tonight [2:31] thank you so much for the invitation [2:33] good evening mayor vice mayor City [2:35] commissioners and the city manager and [2:38] the City attorney and [2:41] the city of Houston staff my name is [2:43] Sonja white I am the FBLA advisor for [2:46] Eustis High School this is our second [2:48] year and we want to say thank you so [2:50] much we do have a small PowerPoint [2:53] presentation [2:58] and first of all I want to say a huge [3:03] heartfelt thank you for the City of [3:05] Eustis thank you so much for supporting [3:07] our students last year we had the [3:10] opportunity to travel to Chicago for the [3:13] future Business Leaders of America [3:15] national competition we had two students [3:18] from Houston this was like the first [3:20] time in about eight years I believe that [3:23] we had two students to compete in the [3:26] National even though they did not place [3:28] in Nashville but the experience and the [3:32] exposure that they got was just totally [3:34] phenomenal and one of the students she [3:36] was currently a freshman in Dallas Texas [3:38] at Baylor University so she was in FBLA [3:43] pretty much our whole time at Eustis [3:46] High School so we are very excited for [3:48] her but also we're excited to kick off [3:51] this year and I just wanted to let the [3:54] audience know exactly what your donation [3:57] and your support for Eustis High School [4:00] what we're doing we have a a few [4:02] community events that we like to do this [4:04] year and of course it's the continuation [4:06] of the socks for seniors where we donate [4:09] socks to we have adopted Lake Eustis [4:12] nursing home and the Eustis Head Start [4:15] program we are providing socks for their [4:18] children and providing socks for their [4:20] seniors it's no cost to them this is our [4:23] community event for the FBLA and of [4:27] course this year we're going to support [4:28] and kick off the March of Dimes which is [4:31] fbla's [4:33] um baby that's their baby of fundraisers [4:36] I mean community events and of course [4:38] Eustis High School we are doing the [4:40] panther Pantry because you know with the [4:43] um pandemic a lot of people lost jobs a [4:46] lot of families are in need but we are [4:48] so thankful for you since high school [4:50] where we can contribute non-perishable [4:53] food items some of us give out our [4:55] pockets and some of us have like [4:57] relatives that have small businesses [4:59] that donate to that and believe it or [5:02] not this year [5:04] the staff the administrative has told us [5:07] that there is a huge need and what they [5:11] have done was they put together a survey [5:13] where the students can go in confidence [5:16] they will go on a complete a survey [5:18] letting us know who is in need and what [5:21] they're in need of and it's on both [5:22] campuses it's on the ninth grade Center [5:24] and on the main campus as well so [5:28] this is very dear um of course FBLA does [5:31] a lot of Charity and yes we do solicit [5:34] donations but we give back as well and [5:37] I'm so excited to be the advice and I'm [5:39] so excited tonight I have our district [5:41] director and Miss Debbie sear here with [5:44] me she's [5:46] showed me the ropes and guided me [5:48] through this so I'm very thankful for [5:51] that our food box drive that we are [5:53] doing is of course during the month of [5:55] November it kicks off October 1st the [5:58] time for the students to leave for the [6:00] Thanksgiving holidays and you know a lot [6:02] of students are dependent on the free [6:05] breakfast and the free lunch so we are [6:08] going to start early at any time you can [6:10] do drop off there will be a box place on [6:13] both campuses for the non-perishable [6:15] food items of course items that they can [6:18] use if they don't have any electricity [6:20] we do have students that are homeless we [6:22] have students that are in shelters [6:24] and in foster care but we're trying to [6:26] do our best uh we are blessed to have [6:30] these things and we are giving back to [6:31] our community as well so we will be [6:34] doing that both November and December [6:36] and also [6:40] um these are just pictures from our [6:41] previous just to let you know that we're [6:43] just not up here talking we have [6:45] evidence of what we're doing and the [6:47] kids they enjoy giving back um this is [6:50] uh miss here and I we were at the Lake [6:52] Eustis nursing home and of course we [6:55] have their permission [6:56] um to post their pictures and we're so [6:58] thankful for the City of Eustis that [7:00] come out when we had our heritage [7:02] festival at the Eustis campus and also [7:05] we give back to the um uses Head Start [7:08] program and this is our food drive that [7:10] we're giving back now what we're asking [7:13] for because I'm so excited that we had [7:17] our first meeting and we had 15 new [7:21] students to want to be a part of it so [7:24] they were aware of what FBLA was doing [7:27] at uses and also the opportunities that [7:30] we're giving them we're very thankful [7:31] that we're again the local community to [7:33] partner with us they have businesses and [7:36] I'm so proud that over the summer one of [7:39] the local business here in Eustis hired [7:41] one of our students for the summer [7:43] program and another one that was in [7:45] Leesburg even though they were in Lake [7:47] County they hired our students so not [7:49] only are we being involved we're [7:51] competing nationally but we are training [7:54] our students in our CTE program to be [7:57] equipped and to be ready to [7:59] be productive citizens in Corporate [8:03] America as well we um we have combined [8:06] with um the encourage it's an [8:09] organization that is doing a survey to [8:11] see where our students want to go to [8:13] college offer them scholarships give [8:15] them those resources that in a normal [8:17] setting they would not get it so we are [8:19] very thankful that the FBLA students and [8:22] Entrepreneurship program at Eustis High [8:25] School we can get that stuff that makes [8:27] sure that this next generation will not [8:29] be a forgotten generation would not be a [8:32] Lost Generation because we are Village [8:34] Keepers and we are here to help equip [8:37] our students so I am asking if the City [8:40] of Eustis along with the entire Lake [8:43] County those that have small businesses [8:45] or are aware of a business if they can [8:48] give a donation [8:50] if they can give her a donation [8:52] um to Eustis High School to the FBLA [8:55] program we are going to be competing at [8:57] a local level a state level and [9:01] hopefully again this year on the [9:02] national level we're excited that this [9:05] year come November our elective officers [9:08] will be participating in the fall [9:10] National Conference which will be held [9:13] in Orlando so we're getting them early [9:15] to get them ready so I'm super excited [9:18] about that I'm super excited that [9:20] they're here learning about government [9:21] even though it is almost an election [9:24] year but every little bit helps and we [9:27] want them to be equipped we want them to [9:29] be prepared we're educating them that at [9:31] 16 you can pre-register to vote so we [9:34] want them to know everything that there [9:36] is to know and how to be successful [9:39] productive positive citizens so as the [9:43] FBLA advisor I am asking if you would [9:46] just think back you can process or when [9:49] you was in high school or when you was [9:51] trying to find that job did you not have [9:54] the tools that you needed to be [9:55] successful did you not know how to type [9:58] how to write a resume how to fill out an [10:01] application so remember our students of [10:03] Eustis High School [10:05] all the information is up there and we [10:08] do have flyers in different colors for [10:11] you to have and just to read over and [10:13] let you know what FBLA is all about and [10:16] like I said we are Village Keepers and [10:18] it takes a whole village as you can see [10:20] in the last three years it's taken [10:23] everybody it's taking the local grocery [10:25] store manager is taking Miss Jones [10:27] across the street it's taking the [10:29] babysitter you know the Publix person [10:32] the library and everybody to help shape [10:35] and mold our citizens our students for [10:38] the Next Generation they're going to be [10:40] the ones when we retire being the [10:42] decision making so we want to make sure [10:44] that they are equipped and they have [10:46] everything that they need to be [10:49] successful and I thank you so much for [10:51] your time Sonya thank you so much thank [10:54] you for what you're doing with that [10:55] program when I was in high school at [10:58] Eustis it was a strong program and [11:01] you're growing it back to what it used [11:02] to be so thank you so much thank you [11:04] would you like to introduce some of your [11:06] students law firm uh to [16:18] review some items related to our [16:20] comprehensive plan and the joint [16:22] planning area agreement with Lake County [16:24] and so we have here tonight Derek Bruce [16:27] and Jack Rice from gunster who are going [16:30] to talk to you a little bit about their research you should have received [16:36] some information from City attorney [16:38] Derek Shroff related to their findings [16:40] but they're here to present those [16:42] findings tonight thank you good to see [16:44] you my friend mayor good to see you as [16:46] well Commissioners a pleasure to be with [16:48] you all this evening and uh Tom thank [16:50] you very much for uh for that [16:52] introduction uh so on on this particular [16:56] assignment what uh what I thought would [16:58] be really beneficial is to uh is to [17:02] utilize when you have resources like our [17:05] firm does and that we can make available [17:07] to you we have people with with very [17:10] specific expertise and and the person [17:13] that that I thought would be best suited [17:15] for the for the assignment and the [17:17] research and giving you all the the [17:18] advice for which you were looking on the [17:20] map 19 issue is Jack Rice uh Jack has [17:24] been uh either legal counsel or special [17:27] counsel to five different uh uh cities [17:30] and and counties as well as has a [17:33] master's degree in in urban planning and [17:36] so he is intimately familiar with uh [17:39] with the issues that that you have asked [17:42] about and and really dove in so I'm [17:44] gonna turn it over to Jack who's got a [17:46] little presentation uh that uh [17:49] will hopefully give you all the [17:51] information you need and we'll be here [17:52] for questions as well thank you Gary [17:54] welcome Chad thank you thank you mayor [17:56] thank you Derek good morning good [17:58] evening everybody thank you for having [17:59] me [18:00] um [18:01] just as Derek said my name is Jack Rice [18:03] I'm attorney at gunster and I prime [18:05] practice primarily in the areas of land [18:06] use and Zoning I will warn you that I am [18:09] also a nerd when it comes to planning [18:10] and learning which means that there are [18:12] lots of details in my head so I'm going [18:15] to try to go through this as quickly and [18:16] succinctly as possible but feel free to [18:19] follow up and ask me some you know [18:21] general questions if you have any [18:23] um the first thing I kind of wanted to [18:25] look [18:25] kind of look at everything from a [18:27] sky-high view the questions that we were [18:28] assigned and what the results were and [18:30] then we'll kind of go into the details [18:31] so the first question that we were [18:33] opposed with was weather removal of map [18:35] 19 would invalidate the city of eustis's [18:37] jpa with the county the answer is no [18:40] resolution 87 34 that establishes the [18:44] jpa that is going to remain in effect [18:46] even if map 19 is removed from your comp [18:49] plan the reason is is because this [18:51] resolution is an independent legal [18:53] instrument it has a map attached to it [18:56] and that map identifies the areas where [18:59] the provisions related to [19:00] intergovernmental coordination [19:02] annexation and just general you know [19:05] joint planning occur so even if map 19 [19:09] is removed the jpa's obligations and [19:12] those boundaries will remain unchanged [19:13] because of the map attached to your [19:15] resolution that is still in effect with [19:17] the county [19:18] um the next question was whether removal [19:20] of map 19 would create some [19:21] inconsistencies or otherwise be [19:23] incompatible with the comp plans of [19:25] either the county or Eustis the answer [19:28] there again is No removal of map19 will [19:31] really create no inconsistencies with [19:33] either comp plan there is some text [19:35] within your own comprehensive plan that [19:37] will need to be changed just to avoid [19:39] internal inconsistencies which is as a [19:42] general policy matter your comp plan [19:44] will remain the same and will remain in [19:46] effect and it'll be fine [19:48] there will also be no issue if the [19:50] County's comp plan as I'll point out [19:52] during my presentation the County's comp [19:53] plan actually does not make reference to [19:55] the jpa with Eustis [19:59] in fact it after our review it actually [20:01] seems that if you removed map 19 it [20:03] would really offer a lot of clarity and [20:05] eliminate a lot of confusion and then [20:07] finally we were asked to look at math 19 [20:09] and the effect of the interlocal [20:11] agreement you all have with Mount Dora [20:13] and once again the answers no there [20:16] wouldn't be an issue there because your [20:18] interlocal agreement with Mount Dora [20:19] would continue to remain as a [20:21] freestanding legal agreement it has a [20:23] map attached and that agreement and map [20:26] have their own obligations which would [20:28] continue even if mat 19 is removed [20:31] um so to quickly go through things in [20:33] Greater detail [20:34] um resolution 8734 as we've just talked [20:37] about it today that's rather older [20:39] documents from July of 87. it was [20:42] executed by both the City of Eustis and [20:43] the county it allowed usages to Annex [20:46] properties into a jpa area that were [20:48] identified on a map that's being shown [20:50] on the screens in front of you it also [20:52] said that eventually that a jpa plan [20:54] would be mutually adopted by both the [20:57] county and Eustis and that that plan [20:59] once it was adopted would would [21:02] basically guide the growth for this area [21:04] and then one of the notable portions of [21:06] the resolution that says quote until [21:08] then the city and county and the interim [21:11] period will regulate development in the [21:13] jpa in accordance with their currently [21:15] adopted comprehensive plans in any [21:17] Amendment and when we started to go [21:19] through the history of the Eustis plan [21:21] it it we found basically in records that [21:24] the county never actually no Mutual [21:25] adoption occurred so the status [21:28] currently is zero resolution is what [21:30] governs until the two bodies come [21:32] together and are able to adopt a plan [21:34] and outline their future [21:36] and the way we found that out was we we [21:38] went back in history and we looked at [21:39] your first plan and what I'm showing up [21:42] on the map right now that is the one of [21:44] the maps that was attached and [21:45] identified in your first comprehensive [21:46] plan as the the map of the Eustis area [21:49] now I'm assuming everybody in this room [21:52] knows even better than myself that when [21:54] you look at that map that includes areas [21:56] that are not in the City of Eustis and [21:59] so what was interesting was when we [22:01] contacted the Florida Department of [22:02] Economic Opportunity which is the [22:04] current successor to the Department of [22:06] Community Affairs we were we had to go [22:09] through the record records and we were [22:11] told first a we found a memorandum that [22:13] you know recited the fact that the [22:15] county never adopted this plan but it [22:17] also said that you know this map created [22:19] confusion because it's got two different [22:21] sets two different jurisdictions within [22:23] it and it said only Eustis can basically [22:27] you know Implement planning designations [22:30] for properties in Eustis and by putting [22:33] designations for both useless properties [22:35] and the county in one you're creating [22:37] some confusion [22:39] and it appears that that that confusion [22:42] kind of persisted [22:44] um once again the original comp plans [22:47] memos or from DCA basically said their [22:49] recommendation was that you try to pull [22:51] the two maps apart so that you had one [22:53] that identified just properties and [22:55] Eustis and one that identified [22:56] properties in the other in the county [22:58] and the rationale was because the County [23:01] Properties could not be planned really [23:04] by Eustis and so like I said that [23:07] confusion appears to have persisted [23:09] because in 2010 when the city was [23:11] reviewing its comprehensive plan a [23:13] consultant came in and basically [23:15] suggested that you guys take the maps [23:17] apart and have one showing just Eustis [23:19] and one showing just County or just this [23:22] jpa area [23:23] but in effect what happened was you had [23:26] another map that was adopted showing the [23:29] both the planning designations for both [23:31] cities [23:33] um and so [23:35] what I'm showing on the map is basically [23:37] it's still map19 today it was adapted in [23:40] 2010 and it's still presently in your [23:42] comprehensive plan when we take a closer [23:44] look at it you can see that there are [23:46] some language and some policies in it or [23:49] actually referenced on it that kind of [23:50] show that this was probably never [23:51] intended to really become a binding plan that would you know [23:55] regulate this body so if we zoom in it's [23:58] not really showing up on this screen I [23:59] apologize but you'll see references to a [24:03] non-transmitted map a draft map a [24:06] working copy and so these basically tell [24:09] us what probably got happened what may [24:11] have happened was you know the wrong [24:12] document got put in when things got sent [24:14] off to the DCA to be adopted but in [24:17] effect the current the current document [24:19] just really creates confusion and it [24:21] doesn't need to be there and there are [24:24] other policies within your comp plan [24:26] that do address [24:28] um [24:30] I'm sorry the the do address the or [24:32] acknowledge the existence of the jpa so [24:35] even if map 19 was pulled out there are [24:37] freestanding policies within your [24:39] comprehensive plan that reference the [24:40] existence of that jpa and will continue [24:42] to continue to bind you and also [24:46] basically show the city's commitment to [24:48] work with the county within the jpa area [24:50] for purposes of annexation and [24:52] intergovernmental coordination [24:54] before we really you know opine on you [24:57] know the effect it will have on the [24:58] county plan we had to look at the county [24:59] plan and what we found was the county [25:01] plan really doesn't mention the jpa with [25:03] Eustis we know that the county is aware [25:06] of the resolution and that they [25:08] currently consider it to still be in [25:10] effect but the comprehensive plan itself [25:12] it doesn't make any mention of the jpa [25:14] what I'm showing on the screen right now [25:16] is the future the County's future Lane [25:17] use map exhibit number five which [25:19] identifies the various joint planning [25:22] areas within uh the County's [25:25] jurisdictions and what you'll see is it [25:28] shows jbas with Lady Lake Claremont and [25:31] Mount Dora but not Eustis and that's [25:33] likely because the county is aware just [25:35] like I said before that the resolution [25:36] itself continues to kind of stand on its [25:39] own and bind the two entities [25:41] um and so in regard to the first two [25:43] questions it's pretty clear that removal [25:45] of map 19 would not create any [25:47] inconsistencies with Eustis or the [25:49] county plans [25:50] if anything it will create you know [25:53] Clarity for individuals when they're [25:55] looking at the Eustis plan and it will [25:57] really kind of clear things up because [25:58] the one thing you'll have which will [26:00] continue to bind that you can point [26:02] people to is the original resolution [26:04] which is what set all of this up [26:07] um in regard to Mount Dora [26:09] which is which is what we're discussing [26:11] you know question number three [26:13] um mount doors basically you guys have [26:15] an interlocal agreement with them you [26:17] entered into that into local agreement [26:19] in 2003 it expires in December of 2023 [26:23] unless it's terminated it is an [26:26] automatically renewing agreement and [26:28] what does it do it sets out purposes and [26:30] terms for planning providing utilities [26:32] as well as intergovernmental [26:33] coordination and most notably it says [26:36] that Eustis and Mount Dora will not [26:38] Annex any property in each other's [26:40] planning areas and identifies that [26:42] planning area by resort to a map that [26:44] I'm showing on the screen [26:46] and [26:48] it basically it says that you know this [26:51] map will take effect once Eustis [26:53] acknowledges it and once the county got [26:55] I'm sorry once Mount Dora acknowledge it [26:57] and their comprehensive plans you have a [26:59] text provision and your comprehensive [27:01] plan I believe it's intergovernmental [27:03] coordination policy 1.3.5 which [27:06] basically States or recognizes the [27:07] existence of the interlocal agreement it [27:09] says that you will continue to work with [27:12] it and be bound by it and that you'll [27:14] continue to work with Mount Dora to uh [27:16] to honor it so Eustis is fulfilled it's [27:19] part of the bargain in that regard what [27:21] is the mount doors comprehensive plan [27:23] say again it's got language [27:27] I'm sorry this is the language in the [27:29] Eustis comprehensive plan that [27:30] acknowledges the existence of the jpa [27:32] not the jpa with the interlocal [27:33] agreement [27:38] and next I have the language and the [27:40] Mount Dora comprehensive plan that talks [27:42] about and acknowledges the existence of [27:44] the interlocal agreement with Eustis [27:46] so if you remove map 19 you won't be [27:49] touching this these languages in either [27:51] comprehensive plan those will continue [27:53] to be in existence and you'll continue [27:55] to be bound by the interlocal agreement [27:57] and it really won't have any effect on [27:59] the interlocal agreement status with [28:02] Mount Dora [28:04] um so that's kind of how we got to our [28:06] answers I've I know I've set them out in [28:07] Greater detail but I hope I haven't [28:08] bored you all to death if you guys have [28:10] any questions I'm more than happy to [28:12] answer to them and it's been a pleasure [28:13] to look into both y'all's histories and [28:16] futures [28:17] any questions subject [28:20] yeah good job he brought Clarity for me [28:24] because I I read every Phillips [31:26] and I represent a few families here in [31:28] the Eustis area and surrounding [31:30] communities and we would like to thank [31:32] the City commissioners for taking time [31:34] once again to hear the concerns of [31:36] residents in regards to keeping backyard [31:38] chickens within Cinemas city limits [31:40] we've heard your concerns and Views [31:42] about keeping chickens in the previous [31:43] meeting and we are under the under we [31:47] are of the understanding this has been a [31:49] reoccurring issue it's it seems like it [31:51] continues to come up over the years uh [31:53] we'd like to help overcome this obstacle [31:55] and move forward together I assure you [31:57] although we might ruffle some feathers [31:59] we won't pluck you I had to I had to I [32:04] can't fall so first when we speak about [32:07] chickens we're referring to keeping and [32:09] not raising uh hens in the backyards no [32:11] roosters this keeps our dialogue clear [32:13] of potential agricultural concerns which [32:16] were brought up in the past and [32:18] regulations as residents of this city [32:20] and members of the surrounding [32:21] communities we are respectfully offering [32:22] the city our recommended guidelines for [32:24] keeping backyard chickens members of our [32:27] safety and preparedness team our [32:29] education team and our Civics team have [32:31] researched and collaborated on these [32:32] proposed guidelines an effort to assist [32:34] and streamline the ordinance and code [32:36] writing processes our group has analyzed [32:39] almost 50 cities and counties here in [32:40] Florida that allow for the keeping of [32:42] chickens [32:43] it turned out to be quite the Endeavor [32:46] but a phenomenal exercise and experience [32:48] for us nonetheless we compared we tried [32:52] our best I promise we compared City [32:55] areas populations population densities [32:57] as well as traditions and culture [32:59] we found little to no correlation [33:02] between them we then compared the [33:04] different city codes and ordinances [33:06] guidelines and requirements in a gown [33:07] again found no real solid consistencies [33:11] there we did however find wordy verbiage [33:14] gratuitous regulations and excessive [33:16] educational requirements for something [33:17] humans have been accomplishing for [33:19] literally thousands of years I'm sure [33:20] that's been brought to your attention [33:21] here in the past as well therefore we [33:24] decided to use the same search and [33:25] comparison criteria for these guidelines [33:27] for the city of use of space on our [33:28] experiences conducting the research [33:30] reviewing dialogues from blogs websites [33:33] and various academic institutions [33:35] we believe in the kiss rule keep it [33:37] simple super simple so we have limited [33:39] our list to 10 guidelines [33:41] this is done with intent as it allows [33:44] for the people to govern themselves [33:45] accordingly [33:46] and it allows for the city and the [33:49] future to impose further governance [33:50] where it may be needed in the community [33:53] do you want me to read these 10 real [33:55] quick that's entirely man's like nope [33:59] I already read the 22-page dissertation [34:02] oh you poor thing I'm glad I missed that [34:04] if you'll give it resolution 22-68 a resolution of the [34:35] city Commission of the City of Eustis [34:37] Florida approving a code enforcement [34:39] board action to authorize the City [34:40] attorney to foreclose on an outstanding [34:42] code enforcement lien recorded against [34:44] 44 sharp Circle LLC [34:47] believe Mr Martin so I I can start off [34:50] maybe give you some general background [34:53] um so this case has been going on uh for [34:57] about a year you have in your packet the [35:00] initial case history for this case [35:03] September 14th of 2021. [35:06] there have been quite a few visits to [35:10] the property by code enforcement [35:13] um [35:14] based on [35:16] this particular issue is related to the [35:20] conditions of a rental unit there over [35:25] the past year there's been a lot of [35:27] discussion with the property owner about [35:29] whether the property would be renovated [35:32] and rehabilitated or whether whether the [35:35] property would be demolished it remains [35:38] an outstanding issue [35:40] and [35:42] excuse me [35:44] um it has as you can see from your [35:48] information it's gone to the code board [35:50] quite a few times [35:52] the code board on August 8 2022 [35:57] considered moving forward with a [36:01] foreclosure on the lien they approve [36:05] that [36:06] again just a little bit of background [36:08] you we forwarded to you some [36:11] correspondence with a representative of [36:14] the property owner that representative [36:16] was questioning uh due process I will [36:21] tell you that both at the code board on [36:24] August 8 2022 the question came up as to [36:27] whether the code board was authorized [36:29] based on due process to move forward [36:32] with this and the code board attorney [36:35] assured the code board that they were [36:37] able to move forward with this if they [36:40] so chose and they did move forward with [36:43] that the question has been raised and I [36:46] know uh Sasha has had some discussions [36:49] with their representative I'm [36:51] paraphrasing what Sasha and I discussed [36:54] which is uh we feel that it is [36:59] appropriate for the city commission to [37:01] move forward with this if they so choose [37:04] the prop the representative of the [37:06] property owner has asked that it be [37:08] continued until October 6th but that is [37:12] completely at the discretion of the city [37:15] commission we do have a couple people [37:17] who have given cards who want to speak [37:19] on this item [37:21] code enforcement [38:18] issues unrelated to this specific case [38:21] that we're also dealing with out there [38:23] and so we'd be happy to try to answer [38:25] any questions you may have [38:27] I think we start with Derek okay Eric [38:30] sorry okay all right Garrett yeah [38:35] good evening Commissioners Eric Martin [38:37] code enforcement supervisor [38:40] so [38:41] basically I'm just here to kind of do a [38:44] ask an answer I do know we have some [38:47] more residents in today's tonight's [38:49] audience that did not fill out a card so [38:52] you know I guess when they come in I [38:54] guess I can just before they leave fill [38:56] one out is that how it would work we um [39:00] I think I think we we can just call them [39:02] up as long as they State their name [39:05] um that that's fine they don't have to [39:06] fill out a card so the first thing I did [39:09] this morning when in preparation for [39:11] tonight I the park obtained ownership of [39:15] the property in February 2019. since [39:19] then there have been 18 total code [39:21] violations at that location [39:24] but for numerous violations and we can [39:27] go into the details if you if you wish [39:29] us to but the item today is a [39:33] three-sharp circle [39:51] let me pull that one out I've got a [39:56] lunch [40:07] so basically on September 14 2021 the [40:11] city received a code enforcement or a [40:14] lieutenant complaint about the [40:15] conditions of this mobile home and [40:18] dwelling unit when we went in and [40:20] inspected it we saw some very severe [40:23] electrical hazards [40:25] here like in picture two they had an [40:29] extension cord on a plug outlet and it [40:31] ran all the way through it was run all [40:33] the way through the front porch [40:34] underneath the mobile home and into an [40:37] outlet inside the mobile home and it was [40:39] running power or running a light or of [40:41] some sort on the on the patio there were [40:44] issues with the stairs not being secure [40:46] not being centered on the doorways [40:49] um the main issue was there was a water [40:51] leak in the toilet room and you'll see [40:54] here in picture eight that is an actual [40:57] electrical wire coming down [40:59] and as you see here in picture nine it [41:02] is hot [41:03] so there was a water leak so the [41:05] toilet's leaking water all over the [41:06] floor there's no um [41:09] impervious surface in that bathroom it [41:12] was just pretty much hot-nosed pieces of [41:14] plywood [41:15] and anyone that has sitting on that [41:18] toilet you know your water's leaking [41:22] around you you've got live wires within [41:24] Arms Reach of you so we were really [41:27] concerned with the life safety of the [41:30] tenant at that point [41:31] so we here's showing just some water [41:34] damage some some surface damages [41:38] uh in this in this and you know looks [41:40] like an old roof leak [41:42] um so throughout the mobile home we we [41:44] continue to find more electrical hazards [41:47] throughout [41:50] so this was inside a cabinet this one [41:52] was in over the stove this was over the [41:56] uh [41:57] there was one over the coffee maker [41:59] there were two exposed electrical wires [42:02] on the uh in the living room [42:07] there was a plug outlet they had [42:10] completely come dislodged and was laying [42:11] inside the wall [42:13] and there were other electrical [42:15] violations that don't meet the National [42:17] Electric Code [42:18] so when I notified the building official [42:20] loved the conditions he authorized Duke [42:23] Energy to terminate the power on that [42:26] dwelling unit immediately that day [42:28] so it's been off ever since [42:31] um [42:31] and this is owned by that's owned by [42:34] sharks mobile home park okay that that [42:37] was thank you [42:40] Eric Were you invited in by the the yes [42:43] the tenants signed a consent to allow us [42:47] to to go in and inspect her dwelling [42:50] um we don't the city has never taken [42:52] lightly condemning and owner-occupied [42:55] residential dwelling the last thing we [42:57] want to do is put someone out on the [42:59] street but in this case there was there [43:01] was no avoidance [43:03] so [43:04] um these pictures here show where [43:07] the property owner eventually did come [43:09] in and get a repair permit [43:11] and they started fixing the bathroom [43:13] and then all works seized the building [43:17] official had determined that the scope [43:19] of work in the permit was not adequate [43:21] to bring the mobile home up to code [43:24] okay I'm sorry I thought I I am but go [43:27] ahead and finish [43:28] um [43:29] so [43:31] the property owner decided instead of [43:34] bringing it up to code they decided they [43:35] were going to demolish it well that's [43:37] been ongoing for eight or more months uh [43:42] so [43:43] without digging into my dig deep into my [43:47] notes I do know there's a pending [43:48] demolition permit on file [43:51] to take you know three and unit five out [43:54] so there were concerns when the park [43:56] manager came and testified in August [43:59] they were concerned about the type [44:01] proximity and working around the [44:04] neighbor's fence asking them if they [44:06] could take it down so they could get [44:07] equipment in it it sounds to me like [44:09] they've just decided to take unit five [44:11] out so they can get to unit 3 and take [44:13] it out which is definitely that's two [44:16] for one [44:17] so that's that is pending I believe the [44:21] only thing they're waiting on is the [44:22] utility disconnects but I don't know why [44:24] that's taking so long question for you [44:28] um you had correspondence with the owner [44:31] correct [44:32] I spoke to the property manager [44:36] personally I don't believe I've spoken [44:38] to the property owner about this [44:40] particular case [44:42] I haven't spoken to the property owner [44:44] probably since 2020. [44:46] um most of our most of our [44:48] correspondence is directly with the [44:50] property man so this shouldn't come as a [44:52] surprise to them [44:54] no at least headquarters or you know [44:58] that this is a problem right okay so and [45:02] you sent [45:04] letter after letter getting into getting [45:07] to it now okay good all right I will say [45:11] this because looking at the email [45:12] correspondence then I looked through all [45:14] this all of this stuff [45:17] um the actually owner [45:19] I think it's been changed twice now said [45:21] here's the new representative send [45:22] everything to them send everything to [45:24] them so he's aware yeah yeah right and [45:28] now he's shoving it off on exactly [45:30] somebody else two other people [45:34] so on September 23rd we pretty much just [45:38] basically sent out a correction notice [45:40] that had a list of a full list of the [45:42] diff all the deficiencies [45:44] um requiring that they correct them by [45:46] October 25th 2021. [45:50] when they failed to do so we sent out a [45:53] formal notice of violation slash hearing [45:55] on November 4th requiring compliance [46:00] with the housing code by December 6 2021 [46:04] or there be a code enforcement Board [46:06] hearing on December 13th [46:08] so went to the code enforcement board [46:11] and here is I've got copies of the [46:14] notices the so the thing is [46:17] the the [46:19] address listed in Lake County [46:22] those those notices were being returned [46:24] under undeliverable as addressed so we [46:26] also started mailing them to registered [46:28] agent which is Hansel Rodriguez so the [46:31] one that we mailed to Hansel Rodriguez [46:34] it was delivered on November 6. at his [46:37] office [46:37] we also posted a copy of that notice of [46:40] violation on the manager's door on the [46:43] same day [46:44] is their own site yes it's uh it's [46:48] addressed 44 sharp Circle actually it's [46:50] right it's the building right next to [46:52] where if you drive in you got your [46:53] mailboxes and and so forth is right next [46:56] to the two-story kind of Warehouse [46:59] uh so on December 13th 2021 the code [47:03] enforcement board issued an order of [47:04] enforcement for acquiring compliance by [47:10] January 12 2022 or a fine of 250 per day [47:14] of occurrence would be imposed [47:16] so that deadline expired [47:19] on January 28th 2022 the city issued a [47:24] notice of non-compliance and I noticed a [47:26] hearing for assessment of fine [47:29] so that was held on February 14 2022 [47:34] where the code enforcement board [47:35] officially issued the order imposing [47:38] fine and that was recorded in public [47:40] record on April 13 2022. in every [47:43] correspondent set that we send we tell [47:46] them they have the opportunity to come [47:47] before the code enforcement board [47:49] correct [47:50] yes that's what that's what the notice [47:52] and hearing is for okay and have they [47:54] ever [47:55] the um [47:57] yes they have and let me get to the [47:59] staff report [48:02] I believe [48:16] okay on the first hearing that was held [48:18] on December 13th there was no [48:20] representative the tenant the tenant [48:22] showed up but the no representative from [48:24] 44 Sharps LLC [48:26] and then on [48:34] I think the property manager did attend [48:36] this one I don't have it into my note [48:38] hold on yeah I do [48:44] can I oh that's a good question real [48:47] quick actually yes ma'am are we we're [48:49] closing number three sharp Circle or [48:52] number 44. no it's it's the lien is [48:56] against the entire property it's all one [48:58] product it's all one property it's the [49:00] name of the corporate the LLC is 44 [49:02] Sharps Circle LLC [49:07] thank you Eric that's it [49:11] you know I know you're looking for that [49:13] but what I'm trying to get is [49:16] they've known from the beginning that [49:19] there were deficiencies yes you [49:20] corresponded with them they've gone in [49:23] and they attempted to make some repairs [49:27] right they as you see they saved off the [49:30] um if you I didn't point it out because [49:32] I don't believe I don't think I [49:35] So within two days of us being in there [49:38] they did get an electrician and they [49:40] saved off all the wiring put them in [49:42] metal boxes as you see in these photos [49:45] well [49:46] some of these photos here but so all the [49:48] exposed wires the that plug outlet was [49:51] not fixed but any of the exposed wires [49:53] are hanging down they did put in metal [49:56] boxes and cap them off [50:00] so the issues [50:03] they should have known [50:05] with continued correspondence and [50:08] communication with you right that all of [50:10] the issues hadn't been taken care of [50:12] correct correct so it should come as no [50:15] surprise to anyone [50:18] that the City of Eustis code enforcement [50:21] board meant business right okay all [50:23] right [50:24] is there more [50:26] bold I didn't witness any [50:29] some of it looks kind of dark like that [50:31] might be how long and and you might not [50:34] know this and I don't know if anybody [50:35] who lived in this unit is anybody here [50:37] that lived in this unit [50:39] only Donna Manning she lived in it she [50:41] was the complainant but before that I [50:44] don't know who owned it or how long did [50:46] you live like this man you can't do that [50:48] oh no I can't all right I just wondered [50:50] how long this has been do you know how [50:51] long this has been going on [50:53] all I know is the date that we receive [50:55] the complaint okay [50:57] I can tell you that Donna Manning has [50:58] filled out a card to speak there you go [51:00] that's what all I knew she did that's [51:02] why and I'm sorry when she stands up you [51:04] can do it okay [51:13] and the concern that [51:15] um [51:17] well the issue that [51:19] they're trying to raise is they didn't [51:21] get noticed they didn't have enough [51:23] notice yes they're raising the concern [51:26] that they didn't get notice about the [51:28] Foreclosure hearing [51:30] but the Florida Statutes doesn't require [51:33] any notification for the Foreclosure it [51:36] just simply states that the code enforce [51:38] the after an order is imposed the city [51:42] can record that in public record as a [51:44] lien against the property and after 90 [51:47] days the code enforcement board can [51:49] authorize a City attorney to foreclose [51:51] on the unpaid lien [51:53] okay and so all the notification [51:55] requirements start at the beginning we [51:57] do notice of uh we do requires it's like [52:01] if when a code enforcement officer [52:02] identifies a violation we're required by [52:04] a statute to notify the property owner [52:07] of the violation and give them a [52:08] reasonable time to correct it and if [52:10] they don't then we schedule a hearing [52:12] and that's when we're we're required to [52:15] send out the certified notices return [52:17] receipt postings hand delivery any way [52:21] you can try to get get notice out to the [52:24] property owner [52:25] and then that's for the first hearing [52:28] now this there's no there's no [52:30] requirement for a second Hearing in [52:32] chapter 162 but we do a second hearing [52:36] for notice of non-compliance for due [52:39] process reasons I think it's to comply [52:40] with Florida Statutes 219 is that the [52:43] due process section yes and it's also [52:45] chapter 162. well yes [52:48] um [52:49] so [52:52] then we have that hearing and that's [52:54] pretty much the last hearing until we [52:57] bring it back to the code enforcement [52:58] board for consideration of foreclosure [53:00] and traditionally we've never given [53:02] notice for that [53:04] and and [53:07] our correspondence with them they know [53:10] that foreclosure is going to be a [53:13] possibility correct so in the notice of [53:17] non-compliance [53:19] that was issued [53:24] on January 28th [53:26] all our letters go out with a cover [53:28] letter and here it says to stop accrual [53:31] of the daily fine the property owner [53:33] must the property must be brought into [53:35] compliance if compliance is not met and [53:37] the accrued fine is not paid within [53:39] three months of the date of the [53:40] recording the order of the recording of the order imposing fine the [53:46] property may be subject to foreclosure [53:48] proceedings and sold to enforce the lean [53:50] January 28th of this year yes sir okay [53:56] and the [53:57] discovered by the statue everything's [53:59] yes and I did speak to Mr Arbiter [54:01] yesterday about this um and statutorily [54:04] we've complied with everything that [54:06] we're required to do we're not required [54:07] to provide additional notice uh he's [54:09] asking for something that is in excess [54:11] of what we're required to provide the [54:14] property owner so as far as due process [54:16] is concerned we're covered now of course [54:18] it's this is up to the commission it's [54:20] completely discretionary if you wanted [54:22] to push this off to the next meeting [54:24] because this is what he's asked for [54:25] however it's not an opportunity for him [54:26] to challenge the findings of the code [54:28] enforcement board that's already been [54:29] determined and that was part of the [54:31] order that was recorded and is the lien [54:33] against the property simply it would I [54:37] guess be an opportunity just to try to [54:38] avoid the expense of the Foreclosure [54:41] should they somehow comply in the future [54:45] I am you know it's it surprises me that [54:49] uh you know we give them all this time [54:51] to to fix it and they don't do anything [54:54] but they want us they want us to give [54:56] them more time to do [54:58] yeah yeah I'm not right and the attorney [55:00] did attend the August 8th uh code [55:03] enforcement Board hearing there were [55:05] some other items on the agenda for Sharp [55:08] Circle that day so their attorney was [55:10] present he asked the board for [55:13] um continuance before they considered [55:16] doing a motion for foreclosure which the [55:18] code enforcement board denied his [55:20] request so you said there's 18 current [55:23] there's eight no there have been 18 [55:24] violations [55:26] since February [55:28] 2019 when occurring okay so right now [55:33] um I also put some [55:36] other open and unresolved violations so [55:40] there's a minimum housing code violation [55:42] against unit number 26. there's a [55:45] violation for an unsafe power pole and [55:48] there's an active code violation for the [55:50] condition of the roads is that powerful [55:52] still leaning today I'm sorry is that [55:54] power pole still leaning uh it's it's [55:57] still propped up they had not they have [55:59] not fixed and we walked that property [56:01] July 1st and we know we told them so [56:04] what happened on July 1st we had a storm [56:07] come through the night after we walked [56:09] through it and the power pole that was [56:11] right next to the the unit that is at [56:15] the main entrance that was blown over [56:17] during the storm [56:19] so they fixed that one immediately I [56:22] drove through on July 5th [56:24] and I'm actually there it is right thank [56:28] you yeah [56:29] so on July 8th when I'm driving by I see [56:32] this 2x4 propping up this power pole and [56:35] I'm thinking what's going on here so I [56:36] get out and I touch it and just from [56:39] touching it almost fell over so that's [56:42] what I called the building inspector out [56:43] I had him take a look at it and I have [56:45] to resist a life safety issue and he [56:47] says absolutely so [56:50] this is steel like this yes yes [56:54] been that way since July 8th so there's [56:57] been a lien recorded on that one [56:59] recently [57:00] for [57:05] so that's 528. here Eric this this is a [57:09] public safety and a health hazard and [57:12] the attorney has told us that we have [57:15] that I can ask for this place to be [57:17] totally shut down and I'm willing to [57:19] sign in order to shut it down if they [57:21] can't get it together right it's [57:23] absolutely ridiculous [57:26] that we're allowing this to go on that [57:28] we're allowing our citizens to live like [57:30] this [57:31] so if this isn't done quickly I will [57:35] sign an order to shut the place down now [57:37] we're going to find places for people to [57:39] live yes but this is absolutely [57:40] ridiculous and for an attorney to [1:01:03] believe there one or two days [1:01:05] and the notice was hand delivered to the [1:01:08] property right after the code [1:01:09] enforcement board's ruling [1:01:12] at the last code enforcement board they [1:01:14] brought an attorney with a recorder that [1:01:17] would challenge the code enforcement [1:01:18] board with respect to not respecting due [1:01:22] process [1:01:24] we have never [1:01:26] on any occasion not given anybody who [1:01:29] appears in front of the code enforcement [1:01:31] board due process we have obtained and [1:01:34] listened to numerous complaints by [1:01:38] residents of the property who are forced [1:01:41] to live in property like this who are [1:01:43] then punitively dealt with because [1:01:47] they've complained to the city because [1:01:49] our board has taken action against them [1:01:51] and the manager has personally appeared [1:01:54] the new property manager they've had [1:01:55] several new property managers appeared [1:01:58] at the last at least two that I'm aware [1:02:00] of and uh [1:02:02] mayor Holland I couldn't agree with you [1:02:04] more [1:02:05] this is not what the City of Eustis or [1:02:08] its residents whether they're renters or [1:02:10] property owners deserve or should be [1:02:13] subjected to [1:02:14] answer any questions if you have any do [1:02:16] you have a question and I don't know if [1:02:17] you know this off the top of your head [1:02:19] how many if if we did [1:02:22] the shutdown how many people will be [1:02:25] displaced I really couldn't answer that [1:03:12] that they're fighting us is because once [1:03:15] a trailer is condemned the plane is [1:03:18] placed against it and we order it to be [1:03:21] demolished it cannot be replaced because [1:03:23] they are over their density [1:03:26] and so that's one of the big issues that [1:03:29] their attorney and others have tried to [1:03:31] confront the code enforcement board with [1:03:33] is because once we order a unit that is [1:03:37] as disgusting as those you've seen to be [1:03:40] knocked down they cannot replace it so [1:03:42] that's a loss of income obviously as she [1:03:44] said it's [1:03:47] when I spoke to the day that we were out [1:03:50] there and I was speaking to miss Morales [1:03:52] and I was just brought up the condition [1:03:55] around some of the parks why the park [1:03:57] management isn't making sure making sure [1:03:59] it's residents are keeping the area [1:04:00] around their mobile homes clean and [1:04:02] sanitary and she told me that's a city's [1:04:04] job [1:04:06] um so how many how many um [1:04:10] how many of these trailers have you been invited into oh [1:04:15] just uh just number three and number six [1:04:18] I mean it's number three and number 26. [1:04:20] is it possible to do and I don't know if [1:04:22] this is something we want to look at [1:04:23] doing is it possible to do like a little [1:04:26] town hall meeting [1:04:27] with them with just Sharp's Park to talk [1:04:31] to them and to possibly get into all of [1:04:34] these units well that's something that I [1:04:36] want that's one of the focuses that [1:04:37] we're going to have I sent on July 5th I [1:04:41] sent Miss Morales an email asking for a [1:04:43] list of all of all the park owners so I [1:04:47] could determine which which mobile homes [1:04:49] are privately owned and which ones the [1:04:51] park owns yes and I didn't receive [1:04:54] anything when I when I'd hand delivered [1:04:55] that life notice of Life Safety [1:04:57] violation I asked her about it and she [1:04:59] pretty much told me that I'm going to [1:05:00] have to go to the vice president or you [1:05:04] know the [1:05:05] she it was not within her authority to [1:05:07] provide that information I would have to [1:05:09] go to the property owner Hansel [1:05:11] Rodriguez or the the director of [1:05:13] operations to to get it [1:05:17] you can't because it's all in the land [1:05:19] industry and you can't it's not like [1:05:21] real property a mobile home is [1:05:24] um defined under State Statute as a [1:05:26] vehicle that's licensed through the [1:05:28] Department of Motor Vehicles so my [1:05:30] office [1:05:31] no they don't on the land so my office [1:05:34] can't go you know for real property we [1:05:36] can go to the Lake County Property [1:05:38] Appraisers website [1:05:40] search it find who the owner of record [1:05:42] is and send notice out to them well for [1:05:45] mobile for mobile homes we don't have we [1:05:47] don't have that capability we don't [1:05:48] there's no way for us to find you know [1:05:50] we could run the tag but I bet half the tags in that mobile home are [1:05:54] expired yeah it seems like we have a [1:05:56] good representative group tonight we [1:05:58] should be able to give us some feedback [1:05:59] yeah and be able to get the word out to [1:06:01] everyone else yeah yeah [1:06:03] I would I I do want to ask um so we have two types of units in here we [1:06:08] have units that are owned by the [1:06:10] occupants and then we have units that [1:06:12] are owned by the park that they rent out [1:06:14] if we were to take code enforcement [1:06:16] action against a unit that is owner [1:06:18] occupied is it the owner occupant that [1:06:21] is being cited or is it the property [1:06:24] owner that's under Florida statute the [1:06:26] city cannot [1:06:28] um impose fines against a park owner for [1:06:30] a violation that's created by a mobile [1:06:32] home owner [1:06:34] so it would be against the mobile [1:06:35] homeowner yes okay but we don't know how [1:06:39] many [1:06:40] well like I'm sorry we don't know how [1:06:43] many 44. [1:11:13] the property manager the current [1:11:14] property manager filed an eviction [1:11:16] against me on the 12th of September [1:11:19] stating that my monthly rent is 524. [1:11:23] it was dismissed by the judge because [1:11:26] it included somebody else's paperwork so [1:11:29] the judges missed it she went and [1:11:31] refiled it [1:11:32] the following week following Monday now [1:11:34] it's 5 42 so she doesn't even know so [1:11:36] how do I know what my rent is Hispanic [1:11:39] what does that include [1:11:41] what what does your rent include it's [1:11:43] supposed they do pay the electric okay [1:11:46] um and it's supposed to include Lawn [1:11:48] Care my grass right now is [1:11:50] I know what about water you pay your own [1:11:54] water or what [1:11:55] um no yeah we pay 67 a month water [1:11:57] that's the base rents like 475 and then [1:12:00] 67 water do you pay 67 to the city or to [1:12:04] the yeah we pay it all to the park you [1:12:07] pay it to the park it's it's a Master [1:12:09] Meter so one meter [1:12:11] um 67 what do you pay [1:12:13] 60 [1:12:15] 67. 67 a month there's 119 units in [1:12:20] there but Jacksonville or Gainesville or [1:13:03] something some inspectors 26 sharp [1:13:06] Circle and 209 sharp Circle have no VIN [1:13:09] number on them they're not titled [1:13:11] and they can never be sold [1:13:15] but I I'm thinking that maybe because [1:13:17] they're on their property they have the [1:13:19] right to rent them I don't know that I [1:13:20] don't know the laws [1:13:23] um [1:13:25] so I'm not sure how that works but those [1:13:27] are the only two rentals and I did [1:13:28] receive [1:13:29] a letter from their attorney Mr Arbiter [1:13:33] on um the well [1:13:35] I about a prohibitive practice case [1:13:37] against them they turned my electric off [1:13:39] the week of Christmas last year [1:13:41] the the previous management yeah no [1:13:43] warning nothing 40 degrees at night no [1:13:46] heat nothing [1:13:48] so I found a prohibited practice case [1:13:49] against them and I settled out of court [1:13:51] with them [1:13:53] three days later I got a letter in the [1:13:55] mail saying we are no longer renting it [1:13:57] after September 30th you need to be out [1:13:59] on September 30th [1:14:01] after all they've put me through and now [1:14:02] they throw him out on the street because [1:14:04] all of a sudden it's not September 30th [1:14:07] of this month that you've yes ma'am [1:14:09] you're going to be evicted I got it I [1:14:10] was posted on my door today from the [1:14:12] sheriffs [1:14:13] I have a question [1:14:16] um [1:14:19] is an entity that does not have a water [1:14:22] service let's just say like you know we [1:14:24] have our own water and we pay when [1:14:26] they're collecting are legally is the [1:14:29] park allowed to make money [1:14:31] off of their water [1:14:33] I'd have to check um normally they [1:14:35] charge what what the actual expense is [1:14:38] um there might be a minor fee that they [1:14:40] can charge for administration normally [1:14:41] but I don't know about making money [1:14:43] that's not something [1:14:45] yeah every Public Services I can double [1:14:47] check [1:14:48] we have one meter how do you yeah yeah [1:14:51] every time I pay 67 dollars my [1:22:24] mail and was coming through the park and [1:22:27] I noticed it laying down so I kept my [1:22:28] car parked there and I called Duke [1:22:31] Energy and different things to try to year [1:23:09] to pay property taxes of the past two [1:23:12] years [1:23:12] has been added onto our flat rate [1:23:15] so mine right now is 570 dollars a month [1:23:19] I make about a thousand three hundred [1:23:21] months I'm being evicted next week [1:23:23] because I cannot afford the lot rent [1:23:27] and I'll be homeless because I have no [1:23:29] place to go [1:23:30] and there's like four other people in [1:23:32] the park that are also being evicted [1:23:34] because we can't afford and we're [1:23:36] getting behind on a rent [1:23:40] and I live next to the three empty ones [1:23:43] by the railroad tracks for two years [1:23:46] they don't keep the grass and weeds [1:23:48] around the trailer kept up I tried doing [1:23:50] it I get full of splinters and Spurs and [1:23:53] everything from the weeds and the little [1:23:55] Sanders [1:23:56] the grass is now getting up to our hips [1:23:59] and if we do it I asked the manager for [1:24:03] um a discount on my rent because I'm [1:24:06] doing my own lawn even if it's sweet [1:24:07] with a weeder she said no you're doing [1:24:09] that out of the kindness of your heart [1:24:12] okay that I can't get a discount on my [1:24:15] rent even though it was in the main [1:24:16] paperwork we get [1:24:18] I live next to those three empty [1:24:20] trailers for two years [1:24:22] I am the one that went and re-boarded up [1:24:25] number three because of homelessness [1:24:28] constantly going in there in the middle [1:24:30] of the night to do whatever they do and [1:24:33] how can we sleep restfully when we don't [1:24:36] know what's going on next door to us [1:24:38] whether someone's gonna break in or [1:24:40] whatever or the place is going to burn [1:24:42] down because who knows what they're [1:24:44] doing [1:24:44] it took me a half a day with a herniated [1:24:47] disc to board that trailer up completely [1:24:50] so they could not get in there [1:24:55] and a lot of the owners most people own [1:24:59] their trailers there and what he was [1:25:01] saying about coming in to inspect [1:25:03] everybody's place that the owners would [1:25:06] be the ones to get and find if there's [1:25:07] any no that's a problem we were just [1:25:10] concentrating on trying to find the ones [1:25:12] that were owned by the mobile home park [1:25:13] okay because owners we were trying to [1:25:16] find out who the ones were so we could [1:25:18] separate those out and do a process of [1:25:20] elimination and find out which ones the [1:25:23] park actually are because I would say [1:25:24] that the owners would probably be [1:25:26] reluctant to let you know them come in [1:25:27] and check because who knows how long [1:25:29] they've been there and with our limited [1:25:31] [1:31:06] you've been provided a staff report [1:31:08] regarding commission compensation this [1:31:11] is based on the conversation of the last [1:31:13] commission meeting where the commission [1:31:14] asked staff to make a recommendation [1:31:15] based on area municipality wages paid to [1:31:19] Commissioners and the mayor [1:31:21] brief summary is we've recommended [1:31:25] the current amount for the commission is [1:31:27] fifty four hundred dollars a month a [1:31:29] year excuse me uh that was a year now to [1:31:33] make a difference [1:31:36] yeah you want to see 400 annually [1:31:39] as we said that was last adjusted in [1:31:42] 1989 33 years ago uh the com the wages [1:31:46] for the mayor's 6400 annually we're [1:31:49] recommending that when you look at the [1:31:51] top eight population jurisdictions in [1:31:53] the county and you average those other [1:31:55] than Eustis the average is eight [1:31:57] thousand dollars that's our [1:31:59] recommendation for the commission the [1:32:01] average of the mayor's positions in the [1:32:03] other large cities uh is 9751 annually [1:32:07] we're recommending a uh an amount of [1:32:10] 97.50 annually [1:32:13] we'd also recommend that the commission [1:32:16] consider making future increases [1:32:18] annually as given to other General [1:32:20] employees that will prevent us from [1:32:22] going 33 years without looking in a wage [1:32:24] adjustment [1:32:25] I provided information at the last [1:32:28] meeting regarding medical insurance it's [1:32:30] provided to two cities in Lake County [1:32:33] and then we're asking what the will of [1:32:35] the commission is regarding the medical [1:32:36] insurance I've provided cost information [1:32:38] for those and I'd be happy to answer any [1:32:41] questions of Bill [1:32:44] all right [1:32:46] um so this will need to come back for a [1:32:48] vote correct Tom [1:32:50] yes [1:32:51] um we're asking for consensus considered part-time but I [1:34:59] can promise you it's not [1:35:02] I think you all know that I do more than [1:35:04] 27 hours and Karen I do believe we had [1:35:08] it at one time I did do away with it so [1:35:11] um it was an option before I think it [1:35:13] should be something optional that people [1:35:15] want to opt for it all right I think the [1:35:18] part of the reason we took it away [1:35:21] because then more commissioners [1:35:24] were paid [1:35:25] additional [1:35:27] seem like [1:35:29] um [1:35:31] for the insurance I mean as a as [1:35:36] well I guess if you only take it on [1:35:38] yourself the city pays all of the [1:35:41] insurance depending on what plan you [1:35:43] selected there are some two of the base [1:35:45] plans there would be no charge for the [1:35:48] commissioner City cost that's where the [1:35:51] inequality came out about because the [1:35:54] Commissioners that chose it was they were covered by the taxpayer [1:36:00] so that was why it was deleted [1:36:04] and they did the same time they did away [1:36:06] with FRS as well yes yeah it was a lot [1:36:09] of different reasons there was a lot of [1:36:11] different things they did away with [1:36:13] yeah just because there was some some [1:36:15] Commissioners felt there was an [1:36:16] inequality yeah and I just didn't [1:36:18] remember the reasons and and you know it [1:36:21] could be a situation where if you just [1:36:23] um [1:36:24] do the base whatever and if you want the [1:36:27] next package then you pay for it [1:36:30] so you know so it would be my belief [1:36:32] that the benefit provided to full-time [1:36:35] employees would be provided to [1:36:37] commissioners [1:36:38] if Commissioners as full-time employees [1:36:41] do they select the base plan the city [1:36:43] would pay and generally we're paying [1:36:45] about eighty four hundred dollars a year [1:36:47] for single coverage [1:36:48] fifteen thousand dollars for family [1:36:50] coverage [1:36:52] if the commission or the full-time [1:36:54] employee wants to upgrade to a higher [1:36:56] level HMO or PPO then then the employee [1:37:00] of the commissioner would pay that [1:37:01] difference I didn't know because I just [1:37:03] paid the whole thing yeah [1:37:06] okay [1:37:07] I think I think we can bring it back [1:37:09] that way okay so we will [1:37:12] um we'll how about we contact the [1:37:15] Commissioners individually to see what [1:37:16] their interest is in health insurance [1:37:18] and then we'll bring some for that okay [1:37:22] sounds good to everybody [1:37:23] all right thank you thank you Bill [1:37:26] uh next one uh where are we at [1:37:29] discussion at downtown and East Town [1:37:32] Redevelopment agency board CRA and the [1:37:35] community representative positions [1:37:43] I promise [1:37:48] okay so this is a continuation of a [1:37:51] discussion we had at the last Commission [1:37:53] meeting and there were some additional [1:37:56] questions that were brought up and so [1:37:57] hopefully I'll be able to address those [1:38:00] so [1:38:01] we expanded the CRA board back in 2018 [1:38:05] according to the fra 97 percent of CRA [1:38:08] board members are local elected [1:38:10] officials and in our case uh the the CRA [1:38:13] board is the five members uh back in [1:38:17] 2018 we added the two Community reps and [1:38:21] that was under Florida statute [1:38:24] 163.357 governing body which consists of [1:38:27] five members May appoint two additional [1:38:30] members to act as members of the [1:38:33] community redevelopment agency and this [1:38:36] will address one of the questions that [1:38:37] came up at the last meeting the statute [1:38:40] actually says the term shall be for four [1:38:43] years except that the first person [1:38:45] appointed shell initially served for two [1:38:47] years and that's to stagger the terms so [1:38:50] our initial appointee was Dan Kelsey Dan [1:38:53] Kelsey [1:38:54] then left and so that that two-year term [1:38:57] has been [1:38:59] um [1:39:00] we're on four-year terms at this point [1:39:02] and the statute says they have to be [1:39:04] four-year terms so we don't have the [1:39:06] ability to to I know one of the [1:39:08] questions was can we go to two-year [1:39:09] terms or one-year terms uh we cannot do [1:39:12] that based on the statute [1:39:14] so [1:39:16] the um the statute the statute does [1:39:19] require that the new board members must [1:39:21] reside or be engaged in business in the [1:39:24] CRA and it also says that the board [1:39:27] members are subject to Sunshine Law and [1:39:30] to the code of ethics [1:39:31] um that all elected officials are [1:39:34] subject to [1:39:36] so this is a little bit of an [1:39:38] explanation there were some questions [1:39:39] about the language we had in there [1:39:42] so there were some questions as to why [1:39:44] do we talk about requiring expertise in [1:39:47] architecture Finance construction land [1:39:49] use affordable housing sustainability [1:39:52] and or community redevelopment and when [1:39:55] I pulled up the research there were two [1:39:57] bills in 2018 one house bill and one [1:40:00] Senate Bill the Senate bill was actually [1:40:03] going to require that we add two members [1:40:06] the bill didn't pass but it was going to [1:40:10] not only require that we add two members [1:40:13] but the two new members couldn't be [1:40:15] elected officials and they had to have [1:40:17] expertise in architecture Finance [1:40:19] construction so what we did was we [1:40:21] borrowed that language the commission at [1:40:23] the time said we kind of like that [1:40:25] language and even though the Senate Bill [1:40:27] didn't pass let's use that language [1:40:30] and so that's why that language is in [1:40:33] there [1:40:35] so items for your consideration [1:40:38] um one thing that was mentioned is what [1:40:41] if we ask the community reps to give [1:40:44] periodic reports [1:40:45] to the commission and by that I think [1:40:49] the intent was if you're out there [1:40:51] talking to the community if you're [1:40:52] attending events come back and report to [1:40:55] us as to what kind of public input [1:40:57] you're getting what events have you [1:40:58] attended what upcoming events are you [1:41:01] planning to attend uh that type of thing [1:41:03] and then another item [1:41:07] is [1:41:08] um the the resolution that was passed [1:41:10] actually encourage professional [1:41:12] development and continuing education but [1:41:15] I will be honest I have not encouraged [1:41:18] that enough so we should be working with [1:41:21] our two Community reps to talk to them [1:41:24] about opportunities at Florida [1:41:26] Redevelopment Association and everybody [1:41:28] should have gotten in the packet of the [1:41:31] fra annual meeting is upcoming in [1:41:34] mid-october and so we should be [1:41:36] encouraging our community reps to go to [1:41:38] this and then fra also has a [1:41:40] certification program where they do [1:41:42] periodic trainings uh around the state [1:41:46] and so [1:41:48] um again we in this in the resolution we [1:41:51] have said we encourage professional [1:41:53] development [1:41:55] um [1:41:55] and continuing education but I will be [1:41:58] more aggressive about that moving [1:42:00] forward and so [1:42:02] that's all I have at this point [1:42:05] um so really items to if we can't we [1:42:07] can't do anything about the terms uh so [1:42:10] the question is do you want to continue [1:42:11] having these two positions [1:42:13] if so do you want the Reps to do [1:42:17] periodic reporting and I will be more [1:42:19] aggressive about professional [1:42:21] development and so I'd be happy to [1:42:23] listen to any feedback you might have [1:42:25] vice mayor start us off [1:42:30] I have some concerns about [1:42:33] um can even continuing [1:42:35] I like that the suggestions about uh I [1:42:39] feel like there needs to be a better [1:42:41] connection [1:42:42] if they're going to be the community [1:42:44] reps they come they sit and they just [1:42:46] listen to us and we get nothing back so [1:42:49] I I like that idea that they come back [1:42:51] we know that they're interacting with [1:42:53] the community we know that they're [1:42:55] getting [1:42:57] feedback from the community and they [1:42:58] bring back to us I guess I'd like to see [1:43:00] that happen I really really encourage [1:43:04] um the [1:43:06] education part of it I think that's very [1:43:08] important [1:43:10] my concern is [1:43:12] the the qualifications when you go back [1:43:15] to it the land use [1:43:16] um [1:43:17] knowing these things [1:43:20] um that seems like it's limits [1:43:24] the participation of people having these [1:43:28] kinds of qualifications [1:43:31] um I I think it would be wonderful if we [1:43:33] could find someone to do that but I do [1:43:35] think it's important that [1:43:37] um they have a [1:43:39] they were asking about voting that isn't [1:43:42] as much of an issue to me as their [1:43:45] being connected to the community and [1:43:47] being able to feedback give us some [1:43:49] information and interact with us on that note so that's more important to [1:43:54] me than whether or not they can vote but [1:43:56] if they couldn't vote and it's nothing [1:43:58] other than the way we've been doing it I [1:44:00] would say demolished get rid of it but [1:44:02] if we add all these other things I think [1:44:04] it's important and I think it'll create [1:44:06] a better [1:44:08] um kind of position if we did if we do [1:44:11] those things okay so if we add the [1:44:13] education ring and the other thing [1:44:16] reporting back you're good with going [1:44:18] ahead and keeping the two seats yes on [1:44:21] the CRA yes my question is how do they [1:44:24] apply and then they can show that they [1:44:27] have expertise in these areas and then [1:44:29] they come back to us and we choose them [1:44:30] that's the process okay [1:44:33] it's it's similar to every other board [1:44:35] in commission we have so there's a [1:44:38] standard application and they would fill [1:44:40] that out [1:44:42] really I [1:44:46] you know I think we should keep them uh [1:44:49] I think that they should stay on we well [1:44:50] we should uh you know keep the two uh [1:44:53] Community uh members okay I think to [1:44:57] do a way way with them is a step back [1:45:00] for us okay uh [1:45:02] the one thing I'm not crazy about is [1:45:07] you know this verbiage architecture [1:45:09] Finance construction you know we want [1:45:11] people that live here that that love [1:45:14] this city and they all may not have [1:45:17] and I'm sure the majority of the people [1:45:19] that may apply you know won't have any [1:45:21] of that stuff so I don't know what [1:45:23] previous commissions [1:45:24] uh thought when they wanted to include [1:45:28] that [1:45:29] um but I don't want to use that as a way [1:45:31] to kind of weed people out I think love [1:45:34] of community [1:45:35] uh you know wanting to see Eustis grow [1:45:38] is is probably a little bit more [1:45:40] important than some of this and I agree [1:45:43] we do need to have that feedback [1:45:45] I think that would be great to him have [1:45:48] them come in and [1:45:50] you know and give us that feedback [1:45:53] um you know what communities think and [1:45:54] what the communities say all right [1:45:56] sounds good I think they would feel good [1:45:59] about being a part of it when they can [1:46:01] give [2:09:40] and they were talking about the [2:09:43] importance of Grant riders for them and [2:09:46] I'd like to know how things are going [2:09:48] with us and if it's a compensation thing [2:09:50] because grant writers are so important [2:09:53] too what we want to do and how we want [2:09:56] to grow [2:09:57] do we need to [2:10:00] look at maybe raising that [2:10:05] sure so we have the position advertised [2:10:08] one thing that has changed is we brought [2:10:10] Al on board and Al has some experience [2:10:14] and actually [2:10:16] um working with representative trunow's [2:10:19] office we submitted uh two [2:10:22] Appropriations grants and although [2:10:25] nothing is official I think one of those [2:10:27] projects is likely to get some funding [2:10:30] so that's and the the Al wrote those [2:10:33] requests we also have a grant into [2:10:38] dceo related to some utility relocations [2:10:42] related to the Waterman site [2:10:44] and so I [2:10:47] we've had discussions with with Al [2:10:50] related to the grant writing position is [2:10:53] that a position at one point that [2:10:55] position might have reported directly to [2:10:57] me but it might be appropriate for that [2:11:00] person to report to Al uh we can take a [2:11:02] look it's probably we need to take a [2:11:04] look at the job description I know we [2:11:07] submitted it to our HR consultant for [2:11:10] scoring so that the HR consultant could [2:11:13] give us a range where maybe the pay was [2:11:16] appropriate we could take a look at that [2:11:19] again [2:11:20] um I think the the short answer to your [2:11:23] question is I think we have more grant [2:11:26] writing expertise on staff than we did [2:11:27] before uh but we need to ramp that up [2:11:30] and we know that and so we'll we'll take [2:11:32] another look at it yeah and I and I this [2:11:35] is just me I don't want Al to get yeah no I I understand if we get any [2:11:41] application at all when have you [2:11:43] received any applications [2:11:46] okay any qualified [2:11:57] we'll take another look at it okay we [2:11:59] don't want to revisit looking at a [2:12:01] company that does [2:12:04] I mean you look at the cost of [2:12:07] individual versus if you could pay a [2:12:10] company for specific projects I don't [2:12:13] know yeah the the [2:12:15] um there are we for example Palmetto [2:12:18] Plaza uh we had a grant consultant of [2:12:22] write that Grant and then manage that [2:12:24] grant for us and they secured us 750 000 [2:12:27] in cdbg small cities [2:12:31] but they are not experts in every type [2:12:33] of grant you know there are uh Public [2:12:35] Safety grants police grants fire grants [2:12:38] and so [2:12:39] um we can get external consultant help [2:12:43] but we would have to get help from many [2:12:46] sectors right [2:12:48] um and so there are not a lot of firms [2:12:50] out there that just write all kinds of [2:12:53] Grants and so we'd have to we've looked [2:12:55] at that [2:12:56] um but again they're usually specific to [2:12:58] certain types of Grants or sectors so [2:13:01] yeah I look at that as being with us [2:13:04] trying to grow the way that we want to [2:13:06] grow that's being one of the most [2:13:08] important things that we leave to yep we [2:13:10] need to do yeah we will um definitely couple of items [2:15:05] um organizational grants we are ramping [2:15:07] up to release our organizational Grant [2:15:09] application [2:15:10] we know that there are some changes this [2:15:13] year one it's going to be a [2:15:15] reimbursement this year so you have to [2:15:17] perform as an organization before you [2:15:19] get the reimbursement we also want [2:15:22] presentations [2:15:26] um at after the event or the effort is [2:15:30] done we want presentations [2:15:32] as to the impact of the grant [2:15:36] we will provide all of the applications [2:15:40] to the city commission for review I [2:15:42] don't think in the past we've provided [2:15:45] all of those applications so the one [2:15:47] question I want to ask does the [2:15:50] commission want presentations [2:15:52] as part of the application process in [2:15:55] other words all of the applicants come [2:15:58] before the city commission to present [2:16:01] their Grant applications [2:16:02] that in the past we've had 15 19 20 [2:16:06] applicants so that would be a [2:16:09] significant amount of time it might be a [2:16:12] standalone Workshop because of the [2:16:14] number of presentations but if that's [2:16:16] the will of the city commission we're [2:16:18] happy to set that up so we know we're [2:16:21] going to get a presentation after the [2:16:24] organization performs but do we want [2:16:26] presentations [2:16:28] upon application before they perform [2:16:31] how about if we all read the [2:16:33] applications and then we select the ones [2:16:36] that we think would be most appropriate [2:16:37] and then to view them [2:16:40] so the commission would get all of the [2:16:43] applications they would narrow down the [2:16:45] pool and then bring in just those that [2:16:47] they feel should be funded is that is [2:16:50] that what you're saying that's a [2:16:51] suggestion I'm not saying that's what we [2:16:52] should we should have to do I also would [2:16:54] want to know how many people are they [2:16:57] serving how many in the community that [2:16:59] they serve and reach you know you could [2:17:01] do a grant and do five people I want to [2:17:03] know that it was a significant amount of [2:17:06] people that was impacted by whatever [2:17:08] they did I'd like to know what they're [2:17:09] going to do with the money and how are [2:17:11] we represented as a sponsor as well sure [2:17:13] and I so those that information is [2:17:16] required as part so they have to tell us [2:17:19] how many people they're impacting they [2:17:21] have to tell us how they're going to [2:17:22] spend the money they have to submit [2:17:24] financials and you'll see all that as [2:17:26] part of the applications yeah I think [2:17:29] what I'd like is because we have a panel [2:17:32] that that [2:17:34] goes through and looks at him now we [2:17:36] have traditionally had a staff review [2:17:38] group who then makes a recommendation in [2:17:40] the city commission that's how it's [2:17:41] worked and I think what what I'd like to [2:17:44] see is [2:17:46] because I'm going to be honest with you [2:17:48] I don't want to listen to 19 of anything [2:17:51] now we're down yeah I'd like for the [2:17:55] staff to to kind of narrow it down and [2:17:58] they maybe have them come in yes yeah [2:18:00] and I actually [2:19:09] um at one point I was going to suggest [2:19:11] uh Tuesday October 4th but we just [2:19:15] scheduled a workshop for the for October [2:19:18] 3rd [2:19:20] um and so I don't want to leave this [2:19:21] hanging and I it's taken I need to get [2:19:25] on top of this [2:19:27] um [2:19:28] because I know we have a couple of [2:19:29] outstanding items uh what about Tuesday
