[0:03] Good morning, everyone. [0:04] Welcome to our August Council Meeting. [0:06] Today is Wednesday, August 12. [0:09] The time is now 10:07 AM. [0:11] And I hereby call this meeting to order. [0:14] Remember to please silence your phones. [0:16] If you must take a call, we ask you [0:18] to kindly step outside so that we can maintain [0:21] a respectful atmosphere. [0:23] Madam Clerk, please call the roll. [0:25] Councilwoman Nicole Reinoso? [0:27] Present. [0:27] Councilwoman Maureen Porras? [0:29] Here. [0:29] Councilman Rafael Pineyro? [0:30] Present. [0:31] Vice-Mayor Digna Cabral? [0:32] Present. [0:32] Mayor Christi Fraga? [0:33] Present. [0:33] Mayor, you have quorum. [0:34] Please rise for the Pledge of Allegiance, [0:36] led by Councilwoman Reinoso. [0:38] I pledge allegiance to the Flag of the United States of America, [0:42] and to the Republic for which it stands, one Nation under God, [0:47] indivisible, with liberty and justice for all. [0:54] Before we continue, I'd like to ask you all [0:57] to join me in a moment of silence [0:59] as we remember some from our team that we have recently lost. [1:04] We honor the life of Officer Edwin-- [1:07] Erwin Fernandez and thank him for his service [1:10] and his family for service and dedication to our community. [1:13] We also remember our City of Doral Public Works [1:16] employee, Carlos Cuba, who has passed away in July. [1:19] Carlos was a valued member of our city family. [1:23] And our thoughts remain with him and his loved ones [1:26] and all his colleagues. [1:28] Likely, I would like to ask for solidarity [1:31] as we stand with the people of Colombia, [1:33] as they mourn the lives of those who were lost [1:35] in the devastating earthquake. [1:37] Our hearts are with the victims and families [1:40] and all those affected during this incredibly difficult time. [1:43] Please join me in a moment of silence. [2:09] Thank you. [2:11] We now have our invocation, led by Pastor Ricky from Dios con [2:15] Nosotros. [2:16] Pastor? [2:25] Before I start, I'll start to read a Bible [2:27] verses in Jeremiah 29, verse 7. [2:30] Says, "Seek peace of the city. [2:33] And pray to the Lord for peace. [2:36] We will have overcome and will come to the city [2:41] that you live in. [2:43] Seek for peace. [2:45] Pray for the Lord and peace that surpasses all understanding." [2:49] In obedience to the word, I gather today [2:51] and give thanks to God for every moment that he gives us. [2:56] We come unto you, O, Lord, as one nation under God. [3:00] We come unto you, Father, asking and thanking you [3:04] for the privilege that we woke up today, [3:07] that we're able to breathe, that we're able to stand, [3:11] that we're able to come here today. [3:13] I pray that you bless our mayor, city councils, [3:17] and every decision they may hold with integrity. [3:21] And above all, Lord, the missed city, this community, [3:25] may receive the blessing for their needs, [3:28] for what they're about to do, for what [3:30] they're about to establish. [3:31] Today, you remind us how fragile we are. [3:34] We pray for the people in Venezuela. [3:37] We pray for the people in Colombia. [3:39] We pray for the people in the United States of America. [3:42] You know what is happening. [3:44] They were waking up this morning with a different atmosphere [3:47] as what happened two days ago. [3:51] Anywhere, anything can happen. [3:53] You hold in the palm of your hand the whole Earth. [3:58] And today, we're reminded how fragile we can be. [4:00] We thank you that this is the land of the free. [4:04] But over there, they're experimenting a very difficult [4:07] situation. [4:09] May I ask everybody here to please stand [4:11] for a moment and pray with me. [4:16] We pray for those, Lord, that lost family members. [4:20] We pray for those, Lord, that lost everything they had. [4:25] But you still, in your amazing love, [4:29] you spared a lot of lives, Lord. [4:32] We pray for those in Venezuela who lost [4:35] not only what they lost, but they lost even more [4:38] when they lost family members. [4:40] Today, we're reminded how important it [4:42] is to keep our family together. [4:46] Also, we pray for the people in Colombia [4:48] and for every aid to reach the right places. [4:52] We are here, Father, privileged and also [4:55] honored to come together as one body, one family. [5:00] We thank you for the opportunity to pray here together. [5:03] And we come as one. [5:05] Thank you, as the city has allowed us to come here [5:09] and come together to pray. [5:11] If everybody can please say these words with me. [5:15] Dear God-- [5:16] Dear God-- [5:17] --have mercy. [5:19] --have mercy. [5:19] Bless those-- [5:20] Bless those-- [5:21] --in need. [5:22] --in need. [5:23] Provide for them. [5:25] Provide for them. [5:26] Give them peace. [5:27] Give them peace. [5:28] In your name we pray, Lord. [5:30] In your name we pray, Lord. [5:31] Amen. [5:32] Amen. [5:33] Thank you. [5:34] Thank you. [5:36] Thank you, Pastor, for those beautiful words. [5:40] We will now move into our Agenda/Order of Business [5:44] and go ahead and start with our City Manager's office. [5:48] Mayor, we don't have anything. [5:49] Thank you. [5:50] Thank you. [5:50] Mr. City Attorney? [5:52] Madam Manager, I'd like to defer item 6B. [5:56] 6B, as in boy? [5:58] 6B as in boy, yes. [6:01] OK. [6:02] Anything else? [6:03] That's all. [6:10] OK. [6:12] Councilman Pineyro? [6:13] I don't have anything, Mayor. [6:14] Thank you. [6:15] Vice-Mayor Cabral? [6:17] None. [6:19] Councilwoman Reinoso? [6:20] No, Mayor, nothing. [6:21] OK. [6:22] Councilwoman Porras? [6:23] None. [6:25] Madam City Clerk? [6:26] None. [6:27] All right. [6:29] So we'll go ahead and defer that. [6:31] All right, well, we'll now move into the public comments [6:35] section of our meeting. [6:37] Each speaker will have three minutes [6:39] to address any item on today's agenda [6:41] or any other matters related to the City of Doral. [6:44] Please begin by stating your name [6:46] and address for the record to ensure that you are registered [6:50] with the City Clerk's office. [6:51] We will first hear from those who are preregistered, followed [6:54] by any walk-in speakers. [6:56] Once all have spoken, I will ask if any final speakers [6:59] would like to use the reasonable opportunity time to speak. [7:03] As a reminder, in accordance with the city code of conduct, [7:06] we ask that all remarks be made in a respectful, courteous, [7:09] and orderly manner. [7:11] Personal attacks, offensive language, or disruptive behavior [7:15] will not be permitted. [7:17] Let's work together to keep this forum [7:18] productive and constructive for all. [7:21] And I'll go ahead and start with Mr. Richard Glukstad. [7:48] Excuse me. [7:50] Richard Glukstad, 4768 Northwest 114th Avenue. [7:55] All right. [7:56] Today, I brought two visual aids-- [7:59] my brown belt and a jacket. [8:04] And you say, why did you bring a belt and a jacket? [8:07] So I'm going to explain. [8:08] First of all, this brown belt represents to me [8:11] my Uncle Manfred from Germany. [8:14] He was a prisoner of war of the French because he was German. [8:18] They didn't care that he was Jewish. [8:19] They still kept him as a prisoner of war. [8:24] He was a very religious Jew. [8:26] He went to Cuba first. [8:27] And then from there, he went to New York. [8:29] He lived in the Bronx. [8:30] He went to temple every Saturday. [8:33] And money, for him, was no object. [8:37] He didn't really care about it. [8:39] And one day, I stayed-- [8:41] I was in his house. [8:43] And I was spending the week there. [8:45] And I brought two belts with me. [8:48] I always had two belts, a brown one and a black one. [8:52] He said, Richard, what do you need two belts for? [8:56] He said, you really only need one belt to hold up your pants. [9:01] Why spend money on another belt? [9:04] Well, this was his philosophy because showing off and having [9:09] money meant absolutely nothing to him. [9:11] He probably just died with one belt. Whereas his brother, [9:14] my father, he was all into what other people thought about him-- [9:18] to make money, be a success. [9:20] He became a multimillionaire. [9:24] But you know what? [9:25] They both wound up in the same place-- [9:29] 6 feet under. [9:30] And they lived about the same time. [9:32] So I don't think-- [9:34] actually, he was probably happier [9:36] when he died than my father. [9:38] So I just wanted to show you that the quest for money [9:41] doesn't really bring happiness. [9:44] The second thing to talk about has to do with money, too. [9:47] It's about the Vietnam War. [9:49] I was in the Army in ROTC for three years, from 1967 and 1970. [9:56] And I was getting ready to go to Vietnam as an infantry officer. [10:01] So we were basically brainwashed. [10:03] We have to go over there, fight communism, [10:06] because if we don't fight communism, [10:07] it's going to spread all over the place, yada, yada, yada. [10:11] Well, they extended the war. [10:12] They extended it. [10:13] We were losing. [10:14] But they would never admit that we were losing the war. [10:18] And they kept sending more and more people to die. [10:20] 55,000 Americans died there. [10:23] But yet, I bought a jacket from the Gap. [10:27] It's made in Vietnam. [10:29] So today, we have diplomatic relations with Vietnam. [10:35] We have factories over there. [10:36] We do business with them, as usual. [10:39] And Americans go there on vacation all the time. [10:41] It's a real big vacation spot. [10:44] So why did we do this? [10:45] Well, the answer was money. [10:48] People can make money from wars. [10:50] If you support people who support wars, [10:54] don't support them anymore. [10:55] There's very few wars that are just wars. [10:59] And a war has to be a just war, according to the Catholic [11:01] Church, anyway, for you to even participate. [11:03] Thank you, Mr. Glukstad. [11:04] I know my time is over. [11:06] But please, think about it. [11:09] Don't support wars, only if it's a just war. [11:12] Thank you. [11:13] And don't look at money as your goal in life, [11:16] because it'll probably make you less happy than somebody [11:19] like-- even like my Uncle Manfred. [11:21] Thank you, Mr. Glukstad. [11:23] You're welcome. [11:23] Thank you. [11:24] All right. [11:25] I next have Maurizio Bettoli. [11:38] Hi. [11:39] Yes, I'm here to talk about Agenda Item 9A, [11:41] Vending Machine Services. [11:43] I don't like to waste anybody's time. [11:44] So we sent a letter from an attorney for you all to review. [11:48] I hope that you read it. [11:50] The items in there, I want to echo. [11:52] If you have any questions or clarifications of those issues, [11:55] I'll be sitting here. [11:56] So when you bring the item up for a vote, [11:58] I want to discuss it. [12:00] Thank you. [12:01] Thank you. [12:01] Just to clarify, this is the time for reasonable opportunity [12:04] if something needs to be put on the record. [12:06] We don't normally open up public comments in discussion items. [12:12] We also have Leonardo Bettoli. [12:27] Good evening, Mayor, Vice Mayor, and members of the Council. [12:30] My name is Leonardo Bettoli. [12:32] I'm here in support of Compass Group USA [12:34] through its Canteen division. [12:37] Again, thank you for the opportunity. [12:39] I respectfully ask the Council to select [12:41] Canteen for the city vendings operations and management [12:44] contract. [12:45] Canteen is ready to perform from day one. [12:48] It holds the proper business licensing for vending machines [12:52] operations in the city, county, and state, including the NAICS [12:58] Code 4542. [13:01] And its proposal satisfies the city solicitation's [13:04] requirements. [13:06] Canteen has also demonstrated its financial capability [13:09] by transparency by providing the city [13:12] with the required audited financial statements. [13:16] By doing so, Canteen gave the city the financial information [13:19] required to evaluate its strength and ability to perform [13:23] through the contract. [13:25] Canteen is not simply a local vending operator. [13:28] It is a national operator backed by Compass Group [13:30] USA with coast-to-coast capabilities. [13:33] Canteen serve clients across the country and provides food [13:36] service solutions at more than 60,000 locations. [13:40] That national scales give Doral access [13:42] to established operating systems, advanced technologies, [13:45] substantial resources, and broad organizational support, [13:48] while its local team remains accountable for responsive [13:52] day-to-day service. [13:54] Canteen also brings proven track record in Doral [13:58] and extensive experience serving municipalities, counties, [14:01] public entities, and other governmental throughout Florida. [14:05] It understands the accountability, reporting, [14:08] responsiveness, and continuity of service required [14:10] in a public-sector partnership. [14:12] Doral will also receive a mature service model supported [14:15] by dedicated account management, preventive maintenance, [14:17] real-time monitoring, extensive local staffing, [14:20] technical support, and comprehensive reporting. [14:22] Canteen smart tech service-- [14:25] Canteen Connect and smart tech platforms [14:27] are designed to reduce downtime, improve inventory management, [14:31] respond quickly to service needs, [14:32] and provide the city with transparent oversight [14:35] of performance. [14:37] Canteen is also offering significant financial value-- [14:41] a minimal annual guarantee of $95,000 and prepaid commissions [14:48] of $285,000 on day one. [14:52] These are concrete commitment that [14:54] provide the city with immediate value [14:57] and predictable annual revenue. [15:00] This decision is about selecting a partner with national strength [15:03] and local accountability, proper licensing, [15:06] proper financial capabilities, public-sector experience, [15:10] advanced technology, and a record of dependable service. [15:13] For those reasons, I respectfully [15:15] ask the Council to award this contract to Canteen. [15:17] Thank you. [15:19] Thank you, Mr. Bettoli, for being here. [15:21] I have Alexander Recalde. [15:35] Hello. [15:36] My name is Alexander Recalde. [15:38] My address is 5670 Northwest 116th Avenue, Doral, Florida, [15:44] 33178. [15:48] Good morning, Mayor, Councilmembers, [15:50] and City Administration. [15:52] My name is Alexander Recalde. [15:53] And I'm owner of Fresh Service & Repair. [15:57] First, I want to thank the evaluation committee [16:01] and the city manager for recommending our company [16:04] for this opportunity. [16:06] It truly means a lot to me. [16:10] We have experience more than 15 years in the business. [16:14] I spent more than 50 years building this company. [16:17] And I'm very proud of what we have to build. [16:22] But what makes this opportunity special [16:24] is that Doral is also my home. [16:28] I have lived here for many years. [16:30] I have invested in this community. [16:33] And I'm proud to be raising my family here. [16:37] Having the opportunity to serve my own city [16:39] would be an honor and something I will take very personally. [16:45] You won't be dealing with faraway corporate office. [16:50] You would be dealing directly with me. [16:53] My name and my reputation are behind this company. [16:57] And I will always make sure we provide the level of the service [17:01] that our community deserves. [17:04] Thank you for your opportunity and your consideration. [17:07] Thank you. [17:09] Thank you, Mr. Recalde. [17:11] All right. [17:12] That is all I have for the preregistered speakers. [17:14] If anyone else would like to speak, [17:16] now would be your reasonable opportunity. [17:19] You may speak on anything on this agenda or anything that [17:23] is germane to this Council. [17:28] Being none, we will now close reasonable opportunity. [17:33] And I will take a motion on the consent agenda [17:36] once the City Clerk reads the item that has [17:38] been pulled into the record. [17:40] This will be for all the items on Section 6, [17:42] with the exception 6B. [17:44] All right. [17:44] I need a motion. [17:45] Motion. [17:45] Motion. [17:46] Motion to approve by Councilwoman Reinoso. [17:48] Second. [17:48] Second by Councilman Pineyro. [17:50] All in favor say, "aye." [17:51] Aye. [17:51] Aye. [17:52] OK. [17:53] Madam Clerk, let the record reflect that the consent agenda [17:55] has been approved unanimously. [17:57] I now need a motion on the minutes. [17:59] Motion. [17:59] Motion to approve by Councilwoman Reinoso. [18:01] Second. [18:02] Second by Councilman Pineyro. [18:03] All in favor say, "aye." [18:04] Aye. [18:05] Aye. [18:05] Aye. [18:06] Madam Clerk, let the record reflect that the minutes [18:07] have been approved unanimously. [18:09] All right, we'll now move into presentations. [18:12] Presentations item 8A, Keep Doral Beautiful Business Award. [18:28] Good morning, Honorable Mayor, Vice Mayor, [18:30] members of the Council, Madam Manager, Mr. Deputy Manager, [18:33] Mr. City Attorney, Madam Clerk. [18:36] Danny Del Toro, Code Compliance Director. [18:39] This month, we are pleased to recognize Chick-fil-A [18:42] for their outstanding commitment to keeping Doral beautiful. [18:45] The property for which they are being recognized is located [18:47] at 9815 Northwest 41st Street. [18:51] This Chick-fil-A has been in the City of Doral for two years. [18:54] The property is approximately 65,000 total square feet. [18:57] And the business has 70 employees. [19:00] Chick-fil-A is a nationally recognized restaurant [19:02] known for its diverse selection of chicken-based menu offerings. [19:06] Its menu includes a variety of options for breakfast, lunch, [19:10] and dinner, as well as salads, treats, kids meals, and more. [19:14] In 2023, Chick-fil-A made a significant investment [19:17] in the city by demolishing the previous structure [19:19] on the property and constructing the facility that exists there [19:22] today. [19:24] Since its completion, the property [19:26] has been maintained to a high standard [19:27] through daily inspections and cleaning [19:29] of the exterior, weekly landscape [19:31] inspections, and biweekly landscape maintenance services. [19:35] These ongoing efforts demonstrate [19:37] Chick-fil-A's commitment to maintaining [19:38] an attractive, clean, and well-kept property [19:41] within the city. [19:43] It is with great pleasure that we named Chick-fil-A [19:46] for the Keep Doral Beautiful Business Award [19:48] for their continued efforts to keep Doral beautiful. [19:52] Madam Mayor and Council, here to accept the award [19:54] on behalf of the businesses Operations [19:56] Director Janet [? Sedidas ?] and Marketing Director Rachel Tapia. [20:15] In behalf of Chick-fil-A, Doral, we just [20:17] want to say how honored and grateful [20:19] we are to receiving this reward. [20:22] It's the reflection of the hard work [20:25] that our team everyday puts into our restaurant. [20:28] And we are just very thankful to be [20:30] part of this wonderful and amazing community. [20:32] Thank you so much. [20:33] Thank you so much. [20:34] And Chick-fil-A always does a great job [20:36] of keeping their properties clean and wonderful service. [20:39] Please come up for a photo. [20:56] [INAUDIBLE] [20:58] Thank you so much. [20:59] Congratulations. [21:00] Thank you. [21:01] Thank you. [21:26] Thank you. [21:28] Thank you. [21:28] Thank you so much. [21:39] OK, we move on to the next presentation. [21:43] Yes. [21:44] Good morning, Mayor. [21:46] The Chief, I think, has a few words. [21:48] We're going to do a commendation for our officers. [21:53] Madam Clerk, would you like to read the record-- read the item [21:55] into the record real quick? [21:56] Yes. [21:58] Item 8B, Special Recognition Officers Adrian Ochoa and Samuel [22:01] Guerra. [22:11] Good morning, City Manager. [22:13] Good morning, Mayor and Council. [22:15] Thank you all so much. [22:16] I want to first off say that we suffered a tragedy last week. [22:21] And we appreciate all the support [22:24] and love from the community and from your positions. [22:28] Thank you all so much. [22:29] Together, we're going to become a bigger and stronger and better [22:32] agency through this tragedy. [22:33] So I just want to say-- give you that and give you my commitment. [22:39] Now I want to pivot to a commendation that [22:42] was on April 17. [22:45] I would like to ask the two officers to step up [22:48] to the plate, Officer Adrian Ochoa and Officer Samuel Guerra. [22:52] Can you go in front? [22:57] So I want to paint the picture because I read this paper. [23:00] And I told Lauren earlier this morning, I said, [23:03] the paper doesn't do it justice. [23:05] I want you guys to actually visibly see [23:07] what these officers did. [23:08] They saved a life. [23:10] It all occurred on April 17. [23:13] And I'm going to give you the rundown of the call. [23:15] It was basically a sick or injured person. [23:18] And the call came out as a 41-year-old male who just [23:21] fainted. [23:22] And we get those calls all the time. [23:24] It's a routine call. [23:25] But this call ended up not being routine. [23:27] That's why I want to really commend these officers. [23:30] And I want to show you visually what they did. [23:32] So can you go ahead and play the video, please? [23:38] [VIDEO PLAYBACK] [23:39] - OK. [23:45] - [INAUDIBLE], 24, starting CPR. [23:48] [INAUDIBLE] [23:51] - Don't stop because [INAUDIBLE]. [23:54] - [INAUDIBLE] [24:01] - Someone told me that I look so [INAUDIBLE]. [24:04] - When I said, "Starting CPR, she [24:07] raised you throughout till 20 to advise you that they were-- [24:11] - Yes. [24:11] All right. [24:13] [END PLAYBACK] [24:13] OK, that's enough. [24:15] So these two officers right here, they were on probation. [24:20] They were their second month as officers. [24:23] And they responded to this call of a fainted person, which [24:27] ended up being someone going through cardiac arrest. [24:30] He was purple to the touch. [24:31] And these officers, they went into action. [24:35] And it's very commendable about what they did. [24:37] They didn't hesitate. [24:38] And their performance of CPR saved this individual's life. [24:42] And they are a direct reflection of this police department [24:45] and the professionalism of this police department. [24:47] So with that said, a congratulations so much, [24:50] Officer Samuel Guerra and Officer Adrian Ochoa. [24:54] And Officer Adrian Ochoa, his father is Major Leo Ochoa. [24:58] And I would love for him to come up and present [25:00] this award to him. [25:02] A good father-son moment. [25:03] [APPLAUSE] [25:12] Congrats. [25:13] Congrats. [25:16] Congratulations. [25:20] You can give him a kiss. [25:22] We won't tell anybody. [25:23] We got it on camera. [25:35] You want to go first? [25:36] Yeah, I think Mayor and Council. [25:41] So actually, if you can go behind the dais. [25:42] It's a photo with Mayor and Council. [25:44] Oh, we're all going to come forward. [25:46] Thank you. [25:52] It's so cute. [25:53] I want to cry. [25:54] He's his son. [25:56] I want to cry. [25:57] Pose like a beautiful man. [26:08] There's so much space. [26:10] This is really nice. [26:11] They gave it to him. [26:14] That's mine. [26:15] Oh, that's yours? [26:16] Yeah. [26:16] I'm like, wait, I didn't know that. [26:23] Mayor, can we figure out-- [26:27] Mayor, can we-- [26:31] Mayor, can we-- [26:33] [INAUDIBLE] [26:34] Yeah. [26:35] Let's turn to you guys. [26:36] So take a step this way so you're centered with the seal. [26:40] I wanted to try to get them all. [26:46] Frank, can you come on this side? [26:49] Perfect. [26:50] [INAUDIBLE] [26:51] Oh, OK. [26:53] All right. [26:53] Everybody, look straight ahead. [26:58] Officers, are you showing your plaques? [26:59] I can't see from here. [27:00] Yes. [27:01] OK. [27:07] Did everybody get their photo? [27:08] One more. [27:08] Yes. [27:14] Monica, you got it? [27:15] Yes. [27:15] Thank you. [27:17] Thank you, Mayor. [27:17] Thank you. [27:18] Great job. [27:19] Great job. [27:25] Thank you. [27:26] Congratulations. [27:27] Thanks. [27:28] [INAUDIBLE] [27:29] You know how I do [INAUDIBLE]. [27:31] I know. [27:38] After you. [27:40] [INAUDIBLE] [27:41] I will. [27:43] Madam Manager-- actually, [INAUDIBLE]. [27:53] OK. [27:53] Madam Clerk, next item. [27:55] Next item is item 8C, Doral International Art Fair [27:58] Presentation. [28:15] Thank you. [28:16] Good morning, Mayor Christi Fraga, [28:18] members of the City Council, City Manager, [28:20] and members of the staff of the City of Doral. [28:23] My name is Billy Garcia. [28:25] And I'm here joined by the team members of the DIAF. [28:28] It's really an honor for us to officially present [28:32] the fourth edition of Doral International Art Fair, which-- [28:36] it will take place from November 12 [28:38] to November 15 of this year at the Doral Cultural Arts Center. [28:43] As is well known, every year, Miami-Dade [28:46] becomes one of the leading destinations [28:48] for contemporary art. [28:50] During the arts season in South Florida, [28:52] all the galleries, artists, business leaders, [28:55] media representative, and visitors from around the world [28:59] come together, bringing economic and cultural benefits [29:02] to our community. [29:04] This year, DIAF will have the privilege [29:06] of opening the International Art Fair season [29:09] and positioning the City of Doral [29:12] as the starting point for one of South Florida [29:15] most relevant cultural events of the year. [29:18] For this fourth edition, we have already confirmed participation [29:23] from galleries and art organizations [29:25] from Houston, Ecuador, Cuba, Spain, Mexico, Colombia, [29:31] Venezuela, and more. [29:33] This shows the international reach of the fair [29:36] and reinforce Doral's position as a city [29:39] that welcome art, culture, new ideas, and business [29:43] opportunities. [29:44] We are also proud to welcome the Museum of the Americas, [29:47] MoCAA, the Biennial of Cuenca from Ecuador, [29:51] and the Spanish Cultural Center of Miami. [29:55] We expect around 3,000 visitors to attend DIAF 2026 during that [30:00] weekend. [30:01] This level of attendance will help boost the local economy, [30:05] directly supporting hotels, restaurant, shops, [30:08] transportation services, cultural venues, and businesses [30:11] across the city. [30:13] DIAF is more than an art fair. [30:15] We believe it's also a great opportunity [30:17] to promote the City of Doral. [30:20] Through this event, Doral can be presented and showcased [30:23] to the public, both locally and internationally, [30:26] as a modern, diverse, business-friendly city [30:29] in the heart of Miami-Dade. [30:31] As we prepare for this fourth edition on September 15 [30:35] of this year, we will open an special exhibition called [30:39] Water Trail at the Miami Dade College West Campus gallery, [30:43] lead and curated by Félix Suazo. [30:45] The exhibition will be on display [30:47] during September and October and will explore the theme of water [30:51] through photography and painting. [30:53] This project reflects our ongoing support for the arts [30:56] and our collaboration with educational and cultural [30:59] organizations. [31:01] Each edition, DIAF gives another opportunity [31:03] to place Doral among the major events that [31:06] make Miami-Dade special. [31:08] Our goal is for the city to play an active role while welcoming [31:11] visitors, supporting cultural tourism, [31:14] creating new opportunities for local businesses, [31:17] and celebrating the cultural richness of our community. [31:21] Finally, we want to say thank you, Mayor Fraga. [31:24] Thank you, member of City Council, City Manager as well. [31:27] Thank you to all the members of the staff [31:30] of the City of Doral for your support and commitment [31:32] to this event. [31:33] We kindly ask you for your continued partnership [31:36] so we can keep bringing artists, galleries, media, [31:39] visitors from around the world to visit Doral. [31:42] We are sure that together, we can continue building Doral [31:46] as an important destination for culture, art, [31:49] and economic growth in South Florida. [31:51] Thank you so much. [31:52] Thank you. [31:54] Thank you very much. [31:56] I just want to congratulate you guys for the work [31:58] that you've done, the entire team. [32:01] Every year, it's been an improvement, more visitors, [32:05] and exceptional artists and galleries. [32:08] So thank you for your commitment to the city. [32:11] We really value the partnership. [32:13] I think it's brought a true meaning to what the Cultural [32:16] Center was supposed to really be for for our community. [32:21] Art and culture is definitely something [32:22] that we, as a community, cherish and our community [32:27] enjoys and value. [32:29] And so I think that the Art Festival has really [32:33] brought significance to that in our community. [32:35] And it's been recognized not just countywide but regionally. [32:40] And that's a testament to your work, dedication, [32:43] and professionalism. [32:43] So we appreciate it. [32:44] And we look forward to this year's festival. [32:47] We know that it'll be a great success once again. [32:51] So thank you for your presentation. [32:53] If there's any additional comments or questions-- [32:55] I have a comment. [32:56] Thank you. [32:56] Councilwoman Reinoso. [32:57] Hold on. [32:58] There's a comment. [32:59] Yes? [33:00] DIAF, I'm really proud of all the work [33:02] that you have done throughout the years. [33:03] I value the continued effort of making it better every year [33:09] and to include art that is diverse, that is unique. [33:12] And it's really adding to what the cultural diversity of Doral [33:16] is and really bringing up what-- art and the meaning of keeping [33:21] that alive and present within our community [33:25] and the importance of doing so. [33:27] So I'm glad that you all have been tasked to do that. [33:30] It's a big responsibility because art and culture [33:32] is something that if we don't do as a city, [33:35] it's going to be hard for anyone else to do. [33:37] So thank you for your efforts. [33:39] Thank you for the diversity that you bring to the community [33:41] and for keeping art alive. [33:43] Thank you. [33:44] I have some comments, Mayor. [33:45] Councilwoman Porras? [33:46] I want to thank you guys. [33:48] I can't believe it's already the fourth edition. [33:51] And since the beginning, I've always been supportive. [33:54] It's something that you guys have always [33:56] done with professionalism. [33:58] You've given a lot of local artists, as well, opportunities. [34:02] And to reiterate the comments that my colleagues have made, [34:05] you really have elevated our culture and our art, [34:08] which is something that residents really wanted [34:10] to see here in our community. [34:12] So I want to thank you for that great work. [34:13] And hopefully, we can continue this. [34:16] And wishing you a lot of great success [34:18] and to continue expanding and making our city proud. [34:22] Thank you. [34:23] Thank you. [34:24] Councilman Pineyro, you had a comment? [34:25] Thank you, Mayor. [34:26] I also just want to say congratulations because I [34:29] always-- [34:30] there has been a before and after when [34:32] it comes to art in Doral. [34:34] And you guys, as a group, have accomplished that. [34:38] I always like to say this is like our mini [34:41] Art Basel or our Art Basel of the year. [34:45] So I see the excitement, the opportunities, [34:48] and the collaboration from a lot of the local businesses [34:51] and other businesses from other places as well. [34:54] So I just want to say thank you for everything [34:59] you guys are doing as a group, because it's also your time. [35:02] And we also have to recognize that. [35:04] I mean, you're putting a lot of hours every year [35:08] into this great, great event. [35:11] And it's not that you guys are getting paid for this. [35:14] So you do it because you love art, you love what you do. [35:18] We have local business owners here. [35:19] We have residents as well as part of the organization. [35:22] So congratulations because you're-- and let me say this [35:26] as well-- we also have to recognize that art is a way [35:30] of moving the city, financially speaking. [35:33] It's an economic engine. [35:35] And if we don't see it that way, then, certainly, we [35:39] don't know anything about art. [35:40] But that's why you also have actually created [35:44] that sense of mobility around the city [35:46] when it comes to people visiting Doral, people [35:50] after the fair staying in downtown Doral or other places [35:54] around the city also spending money here. [35:58] So I just want to say congratulations [36:00] because every year is more and more participation. [36:04] And I certainly look forward to be there this year once again. [36:08] Thank you. [36:09] Thank you, Councilman Pineyro. [36:10] Thank you all again. [36:11] Thank you. [36:12] Best of luck. [36:13] All right. [36:14] We're going to move into our discussion items. [36:16] Madam Clerk? [36:17] Discussion item 9A, A resolution of the Mayor the City Council [36:19] of the City of Doral, Florida, awarding invitation to negotiate [36:22] ITN 2026-11 "Vending machines operation and management" [36:24] to Fresh Service & Repair Corporation; [36:26] authorizing the City Manager to enter into an agreement with [36:28] Fresh Service & Repair Corporation for a period [36:30] of three years, with an option to renew for two one-year [36:32] periods; authorizing the City Manager to execute [36:34] the agreement; providing for implementation and incorporation [36:36] of recitals and an effective date. [36:38] All right. [36:39] Madam City Manager, it's your item. [36:41] Good morning, Mayor and Council, again. [36:44] I just have a few words with respect to this item. [36:47] So this ITN was issued on April 1, 2026. [36:52] And the city received three responsive proposals. [36:55] The procurement consisted of four phases-- [36:58] the evaluation and ranking, the presentations [37:01] and the question and answer, the negotiations, [37:04] and the final evaluation recommendation. [37:07] On May 12, 2026, the evaluation committee [37:10] unanimously advanced all three proposals to phase 2. [37:14] Following presentations and question and answers, [37:17] two finalists, Canteen and Fresh Service, [37:20] were selected to proceed to negotiations. [37:23] Negotiations with the two finalists [37:25] were held on June 2, 2026. [37:28] And on June 8, 2026, the evaluation committee [37:32] completed its final evaluation and unanimously ranked [37:35] the proposals as follows. [37:38] Number one, Fresh Service & Repair Corporation [37:40] with 91 points. [37:42] And number two, Canteen with 82.67. [37:46] The difference between the two finalists [37:48] was an 8.33 points difference, resulting in the committee's [37:54] recommendation to award the ITN to Fresh Service & Repair Corp. [37:59] The city's intent to award was signed and announced [38:01] on June 9, 2026. [38:04] On June 12, 2026, a bid protest was filed with the City Clerk. [38:10] On June 22, the Procurement and Asset Manager Director [38:13] submitted a written decision to the City Manager. [38:17] On July 27, 2026, the City Manager, I, [38:22] issued a decision resolving the protest and affirming the ITN [38:26] 2026-11 award to Fresh Service & Repair Corp., [38:31] with headquarters in the City of Doral. [38:34] The final decision was emailed to the protesting party on July [38:38] 27, 2026 at 3:52 PM. [38:42] Pursuant to Section 2-338 of the City Municipal Code, [38:46] any appeal was required to be filed within five calendar days [38:49] of that notice. [38:51] Accordingly, the appeal deadline was August 1, 2026. [38:55] The protesting parties submitted their appeal two days late, [38:58] on Monday, August 3, at 5:03 PM. [39:03] All actions related to this bid protest, appeal, [39:05] and resolution were conducted pursuant to Section 2-338 [39:09] of the City Municipal Code. [39:10] The code also provides that the protesting party must first [39:14] follow the established protest and appeal procedures [39:16] before seeking judicial relief. [39:21] I want to just state that I stand [39:24] by the decision and the recommendation [39:25] I've made to Council. [39:27] And I would ask for you to uphold that recommendation [39:30] and select Fresh Service & Repair Corp. for this contract. [39:34] Thank you. [39:35] Thank you, Madam City Manager. [39:37] Before we open to any questions or discussion, [39:39] I think the City Attorney also has-- [39:42] go ahead, Mr. City Attorney. [39:43] And then I'll ask for any ex parte communication [39:45] before we discuss. [39:46] Thank you, Madam Mayor, Council. [39:49] The job of the Council today is twofold. [39:51] First, you're treating this protest that we received. [39:53] It's before you. [39:55] You've received in the-- in your agenda and in other documents [40:01] that we forwarded to you the letters that were submitted [40:04] by Canteen by their council, the different protest [40:08] letters that they forwarded, and including the August 3, which [40:12] was untimely, but it is before you. [40:14] And I think you should consider it and, in your determination, [40:18] take that into account. [40:20] You've also listened to the testimony [40:22] that's been presented by the Canteen and also by the awardee. [40:28] And so your job today is to take all this evidence into account [40:32] and weigh that and make a decision [40:36] first on whether to uphold the protest, [40:39] and then what would happen is that the item would be rebidded, [40:42] or to uphold the manager's decision [40:45] and move forward with the awarding. [40:46] OK. [40:47] Thank you, Mr. City Attorney. [40:48] At the advice of the City Attorney, [40:50] he's asked me to ask for ex parte communication, [40:53] as the protester has taken a litigious approach. [40:58] So we're going to ask if there's been any ex parte [41:01] communications at this time before there's any comments [41:03] or questions and a motion. [41:05] There's been communication with my office. [41:07] But it will not influence my decision. [41:09] I also have been contacted by the protesting party. [41:13] And it should not have any effect on my decision. [41:17] Mayor, I've also had ex parte communication. [41:19] And it will not affect my decision. [41:21] Likewise here. [41:23] None. [41:24] OK. [41:24] All right. [41:25] Is there any comments, questions, or a motion [41:28] based on the recommendation? [41:30] Motion to approve. [41:32] Motion to approve by Councilman Pineyro. [41:35] Second. [41:36] Second by Councilwoman Reinoso. [41:38] Based on the recommendation-- yes? [41:39] Madam Mayor, so is the motion to approve-- [41:42] is the motion to uphold the Manager's decision, Councilman? [41:47] Yes. [41:49] Any comments or questions before we call the question? [41:53] OK. [41:53] Madam Clerk, please call the question. [41:56] Motion to approve the Manager's recommendation [41:58] made by Councilman Pineyro, seconded [42:00] by Councilwoman Reinoso. [42:00] Councilman Pineyro? [42:01] Yes. [42:02] Councilwoman Reinoso? [42:02] Yes. [42:03] Councilwoman Porras? [42:04] Yes. [42:04] Vice Mayor Cabral? [42:05] Yes. [42:05] Mayor Fraga? [42:06] Yes. [42:06] Motion passes. [42:07] All right. [42:08] Thank you very much for your time and consideration. [42:13] All right, we move on to the next item. [42:15] Item 9B, A resolution of the Mayor and the City Council [42:17] of City of Doral, Florida, adopting a fiscal transition [42:18] policy for Council office budgets, [42:20] providing for applicability, implementation, [42:22] incorporation of recitals, and an effective date. [42:24] OK. [42:24] Thank you very much, Madam Clerk. [42:26] This is my item. [42:28] Councilmembers, the item that is before you is something that [42:31] has come to my attention in the past, [42:33] not just at the School District. [42:35] I ran into this issue. [42:36] I know Councilwoman Reinoso ran into this issue [42:38] when she was elected here. [42:40] And what I have experienced and what [42:43] we have discussed through the administration [42:45] is, in preparation for the budget, [42:47] it's come to our attention that there [42:50] is no policy or no, really, way for there [42:57] to be a barrier for a Council member [43:02] that is outgoing or termed out or in an election process [43:05] to expend their office's budget in one month for the full year, [43:09] leaving the potentially incoming Council member, [43:12] if it's a termed-out person, or if someone is up for reelection [43:16] and doesn't succeed, then that coming-- incoming person would [43:21] basically be left with zero budget, which is what happened [43:23] to Councilwoman Reinoso. [43:24] In one month, the former Council member [43:27] expended the entire budget. [43:29] And she was basically left with almost nothing. [43:31] Happened to me at the School District also. [43:33] You remember because you were with me at the time. [43:36] We came in. [43:37] And basically, the person before me, [43:39] knowing they were on their way out, expended all the funds. [43:41] And so taxpayers are basically double-burdened because it's [43:45] unfair for that person coming in to not [43:47] have the funding that is intended for that person [43:49] to do their job. [43:51] And so funds have to be replenished in some cases. [43:54] And so this policy, well, it does assess a strict fiscal [43:56] responsibility and transparency, as well as a policy that [44:02] basically prorates those funds into 1/12. [44:06] So you will be able to continue doing your job by the time [44:09] you're there, but you're not allowed [44:10] to expend over the prorated amount for that month [44:13] that you are there. [44:15] There are exemptions such as you should not [44:17] be ordering logo wear or cards or anything like that [44:19] if you are termed out. [44:20] So this just creates a standard procedure and policy [44:25] to be followed so that there is no questions, and there's no-- [44:30] it's not abused from the office of the person sitting there, [44:35] leaving that other person basically helpless when [44:37] they come in with no funding. [44:39] I think it's pretty self-explanatory. [44:41] If there's any questions, I'm happy to answer them. [44:43] The City Attorney has reviewed this for legal sufficiency. [44:47] And the policy is before you. [44:49] I have some quick questions, Mayor. [44:51] Yes, Councilwoman Porras. [44:53] I get the intent. [44:55] And I do agree with it. [44:56] I mean, I've heard this happening [44:57] at the county level and different governments-- [45:01] levels of government. [45:02] What was done in Councilwoman Reinoso's case, [45:05] was her budget replenished? [45:08] I don't remember, actually. [45:09] Councilwoman, you remember? [45:10] No. [45:11] No? [45:11] No. [45:11] I think you had to wait for the new fiscal year. [45:13] Whatever was spent-- through the Mayor. [45:15] Whatever was spent was spent. [45:17] And then I don't remember having funds. [45:21] Yeah, it was, I think, promotional items, memberships, [45:24] and journals. [45:25] I don't remember. [45:26] But I know that it was spent. [45:27] Got it. [45:27] And there was no money to replenish that account. [45:29] Yeah. [45:30] No, I agree with the policy. [45:32] Again, I've seen it happen and-- [45:34] in different offices. [45:36] My only question is I don't see it including the mayor's office. [45:40] Is that something that we can add as well? [45:42] It is included. [45:43] Oh, is it? [45:43] Yes. [45:43] Because it just says-- [45:44] I'm considered a Council member, too, as far as-- [45:46] OK. [45:46] Yeah. [45:46] OK. [45:47] I just wanted to clarify that. [45:48] It is included. [45:49] OK. [45:50] All right. [45:51] Motion to approve. [45:52] Motion to approve by Councilman Pineyro. [45:54] Second. [45:55] Second by Councilwoman Reinoso. [45:57] If there's no further questions, Madam Clerk, [45:59] please call the roll. [46:00] Motion to approve moved by Councilman Pineyro, seconded [46:02] by Councilwoman Reinoso. [46:03] Councilman Pineyro? [46:03] Yes. [46:04] Councilwoman Reinoso? [46:05] Yes. [46:05] Councilwoman Porras? [46:06] Yes. [46:06] Vice Mayor Cabral? [46:07] Yes. [46:07] Mayor Fraga? [46:08] Yes. [46:08] Motion passes. [46:09] Thank you for your support. [46:10] We'll move on to the next item. [46:11] Item 9C, A resolution of the Mayor and the City Council [46:13] of the City of Doral, Florida, directing the City Manager [46:15] to establish a "Doral Ready Squad" [46:16] Hurricane Preparedness Volunteer Program in conjunction with [46:19] the Parks and Recreation Department's Silver Club [46:20] and the Military Affairs Advisory Board, [46:22] pairing veterans, high school student volunteers teams through [46:24] our Student Volunteer Program, providing for implementation, [46:27] incorporation of recitals, and an effective date. [46:30] Councilwoman Reinoso, this is your item. [46:32] Thank you, Mayor. [46:33] So this item would already use an established volunteer program [46:39] that we do have through our parks, I believe. [46:41] And it would be using our Military Affairs Advisory Board [46:47] to lead the Doral squad in events of emergency, [46:52] particularly a hurricane. [46:54] So during the time of a hurricane warning, [46:57] I would like-- because our community is so strong, [47:00] and we're so united for even a time of need, [47:05] such as a hurricane-- to be able to establish an emergency [47:10] team based of volunteers, led by the Military Advisory Board, [47:15] to dispatch within our different communities, [47:18] particularly to our Silver Club and our Special Needs group, [47:23] help during a hurricane, whether it be setting up shutters, maybe [47:28] bringing in groceries. [47:29] But it's just a neighborly initiative. [47:34] And the idea behind it is for the Military Advisory Board [47:38] to essentially break the city into separate sections. [47:43] And they would lead a certain section of the city. [47:46] And my hope is to have enough volunteers registered [47:49] that each community has at least two volunteers in case [47:53] of emergency. [47:54] Now, this could very well be seen as a pilot program. [47:58] And it could turn into something greater. [48:00] But I think it's a beautiful thing when [48:02] we have a community that is so united [48:05] and to extend that neighborly help in a time of need. [48:10] So this item sets some parameters to do that. [48:13] And I hope that I can have the support of my colleagues. [48:17] Thank you, Councilwoman Reinoso. [48:19] Any comments or questions for the Councilwoman? [48:23] Motion to approve. [48:23] Motion to approve by Councilman Pineyro. [48:25] Second. [48:26] Second by Councilwoman Porras. [48:28] Finished it? [48:30] Yeah. [48:30] Thank you. [48:31] All right. [48:31] If there's no other comments or questions, [48:33] Madam Clerk, please call the roll. [48:34] Motion to approve moved by Councilman Pineyro, seconded [48:35] by Councilwoman Porras. [48:36] Councilman Pineyro? [48:37] Yes. [48:37] Councilwoman Porras? [48:38] Yes. [48:38] Councilwoman Reinoso? [48:39] Yes. [48:40] Vice Mayor Cabral? [48:41] Yes. [48:41] Mayor Fraga? [48:42] Yes. [48:42] The motion passes. [48:44] All right. [48:45] Next item, Madam Clerk. [48:46] Next item, 9D, A resolution of the Mayor and the City Council [48:48] of the City of Doral, Florida, directing the City Manager [48:50] to explore mental health options for City of Doral employees, [48:52] providing for implementation, incorporation of recitals, [48:54] and an effective date. [48:55] All right. [48:55] Councilwoman Reinoso, this is also your item. [48:57] Yes. [48:58] So the City of Doral has had some hard last couple of months. [49:05] But we are resilient. [49:07] We are a community with heart. [49:09] The reason why things affect us so closely [49:12] is because of the close relationship [49:14] that our employees have with each other, [49:17] our community has with us. [49:19] And it's a bittersweet thing. [49:22] But again, it shows what a great job we are doing as a city [49:27] that all these different people and events intertwine us, [49:34] keep us connected. [49:36] So mental health needs to be our priority. [49:41] I know that the city has been doing things. [49:44] But we need to do more. [49:45] And we need to do better. [49:48] So public service can be demanding. [49:50] And we must ensure our employees have ample resources to address [49:56] and discuss challenges that may be [49:58] affecting them, both personally and professionally. [50:02] While the city currently provides support, [50:05] I believe we should educate and give this area the attention [50:12] and funding it deserves. [50:14] I ask the City Manager to look into the different programs [50:19] that may be available and, if it is within her budget, [50:23] to move forward, and if it is not, [50:25] to bring it back to Council. [50:28] I am requesting, therefore, the City Manager to work with staff [50:32] and the experts needed to develop [50:34] a comprehensive mental health program for all [50:39] of our employees, every single one. [50:43] The goal is to provide resources, private help, [50:48] anonymous private help, and reduce the stigma [50:52] behind mental health. [50:53] I believe, as the leaders that we are, sitting up here, [50:57] it is our role to call attention to these things. [51:01] And it needs to be done. [51:03] It needs to be done. [51:04] And it needs to be a conversation that [51:07] is comfortable, a conversation that [51:09] needs to be had because grief is normal. [51:14] It is an extension, a different phase, of love. [51:17] Life can be overwhelming and demanding. [51:20] But you're not alone. [51:23] You're loved. [51:24] There's resources. [51:25] And we need to be able-- as Council, as staff, [51:30] as administration, we need to be able to provide that resource. [51:35] So supporting the mental health of our employees [51:38] is an investment in their well-being [51:41] and the continued strength within our city. [51:45] God bless the staff. [51:47] God bless our city. [51:49] And I hope to have the support from my colleagues [51:52] as well to pass this along. [51:55] Our employees are our top priority. [51:58] And we love you. [51:59] And mental health needs to be discussed. [52:01] And you all need the resources available to help [52:05] you do the best for our city and to help [52:07] do the best for yourselves. [52:11] Thank you, Councilwoman. [52:13] I couldn't agree more. [52:15] And I would like to co-sponsor this item if possible. [52:19] And I think it's an extremely sensitive item. [52:22] So I really appreciate your approach on it, [52:24] because I know that it's something that is extremely, [52:27] deeply personal to people. [52:29] And so we want to be able to extend [52:31] that help and that resource. [52:36] But it is extremely personal. [52:38] And so I think that we should absolutely [52:41] have the experts look into it and see how we can continue [52:44] to improve and be better and continue to grow and learn [52:48] from these circumstances. [52:50] So thank you for bringing this forward. [52:52] I also want to just piggyback off of it [52:54] and mention I have been having conversations [52:57] right after learning about this with the Manager and our Parks [53:01] Director to include a monthly mental health [53:05] emotional intelligence support or-- [53:11] we're calling it-- what was the word I used? [53:13] Not a support group, but a come-together group [53:17] through our parks in our monthly programming. [53:20] So not just sports and art and all these great things [53:22] that we do, but also to have one programming a month [53:27] in our parks, a public opportunity for people [53:31] to either come to a workshop, a class, [53:34] a motivational speaker, a group of colleagues that get together. [53:40] So we will be starting to incorporate some of that [53:42] into our monthly programming. [53:43] So I just wanted to mention that as well. [53:46] And I think it's extremely valuable for our community, not [53:48] just our employees. [53:50] So thank you for bringing this forward. [53:54] You have my full support. [53:55] And I look forward to working with all of you [53:58] to improve this in our-- amongst our community. [54:01] Motion to approve. [54:02] Motion to approve by Vice Mayor Cabral. [54:04] Second. [54:05] Second by Councilman Pineyro. [54:06] And Councilman Pineyro? [54:07] Sure. [54:08] Comment? [54:08] Thank you, Mayor. [54:10] And thank you, Councilwoman Reinoso, [54:12] for bringing this forward. [54:13] And I would love to co-sponsor as well this item. [54:16] Thank you. [54:17] But I also want to mention just an idea as well, [54:21] because I think we did something similar [54:24] when it came to the discussion about the domestic violence [54:28] as well, that we included a section on our website [54:33] about services, local providers, or approved institutions that [54:40] provide these type of services, not only for staff, but also [54:44] for residents as well. [54:46] So maybe we can look into that option [54:48] as well, that we can provide information [54:52] in our website about mental health. [54:55] And, as a matter of fact, we-- [54:57] I have been working on hosting-- [55:01] next week-- I believe it's the 22nd-- [55:04] at Albizu University a workshop conference about mental health. [55:10] We have been working on this for the past almost two months. [55:14] So I'm going to pass the information to you [55:16] as well so you can attend and speak about it because it's [55:20] something that certainly is needed to speak and to-- [55:26] and for residents to know what type of resources are available. [55:30] So I'm going to be sharing that information as well. [55:33] And speaking of Albizu University, it's here in Doral. [55:37] And they do provide a lot of these services. [55:40] So just for you to keep that in mind as well. [55:43] And we can work with them in a lot of these initiatives. [55:46] So thank you. [55:49] Absolutely. [55:49] Thank you, Councilman. [55:50] Yes, absolutely. [55:51] So all right. [55:53] Mayor? [55:53] Yes. [55:54] Yes. [55:54] So I just wanted to make a quick comment. [55:57] So we have been already-- [56:00] we have already started conversations and meetings. [56:02] I've met with the HR Director, the Chief of Police, [56:06] I also met with Councilwoman Reinoso [56:08] to get some guidance on what it is that we wanted to see. [56:13] And we are putting together some proposals. [56:17] If we can do it under my threshold, which [56:20] I would hope we could, then I'll go ahead and do that. [56:24] But I will update Council. [56:25] And also, if it does exceed, then we [56:29] can examine those as well. [56:30] But we are coming up with specific programs tailored [56:33] to specific populations and also to-- [56:36] but it will cover all of our employees. [56:39] Thank you. [56:39] Mayor? [56:40] Yes, Councilwoman. [56:41] And I would like for mandatory sessions [56:44] to be included in whatever the program is because I think [56:47] if everybody needs to go to a session, whether it's a workshop [56:53] or whatever it may be, it starts to break down the stigma. [56:57] It also becomes an avenue that if somebody [56:59] does need that extra help, they can [57:02] go through that under the radar and seek that help that they [57:06] may be needing without a worry of maybe somebody noticing. [57:12] We just want to be able to provide that resource of help [57:15] when needed. [57:16] And to the Mayor's point, I love the now [57:21] extending this to the community-- [57:24] perhaps on a monthly basis, is what I'm hearing? [57:26] Yeah, once a month. [57:27] We did have tragedies at our local school. [57:30] And I think it would be nice to also have a component [57:34] for students, parents, and families that may have gone [57:38] through some things recently to have some source-- [57:42] some resource that they can seek guidance or-- [57:49] we can't prevent tragedies from happening. [57:53] We have to be ready for when they do happen. [57:56] And again, these are things that happen within our life. [58:05] There's a way to prevent the really, really terrible stuff. [58:10] And I think that's what we're trying [58:12] to do with this opportunity. [58:13] But when things do happen, there's [58:16] people that are heartbroken, that are hurt, [58:18] that are left over. [58:19] And they also need help too. [58:21] So yes, it's a very delicate topic. [58:26] I don't want to speak more about it. [58:27] I think enough has been said. [58:29] But I appreciate that just how we [58:31] plan parties and feel-good events, that, as a city, [58:35] we also deal with the harder topics [58:37] and provide those resources as well. [58:41] Thank you. [58:42] All right. [58:42] If there's no additional comments or questions, [58:45] Madam Clerk, please call the roll. [58:46] Motion to approve by Vice Mayor Cabral, [58:48] seconded by Councilman Pineyro. [58:49] Vice Mayor Cabral? [58:50] Yes. [58:50] Councilman Pineyro? [58:51] Yes. [58:51] Councilwoman Porras? [58:52] Yes. [58:53] Councilwoman Reinoso? [58:53] Yes. [58:54] Mayor Fraga? [58:55] Yes. [58:55] Motion passes. [58:56] All right. [58:56] Thank you very much for your support. [58:58] Item 9E, Discussion-- Employee Salary Public Search Portal. [59:02] OK. [59:02] Councilwoman Porras, this is your item. [59:04] Thank you, Mayor. [59:05] This is just a very, very brief discussion [59:09] on the implementation of a search tool that's [59:13] going to allow the public to access and view employee [59:17] salaries for the city. [59:19] When I was looking into this, after the City of Miami [59:22] Beach and the City of Miami passed their own, [59:26] I-- and I emailed the City Manager's office about it, [59:30] she informed me that the city was already [59:32] working on something like this. [59:35] And so I just wanted to let residents know that it [59:38] is going to be happening. [59:41] And also, it is going to be something [59:46] that new state law is going to require [59:48] of cities and municipalities. [59:50] So I wanted to just very quickly have the City Attorney just [59:55] explain what the city-- what the new law requires [59:58] and then just, Manager, what you told me [1:00:01] so that the residents can know what's [1:00:03] going to be implemented later on. [1:00:06] Through the Mayor. [1:00:07] Councilwoman, so the new law that's [1:00:10] going to effect at the beginning of this year [1:00:12] basically requires that all local governments [1:00:15] post salaries of their employees and updated [1:00:18] on a quarterly basis. [1:00:20] OK, thank you. [1:00:24] So, Mayor and Council, since the law was passed, [1:00:30] we have been discussing implementing [1:00:32] that, which the timeline for that is January 1 of 2027. [1:00:39] We are speaking with our vendors-- [1:00:42] our Paycom vendor. [1:00:44] I'm trying to be able to make that an efficient process [1:00:47] because I don't want something that has to be manually done [1:00:50] and inputted all the time. [1:00:54] So we are working on that. [1:01:00] Because I like to keep things clear, I want to understand-- [1:01:04] I want to just state that, yes, we have been working on it. [1:01:07] It is an administrative policy. [1:01:09] I did ask the Attorney if I was required [1:01:12] to ask Council for action on that, and I'm not. [1:01:16] So I am going to be handling this in an administrative policy [1:01:19] manner. [1:01:21] And I will update Council accordingly [1:01:24] once we come up with the system. [1:01:26] But absolutely, it will be up and running to meet-- [1:01:28] to be compliant with state law. [1:01:31] Thank you very much. [1:01:32] All right. [1:01:33] Another-- [1:01:34] Thank you very much. [1:01:34] Thank you. [1:01:35] All right. [1:01:36] No action is required. [1:01:37] We'll move on to the next item, Item 9F. [1:01:39] Item 9F, Discussion-- Advisory Boards, Committees, [1:01:41] and Commissions Member Nomination. [1:01:43] Mayor and Council, I did receive one nomination [1:01:45] from the office of Councilwoman Porras, which [1:01:46] is attached here in for the commission on status of women. [1:01:49] Do we have a motion? [1:01:50] Motion. [1:01:51] Motion to approve by Councilwoman Porras. [1:01:52] Second. [1:01:52] Second by Councilwoman Reinoso. [1:01:55] All in favor say, "aye." [1:01:56] Aye. [1:01:56] Aye. [1:01:58] Sorry, do we need a full roll call? [1:01:59] That's fine, no. [1:02:00] OK. [1:02:01] Mayor's Report. [1:02:02] All right, Mayor's Report. [1:02:07] Give me one second. [1:02:08] Sorry. [1:02:11] So, first, I'd like to thank our Parks and Recreation Department [1:02:15] and our Doral Police Department for a great National Night Out [1:02:19] event. [1:02:19] It was a success. [1:02:20] People were happy, very well organized, [1:02:22] every year better and better. [1:02:24] So thank you to the entire team-- [1:02:26] it was a wonderful evening-- [1:02:28] and to the Police Department that [1:02:29] always does a great job with their National Night Out event. [1:02:32] And I think our families truly enjoy it. [1:02:34] As our students head back to school tomorrow, [1:02:36] I want to wish all our students a very successful, safe, [1:02:42] and educational school year, creating new memories. [1:02:45] I just want to mention on that, too, I did ask-- [1:02:48] I know every year, first week of school [1:02:50] is tough with some traffic delays. [1:02:54] And so every year, we've gotten, I [1:02:55] think, a little bit better and not just [1:02:57] implementing more police officers around the schools [1:03:00] to help the flow of traffic. [1:03:03] [PHONE RINGS] [1:03:07] Silence your phones. [1:03:08] No, I'm just kidding. [1:03:10] So not just on helping with the flow of traffic [1:03:13] and making sure that people have an easier route [1:03:17] and that they feel and see the presence of our police officers. [1:03:20] And we get to engage with the kids and things. [1:03:21] So it's always wonderful to see our men and women in uniform [1:03:25] out there supporting families. [1:03:26] But this year, actually with the help of Public Works, [1:03:31] we requested all active MOTs to be delayed [1:03:37] and not obstruct the flow of traffic. [1:03:40] And so Carlos and his team did a great job of speaking with [1:03:43] the County and making sure that there was no MOTs that had been [1:03:47] approved through the County that we hadn't seen that would affect [1:03:50] the traffic flow, because we know that it's-- it can always [1:03:53] be a challenge in the mornings and in the afternoons. [1:03:55] So I can't promise there will be no traffic to the residents. [1:03:59] But we're going to make it as an easy process [1:04:01] and as a safe process as possible. [1:04:04] A quick reminder to our city offices that-- [1:04:07] I mean, to our city that the offices will be closed in-- [1:04:12] for Labor Day in recognition of-- observance [1:04:14] of Labor Day on September 7. [1:04:15] Obviously, we don't have a Council meeting until then, [1:04:18] so I just wanted to mention that. [1:04:19] And it will take place on Tuesday, September 8. [1:04:22] And then, of course, we have some birthdays this month-- [1:04:25] our Director of IT, Eylin Fernandez, on August 13. [1:04:31] So tomorrow is your birthday. [1:04:34] I forgot what day it was. [1:04:36] Our Director of-- our Building Official, I'm sorry, [1:04:40] Linda Blanco, on August 26. [1:04:44] Happy birthday. [1:04:45] And we have a very special birthday. [1:04:47] Also, on Monday, August 17, our City Manager [1:04:52] will be celebrating her birthday. [1:04:54] Happy birthday. [1:04:59] Cake. [1:05:00] (SINGING) Happy birthday to you [1:05:02] (SPEAKING) We sing here. [1:05:03] (SINGING) Happy birthday to you [1:05:07] Happy birthday, dear Zeida [1:05:10] Happy birthday to you [1:05:14] (SPEAKING) It looks like a Game of Thrones cake. [1:05:19] Thank you, everybody. [1:05:21] All right, that concludes my Mayor's comments. [1:05:24] Thank you very much. [1:05:26] All right, the next item is Advisory Board Comments, [1:05:28] Special Needs Advisory Board for August 2026. [1:05:31] We do have Mr. Trevor Cunningham here [1:05:32] to present the report, Mayor. [1:05:34] Thank you. [1:05:35] Thank you for your patience. [1:05:37] Yeah, absolutely. [1:05:39] And thank you for singing. [1:05:40] That gives me a little lightheartedness to do this. [1:05:45] As mentioned, my name is Trevor Cunningham. [1:05:47] And I am the Chair of the City of Doral Special Needs [1:05:49] Advisory Board. [1:05:52] I just want to quickly thank my fellow board members [1:05:56] for bringing this opportunity to my attention, the Department [1:05:59] of Public Works here at the City of Doral [1:06:00] for answering many of our questions [1:06:02] about this, and Madam City Clerk and Miss Juanita Cruz [1:06:07] for welcoming me this morning. [1:06:09] This is my first City Council meeting, [1:06:11] so I'm really happy to be here and be with you all. [1:06:15] Our Advisory Board is asking to expand ridesharing options [1:06:19] to individuals with disabilities, [1:06:21] specifically at free or low cost, [1:06:26] specifically looking at providing services [1:06:29] for individuals to travel to medical appointments or job [1:06:35] opportunities as city residents to city places. [1:06:40] These are not necessarily meant to replace the Doral Trolley [1:06:44] system or the Special Transportation Services. [1:06:50] Both services are great. [1:06:51] As someone who has a visual impairment, I use both of them. [1:06:54] Every single day, I use the Trolley to get to the Metrorail. [1:06:57] And I use my STS card to use the Metrorail. [1:07:00] However, both have limitations. [1:07:02] The [? Doral ?] Trolley has specific routes [1:07:05] that can't go everywhere. [1:07:07] And the STS service that is meant to go to door to door [1:07:12] is constantly delayed and constantly has [1:07:14] its own challenges. [1:07:16] And for someone trying to get to a job or a medical appointment [1:07:21] and being several hours delayed, you [1:07:23] can only imagine how challenging that could be. [1:07:27] Our simple ask here is that we ask that the City of Doral [1:07:30] explore opportunities to expand the Freebee ridesharing [1:07:35] program to people with disabilities [1:07:37] and specifically look at opportunities for demand, [1:07:40] operational feasibility, and long-term sustainability, [1:07:43] specifically long-term cost. [1:07:45] We know that this could be an expensive program. [1:07:50] But we want to make sure that the demand is there, [1:07:53] that the opportunity to make this a successful program [1:07:55] would be there as well. [1:07:57] So that is our proposal at this moment. [1:08:00] And happy to answer any questions. [1:08:02] Thank you, Trevor. [1:08:03] Just to give some information on this-- so we have-- [1:08:08] I've been working with Public Works on this. [1:08:10] And we have had discussions about expanding it. [1:08:14] The question that hasn't been answered, [1:08:16] and what we're trying to understand better, [1:08:19] is to what level of capabilities we would allow, [1:08:22] whether the rider will be by themselves, accompanied [1:08:25] with someone, because we understand the request of going [1:08:29] to work and things like that. [1:08:30] That's someone who's a little more independent. [1:08:32] But we have no way of limiting someone [1:08:35] putting someone with less capabilities in a vehicle [1:08:39] on their own to go somewhere. [1:08:41] So we're trying to figure out how to best service and serve [1:08:45] those with the independence that they would be able to. [1:08:52] We're working with Freebee on what the disability allow-- [1:08:59] what they would allow as a disability for a person [1:09:01] to be alone, or if they would have to say [1:09:03] you have to be accompanied. [1:09:04] So it is something that's being looked at. [1:09:06] And then, obviously, the funding is the biggest issue. [1:09:08] It is very costly. [1:09:09] And it does cost us a lot right now even for the seniors. [1:09:12] So we are currently reviewing that and seeing how we can best [1:09:16] fund the program and expand it. [1:09:19] We do subsidize a lot of special needs programming now. [1:09:22] There's a lot of changes potentially coming down [1:09:24] from Tallahassee on our revenue structures. [1:09:27] So we are looking into all those capabilities, advertising, [1:09:32] so on. [1:09:32] So it is something that has been in discussion for some time. [1:09:36] And I know that we would all be very supportive of it. [1:09:39] We're just looking at what's the best model forward [1:09:41] to be able to provide some expansion to the program. [1:09:45] Great. [1:09:46] Any additional questions? [1:09:50] We'll let you all know very soon. [1:09:51] Hopefully, there'll be a response. [1:09:53] But I know Public Works is actively working on it. [1:09:55] And they did hear your request that would be coming forward [1:09:59] as part of the agenda. [1:10:00] Excellent. [1:10:01] We really appreciate it. [1:10:02] Madam Manager, anything you would like to add on that? [1:10:04] No? [1:10:05] OK. [1:10:06] All right. [1:10:06] Thank you, Trevor. [1:10:07] Thank you. [1:10:07] Thank you so much. [1:10:08] We'll keep you up to date. [1:10:10] All right. [1:10:11] Move on to the next item. [1:10:12] City Manager's Report. [1:10:14] Madam City Manager? [1:10:16] Hi. [1:10:16] Yes. [1:10:17] Good morning. [1:10:18] So I wanted to just bring a few-- a couple things [1:10:24] to the Council's attention. [1:10:27] It's with great honor that I report that the City of Doral [1:10:30] is in receipt of the prestigious Government Finance Officers [1:10:32] Association Triple Crown Award for 2024. [1:10:37] So the 2024 Triple Crown Award recognizes [1:10:40] governments that have achieved the following GFOA awards. [1:10:44] The Certificate of Achievement for Excellence in Financial [1:10:47] Reporting for the FY 2023 ACFR, the Popular Annual Financial [1:10:55] Reporting Award, and the Distinguished Budget [1:10:58] Presentation Award for FY '25/'26 budget. [1:11:03] So Doral is just one of 441 governments [1:11:07] to achieve this special recognition [1:11:08] for fiscal year ending 2024. [1:11:10] The Triple Crown designation represents [1:11:12] a significant achievement. [1:11:13] To qualify, each entity must meet [1:11:15] the high standards of all three separate award programs. [1:11:18] Each award program recognizes governments [1:11:20] that produce reports which communicate [1:11:22] their financial stories in a transparent manner [1:11:25] and meet applicable standards. [1:11:26] So I would like to take this opportunity [1:11:28] to express my gratitude to the entire Finance [1:11:30] team for their hard work and dedication. [1:11:34] We have commended them for these awards before. [1:11:37] [APPLAUSE] [1:11:45] In addition to that, I'm also pleased to share [1:11:47] that Doral Central Park project has officially earned the Gold [1:11:51] certification from the Florida Green Building Coalition. [1:11:55] Although the project was originally [1:11:56] designed to achieve only the Silver certification, [1:12:00] the dedication and collaborative efforts [1:12:01] of the City of Doral team followed us to exceed that goal. [1:12:05] Through strategic coordination, careful planning, [1:12:07] and strong commitment to sustainable design [1:12:09] and construction practices, the project [1:12:11] achieved the higher Gold certification. [1:12:13] This recognition is a significant accomplishment [1:12:15] for the city and reflects the hard work [1:12:17] of everyone involved in delivering [1:12:19] a high-quality, environmentally responsible project that [1:12:22] will benefit our community for years to come. [1:12:25] I'd like to congratulate and thank [1:12:28] Lazaro Quintero and the entire project team [1:12:31] for this outstanding achievement. [1:12:32] They do have an award that was sent to them, [1:12:36] so I'd like for them to come and take a picture with you [1:12:40] if possible. [1:12:40] Of course. [1:12:41] Thank you. [1:12:41] Please come up. [1:12:42] [APPLAUSE] [1:12:45] We'll do it right when we wrap up-- let's finish the reports. [1:12:49] Yes. [1:12:49] Yes. [1:12:50] Anything else, City Manager? [1:12:52] No, that's it, Mayor. [1:12:53] Thank you. [1:12:53] OK. [1:12:54] Madam City Clerk, next item. [1:12:55] City Attorney's Report. [1:12:56] City Attorney. [1:12:57] Mr. City Attorney? [1:12:58] Nothing to report, Madam Mayor. [1:12:59] OK, no sessions to call. [1:13:01] No sessions to call. [1:13:02] OK. [1:13:02] Madam City Clerk, your report's always so-- [1:13:05] It's very lengthy. [1:13:06] It's attached. [1:13:07] OK, perfect. [1:13:08] Thank you. [1:13:08] Thank you very much. [1:13:09] All right. [1:13:10] That exhausts our morning council meeting agenda. [1:13:12] Do I have a motion to recess? [1:13:14] Motion. [1:13:15] Motion to recess by Councilman Pineyro. [1:13:17] Second. [1:13:17] Second by Councilwoman Reinoso. [1:13:19] All in favor say, "aye." [1:13:19] Aye. [1:13:20] Aye. [1:13:20] We'll see you back here for our protocol hour. [1:13:22] And then our Council meeting OPA, 5:30. [1:13:26] Thank you very much. [1:13:27] See you later. [1:13:33] All right. [1:13:35] Good evening, everyone. [1:13:36] Welcome to our regular scheduled Council meeting. [1:13:38] Today is Wednesday the 12th. [1:13:42] The time is now 6:09 PM. [1:13:43] I hereby call this meeting to order. [1:13:45] Please remember to silence your phones. [1:13:46] And if you must take a call, please step [1:13:48] outside so that we can keep an orderly and respectful [1:13:51] atmosphere while we have our meeting. [1:13:53] All right. [1:13:53] Madam Clerk, please call the roll. [1:13:55] Councilwoman Nicole Reinoso? [1:13:56] Present. [1:13:57] Councilwoman Maureen Porras? [1:13:58] Here. [1:13:59] Councilman Rafael Pineyro? [1:14:00] Present. [1:14:00] Vice Mayor Digna Cabral? [1:14:01] Here. [1:14:02] Mayor Christi Fraga? [1:14:03] Present. [1:14:03] Mayor, we have quorum. [1:14:04] Please rise for the Pledge of Allegiance, [1:14:06] led by Councilwoman Porras. [1:14:09] I pledge allegiance to the Flag of the United States of America, [1:14:13] and to the Republic for which it stands, one Nation under God, [1:14:17] indivisible, with liberty and justice for all. [1:14:26] OK. [1:14:27] Agenda/Order of Business. [1:14:28] Madam City Manager, Mr. City Attorney, any changes from you? [1:14:34] No, Mayor, we're fine. [1:14:35] No, Mayor. [1:14:35] Thank you. [1:14:36] I have had some requests to make some arrangements in the Agenda [1:14:40] since it is a long one. [1:14:41] So if you all will indulge some of our requests. [1:14:45] We have been asked to hear item 20G, [1:14:47] which is the City's Comprehensive Plan, [1:14:49] first reading again. [1:14:51] As our first item, should be very quick. [1:14:53] So we'll hear that first. [1:14:55] And then we're going to move item 20Q right after 20E since [1:14:59] the applicant has several items and would like to have them all [1:15:03] taken up right after the other. [1:15:05] If there's no objections to that, [1:15:07] those will be the changes to the Agenda/Order of Business. [1:15:10] Is everyone OK with that? [1:15:11] Yup. [1:15:11] Yes? [1:15:12] OK. [1:15:12] Madam Clerk, make the notes on the Agenda, please. [1:15:14] Yes, ma'am. [1:15:15] All right. [1:15:16] And we will go ahead and move into Public Comments. [1:15:22] We will now open the floor for public comments. [1:15:24] Each speaker will have three minutes [1:15:26] to address any item on today's agenda [1:15:28] or any matter related to the City of Doral. [1:15:31] Please begin by stating your name [1:15:32] and address for the record to ensure that you're [1:15:35] registered with the City Clerk. [1:15:36] We'll first hear from those who have preregistered with our City [1:15:39] Clerk, followed by any walk-in speakers. [1:15:42] Once all of the preregistered speakers have spoken, [1:15:44] I will mention that this is your final reasonable opportunity, [1:15:47] and you can approach the podium. [1:15:49] As a reminder, in accordance with City Code of Conduct, [1:15:51] we ask that you make all remarks in a respectful, courteous, [1:15:54] and orderly manner. [1:15:55] Personal attacks, offensive language, [1:15:57] disruptive behavior will not be permitted. [1:16:00] Please, let's work together to maintain a productive forum that [1:16:03] is constructive for all. [1:16:05] I will go ahead and open up the floor [1:16:07] to preregistered speakers, which I believe [1:16:08] we have none at this time. [1:16:10] So anyone who would like to speak on any item related [1:16:13] to the City Council, germane to the city, or on this agenda, [1:16:17] please approach the podium. [1:16:28] Being none, Public Comments is now closed. [1:16:31] Madam Clerk, let the record reflect [1:16:32] no one has chosen to speak at this time. [1:16:34] And we'll go ahead and move into our Public Hearing items. [1:16:37] Madam Mayor, may I please swear in all the witnesses [1:16:39] for all the public hearings? [1:16:40] Yes, ma'am. [1:16:40] If you are presenting testimony in any of the public hearings [1:16:43] tonight, please stand up, raise your right hand, [1:16:45] and repeat after me. [1:16:48] I do solemnly swear that the information that I'm [1:16:51] about to present shall be the truth and nothing but the truth. [1:16:54] Thank you very much. [1:16:56] Item 20G, Ordinance Number 2026-20, [1:16:59] Comprehensive Plan Update. [1:17:00] An ordinance of the Mayor and the City Council of the City [1:17:02] of Doral, Florida, adopting evaluation and appraisal report [1:17:04] EAR-based amendments to the comprehensive plan by amending [1:17:06] the resiliency element, future land use element, [1:17:09] transportation element, housing element, infrastructure element, [1:17:12] conservation element, parks and recreation element, [1:17:14] educational facilities element, intergovernmental coordination [1:17:16] element, and capital improvements element by creating [1:17:19] new private property rights element and economic development [1:17:21] element and updating the water supply facilities work plan [1:17:23] pursuant to Sections 163.3191, 163.3184, and 163.3177(6)(C), [1:17:28] Florida Statutes, providing for transmittal to the State Land [1:17:31] Planning Agency, Florida Department of Commerce, [1:17:33] providing for conflicts, severability, [1:17:34] inclusion in the Comprehensive Plan, and an effective date. [1:17:36] OK. [1:17:37] Opening up the public hearing for Item 20G, [1:17:39] also known as 26-6715. [1:17:42] Anyone who would like to speak on this item, please [1:17:44] approach the podium. [1:17:50] Showing no interest, Public Comments is now closed. [1:17:52] Madam Clerk, let the record reflect [1:17:53] no one has chosen to speak at this time. [1:17:55] And we'll now hear from staff, or, I believe, [1:17:57] Ms. Michelle Lopez is here visiting us? [1:18:00] Welcome. [1:18:01] Thank you, Mayor. [1:18:05] Always nice to be back in your chambers. [1:18:09] Good evening, Mayor, Council, and-- [1:18:12] I'm sorry, Mayor, Vice Mayor, and members of the City Council. [1:18:16] Tonight, we're presenting the ordinance [1:18:18] for the City's Evaluation and Appraisal Report [1:18:20] of the Comprehensive Plan. [1:18:22] It's a required, state-mandated update. [1:18:24] I'll walk you through what the year is, [1:18:26] what changed in your Comp Plan, and how we engage the community [1:18:29] and what happens after tonight. [1:18:32] So two terms that you're going to hear [1:18:34] throughout this presentation, I'm [1:18:36] going to define them up front. [1:18:38] The first is the comprehensive plan. [1:18:39] That's the City's long-range policy document. [1:18:42] It sets the city's goals, objectives, and policies [1:18:45] and its growth pattern. [1:18:47] Every land development regulation and every development [1:18:49] order has to be consistent with your Comprehensive Plan. [1:18:52] The second is the Evaluation and Appraisal Report, [1:18:54] which is a periodic checkup of that plan. [1:18:57] State law requires that it's done at least every seven years. [1:19:01] We evaluate whether the plan still reflects the current state [1:19:03] law and the local conditions, notify the state, [1:19:06] and then adopt whatever amendments are required. [1:19:08] In short, the Comp Plan is the document. [1:19:11] And the EAR review tells us what we need [1:19:13] to update every seven years. [1:19:17] Your last Comp Plan update was in 2016, a holistic Comp Plan [1:19:22] update. [1:19:22] You've done minor updates since then. [1:19:24] But the EAR process and the last major Comp Plan update [1:19:28] was done in 2016. [1:19:29] So that's 10 years of development pattern [1:19:33] that has changed. [1:19:35] It's a decade of growth, development, and infrastructure [1:19:37] demand. [1:19:38] And we just need to catch up through the policy document [1:19:42] and update that and then have a 25-year projection forward. [1:19:46] So the purpose of the ordinance is [1:19:48] to amend the Comp Plan so it stays consistent [1:19:50] with local state requirements and reflects where [1:19:53] the City is actually at today. [1:19:56] And so through this effort, we're [1:19:57] updating every element, objective, [1:19:59] policy in the Plan that was reviewed and required updating. [1:20:06] So we updated or amended your 10 core elements, [1:20:10] which is resiliency, your land use-- future land use policy, [1:20:13] transportation, housing, infrastructure, conservation, [1:20:15] parks and recs, education, intergovernmental coordination, [1:20:20] and capital improvements. [1:20:22] There are two new elements as part [1:20:23] of the Comp Plan, which is your economic development policy. [1:20:26] Several years ago, FIU conducted a project [1:20:31] where they looked at potential economic development policies [1:20:34] that the City could pursue. [1:20:36] And so we're rolling that into the Comprehensive Plan. [1:20:39] And then the property rights element [1:20:40] was adopted by reference in 2022. [1:20:43] Through this effort, we're incorporating the property [1:20:45] rights element into the larger document, as well as the data [1:20:48] and analysis that goes with it. [1:20:50] We've also taken the Water Supply Plan, [1:20:53] the 10-year horizon, and brought it up to date. [1:20:58] So through this process, there was community engagement, [1:21:00] which is also required. [1:21:02] The first was a community workshop held [1:21:04] at Doral Central on January 20. [1:21:07] The second was a tabling event at the Farmers Market [1:21:09] at Doral Central again. [1:21:11] That one had a little bit more interaction and activity [1:21:13] from the residents. [1:21:15] And we really appreciated their input. [1:21:17] And then the third, we had QR codes at both events [1:21:21] and then also posted throughout city facilities, [1:21:23] City Hall, at your parks departments [1:21:25] so that the community can engage from a remote setting [1:21:28] on their cell phones. [1:21:29] So we took all of that engagement and commentary, [1:21:33] and we rolled it into the document [1:21:36] as we looked at the policies and objectives to update. [1:21:41] So this all probably sounds a little bit familiar. [1:21:44] I was here on April 10, doing a very similar presentation. [1:21:48] At that time, the document was adopted. [1:21:51] We transmitted to the state. [1:21:52] The state came back. [1:21:53] They wanted some changes and requested that we go back [1:21:58] to first reading in LPA. [1:22:00] So we're doing so. [1:22:04] Where we land next is after tonight, [1:22:08] if we have your support to proceed, [1:22:10] we'll go ahead and retransmit to the state again. [1:22:14] They'll go through a 30-day review cycle, submit comments. [1:22:17] We'll address the comments, then we come back for second reading, [1:22:21] and then we retransmit again for another 30-day review. [1:22:26] We had a significant engagement between our staff [1:22:30] at Corradino and the City. [1:22:32] And so I just want to give a brief acknowledgment. [1:22:35] The Corradino Project Manager was Kathryn Lyon. [1:22:39] And we had Madison Hermida supporting on data analysis [1:22:42] and collection. [1:22:44] Your land use special counsel Valerie [1:22:47] Vicente looked at the document. [1:22:48] She did her legal sufficiency review. [1:22:51] And then, of course, most importantly is your departments. [1:22:54] Guillermo De Nacimiento, the Assistant Director [1:22:56] of Planning and Zoning, was the City's project manager, [1:22:58] shepherding this process, coordinating [1:23:00] between departments. [1:23:01] And then we had significant feedback from your Planning [1:23:04] and Zoning team, Public Works, Parks and Recs, Capital [1:23:07] Improvements, Economic Development, and Public Affairs [1:23:11] helping us with the notices and the social media posts [1:23:14] for those community workshops that we discussed. [1:23:16] So I just want to say thank you to all of those departments [1:23:19] and participation. [1:23:20] We couldn't do it without you. [1:23:22] And with that, thank you for your time. [1:23:25] I ask for a recommendation of approval. [1:23:27] And then we can proceed with transmittal. [1:23:30] OK. [1:23:31] Do you have any comments? [1:23:33] Madam Manager, I have a quick question. [1:23:35] Sure. [1:23:36] Are we required to do all of the public engagement stuff again? [1:23:40] Is that not-- [1:23:41] No, it's-- [1:23:42] It's not being affected? [1:23:43] Yeah, it's not being affected. [1:23:44] So the language that's being updated or changed [1:23:47] was more based on what exactly? [1:23:50] Yeah, there were technical nuances [1:23:51] that the state felt were maybe a little bit more [1:23:54] restrictive or burdensome. [1:23:57] I had an in-depth conversation with the Manager's office [1:23:59] and your legal team. [1:24:03] We determined collectively none of those policies we were [1:24:06] willing to die on the hill for. [1:24:07] We can always come back later. [1:24:09] We roll them back? [1:24:10] Yeah. [1:24:12] But not detrimental to the changes to the Comp Plan? [1:24:14] Not at all. [1:24:15] And we're certain that the state will be-- [1:24:18] I mean, it was in line with what they recommended we review? [1:24:21] Yes. [1:24:22] We took all their recommendations. [1:24:23] And we just went line by line and accepted [1:24:26] what they asked for. [1:24:27] [INAUDIBLE] [1:24:28] It was a little bit of an overreach, but-- [1:24:31] do you have any other questions? [1:24:34] No? [1:24:34] All right. [1:24:35] Motion. [1:24:36] Motion to approve by Councilwoman Reinoso. [1:24:37] Second. [1:24:38] Second by Councilman Pineyro. [1:24:39] Madam Clerk, please call the roll. [1:24:41] Motion to approve Ordinance Number 2026-20 on first reading [1:24:44] made by Councilwoman Reinoso, seconded by Councilman Pineyro. [1:24:45] Councilwoman Reinoso? [1:24:46] Yes. [1:24:47] Councilman Pineyro? [1:24:47] Yes. [1:24:48] Councilwoman Porras? [1:24:49] Yes. [1:24:49] Vice Mayor Cabral? [1:24:50] Yes. [1:24:50] Mayor Fraga? [1:24:50] Yes. [1:24:51] Motion passes. [1:24:52] Thank you. [1:24:52] Thank you. [1:24:53] See you soon. [1:24:54] All right. [1:24:55] Next item, Madam Clerk. [1:24:56] We're going back to item 20A, A resolution of the Mayor [1:24:58] and the City Council of the City of Doral, Florida, [1:25:00] approving the site plan and special exception use permit [1:25:02] for plus or minus 8,000-square-foot fitness/sports [1:25:04] facility and outdoor soccer fields located on a vacant [1:25:06] parcel in the City of Doral, Florida, [1:25:08] identified with a Miami-Dade Folio Number 35-3022-000-0981, [1:25:12] pursuant to Section 68-849(B)(5) of the City's Land Development [1:25:16] Code and providing for an effective date. [1:25:17] All right. [1:25:18] Let me go ahead and do the Public Hearing first. [1:25:20] Mr. Magrisso, thank you. [1:25:22] Opening up Public Comments for item 20A, also known as 26-6681. [1:25:26] Anyone who would like to speak on this item, and this item [1:25:29] alone, please approach the podium. [1:25:35] Seeing no public comments for this item, [1:25:38] we are now closing the Public Comments portion. [1:25:40] Madam Clerk, let the record reflect [1:25:40] no one has chosen to speak at this time. [1:25:42] And I will take any ex parte communications on this item. [1:25:47] No. [1:25:48] No? [1:25:48] I did have some ex parte communication [1:25:50] during the workshop. [1:25:50] I happened to walk in and meet the applicant. [1:25:52] And I know that they've worked hard on this. [1:25:55] It will not affect my decision on it. [1:25:59] And we're happy that we're here today. [1:26:01] Let's move forward. [1:26:02] Mr. Magrisso? [1:26:05] OK. [1:26:06] Good evening, Mayor, Vice Mayor, Council, Madam Manager. [1:26:10] I think I have a presentation. [1:26:12] Perfect OK, so this is a fitness/sports facility. [1:26:17] It is located right back here on 56th Street, [1:26:21] on the corner of Northwest 82nd Avenue. [1:26:23] And it's approximately 0.86 acres. [1:26:26] The land use around it and the zoning districts are pretty much [1:26:31] all industrial districts and future land use categories. [1:26:35] These are a couple of renderings of the proposal pursuant [1:26:40] to 53-128, a Special Exception is required for this use [1:26:43] in the location. [1:26:45] And they're coming in for site plan approval as well. [1:26:48] So you can see that there are two pitches on the proposed site [1:26:52] plan, accompanied by a facility-- [1:26:55] training facility in the back of the pitch. [1:26:57] Currently, it's a vacant lot. [1:27:00] So this will all be incorporated within that vacant lot. [1:27:03] They went to workshop, as the Mayor said, on March 25. [1:27:06] The site plan evaluation standards, [1:27:08] we have compliance with all relevant standards [1:27:12] and the standards for the Special Exception [1:27:18] saying all are approved of the relevant ones. [1:27:22] So with that, the staff recommends [1:27:24] approval of the proposed Special Exception and approval [1:27:27] of the site plan. [1:27:30] I haven't seen the applicant. [1:27:31] I don't know if the applicant's here. [1:27:32] I think they are here. [1:27:33] The applicant is here if you have any further questions [1:27:36] or if I can answer any questions you might have. [1:27:39] Thank you, Mr. Magrisso. [1:27:40] Would the applicant like to present [1:27:42] or have any comments to add? [1:27:45] You're not required to, but-- [1:27:46] I wish I can present the project. [1:27:48] If not-- [1:27:49] We'll leave it up to our colleagues. [1:27:50] Is there any comments or questions [1:27:52] about this project for the applicant? [1:27:56] No. [1:27:57] All right. [1:27:57] I think you're good. [1:27:58] If there's no more comments or questions, [1:28:00] I need a motion to approve. [1:28:01] Motion. [1:28:02] Motion. [1:28:02] Motion to approve by Councilman Pineyro, seconded [1:28:04] by Councilwoman Reinoso. [1:28:05] If there's no more debate, Madam Clerk, please call the roll. [1:28:08] Motion to approve moved by Councilman Pineyro, seconded [1:28:09] by Councilwoman Reinoso. [1:28:10] Councilman Pineyro? [1:28:11] Yes. [1:28:11] Councilwoman Reinoso? [1:28:12] Yes. [1:28:13] Councilwoman Porras? [1:28:13] Vice Mayor Cabral? [1:28:14] Yes. [1:28:15] Mayor Fraga? [1:28:15] Yes. [1:28:16] Motion passes. [1:28:17] All right. [1:28:17] Thank you very much. [1:28:18] Move on to the next item. [1:28:19] Item 20B, A resolution of the Mayor and City Council [1:28:22] of the City of Doral, Florida, approving a site plan for 8300 [1:28:24] Invest LLC, for the property located at 8335 Northwest 56th [1:28:27] Street in the City of Doral, Florida, [1:28:28] pursuant to Section 53-184(F) of the City's Land Development Code [1:28:31] and providing for an effective date. [1:28:33] All right. [1:28:33] I'm going to go ahead and do Public [1:28:34] Hearing first, Mr. Magrisso. [1:28:35] Opening up Public Hearing for item 20B, also known as 26-6682. [1:28:38] Anyone who would like to speak on this item, and this item [1:28:41] alone, please approach the podium. [1:28:48] Showing no interest, I am closing the Public Hearing [1:28:52] portion for this item. [1:28:54] Madam Clerk, let the record reflect [1:28:56] no one has chosen to speak at this time. [1:28:58] And I will take any ex parte communication. [1:29:01] Has there been any ex parte communication? [1:29:04] Uh-uh. [1:29:06] No? [1:29:07] All right. [1:29:08] Mr. Magrisso? [1:29:09] OK. [1:29:10] The presentation. [1:29:14] OK, so this is known as Mediterranea Center II. [1:29:18] They are here for a site plan approval. [1:29:20] It is located at 8335 Northwest 56th Street. [1:29:26] And it is approximately 0.926 acres. [1:29:29] They went to workshop on February 24, 2025. [1:29:32] I think that is 6. [1:29:35] So this is pretty much located in a completely industrial [1:29:38] district. [1:29:39] All the surrounding areas north, south, east and west [1:29:42] have a future land use category of Industrial. [1:29:44] And they accompany a zoning district of Industrial as well. [1:29:49] This is consistent with the Comprehensive Plan and the Land [1:29:52] Development Code. [1:29:53] These are the existing conditions as you see them now. [1:29:58] It is located adjacent to what is [1:30:00] known as Mediterranea I. They're just [1:30:02] building a pretty much mirror image of what is currently there [1:30:07] on this vacant lot. [1:30:09] Here's the site plan you see. [1:30:11] Like I said, it's approximately one acre. [1:30:13] It's going to have a modern architectural design [1:30:16] for warehouse buildings with 24 parking spaces, landscaping, [1:30:21] bicycle areas. [1:30:23] These are elevations from the east and the west [1:30:27] and the south and the north. [1:30:32] The site plan evaluation standards-- [1:30:33] complies with all relevant site plan evaluation standards. [1:30:36] And the staff is recommending approval of the proposed site [1:30:40] plan. [1:30:40] If you have any further questions, [1:30:42] I'm happy to answer it at this time. [1:30:44] Is the applicant present, wanting to make any comments? [1:30:49] It's not required, but if you're present-- if there's [1:30:51] any questions for the applicant or for Mr. Magrisso, [1:30:55] now would be your time. [1:30:57] If there's no comments, questions, or debate, [1:30:58] I need a motion. [1:30:59] Motion. [1:31:00] Motion to approve by Councilwoman Reinoso. [1:31:02] Second. [1:31:03] Second by Councilman Pineyro. [1:31:05] No more comments or questions. [1:31:06] Madam Clerk, please call the roll. [1:31:07] Motion to approve moved by Councilwoman Reinoso, [1:31:09] seconded by Councilman Pineyro. [1:31:10] Councilwoman Reinoso? [1:31:11] Yes. [1:31:11] Councilman Pineyro? [1:31:12] Yes. [1:31:12] Councilwoman Porras? [1:31:13] Yes. [1:31:13] Vice Mayor Cabral? [1:31:14] Yes. [1:31:14] Mayor Fraga? [1:31:15] Yes. [1:31:15] Motion passes. [1:31:16] OK, thank you very much. [1:31:17] We move on to the next item. [1:31:18] Item 20C, A resolution of the Mayor and the City Council [1:31:20] of the City of Doral, Florida, approving a site plan for CEDECO [1:31:23] 41, LLC for a commercial development featuring [1:31:25] a pharmacy, retail storefronts, and a gas station with [1:31:27] an associated convenience store on a plus or minus 7.57-acre [1:31:30] vacant parcel, generally located on Northwest 41st Street between [1:31:33] Northwest 114th and 112th Avenue in the City of Doral, Florida, [1:31:36] identified with Miami-Dade Folio Number 35-3019-001-0370 pursuant [1:31:41] to Section 53-184(F) of the City's Land Development Code [1:31:44] and providing for an effective date. [1:31:45] Thank you, Madam Clerk. [1:31:46] We're going to go ahead and open Public Comments for item 20C, [1:31:50] also known as 26-6693. [1:31:53] Anyone who would like to speak on this item, and this item [1:31:56] alone, please approach the podium. [1:31:58] Please remember that the three minutes [1:31:59] do apply for the public hearing items as well. [1:32:02] State your name and address for the record. [1:32:05] Yes. [1:32:06] Good evening. [1:32:07] My name is Orietta Carvalho. [1:32:09] My address, 11360 Northwest 42nd Terrace in Doral. [1:32:16] And I'm opposing about having a gas [1:32:20] station and a big convenience store there. [1:32:23] I'm not against about development. [1:32:25] But I would prefer office or something more [1:32:30] low-impact for the community. [1:32:32] I've been living there since 1997. [1:32:34] I do have a lot of health issues. [1:32:36] And having a gas station, the fume, the smell, and the noise [1:32:43] is giving you more stress. [1:32:46] [CRYING] [1:32:47] Sorry. [1:32:51] And then I did my research behind the Navarro. [1:32:58] And you can smell the odours. [1:33:00] I have photo of those big dumped garbage can. [1:33:06] And that will bring more water, rodent, rats coming over [1:33:11] to our community. [1:33:13] And we have 10 houses which the master bedroom [1:33:18] will be facing the community. [1:33:20] Even if they want to do 20-feet-- [1:33:25] how you say that? [1:33:27] 20-feet-- [1:33:28] Trees? [1:33:29] --trees, it will not be enough. [1:33:32] They need to have big walls. [1:33:34] And what we going to be seeing are garbage can. [1:33:38] And then the gasoline, they're going to be open 24 hours. [1:33:44] We have the turnpike people going north and south. [1:33:48] There's going to be a busy place. [1:33:50] We get already a lot of traffic on 41 and 114, [1:33:54] 112 because there's a school there. [1:33:56] So I don't know if when they did the measuring was [1:34:00] during no school time or after traffic time. [1:34:04] So I request the City to do the inspection [1:34:07] to see how bad the traffic is there [1:34:10] a lot of the time and people trying to cut to go faster. [1:34:16] Another thing is our community has a lot of children. [1:34:20] We have the pool will be facing to that side. [1:34:24] So the safety, there's so much concern. [1:34:26] And I'm opposed of that and have the City [1:34:30] to do the inspection about the smell and the garbage cans. [1:34:34] So thank you so much. [1:34:36] OK, thank you very much. [1:34:40] Anyone else who would like to speak, please [1:34:42] approach the podium. [1:34:49] Good evening. [1:34:50] My name is Werner Vonblon. [1:34:51] I'm at 11244 Northwest 42nd Terrace in Doral, [1:34:57] the Hawksnest community there. [1:35:01] Just picking up on the point of the previous speaker. [1:35:04] Right now, the understanding is that they [1:35:06] want to put a chain-link fence between ourselves [1:35:09] and the new development. [1:35:10] So from what I've seen along 41st Street, [1:35:14] there's walls behind each commercial center [1:35:18] that's developed. [1:35:19] So I would ask the developers to look at that and for yourselves [1:35:22] to, let's say, put some interest in putting a wall versus that. [1:35:26] That also addresses the issues of rodents and so [1:35:30] on versus a chain-link fence. [1:35:34] It's generally understood that the owner [1:35:36] or the owners of the property can develop that. [1:35:38] That's well understood. [1:35:41] But there will be a large impact on traffic. [1:35:44] Now, I'm not sure when they're doing the studies they're taking [1:35:47] into account the huge complex that's been built on the other [1:35:50] side of 41st Street, which is basically vacant right now. [1:35:53] So once that's developed, we're going [1:35:54] to have that additional traffic moving through that-- [1:35:58] specifically 112th and 41st Street. [1:36:01] The entrance to the gasoline station, one entrance. [1:36:05] So let's say vehicles coming on 112th heading north will have [1:36:08] to make a turn. [1:36:09] And they'll have to go across three lanes [1:36:11] to make-- take the right into the gasoline station. [1:36:14] So that corner's had a lot of accidents in the past. [1:36:18] Maybe look at that history as well. [1:36:20] With additional traffic, with the additional street lanes [1:36:23] going through, it would be something [1:36:24] of interest in your studies. [1:36:28] Yeah, nobody wants a gasoline station next to the community. [1:36:32] Speaking for the community, that's understood there. [1:36:36] Car washes, timing of deliveries of gasoline [1:36:42] and all that will be of interest for us [1:36:44] as far as trying to mitigate the timing of that [1:36:47] if it's late night and so on. [1:36:49] If there's a gas station, if it's [1:36:51] placed near the back towards where the community is, [1:36:53] they'll be heard constantly. [1:36:56] Having talked a little bit to the lawyers of the developers, [1:36:59] they have mentioned the tree covers and bushes, [1:37:02] et cetera, et cetera. [1:37:03] That seems harmful. [1:37:04] Hopefully, the trees do grow up to 20, 30 feet and the bushes [1:37:09] as well. [1:37:10] But we would like to see the wall. [1:37:12] Again, it's not something you don't see throughout Doral [1:37:16] as far as the 41st Street commercial development. [1:37:20] And thank you very much. [1:37:21] Thank you, sir. [1:37:22] Thank you. [1:37:23] Any other comments? [1:37:25] This is the only reasonable opportunity for this item. [1:37:29] So if you'd like to speak, please come up to the podium. [1:37:36] Good evening, Mayor, Vice Mayor, Councilmembers. [1:37:38] My name is Richard Rios. [1:37:40] I'm a resident of Doral since 1997. [1:37:43] They used to have horses going by that area. [1:37:46] And adding to the comments from the other residents, [1:37:52] we understand that, yes, there is authority to-- or zoning [1:38:00] for a commercial location. [1:38:04] We would like to see some type of mitigation, [1:38:08] particularly regards to noise. [1:38:11] If the car wash is located towards the rear, [1:38:15] then if there was some type of limitation like hours-- [1:38:20] because car washes, especially when they're blow drying, [1:38:23] the cars are very loud. [1:38:25] The other areas of concern would be any type of traffic going [1:38:30] northbound from 41st Street up to 112th. [1:38:35] We have an exit in our community on 112th Avenue. [1:38:39] And if cars are making a left turn to go into the gas station [1:38:43] while we're coming out-- [1:38:45] there was one resident here who almost had an accident recently [1:38:48] when she was leaving our community, [1:38:50] and there was a truck barreling down 112th Avenue. [1:38:54] So we'd like to see some type of, maybe, agreements with code [1:38:58] enforcement that we would have some sort of guarantees [1:39:01] as far as no late-night deliveries, [1:39:04] overnight deliveries, any type of big gas trucks [1:39:09] coming in at odd hours of the night. [1:39:12] We understand that, yes, there's a business. [1:39:14] There's going to be a 24-hour convenience store. [1:39:17] Hopefully, they won't have that much traffic. [1:39:19] But during the day, it's a concern for us. [1:39:22] And we hope that you'll look into that [1:39:25] or at least be able to come to some agreement, [1:39:28] maybe have us included in some future discussions [1:39:30] with the developers on that. [1:39:34] Thank you very much. [1:39:36] Thank you. [1:39:37] Anyone else who would like to speak? [1:39:48] Good afternoon, Mayor. [1:39:49] Good afternoon. [1:39:50] My name is Maria Pazos. [1:39:53] I am a resident of Doral since 2004 and a resident of Hawksnest [1:39:58] at Doral 4227 Northwest 112th Court since 2006. [1:40:05] My major concern is the health of our community, [1:40:08] of our children, of all our Hawksnest community. [1:40:14] I'm going to read why the gasoline component warrants [1:40:19] a special scrutiny. [1:40:20] It says, "Gasoline is a source of benzene and other air [1:40:24] pollutants. [1:40:25] ATSDR states that benzene is released to the environment [1:40:29] through the operation of gasoline stations, [1:40:32] and that people may be exposed by breathing contaminated air [1:40:35] around gasoline stations. [1:40:37] ATSDR also explains that long-term benzene exposure can [1:40:42] affect blood cells and bone marrow [1:40:44] and can cause bone marrow cancers, including [1:40:47] acute leukemia. [1:40:49] ATSDR notes that the US Department of Health and Human [1:40:52] Services and the US EPA classify benzene [1:40:56] as a known human carcinogen. EPA, likewise, [1:40:59] regulates benzene as a mobile source of air toxic and notes [1:41:03] that gasoline contains benzene. [1:41:06] EPA identifies benzene and other hydrocarbons [1:41:10] among air pollutants associated with gasoline and vehicle [1:41:13] emissions. [1:41:15] Also, a gasoline station creates multiple potential emission [1:41:18] points-- [1:41:19] vehicle fueling and displacement of gasoline vapors [1:41:22] during the refueling, underground storage tanks [1:41:25] and their vent pipes, bulk fuel delivery operations, including [1:41:30] tanker trunk unloading and fuel connections, equipment leaks, [1:41:34] spills, and losses, additional vehicle traffic [1:41:39] associated with the use. [1:41:41] EPA also recognizes petroleum vapor intrusion [1:41:44] as a pathway in which vapors from petroleum hydrocarbons, [1:41:48] such as gasoline, can mitigate from subsurface sources [1:41:51] into buildings, creating potential safety and health [1:41:53] concerns. [1:41:54] [? These are ?] the main vapor intrusion [1:41:56] will occur at this site. [1:41:57] It is a recognized pathway that supports careful siting, [1:42:01] monitoring, and leak prevention." [1:42:03] So this is my main concern. [1:42:05] Obviously, traffic and all the other things we've stated. [1:42:10] And if the gas station is already been approved, [1:42:13] at least we need to-- as a community, [1:42:17] we would like to be informed of-- or at least [1:42:20] taking into account of where are they going to place it. [1:42:24] Because on 114th Avenue, we have a lake. [1:42:27] So maybe that would be the best place for it to be. [1:42:32] But that's my main concern. [1:42:33] Thank you very much. [1:42:34] Thank you. [1:42:35] Thank you very much. [1:42:36] Anyone else who would like to speak? [1:42:47] Yes. [1:42:48] Good afternoon. [1:42:49] My name is Ileana Cernuda. [1:42:51] I also lived in Doral. [1:42:52] We can't hear you. [1:42:55] Can you hear me now? [1:42:58] There you go. [1:42:58] OK. [1:42:59] I'm also a resident of Doral, 11220 Northwest 42nd Terrace. [1:43:04] Your name, I'm sorry, again? [1:43:05] Because we couldn't hear. [1:43:06] Ileana Cernuda. [1:43:09] I would be exactly behind of the proposed service station-- gas [1:43:18] station. [1:43:19] So in addition to all of the other residents' concerns [1:43:24] and the gas, I believe that if it has to be another gas [1:43:28] station-- because then you would be placing-- [1:43:31] there's one in 109th and 107th. [1:43:35] So I would think that it would be better to have it on 114th [1:43:39] Avenue, as my previous person-- resident said, [1:43:44] because it would be-- the back part would be on the lake [1:43:48] instead of directly behind my house. [1:43:52] And I'm deeply concerned about all the rest-- [1:43:55] the noise, the gas, the traffic. [1:43:57] But we understand that-- as you said, that they have the right [1:44:00] to do it. [1:44:01] So if they at least could put the place in 114th. [1:44:08] You already have two other gas stations on 109th and 107th. [1:44:12] Thank you. [1:44:14] Thank you. [1:44:15] Any other comments? [1:44:25] Good evening. [1:44:27] Sorry, I speak Portuguese in English. [1:44:30] I make my English, no-- [1:44:31] Portuguese, Spanish. [1:44:33] I make my best new English. [1:44:36] My name is Miriam Goncalves. [1:44:39] I live in 1997 in Hawksnest. [1:44:43] I am a resident and a member of this community. [1:44:50] We are not against development or progress. [1:44:55] But I am concerned about indirect impact [1:45:00] on your community, especially traffic, safety, tranquility, [1:45:07] and the quality of life. [1:45:10] We want to make sure that the residents' concern are [1:45:16] heard and carefully considered before a final decision is made. [1:45:25] We are not here to create confrontation. [1:45:31] We are here to cooperate, work together. [1:45:37] We respectful-- I don't know, so respectful autocorrect-- [1:45:42] ask this City and everyone involved with this project [1:45:47] to consider the families who already live in this community. [1:45:54] You believe developing and the quality of life [1:45:59] can coexist when there is responsibility planning. [1:46:06] We are not against progress. [1:46:08] We are asking for responsible developing, respect [1:46:13] to the safely, tranquility, and quality of life [1:46:19] of your community. [1:46:22] This is community, the Hawksnest. [1:46:25] Everybody could stay here. [1:46:27] Everybody put vote for us. [1:46:30] Please, can you help the Hawksnest at Doral? [1:46:34] Thank you so much. [1:46:36] Thank you very much. [1:46:37] Any other comments at this time? [1:46:49] Hi. [1:46:50] Good evening. [1:46:50] My name is Eda Tinoco. [1:46:52] I live in-- [1:46:52] Please get a little bit closer to the microphone [1:46:54] so that we can hear you-- [1:46:55] There you go. [1:46:56] --clearly. [1:46:56] Now? [1:46:57] Yes. [1:46:57] My name is Eda Tinoco. [1:46:59] I live in 11261 Northwest on Hawksnest since 20 years ago. [1:47:06] I just retired from Eugenia B. Thomas [1:47:09] after 25 years of working there. [1:47:11] My concern is about the same of my people [1:47:17] that we live in the same complex, [1:47:19] but more is about the pedestrians. [1:47:22] And I see that the traffic now, now they open the 112 and how [1:47:29] it's so difficult to cross, just to walk and pass by the 41st [1:47:35] Street is terrible. [1:47:37] I mean, as an adult, I have to be really, really careful. [1:47:42] And after 25 years seeing the kids, I mean, after dismissal, [1:47:47] trying to buy and crossing and buy to McDonald's or going-- [1:47:52] just passing by to street, it's really difficult [1:47:56] to see them and the buses and all that. [1:47:58] My concern is about the children, [1:48:01] how they're going to be safe. [1:48:04] I mean, having a gas station in one corner and a building [1:48:08] is in the other one in Navarra in the middle one, [1:48:11] and then the new development, that is-- [1:48:14] I mean, by the way, it's really nice now. [1:48:17] It's really nice. [1:48:18] And, believe me, I love my city. [1:48:21] It was like Publix, Where Shopping is a Pleasure. [1:48:24] Doral is a pleasure to live in. [1:48:27] It's really nice. [1:48:28] But, I mean, I think there is a point where [1:48:31] the progress and the development is a conflict with the people [1:48:35] that we live here, that we're resident. [1:48:38] We're not in the-- any business. [1:48:40] We live in the city. [1:48:42] And that's what I'm thinking about-- the children, [1:48:46] how they're going to pass by, how the kids, the middle ones, [1:48:49] the kids that are coming from middle school that-- [1:48:52] those groups of children that are going and passing [1:48:55] from McDonald's or going to any-- [1:48:58] and now that we have, I mean, Whole [1:48:59] Foods and all the coffees and all the places, [1:49:03] it's really difficult to cross-- [1:49:05] to pass that 112th. [1:49:07] And 41st is really hectic. [1:49:10] The traffic is like you are risking your life every time [1:49:13] that you want to pass in by. [1:49:15] But afternoons, I try to walk by and because it's really nice, [1:49:19] but it's really difficult to pass. [1:49:21] My concern, besides all that my neighbors are expressing, [1:49:28] is the safety. [1:49:31] I don't want to see any accident regarding [1:49:34] any children passing by. [1:49:36] And that's my concern having a gas station. [1:49:39] How are they going to cross? [1:49:40] If I must feel that now there's no gas station there, [1:49:43] it's hard for me to pass. [1:49:45] And I'm an adult. How about children? [1:49:48] That's going to mean that teenagers, [1:49:51] they're going to pass that-- [1:49:54] and there's a school right there. [1:49:56] It's a charter school. [1:49:57] Thank you, ma'am. [1:49:57] And the traffic right there is terrible. [1:49:59] Well, thank you so much. [1:50:01] Thank you so much. [1:50:02] Any additional comments? [1:50:09] Good evening. [1:50:10] My name is Jorge Mauricio Salas. [1:50:12] I have been resident of Doral for the last-- [1:50:15] Address please? [1:50:16] Sorry? [1:50:16] Address for the record. [1:50:17] 4267 Northwest 112th Court, Doral, Florida, 33178. [1:50:23] Thank you. [1:50:24] My fellows here, residents, we are just [1:50:27] concerned with the health issues that [1:50:30] can be aroused from the development of the gas station. [1:50:37] We understand that the progress is good for everyone. [1:50:42] But we're just concerned about the health [1:50:44] of our kids, our community. [1:50:48] Just a few months ago, the new project [1:50:52] for the warehouses in front was finished. [1:50:56] And we have been dealing with a lot of noise. [1:51:00] And now with the gas station, it's [1:51:03] not only going to be noise but health concerns. [1:51:06] So we really are against that project. [1:51:10] And if you can help us out, that will be really great. [1:51:14] Thank you. [1:51:17] All right. [1:51:17] Any other comments or questions? [1:51:22] All right. [1:51:23] Being no more public comments, we [1:51:27] will close the Public Comments portion. [1:51:29] And we will hear from our staff and then the applicant. [1:51:37] OK. [1:51:38] So this is a site plan coming forward from CEDECO 41, LLC. [1:51:44] It is in-- a commercial corridor-- [1:51:47] commercial retail plaza. [1:51:49] And it is located on 41st Street and is bound by Northwest 114th [1:51:53] Avenue and Northwest 112th Avenue to the east and the west. [1:51:58] It is approximately 7 and 1/2 acres. [1:52:00] And it was-- went to workshop in June of 2025. [1:52:04] So the surrounding land, it is a vacant land. [1:52:09] And it's pretty landscaped. [1:52:14] To the north, you have multifamily residential. [1:52:16] And to the south, you have office buildings. [1:52:19] The east is vacant. [1:52:20] And to the west, you have a retail outlet, [1:52:24] which is where the current Navarro currently sits. [1:52:28] These are the existing views of how it looks currently. [1:52:33] And these are the renderings that [1:52:37] are going to be on the site. [1:52:40] If you can see the site plan at the bottom, we have a-- [1:52:45] two anchors. [1:52:46] On the west, you have the Navarro [1:52:48] with the parking in the back and to the side. [1:52:51] On the east side, you have the other anchor, which [1:52:54] is going to be the gas station. [1:52:56] And in between the two anchors, you [1:52:57] have a commercial retail component with multiple shops [1:53:02] with parking to the rear of the property. [1:53:06] So this was determined by the Doral Master Plan Boulevard [1:53:13] and where it says that you cannot have any parking fronting [1:53:17] the Doral Boulevard. [1:53:19] So all the parking will be to the back along Doral Boulevard. [1:53:23] You'll have a 35-foot setback with landscaping and pedestrian [1:53:28] path with benches, bike racks, and trash receptacles. [1:53:34] This project is in compliance with all of our site plan [1:53:39] evaluation standards that are applicable. [1:53:41] And based on that, staff is recommending [1:53:44] approval of the site plan. [1:53:47] With that, I am here to answer any questions that you may have. [1:53:50] And I think Melissa is also here. [1:53:53] Thank you, Mr. Magrisso. [1:53:56] Ms. Tapanes? [1:54:03] Good evening, Madam Mayor, Madam Vice Mayor, [1:54:06] honorable Councilmembers. [1:54:07] My name is Melissa Tapanes, with law offices at 200 South [1:54:10] Biscayne Boulevard, Miami. [1:54:12] I do have a presentation. [1:54:13] Ms. Diaz, if you'll play it. [1:54:15] Let's see, do I get-- [1:54:17] [INAUDIBLE] [1:54:18] Oh, thank you. [1:54:19] Excellent. [1:54:20] Wonderful. [1:54:21] Thank you. [1:54:22] So the property is 7 and 1/2 acres, [1:54:26] located on Doral Boulevard, just between 112th Avenue and 114th [1:54:32] Avenue. [1:54:34] I should mention before I get started that I'm joined here [1:54:37] by Marcos Puentes with the applicant, our architect, Terry [1:54:40] Runyan, our traffic engineer, Natalia [1:54:42] Lercari, and my colleagues, Rob Alvarez and Tom Robertson. [1:54:48] In case we have any specific questions, [1:54:51] I'll submit that we have expert witnesses to add [1:54:55] to any of the substantial competent evidence [1:54:57] in the record. [1:54:59] So we're here today seeking site plan approval. [1:55:02] This property is vacant. [1:55:04] It consists of poor-quality wetlands [1:55:06] of mostly invasive species. [1:55:09] And we're here to request the site plan approval [1:55:13] to allow for neighborhood-serving commercial [1:55:16] development fully in compliance with the City Code. [1:55:20] We're pleased to have worked with [1:55:22] and collaborated with both the community as well as [1:55:27] your professional staff, who is recommending [1:55:30] in favor of this application. [1:55:34] So the criteria for approval of site plans [1:55:37] include consistency with the Comprehensive Plan, [1:55:41] compatibility with the surrounding corridor, [1:55:44] high-quality site design, traffic, access, circulation, [1:55:48] and, very importantly, health, safety, and welfare. [1:55:53] The property is designated Business in the Land Use [1:55:57] Comprehensive Plan, as well as Commercial Corridor [1:56:00] in your zoning code, and has the overlay of the Doral Boulevard [1:56:05] Master Plan. [1:56:07] These allow for the full mixed-use developments. [1:56:12] And you can see that the Doral Boulevard [1:56:14] contacts from the Florida Turnpike to our east [1:56:18] has your hotel uses, your mixed uses, your commercial uses, [1:56:23] as well as gas stations, automotive uses, and, of course, [1:56:29] the new bridge industrial site to our south. [1:56:36] What we're proposing are neighborhood-serving uses, [1:56:39] including the relocation of the existing Navarro Pharmacy that [1:56:43] is on the south side of Doral Boulevard, [1:56:47] as well as about 27,000 square feet of neighborhood-serving [1:56:52] retail storefronts and a Shell gasoline station that will be [1:56:57] developed by Sunshine, which is a Doral business. [1:57:02] The proposal includes a high-quality design. [1:57:07] Specifically, the development includes that 15,000-square-foot [1:57:11] Navarro, as well as that 27,000-square-foot commercial. [1:57:17] The convenience store is only 3,000 square feet. [1:57:21] And the canopied area of the Shell gas station is about 7,900 [1:57:27] square feet. [1:57:28] Very importantly, there is no car wash at the site. [1:57:33] And the hours of operation are consistent with that [1:57:37] of the Doral Boulevard. [1:57:41] The Doral Boulevard Master Plan proposes [1:57:45] significant restrictions and encourages urban design [1:57:51] along the Boulevard. [1:57:53] Specifically, this project complies and provides [1:57:56] specifically with stuccoed concrete block [1:58:00] and horizontal wood slats along the Doral Boulevard [1:58:04] to cover the 13 parking spaces. [1:58:06] And the remainder is open plazas, [1:58:10] both in the central focal courtyard along the commercial [1:58:15] storefronts, as well as plazas along 112th Avenue. [1:58:24] You can see here that the Doral Boulevard Master Plan provides [1:58:28] for 10 feet of front buffering. [1:58:31] And we're providing 25 feet. [1:58:35] Onto the proposed site plan and specific access and circulation. [1:58:40] The Navarro Pharmacy is at the corner of 114th and Doral [1:58:46] Boulevard. [1:58:47] There is a drive-through with limited hours of operation. [1:58:51] So we have placed it on 114th Avenue in order to be part [1:58:56] of the open space feature to the rear of the property [1:59:00] and the Hawksnest community. [1:59:03] You can see that, based on the Mayor's [1:59:06] and other Councilmembers' comments, [1:59:09] we have worked with CVS and modified [1:59:12] the color scheme of the Navarro Pharmacy [1:59:14] to provide for the traditional brands of Bahamian yellow only [1:59:20] as an accent feature and to be more [1:59:22] compatible with the surrounding Doral Boulevard color schemes. [1:59:28] As it relates to the proposed site plan, [1:59:31] and specifically the 27,000 square feet of new retail [1:59:35] storefronts, there is a central courtyard perfect for outdoor [1:59:40] dining or food and beverage opportunities. [1:59:44] And the Shell gas station, notably, [1:59:47] does not have a car wash. [1:59:49] Very important, there is no left in or left out on either 112th [1:59:55] Avenue or 114th Avenue. [1:59:59] This plan provides for specific 35% open space where only 17% [2:00:07] is required. [2:00:09] Notably, the commercial corridor zoning district [2:00:13] allows for up to six stories of height, 0.5 FAR, as well [2:00:20] as 50% lot coverage, and again, only 17% open space. [2:00:26] The front setback required is 20 feet. [2:00:30] We're providing over 25 feet. [2:00:32] And the rear setback minimum is 15 feet. [2:00:35] And we're providing not only a 20-foot buffer yard, [2:00:38] but we'll show you in detail how our rear setback is from 90 [2:00:44] to 140 feet. [2:00:45] But before we get there, gas station, [2:00:48] I understand that that is a concern of the community. [2:00:51] So we have gone through the Miami-Dade County Environmental [2:00:55] Resource Management process, specifically [2:00:58] appearing before the County's Environmental Quality Control [2:01:01] Board. [2:01:02] And they found that the establishment of the proposed [2:01:04] gas station will not be detrimental [2:01:07] to the public health, welfare and safety, [2:01:10] will not create a nuisance, and will not materially [2:01:12] increase the level of pollution in the overall county. [2:01:17] Specifically, conditions for the gas station [2:01:20] are those that are consistent with federal, state, [2:01:23] and local regulations. [2:01:25] The fuel systems will incorporate multiple [2:01:27] state-of-the-art safety measures, [2:01:30] including double-wall tanks and piping, [2:01:32] spill containment systems, overfill protection, [2:01:36] leak detection, and continuous monitoring. [2:01:39] Employees will be required to complete all necessary training [2:01:43] to become Underground Storage Class C Operators [2:01:47] and maintain certification through the compliance courses. [2:01:52] This gas station, as I mentioned, [2:01:54] will be developed by Sunshine, which is headquartered here [2:01:58] in the City of Doral and owns and operates numerous gas [2:02:02] stations throughout the City and Miami-Dade County. [2:02:06] Most importantly, before any installation [2:02:09] and the operation of this gas station [2:02:11] and specifically the storage tanks, [2:02:13] the County must approve all engineering [2:02:16] plans demonstrating compliance with [2:02:18] all environmental regulations. [2:02:20] That, of course, is in addition to the City of Doral Building [2:02:23] Department, City of-- [2:02:25] Miami-Dade County Fire Department as they [2:02:28] review these plans and, of course, [2:02:30] enforce these plans into the future. [2:02:35] The gas station use is allowed as of right within the zoning [2:02:40] district. [2:02:41] The property fronts Northwest 41st Street, [2:02:44] which is an arterial roadway. [2:02:47] It's designed and constructed in full compliance with the City's [2:02:50] Fire Prevention Code. [2:02:52] The attendant-control area will have clear visibility [2:02:56] with-- to all pumps with no attraction [2:02:59] signs on the windows in compliance [2:03:01] with Doral regulations dealing with aesthetics. [2:03:05] We're providing over the minimum required parking [2:03:08] spaces at the gas station. [2:03:10] And it meets the minimum building square footage [2:03:13] and all applicable land development regulations. [2:03:16] We went through both the City of Doral and the Miami-Dade County [2:03:21] Traffic Engineering process. [2:03:24] All of the sites for driveway connections [2:03:26] are expected to operate at level of service [2:03:29] A. The development of this site will [2:03:33] continue the City's overall level of service standards. [2:03:38] There will be no changes. [2:03:40] And the queues are generally consistent with all background [2:03:43] conditions as they exist today. [2:03:45] The projected traffic pattern reflects [2:03:48] just the commercial developments designed [2:03:50] to serve the immediate neighborhood and passerbys. [2:03:54] The pharmacy will provide sufficient on-site stacking [2:03:58] for vehicles. [2:03:59] And that has been reviewed by both County Traffic Engineering [2:04:02] as well as the City of Doral. [2:04:05] As part of our traffic analysis, we've been asked to implement [2:04:11] the City of Doral's Master Plan, which provides for, notably, [2:04:16] dedicated right-turn lanes into the property the site proposes [2:04:21] and is required to provide three-- [2:04:24] one on 114th Avenue that will be right-in, right-out only, [2:04:29] no left turns. [2:04:31] We are also providing an exclusive right-turn lane on-- [2:04:36] entering both the Navarro entrance as well as [2:04:40] the gas station entrance. [2:04:42] And again, the retail storefronts are in the center. [2:04:45] I'll go through these in a little bit more detail. [2:04:48] We're also relocating the Doral Trolley stop to 41st Street from [2:04:54] 114th Avenue. [2:04:57] It will be upgraded with the modern shelter [2:05:00] for enhanced transit access and rider convenience. [2:05:03] We're also installing special emphasis marked crosswalks [2:05:08] to create pedestrian safety along 112th and 114th Avenues. [2:05:15] In addition, we are improving the Doral Boulevard right of way [2:05:20] by not only increasing-- by dedicating private land [2:05:24] for those exclusive right-turn lanes, [2:05:27] but we're also increasing the storage to accommodate more [2:05:33] vehicles as they travel eastbound and make lefts [2:05:39] at 109th Avenue. [2:05:41] The 112th and 114th intersections are fully built [2:05:45] out, with the exception that the site to our east is currently [2:05:49] vacant and will be dedicating additional right of way, [2:05:53] just like we are dedicating right of way towards 112th [2:05:57] Avenue and likely on 41st Street as well. [2:06:01] I mentioned the exclusive right-turn lanes. [2:06:04] There are three. [2:06:08] And we think that this slide is very important. [2:06:11] As we work to provide the highest-quality design [2:06:16] and consistent with Doral aesthetics, [2:06:19] we did not build a six-story building only 15-- [2:06:22] with 15 feet of setback. [2:06:24] We have planned for a 20-foot buffer yard that will be [2:06:30] of dense vegetation and trees. [2:06:33] We'll get into those details. [2:06:35] But most importantly, in extending that 15-foot rear [2:06:38] setback, we are extending it at the Navarro site to over 90 [2:06:43] feet. [2:06:44] That building is approximately 30 feet to the parapet. [2:06:48] And along the gas station, it is over 140 feet. [2:06:52] And that height is 19 feet. [2:06:55] The buffer yard is over 6,000 square feet of landscape [2:07:00] planting areas. [2:07:02] We had it proposed as the same treatment [2:07:05] as Hawksnest, which is a green chain-link fence and cocoplum [2:07:11] shrubs. [2:07:12] We are creating a full buffer utilizing buttonwood trees at 14 [2:07:19] feet at the time of planting. [2:07:21] We were able to be at the Hawksnest site [2:07:24] and be able to see exactly what that height would be, [2:07:27] which is over the one-story buildings, which [2:07:32] are about 10 to 12 feet. [2:07:34] And these are at 14 feet. [2:07:37] We're also including as specimen trees for both color [2:07:42] and aesthetics Queen's crape myrtle trees as focal points [2:07:47] throughout the buffer yard, as well as 6-foot-tall pitch apple [2:07:51] trees. [2:07:52] We understand that there has been some discussion [2:07:55] as to a 6-foot concrete masonry wall or panel system. [2:08:00] We are open for the Council to choose what kind of feature [2:08:07] they would like. [2:08:09] Our initial discussions were that we would match Hawksnest. [2:08:13] But again, we leave that up to the will of the Council. [2:08:17] Regarding impact fees, this project [2:08:20] will generate over $2.1 million in impact fees, notably [2:08:25] almost $1.2 million to the Doral road impact fee specifically. [2:08:32] The goal is that in addition to us not-- or this project [2:08:35] not impacting the level of service [2:08:38] and creating additional right-of-way improvements [2:08:41] and dedicating additional right-of-way [2:08:43] for the public good, we are also contributing [2:08:47] to the future traffic impact of this project [2:08:51] and the other projects along Doral Boulevard [2:08:53] through that Doral City road impact fee. [2:08:58] We had the opportunity to meet Mr. Rios [2:09:01] at the City of Doral workshop. [2:09:04] We followed up with a virtual meeting, [2:09:07] where we had over 20 residents from Hawksnest. [2:09:10] We took their comments. [2:09:12] We did our very best to address their concerns and comments. [2:09:16] They asked for an in-person meeting, which we had on Monday. [2:09:20] It was very hot. [2:09:23] Their clubhouse did not have power, [2:09:25] so we had a good time by their pool, [2:09:28] enjoying a very breezy afternoon. [2:09:32] We were able to answer many of their questions [2:09:34] and continue-- want to continue our relationship [2:09:37] as good neighbors as we're committed to continue [2:09:40] to work with them not only through this entitlement [2:09:44] and permitting process, but most importantly through construction [2:09:47] and as we co-exist as neighbors. [2:09:52] I did want to mention also the vehicular trips, [2:09:57] since that was brought up as far as traffic goes. [2:10:01] Specifically, our project-- you can see on the screen [2:10:05] the AM and PM vehicle trips. [2:10:07] Some mentioned, "You could build an office." [2:10:10] Well, medical office at the site is 90,000 square feet versus [2:10:16] our site, which is significantly less than that. [2:10:19] And you can see that the traffic associated with an office [2:10:23] building, even just a couple of fast-food restaurants, [2:10:28] a coffee shop with a drive-through, [2:10:29] you can see that the traffic is significantly more [2:10:33] than the neighborhood-serving retail [2:10:35] that the project proposes. [2:10:38] And I think that that is all for my presentation. [2:10:42] I'm available for any questions, as is our team. [2:10:45] And we thank you and the neighbors for meeting with us [2:10:49] and continuing to work with us on this project. [2:10:51] Thank you. [2:10:52] Thank you, Ms. Tapanes. [2:10:55] All right. [2:10:57] I need to ask for ex parte communication. [2:10:59] And then we can open up to questions, comments, and debate. [2:11:04] Yes, Councilman. [2:11:05] I met with the applicant. [2:11:07] But it wouldn't affect my decision. [2:11:08] OK. [2:11:09] Thank you very much. [2:11:10] Same. [2:11:10] Thank you. [2:11:11] Councilwoman? [2:11:12] Mayor, yes, same. [2:11:13] Ex parte won't affect my decision. [2:11:15] And same here. [2:11:16] OK. [2:11:16] Thank you very much. [2:11:17] I also had communications, not just with the residents [2:11:19] but with the applicant. [2:11:20] And that will not affect the outcome of my decision. [2:11:24] All right. [2:11:24] We can go ahead and open up to any questions or comments [2:11:27] from the Council at this time. [2:11:28] OK. [2:11:29] I have a few to the Mayor. [2:11:30] Yes, Councilwoman Reinoso? [2:11:32] OK. [2:11:33] I have a question for the applicant. [2:11:37] After listening through-- to the residents' concerns, [2:11:40] I want to address this. [2:11:44] I didn't see it this way when I first met with the applicant, [2:11:47] so I want to see what the thought process behind this was. [2:11:51] We have lot 1 to the west. [2:11:54] And we have lot 3 to the east. [2:11:57] Is there a reason why that wasn't considered [2:12:00] to put the gas station more towards the west [2:12:04] and maybe switch the Navarro property with the gas station? [2:12:08] There were several thoughts as part of that decision-making. [2:12:11] First, the Navarro Pharmacy already [2:12:14] exists across the street, so if we're existing patrons, [2:12:17] we wanted to keep it as close as possible. [2:12:19] But I think, most importantly, there [2:12:22] is-- the only drive-through associated with the entire site [2:12:25] plan is at the Navarro. [2:12:27] And you can see through-- [2:12:28] if I can go back to the aerial. [2:12:31] Just to the north at Hawksnest, that's where you would have-- [2:12:36] you can see it here. [2:12:39] Let's see. [2:12:41] The Hawksnest has its entrance feature, [2:12:47] which includes a stormwater retention pond. [2:12:50] And our thought was that the neighbors would prefer to be [2:12:55] buffered by the drive-through from-- [2:13:00] in that direction. [2:13:01] So that was the choice. [2:13:03] I'm just going through the aerials so you can see. [2:13:05] I guess you can see it best right here. [2:13:09] You can see it. [2:13:10] So on 114th Avenue, where the Navarro is located, [2:13:15] you can see that Hawksnest has their entrance feature [2:13:18] and stormwater retention ponds. [2:13:20] So when we were thinking about queuing and having [2:13:24] that pharmacy, that made the most sense to us for placement. [2:13:29] Also, the Navarro Pharmacy is, as I mentioned, [2:13:34] 30-feet tall to the parapet, which is more equivalent [2:13:37] to their two-story townhomes, which are usually about 30 to 35 [2:13:42] feet. [2:13:43] And the gas station is-- the Navarro [2:13:46] is 90 feet away, whereas the gas station is 140 feet away [2:13:51] and is only 19 foot in height to the canopy. [2:13:55] The convenience store is even lower and only 3,000 square [2:13:59] feet. [2:14:00] So what we were trying to do was ensure [2:14:03] that the least amount of construction and the largest [2:14:06] setback would be where the neighbors were, which [2:14:09] is at the center of the site, as well as the gas station parcel. [2:14:15] And then my next question is-- let's see. [2:14:21] I see the buffer. [2:14:23] And that's been intentional to keep the most distance apart [2:14:29] from the property and the residence. [2:14:32] I would like to discuss the possibility of having a stone [2:14:36] wall versus the chain link. [2:14:38] Hearing the residents today, the same-- [2:14:40] Concrete. [2:14:41] Concrete. [2:14:41] I'm sorry, the concrete. [2:14:44] Concrete wall versus a chain link. [2:14:47] I believe there's more proper privacy, more protection [2:14:51] to them, and if that's something that could be discussed. [2:14:55] We are open to the Council's will and happy to make any [2:14:59] of the reasonable concessions, including a 6-foot wall [2:15:04] at the location. [2:15:05] And we just want to be sure that Hawksnest understands [2:15:08] that their-- they have a chain-link fence, and our wall [2:15:11] would be against it. [2:15:12] So we won't be able to maintain necessarily [2:15:15] their side of the wall. [2:15:17] But we can continue having communications [2:15:19] through the process as well as once the property is fully [2:15:23] developed to make sure that that wall is maintained on their side [2:15:26] as well. [2:15:27] OK. [2:15:28] I mean, other than these two questions, which, again, [2:15:32] have been brought through our residents, [2:15:34] which I appreciate their input, I [2:15:39] think the project is thoughtful towards the community. [2:15:44] And there are property rights that we need [2:15:47] to respect from both parties. [2:15:51] Those are my questions for now. [2:15:54] Thank you. [2:15:54] I have some comments, Mayor. [2:15:56] Councilwoman Porras. [2:15:57] Thank you. [2:15:59] I'm also in agreement with my colleague. [2:16:03] Well, first of all, I want to thank the residents. [2:16:05] Thank you guys for showing up. [2:16:06] Thank you for coming. [2:16:07] It takes a lot of courage. [2:16:09] It takes a lot of organizing. [2:16:10] But obviously, you're showing that you really [2:16:13] care about your community. [2:16:15] Many of you have been living there over two decades. [2:16:18] And so it's always unfortunate when [2:16:22] we have these cases because we're [2:16:25] faced with a community that wants [2:16:27] to protect their residents and their people. [2:16:30] And then you're also dealing with property owners. [2:16:35] And so the best way to really balance it [2:16:37] is what what's happening now. [2:16:40] And I do want to thank the applicant, Melissa. [2:16:42] She's someone I truly do respect. [2:16:44] Thank you having those conversations with the residents [2:16:48] and getting their feedback. [2:16:50] And that's really the point where we both converge, [2:16:54] the residents and the owners. [2:16:56] And we try to negotiate. [2:16:58] We try to come to an agreement. [2:17:00] And I think that, as my colleague Councilwoman [2:17:04] Reinoso mentioned, we heard from you guys [2:17:07] right now, the two things that were just mentioned. [2:17:11] I know that I would be in agreement with making sure [2:17:14] that there is a concrete wall if that's [2:17:16] what the residents desire. [2:17:19] The other thing is, as far as the gas station, [2:17:22] I know that it was taken into consideration. [2:17:24] And there were a lot of-- there was an evaluation done [2:17:26] on different things. [2:17:27] But is it still a possibility, something [2:17:30] that you can consider, moving it to the other side where there's [2:17:34] a lake? [2:17:35] It sounds like the residents believe [2:17:37] that's where it would have the least impact. [2:17:42] Let me see. [2:17:43] And, I mean, it sounds like you're not [2:17:45] going to have-- the gas station is not going [2:17:46] to have a car wash, right? [2:17:47] No car wash, correct. [2:17:49] Because I think I had heard that previously from-- [2:17:51] I think they were very concerned about the car wash. [2:17:54] But now seeing that it's 140 feet, [2:17:56] the concern is moving the Navarro [2:17:58] and then having the queuing for the pharmacy at the rear [2:18:04] at a lesser setback. [2:18:06] We've already gone through the Miami-Dade County DERM [2:18:09] process for this site. [2:18:11] And we would respectfully ask for it [2:18:14] to be preserved at this location since all the fire, county [2:18:20] traffic, city traffic is all accommodated for that location. [2:18:25] And just to know, would it be completely detrimental [2:18:32] and a big delay to reevaluate that [2:18:36] and look at the position of the gas station even-- [2:18:39] It has been evaluated. [2:18:41] And this is the best location for it [2:18:44] as it relates to traffic, environmental, as well [2:18:48] as the distance from the rear property line. [2:18:54] OK. [2:18:57] Yeah, I mean, I think those were the two-- [2:18:59] and again, personally, if I were living there, [2:19:02] I would also want the gas station on the other side [2:19:06] as well. [2:19:08] Again, I don't know when discussions took place [2:19:10] or when the meeting with the residents [2:19:12] happened, whether it was before the site plan was done or after. [2:19:18] But that would have been something [2:19:21] that I would have also suggested as well. [2:19:25] That's all the questions I have. [2:19:28] Councilman Pineyro? [2:19:30] Thank you, Mayor. [2:19:32] First of all, I also want to thank the residents [2:19:35] because, as we just heard, it is important for you guys [2:19:41] to get engaged, to participate. [2:19:43] We're talking about your community. [2:19:45] It's next door to this property. [2:19:47] So the fact that you're here is not [2:19:49] only because you care about your community, [2:19:51] but you also care about the City as well. [2:19:54] So I want to thank you for being here and for raising your voice. [2:19:57] Because at the end of the day, in my case, [2:20:01] I always try to do what is best for the residents [2:20:04] and for the community as well. [2:20:06] To the applicant, thank you so much for your time. [2:20:09] I know that we have been discussing [2:20:11] this different occasions. [2:20:15] Just for-- more for educational component or learning process, [2:20:21] especially for-- not only for the residents that [2:20:24] are here for-- but overall. [2:20:27] Looking at this particular site, can you [2:20:30] tell us what other type of project [2:20:33] can be built on this particular site other than the one [2:20:37] that you're proposing? [2:20:38] Absolutely. [2:20:39] As we mentioned in the-- in our presentation, what you're [2:20:43] allowed to do is 50% lot coverage, [2:20:47] where-- which is significant. [2:20:48] Six stories of height uses, all commercial office [2:20:53] uses, hotel uses, automotive uses, et cetera. [2:20:59] The reason why I ask you the question-- [2:21:02] and I have mentioned it to you before-- is because-- [2:21:05] and I want for the residents to understand this as well-- [2:21:08] when we make these type of decisions, at least in my case, [2:21:12] I always try to go with what is going [2:21:14] to be the best for the City and for the residents. [2:21:18] So obviously, having a hotel right behind the property, [2:21:22] I would say no. [2:21:23] Well, you have the right to do it. [2:21:25] But I would say no. [2:21:28] But even with this particular project [2:21:32] that I'm 100% satisfied-- [2:21:35] of course, I like to-- [2:21:37] always to listen to the residents. [2:21:39] And I have to say no. [2:21:41] But I always going to look for the best interests of the City [2:21:44] and the residents as well. [2:21:45] So my point, especially to the residents that are here, [2:21:48] is that know that this particular proposal or site [2:21:54] plan that you're looking at so far [2:21:57] is the best that we can have for this particular section. [2:22:01] Again, that I like it 100%. [2:22:04] I mean, I'm honest. [2:22:06] I mean, it's not 100%. [2:22:08] But it's going to be the best of what we have so far, especially [2:22:14] in that particular area. [2:22:17] The concerns that the residents have-- and I [2:22:20] agree with Councilwoman Reinoso as well-- if the wall [2:22:24] is something that they ask for, I know you already said yes, [2:22:28] so absolutely, I'll be in favor of that. [2:22:32] But I think it's important to understand, even if we say no-- [2:22:38] and I'm going to ask this to my City Attorney-- [2:22:41] even if we say no to the gas station as part of this project, [2:22:45] what would be the consequences? [2:22:49] Through the Mayor, Councilman, the issue [2:22:52] is the applicant has a property right and to be able to build [2:22:56] whatever the area is zoned for. [2:22:58] And as she stated, they can build a hotel. [2:23:00] They can build an office building 6 feet. [2:23:02] They can build entertainment establishments. [2:23:04] And they can build a whole host. [2:23:06] It's within our commercial corridor section of the City. [2:23:09] So if we were to decide today that a hard no on the gas, [2:23:14] then we might be exposing the City to some litigation. [2:23:20] Why? [2:23:20] Because that gas station produces a certain amount [2:23:23] of money. [2:23:23] It's a certain use. [2:23:24] That is a benefit to the landowner. [2:23:26] And by us saying no, then that could [2:23:28] be perceived as a possible taking of their rights [2:23:33] on the property. [2:23:34] Of course, we would defend that vigorously. [2:23:36] But it could happen. [2:23:39] Thank you. [2:23:40] And again, the reason why I ask these-- [2:23:41] I like sparring with you, Lorenzo. [2:23:45] But the reason why I ask these questions is especially [2:23:48] for the residents to understand when we make [2:23:51] or when I make a decision, it's based [2:23:53] on what is actually best for us as a City overall. [2:23:59] I don't take it slightly. [2:24:01] I obviously always like to listen from legal. [2:24:06] But again, out of all the options, [2:24:09] certainly, this is the one that-- [2:24:13] it makes sense. [2:24:14] Let's put it that way. [2:24:15] Now, I just want to clarify a few points that were actually [2:24:18] brought up because-- since we have the residents here. [2:24:22] When we speak about our children-- [2:24:26] and I heard about the school across the street-- [2:24:29] right now, we have-- finally, we have traffic lights in 112, 109. [2:24:35] We didn't have traffic lights before [2:24:38] in those particular sections. [2:24:41] When we speak about safety, we have our police officers here. [2:24:46] We have a great Police Department, by the way. [2:24:49] We have the lowest crime rate in Miami-Dade County as a city. [2:24:51] So we should be proud of our Police Department, which [2:24:54] I know we are. [2:24:55] But I just want to leave it on the record [2:24:57] because these are things that sometimes are not [2:25:00] actually mentioned when we talk about safety, for example. [2:25:05] Traffic, it's a reality that we're all facing. [2:25:08] Unfortunately, we have-- well, unfortunately for some. [2:25:11] Fortunately for businesses, we have over 120,000 vehicles [2:25:16] Monday through Friday coming, passing Doral, coming to work. [2:25:21] So we have a lot of cars Monday through Friday that, obviously, [2:25:26] having this particular project or adding this project [2:25:30] to the Doral Boulevard at this point is not going to make any [2:25:35] other difference since we already have 120,000 vehicles [2:25:39] coming into the city every day. [2:25:40] So the city is growing. [2:25:44] I mean, we're thinking about the city-- the future. [2:25:47] We're thinking about our children [2:25:49] when we make-- at least as a father, when [2:25:51] I make these decisions. [2:25:53] And when we speak about quality of life, [2:25:56] I certainly rather to have something like this than a hotel [2:26:00] or a medical building right behind this community. [2:26:04] So I just wanted to mention those comments. [2:26:10] And I also heard about rats behind one [2:26:15] of the shopping centers. [2:26:16] If that happens, now that we know, [2:26:17] I'm sure the City Manager heard that. [2:26:20] So Code Compliance will be there tomorrow morning, I guess. [2:26:23] Yeah. [2:26:24] Because I hope that's not the case, by the way [2:26:28] because we take this very seriously. [2:26:30] But I want to-- again, and to conclude my comments, [2:26:34] I just want to make sure the residents understand [2:26:36] that when we make these decisions, [2:26:38] it's thinking about everything that was mentioned-- quality [2:26:42] of life, traffic, safety, and certainly [2:26:45] the future of our city. [2:26:47] So I just want to thank the residents once again. [2:26:51] The applicant, thank you for listening to the residents. [2:26:54] And hopefully, this is something that-- [2:26:57] it will move forward with the residents' satisfaction. [2:27:02] And again, it's not going to be 100%. [2:27:05] Because in my case, it's not 100%. [2:27:07] I'm sure in your case, it's not going to be 100%. [2:27:09] But hopefully, we can make it happen. [2:27:13] Thank you. [2:27:14] Thank you. [2:27:15] If I may. [2:27:16] Yes. [2:27:17] Vice Mayor Cabral? [2:27:18] Thank you for the presentation and for explaining [2:27:23] the changes and-- that you have implemented [2:27:28] after meeting with the residents and also reflecting [2:27:34] that only 40% compared to the 50% that is the maximum that [2:27:38] can be permit by code and also the setback on the property. [2:27:46] I do also understand as a resident. [2:27:49] And I know many of them for many years, [2:27:52] that they lived there for over two decades, [2:27:54] that it will be a great impact for them, [2:27:58] an area that is being vacant for so many years and an area that [2:28:02] is going to turn from being an empty lot into a commercial one. [2:28:09] And I also understand that many of them rather-- [2:28:12] even though you explain about the impact of having something [2:28:16] residential than having something commercial-- [2:28:19] moving along the day and part of the night [2:28:22] too, that for them is a disruption for what they already [2:28:26] have or having a residential there. [2:28:30] I really would like to see. [2:28:32] But you explained already that it cannot be and having it [2:28:35] instead on the other side. [2:28:37] Because that area-- [2:28:38] I know the area very well. [2:28:41] So having it on the other side, just [2:28:42] for them-- to the traffic coming in and out from the community [2:28:46] will make a difference. [2:28:47] So that's the part that I'm disappointed that it cannot be [2:28:50] accomplished, because that will make a less impact on them [2:28:54] at the time that they are going to return or coming out from [2:28:58] their communities-- [2:29:00] their community during the day. [2:29:03] So that's all that I have to say, really, about the project. [2:29:07] I do understand the rights that it has. [2:29:10] But I also understand the impact on the day-to-day [2:29:13] on the quality of life of the most [2:29:14] residents of the City for over two decades [2:29:17] before the city was even incorporated. [2:29:21] Thank you, Vice Mayor. [2:29:23] So thank you. [2:29:25] So I have a couple of comments and questions. [2:29:28] And first, I also want to thank the residents [2:29:30] for coming out and for-- [2:29:31] I actually joined the first Zoom meeting that you all had-- [2:29:33] I was there for a little while because I [2:29:35] had something to get to as well-- and heard some of it [2:29:38] and just wanted to hear the concerns from the residents. [2:29:40] I did respond to the emails that I received. [2:29:43] And I actually responded to all of you [2:29:44] that signed the petition today. [2:29:47] And so I thank you for your involvement and your input. [2:29:50] I think it's really valid when we have the opportunity [2:29:53] to listen to it. [2:29:54] I also want to put on the record that as elected officials, [2:29:56] we have a responsibility to protect the interests [2:29:59] and quality of life of our residents, while also [2:30:02] respecting the legal property rights of those who own [2:30:05] and develop land in our city. [2:30:07] The Council cannot deny or-- otherwise permitted uses solely [2:30:12] because there's opposition to it. [2:30:14] Actually, there's laws that completely protect us-- protect [2:30:18] the landowners from that. [2:30:19] At the same time, a property owner's rights to develop [2:30:22] does not exempt them or a project [2:30:26] from the City's requirements or from rigorous standards intended [2:30:30] to protect the surrounding communities. [2:30:32] And I believe that that's what our code does. [2:30:34] And so I want to address some of those comments [2:30:36] because I heard them here today. [2:30:38] And so I have many notes and questions that I'd like to ask. [2:30:41] And I am going to ask to go back to the site plan for a second. [2:30:43] And I heard the comments and concerns [2:30:46] of where the gas station is located. [2:30:49] And I know that the request has already [2:30:50] been made to potentially look at the changes to that. [2:30:54] And I know it's very late to do that at this point. [2:30:56] This project, before getting here, [2:30:58] has to go through several departments, state, [2:31:02] especially when you're talking about a gas station [2:31:05] and building things that have a lot of oversight. [2:31:10] Because there is state, federal, and local agencies [2:31:15] that will look at the compliance for something [2:31:18] like a gas station. [2:31:19] So I think it is unreasonable at this time to go back [2:31:22] and say, redo your entire site plan. [2:31:25] I also understand the process that's [2:31:27] put into place when looking at a site plan and the best way [2:31:31] to meet concurrences and circulation of the property [2:31:35] and all of that. [2:31:36] And so I'd like to go back to the site plan [2:31:38] to point out a couple of things and see [2:31:40] if there is any abilities to-- if there's [2:31:42] room for improvements, that we look at those, [2:31:46] and addressing some of those concerns. [2:31:49] So to my-- [2:31:50] If I may, one thing about the gas station location is that, [2:31:53] as was mentioned, 114th is the main entrance to Hawksnest. [2:31:58] So the idea that anybody would want a gas [2:32:01] station at their main entrance just seems a little irrational. [2:32:06] Yes. [2:32:06] And I want to also ask because I didn't see it [2:32:10] when I saw the photo with the Hawksnest and the site plan. [2:32:15] Is there an exit of Hawksnest on 112th? [2:32:19] Yes. [2:32:19] There is an exit-- [2:32:20] That's the secondary exit-- [2:32:21] Is there an entrance there as well? [2:32:23] Yes. [2:32:23] That's the secondary-- the main entrance-- [2:32:25] It's the second entrance and exit? [2:32:26] Correct. [2:32:26] So the idea being that a gas station [2:32:29] wouldn't be at the main entrance where they have their landscape. [2:32:32] So I'm assuming one of the main reasons [2:32:34] this was considered, after listening to some of the input [2:32:37] that you made and that your experts look [2:32:40] at when developing a site plan, is the line of sight [2:32:43] of the building for the pharmacy for Navarro [2:32:46] is higher than the gas station. [2:32:49] So if we're concerned about building [2:32:51] and from second stories, trees being higher [2:32:54] so that you can see, putting a higher line of sight [2:32:58] on an area that doesn't have homes directly behind it, where [2:33:01] there's a water and a buffer, makes sense to the experts [2:33:05] and to the engineers, which is what they've done. [2:33:07] They put your highest line of sight [2:33:09] on the section that doesn't have a direct line of sight [2:33:12] from your second homes. [2:33:14] So I understand that coming from the architects and the engineers [2:33:17] that are looking at-- and we look at that too when we're-- [2:33:22] staff is looking at that when they are developing this. [2:33:24] By the way, just to understand this process, while they're [2:33:28] going to Miami-Dade and State and all these things that [2:33:31] have to get done for these approvals, DERM, [2:33:33] it's also going through our departments. [2:33:35] And it goes back and forth with comments [2:33:37] to make sure that they're meeting our Master Doral [2:33:40] Boulevard Plan, that they're meeting our codes, our setbacks, [2:33:42] which I'm grateful that your setbacks are triple what we're [2:33:48] required by code. [2:33:50] I think that that's very intentional because you [2:33:54] want to be good neighbors. [2:33:55] Now, understanding that this will have a drive-through, [2:33:58] as the Navarro will, I'd like to understand [2:34:01] where that drive-through goes through. [2:34:03] And can you explain to me the flow [2:34:04] of traffic for the property? [2:34:06] Because I think that also makes a big point [2:34:09] to why the Navarro is where it is [2:34:11] and the gas station is where it is. [2:34:14] Because the connectivity is also important for that flow [2:34:17] and the stacking. [2:34:19] Absolutely. [2:34:20] So you can see here the traffic improvements. [2:34:23] There is an exclusive right-turn lane into the Navarro Pharmacy [2:34:29] from the rear-- that's only right in, right out-- [2:34:33] as well as the entrance, the exclusive right turn [2:34:36] that's marked as number 2, where anyone coming westbound on 41st [2:34:43] Street would enter the Navarro site. [2:34:45] At that entrance is where they would [2:34:48] enter going through the site. [2:34:51] So the actual drive-through area is to the rear of that site. [2:34:58] So it goes from right to-- into the site. [2:35:01] So right in from 114th out through the westbound. [2:35:08] So the stacking for the drive-through [2:35:11] which is on the rear of the Navarro, correct? [2:35:15] Yes. [2:35:15] Can you zoom in on the Navarro one? [2:35:17] I'm going to zoom in. [2:35:18] Yeah, I've got a better one. [2:35:19] Sorry, that was the gas station. [2:35:22] That one. [2:35:22] There we go. [2:35:24] So the stacking comes from the east to west? [2:35:27] Correct. [2:35:30] And then they go back out, and there's only right turn? [2:35:32] Correct. [2:35:35] So if you were to do that on the other side, [2:35:38] you would have the problem-- [2:35:40] Exactly. [2:35:41] --of the stacking-- [2:35:42] And the queuing. [2:35:43] --over-- right, and the queuing onto 112th? [2:35:46] Arguably, yes. [2:35:49] Internalize the [? sound. ?] [2:35:50] Engineering wise, I think it would be very difficult [2:35:53] unless you were to stick it in the middle of the property, [2:35:55] which would really disrupt. [2:35:57] Right. [2:35:58] The goal is for the Navarro and the gas station to-- [2:36:02] Anchor. [2:36:03] --anchor the 27,000 square feet of food, beverage, [2:36:07] neighborhood-style uses. [2:36:10] And that central courtyard is intended [2:36:12] to be the outdoor dining associated [2:36:15] with those food and beverage. [2:36:16] And I can go to this site so you can see that there. [2:36:20] I did want to mention, also, just as we're on the topic here, [2:36:24] there was comments and concerns about noise [2:36:27] and odors and all these things. [2:36:28] I want to reiterate that we have protections of quality [2:36:33] of life for all of you on that. [2:36:35] We have current code that protects for noise. [2:36:40] We actually have even code that doesn't allow for dump trucks [2:36:45] to come into residential areas to pick up trash [2:36:48] at certain hours so you don't hear [2:36:49] the beeping of the car-- of the trucks [2:36:52] to back up into your areas at certain times. [2:36:55] So all of those things are already [2:36:56] built into our code to protect quality of life [2:36:59] for our residents. [2:37:00] So understand that there is protections [2:37:02] built in that if you run into these issues, [2:37:04] you can call Code Compliance, and they will be enforced. [2:37:09] I want to point out that just down the street-- and, look, [2:37:12] I-- we see this all the time-- two gas stations and one corner. [2:37:15] So I understand the theory of, "why is there another gas [2:37:18] station there?" [2:37:19] I can't answer that. [2:37:19] I don't own a gas station. [2:37:20] I can only imagine the competition [2:37:23] and so on and so forth. [2:37:24] And so to my understanding, the operator of this is Sunshine [2:37:27] Gas, which is not only a local resident-- [2:37:29] the family lives in Doral-- but they also own-- [2:37:32] they own several properties in Doral. [2:37:34] They operate most of the gas stations in Doral. [2:37:37] And their headquarter is in Doral. [2:37:39] So I know they will be thoughtful operators. [2:37:43] And they're not going to want to cause issues. [2:37:46] So I'm glad that there's no car wash. [2:37:52] And I want to point out that there [2:37:55] is no anticipated future car washes being put. [2:37:58] And I'd like to make sure that that's stated here. [2:38:00] Because we did have a situation down the road [2:38:03] where the gas station that was there later [2:38:06] came and added a car wash. [2:38:09] And the residents behind were very concerned [2:38:12] that there would be noise. [2:38:13] And we have had no noise complaints from them. [2:38:16] I also want to point out that it's a very similar situation [2:38:18] in that lot. [2:38:19] And I actually sent you all an email today [2:38:21] with the-- my own little site plan. [2:38:22] I'm not an engineer. [2:38:23] But I drew up my own little site plan [2:38:25] and showed you all that this is very consistent. [2:38:28] It's not only consistent throughout the county. [2:38:30] It's consistent throughout our city. [2:38:31] May not be what we absolutely love and think that [2:38:34] is the best solution. [2:38:35] And I understand some of us may not want [2:38:36] to live near a gas station. [2:38:38] But we already have this exact situation. [2:38:41] So there's precedence set that a gas [2:38:44] station is consistent near a residential community. [2:38:48] As a matter of fact, the residential community [2:38:50] that is behind the gas station is an apartment complex, [2:38:54] so it's actually taller than what your homes are. [2:38:57] We've never had complaints, to my understanding, for noise. [2:39:00] They operate a car wash. [2:39:02] And they're actually much closer. [2:39:03] They have a much smaller setback than what they [2:39:05] are proposing here for you all. [2:39:08] And they don't have the buffering that you all have. [2:39:10] So I don't think it's going to be as much of a nuisance [2:39:13] as you're anticipating. [2:39:14] And I understand living by an area that [2:39:16] was not developed for a very long time, we would all love-- [2:39:19] I miss the cows. [2:39:21] Truly, I do. [2:39:22] But we have to understand that it's just the progress-- [2:39:25] the natural progress and progression of our city. [2:39:28] So it's very difficult for us to deny the progress [2:39:33] that Doral is experiencing. [2:39:35] We can do our best to protect the quality of life [2:39:37] by enhancing our Comprehensive Plan, which [2:39:39] is what you saw us do earlier today, that's going back [2:39:42] to the State and continuing to make sure Doral evolves [2:39:45] to be the place and protect its natural characteristics [2:39:48] in our neighborhoods, which, I think, we've done very well. [2:39:51] So when I met with the applicant, [2:39:54] I did see a lot of the intention put behind this [2:39:56] and making sure by putting mature vegetation. [2:39:58] You don't see that from developers. [2:40:00] They don't put mature vegetation. [2:40:01] They put the bare minimum many times. [2:40:04] So I do think that there was a lot of thought. [2:40:06] And I do want to thank the developers for that. [2:40:08] And they took back a lot of our feedback, [2:40:10] understanding that you're going from a very-- from a vacant land [2:40:14] to a development. [2:40:15] But I think that there will be-- [2:40:17] I think you'll be pleased to see that it won't be as harsh as it [2:40:21] may seem, at the same time, understanding that there will [2:40:25] be a difference, and there will be an impact to the communities. [2:40:28] And so I want to make sure all concurrences [2:40:30] have been met with traffic. [2:40:31] When we look at traffic, it's not just [2:40:33] what's captured on site. [2:40:35] They also look at the surrounding properties. [2:40:37] And that's why you see off-site improvements [2:40:40] not in front of their development, but down the road. [2:40:43] Can you talk a little bit about the concurrences [2:40:45] in the traffic studies? [2:40:47] Natalia? [2:40:47] Yeah, go ahead. [2:40:48] We have our traffic engineer. [2:40:49] She's here. [2:40:51] Go ahead. [2:40:52] Thank you. [2:40:53] Natalia Lercari with Bowman. [2:40:55] So when we do the traffic studies, [2:40:57] they were required to go out there and collect the existing [2:40:59] traffic that's on the road. [2:41:01] And so for this particular project, [2:41:03] we looked at all the intersections [2:41:04] all the way from the Turnpike to 107. [2:41:06] So we go out there. [2:41:07] We collect existing counts, the worst times of the day. [2:41:09] So you're collecting in the morning rush [2:41:11] hour, when everyone goes to work, [2:41:12] when the kids go to school. [2:41:14] We collect it in the midday and in the afternoon, when the most [2:41:16] traffic is on the road. [2:41:18] And to answer one of the resident questions, [2:41:20] we did include all the community developments that [2:41:23] are in the surrounding area. [2:41:24] So it included Bridge Point, which is across from us, [2:41:26] and four or five other developments [2:41:28] that are not yet built but that have been approved by the City. [2:41:31] So all of that gets included in our study. [2:41:33] And then we add our project on top of that. [2:41:35] And we look at all those intersections. [2:41:37] And this also includes the improvements [2:41:40] for pedestrian crosswalks? [2:41:42] Correct. [2:41:42] I heard earlier there's concerns there-- [2:41:44] this is now a vacant land that will have not only [2:41:48] sidewalk built so it creates connectivity, [2:41:51] and there's now ability to walk safer, [2:41:53] but it will include crosswalks. [2:41:55] It will. [2:41:56] It'll include, by requirement by the City of Doral and Miami-Dade [2:41:59] County, special emphasis crosswalks across our driveways. [2:42:02] And I believe at 112 and 114 or 112, [2:42:05] Bridge Point is already upgrading [2:42:06] that entire intersection, if not already, [2:42:08] with special emphasis crosswalks and [INAUDIBLE]. [2:42:10] And those crosswalks have the-- where you can push for walking, [2:42:14] and it'll have-- [2:42:15] At the signalized intersection, yes. [2:42:17] At the driveways, where it's unsignalized, no. [2:42:19] Right, not the driveways. [2:42:19] But I think the concern was the crossing of 41st Street. [2:42:22] Yes, of course. [2:42:22] All of that is updated when they were-- they're [2:42:24] updating 112 through-- now with Bridge Point. [2:42:30] And if our staff wants to address this concern as well-- [2:42:35] we also look at the traffic analysis. [2:42:36] Our team looks at-- [2:42:38] Public Works look at the traffic analysis. [2:42:40] We don't just take the applicant's traffic studies [2:42:44] word for it. [2:42:45] We also take a look at the impacts [2:42:49] from going from a vacant land to going to its uses and-- [2:42:53] Yeah, absolutely. [2:42:54] So it goes through County Traffic. [2:42:55] And then we have our own analysis within the city [2:42:58] to determine whether or not it is [2:43:01] viable for the city's purposes. [2:43:03] There are comments that come back. [2:43:05] We send the comments to the applicant. [2:43:06] And the applicant addresses their-- [2:43:08] the comments that the city has, if any. [2:43:11] So it's analyzed in the county and in the city. [2:43:15] OK, perfect. [2:43:17] Going through some of my notes because there [2:43:18] was a lot of comments put. [2:43:20] And so I want to make sure we address everything [2:43:22] that the residents have stated. [2:43:24] I'll go back just real quick before I close to things-- [2:43:27] to the health concerns. [2:43:31] The gas stations would not be allowed in a residential area [2:43:35] if the transmissions-- and I understand [2:43:36] that there's particles and things that are transmitted [2:43:39] when there's gas. [2:43:40] It's the same as our cell phones. [2:43:41] We know our cell phones radiate-- have radiation. [2:43:45] And we still use them. [2:43:46] We don't get rid of them. [2:43:47] Our microwaves-- we don't stop using microwaves [2:43:49] because we know that there's radiation. [2:43:50] And we're all impacted in different ways [2:43:52] and impacts our lives. [2:43:54] However, there is certain EPA standards. [2:43:57] And if those standards are met and the safety measures [2:44:00] are implemented, there's no opposition [2:44:06] that can be stated for a legal sufficient argument [2:44:11] that a gas station is not-- would not be allowed, correct? [2:44:18] Yes, correct. [2:44:18] OK. [2:44:19] Have the residents put any legal sufficient evidence [2:44:24] on the record that you feel that we would be able to-- [2:44:28] I mean, the residents' testimony is something [2:44:30] that you need to weigh in conjunction [2:44:32] with the presentation, everything that you've heard. [2:44:35] There's nothing they've cited that would [2:44:37] make me give the opinion that this is something [2:44:41] we need to reconsider that is imminent danger to the health [2:44:44] safety of the residents of Doral. [2:44:46] So to our staff that has recommended for approval, [2:44:50] the applicant has met all legal requirements, concurrences, [2:44:55] and code requirements for land use and Comprehensive Plan [2:45:01] within its zoning and land use rights? [2:45:05] That is correct, Mayor. [2:45:06] OK. [2:45:08] All my questions have been answered. [2:45:10] Again, I want to thank the residents for coming out. [2:45:13] I know it takes a lot to be out here and discussing. [2:45:17] I know we all care about the community. [2:45:19] I live right down the street. [2:45:20] So we want to make sure that the best is [2:45:23] being done for our community. [2:45:25] And we try and work with these applicants as best as possible. [2:45:27] And I want to thank them because they [2:45:29] did incorporate the comments that I made [2:45:31] in concerns to the property. [2:45:32] And I do think that it has been done with all the thought [2:45:36] process. [2:45:36] It was not trying to shove sardines in a sardine can. [2:45:40] There's a lot of open space, extra parking, which we-- we're [2:45:43] always concerned about. [2:45:45] And there's always a push and a shove [2:45:47] there with the developments, sufficient setbacks [2:45:51] and landscaping. [2:45:52] So with all that in mind, I'm satisfied [2:45:55] with the responses and also the residents' concerns being met. [2:46:00] I'm in favor of the wall if that is [2:46:02] the will of the Council as-- which I think [2:46:05] we're all in favor of that. [2:46:06] I believe our-- does our code prohibit a-- [2:46:10] do you need something from us in addition to being able to allow [2:46:14] the 6-foot wall? [2:46:15] So you can go up to 8 feet in the district between the buffer. [2:46:18] So if Melissa wants to proffer specific footage right now [2:46:24] to proffer on the record. [2:46:25] Are we OK with 6 feet? [2:46:26] Do we want 8 feet? [2:46:28] Are we OK with-- you want taller? [2:46:30] [INAUDIBLE] [2:46:31] So can we go to 8 feet? [2:46:32] Are you all OK with that? [2:46:33] I would recommend 6 feet because when-- the site currently [2:46:37] is undeveloped. [2:46:38] So it will be filled because it's all invasive wetlands. [2:46:41] So it's going to be higher. [2:46:42] So my concern is you're going to have a very tall wall. [2:46:45] And what they have today is, I would say, a 4, [2:46:49] 5-foot chain-link fence with, I think, [2:46:53] 6-foot pillars on their side. [2:46:55] So an 8-foot fence would be double. [2:46:58] It may not be as aesthetically pleasing as they may think. [2:47:02] So I would suggest a 6-foot fence because once we elevate [2:47:06] our site, that will be sufficient. [2:47:07] And you think your elevation's going to be 2 feet, 3 feet once [2:47:11] you fill? [2:47:14] 3 feet? [2:47:14] 4 feet, we're being told. [2:47:15] Huh? [2:47:16] I'm being told 4 feet. [2:47:17] 4 feet? [2:47:18] Yeah. [2:47:18] 4 feet? [2:47:18] OK. [2:47:19] So I just think that we should be careful with that. [2:47:21] So we'll stay with 6 feet. [2:47:23] I'm OK with the wall-- with the concrete wall [2:47:27] if the residents are OK and understand what that is. [2:47:30] I think-- [2:47:30] [INTERPOSING VOICES] [2:47:31] Absolutely. [2:47:34] The trees that they're putting are mature trees. [2:47:36] And they have to grow. [2:47:37] You're not going to get fully-- [2:47:38] you're not going to get full 20-foot trees. [2:47:41] That's impossible. [2:47:42] But you will get, I think, plenty of buffer and vegetation. [2:47:48] And then the trees will grow. [2:47:50] And we don't allow them to have dead trees on their property. [2:47:53] They will enforce. [2:47:54] We will come and fine them for that. [2:47:56] Absolutely. [2:47:56] So don't worry. [2:47:57] The trees will survive. [2:47:58] And they will grow. [2:47:59] And the City makes sure of that. [2:48:01] So yeah, if we having our best. [2:48:04] Also, the other change from what was submitted [2:48:06] is the change to the elevation of the Navarro [2:48:10] to incorporate the Bahamian yellow just as accent. [2:48:14] So if that's OK for modification on the record-- [2:48:16] That's fine. [2:48:16] --that would be wonderful. [2:48:17] We'll memorialize that. [2:48:20] All right. [2:48:21] Thank you very much. [2:48:22] Again, I'm satisfied with the responses. [2:48:24] I think that we have been able to, as much as possible, [2:48:27] come to a consensus and place of understanding. [2:48:31] And I know you all will be happy Navarro shoppers. [2:48:35] No? [2:48:36] [INAUDIBLE] [2:48:38] Oh, I wish. [2:48:39] They're long gone. [2:48:41] Maybe a small independent bookshop in those 27,000 [2:48:44] square-- [2:48:45] Maybe a small independent bookshop in the retail, yes. [2:48:46] We're hopeful for that. [2:48:48] All books are books. [2:48:49] And again, we don't engage in the back-and-forth debate. [2:48:52] So if some of you felt that you came up and we didn't respond, [2:48:55] understand it's our practice and policy not [2:48:57] to go back and forth in that because it just [2:48:59] opens up the door to a lot. [2:49:00] So we don't conduct in that. [2:49:02] But thank you very much for being here once again. [2:49:04] And I know we can't always make everybody happy. [2:49:06] But we do our best to try and listen to our residents [2:49:08] and comply within the law. [2:49:09] We do sit as a quasi-judicial board up here. [2:49:12] So thank you. [2:49:13] All right. [2:49:14] I need a motion to approve. [2:49:16] A motion. [2:49:17] But I have a comment. [2:49:18] Motion to approve by Councilwoman Reinoso. [2:49:20] And you're on the floor for a comment. [2:49:21] Thank you. [2:49:23] And also, one of the conversations [2:49:25] that I was having with the applicant's counsel [2:49:29] was about our children. [2:49:30] I wanted to make sure that the property was safe for them. [2:49:33] And they did tell me that they did consider 41st and having [2:49:38] ample space between 41st and the property. [2:49:41] I'm a mother of three. [2:49:42] And that's imperative. [2:49:44] I mean, all of us care about that. [2:49:46] So that was part of my conversations with them. [2:49:48] So they did take that into consideration-- [2:49:50] the safety of our children and the community [2:49:53] that is going to visit that area. [2:49:55] And I do want to echo what Councilmember Pineyro said [2:50:01] as far as looking into what is going to be the least [2:50:05] impact to your community. [2:50:07] Because your community is our community. [2:50:09] And we're here for you. [2:50:11] Well, we're here because of you. [2:50:13] So I definitely do appreciate all the comments today. [2:50:16] I really did take it to heart. [2:50:18] It did open another perspective for me as well. [2:50:22] And I hope that I did a good job representing [2:50:25] the needs and the questions that you had today. [2:50:28] And I believe the applicant's counsel is very professional. [2:50:32] She's been doing this for a very, very long time. [2:50:34] She is an adversary. [2:50:36] And I know that she takes into consideration-- their team takes [2:50:40] into consideration the community that we represent [2:50:44] and the needs of the community in balance with their client. [2:50:48] So I appreciate everybody that came out today. [2:50:51] So thank you. [2:50:52] Thank you. [2:50:53] All right. [2:50:53] And we have a motion to approve. [2:50:54] We need a second. [2:50:55] Second. [2:50:56] Second by Councilman Pineyro. [2:50:57] Madam Clerk, please read the-- [2:50:59] please call the roll. [2:51:00] Motion to approve moved by Councilwoman Reinoso, [2:51:02] seconded by Councilman Pineyro. [2:51:03] Councilwoman Reinoso? [2:51:04] Yes. [2:51:05] Councilman Pineyro? [2:51:06] Yes. [2:51:06] Councilwoman Porras? [2:51:07] Yes. [2:51:08] Vice Mayor Cabral? [2:51:09] No. [2:51:09] Mayor Fraga? [2:51:10] Yes. [2:51:10] Motion passes. [2:51:11] All right. [2:51:12] Thank you very much. [2:51:12] Thank you. [2:51:13] All right. [2:51:13] We move on to the next item. [2:51:15] Thank you. [2:51:18] Next item, Item 20D, A resolution of the Mayor [2:51:20] and the City Council of the-- [2:51:21] [INAUDIBLE], thank you so much. [2:51:22] A resolution of the Mayor and the City Council of the City [2:51:24] of Doral, Florida, approving a site plan modification for Royal [2:51:27] Atlantic Realty, Inc., located at 2020 Northwest 89th Place [2:51:30] in the City of Doral, Florida, pursuant to Section 53-184(F) [2:51:33] of the City's Land Development Code and providing [2:51:35] for an effective date. [2:51:38] All right. [2:51:38] I'm going to go ahead and open up Public Hearing. [2:51:41] Public Hearing is now open for item 20D, 26-6694. [2:51:46] Anyone who would like to speak on this item, please [2:51:48] approach the podium. [2:51:54] OK. [2:51:55] Seeing no comments, the Public Comments is now closed. [2:51:59] Madam Clerk, let the record reflect [2:52:00] no one has chosen to speak at this time. [2:52:03] And we will take any ex parte communication [2:52:08] before we hear from the staff. [2:52:14] Any ex parte communication on this one? [2:52:17] OK. [2:52:17] Being none, go ahead-- [2:52:19] Thank you. [2:52:19] --Mr. Magrisso. [2:52:20] OK. [2:52:21] So this is Royal Atlantic Realty, [2:52:23] Inc. They are coming for an industrial warehouse site plan [2:52:26] modification. [2:52:27] It is located at 2020 Northwest 89th Place, [2:52:32] close proximity to the Fingerlakes. [2:52:33] It's approximately total acreage of 2.3 acres. [2:52:39] The entire area is surrounded by Industrial future land use [2:52:43] categories and zoning districts. [2:52:46] These are the existing conditions. [2:52:48] If you see the top-right picture on the right, [2:52:51] you'll have the existing warehouses. [2:52:53] And to the east of that-- [2:52:57] I mean, the west of that, you see the existing [2:53:00] three-story office building that they [2:53:02] are proposing to demolish and replace [2:53:05] by expanding the warehouses into the office space. [2:53:11] Here is the site plan. [2:53:13] As I said, that three-story office building [2:53:15] will be demolished. [2:53:17] It was developed in 1985. [2:53:18] And it's going to be redeveloped by more warehouses totaling [2:53:24] 17,000, approximately, square feet. [2:53:27] You'll have 41 parking spaces. [2:53:29] And it'll be a modern look. [2:53:30] This is the landscape plan. [2:53:32] You'll see it's surrounded by trees and shrubs. [2:53:36] Here are the elevations. [2:53:39] These are the renderings of the proposed site. [2:53:43] It complies with all of our site plan [2:53:45] evaluation standards that are applicable. [2:53:47] And based on that, staff recommends [2:53:50] that you approve the modification of the site plan. [2:53:53] If you have any questions, I'm here to answer anything. [2:53:56] And Joe is also here for any questions that you may have. [2:53:59] Thank you, Mr. Magrisso. [2:54:00] Do we need to hear from the applicant? [2:54:06] No, Madam Mayor. [2:54:06] We agreed. [2:54:07] Just one correction. [2:54:08] That building has been demolished. [2:54:09] Has been? [2:54:10] The office. [2:54:10] Yeah. [2:54:11] So it was just, I guess, in between. [2:54:12] But the proposed construction is the new construction [2:54:15] on what is currently vacant. [2:54:16] OK. [2:54:17] Perfect. [2:54:17] Thank you very much. [2:54:18] I need a motion to approve if there's no-- [2:54:20] Motion to approve. [2:54:20] Motion to approve by Councilman Pineyro. [2:54:22] Second. [2:54:23] Second by Councilwoman Reinoso. [2:54:25] All right. [2:54:25] Madam Clerk? [2:54:26] Motion to approve made by Councilman Pineyro, seconded [2:54:29] by Councilwoman Reinoso. [2:54:30] Councilman Pineyro? [2:54:30] Yes. [2:54:31] Councilwoman Reinoso? [2:54:32] Yes. [2:54:32] Councilwoman Porras? [2:54:33] Yes. [2:54:33] Vice Mayor Cabral? [2:54:34] Yes. [2:54:34] Mayor Fraga? [2:54:35] Yes. [2:54:35] Motion passes. [2:54:36] All right. [2:54:36] Thank you very much. [2:54:37] We'll move on to the next item, going to First Reading. [2:54:39] First Reading. [2:54:40] Ordinance Number 2026-18, Fourth Amendment to Downtown Doral MDA [2:54:43] and Pattern Book. [2:54:44] An ordinance of the Mayor and the City Council [2:54:45] of the City of Doral, Florida, approving the Fourth Amendment [2:54:47] to the Downtown Doral Master Development Agreement [2:54:48] and modifications to the Downtown Doral Urban [2:54:50] Regulations, Pattern Book, providing for recordation, [2:54:52] implementation, severability, conflicts, [2:54:53] and an effective date. [2:54:54] All right. [2:54:55] Thank you very much. [2:54:56] I'm going to go ahead and open up to Public Comments for this [2:54:59] Item 20E, also known as 26-6698. [2:55:03] Anyone who has any comments, please approach the podium. [2:55:14] OK. [2:55:15] Being none, Public Comments is now closed. [2:55:17] And I will take any ex parte communication. [2:55:21] I did meet with the applicant for a brief discussion. [2:55:26] And it will not affect my decision. [2:55:28] All right. [2:55:28] Mr. Magrisso. [2:55:30] So we don't have a presentation for this one. [2:55:32] I'll just explain what the modifications of the MDA are. [2:55:36] As the Mayor mentioned, this is the fourth modification [2:55:39] of the MDA. [2:55:40] The first thing the modification does [2:55:42] is reallocate the square footage that is allotted [2:55:45] throughout Downtown Doral. [2:55:47] Specifically, it's removing 100,000 square feet from [2:55:52] the retail allocation. [2:55:54] And it is being granted to the new hotel use. [2:55:58] So that's going to generate about 213 rooms. [2:56:02] So there's not an increase in square footage. [2:56:04] It's just, like I said, a reallocation [2:56:07] of what was already approved. [2:56:09] Additionally, the height that you [2:56:12] are allowed to build in Downtown Doral is being changed. [2:56:16] Currently, the city has matched the Miami-Dade County standards [2:56:22] of height. [2:56:24] Recently, Miami-Dade County shifted its standard [2:56:27] to match what the FAA standard is. [2:56:31] So we are moving to the new FAA standard, [2:56:35] which is going to match Miami-Dade County's. [2:56:38] The other thing that the amendment does [2:56:41] is it caps the total dwelling unit allotment [2:56:46] that you are allowed to have to 35 units an acre. [2:56:50] So they will not be-- that's where they're capped at. [2:56:54] So you can't go above or below that number. [2:56:56] And the last thing it does is amends the Pattern Book. [2:57:01] The Pattern Book never contemplated single-family homes [2:57:04] within the Downtown Doral area. [2:57:06] You have a new development here that has single-family homes. [2:57:10] And the Pattern Book will now have design criteria [2:57:13] for single-family homes. [2:57:15] Other than that, unless I missed anything, that is the amendment. [2:57:20] And Joe is here if you have any questions. [2:57:24] Motion to approve. [2:57:25] Motion to approve by Councilwoman Cabral. [2:57:27] Second. [2:57:27] Second by Councilman Pineyro. [2:57:31] Is there any other additional questions, comments? [2:57:33] No. [2:57:34] All mine were addressed when we talked. [2:57:38] Motion to approve Ordinance Number 2026-18 on first reading [2:57:41] made by Vice Mayor Cabral, seconded by Councilman Pineyro. [2:57:44] Vice Mayor Cabral? [2:57:45] Yes. [2:57:45] Councilman Pineyro? [2:57:46] Yes. [2:57:46] Councilwoman Reinoso? [2:57:47] Yes. [2:57:48] Councilwoman Porras? [2:57:49] Yes. [2:57:49] Mayor Fraga? [2:57:50] Yes. [2:57:50] Motion passes. [2:57:51] All right. [2:57:52] We're going to hear item 20Q now since we moved it. [2:57:56] Item 20Q, Second Reading. [2:57:59] Ordinance Number 2026-07, Vacation of Street-- [2:58:01] La Joya. [2:58:03] An ordinance of the Mayor and the City Council of the City [2:58:04] of Doral, Florida, approving a public right-of-way vacation [2:58:07] of Northwest 52nd Terrace in Downtown Doral, [2:58:09] adjacent to the properties with Folio Numbers 35-3022-018-0010, [2:58:14] 35-3022-018-0020, 35-3022-018-0030, [2:58:20] and 35-3022-018-0040 for the proposed housing development [2:58:24] named La Joya, authorizing the City Manager to execute any [2:58:27] necessary documents for this provision upon approval [2:58:29] of a second reading by the City Council, [2:58:30] providing for implementation and providing for an effective date. [2:58:32] This was approved on first reading on April 8. [2:58:34] OK. [2:58:35] I'm opening up Public Comments for Item 20Q, [2:58:37] also known as 26-6570. [2:58:39] Anyone who would like to speak on this item, and this item [2:58:42] alone, please approach the podium. [2:58:54] Public Comments is now closed on this item. [2:58:56] And we will hear from staff. [2:58:58] Or second reading. [2:59:00] Oh, it's second reading. [2:59:01] It's second reading, Mayor. [2:59:01] We've got everything we needed, right? [2:59:02] I think that's the-- [2:59:03] Yes, we did. [2:59:04] And we have no changes between first and second. [2:59:07] The applicant received all the approvals [2:59:09] they needed to from the County and their process, [2:59:12] so we're good. [2:59:14] All right. [2:59:15] Motion to approve. [2:59:16] Motion to approve by Councilwoman Cabral. [2:59:18] Second. [2:59:18] Second by Councilman Pineyro. [2:59:21] Madam Clerk, please call the roll. [2:59:22] Motion to approve Ordinance Number 2026-07 on second reading [2:59:25] made by Vice Mayor Cabral, seconded by Councilman Pineyro. [2:59:27] Vice Mayor Cabral? [2:59:28] Yes. [2:59:28] Councilman Pineyro? [2:59:29] Yes. [2:59:30] Councilwoman Reinoso? [2:59:30] Yes. [2:59:31] Councilwoman Porras? [2:59:32] Yes. [2:59:32] Mayor Fraga? [2:59:32] Yes. [2:59:33] Motion passes. [2:59:34] All right. [2:59:34] Thank you very much. [2:59:35] We'll go back now to item-- [2:59:37] 20F. [2:59:37] --20F. [2:59:39] 20F, Ordinance Number 2026-19, Emre Tuna Investment, [2:59:43] LLC Rezoning. [2:59:44] An ordinance of the Mayor and the City Council of the City [2:59:45] of Doral, Florida, approving an amendment to the City's Official [2:59:47] Zoning Map from Industrial, I, to Corridor Commercial, CC, [2:59:50] for plus or minus 1.5 acres for the property located at 2500 [2:59:53] Northwest 107th Avenue, providing for severability, [2:59:55] conflicts, and an effective date. [2:59:57] OK, I'm going to go ahead and open up Public Comments for item [2:59:59] 20F, also known as 26-6703. [3:00:03] Anyone who would like to speak at this time, please [3:00:06] approach the podium. [3:00:11] Being none, Public Comments is now closed. [3:00:14] And I will take any ex parte communication. [3:00:19] All right. [3:00:19] I don't believe there's been any. [3:00:22] Mr. Magrisso, the floor is yours. [3:00:25] So this is Emre Tuna Investment. [3:00:27] It's a rezoning. [3:00:28] The property is located on 107th Avenue. [3:00:30] It's approximately 1.5 acres. [3:00:32] They are looking to rezone from Industrial [3:00:35] to Corridor Commercial. [3:00:37] A quick background. [3:00:39] When the City incorporated in 2003, [3:00:41] the City adopted Miami-Dade County's Zoning and Future Land [3:00:44] Use Maps. [3:00:45] When the City created its own Future Land Use Map and Zoning [3:00:49] Code, the original Zoning and Future Land Use [3:00:55] were incompatible with the two, that [3:00:57] being Business and Industrial. [3:01:00] In our code, those are incompatible uses, [3:01:04] so we are here to correct that to rezone the property so it's [3:01:08] compatible with your Comprehensive Plan. [3:01:11] The site, like I said, is Business. [3:01:13] The zoning district is Industrial. [3:01:15] To the north, you have Business and Industrial as well. [3:01:19] And to the south, it is not within the city limits. [3:01:23] These are the existing views of what is there now. [3:01:27] The rezoning is to Corridor Commercial from Industrial. [3:01:33] It's a permitted use for what is used currently [3:01:35] so they can continue operating with no issues. [3:01:38] This is just a cleanup for the City [3:01:41] to be compatible with one another. [3:01:44] The land use designation, like I said, is Business. [3:01:46] And based on this, staff recommends [3:01:48] to right the wrong that is currently [3:01:51] being done and approve the rezoning to Corridor Commercial. [3:01:56] And the applicant is here if you have any questions. [3:01:59] I just want to clarify that there's no proposed [3:02:01] development or anything. [3:02:02] This was just-- [3:02:04] Correct, Mayor. [3:02:05] --a correction on-- [3:02:06] Correct, Mayor. [3:02:06] --compatible uses-- [3:02:07] Yes. [3:02:08] --within the area? [3:02:08] Yes. [3:02:09] Motion to approve. [3:02:10] Motion to approve by Vice Mayor Cabral. [3:02:12] Do we have a second? [3:02:13] Second. [3:02:14] Second by Councilwoman Reinoso. [3:02:15] If there's no additional comments or questions, [3:02:17] Madam Clerk, please call the roll. [3:02:19] Motion to approve Ordinance Number 2026-19 on first reading [3:02:22] made by Vice Mayor Cabral, seconded by Councilwoman [3:02:24] Reinoso. [3:02:24] Vice Mayor Cabral? [3:02:25] Yes. [3:02:26] Councilwoman Reinoso? [3:02:27] Yes. [3:02:27] Councilman Pineyro? [3:02:28] Yes. [3:02:28] Councilwoman Porras? [3:02:29] Yes. [3:02:30] Mayor Fraga? [3:02:30] Yes. [3:02:30] Motion passes. [3:02:31] All right. [3:02:32] We're now going to go to item 20H since we've already [3:02:35] exhausted 20Q. [3:02:36] 20H, Ordinance Number 2026-21, Restating and Reaffirming Repeal [3:02:41] of Ordinance 2023-15. [3:02:43] An ordinance of the Mayor and the City Council of the City [3:02:44] of Doral, Florida, reaffirming and restating Ordinance Number [3:02:46] 2023-15, providing for findings regarding pending litigation [3:02:49] concerning the retroactive application of Ordinance Number [3:02:51] 2023-15, reaffirming the City's position that the retirement [3:02:54] system for elected officials was canceled and is no longer active [3:02:57] upon adoption of Ordinance Number 2023-15, [3:02:59] affirming the repeal of Ordinance 2021-02, [3:03:02] affirming the repeal of Article IX, [3:03:04] "Retirement System for Elected Officials" [3:03:05] of Chapter 2 of the City of Doral Code of Ordinances, [3:03:07] providing for severability, repealing all ordinances [3:03:09] or parts of ordinances in conflict, [3:03:10] and providing for an effective date. [3:03:12] All right. [3:03:12] I'm going to go ahead and open up Public Comments for Item 20H [3:03:16] or also known as 26-6724. [3:03:19] Anyone who would like to speak on this item, and this item [3:03:21] alone, please approach the podium. [3:03:27] Showing no interest, we will close Public Comments. [3:03:31] And we will hear from staff. [3:03:33] Or I think it's legal that will address this item. [3:03:37] Yes, Mayor. [3:03:39] Madam Mayor, Council, so back in 2023, the Council [3:03:44] repealed a pension program that had [3:03:47] been authorized through an ordinance established in 2021. [3:03:52] That repeal was subsequently a subject [3:03:54] of litigation, which is currently [3:03:56] before the third DCA on a rehearing. [3:04:00] The purpose for this is just to make sure [3:04:03] that there's no doubt that in 2023, [3:04:08] when that 2021 ordinance-- that pension program was repealed, [3:04:12] it was repealed properly. [3:04:14] And so it's just reaffirming that. [3:04:17] There was a question of whether its application was [3:04:20] retroactive or not. [3:04:21] But regardless of its retroactive applicability, [3:04:24] what this is stating-- that on 2023, as of that date, [3:04:26] the pension program no longer exists in the City of Doral [3:04:30] as it relates to its elected officials. [3:04:33] All right. [3:04:34] Is there any comments or questions? [3:04:36] I have a quick question, Mayor. [3:04:38] Yes. [3:04:39] I'm sorry, Councilwoman Porras? [3:04:40] Yeah, I just want to confirm that there will not [3:04:44] be anyone that's going to receive the pension moving [3:04:47] forward even if they acquire the age required [3:04:51] under the original pension because they were just not [3:04:54] vested. [3:04:55] I just wanted to confirm that this-- that's it. [3:04:58] Yeah. [3:04:58] Through the Mayor, Councilwoman, that is correct.
