People wishing to speak, [10:09] must sign up by 6 p.m. by using the Q-minder kiosk just outside the council door. Please see the courier for assistance. This evening's meeting speakers are on agenda items only. Let the record reflect that Mrs. Hoffman is participating via Zoom. Mrs. Hoffman? [10:31] Thank you and all other council members are in attendance. [10:35] Please silence any electronic devices if you must make or receive a phone call kindly [10:40] do so from outside the chamber. [10:42] We will begin tonight's meeting with a moment of silence. [10:54] Thank you. [10:55] Mr. Methini, would you lead us in the pledge? [11:21] The City of Greensboro is committed to promoting an environment that is free of discrimination [11:26] In order to maintain a safe space for all speakers and members of the audience, [11:36] sorry, members of the audience are speakers from the podium who intentionally disrupt the meeting or ridicule others will be given a warning and if unheated they will be removed from the meeting. [11:47] That person will be suspended from in-person participation for three months. [11:51] In order to preserve their right to free speech, they can attend virtually by Zoom, by phone, or by email. [11:58] It is the goal of the City Council that this Chamber is a welcoming space and [12:02] that all residents feel empowered to bring issues of concern to their elected officials. [12:09] Speakers are allotted three minutes for comments on specific agenda items. [12:14] Zoning matters do allow for a 15 minute presentation both for and against the rezoning. [12:19] There is a five-minute rebuttal period for each side, pro-and-com. [12:25] Zoom participants are requested to mute their microphone until they are called upon to speak. [12:31] All meeting attendees are expected to respect the speakers and council deliberations. [12:36] People disrupting the meeting will be removed from the meeting. [12:39] By statute, council members must vote on all items unless there is a direct financial interest. [12:44] Or if you sit on the board of a non-profit receiving Sunday funding from the city, all votes must be moved and seconded, the mayor will announce the vote total. [12:57] Let's see, we [13:03] do have a consent agenda for items G1 through G20, which are a grouping of agenda items that are voted on with one single vote to expedite, what are believed to be routine and non-controversial items. [13:15] Any council member may withdraw an item from the consent agenda due to a conflict of interest or for the purpose of voting no. [13:24] Items removed from the consent agenda for discussion will be placed on the January 16th meeting of the Greensboro City Council business agenda. [13:33] This night does include close captioning, depending on the length of tonight's meeting we may take a short recess around 7.30 p.m. [13:41] Now is the time for our ceremonial and presentation items, and I am going to read a resolution naming December 21st, 2023 National Homeless Persons Memorial Day. [13:57] We're as December 21st, 2023 marks the first day of winter and is the longest night of the year. [14:04] Whereas the national coalition for the homeless and the national health care for homeless council have designated December 21, 2023 as National Homeless Persons Memorial Day. [14:18] Whereas the city of Greensboro, the city of High Point and Guildford County have jointly designated December 21, 2023 as National Homeless Persons Memorial Day. [14:30] Whereas in the season of generosity and sharing, the citizens of Greensboro are encouraged to commit themselves to promoting compassion and concern for all, particularly during the winter months that pose extreme hardships for Greensboro citizens who are less fortunate and without homes. [14:48] Whereas homelessness continues to be a serious challenge for many Greensboro citizens who have the right to adequate food, housing, clothing, safety, and health care. [14:57] We're as homeless significantly [15:00] Assembly increases one risk of illness, injury, and death. Whereas the homeless memorial [15:06] walk of remembrance will take place in Greensboro on Thursday, December 21, 2023, to honor [15:14] those who have passed away in 2023 as a result of homelessness. Whereas by joining together [15:21] in remembering our neighbors, we can honor their lives by working to provide solutions [15:26] and homelessness within our city. [15:29] And now therefore be it resolved by the City Council of the City of Greensboro that December 21st, 2023 is hereby named National Homeless Persons Memorial Day in Greensboro to remember those who have died homeless and to encourage citizens to come together to celebrate their lives by working to resolve the factors that lead to homelessness within our city. [15:56] It looks like we have a speaker signed up to speak to the resolution, [16:04] Mr. Marsh. [16:45] I want to tell Mr. Hostin and the rest of you that work to assist in cleaning up the East [16:52] Washington Corridor, we appreciate the attention to that small detail and I guess is adequate [17:01] to be down here speaking tonight did not know that there would be a resolution, but I think that that's very much needed. [17:07] Our homeless citizens in this city do reserve respect them for us to be working diligently to come up with permanent solutions for what affects them, as well as others that visit our community, their homes. [17:21] And I just want to say that hopefully going into this next year, we've hit some stumbling blocks this year of what we could have done to further a [17:31] address these problems, I don't know, Ms. Muthaney has had numerous Fox 8 segments on this and coming up with permanent solutions that seems like this is a recurring problem that does never have a permanent solutions that, you know, work to basically move some of these people out of this transition period that they tend to stay into. [17:55] And so I just want to say that again, I presented the city with multiple options, not only for my benefit, but for that community's benefit, as well as for the city managers office that sometimes we don't see eye to eye, but either way we have to work together to come up with solutions for the business community that takes the brunt of some of these actions that never seem to come to any type of resolution. [18:23] So again, I do want to say, I appreciate what you are doing for that community tonight, and hopefully we can all come up with a solution going into next year that works to permanent solutions, not just temporary solutions, cleaning up streets every two days, every week, every month, that just is untenable. [18:45] And again, you run off businesses that pay taxes in this city, and we just have to do a better job. [18:52] So I understand there's a very hard job. [18:55] There are no easy answers, but hopefully we can come up with those solutions that work for everyone. [19:00] Thank you. [19:01] Thank you. [19:02] I believe there was a motion in a second. [19:06] Council, please vote. [19:07] That was moved by Mayor Pro Tem, seconded by Mrs. Thurham. [19:11] I don't know if there's anybody here to accept the resolution from staff, yes. [19:44] Thank you Mayor for the resolution. [19:45] I did just want to remind everyone that we will be having the walk of remembrance and a small [19:50] ceremony on Thursday at 5.30 p.m. at the flagpole out here on the Washington Street side will walk [19:56] to Center City Park and back. [19:58] So thank you. [19:59] Thank you. [20:02] Now we move on to item E2, which is the manager's report. [20:07] Nothing. Nothing this evening. Now we will move on to our consent agenda. Do I have [20:14] a motion? [20:17] Okay. Move by Mr. Holston. Second. By Mrs. Ibusa-Water. Council, please vote. [20:41] And that passes 9-0. We will now move on to the public hearing portion of our agenda. [20:48] We do have one speaker signed up in favor, I'll read H1 and H2 together. [20:57] Item H1 is a public hearing for an ordinance annexing territory into the corporate limits. [21:02] For the property located at 2810, 2820 Rowland Road, 0.544 acres trace a McKinney for McKinney and [21:12] and Son's Construction LLC, an item H2, public hearing for an ordinance for [21:18] original zoning for 2010, 28, 12, Roland Road, Tracy A. [21:23] McKinney for McKinney and Son's Construction LLC. [21:27] Mr. Kirkman? [21:28] Yes, thank you, Mayor Vaughn. [21:29] Good evening, members of City Council. [21:30] The request again is to annex these two properties into the City of Greensboro and [21:35] establish original city zoning to City R5 residential single family. [21:39] North and east of this request is currently [21:41] zone county RS-20 residential single family. [21:45] South of this request is zone city R-3 residential [21:48] single family and county RS-20. [21:51] West request is zone city C-D-C-L as well as county RS-20. [21:56] The subject property is currently undeveloped at this time. [21:59] North, east and south of the request are single family dwellings. [22:02] West request are a combination of single family dwellings [22:05] and an indoor recreation used that is currently under construction. [22:09] Properties are currently designated as residential on the feature land use map of the Comprehensive Plan and as urban general on the feature built form map. [22:17] Staff has concluded this request does support the Comprehensive Plan's creating great places goal to expand greens for a citywide network [22:23] If you need neighborhoods offering residents of all walks of life a variety of quality housing choices and the building community connections goal to maintain stable attractive and healthy places to live and raise families. [22:33] The proposed R5 district accommodates lower density single-family detached residential development of up to five dwelling units per acre [22:40] And allows uses that are similar to existing uses in the surrounding area and staff is recommending approval of these requests [22:46] These requests were heard by the planning and zoning commission that their November 20th meeting and the commission did recommend in favor of both the annexation and zoning [22:54] There were no speakers on that item at that meeting. Can you answer any questions? [22:58] Any questions from Mr. Kirkman? [23:01] We do have one speaker signed up in favor, Trace McKinney, I don't know if you would [23:07] like to comment or if you're here for questions, [23:18] I guess, near. [23:23] Do we have a motion on H1? [23:35] So that was moved by Mrs. Thurm and seconded by Dr. Wells, Council, please vote. [23:58] And that passes 9 to 0. [24:00] We need a statement of consistency for H2, moved by Mrs. Thurm, seconded by Dr. Wells. [24:10] The Greensboro City Council believes that it's action to approve the original zoning request for the property at 28, 10, 28, 12 roll-in road from county RS 20 to city R5 to be consistent with the adopted GSO 2040 Comprehensive Plan and considers the action taken to be reasonable and in the public interest for the following reasons. [24:32] The request is consistent with the Comprehensive Plan's future belt form map and future land use map. [24:38] The proposed city R5 zoning district permits uses that fit the context of surrounding areas and [24:45] limits negative impacts on the adjacent properties. [24:48] The request is reasonable due to the size, physical conditions and other attributes of the area. [24:53] It will benefit the property owner and surrounding community and approval is in the public interest. [25:00] Council, please vote, and [25:09] that passes 9 to 0. [25:11] I will read H3 and H4 into the record. [25:15] We do have one speaker in favor and one speaker opposed. [25:19] Item H3 is a public hearing for an ordinance annexing territory into the corporate limits for [25:24] the property located at 4012, Hickory Tree Lane, 0.61 acres, Ronald Benjamin, and [25:31] an item H for a public hearing for an ordinance for original zoning for 40, 12, Hickory Tree Lane, Ronald Benjamin. [25:39] Mr. Kirkman. [25:40] Yes, thank you, Mayor Vaughn. [25:41] Again, the request is for annexation and original zoning from County RS40, residential single family to city R3, residential single family. [25:50] North, east and west, the request is also zone County RS40. [25:54] South of the request is zone of combination of County RS40, as well as County CZ RS3. [26:00] both of those are single-family designations. [26:03] The subject property has currently undeveloped this point. [26:06] The applicant is in the process of constructing a single-family dwelling on the property. [26:10] North, South, East, and West request are single-family dwellings. [26:14] The property is designated as residential on the future land use map of the comprehensive [26:17] plan and is urban general on the future built format. [26:21] Staff notes that this request does support the comprehensive plan's creating great places [26:25] goal to expand Greensboro Citywide network of unique neighborhoods, offering residents [26:29] of all walks of life, a variety of quality housing choices, and the building community [26:33] connections goal to maintain stable, attractive, and healthy places to live and raise families. [26:38] Their proposed R3 district is intended to accommodate low-density single-family detached residential [26:43] development of up to three dwellings per acre, and allows uses that are similar to the existing [26:47] uses in the surrounding area and staff is recommending approval of this request. [26:51] The planning and zoning commission heard this request at their November 20th meeting. [26:55] They recommended denial of both the annexation and the zoning requests. [26:59] There were no speakers in favor in three in opposition. [27:02] I would note that part of the issue with that, the applicant was present earlier in the meeting. [27:07] When the large crowd left from a previous zoning case, there was a miscommunication with staff. [27:13] He understood that the case had already been heard and unfortunately left and was not available for the meeting. [27:17] the applicant is here this evening, though, to my knowledge to be able to address the [27:21] request. [27:22] Any other questions? [27:24] Thank you. [27:25] Sharon? [27:32] Yes. [27:32] Sorry. [27:33] So Mike, and I did find a zoning minute. [27:37] One of the things I saw in the staff report, and I'll go back and find it, you gave a mixed [27:47] message in your staff report and I'm a little concerned by that because I believe what [27:57] it says here the request is consistent with the intent and purpose of the zoning code [28:06] inconsistent with the comprehensive plan GSO 2040 and generally compatible so with the [28:16] existing development. What exactly made it inconsistent? Do you know a page that's on? I don't [28:24] see that, but that may be a typo unfortunately. That is the last page of the zoning minutes. [28:32] The staff report that is the very last paragraph. Oh, that is a typo. It's supposed to be [28:42] and consistent, I apologize for that. [28:46] Okay, because I was wondering why there was a mixed man. [28:50] Unfortunately, it's an error on the report [28:51] side of apologize for that, but it's supposed to read the intent [28:54] and purpose of the zoning code and consistent [28:56] with the comprehensive plan. [29:01] I'm just going to ask somebody to please spell check [29:04] because it makes it, it's important because I do read these [29:09] and so it's important to help me understand. [29:13] The second question, most of this is counting from what you were saying. [29:21] Everything around. [29:23] And so the house beside it is counting as well. [29:27] Yeah, I'm going to bring the map back up here. [29:29] That'll help us. [29:32] Yes. [29:33] So basically everything that's in yellow on this map is in the city and everything [29:37] else is in the county's jurisdiction. [29:39] The [29:42] property is. [29:44] That has marked it. [29:45] So it is like one, two, three houses away from City on the left and one, two, three, both. [30:00] All right. From the right. [30:04] And it's non-contiguous, of course. [30:09] Do you know the reason? Is it just to build a single family home? Yes, they're they're petitioning the access city water and sewer to build a single family dwelling and our policy. It's in growth here. One, so it needs to be annexed in order to access city water sewer to develop the property. And was the house already being built and was determined. [30:29] I believe the house has started to be under construction and I believe the applicant can speak a little more to that when he gets up here [30:34] Which means it started on the county but it was yeah, I think there was some some efforts to begin to develop the site [30:41] And they realize that they had to connect to city water and sewer and that sure the discussion for annexation and zoning [30:47] Okay, thank you for now [30:48] Sure and I have a general question [30:52] Mike so in H3 and H4 same property H3 the staff recommended approval [31:02] We are recommending approval for both items. I'm looking at the minutes for H4 and the [31:11] first paragraph at the very end is I [31:19] will clarify that staff is recommending approval [31:21] both items. I'm not going to get that all right. [31:27] We do have one speaker in favor and two against. [31:36] So our speaker in favor is Ronald Benjamin. [31:41] Would you like to come to the podium? [31:45] You have up to 15 minutes. [31:51] Good afternoon everybody. [31:53] My main purpose is to build a single family home for me and my wife. [31:58] For some reason, I have a couple of people that feel that I'm going to do a group home [32:03] because I am in that business, but this is basically for my personal self and my wife [32:10] to live there. [32:11] We like the community. [32:12] There's a beautiful community, and we want to keep it that way. [32:15] I try several times to compromise with them in any kind of way, but they refuse to talk to [32:22] me. [32:22] I don't know why they don't want to talk to me, but it is what it is, but I'm not planning to do any kind of group home or any sort of just a family home for me and my wife so we could retire there. [32:38] That's all I have to say. [32:40] Any questions for Mr. Benjamin? [32:44] Would this, I have a question for staff and maybe it's chalk, if it passes without any [32:52] conditions on it, can he come back for a group home at a later date? [32:57] And are there any restrictions where it wouldn't qualify for one? [33:01] Well, as you know, this is a hearing about zoning and annexation that sets the frame for what he could use it for going forward. [33:16] Typically, that doesn't involve an inquiry as to actually what the specific use may be. [33:22] We've had many, you know, developers coming here and show a lustre to plans and so forth. [33:27] And we often point out that none of that is a commitment, unless there's a condition involved [33:34] in the zoning that would make it a commitment. [33:37] So he would have every right of an owner with this property under that zoning condition. [33:43] And I think there's certain types of facilities that can be used in a similar to a group home, [33:52] but maybe Mike might be able to be more specific. [33:55] Yeah, I was going to ask Sue or Mike, would it require a special use permit or? [34:00] So I think we need to make a distinction, too, because there's a group care facility, [34:04] which is a larger institutional style use, and there's a family care home, [34:08] which is supposed to be more of a residential style use. [34:11] A family care home isn't allowed use in single family zoning. [34:15] There's a requirement though that they must be separated from other family care homes by at least half a mile under our ordinance. [34:22] So they would have to meet that standard in order to do with one of this protection for family care for a family care home. [34:27] A group care would not be allowed. [34:29] That's a much more intense institutional style use. [34:33] So a group, a group home would not be allowed? [34:37] Right, under our ordinance is referred to as a group care facility. [34:41] That would not be allowed. [34:43] A family care home could be allowed in residential zoning, but [34:47] it would have to be far enough away from other family care homes. [34:50] A minimum of a half mile. [34:52] Correct, under our ordinance. [34:53] Do you know if there are other family care homes nearby? [34:58] We know there's one next door at 4010, I believe. [35:02] We've hickory trade on tree and I think there may be some additional ones in the area. [35:07] All of those are in the county obviously so we don't have full records on that but we did get independent verification both from Mr. Benjamin and pulling information from the state that there's one next door to this property. [35:17] So if there is one next door to his property then it appears that he couldn't do a family care home either. [35:24] Absent of variance, yes that's correct. [35:26] So okay, he said absence of variance is what yeah, they would have to go through the board of adjustment and request a variance, which would be a basically a zero foot separation from another family care home. [35:41] So is that separation is in writing so that that's in our ordinance? Yes, it's a development standard for a family care home. [35:52] So the house next door could not, the house building could not become an extension of the one next door [36:00] and I've checked the ownership and I know that's not part of the zoning so I am a little concerned [36:09] about that so could that become any kind of extension of what is already there? Could that be a lie? [36:17] It's a separate dwelling unit, so they could have up to four unrelated individuals as a family that's allowed throughout the city, but that's the operation of a single family dwelling. [36:28] But regardless, he's not asking for a family care. [36:32] Right, I mean, Mr. Benjamin, it's not in that here. [36:35] Single family residential rezoning that you're requesting. [36:39] Any other questions for Mr. Benjamin? [36:40] of it. [36:44] You have one for him. The question for Mike. [36:49] So I understand the house was, there's a foundation, something already there. So the house [36:56] was being built under the county. So they were starting to process what they did, they [37:05] had the trees and they started. This is the home builders that actually started and at that time I didn't know what I was supposed to have done. [37:18] So they told me I had to do the annexation. So this is, I ran it to that problem so they stopped and they said I had to go through the process for annexation. [37:29] So this is why I'm here today to try to get this approved. [37:32] move. So primarily you want water and sewer? Yes, yes, ma'am. [37:41] Mrs. Saitower, are you through? But the house beside it doesn't have water and so [37:45] happened that? Yes, it does. The house beside has been [37:50] annexed into the city? No, but it would have been developed many years ago under different [37:55] water and sewer extension policies. So the current policy says that in order for him to [38:00] access water and sewer he would need to be annexed into the city. [38:07] Mrs. Thurne. [38:09] Question, I guess for Chuck, do or sorry, city attorney what? [38:15] Do we have the ability to add a condition at this point on this reason? [38:22] I wouldn't think that would be prudent. [38:25] Thank you. [38:28] If you're through and there are no further questions, we do have two people in. [38:33] an opposition, Ernest Allen, and Paratollison? [38:38] I don't know if you have an order you would like to speak. [38:43] Paratollison is by Zoom, can we see? [38:48] Can you bring that person up? [38:54] Good afternoon, ladies and gentlemen. [38:56] My name is Ernest Allen. [38:58] I live in 39-13 Hickory Lane. [39:02] My wife and I built that house 49 years ago. [39:07] We were fortunate to see every house that is in that neighborhood now except [39:14] too. So you're looking at about 40 houses that will build after our house will [39:21] build. [39:23] 4010 is a group home. [39:28] The concern and I'm the community watch coordinator. [39:32] The concern with my neighbors is that 4012 might also become a group home. [39:41] I have been assured by Mr. Benjamin, I've had two conversations with him since November [39:47] the 20th. [39:49] He assures me verbally that he does not plan to make 4012 a group home. [39:58] He indicated to me that if a house is built on that property, he and his wife planned [40:05] to occupy that house. [40:09] He indicated to me the term that he used is going to be a luxury home. [40:19] I asked him to define luxury home for me, put it in money value. [40:25] he said five to six hundred thousand dollars. This is what he said. So I'm here [40:31] tonight to represent my neighbors and based on what I heard here tonight and [40:38] based on the way that I feel this is going and based on my conversation with [40:43] Mr. Benjamin. If indeed he's going to be a man of his words you judge a man by his [40:51] word and his character, and he's indicated to me twice as to what his plans are, that [40:58] I will remove my opposition for Mr. Benjamin to move on with this with this project. [41:07] If indeed the plans are to build a house on that property and he and his wife occupied [41:18] about that house and not at any point in my lifetime become a group home. [41:27] Have we had issues with 40-10? Yes, we have. [41:31] Have I written letters? Yes, I have. I give you some idea. [41:39] I wrote a letter. I've written three or four letters. I don't have copies of all of them. [41:45] But I'm going to give you some idea where the letters were written. [41:50] State of North Carolina, Department of Health and Human Services, Division of Health Services [41:57] Regulation, Mental Health Licensure and Certification Section is where my letters have gone. [42:05] I don't want to have to do this anymore. [42:07] I don't want 40-12 to become a group home. [42:11] I know my time is about up. [42:12] So thank you for listening and Mr. Benjamin, I trust that you'll be a man of your word and you'll put a house on there that you and your wife can enjoy and occupy. [42:25] Thank you so much. [42:27] Thank you, Mr. Allen. [42:31] Tara, Talison, I believe is on Zoom. [42:34] Yes, can you hear me okay? [42:36] We can, I understand your camera isn't working. [42:39] Yes, that's correct. [42:40] Some reason I think with the feed and everything, it doesn't like it. [42:43] So just to keep the audio to make sure you can hear me. [42:45] Okay. [42:46] If you would proceed with your comments. [42:51] I sent some information to the committee members to review. [42:55] I'm not sure if you've been able to look at any of the materials I sent, but I would like to reference from some of them within this brief period. [43:03] I'm not going to necessarily go through all of it, but it was to give you an idea. [43:08] With the license facilities, that particular one, I sent it as a source document because if you look at these scrolled down, [43:15] I think it's 12.7 there. That one, the XLS file, that was what I was going to say you could do. [43:20] you can pull it is for all those that elicit that Mr. Benjamin that includes Mr. Benjamin's ownership [43:26] to my knowledge he owns 11 properties sorry 11 facilities but owns four buildings [43:33] two of them are right beside each other in the county and not far from the particular location [43:39] that he's trying to build and he owns the property he's also the his daughter owns the property [43:45] but I think he leases a rents for that location for the crime business. [43:49] So I look at this from the business aspect. [43:51] I can't necessarily take the person for his work. [43:54] I know if you look at some of the documents I sent was one of them showing. [43:59] Let's say I'm not sure what all you can show. [44:02] I just said that as an Excel. [44:03] So if you want to download, you can. [44:05] You will find out you do this. [44:07] You will find several within our particular community and not just his. [44:13] And so that's more for inference and if there's a source if you want to check my data, that's where I pulled it for the sorts that I have. [44:21] I'm not sure if you can go to the next another document and I can speak from that one. [44:29] Okay, that's just a listing of what they would they put out to where you can find a single and a number you can go into number three if you like. [44:36] This one here scroll to the bottom of the document. [44:42] in the city of what is happening. [44:50] If you do one, I'm curious about your rules about the, um, uh, uh, if you, if one is under [44:56] the city and one is under the county because what is not listed is that you can pull [45:00] Support a license to another and pass it you get a more direct answer from the council members about how that's done. And for based on the earlier questions, it sounds like they don't have to consult the community at large. Only go through the owner of the home. So you can go to the next one. But that's just to give you an idea of the most immediate ones and Mr. Benjamin on several one being 1596 Candice Road and one 1594 Candice Rail, which are right beside each other. That's his rules and regulations for family care. [45:29] I understand it's important. It's important for community. It's important to have the options, but [45:35] That gets to the next one. I think he's going to go on to number five. Your next documents [45:41] Yes, I specifically pulled this one. That's forty-ten. That's next door. That's his proper [45:48] Scroll down. My point is is that for almost a minute [45:51] It started that we've had issues with that location. Doesn't mean the license can't be courted [45:56] Again, this is a business. He went from one to ten within a four-year period. [46:03] My understanding of property he wants to build next door is going to be a five-bedroom, four-bath house, which is in the range of having individuals come in. [46:13] And you don't have to, I'm not sure how the licensing all works because I couldn't really get an answer from Department of Health and Human Services, and they have limited hours and staff, which are told me understand. [46:22] But I'm opposed because of the fact that he has spoken to the community state is going [46:27] to work on things. [46:28] If you go through these records, there are times the community has reported issues, but [46:33] it's not showing on DHSS records of those events taken place of individuals who's in their [46:40] care getting out, going in against residents, knocking on doors, opening cars, going through [46:47] property. [46:47] I don't know if it's a staffing issue because I'm sure the money's probably not an issue if you could have 10 units within a four-year period. [46:56] So that's just a given idea if you want to check my data you can, but I can tell you the clinic correction won't necessarily or the statement deficiencies not going to match up to events that have happened because my understanding is that you go to him to Mr. Benjamin or his daughter who is the landlord of that their location to resolve it is not getting back to the health. [47:16] also it's not a pure picture of what's happening in that location. [47:21] So this is to me a business, it's not about the home because that's what the state and [47:26] federal pay for. [47:27] Those individuals will be treated and given a good community and not for that, but I'm [47:32] not for for business management, which is what is happening where people will be rewarded [47:37] for with a $600,000 type property. [47:41] You can go to the next document, please. [47:48] This is what I'm getting to. [47:50] Copy ownership or rental. [47:51] This is what I was speaking to, number one and two, he owns those, those are what's in the [47:56] malrange. [47:57] Bay, what he doesn't say is that he owned, he bought the property but then bought it with his [48:02] LLC. [48:03] I don't hear that's how that's addressed, he can resell it and he's still keeping his promise [48:07] but it's the business that can change, that can go in and make a new home or a care facility. [48:16] And so, and I will say number 10, I couldn't find that one at all. [48:21] It's listed on the spreadsheet, but I couldn't find it. [48:24] But if you look at it number one, that was the third property he bought. [48:28] If number two was the tenth property, number three was the fifth property he had access. [48:31] Number four was the ninth property he got. [48:33] Number five is the eighth property. [48:35] Number six is the sixth property. [48:37] Number seven is the second property. [48:38] the 8th one is the 7th property and the 4th one and his 9th property, 10 I can't count for, and the first one, 11, 20, 2017 was the first property that I can see that was listening to his door, which he told our family, his door was buying her first home. [48:54] He didn't mention it was going to be a group home. [48:57] So I am not, I don't see the individual as someone as a man of his word. [49:03] So I've got a couple of years and we have more data than I have time to say that he's not necessarily a man of his word. [49:09] Not including the motorcycles of Downstreet, including the other individuals are going on. [49:14] If, and it also doesn't, I don't know how the rules are addressed. [49:18] If the neighbors are complaining, but the neighbor or yours are related to you, I don't know how backstunning. [49:22] backstun because considering how one and two are with him [49:25] owning both those properties. [49:27] And they're both homes, but they're probably in the county. [49:31] So how would that be addressed if one is county one is city. [49:36] And that I'm not sure if I'm making any sense, but. [49:39] It's I had a lot of data and I don't want to overwhelm you, [49:42] but the spreadsheet can speak volumes because he's not the home. [49:45] He has probably one of your properties of multiples. [49:52] So I see it as a business in a business that can just tell you one thing [49:55] and they can buy it out with the LLC or something else. [49:58] And he still has kept his promises in business. [50:00] It doesn't mean he's going to officially retire there. [50:03] And I don't know if the rules are, [50:04] if he's living at one of these addresses, [50:06] like number two, 1594, [50:08] I don't know if anyone is at that location. [50:11] Does it mean that he's not living it? [50:17] And I just only check Guilford County. [50:24] And almost all of these, [50:25] if you go through the record, have problems. [50:30] And so my fears are, our esteemed neighbor, [50:33] his letters are not getting in [50:35] Because he keeps getting licenses no matter what the efficiencies they are so [50:44] my concern is I do not believe [50:46] The possible new neighbor will keep this word and then so full disclosure the property that's 4010 [50:53] My family built that house my parents did [50:57] Came back it is an excellent neighborhood came back and moved back in [51:02] Next door at the time 4010 and 4012 were one property and [51:06] And she sold it off, or it was officially divided off and sold off. [51:12] So it's officially good thing. [51:13] So the third thing the last thing I have was a video reference to the meeting in which [51:18] I want for you all to hear because that spoke more to the character of what's been going [51:23] on that also spoke to some of the history. [51:25] And that's what Mr. John Patterson, instead of sending a video file, I cited it within the [51:30] planning minutes to where it started. [51:34] I don't know how if they did it or not. [51:36] Ms. [51:47] Talison, are you through with your comments? [51:51] Yes, but I wanted to see if that video segment that I had submitted was going to be played or not. [52:00] I'm reading the minutes. [52:04] It was Mr. John Patterson's presentation. [52:20] I sent a link to the planning committee and said where it started. [52:24] Because I didn't think I could send an audio video file that large to email. [52:44] No, it's a video. It's you all is the planning committee's all videos up online [52:57] Well, the video testimony that's linked to the planning committee. It was this presentation. I'm not really trying to debate with the speaker [53:04] I was just pointing out our policy. Oh, why I didn't know that [53:09] That I was I assumed it was okay. I would have tried to send it in [53:15] So there was at the three hours, 16 minutes and 16 second point where Mr. Patterson spoke. [53:20] So we waited. [53:21] I do find it interesting that we did hear that it was disposed. [53:25] We are the those in opposition waited the whole for almost four hours to speak. [53:32] Is the video marked at the spot? [53:37] I said the time stamp is started three hours and 16 minutes and 16 seconds. [53:44] It starts at three hours and 15 minutes. [53:49] Dr. The time says you go through the video player. [53:52] The three hour mark. [53:54] Three 16 16 is when he is speaking. [53:58] Yeah. [53:59] They were three hours into the meat. [54:03] Yeah. [54:04] They need it. [54:06] Right. [54:07] Three hours 16. [54:11] But if it's part of what she sent in. [54:16] Then. [54:16] I mean, if it's a video of our proceedings, that's not a big issue for me, it's from I believe our own plan and me. [54:25] Okay, because I know I've shown anybody want to make a motion to continue. [54:29] No, I showed quite a popular video. [54:32] No, okay. [54:33] No audio. [54:34] No one, there's no desire to hold you. [54:37] Can you turn the volume? [54:38] No, if the applicant is not present and there is no one to speak in favor, then we will allow anyone to speak in opposition. [54:44] I believe if you really can't hear that by yourself, please. [54:50] And the one thing I would say that differentiates this from that meeting is that the applicant had left already and was not able to give his side of the story. [55:00] A matter of significant concern to the residents of our esteemed young acres community, but formally opposing the zoning requests submitted by Mr. Ronald Benjamin. [55:10] My decision to make this request is grounded in the thorough consideration of Mr. [55:16] Benjamin's track record and property development, particularly his actions at the [55:20] joining property at 4010 Hickory Tree Lane, as well as his involvement in the Candace [55:27] Ridge and Pleasant Hill neighborhood. [55:29] If I may get the clock stopped real quick, I apologize for interrupting you, but at the [55:34] of the meeting I stated that, you know, this is, this deals with land use. We really, [55:39] where'd that come from? [55:42] Oh, that's on the report. That was loud enough. I do want to say that [55:49] we really have to. Yeah, that was the video. Yeah, that was. We have to stick to land use, not a person's [55:57] character. The zoning meeting and what zoning tells us is we have to look at the land use and what [56:02] what it can be used for, that's it. [56:06] So, you know, to talk about other properties that he owns isn't really relevant by statute [56:12] to this hearing. [56:14] Is that correct? [56:17] Thank you. [56:18] Exactly. [56:21] So normally we would review a video before it's played and they have not had the chance to [56:29] review that, and if it's all about Mr. Benjamin and not about the property, it would not be appropriate. [56:42] So, well, I don't know, Ms. Tullerson, are you? [56:50] I'm still here. I'm just, I hear it, but because you, like you said, you haven't reviewed it. [56:55] It does address the property, but I'm not sure when you can get to review that part since you've paused it. [57:04] Because to me, the property part is how you talk about stable attractive places to live and benefit property owners around the community and the development of this will not benefit the surrounding community. [57:19] And that's what back what Mr. Passion was speaking to and also being stable. [57:25] Is [57:35] that the end of your comments for this portion? [57:37] There is a five minute rebuttal period. [57:39] Yes, yes, yes. [57:40] Are there any questions from Ms. Tullison? [57:45] Okay, Mr. Benjamin, you have a five minute rebuttal [57:48] if you wish to use it. [58:14] But like I told them, that's not my intent. [58:18] I never lied to anybody. [58:20] Never did something that I wasn't supposed to do [58:22] because I wasn't raised that way. [58:24] I'm just helping people. [58:25] And so if I'm helping people and that's wrong, [58:29] I don't know what to say about this world. [58:31] But this is personally for me and my wife. [58:34] We work hard to make sure that people live good, [58:38] just like anybody else. [58:40] Every one of my homes is in top, not shape. [58:44] They live just like anybody else. [58:46] They eat like everybody else. [58:48] That's all I do. [58:49] I try to make your right for all these guys that deserve that. [58:54] That's all I have to say. [58:56] So, Mr. Benjamin, you just want to make sure you're aware of, so if you were to buy this property [59:02] and there is a facility next to you that you would not be able to do a group home. [59:12] No, is that so? [59:12] That you would have to go before the Board of Adjustments if you wanted to change that. [59:16] that and the Board of Adjustments would certainly take this zoning hearing into consideration. [59:22] So I think that should give the applicants some comfort. [59:26] Yes, no problem. [59:28] I have no problem with that. [59:30] My intent, like I said, from the beginning, is to build a family home for me and my wife. [59:35] Okay. [59:36] That's it. [59:37] Do those in opposition, would you like to do a five minute rebuttal? [59:51] I was reading through the rest of the notes and I think one of the zoning commissioners [59:58] even ask this question. [1:00:00] The size of the lot, the way he asked the question, is this a large size piece of property? It's like the normal size of all the other homes. It's nothing bigger than the others. It's going to be, it's going to fit right in with everything else that is around there. Do you want to pull the zoning map up again? [1:00:26] Mr. Kirkman, could you bring that up? [1:00:32] But I know keeping the character of that neighborhood that's one of the older neighborhoods out in that particular area and they're getting hit with a lot of rezoning stuff coming their way. [1:00:48] So I know there are many of them want to try to keep the character of the home but I was curious about the size of the lot. [1:00:58] Did [1:01:02] you get it back up? [1:01:06] Okay, there it is. [1:01:08] Oh, it's available. [1:01:11] Not that bad. [1:01:15] Go back to the, to the area where you want some events [1:01:17] with this one. [1:01:26] That would be in Councilor. [1:01:33] It's pretty long, it's pretty long. [1:01:35] It's a long, it's pretty deep. [1:01:40] I think the one's next to it, or deep also? [1:01:44] All the same, basically. [1:01:50] Did you previously offer that, [1:01:51] Did you previously offer that this is going to be a 5-bed 4-bath, or is that someone else? [1:01:59] Someone else diggin' in my personal. [1:02:02] Like I said, it's just a personal home that I built, and it's for me and my wife, and [1:02:08] that's all my tent was. [1:02:10] I think that's all you need to say. [1:02:12] Yeah. [1:02:13] I think you've made your point, Mayor. [1:02:15] I think that if you do something else, you're probably going to get in trouble, so I don't [1:02:19] recommend it. [1:02:20] Right. No, no, I'm so let's move on. Thank you. Thank you, sir. Are there is there any [1:02:28] Rebuttal Alaska second time? Can we hear me? Yes, go ahead. I know we said about to move [1:02:37] on, but it's not easy to say when you're not individuals living there. You're representing [1:02:47] I'm sure that the policy, but the execution of policy is not necessarily going to stay as stated as written within what you all have. [1:02:58] My concern is, again, if you look at the history, properties can be purchased and by businesses and change the rules. [1:03:06] also I don't see how it's addressed if one is listed under city and one is [1:03:10] listed under county those are different rules per per say even looking at [1:03:14] the zoning that we sent about units within a mile and within the city it's [1:03:19] supposed to be half a mile and that would break that so I would be curious as to [1:03:24] how that would be resolved technically they're under two different rules [1:03:28] jurisdictions is one's under county and one's under city we would go by the [1:03:32] the city's regulations and we would include the group home's family homes that are in the county. [1:03:40] Okay, so you would then cite the other ones within the mile or just only the ones at present at the time. [1:03:45] If that's more of a question, but I was just, I didn't hear how that was going to be done. [1:03:52] And also from understanding it doesn't necessarily go through the community, it goes through you all first, right? [1:04:00] Yes, that question again. [1:04:02] If there is a change in two years, that goes before a committee, it doesn't go through [1:04:08] the neighborhood, the neighbors are not in part of that, correct? [1:04:12] If he wanted to change, if he wanted to use a group home or a family care home, he would [1:04:19] have to go in front of the Board of Adjustments and there would be a sign in the front yard [1:04:24] that says when the Board of Adjustment Meeting is, and the neighbors get letters, 600 feet, [1:04:31] 700 feet, 700 feet, not what would have happened in that, or that under counting, neighbors get, neighbors get letters. [1:04:38] A Jason property owners and when it's for the, a Jason property. [1:04:42] Okay, so because so a Jason, one of them would that include the one that's being done on the one to the left of it says that a 4010 to 4048, for instance. [1:04:52] We'll make sure there [1:04:58] are multiple ways that, that, that a board of adjustment case should it ever come to that. [1:05:03] that we advertise in the paper and the piecemaker, [1:05:08] the adjacent property owners receive a letter [1:05:10] and it's posted so that if you don't get a letter, [1:05:13] you can see the sign that is posted [1:05:16] with the contact information in there. [1:05:18] And just to be clear, [1:05:20] property owners don't want to respond [1:05:21] because other properties can rent out. [1:05:23] For instance, the rentals can't speak. [1:05:29] There's nothing that says the limits who can speak. [1:05:33] Okay. [1:05:34] Because there, I mean, this is one [1:05:35] to make sure by impacting if that's the case. [1:05:37] Just want to make sure. [1:05:40] But I do want to say to one thing he stayed about, [1:05:42] someone digging into his business, [1:05:44] he is the one who sent out some information [1:05:46] to the community chair who spoke earlier [1:05:49] about what type of house he would have there. [1:05:51] That's why I say what I said, [1:05:53] because that's what he told the individual. [1:05:54] When he said it was a man of his word, [1:05:56] he wouldn't try to see if he believed him. [1:05:57] But the community watch person who spoke [1:06:01] is the one who sent the information [1:06:02] sure what's in that group about what type of house it would be and that's why I said what I did. [1:06:12] Okay, those are the final comments. [1:06:16] Right. [1:06:18] Fall in favor say aye. [1:06:20] Uh-huh. [1:06:20] Opposed? [1:06:21] That passed this 9-0. [1:06:22] Mr. City Attorney, I have. [1:06:24] Uh-huh. [1:06:24] Mr. Regimen, you can sit down. [1:06:27] Yeah. [1:06:28] Um. [1:06:30] After this, I really would like to get some clarification on what happens. [1:06:36] When a group home is in a county and group home is in a city, what that those regulations [1:06:43] look like, enforcement look like. [1:06:46] You like us to provide you with that? [1:06:47] Yeah, I would. [1:06:48] Yeah, I would like to know that how just categorize it. [1:06:51] Some of the confusion has to do with the exact label and the multiple labels here involved. [1:06:57] Group home is not one of them, but I know what you're talking about. [1:07:00] Well, root care care, what it, how are you, but it's a smaller version than the larger version is county's language [1:07:06] Maybe similar, so I have to kind of make sure I know what you're exactly pointing at and we can certainly provide that. Yeah [1:07:13] I'm very interested in knowing that difference. Even though this is something new this come up tonight. [1:07:25] Okay, we close the public hearing [1:07:29] concerns questions [1:07:32] motions. [1:07:36] Okay, moved by Mayor Pro Tem, seconded by Tammy, and this is for the annexation. [1:08:07] And that passes eight to one with Mrs. Hytawer voting against. [1:08:13] I need a motion for the next item with the statement of consistency. [1:08:22] Moved by Mrs. Thurm, seconded by Mrs. Busuator. [1:08:26] The Greensboro City Council believes that it's action to approve the original zoning request for the property at 4012, [1:08:33] Hickory Tree Lane from County RS40 to City R3, to be consistent with the adopted GSO 2040 comprehensive plan, [1:08:42] and considers the action taken to be reasonable and in the public interest for the following reasons. [1:08:49] Excuse me. [1:08:50] The request is consistent with the comprehensive plan's feature built for map and future land use map. [1:08:55] The proposed city are three zoning district permits uses that fit the context of surrounding area and the limits negative [1:09:02] Impacts on the adjacent properties [1:09:04] Three the request is reasonable due to the size physical conditions and other attributes of the area [1:09:09] It will benefit the property owner and surrounding community and approvals in the public interest [1:09:15] Council please vote and [1:09:29] that passes 8 to 1 with Mrs. Hightower voting no [1:09:32] So now we move on to the general business portion of our agenda. [1:09:39] Item I1 is a resolution to authorize a contract in the amount of $645,500 with forestale meadows LLC. [1:09:52] Are there moved by Mrs. Abusewader, seconded by Mrs. Thurm, Council please vote, [1:10:10] and that passes 9-0. [1:10:11] Item I-2 is a resolution approving change order number 2 in the amount of $36,328.66 with Bar Construction Inc. [1:10:23] For phase 2 improvements and close out to Spencer Love Tennis Complex for contract number 2018-059-A, [1:10:36] moved by [1:10:55] Mr. [1:10:55] I-3 is a resolution to amend professional services agreement in the amount of 250,000 with Greensboro Sports Foundation. [1:11:04] Madam Mayor, I need to recuse myself. I serve on the board of the Sports Foundation. [1:11:08] Okay, so noted. [1:11:11] Moved by Mr. Hightout. [1:11:13] Mr. Hightout. [1:11:16] I stopped, I stopped. [1:11:31] Moved by Mr. Zach Muthini. [1:11:35] Seconded by Mrs. Ibusa-Water. [1:11:38] I apologize. [1:11:41] Madam Mayor. [1:11:42] Oh, that's right. [1:11:43] Who was the second? [1:11:44] It was not Mary K. [1:11:47] Seconded by Mrs. Thurman. [1:11:49] No, I'm afraid to say. [1:11:53] That's what please vote. [1:12:06] Has everybody voted? [1:12:08] Councilmember Hightower and Hoffman. [1:12:11] Mrs. Hightower, please vote. [1:12:13] Mrs. Hoffman? [1:12:13] I [1:12:21] vote yes, my voting screen did not come up for some reason. [1:12:26] And that passes eight to one with Mrs. Abusuator recused, eight to zero with Mrs. Abusuator [1:12:36] recused. [1:12:37] Thank you. [1:12:41] Item I4 is an ordinance establishing, I want to make sure I'm in there, it is, item I4 is [1:12:49] an ordinance establishing, Tanger Center General Capital Improvements Fund, [1:12:56] moved by Mrs. [1:12:58] Abusawaiter, seconded by Mayor Pro Tem, [1:13:05] and just for general knowledge. [1:13:10] This is to be able to spend some of the money that Tanger Center made. [1:13:16] Is that correct? [1:13:17] Council Member Hoffman. [1:13:23] You know, the voting link is not coming up, I'm voting for it. [1:13:26] So, again, this is money that they've earned that we are allowing them to spend in that [1:13:33] past is 9 to 0. [1:13:35] Thank you. [1:13:36] Item I-5, boards and commission list. [1:13:40] Mrs. Hightower? [1:13:42] No? [1:13:44] Dr. Wells? [1:13:56] That was seconded by Mayor Pro Tem. All in favor say aye. [1:14:00] Aye. [1:14:00] Aye. [1:14:01] Mrs. Hoffman. [1:14:03] Aye. [1:14:05] Dr. Wells. [1:14:06] Anyone else? [1:14:06] Yes. [1:14:07] Mr. Misini. [1:14:08] Motion to adjourn. [1:14:10] No. [1:14:14] Do you have any boards and commissions? [1:14:18] So, Mrs. Hoffman. [1:14:21] I have no appointments, Mayor. [1:14:23] Thank you. [1:14:24] Mrs. Thurne. [1:14:25] Mayor Pro Tem. [1:14:27] Mrs. Abusaweider. [1:14:28] Mr. Holston, all right. Council comments, Mrs. Hightower? [1:14:36] So, first of all, let me just say, [1:14:38] yeah, we're going to adjourn on a high note. Mr. Hightower. [1:14:42] Mr. Hightower. [1:14:47] So, [1:14:50] for many of you all, I'll leave that coming for last. One thing I do want to, [1:14:56] I have a concern about Mr. Sidious, man. [1:15:00] Senator, you know, we voted a few months ago to do a Southeast area plan. And while I think [1:15:11] maybe now there's been an RFP to get someone to do that, this thing has been dragging out [1:15:18] and dragging out. So most recently, there's been discussion of an overlay district for [1:15:27] But down friendly, Mr. City Attorney, I asked you today because I've heard some things [1:15:33] saying overlay districts aren't allowed. [1:15:36] I don't know. [1:15:37] Were you checking that out for me? [1:15:40] If it's not allowed, then why are we doing it, then stop. [1:15:45] But if it is allowed, what is the process, and why is it moving faster than the Southeast [1:15:52] area playing it? [1:15:54] I won't ever rethink to stop until the South East area plan has begun. [1:16:04] We talked about it, we gave direction to do it, and yet it's just like whatever it is. [1:16:16] I try to do, just get hung up, get stopped, I don't get it, but something else come along [1:16:23] And that just rolled to the point that I saw it on the news, I even saw it on the news. [1:16:32] And the news says, I'm going to be a public hearing in January with a look. [1:16:36] I'm like, well, what, what, [1:16:40] please make me understand this. [1:16:43] Because right now I don't. [1:16:46] And until we get this moving properly, [1:16:51] We need to focus only on what we said we were going to do months ago. [1:16:58] We committed and the council did vote to support a Southeast and area plan. [1:17:06] That needs to happen. [1:17:09] I mean, if I didn't respond to that, the planning director is not here, but I don't know [1:17:14] where this is coming from. [1:17:16] Nothing has changed. [1:17:17] Nothing has stopped. [1:17:18] We issued a request for proposal and I believe that that request for proposal either the deadline just came and went or is almost. [1:17:27] I know that personally, I had planning firms that reached out to me because they saw it posted as as recently as two weeks ago, three weeks ago. [1:17:37] So, I'm not sure where it's coming from that nothing has been going forward. [1:17:43] I know that things have been moving forward. [1:17:45] I saw an email from Krista Black earlier and I just want to caution on Council that sometimes [1:17:51] people make assumptions without necessarily verifying, you know, their facts or their information. [1:17:59] Council did not ask us to do an overlay district, they did ask us to move forward on this [1:18:04] this area plan. And I know that we are. And I know that there's even being conversations [1:18:11] around bringing a staff person on board to help manage that effort. And so again, unless [1:18:22] someone tells me that if had otherwise, I do know that in what I've been briefed on, as [1:18:28] recently as a last week. Nothing has changed. Everything is [1:18:31] still moving. I'm not saying nothing has changed. What I'm [1:18:34] saying to you is there's there's two paths. I saw the email [1:18:39] from Miss Black as well. I'm not concerned about our email [1:18:45] while it was factual. In essence, that's not the point. The [1:18:52] point is I brought this up months ago and it just seems to have drug and drug and drug. [1:19:01] Now I hear about an overlay issue. That's not something that has been made up. That's [1:19:08] something I saw on the Fox 8 News myself that I saw and they even listed a schedule of [1:19:17] going to be public hearings. It was moving forward in January. And I'm like, well, once again, [1:19:24] we got a plan in another area that can move quicker than the one we've been talking about [1:19:30] and waiting on. And we've been very patient because I get this process, I get you on the [1:19:36] doing R.P. You want to get your proper planner, but again, I want all the focus on this random [1:19:42] road corridor in the southeast area. You know there's things that now starting to happen [1:19:50] in that area that if we don't have some kind of say in, it's just going to be a mishmash of [1:19:58] stuff. It's going to be something very similar to what we have tonight. We're going one thing in [1:20:02] the county, one thing in the city. One thing here, one thing there. We need to, I'm going to say it, [1:20:08] But I need some, I need to feel like that there is some urgency, there is some concern. [1:20:19] I just need to feel that way and I don't feel that way. [1:20:23] When you see the news and you hear what was said on the news and you're like, where did [1:20:29] this come from? [1:20:30] Where did this overlay district come from? [1:20:32] Where did this move forward come from? [1:20:34] I just, I just need to feel like there is some focus on it. [1:20:39] Are you talking about it? [1:20:40] I really do. [1:20:41] Overlay District, Southeast or for another, I don't understand the connection between [1:20:47] Overlay. [1:20:47] There's a, that's being proposed for the friendly avenue, Gary. [1:20:52] That's being proposed for friendly. [1:20:55] The big zoning. [1:20:56] It's a whole article in the paper. [1:20:58] It's, it's, it's on the news. [1:21:02] But I'm saying to you, I really don't want to have to say what I really feel down here. [1:21:12] Yeah, I understand what you're saying, but I will also say that it's almost like comparing [1:21:18] our first two oranges over the district on the area plan and not the same thing and one [1:21:24] requires a different level of effort. [1:21:26] It's not the matter of being the same thing. [1:21:29] I'm not talking about the plan itself, I'm talking about the attention to the plan and how one can, one is moving and one is moving this way and one is moving like this. [1:21:46] That's what I'm speaking. [1:21:47] I'll take a look at it. I would absolutely do, but I'm not, I don't really think it's [1:21:54] because of any malicious intention. If that's the, if that's what I'm hearing, I don't [1:22:01] think it is because of that, but I will, I will look into that. [1:22:05] I just would like to see the attention and the focus on an area that's really growing [1:22:11] And it's grown by leaps and bounds and people in the community want to feel like they're [1:22:16] a part of something going to be designed for them to protect them. [1:22:22] And that that's what's not being felt and maybe something's happening behind the scene [1:22:29] but it's right now it doesn't feel good, doesn't feel like it. [1:22:32] Thank you. [1:22:34] One last two. [1:22:35] Thank you. [1:22:36] Thank you. [1:22:36] Um, and so lastly, as all of you know, I've been out because I am now a new grandmother [1:22:44] and I've got a brand new grand girl, a beautiful girl named Skylin' Brielle and she is the [1:22:53] love of my heart and I will be working harder than ever to make sure this community is a [1:23:01] a good place for her to live, so yeah, so she is beautiful, [1:23:11] she's very beautiful, and she's a sweetheart, [1:23:14] and so this has been the best few weeks, [1:23:18] and I look forward to much more joy in the future. [1:23:23] So thank you all for understanding [1:23:24] why I was away for a little while. [1:23:27] I almost didn't come tonight, but my daughter said, [1:23:30] it's okay. I just love the way she makes you smile. Yeah she's yeah she doesn't [1:23:40] she wants she's my little Lollipop. So thank you all. Dr. Wells? [1:23:51] Hope that everyone will [1:23:52] have a blessed holiday season and it's good for all of us to be together. [1:24:02] I'm [1:24:02] being a grandmother. And I think all of us up here know the joy of having grandchildren. [1:24:08] So wish all of you a happy holiday. Merry Christmas. Oh, oh, oh, oh, oh, what's that? [1:24:15] I'm sorry. That's it. Mercate. Mr. Hussain. And you keep looking. I'll keep hoping and hoping [1:24:21] and praying. Thank you. Mr. Zach Methini. [1:24:32] Mrs. Hoffman? [1:24:33] Um, [1:24:37] nothing, other mayor, we're living in very troubled times, but you know, I can only wish for, um, for our city and our citizens a holiday of, um, you know, um, [1:24:52] an enjoyable holiday with family and friends and for a peaceful time. Thank you very much. [1:24:58] Thank you. [1:24:59] Mrs. Thurham? [1:25:03] Likewise, I'd like to wish everybody a wonderful holiday season and a meaningful holiday season filled with peace and joy. [1:25:12] I'd also like to thank those members of the community that came out last week for the rededication of the statue. [1:25:22] As we had a meaningful and very important service at the women of the show, she wouldn't take off her boot statue. [1:25:30] and thank you, Madam Mayor, for coming and sharing your fine words with us. [1:25:35] It was very much appreciated. [1:25:37] Thank you. [1:25:39] Mayor Pro Tem? [1:25:41] I just want to wish all of you and Greensboro and in this country and in this world. [1:25:51] If you're celebrating a holiday, a great holiday, [1:25:55] but I wish all of you peace and contentment and love, and I just encourage you to reach out for those you love your family, your friends, and enjoy them and be grateful that you have them. [1:26:12] Thank you. [1:26:14] Thank you. [1:26:16] Mr. Speaker, thank you Madam Mayor, just want to make sure that everyone who is traveling is very safe, that we all take this time to reflect and hope that everyone will pray for peace, so thank you. [1:26:30] Thank you. Mr. Holston. [1:26:34] Thank you, Madam Mayor. Very briefly. First, thank you so very much for the resolution on homelessness. [1:26:42] It's an issue that is really impacting our community and I want to say that this council has done a lot towards homelessness and housing and I look forward to doing even more in the future so that everybody in our community can have a place to call home. [1:26:58] And then also for everyone to have a happy and safe and peaceful holiday season, and we'll see you in 2024. [1:27:05] Thank you Madam Mayor. [1:27:06] Thank you. [1:27:06] Did you need to add something Mrs. Hightower? [1:27:09] Yes Madam Mayor, I was so excited about my grand baby, but, yeah, there's one other thing I need to discuss, Mr. City Manager. [1:27:21] that SPE that we've I've been waiting for that's another one that I've been that I'll just say again it's moving like this just moving like this. [1:27:34] We went to the legislature we got it passed we fought to get it passed and now just it seems like it's sitting in quick saying and I need to see the urgency around this [1:27:49] We should have already had something proposed in [1:27:54] start to be working on, not only just working on it, [1:27:58] but getting the plan implemented alongside the MWBE piece. [1:28:04] There is a small business enterprise piece. [1:28:07] And the first time we went to the state legislature, [1:28:10] they didn't pass it. [1:28:12] The second time we went, we got it. [1:28:16] And so now what are we doing with it? [1:28:18] We just we we I just need to see a better sense of urgency when it comes to these things [1:28:26] Mayor I don't you know I [1:28:30] Know you mayor have been asking me about what's going on with it? What's going on with it? [1:28:34] Quite frankly, I don't even know and we don't need to reinvent the wheel on this when [1:28:40] Charlotte and Durham both have SVE programs [1:28:43] I don't see why we can't pick pick the best out of both and come up with our own [1:28:47] but it has been, I think, over a year now. [1:28:51] Well, it's been, I can go back and find [1:28:55] what it was filed in 2021. [1:28:59] So, it's been too long. [1:29:03] And, yeah, I mean, the SBE piece of it [1:29:07] should not be that complicated and difficult [1:29:11] to put together. [1:29:12] Yes, we want to look at some things here [1:29:14] in this area, but we have numbers from before. [1:29:17] we have data why we're not getting it done you won't find any disagreement from me on that one [1:29:27] we will we will provide you an update on both of those two items this week thank you so [1:29:33] very much now I end on a good note hey sweetheart Lollipop is your Grammy Mr. Olson you [1:29:42] Did something quick you needed to add? [1:29:45] Yes, I wanted to say congratulations to Bishop George Brooks. [1:29:50] Earlier this month, there was a dedication of the private drive there at Mount Zion Baptist Church. [1:29:56] It was joined there by Mayor Vaughan and also Dr. [1:30:00] Thank you, Wales. [1:30:02] And Mayor Pro Tem, I'm sorry, thank you, Mayor Pro Tem, I'm looking right at you. Looking right at you. It was an honor to be there and to celebrate with Bishop Brooks on the dedication of his new private drive. Thank you. I just want to say happy holidays to everyone, no matter how you celebrate. Enjoy the time you have with your families. There are many people in our city and across the globe. [1:30:29] who have empty spaces at the table and if we would keep them in our prayers and [1:30:36] hug our families just a little bit tighter. I think, amen. [1:30:45] You guys don't have [1:30:46] anything? Well just also want to wish everyone happy holidays. [1:30:54] Ditto. Motion to [1:30:55] teacher, all in favor say aye. [1:31:00] Hi.
