I pledge allegiance to the [1:03] Texas one state [1:06] one and indivisible. [1:14] » We'll move on to the consent agenda. [1:16] Approval of the minutes from August [1:18] 10th, 2076 regular council meeting and [1:20] approval of July financials and bills. [1:23] >> Make a motion we approve the consent [1:26] agenda. July financials and bills. [1:29] Second [1:31] >> a motion and a second. Any further [1:33] discussion? All in favor? I. [1:36] >> Any oppose? There are none. [1:39] >> Move on to public comment. I don't have [1:41] any public comment. [1:45] We'll move on to item two. [1:49] Public hearing. The city council act as [1:53] a city of Delhart building and standards [1:54] commission will hold a public hearing [1:56] regarding property located at 102 east [1:59] first street dart Texas substandard [2:02] structure consider act and issue [2:05] necessary orders regarding the [2:06] substandard structure located at 102 [2:09] East 1st Street Delhart Texas [2:13] make the motion that we open the [2:16] >> so uh public hearing regarding [2:20] location 10002 East Street. [2:22] >> Second. [2:23] >> Motion second. Any further discussion? [2:26] All in favor? [2:27] >> I. [2:28] >> Any folks? There are no hearing is open. [2:33] >> Tonight is just a public hearing uh [2:35] regarding this property. This property [2:37] we've been working on for a while. [2:42] Just going to kind of walk you through [2:43] where we're at and what our possible [2:46] next steps were. And like I said, [2:48] tonight's just the public hearing. [2:52] » So, I'm presenting this um here to you [2:54] guys for like like you mentioned, the [2:56] public hearing. We've been in the [2:57] process of this since June 7th, 2024. [3:00] This property has been an issue um with [3:03] a public nuisance when it comes to um [3:07] just the structure. It's unsafe, the [3:10] fire hazard, the nuisance that's caused [3:12] for the neighbors around um the property [3:15] as well. [3:17] Um, [3:19] we first initially entered this property [3:22] on June 6th of 2024 and it was be uh [3:25] because of the Dowart Police Department [3:27] is what got me in initially. Um, they [3:29] called me in for concerns of the safety [3:32] of the property um and living [3:34] conditions. um the inside of it at the [3:37] time. These are updated um the most [3:40] recent ones, the ones that were from the [3:42] beginning um were a little bit more uh a [3:46] lot more debris and trash from the [3:47] inside. Um electrical wire was exposed [3:50] from the walls. Um let's see. The [3:54] utilities for atmosphere for gas wasn't [3:57] on. Excel was discontinued that day due [4:00] to the wires hanging out of the walls. [4:03] Um so XL did come and pull meters that [4:06] same day. Um [4:10] then to the water department here to see [4:12] their active water act. [4:19] There's people living inside this home. [4:21] There still is. They're still in active [4:23] inside and out. Um when we first [4:26] initially gave them the information for them not to be able [4:32] to be inside um that same night we think [4:36] police department issued three citations [4:38] for three people found to sleep inside. [4:40] Uh citations were issued. They had to go [4:42] through Miss Bethmore. Um [4:46] this was during our previous ordinance [4:49] as well. We just did a new one which was [4:52] approved recently and that's where we're [4:54] doing the new notices and this is where [4:56] we bring it to you guys. Before it was [4:57] through the district courts. Um now this [5:00] new ordinance has allowed us to present [5:02] it to you and for you guys to look over [5:04] and just kind of look over the um [5:06] information that we have received from [5:08] any of the the nuisances that we've or [5:12] that were caused with this one. So, um [5:17] I know per our ordinance um that we do [5:20] currently have now once we present to [5:23] you guys, the next step would be we [5:25] would have another which we're going to [5:28] issue for an act on for the next meeting [5:30] that we have with you guys. Um and it's [5:32] going to be an act which would be if you [5:35] guys would approve. Um and what we're [5:38] looking at here is for the property to [5:40] be demolished and or removed. um [5:44] depending on y'all's decisions on how we move forward this. But I feel that [5:49] since June 7th of 2024, we were pretty [5:53] lenient. I was pretty lenient with [5:54] notices giving her time to get in. Um [5:59] and there was just nothing ever done. Um [6:02] as y'all see the the top of the home, [6:05] I'm not sure what they were doing from [6:07] on top. I mean, when all this went [6:09] through, they removed the roof. So, I'm [6:13] not sure what their plans were, but [6:17] there still it still looks the same. [6:18] Nothing's been done, and they haven't [6:20] done any There's no progress that's been [6:22] done to it. [6:28] » I'm guessing they're not here tonight. [6:30] Yeah, three right here. [6:32] >> I'll let them speak here in just a [6:34] minute. [6:40] I want to hear from him and then we'll [6:42] Yes. King [6:45] » I'm not sure. I don't know your name. [6:46] Come on up. [6:51] » And um Okay. I inherited the place and [6:55] had no idea honestly. I I just moved in [6:58] the second apartment because it's duplex [7:00] and my family had lived in that one [7:02] which was Ben. Well, three months after [7:04] he moved me in the other apartment, he [7:05] died and I got left the whole thing, [7:08] which was sudden. And then due to a a [7:13] boy that my daughter was hanging out [7:14] with is why the cops were there that [7:16] time and they called her in. Okay. They [7:19] told me that it was a fire hazard and to [7:24] fix everything or to that I had I had to [7:26] fix the the wiring, right? Well, I was [7:28] diag I got diagnosed with cancer in [7:31] November of 24 and went through chemo [7:33] and and radiation and all that. And [7:36] right after in November of 24, she came [7:40] to me with a guy from the water [7:42] department and told me that they were [7:44] going to tape it off for demolition. [7:45] Okay, she that's the only thing she has [7:47] talked to me about since is demolition. [7:49] And and I was working on it. We actually [7:51] intentionally like literally put [7:53] everything we had into this last [7:54] inspection, right? And she she told me a [7:57] week before inspection, she said, "Well, [7:58] I don't know why it's it's sagging down [8:00] right there in the middle, which is the [8:02] garage. It's not the house." And uh so [8:05] what do we do? We we try to fix that. [8:07] And that's where that came in. Okay. And [8:09] the hole in there. The only reason why [8:10] it's there is cuz she told us it was [8:11] sagging down. We had to fix it before [8:13] the inspection. Well, when she came the [8:15] day of the inspection, I had just a [8:17] friend of mine was a blessing bought me [8:19] the plywood and everything because mind [8:20] you, I'm on I'm on social security right [8:22] now. You know what I mean? I don't have [8:23] the money to fix it. I didn't go [8:24] purchase this home. I just it's my my [8:26] residence, you know what I mean? So, I'd [8:28] put in as much to it as I can as I go. [8:31] And before the cancer and then after, [8:34] you know, I'm just still struggling. But [8:35] I'm on social security. That's all I [8:36] have now. But the day of the inspection, [8:40] she refused to even go in and look at [8:42] the house. And we had done everything [8:43] but the roof. Everything. All the little [8:45] stuff that she told us to do. I didn't [8:46] get the electrician and the plum and the [8:48] plumber there, but everything else had [8:50] been done. and she didn't refuse to go [8:52] in and look at it because the roof [8:53] wasn't done. He was up there working on [8:55] it when she came. So she I mean she the [8:57] whole time we've been steady trying to [8:59] do what I can. It's not like we've just [9:01] been not doing anything and we haven't [9:02] done anything since that day because she [9:04] told us I couldn't. She told me I could [9:06] not work on it no more that I've hearing [9:08] from their lawyer and I've been hearing [9:10] that probably for about a year and a [9:11] half from her. Okay. And I've I've I've [9:13] reached out. I've asked her for a list [9:15] of specific things that needed done [9:16] before that inspection. She never would [9:18] give them to me. She told me she works [9:19] on pictures. Okay. Well, all the [9:21] pictures that she gave me the first day [9:23] are all of a the other apartment. Okay. [9:25] None of them were the apartment I was [9:27] fixing up except one. Okay. First of [9:29] all, second of all, it's came it came a [9:31] long ways. It It really did. And the [9:33] other one I would like to um ask y'all [9:36] if there's any way possible if we could [9:39] inspect that one and maybe let me keep [9:41] the other apartment, get it ready now [9:43] because the other one I mean I could [9:46] still do that one too. I mean, but it's a long road and it's been hard. [9:50] cuz I ain't got the money [9:51] and I've been trying to do what I can [9:53] and she but demolition is basically the [9:55] only thing she's been telling me. She [9:57] told me $25,000 that I would be indebted [9:59] to the city for the demolition and that [10:01] I'd have to pay that back before I could [10:03] do anything. I mean, it's just [10:05] unbelievable. I don't know how y'all [10:06] work or how it goes, but I know that [10:08] that's definitely not, you know what I [10:10] mean? I'm living in it trying to fix it [10:12] up. I'm It's not like abandoned or [10:13] nobody's doing anything. You know what I [10:15] I'm doing what I can and it's not it may [10:18] not be much but it's it's what I can [10:20] right now. All I ask is please think [10:23] about it and maybe let me fix the other [10:26] one and if you have a list of what needs [10:27] done or something for y'all or something [10:29] in a timely manner it needs. I don't [10:31] know. I don't know what else to do. It's [10:32] my home [10:34] and it's just me by myself now. So I [10:37] don't know what else. [10:38] >> Well, hang on. Do y'all have any [10:40] questions for her? [10:41] >> So Lacy, you you're living in one side [10:44] of it. since the folks came, they they [10:46] told me I couldn't live in it. So, I [10:48] I've been living in my car out front in front of this house for two years [10:52] because I mean that's my home. I don't [10:53] have money to go put into something else [10:55] if I'm still going to have this. You [10:56] know what I mean? I don't want it to [10:57] just the taxes and everything to add up [10:58] and add up on it and me be somewhere [11:00] else. You know what I mean? I didn't see [11:02] the point in that. And I had dogs and I [11:03] really couldn't I really didn't have [11:05] anywhere to go. So, I've been steady. [11:08] I'm trying to go back to Hod's little by [11:10] little, you know what I to work. But I [11:11] still have my social security and I mean [11:13] it's it's hard. I've been staying in my [11:15] car though trying to make things work. [11:24] » This is my daughter by the way. [11:28] >> Do you live in the residence as well? [11:30] >> At the time. [11:33] » Yeah. [11:35] >> Okay. Um, so yes, she uh there the first [11:39] time that they went and the citations [11:40] got issued the after that everybody [11:42] moved out of it. After the citations and [11:44] the they got tickets, everybody moved [11:47] out. Nobody lives in the house. Nobody [11:48] stays in the house. Nobody sleeps in the [11:50] house. There's in the house. There's no [11:53] furniture to live in the house. There is [11:55] nobody occupying that space at all. Now [11:57] there's constantly probably people [11:59] outside and you know going in and out [12:01] because my mom is trying to do whatever [12:03] she can to keep it but it's not nobody [12:06] else is staying there anymore. We've [12:07] done we've tried to follow what she said [12:09] and every time I ask my mom you know [12:11] what I mean well what exactly needs to [12:12] be done. She didn't have any she had no [12:14] idea what to do and she's single like [12:17] she she doesn't have anybody to help [12:19] her. It's just her. If anything could [12:21] y'all please just give her some more [12:22] time. I finally got a job now. I mean, I [12:25] am working and I will do what I can to [12:27] make improvements or demolish it even, [12:30] but she has nowhere else to go. And it [12:32] was a blessing from God that she even [12:33] got this place. And I just beg y'all [12:36] please to give her another chance [12:38] because she hasn't been specific and she [12:40] has been no she hasn't she just hasn't [12:43] been specific and she's said she's been [12:45] lenient and what and whatnot, but she's [12:48] I really feel like she's just been I [12:50] don't know. I just I just hope that [12:52] y'all give my mom another chance because [12:54] we didn't know what we were supposed to [12:56] do, what we could do, what we couldn't [12:57] do. [13:00] It wasn't fair. So, to correct her on [13:02] that, I have notices that I've provided [13:04] to Liy. She had notices sent to her [13:07] every single time um from the first of [13:10] the uh ordinance that we first had. Then [13:14] we had this new one that came in and I [13:16] also send notices then too. So, it's not [13:18] that they never received. They received [13:20] notices on the structure of the building [13:24] of the home and the correction. I I even [13:27] went and did my own little inspections [13:29] on there and then would give them a [13:31] paper which I do have here. Anything and [13:33] everything. I'm a very documentative [13:34] person. So, I make sure the documents [13:36] that I have are provided to them as well [13:38] and then I would sit notice. So, um if [13:42] they have their notices on them, that is [13:43] on them. But I do have copies. So [13:46] >> I've done my part from the city of D for [13:47] us to make sure that we're following our [13:49] proper procedures. [13:51] >> Notice you would have to [13:52] >> Yeah, I have [13:55] the original. No, she would never give [13:57] it to me. The original the first day [13:59] those the violation then she wouldn't [14:02] give it to me. Tell me she operates on [14:04] her pictures. And mind you, when you [14:06] look at these pictures, they raided me [14:07] before they called her. So they [14:09] destroyed my house on top of what what [14:11] was there. [14:12] >> That's a PD matter. It's not a code [14:15] matter. [14:16] >> I think that's what those pictures [14:23] » mean. I will say we've been working on [14:24] this for two years. This has been a [14:27] sticking point of mine. I ask for [14:30] updates quite regularly on this where [14:34] we're at, how [14:35] >> police reports as well. Again, [14:38] >> forward. Is there progress being made [14:41] there? And [14:45] >> she told me not to do anything after the [14:47] last inspection though. [14:48] >> And there's still progress with there's [14:50] been a lot of progress made [14:53] >> since day one. Yeah, there has been. But [14:56] like two years [14:57] >> I I had a camper out in my driveway and [15:00] I got a violation and put they put on it [15:02] as if it was a a semi in a residential. [15:04] Like what is that? You can't be in no [15:06] alley or a public street, but it was in [15:07] my driveway. She was asleep in this RV [15:09] and when we went in there we had to [15:11] remove her from the RV where the police [15:13] department again found paraphernilia [15:14] inside. [15:15] >> Had to remove me from the [15:17] >> Yes. We asked you to come out. [15:20] >> Had two people. This was coming from her [15:23] and that I mean all kinds of stuff. She [15:25] went and called the cops to come take [15:26] her through there and make sure it was a [15:28] safe structure. Well, it was always a [15:29] safe structure before. So, I don't know [15:31] why it wouldn't have been there. You [15:32] know, I mean, it's been a constant [15:33] battle with her. She has not nothing but [15:36] demolition has been her solution since [15:38] day one. That's all she wants to do and that's [15:41] all she'll hear. And I just don't think [15:43] that's fair. I mean, I don't know any [15:44] people out here who are working on their [15:46] house and that y'all are out there doing [15:48] that. You know what I mean? There's a [15:49] semi that's parked a block away from me [15:51] every night. Every night full semi [15:53] parked right there and they don't tell [15:54] me nothing. I feel like it's been a [15:56] straight harassment since day one. And [15:58] I'm sorry, but that's my my thoughts on [16:00] it. [16:05] The day after I freaking found out I had [16:07] cancer, I talked to her. That's when [16:08] they were taping it off for demolition. [16:10] And that was in 20 in 24 in November 24. [16:14] >> And I'm going to correct that. We have [16:16] not we have not scheduled the demolition [16:18] date one time. [16:18] >> No, we haven't scheduled demolition for [16:20] anything. [16:22] >> That's all. She threatened me with it. [16:23] That's what she told me. Then [16:28] >> all she told me, I've been dealing with [16:29] it for a while, y'all. [16:34] tell me my cancer didn't lay well with [16:36] her schedule. I mean, me and her have [16:38] had words and and she's been in my face [16:39] yelling at me and it's been it's been [16:41] bad. I mean, [16:42] >> okay, we're we're here to discuss this [16:44] matter, not not a personal agenda here [16:49] for for this council. We just need to [16:51] know the facts as far as the property is [16:53] concerned. [16:57] » Far as the property is concerned, I went [16:59] the legal process. We made sure we [17:01] issued the warrant properly through the [17:04] judge. It was signed for us to enter and [17:07] that's where we got these pictures for [17:08] the second part. So the first part was [17:12] the initial um what Tai has in his hand [17:14] right now. That was the first initial [17:16] entry is whenever the warrant was issued [17:18] with PD. What got me in to begin with? [17:21] Um this is the second search warrant [17:24] that was for code that got me in for the [17:26] second one. [17:36] I want to say this. [17:39] Yeah, I like too. [17:56] Is there another like little apartment [17:58] that he's talking about or is that [17:59] >> the duplex? Um, [18:01] >> it's all the same, [18:02] >> but they they have the same they use the [18:04] same water meter. [18:05] >> They have two separate water meters in [18:07] the same bill. [18:08] >> They only had one meter, which we that's [18:10] what we checked for and it hasn't been [18:12] active since 2023. [18:16] » I got to [18:18] have water. We had water. [18:19] >> We really did water. [18:21] >> We just turned it off at the meter [18:22] because the pipe busted in the winter. [18:25] There was water on there from the time I [18:27] >> I used to be the water supervisor for [18:28] the city [18:30] for 20 years and I know there's only one [18:32] water meter there. So [18:35] >> water [18:38] >> is that is it habitable? I mean is it [18:41] >> the left side is not the right side [18:44] looking at right now. [18:46] >> Okay. [18:48] >> The left side is where all the debris [18:49] and trash is in right now. The right [18:51] side is what we're looking at. [18:59] » Correct me if I'm wrong is but you [19:01] cannot reside in by plumbing code with [19:04] anything without water. [19:05] >> Correct. [19:06] >> Our ordinance if you do not have running [19:08] water any electrical any utilities [19:09] placed into the into the per our [19:11] ordinance is what it states is that they [19:13] have to have active utilities to live [19:15] inside city limits. [19:20] the apartment. [19:22] >> This is the one of the duplex. Yeah, [19:24] >> this is the right side or the left side. [19:27] >> This is the This was all the right. [19:30] >> Say that again. [19:32] >> All the trash here. Is that the left? [19:33] >> The left side. Yes. If you're looking at [19:35] the home to the left, that would be what [19:36] all that is right there. And then to the [19:38] right. So that's all pictures of the [19:40] whole thing when we entered starting [19:41] from the right to left. [19:45] These pictures here that are presented [19:46] to you on the screen, those are from the [19:48] right side. Now when the last entry that [19:50] we made in with the circle does she want [19:53] to live in [19:54] >> the right side, which is this side right [19:56] here since June 24. It's just that it's [20:03] clear it out. [20:09] » Two electric meters. [20:11] >> Yes, two different electric. [20:12] >> Yes, there was two electric meters in [20:14] the [20:16] One water for sure. [20:23] Get a little. [20:41] So, you're living in your car on the [20:43] property, correct? [20:51] that middle part where there's no roof, [20:53] that's the garage anyway. So, it's not [20:54] even part of the house. It's the actual [20:56] garage. It's a double garage in the [20:59] >> picture that's in the screen right now [21:00] showing that was the living room. That [21:02] shows the exposure of where the garage [21:04] is right into her living room. [21:21] the back side away from the street [21:26] process in doing this. What's the [21:28] thought like? So there's public hearing [21:29] Jordan walk me through the scenario to [21:32] make a decision. Tonight's just the [21:34] public hearing and then on the 14th we [21:38] were going to put on the agenda for [21:40] action yay or nay this house. Then after [21:44] the after [21:46] decide which way if you say yes then she [21:49] goes and post that [21:51] >> they have a 30 days and vacate [21:53] >> vacate after that [22:07] after it gets [22:11] wor [22:18] the property would be my mom's [22:20] >> property the the property would still be [22:22] hers but there would be a lean against [22:23] it [22:24] >> yes [22:24] >> foriz [22:29] » we don't know what practice [22:34] » I don't [22:35] >> 25 grand came from a male individual she [22:38] tried to sell the property to for 25 [22:39] grand and he came and asked [22:44] >> yes I clearly remember that [22:46] >> our office cuz we have not we have not [22:49] priced it bid it or anything [22:51] >> we haven't done anything for demo [22:52] process on this no pricing [22:54] >> have to go for bids anyway [22:57] >> and how many square feet is it [22:59] >> um for that property it's 5600 square [23:03] feet [23:06] >> the piece of property or just the home? [23:08] >> The whole property. [23:17] » Shots fired. [23:18] >> That'll be between 8 and $12,000 to [23:20] demo. [23:23] Pretty close. [23:28] » When there's a lean, she still can't [23:29] live off. [23:31] I mean, there's not a [23:34] >> there's no structure there for you to [23:35] live on if there's nothing there. And RV [23:38] won't be allowed there to live on [23:39] either. [23:44] » Okay. This is just a public hearing. So, [23:47] anybody have any more questions? We'll [23:55] want to still review these [23:58] more questions. I see correspondence all [24:00] the way from June all the way through [24:04] into 25 [24:14] to close. [24:18] » Are you ready to close? [24:22] Have a motion and a second close public [24:24] hearing. Any fion? [24:27] All in favor? [24:31] Okay. [24:33] Hearing is closed. [24:36] >> Thank you all. [24:45] Move on to item three. Discuss or act on [24:48] resolution 20 2621. A resolution to city [24:51] council city Texas approving a project [24:54] of the economic development corporation [24:55] 4B to purchase and install wayfinder [24:58] signage in conjunction with the proposed [25:00] phases of text rightway petriation [25:02] project providing a seability clause [25:04] providing a savings clause and providing [25:06] an effective date. [25:08] >> Good evening mayor and council and this [25:10] is an amendment to the first resolution [25:12] that included just the beautifification. [25:14] We're adding wayfinder signs. The reason [25:16] that we're doing this uh in chunks this [25:19] way is to keep from overwhelming and uh [25:23] um because you know naturally we think [25:25] about the la we remember the last thing [25:27] that we heard but we're far down the [25:29] road from the last thing. We're still in [25:31] step one. So this is the next phase [25:34] that's going to run in line with the [25:36] beautifification uh to add wayfinder [25:38] signs. That way we can go to text dot [25:40] for one ask uh that encompasses [25:43] everything that we're trying to do [25:44] within the city for the beautifification [25:46] and the wayfinder system. [25:52] » Remember pictures of [25:54] >> and so when I first moved here that's [25:56] the first thing I said was there's no [25:58] sign tells you get off the highway. [26:00] >> Yeah. [26:01] >> So I think this is a good step forward [26:04] >> and what we're doing with the wayfinder [26:06] signs of course is creating route [26:08] behavior. So, uh, we want people to get [26:10] off. We've got to give them a reason to [26:12] get off the the highway. [26:13] >> We had a study done as I got study. I'm [26:17] not maybe de [26:19] remember that. But even at back then, [26:22] they said if you even get 1% off the [26:25] highway, it would be more than a million [26:28] dollars in sales tax. [26:34] » We've got a lot of great assets. I mean, [26:36] prospects that I brought to town, they [26:38] see the lake and they see the coliseum, [26:40] the rodeo arena, and even the hospital [26:42] district. They didn't even know we had [26:45] that great of assets in the in the [26:46] community cuz there's no signage [26:48] pointing it, you know, pointing to them. [26:51] >> Sales tax is bringing in what now about [26:53] 700 800,000. [26:54] >> Um, yeah, my budget's my budget's gone [26:57] down about 90,000 this year [27:00] last year. [27:07] I'll make a motion we we uh adopt [27:10] resolution 2026-21. [27:12] >> Second. [27:13] >> Have a motion. Second. Any further [27:16] discussion? [27:17] All in favor? [27:19] >> Any opposed? There are none. [27:24] We're on to item four, city dollar 2026 [27:27] 2020. That's workshop number two. [27:31] >> We haven't changed anything uh from the [27:33] last meeting. Um, I'll be happy to [27:35] answer any questions uh that y'all have [27:38] over it. I mean, like I said, it's a [27:42] pretty tight budget, but I think we're [27:44] going to get everything done that we [27:46] need to get done. [27:48] If you had a chance to look over, I'd be [27:49] happy to answer any questions that y'all [27:51] have over it. [27:54] >> Very tight budget. [27:56] >> And it is, but I think it's a it's a [27:59] good budget. It's a conservative budget. [28:01] Uh it is a budget that sets us up nicely [28:05] for the future. So uh which is a good [28:08] thing because I mean we have a lot of [28:10] big ticket items that are going to have [28:12] to be addressed in the next 5 to 10 [28:14] years that we need to figure out [28:16] starting now how we are going to pay for [28:18] in the future. So [28:22] there any questions? Well, I think there [28:24] some of them weren't here [28:26] because I think this is going to be what [28:28] is it a cent and a half reduction in the [28:31] >> uh Yeah, we'll talk about that. It's a [28:33] little over a penny. [28:34] >> Just Yeah. [28:35] >> So that they understand that this budget [28:37] incorporates a cent and a half reduction [28:40] in property tax. [28:44] >> Yeah. So, but uh for anybody that missed [28:48] last when I did the first workshop, I'll [28:51] be happy to meet with you and go over [28:53] and walk you through kind of what I'm [28:54] thinking and where we're at as a whole. [28:58] That goes for the public, too. Anybody [29:00] back there that wants to listen to a [29:02] budget presentation, I'd be happy to [29:03] give it to you. [29:14] I'll entertain a motion. [29:20] » On to the next. Yep. Next. [29:22] >> Ready for your [29:22] >> Okay. Number it on item five. Discuss or [29:25] act upon approving proposed tax rate for [29:28] 2026 27 for the publication. Uh yes, we [29:32] are going to if y'all approve the tax [29:35] rate that I proposed tonight, we will uh [29:37] send it off for publishing tomorrow. And [29:41] uh what that will entail is [29:44] uh we're going to run it in the paper [29:46] not once, but we're required by law, but [29:48] we're going to run it twice. Uh the [29:50] public hearing will be set. We set that [29:52] last uh meeting [29:55] for the 14th of uh September uh with [30:00] everything ran and put up on the website [30:03] and out front. That gives us ample time [30:05] and the public ample time to come ask [30:07] their questions and go over it. But uh [30:10] for the 2026 [30:13] 27 fiscal year uh uh property tax that [30:18] I'm proposing this year is uh 0.4284 [30:22] 420284 [30:26] that is a decrease of roughly 1 and a [30:29] half uh cents and it will be for the M [30:33] side which is the maintenance and [30:34] operation side uh will be 394298 [30:40] that's 39 cent basically 39.5 cents and [30:44] on the interest and syncing side for the [30:46] bonds that we do have out that that [30:49] property tax services will be 025986. [30:56] So 2 1/2 cents uh will of property tax [31:00] rate will make up the debt payment for a [31:04] total of 42 cents [31:07] total which is 4.420284. [31:12] And before you make a motion and uh [31:15] vote, this does have to be a roll call [31:17] vote. The city secretary has to record [31:19] each vote individually. [31:22] >> And the second one was for the debt [31:24] service. [31:25] >> Yes. The interesting bond that we have [31:27] on [31:28] >> Yes. [31:29] >> We don't have a choice now. [31:34] » I'll be more than happy to answer any [31:35] questions [31:38] or walk you through the calculation [31:40] worksheet. Anybody have any questions? [31:44] >> Make a motion that we approve the [31:45] proposed tax rate for 2627. [31:49] >> Second. [31:50] >> A motion. Second. I want to start with [31:52] you, Dennis. [31:54] I [31:59] >> I [32:13] need Wendy. [32:14] >> Yes, sir. [32:16] >> Okay. [32:21] Uh okay. Move on to item six. discuss [32:23] our act upon renewal of the municipal [32:26] judge contract. [32:28] >> Uh, as y'all all know, Beth Moore is our [32:30] municipal judge. Um, her contract comes [32:33] up at a yearly basis. I think she does a [32:36] great job. She still wants to continue. [32:39] Why? I'm not sure, but she does. And [32:43] >> and uh I would recommend that we uh [32:46] renew her contract for another year. uh [32:50] basically the same terms, but she does [32:52] want to change her dates a couple times. [32:54] Do you want to elaborate a little bit on [32:55] that? [32:56] >> Can you hear me from back there? [32:58] >> Sure, ma'am. [32:59] >> After January 1, I would like to change [33:02] my days from I'm working now Monday, [33:04] Wednesday, Monday, Tuesday, Wednesday, [33:07] in the afternoons from 1 to 4. I would [33:10] like to go to more hours on Tuesday and [33:12] Wednesday. [33:15] >> I will no longer be in the JP office. [33:18] And I think it work it would work better [33:20] because we do have a lot of people that [33:21] come in here in the mornings and if [33:24] she's here two full days that be [33:28] wonderful. [33:29] >> As long as we publicize that, I don't [33:31] have issue with that at all. [33:32] >> That is the hours that [33:36] Gergen and Judge Rain both had those [33:39] hours. So we would be going back to what [33:41] we were doing before. [33:45] Make a motion that we renew the [33:46] municipal vict. [33:51] Any further discussion? [33:53] All in favor? [33:55] >> Any post? There are none. [33:59] >> Item seven, discuss or act upon lease [34:01] agreement with Vive Broadband. [34:03] >> Yeah, every uh Vive offers uh internet [34:07] service throughout the city. This is um [34:10] basically a yearly renewal, but they had [34:13] been how many years had been since we [34:15] actually worked a brand new lease. It [34:17] had been several years. We worked with [34:19] the city attorney and and Vive and we [34:21] came up with a brand new lease. We [34:23] really didn't change any terms of the [34:25] lease, but it is a brand new lease and [34:27] it's just a lease to that they can [34:30] continue to operate and offer services [34:32] for customers within the city limits. [34:34] >> I had one question I forgot about. So, [34:37] if we didn't change any of the terms, I [34:38] think they provide a cable to the jail [34:42] for free under that contract. [34:45] >> I believe you're correct, but I I'll [34:47] double check on that. We really didn't [34:49] change any, right? [34:50] >> We didn't change any of the terms. We [34:52] just worked a new lease, [34:54] so we didn't renew it. It was [34:57] >> It's just good practice for every few [35:00] years to have a brand new le tower up [35:02] there on [35:05] the curve. [35:08] So [35:12] » make a motion that we approve the lease [35:14] agreement with VI broadband. [35:16] >> Second a motion to second. Any further [35:18] discussion? [35:20] All in favor? [35:22] >> Any opposed? There are no [35:24] >> Is this um I know we've done this [35:26] before. I think I don't remember numbers [35:30] and we can call it executive session for [35:33] staff issue. [35:36] It it needs to be publicized. [35:40] >> I mean, it got to be on the agenda. [35:41] >> It has to. [35:43] >> Okay. I thought there was I thought we [35:45] did this before. We could talk about [35:46] something. [35:48] >> The school board does. It's on there. [35:50] >> Yeah. [35:51] >> Every month. [35:52] >> Attorney's on. You could [35:54] >> Brian. [35:55] >> Yeah. [35:57] Brian. Brian, are you there? [36:10] Yes. Can you [36:12] >> How are you? This is Terry Steall. I [36:14] feel like in the past I was able to call [36:16] an executive session for a stash staff [36:18] issue that occurred [36:21] during a meeting. Am I wrong about that? [36:24] >> Yeah, it would need to be on the agenda [36:27] um [36:29] to be able to go into an executive [36:30] session. So since it's not we can add it [36:33] to an upcoming meeting uh agenda [36:36] and and yeah personnel exception that [36:39] relates to a certain employee um you [36:42] know then that employee uh when we [36:45] announced going into executive session [36:47] on personnel matter they can they can [36:49] request that it be done in open but yeah [36:52] it would need to be at a separate [36:53] meeting. Good question. [36:56] >> Thank you. [36:58] I knew that. [37:01] >> Make a motion that we [37:04] have a motion second. All in favor? [37:06] >> We are journed. [37:08] >> Bye y'all. [37:10] >> Thank you. [37:12] Hey, do you need every anybody else's [37:15] information for get airlines?
