use [10:22] the New Life Community [10:25] Church the parcel is rather large at [10:27] just over 28,000 square fet and [10:30] currently on the lot are two structures [10:32] one is the predom one is the main [10:34] Auditorium for the church and the other [10:37] is the school and classroom [10:40] area both are going to be remodeled and [10:43] slightly [10:48] expanded this is what the facade of the [10:51] structure currently looks like from [10:52] 119th Street it's two stories a little [10:56] over 32 feet tall and as you can see [10:58] there's plenty of Street Frontage so [11:00] that gives great opportunity to improve [11:02] the Landscaping which we'll look at [11:06] later this is an alternative view of the [11:09] buildings from Felton Avenue you can see [11:12] the school on the left has the flat roof [11:14] and the church is on the right with the [11:16] gable [11:19] roof so this is the proposed site plan [11:22] some of the modifications are shown with [11:24] the yellow highlight with the orangey [11:26] yellow highlight um The Roof is going to [11:29] to be expanded to accommodate some [11:31] widened side aisles on either side of [11:33] the church this is not to increase the [11:35] number of seats in the auditorium but [11:37] just to accommodate um Ada accessibility [11:40] so there's an a nice path of travel to [11:42] get through there also shown is a new [11:45] tower and elevator that's going to serve [11:47] all both all both of the main floors of [11:50] the church as well as the third floor [11:52] roof deck um there is going to be a [11:54] third floor roof deck as well as a [11:56] second floor roof deck and on the third [11:59] floor floor is a new kitchen net and um [12:01] Ada [12:05] restroom so this is the proposed layout [12:08] for the first floor as I mentioned [12:10] earlier one of the changes is going to [12:11] be widening to the side aisles to allow [12:14] that increased accessibility the altar [12:16] in the front of the church is being [12:18] redesigned and reshaped um some of the [12:21] restrooms are going to be relocated to [12:22] the southwest corner of the church [12:25] there's going to be a new Sacrament [12:27] Bakery and Lounge area [12:29] when it comes to the school side some of [12:31] the um there's going to be a remodel of [12:34] the restroom and a little kitchenet [12:37] added for a little coffee area rather [12:39] added near the kitchenet which is [12:43] existing this is the proposed layout of [12:46] the second [12:47] floor um on the far west side there's a [12:51] new conference room and office space [12:53] adjacent to that is an existing [12:55] mezzanine area that is going to be [12:57] remodeled so that it opens out to the [13:00] outdoor deck toward the front of the [13:03] church is going to be another little [13:05] Lounge area or a small conference room I [13:08] can't quite tell from here but I it's [13:10] one of the two and then um on the school [13:13] side there's going to be um another [13:16] restroom [13:22] remodel so this gives us a closer look [13:24] at the roof decks that are being added [13:27] on the second floor it's about 1600 ft [13:31] and a staircase can take you up to the [13:33] third floor roof deck as well as an [13:35] elevator that serves that area the third [13:37] floor roof deck will be approximately [13:39] 2600 Square ft and it'll be enclosed on [13:43] all sides by a 24in parapet wall and [13:46] above that a 42in tempered glass guard [13:48] rail so all in all about 5 and 1/2 ft of [13:52] protection on all sides there will also [13:54] be a new kitchenet and restroom up there [14:02] these are the North and South elevations [14:04] which give us a view of what the [14:06] exterior of the structure will look like [14:08] after the remodel as you can tell it's a [14:10] very traditional Church there's going to [14:13] be um ornate decorations and copper [14:16] domes as well as gold um crosses that [14:20] Adorn the [14:21] building there's a tower there too that [14:24] we'll analyze in a [14:27] moment these are altern elevations where [14:29] you can see other [14:35] angles also included in the scope of [14:37] work of this project is Landscaping so [14:41] mulch is going to be added to existing [14:43] plant areas to freshen up what's [14:46] existing and the designers have proposed [14:48] to add new varieties of trees and [14:53] shrubs these are the V varieties that [14:56] have been called out by the designer [14:57] there's going to be citrus tree [14:59] and different types of plants and um [15:02] bushes those vibrant colors such as the [15:05] orange and the purple and the blue are [15:07] going to provide nice pops of color to [15:08] really enhance the street Frontage of [15:10] this [15:14] project so this Tower is one of the key [15:18] design elements of this project it's [15:21] it's functional as it encloses the the [15:24] elevator um it's also a you know it's [15:28] also a design element so we have the the [15:30] cross at the top as well as a little [15:32] copper gold Dome that's up there [15:36] um the what looks to be like a little [15:39] glass window on that Tower is actually a [15:42] proposed electric message center so I'd [15:45] like to point out that that's going to [15:46] be reviewed separately by the design I [15:48] mean by the uh planning department [15:49] because we have to make sure that meets [15:51] um the zoning code and so we'll be [15:53] reviewing that [15:54] separately um the tower is proposed to [15:57] be a little over 72 ft tall so that is [16:00] significant but it's not unlike some [16:02] other Steeples that we have in the [16:03] church there in the city there's St [16:06] Joseph's Church as well as Trinity [16:08] Lutheran that both have tall Steeples so [16:11] it's it's seen elsewhere in the city as [16:17] well this is a closeup of the roof plan [16:21] much of which is going to be existing [16:23] the shingles are to remain um the roof [16:26] will be expanded to accommodate those [16:28] widened sides [16:29] aisles [16:31] um and the roof Dome is another design [16:34] element that stands out and it's going [16:37] to be about 16 feet tall and 25 feet in [16:40] diameter so it's it is significant and [16:44] um that's included in this in this um [16:50] slide and that brings us to the staff [16:53] recommendation which is that we [16:54] recommend for the Planning Commission to [16:56] adopt the resolution 202 2413 with [17:00] conditions of approval before you a [21:01] proposal for a vesting tentative track [21:04] map uh this this uh tenative tract map [21:08] here revolves around the Hawthorne [21:10] Nursery site uh the owners are proposing [21:13] to develop it and in order to do that [21:16] they need to combine the 15 existing [21:18] Parcels into two one north of alunda [21:21] Boulevard and one [21:23] South um the primary issue here is that [21:28] vesting inative track map uh the [21:30] development and the permitting of the [21:31] actual housing is not part of this [21:33] project uh that is because the city [21:36] council has passed several ordinances [21:38] that Implement a housing overlay uh this [21:41] was part of the general plan uh this was [21:43] part of the housing element update that [21:46] only commissioner Richard was on on the [21:47] commission at that time uh but did go [21:50] through the Planning Commission uh the [21:52] the city council has stated that a [21:54] residential development is a [21:57] byright uh approval [21:59] on within the housing overlay uh [22:03] so when we look at the site we see that [22:05] it does have different zoning we've got [22:08] a mix of commercial and residential but [22:10] like I mentioned it's all within a [22:12] housing overlay so the housing overlay [22:14] was established uh was approved in [22:17] 2022 uh this housing overlay is is where [22:21] the city council established that [22:22] byright [22:24] development So currently as I mentioned [22:27] there's 15 total parcels across both [22:29] sites uh it has a total of uh just over [22:32] three gross Acres um there are four [22:35] existing structures on the site uh [22:37] they're on the Northern section of the [22:39] site there's uh some homes that have not [22:41] been used in a very long time as well as [22:44] some other structures that the nursery [22:47] used um so here we have a snapshot of [22:50] the current conditions on the Northern [22:52] section um you can see that it's bounded [22:54] by gravilla and [22:56] Manor and we can see that there is [22:59] residential uh on the west and the North [23:02] and there is some uh institutional use [23:06] to the [23:07] east with the southern section we see [23:11] similar we see commercial or excuse me [23:13] we see residential uh on the the west [23:16] and the South partially on the East we [23:19] also have a church the church of the [23:22] nazarine uh this is just to give you an [23:24] idea this is the current assessor parcel [23:26] map from the Los Angeles County [23:28] assessors um the highlighted in red are [23:31] the sections that are north of ela [23:33] Boulevard so these are the [23:36] proposed Parcels to be combined into one [23:39] parcel with this [23:40] application um so if this does get [23:42] approved that's what the assessors [23:44] parcel map will eventually be updated to [23:47] reflect uh the the southern site is [23:49] going to be the same thing these Parcels [23:51] will all be combined into [23:54] one we do have a preliminary site plan [23:57] that we are showing here um please [24:01] remember that these site plans are [24:03] tentative they're subject to change uh [24:06] they do have to be reviewed by all [24:08] relevant City departments so we're [24:09] looking at the building and safety [24:12] department the planning department um as [24:14] well as public works and the MPD review [24:18] so they have to go through all of the [24:20] requirements in order to be issued any [24:22] permits for building or for grading for [24:24] anything [24:27] um so on the site we have both North and [24:30] Southern section northern and southern [24:32] sections presented here uh these are all [24:35] going to be ownership for ownership [24:37] units for sale at market value um they [24:41] are town homes so we're not looking at [24:43] apartments or [24:45] condos uh here is a little bit closer of [24:48] the northern section I did want to point [24:51] out this is what's being proposed for [24:53] Access so there's two access points uh [24:55] one on Manor Drive and one on elag gundo [24:58] um this is in order to accommodate fire [25:01] as well as trash uh so [25:04] it's required essentially in order for [25:06] it to be safe and [25:09] accessible uh they are currently [25:11] proposing 60 garage stalls for the [25:13] residents as well as an additional 12 [25:15] open stalls on the Northern section [25:17] Alone um right now as far as we can tell [25:21] there if if it were to come under just [25:23] the objective design standards we would [25:24] require 45 roughly stalls so they're [25:27] well in except ESS of [25:29] that uh the southern site is similar uh [25:32] there's only one entrance on this um but [25:34] if you take a look you can see that it [25:36] does loop around and there are turning [25:38] points for fire and for trash um there's [25:42] a few more stalls on the southern [25:44] section than there are in the northern [25:46] uh there's 66 for residents there's [25:49] eight open for guests and residents uh [25:51] right now it looks as if there would be [25:53] 51 required under the objective [25:56] standards um two important things to [25:59] note uh the primary one here is that [26:01] 129th is completely closed off uh there [26:04] will be no vehicular access uh from [26:07] 129th into the project there will be a [26:10] propos there is a proposed retaining [26:11] wall that will be put in place there uh [26:14] to limit any visual impacts that may [26:19] occur um at this time we do want to [26:22] recommend that the Planning Commission [26:24] adopt a notice of exemption MPC [26:26] resolution 20245 with the conditions uh [26:29] approving subdivision application 2024 [26:34] 002 thank you does the Planning [26:37] Commission have any questions for [26:40] staff I have a question so today we are [26:44] just voting on taking this from 15 Lots [26:49] down to two correct yes that is correct [26:53] when the build is going to take place [26:57] and permits are going to need to be [27:00] issued I'm assuming this is when we get [27:03] into the is there going to be turn lanes [27:05] are there going to be all of these types [27:07] of questions that get a little deeper [27:08] into the minutia than for this right now [27:11] or is this the time to [27:23] building permits have already been [27:24] approved no no let me let me add that um [27:27] the applicant is already met with the [27:29] public works department to discuss turn [27:31] lanes and that sort of thing and they've [27:32] come to an agreement on how that will be [27:35] how that will be done so there will be [27:37] adjustments on elag Boulevard to [27:39] accommodate the properties okay and [27:41] those are those are reflected in in the [27:43] propos in the resolution before you um [27:46] we incorporated all of the requests from [27:49] the public works department in order to [27:50] ensure that I know I know I read it I'm [27:54] just asking so other people here can [27:56] hear it right I don't know if they read [27:59] the staff [28:00] report Ruby well yeah this project is exempt from design [28:24] review and that's based on the housing [28:27] overlay section that was added by city [28:29] council um so the housing overlay is [28:32] specifically Exempted but it does have [28:34] to meet uh objective design standards so [28:38] along with that housing overlay Edition [28:40] there was another addition of an entire [28:43] chapter devoted to those objective [28:45] design standards uh so those standards [28:47] will apply to like the project we have [28:50] before us within the housing overlay and [28:52] also apply to the multitude of different [28:54] types of affordable housing applications [28:56] that that require objective design [28:59] standards got [29:03] okay I know this is going to seem [29:08] repetitive so just to be [29:11] clear we're only [29:13] voting to have the two partials correct [29:16] correct okay and you're also saying that [29:21] it's administerial [29:23] then the rest of it since because of [29:26] Raina and the house in element Am I am I [29:31] reading you correct on that [29:33] ministerial meaning that the decision [29:36] has no opportunity for discretion [29:38] whatsoever it's simply a matter of does [29:41] it meet the codes this is um this is the [29:44] outcome of the state laws and the need [29:47] to accommodate our um Regional Housing [29:50] needs um assessment that was part of the [29:52] housing element in order to hit the [29:54] numbers that the state requires we had [29:56] to designate certain properties [29:58] properties around the city that were [29:59] likely to be developed and were [30:01] appropriate for [30:02] residential into these um housing [30:05] overlay and the housing overlay sets a [30:08] standard that is 30 units to the acre [30:10] this is under that I believe slightly um [30:14] but the housing overlay does not specify [30:16] that it has to be Town Homes ownership [30:19] it could be apartments and it doesn't [30:21] say that it has to be affordable these [30:22] are not affordable these are market rate [30:24] units if it were affordable we would [30:27] have even less control control over the [30:28] situation there would be no control on [30:30] density no control on height no control [30:33] on anything so I think that the question [30:37] before you in addition to just making it [30:39] two Parcels is you're Paving the way for [30:41] this only to be a ownership [30:44] project now any of [30:47] these Town Homes being [30:50] developed are they going into the [30:52] numbers yeah all all housing that's [30:55] built will count in some fashion these [30:57] are not accounting is Affordable these [30:58] are market rate there is a category for [31:00] market rate and since we're still very [31:02] early in our excuse me in our housing [31:05] cycle these will count after we achieve [31:08] our goal in the market rate any any [31:10] additional market rate housing just is [31:12] not going to count but we wouldn't stop [31:14] it from being [31:15] developed but this one these will all [31:18] count absolutely so they will count but [31:20] they won't be affordable right these [31:22] your market rate none of them not we [31:26] haven't asked for any to be [31:31] okay are we able to put conditions [31:34] though at all what well it depends what [31:37] sort of conditions you're you're looking [31:39] any conditions that you make have to [31:40] have an access to the application the [31:42] application is 15 to2 Lots so if you can [31:46] find a way to make that connection to [31:48] the 15 to2 lot problem you can have a [31:52] condition anything else is not going to [31:53] be permitted I'm just actually my [31:56] concern is always about parking [31:58] yeah and is there a way of just making [32:02] sure that there's some type of parking [32:06] agreement within this development some [32:09] type of parking agreement no because [32:12] that you can't make the Nexus that that [32:14] has anything to do with the number of [32:15] Lots now the applicant has taken it upon [32:17] themselves to provide Surplus parking [32:20] considerable amount of surplus parking [32:22] and every unit has assigned parking in a [32:24] garage in addition to guest parking on [32:26] the outside so um they've kind of taken [32:30] the the issue off the table to some [32:34] extent I I did see that yeah and I did [32:37] appreciate all that because I saw the [32:39] tandem parking I saw the two two-car [32:41] garage I saw the Surplus which is [32:44] wonderful but I just want to get a [32:47] clarification did you just say that it [32:49] could be [32:51] changed so these these plans are [32:53] preliminary yes um you know that that is [32:58] the nature of this sort of development [33:00] is that these are preliminary and these [33:02] were added essentially to assure the [33:05] commi the Commissioners as well as the [33:07] public that's here today of what exactly [33:09] the developers are trying to do here um [33:13] you know this this was viewed largely as [33:16] a very good project compared to other [33:20] ideas that were that were seen and that [33:22] were proposed um especially as far as [33:24] density of of dwelling units goes um [33:30] yes it may change that that's always [33:33] that's a possibility in this situation [33:36] um again though you come to the issue of [33:39] trying to connect any requirements for [33:42] parking with the actual project in front [33:45] of us of the the merge but when you say [33:50] change that means that although you say [33:52] that there's going to be two car garages [33:55] two tandem parking so forth or spaces [33:58] are [34:00] those can the [34:02] developer come back and say no parking [34:05] outside I'll just get the 35 guest [34:08] parking outside and that's it they have [34:10] to meet the objective design standards [34:12] which do address parking okay okay so so [34:15] all that it may change but no matter [34:18] what in order to have a building permit [34:20] issued to them to start construction to [34:22] get a certificate of occupancy they have [34:24] to meet the objective design standards [34:27] and what about the vegetation itself [34:29] that's part of the objective design [34:31] standards it's [34:32] Incorporated is there anything stady [34:34] maybe like every 10 parking spaces we [34:37] can at least have a tree or something or [34:39] something tied down to just to make sure [34:41] that we have something there there I I I [34:43] apologize I don't remember what the [34:45] design standard for trees and parking [34:46] lots is but um they are codified into [34:49] the municipal code and the question is [34:51] does it meet the code requirements or [34:53] not and that's the decision we'll make [34:55] when we get the [34:56] application and again there's not a [34:58] clear access to the map at this [35:01] point okay no [35:54] thanks let's roll please [35:58] so Malia holes is as I said is a private [36:00] home builder um we have developed homes [36:04] in southern LA County Orange County [36:07] Northern San Diego County um we are a [36:10] for sale Builder we're not an apartment [36:12] Construction Company um so everything [36:15] that we do is a product that is for sale [36:18] to Future homeowners and um I've been uh [36:22] working as an infill uh builder for 13 [36:26] years from aah homes prior to that I [36:28] work for the City of Laguna Nigel and [36:29] the County of Orange in the planning [36:31] departments um so I'm very familiar with [36:33] infill and compatibility and some of the [36:36] challenges that come along with infill [36:38] developments um and the project that we [36:40] have before us tonight is is is [36:43] something that is a result of um the [36:48] housing overlay and the state housing [36:51] element and uh city of city of [36:54] Hawthorne's General plan uh housing [36:56] element updates so forth that have come [36:58] on but again we're looking at it from a [37:01] standpoint for Quality development and [37:04] quality from a quality Builder um the [37:06] slide in front of you are two recent [37:08] projects that Malia Holmes has [37:09] constructed one is in the city of [37:11] Gardina uh the top two photos are those [37:13] of the city of Gardina or Moneta Point [37:15] project that was 84 homes um on an old [37:20] ironically enough a nursery site uh that [37:23] existed in Gardina um the bottom the [37:25] bottom two photos before you are uh what [37:28] the city of Anaheim again three-story [37:31] row Town Homes home ownership um you see [37:35] uh kind of the front entry the Poo as [37:37] well as the landscape and the right [37:39] photo is that of something similar to [37:42] what to what we're proposing here for [37:43] Recreation Area some shelter some play [37:46] space and some outdoor tables and a [37:48] barbecue uh tabletop um for the [37:51] residents on each site to be able to [37:53] enjoy there's one proposed on both of [37:55] those and I'll I'll get into that a [37:56] little bit further [38:02] as we talked about uh and and staff [38:05] presented this is the hawthor nursery [38:07] site uh just a Stones Throw here from [38:09] City Hall and is it it is um one of the [38:13] many sites throughout the city that have [38:15] been selected with the housing overlay [38:17] um that has D carries a density range of [38:20] 20 to 30 units per acre um so this site [38:23] could potentially have up to 94 units on [38:25] it combined it's about 3 .4 3.3 Acres um [38:30] we're proposing a total of 68 homes on [38:33] these um again it's because the homes [38:36] when they are for sale they need to be [38:38] marketable they need to be attractive [38:40] and they need to be have a want for [38:42] people to come and invest their their [38:44] their monies and their future with them [38:45] and we recognize that and we therefore [38:49] they range in size I'll cover that a [38:52] little bit further but they range in [38:53] size of something from one two three and [38:56] four bedroom homes um two car garages [38:59] two car garages with Tandem and single [39:01] car garages but every home has a has an [39:03] attached garage with it with direct [39:06] access into the house into their [39:08] personal house um the nursery site was [39:12] selected um by the city as a part of it [39:15] and we uh were contacted um they reached [39:19] out various Brokers reached out to Malia [39:22] homes see if we're interested in it um [39:24] and uh we put some information and uh [39:28] obviously a plan together uh make sure [39:30] it works economically that it chased the [39:32] level of of uh of quality um and uh and [39:36] we're we decided to move forward with [39:39] it um again this is a result of the uh [39:43] General plan it's a result of the [39:45] housing overlay and it's a result of the [39:47] state as uh as Mr mlan has mentioned um [39:51] but it also follows the adopted mixed [39:55] use and multif family govern guidelines [39:57] the objective guidelines that the city [39:59] has adopted to make sure it has ample [40:01] parking to make sure that is set back [40:03] proper distances to make sure that it's [40:05] designed properly um we have uh we have [40:09] included all of that with [40:12] it [40:13] so as been as has been indicated U the [40:18] what's before you tonight is the [40:19] subdivision of this property the [40:22] subdivision is required in order for the [40:24] project to be for sale um we have to go [40:27] go through the department of real estate [40:28] State of California process condo maps [40:32] and they need to be related to a map [40:34] process if if we were to build rental [40:37] units or build apartments or proposed to [40:40] build apartments on this property we [40:42] wouldn't be here tonight the fact that [40:44] this is for sale and we're asking for [40:46] the subdivision map to be approved is [40:49] that this is a for sale project and not [40:51] something that is for [40:54] rent the site itself as I said is a [40:57] little over three acres and could [40:59] potentially have up to 94 units on it [41:02] based upon the housing overlay density [41:07] allowances the map is providing for [41:10] easement dedications to increase the [41:13] parkway widths around all perimeter of [41:16] the site meaning the sidewalks will be [41:17] improved with a six- foot sidewalk and a [41:19] 4-ft landscape planter outside of the [41:22] perimeter walls um with the exception of [41:24] 129th Street where that street and [41:27] Parkway are currently fairly narrow and [41:30] the current Parkway is 7 ft That [41:33] Sidewalk will be improved to a full [41:35] width 7 foot sidewalk with planter Wells [41:39] for trees to be planted every 50 feet on [41:42] Center um up at the elevation of 129th [41:45] Street along what would be the southerly [41:47] boundary of this of this project [42:06] and again as staff has pointed out [42:07] although not subject of the [42:09] discretionary action before you tonight [42:12] um I thought that it would be a good [42:14] idea to present to the Planning [42:16] Commission a little bit greater detail [42:18] of the project that we are proposing [42:21] with the pro with the subdivision map [42:23] and what it would look like how it will [42:25] live and some of the amenities and the [42:27] thought that has gone behind it um I [42:29] would like to add that I'm a little bit [42:32] surprised by the turnout of the [42:34] residents that are behind [42:38] me back when we initially started [42:41] looking at this property in January [42:43] February earlier this year um part of [42:46] our due diligence research is I send out [42:49] letters to all property owners that are [42:53] directly and this may be a little bit of [42:56] the confusion side the property owners [42:58] that are directly adjacent to or [43:00] directly across from the project area to [43:03] solicit input to solicit comments to [43:06] provide for them some basic information [43:09] about what we are proposing to do um and [43:12] that all goes in line with me talking [43:14] with the city staff and and and [43:17] understanding what the regulations are [43:19] but I reached out and I'll go into this [43:21] in Greater detail if we want to discuss [43:23] about the Outreach that was done on this [43:26] but it started in February um I had uh [43:29] multiple calls and discussions with many [43:32] neighbors mostly generated from manner [43:35] Drive uh directly to the west of the [43:37] site of lot one of the proposed [43:40] subdivision um lot two I only heard from [43:43] one resident um on the north side of 129 [43:46] or the South side of 129th Street above [43:48] the site um so I'm I'm surprised by I I [43:52] been shared with some of the emails and [43:54] information and so forth uh regarding [43:56] some of the concern [43:57] and I hope that this will help alleviate [43:59] some of those concerns with the uh with [44:02] me showing you the plans as they go [44:04] through so what you're looking at is a [44:06] conceptual landscape plan uh for the [44:09] project um it has interior PES as you [44:13] can see uh many places between buildings [44:16] it's a little bit small but tucked away [44:18] on the right side of your screen um the [44:22] bottom right hand corner is an area [44:24] dedicated to an outdoor Turf play area [44:26] for small children that's where the uh [44:29] at trellis uh shade structure would be [44:31] provided with some outdoor barbecue [44:33] areas and some tables um bike racks and [44:36] so forth as well um the South site has [44:39] much of the same it's more of a central [44:41] location on the south site right in the [44:43] center of the project is where you see [44:45] the turf green um there's sitting [44:47] benches there's landscaping and again [44:49] it's a shade structure with a barbecue [44:51] outdoor dining area for future residents [44:58] one of the things I want to point to as [45:00] a result of my meetings with the [45:02] homeowners on Manor Drive is I'm going [45:05] to back up for a second because you're [45:06] going to see an arrow pop up on the [45:08] North on the west Edge on the west Edge [45:11] the landscaping that's being placed or [45:13] proposed along this Edge is proposed to [45:16] be well it is on this plan is an [45:18] evergreen type of tree more of a [45:20] vertical type of tree um that would Pro [45:23] and we've spaced them much tighter [45:24] together than other places around the [45:27] site and that again is for the Privacy [45:29] uh and protection of privacy to the [45:31] existing homeowners along Manor Drive [45:33] and that occurs both on the west Edge [45:35] where the arrow is shown as well as here [45:37] on the North edge of it um where we've [45:39] taken that that proposed landscape and [45:42] condensed it down so it creates a uh a [45:45] much nicer a denser screen so to speak [45:47] for uh for privacy the homes that are [45:51] proposed are three story in height um [45:54] they're about 38 ft total height to the [45:56] pitched roof it's not a flat roof um but [45:59] they are uh three-story in height so [46:02] there would be bedrooms up on the third [46:04] level there are no outdoor decks there [46:07] are no outdoor roof decks on the third [46:09] level nor the roof but there are decks [46:11] um from the primary living area off the [46:14] living room at the second story so these [46:17] trees um while they'll go in rather [46:20] young um we would be willing to put them [46:23] in at A Min at a at a 12ft minimum [46:25] height upon installation um that's [46:27] something I discussed with the neighbors [46:28] in my meetings with them uh earlier or I [46:31] guess early last [46:33] month the site plans for each of the [46:36] sites uh staff showed you a portion of [46:39] these um this is the layout the [46:42] circulation that's proposed um I wanted [46:44] to highlight there's 35 units on on the [46:49] uh South site and there's with parking [46:53] the total of I'm sorry 38 units on the [46:55] south site with total of 74 parking [46:57] stalls there's 35 units on the North [47:00] portion of the site with uh with the [47:02] resulting 72 parking stalls and again [47:05] this is each home has an enclosed [47:07] two-car garage the one-bedroom unit has [47:10] a onecar enclosed garage but there are [47:12] also as noted in the staff report or on [47:15] the plans um open parking stalls [47:17] dedicated to guest parking and so forth [47:19] and I want to get to your question and [47:21] and respond to that later on about [47:23] parking and ccnr as and homeowners [47:25] association and so forth [47:27] um there are four different floor plans [47:30] and those four floor plans that are [47:32] proposed are configured in si six [47:34] different buildings so it's not a [47:36] repetitive uh building over and over and [47:38] over again there is some unique uh [47:40] characteristics to each of the buildings [47:42] with articulation and design for each of [47:46] them um both of these Lots uh [47:51] individually and collectively exceed the [47:53] minimum number of parking spaces that [47:55] are required by your code um within the [47:58] city and the floor plans range anywhere [48:01] between 986 Square ft up to, [48:04] 19922 square feet for the four-bedroom [48:08] unit elevation wise uh I'm showing you a [48:12] a proposed material and uh color board [48:17] um illustrating the proposed building [48:19] types this is shown building type [48:21] a um that uh with the colors that are [48:26] intended to be cohesive create breakup [48:28] of mass um and complimentary color [48:31] palette um with trim contrasts uh to add [48:34] depth and so forth to the [48:38] design the next this slide and the next [48:41] one are this is a building type c um [48:44] it's all cohesive they're not [48:45] individually unique but they are all [48:47] different um types A through F of the [48:49] buildings they just have different unit [48:51] uh configurations uh making them each [48:55] building labeled as they [48:57] are and this is building type [49:02] f the next slide is showing you [49:06] basically a street scene from elsag [49:08] gundo Boulevard um the top photo is that [49:11] looking West the bottom photo is that [49:12] looking East and we've had uh our [49:16] architect provide some perspectives of [49:19] what that may look like in the future if [49:22] the the left hand [50:03] side different per different perspective [50:06] this is the gravelia street Frontage and [50:09] I always try to screen back landscaping [50:11] or have the architect screen back [50:12] Landscaping in this so that I'm not [50:14] hiding the building um it's not [50:16] something that if you if I can show all [50:19] the greencape and so forth and you won't [50:20] see what's behind [50:22] it same thing for this is at the Manor [50:25] or looking towards The Manor [50:28] intersection uh from uh from elun to [50:33] Boulevard again uh I thank you for your [50:36] time I do ask for your approval of this [50:38] project tonight um of the vest intended [50:41] of track map it has the result of a [50:44] landing in a for sale project as opposed [50:46] to Apartments if we were to go away [50:48] there's a potentially other buyers that [50:50] would come in that would look to do [50:52] Apartments here and they have the [50:53] ability to do that by right um we're [50:56] we're wanting to and asking for your [50:58] approval to move forward with the [50:59] subdivision map so that we can develop [51:02] and invest into the City and create [51:04] pride of ownership in the city like many [51:05] of these homeowners here have me and [51:07] their concerns is a result of them [51:11] having pride in where they live and [51:13] having invested economic interest in it [51:16] um we are trying to create more [51:18] opportunity for more residents of hathor [51:20] to have that same ownership [51:24] capabilities um we have read the [51:26] condition of approval and I'm uh and we [51:29] are accepting of them and again I ask [51:30] for your affirmative approval tonight [51:34] thank you you thank you go ahead just G [51:40] to claric yeah questions of a go go for [51:43] I just want to you said four you I'm not [51:45] sure if this was an accident or not or a [51:47] mistake you said four bedrooms I thought [51:49] it was only up to three bedrooms no [51:51] there's a there's a four bedom unit [51:53] there four bom there's one two three and [51:55] four bedroom units it's lower in there's [51:57] less of the four bedrooms but yes there [51:59] is a four-bedroom unit the 1922 foot is [52:02] a four-bedroom unit yes okay I was [52:04] unaware of that go ahead got [52:08] umle questions just um as we've [52:12] mentioned as far as these projects go [52:14] you have these uh these drawings that [52:15] you presented to us here today um in [52:17] your past projects have you seen much [52:20] variation between what you present [52:21] versus what ends up being [52:24] constructed the answer to that is no [52:27] because as what we what we do is we've [52:29] based all of our research all of our due [52:31] diligence and all of our designs based [52:33] upon work that gets us to this point [52:35] today for us to go back and change would [52:38] be a a drastic move um and something [52:41] that we quite frankly don't want to do [52:43] we want to build the project that we've [52:45] designed and and are wanting to stand [52:47] behind and put before you tonight got [52:49] you apprciate [52:51] it um from breaking ground till end of [52:54] project is it going in phases like how [52:56] long do you think total it would be [52:58] under construction so the phasing of the [53:01] project is somewhat tough to tough to [53:04] describe because it is Market dependent [53:07] um but essentially from the time we bake [53:10] break ground to the time that we might [53:12] start the first vertical construction of [53:14] model homes that would be viewed for [53:16] sales is probably six months of ground [53:20] grading infrastructure Improvement sewer [53:23] water storm drain um and things of that [53:25] nature and then we would start the [53:26] vertical construction for the model [53:28] homes um and each home each home phase [53:32] takes approximately four to seven months [53:36] to [53:37] complete and if sales go well we would [53:40] overlap in some areas uh so that time [53:42] frame could be [53:44] condensed but from initial construction [53:47] beginning to buildout would be probably [53:50] approximately two years the number of [53:53] phases that we have placed in this is a [53:55] model home phase phase which is on the [53:58] south site and four construction phases [54:01] thank [54:02] you sorry I did have a couple one more [54:05] questions where I know you mentioned you [54:06] were going to go into a bit more detail [54:08] about the notification of the residents [54:10] yeah so um I notic you mentioned you [54:12] said you started doing reach out to the [54:14] residents in about February so I was [54:16] just wondering when you when did you [54:19] meet with this city that you got the [54:21] idea that hey this was something we're [54:22] going to move forward with I want to [54:24] know the diff like how long it was [54:26] between you spoke with the city and said [54:28] hey this is something we're going to [54:29] move forward with before you actually [54:30] reached out to the first set of [54:32] residents oh we reached we reached out [54:34] to the residents prior to um prior to [54:39] any formal application being submitted [54:41] with the city okay and and if I can show [54:44] you [54:45] me so in in January and basically I [54:50] think it was like January 20th 27th or [54:53] so is it for this year or is it yes this [54:55] year okay I just 2024 okay um is what [54:58] you're seeing on your screen I know you [55:00] can't read it but I've seen them many of [55:02] them have them in their hands tonight um [55:04] is a letter introduction letter of Malia [55:07] Holmes introducing us our project and a [55:11] basic layout much and much hasn't [55:13] changed from January where we initially [55:15] started a due diligence in a layout it's [55:17] gotten more detailed if anything um but [55:21] so the initial letter had a description [55:23] of the project the number of homes that [55:25] were being proposed that would they were [55:27] for sale please reach out and contact me [55:29] if you have any comments or concerns um [55:33] the mailing list that I went out to [55:36] is the sites are shown in yellow um all [55:40] the properties where you see the little [55:42] red dots were the property owners were [55:45] my letter went to it doesn't have [55:47] anything to do with the 300 foot radius [55:49] mailing list that is uh required by law [55:52] for public notice and public [55:54] hearings so as a result of my letter I [55:58] received phone calls from approximately [56:00] seven to eight people um only one person [56:03] on 129th his name was Richard Dragon is [56:06] is what I took down um and I believe he [56:09] lived almost directly Center behind it [56:11] on 129th um most of the residents that I [56:14] heard from were those located on Manor [56:17] Drive and so in uh what you see that's [56:21] highlighted yellow I'm giving you raw [56:23] data right this is right off my computer [56:25] um so I had a meeting we scheduled a [56:28] meeting and uh met with the uh residents [56:31] and the they organized their meeting for [56:34] me were kind enough to invite me into [56:35] their house um Mr oros baked cookies and [56:39] goods and we we spent about two hours [56:42] together um reviewing the proposed plans [56:45] um I know that they had some concerns [56:47] I've I hope that I've Al alleviated [56:49] those with parking and with the [56:51] landscape proposals to protect their [56:53] views um but what you see highlighted in [56:56] yellow are those that had sent this [56:57] letter to that were also in attendance [56:59] at that meeting okay on June 11th oh got [57:03] gotcha [57:04] okay I can provide to you in the future [57:07] uh this is the this is a [57:09] chronological uh basically synopsis of [57:12] all the contact that I had um that's [57:15] there on the left and the comment uh the [57:19] the June 11th 2024 on the right hand [57:22] side is basically a summary of the [57:24] takeaway from that meeting that we had [57:26] in June and then there's the sign-in [57:28] sheet that's shown at the very bottom [57:30] where the where the neighbors were uh in [57:33] case we wanted to contact each other and [57:35] so forth and I did I sent out a thank [57:36] you letter following that um then it [57:40] gets into other stuff in case other [57:41] questions but I have I wanted to have [57:43] this for reference appreciate it as well [57:45] thank you um commissioner Cohen you also [57:47] had a question that you'd mentioned [57:49] about the parking the garages if there [57:52] if it's well if we could encourage some [57:55] type of parking agreement you also [57:56] mentioned it was going to be an HOA yes [57:59] is there going to be a well let's start [58:01] with the parking agreement um would you [58:05] be up for that to have a parking [58:08] agreement within that Association just [58:10] to make sure there's no conflict [58:12] between uh homeowners and so forth [58:15] because it can be a problem later is [58:17] what we have as a standard and I would [58:20] accept as would accept as a condition is [58:24] that the cc&rs [58:26] that would be created for this project [58:29] every homeowners association is [58:31] basically bound and operated by Covenant [58:34] conditions and restrictions [58:35] cc&rs and that's part of the Dr process [58:38] of of creating town homes and selling [58:41] them um individually the ccrs our [58:45] standard ccnr that's why I wanted to [58:47] bring it up our standard ccrs have [58:49] requirements in them that stipulates [58:53] that garages if it's a two-car garage [58:55] they're required Park two cars in it [58:57] that can't be blocked for storage or [58:59] other things if it's a onecar garage [59:01] that one car space needs to be provided [59:03] for a vehicle inside of it not not for [59:06] boxes and storage and everything else so [59:09] I mean it is a standard and I'm I'm [59:11] happy to if you I stipulate that uh that [59:15] our cc&rs will require that garages be [59:17] used for parking of vehicles and not for [59:19] storage okay well my concern actually [59:22] really is besides the spaces in side the [59:27] garage I'm really concerned about the [59:29] outside parking because it's always a [59:33] problem um if there can be in your ccnr [59:38] not the bylaws not into the rules either [59:40] because rules can always be changed but [59:42] I'm actually talking about the actual [59:43] ccnr itself if you can maybe put some [59:47] I'm so sorry oh my God after we told [59:54] everybody um round it up I get that [1:01:18] but it's better if you just do a point [1:01:20] where everybody or every resident has a [1:01:23] right to park outside [1:01:27] they do an extra parking space if resident against resident and then them [1:01:59] putting rules out and then it's going to [1:02:01] create chaos within the community for [1:02:04] parking trust me I know that for a fact [1:02:07] project um just [1:13:34] about two weeks ago um only because we [1:13:38] were talking and sharing information but [1:13:41] I reside right across directly across [1:13:43] the street from her on 129th and I never [1:13:47] received any information regarding this [1:13:50] project at all so I understand that they [1:13:53] want to do the proximity close to the [1:13:56] area but this impacts all of the [1:13:58] Neighbors on 129 [1:14:01] street so I'm concerned about that and [1:14:04] then I had a couple other things um [1:14:08] incorrect information as was stated by [1:14:11] um the resident at [1:14:13] 4490 um was sent to the [1:14:16] residents with a date I did call and I I [1:14:20] commented about it to um that the phone [1:14:24] number that was listed and I was really [1:14:26] disappointed that we have a June 5th [1:14:30] when we didn't receive the information [1:14:32] until after the the 25 the [1:14:36] 21st of this month or I mean of last [1:14:39] month for this [1:14:42] um that's a problem that's incomplete [1:14:46] information and I was I did a couple [1:14:50] days later receive a corrected copy but [1:14:52] this actually doesn't give us much time [1:14:55] to review any of the reports or anything [1:14:57] that we can do especially when we don't [1:15:00] know what is going on in our [1:15:02] neighborhood I never received any [1:15:04] [1:19:44] in the future um you should consider [1:19:46] adding speed bumps um the intersection [1:19:49] of elag gundo I'm sorry 129th Ramona [1:19:51] Avenue is particularly dangerous because [1:19:53] of a lack of sight line [1:19:55] and there's also only a two-way stop you [1:19:57] should consider putting in a four-way [1:19:58] stop at that intersection and putting [1:20:00] additional speed bumps on the Ramona [1:20:02] Avenue um uh I have some additional [1:20:06] notes here um just question about the [1:20:08] extended construction phase um Can the [1:20:10] city assure existing residents that [1:20:12] portions of the current parking area [1:20:14] along 129th Street won't be disrupted [1:20:16] for an extended period of time uh if [1:20:19] it's expected that that's going to be [1:20:20] the case what Provisions will the city [1:20:22] or the developer do you know provide so [1:20:25] that we are not parking blocks away [1:20:27] parking is already an issue safety is [1:20:29] already an issue I should also point out [1:20:31] that that street that sidewalk is used [1:20:33] by dozens of high school students and [1:20:36] you know people use that to actually [1:20:38] walk so there are definitely safety [1:20:40] considerations uh and lastly I want to [1:20:42] Echo the concerns about um overflow from [1:20:45] this uh development like we have [1:20:47] difficulty parking already um I'd like [1:20:50] to know if there's going to be permit [1:20:51] parking or something like that [1:20:52] considered um so [1:20:55] that's all I got thank [1:21:48] on 129th right now I would love that um [1:21:51] I often uh get home late from work and [1:21:53] have to park BL walks away so when [1:21:57] holidays happen when people have guests [1:21:58] over where do you think that parking's [1:22:00] going it's going on 129th where there's [1:22:02] already a pretty significant parking [1:22:03] issue and that lot at the end doesn't [1:22:05] allow for overnight parking so I'm just [1:22:08] something will have to be done with this [1:22:11] development going in to um take care of [1:22:13] the current residents who've chosen to [1:22:15] live here we've been living here for 14 [1:22:17] years so we would just ask that you [1:22:18] would take care of us as well as your [1:22:20] new residents um permit parking [1:22:23] certainly would be an answer on 129th um [1:22:26] certainly narrowing the street is a [1:22:28] concern when I go to my car in the [1:22:30] morning people come screaming through at [1:22:34] 50 40 50 miles per hour and if you if [1:22:37] there's no stoplight coming out of that [1:22:39] um that new uh development what they're [1:22:43] going to do is they're going to turn [1:22:44] right on Elsa gundo turn right on [1:22:46] Hawthorne turn right on 129th and just [1:22:49] join the rest of the barrage of cars [1:22:51] that we get in the morning um I too have [1:22:54] had Dam done to my car I think everybody [1:22:55] who lives on that street who's had to [1:22:57] park on the street has so I would just [1:23:00] say like traffic I don't know if there's [1:23:01] been a traffic study done I would [1:23:03] certainly appreciate knowing where that [1:23:04] is because it certainly should I'm [1:23:06] guessing it did because I think it's [1:23:08] required um I also would like to know [1:23:09] where the SQL study is and the [1:23:11] environmental study was done um I would [1:23:13] like to know where those are posted so [1:23:14] that we can make sure that we as [1:23:16] residents can take a look at that [1:23:17] because you are replacing green space [1:23:19] with Hardscape um and and and I I just [1:23:22] want to be aware of what the impact of [1:23:24] that is to make sure that you know [1:26:22] if we can make that happen [1:26:24] that would be great and you know the [1:26:26] large larger trees the better so because [1:26:28] I'm right there on the north of the [1:26:30] property and my other concern is with [1:26:33] increased traffic of course and and [1:26:36] street parking on Manor Drive that could [1:26:39] happen from the project and so if this purchased that [1:31:17] house basically because on one side was [1:31:19] the nursery we and we have been there [1:31:22] for like I'd say 30 years years and [1:31:24] we've been using it at rental it was [1:31:27] basically an income for our kids um what [1:31:31] I'm seeing now is that I don't know if [1:31:34] they're concerned about the water we've [1:31:36] had problems with our sump in our rental [1:31:39] we've had it replaced twice already are [1:31:41] they taking that in consideration [1:31:43] because of the height level as well as [1:31:46] the parking I've always never been able [1:31:48] to find easy parking and I would always [1:31:50] block my driveway when I come to talk to [1:31:53] the tenants [1:31:55] so that is an issue for me and I come in [1:31:57] the middle of the day I don't even come [1:31:59] at night when people are at home and um [1:32:03] walking on that sidewalk which is narrow [1:32:05] with certain areas where [1:32:07] the the poles for electricity it is a [1:32:11] little hazardous so widening it I don't [1:32:14] know if it'll make a difference but um [1:32:17] putting that block wall but at the [1:32:20] different heights uh is the are they [1:32:22] going to have the three floors I mean [1:32:25] the the apartments that have three [1:32:26] floors on the height of 129th or are [1:32:30] they going to base it down below and are [1:32:32] they going to take care of the water [1:32:33] drainage so that it doesn't flood and [1:32:36] cause [1:32:37] problems um the other thing is the noise [1:32:41] there's going to be two years that my [1:32:43] tenants are going to have to suffer [1:32:45] through and the dust and the noise I [1:32:47] hope they are thinking of accommodating [1:32:49] living standards and how how the noise [1:32:52] will impact everybody [1:32:55] um I think it's great that it's going to [1:32:57] be for sale and I I'm aware that our [1:33:00] hands are tied because of what [1:33:02] California State Legislature had passed [1:33:05] regarding housing so um I think this is [1:33:09] the best of worst [1:33:12] scenarios and I can accommodate that but [1:33:15] I think uh this area has some unique [1:33:18] features that needed to be taken care of [1:33:21] in fact my neighbor on the other side [1:33:24] I've gone in when I've taken before [1:33:26] while I was taking care of my myself had [1:33:29] people come in and change the cement and [1:33:31] everything there's just a little bit [1:33:33] overflowing and it's flooding you have [1:33:35] to understand 129th is like the houses [1:33:39] on the owner's unit is three levels with [1:33:41] the one down below being a car garage so [1:33:44] that's the height but on the street it's [1:33:47] two floors okay and to me that's a the 129th for automobiles but they allow [1:36:13] entrance and exit by passengers or [1:36:16] pedestrians so you can park your car 129 [1:36:20] then walk in the back gate but if you [1:36:22] don't get on when you're coming down [1:36:24] elag gondo you don't get in you just [1:36:26] whip around the corner find a place to [1:36:27] park but I walked over here I didn't [1:36:30] drive because there's no parking when I [1:36:31] go when I went back I couldn't get a [1:36:33] parking spot [1:36:36] so people drive from they M they try to [1:36:39] mitigate this about 10 years ago they [1:36:40] put speed bumps on top of the hill 129th [1:36:43] because people cut down when they put in [1:36:46] uh SpaceX more traffic started coming so [1:36:49] they shoot down 129th Street to get get [1:36:52] to Haw bouard turn right on ha bouevard [1:36:55] or they come down 130th cut cut across [1:36:57] and they cut down hawor bouevard when [1:37:00] you do the same thing when with El [1:37:01] agendo they're not going to be able to [1:37:04] they won't be able to park so they'll [1:37:06] whip around the street park on 12 29th [1:37:09] taking people's parking space so I think people [1:38:24] like myself that it works to respond and [1:38:27] to say anything [1:38:30] except I hope you consider it extended [1:38:34] and I hope it be another opportunity for [1:38:37] the community to speak because many [1:38:39] people doesn't get even the [1:38:42] notice is the first time I have it in my [1:38:46] hands I do not hear from previous [1:38:49] months or [1:38:52] previous information [1:38:55] nothing thank you thank [1:39:01] you is there anyone else who wishes to [1:39:04] address the Planning Commission on this [1:39:08] issue I cannot allow that um now [1:39:43] late that's with the Postal Service [1:39:45] unfortunately not with the city uh we [1:39:48] sent everything out 10 days prior we did [1:39:51] then subsequently find that one part of [1:39:53] the notice which says submit your [1:39:56] comments by had a date from a previous [1:39:59] notice which was June 5th [1:40:01] 2023 however the meeting date time and [1:40:05] location were correct and furthermore [1:40:08] the meeting date and time and location [1:40:10] were correct in the newspaper [1:40:11] notification so we did legally meet our [1:40:14] requirement but as a courtesy we did [1:40:16] send a a revised notice to all the same [1:40:19] people stating that the period to make [1:40:22] comments was was was not June 5th but [1:40:24] it's actually today the um the reason [1:40:27] it's set for today is because this is [1:40:29] the hearing and we don't it wouldn't do [1:40:32] anybody any good to have comments come [1:40:34] after the hearing okay but 10 days is [1:40:37] the standard that's standard throughout [1:40:39] the state um there may be some [1:40:41] jurisdictions that give more but we uh [1:40:43] by our Municipal Code give a 10-day [1:40:45] notice and it's not 10 days from the day [1:40:48] you receive it but from 10 days from [1:40:49] when we mail it okay um [1:40:54] with regard to the sidewalk on 129 [1:40:56] Street it is being widened but the curb [1:40:58] is not being moved so the street will [1:40:59] not be narrowed okay the um there's a [1:41:03] there's a narrow sidewalk there now and [1:41:06] some landscaping or dirt or whatever um [1:41:10] that'll all be made into sidewalk so [1:41:12] it'll be a 7 foot sidewalk with tree [1:41:15] Wells every 50 feet with a tree planted [1:41:17] in it by the applicant so I want to be [1:41:20] clear on that they will have no impact [1:41:22] on the width of of the actual driving [1:41:24] area on 129 Street um with regard to [1:41:28] construction traffic and [1:41:30] noise um well let's deal with noise [1:41:33] noise is controlled by the municipal [1:41:35] code there are [1:41:37] um timelines in which construction can [1:41:39] take place every single day it's a [1:41:41] little bit more restrictive on on the [1:41:43] weekends I believe but uh we we will be [1:41:46] watching for that if they start [1:41:48] construction prior to was it s I think [1:41:51] or is it 8 I forgot seven [1:41:54] um they will receive a notice um of [1:41:57] violation but I don't expect that to be [1:41:59] the case and likewise construction has [1:42:01] to stop at is it 6 or something I forgot [1:42:06] when but anyway there's a time that that [1:42:08] has to stop so at the nighttime at least [1:42:11] there will be no construction permitted [1:42:13] and um we will be I mean we're very [1:42:16] close so we'll know if they're violating [1:42:17] that and code enforcement will be [1:42:20] keeping an eye on it as we do for every [1:42:22] construction project in the [1:42:24] city um as for the issue of notification [1:42:27] not going to all of the neighbors again [1:42:29] this goes back to the municipal code the [1:42:31] requirement for code is Neighbors within [1:42:34] 300 [1:42:35] ft now that doesn't include everybody on [1:42:39] 129th but you know how there's no um [1:42:43] provision that we have to provide notice [1:42:45] to everybody on 129th the requirement is [1:42:47] Neighbors within 300 ft if even a small [1:42:49] portion of your property is within 300 [1:42:51] ft of this property a notice would been [1:42:53] mailed to you anybody outside of that [1:42:56] doesn't get a notice but that's why we [1:42:58] advertise in the newspaper [1:43:01] and I don't that's that's just pursuant [1:43:03] to the municipal code and for per state [1:43:06] law um as for the driveway on uh Manor [1:43:10] Drive I'll let the applicant address why [1:43:13] not gravilla but I will say that the [1:43:15] second driveway is required on the [1:43:17] Northern portion for fire um trucks to [1:43:20] be able to get into the property and get [1:43:22] out the the southern one is wider so [1:43:24] they're able to do a complete circle or [1:43:26] Square so they can use one driveway that [1:43:29] doesn't apply to the northern part and [1:43:30] that's why there's a second driveway [1:43:32] there [1:43:35] um I a lot of the comments deal with uh [1:43:39] development standards such as [1:43:41] parking um I'd like to point out again [1:43:45] that that is outside of this uh scope of [1:43:48] this hearing all of those standards are [1:43:51] contained in the municipal code [1:43:53] and their objective meaning that the [1:43:55] city uses no judgment it's either yes or [1:43:58] no complies or doesn't comply that's [1:44:00] pursuant to state law as one of the [1:44:02] applicants or one of the residents had [1:44:04] said you know our hands are somewhat [1:44:06] Tied by state law here so rest assured [1:44:09] though there are standards and they will [1:44:10] be applied and and upheld so all of the [1:44:15] um all the issues related to Landscaping [1:44:18] parking um height all of that stuff is [1:44:21] covered and they they know the rules we [1:44:23] know the rules and they're free to build [1:44:26] up to those rules but not [1:44:29] Beyond um as mentioned RFK there is an [1:44:32] application already on I don't remember [1:44:35] who made that request but there is an [1:44:36] application for that site it's just it's [1:44:38] tied up in the in the environmental [1:44:39] review right now it it is slated to [1:44:42] happen but it's a long process and there [1:44:44] are plenty of other sites in the city [1:44:46] where housing is also being proposed and [1:44:48] being studied [1:44:50] currently um [1:44:53] let's see if there's anything [1:44:54] construction [1:44:55] dust goes with time construction dust is [1:44:58] controlled by the by the um [1:45:02] AQMD and the city does enforce um dust [1:45:06] control so if there's any incident of of [1:45:10] construction dust please notify the um [1:45:14] the city because that has to stop and [1:45:17] and the applicant is well aware of this [1:45:19] as part of the construction you know [1:45:21] process [1:45:23] a water issues I think you're talking [1:45:25] about drainage um again there there are [1:45:29] plenty of of regulations that apply to [1:45:33] water all of the water that falls onto [1:45:35] this property does not leave the [1:45:36] property it stays on the property that's [1:45:38] pursuant to law um and they're they're [1:45:43] going to have to have the property [1:45:45] graded which means they're going to you [1:45:47] know move the dirt around a little bit [1:45:48] to make it drain properly that's um [1:45:51] going to be carefully uh monitored by [1:45:53] the city and and it'll have to be [1:45:55] approved that's standard that's for [1:45:57] every [1:45:58] project um so I don't think that um [1:46:00] flooding is going to be much of an issue [1:46:03] here and the applicant may want to [1:46:05] expand on that a little [1:46:07] bit um the question about where the [1:46:09] bottom of the units uh adjacent to 129 [1:46:12] they'll be on the low part they will not [1:46:14] be three stories above 129 Street [1:46:17] there'll be a floor and a half below [1:46:18] 129th and then a floor and a half above [1:46:24] I think that covers all the city issues [1:46:26] now um if uh the applicant would like to [1:46:30] address the issues that are more [1:46:32] specific to the [1:46:33] project oh I'm sorry there was one other [1:46:36] question related to [1:46:37] squa um the squl studies I think that [1:46:41] person actually left but hopefully [1:46:43] they're watching on TV the squl studies [1:46:45] were um there's two of there's actually [1:46:48] one it was done when the um in 2022 when [1:46:52] the uh overlay was first adopted that's [1:46:55] available from the city we can email it [1:46:58] to you or you can come in and look at it [1:47:01] um I'm not sure if it's posted online [1:47:03] right now but we'll accommodate anyone [1:47:05] that needs to see it the other squa um [1:47:08] that we're addressing here is called a [1:47:10] categorical exemption for infill [1:47:12] development that's a state carve out [1:47:14] that exempts this project from requiring [1:47:17] eir or a negative declaration or [1:47:19] anything more significant this is a [1:47:22] qualified site for infill development so [1:47:26] we're covered on two basis if you if [1:47:28] you're not satisfied with the one we've [1:47:29] got the other but um usually you only [1:47:31] need [1:47:32] one okay just a uh Greg concerns and I hope by [1:48:29] some of those responses that I'm that [1:48:31] I'll be providing to you um show that we [1:48:35] in our design of the ultimate project [1:48:38] that is [1:48:41] uh following the map process that we're [1:48:44] here for tonight that because of our [1:48:47] history and my history um that we've [1:48:49] tried to address those as some what I [1:48:52] like like to call us project design [1:48:54] features um and that is um with regards [1:48:59] to for instance uh the elevation of the [1:49:02] buildings from 129th Street um we [1:49:05] initially I mean I've got portions of [1:49:07] our of our team that are here I was like [1:49:10] we want to because those houses are [1:49:12] elevated to some degree I want to drop [1:49:14] the grade so that's why we're dropping [1:49:16] the site grade at 129th below 129th to [1:49:20] help alleviate a three-story structure I [1:49:23] believe um we don't build homes that are [1:49:26] 60 ft tall but I believe the housing [1:49:29] overlay has an allowance of up to 60 [1:49:31] feet uh for Building height we're at 38 [1:49:34] we're three stories so we initially and [1:49:37] in our proposed designs that are part of [1:49:40] the tenative track map are lowering the [1:49:42] elevation of the site 6 to8 feet below [1:49:45] the elevation of 129th Street um for for [1:49:48] that reason as Mr mlan mentioned there [1:49:50] will only be portions of the POR of the [1:49:53] House of the proposed town homes that [1:49:54] would be visible from Beyond and above [1:49:57] at [1:49:58] 129 um Mr mlan touched on the sidewalk [1:50:02] um the sidewalk on 129th is very narrow [1:50:05] it is dirt there are utility poles and [1:50:07] so forth with it and that's why the City [1:50:10] Public Works director is wanting that [1:50:12] sidewalk to be seven feet wide that [1:50:15] current is the width of the current [1:50:17] Parkway whether it be sidewalk and dirt [1:50:19] it's going to be all sidewalk with some [1:50:20] trees planted along the sidewalk at the [1:50:23] top of the at the top of the project if [1:50:25] it is [1:50:26] approved um regards to the parking that [1:50:30] we've heard [1:50:32] um we [1:50:34] design what we have to have for our [1:50:38] residents future residents to be happy [1:50:40] and have a place to park it has to be [1:50:41] marketable it's something that they look [1:50:43] at when they come to buy into a project [1:50:45] that they have ample parking this [1:50:48] project when built would probably have [1:50:51] more parking spaces than any most [1:50:53] projects that you have in the [1:50:55] city and it is compliant with the [1:50:58] code with regards to the retaining wall [1:51:01] at 129th the retaining wall is necessary [1:51:04] so that we can drop the grade and retain [1:51:06] this the street at 129th as it is today [1:51:09] on top of that retaining wall would be [1:51:11] an open rail fence it's not going to be [1:51:13] a solid 12 foot 12ft retaining wall it [1:51:15] be a five to six foot tall retaining [1:51:17] wall with open rail fencing that would [1:51:19] have some Landscaping growing up both in [1:51:21] front and interior to the wall visible [1:51:24] from [1:51:26] 129th um The Manor driveway opening that [1:51:30] Mr Wong and the neighbors that I met [1:51:32] with had mentioned um we looked at [1:51:35] trying to redirect that opening and [1:51:38] still maintain the required fire access [1:51:41] to another uh to to grela it wasn't [1:51:45] possible because of the configuration [1:51:47] and shape of that Northern parcel that [1:51:50] you see on the map um there is a not [1:51:52] that goes and I'm going to mention a [1:51:54] name that goes to in the property of the [1:51:56] current Nursery that reaches towards [1:52:00] Tony's house the neighbor to the direct [1:52:02] north of the site that allows [1:52:05] for the units the town homes to be built [1:52:09] on that portion of it and still maintain [1:52:11] the circulation necessary for uh for [1:52:14] fire and for trash service but more more [1:52:16] importantly fire um the South site with [1:52:20] the loop Street in it has enough room to [1:52:23] create the loop system so it just has [1:52:25] the one driveway in and [1:52:28] out there are no stairs proposed to [1:52:31] 129th so I think that the parking on [1:52:33] 129th is not of convenience for the [1:52:36] residents future residents of this [1:52:38] proposed project to park on 129th and [1:52:41] walk all the way around the block to [1:52:43] come around um the and that was by [1:52:47] Design to not provide pedestrian link up [1:52:50] to 129th because they have ample Ada and [1:52:53] pedestrian link directly down to elaga [1:52:55] Boulevard and they can get to haam [1:52:57] Boulevard or Englewood or the high [1:52:58] school or whatever out on Elsa [1:53:02] Boulevard [1:53:05] um [1:53:08] the the [1:53:10] letter I think there may be some [1:53:12] confusion regarding the city's public [1:53:14] notice letter versus my letter that I [1:53:16] sent out my letter was only sent to [1:53:18] those neighbors that are directly [1:53:19] adjacent to it it goes out in a standard [1:53:21] envelope that says Malia homes on it it [1:53:24] maybe looks like any other piece of junk [1:53:25] mail that we all get in our mail and it [1:53:27] maybe have tossed out and thrown away um [1:53:31] I count one two three four uh [1:53:34] individuals who spoke tonight saying [1:53:37] they didn't receive that letter that [1:53:38] were on the mailing list that I mailed [1:53:40] out so whether or not they saw it it's [1:53:43] been several months whether they tossed [1:53:45] it looked at it whatever it may be um [1:53:48] but those that are directly adjacent did [1:53:51] receive some correspond for me asking [1:53:53] for their input and to make contact uh [1:53:56] with me um and and to introduce myself [1:53:59] to them um regarding the drainage Andor [1:54:02] storm water and or [1:54:04] infiltration um regarding the storm [1:54:06] water that hits the site a certain [1:54:08] amount of water from a storm event is [1:54:10] required to be retained on site as Mr [1:54:13] mlan mentioned um in this particular [1:54:15] instance we're doing uh both detention [1:54:19] on the site in underground storage pipes [1:54:21] to retain that water volume and then it [1:54:24] would go into what we call a dryw which [1:54:27] is basically a chamber that goes down [1:54:30] about 35 to 40 feet into the Earth and [1:54:32] the storm water would go into that and [1:54:34] infiltrate back into the ground and [1:54:36] hopefully recharge our groundwater Basin [1:54:38] to some degree heavier storms and so [1:54:41] forth the codes require certain amount [1:54:43] of water be retained in a storm that [1:54:45] continues on and on and on in 100e storm [1:54:48] all that storm drain water is contained [1:54:50] and ultimately would run out to Elson [1:54:52] Boulevard just like the property does [1:54:56] today is there anything that I missed [1:54:58] that we would like to go back on [1:55:00] two lot [1:56:50] parcel it is I wish we we were voting on [1:56:53] all the other things that were brought [1:56:54] up here today because as a resident of [1:56:57] Hawthorne I feel what you are feeling um [1:57:01] as I mentioned earlier in this session I [1:57:03] I live very close to 360 and when that [1:57:07] was built that is 600 units um so [1:57:10] there's a part of me that was like oh [1:57:11] gosh I wish it was only 68 but that [1:57:13] doesn't take away from what you are [1:57:15] feeling and please do not think I am [1:57:16] taking anything away from what you are [1:57:18] feeling because of this um if you anyone [1:57:22] likes to talk to me about that it it it [1:57:24] wasn't it didn't end up being even an [1:57:27] fraction of what we thought it was going [1:57:29] to be it's worked out very well for us [1:57:32] um and so if anyone wants to speak to me [1:57:34] about my experience with that offline [1:57:36] I'm more than happy to do that but it it [1:57:38] wasn't as catastrophic as in the [1:57:41] beginning we thought it was it in in all [1:57:43] honesty it wasn't catastrophic at all um [1:57:46] but again this is that was my experience [1:57:48] that is not your experience and I'm not [1:57:50] trying to take anything away from that [1:57:52] so I just wanted to say thank you for [1:57:54] coming expressing it and saying and [1:57:56] sharing with you that I wish it was [1:57:57] something else we were voting on today [1:57:59] versus what it was because as it is our [1:58:01] job to just vote and keep the the city [1:58:04] accountable for what the laws they put [1:58:06] into place the city council makes the [1:58:09] laws so again there are meetings every [1:58:12] two weeks for for that where you can [1:58:14] once again get on that agenda and can [1:58:16] talk to them about this and what it is [1:58:19] for the next phase of the building if [1:58:21] this goes through tonight so please know [1:58:24] that that is something it's every other [1:58:26] Tuesday and you can get time in front of [1:58:28] the city council because that is that is [1:58:30] who put this on our docket this evening [1:58:32] so with that again just different [1:59:56] department that takes care of that today [1:59:59] we're just here for the uh to combine or [2:00:03] make uh two lots so I just want to make [2:00:06] sure that we are clear on that um I've [2:00:10] seen different projects that come to the [2:00:12] planning department I do have to say [2:00:15] from what I see and hopefully um it is [2:00:19] what we're seeing today um I do [2:00:22] appreciate the idea that instead of [2:00:23] putting 94 units it is 68 homes not [2:00:28] Apartments so at [2:00:30] least it coming to the city someone has [2:00:33] or can take advantage of the fact that [2:00:35] they can actually be a homeowner so that [2:00:38] is something that is a major Pro um with [2:00:42] this [2:00:44] project also um I do appreciate the fact [2:00:49] that um [2:00:52] Malia Holmes [2:00:55] uh saw that there were some issues with [2:00:58] sidewalks and so forth he could actually [2:00:59] had a five uh foot setback on [2:01:04] sidewalks they decided to do seven [2:01:07] that's also a [2:01:08] pro also widening that street as well or [2:01:11] making that extra sidewalk I mean it's [2:01:13] just um that is greatly appreciated if [2:01:16] that's what they're going to do also the [2:01:18] trees the vegetation instead of putting [2:01:22] um smaller trees if they put 12T trees [2:01:24] that's also was just a consideration for [2:01:26] them um to maybe consider or at least we [2:01:30] encourage that so we'll see where they [2:01:32] go with that um but that is it for me [2:01:36] and again thank you guys about [2:02:37] how we want to direct our city like we [2:02:39] mentioned these are this overlay was [2:02:41] done part of our general plan our [2:02:43] general plan was done a while ago and [2:02:45] this is why it's important for us to be [2:02:47] at every single one of these meetings [2:02:49] because two years ago when this was done [2:02:51] it didn't really [2:02:52] it was just a thing we did now it's two [2:02:55] years later and it impacts us so it's [2:02:57] the reason why we come and we stay up on [2:02:59] these things when they're happening it's [2:03:01] a reason why every time there's [2:03:03] legislation that comes up we read it [2:03:05] thoroughly and we make sure we [2:03:06] understand what's happening because that [2:03:09] would prevent us a lot of us from being [2:03:10] confused as we go forward in this um [2:03:14] just share the same sentiments yeah some [2:03:15] of these things are are disappointing [2:03:17] when it comes to the way that um you [2:03:19] know that residents feel about them in [2:03:21] the time I do hope that everyone has the [2:03:24] same experience as commissioner Houston [2:03:25] where it's not that bad I really do [2:03:28] really do hope that it comes out in a [2:03:30] great way but personally as we as we sit [2:03:33] here we've seen a few projects that's [2:03:35] come past that were only done for [2:03:38] rentals we we fought as hard as we could [2:03:41] to try to get things that were not done [2:03:42] for rentals and there's another space [2:03:45] where we're hands tied so the fact that [2:03:47] this time we're actually able to get [2:03:48] some home ownership out of this I think [2:03:50] is a is a great is a great piece here [2:03:53] that's a big win that we should take [2:03:54] away subdivision uh we at the reason I [2:07:18] brought up the question about other [2:07:19] projects that we had that were only [2:07:21] allowed to be rental is there [2:07:25] any is there any way that we can utilize [2:07:27] this this set of um the set of zoning to [2:07:32] encourage more projects that come in [2:07:34] that allow for or or only allow to do s [2:07:38] for sale because right now what we're [2:07:39] doing is we're we're producing this so [2:07:41] that way they can sell it but it seems [2:07:43] like there may be a lot of spaces in the [2:07:44] city where they're already set up to [2:07:46] just go these will allow you to do [2:07:48] rentals and thus we don't have we don't [2:07:50] even have to have have this conversation [2:07:52] is there something we can do to kind of [2:07:54] promote there there is the possibility [2:07:57] to create incentives for someone to [2:08:00] choose the ownership option um we we [2:08:03] we've can look at that we've have been [2:08:05] kind of looking at that for a while now [2:08:07] we um we're also looking at other [2:08:09] incentives such as law consolidations [2:08:11] and so forth we haven't gotten around to [2:08:13] codifying those yet um we can't make a [2:08:15] requirement per se um for two reasons [2:08:18] one um it it's it's a property right to [2:08:21] be able to sell or to you know have an [2:08:24] apartment and the other is that we would [2:08:27] be anticipating the housing market in [2:08:31] the city in you know in a year from now [2:08:33] or two years from now and that's not [2:08:36] really anything that we're qualified to [2:08:37] do any of us so builders on the other [2:08:41] hand have a much better um sense of the [2:08:43] pulse of the of the market and you know [2:08:47] and I think the applicant had even [2:08:48] mentioned that if sales are good things [2:08:50] will go faster [2:08:52] right but if sales are slow then things [2:08:53] will take longer they just you know [2:08:55] that's just the way housing works and [2:08:59] none of us in this room can tell you [2:09:01] whether or not the demand that's going [2:09:03] to come up in two years or something is [2:09:05] going to be for renders or owners we're [2:09:07] all banking on it being owners and [2:09:09] hoping so especially the applicant I'm [2:09:11] sure but that's the reason why we
