[0:13] I'm going to call this meeting to order [0:14] of the uh city council of the city of [0:17] Haywarden. We are in the city hall, the [0:20] council chambers room. It is Wednesday, [0:22] December 10th, 2025 at 5:30 p.m. [0:28] We have our standard agenda items. [0:31] Um, [0:33] first item is to approve the November [0:35] 12, 2025 regular meeting minutes was in [0:39] your packet. Could I have a motion, [0:41] please? [0:41] >> So, move [0:42] >> and a second. [0:44] >> Second. [0:49] » Fight over it. Mhm. [0:51] >> Go by alphabetical order. Uh we've got a [0:55] motion in a second. All those in favor [0:56] of approving the minutes from last [0:58] meeting, please say I. [1:00] >> I. [1:00] >> Opposed? [1:02] >> Passes four to zero. [1:08] 1B is approval of uh December 10th, 2025 [1:11] claims for payment. Could I have a [1:13] motion, please? [1:15] >> A motion to approve [1:16] >> and a second. [1:18] >> Second. [1:19] Uh any questions on the claims? [1:24] If not, all those in favor, please say [1:26] I. [1:27] >> I. [1:27] >> Opposed? [1:29] Passes four to zero. At this time, we [1:31] have open business from the community. [1:33] Do we have anyone who would like to [1:34] speak to the council tonight? [1:39] Seeing none, we'll go on to the mayor's [1:42] report. I do not have a report tonight, [1:44] so we'll jump to the staff reports. [1:46] Jacob? [1:47] >> Yes. Um, we have an extended uh agenda [1:51] this time, so I'll keep my things brief, [1:53] but I just wanted to thank John again [1:55] for coming back and doing another six [1:57] months with us and uh closing out this [1:59] term. I want to thank uh Patty for her [2:02] continued service to the city of [2:04] Haywarden and uh the community. Uh she [2:06] has done many many things for the [2:08] community and this is just one of the [2:10] last things that she's done as being a [2:12] council member from January of 2022. [2:14] just wanted to thank her for all that [2:16] time and everything that she's done. I [2:18] wanted to welcome the incoming uh board [2:20] members uh Ben and Trevor. Uh I am [2:22] excited to work with you guys as well. [2:25] Also wanted to welcome Misty to the [2:27] city. You guys got to see her a little [2:29] bit earlier today. Uh Misty is coming to [2:32] us from Sous City. Uh she graduated with [2:34] a bachelor of science in public [2:36] accounting and uh we have been working [2:38] together a little over a week now and I [2:40] am excited to have her on board. It's [2:42] going to be a great addition to the [2:43] team. And I also wanted to thank our [2:46] staff that have been putting in very [2:48] long days and lots of hours to make sure [2:51] that our roads are clear with these uh [2:53] many snow days that we've been having. [2:56] So, and that is all. [2:59] >> Okay. Thank you, Travis. [3:02] >> Uh just going to update everybody on the [3:04] park shelter. Uh it's substantially [3:06] completed. Uh we're just working on the [3:08] flooring and then they'll get the [3:09] cabinets in and then we should be ready [3:12] to go. um hopefully open that up uh [3:15] sometime in January for rentals. Um just [3:19] want to get the final touches and [3:20] everything, get it to be a go. Um I did [3:23] pass out the design. We have an [3:26] opportunity uh on the flooring, the [3:28] concrete. We're going to stain it. Uh [3:30] then they put down a polyurethane and [3:32] then they'll put this stencil out and [3:34] then another layer gets put over top of [3:36] that. So I think this will be a a nice [3:38] addition. And then also the name um was [3:42] uh Veterans Memorial Park or Veterans [3:45] Memorial Shelter um is what the um [3:50] winner the winning name was. Um so [3:53] that's all [3:55] we're going with that. And then [3:57] substation transformers, the old [3:59] substation. Um I've put it out there for [4:02] quotes to get that scrapped out and then [4:05] sent off. So, um hopefully um in the [4:09] next few months we'll get those taken [4:10] out and so we can get that area cleaned [4:12] up. [4:16] » Okay. Thanks, Travis. [4:19] Chief Depri, [4:20] >> nothing. Thank you, Carol. [4:24] >> I'm excited to announce that the USDA [4:26] has opened up another opportunity for [4:28] some people who had quite a bit of [4:30] damage to the flood. Um they're offering [4:33] $44,000 of a grant. Um it is an income [4:36] eligible opportunity, but if you [4:39] qualify, it's an easily funded one. Um [4:42] so that'll be available for individuals, [4:44] homeowners if they'd like to come in. [4:46] I'm just working on a couple other grant [4:48] opportunities. Um just getting through [4:50] the end of the year. Um other than that, [4:53] that's about it. [4:54] >> Okay, great. Thank you, Carol. Jenny, [4:57] anything tonight? [4:58] >> No, nothing. Thank you. [5:00] >> All right, we'll open it up to council [5:02] comments at this time. Does anyone [5:05] have a comment. [5:07] >> Yes. I just want to say thank you to [5:08] John for coming on board with us and [5:11] helping us out here the last couple [5:12] months and also to Patty Anderson for [5:15] all of her work that she put forth um in [5:18] serving as a council member as well. [5:21] >> Very good. I'm sure we all share that [5:23] sentiment. Thank you to both of them. [5:26] >> Yeah. I just say it's been a pleasure to [5:28] be up here again for the last few months [5:30] and thanks to everyone for their trust [5:32] and letting me sit here. So hopefully [5:34] it's not the last time, but I have faith [5:36] in those coming in. So we'll see where [5:38] this goes. [5:39] >> Good. [5:39] >> Put that name tag back in the drawer. [5:41] >> Yeah, I'll save that for later. [5:42] >> Save it. Yes. Kept it for this long. [5:47] >> Anyone else? [5:48] >> I want to thank John, thank Patty. Uh [5:52] you guys' experience has been uh [5:55] paramount for all of this. Uh, also that [5:58] there is [6:00] this Saturday wreaths across America's [6:01] coming and there's about 400 wreaths [6:04] that need to be laid on veterans ce [6:06] veterans gravestones at the cemetery. [6:08] Um, so if anybody's willing to help at [6:12] 11:30 go to the little shel the little [6:14] shop shelter at the cemetery and uh uh [6:17] Terry and Mike Coulson are kind of [6:19] heading that up and Sud Young guys at [6:21] the Eagles. So, if anybody wants to help [6:23] do that, uh 11:30 on Saturday. So, [6:28] >> okay. At How many wreaths you have [6:31] coming in? [6:32] >> 400, I think, is what they said. [6:33] >> Wow. [6:34] >> Yeah. There's there's their plan is to [6:36] have one for every there's 669 [6:39] veterans buried in our cemetery. And [6:41] their goal for next year is to have one [6:42] for every single veteran. [6:44] >> So, [6:45] >> do you remember how many you had last [6:46] year? [6:46] >> None. Well, I think they had a hand they [6:49] had a handful, but not nearly as many as [6:51] they do this year. So, [6:52] >> that's that's amazing. [6:54] >> Thank you for for your work on that and the others also. [7:00] Okay, then at this time we have uh some [7:05] oath of offices to give. We're going to [7:08] start out with Rob. We're going to just [7:10] go in front here and have you read your [7:12] oath. [7:15] Raise [7:28] your right hand and read your oath, [7:30] please. [7:30] >> I Rob Fluffy do so I will support the [7:33] United States and Constitution of the [7:35] State of Iowa and I will faithfully and [7:38] to the best of my ability all the duties [7:40] of the city council for the city of [7:54] and then uh [7:59] » you sure did check [8:01] >> and then you can keep [8:06] me square that I will support the [8:07] Constitution of the United States and [8:09] the Constitution of the State of Iowa [8:10] and that I will faithfully and [8:12] impartially to the best of my ability [8:14] Discharge all the duties of city council [8:16] for the city of Horton as now and [8:18] hereafter required by law. [9:53] » I want to sign this one and this one [9:55] both of them. [10:00] Jacob with the exception of probably [10:07] » I can email you [10:09] >> open meetings. I've got certificates for [10:11] almost everybody. [10:15] » All right. Uh this one's yours with that [10:17] pen. [10:28] Okay. Like to thank all of those who are [10:30] willing to serve uh the city. LET'S [10:40] we'll move on. We've got a public [10:42] hearing to dispose of real property. [10:47] Um can you give us some information on [10:49] that, Jacob? [10:51] >> Yes. So this is uh the one that is being [10:54] sold to SD construction. This is going [10:56] to be our public hearing. Um I [11:00] have not myself heard anything. Have you [11:02] heard anything? Any public comments? [11:04] >> No, nothing at this time. [11:07] >> Okay. We will open up the public hearing [11:09] at this time. If there are any comments [11:11] from anyone in attendance, can hear them [11:14] now. [11:18] Not seeing any. We will move on. Um, [11:23] could use a need a motion to approve [11:26] that resolution 202523. [11:30] >> I'll make a motion to approve resolution [11:32] 2523. [11:33] >> And a second. [11:34] >> I'll second. [11:36] >> Further discussion. [11:39] We'll do roll call. Allan [11:41] >> I. [11:42] >> Warner. [11:43] >> I. [11:44] >> Felacer. [11:45] >> I. [11:46] >> And Klucky. [11:48] >> I. That passes four to zero. Thank you. [11:53] Moving on to four. [11:56] We've got a resolution 2025 24 setting [12:00] public hearing on proposal to dispose of [12:04] real property. We will open the um the [12:08] public hearing at this time. [12:09] >> No, no, no. This is just setting the [12:10] public hearing. [12:11] >> Setting the public. Gotcha. [12:13] >> Thank you. Yep. [12:14] >> Uh so um anything you want to add to [12:17] that? Yes. [12:19] >> All right. So, the Haywardarden Chamber [12:21] and Economic Development is looking to [12:23] purchase this property. Um, they've had [12:25] a lot of interest from people that have [12:27] been trying to look for a place to put [12:28] something. They show them this property, [12:30] but then there's a lot of unknown stuff [12:33] kind of going on. They have to build up [12:35] and they don't want to um they want to [12:37] just kind of know what the price is. So, [12:38] a lot of people have been backing off [12:40] after they show them that and they show [12:41] that this going on. So, the chamber got [12:43] together and came up with this idea to [12:46] just get this [12:48] uh uh spend what it needs to get it up [12:51] uh to where it's supposed to be. Uh so [12:54] that somebody can build on it and then [12:56] somebody will have just that that's the [12:58] price that they will pay and make it [13:00] more enticing for them to uh come in and [13:03] get it. Uh and they are not looking to [13:07] uh make any profit off of it. They're [13:09] going to do it the same as if we were to [13:10] sell it. They're just doing the work to [13:12] build it up and spending that money to [13:14] make it more enticing for somebody to [13:16] move in there. Any [13:21] questions? Yeah. Okay. Got a motion. [13:23] >> Second [13:24] >> and a second. We'll do a roll call here [13:27] again. Uh Warner [13:28] >> I. [13:30] >> Philer. [13:31] >> I. [13:32] >> Clucky. [13:33] >> I. [13:33] >> Allen. [13:34] >> I. [13:35] >> Motion passes four to zero. [13:39] Number five. Resolution 202525 [13:43] setting a public hearing to consider [13:45] proposed changes to the Haywarden code [13:47] of ordinance by amending cable [13:49] television utility rates and fees. It is [13:53] my um goal to have more public hearings [13:56] for these ordinances that uh change [13:58] monetary um stuff for citizens. So uh [14:02] this will just be the setting a public [14:04] hearing for our final reading for the [14:05] ordinance for cable rates. Um, I want to [14:07] make sure that I read clearly tonight, [14:11] especially uh the rates and what they [14:13] were and what they're going to and why [14:16] so that uh anybody watching uh later on [14:20] or listening in later on can have [14:23] something to kind of reference and know [14:25] what's going on. So, uh but just uh [14:28] setting the public hearing so that they [14:30] have their chance to come give us their [14:31] input before we set the rates. [14:36] Okay. Any questions on that? [14:41] » So move. [14:44] >> Second. [14:45] >> Okay. We've got a motion in a second. [14:48] Any further discussion? [14:51] If not, we'll do roll call. Felteer. [14:53] >> I. [14:55] >> Cluckucky. [14:55] >> I. [14:57] >> Allen. [14:57] >> I. [14:58] >> Warner. [14:59] >> I. [15:00] >> Motion passes four to zero. Setting the [15:03] public hearing. [15:04] Uh number six is uh the second reading [15:07] of ordinance 761 which is an ordinance [15:10] amending cable rates and fees of the [15:13] city of Haywarden by amending sections [15:16] 113.09, [15:17] 113.10 [15:19] and 113.13. [15:23] Um [15:24] >> yes. Yeah. So this is actually changing [15:27] the rates. Um last meeting I I spoke [15:30] about it uh but I know I kind of [15:31] stumbled over a couple things. So, I [15:33] want to see if I can do it a little bit [15:34] more clear for people. Um, currently [15:37] right now, we have two primary packages [15:40] for cable. We have a basic and we have [15:42] an expanded. Uh, the basic right now [15:44] without taxes is 37.93 a month and [15:47] expanded is 9227 a month. Now, our [15:51] actual cost to the city to transmit [15:54] those packages to the customer is [15:56] actually $42 a month and $112 a month to [16:01] transmit that to them. So, we have been [16:03] losing money every single month, every [16:05] single customer for everybody that has [16:08] uh cable and uh we can't sustain that if [16:11] we're going to continue to have [16:13] high-tech be a competitive and good um [16:16] utility. So, we are just going to try [16:18] and raise it to a rate that just kind of [16:21] breaks us even so that it's not um [16:23] eating away at some profits. So, uh what [16:26] we have in this ordinance is to raise it [16:28] up to $43 for the basic a month and $113 [16:33] for the expanded. Um, and then I also [16:37] just kind of wanted to highlight that in [16:39] this ordinance it also removes the [16:41] digital packages because we are not [16:44] being able to do digital going forward [16:46] as uh beginning in early January. But I [16:49] am told that only affects about 15 [16:52] customers. So, and they have been sent [16:55] letters to inform them of the services [16:59] that are going to be changing. Um, [17:02] I think I've covered that pretty well. [17:05] So that is uh what this ordinance is [17:07] doing. [17:10] » Okay. We're amending cable rates. Uh any [17:14] further discussion? [17:17] >> If not, I would take a motion. [17:19] >> A motion to approve the second reading [17:20] of ordinance 761. [17:23] >> Okay, Christie. And a second. [17:24] >> I'll second that motion. [17:27] >> Rob. And any further discussion? [17:32] If not, we'll do roll call. Cluckucky. [17:34] >> I [17:35] >> Allan, [17:36] >> hi. [17:37] >> Warner, [17:38] >> I. [17:39] >> Peler, [17:40] >> hi. [17:41] >> Passes four to zero. Thank you. We're at [17:45] number seven, approval of the leasing [17:46] contract. [17:48] >> Okay. So, Quadant uh has our mailer [17:50] machine. And our mailer machine, what [17:52] the city uses it for is it seals and [17:55] stamps all of our envelopes that we send [17:57] out. Uh which includes all of our [17:59] utility billing um letters that go out [18:02] every single month. So on average, I [18:04] mean we have over 1,200 items that go [18:06] through this machine a month. Um [18:10] it looks like the monthly increase right [18:13] now if we sign uh this which is actually [18:16] a the lease comes up in April but they [18:21] have a program that we can sign a new [18:24] contract with this year's rate increase [18:27] if we sign it now ahead of time. Um but [18:31] they anticipate that the rate's going to [18:32] go up. So if we wait till April, it'll [18:34] be a little bit higher. And this is just [18:36] a way that they can try and give back to [18:38] the people that have their current [18:40] contracts is to sign one slightly early [18:43] at the year before's rates. So um we [18:47] don't have to sign it now. That's going [18:48] to be up to you guys, but then come [18:50] April, we would have probably a slightly [18:53] higher contract that we would be [18:54] approving for it. So, [19:00] » I'll make a motion that we sign it now. [19:02] >> I'll second. [19:04] >> Okay, we got a motion and a second. Any [19:06] further discussion? [19:08] All those in favor, please say I. [19:10] >> I. [19:10] >> Opposed? [19:12] >> Passes four to zero. Thank you. Moving [19:15] on to item eight is discussion on mobile [19:18] vendors. [19:21] Okay. So last meeting uh we had talked [19:24] about doing the schedule of fees uh [19:26] which we tabled which we'll have to [19:28] figure out the proper process to on [19:30] table. I think one of you guys will [19:31] motion it to bring it off the table [19:33] before we can actually vote on it next [19:35] item. Um but we wanted to uh take some [19:40] time to uh talk about the mobile vendors [19:44] and maybe the definition behind it and [19:47] what all is included in a mobile vendor. [19:49] Uh specifically, there are a couple [19:51] different things that uh were brought to [19:53] our attention that we wanted to look at [19:55] that were, you know, not included in a a [19:57] mobile food truck. Um so they have the [20:00] uh the coffee that has uh delivered to [20:03] the hospital that they serve out of [20:05] there. I think it's once a month. Um [20:07] another one is the flower shop that is [20:09] uh set up like across the street from [20:11] Casey's in the springtime. Used to be uh [20:14] on Sunshine. Um and then some other just [20:19] uh vendors that sell things. Uh they uh [20:22] we just wanted to bring it up for [20:25] discussion what you guys think, what [20:26] should be included, what shouldn't be [20:28] included, why. And uh the city is [20:32] wanting to hear from you guys on what [20:34] direction you want to go for that so [20:37] that we can [20:39] put your vision on paper [20:42] because the way that it's written right [20:43] now it would stay the same with that [20:47] being just mobile food trucks. So [20:52] as I mentioned last time and I'll speak [20:54] about it again that I uh would prefer [20:57] the language to include [21:00] So it so it's not so just specific to [21:03] food trucks. So I want it to encompass [21:07] any um entity that comes to our city [21:10] that it's not brick and mortar. They [21:12] come in, they sell their items, and then [21:16] they're out. So anything like that that [21:18] we can think of. And Jenny, if you have [21:20] any guidance on this as far as wordage, [21:23] verbiage, however you want to say it, um [21:25] I'll gladly listen to what you have to [21:28] say. I think in crafting this ordinance, [21:31] it's going to be important to define or [21:34] identify a purpose of the ordinance. So, [21:37] typically they're they're crafted [21:39] towards food vendors for the purpose of [21:42] ensuring safety, sanitary conditions, [21:45] regulations. So, if we're going to [21:48] expand it, I think we have to be um [21:51] intentional about why we're expanding it [21:54] and what public purpose we are [21:57] essentially protecting. So, uh I think [22:01] that would be my take on it is if it's [22:03] expanded, we need to identify and define [22:07] why and what public purpose it is [22:09] serving. [22:16] Yeah, it for me uh you know if it's at a [22:19] private business and they bring a a [22:22] coffee company in there, that's a little [22:24] different than on the corner of the [22:26] street or wherever. So that's one thing [22:28] I see is different. And then the other [22:30] thing is like spillet soil, sweet corn, [22:34] pumpkins, different things like that [22:36] outside of the farmers market where we [22:38] start and stop. And [22:39] >> well, wouldn't that too [22:41] >> if you change it if you change it to [22:42] >> I think we got to be specific in what we [22:44] do. [22:44] >> I was going to say if you change it to [22:45] just [22:46] >> non- brick and mortar like you said [22:48] >> that affects every vendor at the farmers [22:50] market. That affects every person that [22:52] comes in to sell sweet corn. [22:54] >> That affects all the vendors that come [22:56] for Labor Day weekend. I mean, that's [22:58] what it is. They don't It's not a [22:59] brick-and-mortar store, so they'd all [23:01] have to pay this. [23:03] >> What's the purpose? [23:04] >> That's what, you know, [23:06] >> my my goal was to, you know, um make [23:09] sure we I mean, everybody does a great [23:11] job supporting small town businesses, [23:13] but, you know, those small town [23:15] businesses, they give back to the [23:17] community, and I don't see that with the [23:19] other ones coming in. And correct me if [23:22] I'm wrong. Maybe I don't know, and maybe [23:24] they do. let me know and I might be able [23:28] to change my opinion on that. [23:31] So, that's where I'm at with it. And I [23:33] don't know if that's good enough purpose [23:34] or not, Jenny, but you guys can let me [23:37] know where we need to go in the [23:39] direction with this. [23:40] >> Derek brought up the Labor Day vendors. [23:43] >> They actually pay a fee to the chamber, [23:45] I believe, for being there. So, [23:47] >> well, then they have to pay that would [23:48] pay a fee to the chamber and they'd have [23:50] to pay a fee to the city. So, [23:52] >> Yep. [23:52] >> Y [23:53] >> I mean, and a lot of those people that [23:54] do that are local. they, you know, [23:56] they're localish. Yeah. I mean, [23:59] >> yeah. [23:59] >> So, I don't want to put an undue burden [24:01] on them, [24:01] >> right? [24:02] >> You know, and this [24:05] >> I get the food truck thing. I really do. [24:07] I get the food truck thing where making [24:10] sure it's safe and all that stuff and [24:12] charging a fee for it. [24:14] >> It's kind of protecting our local [24:15] restaurants as well because they're not [24:17] coming in for free. They're not doing [24:19] any of that stuff. You know, I [24:22] understand that. But I mean all the [24:24] other ones I'm like, [24:26] you know, they're not they're there for [24:29] two months or whatever one day or what. [24:31] I don't see an issue with having that, [24:34] you know. That's just my opinion on it. [24:38] >> Where does the pedaller's license stop [24:40] when it comes to things like that? [24:43] >> Um he's talking about like the other [24:45] one, the pedaller fee where they come in [24:47] to sell things. Uh [24:48] >> so I mean like there'll be some that are [24:49] subject to that already. Uh that is [24:52] defined as like they have they are [24:54] selling um is that just like door to [24:56] door [24:57] >> door to door? [24:58] >> Yeah, [24:58] >> I think that's the definition I'm going [25:00] to look for right now because I was [25:02] thinking that same thing that some might [25:03] be covered under that. [25:07] » I did check area around us as well. The [25:11] ones that have them [25:13] are food or beverage. There were some [25:15] beverage ones. I think there's a [25:18] margarita truck that goes around that [25:20] you have to have a Right. [25:21] >> Wait, there's a margarita truck. [25:23] >> There is. There is. They have to have a license. [25:29] >> We've had a two in center where those [25:31] that had a food truck and they served [25:32] inside then they actually had to [25:33] transfer get their license to qualify [25:35] them inside. So for those that are [25:37] serving coffee in a in a facility, they [25:40] might already have to do that by Iowa [25:42] law. [25:44] >> All right. So, can you correct me if I'm [25:45] wrong here, but what I'm hearing is that [25:47] this would have to be an ordinance [25:49] change to do any of that. [25:51] >> Yeah, I'm looking at Yes. [25:53] >> Okay. So, no matter what happens, uh [25:56] what we're talking about with the next [25:58] item, whatever we say here wouldn't [26:00] change that anyways because we would [26:02] have to do an ordinance change to change [26:04] uh that um which I wasn't tracking. So [26:10] what I would say is for the for that [26:13] schedule of fees like [26:16] I wouldn't recommend to scrap that [26:19] section of it because then we're just [26:21] going to go back to what is there now [26:23] and our updated section I think is [26:25] higher than what [26:28] um than what it was. [26:34] So, um I would almost recommend [26:37] >> leave it tabled until we [26:38] >> Well, either that or pass this [26:41] >> currently proposed and then we discuss [26:44] the rest later. [26:45] >> Yeah, we can't do any of these fees [26:47] until you pass this. [26:49] >> Um well, we can do them from the old [26:50] rates, right? [26:52] >> Um we're we're trying to get those [26:53] changed, so we don't want to table it [26:55] too long. [26:55] >> Yeah, I would say if we're um going to [26:58] move because when was it tabled? Was it [26:59] last meeting last meeting? then then we [27:01] need to take it off the table. I realize [27:05] we're kind of in a time crunch because [27:07] we only have one meeting because of the [27:08] holidays, but sooner rather than later. [27:11] >> Yeah. [27:12] >> The one thing I will say because Johnny [27:14] brought up a good point about the [27:15] peddlers. It says, [27:17] so this Chris, you would cover some of [27:19] the delivery of goods or merchandise, [27:21] but just from house to house or upon [27:23] public street. So, I think that's where [27:26] it probably wouldn't cover the um [27:30] >> the park stuff. [27:30] >> Yeah, the park stuff, the private [27:32] property, but it would I guess if [27:34] they're on the street. [27:42] » I'll make a motion that we untable this [27:44] and pass the current proposed fees [27:48] resolution 2025-8. [27:51] >> It has to be two different motions, [27:52] correct? [27:53] >> Yes. First, we got to take it off. [27:55] >> My motion was to untab [27:56] >> to take it off. [27:56] >> I'll second the untabling. [27:58] >> Okay, further discussion. [28:03] » If not, this motion is to take uh the [28:06] resolution off the table. Uh Allan, [28:10] >> I [28:11] >> Warner. [28:12] >> I [28:14] >> Feldcker. [28:15] >> Hi, [28:16] >> Clucky. [28:17] >> Hi. [28:20] Okay, it is off the table now. Is there [28:24] another motion we want to make? [28:26] >> Well, do you want to skip second and [28:29] first and second readings and try to [28:31] actually get it approved before the end [28:32] of the year, or do you want to [28:34] >> um Well, we don't even have an ordinance [28:36] ready for that. So, this would just be [28:38] to approve the new [28:40] >> fees for what we have that go attached [28:42] to the old ordinance already. So, we [28:45] would have to come up with a a whole new [28:48] ordinance change to look at the other [28:50] thing. Okay. [28:51] >> Um, [28:52] and then I'm assuming that there's just [28:54] going to be um some more [28:59] things that I'll have to look into for [29:00] different possibilities with uh Jenny [29:02] and then we'll bring something to you. [29:06] >> So, [29:09] okay. Uh, we've got a motion for uh [29:12] approving the resolution 202518. [29:14] Amending the schedule of fees. [29:17] >> Second. [29:18] >> Okay. [29:20] Got a motion and a second. [29:22] Um, Warner [29:24] >> I. [29:26] >> Felnecker. [29:27] >> Hi, [29:28] >> Clucky. [29:29] >> I, [29:30] >> Alen. [29:31] >> I. [29:33] >> Okay. Resolution 202518 has passed [29:37] 4 to zero. We'll move on to 10 to update [29:41] authorized users. Yeah, this is just to [29:44] add Misti to River's Edge and People's [29:47] Bank. And we are going to take off [29:48] Travis because we don't want extra [29:50] people that don't need to have access to [29:52] it. He was our backup and we won't need [29:54] it anymore. [29:56] >> So moved. [29:59] >> Second. [30:01] Got a motion and a second. All those in [30:04] favor of updating authorized users, [30:06] please say I. [30:07] >> I. [30:08] >> Opposed? [30:09] Passes four to zero. [30:12] Item 11 is resolution 202526 [30:16] setting wages for fiscal year 26. [30:21] Okay, [30:22] I need to get down here. [30:26] So, last meeting we talked about uh the [30:28] union contract and that we had uh big [30:32] jumps that we needed to do for some of [30:33] our guys to get them back to even just [30:36] the medium range of uh their positions [30:39] comparative to other uh cities in our [30:41] area and people that do what they do. [30:44] Um, you asked me to crunch the numbers [30:46] and see how this would affect our [30:48] current year's budget. And the electric [30:51] budget would uh be increased by a little [30:54] over $14,600. [30:57] And they uh current in our budget have [30:59] that in revenue over expenses. These [31:01] will all be have to be amended because [31:04] they weren't built into the expenses, [31:06] but we have the uh um extra revenue over [31:09] expenses to cover these increases this [31:12] year. [31:13] um in almost all these departments and [31:16] I'll talk about the one that doesn't. [31:17] So, uh gas uh an increase of a little [31:21] over $7,300. Also, they have a surplus [31:24] uh a surplus uh estimated for this year. [31:28] Um water and wastewater [31:30] um are each going to be about a little [31:33] over $3,600 [31:35] and they can both support it. Telecom uh [31:39] is uh $4,262. [31:42] Now, telecom is not budgeted to have a [31:44] surplus. Um, I do not think that this uh [31:49] amount is going to make or break what [31:51] we're doing right now. And with all of [31:52] our changes that we're making, it should [31:54] still make it just fine. Uh, as long as [31:57] we stick to the schedule, uh, we will [31:59] have uh internet changes coming up [32:02] shortly as well. [32:04] And then street. Um, that one is uh [32:09] $4,262 [32:11] and we do still have uh enough money in [32:14] the rut fund to cover that as well. And [32:17] then uh cemetery uh is uh $890 $95. So [32:23] that's not really going to move [32:25] anything. And then uh the utilities is [32:28] another 1,200 that's going to be split [32:30] over four utilities. So also all of [32:33] these are very doable. this year. We [32:35] will have amendments that cover them, [32:36] but nothing is going to um negatively [32:40] affect us to be able to do it early. [32:42] Again, that's going to be completely on [32:44] you uh on your guys's decision on [32:46] whether you want to start this January 1 [32:47] with this resolution or if it waits [32:50] until July. [32:52] >> I'll make a motion to approve resolution [32:54] 202526. [32:57] » Second. [32:59] I'll second it. Further discussion. [33:06] Okay, we'll do roll call. [33:10] Feldhacker. [33:11] >> I. [33:12] >> Clucky. [33:13] >> Hi. [33:14] >> Allen. [33:14] >> Hi. [33:15] >> Warner. [33:16] >> I. [33:18] >> Resolution passes 4 to zero. [33:22] Thank you. [33:26] Next is a discussion on electric [33:29] scooters. [33:30] Um, [33:32] I had uh [33:35] in your packet you've got some [33:37] proposals. I visited with uh Jacob and [33:41] Brian about these. Um, [33:45] I've got some proposals which um provide [33:50] some critical modifications in addition [33:52] to the existing city ordinance [33:55] concerning electric scooters, [33:57] including the recent additions by the [34:00] city council. These recommend [34:03] recommendations stem from a shared [34:04] desire to make our community safer for [34:07] all residents, particularly our youth. [34:10] The time for action is now. We must [34:13] proactively prevent a potential tragedy [34:16] rather than react to one after it [34:18] occurred. [34:21] These recommendations are designed to [34:23] mitigate risk, encourage parental [34:26] involvement, and ensure that individuals [34:30] possess the necessary skills and [34:32] knowledge and judgment to safely operate [34:35] motorized scooters. [34:38] My first proposal is to require a [34:42] minimum age of 10 years old to operate [34:46] in in the city. Operating a motorized [34:49] scooter safely [34:51] requires a specific level of strength, [34:54] coordination, motor skills, judgment, [34:57] and a basic understanding of traffic [34:59] laws and city ordinances. [35:02] I believe um that our children that are [35:07] under 10 uh do not have all of those [35:10] skills that they need to travel safely [35:14] on city streets and sidewalks. The [35:17] proposal specifically is to enforce a [35:20] minimum age requirement of 10 years old [35:22] to operate a motorized scooter on public [35:25] streets, sidewalks, or parks within [35:28] Haywarden. [35:30] Um, any questions, comments, [35:34] uh, reactions to that [35:38] proposal? What are your thoughts? [35:41] >> It's not a bad idea. [35:43] You're you're you're right on the age [35:45] limit. I I've seen kids that shouldn't [35:49] even ride a tricycle, [35:50] >> right? [35:50] And I don't I don't want to see [35:52] somebody get hurt. [35:54] It's 10's a pretty good is a good round [35:59] age for that idea. It's a good idea in [36:02] my mind. Okay, [36:05] other thoughts. [36:10] Let's move on to uh proposal number two [36:13] is mandatory helmet use for riders aged [36:16] 14 and under. [36:19] The most serious injuries involving [36:21] motorized scooters are predominantly [36:22] head related. Protecting our children [36:25] must be our top priority. [36:27] The proposal is to require all motorized [36:30] scooter operators aged 14 and under to [36:33] wear a properly fitted safety helmet at [36:35] all times while riding on public [36:37] property, including streets and [36:39] sidewalks. [36:45] Reaction [36:49] It's about protecting the kids. Really? [36:51] >> Do we require it for a bicycle though? [36:53] >> We do not. [36:55] >> The only counter argument is [36:56] >> that'd be Yeah, that's that devil's [36:58] advocate counter argument. We don't [36:59] require it for a bicycle. I understand [37:01] the scooter goes faster [37:03] >> and protecting kids is a paramount, but [37:07] can we require one without the other? [37:09] >> In my mind, a scooter is dramatically [37:12] different than a bicycle. When you take [37:15] a look at the uh the size of the wheels [37:18] and the stability, [37:20] um [37:22] I a bicycle would handle uh ruts in the [37:26] street and uneven sidewalks much better [37:29] than a um um [37:33] a electric scooter would be. Plus, uh [37:36] you've got kids standing on it [37:38] >> rather than sitting on a bicycle. I I [37:40] feel like a bicycle is a different [37:44] animal. [37:45] Um [37:46] >> yeah, I don't dis I don't disagree. [37:48] >> Yeah, these we are talking about [37:50] electric motorized scooters. [37:51] >> Electric motorized scooters. [37:54] >> That's easy to not like the [37:56] >> not the ones you [37:57] >> Right. Right. [37:59] >> Those don't go very fast. [38:01] >> No, this is No, you're right. It just [38:03] that was my counter argument. We don't [38:05] require for a bicycle. [38:06] >> That's a good point. Okay. Anything [38:15] else? [38:19] My third proposal is to uh set a speed [38:23] limit of 15 miles per hour for the [38:25] motorized scooters. The higher speeds [38:28] drastically reduce the time available [38:29] for both scooter operators and vehicle [38:32] drivers to avoid collisions leading to [38:34] more serious incidents. Uh, I know I [38:38] have witnessed um riders on motorized [38:42] scooters um going faster than 15 miles [38:46] per hour. And it's to me it's scary to [38:49] see that. Um the proposal would be to [38:53] implement a speed limit of 15 mph for [38:56] all motorized scooters operating within [38:58] the city limits regardless of location, [39:01] street, sidewalk, or bike path. [39:04] I have a question about can we can we [39:06] actually enforce this one because not [39:08] all scooters have speedometers. [39:10] >> So the kids don't know how fast they're [39:11] going, [39:13] >> right? [39:13] >> Can we can this one actually be enforced [39:15] because they don't know? [39:17] >> I talked with Brian about this and and he had concerns about the radar [39:22] guns, you know, don't do that. [39:25] uh it would be a subjective thing and it [39:28] probably would be something that if you [39:30] see somebody and I think maybe we have [39:32] some language already that if someone is [39:35] driving um [39:38] beyond the the situation the road [39:42] situation and and such that that would [39:44] be um against the rules anyway. I don't [39:48] know if it's in our ordinance or not, [39:50] but [39:50] >> yeah, if if they're operating in a [39:53] manner which is um [39:56] harmful to public safety to themselves [39:58] or others, then we can address it [40:00] >> just under because they're required to [40:02] obey any general traffic laws under the [40:05] Code of Iowa. [40:07] >> Yeah. [40:08] >> So, we don't do Do you really I mean, do [40:10] you really need the specific language of [40:12] 15 miles an hour? Because if the kid [40:14] doesn't, like I said, if the kid doesn't [40:15] know how fast they're going, can you [40:17] give a kid a speeding ticket on a on a [40:19] bicycle? [40:22] » No. [40:23] >> Okay. So, if there's no speedometer, you [40:25] can't tell how fast you're going. Is it [40:27] really fair to the the kid or And but if [40:30] they're driving it recklessly, that's a whole different animal. So, [40:32] >> yeah. And frankly, if uh a kid is [40:37] driving at 15 mph on our streets or [40:40] sidewalks, that that's reckless as far [40:42] as I'm concerned. Um and as far as [40:46] enforcement, uh there would be [40:48] definitely some um subjectivity uh on [40:52] the part of uh the police. I do think it [40:56] would be um [40:59] it would be good to have [41:03] um the police maybe pull over someone [41:05] who is in their opinion driving too fast [41:10] and [41:11] especially 15 miles per hour. Um it [41:15] gives them the opportunity to pull them [41:16] over and talk to them about it. I would [41:19] not ticket somebody probably for uh you [41:22] know going 16 miles per hour or 17 miles [41:25] per hour, but sometimes sometimes we [41:28] need a little [41:28] >> one kid over for going too fast. Word's [41:30] going to travel that hey don't go too [41:31] fast you're going to get pulled over. [41:33] >> I mean kids are going to talk to each [41:34] other. So it's not it's not a it's not [41:36] such a bad thing. I just don't know if [41:39] that [41:39] >> how do you enforce [41:40] >> how do you well yeah how do you enforce [41:41] it and then [41:43] >> having it be specifically say that you [41:45] know writing recklessly is a is a [41:47] different animal. So if it said that, [41:50] which our ours already does, that's we [41:52] don't necessarily need that verbiage. [41:55] >> Correct. [41:56] >> So, [41:58] >> okay. Yeah. And Jenny, could you look at [42:01] that to see and not right now [42:03] necessarily, just to see that our [42:05] current language would cover [42:08] >> Well, the we don't need current [42:10] language. So, the code of Iowa covers [42:12] it. So, any reckless use is already in [42:14] the code of Iowa. So like chief had [42:17] indicated it's it's already there. [42:20] Reckless, [42:21] >> okay, [42:21] >> is already there. You know, they have to [42:23] stop at stop signs. They have to, you [42:26] know, yield at yield signs. They have to [42:28] yield to the rightway. They're subject [42:29] to the same traffic regulations [42:33] that are already set forth in the code, [42:34] which would include reckless. [42:36] >> Would we be better to say like we [42:39] recommend speeds under 15? [42:42] And I don't know, [42:44] >> my concern has always been enforcability [42:47] >> within these regulations. You know, the [42:50] first two I think are are obviously a [42:53] lot more [42:54] >> easy to regulate because they're not [42:56] subjective. [42:57] >> The the speed limit's going to cause a [42:59] lot of issues, I think, from a [43:00] subjectivity. We can't have subjective [43:03] regulations. [43:05] >> I should can't say we can't have, but it [43:07] will make [43:09] >> chief's job a lot harder. [43:11] um as well as you know his officers. So [43:15] that would be my concern would just be [43:17] having it be subjective. [43:20] >> Okay. Uh but riding a scooter u [43:25] recklessly is subjective, isn't it? [43:29] >> It is. [43:30] >> Okay. And would would you say that [43:35] um [43:35] >> it is it is defined? I mean, there's [43:37] reckless defined in the um code. [43:47] » Yeah. Willful disregard. [43:49] >> Yeah. Willful or want disregard for the [43:51] safety of persons or property? I mean, [43:54] how you going to determine if a [43:56] 10-year-old is being willful and not, [43:59] you know, in disregard for others? It's [44:03] going to be difficult. And what are you [44:05] going to do to them if they are? [44:06] >> Is CARIS driving more relaxed than that? [44:09] >> Um, yeah, [44:12] >> it is, right? [44:14] >> Yes, [44:14] >> it is. And there's there's case law out [44:17] there as far as speed alone cannot be [44:19] enough to determine um whether and a [44:22] vehicle is operating recklessly. And so [44:26] you need other factors besides speed. [44:28] >> Yeah. [44:29] >> Create unnecessary danger. tire [44:32] squealing. [44:37] » Okay. [44:38] Um [44:39] >> I think there's a good effort to try and [44:42] do that. I mean, to go 25 miles an hour [44:44] on a bike, I mean, it takes effort and a [44:46] 10-year-old's not going to do that where [44:47] on a scooter, [44:49] >> you know, they're there seconds. So, if [44:51] they're allowed to be on like sidewalks [44:54] and to be more prone to interact with [44:57] pedestrians, [44:58] it's nice to give Brian some leeway so [45:00] he can actually enforce some [45:02] recklessness. But, [45:03] >> sure, [45:04] >> I think just the temptation to have that [45:06] is going to be easier and more likely. [45:09] Mhm. [45:10] >> And and and frankly my concern on this [45:14] particular item is not so much [45:17] uh concerns for u others but for concern [45:22] for the writer who is going over 15 [45:27] miles per hour and might be doing [45:29] everything right [45:32] but it's too fast for the conditions of [45:34] the street and sidewalk. [45:40] But um [45:41] >> agree I would agree with that. I mean, [45:45] you know, if they're [45:47] >> Well, I I've seen it. I mean, kids kids [45:50] will go as fast as they can down 16th [45:54] Street. And I think they're banned from [45:56] 16th Street now. Is that one of the [45:59] streets that they're banned from? [46:02] >> No. [46:03] >> Yeah, I don't think so. Okay. That's a [46:04] good street to get uh get some speed up [46:07] and uh or you get one of those scooters, [46:12] you know, a little loose. And I'm I'm [46:15] concerned with with the rider in this [46:17] particular uh case. [46:21] Um but [46:23] let's move on. We we'll have a chance to [46:26] amend these uh at another time. Um, [46:31] number four is consequences and parental [46:33] involvement. To be truly effective, [46:36] safety regulations require the active [46:38] participation of parents. Finding [46:40] children is often inappropriate. The [46:43] primary consequence for a minor's [46:45] infraction should involve the parents [46:48] managing the privilege of riding the [46:50] scooter. [46:52] the um [46:56] and so the the proposal that I have [46:58] which [47:01] is just uh can can be uh changed but uh [47:05] to establish a range of enforcement [47:07] actions dependent upon the severity of [47:10] the infraction and the number of [47:12] previous infractions starting with a [47:14] verbal warning of reports to the parents [47:19] uh a ticket issued to the parents with [47:22] escalating fines of $25 for the first [47:25] event, first offense, 50 for the second, [47:28] and 100 for the third and subsequent [47:30] offenses, leading to a temporary ban on [47:34] riding electric scooters of up to 30 [47:36] days within the city limits. And the [47:38] consequences can be appealed to the city [47:41] council within 30 days of the [47:43] infraction. [47:46] Um, [47:48] right now I think we have [47:52] the ability of the police department to [47:55] uh take the scooter. [47:58] >> Yeah, that's the only enforcement action [47:59] that we have is to take the scooter. [48:01] >> Yeah. Seems to me like we should have [48:04] some options prior to that. And [48:09] I I'm I don't really care for the uh the [48:12] optics of the police department taking a [48:15] kid's scooter and putting it in the in [48:17] the uh the back of the pickup. Um, [48:22] I think I think we want to [48:27] if if it becomes necessary to [48:30] incentivize parents to take away the [48:35] right of uh riding the electric scooters [48:37] from their um minor children. [48:42] Thoughts? [48:43] >> I mean, I don't disagree with it. I [48:44] don't I don't disagree with [48:47] any of this. You know, if a if a if [48:51] chief pull chief stops the same kid six [48:54] times, [48:56] you know, a verbal warning obviously [48:58] isn't doing any good. So maybe you do [49:00] got to tell the parents, you know, and [49:02] let that be we don't like being [49:05] subjective, but you know, if it's one, [49:07] two times, it's not that big of a deal, [49:09] but if it gets out of hand, then yeah, [49:12] then this gives a little bit of bite to [49:14] it. And I I don't disagree with it. The [49:17] only my only question is would this fall [49:18] under the same category as a traffic [49:21] ticket or a parking ticket? [49:24] >> Would it be a city or violation? [49:27] >> Right. So like a parking ticket [49:29] basically. [49:29] >> It's not going to go on their driving [49:30] record. [49:31] >> No, that's what I'm asking. I mean I [49:33] don't want it to [49:34] >> No. Is it going to affect and can you [49:36] find a parent for something the kid did? [49:38] >> I see a lot. [49:39] >> Yeah. [49:40] >> I mean a lot of issues with this. [49:43] >> Um [49:44] >> Yes, I do too. I see verbal warning is [49:47] great. I think chief can report to the [49:50] parents without it being in an [49:51] ordinance. He has the ability to go [49:53] knock on the door and say, "Your kid's [49:54] acting like a fool." Um, not all kids [49:58] have parents. Not all kids have two [50:00] parents. I tell you what, my kid gets a [50:02] ticket at his dad's house. I'm not [50:04] paying it. You know, there's just so I [50:07] just this I don't like. But I think [50:10] yeah, finding the parents is probably [50:12] going to have a lot of issues. And I [50:15] think that's what we kind of discussed [50:17] when we decided to just take the scooter [50:19] away [50:20] >> because Yeah. Are you going to find a [50:21] 10-year-old? What happens when the [50:23] 10-year-old doesn't pay? [50:26] » No, you wouldn't find a 10 10-y old. [50:28] >> No. [50:29] >> Can you legally find a parent for it? [50:32] >> Find out. [50:34] >> I'm not going to tell you. I'd fight it. [50:37] >> I mean, that's [50:38] that that'd be, [50:39] >> you know, what if the kid's on a [50:40] neighbor scooter and the parent doesn't [50:42] know, right? [50:43] >> Um the the whatifs go on and on and on. [50:47] >> And I don't want to put something in an [50:48] ordinance with what if [50:50] >> I absolutely none of this. I am not in [50:53] favor. I'm in favor of safety 100%. I'd [50:57] probably stop a kid if it wasn't even my [50:58] kid that was recklessly driving. And I [51:01] have done that before. Um and I do it [51:04] again just, you know, for their safety. [51:06] um takes a village, right? So, [51:10] I don't know. I'm not I I agree with our [51:13] ordinance that we just [51:16] um we just passed not that long ago. So, [51:19] I don't see any of this needing to be [51:21] added or amended. And that's just my [51:23] opinion. [51:25] >> And I think that's what you said, [51:27] Christie, about it takes a village. You [51:28] know, we kind of talked about that. [51:30] >> What can we do now? School is in [51:32] session. You know, maybe now is the time [51:34] to to push the schools to to make kids [51:36] more aware. Maybe we wait till [51:38] springtime when they start using them. [51:39] Do they use them when it's this cold? [51:42] >> Yeah, that's Brian. [51:44] >> I saw one the other day through the [51:46] slush and snow. [51:47] >> Nice. [51:48] >> Yes. [51:48] >> Thankfully, the the speeds were just [51:51] right for the conditions. [51:53] >> I don't I I I don't disagree. I I don't [51:56] disagree with the first two. Yeah, [51:58] >> putting an age limit on it is is fine. [52:02] And then making a kid wear a helmet [52:04] who's under the age of 14, I'm perfectly [52:06] okay with that, too. The other ones, I [52:09] don't think we need. I mean, we got the [52:12] take your scooter away, you know, let [52:15] Brian do his community thing. He knows [52:18] the community, too. He can handle that. [52:21] But the the first two I'm completely [52:23] okay with and putting, you know, we [52:25] talked about that before, maybe putting [52:26] an age limit on it, but we weren't sure [52:28] if we could. [52:31] But I don't think that I don't think [52:32] that's an issue. And having making you [52:34] wear a helmet, that's that's fine, too. [52:36] But the other ones, I don't think we [52:37] necessarily need to add. So, [52:45] okay. Anything else? [52:50] So I think the plan is um you know this [52:54] was just just a discussion item. [52:56] >> We will maybe put these together for a [53:00] um [53:04] » potential amendment. [53:05] Yeah. [53:08] >> And u and then we will have some [53:10] readings where we will be able to amend [53:12] and decide. [53:14] >> That sounds good. [53:14] >> Uh the wording and what we want to do [53:17] with that. But I wanted to put that out [53:19] in front of you now so you could think [53:21] about that. [53:22] >> You know, I don't know if we've offered [53:24] any safety courses yet on any of this, [53:26] but that's really the focus I'd like to [53:28] see us move towards. Just [53:30] >> talk to them about how important it is [53:33] >> agree with just like hunter safety or [53:35] any other thing that that is done in the [53:39] public sector anyway. [53:40] >> And now would be the time when they're [53:41] all in school and not riding their [53:43] scooters so when it does come time they know what the rules are. So, [53:47] >> well, yeah, [53:48] >> you could even have a required safety [53:50] course at a certain age. [53:52] >> I don't know. [53:53] >> And and we've talked about that and um [53:56] and I think we'll probably [53:58] >> I'm sure there's other communities out [53:59] there that do that that we can we don't [54:01] have to reinvent the wheel. We can [54:03] >> borrow from them and do one. So, [54:09] » okay, [54:10] let's move on. We've got a consent [54:12] agenda. [54:14] got a temporary transfer from the [54:17] Hayward Golf Club to the Hayward [54:19] Community Center. Uh, two of those and [54:23] ownership update for Casey's general [54:26] store. [54:28] Yep. So, uh, occasionally Casey's, uh, [54:32] corporate Casey's, uh, changes, uh, [54:34] ownership over who's over their, uh, [54:36] alcohol permits. It's not anything like [54:38] local here. So, uh, we just pass through [54:40] shows up in my, uh, system to approve [54:43] for their ownership update, and I just [54:44] throw it on here. So, [54:48] » any questions? [54:51] Have a motion. We got a motion and a [54:54] second. All those in favor of approving [54:56] the consent agenda, please say I. [54:59] >> Opposed? Passes four to zero. We are at [55:03] the end of our agenda. Um, I would take [55:06] a motion to adjurnn. So moved. [55:07] >> So moved. [55:09] >> First [55:10] and and a second. [55:12] >> I'll second. [55:14] >> All those in favor of adjournment, [55:15] please say I. [55:17] >> Opposed. Passes four to zero. Our next [55:20] meeting is January 14th, [55:23] 2026. [55:26] Thank you. Thank you. Way to go, John. [55:31] >> Thanks, John. [55:32] >> You're supposed to bring cake. [55:34] >> There ain't no cake. That's above the [55:37] $25 limit or whatever. Uh the gift or [55:40] something. $5 limit.
