] Motion carries. [35:21] Mr. Loeb. [35:23] >> what is the future land use [35:25] map say on this sight? [35:27] >> the future land use map does [35:31] call it for low family [35:32] residential. [35:32] >> okay. [35:33] Does it call for any commercial [35:35] south of yorktown? [35:37] >> no, the area development [35:42] plan, the flower bluff plan [35:43] calls for commercial uses [35:45] between fire bluff and laguna. [35:47] So that is a reason why we did [35:48] choose to go with a [35:52] neighborhood commercial zoning [35:53] for this property. [36:00] >> okay, are there vacant, the [36:04] corner sight just to the north [36:04] is vacant? [36:05] >> yes. [36:07] >> how many vacant property is [36:08] there? [36:10] >> could you also point out toe [36:12] that on the -- out to that on the [36:15] map and make that area a little [36:15] larger? [36:18] >> yes, do you have closer? [36:29] >> I think, do psg~we have the next [36:30] slide over? [36:31] >> okay, that shows that [36:38] property to the north, that is [36:38] currently zoned commercial. [36:45] >> okay, can you point to it? [36:45] Okay. [36:48] Thank you. [36:50] >> we can see you writing on [36:51] it. [36:51] >> oh, I am sorry. [36:55] >> it is not showing up on my [36:55] screen. [37:02] This property right here is the [37:03] commercial property. [37:08] It is current I will vacant and [37:10] to the -- currently vacant and in [37:13] the north you can see the [37:15] storage that silty that is- [37:16] -storage facility that is [37:17] already there. [37:19] It is already zoned commercial. [37:21] I just want to know that note- [37:24] -want to note that again, it is [37:26] zoned commercial, it would [37:27] still have the limitations of [37:31] 400 square feet for that [37:31] property. [37:32] Also, I just want to mention [37:34] that the south portion of this [37:36] property right now is currently [37:37] zoned for a mobile home. [37:39] So if someone wanted to come in [37:43] and place a mobile home on that [37:45] property, they could without [37:45] any rezoning. [37:46] >> all right. [37:47] >> that is near residential [37:55] area that we are speak to go [37:55] today? [37:56] >> yes. [37:59] -- that we are speaking to [38:00] today. [38:00] >> I believe there is more [38:02] property to the north but also, [38:06] keep in mind, we do not have a [38:08] map here, but there is the aq [38:09] zone that comes off the field [38:14] and a lot of that is limited by [38:15] that particular -- [38:18] >> but a boat barn is fine [38:19] there, right? [38:20] >> correct. [38:20] >> okay. [38:24] But the the estate -- but the [38:25] estate residential is a [38:28] preferred use there as well, it [38:28] is not? [38:31] >> yes it is. [38:34] >> all right, the 20% rule? [38:34] >> yes. [38:39] >> does that mean it is [38:40] unanimous? [38:40] >> it requires a three-quarter [38:43] vote of the council. [38:43] So that is seven. [38:46] >> that is all of us? [38:48] >> I am not really convinced on [38:54] this so I think I am going to [38:55] vote no. [38:56] I think, I think this is [39:00] problem based on the zoning [39:03] districts we put together. [39:07] And so I, the thing, people [39:09] want to put boat barns near the [39:10] water around people want to [39:11] live near the water. [39:13] And I think it is really [39:17] beneficial for staff to work on [39:22] a zoning district that would [39:28] allow some of those water [39:31] oriented commercial [39:32] developments that are not [39:32] consistent. [39:34] Because I think doing all of [39:36] those by special permit is a [39:40] bad idea and I think generally, [39:43] just giving people industrial [39:46] zoning for them is really bad. [39:48] And then kind of just doing [39:51] them all case by case with the [39:53] special permit to maybe, maybe [39:56] it is changing cg1 to give it [40:00] an extra 60 feet if that is [40:03] what a standard boat barn bay [40:03] is. [40:07] But it just seems like the [40:08] ordnance is unwieldy and this [40:10] is maybe where we need to do [40:15] some work. [40:16] So that is my thoughts. [40:17] >> thank you. [40:19] You know, that is why we have [40:22] the process and we listen to [40:22] the public. [40:25] And I will tell you what [40:27] resinated with me, what Mr. [40:28] Meyer also said is the [40:29] President [Inaudible-low [40:32] volume] With the neighboring [40:36] property when it gets sold. [40:37] And once we do set a precedent [40:39] and then you are right, they [40:43] say well, we did it here and [40:45] you changed the whole intent. [40:50] So, I am listening to you. [40:54] And I hear you. [40:55] Ms. Mcintyre. [40:55] >> thank you. [40:56] Just listening and hearing for [40:56] little while on this one, I [40:59] have to tell you and it is a [40:59] hard one. [41:00] Because you want boats near the [41:02] water and you want to have [41:03] people have storage and with [41:05] code enforcement reel I will [41:07] trying to be strict about that, [41:10] it does create a great renied. [41:12] But I would echo david's [41:14] comments that having a zoning [41:17] that makes us not go to special [41:17] per nit every time -- permit [41:21] every time would be very [41:21] helpful. [41:27] When you go down yorktown, you [41:28] start the at the bridge and- [41:29] -start at the bridge and I [41:31] think it is important to keep [41:34] that, when you look, also [41:35] driving through flower bluff [41:40] and seeing how much commercial [41:42] property is available in the [41:46] bluff as general, it also [41:47] serves its purpose. [41:52] [Inaudible-low volume] That [41:54] has development just platted [41:55] recently, to take that out of [41:58] that and you look at properties [41:59] that are being put in the bluff [42:00] right now. [42:01] It is a great place to live and [42:03] people want to be there. [42:06] And there is residential [42:08] property being planned and [42:09] developed, you cannot drive [42:10] down the road without seeing a [42:13] new neighborhood coming up on a [42:13] regular basis. [42:16] And so it does not matter for [42:21] me to say this, I am not going [42:25] to support the changes. [42:26] >> Mr. Magill. [42:31] >> orange the traffic concern, [42:32] is there, is there not a [42:33] stoplight or a stop line? [42:35] I know there is not a light, [42:37] but is there not a stop sign? [42:41] >> it is an one-way stop line. [42:43] It is a two-way, I guess. [42:45] >> yes, can we take a look at [42:47] that as staff just to make sure [42:50] that that is the best possible [42:53] within the means of the [42:53] financial availability. [42:54] I just want to make sure that [42:56] is not a concern in the future. [42:57] >> will do. [42:59] >> and with this, regarding the [43:03] fact that it would require a [43:04] two-thirds, or three-quarters [43:11] today, is that with the zoning, [43:12] that Councilman Loeb and [43:15] Councilwoman Mcentire brought [43:15] up, I agree. [43:18] We give vast time to come back [43:20] with -- can we give staff time to [43:23] come back, can we table this? [43:26] Or I am just, I am posing the [43:27] question, do we give staff time [43:29] to come back with a zoning? [43:35] >> well, I think that is a fair [43:35] question. [43:38] However, to me, now, listening [43:40] to the concerns and I was very [43:43] impressed with the applicant of [43:45] taking all of those [43:46] restrictions and trying to [43:49] coexist and work well with the [43:50] neighbors. [43:51] But, it is not going to change [43:55] this area that was once [43:56] considered to me, my concern is [43:59] once this is dealt with, what [44:02] it does with the precedent [44:02] going forward. [44:06] And I am prepared to voted to [44:07] on this. [44:12] But, if is there anyone else, [44:18] excuse me, to Mr. Magill's [44:18] subjoinsdown. [44:18] Mr. Loeb. [44:19] >> -- suggestion. [44:19] Mr. Loeb. [44:21] >> I am ready to vote on this [44:22] today. [44:22] But separately. [44:24] I think staff needs to work on [44:26] modifying it so it is a [44:30] standard size, or whatever the [44:33] base zoning district for the [44:34] commercial is that allows [44:36] storage but upping it enough so [44:39] this, you know, the standard [44:41] vote will fit in one of those [44:44] or doing a different zoning [44:44] district. [44:45] But I think that is something [44:46] that staff needs to take some [44:49] time to really lock at rather [44:51] than just -- to look at rather [44:53] than us just telling them one [44:54] or another. [44:56] >> this is the second request [45:00] similar to this with the size [45:01] limb limitations. [45:01] -- limitations. [45:03] So the talk has been do we need [45:05] to modify that 400 square foot [45:09] limit to something like 600 or [45:11] 500 because it seems like 400, [45:15] 500 has been a common number [45:15] already twice. [45:16] So that conversation has [45:18] already been started. [45:21] >> yes, to Mr. Magill's point, [45:22] to have that separate [45:26] conservation and then come [45:26] back. [45:27] Mr. Magill, sorry. [45:30] >> thank you, I appreciate the [45:31] clarification. [45:31] So thank you. [45:35] >> thank you, Mr. Magill. [45:37] Appreciate your comments. [45:37] Mr. Garza. [45:38] >> thanks. [45:41] I was going to say the same [45:43] thing about us creating a [45:44] different zoning, it is [45:47] something that we missed when [45:47] working on the zoning [45:48] committee. [45:49] And it is the second time that [45:52] I have seen this issue come up. [45:53] But I do want to articulate [45:55] that we are going to be seeing, [45:59] I think, more and more requests [46:00] for zoning for boat storages [46:04] and RVs because of all of the [46:08] activity that we are seeing in [46:10] the laguna and in our area. [46:12] At some point, we are going to [46:14] rezone it and be able to allow. [46:16] Because it is going to take [46:20] some of the vote traffic out [46:22] and allow -- the boat traffic out [46:26] and let people just haul them [46:29] down the block, to the marina [ [46:31] Inaudible-low volume] We [46:34] need to keep that in mind. [46:37] >> thank you, Mr. Garza. [46:37] Ms. Mcentire. [46:41] >> thank you, I wanted, we just [46:43] dealt with this over at graham [46:45] and thompson road, right [46:46] between the two of those and [46:47] the size was the biggest [46:48] concern there as well. [46:50] And if we can have it so that [46:51] it is able to get in without [46:54] having to do a special permit, [46:57] I did want to echo, I made some [47:00] notes on one other thing that I [47:03] did want to say, the [47:04] developers, I think they are [47:06] great at putting in the [47:08] property and keeping it nice [47:09] and clean. [47:11] And really, you need to be [47:14] within code and building a [47:15] quality product that you really [47:17] want to live next to. [47:19] That is one, when you look at [47:24] their other ones, they are good [47:26] with being responsible with the [47:27] neighborhood. [47:30] I think that their ability to [47:31] work with the neighborhood has [47:32] been commendable. [47:33] >> and thank you for saying [47:35] that about the priest family. [47:37] Because their intention of the, [47:38] what they were trying to do to [47:40] coexist, to me, it is more the [47:43] long term of changing the whole [47:45] nature of this area for those [47:46] who invested in their homes. [47:48] That is what I have concerns [47:48] with. [47:52] And there is no doubt that the [47:52] priest family are first class [47:56] and really care about the [47:57] community. [48:01] Mrs. Huerta, we are ready to [48:01] vote. [48:03] >> okay, for ordnance number [48:03] 52. [48:04] >> excuse me, it is 51. [48:06] >> it is 52. [48:07] >> oh, I am sorry. [48:08] That was my error. [48:13] >> it is way on the bottom. [48:17] >> thank you. [48:18] >> for passage of ordnance. [48:30] >> [Roll call vote taken] [48:32] >> the ordnance fails. [48:35] >>> thank you, item number 53. [48:38] >> oh, let ice move forward to [48:39] disturb-let's move forward to [48:40] public comment. [48:42] We would like to have it [48:43] approximately around 12:00 P.M. [48:46] Thank you for the patience of [48:48] those who are waiting. [48:51] if you can come forward around [49:02] state your name an address [49:05] appreciate that, thank you. [49:07] >> mayor, council, jim, [49:08] recording secretary of U.S. [49:08] Local 235. [49:10] I am hear to share with the -- I [49:13] am here to share with the [49:16] council, and you, mayor, the [49:23] status of the ongoing labor [49:23] issue happening across the bay. [49:30] I would just like to share some [49:30] highlights with you. [49:34] Since bargaining started in [49:37] July of 2014, we have demanded [49:40] deep cuts in pay and benefits [49:43] for our local numbers. [49:45] -- members. [49:48] On October 10th, after re- [49:50] rejected their offer, the [49:55] company locked the gates and [49:55] locking out 450 families. [49:59] It effects our economic base [49:59] here in the [50:03] city and we feel [50:07] that the cuts are unnecessary, [50:11] sherwin is an extremely [50:11] profitable company. [50:15] They have falling production [50:16] costs with rising production [50:19] over the last ten years. [50:25] They are 100% owned by glenn [50:26] core ag. [50:28] And publicly owned trading and [50:34] mining company head quartered [50:34] in switzerland. [50:38] Glenn core is the tenth largest [50:42] company in the world. [50:48] They have revenues of $233 [50:48] billion in 2013. [50:50] Net profits of $4.6 billion. [50:52] This is the first labor dispute [50:58] that we have had since they [51:01] bought us in 2007. [51:02] The repercussions on this [51:04] economically and e. Coli [51:04] notionally to the -- and [51:08] emotionally, we would like to [51:09] ask the council to support both [51:13] sides on this an urge them to [51:16] come back to the table and [51:17] reach a good resolution so [51:19] everyone can move on with their [51:19] lives and our neighborhood can [51:23] get back to where it needs to [51:23] be. [51:25] Thank you very much. [51:26] >> thank you for coming today. [51:27] >> [Inaudible-multiple [51:27] speakers] [51:31] >> we are not able to engage [51:34] per the open meetings act, only [51:35] for clarifications and [51:36] corrections. [51:36] >> very good. [51:37] Thank you all very much. [51:38] You have a good holiday. [51:48] >> thank you, same to you, sir. [51:55] Anyone else here for public [51:55] comment? [52:24] He is passing out something [52:26] from the kn.E [52:27] rbeach community [52:27] association. [52:31] I am the President Of that [52:33] group in north beach. [52:34] Colleen just said that flower [52:35] bluff is a great place to live [52:40] and people want to be there. [52:45] And because of that, your, your [52:46] discussion revolved around the [52:49] fact that you are representing [52:50] residents and taxpayers and [52:51] keeping them in mind. [52:52] And that is what we want to [52:52] north beach. [52:54] It is a great place to live and [52:55] people want to be there. [52:57] And yet in my neighborhood, on [53:00] the authority end of not beach, [53:01] street -- north end of north [53:04] beach, the street is filled [53:05] with potholes most of the time. [53:08] This is no sidewalk, no [53:10] gutters, no curbs, the water [53:12] pipe is six inch and it is [53:14] water front land that is empty [53:16] with a six in67 water pipe and [53:20] it has -- inch water pipe and- [53:23] -and it has been that way in a [53:24] long, long time. [53:26] In the 1990s, the city invested [53:33] on the south side of the beach [53:34] and improved the infrastructure [53:35] there. [53:36] And it is beautiful when you [53:39] drive all the way to the [53:40] aquarium in the lexington. [53:41] But on the north half at beach [53:43] up there where the tax bayers [53:47] live, that area has not been [53:47] improved. [53:48] We got improvements on the [53:51] beach through a bond but we [53:52] have not had neighborhood [53:53] improve. [53:57] S. So that is what the pack- [53:57] -improve. [54:00] S. So what is what the pack -- so [54:02] that is what the packet here is [54:02] about. [54:05] The first one is not [54:07] necessarily for infrastructure. [54:10] This is the hotel tax, it is [54:11] asking you use that on north [54:12] beach for the things that it [54:14] can be used for on the beach [54:14] itself. [54:17] And that is explained in the [54:19] first letter. [54:22] The second letter talks about a [54:24] tax financing zone and we have [54:26] been talking about this for a [54:27] long time. [54:29] In fact joe and kevin came to [54:31] talk to us in 2009 and told us [54:32] what it would take, how we [54:34] needed to do it, how the [54:36] process would work and you [54:40] know, it fell between the [54:40] activities. [54:41] We didn't --- between the cracks. [54:42] We didn't have a champion. [54:45] And because there is no funding [54:47] for north beach. [54:51] For authority beach improves. [54:53] You now -- for north beach [54:53] improve ments. [54:56] It is like how do you get in [54:57] line. [54:58] You know, how do we do this? [55:01] Well, right now, it is |Spjust not [55:01] on the radar. [55:04] So we are not going to get on [55:05] the improve project list [55:06] really, for major improve. [55:09] S so we think that if we did a [55:11] tiff, just like downtown has [55:28] and the island and other areas. [55:29] >> thank you, Miss Meyer. [55:31] Thank you for coming. [55:31] >> mayor, council, I am [ [55:33] Inaudible-low volume] [55:36] >> can you move the microphone [55:38] closer to you. [55:39] That is lot better. [55:43] >> I am Ms. Waller. [55:47] I live at 6133 hastings drive [55:48] in Mr. Garza's district. [55:51] And it is my privilege to serve [55:54] a third time as the Chairman Of [56:02] the corpus christi housing q-x` [56:07] authority board of [56:09] commissioners. I want to talk [56:16] about where we have a major [56:17] roadblock. [56:22] When I cam on the board, it was [56:25] in dis-awry, we were facing a [56:27] shutdown, a quite sincere [56:33] shutdown effort on the part of [56:37] ud-part of hud because it was [56:38] mess. [56:43] And it had been neglected. [56:43] There was a crisis. [56:46] And in recorder to you have [56:48] problem, a -- and in order to [56:50] solve that problem, a new board [56:52] was picked to get this thing [56:53] back together. [56:55] Now hud, unlike a lot of [56:56] federal agencies takes the [56:57] position that if you are not [56:58] doing thicks well, you do- [57:01] -things well, you do not get [57:01] money. [57:04] They decrease your money as you [57:05] do things worse and worse. [57:07] And we were a troubled agency. [57:10] Over the years we have been [57:12] able to moved from a troubled [57:15] agency to one that is a high [57:16] performance agency. [57:18] And I am going to tell you [57:20] frankly, we have done it [57:24] without the help from the city [57:25] of corpus christi. [57:28] We have had good leaper ship [57:29] and -- good leadership and [57:30] excellent staff. [57:36] In that time we have been 1)]Not [57:40] only to right a sink ship. [57:41] We built housing for the [57:45] elderly and we have been trying [57:47] for years to renovate, to make [57:49] it from a place that no one [57:51] wants to even walk in to a [57:54] place where you want to be [57:56] there and to be, to raise your [58:00] children there in a safe, good [58:01] environment. [58:04] I know of two times we have [58:11] tried to get an old hope sticks [58:12] project. [58:14] And that federal money to [58:15] revitalize an area, zero help. [58:17] And the last time that hope [58:20] sticks was funded, we were in a [58:22] tie for the last bit of money. [58:24] And the reason we were told [58:26] that we didn't get it, one of [58:29] the main reasons was that we [58:31] had no support from the city. [58:32] Well, I have talked too long. [58:33] >> thank you. [58:35] >> I would like a chance to [58:38] talk with any of the council [58:39] members individually, if they [58:40] want a briefing on what we are [58:51] doing and what we are trying to [58:51] do. [58:53] >> thank you, Miss Waller. [58:58] >> I am gary, I am the ceo of [59:00] the housing authority. [59:02] I think that the piece that Ms. [59:03] Waller didn't get to was the [59:05] real reason that we are here [59:06] today. [59:09] We have been working through [59:11] the city so processes to -- city [59:13] processes to get some gap [59:14] funding to make this process, [59:15] or this plan work. [59:18] And in the last two days, we [59:21] have been removed from two two [59:22] agendas that we thought were [59:24] going to put us in a position [59:26] to move forward. [59:28] Yesterday, re-were moved from [59:30] the type a board and we were [59:33] replaced by a presentation [59:35] obama health the -- presentation [59:41] and the value on the [59:43] feasibility and impact of new [59:43] home construction. [59:46] So we are not sure why that [59:47] happened and then thought, I [59:48] thought -- and then today, I [59:49] thought we were on the agenda [59:51] to have a resolution of support [59:53] that we were going to be able [59:55] to use with hour hud [1:00:01] application and that has been [1:00:01] pulled as well. [1:00:03] So we are trying to understand [1:00:05] the process and be a good [1:00:07] partner in trying to address [1:00:08] the affordable housing crisis [1:00:10] but we feel like we are not [1:00:12] sure where we are in the [1:00:14] process at this time and @3\~we [1:00:16] wanted to bring this to the [1:00:17] council's attention because we [1:00:19] seem to hear good things from [1:00:20] the council. [1:00:22] But it does not seem like they [1:00:24] are getting any traction in [1:00:26] taking the next steps. [1:00:28] So that would really conclude [1:00:29] our ywm [1:00:29] rovide [1:00:31] the information that we thought [1:00:33] you needed to know. [1:00:35] >> thank you. [1:00:36] Mr. Olson? [1:00:39] >> just a clarifying comment on [1:00:43] the meeting yesterday, it is my [1:00:44] understanding that the board [1:00:48] took up the question about [1:00:49] modifying their policies that [1:00:51] would, and voted on a 3-2 vote [1:00:53] to go ahead and modify the [1:00:55] policies that would allow for [1:00:58] the use of type a money for [1:00:59] rental which would then open [1:01:01] the door to be able to deal [1:01:03] with the issue [Inaudible- [1:01:04] low volume] [1:01:06] >> so toe clarify also -- so to [1:01:08] clarify also, now that the vote [1:01:10] has been taken, with changing [1:01:12] their policy to using some of [1:01:17] the affording housing type a [1:01:19] funds for rentals, now it is on [1:01:22] the agenda at our first January [1:01:22] meeting. [1:01:23] That is correct? [1:01:29] >> I am not suring of the [1:01:30] timing. [1:01:33] >> it is on our next, first [1:01:33] available meeting. [1:01:35] >> it is January 13th. [1:01:39] >> okay, could we put that on [1:01:40] the agenda, please? [1:01:41] >> [Inaudible-low volume] [1:01:42] Says yes, behind you. [1:01:44] >> okay, we are good then. [1:01:48] >> if she says yes, that is [1:01:48] yes. [1:01:49] >> our deputy city manager, [1:01:52] would you like to address the [1:01:53] clarification any further? [1:01:56] Okay, thank you, Mr. Olson. [1:01:58] I appreciate that. [1:01:58] Mr. Loeb. [1:02:02] >> is that going to meet, the [1:02:06] deadline to get stuff into hud? [1:02:09] >> yes, it does meet the [1:02:11] deadline, sort of. [1:02:15] We do not have a drop dead date [1:02:16] to submit the application. [1:02:17] our biggest concern is that we [1:02:20] have been work orange this for [1:02:21] several months at this time and [1:02:26] while we all have a place to go [1:02:27] home to, there are many people [1:02:30] in corpus christi that do not. [1:02:31] And there are 90 units that we [1:02:36] can be work together get online [1:02:37] and make available for the low [1:02:41] income families and we are not [1:02:41] doing that. [1:02:44] So time is important, as much [1:02:44] as possible. [1:02:46] >> I probably will not be [1:02:47] voting in January. [1:02:50] But in the meantime, just [1:02:51] because the council cannot, [1:02:54] does not have it on our agenda [1:02:58] to have a resolution, does not [1:03:09] keep us from individually [1:03:09] commenting! [1:03:10] Thank you. [1:03:12] >> thank you. [1:03:12] >> Mr. Ma dina? [1:03:14] >> I am [Inaudible-heavy [1:03:15] accent] [1:03:17] I live at 5413 cane drive here [1:03:18] in corpus christi. [1:03:22] We had a problem with a code [1:03:23] enforcement. [1:03:28] It is a sad state of affairs, [1:03:28] really. [1:03:30] The codes are not enforced. [1:03:31] The gentleman that is enforcing [1:03:33] the code in my particular area, [1:03:34] the day before yesterday, I was [1:03:36] talking to him and my son, and [1:03:40] he was telling me is there no [1:03:42] code to address the fences back [1:03:44] there, when a business butts [1:03:44] with a residential. [1:03:50] That is my case, my property. [1:03:55] Also, is there no code, no book [1:03:57] that the canopy trees that they [1:03:58] are required to plant, tell [1:04:00] them you need 30 feet, the [1:04:03] trees have to be at least 30 [1:04:03] feet apart. [1:04:06] The fence has to be at least [1:04:08] six feet, I know that. [1:04:09] but this gentleman does not [1:04:12] know the rules how is he going [1:04:13] to enforce them? [1:04:15] We have a big problem on cane [1:04:16] drive. [1:04:18] They are going continue to [1:04:23] build in that and they have not [1:04:27] had any residential houses [1:04:30] because the property was not [1:04:31] for a sale. [1:04:32] Two houses from mine, it is at [1:04:35] least a foot and a half high [1:04:39] and it has been like that for [1:04:40] several months. [1:04:41] Nay do not cut it. [1:04:45] There are five or -- they do not [1:04:45] cut it. [1:04:47] When the trash goes out, nay [1:04:48] put out both cans, all though [1:04:52] they are required to only put [1:04:53] one. [1:04:53] >> [Captioners transitioning] [1:06:38] >> Mr. Gordy. [1:06:39] >> I live at 4118 ray drive. [1:06:41] He's passing out some papers. [1:06:44] >>> all of you got a letter [1:06:47] from me talking about the code. [1:06:52] It needs to be looked at and [1:06:53] some changes need to be made, [1:06:58] because the unified developing [1:06:59] code says one thing, and the [1:07:00] highway beautification act says [1:07:00] something else. [1:07:06] I would just like 2 -- the [1:07:07] legal find out there come the [1:07:08] state law says one thing and [1:07:10] the unified developing code [1:07:11] says something else. [1:07:14] What you have there on the very [1:07:18] front is the agreement, and [1:07:18] eisai agreement come a the [1:07:23] state attorney says it's not an [1:07:24] agreement. [1:07:24] But my impression is, and [1:07:25] everyone else's, if the city [1:07:26] says we will do something if we [1:07:32] can get the money, to me, that [1:07:37] is an agreement. [1:07:38] And they will enforce the [1:07:39] beautification act. [1:07:44] and they say they will collect [1:07:45] the sign permit. [1:07:50] They taught me that in the [1:07:50] first grade. [1:07:51] You might want to look at that. [1:07:54] The second page that you have [1:08:05] there, the letter you got from [1:08:07] susan thorpe. [1:08:08] They said that your local [1:08:12] government code restricts the [1:08:14] municipality and they got a [1:08:19] copy of that on the third page [1:08:20] of the local government code. [1:08:22] Yes, there are certain things [1:08:23] you can't do. [1:08:25] You can charge them for a [1:08:25] permit, you can't make them pay [1:08:28] so much per day to put the sign [1:08:29] there, and you also got a copy [1:08:33] of the state law and highway [1:08:34] beautification act, you will [1:08:46] notice the second part is [1:08:46] highlighted. [1:08:50] And, the highway beautification [1:08:53] act doesn't cover political [1:08:54] science. [1:09:02] That doesn't couple cover the [1:09:02] political science. [1:09:05] This covers political signs on [1:09:08] those 14 roadways, not the [1:09:08] highway beautification act. [1:09:10] The city staff needs to sort of [1:09:13] go back to school and do some [1:09:19] research and learn how to read. [1:09:23] That's pretty clear how that [1:09:26] senate bill 446, that covers [1:09:31] political science. [1:09:32] And also, the city with [1:09:33] certified, easy on the third [1:09:33] page when it was certified. [1:09:35] And they got certified as the [1:09:37] only two cities in corpus [1:09:40] christi that were certified to [1:09:42] enforce the highway [1:09:43] beautification act. [1:09:44] >> thank you Mr. Gordy. [1:09:47] We finished, but a few -- we [1:09:52] are going to get a memo [1:09:58] requests for some of these [1:09:58] contradict team language that [1:09:59] has been brought to our [1:10:00] attention. [1:10:02] We will get into remission on [1:10:03] that in writing. [1:10:08] Thank you, Mr. Gordy. [1:10:11] >> Mr. Montesano. [1:10:17] >> rocco montesano, 2101 rialto [1:10:17] drive. [1:10:18] I'm not going to talk about [1:10:19] housing, but so many good [1:10:19] things have gone on in the city [1:10:21] in the last year. [1:10:22] I didn't want to end it with [1:10:24] the bad note. [1:10:28] Want to thank counsel and staff [1:10:28] are taking action. [1:10:31] The lexington problem on north [1:10:33] beach in relation to water and [1:10:35] my pipes breaking and also the [1:10:40] sidewalk on the beach that fell [1:10:40] in. [1:10:43] Quite honestly, much faster [1:10:43] than anticipated, the staff got [1:10:53] on it and contracted it to be [1:10:53] fixed. [1:10:53] We went and talked to the guy [1:10:54] putting the concrete in for the [1:10:59] city and he agreed if we got [1:10:59] him to come over to the patio [1:11:01] to reroute my pipes under the [1:11:03] patio, we were able to contract [1:11:03] that. [1:11:05] But the city stepped up and [1:11:07] rerouted that water, so don't [1:11:10] expect to see me back here [1:11:11] talking about [1:11:12] broken pipes in lexington, it [1:11:22] cleaned up the area quite a [1:11:22] bit. [1:11:23] But as the year closes I wanted [1:11:23] to thank the staff and council [1:11:24] for actually taking some pretty [1:11:25] good action over there on north [1:11:25] beach to get lexington up and [1:11:26] going again and hopefully [1:11:28] present the problem in the [1:11:28] future. [1:11:32] Merry christmas and happy new [1:11:32] year. [1:11:33] >> thank you Mr. Montesano. [1:11:45] anyone else here for public [1:11:47] comment but. [1:11:54] >> elena soldotna 4710 tackle [1:11:54] drive. [1:11:55] First of all, merry christmas [1:11:56] or happy hanukkah, whichever [1:11:56] when you celebrate. [1:11:57] As the year comes to an end and [1:12:01] we start a new year and a new [1:12:03] counsel, please take into [1:12:10] consideration some of the [1:12:10] things. [1:12:11] You have done some good things [1:12:12] and I will never argue that you [1:12:12] haven't, but I want you to keep [1:12:13] in some of the things that you [1:12:13] need to remember. [1:12:17] There are all sorts of rumors [1:12:17] about bayfront resurfacing. [1:12:19] I hope that is not true. [1:12:20] And I want you to make sure [1:12:23] that you understand that the at- [1:12:28] large representatives represent [1:12:28] the [1:12:28] whole city emma and that you [1:12:29] keep that in mind as we go [1:12:34] forward in this year. [1:12:35] And, you know, that we get away [1:12:36] from this illegal annexation [1:12:38] and all the things that go [1:12:38] along with it. [1:12:39] We want to make sure that as [1:12:41] you go into the new year, you [1:12:45] have a prosperous year. [1:12:45] And in that prosperity you [1:12:47] keep the citizens in mind. [1:12:49] So emma merry christmas. [1:12:55] >> dairy christmas to you. [1:12:58] Anyone else here for public [1:12:58] comment? [1:12:58] Okay. [1:13:08] It's move into executive [1:13:16] session. [1:13:16] >>> before we move into [1:13:19] executive session, I apologize. [1:13:24] I'm meant to finish our public [1:13:24] hearing. [1:13:58] Item 53 is a request by the [1:14:02] property owner to rezone land [1:14:05] at the northwest corner of [1:14:10] folly and south staples road. [1:14:13] The owners requesting the [1:14:15] rezoning to cg two, general [1:14:16] commercial. [1:14:20] To allow the construction of [1:14:21] single-story approximately [1:14:22] 18,400 square-foot restaurant [1:14:25] and bar with about 7600 square- [1:14:31] foot exterior deck space. [1:14:34] The rezoning is consistent with [1:14:36] the future land-use in the [1:14:37] south side. [1:14:38] Development plan. [1:14:39] As such staff recommends [1:14:41] approval of the rezone.
